Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions relating to law enforcement officers in a county merit system, <ln numlevel="1" lineno="6" slineno="0-6"/>career service, or civil service.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">defines terms;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">provides that an employee in a county sheriff's office is exempt from a merit system, <ln numlevel="1" lineno="11" slineno="0-11"/>career service, or civil service, if that employee is in a position with a rank or equivalent <ln numlevel="1" lineno="12" slineno="0-12"/>rank of lieutenant or higher, unless before uid="C17-75-S502_2026070120260701" sort="17 75 05020020260701" numlevel="1" lineno="62" slineno="1-1" sn="1"><section number="17-75-502" numlevel="1" lineno="63" slineno="1-2" type="amend"><secline lineno="62">Section 1. Section <bold>17-75-502</bold> is amended to read:</secline><catline lineno="63"><bold>17-75-502<parens/>. Career service -- Exempt positions.</bold></catline><subsection ssid="124-null-1" dnum="1-o" numlevel="1" lineno="64" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>The career service:<subsection ssid="124-null-2" dnum="a-o" numlevel="1" lineno="65" slineno="1-4" level="2"><display>(a)</display>is a permanent service to which this part applies; and</subsection><subsection ssid="124-null-3" dnum="b-o" numlevel="1" lineno="66" slineno="1-5" level="2"><display>(b)</display>comprises all tenured county positions in the public service, except:<subsection ssid="124-null-4" dnum="i-o" numlevel="1" lineno="67" slineno="1-6" level="3"><display>(i)</display>subject to Subsection <xref depth="4" refnumber="17-33-8(2)" start="0">(2)</xref>:<subsection ssid="124-null-5" dnum="A-o" numlevel="1" lineno="68" slineno="1-7" level="4"><display>(A)</display>the county executive, members of the county legislative body, and other <ln numlevel="1" lineno="69" slineno="1-8"/>elected officials; and</subsection><subsection ssid="124-null-6" dnum="B-o" numlevel="1" lineno="70" slineno="1-9" level="4"><display>(B)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">each</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> major county department head charged directly by the county <ln numlevel="1" lineno="71" slineno="1-10"/>legislative body, or by a board appointed by the county legislative body, with <ln numlevel="1" lineno="72" slineno="1-11"/>the responsibility of assisting to formulate and carry out policy matters;</subsection></subsection><subsection ssid="124-null-7" dnum="ii-o" numlevel="1" lineno="73" slineno="1-12" level="3"><display>(ii)</display>one confidential secretary for each elected county officer and major county <ln numlevel="1" lineno="74" slineno="1-13"/>department head, if a confidential secretary is assigned;</subsection><subsection ssid="124-null-8" dnum="iii-o" numlevel="1" lineno="75" slineno="1-14" level="3"><display>(iii)</display>an administrative assistant to the county executive, each member of the county <ln numlevel="1" lineno="76" slineno="1-15"/>legislative body, and each elected official, if an administrative assistant is <ln numlevel="1" lineno="77" slineno="1-16"/>assigned;</subsection><subsection ssid="124-null-9" dnum="iv-o" numlevel="1" lineno="78" slineno="1-17" level="3"><display>(iv)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">each duly</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an</amend> appointed chief deputy of any elected county officer who takes <ln numlevel="1" lineno="79" slineno="1-18"/>over and discharges the duties of the elected county officer in the absence or <ln numlevel="1" lineno="80" slineno="1-19"/>disability of the elected county officer;</subsection><subsection ssid="124-31" dnum="_-o:v-i" numlevel="1" lineno="81" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">a peace officer in a position with a rank or equivalent rank of lieutenant or higher, <ln numlevel="1" lineno="82" slineno="1-21"/>unless, before July 1, 2026, the county sheriff designates the position as a merit <ln numlevel="1" lineno="83" slineno="1-22"/>system position;</amend></subsection><subsection ssid="124-null-10" dnum="v-o:vi-i" numlevel="1" lineno="84" slineno="1-23" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1010" style="2" owner="o" level="1" deltag="both">(v)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="both" space="true">(vi)</amend></display>subject to Subsection <xref depth="4" refnumber="17-33-8(3)" start="0">(3)</xref>, an individual who<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both"> is</amend><amendoutend style="2"/>:<subsection ssid="124-null-11" dnum="A-o" numlevel="1" lineno="85" slineno="1-24" level="4"><display>(A)</display><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">is </amend>appointed by an elected county officer to be a division director, to <ln numlevel="1" lineno="86" slineno="1-25"/>administer division functions in furtherance of the performance of the elected <ln numlevel="1" lineno="87" slineno="1-26"/>officer's professional duties;</subsection><subsection ssid="124-null-12" dnum="B-o" numlevel="1" lineno="88" slineno="1-27" level="4"><display>(B)</display><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">is </amend>in a confidential relationship with the elected county officer; and</subsection><subsection ssid="124-null-13" dnum="C-o" numlevel="1" lineno="89" slineno="1-28" level="4"><display>(C)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both">not in a law enforcement rank position of captain or below</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">is not a peace <ln numlevel="1" lineno="90" slineno="1-29"/>officer</amend>;</subsection></subsection><subsection ssid="124-null-14" dnum="vi-o:vii-i" numlevel="1" lineno="91" slineno="1-30" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1014" style="2" owner="o" level="1" deltag="both">(vi)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="both" space="true">(vii)</amend></display>each <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individual</amend> employed to make or conduct a temporary and <ln numlevel="1" lineno="92" slineno="1-31"/>special inquiry, investigation, or examination on behalf of the county legislative <ln numlevel="1" lineno="93" slineno="1-32"/>body or one of its committees;</subsection><subsection ssid="124-null-15" dnum="vii-o:viii-i" numlevel="1" lineno="94" slineno="1-33" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(vii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(viii)</amend></display>each noncareer employee:<subsection ssid="124-null-16" dnum="A-o" numlevel="1" lineno="95" slineno="1-34" level="4"><display>(A)</display>compensated for the employee's services on a seasonal or contractual basis; <ln numlevel="1" lineno="96" slineno="1-35"/>and</subsection><subsection ssid="124-null-17" dnum="B-o" numlevel="1" lineno="97" slineno="1-36" level="4"><display>(B)</display>hired on emergency or seasonal appointment basis, as approved by the council;</subsection></subsection><subsection ssid="124-null-18" dnum="viii-o:ix-i" numlevel="1" lineno="98" slineno="1-37" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1018" style="2" owner="o" level="1" deltag="both">(viii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="both" space="true">(ix)</amend></display>each provisional employee, as defined by the county's policies and <ln numlevel="1" lineno="99" slineno="1-38"/>procedures or personnel rules;</subsection><subsection ssid="124-null-19" dnum="ix-o:x-i" numlevel="1" lineno="100" slineno="1-39" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1019" style="2" owner="o" level="1" deltag="both">(ix)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="both" space="true">(x)</amend></display>each part-time county employee, as defined by the county's policies and <ln numlevel="1" lineno="101" slineno="1-40"/>procedures or personnel rules;</subsection><subsection ssid="124-null-20" dnum="x-o:xi-i" numlevel="1" lineno="102" slineno="1-41" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(x)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="both" space="true">(xi)</amend></display>each county employee appointed to perform:<subsection ssid="124-null-21" dnum="A-o" numlevel="1" lineno="103" slineno="1-42" level="4"><display>(A)</display>work that does not exceed three years in duration; or</subsection><subsection ssid="124-null-22" dnum="B-o" numlevel="1" lineno="104" slineno="1-43" level="4"><display>(B)</display>work with limited funding; and</subsection></subsection><subsection ssid="124-null-23" dnum="xi-o:xii-i" numlevel="1" lineno="105" slineno="1-44" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" space="true">(xii)</amend></display>each county position that, by the position's confidential or key <ln numlevel="1" lineno="106" slineno="1-45"/>policy-determining nature, cannot or should not be appropriately included in the <ln numlevel="1" lineno="107" slineno="1-46"/>career service. </subsection></subsection></subsection><subsection ssid="124-null-24" dnum="2-o" numlevel="1" lineno="108" slineno="1-47" level="1"><display>(2)</display>Before a position under Subsection <xref depth="4" refnumber="17-33-8(1)(b)(i)" start="0">(1)(b)(i)</xref> may be changed from its current status to <ln numlevel="1" lineno="109" slineno="1-48"/>exempt or tenured, the council shall, after giving due notice, hold a public hearing on the <ln numlevel="1" lineno="110" slineno="1-49"/>proposed change of status.</subsection><subsection ssid="124-null-25" dnum="3-o" numlevel="1" lineno="111" slineno="1-50" level="1" space="false"><display>(3)</display><subsection ssid="124-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="39" style="2" owner="jchristopherson" level="1" deltag="both">Subsection <xref depth="4" refnumber="17-33-8(1)(b)(v)" start="0">(1)(b)(v)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="41" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsection <xref depth="4" refnumber="17-75-502(1)(b)(vi)">(1)(b)(vi)</xref></amend> may not be construed to cause an <ln numlevel="1" lineno="112" slineno="1-51"/>individual serving as a nonexempt county employee on May 5, 2008, in a position <ln numlevel="1" lineno="113" slineno="1-52"/>described in that subsection to lose the nonexempt status.</subsection><subsection ssid="124-37" dnum="_-o:b-i" numlevel="1" lineno="114" slineno="1-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">Subsection <xref depth="4" refnumber="17-75-502(1)(b)(v)">(1)(b)(v)</xref> may not be construed to cause an individual serving as a <ln numlevel="1" lineno="115" slineno="1-54"/>nonexempt county employee before July 1, 2026, in a position described in that <ln numlevel="1" lineno="116" slineno="1-55"/>subsection to lose the nonexempt status.</amend></subsection><subsection ssid="124-null-27" dnum="b-o:c-i" numlevel="1" lineno="117" slineno="1-56" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1028" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>The elected county officer in a supervisory position over a county employee <ln numlevel="1" lineno="118" slineno="1-57"/>described in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="51" groupid="46" style="2" owner="jchristopherson" level="1" deltag="both">Subsection</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="48" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsections</amend> <xref depth="4" refnumber="17-33-8(3)(a)" start="0">(3)(a)</xref> <amend anum="0" ea="amend" pairid="50" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="both">and (3)(b) </amend>shall work with the county's <ln numlevel="1" lineno="119" slineno="1-58"/>office of personnel management to develop financial and other incentives to <ln numlevel="1" lineno="120" slineno="1-59"/>encourage a nonexempt employee to convert voluntarily to exempt status.</subsection></subsection><subsection ssid="124-null-28" dnum="4-o" numlevel="1" lineno="121" slineno="1-60" level="1" space="false"><display>(4)</display><subsection ssid="124-null-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>County policies made in conformity with this part shall list by job title and county <ln numlevel="1" lineno="122" slineno="1-61"/>department, office or agency, each position designated as exempt under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="56" groupid="51" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="17-33-8(1)(b)(xi)" start="0"><ln numlevel="1" lineno="123" slineno="1-62"/>(1)(b)(xi)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="54" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(1)(b)(xii)</amend>.</subsection><subsection ssid="124-null-30" dnum="b-o" numlevel="1" lineno="124" slineno="1-63" level="2"><display>(b)</display>A change in exempt status of a position designated as being exempt under <ln numlevel="1" lineno="125" Section <bold>17-76-201</bold> is amended to read:</secline><catline lineno="128"><bold>17-76-201<parens/>. Definitions.</bold></catline><sectionText lineno="129"><tab/>As used in this part:</sectionText><subsection ssid="39-null-1" dnum="1-o" numlevel="1" lineno="130" slineno="2-4" level="1"><display>(1)</display>"Appointing authority" means the sheriff of a county having jurisdiction over any peace <ln numlevel="1" lineno="131" slineno="2-5"/>officer.</subsection><subsection ssid="39-null-2" dnum="2-o" numlevel="1" lineno="132" slineno="2-6" level="1"><display>(2)</display>"Commission" means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="75" groupid="55" style="2" owner="jchristopherson" level="1" deltag="both">the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="74" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> merit system commission consisting of three individuals <ln numlevel="1" lineno="133" slineno="2-7"/>appointed in accordance with Section <xref depth="3" refnumber="17-76-203">17-76-203</xref> and having the duty, power, and <ln numlevel="1" lineno="134" slineno="2-8"/>responsibility for the discharge of the functions of this chapter.</subsection><subsection ssid="39-null-3" dnum="3-o" numlevel="1" lineno="135" slineno="2-9" level="1"><display>(3)</display>"Department of Public Safety" means the department created in Section <xref depth="3" refnumber="53-1-103" start="0">53-1-103</xref>.</subsection><subsection ssid="39-null-4" dnum="4-o" numlevel="1" lineno="136" slineno="2-10" level="1"><display>(4)</display>"Eligible register" means the list made by a commission described in Subsection <xref refnumber="17-76-209(1)" depth="4"><ln numlevel="1" lineno="137" slineno="2-11"/>17-76-209(1)</xref> that contains the names of all applicants that took the examination and that <ln numlevel="1" lineno="138" slineno="2-12"/>received a passing grade.</subsection><subsection ssid="39-null-5" dnum="5-o" numlevel="1" lineno="139" slineno="2-13" level="1"><display>(5)</display>"Examination" means the competitive examination for employment as a peace officer <ln numlevel="1" lineno="140" slineno="2-14"/>described in Section <xref depth="3" refnumber="17-76-207">17-76-207</xref>.</subsection><subsection ssid="39-null-6" dnum="6-o" numlevel="1" lineno="141" slineno="2-15" level="1"><display>(6)</display>"Member" means an individual appointed to the merit commission in accordance with <ln numlevel="1" lineno="142" slineno="2-16"/>Section <xref depth="3" refnumber="17-76-203">17-76-203</xref>.</subsection><subsection ssid="39-null-7" dnum="7-o" numlevel="1" lineno="143" slineno="2-17" level="1"><display>(7)</display>"Merit system officer" means<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="98" groupid="72" style="2" owner="jchristopherson" level="1" deltag="both"> a peace officer who has merit status as defined in this <ln numlevel="1" lineno="144" slineno="2-18"/>part.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="58" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="39-28" dnum="_-o:a-i" numlevel="1" lineno="145" slineno="2-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">a peace officer:</amend><subsection ssid="39-34" dnum="_-o:i-i" numlevel="1" lineno="146" slineno="2-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="103" groupid="76" style="1" owner="jchristopherson" level="1" amendtag="end">in a position with a rank or equivalent rank of sergeant or lower; or</amend></subsection><subsection ssid="39-35" dnum="_-o:ii-i" numlevel="1" lineno="147" slineno="2-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="end">in a position, except chief deputy, with a rank of lieutenant or higher that the <ln numlevel="1" lineno="148" slineno="2-22"/>county sheriff designates as a merit system position before July 1, 2026;</amend></subsection></subsection><subsection ssid="39-29" dnum="_-o:b-i" numlevel="1" lineno="149" slineno="2-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">regardless of rank, a peace officer who, immediately before July 1, 2026, was in a <ln numlevel="1" lineno="150" slineno="2-24"/>merit system position under this part, unless, on or after July 1, 2026, the peace <ln numlevel="1" lineno="151" slineno="2-25"/>officer:</amend><subsection ssid="39-30" dnum="_-o:i-i" numlevel="1" lineno="152" slineno="2-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="85" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">except as described in Subsection <xref depth="4" refnumber="17-76-201(7)(c)">(7)(c)</xref>, voluntarily accepts a position that is not a <ln numlevel="1" lineno="153" slineno="2-27"/>merit system position; or</amend></subsection><subsection ssid="39-31" dnum="_-o:ii-i" numlevel="1" lineno="154" slineno="2-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">in accordance with the written policy described in Subsection <xref depth="4" refnumber="17-76-202(4)">17-76-202(4)</xref>, <ln numlevel="1" lineno="155" slineno="2-29"/>voluntarily surrenders merit status; or</amend></subsection></subsection><subsection ssid="39-33" dnum="_-o:c-i" numlevel="1" lineno="156" slineno="2-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="97" groupid="71" style="1" owner="jchristopherson" level="1" amendtag="end">a peace officer who returns to a merit system position after a leave of absence under <ln numlevel="1" lineno="157" slineno="2-31"/>Section <xref depth="3" refnumber="17-76-214">17-76-214</xref>, unless the peace officer voluntarily surrenders merit status under <ln numlevel="1" lineno="158" slineno="2-32"/>Subsection <xref depth="4" refnumber="17-76-201(7)(b)(ii)">(7)(b)(ii)</xref>.</amend></subsection></subsection><subsection ssid="39-null-8" dnum="8-o" numlevel="1" lineno="159" slineno="2-33" level="1"><display>(8)</display>"Peace officer" means any paid deputy sheriff, other than a chief deputy designated by <ln numlevel="1" lineno="160" slineno="2-34"/>the sheriff, who is in the continuous employ of a county.</subsection><subsection ssid="39-null-9" dnum="9-o" numlevel="1" lineno="161" slineno="2-35" level="1"><display>(9)</display>"Police interlocal entity" means an interlocal entity, as defined in Section <xref depth="3" refnumber="11-13-103">11-13-103</xref>, <ln numlevel="1" lineno="162" slineno="2-36"/>that is created:<subsection ssid="39-null-10" dnum="a-o" numlevel="1" lineno="163" slineno="2-37" level="2"><display>(a)</display>under <xref depth="1" refnumber="11-13">Title 11, Chapter 13, Interlocal Cooperation Act</xref>, by an agreement to which a <ln numlevel="1" lineno="164" slineno="2-38"/>county of the first class is a party; and</subsection><subsection ssid="39-null-11" dnum="b-o" numlevel="1" lineno="165" slineno="2-39" level="2"><display>(b)</display>to provide law enforcement service to an area that includes the unincorporated part <ln numlevel="1" lineno="166" slineno="2-40"/>of the county.</subsection></subsection><subsection ssid="39-null-12" dnum="10-o" numlevel="1" lineno="167" slineno="2-41" level="1"><display>(10)</display>"Police special district" means a special district, as defined in Section <xref depth="3" refnumber="17B-1-102">17B-1-102</xref>:<subsection ssid="39-null-13" dnum="a-o" numlevel="1" lineno="168" slineno="2-42" level="2"><display>(a)</display>whose creation was initiated by the adoption of a resolution under Section <xref depth="3" refnumber="17B-1-203">17B-1-203</xref> <ln numlevel="1" lineno="169" slineno="2-43"/>by the legislative body of a county of the first class, alone or with one or more other <ln numlevel="1" lineno="170" slineno="2-44"/>county legislative bodies; and</subsection><subsection ssid="39-null-14" dnum="b-o" numlevel="1" lineno="171" slineno="2-45" level="2"><display>(b)</display>that is created to provide law enforcement service to an area that includes the <ln numlevel="1" lineno="172" slineno="2-46"/>unincorporated part of the county.</subsection></subsection></section></bsec><bsec buid="57" num="17-76-202" type="amend" src="code" uid="C17-76-S202_2026070120260701" sort="17 76 02020020260701" numlevel="1" lineno="173" slineno="3-1" sn="3"><section number="17-76-202" numlevel="1" lineno="174" slineno="3-2" type="amend"><secline lineno="173">Section 3. Section <bold>17-76-202</bold> is amended to read:</secline><catline lineno="174"><bold>17-76-202<parens/>. Applicability.</bold></catline><subsection ssid="57-null-1" dnum="1-o" numlevel="1" lineno="175" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>This <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">chapter</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="35" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">part</amend> does not apply to a county of the first class or an interlocal entity, as <ln numlevel="1" lineno="176" slineno="3-4"/>defined in Section <xref depth="3" refnumber="11-13-103" start="0">11-13-103</xref>, in which a county of the first class is a party to an <ln numlevel="1" lineno="177" slineno="3-5"/>interlocal agreement to provide law enforcement service.</subsection><subsection ssid="57-null-2" dnum="2-o:_-i" numlevel="1" lineno="178" slineno="3-6" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1054" style="2" owner="o" level="1" deltag="start">(2)</amend></display><amend anum="0" ea="erase" pairid="11" groupid="6" style="2" owner="jchristopherson" level="1" deltag="end">The sheriff of each county with a population of 20,000 people or more who regularly <ln numlevel="1" lineno="179" slineno="3-7"/>employs one or more peace officers shall:</amend><amendoutend style="2"/><subsection ssid="57-null-3" dnum="a-o:_-i" numlevel="1" lineno="180" slineno="3-8" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1055" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="12" groupid="7" style="2" owner="jchristopherson" level="1" deltag="end">appoint peace officers and fill vacant positions for peace officers: </amend><amendoutend style="2"/><subsection ssid="57-null-4" dnum="i-o:_-i" numlevel="1" lineno="181" slineno="3-9" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1056" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="13" groupid="8" style="2" owner="jchristopherson" level="1" deltag="end">with the advice and consent of the county legislative body; </amend><amendoutend style="2"/></subsection><subsection ssid="57-null-5" dnum="ii-o:_-i" numlevel="1" lineno="182" slineno="3-10" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1057" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="14" groupid="9" style="2" owner="jchristopherson" level="1" deltag="end">subject to the rules of the merit service commission; and</amend><amendoutend style="2"/></subsection><subsection ssid="57-null-6" dnum="iii-o:_-i" numlevel="1" lineno="183" slineno="3-11" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1058" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="15" groupid="10" style="2" owner="jchristopherson" level="1" deltag="end">from the classified merit service list furnished by the merit service commission; <ln numlevel="1" lineno="184" slineno="3-12"/>and </amend><amendoutend style="2"/></subsection></subsection><subsection ssid="57-null-7" dnum="b-o:_-i" numlevel="1" lineno="185" slineno="3-13" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1059" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="16" groupid="11" style="2" owner="jchristopherson" level="1" deltag="end">promote, transfer, demote, suspend or remove peace officers in accordance with this <ln numlevel="1" lineno="186" slineno="3-14"/>part.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="57-14" dnum="_-o:2-i" numlevel="1" lineno="187" slineno="3-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">The sheriff of a county with a population of 20,000 or more residents that employs one <ln numlevel="1" lineno="188" slineno="3-16"/>or more merit system officers shall make all decisions regarding the promotion, transfer, <ln numlevel="1" lineno="189" slineno="3-17"/>demotion, suspension, or removal of a merit system officer with the advice and consent <ln numlevel="1" lineno="190" slineno="3-18"/>of the county legislative body and in accordance with this part.</amend></subsection><subsection ssid="57-null-8" dnum="3-o:_-i" numlevel="1" lineno="191" slineno="3-19" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1061" style="2" owner="o" level="1" deltag="start">(3)</amend></display><amend anum="0" ea="erase" pairid="31" groupid="18" style="2" owner="jchristopherson" level="1" deltag="end">Every peace officer who is serving as such upon the effective date of this part is <ln numlevel="1" lineno="192" slineno="3-20"/>considered: </amend><amendoutend style="2"/><subsection ssid="57-null-9" dnum="a-o:_-i" numlevel="1" lineno="193" slineno="3-21" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1062" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="32" groupid="19" style="2" owner="jchristopherson" level="1" deltag="end">fully qualified for such position without examination or test; and </amend><amendoutend style="2"/></subsection><subsection ssid="57-null-10" dnum="b-o:_-i" numlevel="1" lineno="194" slineno="3-22" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1063" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="33" groupid="20" style="2" owner="jchristopherson" level="1" deltag="end">to have been appointed and to hold the position of peace officer in accordance with <ln numlevel="1" lineno="195" slineno="3-23"/>this part.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="57-null-11" dnum="4-o:3-i" numlevel="1" lineno="196" slineno="3-24" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1064" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>Counties with a population of less than 20,000 people may implement a deputy <ln numlevel="1" lineno="197" slineno="3-25"/>sheriff merit system if: <subsection ssid="57-null-12" dnum="a-o" numlevel="1" lineno="198" slineno="3-26" level="2"><display>(a)</display>the county legislative body approves the deputy sheriff merit system; and</amend></subsection><subsection ssid="57-23" dnum="_-o:b-i" numlevel="1" lineno="205" slineno="3-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">provide a copy of the policy to each peace officer who retains merit status under <ln numlevel="1" lineno="206" slineno="3-34"/>Subsection <xref depth="4" refnumber="17-76-201(7)(b)">17-76-201(7)(b)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="142" num="17-76-205" type="repreenact" src="code" uid="C17-76-S205_2026070120260701" sort="17 76 02050020260701" numlevel="1" lineno="207" slineno="4-1" sn="4"><section numlevel="1" lineno="208" slineno="4-2" number="17-76-205" type="repreenact"><secline lineno="207">Section 4. Organization of commission -- Secretary -- Offices -- Job <ln numlevel="1" lineno="209" slineno="4-3"/>classification plan.</bold></catline><subsection ssid="142-1" dnum="_-o:1-i" numlevel="1" lineno="210" slineno="4-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">Each commission shall:</amend><subsection ssid="142-2" dnum="_-o:a-i" numlevel="1" lineno="211" slineno="4-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">be organized by the commission's members;</amend></subsection><subsection ssid="142-3" dnum="_-o:b-i" numlevel="1" lineno="212" slineno="4-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">select one member as chairperson;</amend></subsection><subsection ssid="142-4" dnum="_-o:c-i" numlevel="1" lineno="213" slineno="4-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">establish a comprehensive job classification plan that:</amend><subsection ssid="142-5" dnum="_-o:i-i" numlevel="1" lineno="214" slineno="4-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">covers each merit system officer of the governmental unit;</amend></subsection><subsection ssid="142-6" dnum="_-o:ii-i" numlevel="1" lineno="215" slineno="4-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">places each position requiring substantially the same duties and qualifications in <ln numlevel="1" lineno="216" slineno="4-10"/>the same classification;</amend></subsection><subsection ssid="142-7" dnum="_-o:iii-i" numlevel="1" lineno="217" slineno="4-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">provides standards for promotion for each position; and</amend></subsection><subsection ssid="142-8" dnum="_-o:iv-i" numlevel="1" lineno="218" slineno="4-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">includes minimum physical and educational qualifications for each position.</amend></subsection></subsection></subsection><subsection ssid="142-9" dnum="_-o:2-i" numlevel="1" lineno="219" slineno="4-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">If the governing body creates and approves a new position, the commission shall <ln numlevel="1" lineno="220" slineno="4-14"/>classify the position in the classification plan described in Subsection <xref depth="4" refnumber="17-76-205(1)(c)">(1)(c)</xref>.</amend></subsection><subsection ssid="142-10" dnum="_-o:3-i" numlevel="1" lineno="221" slineno="4-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">The governing body shall assign a qualified county employee to act as secretary of the <ln numlevel="1" lineno="222" slineno="4-16"/>commission.</amend></subsection><subsection ssid="142-11" dnum="_-o:4-i" numlevel="1" lineno="223" slineno="4-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="end">The secretary described in Subsection <xref depth="4" refnumber="17-76-205(3)">(3)</xref> shall serve without additional compensation <ln numlevel="1" lineno="224" slineno="4-18"/>unless the county legislative body specifies otherwise.</amend></subsection><subsection ssid="142-12" dnum="_-o:5-i" numlevel="1" lineno="225" slineno="4-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">The governing body shall provide suitable accommodations, supplies, and equipment as <ln numlevel="1" lineno="226" slineno="4-20"/>needed to enable the commission to carry out the commission's business.</amend></subsection></section></bsec><bsec buid="72" num="17-76-207" type="amend" src="code" uid="C17-76-S207_2026070120260701" sort="17 76 02070020260701" numlevel="1" lineno="227" slineno="5-1" sn="5"><section number="17-76-207" numlevel="1" lineno="228" slineno="5-2" type="amend"><secline lineno="227">Section 5. Section <bold>17-76-207</bold> is amended to read:</secline><catline lineno="228"><bold>17-76-207<parens/>. Examinations -- How prepared, conducted, and graded -- Notice of <ln numlevel="1" lineno="229" slineno="5-3"/>examination -- Preservation and inspection of examination papers.</bold></catline><subsection ssid="72-null-1" dnum="1-o" numlevel="1" lineno="230" slineno="5-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="72-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>When necessary, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> commission shall administer a competitive examination <ln numlevel="1" lineno="231" slineno="5-5"/>for employment as a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> to determine the <ln numlevel="1" lineno="232" slineno="5-6"/>qualification of applicants<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>.</subsection><subsection ssid="72-null-3" dnum="b-o" numlevel="1" lineno="233" slineno="5-7" level="2"><display>(b)</display>An examination shall be practical in character and shall relate to matters that will <ln numlevel="1" lineno="234" slineno="5-8"/>fairly test the mental and physical ability and knowledge of the applicants to <ln numlevel="1" lineno="235" slineno="5-9"/>discharge the duties of peace officer.</subsection><subsection ssid="72-null-4" dnum="c-o" numlevel="1" lineno="236" slineno="5-10" level="2"><display>(c)</display>An examination shall be prepared, conducted, and graded as directed by the <ln numlevel="1" lineno="237" slineno="5-11"/>commission, or by impartial special examiners if the commission finds it necessary.</subsection></subsection><subsection ssid="72-null-5" dnum="2-o" numlevel="1" lineno="238" slineno="5-12" level="1" space="false"><display>(2)</display><subsection ssid="72-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notice of examination shall be:<subsection ssid="72-null-7" dnum="i-o" numlevel="1" lineno="239" slineno="5-13" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="72-null-8" dnum="A-o" level="4" placement="sameline"><display>(A)</display>published one time not less than 15 days before the examination in a <ln numlevel="1" lineno="240" slineno="5-14"/>newspaper of general circulation in the area concerned; and</subsection><subsection ssid="72-null-9" dnum="B-o" numlevel="1" lineno="241" slineno="5-15" level="4"><display>(B)</display>published, in accordance with Section <xref depth="3" refnumber="45-1-101" start="0">45-1-101</xref>, for 15 days before the <ln numlevel="1" lineno="242" slineno="5-16"/>examination; and</subsection></subsection><subsection ssid="72-null-10" dnum="ii-o" numlevel="1" lineno="243" slineno="5-17" level="3" tab="1"><display>(ii)</display>posted in a conspicuous place in the office of the appointing authority's <ln numlevel="1" lineno="244" slineno="5-18"/>department.</subsection></subsection><subsection ssid="72-null-11" dnum="b-o" numlevel="1" lineno="245" slineno="5-19" level="2"><display>(b)</display>The notice shall <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">set forth</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">describe the</amend> minimum and maximum wages, physical and <ln numlevel="1" lineno="246" slineno="5-20"/>educational requirements, and passing grades that are not less than 70% correct <ln numlevel="1" lineno="247" slineno="5-21"/>answers.</subsection><subsection ssid="72-null-12" dnum="c-o" numlevel="1" lineno="248" slineno="5-22" level="2"><display>(c)</display>An applicant completing an examination shall be promptly notified of the applicant's <ln numlevel="1" lineno="249" slineno="5-23"/>final grade by mail at the applicant's last known address.</subsection></subsection><subsection ssid="72-null-13" dnum="3-o" numlevel="1" lineno="250" slineno="5-24" level="1"><display>(3)</display>All examination papers are the commission's property, and the commission shall <ln numlevel="1" lineno="251" slineno="5-25"/>preserve the examination papers until the expiration of the eligible register.</subsection><subsection ssid="72-null-14" dnum="4-o" numlevel="1" lineno="252" slineno="5-26" level="1"><display>(4)</display>Examination papers are not open to public inspection without court order, except that:<subsection ssid="72-null-15" dnum="a-o" numlevel="1" lineno="253" slineno="5-27" level="2"><display>(a)</display>an applicant may inspect the applicant's own examination papers at any time within <ln numlevel="1" lineno="254" slineno="5-28"/>30 days after the date the commission mails the notice described in Subsection <xref refnumber="17-30-6(2)" depth="4">(2)</xref>; <ln numlevel="1" lineno="255" slineno="5-29"/>and</subsection><subsection ssid="72-null-16" dnum="b-o" numlevel="1" lineno="256" slineno="5-30" level="2"><display>(b)</display>the appointing authority may inspect the papers of any eligible applicant the <ln numlevel="1" lineno="257" slineno="5-31"/>commission certifies for appointment.</subsection></subsection></section></bsec><bsec buid="105" num="17-76-209" type="amend" src="code" uid="C17-76-S209_2026070120260701" sort="17 76 02090020260701" numlevel="1" lineno="258" slineno="6-1" sn="6"><section number="17-76-209" numlevel="1" lineno="259" slineno="6-2" type="amend"><secline lineno="258">Section 6. Section <bold>17-76-209</bold> is amended to read:</secline><catline lineno="259"><bold>17-76-209<parens/>. Preparation and expiration of eligible register -- Appointments from <ln numlevel="1" lineno="260" slineno="6-3"/>eligible register -- Failure to accept appointment -- Probationary period.</bold></catline><subsection ssid="105-null-1" dnum="1-o" numlevel="1" lineno="261" slineno="6-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="105-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Upon completion of an examination, the commission shall make an eligible <ln numlevel="1" lineno="262" slineno="6-5"/>register that contains the names of all applicants that received a passing grade in the <ln numlevel="1" lineno="263" slineno="6-6"/>order of grades earned, beginning with the highest.</subsection><subsection ssid="105-null-3" dnum="b-o" numlevel="1" lineno="264" slineno="6-7" level="2"><display>(b)</display>An eligible register expires not later than two years after the date of the examination <ln numlevel="1" lineno="265" slineno="6-8"/>unless the commission, for good reason, extends the time not to exceed one <ln numlevel="1" lineno="266" slineno="6-9"/>additional year. </subsection><subsection ssid="105-null-4" dnum="c-o" numlevel="1" lineno="267" slineno="6-10" level="2"><display>(c)</display>When the commission makes a new eligible register, previous eligible registers for <ln numlevel="1" lineno="268" slineno="6-11"/>the same class or position are automatically canceled.</subsection></subsection><subsection ssid="105-null-5" dnum="2-o" numlevel="1" lineno="269" slineno="6-12" level="1" space="false"><display>(2)</display><subsection ssid="105-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">When a peace officer is to be appointed</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">To appoint a merit system officer</amend>, the <ln numlevel="1" lineno="270" slineno="6-13"/>appointing authority shall request that the commission certify three eligible <ln numlevel="1" lineno="271" slineno="6-14"/>applicants for the position.</subsection><subsection ssid="105-null-7" dnum="b-o" numlevel="1" lineno="272" slineno="6-15" level="2"><display>(b)</display>After the appointing authority makes a request described in Subsection <xref refnumber="17-30-9(2)(a)" depth="4">(2)(a)</xref>:<subsection ssid="105-null-8" dnum="i-o" numlevel="1" lineno="273" slineno="6-16" level="3"><display>(i)</display>the commission shall certify to the appointing authority the names of the three <ln numlevel="1" lineno="274" slineno="6-17"/>applicants standing highest on the eligible register; and</subsection><subsection ssid="105-null-9" dnum="ii-o" numlevel="1" lineno="275" slineno="6-18" level="3"><display>(ii)</display>the appointing authority shall select and appoint one of the three applicants the <ln numlevel="1" lineno="276" slineno="6-19"/>commission certifies.</subsection></subsection><subsection ssid="105-null-10" dnum="c-o" numlevel="1" lineno="277" slineno="6-20" level="2"><display>(c)</display>If an applicant described in Subsection <xref refnumber="17-30-9(2)(b)(ii)" depth="4">(2)(b)(ii)</xref> does not accept the appointing <ln numlevel="1" lineno="278" slineno="6-21"/>authority's offer of appointment, the applicant may, in writing:<subsection ssid="105-null-11" dnum="i-o" numlevel="1" lineno="279" slineno="6-22" level="3"><display>(i)</display>request that the applicant retain the applicant's place on the eligible register; and</subsection><subsection ssid="105-null-12" dnum="ii-o" numlevel="1" lineno="280" slineno="6-23" level="3"><display>(ii)</display>provide reasons sufficient, in the judgment of the commission, to justify the <ln numlevel="1" lineno="281" slineno="6-24"/>applicant's rejection of the appointing authority's offer of appointment.</subsection></subsection></subsection><subsection ssid="105-null-13" dnum="3-o" numlevel="1" lineno="282" slineno="6-25" level="1" space="false"><display>(3)</display><subsection ssid="105-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> appointed under Subsection <xref depth="4" refnumber="17-30-9(2)">(2)</xref> shall serve a <ln numlevel="1" lineno="283" slineno="6-26"/>probationary period of 12 consecutive months, during which time the appointing <ln numlevel="1" lineno="284" slineno="6-27"/>authority may discharge the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend>.</subsection><subsection ssid="105-null-15" dnum="b-o" numlevel="1" lineno="285" slineno="6-28" level="2"><display>(b)</display>The probationary period shall be extended as necessary for a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit <ln numlevel="1" lineno="286" slineno="6-29"/>system officer</amend> who has not yet satisfactorily completed an approved peace officer <ln numlevel="1" lineno="287" slineno="6-30"/>training program and received a certificate of completion under <xref depth="1" refnumber="53-6">Title 53, Chapter 6</xref>, <ln numlevel="1" lineno="288" slineno="6-31"/>Peace Officer Standards and Training Act.</subsection><subsection ssid="105-null-16" dnum="c-o" numlevel="1" lineno="289" slineno="6-32" level="2"><display>(c)</display>If a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> remains in the position to which the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both">peace <ln numlevel="1" lineno="290" slineno="6-33"/>officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> was appointed after the expiration of the probationary <ln numlevel="1" lineno="291" slineno="6-34"/>period, the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="28" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both">peace officer's</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer's</amend> retention constitutes appointment to <ln numlevel="1" lineno="292" slineno="6-35"/>merit status.</subsection><subsection ssid="105-null-17" dnum="d-o" numlevel="1" lineno="293" slineno="6-36" level="2"><display>(d)</display>Service as a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> under a temporary or emergency <ln numlevel="1" lineno="294" slineno="6-37"/>appointment is not considered as part of the probationary period.</subsection><subsection ssid="105-null-18" dnum="e-o" numlevel="1" lineno="295" slineno="6-38" level="2"><display>(e)</display>A <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> removed anum="0" ea="amend" pairid="20" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit <ln numlevel="1" lineno="296" slineno="6-39"/>system officer's</amend> probationary period may not be placed on the eligible register again <ln numlevel="1" lineno="297" slineno="6-40"/>without having passed another regular commission shall report the <ln numlevel="1" lineno="309" slineno="7-12"/>reason for suspending competitive hiring in the commission's annual reports.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="42-15" dnum="_-o:1-i" numlevel="1" lineno="310" slineno="7-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" pairid="27" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">there is substantial evidence that competition to fill the vacant position is <ln numlevel="1" lineno="314" lineno="316" slineno="7-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">the commission members unanimously vote to suspend the competition.</amend></subsection></subsection><subsection ssid="42-21" dnum="_-o:2-i" numlevel="1" lineno="317" slineno="7-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">The commission shall report a suspension under Subsection <xref depth="4" refnumber="17-76-210(1)">(1)</xref>, along with the reason <ln numlevel="1" lineno="318" slineno="7-21"/>for the suspension, in the commission's annual reports.</amend></subsection><subsection ssid="42-null-6" dnum="2-o:_-i" numlevel="1" lineno="319" slineno="7-22" ea="erase" anum="0" owner="jchristopherson" style="2" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1127" style="2" owner="o" level="1" deltag="start">(2)</amend></display><subsection ssid="42-null-7" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amend anum="0" ea="erase" pairid="1128" style="2" owner="o" level="1">(a)</amend></display><amend anum="0" ea="erase" pairid="109" groupid="78" style="2" owner="jchristopherson" level="1" deltag="end">The appointing authority shall fill vacancies occurring in the merit system <ln numlevel="1" lineno="320" slineno="7-23"/>classification by promotion if possible.  </amend><amendoutend style="2"/></subsection><subsection ssid="42-null-8" dnum="b-o:_-i" numlevel="1" lineno="321" slineno="7-24" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1129" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="112" groupid="80" style="2" owner="jchristopherson" level="1" deltag="end">A promotion shall be made only after an examination, with admission to the <ln numlevel="1" lineno="322" slineno="7-25"/>examination limited to merit system officers.  </amend><amendoutend style="2"/></subsection><subsection ssid="42-null-9" dnum="c-o:_-i" numlevel="1" lineno="323" slineno="7-26" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1130" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="115" groupid="82" style="2" owner="jchristopherson" level="1" deltag="end">An examination for a promotion shall include an average of service ratings for the <ln numlevel="1" lineno="324" slineno="7-27"/>next preceding year, a rating of seniority, and test the merit system officer's <ln numlevel="1" lineno="325" slineno="7-28"/>competence to perform the duties required in the position for which application is <ln numlevel="1" lineno="326" slineno="7-29"/>made.  </amend><amendoutend style="2"/></subsection><subsection ssid="42-null-10" dnum="d-o:_-i" numlevel="1" lineno="327" slineno="7-30" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1131" style="2" owner="o" level="1" deltag="start">(d)</amend></display><amend anum="0" ea="erase" pairid="118" groupid="84" style="2" owner="jchristopherson" level="1" deltag="end">An examination for a promotion shall not combine the weights of service rating and <ln numlevel="1" lineno="328" slineno="7-31"/>seniority to more than 40% of the whole examination.  </amend><amendoutend style="2"/></subsection><subsection ssid="42-null-11" dnum="e-o:_-i" numlevel="1" lineno="329" slineno="7-32" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1132" style="2" owner="o" level="1" deltag="start">(e)</amend></display><amend anum="0" ea="erase" pairid="121" groupid="86" style="2" owner="jchristopherson" level="1" deltag="end">The appointing authority shall fill subsequent vacancies by promotion until the <ln numlevel="1" lineno="330" slineno="7-33"/>lowest grade is reached, which grade shall then be filled from the eligible list in <ln numlevel="1" lineno="331" slineno="7-34"/>accordance with this part.</amend><amendoutend style="2"/></subsection><subsection ssid="42-null-12" dnum="f-o:_-i" numlevel="1" lineno="332" slineno="7-35" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1133" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/></display></subsection></subsection><subsection ssid="42-36" dnum="_-o:3-i" numlevel="1" lineno="333" slineno="7-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="150" groupid="104" style="1" owner="jchristopherson" level="1" amendtag="end">Vacancies in a merit system classification shall be filled by promotion when possible.</amend></subsection><subsection ssid="42-34" dnum="_-o:4-i" numlevel="1" lineno="334" slineno="7-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="42-35" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">A department shall make a promotion only after conducting an examination that is <ln numlevel="1" lineno="335" slineno="7-38"/>limited to peace officers in the merit system.</amend></subsection><subsection ssid="42-31" dnum="_-o:b-i" numlevel="1" lineno="336" slineno="7-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1137" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="132" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="end">An examination process described in Subsection <xref depth="4" refnumber="17-76-210(4)(a)">(4)(a)</xref> shall include consideration of <ln numlevel="1" lineno="337" slineno="7-40"/>the seniority and competence of the peace officer to perform the duties required in the <ln numlevel="1" lineno="338" slineno="7-41"/>position for which application is made.</amend></subsection><subsection ssid="42-32" dnum="_-o:c-i" numlevel="1" lineno="339" slineno="7-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="135" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">The seniority element of the examination may not exceed 40% of the entire <ln numlevel="1" lineno="340" slineno="7-43"/>examination score.</amend></subsection></subsection><subsection ssid="42-null-13" dnum="i-o:5-i" numlevel="1" lineno="341" slineno="7-44" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1139" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start" space="true">(5)</amend></display><subsection ssid="42-27" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="end">(a)</amend></display>After an examination for a promotion, the commission shall prepare a <ln numlevel="1" lineno="342" slineno="7-45"/>promotion register that takes precedence over an eligible register. </subsection><subsection ssid="42-null-14" dnum="ii-o:b-i" numlevel="1" lineno="343" slineno="7-46" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1141" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>The commission shall make the promotion register in the same manner as it <ln numlevel="1" lineno="344" slineno="7-47"/>makes an eligible register.</subsection></subsection></section></bsec><bsec buid="107" num="17-76-211" type="amend" src="code" uid="C17-76-S211_2026070120260701" sort="17 76 02110020260701" numlevel="1" lineno="345" slineno="8-1" sn="8"><section number="17-76-211" numlevel="1" lineno="346" slineno="8-2" type="amend"><secline lineno="345">Section 8. Section <bold>17-76-211</bold> is amended to read:</secline><catline lineno="346"><bold>17-76-211<parens/>. Temporary appointment.</bold></catline><subsection ssid="107-null-1" dnum="1-o" numlevel="1" lineno="347" slineno="8-3" level="1" placement="noreturn"><display>(1)</display>An appointing authority may make a temporary appointment <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">for a period not exceeding <ln numlevel="1" lineno="348" slineno="8-4"/>60 days, pending examination, when there is no existing eligible, promotion, or <ln numlevel="1" lineno="349" slineno="8-5"/>re-employment register.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">if:</amend><subsection ssid="107-7" dnum="_-o:a-i" numlevel="1" lineno="350" slineno="8-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">the appointment does not exceed seven days;</amend></subsection><subsection ssid="107-9" dnum="_-o:b-i" numlevel="1" lineno="351" slineno="8-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">no eligible individual is immediately available from the eligible, promotional, or <ln numlevel="1" lineno="352" slineno="8-8"/>re-employment registers; Temporary layoffs -- Reemployment register.</bold></catline><subsection ssid="45-null-1" dnum="1-o" numlevel="1" lineno="366" slineno="9-3" level="1" placement="noreturn"><display>(1)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">A peace officer may be temporarily laid off</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">An appointing authority may temporarily <ln numlevel="1" lineno="367" slineno="9-4"/>layoff a merit system officer</amend>:<subsection ssid="45-null-2" dnum="a-o" numlevel="1" lineno="368" slineno="9-5" level="2"><display>(a)</display>when the appointing authority determines it is necessary because of lack of funds or <ln numlevel="1" lineno="369" slineno="9-6"/>work; and </subsection><subsection ssid="45-null-3" dnum="b-o" numlevel="1" lineno="370" slineno="9-7" level="2"><display>(b)</display>with the commission's approval. </subsection></subsection><subsection ssid="45-null-4" dnum="2-o" numlevel="1" lineno="371" slineno="9-8" level="1"><display>(2)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">A</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">An appointing authority shall make a</amend> layoff described in Subsection <xref refnumber="17-30-16(1)" depth="4">(1)</xref> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">shall be <ln numlevel="1" lineno="372" slineno="9-9"/>made </amend><amendoutend style="2"/>according to the lowest rating of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">peace officers</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officers</amend> of the <ln numlevel="1" lineno="373" slineno="9-10"/>class of position affected, calculated upon seniority under a method prescribed by the <ln numlevel="1" lineno="374" slineno="9-11"/>commission. </subsection><subsection ssid="45-null-5" dnum="3-o" numlevel="1" lineno="375" slineno="9-12" level="1"><display>(3)</display>An individual serving under temporary <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both">or emergency </amend><amendoutend style="2"/>appointment shall be laid off <ln numlevel="1" lineno="376" slineno="9-13"/>before any merit system officer. </subsection><subsection ssid="45-null-6" dnum="4-o" numlevel="1" lineno="377" slineno="9-14" level="1"><display>(4)</display>A merit system officer who is laid off shall be placed upon a reemployment register to <ln numlevel="1" lineno="378" slineno="9-15"/>be re-employed in the inverse order in which the merit system officer is laid off, which <ln numlevel="1" lineno="379" slineno="9-16"/>reemployment register shall take precedence over all eligible registers.</subsection></section></bsec><bsec buid="110" num="17-76-214" type="amend" src="code" uid="C17-76-S214_2026070120260701" sort="17 76 02140020260701" numlevel="1" lineno="380" slineno="10-1" sn="10"><section number="17-76-214" numlevel="1" lineno="381" slineno="10-2" type="amend"><secline lineno="380">Section 10. Section <bold>17-76-214</bold> is amended to read:</secline><catline lineno="381"><bold>17-76-214<parens/>. Leave of absence -- Sick leaves and vacations.</bold></catline><subsection ssid="110-null-1" dnum="1-o" numlevel="1" lineno="382" slineno="10-3" level="1" placement="noreturn"><display>(1)</display>The appointing authority, with the commission's approval, may grant a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="383" slineno="10-4"/>merit system officer</amend> a leave of absence without pay for a period not to exceed one year. </subsection><subsection ssid="110-null-2" dnum="2-o" numlevel="1" lineno="384" slineno="10-5" level="1"><display>(2)</display>If a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> on leave takes a higher position in police work <ln numlevel="1" lineno="385" slineno="10-6"/>that does not come under the merit system provisions of this part, the appointing <ln numlevel="1" lineno="386" slineno="10-7"/>authority may, with the commission's consent, renew the leave of absence. </subsection><subsection ssid="110-null-3" dnum="3-o" numlevel="1" lineno="387" slineno="10-8" level="1"><display>(3)</display>If a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> is elected sheriff, or is appointed chief deputy, <ln numlevel="1" lineno="388" slineno="10-9"/>the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> shall automatically be placed on a leave of <ln numlevel="1" lineno="389" slineno="10-10"/>absence for the period of time the peace officer remains sheriff or chief deputy. </subsection><subsection ssid="110-null-4" dnum="4-o" numlevel="1" lineno="390" slineno="10-11" level="1"><display>(4)</display>Upon the termination of a leave of absence, the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> shall <ln numlevel="1" lineno="391" slineno="10-12"/>be returned to the peace officer's former position.</subsection><subsection ssid="110-null-5" dnum="5-o" numlevel="1" lineno="392" slineno="10-13" level="1"><display>(5)</display>Sick leaves and vacations with pay shall be as provided by law or ordinance.</subsection></section></bsec><bsec buid="51" num="17-76-215" type="amend" src="code" uid="C17-76-S215_2026070120260701" sort="17 76 02150020260701" numlevel="1" lineno="393" slineno="11-1" sn="11"><section number="17-76-215" numlevel="1" lineno="394" slineno="11-2" type="amend"><secline lineno="393">Section 11. Section <bold>17-76-215</bold> is amended to read:</secline><catline lineno="394"><bold>17-76-215<parens/>. Demotion, reduction in pay, suspension or discharge -- Grounds.</bold></catline><subsection ssid="51-null-1" dnum="1-o" numlevel="1" lineno="395" slineno="11-3" level="1" placement="noreturn"><display>(1)</display>A merit system officer holding a permanent appointment may be demoted, reduced in <ln numlevel="1" lineno="396" slineno="11-4"/>pay, suspended, or discharged for:<subsection ssid="51-null-2" dnum="a-o" numlevel="1" lineno="397" slineno="11-5" level="2"><display>(a)</display>neglect of duty;</subsection><subsection ssid="51-null-3" dnum="b-o" numlevel="1" lineno="398" slineno="11-6" level="2"><display>(b)</display>disobedience of a reasonable order;</subsection><subsection ssid="51-null-4" dnum="c-o" numlevel="1" lineno="399" slineno="11-7" level="2"><display>(c)</display>misconduct;</subsection><subsection ssid="51-null-5" dnum="d-o" numlevel="1" lineno="400" slineno="11-8" level="2"><display>(d)</display>inefficiency, or inability to satisfactorily perform assigned duties; or</subsection><subsection ssid="51-null-6" dnum="e-o" numlevel="1" lineno="401" slineno="11-9" level="2"><display>(e)</display>any act inimical to the public service.</subsection></subsection><subsection ssid="51-null-7" dnum="2-o" numlevel="1" lineno="402" slineno="11-10" level="1"><display>(2)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">No </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A </amend>merit system officer <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">shall be</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">may not be</amend> suspended for more than 30 days at <ln numlevel="1" lineno="403" slineno="11-11"/>one time, nor more than 60 days in one year. </subsection><subsection ssid="51-null-8" dnum="3-o" numlevel="1" lineno="404" slineno="11-12" level="1"><display>(3)</display>Demotion, reduction in pay, suspension, or discharge shall be made upon order of the <ln numlevel="1" lineno="405" slineno="11-13"/>appointing authority.</subsection></section></bsec><bsec buid="54" num="17-76-216" type="amend" src="code" uid="C17-76-S216_2026070120260701" sort="17 76 02160020260701" numlevel="1" lineno="406" slineno="12-1" sn="12"><section number="17-76-216" numlevel="1" lineno="407" slineno="12-2" type="amend"><secline lineno="406">Section 12. Section <bold>17-76-216</bold> is amended to read:</secline><catline lineno="407"><bold>17-76-216<parens/>. Disciplinary charges and merit system officer grievances -- Appeal to <ln numlevel="1" lineno="408" slineno="12-3"/>commission -- Hearing -- Findings.</bold></catline><subsection ssid="54-null-1" dnum="1-o" numlevel="1" lineno="409" slineno="12-4" level="1" placement="noreturn"><display>(1)</display>An appointing authority who orders the demotion, reduction in pay, suspension, or <ln numlevel="1" lineno="410" slineno="12-5"/>discharge of a merit system officer for any cause described in Section <xref depth="3" refnumber="17-76-215">17-76-215</xref> shall:<subsection ssid="54-null-2" dnum="a-o" numlevel="1" lineno="411" slineno="12-6" level="2"><display>(a)</display>file written charges with the commission; and</subsection><subsection ssid="54-null-3" dnum="b-o" numlevel="1" lineno="412" slineno="12-7" level="2"><display>(b)</display>serve the merit system officer with a copy of the written charges.</subsection></subsection><subsection ssid="54-null-4" dnum="2-o" numlevel="1" lineno="413" slineno="12-8" level="1" space="false"><display>(2)</display><subsection ssid="54-null-5" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="54-null-6" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>A merit system officer who is the subject of charges under Subsection <xref depth="4" refnumber="17-30-19(1)" start="0">(1)</xref> <ln numlevel="1" lineno="414" slineno="12-9"/>may, within 10 days after the day on which the charges <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">were</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">are</amend> served, appeal <ln numlevel="1" lineno="415" slineno="12-10"/>in writing to the commission.</subsection><subsection ssid="54-null-7" dnum="ii-o" numlevel="1" lineno="416" slineno="12-11" level="3" tab="1"><display>(ii)</display>In the absence of an appeal, a copy of the charges under Subsection <xref depth="4" refnumber="17-30-19(1)" start="0">(1)</xref> may not <ln numlevel="1" lineno="417" slineno="12-12"/>be made public without the consent of the merit system officer charged.</subsection></subsection><subsection ssid="54-null-8" dnum="b-o" numlevel="1" lineno="418" slineno="12-13" level="2"><display>(b)</display>If a merit system officer files a grievance, as defined by the commission, and <ln numlevel="1" lineno="419" slineno="12-14"/>exhausts all internal grievance procedures, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">if any,</amend><amendoutend style="2"/> the merit system officer may, <ln numlevel="1" lineno="420" slineno="12-15"/>within 10 days after the day on which the merit system officer <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">received</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">receives</amend> <ln numlevel="1" lineno="421" slineno="12-16"/>notice of the final disposition of the grievance, file an appeal with the commission.</subsection></subsection><subsection ssid="54-null-9" dnum="3-o" numlevel="1" lineno="422" slineno="12-17" level="1" space="false"><display>(3)</display><subsection ssid="54-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The commission shall:<subsection ssid="54-null-11" dnum="i-o" numlevel="1" lineno="423" slineno="12-18" level="3" tab="1"><display>(i)</display>fix a time and place for a hearing upon the charges or appeal of a merit system <ln numlevel="1" lineno="424" slineno="12-19"/>officer grievance; and</subsection><subsection ssid="54-null-12" dnum="ii-o" numlevel="1" lineno="425" slineno="12-20" level="3" tab="1"><display>(ii)</display>give notice of the hearing to the parties.</subsection></subsection><subsection ssid="54-null-13" dnum="b-o" numlevel="1" lineno="426" slineno="12-21" level="2" space="false"><display>(b)</display><subsection ssid="54-null-14" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="17-30-19(3)(b)(ii)" start="0">(3)(b)(ii)</xref>, each hearing under this Subsection <xref depth="4" refnumber="17-30-19(3)" start="0"><ln numlevel="1" lineno="427" slineno="12-22"/>(3)</xref> shall be held not less than 10 days<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/> and not more than 90 days<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/> after the day <ln numlevel="1" lineno="428" slineno="12-23"/>on which a merit system officer files an appeal or grievance.</subsection><subsection ssid="54-null-15" dnum="ii-o" numlevel="1" lineno="429" slineno="12-24" level="3"><display>(ii)</display>A hearing may be held more than 90 days after an appeal or grievance is filed if:<subsection ssid="54-null-16" dnum="A-o" numlevel="1" lineno="430" slineno="12-25" level="4"><display>(A)</display>the merit system officer and employer agree; or</subsection><subsection ssid="54-null-17" dnum="B-o" numlevel="1" lineno="431" slineno="12-26" level="4"><display>(B)</display>the commission determines there is good cause to delay the hearing.</subsection></subsection></subsection></subsection><subsection ssid="54-null-18" dnum="4-o" numlevel="1" lineno="432" slineno="12-27" level="1" space="false"><display>(4)</display><subsection ssid="54-null-19" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the aggrieved merit system officer <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">so </amend><amendoutend style="2"/>desires, the hearing shall be public.</subsection><subsection ssid="54-null-20" dnum="b-o" numlevel="1" lineno="433" slineno="12-28" level="2"><display>(b)</display>The parties may be represented by counsel at the hearing.</subsection></subsection><subsection ssid="54-null-21" dnum="5-o" numlevel="1" lineno="434" slineno="12-29" level="1"><display>(5)</display>After the hearing, the commission shall make its decision in writing, including findings <ln numlevel="1" lineno="435" slineno="12-30"/>of fact, and shall mail a copy of the commission's decision to each party.</subsection><subsection ssid="54-null-22" dnum="6-o" numlevel="1" lineno="436" slineno="12-31" level="1" space="false"><display>(6)</display><subsection ssid="54-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">An individual aggrieved by an act or failure to act of any commission under this <ln numlevel="1" lineno="437" slineno="12-32"/>part has exhausted the remedies of appeal to the commission, the individual may <ln numlevel="1" lineno="438" slineno="12-33"/>appeal the commission's decision to the district court</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">An individual affected by a <ln numlevel="1" lineno="439" slineno="12-34"/>commission's action or inaction under this part may appeal to the district court after <ln numlevel="1" lineno="440" slineno="12-35"/>the individual exhausts all appeal options with the commission</amend>.</subsection><subsection ssid="54-null-24" dnum="b-o" numlevel="1" lineno="441" slineno="12-36" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">The courts</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A court</amend> may review questions of law and fact, and may affirm, set aside, <ln numlevel="1" lineno="442" slineno="12-37"/>or modify the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">ruling complained of</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">commission's action</amend>.</subsection></subsection></section></bsec><bsec buid="63" num="17-76-217" type="amend" src="code" uid="C17-76-S217_2026070120260701" sort="17 76 02170020260701" numlevel="1" lineno="443" slineno="13-1" sn="13"><section number="17-76-217" numlevel="1" lineno="444" slineno="13-2" type="amend"><secline lineno="443">Section 13. Section <bold>17-76-217</bold> is amended to read:</secline><catline lineno="444"><bold>17-76-217<parens/>. Prohibitions against political activities -- Penalties.</bold></catline><subsection ssid="63-null-1" dnum="1-o" numlevel="1" lineno="445" slineno="13-3" level="1" placement="noreturn"><display>(1)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">It is a class B misdemeanor for an individual with authority to, or who seeks, assists, <ln numlevel="1" lineno="446" slineno="13-4"/>promises, or threatens to appoint, promote, transfer, demote, suspend, discharge, or <ln numlevel="1" lineno="447" slineno="13-5"/>change the amount of compensation of a merit system officer, for giving, withholding, <ln numlevel="1" lineno="448" slineno="13-6"/>or neglecting to make any contributions or any service for any political purpose. </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A <ln numlevel="1" lineno="449" slineno="13-7"/>government employee, member of a governing body, or appointing authority is guilty of <ln numlevel="1" lineno="450" slineno="13-8"/>a class B misdemeanor if that individual:</amend><subsection ssid="63-7" dnum="_-o:a-i" numlevel="1" lineno="451" slineno="13-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1196" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">appoints, promotes, transfers, demotes, suspends, discharges, or alters the <ln numlevel="1" lineno="452" slineno="13-10"/>compensation of a merit system officer for giving, withholding, or neglecting to <ln numlevel="1" lineno="453" slineno="13-11"/>make a political contribution or service;</amend></subsection><subsection ssid="63-9" dnum="_-o:b-i" numlevel="1" lineno="454" slineno="13-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1197" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">promises, seeks, aids, or abets the appointment, promotion, transfer, demotion, <ln numlevel="1" lineno="455" slineno="13-13"/>suspension, discharge, or change in compensation of a merit system officer for <ln numlevel="1" lineno="456" slineno="13-14"/>giving, withholding, or neglecting to make a political contribution or service; or</amend></subsection><subsection ssid="63-10" dnum="_-o:c-i" numlevel="1" lineno="457" slineno="13-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1198" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">directly or indirectly solicits a political contribution or service from a merit system <ln numlevel="1" lineno="458" slineno="13-16"/>officer.</amend></subsection></subsection><subsection ssid="63-null-2" dnum="2-o:_-i" numlevel="1" lineno="459" slineno="13-17" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1199" style="2" owner="o" level="1" deltag="start">(2)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">It is a class B misdemeanor for an individual described in Subsection <xref depth="4" refnumber="17-30-22(1)">(1)</xref> to solicit, <ln numlevel="1" lineno="460" slineno="13-18"/>directly or indirectly, a contribution or servicefor a political purpose from a merit system <ln numlevel="1" lineno="461" slineno="13-19"/>officer.  </amend><amendoutend style="2"/></subsection><subsection ssid="63-null-3" dnum="3-o:2-i" numlevel="1" lineno="462" slineno="13-20" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1200" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1201" style="1" owner="i" level="1" amendtag="both" space="true">(2)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">This section</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsection <xref depth="4" refnumber="17-76-217(1)">(1)</xref></amend> does not apply to political speeches or use of mass <ln numlevel="1" lineno="463" slineno="13-21"/>communication media for political purposes by an individual who is not a merit system <ln numlevel="1" lineno="464" slineno="13-22"/>officer even though a merit system officer may be present or within the reach of such <ln numlevel="1" lineno="465" slineno="13-23"/>media unless the purpose and intent is to violate this section with direct respect to the <ln numlevel="1" lineno="466" slineno="13-24"/>merit system officer.</subsection><subsection ssid="63-null-4" dnum="4-o:3-i" numlevel="1" lineno="467" slineno="13-25" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1201" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1202" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>A merit system officer may not engage in political activity during the hours of <ln numlevel="1" lineno="468" slineno="13-26"/>employment. </subsection><subsection ssid="63-null-5" dnum="5-o:4-i" numlevel="1" lineno="469" slineno="13-27" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1202" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1203" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>An individual may not solicit political contributions from a merit system officer <ln numlevel="1" lineno="470" slineno="13-28"/>during hours of employment for political purposes. </subsection><subsection ssid="63-null-6" dnum="6-o:5-i" numlevel="1" lineno="471" slineno="13-29" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1203" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1204" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>This section does not preclude a merit system officer from voluntarily contributing <ln numlevel="1" lineno="472" slineno="13-30"/>to the party or candidate of the merit system officer's choice.</subsection></section></bsec><bsec buid="78" num="17-76-301" type="amend" src="code" uid="C17-76-S301_2026070120260701" sort="17 76 03010020260701" numlevel="1" lineno="473" slineno="14-1" sn="14"><section number="17-76-301" numlevel="1" lineno="474" slineno="14-2" type="amend"><secline lineno="473">Section 14. Section <bold>17-76-301</bold> is amended to read:</secline><catline lineno="474"><bold>17-76-301<parens/>. Definitions.</bold></catline><sectionText lineno="475"><tab/>As used in this <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">part</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">chapter</amend>:</sectionText><subsection ssid="78-null-1" dnum="1-o" numlevel="1" lineno="476" slineno="14-4" level="1"><display>(1)</display>"Appointing authority" means the county sheriff or the chief executive officer of a <ln numlevel="1" lineno="477" slineno="14-5"/>police interlocal entity.</subsection><subsection ssid="78-null-2" dnum="2-o" numlevel="1" lineno="478" slineno="14-6" level="1"><display>(2)</display>"Commission" means the merit system commission consisting of three individuals <ln numlevel="1" lineno="479" slineno="14-7"/>appointed in accordance with Section <xref depth="3" refnumber="17-76-304">17-76-304</xref>.</subsection><subsection ssid="78-null-3" dnum="3-o" numlevel="1" lineno="480" slineno="14-8" level="1"><display>(3)</display>"Department" means a county sheriff's office or a police interlocal entity.</subsection><subsection ssid="78-null-4" dnum="4-o" numlevel="1" lineno="481" slineno="14-9" level="1"><display>(4)</display>"Eligible appointment register" means the list made by a commission described in <ln numlevel="1" lineno="482" slineno="14-10"/>Section <xref depth="3" refnumber="17-76-310">17-76-310</xref> that contains the names of all applicants that took the examination <ln numlevel="1" lineno="483" slineno="14-11"/>and that received a passing grade.</subsection><subsection ssid="78-null-5" dnum="5-o" numlevel="1" lineno="484" slineno="14-12" level="1"><display>(5)</display>"Examination" means the competitive examination to determine the qualification of an <ln numlevel="1" lineno="485" slineno="14-13"/>applicant for a position as a peace officer described in Section <xref depth="3" refnumber="17-76-307">17-76-307</xref>.</subsection><subsection ssid="78-null-6" dnum="6-o" numlevel="1" lineno="486" slineno="14-14" level="1"><display>(6)</display>"Legislative body" means the county legislative body or the governing body of the <ln numlevel="1" lineno="487" slineno="14-15"/>police interlocal entity.</subsection><subsection ssid="78-null-7" dnum="7-o" numlevel="1" lineno="488" slineno="14-16" level="1"><display>(7)</display>"Merit system officer" means<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both"> a peace officer who has merit status as defined in this <ln numlevel="1" lineno="489" slineno="14-17"/>part.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="78-19" dnum="_-o:a-i" numlevel="1" lineno="490" slineno="14-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1211" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">a peace officer:</amend><subsection ssid="78-24" dnum="_-o:i-i" numlevel="1" lineno="491" slineno="14-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1212" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">in a position with a rank or equivalent rank of sergeant or lower; or</amend></subsection><subsection ssid="78-25" dnum="_-o:ii-i" numlevel="1" lineno="492" slineno="14-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1213" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">in a position, except chief deputy, with a rank of lieutenant or higher that the <ln numlevel="1" lineno="493" slineno="14-21"/>county sheriff designates as a merit system position before July 1, 2026;</amend></subsection></subsection><subsection ssid="78-20" dnum="_-o:b-i" numlevel="1" lineno="494" slineno="14-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">regardless of rank, a peace officer who, immediately before July 1, 2026, was in a <ln numlevel="1" lineno="495" slineno="14-23"/>merit system position under this part, unless, on or after July 1, 2026, the peace <ln numlevel="1" lineno="496" slineno="14-24"/>officer:</amend><subsection ssid="78-21" dnum="_-o:i-i" numlevel="1" lineno="497" slineno="14-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1215" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">except as described in Subsection <xref depth="4" refnumber="17-76-301(7)(c)">(7)(c)</xref>, voluntarily accepts a position that is not a <ln numlevel="1" lineno="498" slineno="14-26"/>merit system position; or</amend></subsection><subsection ssid="78-22" dnum="_-o:ii-i" numlevel="1" lineno="499" slineno="14-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">in accordance with the written policy described in Subsection <xref depth="4" refnumber="17-76-302(2)">17-76-302(2)</xref>, <ln numlevel="1" lineno="500" slineno="14-28"/>voluntarily surrenders merit status; or</amend></subsection></subsection><subsection ssid="78-23" dnum="_-o:c-i" numlevel="1" lineno="501" slineno="14-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">a peace officer who returns to a merit system position after a leave of absence under <ln numlevel="1" lineno="502" slineno="14-30"/>Section <xref depth="3" refnumber="17-76-316">17-76-316</xref>, unless the peace officer voluntarily surrenders merit status under <ln numlevel="1" lineno="503" slineno="14-31"/>Subsection <xref depth="4" refnumber="17-76-301(7)(b)(ii)">(7)(b)(ii)</xref>.</amend></subsection></subsection><subsection ssid="78-null-8" dnum="8-o" numlevel="1" lineno="504" slineno="14-32" level="1"><display>(8)</display>"Peace officer" means a paid deputy sheriff or law enforcement officer, other than a <ln numlevel="1" lineno="505" slineno="14-33"/>chief deputy or other exempt appointed officer designated by the appointing authority, <ln numlevel="1" lineno="506" slineno="14-34"/>who is in the continuous employ of the appointing authority.</subsection><subsection ssid="78-null-9" dnum="9-o" numlevel="1" lineno="507" slineno="14-35" level="1"><display>(9)</display>"Police interlocal entity" means an interlocal entity, as defined in Section <xref depth="3" refnumber="11-13-103" start="0">11-13-103</xref>, <ln numlevel="1" lineno="508" slineno="14-36"/>created:<subsection ssid="78-null-10" dnum="a-o" numlevel="1" lineno="509" slineno="14-37" level="2"><display>(a)</display>under <xref depth="1" refnumber="11-13" start="0">Title 11, Chapter 13, Interlocal Cooperation Act</xref>, by an agreement to which a <ln numlevel="1" lineno="510" slineno="14-38"/>county of the first class is a party; and</subsection><subsection ssid="78-null-11" dnum="b-o" numlevel="1" lineno="511" slineno="14-39" level="2"><display>(b)</display>to provide law enforcement service to an area that includes the unincorporated part <ln numlevel="1" lineno="512" slineno="14-40"/>of the county.</subsection></subsection></section></bsec><bsec buid="147" num="17-76-302" type="amend" src="code" uid="C17-76-S302_2026070120260701" sort="17 76 03020020260701" numlevel="1" lineno="513" slineno="15-1" sn="15"><section number="17-76-302" numlevel="1" lineno="514" slineno="15-2" type="amend"><secline lineno="513">Section 15. Section <bold>17-76-302</bold> is amended to read:</secline><catline lineno="514"><bold>17-76-302<parens/>. Applicability.</bold></catline><subsection ssid="147-1" dnum="_-o:1-i" numlevel="1" lineno="515" slineno="15-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1222" style="1" owner="i" level="1" amendtag="both">(1)</amend></display>This part applies to a county of the first class or a police interlocal entity in which a <ln numlevel="1" lineno="516" slineno="15-4"/>county of the first class is a party to an interlocal agreement to provide law enforcement <ln numlevel="1" lineno="517" slineno="15-5"/>service.</subsection><subsection ssid="147-3" dnum="_-o:2-i" numlevel="1" lineno="518" slineno="15-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1223" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">A commission shall:</amend><subsection ssid="147-9" dnum="_-o:a-i" numlevel="1" lineno="519" slineno="15-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1224" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">establish a written policy that provides financial or other incentives for a peace <ln numlevel="1" lineno="520" slineno="15-8"/>officer who retains merit status under Subsection <xref depth="4" refnumber="17-76-301(7)(b)">17-76-301(7)(b)</xref> to voluntarily <ln numlevel="1" lineno="521" slineno="15-9"/>surrender merit status; and</amend></subsection><subsection ssid="147-12" dnum="_-o:b-i" numlevel="1" lineno="522" slineno="15-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1225" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">provide a copy of the policy to each peace officer who retains merit status under <ln numlevel="1" lineno="523" slineno="15-11"/>Subsection <xref depth="4" refnumber="17-76-301(7)(b)">17-76-301(7)(b)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="81" num="17-76-303" type="amend" src="code" uid="C17-76-S303_2026070120260701" sort="17 76 03030020260701" numlevel="1" lineno="524" slineno="16-1" sn="16"><section number="17-76-303" numlevel="1" lineno="525" slineno="16-2" type="amend"><secline lineno="524">Section 16. Section <bold>17-76-303</bold> is amended to read:</secline><catline lineno="525"><bold>17-76-303<parens/>. Subordinate peace officers appointed, reappointed.</bold></catline><subsection ssid="81-null-1" dnum="1-o" numlevel="1" lineno="526" slineno="16-3" level="1" placement="noreturn"><display>(1)</display>The appointing authority of a county or police interlocal entity subject to this part that <ln numlevel="1" lineno="527" slineno="16-4"/>regularly employs one or more <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">peace officers</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="38" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officers</amend> shall:<subsection ssid="81-null-2" dnum="a-o" numlevel="1" lineno="528" slineno="16-5" level="2"><display>(a)</display>appoint a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="39" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> with the advice and consent of the <ln numlevel="1" lineno="529" slineno="16-6"/>county legislative body or police interlocal entity governing body, subject to the <ln numlevel="1" lineno="530" slineno="16-7"/>commission's rules;</subsection><subsection ssid="81-null-3" dnum="b-o" numlevel="1" lineno="531" slineno="16-8" level="2"><display>(b)</display>appoint each <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">subordinate peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="40" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend>;</subsection><subsection ssid="81-null-4" dnum="c-o" numlevel="1" lineno="532" slineno="16-9" level="2"><display>(c)</display>fill a vacancy in the department; and</subsection><subsection ssid="81-null-5" dnum="d-o" numlevel="1" lineno="533" slineno="16-10" level="2"><display>(d)</display>further promote, transfer, reassign, reappoint, demote, suspend, or remove a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">peace <ln numlevel="1" lineno="534" slineno="16-11"/>officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="41" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> in accordance with this part.</subsection></subsection><subsection ssid="81-null-6" dnum="2-o" numlevel="1" lineno="535" slineno="16-12" level="1"><display>(2)</display>The commission shall <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="47" groupid="47" style="2" owner="jchristopherson" level="1" deltag="both">adopt</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="46" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">make</amend> rules governing the appointment of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both">peace officers</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="42" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="536" slineno="16-13"/>merit system officers</amend> through reappointment of a former employee who separated in <ln numlevel="1" lineno="537" slineno="16-14"/>good standing, within one year after separation.</subsection><subsection ssid="81-null-7" dnum="3-o" numlevel="1" lineno="538" slineno="16-15" level="1"><display>(3)</display>A <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="28" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="43" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> appointed before May 13, 2014, is considered to <ln numlevel="1" lineno="539" slineno="16-16"/>have been appointed to and hold the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">peace officer's</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="44" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer's</amend> position and <ln numlevel="1" lineno="540" slineno="16-17"/>classification in accordance with <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">the provisions of </amend><amendoutend style="2"/>this part.</subsection></section></bsec><bsec buid="84" num="17-76-305" type="amend" src="code" uid="C17-76-S305_2026070120260701" sort="17 76 03050020260701" numlevel="1" lineno="541" slineno="17-1" sn="17"><section number="17-76-305" numlevel="1" lineno="542" slineno="17-2" type="amend"><secline lineno="541">Section 17. Section <bold>17-76-305</bold> is amended to read:</secline><catline lineno="542"><bold>17-76-305<parens/>. General duty -- Creation of comprehensive job classification plan -- <ln numlevel="1" lineno="543" slineno="17-3"/>Oaths and subpoenas -- Provide for unspecified activities.</bold></catline><subsection ssid="84-null-1" dnum="1-o" numlevel="1" lineno="544" slineno="17-4" level="1" placement="noreturn"><display>(1)</display>The commission:<subsection ssid="84-null-2" dnum="a-o" numlevel="1" lineno="545" slineno="17-5" level="2"><display>(a)</display>is responsible for carrying out the provisions of this chapter; and</subsection><subsection ssid="84-null-3" dnum="b-o" numlevel="1" lineno="546" slineno="17-6" level="2"><display>(b)</display>shall make necessary rules and regulations to govern the merit system in accordance <ln numlevel="1" lineno="547" slineno="17-7"/>with this part, including:<subsection ssid="84-null-4" dnum="i-o" numlevel="1" lineno="548" slineno="17-8" level="3"><display>(i)</display>adopting merit rules regarding:<subsection ssid="84-null-5" dnum="A-o" numlevel="1" lineno="549" slineno="17-9" level="4"><display>(A)</display>appointments and registers;</subsection><subsection ssid="84-null-6" dnum="B-o" numlevel="1" lineno="550" slineno="17-10" level="4"><display>(B)</display>examinations;</subsection><subsection ssid="84-null-7" dnum="C-o" numlevel="1" lineno="551" slineno="17-11" level="4"><display>(C)</display>promotions;</subsection><subsection ssid="84-null-8" dnum="D-o" numlevel="1" lineno="552" slineno="17-12" level="4"><display>(D)</display>reassignments;</subsection><subsection ssid="84-null-9" dnum="E-o" numlevel="1" lineno="553" slineno="17-13" level="4"><display>(E)</display>reappointments;</subsection><subsection ssid="84-null-10" dnum="F-o" numlevel="1" lineno="554" slineno="17-14" level="4"><display>(F)</display>disciplinary grievance procedures;</subsection><subsection ssid="84-null-11" dnum="G-o" numlevel="1" lineno="555" slineno="17-15" level="4"><display>(G)</display>administrative reviews;</subsection><subsection ssid="84-null-12" dnum="H-o" numlevel="1" lineno="556" slineno="17-16" level="4"><display>(H)</display>recognition of the equivalency of another merit system for the purpose of <ln numlevel="1" lineno="557" slineno="17-17"/>appointing a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> from another agency; and</subsection><subsection ssid="84-null-13" dnum="I-o" numlevel="1" lineno="558" slineno="17-18" level="4"><display>(I)</display>reductions in force;</subsection></subsection><subsection ssid="84-null-14" dnum="ii-o" numlevel="1" lineno="559" slineno="17-19" level="3"><display>(ii)</display>adopting a rule regarding the preparation of a job classification plan; and</subsection><subsection ssid="84-null-15" dnum="iii-o" numlevel="1" lineno="560" slineno="17-20" level="3"><display>(iii)</display>adopting rules necessary for the efficient management of the merit system not <ln numlevel="1" lineno="561" slineno="17-21"/>specifically enumerated above and not inconsistent with this chapter or applicable <ln numlevel="1" lineno="562" slineno="17-22"/>law.</subsection></subsection></subsection><subsection ssid="84-null-16" dnum="2-o" numlevel="1" lineno="563" slineno="17-23" level="1"><display>(2)</display>Upon the request of the appointing authority and after conducting a public hearing, the <ln numlevel="1" lineno="564" slineno="17-24"/>commission may temporarily suspend a rule if the suspension is necessary for the proper <ln numlevel="1" lineno="565" slineno="17-25"/>enforcement of this part.</subsection><subsection ssid="84-null-17" dnum="3-o" numlevel="1" lineno="566" slineno="17-26" level="1" space="false"><display>(3)</display><subsection ssid="84-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The commission shall formulate a comprehensive job classification plan covering <ln numlevel="1" lineno="567" slineno="17-27"/>all merit system officers employed by the sheriff or by the police interlocal entity.</subsection><subsection ssid="84-null-19" dnum="b-o" numlevel="1" lineno="568" slineno="17-28" level="2"><display>(b)</display>The job classification plan shall:<subsection ssid="84-null-20" dnum="i-o" numlevel="1" lineno="569" slineno="17-29" level="3"><display>(i)</display>place all positions requiring substantially the same duties and qualifications in the <ln numlevel="1" lineno="570" slineno="17-30"/>same classification;</subsection><subsection ssid="84-null-21" dnum="ii-o" numlevel="1" lineno="571" slineno="17-31" level="3"><display>(ii)</display>include minimum physical and educational qualifications of the applicants for <ln numlevel="1" lineno="572" slineno="17-32"/>each position; and</subsection><subsection ssid="84-null-22" dnum="iii-o" numlevel="1" lineno="573" slineno="17-33" level="3"><display>(iii)</display>provide standards for promotion.</subsection></subsection><subsection ssid="84-null-23" dnum="c-o" numlevel="1" lineno="574" slineno="17-34" level="2"><display>(c)</display>If a new position is created and approved, the commission shall classify the position <ln numlevel="1" lineno="575" slineno="17-35"/>in the job classification plan.</subsection></subsection><subsection ssid="84-null-24" dnum="4-o" numlevel="1" lineno="576" slineno="17-36" level="1" space="false"><display>(4)</display><subsection ssid="84-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A member of the commission, in performance of commission duties, may <ln numlevel="1" lineno="577" slineno="17-37"/>administer oaths and subpoena witnesses and documents.</subsection><subsection ssid="84-null-26" dnum="b-o" numlevel="1" lineno="578" slineno="17-38" level="2"><display>(b)</display>If an individual refuses to comply with or fails to comply with a subpoena issued by <ln numlevel="1" lineno="579" slineno="17-39"/>a member of the commission, the district court may, upon application by the member <ln numlevel="1" lineno="580" slineno="17-40"/>of the commission, compel obedience.</subsection></subsection><subsection ssid="84-null-27" dnum="5-o" numlevel="1" lineno="581" slineno="17-41" level="1" space="false"><display>(5)</display><subsection ssid="84-null-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A witness in a proceeding before the commission is subject to all the rights, <ln numlevel="1" lineno="582" slineno="17-42"/>privileges, duties, and penalties of witnesses in courts of record.</subsection><subsection ssid="84-null-29" dnum="b-o" numlevel="1" lineno="583" slineno="17-43" level="2"><display>(b)</display>The commission shall pay a witness fee equivalent to those paid for a court of record.</subsection></subsection><subsection ssid="84-null-30" dnum="6-o" numlevel="1" lineno="584" slineno="17-44" level="1"><display>(6)</display>The commission may adopt a rule for an activity within the purpose and spirit of this <ln numlevel="1" lineno="585" slineno="17-45"/>part that:<subsection ssid="84-null-31" dnum="a-o" numlevel="1" lineno="586" slineno="17-46" level="2"><display>(a)</display>the commission deems is necessary and proper; and</subsection><subsection ssid="84-null-32" dnum="b-o" numlevel="1" lineno="587" slineno="17-47" level="2"><display>(b)</display>not otherwise prohibited by law.</subsection></subsection></section></bsec><bsec buid="118" num="17-76-310" type="amend" src="code" uid="C17-76-S310_2026070120260701" sort="17 76 03100020260701" numlevel="1" lineno="588" slineno="18-1" sn="18"><section number="17-76-310" numlevel="1" lineno="589" slineno="18-2" type="amend"><secline lineno="588">Section 18. Section <bold>17-76-310</bold> is amended to read:</secline><catline lineno="589"><bold>17-76-310<parens/>. Preparation and expiration of eligible appointment register -- <ln numlevel="1" lineno="590" slineno="18-3"/>Appointments from eligible appointment register -- Failure to accept appointment -- <ln numlevel="1" lineno="591" slineno="18-4"/>Probationary period.</bold></catline><subsection ssid="118-null-1" dnum="1-o" numlevel="1" lineno="592" slineno="18-5" level="1" placement="noreturn"><display>(1)</display>Upon completion of an examination, the commission shall prepare and adopt an eligible <ln numlevel="1" lineno="593" slineno="18-6"/>appointment register containing the names of applicants receiving a passing grade <ln numlevel="1" lineno="594" slineno="18-7"/>ranked in the order of grades earned, beginning with the highest.</subsection><subsection ssid="118-null-2" dnum="2-o" numlevel="1" lineno="595" slineno="18-8" level="1" space="false"><display>(2)</display><subsection ssid="118-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An eligible appointment register shall expire not later than two years after the date <ln numlevel="1" lineno="596" slineno="18-9"/>of the examination unless the commission, for good reason, extends the time not to <ln numlevel="1" lineno="597" slineno="18-10"/>exceed one additional year.</subsection><subsection ssid="118-null-4" dnum="b-o" numlevel="1" lineno="598" slineno="18-11" level="2"><display>(b)</display>If the commission adopts a new eligible appointment register, a previous eligible <ln numlevel="1" lineno="599" slineno="18-12"/>appointment register for the same class or position is cancelled.</subsection></subsection><subsection ssid="118-null-5" dnum="3-o" numlevel="1" lineno="600" slineno="18-13" level="1"><display>(3)</display>If the appointment of a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> is an appointment based on <ln numlevel="1" lineno="601" slineno="18-14"/>an examination, the appointing authority shall request that the commission certify <ln numlevel="1" lineno="602" slineno="18-15"/>eligible applicants for each position.</subsection><subsection ssid="118-null-6" dnum="4-o" numlevel="1" lineno="603" slineno="18-16" level="1" space="false"><display>(4)</display><subsection ssid="118-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The commission shall certify, to the appointing authority, a number of names <ln numlevel="1" lineno="604" slineno="18-17"/>equal to three times the number of allocations being filled.</subsection><subsection ssid="118-null-8" dnum="b-o" numlevel="1" lineno="605" slineno="18-18" level="2"><display>(b)</display>The names of the applicants shall be ranked in order of examination score, beginning <ln numlevel="1" lineno="606" slineno="18-19"/>with the name of the applicant standing highest on the eligible appointment register.</subsection></subsection><subsection ssid="118-null-9" dnum="5-o" numlevel="1" lineno="607" slineno="18-20" level="1"><display>(5)</display>The appointing authority shall select <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">a person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an applicant</amend> described in Subsection <xref depth="4" refnumber="17-30a-305(4)(b)"><ln numlevel="1" lineno="608" slineno="18-21"/>(4)(b)</xref> and appoint one <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">applicant</amend> to each open position.</subsection><subsection ssid="118-null-10" dnum="6-o" numlevel="1" lineno="609" slineno="18-22" level="1"><display>(6)</display>If a certified applicant fails to accept a proffered appointment, the applicant:<subsection ssid="118-null-11" dnum="a-o" numlevel="1" lineno="610" slineno="18-23" level="2"><display>(a)</display>may request in writing that the applicant be able to retain the applicant's place on the <ln numlevel="1" lineno="611" slineno="18-24"/>eligible appointment register; and</subsection><subsection ssid="118-null-12" dnum="b-o" numlevel="1" lineno="612" slineno="18-25" level="2"><display>(b)</display>shall provide reasons sufficient, in the judgment of the commission, to justify the <ln numlevel="1" lineno="613" slineno="18-26"/>applicant's failure to accept.</subsection></subsection><subsection ssid="118-null-13" dnum="7-o" numlevel="1" lineno="614" slineno="18-27" level="1"><display>(7)</display>A <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> appointed under Subsection <xref depth="4" refnumber="17-30a-305(5)">(5)</xref> shall serve a <ln numlevel="1" lineno="615" slineno="18-28"/>probationary period of 12 consecutive months, during which time the <amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both">merit system </amend><ln numlevel="1" lineno="616" slineno="18-29"/>officer may be discharged at the appointing authority's sole discretion.</subsection><subsection ssid="118-null-14" dnum="8-o" numlevel="1" lineno="617" slineno="18-30" level="1" space="false"><display>(8)</display><subsection ssid="118-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>At the request of the appointing authority, and with the approval of the <ln numlevel="1" lineno="618" slineno="18-31"/>commission, the probationary period may be extended beyond 12 months for a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both">peace <ln numlevel="1" lineno="619" slineno="18-32"/>officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> who has not yet satisfactorily completed an approved <ln numlevel="1" lineno="620" slineno="18-33"/>peace officer training program and received a certificate of completion under <xref depth="1" refnumber="53-6">Title <ln numlevel="1" lineno="621" slineno="18-34"/>53, Chapter 6</xref>, Peace Officer Standards and Training Act.</subsection><subsection ssid="118-null-16" dnum="b-o" numlevel="1" lineno="622" slineno="18-35" level="2"><display>(b)</display>At the request of the appointing authority, and with the approval of the commission, <ln numlevel="1" lineno="623" slineno="18-36"/>the probationary period of a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="28" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> may be extended <ln numlevel="1" lineno="624" slineno="18-37"/>beyond 12 months for good cause shown.</subsection><subsection ssid="118-null-17" dnum="c-o" numlevel="1" lineno="625" slineno="18-38" level="2"><display>(c)</display>Service under a temporary or part-time appointment is not considered a part of the <ln numlevel="1" lineno="626" slineno="18-39"/>probationary period.</subsection></subsection><subsection ssid="118-null-18" dnum="9-o" numlevel="1" lineno="627" slineno="18-40" level="1"><display>(9)</display>If a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer</amend> is retained in a position after the expiration of <ln numlevel="1" lineno="628" slineno="18-41"/>the probationary period, the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">peace officer's</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system officer's</amend> retention constitutes <ln numlevel="1" lineno="629" slineno="18-42"/>appointment to merit status.</subsection><subsection ssid="118-null-19" dnum="10-o" numlevel="1" lineno="630" slineno="18-43" level="1"><display>(10)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both">A person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">An individual</amend> removed from employment during the probationary period <ln numlevel="1" lineno="631" slineno="18-44"/>may not be placed on the eligible appointment register again without having passed <ln numlevel="1" lineno="632" slineno="18-45"/>another regular examination.</subsection><subsection ssid="118-null-20" dnum="11-o" numlevel="1" lineno="633" slineno="18-46" level="1"><display>(11)</display>The commission may make or adopt policies governing probationary periods for other <ln numlevel="1" lineno="634" slineno="18-47"/>appointments, including the appointing or transfer of a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both">peace officer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">merit system <ln numlevel="1" lineno="635" slineno="18-48"/>officer</amend> from another jurisdiction.</subsection></section></bsec><bsec buid="93" num="17-76-313" type="amend" src="code" uid="C17-76-S313_2026070120260701" sort="17 76 03130020260701" numlevel="1" lineno="636" slineno="19-1" sn="19"><section number="17-76-313" numlevel="1" lineno="637" slineno="19-2" type="amend"><secline lineno="636">Section 19. Section <bold>17-76-313</bold> is amended to read:</secline><catline lineno="637"><bold>17-76-313<parens/>. Temporary layoffs -- Reappointment register.</bold></catline><subsection ssid="93-null-1" dnum="1-o" numlevel="1" lineno="638" slineno="19-3" level="1" placement="noreturn"><display>(1)</display>Subject to Subsections <xref depth="4" refnumber="17-30a-311(2)" start="0">(2)</xref> and <xref depth="4" refnumber="17-30a-311(3)" start="0">(3)</xref>, and if necessary, because of lack of funds or work, a <ln numlevel="1" lineno="639" slineno="19-4"/>department may temporarily lay off a merit system officer.</subsection><subsection ssid="93-null-2" dnum="2-o" numlevel="1" lineno="640" slineno="19-5" level="1"><display>(2)</display>A department that lays off a merit system officer under Subsection <xref depth="4" refnumber="17-30a-311(1)" start="0">(1)</xref> shall lay off the <ln numlevel="1" lineno="641" slineno="19-6"/>merit system officer according to the seniority of the merit system officers of the class of <ln numlevel="1" lineno="642" slineno="19-7"/>positions affected, following the process prescribed by commission rule.</subsection><subsection ssid="93-null-3" dnum="3-o" numlevel="1" lineno="643" slineno="19-8" level="1"><display>(3)</display>A department shall lay off an individual serving under temporary or part-time <ln numlevel="1" lineno="644" slineno="19-9"/>appointment before a merit system officer.</subsection><subsection ssid="93-null-4" dnum="4-o" numlevel="1" lineno="645" slineno="19-10" level="1" space="false"><display>(4)</display><subsection ssid="93-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a merit system officer is laid off, the department shall place the merit system <ln numlevel="1" lineno="646" slineno="19-11"/>officer on an eligible reappointment register to be reappointed in the inverse order in <ln numlevel="1" lineno="647" slineno="19-12"/>which the <amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">merit system </amend>officer is laid off.</subsection><subsection ssid="93-null-6" dnum="b-o" numlevel="1" lineno="648" slineno="19-13" level="2"><display>(b)</display>The eligible reappointment register described in Subsection <xref depth="4" refnumber="17-30a-311(4)(a)" start="0">(4)(a)</xref> takes precedence <ln numlevel="1" lineno="649" slineno="19-14"/>over all other eligible reappointment registers.</subsection></subsection></section></bsec><bsec buid="148" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="650" slineno="20-1" sn="20"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="650">Section 20.  <bold>Effective Date.</bold></secline><sectionText lineno="651"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="7/1/2026">July 1, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-11-26 4:24 PM</tm></rev></foot></leg>
