Wilcox</sponsorhead><otherSponsorhead>Senate Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends requirements for providing health coverage and resources to first <ln numlevel="1" lineno="6" slineno="0-6"/>responders.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">amends eligibility requirements for the Volunteer Emergency Medical Service Personnel <ln numlevel="1" lineno="10" slineno="0-10"/>Insurance Program;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">requires the Department of Public Safety (department) to annually submit a report on first <ln numlevel="1" lineno="12" slineno="0-12"/>responder agencies' compliance with requirements to provide mental health resources to <ln numlevel="1" lineno="13" slineno="0-13"/>first responders and first responders' spouses to the:<hl numlevel="1" lineno="14" slineno="0-14" level="2">Law Enforcement and Criminal Justice Interim Committee; and</hl><hl numlevel="1" lineno="15" slineno="0-15" level="2">State Commission on Criminal and Juvenile Justice's public safety portal; </hl></hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">amends eligibility for receiving mental health resources for separated first responders and <ln numlevel="1" lineno="17" slineno="0-17"/>separated first responders' spouses;                </hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">creates the Mental Health Resources for First Responders Restricted Account (account) to <ln numlevel="1" lineno="19" slineno="0-19"/>provide funding for the department to provide certain mental health resources to eligible <ln numlevel="1" lineno="20" slineno="0-20"/>small first responder agencies;</hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">provides a sunset date for grants to first responder agencies;</hl><hl numlevel="1" lineno="22" slineno="0-22" level="1">defines terms; and</hl><hl numlevel="1" lineno="23" slineno="0-23" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="24" slineno="0-24" display="normal">Money Appropriated in this Bill:<fy fy="2027" ltid="2" seq="2027" numlevel="1" lineno="25" slineno="0-25"><ltcat ltid="3" seq="1">This bill appropriates <ltamt>($669,700)</ltamt> in operating and capital budgets for fiscal year 2027, <ln numlevel="1" lineno="26" slineno="0-26"/>including:<ltsrc ltid="2027.GEN.1000" seq="1" numlevel="1" lineno="27" slineno="0-27"><ltamt>($800,000)</ltamt> from General Fund; Volunteer Emergency <ln numlevel="1" lineno="49" slineno="1-3"/>Medical Service Personnel Insurance Program -- Creation -- Administration -- Eligibility <ln numlevel="1" lineno="50" slineno="1-4"/>-- Benefits -- Rulemaking -- Advisory board.</bold></catline><subsection ssid="19-null-1" dnum="1-o" numlevel="1" lineno="51" slineno="1-5" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="19-null-2" dnum="a-o" numlevel="1" lineno="52" slineno="1-6" level="2"><display>(a)</display><amend anum="0" ea="amend" pairid="37" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="both">"Assigned service area" means the operations subdivisions of a geographical service <ln numlevel="1" lineno="53" slineno="1-7"/>area that a local government entity creates based on the local government entity's <ln numlevel="1" lineno="54" slineno="1-8"/>emergency medical services operational needs.</amend></subsection><subsection ssid="19-61" dnum="_-o:b-i" numlevel="1" lineno="55" slineno="1-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>"Basic life insurance benefit" means the standard group life insurance benefit offered <ln numlevel="1" lineno="56" slineno="1-10"/>by PEHP that combines basic life, line-of-duty, accidental death and disability, and <ln numlevel="1" lineno="57" slineno="1-11"/>dependent coverage into one benefit package.</subsection><subsection ssid="19-null-3" dnum="b-o:c-i" numlevel="1" lineno="58" slineno="1-12" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1003" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>"Basic long-term disability benefit" means a $1,000 monthly benefit arising <ln numlevel="1" lineno="59" slineno="1-13"/>from a disability determined in accordance with Title 49, Chapter 21, Public <ln numlevel="1" lineno="60" slineno="1-14"/>Employees' Long-Term Disability Act, and excluding any coverage offered on a pilot <ln numlevel="1" lineno="61" slineno="1-15"/>basis.</subsection><subsection ssid="19-null-4" dnum="c-o:d-i" numlevel="1" lineno="62" slineno="1-16" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1004" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>"Dental plan" means the same as that term is defined in Section <xref depth="3" refnumber="31A-22-646">31A-22-646</xref>.</subsection><subsection ssid="19-55" dnum="_-o:e-i" numlevel="1" lineno="63" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">"Emergency medical services operations" means an emergency medical services <ln numlevel="1" lineno="64" slineno="1-18"/>provider's duties, as assigned by the local government entity, including:</amend><subsection ssid="19-56" dnum="_-o:i-i" numlevel="1" lineno="65" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">911 call response in the assigned service area;</amend></subsection><subsection ssid="19-57" dnum="_-o:ii-i" numlevel="1" lineno="66" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">standby services for regular operations or special events;</amend></subsection><subsection ssid="19-58" dnum="_-o:iii-i" numlevel="1" lineno="67" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">training; and</amend></subsection><subsection ssid="19-59" dnum="_-o:iv-i" numlevel="1" lineno="68" slineno="1-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">emergency medical services-related community engagement in the geographical <ln numlevel="1" lineno="69" slineno="1-23"/>service area.</amend></subsection></subsection><subsection ssid="19-60" dnum="_-o:f-i" numlevel="1" lineno="70" slineno="1-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">"Geographical service area" means a local government entity's jurisdiction.</amend></subsection><subsection ssid="19-null-5" dnum="d-o:g-i" numlevel="1" lineno="71" slineno="1-25" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1011" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>"Health benefit plan" means the same as that term is defined in Section <xref depth="3" refnumber="31A-1-301"><ln numlevel="1" lineno="72" slineno="1-26"/>31A-1-301</xref>.</subsection><subsection ssid="19-null-6" dnum="e-o:h-i" numlevel="1" lineno="73" slineno="1-27" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1012" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display>"Local government entity" means a political subdivision that:<subsection ssid="19-null-7" dnum="i-o" numlevel="1" lineno="74" slineno="1-28" level="3"><display>(i)</display>is licensed as a ground ambulance provider under Part 5, Ambulance and <ln numlevel="1" lineno="75" slineno="1-29"/>Paramedic Providers<amend anum="0" ea="amend" pairid="48" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> or a quick response provider as designated under <amend anum="0" ea="amend" pairid="49" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="both">Section </amend><xref depth="3" refnumber="53-2d-403"><ln numlevel="1" lineno="76" slineno="1-30"/>53-2d-403</xref>; and</subsection><subsection ssid="19-null-8" dnum="ii-o" numlevel="1" lineno="77" slineno="1-31" level="3"><display>(ii)</display>does not offer health insurance benefits to volunteer emergency medical service <ln numlevel="1" lineno="78" slineno="1-32"/>personnel.</subsection></subsection><subsection ssid="19-null-9" dnum="f-o:i-i" numlevel="1" lineno="79" slineno="1-33" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>"PEHP" means the Public Employees' Benefit and Insurance Program created in <ln numlevel="1" lineno="80" slineno="1-34"/>Section <xref depth="3" refnumber="49-20-103">49-20-103</xref>.</subsection><subsection ssid="19-null-10" dnum="g-o:j-i" numlevel="1" lineno="81" slineno="1-35" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both" space="true">(j)</amend></display>"Political subdivision" means a county, a municipality, a limited purpose <ln numlevel="1" lineno="82" slineno="1-36"/>government entity described in Title 17B, Limited Purpose Local Government <ln numlevel="1" lineno="83" slineno="1-37"/>Entities - Special Districts, or Title 17D, Limited Purpose Local Government Entities <ln numlevel="1" lineno="84" slineno="1-38"/>- Other Entities, or an entity created by an interlocal agreement under Title 11, <ln numlevel="1" lineno="85" slineno="1-39"/>Chapter 13, Interlocal Cooperation Act.</subsection><subsection ssid="19-null-11" dnum="h-o:k-i" numlevel="1" lineno="86" slineno="1-40" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(k)</amend></display>"Qualifying association" means an association that represents two or more <ln numlevel="1" lineno="87" slineno="1-41"/>political subdivisions in the state.</subsection><subsection ssid="19-null-12" dnum="i-o:l-i" numlevel="1" lineno="88" slineno="1-42" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1018" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="both" space="true">(l)</amend></display>"Qualifying community" means any of the following located in a county of the <ln numlevel="1" lineno="89" slineno="1-43"/>second class:<subsection ssid="19-null-13" dnum="i-o" numlevel="1" lineno="90" slineno="1-44" level="3"><display>(i)</display>a city of the fifth class; or</subsection><subsection ssid="19-null-14" dnum="ii-o" numlevel="1" lineno="91" slineno="1-45" level="3"><display>(ii)</display>a town.</subsection></subsection></subsection><subsection ssid="19-null-15" dnum="2-o" numlevel="1" lineno="92" slineno="1-46" level="1"><display>(2)</display>The Volunteer Emergency Medical Service Personnel Insurance Program shall promote <ln numlevel="1" lineno="93" slineno="1-47"/>recruitment and retention of volunteer emergency medical service personnel by making <ln numlevel="1" lineno="94" slineno="1-48"/>insurance available to volunteer emergency medical service personnel in accordance <ln numlevel="1" lineno="95" slineno="1-49"/>with this section.</subsection><subsection ssid="19-null-16" dnum="3-o" numlevel="1" lineno="96" slineno="1-50" level="1" space="false"><display>(3)</display><subsection ssid="19-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The bureau shall contract with a qualifying association to create, implement, and <ln numlevel="1" lineno="97" slineno="1-51"/>administer the Volunteer Emergency Medical Service Personnel Insurance Program <ln numlevel="1" lineno="98" slineno="1-52"/>described in this section.</subsection><subsection ssid="19-null-18" dnum="b-o" numlevel="1" lineno="99" slineno="1-53" level="2"><display>(b)</display>The qualifying association will create promotional campaigns for the Volunteer <ln numlevel="1" lineno="100" slineno="1-54"/>Emergency Medical Service Personnel Insurance Program and volunteer emergency <ln numlevel="1" lineno="101" slineno="1-55"/>medical service recruitment and retention including outreach to local government <ln numlevel="1" lineno="102" slineno="1-56"/>entities through social media, video production, and other media platforms.</subsection></subsection><subsection ssid="19-null-19" dnum="4-o" numlevel="1" lineno="103" slineno="1-57" level="1"><display>(4)</display>Participation in the program is limited to any individual who:<subsection ssid="19-null-20" dnum="a-o" numlevel="1" lineno="104" slineno="1-58" level="2"><display>(a)</display>is licensed under Section <xref depth="3" refnumber="53-2d-402">53-2d-402</xref> as an emergency medical technician, an <ln numlevel="1" lineno="105" slineno="1-59"/>advanced emergency medical technician, or a paramedic;</subsection><subsection ssid="19-null-21" dnum="b-o" numlevel="1" lineno="106" slineno="1-60" level="2"><display>(b)</display>is able to perform all necessary functions associated with the license;</subsection><subsection ssid="19-null-22" dnum="c-o" numlevel="1" lineno="107" slineno="1-61" level="2"><display>(c)</display>provides emergency medical services under the direction of a local governmental <ln numlevel="1" lineno="108" slineno="1-62"/>entity:<subsection ssid="19-null-23" dnum="i-o" numlevel="1" lineno="109" slineno="1-63" level="3"><display>(i)</display>by <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both">responding to 20% of calls for emergency medical services in</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="38" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">participating in <ln numlevel="1" lineno="110" slineno="1-64"/>at least 20% of emergency medical services operations during</amend> a rolling <ln numlevel="1" lineno="111" slineno="1-65"/>twelve-month period; and</subsection><subsection ssid="19-null-24" dnum="ii-o" numlevel="1" lineno="112" slineno="1-66" level="3"><display>(ii)</display>within a qualifying community or a county of the third, fourth, fifth, or sixth class<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="40" groupid="33" style="2" owner="jchristopherson" level="1" deltag="both"> <ln numlevel="1" lineno="113" slineno="1-67"/>by responding to the number of calls described in Subsection (4)(c)(i)</amend><amendoutend style="2"/>; and</subsection><subsection ssid="19-null-25" dnum="iii-o" numlevel="1" lineno="114" slineno="1-68" level="3" space="false"><display>(iii)</display><subsection ssid="19-null-26" dnum="A-o" level="4" placement="sameline"><display>(A)</display>as a volunteer under the Fair Labor Standards Act, in accordance with 29 <ln numlevel="1" lineno="115" slineno="1-69"/>C.F.R. Sec. 553.106; or</subsection><subsection ssid="19-null-27" dnum="B-o" numlevel="1" lineno="116" slineno="1-70" level="4"><display>(B)</display>as a part-time unbenefited employee, as classified by the employing local <ln numlevel="1" lineno="117" slineno="1-71"/>government entity;</subsection></subsection></subsection><subsection ssid="19-null-28" dnum="d-o" numlevel="1" lineno="118" slineno="1-72" level="2"><display>(d)</display>if seeking health insurance:<subsection ssid="19-null-29" dnum="i-o" numlevel="1" lineno="119" slineno="1-73" level="3" space="false"><display>(i)</display><subsection ssid="19-null-30" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is not eligible for a health benefit plan through an employer or a spouse's <ln numlevel="1" lineno="120" slineno="1-74"/>employer; and</subsection><subsection ssid="19-null-31" dnum="B-o" numlevel="1" lineno="121" slineno="1-75" level="4"><display>(B)</display>is not eligible for medical coverage under a government sponsored healthcare <ln numlevel="1" lineno="122" slineno="1-76"/>program; or</subsection></subsection><subsection ssid="19-null-32" dnum="ii-o" numlevel="1" lineno="123" slineno="1-77" level="3"><display>(ii)</display>the individual's premium cost for individual, double, or family coverage through <ln numlevel="1" lineno="124" slineno="1-78"/>another source exceeds 20% or greater of the premium cost of the program created <ln numlevel="1" lineno="125" slineno="1-79"/>by this section;</subsection></subsection><subsection ssid="19-null-33" dnum="e-o" numlevel="1" lineno="126" slineno="1-80" level="2"><display>(e)</display>if seeking dental insurance:<subsection ssid="19-null-34" dnum="i-o" numlevel="1" lineno="127" slineno="1-81" level="3" space="false"><display>(i)</display><subsection ssid="19-null-35" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is not eligible for a dental plan through an employer or a spouse's employer; <ln numlevel="1" lineno="128" slineno="1-82"/>and</subsection><subsection ssid="19-null-36" dnum="B-o" numlevel="1" lineno="129" slineno="1-83" level="4"><display>(B)</display>is not eligible for dental coverage under a government sponsored healthcare <ln numlevel="1" lineno="130" slineno="1-84"/>program; or</subsection></subsection><subsection ssid="19-null-37" dnum="ii-o" numlevel="1" lineno="131" slineno="1-85" level="3"><display>(ii)</display>the individual's premium cost for individual, double, or family coverage exceeds <ln numlevel="1" lineno="132" slineno="1-86"/>20% or greater of the premium cost of the program created by this section; and</subsection></subsection><subsection ssid="19-null-38" dnum="f-o" numlevel="1" lineno="133" slineno="1-87" level="2"><display>(f)</display>resides in the state.</subsection></subsection><subsection ssid="19-null-39" dnum="5-o" numlevel="1" lineno="134" slineno="1-88" level="1" space="false"><display>(5)</display><subsection ssid="19-null-40" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A participant in the program is eligible to participate in PEHP in accordance with <ln numlevel="1" lineno="135" slineno="1-89"/>Subsection <xref depth="4" refnumber="53-2d-703(5)(b)">(5)(b)</xref> and Subsection <xref depth="4" refnumber="49-20-201(3)">49-20-201(3)</xref>.</subsection><subsection ssid="19-null-41" dnum="b-o" numlevel="1" lineno="136" slineno="1-90" level="2"><display>(b)</display>Health and dental benefits available to program participants under PEHP are limited <ln numlevel="1" lineno="137" slineno="1-91"/>to health insurance and dental insurance that:<subsection ssid="19-null-42" dnum="i-o" numlevel="1" lineno="138" slineno="1-92" level="3"><display>(i)</display>covers the program participant and the program participant's eligible dependents <ln numlevel="1" lineno="139" slineno="1-93"/>on a July 1 plan year;</subsection><subsection ssid="19-null-43" dnum="ii-o" numlevel="1" lineno="140" slineno="1-94" level="3"><display>(ii)</display>accepts enrollment during an open enrollment period or for a special enrollment <ln numlevel="1" lineno="141" slineno="1-95"/>event, including the initial eligibility of a program participant;</subsection><subsection ssid="19-null-44" dnum="iii-o" numlevel="1" lineno="142" slineno="1-96" level="3"><display>(iii)</display>if the program participant is no longer eligible for benefits, terminates on the last <ln numlevel="1" lineno="143" slineno="1-97"/>day of the last month for which the individual is a participant in the Volunteer <ln numlevel="1" lineno="144" slineno="1-98"/>Emergency Medical Service Personnel Insurance Program; and</subsection><subsection ssid="19-null-45" dnum="iv-o" numlevel="1" lineno="145" slineno="1-99" level="3"><display>(iv)</display>is not subject to continuation rights under state or federal law.</subsection></subsection><subsection ssid="19-null-46" dnum="c-o" numlevel="1" lineno="146" slineno="1-100" level="2"><display>(c)</display>Within existing appropriations, the Volunteer Emergency Medical Service Personnel <ln numlevel="1" lineno="147" slineno="1-101"/>Insurance Program may offer basic life insurance and long-term disability insurance <ln numlevel="1" lineno="148" slineno="1-102"/>to participants to enhance recruitment and retention efforts.</subsection></subsection><subsection ssid="19-null-47" dnum="6-o" numlevel="1" lineno="149" slineno="1-103" level="1" space="false"><display>(6)</display><subsection ssid="19-null-48" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The bureau may make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="150" slineno="1-104"/>Administrative Rulemaking Act, to define additional criteria regarding benefit <ln numlevel="1" lineno="151" slineno="1-105"/>design, eligibility for the program, and to implement this section.</subsection><subsection ssid="19-null-49" dnum="b-o" numlevel="1" lineno="152" slineno="1-106" level="2"><display>(b)</display>The bureau shall convene an advisory board:<subsection ssid="19-null-50" dnum="i-o" numlevel="1" lineno="153" slineno="1-107" level="3"><display>(i)</display>to advise the bureau on making rules under Subsection <xref depth="4" refnumber="53-2d-703(6)(a)">(6)(a)</xref>; and</subsection><subsection ssid="19-null-51" dnum="ii-o" numlevel="1" lineno="154" slineno="1-108" level="3"><display>(ii)</display>that includes representation from at least the following entities:<subsection ssid="19-null-52" dnum="A-o" numlevel="1" lineno="155" slineno="1-109" level="4"><display>(A)</display>the qualifying association that receives the contract under Subsection <xref depth="4" refnumber="53-2d-703(3)">(3)</xref>; and</subsection><subsection ssid="19-null-53" dnum="B-o" numlevel="1" lineno="156" slineno="1-110" level="4"><display>(B)</display>PEHP.</subsection></subsection></subsection></subsection><subsection ssid="19-null-54" dnum="7-o" numlevel="1" lineno="157" slineno="1-111" level="1"><display>(7)</display>For purposes of this section, the qualifying association that receives the contract under <ln numlevel="1" lineno="158" slineno="1-112"/>Subsection <xref depth="4" refnumber="53-2d-703(3)">(3)</xref> shall be considered the public agency for whom the program participant <ln numlevel="1" lineno="159" slineno="1-113"/>is volunteering under 29 C.F.R. Sec. 553.101.</subsection></section></bsec><bsec buid="13" num="53-21-101" type="amend" src="code" uid="C53-21-S101_2026070120260701" sort="53 21 01010020260701" numlevel="1" lineno="160" slineno="2-1" sn="2"><section number="53-21-101" numlevel="1" lineno="161" slineno="2-2" type="amend"><secline lineno="160">Section 2. Section <bold>53-21-101</bold> is amended to read:</secline><catline lineno="161"><bold>53-21-101<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/26</date></paren></parens>. Definitions.</bold></catline><sectionText lineno="162"><tab/>As used in this chapter:</sectionText><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="163" slineno="2-4" level="1"><display>(1)</display>"Crime scene investigator technician" means an individual employed by a law <ln numlevel="1" lineno="164" slineno="2-5"/>enforcement agency to collect and analyze evidence from crime scenes and <ln numlevel="1" lineno="165" slineno="2-6"/>crime-related incidents.</subsection><subsection ssid="13-null-2" dnum="2-o" numlevel="1" lineno="166" slineno="2-7" level="1"><display>(2)</display>"Designated mental health resources liaison" means a non-leadership human resources <ln numlevel="1" lineno="167" slineno="2-8"/>or other administrative employee designated by a first responder agency who receives <ln numlevel="1" lineno="168" slineno="2-9"/>and processes a request for mental health resources on behalf of the first responder <ln numlevel="1" lineno="169" slineno="2-10"/>agency under this chapter.</subsection><subsection ssid="13-null-3" dnum="3-o" numlevel="1" lineno="170" slineno="2-11" level="1"><display>(3)</display>"First responder" means:<subsection ssid="13-null-4" dnum="a-o" numlevel="1" lineno="171" slineno="2-12" level="2"><display>(a)</display>a law enforcement officer, as defined in Section <xref depth="3" refnumber="53-13-103">53-13-103</xref>;</subsection><subsection ssid="13-null-5" dnum="b-o" numlevel="1" lineno="172" slineno="2-13" level="2"><display>(b)</display>an emergency medical technician, as defined in Section <xref depth="3" refnumber="53-2e-101">53-2e-101</xref>;</subsection><subsection ssid="13-null-6" dnum="c-o" numlevel="1" lineno="173" slineno="2-14" level="2"><display>(c)</display>an advanced emergency medical technician, as defined in Section <xref depth="3" refnumber="53-2e-101">53-2e-101</xref>;</subsection><subsection ssid="13-null-7" dnum="d-o" numlevel="1" lineno="174" slineno="2-15" level="2"><display>(d)</display>a paramedic, as defined in Section <xref depth="3" refnumber="53-2e-101">53-2e-101</xref>;</subsection><subsection ssid="13-null-8" dnum="e-o" numlevel="1" lineno="175" slineno="2-16" level="2"><display>(e)</display>a firefighter, as defined in Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="3" refnumber="34A-3-113">34A-3-113</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="3" refnumber="34A-3-101">34A-3-101</xref></amend>;</subsection><subsection ssid="13-null-9" dnum="f-o" numlevel="1" lineno="176" slineno="2-17" level="2"><display>(f)</display>a dispatcher, as defined in Section <xref depth="3" refnumber="53-6-102">53-6-102</xref>;</subsection><subsection ssid="13-null-10" dnum="g-o" numlevel="1" lineno="177" slineno="2-18" level="2"><display>(g)</display>a correctional officer, as defined in Section <xref depth="3" refnumber="53-13-104">53-13-104</xref>;</subsection><subsection ssid="13-null-11" dnum="h-o" numlevel="1" lineno="178" slineno="2-19" level="2"><display>(h)</display>a special function officer, as defined in Section <xref depth="3" refnumber="53-13-105">53-13-105</xref>, employed by a local <ln numlevel="1" lineno="179" slineno="2-20"/>sheriff;</subsection><subsection ssid="13-null-12" dnum="i-o" numlevel="1" lineno="180" slineno="2-21" level="2"><display>(i)</display>a search and rescue worker under the supervision of a local sheriff;</subsection><subsection ssid="13-null-13" dnum="j-o" numlevel="1" lineno="181" slineno="2-22" level="2"><display>(j)</display>a forensic interviewer or victim advocate employed by a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">children's justice center</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="182" slineno="2-23"/>Children's Justice Center</amend> established in accordance with Section <xref depth="3" refnumber="67-5b-102">67-5b-102</xref>;</subsection><subsection ssid="13-null-14" dnum="k-o" numlevel="1" lineno="183" slineno="2-24" level="2"><display>(k)</display>a credentialed criminal justice system victim advocate as defined in Section <xref depth="3" refnumber="77-38-403"><ln numlevel="1" lineno="184" slineno="2-25"/>77-38-403</xref> who responds to incidents with a law enforcement officer;</subsection><subsection ssid="13-null-15" dnum="l-o" numlevel="1" lineno="185" slineno="2-26" level="2"><display>(l)</display>a crime scene investigator technician;</subsection><subsection ssid="13-null-16" dnum="m-o" numlevel="1" lineno="186" slineno="2-27" level="2"><display>(m)</display>a wildland firefighter;</subsection><subsection ssid="13-null-17" dnum="n-o" numlevel="1" lineno="187" slineno="2-28" level="2"><display>(n)</display>an investigator or prosecutor of cases involving sexual crimes against children; or</subsection><subsection ssid="13-null-18" dnum="o-o" numlevel="1" lineno="188" slineno="2-29" level="2"><display>(o)</display>a civilian employee of a first responder agency who has been authorized to view or <ln numlevel="1" lineno="189" slineno="2-30"/>otherwise access information concerning crimes, accidents, or other traumatic events.</subsection></subsection><subsection ssid="13-null-19" dnum="4-o" numlevel="1" lineno="190" slineno="2-31" level="1"><display>(4)</display>"First responder agency" means:<subsection ssid="13-null-20" dnum="a-o" numlevel="1" lineno="191" slineno="2-32" level="2"><display>(a)</display>a special district, municipality, interlocal entity, or other political subdivision that <ln numlevel="1" lineno="192" slineno="2-33"/>employs a first responder to provide fire protection, paramedic, law enforcement, or <ln numlevel="1" lineno="193" slineno="2-34"/>emergency services; or</subsection><subsection ssid="13-null-21" dnum="b-o" numlevel="1" lineno="194" slineno="2-35" level="2"><display>(b)</display>a certified private law enforcement agency as defined in Section <xref depth="3" refnumber="53-19-102">53-19-102</xref>.</subsection></subsection><subsection ssid="13-null-22" dnum="5-o" numlevel="1" lineno="195" slineno="2-36" level="1" space="false"><display>(5)</display><subsection ssid="13-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Mental health resources" means:<subsection ssid="13-null-24" dnum="i-o" numlevel="1" lineno="196" slineno="2-37" level="3" tab="1"><display>(i)</display>an assessment to determine appropriate mental health treatment that is performed <ln numlevel="1" lineno="197" slineno="2-38"/>by a mental health therapist;</subsection><subsection ssid="13-null-25" dnum="ii-o" numlevel="1" lineno="198" slineno="2-39" level="3" tab="1"><display>(ii)</display>outpatient mental health treatment provided by a mental health therapist; or</subsection><subsection ssid="13-null-26" dnum="iii-o" numlevel="1" lineno="199" slineno="2-40" level="3" tab="1"><display>(iii)</display>peer support services provided by a peer support specialist who is qualified to <ln numlevel="1" lineno="200" slineno="2-41"/>provide peer support services under Subsection <xref depth="4" refnumber="26B-5-102(2)(gg)">26B-5-102(2)(gg)</xref>.</subsection></subsection><subsection ssid="13-null-27" dnum="b-o" numlevel="1" lineno="201" slineno="2-42" level="2"><display>(b)</display>"Mental health resources" includes, at a minimum, the following services:<subsection ssid="13-null-28" dnum="i-o" numlevel="1" lineno="202" slineno="2-43" level="3"><display>(i)</display>regular periodic screenings for all employees within the first responder agency;</subsection><subsection ssid="13-null-29" dnum="ii-o" numlevel="1" lineno="203" slineno="2-44" level="3"><display>(ii)</display>assessments and availability to mental health services for personnel directly <ln numlevel="1" lineno="204" slineno="2-45"/>involved in a critical incident within 48 hours of the incident; and</subsection><subsection ssid="13-null-30" dnum="iii-o" numlevel="1" lineno="205" slineno="2-46" level="3"><display>(iii)</display>regular and continuing access to the mental health program for:<subsection ssid="13-null-31" dnum="A-o" numlevel="1" lineno="206" slineno="2-47" level="4"><display>(A)</display>spouses and children of first responders;</subsection><subsection ssid="13-null-32" dnum="B-o" numlevel="1" lineno="207" slineno="2-48" level="4"><display>(B)</display>first responders who have retired or separated from the agency; and</subsection><subsection ssid="13-null-33" dnum="C-o" numlevel="1" lineno="208" slineno="2-49" level="4"><display>(C)</display>spouses of first responders who have retired or separated from the agency.</subsection></subsection></subsection></subsection><subsection ssid="13-null-34" dnum="6-o" numlevel="1" lineno="209" slineno="2-50" level="1"><display>(6)</display>"Mental health therapist" means the same as that term is defined in Section <xref depth="3" refnumber="58-60-102">58-60-102</xref>.</subsection><subsection ssid="13-null-35" dnum="7-o" numlevel="1" lineno="210" slineno="2-51" level="1"><display>(7)</display>"Plan" means a plan to implement or expand a program that provides mental health <ln numlevel="1" lineno="211" slineno="2-52"/>resources to first responders for which the division awards a grant under this chapter.</subsection><subsection ssid="13-null-36" dnum="8-o" numlevel="1" lineno="212" slineno="2-53" level="1"><display>(8)</display>"Retired" means the status of an individual who has become eligible, applies for, and <ln numlevel="1" lineno="213" slineno="2-54"/>may receive an allowance under Title 49, Utah State Retirement and Insurance Benefit <ln numlevel="1" lineno="214" slineno="2-55"/>Act.</subsection><subsection ssid="13-null-37" dnum="9-o" numlevel="1" lineno="215" slineno="2-56" level="1"><display>(9)</display>"Separated" means the status of an individual who has separated from employment as a <ln numlevel="1" lineno="216" slineno="2-57"/>first responder from a first responder agency<amend anum="0" ea="amend" pairid="17" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both">, except</amend> as a result of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">a critical incident <ln numlevel="1" lineno="217" slineno="2-58"/>involving the first responder</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">misconduct or disciplinary action</amend>.</subsection><subsection ssid="13-null-38" dnum="10-o" numlevel="1" lineno="218" slineno="2-59" level="1"><display>(10)</display>"Small first responder agency" means a first responder agency that:<subsection ssid="13-null-39" dnum="a-o" numlevel="1" lineno="219" slineno="2-60" level="2"><display>(a)</display>has 10 or fewer employees;</subsection><subsection ssid="13-null-40" dnum="b-o" numlevel="1" lineno="220" slineno="2-61" level="2"><display>(b)</display>is primarily staffed by volunteers; or</subsection><subsection ssid="13-null-41" dnum="c-o" numlevel="1" lineno="221" slineno="2-62" level="2"><display>(c)</display>is located in:<subsection ssid="13-null-42" dnum="i-o" numlevel="1" lineno="222" slineno="2-63" level="3"><display>(i)</display>a county of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">third, fourth, fifth,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">fifth</amend> or sixth class;</subsection><subsection ssid="13-null-43" dnum="ii-o" Mental health services -- Requirement to provide  <ln numlevel="1" lineno="227" slineno="3-3"/>-- Eligibility -- Confidentiality -- Requests -- Reporting noncompliance -- Designation.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="228" slineno="3-4" level="1" placement="noreturn"><display>(1)</display><amend anum="0" ea="amend" pairid="35" groupid="26" style="1" owner="jchristopherson" level="1" m-anum="0" m-ea="amend" m-pairid="42" m-groupid="31" m-style="1" m-owner="jchristopherson" m-level="1" amendtag="both">As used in this section, "public safety portal" means the data portal created in Section <xref depth="3" refnumber="63A-16-1002"><ln numlevel="1" lineno="229" slineno="3-5"/>63A-16-1002</xref>.</amend></subsection><subsection ssid="3-25" dnum="_-o:2-i" numlevel="1" lineno="230" slineno="3-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="i" level="1" amendtag="both">(2)</amend></display>Every first responder agency within the state shall provide or make available mental <ln numlevel="1" lineno="231" slineno="3-7"/>health resources to:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="232" slineno="3-8" level="2"><display>(a)</display>all first responders;</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="233" slineno="3-9" level="2"><display>(b)</display>the spouse and children of first responders;</subsection><subsection ssid="3-null-4" dnum="c-o" numlevel="1" lineno="234" slineno="3-10" level="2"><display>(c)</display>surviving spouses of first responders whose death is classified as a line-of-duty death <ln numlevel="1" lineno="235" slineno="3-11"/>under Title 49, Utah State Retirement and Insurance Benefit Act;</subsection><subsection ssid="3-null-5" dnum="d-o" numlevel="1" lineno="236" slineno="3-12" level="2"><display>(d)</display>retired or separated first responders for at least three years from the date that the <ln numlevel="1" lineno="237" slineno="3-13"/>retired or separated first responder requests mental health resources, regardless of any <ln numlevel="1" lineno="238" slineno="3-14"/>subsequent employment as a non-first responder; and</subsection><subsection ssid="3-null-6" dnum="e-o" numlevel="1" lineno="239" slineno="3-15" level="2"><display>(e)</display>spouses of retired or separated first responders for at least three years from the date <ln numlevel="1" lineno="240" slineno="3-16"/>that the spouse of the retired or separated first responder requests mental health <ln numlevel="1" lineno="241" slineno="3-17"/>resources, regardless of any subsequent employment as a non-first responder.</subsection></subsection><subsection ssid="3-null-7" dnum="2-o:3-i" numlevel="1" lineno="242" slineno="3-18" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1112" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1113" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>All access by first responders and their families to mental health resources shall be <ln numlevel="1" lineno="243" slineno="3-19"/>kept confidential.</subsection><subsection ssid="3-null-8" dnum="3-o:4-i" numlevel="1" lineno="244" slineno="3-20" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1113" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1114" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>A first responder agency shall:<subsection ssid="3-null-9" dnum="a-o" numlevel="1" lineno="245" slineno="3-21" level="2"><display>(a)</display>annually provide information to all employed first responders regarding:<subsection ssid="3-null-10" dnum="i-o" numlevel="1" lineno="246" slineno="3-22" level="3"><display>(i)</display>the availability of mental health resources under this section, including:<subsection ssid="3-null-11" dnum="A-o" numlevel="1" lineno="247" slineno="3-23" level="4"><display>(A)</display>for individuals in addition to the first responders as described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="45" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="53-21-102(2)"><ln numlevel="1" lineno="248" slineno="3-24"/>(1)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="44" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="(2)" depth="4">(2)</xref></amend>; and</subsection><subsection ssid="3-null-12" dnum="B-o" numlevel="1" lineno="249" slineno="3-25" level="4"><display>(B)</display>subsequent to a separation or retirement;</subsection></subsection><subsection ssid="3-null-13" dnum="ii-o" numlevel="1" lineno="250" slineno="3-26" level="3"><display>(ii)</display>how to access the mental health resources under this section; and</subsection><subsection ssid="3-null-14" dnum="iii-o" numlevel="1" lineno="251" slineno="3-27" level="3"><display>(iii)</display>directions on how to appeal a denial of mental health resources under this section <ln numlevel="1" lineno="252" slineno="3-28"/>to the department, as provided under Section <xref depth="3" refnumber="53-21-104.3">53-21-104.3</xref>; and</subsection></subsection><subsection ssid="3-null-15" dnum="b-o" numlevel="1" lineno="253" slineno="3-29" level="2" space="false"><display>(b)</display><subsection ssid="3-null-16" dnum="i-o" level="3" placement="sameline"><display>(i)</display>assign a designated mental health resources liaison;</subsection><subsection ssid="3-null-17" dnum="ii-o" numlevel="1" lineno="254" slineno="3-30" level="3"><display>(ii)</display>inform the department of the identity of the designated mental health resources <ln numlevel="1" lineno="255" slineno="3-31"/>liaison; and</subsection><subsection ssid="3-null-18" dnum="iii-o" numlevel="1" lineno="256" slineno="3-32" level="3"><display>(iii)</display>update the department as to the identity of the designated mental health resources <ln numlevel="1" lineno="257" slineno="3-33"/>liaison when a new individual is assigned.</subsection></subsection></subsection><subsection ssid="3-21" dnum="_-o:5-i" numlevel="1" lineno="258" slineno="3-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="3-22" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline" space="false"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1">(a)</amend></display><subsection ssid="3-39" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall annually submit a report to the Law Enforcement and <ln numlevel="1" lineno="259" slineno="3-35"/>Criminal Justice Interim Committee, on or before the date of the committee's <ln numlevel="1" lineno="260" slineno="3-36"/>November meeting, on first responder agencies' compliance with this section.</amend></subsection><subsection ssid="3-40" dnum="_-o:ii-i" numlevel="1" lineno="261" slineno="3-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">The department may fulfill the requirement described in Subsection <xref depth="4" refnumber="53-21-102(5)(a)(i)">(5)(a)(i)</xref> by <ln numlevel="1" lineno="262" slineno="3-38"/>conducting a survey of first responder agencies and reporting the first responder <ln numlevel="1" lineno="263" slineno="3-39"/>agencies' responses related to the first responder agencies' compliance with this <ln numlevel="1" lineno="264" slineno="3-40"/>section.</amend></subsection></subsection><subsection ssid="3-23" dnum="_-o:b-i" numlevel="1" lineno="265" slineno="3-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall submit a copy of the report described in Subsection <xref depth="4" refnumber="53-21-102(5)(a)">(5)(a)</xref> to <ln numlevel="1" lineno="266" slineno="3-42"/>the public safety portal as described in Section <xref depth="3" refnumber="63A-16-1002">63A-16-1002</xref>.</amend></subsection></subsection></section></bsec><bsec buid="10" num="53-21-104.1" type="amend" src="code" uid="C53-21-S104.1_2026070120260701" sort="53 21 01040120260701" numlevel="1" lineno="267" slineno="4-1" sn="4"><section number="53-21-104.1" numlevel="1" lineno="268" slineno="4-2" type="amend"><secline lineno="267">Section 4. slineno="4-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="10-11" dnum="_-o:a-i" numlevel="1" lineno="271" slineno="4-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1130" style="1" Health Resources for First Responders Restricted <ln numlevel="1" lineno="272" slineno="4-6"/>Account created in Section <xref depth="3" refnumber="53-21-105">53-21-105</xref>.</amend></subsection><subsection ssid="10-10" dnum="_-o:b-i" numlevel="1" lineno="273" slineno="4-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1131" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">"Eligible first responder agency" means a small first responder agency that <ln numlevel="1" lineno="274" slineno="4-8"/>contributes funds to the account in accordance with Section <xref depth="3" refnumber="53-21-105">53-21-105</xref>.</amend></subsection></subsection><subsection ssid="10-null-1" dnum="1-o:2-i" numlevel="1" lineno="275" slineno="4-9" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1132" style="2" owner="o" level="1" deltag="both">(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1133" style="1" owner="i" level="1" amendtag="both" space="true">(2)</amend></display><subsection ssid="10-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">Subsection (4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsection <marker pairid="51"/><xref depth="4" refnumber="53-21-104.1(5)">(5)</xref></amend>, the department may, at <ln numlevel="1" lineno="276" slineno="4-10"/>the department's discretion, provide certain mental health resources to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">a small</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an <ln numlevel="1" lineno="277" slineno="4-11"/>eligible</amend> first responder agency.</subsection><subsection ssid="10-null-3" dnum="b-o" numlevel="1" lineno="278" slineno="4-12" level="2"><display>(b)</display>The mental health resources described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="53-21-104.1(1)(a)">(1)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)(a)</amend> may include an <ln numlevel="1" lineno="279" slineno="4-13"/>assessment and availability to mental health services for personnel directly involved <ln numlevel="1" lineno="280" slineno="4-14"/>in a critical incident within 48 hours of the incident.</subsection></subsection><subsection ssid="10-null-4" dnum="2-o:3-i" numlevel="1" lineno="281" slineno="4-15" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1135" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1136" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>The department may use a contracted provider to provide the services described in <ln numlevel="1" lineno="282" slineno="4-16"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="53-21-104.1(1)">(1)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)</amend>.</subsection><subsection ssid="10-null-5" dnum="3-o:4-i" numlevel="1" lineno="283" slineno="4-17" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1136" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1137" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>If <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="33" style="2" owner="jchristopherson" level="1" deltag="both">a small</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="33" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an eligible</amend> first responder agency elects to receive mental health services <ln numlevel="1" lineno="284" slineno="4-18"/>as provided under this section, the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">small</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="34" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">eligible</amend> first responder agency shall designate <ln numlevel="1" lineno="285" slineno="4-19"/>a representative of the small first responder agency who is responsible for providing a <ln numlevel="1" lineno="286" slineno="4-20"/>timely notification to the department or the department's designee if a critical incident <ln numlevel="1" lineno="287" slineno="4-21"/>occurs as described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="44" groupid="38" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="53-21-104.1(1)(b)">(1)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="43" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)(b)</amend>.</subsection><subsection ssid="10-null-6" dnum="4-o:5-i" numlevel="1" lineno="288" slineno="4-22" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1137" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="start" space="true">(5)</amend></display><subsection ssid="10-12" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="end">(a)</amend></display>As provided in Subsection <xref depth="4" refnumber="53-21-103(10)">53-21-103(10)</xref>, the department may use up to 25% <ln numlevel="1" lineno="289" slineno="4-23"/>of the remaining grant funds for the mental health resources described in this section<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="49" groupid="42" style="2" owner="jchristopherson" level="1" deltag="both">, <ln numlevel="1" lineno="290" slineno="4-24"/>and may discontinue the mental health resources once the available grant funding is <ln numlevel="1" lineno="291" slineno="4-25"/>depleted</amend><amendoutend style="2"/>.</subsection><subsection ssid="10-7" dnum="_-o:b-i" numlevel="1" lineno="292" slineno="4-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">The department may:</amend><subsection ssid="10-13" dnum="_-o:i-i" numlevel="1" lineno="293" slineno="4-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">use funds in the account for the mental health resources described in this section <ln numlevel="1" lineno="294" slineno="4-28"/>and for administrative support related to providing the mental health resources; <ln numlevel="1" lineno="295" slineno="4-29"/>and </amend></subsection><subsection ssid="10-14" dnum="_-o:ii-i" numlevel="1" lineno="296" slineno="4-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">may discontinue the mental health resources if there are insufficient funds in the <ln numlevel="1" lineno="297" slineno="4-31"/>account.</amend></subsection></subsection></subsection></section></bsec><bsec buid="28" num="53-21-104.3" type="amend" src="code" uid="C53-21-S104.3_2026050620260506" sort="53 21 01040320260506" numlevel="1" lineno="298" slineno="5-1" sn="5"><section number="53-21-104.3" numlevel="1" lineno="299" slineno="5-2" type="amend"><secline lineno="298">Section 5. Section <bold>53-21-104.3</bold> is amended to read:</secline><catline lineno="299"><bold>53-21-104.3<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Education -- Complaints -- Investigations.</bold></catline><subsection ssid="28-null-1" dnum="1-o" numlevel="1" lineno="300" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>On or before September 1, 2024, the department shall inform all first responder <ln numlevel="1" lineno="301" slineno="5-4"/>agencies in the state of the requirements described in Section <xref depth="3" refnumber="53-21-102">53-21-102</xref>.</subsection><subsection ssid="28-null-2" dnum="2-o" numlevel="1" lineno="302" slineno="5-5" level="1"><display>(2)</display>In addition to the notification required under Subsection <xref depth="4" refnumber="53-21-104.3(1)">(1)</xref>, the department shall, on <ln numlevel="1" lineno="303" slineno="5-6"/>the department's website, provide information describing:<subsection ssid="28-null-3" dnum="a-o" numlevel="1" lineno="304" slineno="5-7" level="2"><display>(a)</display>an individual's eligibility for mental health resources under Section <xref depth="3" refnumber="53-21-102">53-21-102</xref>;</subsection><subsection ssid="28-null-4" dnum="b-o" numlevel="1" lineno="305" slineno="5-8" level="2"><display>(b)</display>the statutory definition for mental health resources provided in Section <xref depth="3" refnumber="53-21-101">53-21-101</xref>;</subsection><subsection ssid="28-null-5" dnum="c-o" numlevel="1" lineno="306" slineno="5-9" level="2"><display>(c)</display>the designated mental health resources liaison for each first responder agency as <ln numlevel="1" lineno="307" slineno="5-10"/>described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">53-21-102(3)(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="53-21-102(4)(b)">53-21-102(4)(b)</xref></amend>; and</subsection><subsection ssid="28-null-6" dnum="d-o" numlevel="1" lineno="308" slineno="5-11" level="2"><display>(d)</display>how to appeal a denial of mental health resources to the department.</subsection></subsection><subsection ssid="28-null-7" dnum="3-o" numlevel="1" lineno="309" slineno="5-12" level="1" space="false"><display>(3)</display><subsection ssid="28-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department shall investigate a denial of mental health resources that is <ln numlevel="1" lineno="310" slineno="5-13"/>received under Subsection <xref depth="4" refnumber="53-21-104.3(2)(d)">(2)(d)</xref> to determine whether the denial was in violation of <ln numlevel="1" lineno="311" slineno="5-14"/>this chapter.</subsection><subsection ssid="28-null-9" dnum="b-o" numlevel="1" lineno="312" slineno="5-15" level="2"><display>(b)</display>If, after an investigation, the department determines that a first responder agency <ln numlevel="1" lineno="313" slineno="5-16"/>improperly denied mental health resources in violation of this chapter, the department <ln numlevel="1" lineno="314" slineno="5-17"/>shall notify the first responder agency and provide 60 days for the first responder <ln numlevel="1" lineno="315" slineno="5-18"/>agency to correct the improper denial.</subsection><subsection ssid="28-null-10" dnum="c-o" numlevel="1" lineno="316" slineno="5-19" level="2"><display>(c)</display>The department shall determine whether a first responder agency has cured the <ln numlevel="1" lineno="317" slineno="5-20"/>violation within the time described in Subsection <xref depth="4" refnumber="53-21-104.3(3)(b)">(3)(b)</xref> and, if the first responder <ln numlevel="1" lineno="318" slineno="5-21"/>agency has not, the department shall send a letter within a reasonable time identifying <ln numlevel="1" lineno="319" slineno="5-22"/>the first responder agency and the relevant details of the department's investigation to:<subsection ssid="28-null-11" dnum="i-o" numlevel="1" lineno="320" slineno="5-23" level="3"><display>(i)</display>the commissioner;</subsection><subsection ssid="28-null-12" dnum="ii-o" numlevel="1" lineno="321" slineno="5-24" level="3"><display>(ii)</display>the chairs of the Law Enforcement and Criminal Justice Interim Committee; and</subsection><subsection ssid="28-null-13" dnum="iii-o" numlevel="1" lineno="322" slineno="5-25" level="3"><display>(iii)</display>the director of the State Commission on Criminal and Juvenile Justice, who shall <ln numlevel="1" lineno="323" slineno="5-26"/>refer the matter for investigation under Section <xref depth="3" refnumber="63M-7-204">63M-7-204</xref> and may restrict state <ln numlevel="1" lineno="324" slineno="5-27"/>grant money under Section <xref depth="3" refnumber="63M-7-218">63M-7-218</xref>.</subsection></subsection></subsection></section></bsec><bsec buid="5" num="53-21-105" type="enact" src="code" uid="C53-21-S105_2026070120260701" sort="53 21 01050020260701" numlevel="1" lineno="325" slineno="6-1" sn="6"><section numlevel="1" lineno="326" slineno="6-2" number="53-21-105" type="enact"><secline lineno="325">Section 6. Account."</amend></subsection><subsection ssid="5-4" dnum="_-o:3-i" numlevel="1" lineno="336" slineno="6-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">The account consists of:</amend><subsection ssid="5-5" dnum="_-o:a-i" numlevel="1" lineno="337" slineno="6-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1161" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="21" style="1" style="1" owner="jchristopherson" level="1" amendtag="end">If a small first responder agency contributes to the account, the small first responder <ln numlevel="1" lineno="347" slineno="6-23"/>agency shall contribute to the account as described in this section.</amend></subsection></subsection><subsection ssid="5-47" dnum="_-o:6-i" numlevel="1" lineno="348" slineno="6-24" ea="amend" anum="0" amendtag="end">The department shall make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="352" slineno="6-28"/>Administrative Rulemaking Act, for:</amend><subsection
