Section <bold>58-55-102</bold> is amended to read:</secline><catline lineno="26"><bold>58-55-102<parens/>. Definitions.</bold></catline><sectionText lineno="27"><tab/>In addition to the definitions in Section <xref depth="3" refnumber="58-1-102">58-1-102</xref>, as used in this chapter:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="28" slineno="1-4" level="1" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Alarm business" or "alarm company" means a person engaged in the sale, <ln numlevel="1" lineno="29" slineno="1-5"/>installation, maintenance, alteration, repair, replacement, servicing, or monitoring of <ln numlevel="1" lineno="30" slineno="1-6"/>an alarm system, except as provided in Subsection <xref depth="4" refnumber="58-55-102(1)(b)">(1)(b)</xref>.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="31" slineno="1-7" level="2"><display>(b)</display>"Alarm business" or "alarm company" does not include:<subsection ssid="1-null-4" dnum="i-o" numlevel="1" lineno="32" slineno="1-8" level="3"><display>(i)</display>a person engaged in the manufacture or sale of alarm systems unless:<subsection ssid="1-null-5" dnum="A-o" numlevel="1" lineno="33" slineno="1-9" level="4"><display>(A)</display>that person is also engaged in the installation, maintenance, alteration, repair, <ln numlevel="1" lineno="34" slineno="1-10"/>replacement, servicing, or monitoring of alarm systems;</subsection><subsection ssid="1-null-6" dnum="B-o" numlevel="1" lineno="35" slineno="1-11" level="4"><display>(B)</display>the manufacture or sale occurs at a location other than a place of business <ln numlevel="1" lineno="36" slineno="1-12"/>established by the person engaged in the manufacture or sale; or</subsection><subsection ssid="1-null-7" dnum="C-o" numlevel="1" lineno="37" slineno="1-13" level="4"><display>(C)</display>the manufacture or sale involves site visits at the place or intended place of <ln numlevel="1" lineno="38" slineno="1-14"/>installation of an alarm system; or</subsection></subsection><subsection ssid="1-null-8" dnum="ii-o" numlevel="1" lineno="39" slineno="1-15" level="3"><display>(ii)</display>an owner of an alarm system, or an employee of the owner of an alarm system <ln numlevel="1" lineno="40" slineno="1-16"/>who is engaged in installation, maintenance, alteration, repair, replacement, <ln numlevel="1" lineno="41" slineno="1-17"/>servicing, or monitoring of the alarm system owned by that owner.</subsection></subsection></subsection><subsection ssid="1-null-9" dnum="2-o" numlevel="1" lineno="42" slineno="1-18" level="1"><display>(2)</display>"Alarm company agent":<subsection ssid="1-null-10" dnum="a-o" numlevel="1" lineno="43" slineno="1-19" level="2"><display>(a)</display>except as provided in Subsection <xref depth="4" refnumber="58-55-102(2)(b)">(2)(b)</xref>, means any individual employed within this <ln numlevel="1" lineno="44" slineno="1-20"/>state by an alarm business; and</subsection><subsection ssid="1-null-11" dnum="b-o" numlevel="1" lineno="45" slineno="1-21" level="2"><display>(b)</display>does not include an individual who:<subsection ssid="1-null-12" dnum="i-o" numlevel="1" lineno="46" slineno="1-22" level="3"><display>(i)</display>is not engaged in the sale, installation, maintenance, alteration, repair, <ln numlevel="1" lineno="47" slineno="1-23"/>replacement, servicing, or monitoring of an alarm system; and</subsection><subsection ssid="1-null-13" dnum="ii-o" numlevel="1" lineno="48" slineno="1-24" level="3"><display>(ii)</display>does not, during the normal course of the individual's employment with an alarm <ln numlevel="1" lineno="49" slineno="1-25"/>business, use or have access to sensitive alarm system information.</subsection></subsection></subsection><subsection ssid="1-null-14" dnum="3-o" numlevel="1" lineno="50" slineno="1-26" level="1"><display>(3)</display>"Alarm company officer" means:<subsection ssid="1-null-15" dnum="a-o" numlevel="1" lineno="51" slineno="1-27" level="2"><display>(a)</display>a governing person, as defined in Section <xref depth="3" refnumber="48-3a-102">48-3a-102</xref>, of an alarm company;</subsection><subsection ssid="1-null-16" dnum="b-o" numlevel="1" lineno="52" slineno="1-28" level="2"><display>(b)</display>an individual appointed as an officer of an alarm company that is a corporation in <ln numlevel="1" lineno="53" slineno="1-29"/>accordance with Section <xref depth="3" refnumber="16-10a-830">16-10a-830</xref>;</subsection><subsection ssid="1-null-17" dnum="c-o" numlevel="1" lineno="54" slineno="1-30" level="2"><display>(c)</display>a general partner, as defined in Section <xref depth="3" refnumber="48-2e-102">48-2e-102</xref>, of an alarm company; or</subsection><subsection ssid="1-null-18" dnum="d-o" numlevel="1" lineno="55" slineno="1-31" level="2"><display>(d)</display>a partner, as defined in Section <xref depth="3" refnumber="48-1d-102">48-1d-102</xref>, of an alarm company.</subsection></subsection><subsection ssid="1-null-19" dnum="4-o" numlevel="1" lineno="56" slineno="1-32" level="1"><display>(4)</display>"Alarm company owner" means:<subsection ssid="1-null-20" dnum="a-o" numlevel="1" lineno="57" slineno="1-33" level="2"><display>(a)</display>a shareholder, as defined in Section <xref depth="3" refnumber="16-10a-102">16-10a-102</xref>, who owns directly, or indirectly <ln numlevel="1" lineno="58" slineno="1-34"/>through an entity controlled by the individual, 5% or more of the outstanding shares <ln numlevel="1" lineno="59" slineno="1-35"/>of an alarm company that:<subsection ssid="1-null-21" dnum="i-o" numlevel="1" lineno="60" slineno="1-36" level="3"><display>(i)</display>is a corporation; and</subsection><subsection ssid="1-null-22" dnum="ii-o" numlevel="1" lineno="61" slineno="1-37" level="3"><display>(ii)</display>is not publicly listed or traded; or</subsection></subsection><subsection ssid="1-null-23" dnum="b-o" numlevel="1" lineno="62" slineno="1-38" level="2"><display>(b)</display>an individual who owns directly, or indirectly through an entity controlled by the <ln numlevel="1" lineno="63" slineno="1-39"/>individual, 5% or more of the equity of an alarm company that is not a corporation.</subsection></subsection><subsection ssid="1-null-24" dnum="5-o" numlevel="1" lineno="64" slineno="1-40" level="1"><display>(5)</display>"Alarm company proprietor" means the sole proprietor of an alarm company that is <ln numlevel="1" lineno="65" slineno="1-41"/>registered as a sole proprietorship with the Division of Corporations and Commercial <ln numlevel="1" lineno="66" slineno="1-42"/>Code.</subsection><subsection ssid="1-null-25" dnum="6-o" numlevel="1" lineno="67" slineno="1-43" level="1"><display>(6)</display>"Alarm company trustee" means an individual with control of or power of <ln numlevel="1" lineno="68" slineno="1-44"/>administration over property held in trust.</subsection><subsection ssid="1-null-26" dnum="7-o" numlevel="1" lineno="69" slineno="1-45" level="1" space="false"><display>(7)</display><subsection ssid="1-null-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Alarm system" means equipment and devices assembled for the purpose of:<subsection ssid="1-null-28" dnum="i-o" numlevel="1" lineno="70" slineno="1-46" level="3" tab="1"><display>(i)</display>detecting and signaling unauthorized intrusion or entry into or onto certain <ln numlevel="1" lineno="71" slineno="1-47"/>premises; or</subsection><subsection ssid="1-null-29" dnum="ii-o" numlevel="1" lineno="72" slineno="1-48" level="3" tab="1"><display>(ii)</display>signaling a robbery or attempted robbery on protected premises.</subsection></subsection><subsection ssid="1-null-30" dnum="b-o" numlevel="1" lineno="73" slineno="1-49" level="2"><display>(b)</display>"Alarm system" includes a battery-charged suspended-wire system or fence that is <ln numlevel="1" lineno="74" slineno="1-50"/>part of and interfaces with an alarm system for the purposes of detecting and <ln numlevel="1" lineno="75" slineno="1-51"/>deterring unauthorized intrusion or entry into or onto certain premises.</subsection></subsection><subsection ssid="1-null-31" dnum="8-o" numlevel="1" lineno="76" slineno="1-52" level="1"><display>(8)</display>"Apprentice electrician" means a person licensed under this chapter as an apprentice <ln numlevel="1" lineno="77" slineno="1-53"/>electrician who is learning the electrical trade under the immediate supervision of a <ln numlevel="1" lineno="78" slineno="1-54"/>master electrician, residential master electrician, a journeyman electrician, or a <ln numlevel="1" lineno="79" slineno="1-55"/>residential journeyman electrician.</subsection><subsection ssid="1-null-32" dnum="9-o" numlevel="1" lineno="80" slineno="1-56" level="1"><display>(9)</display>"Apprentice plumber" means a person licensed under this chapter as an apprentice <ln numlevel="1" lineno="81" slineno="1-57"/>plumber who is learning the plumbing trade under the immediate supervision of a master <ln numlevel="1" lineno="82" slineno="1-58"/>plumber, residential master plumber, journeyman plumber, or a residential journeyman <ln numlevel="1" lineno="83" slineno="1-59"/>plumber.</subsection><subsection ssid="1-null-33" dnum="10-o" numlevel="1" lineno="84" slineno="1-60" level="1"><display>(10)</display>"Approved continuing education" means instruction provided through courses under a <ln numlevel="1" lineno="85" slineno="1-61"/>program established under Subsection <xref depth="3" refnumber="58-55-302.5">58-55-302.5</xref>(2).</subsection><subsection ssid="1-null-34" dnum="11-o" numlevel="1" lineno="86" slineno="1-62" level="1" space="false"><display>(11)</display><subsection ssid="1-null-35" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Approved prelicensure course provider" means a provider that is the Associated <ln numlevel="1" lineno="87" slineno="1-63"/>General Contractors of Utah, the Utah Chapter of the Associated Builders and <ln numlevel="1" lineno="88" slineno="1-64"/>Contractors, or the Utah Home Builders Association, and that meets the requirements <ln numlevel="1" lineno="89" slineno="1-65"/>established by rule by the commission with the concurrence of the director, to teach <ln numlevel="1" lineno="90" slineno="1-66"/>the 25-hour course described in Subsection <xref depth="3" refnumber="58-55-302">58-55-302</xref>(1)(e)(iii).</subsection><subsection ssid="1-null-36" dnum="b-o" numlevel="1" lineno="91" slineno="1-67" level="2"><display>(b)</display>"Approved prelicensure course provider" may only include a provider that, in <ln numlevel="1" lineno="92" slineno="1-68"/>addition to any other locations, offers the 25-hour course described in Subsection <xref depth="3" refnumber="58-55-302"><ln numlevel="1" lineno="93" slineno="1-69"/>58-55-302</xref>(1)(e)(iii) at least six times each year in one or more counties other than <ln numlevel="1" lineno="94" slineno="1-70"/>Salt Lake County, Utah County, Davis County, or Weber County.</subsection></subsection><subsection ssid="1-null-37" dnum="12-o" numlevel="1" lineno="95" slineno="1-71" level="1"><display>(12)</display>"Board" means the Alarm System Security and Licensing Board or Electricians and <ln numlevel="1" lineno="96" slineno="1-72"/>Plumbers Licensing Board created in Section <xref depth="3" refnumber="58-55-201">58-55-201</xref>.</subsection><subsection ssid="1-null-38" dnum="13-o" numlevel="1" lineno="97" slineno="1-73" level="1"><display>(13)</display>"Combustion system" means an assembly consisting of:<subsection ssid="1-null-39" dnum="a-o" numlevel="1" lineno="98" slineno="1-74" level="2"><display>(a)</display>piping and components with a means for conveying, either continuously or <ln numlevel="1" lineno="99" slineno="1-75"/>intermittently, natural gas from the outlet of the natural gas provider's meter to the <ln numlevel="1" lineno="100" slineno="1-76"/>burner of the appliance;</subsection><subsection ssid="1-null-40" dnum="b-o" numlevel="1" lineno="101" slineno="1-77" level="2"><display>(b)</display>the electric control and combustion air supply and venting systems, including air <ln numlevel="1" lineno="102" slineno="1-78"/>ducts; and</subsection><subsection ssid="1-null-41" dnum="c-o" numlevel="1" lineno="103" slineno="1-79" level="2"><display>(c)</display>components intended to achieve control of quantity, flow, and pressure.</subsection></subsection><subsection ssid="1-null-42" dnum="14-o" numlevel="1" lineno="104" slineno="1-80" level="1"><display>(14)</display>"Commission" means the Construction Services Commission created under Section <xref depth="3" refnumber="58-55-103"><ln numlevel="1" lineno="105" slineno="1-81"/>58-55-103</xref>.</subsection><subsection ssid="1-null-43" dnum="15-o" numlevel="1" lineno="106" slineno="1-82" level="1"><display>(15)</display>"Construction trade" means any trade or occupation involving:<subsection ssid="1-null-44" dnum="a-o" numlevel="1" lineno="107" slineno="1-83" level="2" space="false"><display>(a)</display><subsection ssid="1-null-45" dnum="i-o" level="3" placement="sameline"><display>(i)</display>construction, alteration, remodeling, repairing, wrecking or demolition, addition <ln numlevel="1" lineno="108" slineno="1-84"/>to, or improvement of any building, highway, road, railroad, dam, bridge, <ln numlevel="1" lineno="109" slineno="1-85"/>structure, excavation or other project, development, or improvement to other than <ln numlevel="1" lineno="110" slineno="1-86"/>personal property; and</subsection><subsection ssid="1-null-46" dnum="ii-o" numlevel="1" lineno="111" slineno="1-87" level="3"><display>(ii)</display>constructing, remodeling, or repairing a manufactured home or mobile home as <ln numlevel="1" lineno="112" slineno="1-88"/>defined in Section <xref depth="3" refnumber="15A-1-302">15A-1-302</xref>; or</subsection></subsection><subsection ssid="1-null-47" dnum="b-o" numlevel="1" lineno="113" slineno="1-89" level="2"><display>(b)</display>installation or repair of a residential or commercial natural gas appliance or <ln numlevel="1" lineno="114" slineno="1-90"/>combustion system.</subsection></subsection><subsection ssid="1-null-48" dnum="16-o" numlevel="1" lineno="115" slineno="1-91" level="1"><display>(16)</display>"Construction trades instructor" means a person licensed under this chapter to teach <ln numlevel="1" lineno="116" slineno="1-92"/>one or more construction trades in both a classroom and project environment, where a <ln numlevel="1" lineno="117" slineno="1-93"/>project is intended for sale to or use by the public and is completed under the direction <ln numlevel="1" lineno="118" slineno="1-94"/>of the instructor, who has no economic interest in the project.</subsection><subsection ssid="1-null-49" dnum="17-o" numlevel="1" lineno="119" slineno="1-95" level="1" space="false"><display>(17)</display><subsection ssid="1-null-50" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Contractor" means any person who for compensation other than wages as an <ln numlevel="1" lineno="120" slineno="1-96"/>employee undertakes any work in the construction, plumbing, or electrical trade for <ln numlevel="1" lineno="121" slineno="1-97"/>which licensure is required under this chapter and includes:<subsection ssid="1-null-51" dnum="i-o" numlevel="1" lineno="122" slineno="1-98" level="3" tab="1"><display>(i)</display>a person who builds any structure on the person's own property for the purpose of <ln numlevel="1" lineno="123" slineno="1-99"/>sale or who builds any structure intended for public use on the person's own <ln numlevel="1" lineno="124" slineno="1-100"/>property;</subsection><subsection ssid="1-null-52" dnum="ii-o" numlevel="1" lineno="125" slineno="1-101" level="3" tab="1"><display>(ii)</display>any person who represents that the person is a contractor, or will perform a <ln numlevel="1" lineno="126" slineno="1-102"/>service described in this Subsection  (17) by advertising on a website or social <ln numlevel="1" lineno="127" slineno="1-103"/>media, or any other means;</subsection><subsection ssid="1-null-53" dnum="iii-o" numlevel="1" lineno="128" slineno="1-104" level="3" tab="1"><display>(iii)</display>any person engaged as a maintenance person, other than an employee, who <ln numlevel="1" lineno="129" slineno="1-105"/>regularly engages in activities set forth under the definition of "construction trade";</subsection><subsection ssid="1-null-54" dnum="iv-o" numlevel="1" lineno="130" slineno="1-106" level="3" tab="1"><display>(iv)</display>any person engaged in, or offering to engage in, any construction trade for which <ln numlevel="1" lineno="131" slineno="1-107"/>licensure is required under this chapter; or</subsection><subsection ssid="1-null-55" dnum="v-o" numlevel="1" lineno="132" slineno="1-108" level="3" tab="1"><display>(v)</display>a construction manager, construction consultant, construction assistant, or any <ln numlevel="1" lineno="133" slineno="1-109"/>other person who, for a fee:<subsection ssid="1-null-56" dnum="A-o" numlevel="1" lineno="134" slineno="1-110" level="4"><display>(A)</display>performs or offers to perform construction consulting;</subsection><subsection ssid="1-null-57" dnum="B-o" numlevel="1" lineno="135" slineno="1-111" level="4"><display>(B)</display>performs or offers to perform management of construction subcontractors;<amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"> or</amend></subsection><subsection ssid="1-null-58" dnum="C-o:_-i" numlevel="1" lineno="136" slineno="1-112" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1057" style="2" owner="o" level="1" deltag="start">(C)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">provides or offers to provide a list of subcontractors or suppliers; or</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-59" dnum="D-o:C-i" numlevel="1" lineno="137" slineno="1-113" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1058" style="2" owner="o" level="1" deltag="both">(D)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="both" space="true">(C)</amend></display>provides or offers to provide management or counseling services on a <ln numlevel="1" lineno="138" slineno="1-114"/>construction project.</subsection></subsection></subsection><subsection ssid="1-null-60" dnum="b-o" numlevel="1" lineno="139" slineno="1-115" level="2"><display>(b)</display>"Contractor" does not include:<subsection ssid="1-null-61" dnum="i-o" numlevel="1" lineno="140" slineno="1-116" level="3"><display>(i)</display>an alarm company or alarm company agent; or</subsection><subsection ssid="1-null-62" dnum="ii-o" numlevel="1" lineno="141" slineno="1-117" level="3"><display>(ii)</display>a material supplier who provides consulting to customers regarding the design <ln numlevel="1" lineno="142" slineno="1-118"/>and installation of the material supplier's products.</subsection></subsection></subsection><subsection ssid="1-null-63" dnum="18-o" numlevel="1" lineno="143" slineno="1-119" level="1" space="false"><display>(18)</display><subsection ssid="1-null-64" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Electrical trade" means the performance of any electrical work involved in the <ln numlevel="1" lineno="144" slineno="1-120"/>installation, construction, alteration, change, repair, removal, or maintenance of <ln numlevel="1" lineno="145" slineno="1-121"/>facilities, buildings, or appendages or appurtenances.</subsection><subsection ssid="1-null-65" slineno="1-123" level="3"><display>(i)</display>transporting or handling electrical materials;</subsection><subsection ssid="1-null-67" dnum="ii-o" numlevel="1" lineno="148" slineno="1-124" level="3"><display>(ii)</display>preparing clearance for raceways for wiring;</subsection><subsection ssid="1-null-68" dnum="iii-o" numlevel="1" lineno="149" slineno="1-125" level="3"><display>(iii)</display>work commonly done by unskilled labor on any installations under the exclusive <ln numlevel="1" lineno="150" slineno="1-126"/>control of electrical utilities;</subsection><subsection ssid="1-null-69" dnum="iv-o" numlevel="1" lineno="151" slineno="1-127" level="3"><display>(iv)</display>work involving cable-type wiring that does not pose a shock or fire-initiation <ln numlevel="1" lineno="152" slineno="1-128"/>hazard;</subsection><subsection ssid="1-null-70" dnum="v-o" numlevel="1" lineno="153" slineno="1-129" level="3"><display>(v)</display>work involving class two or class three power-limited circuits as defined in the <ln numlevel="1" lineno="154" slineno="1-130"/>National Electrical Code; or</subsection><subsection ssid="1-null-71" dnum="vi-o" numlevel="1" lineno="155" slineno="1-131" level="3"><display>(vi)</display>minor electrical work incidental to a mechanical or service installation when <ln numlevel="1" lineno="156" slineno="1-132"/>wiring is extended to no more than 10 feet from an existing outlet or disconnect <ln numlevel="1" lineno="157" slineno="1-133"/>and does not exceed 120 volts and 20 amperes.</subsection></subsection></subsection><subsection ssid="1-null-72" dnum="19-o" numlevel="1" lineno="158" slineno="1-134" level="1"><display>(19)</display>"Elevator" means the same as that term is defined in Section <xref depth="3" refnumber="34A-7-202">34A-7-202</xref>, except that <ln numlevel="1" lineno="159" slineno="1-135"/>for purposes of this chapter it does not mean a stair chair, a vertical platform lift, or an <ln numlevel="1" lineno="160" slineno="1-136"/>incline platform lift.</subsection><subsection ssid="1-null-73" dnum="20-o" numlevel="1" lineno="161" slineno="1-137" level="1"><display>(20)</display>"Elevator contractor" means a sole proprietor, firm, or corporation licensed under this <ln numlevel="1" lineno="162" slineno="1-138"/>chapter that is engaged in the business of erecting, constructing, installing, altering, <ln numlevel="1" lineno="163" slineno="1-139"/>servicing, repairing, or maintaining an elevator.</subsection><subsection ssid="1-null-74" dnum="21-o" numlevel="1" lineno="164" slineno="1-140" level="1"><display>(21)</display>"Elevator mechanic" means an individual who is licensed under this chapter as an <ln numlevel="1" lineno="165" slineno="1-141"/>elevator mechanic and who is engaged in erecting, constructing, installing, altering, <ln numlevel="1" lineno="166" slineno="1-142"/>servicing, repairing, or maintaining an elevator under the immediate supervision of an <ln numlevel="1" lineno="167" slineno="1-143"/>elevator contractor.</subsection><subsection ssid="1-null-75" dnum="22-o" numlevel="1" lineno="168" slineno="1-144" level="1"><display>(22)</display>"Employee" means an individual as defined by the division by rule giving <ln numlevel="1" lineno="169" slineno="1-145"/>consideration to the definition adopted by the Internal Revenue Service and the <ln numlevel="1" lineno="170" slineno="1-146"/>Department of Workforce Services.</subsection><subsection ssid="1-null-76" dnum="23-o" numlevel="1" lineno="171" slineno="1-147" level="1"><display>(23)</display>"Engage in a construction trade" means to:<subsection ssid="1-null-77" dnum="a-o" numlevel="1" lineno="172" slineno="1-148" level="2"><display>(a)</display>engage in, represent oneself to be engaged in, or advertise oneself as being engaged <ln numlevel="1" lineno="173" slineno="1-149"/>in a construction trade; or</subsection><subsection ssid="1-null-78" dnum="b-o" numlevel="1" lineno="174" slineno="1-150" level="2"><display>(b)</display>use the name "contractor" or "builder" or in any other way lead a reasonable person <ln numlevel="1" lineno="175" slineno="1-151"/>to believe one is or will act as a contractor.</subsection></subsection><subsection ssid="1-null-79" dnum="24-o" numlevel="1" lineno="176" slineno="1-152" level="1" space="false"><display>(24)</display><subsection ssid="1-null-80" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Financial responsibility" means a demonstration of a current and expected <ln numlevel="1" lineno="177" slineno="1-153"/>future condition of financial solvency evidencing a reasonable expectation to the <ln numlevel="1" lineno="178" slineno="1-154"/>division and the board that an applicant or licensee can successfully engage in <ln numlevel="1" lineno="179" slineno="1-155"/>business as a contractor without jeopardy to the public health, safety, and welfare.</subsection><subsection ssid="1-null-81" dnum="b-o" numlevel="1" lineno="180" slineno="1-156" level="2"><display>(b)</display>Financial responsibility may be determined by an evaluation of the total history <ln numlevel="1" lineno="181" slineno="1-157"/>concerning the licensee or applicant including past, present, and expected condition <ln numlevel="1" lineno="182" slineno="1-158"/>and record of financial solvency and business conduct.</subsection></subsection><subsection ssid="1-null-82" dnum="25-o" numlevel="1" lineno="183" slineno="1-159" level="1"><display>(25)</display>"Gas appliance" means any device that uses natural gas to produce light, heat, power, <ln numlevel="1" lineno="184" slineno="1-160"/>steam, hot water, refrigeration, or air conditioning.</subsection><subsection ssid="1-null-83" dnum="26-o" numlevel="1" lineno="185" slineno="1-161" level="1" space="false"><display>(26)</display><subsection ssid="1-null-84" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"General building contractor" means a person licensed under this chapter as a <ln numlevel="1" lineno="186" slineno="1-162"/>general building contractor qualified by education, training, experience, and <ln numlevel="1" lineno="187" slineno="1-163"/>knowledge to perform or superintend construction of structures for the support, <ln numlevel="1" lineno="188" slineno="1-164"/>shelter, and enclosure of persons, animals, chattels, or movable property of any kind <ln numlevel="1" lineno="189" slineno="1-165"/>or any of the components of that construction except plumbing, electrical work, <ln numlevel="1" lineno="190" slineno="1-166"/>mechanical work, work related to the operating integrity of an elevator, and <ln numlevel="1" lineno="191" slineno="1-167"/>manufactured housing installation, for which the general building contractor shall <ln numlevel="1" lineno="192" slineno="1-168"/>employ the services of a contractor licensed in the particular specialty, except that a <ln numlevel="1" lineno="193" slineno="1-169"/>general building contractor engaged in the construction of single-family and <ln numlevel="1" lineno="194" slineno="1-170"/>multifamily residences up to four units may perform the mechanical work and hire a <ln numlevel="1" lineno="195" slineno="1-171"/>licensed plumber or electrician as an employee.</subsection><subsection ssid="1-null-85" dnum="b-o" numlevel="1" lineno="196" slineno="1-172" level="2"><display>(b)</display>The division may by rule exclude general building contractors from engaging in the <ln numlevel="1" lineno="197" slineno="1-173"/>performance of other construction specialties in which there is represented a <ln numlevel="1" lineno="198" slineno="1-174"/>substantial risk to the public health, safety, and welfare, and for which a license is <ln numlevel="1" lineno="199" slineno="1-175"/>required unless that general building contractor holds a valid license in that specialty <ln numlevel="1" lineno="200" slineno="1-176"/>classification.</subsection></subsection><subsection ssid="1-null-86" dnum="27-o" numlevel="1" lineno="201" slineno="1-177" level="1"><display>(27)</display>"General electrical contractor" means a person licensed under this chapter as a general <ln numlevel="1" lineno="202" slineno="1-178"/>electrical contractor qualified by education, training, experience, and knowledge to <ln numlevel="1" lineno="203" slineno="1-179"/>perform the fabrication, construction, and installation of generators, transformers, <ln numlevel="1" lineno="204" slineno="1-180"/>conduits, raceways, panels, switch gear, electrical wires, fixtures, appliances, apparatus <ln numlevel="1" lineno="205" slineno="1-181"/>that uses electrical energy, or any other work the division authorizes by rule in <ln numlevel="1" lineno="206" slineno="1-182"/>accordance with Subsection <xref depth="4" refnumber="58-55-301(4)">58-55-301(4)</xref>.</subsection><subsection ssid="1-null-87" dnum="28-o" numlevel="1" lineno="207" slineno="1-183" level="1" space="false"><display>(28)</display><subsection ssid="1-null-88" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"General engineering contractor" means a person licensed under this chapter as a <ln numlevel="1" lineno="208" slineno="1-184"/>general engineering contractor qualified by education, training, experience, and <ln numlevel="1" lineno="209" slineno="1-185"/>knowledge to perform or superintend construction of fixed works, or components of <ln numlevel="1" lineno="210" slineno="1-186"/>fixed works requiring specialized engineering knowledge and skill in:<subsection ssid="1-null-89" dnum="i-o" numlevel="1" lineno="211" slineno="1-187" level="3" tab="1"><display>(i)</display>airports;</subsection><subsection ssid="1-null-90" dnum="ii-o" numlevel="1" lineno="212" slineno="1-188" level="3" tab="1"><display>(ii)</display>airport runways;</subsection><subsection ssid="1-null-91" dnum="iii-o" numlevel="1" lineno="213" slineno="1-189" level="3" tab="1"><display>(iii)</display>bridges;</subsection><subsection ssid="1-null-92" dnum="iv-o" numlevel="1" lineno="214" slineno="1-190" level="3" tab="1"><display>(iv)</display>chemical plants;</subsection><subsection ssid="1-null-93" dnum="v-o" numlevel="1" lineno="215" slineno="1-191" level="3" tab="1"><display>(v)</display>drainage;</subsection><subsection ssid="1-null-94" dnum="vi-o" numlevel="1" lineno="216" slineno="1-192" level="3" tab="1"><display>(vi)</display>electrical utilities;</subsection><subsection ssid="1-null-95" dnum="vii-o" numlevel="1" lineno="217" slineno="1-193" level="3" tab="1"><display>(vii)</display>flood control;</subsection><subsection ssid="1-null-96" dnum="viii-o" numlevel="1" lineno="218" slineno="1-194" level="3" tab="1"><display>(viii)</display>foundations;</subsection><subsection ssid="1-null-97" dnum="ix-o" numlevel="1" lineno="219" slineno="1-195" level="3" tab="1"><display>(ix)</display>harbors;</subsection><subsection ssid="1-null-98" dnum="x-o" numlevel="1" lineno="220" slineno="1-196" level="3" tab="1"><display>(x)</display>highways;</subsection><subsection ssid="1-null-99" dnum="xi-o" numlevel="1" lineno="221" slineno="1-197" level="3" tab="1"><display>(xi)</display>industrial plants;</subsection><subsection ssid="1-null-100" dnum="xii-o" numlevel="1" lineno="222" slineno="1-198" level="3" tab="1"><display>(xii)</display>inland waterways;</subsection><subsection ssid="1-null-101" dnum="xiii-o" numlevel="1" lineno="223" slineno="1-199" level="3" tab="1"><display>(xiii)</display>irrigation systems;</subsection><subsection ssid="1-null-102" dnum="xiv-o" numlevel="1" lineno="224" slineno="1-200" level="3" tab="1"><display>(xiv)</display>piers;</subsection><subsection ssid="1-null-103" dnum="xv-o" numlevel="1" lineno="225" slineno="1-201" level="3" tab="1"><display>(xv)</display>pipelines;</subsection><subsection ssid="1-null-104" dnum="xvi-o" numlevel="1" lineno="226" slineno="1-202" level="3" tab="1"><display>(xvi)</display>power plants;</subsection><subsection ssid="1-null-105" dnum="xvii-o" numlevel="1" lineno="227" slineno="1-203" level="3" tab="1"><display>(xvii)</display>railroads;</subsection><subsection ssid="1-null-106" dnum="xviii-o" numlevel="1" lineno="228" slineno="1-204" level="3" tab="1"><display>(xviii)</display>refineries;</subsection><subsection ssid="1-null-107" dnum="xix-o" numlevel="1" lineno="229" slineno="1-205" level="3" tab="1"><display>(xix)</display>sewers;</subsection><subsection ssid="1-null-108" dnum="xx-o" numlevel="1" lineno="230" slineno="1-206" level="3" tab="1"><display>(xx)</display>tunnels;</subsection><subsection ssid="1-null-109" dnum="xxi-o" numlevel="1" lineno="231" slineno="1-207" level="3" tab="1"><display>(xxi)</display>underground electric utility conduits;</subsection><subsection ssid="1-null-110" dnum="xxii-o" numlevel="1" lineno="232" slineno="1-208" level="3" tab="1"><display>(xxii)</display>utility plants;</subsection><subsection ssid="1-null-111" dnum="xxiii-o" numlevel="1" lineno="233" slineno="1-209" level="3" tab="1"><display>(xxiii)</display>water power; or</subsection><subsection ssid="1-null-112" dnum="xxiv-o" numlevel="1" lineno="234" slineno="1-210" level="3" tab="1"><display>(xxiv)</display>water supply.</subsection></subsection><subsection ssid="1-null-113" dnum="b-o" numlevel="1" lineno="235" slineno="1-211" level="2"><display>(b)</display>A general engineering contractor may not perform or superintend:<subsection ssid="1-null-114" dnum="i-o" numlevel="1" lineno="236" slineno="1-212" level="3"><display>(i)</display>construction of a structure built primarily for the support, shelter, and enclosure of <ln numlevel="1" lineno="237" slineno="1-213"/>persons, animals, and chattels;</subsection><subsection ssid="1-null-115" dnum="ii-o" numlevel="1" lineno="238" slineno="1-214" level="3"><display>(ii)</display>plumbing work;</subsection><subsection ssid="1-null-116" dnum="iii-o" numlevel="1" lineno="239" slineno="1-215" level="3"><display>(iii)</display>electrical work beyond underground electric utility conduit or electrical utilities;</subsection><subsection ssid="1-null-117" dnum="iv-o" numlevel="1" lineno="240" slineno="1-216" level="3"><display>(iv)</display>mechanical work; or</subsection><subsection ssid="1-null-118" dnum="v-o" numlevel="1" lineno="241" slineno="1-217" level="3"><display>(v)</display>work where the general engineering contractor does not have the required <ln numlevel="1" lineno="242" slineno="1-218"/>specialized engineering knowledge and skill.</subsection></subsection></subsection><subsection ssid="1-null-119" dnum="29-o" numlevel="1" lineno="243" slineno="1-219" level="1"><display>(29)</display>"General plumbing contractor" means a person licensed under this chapter as a general <ln numlevel="1" lineno="244" slineno="1-220"/>plumbing contractor qualified by education, training, experience, and knowledge to <ln numlevel="1" lineno="245" slineno="1-221"/>perform the fabrication or installation of material and fixtures to create and maintain <ln numlevel="1" lineno="246" slineno="1-222"/>sanitary conditions in a building by providing permanent means for a supply of safe and <ln numlevel="1" lineno="247" slineno="1-223"/>pure water, a means for the timely and complete removal from the premises of all used <ln numlevel="1" lineno="248" slineno="1-224"/>or contaminated water, fluid and semi-fluid organic wastes and other impurities <ln numlevel="1" lineno="249" slineno="1-225"/>incidental to life and the occupation of such premises, a safe and adequate supply of <ln numlevel="1" lineno="250" slineno="1-226"/>gases for lighting, heating, and industrial purposes, or other work the division authorizes <ln numlevel="1" lineno="251" slineno="1-227"/>by rule in accordance with Subsection <xref tempid="853" depth="4" refnumber="58-55-301(4)">58-55-301(4)</xref>.</subsection><subsection ssid="1-null-120" dnum="30-o" numlevel="1" lineno="252" slineno="1-228" level="1"><display>(30)</display>"HVAC" means a heating, ventilation, and air conditioning system and the specific <ln numlevel="1" lineno="253" slineno="1-229"/>components that are a part of the system, including the gas line.</subsection><subsection ssid="1-null-121" dnum="31-o" numlevel="1" lineno="254" slineno="1-230" level="1"><display>(31)</display>"HVAC contractor" means a person licensed under this chapter specialized in the <ln numlevel="1" lineno="255" slineno="1-231"/>installation, maintenance, repair, and servicing of heating, ventilation, air conditioning <ln numlevel="1" lineno="256" slineno="1-232"/>systems or any other work the division authorizes by rule in accordance with Subsection <xref depth="4" refnumber="58-55-301(4)"><ln numlevel="1" lineno="257" slineno="1-233"/>58-55-301(4)</xref>.</subsection><subsection ssid="1-null-122" dnum="32-o" numlevel="1" lineno="258" slineno="1-234" level="1"><display>(32)</display>"Immediate supervision" means reasonable direction, oversight, inspection, and <ln numlevel="1" lineno="259" slineno="1-235"/>evaluation of the work of a person:<subsection ssid="1-null-123" dnum="a-o" numlevel="1" lineno="260" slineno="1-236" level="2"><display>(a)</display>as the division specifies in rule;</subsection><subsection ssid="1-null-124" dnum="b-o" numlevel="1" lineno="261" slineno="1-237" level="2"><display>(b)</display>by, as applicable, a qualified electrician or plumber;</subsection><subsection ssid="1-null-125" dnum="c-o" numlevel="1" lineno="262" slineno="1-238" level="2"><display>(c)</display>as part of a planned program of training; and</subsection><subsection ssid="1-null-126" dnum="d-o" numlevel="1" lineno="263" slineno="1-239" level="2"><display>(d)</display>to ensure that the end result complies with applicable standards.</subsection></subsection><subsection ssid="1-null-127" dnum="33-o" numlevel="1" lineno="264" slineno="1-240" level="1"><display>(33)</display>"Individual" means a natural person.</subsection><subsection ssid="1-null-128" dnum="34-o" numlevel="1" lineno="265" slineno="1-241" level="1"><display>(34)</display>"Journeyman lineman" means a person that builds and maintains an electrical power <ln numlevel="1" lineno="266" slineno="1-242"/>system, performs work on transmission lines or distribution lines from power plants to <ln numlevel="1" lineno="267" slineno="1-243"/>customers, and has completed an approved 7,000 hour certified apprenticeship program.</subsection><subsection ssid="1-null-129" dnum="35-o" numlevel="1" lineno="268" slineno="1-244" level="1"><display>(35)</display>"Journeyman electrician" means a person licensed under this chapter as a journeyman <ln numlevel="1" lineno="269" slineno="1-245"/>electrician having the qualifications, training, experience, and knowledge to wire, install, <ln numlevel="1" lineno="270" slineno="1-246"/>and repair electrical apparatus and equipment for light, heat, power, and other purposes.</subsection><subsection ssid="1-null-130" dnum="36-o" numlevel="1" lineno="271" slineno="1-247" level="1"><display>(36)</display>"Journeyman plumber" means a person licensed under this chapter as a journeyman <ln numlevel="1" lineno="272" slineno="1-248"/>plumber having the qualifications, training, experience, and technical knowledge to <ln numlevel="1" lineno="273" slineno="1-249"/>engage in the plumbing trade.</subsection><subsection ssid="1-null-131" dnum="37-o" numlevel="1" lineno="274" slineno="1-250" level="1"><display>(37)</display>"Master electrician" means a person licensed under this chapter as a master electrician <ln numlevel="1" lineno="275" slineno="1-251"/>having the qualifications, training, experience, and knowledge to properly plan, layout, <ln numlevel="1" lineno="276" slineno="1-252"/>and supervise the wiring, installation, and repair of electrical apparatus and equipment <ln numlevel="1" lineno="277" slineno="1-253"/>for light, heat, power, and other purposes.</subsection><subsection ssid="1-null-132" dnum="38-o" numlevel="1" lineno="278" slineno="1-254" level="1"><display>(38)</display>"Master plumber" means a person licensed under this chapter as a master plumber <ln numlevel="1" lineno="279" slineno="1-255"/>having the qualifications, training, experience, and knowledge to properly plan and <ln numlevel="1" lineno="280" slineno="1-256"/>layout projects and supervise persons in the plumbing trade.</subsection><subsection ssid="1-null-133" dnum="39-o" numlevel="1" lineno="281" slineno="1-257" level="1"><display>(39)</display>"Person" means a natural person, sole proprietorship, joint venture, corporation, <ln numlevel="1" lineno="282" slineno="1-258"/>limited liability company, association, or organization of any type.</subsection><subsection ssid="1-null-134" dnum="40-o" numlevel="1" lineno="283" slineno="1-259" level="1" space="false"><display>(40)</display><subsection ssid="1-null-135" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Plumbing trade" means the performance of any mechanical work pertaining to <ln numlevel="1" lineno="284" slineno="1-260"/>the installation, alteration, change, repair, removal, maintenance, or use in buildings, <ln numlevel="1" lineno="285" slineno="1-261"/>or within three feet beyond the outside walls of buildings, of pipes, fixtures, and <ln numlevel="1" lineno="286" slineno="1-262"/>fittings for the:<subsection ssid="1-null-136" dnum="i-o" numlevel="1" lineno="287" slineno="1-263" level="3" tab="1"><display>(i)</display>delivery of the water supply;</subsection><subsection ssid="1-null-137" dnum="ii-o" numlevel="1" lineno="288" slineno="1-264" level="3" tab="1"><display>(ii)</display>discharge of liquid and water carried waste;</subsection><subsection ssid="1-null-138" dnum="iii-o" numlevel="1" lineno="289" slineno="1-265" level="3" tab="1"><display>(iii)</display>building drainage system within the walls of the building; and</subsection><subsection ssid="1-null-139" dnum="iv-o" numlevel="1" lineno="290" slineno="1-266" level="3" tab="1"><display>(iv)</display>delivery of gases for lighting, heating, and industrial purposes.</subsection></subsection><subsection ssid="1-null-140" dnum="b-o" numlevel="1" lineno="291" slineno="1-267" level="2"><display>(b)</display>"Plumbing trade" includes work pertaining to the water supply, distribution pipes, <ln numlevel="1" lineno="292" slineno="1-268"/>fixtures and fixture traps, soil, waste and vent pipes, the building drain and roof <ln numlevel="1" lineno="293" slineno="1-269"/>drains, and the safe and adequate supply of gases, together with their devices, <ln numlevel="1" lineno="294" slineno="1-270"/>appurtenances, and connections where installed within the outside walls of the <ln numlevel="1" lineno="295" slineno="1-271"/>building.</subsection></subsection><subsection ssid="1-null-141" dnum="41-o" numlevel="1" lineno="296" slineno="1-272" level="1"><display>(41)</display>"Ratio of apprentices" means the number of licensed plumber apprentices or licensed <ln numlevel="1" lineno="297" slineno="1-273"/>electrician apprentices that are allowed to be under the immediate supervision of a <ln numlevel="1" lineno="298" slineno="1-274"/>licensed supervisor as established by the provisions of this chapter and by rules made by <ln numlevel="1" lineno="299" slineno="1-275"/>the commission, with the concurrence of the director, in accordance with Title 63G, <ln numlevel="1" lineno="300" slineno="1-276"/>Chapter 3, Utah Administrative Rulemaking Act.</subsection><subsection ssid="1-null-142" dnum="42-o" numlevel="1" lineno="301" slineno="1-277" level="1"><display>(42)</display>"Residential and small commercial contractor" means a person licensed under this <ln numlevel="1" lineno="302" slineno="1-278"/>chapter as a residential and small commercial contractor qualified by education, training, <ln numlevel="1" lineno="303" slineno="1-279"/>experience, and knowledge to perform or superintend the construction of single-family <ln numlevel="1" lineno="304" slineno="1-280"/>residences, multifamily residences up to four units, and commercial construction of not <ln numlevel="1" lineno="305" slineno="1-281"/>more than three stories above ground and not more than 20,000 square feet, or any of the <ln numlevel="1" lineno="306" slineno="1-282"/>components of that construction except plumbing, electrical work, mechanical work, and <ln numlevel="1" lineno="307" slineno="1-283"/>manufactured housing installation, for which the residential and small commercial <ln numlevel="1" lineno="308" slineno="1-284"/>contractor shall employ the services of a contractor licensed in the particular specialty, <ln numlevel="1" lineno="309" slineno="1-285"/>except that a residential and small commercial contractor engaged in the construction of <ln numlevel="1" lineno="310" slineno="1-286"/>single-family and multifamily residences up to four units may perform the mechanical <ln numlevel="1" lineno="311" slineno="1-287"/>work and hire a licensed plumber or electrician as an employee.</subsection><subsection ssid="1-null-143" dnum="43-o" numlevel="1" lineno="312" slineno="1-288" level="1"><display>(43)</display>"Residential building," as it relates to the license classification of residential <ln numlevel="1" lineno="313" slineno="1-289"/>journeyman plumber and residential master plumber, means a single or multiple family <ln numlevel="1" lineno="314" slineno="1-290"/>dwelling of up to four units.</subsection><subsection ssid="1-null-144" dnum="44-o" numlevel="1" lineno="315" slineno="1-291" level="1"><display>(44)</display>"Residential electrical contractor" means a person licensed under this chapter as a <ln numlevel="1" lineno="316" slineno="1-292"/>residential electrical contractor qualified by education, training, experience, and <ln numlevel="1" lineno="317" slineno="1-293"/>knowledge to perform the fabrication, construction, and installation of services, <ln numlevel="1" lineno="318" slineno="1-294"/>disconnecting means, grounding devices, panels, conductors, load centers, lighting and <ln numlevel="1" lineno="319" slineno="1-295"/>plug circuits, appliances, and fixtures in a residential unit or any other work the division <ln numlevel="1" lineno="320" slineno="1-296"/>authorizes by rule in accordance with Subsection <xref depth="4" refnumber="58-55-301(4)">58-55-301(4)</xref>.</subsection><subsection ssid="1-null-145" dnum="45-o" numlevel="1" lineno="321" slineno="1-297" level="1"><display>(45)</display>"Residential journeyman electrician" means a person licensed under this chapter as a <ln numlevel="1" lineno="322" slineno="1-298"/>residential journeyman electrician having the qualifications, training, experience, and <ln numlevel="1" lineno="323" slineno="1-299"/>knowledge to wire, install, and repair electrical apparatus and equipment for light, heat, <ln numlevel="1" lineno="324" slineno="1-300"/>power, and other purposes on buildings using primarily nonmetallic sheath cable.</subsection><subsection ssid="1-null-146" dnum="46-o" numlevel="1" lineno="325" slineno="1-301" level="1"><display>(46)</display>"Residential journeyman plumber" means a person licensed under this chapter as a <ln numlevel="1" lineno="326" slineno="1-302"/>residential journeyman plumber having the qualifications, training, experience, and <ln numlevel="1" lineno="327" slineno="1-303"/>knowledge to engage in the plumbing trade as limited to the plumbing of residential <ln numlevel="1" lineno="328" slineno="1-304"/>buildings.</subsection><subsection ssid="1-null-147" dnum="47-o" numlevel="1" lineno="329" slineno="1-305" level="1"><display>(47)</display>"Residential master electrician" means a person licensed under this chapter as a <ln numlevel="1" lineno="330" slineno="1-306"/>residential master electrician having the qualifications, training, experience, and <ln numlevel="1" lineno="331" slineno="1-307"/>knowledge to properly plan, layout, and supervise the wiring, installation, and repair of <ln numlevel="1" lineno="332" slineno="1-308"/>electrical apparatus and equipment for light, heat, power, and other purposes on <ln numlevel="1" lineno="333" slineno="1-309"/>residential projects.</subsection><subsection ssid="1-null-148" dnum="48-o" numlevel="1" lineno="334" slineno="1-310" level="1"><display>(48)</display>"Residential master plumber" means a person licensed under this chapter as a <ln numlevel="1" lineno="335" slineno="1-311"/>residential master plumber having the qualifications, training, experience, and <ln numlevel="1" lineno="336" slineno="1-312"/>knowledge to properly plan and layout projects and supervise persons in the plumbing <ln numlevel="1" lineno="337" slineno="1-313"/>trade as limited to the plumbing of residential buildings.</subsection><subsection ssid="1-null-149" dnum="49-o" numlevel="1" lineno="338" slineno="1-314" level="1"><display>(49)</display>"Residential plumbing contractor" means a person licensed under this chapter as a <ln numlevel="1" lineno="339" slineno="1-315"/>residential plumbing contractor qualified by education, training, experience, and <ln numlevel="1" lineno="340" slineno="1-316"/>knowledge to perform the fabrication or installation of material and fixtures to create <ln numlevel="1" lineno="341" slineno="1-317"/>and maintain sanitary conditions in residential buildings by providing permanent means <ln numlevel="1" lineno="342" slineno="1-318"/>for a supply of safe and pure water, a means for the timely and complete removal from <ln numlevel="1" lineno="343" slineno="1-319"/>the premises of all used or contaminated water, fluid and semi-fluid organic wastes and <ln numlevel="1" lineno="344" slineno="1-320"/>other impurities incidental to life and the occupation of such premises, a safe and <ln numlevel="1" lineno="345" slineno="1-321"/>adequate supply of gases for lighting, heating, and residential purposes, or any other <ln numlevel="1" lineno="346" slineno="1-322"/>work the division authorizes by rule in accordance with Subsection <xref depth="4" refnumber="58-55-301(4)">58-55-301(4)</xref>.</subsection><subsection ssid="1-null-150" dnum="50-o" numlevel="1" lineno="347" slineno="1-323" level="1"><display>(50)</display>"Residential project," as it relates to an electrician or electrical contractor, means <ln numlevel="1" lineno="348" slineno="1-324"/>buildings primarily wired with nonmetallic sheathed cable, in accordance with standard <ln numlevel="1" lineno="349" slineno="1-325"/>rules and regulations governing this work, including the National Electrical Code, and in <ln numlevel="1" lineno="350" slineno="1-326"/>which the voltage does not exceed 250 volts line to line and 125 volts to ground.</subsection><subsection ssid="1-null-151" dnum="51-o" numlevel="1" lineno="351" slineno="1-327" level="1"><display>(51)</display>"Responsible management personnel" means:<subsection ssid="1-null-152" dnum="a-o" numlevel="1" lineno="352" slineno="1-328" level="2"><display>(a)</display>a qualifying agent;</subsection><subsection ssid="1-null-153" dnum="b-o" numlevel="1" lineno="353" slineno="1-329" level="2"><display>(b)</display>an operations manager; or</subsection><subsection ssid="1-null-154" dnum="c-o" numlevel="1" lineno="354" slineno="1-330" level="2"><display>(c)</display>a site manager.</subsection></subsection><subsection ssid="1-null-155" dnum="52-o" numlevel="1" lineno="355" slineno="1-331" level="1"><display>(52)</display>"Sensitive alarm system information" means:<subsection ssid="1-null-156" dnum="a-o" numlevel="1" lineno="356" slineno="1-332" level="2"><display>(a)</display>a pass code or other code used in the operation of an alarm system;</subsection><subsection ssid="1-null-157" dnum="b-o" numlevel="1" lineno="357" slineno="1-333" level="2"><display>(b)</display>information on the location of alarm system components at the premises of a <ln numlevel="1" lineno="358" slineno="1-334"/>customer of the alarm business providing the alarm system;</subsection><subsection ssid="1-null-158" dnum="c-o" numlevel="1" lineno="359" slineno="1-335" level="2"><display>(c)</display>information that would allow the circumvention, bypass, deactivation, or other <ln numlevel="1" lineno="360" slineno="1-336"/>compromise of an alarm system of a customer of the alarm business providing the <ln numlevel="1" lineno="361" slineno="1-337"/>alarm system; and</subsection><subsection ssid="1-null-159" dnum="d-o" numlevel="1" lineno="362" slineno="1-338" level="2"><display>(d)</display>any other similar information that the division by rule determines to be information <ln numlevel="1" lineno="363" slineno="1-339"/>that an individual employed by an alarm business should use or have access to only if <ln numlevel="1" lineno="364" slineno="1-340"/>the individual is licensed as provided in this chapter.</subsection></subsection><subsection ssid="1-null-160" dnum="53-o" numlevel="1" lineno="365" slineno="1-341" level="1" space="false"><display>(53)</display><subsection ssid="1-null-161" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Specialty contractor" means a person licensed under this chapter under a <ln numlevel="1" lineno="366" slineno="1-342"/>specialty contractor classification established by rule, who is qualified by education, <ln numlevel="1" lineno="367" slineno="1-343"/>training, experience, and knowledge to perform those construction trades and crafts <ln numlevel="1" lineno="368" slineno="1-344"/>requiring specialized skill, the regulation of which are determined by the division to <ln numlevel="1" lineno="369" slineno="1-345"/>be in the best interest of the public health, safety, and welfare.</subsection><subsection ssid="1-null-162" dnum="b-o" numlevel="1" lineno="370" slineno="1-346" level="2"><display>(b)</display>A specialty contractor may perform work in crafts or trades other than those in which <ln numlevel="1" lineno="371" slineno="1-347"/>the specialty contractor is licensed if they are incidental to the performance of the <ln numlevel="1" lineno="372" slineno="1-348"/>specialty contractor's licensed craft or trade.</subsection></subsection><subsection ssid="1-null-163" dnum="54-o" numlevel="1" lineno="373" slineno="1-349" level="1"><display>(54)</display>"Unincorporated entity" means an entity that is not:<subsection ssid="1-null-164" dnum="a-o" numlevel="1" lineno="374" slineno="1-350" level="2"><display>(a)</display>an individual;</subsection><subsection ssid="1-null-165" dnum="b-o" numlevel="1" lineno="375" slineno="1-351" level="2"><display>(b)</display>a corporation; or</subsection><subsection ssid="1-null-166" dnum="c-o" numlevel="1" lineno="376" slineno="1-352" level="2"><display>(c)</display>publicly traded.</subsection></subsection><subsection ssid="1-null-167" dnum="55-o" numlevel="1" lineno="377" slineno="1-353" level="1"><display>(55)</display>"Unlawful conduct" means the same as that term is defined in Sections <xref depth="3" refnumber="58-1-501">58-1-501</xref> and <xref depth="3" refnumber="58-55-501"><ln numlevel="1" lineno="378" slineno="1-354"/>58-55-501</xref>.</subsection><subsection ssid="1-null-168" dnum="56-o" numlevel="1" lineno="379" slineno="1-355" level="1"><display>(56)</display>"Unprofessional conduct" means the same as that term is defined in Sections <xref depth="3" refnumber="58-1-501">58-1-501</xref> <ln numlevel="1" lineno="380" slineno="1-356"/>and <xref depth="3" refnumber="58-55-502">58-55-502</xref> and as may be further defined by rule.</subsection><subsection ssid="1-null-169" dnum="57-o" numlevel="1" lineno="381" slineno="1-357" level="1"><display>(57)</display>"Wages" means amounts due to an employee for labor or services whether the amount <ln numlevel="1" lineno="382" slineno="1-358"/>is fixed or ascertained on a time, task, piece, commission, or other basis for calculating <ln numlevel="1" lineno="383" slineno="1-359"/>the amount.</subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="384" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="384">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="385"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec><bsec buid="3" type="uncod" untype="coord" src="uncod" uid="CRD0000" sort="UZT00000" langlock="false" numlevel="1" lineno="386" slineno="3-1" sn="3"><section ccsum="true" type="uncod" untype="coord" display="false" src="uncod"><secline lineno="386">Section 3.  <bold>Coordinating H.B. 344 with H.B. 40.</bold></secline><sectionText lineno="387"><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">If H.B. 344, Construction Consultant Amendments, and H.B. 40, Utah Construction <ln numlevel="1" lineno="388" slineno="3-3"/>Trades Licensing Act Amendments, both pass and become law, the Legislature intends that, on <ln numlevel="1" lineno="389" slineno="3-4"/>January 1, 2027, Subsection 58-55-101(7)(b) enacted in H.B. 40 be amended to read:<eol numlevel="1" lineno="390" slineno="3-5"/>"(b) "Contractor" includes:<eol numlevel="1" lineno="391" slineno="3-6"/>(i) a person that builds a structure on the person's own property that is intended for sale or <ln numlevel="1" lineno="392" slineno="3-7"/>public use;<eol numlevel="1" lineno="393" slineno="3-8"/>(ii) a person that advertises that the person is a contractor or that the person will perform a <ln numlevel="1" lineno="394" slineno="3-9"/>service that requires a license under this chapter; or<eol numlevel="1" lineno="395" slineno="3-10"/>(iii) a person that, for a fee:<eol numlevel="1" lineno="396" slineno="3-11"/>(A) performs or offers to perform construction consulting;<eol numlevel="1" lineno="397" slineno="3-12"/>(B) performs or offers to perform management of construction subcontractors; or<eol numlevel="1" lineno="398" slineno="3-13"/>(D) provides or offers to provide management or counseling services on a construction <ln numlevel="1" lineno="399" slineno="3-14"/>project.".</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-23-26 4:50
