Section <bold>63M-7-502</bold> is amended to read:</secline><catline lineno="26"><bold>63M-7-502<parens/>. Definitions.</bold></catline><sectionText lineno="27"><tab/>    As used in this part:</sectionText><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="28" slineno="1-4" level="1"><display>(1)</display>"Accomplice" means an individual who has engaged in criminal conduct as described in <ln numlevel="1" lineno="29" slineno="1-5"/>Section <xref depth="3" refnumber="76-2-202">76-2-202</xref>.</subsection><subsection ssid="7-null-2" dnum="2-o" numlevel="1" lineno="30" slineno="1-6" level="1"><display>(2)</display>"Advocacy services provider" means the same as that term is defined in Section <xref depth="3" refnumber="77-38-403"><ln numlevel="1" lineno="31" slineno="1-7"/>77-38-403</xref>.</subsection><subsection ssid="7-null-3" dnum="3-o" numlevel="1" lineno="32" slineno="1-8" level="1"><display>(3)</display>"Bodily injury" means physical pain, illness, or any impairment of physical condition.</subsection><subsection ssid="7-null-4" dnum="4-o" numlevel="1" lineno="33" slineno="1-9" level="1"><display>(4)</display>"Claimant" means any of the following claiming reparations under this part:<subsection ssid="7-null-5" dnum="a-o" numlevel="1" lineno="34" slineno="1-10" level="2"><display>(a)</display>a victim;</subsection><subsection ssid="7-null-6" dnum="b-o" numlevel="1" lineno="35" slineno="1-11" level="2"><display>(b)</display>a dependent of a deceased victim; or</subsection><subsection ssid="7-null-7" dnum="c-o" numlevel="1" lineno="36" slineno="1-12" level="2"><display>(c)</display>an individual or representative who files a reparations claim on behalf of a victim.</subsection></subsection><subsection ssid="7-null-8" dnum="5-o" numlevel="1" lineno="37" slineno="1-13" level="1"><display>(5)</display>"Child" means an unemancipated individual who is under 18 years old.</subsection><subsection ssid="7-null-9" dnum="6-o" numlevel="1" lineno="38" slineno="1-14" level="1"><display>(6)</display>"Collateral source" means any source of benefits or advantages for economic loss <ln numlevel="1" lineno="39" slineno="1-15"/>otherwise reparable under this part that the claimant has received, or that is readily <ln numlevel="1" lineno="40" slineno="1-16"/>available to the claimant from:<subsection ssid="7-null-10" dnum="a-o" numlevel="1" lineno="41" slineno="1-17" level="2"><display>(a)</display>the offender;</subsection><subsection ssid="7-null-11" dnum="b-o" numlevel="1" lineno="42" slineno="1-18" level="2"><display>(b)</display>the insurance of the offender or the victim;</subsection><subsection ssid="7-null-12" dnum="c-o" numlevel="1" lineno="43" slineno="1-19" level="2"><display>(c)</display>the United States government or any of its agencies, a state or any of its political <ln numlevel="1" lineno="44" slineno="1-20"/>subdivisions, or an instrumentality of two or more states, except in the case on <ln numlevel="1" lineno="45" slineno="1-21"/>nonobligatory state-funded programs;</subsection><subsection ssid="7-null-13" dnum="d-o" numlevel="1" lineno="46" slineno="1-22" level="2"><display>(d)</display>social security, Medicare, and Medicaid;</subsection><subsection ssid="7-null-14" dnum="e-o" numlevel="1" lineno="47" slineno="1-23" level="2"><display>(e)</display>state-required temporary nonoccupational income replacement insurance or disability <ln numlevel="1" lineno="48" slineno="1-24"/>income insurance;</subsection><subsection ssid="7-null-15" dnum="f-o" numlevel="1" lineno="49" slineno="1-25" level="2"><display>(f)</display>workers' compensation;</subsection><subsection ssid="7-null-16" dnum="g-o" numlevel="1" lineno="50" slineno="1-26" level="2"><display>(g)</display>wage continuation programs of any employer;</subsection><subsection ssid="7-null-17" dnum="h-o" numlevel="1" lineno="51" slineno="1-27" level="2"><display>(h)</display>proceeds of a contract of insurance payable to the claimant for the loss the claimant <ln numlevel="1" lineno="52" slineno="1-28"/>sustained because of the criminally injurious conduct;</subsection><subsection ssid="7-null-18" dnum="i-o" numlevel="1" lineno="53" slineno="1-29" level="2"><display>(i)</display>a contract providing prepaid hospital and other health care services or benefits for <ln numlevel="1" lineno="54" slineno="1-30"/>disability; or</subsection><subsection ssid="7-null-19" dnum="j-o" numlevel="1" lineno="55" slineno="1-31" level="2"><display>(j)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="100" groupid="84" style="2" owner="jchristopherson" level="1" deltag="both">veteran's </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="98" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">veteran </amend>benefits, including <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="101" groupid="85" style="2" owner="jchristopherson" level="1" deltag="both">veteran's</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="99" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">veteran</amend> hospitalization benefits.</subsection></subsection><subsection ssid="7-null-20" dnum="7-o" numlevel="1" lineno="56" slineno="1-32" level="1" space="false"><display>(7)</display><subsection ssid="7-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Confidential record" means a record in the custody of the office that relates to a <ln numlevel="1" lineno="57" slineno="1-33"/>claimant's eligibility for a reparations award.</subsection><subsection ssid="7-null-22" dnum="b-o" numlevel="1" lineno="58" slineno="1-34" level="2"><display>(b)</display>"Confidential record" includes:<subsection ssid="7-null-23" dnum="i-o" numlevel="1" lineno="59" slineno="1-35" level="3"><display>(i)</display>a reparations claim;</subsection><subsection ssid="7-null-24" dnum="ii-o" numlevel="1" lineno="60" slineno="1-36" level="3"><display>(ii)</display>any correspondence regarding:<subsection ssid="7-null-25" dnum="A-o" numlevel="1" lineno="61" slineno="1-37" level="4"><display>(A)</display>the approval or denial of a reparations claim; or</subsection><subsection ssid="7-null-26" dnum="B-o" numlevel="1" lineno="62" slineno="1-38" level="4"><display>(B)</display>the payment of a reparations award;</subsection></subsection><subsection ssid="7-null-27" dnum="iii-o" numlevel="1" lineno="63" slineno="1-39" level="3"><display>(iii)</display>a document submitted to the office in support of a reparations award;</subsection><subsection ssid="7-null-28" dnum="iv-o" numlevel="1" lineno="64" slineno="1-40" level="3"><display>(iv)</display>a medical or mental health treatment plan; and</subsection><subsection ssid="7-null-29" dnum="v-o" numlevel="1" lineno="65" slineno="1-41" level="3"><display>(v)</display>an investigative report provided to the office by a law enforcement agency.</subsection></subsection></subsection><subsection ssid="7-null-30" dnum="8-o" numlevel="1" lineno="66" slineno="1-42" level="1"><display>(8)</display>"Criminal justice system victim advocate" means the same as that term is defined in <ln numlevel="1" lineno="67" slineno="1-43"/>Section <xref depth="3" refnumber="77-38-403">77-38-403</xref>.</subsection><subsection ssid="7-null-31" dnum="9-o" numlevel="1" lineno="68" slineno="1-44" level="1" space="false"><display>(9)</display><subsection ssid="7-null-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Criminally injurious conduct" other than acts of war declared or not declared <ln numlevel="1" lineno="69" slineno="1-45"/>means conduct that:<subsection ssid="7-null-33" dnum="i-o" numlevel="1" lineno="70" slineno="1-46" level="3" tab="1"><display>(i)</display>is or would be subject to prosecution in this state under Section <xref depth="3" refnumber="76-1-201">76-1-201</xref>;</subsection><subsection ssid="7-null-34" dnum="ii-o" numlevel="1" lineno="71" slineno="1-47" level="3" tab="1"><display>(ii)</display>occurs or is attempted;</subsection><subsection ssid="7-null-35" dnum="iii-o" numlevel="1" lineno="72" slineno="1-48" level="3" tab="1"><display>(iii)</display>causes, or poses a substantial threat of causing, bodily injury or death;</subsection><subsection ssid="7-null-36" dnum="iv-o" numlevel="1" lineno="73" slineno="1-49" level="3" tab="1"><display>(iv)</display>is punishable by fine, imprisonment, or death if the individual engaging in the <ln numlevel="1" lineno="74" slineno="1-50"/>conduct possessed the capacity to commit the conduct; and</subsection><subsection ssid="7-null-37" dnum="v-o" numlevel="1" lineno="75" slineno="1-51" level="3" tab="1"><display>(v)</display><amend anum="0" ea="amend" pairid="62" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="both">except as provided in Subsection <xref depth="4" refnumber="63M-7-502(9)(b)(ii)">(9)(b)(ii)</xref>, </amend>does not arise out of the ownership, <ln numlevel="1" lineno="76" slineno="1-52"/>maintenance, or use of a motor vehicle, aircraft, or water craft<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="63" groupid="52" style="2" owner="jchristopherson" level="1" deltag="both">, unless the conduct <ln numlevel="1" lineno="77" slineno="1-53"/>is:</amend><amendoutend style="2"/><subsection ssid="7-null-38" dnum="A-o:_-i" numlevel="1" lineno="78" slineno="1-54" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1037" style="2" owner="o" level="1" deltag="start">(A)</amend></display><amend anum="0" ea="erase" pairid="64" groupid="53" style="2" owner="jchristopherson" level="1" deltag="end">intended to cause bodily injury or death;</amend><amendoutend style="2"/><subsection ssid="7-null-39" dnum="B-o:_-i" numlevel="1" lineno="79" slineno="1-55" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1038" style="2" owner="o" level="1" deltag="start">(B)</amend></display><amend anum="0" ea="erase" pairid="65" groupid="54" style="2" owner="jchristopherson" level="1" deltag="end">punishable under Title <xref depth="1" refnumber="76-5">76, Chapter 5</xref>, Offenses Against the Individual; or</amend><amendoutend style="2"/><subsection ssid="7-null-40" dnum="C-o:_-i" numlevel="1" lineno="80" slineno="1-56" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1039" style="2" owner="o" level="1" deltag="start">(C)</amend></display><amend anum="0" ea="erase" pairid="68" groupid="57" style="2" owner="jchristopherson" level="1" deltag="end">chargeable as an offense for driving under the influence of alcohol or drugs</amend><amendoutend style="2"/>.</subsection></subsection></subsection></subsection></subsection><subsection ssid="7-null-41" dnum="b-o" numlevel="1" lineno="81" slineno="1-57" level="2"><display>(b)</display>"Criminally injurious conduct" includes<amend anum="0" ea="amend" pairid="52" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="both"> conduct that:</amend> <subsection ssid="7-126" dnum="_-o:i-i" numlevel="1" lineno="82" slineno="1-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">is </amend>a felony violation of Section <xref depth="3" refnumber="76-7-101">76-7-101</xref> and other conduct leading to the <ln numlevel="1" lineno="83" slineno="1-59"/>psychological injury of an individual resulting from living in a setting that <ln numlevel="1" lineno="84" slineno="1-60"/>involves a bigamous relationship<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="36" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="7-127" dnum="_-o:ii-i" numlevel="1" lineno="85" slineno="1-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">arises out of the ownership, maintenance, or use of a motor vehicle, aircraft, or <ln numlevel="1" lineno="86" slineno="1-62"/>water craft and is:</amend><subsection ssid="7-128" dnum="_-o:A-i" numlevel="1" lineno="87" slineno="1-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">intended to cause bodily injury or death;</amend></subsection><subsection ssid="7-129" dnum="_-o:B-i" numlevel="1" lineno="88" slineno="1-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="54" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">punishable under Title 76, Chapter 5, Offenses Against the Individual;</amend></subsection><subsection ssid="7-131" dnum="_-o:C-i" numlevel="1" lineno="89" slineno="1-65" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">chargeable as an offense for driving under the influence of alcohol or drugs; or</amend></subsection><subsection ssid="7-135" dnum="_-o:D-i" numlevel="1" lineno="90" slineno="1-66" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">chargeable as an offense for failure to stop and remain at a scene of an <ln numlevel="1" lineno="91" slineno="1-67"/>accident involving death as described in Section <xref depth="3" refnumber="41-6a-401.5">41-6a-401.5</xref>.</amend></subsection></subsection></subsection></subsection><subsection ssid="7-null-42" dnum="10-o" numlevel="1" lineno="92" slineno="1-68" level="1" space="false"><display>(10)</display><subsection ssid="7-null-43" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Dependent" means a natural person to whom the victim is wholly or partially <ln numlevel="1" lineno="93" slineno="1-69"/>legally responsible for care or support.</subsection><subsection ssid="7-null-44" dnum="b-o" numlevel="1" lineno="94" slineno="1-70" level="2"><display>(b)</display>"Dependent" includes a child of the victim born after the victim's death.</subsection></subsection><subsection ssid="7-null-45" dnum="11-o" numlevel="1" lineno="95" slineno="1-71" level="1"><display>(11)</display>"Dependent's economic loss" means loss after the victim's death of contributions of <ln numlevel="1" lineno="96" slineno="1-72"/>things of economic value to the victim's dependent, not including services the dependent <ln numlevel="1" lineno="97" slineno="1-73"/>would have received from the victim if the victim had not suffered the fatal injury, less <ln numlevel="1" lineno="98" slineno="1-74"/>expenses of the dependent avoided by reason of victim's death.</subsection><subsection ssid="7-null-46" dnum="12-o" numlevel="1" lineno="99" slineno="1-75" level="1"><display>(12)</display>"Dependent's replacement services loss" means loss reasonably and necessarily <ln numlevel="1" lineno="100" slineno="1-76"/>incurred by the dependent after the victim's death in obtaining services in lieu of those <ln numlevel="1" lineno="101" slineno="1-77"/>the decedent would have performed for the victim's benefit if the victim had not suffered <ln numlevel="1" lineno="102" slineno="1-78"/>the fatal injury, less expenses of the dependent avoided by reason of the victim's death <ln numlevel="1" lineno="103" slineno="1-79"/>and not subtracted in calculating the dependent's economic loss.</subsection><subsection ssid="7-null-47" dnum="13-o" numlevel="1" lineno="104" slineno="1-80" level="1"><display>(13)</display>"Director" means the director of the office.</subsection><subsection ssid="7-null-48" dnum="14-o" numlevel="1" lineno="105" slineno="1-81" level="1"><display>(14)</display>"Disposition" means the sentencing or determination of penalty or punishment to be <ln numlevel="1" lineno="106" slineno="1-82"/>imposed upon an individual:<subsection ssid="7-null-49" dnum="a-o" numlevel="1" lineno="107" slineno="1-83" level="2"><display>(a)</display>convicted of a crime;</subsection><subsection ssid="7-null-50" dnum="b-o" numlevel="1" lineno="108" slineno="1-84" level="2"><display>(b)</display>found delinquent; or</subsection><subsection ssid="7-null-51" dnum="c-o" numlevel="1" lineno="109" slineno="1-85" level="2"><display>(c)</display>against whom a finding of sufficient facts for conviction or finding of delinquency is <ln numlevel="1" lineno="110" slineno="1-86"/>made.</subsection></subsection><subsection ssid="7-null-52" dnum="15-o" numlevel="1" lineno="111" slineno="1-87" level="1" space="false"><display>(15)</display><subsection ssid="7-null-53" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Economic loss" means economic detriment consisting only of allowable <ln numlevel="1" lineno="112" slineno="1-88"/>expense, work loss, replacement services loss, and if injury causes death, dependent's <ln numlevel="1" lineno="113" slineno="1-89"/>economic loss and dependent's replacement service loss.</subsection><subsection ssid="7-null-54" dnum="b-o" numlevel="1" lineno="114" slineno="1-90" level="2"><display>(b)</display>"Economic loss" includes economic detriment even if caused by pain and suffering <ln numlevel="1" lineno="115" slineno="1-91"/>or physical impairment.</subsection><subsection ssid="7-null-55" dnum="c-o" numlevel="1" lineno="116" slineno="1-92" level="2"><display>(c)</display>"Economic loss" does not include noneconomic detriment.</subsection></subsection><subsection ssid="7-null-56" dnum="16-o" numlevel="1" lineno="117" slineno="1-93" level="1"><display>(16)</display>"Elderly victim" means an individual who is 60 years old or older and who is a victim.</subsection><subsection ssid="7-null-57" dnum="17-o" numlevel="1" lineno="118" slineno="1-94" level="1"><display>(17)</display>"Fraudulent claim" means a filed reparations based on material misrepresentation of <ln numlevel="1" lineno="119" slineno="1-95"/>fact and intended to deceive the reparations staff for the purpose of obtaining reparation <ln numlevel="1" lineno="120" slineno="1-96"/>funds for which the claimant is not eligible.</subsection><subsection ssid="7-null-58" dnum="18-o" numlevel="1" lineno="121" slineno="1-97" level="1"><display>(18)</display>"Fund" means the Crime Victim Reparations Fund created in Section <xref depth="3" refnumber="63M-7-526">63M-7-526</xref>.</subsection><subsection ssid="7-null-59" dnum="19-o" numlevel="1" lineno="122" slineno="1-98" level="1" space="false"><display>(19)</display><subsection ssid="7-null-60" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Interpersonal violence" means an act involving violence, physical harm, or a <ln numlevel="1" lineno="123" slineno="1-99"/>threat of violence or physical harm, that is committed by an individual who is or has <ln numlevel="1" lineno="124" slineno="1-100"/>been in a domestic, dating, sexual, or intimate relationship with the victim.</subsection><subsection ssid="7-null-61" dnum="b-o" numlevel="1" lineno="125" slineno="1-101" level="2"><display>(b)</display>"Interpersonal violence" includes any attempt, conspiracy, or solicitation of an act <ln numlevel="1" lineno="126" slineno="1-102"/>described in Subsection <xref depth="4" refnumber="63M-7-502(19)(a)">(19)(a)</xref>.</subsection></subsection><subsection ssid="7-null-62" dnum="20-o" numlevel="1" lineno="127" slineno="1-103" level="1"><display>(20)</display>"Law enforcement agency" means a public or private agency having general police <ln numlevel="1" lineno="128" slineno="1-104"/>power and charged with making arrests in connection with enforcement of the criminal <ln numlevel="1" lineno="129" slineno="1-105"/>statutes and ordinances of this state or any political subdivision of this state.</subsection><subsection ssid="7-null-63" dnum="21-o" numlevel="1" lineno="130" slineno="1-106" level="1"><display>(21)</display>"Law enforcement officer" means the same as that term is defined in Section <xref depth="3" refnumber="53-13-103">53-13-103</xref>.</subsection><subsection ssid="7-null-64" dnum="22-o" numlevel="1" lineno="131" slineno="1-107" level="1" space="false"><display>(22)</display><subsection ssid="7-null-65" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Medical examination" means a physical examination necessary to document <ln numlevel="1" lineno="132" slineno="1-108"/>criminally injurious conduct.</subsection><subsection ssid="7-null-66" dnum="b-o" numlevel="1" lineno="133" slineno="1-109" level="2"><display>(b)</display>"Medical examination" does not include mental health evaluations for the <ln numlevel="1" lineno="134" slineno="1-110"/>prosecution and investigation of a crime.</subsection></subsection><subsection ssid="7-null-67" dnum="23-o" numlevel="1" lineno="135" slineno="1-111" level="1"><display>(23)</display>"Mental health counseling" means outpatient and inpatient counseling necessitated as a <ln numlevel="1" lineno="136" slineno="1-112"/>result of criminally injurious conduct, is subject to rules made by the office in <ln numlevel="1" lineno="137" slineno="1-113"/>accordance with Title <xref depth="1" refnumber="63G-3">63G, Chapter 3</xref>, Utah Administrative Rulemaking Act.</subsection><subsection ssid="7-null-68" dnum="24-o" numlevel="1" lineno="138" slineno="1-114" level="1"><display>(24)</display>"Misconduct" means conduct by the victim that was attributable to the injury or death <ln numlevel="1" lineno="139" slineno="1-115"/>of the victim as provided by rules made by the office in accordance with Title <xref depth="1" refnumber="63G-3">63G, <ln numlevel="1" lineno="140" slineno="1-116"/>Chapter 3</xref>, Utah Administrative Rulemaking Act.</subsection><subsection ssid="7-null-69" dnum="25-o" numlevel="1" lineno="141" slineno="1-117" level="1"><display>(25)</display>"Noneconomic detriment" means pain, suffering, inconvenience, physical impairment, <ln numlevel="1" lineno="142" slineno="1-118"/>and other nonpecuniary damage, except as provided in this part.</subsection><subsection ssid="7-null-70" dnum="26-o" numlevel="1" lineno="143" slineno="1-119" level="1"><display>(26)</display>"Nongovernment organization victim advocate" means the same as that term is defined <ln numlevel="1" lineno="144" slineno="1-120"/>in Section <xref depth="3" refnumber="77-38-403">77-38-403</xref>.</subsection><subsection ssid="7-null-71" dnum="27-o" numlevel="1" lineno="145" slineno="1-121" level="1"><display>(27)</display>"Nonpublic restitution record" means a restitution record that contains a claimant's <ln numlevel="1" lineno="146" slineno="1-122"/>medical or mental health information.</subsection><subsection ssid="7-null-72" dnum="28-o" numlevel="1" lineno="147" slineno="1-123" level="1"><display>(28)</display>"Pecuniary loss" does not include loss attributable to pain and suffering except as <ln numlevel="1" lineno="148" slineno="1-124"/>otherwise provided in this part.</subsection><subsection ssid="7-null-73" dnum="29-o" numlevel="1" lineno="149" slineno="1-125" level="1"><display>(29)</display>"Offender" means an individual who has violated Title <xref depth="0" refnumber="76">76, Utah Criminal Code</xref>, <ln numlevel="1" lineno="150" slineno="1-126"/>through criminally injurious conduct regardless of whether the individual is arrested, <ln numlevel="1" lineno="151" slineno="1-127"/>prosecuted, or convicted.</subsection><subsection ssid="7-null-74" dnum="30-o" numlevel="1" lineno="152" slineno="1-128" level="1"><display>(30)</display>"Offense" means a violation of Title <xref depth="0" refnumber="76">76, Utah Criminal Code</xref>.</subsection><subsection ssid="7-null-75" dnum="31-o" numlevel="1" lineno="153" slineno="1-129" level="1"><display>(31)</display>"Office" means the director, the reparations and assistance officers, and any other staff <ln numlevel="1" lineno="154" slineno="1-130"/>employed for the purpose of carrying out the provisions of this part.</subsection><subsection ssid="7-null-76" dnum="32-o" numlevel="1" lineno="155" slineno="1-131" level="1"><display>(32)</display>"Perpetrator" means the individual who actually participated in the criminally injurious <ln numlevel="1" lineno="156" slineno="1-132"/>conduct.</subsection><subsection ssid="7-null-77" dnum="33-o" numlevel="1" lineno="157" slineno="1-133" level="1"><display>(33)</display>"Public restitution record" means a restitution record that does not contain a claimant's <ln numlevel="1" lineno="158" slineno="1-134"/>medical or mental health information.</subsection><subsection ssid="7-null-78" dnum="34-o" numlevel="1" lineno="159" slineno="1-135" level="1" space="false"><display>(34)</display><subsection ssid="7-null-79" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Rape crisis and services center" means a nonprofit entity that assists victims of <ln numlevel="1" lineno="160" slineno="1-136"/>sexual assault and victims' families by offering sexual assault crisis intervention and <ln numlevel="1" lineno="161" slineno="1-137"/>counseling through a sexual assault counselor.</subsection><subsection ssid="7-null-80" dnum="b-o" numlevel="1" lineno="162" slineno="1-138" level="2"><display>(b)</display>"Rape crisis and services center" does not include a qualified institutional victim <ln numlevel="1" lineno="163" slineno="1-139"/>services provider as defined in Section <xref depth="3" refnumber="53H-14-401">53H-14-401</xref>.</subsection></subsection><subsection ssid="7-null-81" dnum="35-o" numlevel="1" lineno="164" slineno="1-140" level="1"><display>(35)</display>"Reparations award" means money or other benefits provided to a claimant or to <ln numlevel="1" lineno="165" slineno="1-141"/>another on behalf of a claimant after the day on which a reparations claim is approved <ln numlevel="1" lineno="166" slineno="1-142"/>by the office.</subsection><subsection ssid="7-null-82" dnum="36-o" numlevel="1" lineno="167" slineno="1-143" level="1"><display>(36)</display>"Reparations claim" means a claimant's request or application made to the office for a <ln numlevel="1" lineno="168" slineno="1-144"/>reparations award.</subsection><subsection ssid="7-null-83" dnum="37-o" numlevel="1" lineno="169" slineno="1-145" level="1" space="false"><display>(37)</display><subsection ssid="7-null-84" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Reparations officer" means an individual employed by the office to investigate <ln numlevel="1" lineno="170" slineno="1-146"/>a claimant's request for reparations and award reparations under this part.</subsection><subsection ssid="7-null-85" dnum="b-o" numlevel="1" lineno="171" slineno="1-147" level="2"><display>(b)</display>"Reparations officer" includes the director when the director is acting as a <ln numlevel="1" lineno="172" slineno="1-148"/>reparations officer.</subsection></subsection><subsection ssid="7-null-86" dnum="38-o" numlevel="1" lineno="173" slineno="1-149" level="1"><display>(38)</display>"Replacement service loss" means expenses reasonably and necessarily incurred in <ln numlevel="1" lineno="174" slineno="1-150"/>obtaining ordinary and necessary services in lieu of those the injured individual would <ln numlevel="1" lineno="175" slineno="1-151"/>have performed, not for income but the benefit of the injured individual or the injured <ln numlevel="1" lineno="176" slineno="1-152"/>individual's dependents if the injured individual had not been injured.</subsection><subsection ssid="7-null-87" dnum="39-o" numlevel="1" lineno="177" slineno="1-153" level="1" space="false"><display>(39)</display><subsection ssid="7-null-88" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Representative" means the victim, immediate family member, legal guardian, <ln numlevel="1" lineno="178" slineno="1-154"/>attorney, conservator, executor, or an heir of an individual.</subsection><subsection ssid="7-null-89" dnum="b-o" numlevel="1" lineno="179" slineno="1-155" level="2"><display>(b)</display>"Representative" does not include a service provider or collateral source.</subsection></subsection><subsection ssid="7-null-90" dnum="40-o" numlevel="1" lineno="180" slineno="1-156" level="1"><display>(40)</display>"Restitution" means the same as that term is defined in Section <xref depth="3" refnumber="77-38b-102">77-38b-102</xref>.</subsection><subsection ssid="7-null-91" dnum="41-o" numlevel="1" lineno="181" slineno="1-157" level="1" space="false"><display>(41)</display><subsection ssid="7-null-92" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Restitution record" means a record documenting payments made to, or on <ln numlevel="1" lineno="182" slineno="1-158"/>behalf of, a claimant by the office that the office relies on to support a restitution <ln numlevel="1" lineno="183" slineno="1-159"/>request made in accordance with Section <xref depth="3" refnumber="77-38b-205">77-38b-205</xref>.</subsection><subsection ssid="7-null-93" dnum="b-o" numlevel="1" lineno="184" slineno="1-160" level="2"><display>(b)</display>"Restitution record" includes:<subsection ssid="7-null-94" dnum="i-o" numlevel="1" lineno="185" slineno="1-161" level="3"><display>(i)</display>a notice of restitution;</subsection><subsection ssid="7-null-95" dnum="ii-o" numlevel="1" lineno="186" slineno="1-162" level="3"><display>(ii)</display>an itemized list of payments;</subsection><subsection ssid="7-null-96" dnum="iii-o" numlevel="1" lineno="187" slineno="1-163" level="3"><display>(iii)</display>an invoice, receipt, or bill submitted to the office for reimbursement; and</subsection><subsection ssid="7-null-97" dnum="iv-o" numlevel="1" lineno="188" slineno="1-164" level="3"><display>(iv)</display>any documentation that the office relies on to establish a nexus between an <ln numlevel="1" lineno="189" slineno="1-165"/>offender's criminally injurious conduct and a reparations award made by the office.</subsection></subsection></subsection><subsection ssid="7-null-98" dnum="42-o" numlevel="1" lineno="190" slineno="1-166" level="1"><display>(42)</display>"Secondary victim" means an individual who is traumatically affected by the <ln numlevel="1" lineno="191" slineno="1-167"/>criminally injurious conduct subject to rules made by the office in accordance with Title <xref depth="1" refnumber="63G-3"><ln numlevel="1" lineno="192" slineno="1-168"/>63G, Chapter 3</xref>, Utah Administrative Rulemaking Act.</subsection><subsection ssid="7-null-99" dnum="43-o" numlevel="1" lineno="193" slineno="1-169" level="1"><display>(43)</display>"Service provider" means an individual or agency who provides a service to a claimant <ln numlevel="1" lineno="194" slineno="1-170"/>for a monetary fee, except attorneys as provided in Section <xref depth="3" refnumber="63M-7-524">63M-7-524</xref>.</subsection><subsection ssid="7-null-100" dnum="44-o" numlevel="1" lineno="195" slineno="1-171" level="1"><display>(44)</display>"Serious bodily injury" means the same as that term is defined in Section <xref depth="3" refnumber="76-1-101.5">76-1-101.5</xref>.</subsection><subsection ssid="7-null-101" dnum="45-o" numlevel="1" lineno="196" slineno="1-172" level="1" space="false"><display>(45)</display><subsection ssid="7-null-102" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Sexual assault" means any criminal conduct described in Title <xref depth="2" refnumber="76-5-4">76, Chapter 5, <ln numlevel="1" lineno="197" slineno="1-173"/>Part 4</xref>, Sexual Offenses.</subsection><subsection ssid="7-null-103" dnum="b-o" numlevel="1" lineno="198" slineno="1-174" level="2"><display>(b)</display>"Sexual assault" does not include criminal conduct described in:<subsection ssid="7-null-104" dnum="i-o" numlevel="1" lineno="199" slineno="1-175" level="3"><display>(i)</display>Section <xref depth="3" refnumber="76-5-417">76-5-417</xref>, enticing a minor;</subsection><subsection ssid="7-null-105" dnum="ii-o" numlevel="1" lineno="200" slineno="1-176" level="3"><display>(ii)</display>Section <xref depth="3" refnumber="76-5-418">76-5-418</xref>, sexual battery;</subsection><subsection ssid="7-null-106" dnum="iii-o" numlevel="1" lineno="201" slineno="1-177" level="3"><display>(iii)</display>Section <xref depth="3" refnumber="76-5-419">76-5-419</xref>, lewdness; or</subsection><subsection ssid="7-null-107" dnum="iv-o" numlevel="1" lineno="202" slineno="1-178" level="3"><display>(iv)</display>Section <xref depth="3" refnumber="76-5-420">76-5-420</xref>, lewdness involving a child.</subsection></subsection></subsection><subsection ssid="7-null-108" dnum="46-o" numlevel="1" lineno="203" slineno="1-179" level="1"><display>(46)</display>"Sexual assault counselor" means an individual who:<subsection ssid="7-null-109" dnum="a-o" numlevel="1" lineno="204" slineno="1-180" level="2"><display>(a)</display>is employed by or volunteers at a rape crisis and services center;</subsection><subsection ssid="7-null-110" dnum="b-o" numlevel="1" lineno="205" slineno="1-181" level="2"><display>(b)</display>has a minimum of 40 hours of training in counseling and assisting victims of sexual <ln numlevel="1" lineno="206" slineno="1-182"/>assault; and</subsection><subsection ssid="7-null-111" dnum="c-o" numlevel="1" lineno="207" slineno="1-183" level="2"><display>(c)</display>is under the supervision of the director of a rape crisis and services center or the <ln numlevel="1" lineno="208" slineno="1-184"/>director's designee.</subsection></subsection><subsection ssid="7-null-112" dnum="47-o" numlevel="1" lineno="209" slineno="1-185" level="1"><display>(47)</display>"Strangulation" means any act involving the use of unlawful force or violence that:<subsection ssid="7-null-113" dnum="a-o" numlevel="1" lineno="210" slineno="1-186" level="2"><display>(a)</display>impedes breathing or the circulation of blood; and</subsection><subsection ssid="7-null-114" dnum="b-o" numlevel="1" lineno="211" slineno="1-187" level="2"><display>(b)</display>is likely to produce a loss of consciousness by:<subsection ssid="7-null-115" dnum="i-o" numlevel="1" lineno="212" slineno="1-188" level="3"><display>(i)</display>applying pressure to the neck or throat of an individual; or</subsection><subsection ssid="7-null-116" dnum="ii-o" numlevel="1" lineno="213" slineno="1-189" level="3"><display>(ii)</display>obstructing the nose, mouth, or airway of an individual.</subsection></subsection></subsection><subsection ssid="7-null-117" dnum="48-o" numlevel="1" lineno="214" slineno="1-190" level="1"><display>(48)</display>"Substantial bodily injury" means the same as that term is defined in Section <xref depth="3" refnumber="76-1-101.5"><ln numlevel="1" lineno="215" slineno="1-191"/>76-1-101.5</xref>.</subsection><subsection ssid="7-null-118" dnum="49-o" numlevel="1" lineno="216" slineno="1-192" level="1" space="false"><display>(49)</display><subsection ssid="7-null-119" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Victim" means an individual who suffers bodily or psychological injury or <ln numlevel="1" lineno="217" slineno="1-193"/>death as a direct result of:<subsection ssid="7-null-120" dnum="i-o" numlevel="1" lineno="218" slineno="1-194" level="3" tab="1"><display>(i)</display>criminally injurious conduct; or</subsection><subsection ssid="7-null-121" dnum="ii-o" numlevel="1" lineno="219" slineno="1-195" level="3" tab="1"><display>(ii)</display>the production of pornography in violation of Section <xref depth="3" refnumber="76-5b-201">76-5b-201</xref> or <xref depth="3" refnumber="76-5b-201.1">76-5b-201.1</xref> <ln numlevel="1" lineno="220" slineno="1-196"/>if the individual is a minor.</subsection></subsection><subsection ssid="7-null-122" dnum="b-o" numlevel="1" lineno="221" slineno="1-197" level="2"><display>(b)</display>"Victim" does not include an individual who participated in or observed the judicial <ln numlevel="1" lineno="222" slineno="1-198"/>proceedings against an offender unless otherwise provided by statute or rule made in <ln numlevel="1" lineno="223" slineno="1-199"/>accordance with Title <xref depth="1" refnumber="63G-3">63G, Chapter 3</xref>, Utah Administrative Rulemaking Act.</subsection></subsection><subsection ssid="7-null-123" dnum="50-o" numlevel="1" lineno="224" slineno="1-200" level="1"><display>(50)</display>"Work loss" means loss of income from work the injured victim would have performed <ln numlevel="1" lineno="225" slineno="1-201"/>if the injured victim had not been injured and expenses reasonably incurred by the <ln numlevel="1" lineno="226" slineno="1-202"/>injured victim in obtaining services in lieu of those the injured victim would have <ln numlevel="1" lineno="227" slineno="1-203"/>performed for income, reduced by any income from substitute work the injured victim <ln numlevel="1" lineno="228" slineno="1-204"/>was capable of performing but unreasonably failed to undertake.</subsection></section></bsec><bsec buid="5" num="63M-7-509" type="amend" src="code" uid="C63M-7-S509_2026050620260506" sort="63M07 05090020260506" numlevel="1" lineno="229" slineno="2-1" sn="2"><section number="63M-7-509" numlevel="1" lineno="230" slineno="2-2" type="amend"><secline lineno="229">Section 2. Section <bold>63M-7-509</bold> is amended to read:</secline><catline lineno="230"><bold>63M-7-509<parens/>. Grounds for eligibility.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="231" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>A victim is eligible for a reparations award under this part if:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="232" slineno="2-4" level="2"><display>(a)</display>the claimant is:<subsection ssid="5-null-3" dnum="i-o" numlevel="1" lineno="233" slineno="2-5" level="3"><display>(i)</display>a victim of criminally injurious conduct;</subsection><subsection ssid="5-null-4" dnum="ii-o" numlevel="1" lineno="234" slineno="2-6" level="3"><display>(ii)</display>a dependent of a deceased victim of criminally injurious conduct; or</subsection><subsection ssid="5-null-5" dnum="iii-o" numlevel="1" lineno="235" slineno="2-7" level="3"><display>(iii)</display>a representative acting on behalf of one of the above;</subsection></subsection><subsection ssid="5-null-6" dnum="b-o" numlevel="1" lineno="236" slineno="2-8" level="2" space="false"><display>(b)</display><subsection ssid="5-null-7" dnum="i-o" level="3" placement="sameline"><display>(i)</display>the criminally injurious conduct occurred in Utah; or</subsection><subsection ssid="5-null-8" dnum="ii-o" numlevel="1" lineno="237" slineno="2-9" level="3"><display>(ii)</display>the victim is a Utah resident who suffers injury or death as a result of criminally <ln numlevel="1" lineno="238" slineno="2-10"/>injurious conduct inflicted in a state, territory, or country that does not provide a <ln numlevel="1" lineno="239" slineno="2-11"/>crime victims' compensation program;</subsection></subsection><subsection ssid="5-null-9" dnum="c-o" numlevel="1" lineno="240" slineno="2-12" level="2"><display>(c)</display>the application is made in writing in a form that conforms substantially to that <ln numlevel="1" lineno="241" slineno="2-13"/>prescribed by the office;</subsection><subsection ssid="5-null-10" dnum="d-o" numlevel="1" lineno="242" slineno="2-14" level="2"><display>(d)</display>the criminally injurious conduct is reported to a law enforcement officer, in the law <ln numlevel="1" lineno="243" slineno="2-15"/>enforcement officer's capacity as a law enforcement officer, or another federal or <ln numlevel="1" lineno="244" slineno="2-16"/>state investigative agency;</subsection><subsection ssid="5-null-11" dnum="e-o" numlevel="1" lineno="245" slineno="2-17" level="2"><display>(e)</display>the claimant or victim cooperates with the appropriate law enforcement agencies and <ln numlevel="1" lineno="246" slineno="2-18"/>prosecuting attorneys in efforts to apprehend or convict the perpetrator of the alleged <ln numlevel="1" lineno="247" slineno="2-19"/>offense; and</subsection><subsection ssid="5-null-12" dnum="f-o" numlevel="1" lineno="248" slineno="2-20" level="2"><display>(f)</display>the criminally injurious conduct occurred after December 31, 1986.</subsection></subsection><subsection ssid="5-null-13" dnum="2-o" numlevel="1" lineno="249" slineno="2-21" level="1"><display>(2)</display>A reparations award may be made to a victim regardless of whether any individual is <ln numlevel="1" lineno="250" slineno="2-22"/>arrested, prosecuted, or convicted of the criminally injurious conduct giving rise to a <ln numlevel="1" lineno="251" slineno="2-23"/>reparations claim.</subsection><subsection ssid="5-null-14" dnum="3-o" numlevel="1" lineno="252" slineno="2-24" level="1" space="false"><display>(3)</display><subsection ssid="5-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding the requirements of Subsections <xref depth="4" refnumber="63M-7-509(1)(d)" start="0">(1)(d)</xref> and <xref depth="4" refnumber="63M-7-509(1)(e)" start="0">(e)</xref>, a victim of sexual <ln numlevel="1" lineno="253" slineno="2-25"/>assault is not required to report the sexual assault to a law enforcement officer or <ln numlevel="1" lineno="254" slineno="2-26"/>another federal or state investigative agency or cooperate with the appropriate law <ln numlevel="1" lineno="255" slineno="2-27"/>enforcement agencies and prosecuting attorneys to be eligible for a reparations award <ln numlevel="1" lineno="256" slineno="2-28"/>under this section if:<subsection ssid="5-null-16" dnum="i-o" numlevel="1" lineno="257" slineno="2-29" level="3" tab="1"><display>(i)</display>the victim seeks assistance from an advocacy services provider, a criminal justice  <ln numlevel="1" lineno="258" slineno="2-30"/>system victim advocate, or a nongovernment organization victim advocate; and</subsection><subsection ssid="5-null-17" dnum="ii-o" numlevel="1" lineno="259" slineno="2-31" level="3" tab="1"><display>(ii)</display>the advocacy services provider, the criminal justice system victim advocate, or <ln numlevel="1" lineno="260" slineno="2-32"/>the nongovernment organization victim advocate completes a questionnaire, <ln numlevel="1" lineno="261" slineno="2-33"/>provided by the office, regarding the sexual assault.</subsection></subsection><subsection ssid="5-null-18" dnum="b-o" numlevel="1" lineno="262" slineno="2-34" level="2"><display>(b)</display>Notwithstanding the requirement of Subsection <xref depth="4" refnumber="63M-7-509(1)(e)" start="0">(1)(e)</xref>, a victim who has suffered <ln numlevel="1" lineno="263" slineno="2-35"/>strangulation in the course of interpersonal violence is not required to cooperate with <ln numlevel="1" lineno="264" slineno="2-36"/>the appropriate law enforcement agencies and prosecuting attorneys to be eligible for <ln numlevel="1" lineno="265" slineno="2-37"/>a reparations award under this section if the victim:<subsection ssid="5-null-19" dnum="i-o" numlevel="1" lineno="266" slineno="2-38" level="3"><display>(i)</display>reports the strangulation to a law enforcement officer or another federal or state <ln numlevel="1" lineno="267" slineno="2-39"/>investigative agency after the strangulation occurs; or</subsection><subsection ssid="5-null-20" dnum="ii-o" numlevel="1" lineno="268" slineno="2-40" level="3"><display>(ii)</display>seeks medical care for the strangulation immediately after the strangulation <ln numlevel="1" lineno="269" slineno="2-41"/>occurs.</subsection></subsection></subsection><subsection ssid="5-22" dnum="_-o:4-i" numlevel="1" lineno="270" slineno="2-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1149" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="0" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">An individual is eligible to receive a reparations award for mental health counseling <ln numlevel="1" lineno="271" slineno="2-43"/>resulting from a sexual assault that occurred in a prison, a jail, or a correctional facility <ln numlevel="1" lineno="272" slineno="2-44"/>while the individual is incarcerated if:</amend><subsection ssid="5-23" dnum="_-o:a-i" numlevel="1" lineno="273" slineno="2-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1150" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">the individual is no longer incarcerated; and</amend></subsection><subsection ssid="5-24" dnum="_-o:b-i" numlevel="1" lineno="274" slineno="2-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1151" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">the individual meets the eligibility requirements described in Subsection <xref depth="4" refnumber="63M-7-509(1)">(1)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="3" num="63M-7-510" type="amend" src="code" uid="C63M-7-S510_2026050620260506" sort="63M07 05100020260506" numlevel="1" lineno="275" slineno="3-1" sn="3"><section number="63M-7-510" numlevel="1" lineno="276" slineno="3-2" type="amend"><secline lineno="275">Section 3. Section <bold>63M-7-510</bold> is amended to read:</secline><catline lineno="276"><bold>63M-7-510<parens/>. Ineligible individuals -- Fraudulent reparations claims -- Penalties.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="277" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>The following individuals are not eligible to receive a reparations award:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="278" slineno="3-4" level="2"><display>(a)</display>an individual who does not meet all of the provisions set forth in Section <xref depth="3" refnumber="63M-7-509" start="0">63M-7-509</xref>;</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="279" slineno="3-5" level="2"><display>(b)</display>the offender;</subsection><subsection ssid="3-null-4" dnum="c-o" numlevel="1" lineno="280" slineno="3-6" level="2"><display>(c)</display>an accomplice of the offender;</subsection><subsection ssid="3-null-5" dnum="d-o" numlevel="1" lineno="281" slineno="3-7" level="2"><display>(d)</display>an individual whose receipt of a reparations award would unjustly benefit the <ln numlevel="1" lineno="282" slineno="3-8"/>offender, accomplice, or another individual reasonably suspected of participating in <ln numlevel="1" lineno="283" slineno="3-9"/>the offense;</subsection><subsection ssid="3-null-6" dnum="e-o" numlevel="1" lineno="284" slineno="3-10" level="2"><display>(e)</display>the victim of a motor vehicle injury who was the owner or operator of the motor <ln numlevel="1" lineno="285" slineno="3-11"/>vehicle and was not at the time of the injury in compliance with the state motor <ln numlevel="1" lineno="286" slineno="3-12"/>vehicle insurance laws;</subsection><subsection ssid="3-null-7" dnum="f-o" numlevel="1" lineno="287" slineno="3-13" level="2"><display>(f)</display>a convicted offender serving a sentence of imprisonment in any prison or jail or <ln numlevel="1" lineno="288" slineno="3-14"/>residing in any other correctional facility;</subsection><subsection ssid="3-null-8" dnum="g-o" numlevel="1" lineno="289" slineno="3-15" level="2"><display>(g)</display>an individual who is on probation or parole if the circumstances surrounding the <ln numlevel="1" lineno="290" slineno="3-16"/>offense of which the individual is a victim is a violation of the individual's probation <ln numlevel="1" lineno="291" slineno="3-17"/>or parole; </subsection><subsection ssid="3-null-9" dnum="h-o" numlevel="1" lineno="292" slineno="3-18" level="2"><display>(h)</display><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both">except as provided in Subsection <xref depth="4" refnumber="63M-7-509(4)">63M-7-509(4)</xref>, </amend>an individual whose injuries are the <ln numlevel="1" lineno="293" slineno="3-19"/>result of criminally injurious conduct that occurred in a prison, jail, or another <ln numlevel="1" lineno="294" slineno="3-20"/>correctional facility while the individual was incarcerated; and</subsection><subsection ssid="3-null-10" dnum="i-o" numlevel="1" lineno="295" slineno="3-21" level="2"><display>(i)</display>an individual who:<subsection ssid="3-null-11" dnum="i-o" numlevel="1" lineno="296" slineno="3-22" level="3"><display>(i)</display>submits a fraudulent claim; or</subsection><subsection ssid="3-null-12" dnum="ii-o" numlevel="1" lineno="297" slineno="3-23" level="3"><display>(ii)</display>misrepresents a material fact in requesting a reparations award.</subsection></subsection></subsection><subsection ssid="3-null-13" dnum="2-o" numlevel="1" lineno="298" slineno="3-24" level="1" space="false"><display>(2)</display><subsection ssid="3-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual may not knowingly:<subsection ssid="3-null-15" dnum="i-o" numlevel="1" lineno="299" slineno="3-25" level="3" tab="1"><display>(i)</display>submit a fraudulent claim; or</subsection><subsection ssid="3-null-16" dnum="ii-o" numlevel="1" lineno="300" slineno="3-26" level="3" tab="1"><display>(ii)</display>misrepresent a material fact in requesting a reparations award.</subsection></subsection><subsection ssid="3-null-17" dnum="b-o" numlevel="1" lineno="301" slineno="3-27" level="2"><display>(b)</display>A violation of Subsection <xref depth="4" refnumber="63M-7-510(2)(a)" start="0">(2)(a)</xref> is:<subsection ssid="3-null-18" dnum="i-o" numlevel="1" lineno="302" slineno="3-28" level="3"><display>(i)</display>a class B misdemeanor if:<subsection ssid="3-null-19" dnum="A-o" numlevel="1" lineno="303" slineno="3-29" level="4"><display>(A)</display>the individual who violates Subsection <xref depth="4" refnumber="63M-7-510(2)(a)" start="0">(2)(a)</xref> does not receive a reparations <ln numlevel="1" lineno="304" slineno="3-30"/>award; or</subsection><subsection ssid="3-null-20" dnum="B-o" numlevel="1" lineno="305" slineno="3-31" level="4"><display>(B)</display>the value of the reparations award received is less than $500;</subsection></subsection><subsection ssid="3-null-21" dnum="ii-o" numlevel="1" lineno="306" slineno="3-32" level="3"><display>(ii)</display>a class A misdemeanor if the value of the reparations award received is or <ln numlevel="1" lineno="307" slineno="3-33"/>exceeds $500 but is less than $1,500;</subsection><subsection ssid="3-null-22" dnum="iii-o" numlevel="1" lineno="308" slineno="3-34" level="3"><display>(iii)</display>a third degree felony if the value of the reparations award received is or exceeds <ln numlevel="1" lineno="309" slineno="3-35"/>$1,500 but is less than $5,000; and</subsection><subsection ssid="3-null-23" dnum="iv-o" numlevel="1" lineno="310" slineno="3-36" level="3"><display>(iv)</display>a second degree felony if the value of the reparations award received is or <ln numlevel="1" lineno="311" slineno="3-37"/>exceeds $5,000.</subsection></subsection></subsection><subsection ssid="3-null-24" dnum="3-o" numlevel="1" lineno="312" slineno="3-38" level="1"><display>(3)</display>The state attorney general may prosecute violations under this section or may make <ln numlevel="1" lineno="313" slineno="3-39"/>arrangements with county or city attorneys for the prosecution of violations under this <ln numlevel="1" lineno="314" slineno="3-40"/>section when the attorney general cannot conveniently prosecute.</subsection><subsection ssid="3-null-25" dnum="4-o" numlevel="1" lineno="315" slineno="3-41" level="1" space="false"><display>(4)</display><subsection ssid="3-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A claimant who is not eligible to receive a reparations award under Subsection <xref depth="4" refnumber="63M-7-510(1)" start="0">(1)</xref> <ln numlevel="1" lineno="316" slineno="3-42"/>but receives a reparations award shall reimburse the fund for the amount of the <ln numlevel="1" lineno="317" slineno="3-43"/>reparations award.</subsection><subsection ssid="3-null-27" dnum="b-o" numlevel="1" lineno="318" slineno="3-44" level="2"><display>(b)</display>The office may bring a civil action against a victim who does not reimburse the fund <ln numlevel="1" lineno="319" slineno="3-45"/>for the amount of the reparations award in accordance with Subsection <xref depth="4" refnumber="63M-7-510(4)(a)" start="0">(4)(a)</xref>.</subsection></subsection></section></bsec><bsec buid="9" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="320" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="320">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="321"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-3-26 3:08 PM</tm></rev></foot></leg>
