Section <bold>53G-7-228</bold> is enacted to read:</secline><catline lineno="26"><bold>53G-7-228<parens/>. Artificial turf installation -- Notice and public hearing requirements.</bold></catline><subsection ssid="1-1" dnum="_-o:1-i" numlevel="1" lineno="27" slineno="1-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="1-2" dnum="_-o:a-i" numlevel="1" lineno="28" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">"Artificial turf" means a surface of synthetic fibers made to resemble natural grass, <ln numlevel="1" lineno="29" slineno="1-5"/>including any infill material such as crumb rubber.</amend></subsection><subsection ssid="1-3" dnum="_-o:b-i" numlevel="1" lineno="30" slineno="1-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">"Installation" means the initial placement of artificial turf on LEA property, <ln numlevel="1" lineno="31" slineno="1-7"/>including replacement of natural grass or existing surfaces with artificial turf.</amend></subsection><subsection ssid="1-4" dnum="_-o:c-i" numlevel="1" lineno="32" slineno="1-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">"LEA governing board" means the same as that term is defined in Section <xref depth="3" refnumber="53G-7-303">53G-7-303</xref>.</amend></subsection><subsection ssid="1-7" dnum="_-o:d-i" numlevel="1" lineno="33" slineno="1-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">"Property owner" means an individual or entity that:</amend><subsection ssid="1-8" dnum="_-o:i-i" numlevel="1" lineno="34" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">owns real property with a property boundary within the notification radius <ln numlevel="1" lineno="35" slineno="1-11"/>established under Subsection <xref depth="4" refnumber="53G-7-228(4)">(4)</xref>; or</amend></subsection><subsection ssid="1-9" dnum="_-o:ii-i" numlevel="1" lineno="36" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">resides on real property with a property boundary within the notification radius <ln numlevel="1" lineno="37" slineno="1-13"/>established under Subsection <xref depth="4" refnumber="53G-7-228(4)">(4)</xref>.</amend></subsection></subsection><subsection ssid="1-96" dnum="_-o:e-i" numlevel="1" lineno="38" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="404" groupid="298" style="1" owner="jchristopherson" level="1" amendtag="end">"Substantial shade or tree coverage" means a minimum of 30 percent tree canopy or <ln numlevel="1" lineno="39" slineno="1-15"/>permanent shade-structure coverage within a 150-foot horizontal radius of the outer <ln numlevel="1" lineno="40" slineno="1-16"/>boundary of the field, including existing trees, additional trees or man-made shade <ln numlevel="1" lineno="41" slineno="1-17"/>structure, to reach 30 percent coverage, with percentage to be documented by current <ln numlevel="1" lineno="42" slineno="1-18"/>aerial imagery or another form of certified canopy analysis consistent with accepted <ln numlevel="1" lineno="43" slineno="1-19"/>urban tree canopy assessment methodologies. </amend></subsection><subsection ssid="1-97" dnum="_-o:f-i" numlevel="1" lineno="44" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="407" groupid="300" style="1" owner="jchristopherson" level="1" amendtag="end">"Tree canopy coverage" means the percentage of ground area overlain by tree crowns <ln numlevel="1" lineno="45" slineno="1-21"/>or permanent shade structures when viewed from above, as measured using accepted <ln numlevel="1" lineno="46" slineno="1-22"/>urban tree canopy assessment methodologies.</amend></subsection></subsection><subsection ssid="1-10" dnum="_-o:2-i" numlevel="1" lineno="47" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">Before installing artificial turf on LEA property, an LEA governing board shall:</amend><subsection ssid="1-11" dnum="_-o:a-i" numlevel="1" lineno="48" slineno="1-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">provide notice in accordance with Subsections <xref depth="4" refnumber="53G-7-228(3)">(3)</xref> and <xref depth="4" refnumber="53G-7-228(4)">(4)</xref>; and</amend></subsection><subsection ssid="1-12" dnum="_-o:b-i" numlevel="1" lineno="49" slineno="1-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">hold a public hearing in accordance with Subsection <xref depth="4" refnumber="53G-7-228(5)">(5)</xref>.</amend></subsection></subsection><subsection ssid="1-25" dnum="_-o:3-i" numlevel="1" lineno="50" slineno="1-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="1-26" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="113" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA governing board shall provide written notice to each property owner <ln numlevel="1" lineno="51" slineno="1-27"/>within the notification radius established under Subsection <xref depth="4" refnumber="53G-7-228(4)">(4)</xref> at least 30 days before <ln numlevel="1" lineno="52" slineno="1-28"/>the date of the public hearing required under Subsection <xref depth="4" refnumber="53G-7-228(5)">(5)</xref>.</amend></subsection><subsection ssid="1-86" dnum="_-o:b-i" numlevel="1" lineno="53" slineno="1-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="356" groupid="260" style="1" owner="jchristopherson" level="1" amendtag="end">The LEA governing board shall deliver the written notice required under Subsection <xref depth="4" refnumber="53G-7-228(3)(a)"><ln numlevel="1" lineno="54" slineno="1-30"/>(3)(a)</xref> by:</amend><subsection ssid="1-87" dnum="_-o:i-i" numlevel="1" lineno="55" slineno="1-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="363" groupid="265" style="1" owner="jchristopherson" level="1" amendtag="end">mailing the notice by United States mail to the property address; or</amend></subsection><subsection ssid="1-88" dnum="_-o:ii-i" numlevel="1" lineno="56" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="368" groupid="269" style="1" owner="jchristopherson" level="1" amendtag="end">hand delivering the notice to the property address.</amend></subsection></subsection><subsection ssid="1-27" dnum="_-o:c-i" numlevel="1" lineno="57" slineno="1-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="123" groupid="91" style="1" owner="jchristopherson" level="1" amendtag="end">The written notice shall include:</amend><subsection ssid="1-28" dnum="_-o:i-i" numlevel="1" lineno="58" slineno="1-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="128" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="end">a description of the proposed artificial turf installation, including:</amend><subsection ssid="1-29" dnum="_-o:A-i" numlevel="1" lineno="59" slineno="1-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="133" groupid="99" style="1" owner="jchristopherson" level="1" amendtag="end">the location of the proposed installation;</amend></subsection><subsection ssid="1-30" dnum="_-o:B-i" numlevel="1" lineno="60" slineno="1-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="138" groupid="103" style="1" owner="jchristopherson" level="1" amendtag="end">the size of the proposed installation;</amend></subsection><subsection ssid="1-31" dnum="_-o:C-i" numlevel="1" lineno="61" slineno="1-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="143" groupid="107" style="1" owner="jchristopherson" level="1" amendtag="end">the type of artificial turf and infill material proposed; and</amend></subsection><subsection ssid="1-32" dnum="_-o:D-i" numlevel="1" lineno="62" slineno="1-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="148" groupid="111" style="1" owner="jchristopherson" level="1" amendtag="end">the intended use of the artificial turf;</amend></subsection></subsection><subsection ssid="1-33" dnum="_-o:ii-i" numlevel="1" lineno="63" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="114" style="1" owner="jchristopherson" level="1" amendtag="end">a summary of potential environmental effects, including:</amend><subsection ssid="1-34" dnum="_-o:A-i" numlevel="1" lineno="64" slineno="1-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="158" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="end">heat island effects and elevated ambient temperatures;</amend></subsection><subsection ssid="1-35" dnum="_-o:B-i" numlevel="1" lineno="65" slineno="1-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="163" groupid="121" style="1" owner="jchristopherson" level="1" amendtag="end">volatile organic compound emissions;</amend></subsection><subsection ssid="1-36" dnum="_-o:C-i" numlevel="1" lineno="66" slineno="1-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="167" groupid="124" style="1" owner="jchristopherson" level="1" amendtag="end">potential soil contamination; and</amend></subsection><subsection ssid="1-37" dnum="_-o:D-i" numlevel="1" lineno="67" slineno="1-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="172" groupid="128" style="1" owner="jchristopherson" level="1" amendtag="end">potential groundwater and surface water contamination;</amend></subsection></subsection><subsection ssid="1-38" dnum="_-o:iii-i" numlevel="1" lineno="68" slineno="1-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="178" groupid="131" style="1" owner="jchristopherson" level="1" amendtag="end">in accordance with Subsection <xref depth="4" refnumber="53G-7-228(4)">(4)</xref>, the notification radius used and the reason for <ln numlevel="1" lineno="69" slineno="1-45"/>that radius;</amend></subsection><subsection ssid="1-39" dnum="_-o:iv-i" numlevel="1" lineno="70" slineno="1-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="182" groupid="134" style="1" owner="jchristopherson" level="1" amendtag="end">the date, time, and location of the public hearing required under Subsection <xref depth="4" refnumber="53G-7-228(5)">(5)</xref>;</amend></subsection><subsection ssid="1-40" dnum="_-o:v-i" numlevel="1" lineno="71" slineno="1-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="183" groupid="135" style="1" owner="jchristopherson" level="1" amendtag="end">a statement that the property owner may appear at the public hearing to provide <ln numlevel="1" lineno="72" slineno="1-48"/>comment on the proposed installation;</amend></subsection><subsection ssid="1-41" dnum="_-o:vi-i" numlevel="1" lineno="73" slineno="1-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="189" groupid="139" style="1" owner="jchristopherson" level="1" amendtag="end">contact information for the LEA where the property owner may obtain additional <ln numlevel="1" lineno="74" slineno="1-50"/>information about the proposed installation;</amend></subsection><subsection ssid="1-95" dnum="_-o:vii-i" numlevel="1" lineno="75" slineno="1-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="401" groupid="296" style="1" owner="jchristopherson" level="1" amendtag="end">information for the online location where the property owner may obtain <ln numlevel="1" lineno="76" slineno="1-52"/>additional information and updates on the proposed installation; and</amend></subsection><subsection ssid="1-42" dnum="_-o:viii-i" numlevel="1" lineno="77" slineno="1-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="193" groupid="142" style="1" owner="jchristopherson" level="1" amendtag="end">information on how to access any studies, reports, or environmental <ln numlevel="1" lineno="78" slineno="1-54"/>assessments related to the proposed installation.</amend></subsection></subsection><subsection ssid="1-43" dnum="_-o:d-i" numlevel="1" lineno="79" slineno="1-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="194" groupid="143" style="1" owner="jchristopherson" level="1" amendtag="end">In addition to the written notice required under Subsection <xref depth="4" refnumber="53G-7-228(3)(a)">(3)(a)</xref>, at least 60 days <ln numlevel="1" lineno="80" slineno="1-56"/>before the date of the public hearing, an LEA governing board shall:</amend><subsection ssid="1-44" dnum="_-o:i-i" numlevel="1" lineno="81" slineno="1-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="200" groupid="147" style="1" owner="jchristopherson" level="1" amendtag="end">publish a notice of the proposed installation and public hearing in a newspaper or <ln numlevel="1" lineno="82" slineno="1-58"/>combination of newspapers of general circulation in the area of the proposed <ln numlevel="1" lineno="83" slineno="1-59"/>installation, except as provided in Section <xref depth="3" refnumber="45-1-101">45-1-101</xref>;</amend></subsection><subsection ssid="1-45" dnum="_-o:ii-i" numlevel="1" lineno="84" slineno="1-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="201" groupid="148" style="1" owner="jchristopherson" level="1" amendtag="end">publish a notice of the proposed installation and public hearing electronically in <ln numlevel="1" lineno="85" slineno="1-61"/>accordance with Section <xref depth="3" refnumber="45-1-101">45-1-101</xref>; and</amend></subsection><subsection ssid="1-46" dnum="_-o:iii-i" numlevel="1" lineno="86" slineno="1-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="207" groupid="152" style="1" owner="jchristopherson" level="1" amendtag="end">post a notice of the proposed installation and public hearing on the LEA's <ln numlevel="1" lineno="87" slineno="1-63"/>website.</amend></subsection></subsection><subsection ssid="1-98" dnum="_-o:e-i" numlevel="1" lineno="88" slineno="1-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="410" groupid="302" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding any notice requirements under Title 52, Chapter 4, Open and Public <ln numlevel="1" lineno="89" slineno="1-65"/>Meetings Act, an LEA governing board shall:</amend><subsection ssid="1-99" dnum="_-o:i-i" numlevel="1" lineno="90" slineno="1-66" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="417" groupid="307" style="1" owner="jchristopherson" level="1" amendtag="end">update the website posting required under Subsection <xref depth="4" refnumber="53G-7-228(3)(d)(iii)">(3)(d)(iii)</xref> within seven days <ln numlevel="1" lineno="91" slineno="1-67"/>after a change to the proposed installation is made before the noticed meeting <ln numlevel="1" lineno="92" slineno="1-68"/>where the proposed installation will be discussed or voted on; and</amend></subsection><subsection ssid="1-100" dnum="_-o:ii-i" numlevel="1" lineno="93" slineno="1-69" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="422" groupid="311" style="1" owner="jchristopherson" level="1" amendtag="end">clearly state that an update has been made, including highlighting where to find <ln numlevel="1" lineno="94" slineno="1-70"/>the changes and explaining what the changes are.</amend></subsection></subsection><subsection ssid="1-47" dnum="_-o:f-i" numlevel="1" lineno="95" slineno="1-71" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="208" groupid="153" style="1" owner="jchristopherson" level="1" amendtag="end">The LEA governing board shall maintain documentation demonstrating compliance <ln numlevel="1" lineno="96" slineno="1-72"/>with the notice requirements of this Subsection <xref depth="4" refnumber="53G-7-228(3)">(3)</xref>, including:</amend><subsection ssid="1-48" dnum="_-o:i-i" numlevel="1" lineno="97" slineno="1-73" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="214" groupid="157" style="1" owner="jchristopherson" level="1" amendtag="end">a list of property owners notified;</amend></subsection><subsection ssid="1-49" dnum="_-o:ii-i" numlevel="1" lineno="98" slineno="1-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="219" groupid="161" style="1" owner="jchristopherson" level="1" amendtag="end">copies of written notices sent;</amend></subsection><subsection ssid="1-50" dnum="_-o:iii-i" numlevel="1" lineno="99" slineno="1-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="225" groupid="166" style="1" owner="jchristopherson" level="1" amendtag="end">proof of publication; and</amend></subsection><subsection ssid="1-51" dnum="_-o:iv-i" numlevel="1" lineno="100" slineno="1-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="229" groupid="169" style="1" owner="jchristopherson" level="1" amendtag="end">documentation of website posting.</amend></subsection></subsection></subsection><subsection ssid="1-73" dnum="_-o:4-i" numlevel="1" lineno="101" slineno="1-77" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="1-83" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="320" groupid="237" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA governing board shall determine the notification radius by measuring <ln numlevel="1" lineno="102" slineno="1-78"/>from the outer edge of the proposed artificial turf installation to property boundaries <ln numlevel="1" lineno="103" slineno="1-79"/>of surrounding properties.</amend></subsection><subsection ssid="1-74" dnum="_-o:b-i" numlevel="1" lineno="104" slineno="1-80" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="323" groupid="239" style="1" owner="jchristopherson" level="1" amendtag="end">Except as provided in Subsections <xref depth="4" refnumber="53G-7-228(4)(c)">(4)(c)</xref> and <xref depth="4" refnumber="53G-7-228(4)(d)">(4)(d)</xref>, an LEA governing board shall <ln numlevel="1" lineno="105" slineno="1-81"/>follow a minimum notification radius of 100 feet because artificial turf releases heat <ln numlevel="1" lineno="106" slineno="1-82"/>and substances that may affect air, soil, and water quality beyond the edge of the <ln numlevel="1" lineno="107" slineno="1-83"/>artificial turf installation, including potential impacts to property values, <ln numlevel="1" lineno="108" slineno="1-84"/>environmental quality, and health of nearby property owners and residents.</amend></subsection><subsection ssid="1-75" dnum="_-o:c-i" numlevel="1" lineno="109" slineno="1-85" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="369" groupid="270" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA governing board shall increase the notification radius to 150 feet if the <ln numlevel="1" lineno="110" slineno="1-86"/>proposed installation site:</amend><subsection ssid="1-89" dnum="_-o:i-i" numlevel="1" lineno="111" slineno="1-87" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="374" groupid="274" style="1" owner="jchristopherson" level="1" amendtag="end">has prevailing wind patterns that may increase the distance that heat and chemical <ln numlevel="1" lineno="112" slineno="1-88"/>effects reach; or</amend></subsection><subsection ssid="1-90" dnum="_-o:ii-i" numlevel="1" lineno="113" slineno="1-89" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="379" groupid="278" style="1" owner="jchristopherson" level="1" amendtag="end">lacks substantial shade or tree canopy coverage that may increase heat island <ln numlevel="1" lineno="114" slineno="1-90"/>effects and the distance that heat affects surrounding properties.</amend></subsection></subsection><subsection ssid="1-78" dnum="_-o:d-i" numlevel="1" lineno="115" slineno="1-91" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="380" groupid="279" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA governing board shall increase the notification radius to 200 feet if the <ln numlevel="1" lineno="116" slineno="1-92"/>proposed installation site is in a hydrologically vulnerable location, including:</amend><subsection ssid="1-91" dnum="_-o:i-i" numlevel="1" lineno="117" slineno="1-93" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="385" groupid="283" style="1" owner="jchristopherson" level="1" amendtag="end">within 200 feet of surface water, including a stream, river, lake, or pond;</amend></subsection><subsection ssid="1-92" dnum="_-o:ii-i" numlevel="1" lineno="118" slineno="1-94" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="390" groupid="287" style="1" owner="jchristopherson" level="1" amendtag="end">within 200 feet of a storm drain;</amend></subsection><subsection ssid="1-93" dnum="_-o:iii-i" numlevel="1" lineno="119" slineno="1-95" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="395" groupid="291" style="1" owner="jchristopherson" level="1" amendtag="end">in an area with a shallow water table or wells that may increase the risk of <ln numlevel="1" lineno="120" slineno="1-96"/>groundwater contamination; or</amend></subsection><subsection ssid="1-94" dnum="_-o:iv-i" numlevel="1" lineno="121" slineno="1-97" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="400" groupid="295" style="1" owner="jchristopherson" level="1" amendtag="end">on sloped property where water drainage flows from the proposed installation <ln numlevel="1" lineno="122" slineno="1-98"/>site toward surrounding properties that may increase the risk of contaminant <ln numlevel="1" lineno="123" slineno="1-99"/>transport.</amend></subsection></subsection><subsection ssid="1-84" dnum="_-o:e-i" numlevel="1" lineno="124" slineno="1-100" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="353" groupid="258" style="1" owner="jchristopherson" level="1" amendtag="end">If conditions described in both Subsections <xref depth="4" refnumber="53G-7-228(4)(c)">(4)(c)</xref> and <xref depth="4" refnumber="53G-7-228(4)(d)">(4)(d)</xref> exist, the LEA <ln numlevel="1" lineno="125" slineno="1-101"/>governing board shall use the larger notification radius of 200 feet.</amend></subsection></subsection><subsection ssid="1-52" dnum="_-o:5-i" numlevel="1" lineno="126" slineno="1-102" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="1-53" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="230" groupid="170" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA governing board shall hold a public hearing, as defined in Section <xref depth="3" refnumber="10-20-102"><ln numlevel="1" lineno="127" slineno="1-103"/>10-20-102</xref>, regarding the proposed artificial turf installation.</amend></subsection><subsection ssid="1-54" dnum="_-o:b-i" numlevel="1" lineno="128" slineno="1-104" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="240" groupid="175" style="1" owner="jchristopherson" level="1" amendtag="end">The LEA governing board shall hold the public hearing in compliance with Title 52, <ln numlevel="1" lineno="129" slineno="1-105"/>Chapter 4, Open and Public Meetings Act.</amend></subsection><subsection ssid="1-55" dnum="_-o:c-i" numlevel="1" lineno="130" slineno="1-106" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="244" groupid="178" style="1" owner="jchristopherson" level="1" amendtag="end">At the public hearing, the LEA governing board shall:</amend><subsection ssid="1-56" dnum="_-o:i-i" numlevel="1" lineno="131" slineno="1-107" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="249" groupid="182" style="1" owner="jchristopherson" level="1" amendtag="end">present information about the proposed artificial turf installation;</amend></subsection><subsection ssid="1-57" dnum="_-o:ii-i" numlevel="1" lineno="132" slineno="1-108" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="254" groupid="186" style="1" owner="jchristopherson" level="1" amendtag="end">present information about the environmental effects identified in Subsection <xref depth="4" refnumber="53G-7-228(3)(c)(ii)"><ln numlevel="1" lineno="133" slineno="1-109"/>(3)(c)(ii)</xref>;</amend></subsection><subsection ssid="1-58" dnum="_-o:iii-i" numlevel="1" lineno="134" slineno="1-110" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="259" groupid="190" style="1" owner="jchristopherson" level="1" amendtag="end">allow property owners and members of the public to provide comment; and</amend></subsection><subsection ssid="1-59" dnum="_-o:iv-i" numlevel="1" lineno="135" slineno="1-111" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="264" groupid="194" style="1" owner="jchristopherson" level="1" amendtag="end">respond to questions from property owners and members of the public.</amend></subsection></subsection><subsection ssid="1-60" dnum="_-o:d-i" numlevel="1" lineno="136" slineno="1-112" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="265" groupid="195" style="1" owner="jchristopherson" level="1" amendtag="end">The LEA governing board shall prepare written minutes of the public hearing that <ln numlevel="1" lineno="137" slineno="1-113"/>include:</amend><subsection ssid="1-61" dnum="_-o:i-i" numlevel="1" lineno="138" slineno="1-114" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="271" groupid="199" style="1" owner="jchristopherson" level="1" amendtag="end">a summary of comments received from property owners and members of the <ln numlevel="1" lineno="139" slineno="1-115"/>public; and</amend></subsection><subsection ssid="1-62" dnum="_-o:ii-i" numlevel="1" lineno="140" slineno="1-116" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="276" groupid="203" style="1" owner="jchristopherson" level="1" amendtag="end">the LEA governing board's responses to concerns raised.</amend></subsection></subsection></subsection><subsection ssid="1-63" dnum="_-o:6-i" numlevel="1" lineno="141" slineno="1-117" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="277" groupid="204" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA governing board may not approve installation of artificial turf until at least 45 <ln numlevel="1" lineno="142" slineno="1-118"/>days after the date of the public hearing required under Subsection <xref depth="4" refnumber="53G-7-228(5)">(5)</xref>.</amend></subsection><subsection ssid="1-64" dnum="_-o:7-i" numlevel="1" lineno="143" slineno="1-119" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="280" groupid="206" style="1" owner="jchristopherson" level="1" amendtag="end">This section does not:</amend><subsection ssid="1-65" dnum="_-o:a-i" numlevel="1" lineno="144" slineno="1-120" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="287" groupid="211" style="1" owner="jchristopherson" level="1" amendtag="end">prohibit an LEA governing board from installing artificial turf after complying with <ln numlevel="1" lineno="145" slineno="1-121"/>the requirements of this section;</amend></subsection><subsection ssid="1-66" dnum="_-o:b-i" numlevel="1" lineno="146" slineno="1-122" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="292" groupid="215" style="1" owner="jchristopherson" level="1" amendtag="end">create a private right of action for property owners or other persons;</amend></subsection><subsection ssid="1-67" dnum="_-o:c-i" numlevel="1" lineno="147" slineno="1-123" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="297" groupid="219" style="1" owner="jchristopherson" level="1" amendtag="end">require an LEA to conduct environmental testing or studies beyond what is otherwise <ln numlevel="1" lineno="148" slineno="1-124"/>required by law;
