McKell</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions related to the transfer of credits at an institution of higher <ln numlevel="1" lineno="6" slineno="0-6"/>education.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">requires the Utah Board of Higher Education to:<hl numlevel="1" lineno="10" slineno="0-10" level="2"> strengthen pathways for a student transferring from an institution external to the Utah <ln numlevel="1" lineno="11" slineno="0-11"/>System of Higher Education (USHE);</hl><hl numlevel="1" lineno="12" slineno="0-12" level="2">avoid course duplication for a student transferring from an institution external to <ln numlevel="1" lineno="13" slineno="0-13"/>USHE; and</hl><hl numlevel="1" lineno="14" slineno="0-14" level="2">provide a student with certain information related to the transfer and acceptance of <ln numlevel="1" lineno="15" slineno="0-15"/>credits; and</hl></hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="17" slineno="0-17" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="18">None</moniNone><oc numlevel="1" lineno="19" slineno="0-19">Other Special Clauses:</oc><ocNone lineno="20">None</ocNone><sa numlevel="1" lineno="21" slineno="0-21">Utah Code Sections Affected:<saamd numlevel="1" lineno="22" slineno="0-22"><snhead>AMENDS:</snhead><sn num="53H-1-203" src="code" uid="C53H-1-S203_2026050620260506" buid="1" sort="53H01 02030020260506" numlevel="1" lineno="23" slineno="0-23"><bold>53H-1-203</bold>, as renumbered and amended by Laws of Utah 2025, First Special Session, <ln numlevel="1" lineno="24" slineno="0-24"/>Chapter 8</sn><sn num="53H-3-604" src="code" uid="C53H-3-S604_2026050620260506" buid="2" sort="53H03 06040020260506" numlevel="1" lineno="25" slineno="0-25"><bold>53H-3-604</bold>, as renumbered and amended by Laws of Utah 2025, First Special Session, <ln numlevel="1" lineno="26" slineno="0-26"/>Chapter 8</sn></saamd></sa></lt><enacthead lineno="27"/><enact numlevel="1" lineno="28" slineno="0-28">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" num="53H-1-203" type="amend" src="code" uid="C53H-1-S203_2026050620260506" sort="53H01 02030020260506" numlevel="1" lineno="29" slineno="1-1" sn="1"><section number="53H-1-203" numlevel="1" lineno="30" slineno="1-2" type="amend"><secline lineno="29">Section 1. Section <bold>53H-1-203</bold> is amended to read:</secline><catline lineno="30"><bold>53H-1-203<parens/>. Establishment of board -- Powers, duties, and authority -- Reports.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="31" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>There is established the Utah Board of Higher Education, which:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="32" slineno="1-4" level="3" tab="1"><display>(i)</display>is the governing board for the institutions of higher education; and</subsection><subsection ssid="1-null-4" dnum="ii-o" numlevel="1" lineno="33" slineno="1-5" level="3" tab="1"><display>(ii)</display>controls, oversees, and regulates the Utah System of Higher Education in a <ln numlevel="1" lineno="34" slineno="1-6"/>manner consistent with the purpose of this title and the specific powers and <ln numlevel="1" lineno="35" slineno="1-7"/>responsibilities granted to the board.</subsection></subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="36" slineno="1-8" level="2" space="false"><display>(b)</display><subsection ssid="1-null-6" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The University of Utah shall provide administrative support for the board.</subsection><subsection ssid="1-null-7" dnum="ii-o" numlevel="1" lineno="37" slineno="1-9" level="3"><display>(ii)</display>Notwithstanding Subsection <xref depth="4" refnumber="53B-1-402(1)(b)(i)">(1)(b)(i)</xref>, the board shall maintain the board's <ln numlevel="1" lineno="38" slineno="1-10"/>independence, including in relation to the powers and responsibilities granted to <ln numlevel="1" lineno="39" slineno="1-11"/>the board.</subsection></subsection></subsection><subsection ssid="1-null-8" dnum="2-o" numlevel="1" lineno="40" slineno="1-12" level="1"><display>(2)</display>The board shall:<subsection ssid="1-null-9" dnum="a-o" numlevel="1" lineno="41" slineno="1-13" level="2"><display>(a)</display>establish and promote a state-level vision and goals for higher education that <ln numlevel="1" lineno="42" slineno="1-14"/>emphasize data-driven retrospective and prospective system priorities, including:<subsection ssid="1-null-10" dnum="i-o" numlevel="1" lineno="43" slineno="1-15" level="3"><display>(i)</display>quality;</subsection><subsection ssid="1-null-11" dnum="ii-o" numlevel="1" lineno="44" slineno="1-16" level="3"><display>(ii)</display>affordability;</subsection><subsection ssid="1-null-12" dnum="iii-o" numlevel="1" lineno="45" slineno="1-17" level="3"><display>(iii)</display>access and equity;</subsection><subsection ssid="1-null-13" dnum="iv-o" numlevel="1" lineno="46" slineno="1-18" level="3"><display>(iv)</display>completion;</subsection><subsection ssid="1-null-14" dnum="v-o" numlevel="1" lineno="47" slineno="1-19" level="3"><display>(v)</display>workforce alignment and preparation for high-quality jobs; and</subsection><subsection ssid="1-null-15" dnum="vi-o" numlevel="1" lineno="48" slineno="1-20" level="3"><display>(vi)</display>economic growth;</subsection></subsection><subsection ssid="1-null-16" dnum="b-o" numlevel="1" lineno="49" slineno="1-21" level="2"><display>(b)</display>establish system policies and practices that advance the vision and goals;</subsection><subsection ssid="1-null-17" dnum="c-o" numlevel="1" lineno="50" slineno="1-22" level="2"><display>(c)</display>establish metrics to demonstrate and monitor:<subsection ssid="1-null-18" dnum="i-o" numlevel="1" lineno="51" slineno="1-23" level="3"><display>(i)</display>performance related to the goals; and</subsection><subsection ssid="1-null-19" dnum="ii-o" numlevel="1" lineno="52" slineno="1-24" level="3"><display>(ii)</display>performance on measures of operational efficiency;</subsection></subsection><subsection ssid="1-null-20" dnum="d-o" numlevel="1" lineno="53" slineno="1-25" level="2"><display>(d)</display>collect and analyze data including economic data, demographic data, and data related <ln numlevel="1" lineno="54" slineno="1-26"/>to the metrics;</subsection><subsection ssid="1-null-21" dnum="e-o" numlevel="1" lineno="55" slineno="1-27" level="2"><display>(e)</display>govern data quality and collection across institutions;</subsection><subsection ssid="1-null-22" dnum="f-o" numlevel="1" lineno="56" slineno="1-28" level="2"><display>(f)</display>establish, approve, and oversee each institution's mission and role in accordance with <ln numlevel="1" lineno="57" slineno="1-29"/>Section <xref depth="3" refnumber="53H-3-602">53H-3-602</xref>;</subsection><subsection ssid="1-null-23" dnum="g-o" numlevel="1" lineno="58" slineno="1-30" level="2"><display>(g)</display>assess an institution's performance in accomplishing the institution's mission and role;</subsection><subsection ssid="1-null-24" dnum="h-o" numlevel="1" lineno="59" slineno="1-31" level="2"><display>(h)</display>participate in the establishment and review of programs of instruction in accordance <ln numlevel="1" lineno="60" slineno="1-32"/>with Section <xref depth="3" refnumber="53H-3-603">53H-3-603</xref>;</subsection><subsection ssid="1-null-25" dnum="i-o" numlevel="1" lineno="61" slineno="1-33" level="2"><display>(i)</display>perform the following duties related to an institution of higher education president, <ln numlevel="1" lineno="62" slineno="1-34"/>including:<subsection ssid="1-null-26" dnum="i-o" numlevel="1" lineno="63" slineno="1-35" level="3"><display>(i)</display>hiring an institution of higher education president in accordance with Section <xref depth="3" refnumber="53H-3-302"><ln numlevel="1" lineno="64" slineno="1-36"/>53H-3-302</xref>;</subsection><subsection ssid="1-null-27" dnum="ii-o" numlevel="1" lineno="65" slineno="1-37" level="3"><display>(ii)</display>through the commissioner and the board's executive committee:<subsection ssid="1-null-28" dnum="A-o" numlevel="1" lineno="66" slineno="1-38" level="4"><display>(A)</display>providing support and guidance to an institution of higher education president; <ln numlevel="1" lineno="67" slineno="1-39"/>and</subsection><subsection ssid="1-null-29" dnum="B-o" numlevel="1" lineno="68" slineno="1-40" level="4"><display>(B)</display>evaluating an institution of higher education president based on institution <ln numlevel="1" lineno="69" slineno="1-41"/>performance and progress toward systemwide priorities;</subsection></subsection><subsection ssid="1-null-30" dnum="iii-o" numlevel="1" lineno="70" slineno="1-42" level="3"><display>(iii)</display>setting the terms of employment for an institution of higher education president, <ln numlevel="1" lineno="71" slineno="1-43"/>including performance-based compensation, through an employment contract or <ln numlevel="1" lineno="72" slineno="1-44"/>another method of establishing employment; and</subsection><subsection ssid="1-null-31" dnum="iv-o" numlevel="1" lineno="73" slineno="1-45" level="3"><display>(iv)</display>establishing, through a confidential process, a statewide succession plan to <ln numlevel="1" lineno="74" slineno="1-46"/>develop potential institution presidents from within the system;</subsection></subsection><subsection ssid="1-null-32" dnum="j-o" numlevel="1" lineno="75" slineno="1-47" level="2"><display>(j)</display>create and implement a strategic finance plan for higher education, including by:<subsection ssid="1-null-33" dnum="i-o" numlevel="1" lineno="76" slineno="1-48" level="3"><display>(i)</display>establishing comprehensive budget and finance priorities for academic education <ln numlevel="1" lineno="77" slineno="1-49"/>and technical education;</subsection><subsection ssid="1-null-34" dnum="ii-o" numlevel="1" lineno="78" slineno="1-50" level="3"><display>(ii)</display>allocating statewide resources to institutions;</subsection><subsection ssid="1-null-35" dnum="iii-o" numlevel="1" lineno="79" slineno="1-51" level="3"><display>(iii)</display>setting tuition for each institution;</subsection><subsection ssid="1-null-36" dnum="iv-o" numlevel="1" lineno="80" slineno="1-52" level="3"><display>(iv)</display>administering state financial aid programs;</subsection><subsection ssid="1-null-37" dnum="v-o" numlevel="1" lineno="81" slineno="1-53" level="3"><display>(v)</display>administering performance funding in accordance with Chapter <xref depth="2" refnumber="53B-8-3">8, Part 3</xref>, <ln numlevel="1" lineno="82" slineno="1-54"/>Performance Funding; and</subsection><subsection ssid="1-null-38" dnum="vi-o" numlevel="1" lineno="83" slineno="1-55" level="3"><display>(vi)</display>developing a strategic capital facility plan and prioritization process in <ln numlevel="1" lineno="84" slineno="1-56"/>accordance with Chapter <xref depth="2" refnumber="53B-9-5">9, Part 5</xref>, General Capital Developments, and Sections <xref depth="3" refnumber="53H-9-604"><ln numlevel="1" lineno="85" slineno="1-57"/>53H-9-604</xref> and <xref depth="3" refnumber="53H-9-605">53H-9-605</xref>;</subsection></subsection><subsection ssid="1-null-39" dnum="k-o" numlevel="1" lineno="86" slineno="1-58" level="2"><display>(k)</display>create and annually report to the Higher Education Appropriations Subcommittee on <ln numlevel="1" lineno="87" slineno="1-59"/>a seamless articulated education system for Utah students that responds to changing <ln numlevel="1" lineno="88" slineno="1-60"/>demographics and workforce, including by:<subsection ssid="1-null-40" dnum="i-o" numlevel="1" lineno="89" slineno="1-61" level="3"><display>(i)</display>providing for statewide prior learning assessment, in accordance with Section <xref depth="3" refnumber="53H-3-702"><ln numlevel="1" lineno="90" slineno="1-62"/>53H-3-702</xref>;</subsection><subsection ssid="1-null-41" dnum="ii-o" numlevel="1" lineno="91" slineno="1-63" level="3"><display>(ii)</display>establishing and maintaining<amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">, in accordance with Section <xref depth="3" refnumber="53H-3-604">53H-3-604</xref>,</amend> clear <ln numlevel="1" lineno="92" slineno="1-64"/>pathways for articulation and transfer, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">in accordance with Section <xref depth="3" refnumber="53H-3-604">53H-3-604</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="93" slineno="1-65"/>including identifying strategies that promote transfer from an institution external <ln numlevel="1" lineno="94" slineno="1-66"/>to the Utah System of Higher Education</amend>;</subsection><subsection ssid="1-null-42" dnum="iii-o" numlevel="1" lineno="95" slineno="1-67" level="3"><display>(iii)</display>establishing degree program requirement guidelines, including credit hour limits;</subsection><subsection ssid="1-null-43" dnum="iv-o" numlevel="1" lineno="96" slineno="1-68" level="3"><display>(iv)</display>aligning general education requirements across degree-granting institutions;</subsection><subsection ssid="1-null-44" dnum="v-o" numlevel="1" lineno="97" slineno="1-69" level="3"><display>(v)</display>coordinating and incentivizing collaboration and partnerships between institutions <ln numlevel="1" lineno="98" slineno="1-70"/>in delivering programs;</subsection><subsection ssid="1-null-45" dnum="vi-o" numlevel="1" lineno="99" slineno="1-71" level="3"><display>(vi)</display>coordinating distance delivery of programs;</subsection><subsection ssid="1-null-46" dnum="vii-o" numlevel="1" lineno="100" slineno="1-72" level="3"><display>(vii)</display>coordinating work-based learning; and</subsection><subsection ssid="1-null-47" dnum="viii-o" numlevel="1" lineno="101" slineno="1-73" level="3"><display>(viii)</display>emphasizing the system priorities and metrics described in Subsections <xref depth="4" refnumber="53B-1-402(2)(a)">(2)(a)</xref> <ln numlevel="1" lineno="102" slineno="1-74"/>and <xref depth="4" refnumber="53B-1-402(c)">(c)</xref>;</subsection></subsection><subsection ssid="1-null-48" dnum="l-o" numlevel="1" lineno="103" slineno="1-75" level="2"><display>(l)</display>coordinate with the public education system:<subsection ssid="1-null-49" dnum="i-o" numlevel="1" lineno="104" slineno="1-76" level="3"><display>(i)</display>regarding public education programs that provide postsecondary credit or <ln numlevel="1" lineno="105" slineno="1-77"/>certificates; and</subsection><subsection ssid="1-null-50" dnum="ii-o" numlevel="1" lineno="106" slineno="1-78" level="3"><display>(ii)</display>to ensure that an institution of higher education providing technical education <ln numlevel="1" lineno="107" slineno="1-79"/>serves secondary students in the public education system;</subsection></subsection><subsection ssid="1-null-51" dnum="m-o" numlevel="1" lineno="108" slineno="1-80" level="2"><display>(m)</display>delegate to an institution board of trustees certain duties related to institution <ln numlevel="1" lineno="109" slineno="1-81"/>governance including:<subsection ssid="1-null-52" dnum="i-o" numlevel="1" lineno="110" slineno="1-82" level="3"><display>(i)</display>guidance and support for the institution president;</subsection><subsection ssid="1-null-53" dnum="ii-o" numlevel="1" lineno="111" slineno="1-83" level="3"><display>(ii)</display>effective administration;</subsection><subsection ssid="1-null-54" dnum="iii-o" numlevel="1" lineno="112" slineno="1-84" level="3"><display>(iii)</display>the institution's responsibility for contributing to progress toward achieving <ln numlevel="1" lineno="113" slineno="1-85"/>systemwide goals; and</subsection><subsection ssid="1-null-55" dnum="iv-o" numlevel="1" lineno="114" slineno="1-86" level="3"><display>(iv)</display>other responsibilities determined by the board;</subsection></subsection><subsection ssid="1-null-56" dnum="n-o" numlevel="1" lineno="115" slineno="1-87" level="2"><display>(n)</display>delegate to an institution of higher education president management of the institution <ln numlevel="1" lineno="116" slineno="1-88"/>of higher education;</subsection><subsection ssid="1-null-57" dnum="o-o" numlevel="1" lineno="117" slineno="1-89" level="2"><display>(o)</display>consult with an institution of higher education board of trustees or institution of <ln numlevel="1" lineno="118" slineno="1-90"/>higher education president before acting on matters pertaining to the institution of <ln numlevel="1" lineno="119" slineno="1-91"/>higher education;</subsection><subsection ssid="1-null-58" dnum="p-o" numlevel="1" lineno="120" slineno="1-92" level="2"><display>(p)</display>maximize efficiency throughout the Utah System of Higher Education by identifying <ln numlevel="1" lineno="121" slineno="1-93"/>and establishing shared administrative services, beginning with:<subsection ssid="1-null-59" dnum="i-o" numlevel="1" lineno="122" slineno="1-94" level="3"><display>(i)</display>commercialization;</subsection><subsection ssid="1-null-60" dnum="ii-o" numlevel="1" lineno="123" slineno="1-95" level="3"><display>(ii)</display>services for compliance with Title IX of the Education Amendments of 1972, 20 <ln numlevel="1" lineno="124" slineno="1-96"/>U.S.C. Sec. 1681 et seq.;</subsection><subsection ssid="1-null-61" dnum="iii-o" numlevel="1" lineno="125" slineno="1-97" level="3"><display>(iii)</display>information technology services; and</subsection><subsection ssid="1-null-62" dnum="iv-o" numlevel="1" lineno="126" slineno="1-98" level="3"><display>(iv)</display>human resources, payroll, and benefits administration;</subsection></subsection><subsection ssid="1-null-63" dnum="q-o" numlevel="1" lineno="127" slineno="1-99" level="2"><display>(q)</display>develop strategies for providing higher education, including career and technical <ln numlevel="1" lineno="128" slineno="1-100"/>education, in rural areas;</subsection><subsection ssid="1-null-64" dnum="r-o" numlevel="1" lineno="129" slineno="1-101" level="2"><display>(r)</display>manage and facilitate a process for initiating, prioritizing, and implementing <ln numlevel="1" lineno="130" slineno="1-102"/>education reform initiatives, beginning with common applications and direct <ln numlevel="1" lineno="131" slineno="1-103"/>admissions;</subsection><subsection ssid="1-null-65" dnum="s-o" numlevel="1" lineno="132" slineno="1-104" level="2"><display>(s)</display>provide ongoing quality review of programs;</subsection><subsection ssid="1-null-66" dnum="t-o" numlevel="1" lineno="133" slineno="1-105" level="2"><display>(t)</display>before each annual legislative general session, provide to the Higher Education <ln numlevel="1" lineno="134" slineno="1-106"/>Appropriations Subcommittee a prioritization of all projects and proposals for which <ln numlevel="1" lineno="135" slineno="1-107"/>the board or an institution of higher education seeks an appropriation; and</subsection><subsection ssid="1-null-67" dnum="u-o" numlevel="1" lineno="136" slineno="1-108" level="2"><display>(u)</display>coordinate with the Department of Corrections to establish educational programs for <ln numlevel="1" lineno="137" slineno="1-109"/>inmates as described in Section <xref depth="3" refnumber="64-13-6">64-13-6</xref>.</subsection></subsection><subsection ssid="1-null-68" dnum="3-o" numlevel="1" lineno="138" slineno="1-110" level="1"><display>(3)</display>The board shall submit an annual report of the board's activities and performance <ln numlevel="1" lineno="139" slineno="1-111"/>against the board's goals and metrics to:<subsection ssid="1-null-69" dnum="a-o" numlevel="1" lineno="140" slineno="1-112" level="2"><display>(a)</display>the Education Interim Committee;</subsection><subsection ssid="1-null-70" dnum="b-o" numlevel="1" lineno="141" slineno="1-113" level="2"><display>(b)</display>the Higher Education Appropriations Subcommittee;</subsection><subsection ssid="1-null-71" dnum="c-o" numlevel="1" lineno="142" slineno="1-114" level="2"><display>(c)</display>the governor; and</subsection><subsection ssid="1-null-72" dnum="d-o" numlevel="1" lineno="143" slineno="1-115" level="2"><display>(d)</display>each institution of higher education.</subsection></subsection><subsection ssid="1-null-73" dnum="4-o" numlevel="1" lineno="144" slineno="1-116" level="1"><display>(4)</display>The board shall prepare and submit an annual report detailing the board's progress and <ln numlevel="1" lineno="145" slineno="1-117"/>recommendations on workforce related issues, including career and technical education, <ln numlevel="1" lineno="146" slineno="1-118"/>to the governor and to the Education Interim Committee by December 1 of each year, <ln numlevel="1" lineno="147" slineno="1-119"/>including information detailing:<subsection ssid="1-null-74" dnum="a-o" numlevel="1" lineno="148" slineno="1-120" level="2"><display>(a)</display>how institutions of higher education are meeting the career and technical education <ln numlevel="1" lineno="149" slineno="1-121"/>needs of secondary students;</subsection><subsection ssid="1-null-75" dnum="b-o" numlevel="1" lineno="150" slineno="1-122" level="2"><display>(b)</display>how the system emphasized high demand, high wage, and high skill jobs in business <ln numlevel="1" lineno="151" slineno="1-123"/>and industry;</subsection><subsection ssid="1-null-76" dnum="c-o" numlevel="1" lineno="152" slineno="1-124" level="2"><display>(c)</display>performance outcomes, including:<subsection ssid="1-null-77" dnum="i-o" numlevel="1" lineno="153" slineno="1-125" level="3"><display>(i)</display>entered employment;</subsection><subsection ssid="1-null-78" dnum="ii-o" numlevel="1" lineno="154" slineno="1-126" level="3"><display>(ii)</display>job retention; and</subsection><subsection ssid="1-null-79" dnum="iii-o" numlevel="1" lineno="155" slineno="1-127" level="3"><display>(iii)</display>earnings;</subsection></subsection><subsection ssid="1-null-80" dnum="d-o" numlevel="1" lineno="156" slineno="1-128" level="2"><display>(d)</display>an analysis of workforce needs and efforts to meet workforce needs; and</subsection><subsection ssid="1-null-81" dnum="e-o" numlevel="1" lineno="157" slineno="1-129" level="2"><display>(e)</display>student tuition and fees.</subsection></subsection><subsection ssid="1-null-82" dnum="5-o" numlevel="1" lineno="158" slineno="1-130" level="1"><display>(5)</display>The board may modify the name of an institution of higher education to reflect the role <ln numlevel="1" lineno="159" slineno="1-131"/>and general course of study of the institution.</subsection><subsection ssid="1-null-83" dnum="6-o" numlevel="1" lineno="160" slineno="1-132" level="1"><display>(6)</display>The board may not take action relating to merging a technical college with another <ln numlevel="1" lineno="161" slineno="1-133"/>institution of higher education without legislative approval.</subsection><subsection ssid="1-null-84" dnum="7-o" numlevel="1" lineno="162" slineno="1-134" level="1"><display>(7)</display>This section does not affect the power and authority vested in the State Board of <ln numlevel="1" lineno="163" slineno="1-135"/>Education to apply for, accept, and manage federal appropriations for the establishment <ln numlevel="1" lineno="164" slineno="1-136"/>and maintenance of career and technical education.</subsection><subsection ssid="1-null-85" dnum="8-o" numlevel="1" lineno="165" slineno="1-137" level="1"><display>(8)</display>The board shall ensure that any training or certification that an employee of the higher <ln numlevel="1" lineno="166" slineno="1-138"/>education system is required to complete under this title or by board rule complies with <ln numlevel="1" lineno="167" slineno="1-139"/>Title <xref depth="1" refnumber="63G-22">63G, Chapter 22</xref>, State Training and Certification Requirements.</subsection><subsection ssid="1-null-86" dnum="9-o" numlevel="1" lineno="168" slineno="1-140" level="1"><display>(9)</display>The board shall demonstrate compliance with Subsection <xref refnumber="53B-1-402(2)(p)" depth="4">(2)(p)</xref> by providing to the <ln numlevel="1" lineno="169" slineno="1-141"/>Higher Education Appropriations Subcommittee:<subsection ssid="1-null-87" dnum="a-o" numlevel="1" lineno="170" slineno="1-142" level="2"><display>(a)</display>on or before October 1, 2024, evidence of implementation of at least one shared <ln numlevel="1" lineno="171" slineno="1-143"/>administrative service;</subsection><subsection ssid="1-null-88" dnum="b-o" numlevel="1" lineno="172" slineno="1-144" level="2"><display>(b)</display>on or before October 1, 2025, evidence of implementation of at least two shared <ln numlevel="1" lineno="173" slineno="1-145"/>administrative services; and</subsection><subsection ssid="1-null-89" dnum="c-o" numlevel="1" lineno="174" slineno="1-146" level="2"><display>(c)</display>on or before October 1, 2026, evidence of implementation of at least three shared <ln numlevel="1" lineno="175" slineno="1-147"/>administrative services.</subsection></subsection><subsection ssid="1-null-90" dnum="10-o" numlevel="1" lineno="176" slineno="1-148" level="1"><display>(10)</display>If the Higher Education Appropriations Subcommittee finds the board to be out of <ln numlevel="1" lineno="177" slineno="1-149"/>compliance with Subsection <xref refnumber="53B-1-402(9)" depth="4">(9)</xref>, the Legislature shall:<subsection ssid="1-null-91" dnum="a-o" numlevel="1" lineno="178" slineno="1-150" level="2"><display>(a)</display>deduct 10% of the appropriation described in Section <xref depth="3" refnumber="53H-8-302">53H-8-302</xref> for the following <ln numlevel="1" lineno="179" slineno="1-151"/>fiscal year; and</subsection><subsection ssid="1-null-92" dnum="b-o" numlevel="1" lineno="180" slineno="1-152" level="2"><display>(b)</display>deduct an additional 10% of the appropriation described in Section <xref depth="3" refnumber="53H-8-302">53H-8-302</xref> for <ln numlevel="1" lineno="181" slineno="1-153"/>each subsequent year of noncompliance up to a maximum deduction of 30%.</subsection></subsection></section></bsec><bsec buid="2" num="53H-3-604" type="amend" src="code" uid="C53H-3-S604_2026050620260506" sort="53H03 06040020260506" numlevel="1" lineno="182" slineno="2-1" sn="2"><section number="53H-3-604" numlevel="1" lineno="183" slineno="2-2" type="amend"><secline lineno="182">Section 2. Section <bold>53H-3-604</bold> is amended to read:</secline><catline lineno="183"><bold>53H-3-604<parens/>. Common course numbering -- Transferability of credits -- <ln numlevel="1" lineno="184" slineno="2-3"/>Agreement with competency-based general education provider -- Policies.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="185" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="186" slineno="2-5" level="2"><display>(a)</display>"Accredited institution" means an institution that:<subsection ssid="2-null-3" dnum="i-o" numlevel="1" lineno="187" slineno="2-6" level="3"><display>(i)</display>offers a competency-based postsecondary general education course online or in <ln numlevel="1" lineno="188" slineno="2-7"/>person; and</subsection><subsection ssid="2-null-4" dnum="ii-o" numlevel="1" lineno="189" slineno="2-8" level="3"><display>(ii)</display>is accredited by an organization that the United States Department of Education <ln numlevel="1" lineno="190" slineno="2-9"/>recognizes.</subsection></subsection><subsection ssid="2-null-5" dnum="b-o" numlevel="1" lineno="191" slineno="2-10" level="2"><display>(b)</display>"Articulation agreement" means an agreement between the board and a provider that <ln numlevel="1" lineno="192" slineno="2-11"/>allows a student to transfer credit awarded by the provider for a general education <ln numlevel="1" lineno="193" slineno="2-12"/>course to any institution of higher education.</subsection><subsection ssid="2-null-6" dnum="c-o" numlevel="1" lineno="194" slineno="2-13" level="2"><display>(c)</display>"Competency-based" means a system where a student advances to higher levels of <ln numlevel="1" lineno="195" slineno="2-14"/>learning when the student demonstrates competency of concepts and skills regardless <ln numlevel="1" lineno="196" slineno="2-15"/>of time, place, or pace.</subsection><subsection ssid="2-null-7" dnum="d-o" numlevel="1" lineno="197" slineno="2-16" level="2"><display>(d)</display>"Competency-based general education provider" or "provider" means a private <ln numlevel="1" lineno="198" slineno="2-17"/>postsecondary educational institution that:<subsection ssid="2-null-8" dnum="i-o" numlevel="1" lineno="199" slineno="2-18" level="3"><display>(i)</display>offers a postsecondary competency-based general education course online or in <ln numlevel="1" lineno="200" slineno="2-19"/>person;</subsection><subsection ssid="2-null-9" dnum="ii-o" numlevel="1" lineno="201" slineno="2-20" level="3"><display>(ii)</display>awards academic credit; and</subsection><subsection ssid="2-null-10" dnum="iii-o" numlevel="1" lineno="202" slineno="2-21" level="3"><display>(iii)</display>does not award degrees, including associates degrees or baccalaureate degrees.</subsection></subsection><subsection ssid="2-null-11" dnum="e-o" numlevel="1" lineno="203" slineno="2-22" level="2"><display>(e)</display>"Credit for prior learning" means the same as that term is defined in Section <xref depth="3" refnumber="53H-3-702"><ln numlevel="1" lineno="204" slineno="2-23"/>53H-3-702</xref>.</subsection></subsection><subsection ssid="2-null-12" dnum="2-o" numlevel="1" lineno="205" slineno="2-24" level="1"><display>(2)</display>The board shall:<subsection ssid="2-null-13" dnum="a-o" numlevel="1" lineno="206" slineno="2-25" level="2"><display>(a)</display>facilitate articulation and the seamless transfer of courses, programs, and credit for <ln numlevel="1" lineno="207" slineno="2-26"/>prior learning within the Utah System of Higher Education;</subsection><subsection ssid="2-null-14" dnum="b-o" numlevel="1" lineno="208" slineno="2-27" level="2"><display>(b)</display>provide for the efficient and effective progression and transfer of students within the <ln numlevel="1" lineno="209" slineno="2-28"/>Utah System of Higher Education;</subsection><subsection ssid="2-null-15" dnum="c-o" numlevel="1" lineno="210" slineno="2-29" level="2"><display>(c)</display>avoid the unnecessary duplication of courses<amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">, including for a student who transfers <ln numlevel="1" lineno="211" slineno="2-30"/>from an institution external to the Utah System of Higher Education described in <ln numlevel="1" lineno="212" slineno="2-31"/>Section <xref depth="3" refnumber="53H-1-102">53H-1-102</xref></amend>;</subsection><subsection ssid="2-null-16" dnum="d-o" numlevel="1" lineno="213" slineno="2-32" level="2"><display>(d)</display>communicate ways in which a student may earn credit for prior learning;</subsection><subsection ssid="2-52" dnum="_-o:e-i" numlevel="1" lineno="214" slineno="2-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1108" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">ensure an institution informs a student of the student's options for appealing a <ln numlevel="1" lineno="215" slineno="2-34"/>decision related to the transfer and acceptance of credits;</amend> and</subsection><subsection ssid="2-null-17" dnum="e-o:f-i" numlevel="1" lineno="216" slineno="2-35" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1109" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1110" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>allow a student to proceed toward the student's educational objectives as rapidly <ln numlevel="1" lineno="217" slineno="2-36"/>as the student's circumstances permit.</subsection></subsection><subsection ssid="2-null-18" dnum="3-o" numlevel="1" lineno="218" slineno="2-37" level="1"><display>(3)</display>The board shall develop, coordinate, and maintain a transfer and articulation system that:<subsection ssid="2-null-19" dnum="a-o" numlevel="1" lineno="219" slineno="2-38" level="2"><display>(a)</display>maintains a course numbering system that assigns common numbers to specified <ln numlevel="1" lineno="220" slineno="2-39"/>courses of similar level with similar curricular content, rigor, and standards;</subsection><subsection ssid="2-null-20" dnum="b-o" numlevel="1" lineno="221" slineno="2-40" level="2"><display>(b)</display>allows a student to track courses that transfer among institutions of higher education;</subsection><subsection ssid="2-null-21" dnum="c-o" numlevel="1" lineno="222" slineno="2-41" level="2"><display>(c)</display>allows a student to transfer courses from a provider with which the board has an <ln numlevel="1" lineno="223" slineno="2-42"/>articulation agreement to any institution of higher education;</subsection><subsection ssid="2-null-22" dnum="d-o" numlevel="1" lineno="224" slineno="2-43" level="2"><display>(d)</display>allows a student to transfer competency-based general education courses from an <ln numlevel="1" lineno="225" slineno="2-44"/>accredited institution to an institution of higher education;</subsection><subsection ssid="2-null-23" dnum="e-o" numlevel="1" lineno="226" slineno="2-45" level="2"><display>(e)</display>improves program planning;</subsection><subsection ssid="2-null-24" dnum="f-o" numlevel="1" lineno="227" slineno="2-46" level="2"><display>(f)</display>increases communication and coordination between institutions of higher education;</subsection><subsection ssid="2-null-25" dnum="g-o" numlevel="1" lineno="228" slineno="2-47" level="2"><display>(g)</display>facilitates student acceleration and the transfer of students and credits between <ln numlevel="1" lineno="229" slineno="2-48"/>institutions of higher education; and</subsection><subsection ssid="2-null-26" dnum="h-o" numlevel="1" lineno="230" slineno="2-49" level="2"><display>(h)</display>if the system includes a software or data tool:<subsection ssid="2-null-27" dnum="i-o" numlevel="1" lineno="231" slineno="2-50" level="3"><display>(i)</display>provides predictive analysis that models probabilities of student success; and</subsection><subsection ssid="2-null-28" dnum="ii-o" numlevel="1" lineno="232" slineno="2-51" level="3"><display>(ii)</display>develops tailored strategies to best support students.</subsection></subsection></subsection><subsection ssid="2-null-29" dnum="4-o" numlevel="1" lineno="233" slineno="2-52" level="1" space="false"><display>(4)</display><subsection ssid="2-null-30" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The board shall identify general education courses in the humanities, social <ln numlevel="1" lineno="234" slineno="2-53"/>sciences, arts, physical sciences, and life sciences with uniform prefixes and common <ln numlevel="1" lineno="235" slineno="2-54"/>course numbers.</subsection><subsection ssid="2-null-31" dnum="b-o" numlevel="1" lineno="236" slineno="2-55" level="2"><display>(b)</display>A degree-granting institution shall annually identify institution courses that satisfy <ln numlevel="1" lineno="237" slineno="2-56"/>requirements of courses described in Subsection <xref depth="4" refnumber="53B-16-105(4)(a)" start="0">(4)(a)</xref>.</subsection><subsection ssid="2-null-32" dnum="c-o" numlevel="1" lineno="238" slineno="2-57" level="2"><display>(c)</display>A degree-granting institution shall accept a course described in Subsection <xref depth="4" refnumber="53B-16-105(3)(c)" start="0">(3)(c)</xref>, <xref depth="4" refnumber="53B-16-105(3)(d)" start="0"><ln numlevel="1" lineno="239" slineno="2-58"/>(3)(d)</xref>, or <xref depth="4" refnumber="53B-16-105(4)(a)" start="0">(4)(a)</xref> toward filling specific area requirements for general education or <ln numlevel="1" lineno="240" slineno="2-59"/>lower division courses that transfer to baccalaureate majors.</subsection></subsection><subsection ssid="2-null-33" dnum="5-o" numlevel="1" lineno="241" slineno="2-60" level="1" space="false"><display>(5)</display><subsection ssid="2-null-34" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The board shall:<subsection ssid="2-null-35" dnum="i-o" numlevel="1" lineno="242" slineno="2-61" level="3" tab="1"><display>(i)</display>identify technical education programs with common names, descriptions, lengths, <ln numlevel="1" lineno="243" slineno="2-62"/>and objectives; and</subsection><subsection ssid="2-null-36" dnum="ii-o" numlevel="1" lineno="244" slineno="2-63" level="3" tab="1"><display>(ii)</display>within technical education programs, common course names, descriptions, length, <ln numlevel="1" lineno="245" slineno="2-64"/>and objectives<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="jchristopherson" level="1" deltag="start"> </amend><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="end">allowing</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">, allow</amend> for customization of electives to meet regional <ln numlevel="1" lineno="246" slineno="2-65"/>industry demand.</subsection></subsection><subsection ssid="2-null-37" dnum="b-o" numlevel="1" lineno="247" slineno="2-66" level="2"><display>(b)</display>The commissioner shall appoint committees of faculty members from technical <ln numlevel="1" lineno="248" slineno="2-67"/>education committees to recommend aligned programs and courses that will satisfy <ln numlevel="1" lineno="249" slineno="2-68"/>graduation requirements.</subsection></subsection><subsection ssid="2-null-38" dnum="6-o" numlevel="1" lineno="250" slineno="2-69" level="1" space="false"><display>(6)</display><subsection ssid="2-null-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The board shall identify common prerequisite courses and course substitutions for <ln numlevel="1" lineno="251" slineno="2-70"/>degree programs across degree-granting institutions.</subsection><subsection ssid="2-null-40" dnum="b-o" numlevel="1" lineno="252" slineno="2-71" level="2"><display>(b)</display>The commissioner shall appoint committees of faculty members from the <ln numlevel="1" lineno="253" slineno="2-72"/>degree-granting institutions to recommend appropriate courses of similar content and <ln numlevel="1" lineno="254" slineno="2-73"/>numbering that will satisfy requirements for lower division courses that transfer to <ln numlevel="1" lineno="255" slineno="2-74"/>baccalaureate majors.</subsection><subsection ssid="2-null-41" dnum="c-o" numlevel="1" lineno="256" slineno="2-75" level="2"><display>(c)</display>A degree-granting institution shall annually identify institution courses that satisfy <ln numlevel="1" lineno="257" slineno="2-76"/>requirements of courses described in Subsection <xref depth="4" refnumber="53B-16-105(6)(a)" start="0">(6)(a)</xref>.</subsection><subsection ssid="2-null-42" dnum="d-o" numlevel="1" lineno="258" slineno="2-77" level="2"><display>(d)</display>A degree-granting institution shall accept a course described in Subsection <xref depth="4" refnumber="53B-16-105(3)(c)" start="0">(3)(c)</xref>, <xref depth="4" refnumber="53B-16-105(3)(d)" start="0"><ln numlevel="1" lineno="259" slineno="2-78"/>(3)(d)</xref>, or <xref depth="4" refnumber="53B-16-105(6)(a)" start="0">(6)(a)</xref> toward filling graduation requirements.</subsection></subsection><subsection ssid="2-null-43" dnum="7-o" numlevel="1" lineno="260" slineno="2-79" level="1" space="false"><display>(7)</display><subsection ssid="2-null-44" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="2-null-45" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>The board shall seek proposals from providers to enter into articulation <ln numlevel="1" lineno="261" slineno="2-80"/>agreements.</subsection><subsection ssid="2-null-46" dnum="ii-o" numlevel="1" lineno="262" slineno="2-81" level="3" tab="1"><display>(ii)</display>A proposal described in Subsection <xref depth="4" refnumber="53B-16-105(7)(a)(i)" start="0">(7)(a)(i)</xref> shall include the general education <ln numlevel="1" lineno="263" slineno="2-82"/>courses that the provider intends to include in an articulation agreement.</subsection></subsection><subsection ssid="2-null-47" dnum="b-o" numlevel="1" lineno="264" slineno="2-83" level="2"><display>(b)</display>The board shall:<subsection ssid="2-null-48" dnum="i-o" numlevel="1" lineno="265" slineno="2-84" level="3"><display>(i)</display>evaluate each general education course included in a proposal described in <ln numlevel="1" lineno="266" slineno="2-85"/>Subsection <xref depth="4" refnumber="53B-16-105(7)(a)" start="0">(7)(a)</xref> to determine whether the course is equally rigorous and includes <ln numlevel="1" lineno="267" slineno="2-86"/>the same subject matter as the equivalent course offered by any institution of <ln numlevel="1" lineno="268" slineno="2-87"/>higher education; and</subsection><subsection ssid="2-null-49" dnum="ii-o" numlevel="1" lineno="269" slineno="2-88" level="3"><display>(ii)</display>if the board determines that a course included in a provider's proposal is equally <ln numlevel="1" lineno="270" slineno="2-89"/>rigorous and includes the same subject matter as the equivalent course offered by <ln numlevel="1" lineno="271" slineno="2-90"/>any institution of higher education, enter into an articulation agreement with the <ln numlevel="1" lineno="272" slineno="2-91"/>provider.</subsection></subsection></subsection><subsection ssid="2-null-50" dnum="8-o" numlevel="1" lineno="273" slineno="2-92" level="1"><display>(8)</display>The board shall establish policies to administer the policies and requirements described <ln numlevel="1" lineno="274" slineno="2-93"/>in this section.</subsection><subsection ssid="2-null-51" dnum="9-o" numlevel="1" lineno="275" slineno="2-94" level="1"><display>(9)</display>The board shall include information demonstrating that institutions of higher education <ln numlevel="1" lineno="276" slineno="2-95"/>are complying with the provisions of this section and the policies established in <ln numlevel="1" lineno="277" slineno="2-96"/>accordance with Subsection <xref depth="4" refnumber="53B-16-105(8)" start="0">(8)</xref> in the annual report described in Section <xref depth="3" refnumber="53H-1-203">53H-1-203</xref>.</subsection></section></bsec><bsec buid="3" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="278" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="278">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="279"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on
