Section <bold>63G-7-301</bold> is amended to read:</secline><catline lineno="27"><bold>63G-7-301<parens/>. Waivers of immunity.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="28" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="5-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Immunity from suit of each governmental entity is waived as to any contractual <ln numlevel="1" lineno="29" slineno="1-4"/>obligation.</subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="30" slineno="1-5" level="2"><display>(b)</display>Actions arising out of contractual rights or obligations are not subject to the <ln numlevel="1" lineno="31" slineno="1-6"/>requirements of Section <xref depth="3" refnumber="63G-7-401">63G-7-401</xref>, <xref depth="3" refnumber="63G-7-402">63G-7-402</xref>, <xref depth="3" refnumber="63G-7-403">63G-7-403</xref>, or <xref depth="3" refnumber="63G-7-601">63G-7-601</xref>.</subsection><subsection ssid="5-null-4" dnum="c-o" numlevel="1" lineno="32" slineno="1-7" level="2"><display>(c)</display>The Division of Water Resources is not liable for failure to deliver water from a <ln numlevel="1" lineno="33" slineno="1-8"/>reservoir or associated facility authorized by Title <xref depth="1" refnumber="73-26">73, Chapter 26</xref>, Bear River <ln numlevel="1" lineno="34" slineno="1-9"/>Development Act, if the failure to deliver the contractual amount of water is due to <ln numlevel="1" lineno="35" slineno="1-10"/>drought, other natural condition, or safety condition that causes a deficiency in the <ln numlevel="1" lineno="36" slineno="1-11"/>amount of available water.</subsection></subsection><subsection ssid="5-null-5" dnum="2-o" numlevel="1" lineno="37" slineno="1-12" level="1"><display>(2)</display>Immunity from suit of each governmental entity is waived:<subsection ssid="5-null-6" dnum="a-o" numlevel="1" lineno="38" slineno="1-13" level="2"><display>(a)</display>as to any action brought to recover, obtain possession of, or quiet title to real or <ln numlevel="1" lineno="39" slineno="1-14"/>personal property;</subsection><subsection ssid="5-null-7" dnum="b-o" numlevel="1" lineno="40" slineno="1-15" level="2"><display>(b)</display>as to any action brought to foreclose mortgages or other liens on real or personal <ln numlevel="1" lineno="41" slineno="1-16"/>property, to determine any adverse claim on real or personal property, or to obtain an <ln numlevel="1" lineno="42" slineno="1-17"/>adjudication about any mortgage or other lien that the governmental entity may have <ln numlevel="1" lineno="43" slineno="1-18"/>or claim on real or personal property;</subsection><subsection ssid="5-null-8" dnum="c-o" numlevel="1" lineno="44" slineno="1-19" level="2"><display>(c)</display>as to any action based on the negligent destruction, damage, or loss of goods, <ln numlevel="1" lineno="45" slineno="1-20"/>merchandise, or other property while it is in the possession of any governmental <ln numlevel="1" lineno="46" slineno="1-21"/>entity or employee, if the property was seized for the purpose of forfeiture under any <ln numlevel="1" lineno="47" slineno="1-22"/>provision of state law;</subsection><subsection ssid="5-null-9" dnum="d-o" numlevel="1" lineno="48" slineno="1-23" level="2"><display>(d)</display>subject to Section <xref depth="3" refnumber="63G-7-302">63G-7-302</xref>, as to any action brought under the authority of Utah <ln numlevel="1" lineno="49" slineno="1-24"/>Constitution, Article I, Section 22, for the recovery of compensation from the <ln numlevel="1" lineno="50" slineno="1-25"/>governmental entity when the governmental entity has taken or damaged private <ln numlevel="1" lineno="51" slineno="1-26"/>property for public uses without just compensation;</subsection><subsection ssid="5-null-10" dnum="e-o" numlevel="1" lineno="52" slineno="1-27" level="2"><display>(e)</display>as to any claim for attorney fees or costs under Section <xref depth="3" refnumber="63G-2-209">63G-2-209</xref>, <xref depth="3" refnumber="63G-2-405">63G-2-405</xref>, or <xref depth="3" refnumber="63G-2-802"><ln numlevel="1" lineno="53" slineno="1-28"/>63G-2-802</xref>;</subsection><subsection ssid="5-null-11" dnum="f-o" numlevel="1" lineno="54" slineno="1-29" level="2"><display>(f)</display>for actual damages under Title <xref depth="1" refnumber="67-21">67, Chapter 21</xref>, Utah Protection of Public Employees <ln numlevel="1" lineno="55" slineno="1-30"/>Act;</subsection><subsection ssid="5-null-12" dnum="g-o" numlevel="1" lineno="56" slineno="1-31" level="2"><display>(g)</display>as to any action brought to obtain relief from a land use regulation that imposes a <ln numlevel="1" lineno="57" slineno="1-32"/>substantial burden on the free exercise of religion under Title <xref depth="1" refnumber="63L-5">63L, Chapter 5</xref>, Utah <ln numlevel="1" lineno="58" slineno="1-33"/>Religious Land Use Act;</subsection><subsection ssid="5-null-13" dnum="h-o" numlevel="1" lineno="59" slineno="1-34" level="2"><display>(h)</display>except as provided in Subsection <xref depth="4" refnumber="63G-7-201(3)">63G-7-201(3)</xref>, as to any injury caused by:<subsection ssid="5-null-14" dnum="i-o" numlevel="1" lineno="60" slineno="1-35" level="3"><display>(i)</display>a defective, unsafe, or dangerous condition of any highway, road, street, alley, <ln numlevel="1" lineno="61" slineno="1-36"/>crosswalk, sidewalk, culvert, tunnel, bridge, viaduct, or other structure located on <ln numlevel="1" lineno="62" slineno="1-37"/>them; or</subsection><subsection ssid="5-null-15" dnum="ii-o" numlevel="1" lineno="63" slineno="1-38" level="3"><display>(ii)</display>any defective or dangerous condition of a public building, structure, dam, <ln numlevel="1" lineno="64" slineno="1-39"/>reservoir, or other public improvement;</subsection></subsection><subsection ssid="5-null-16" dnum="i-o" numlevel="1" lineno="65" slineno="1-40" level="2"><display>(i)</display>subject to Subsections <xref depth="4" refnumber="63G-7-101(4)">63G-7-101(4)</xref> and <xref depth="4" refnumber="63G-7-201(4)">63G-7-201(4)</xref>, as to any injury proximately <ln numlevel="1" lineno="66" slineno="1-41"/>caused by a negligent act or omission of an employee committed within the scope of <ln numlevel="1" lineno="67" slineno="1-42"/>employment;</subsection><subsection ssid="5-null-17" dnum="j-o" numlevel="1" lineno="68" slineno="1-43" level="2"><display>(j)</display>notwithstanding Subsection <xref depth="4" refnumber="63G-7-101(4)">63G-7-101(4)</xref>, as to a claim for an injury resulting from a <ln numlevel="1" lineno="69" slineno="1-44"/>sexual battery, as provided in Section <xref depth="3" refnumber="76-5-418">76-5-418</xref>, committed:<subsection ssid="5-null-18" dnum="i-o" numlevel="1" lineno="70" slineno="1-45" level="3"><display>(i)</display>against a student of a public elementary or secondary school, including a charter <ln numlevel="1" lineno="71" slineno="1-46"/>school; and</subsection><subsection ssid="5-null-19" dnum="ii-o" numlevel="1" lineno="72" slineno="1-47" level="3"><display>(ii)</display>by an employee of a public elementary or secondary school or charter school who:<subsection ssid="5-null-20" dnum="A-o" numlevel="1" lineno="73" slineno="1-48" level="4"><display>(A)</display>at the time of the sexual battery, held a position of special trust, as defined in <ln numlevel="1" lineno="74" slineno="1-49"/>Section <xref depth="3" refnumber="76-5-404.1">76-5-404.1</xref>, with respect to the student;</subsection><subsection ssid="5-null-21" dnum="B-o" numlevel="1" lineno="75" slineno="1-50" level="4"><display>(B)</display>is criminally charged in connection with the sexual battery; and</subsection><subsection ssid="5-null-22" dnum="C-o" numlevel="1" lineno="76" slineno="1-51" level="4"><display>(C)</display>the public elementary or secondary school or charter school knew or in the <ln numlevel="1" lineno="77" slineno="1-52"/>exercise of reasonable care should have known, at the time of the employee's <ln numlevel="1" lineno="78" slineno="1-53"/>hiring, to be a sex offender, a kidnap offender, or a child abuse offender as <ln numlevel="1" lineno="79" slineno="1-54"/>described in Section <xref depth="3" refnumber="53-29-202">53-29-202</xref>, required to register under Title 53, Chapter 29, <ln numlevel="1" lineno="80" slineno="1-55"/>Sex, Kidnap, and Child Abuse Offender Registry, whose status as a sex <ln numlevel="1" lineno="81" slineno="1-56"/>offender, kidnap offender, or child abuse offender would have been revealed in <ln numlevel="1" lineno="82" slineno="1-57"/>a background check under Section <xref depth="3" refnumber="53G-11-402">53G-11-402</xref>;</subsection></subsection></subsection><subsection ssid="5-null-23" dnum="k-o" numlevel="1" lineno="83" slineno="1-58" level="2"><display>(k)</display>as to any action brought under Section <xref depth="3" refnumber="78B-6-2303">78B-6-2303</xref>; </subsection><subsection ssid="5-null-24" dnum="l-o" numlevel="1" lineno="84" slineno="1-59" level="2"><display>(l)</display>as to any action brought to obtain relief under Title <xref depth="2" refnumber="53H-7-7">53H, Chapter 7, Part 7</xref>, Student <ln numlevel="1" lineno="85" slineno="1-60"/>Legal Representation;</subsection><subsection ssid="5-null-25" dnum="m-o" numlevel="1" lineno="86" slineno="1-61" level="2"><display>(m)</display>as to any action brought under Section <xref depth="3" refnumber="53-30-301">53-30-301</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-26" dnum="n-o" numlevel="1" lineno="87" slineno="1-62" level="2"><display>(n)</display>as to any action or suit brought under Section <xref depth="3" refnumber="20A-19-301">20A-19-301</xref> and as to any <ln numlevel="1" lineno="88" slineno="1-63"/>compensation or expenses awarded under Subsection <xref depth="4" refnumber="20A-19-301(5)">20A-19-301(5)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="5-81" dnum="_-o:o-i" numlevel="1" lineno="89" slineno="1-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(o)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">as to any action brought under Section <xref depth="3" refnumber="78B-6-1102.1">78B-6-1102.1</xref>.</amend></subsection></subsection><subsection ssid="5-null-27" dnum="3-o" numlevel="1" lineno="90" slineno="1-65" level="1" space="false"><display>(3)</display><subsection ssid="5-null-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="63G-7-301(3)">(3)</xref>:<subsection ssid="5-null-29" dnum="i-o" numlevel="1" lineno="91" slineno="1-66" level="3" tab="1"><display>(i)</display>"Code of conduct" means a code of conduct that:<subsection ssid="5-null-30" dnum="A-o" numlevel="1" lineno="92" slineno="1-67" level="4"><display>(A)</display>is not less stringent than a model code of conduct, created by the State Board <ln numlevel="1" lineno="93" slineno="1-68"/>of Education, establishing a professional standard of care for preventing the <ln numlevel="1" lineno="94" slineno="1-69"/>conduct described in Subsection <xref depth="4" refnumber="63G-7-301(3)(a)(i)(d)">(3)(a)(i)(D)</xref>;</subsection><subsection ssid="5-null-31" dnum="B-o" numlevel="1" lineno="95" slineno="1-70" level="4"><display>(B)</display>is adopted by the applicable local education governing body;</subsection><subsection ssid="5-null-32" dnum="C-o" numlevel="1" lineno="96" slineno="1-71" level="4"><display>(C)</display>regulates behavior of a school employee toward a student; and</subsection><subsection ssid="5-null-33" dnum="D-o" numlevel="1" lineno="97" slineno="1-72" level="4"><display>(D)</display>includes a prohibition against any sexual conduct between an employee and a <ln numlevel="1" lineno="98" slineno="1-73"/>student and against the employee and student sharing any sexually explicit or <ln numlevel="1" lineno="99" slineno="1-74"/>lewd communication, image, or photograph.</subsection></subsection><subsection ssid="5-null-34" dnum="ii-o" numlevel="1" lineno="100" slineno="1-75" level="3" tab="1"><display>(ii)</display>"Local education agency" means:<subsection ssid="5-null-35" dnum="A-o" numlevel="1" lineno="101" slineno="1-76" level="4"><display>(A)</display>a school district;</subsection><subsection ssid="5-null-36" dnum="B-o" numlevel="1" lineno="102" slineno="1-77" level="4"><display>(B)</display>a charter school; or</subsection><subsection ssid="5-null-37" dnum="C-o" numlevel="1" lineno="103" slineno="1-78" level="4"><display>(C)</display>the Utah Schools for the Deaf and the Blind.</subsection></subsection><subsection ssid="5-null-38" dnum="iii-o" numlevel="1" lineno="104" slineno="1-79" level="3" tab="1"><display>(iii)</display>"Local education governing board" means:<subsection ssid="5-null-39" dnum="A-o" numlevel="1" lineno="105" slineno="1-80" level="4"><display>(A)</display>for a school district, the local school board;</subsection><subsection ssid="5-null-40" dnum="B-o" numlevel="1" lineno="106" slineno="1-81" level="4"><display>(B)</display>for a charter school, the charter school governing board; or</subsection><subsection ssid="5-null-41" dnum="C-o" numlevel="1" lineno="107" slineno="1-82" level="4"><display>(C)</display>for the Utah Schools for the Deaf and the Blind, the state board.</subsection></subsection><subsection ssid="5-null-42" dnum="iv-o" numlevel="1" lineno="108" slineno="1-83" level="3" tab="1"><display>(iv)</display>"Public school" means a public elementary or secondary school.</subsection><subsection ssid="5-null-43" dnum="v-o" numlevel="1" lineno="109" slineno="1-84" level="3" tab="1"><display>(v)</display>"Sexual abuse" means the offense described in Subsection <xref depth="4" refnumber="76-5-404.1(2)">76-5-404.1(2)</xref>.</subsection><subsection ssid="5-null-44" dnum="vi-o" numlevel="1" lineno="110" slineno="1-85" level="3" tab="1"><display>(vi)</display>"Sexual battery" means the offense described in Section <xref depth="3" refnumber="76-5-418">76-5-418</xref>, considering <ln numlevel="1" lineno="111" slineno="1-86"/>the term "child" in that section to include an individual under 18 years old.</subsection></subsection><subsection ssid="5-null-45" dnum="b-o" numlevel="1" lineno="112" slineno="1-87" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="63G-7-101(4)">63G-7-101(4)</xref>, immunity from suit is waived as to a <ln numlevel="1" lineno="113" slineno="1-88"/>claim against a local education agency for an injury resulting from a sexual battery or <ln numlevel="1" lineno="114" slineno="1-89"/>sexual abuse committed against a student of a public school by a paid employee of <ln numlevel="1" lineno="115" slineno="1-90"/>the public school who is criminally charged in connection with the sexual battery or <ln numlevel="1" lineno="116" slineno="1-91"/>sexual abuse, unless:<subsection ssid="5-null-46" dnum="i-o" numlevel="1" lineno="117" slineno="1-92" level="3"><display>(i)</display>at the time of the sexual battery or sexual abuse, the public school was subject to a <ln numlevel="1" lineno="118" slineno="1-93"/>code of conduct; and</subsection><subsection ssid="5-null-47" dnum="ii-o" numlevel="1" lineno="119" slineno="1-94" level="3"><display>(ii)</display>before the sexual battery or sexual abuse occurred, the public school had:<subsection ssid="5-null-48" dnum="A-o" numlevel="1" lineno="120" slineno="1-95" level="4"><display>(A)</display>provided training on the code of conduct to the employee; and</subsection><subsection ssid="5-null-49" dnum="B-o" numlevel="1" lineno="121" slineno="1-96" level="4"><display>(B)</display>required the employee to sign a statement acknowledging that the employee <ln numlevel="1" lineno="122" slineno="1-97"/>has read and understands the code of conduct.</subsection></subsection></subsection></subsection><subsection ssid="5-null-50" dnum="4-o" numlevel="1" lineno="123" slineno="1-98" level="1" space="false"><display>(4)</display><subsection ssid="5-null-51" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="63G-7-301(4)">(4)</xref>:<subsection ssid="5-null-52" dnum="i-o" numlevel="1" lineno="124" slineno="1-99" level="3" tab="1"><display>(i)</display>"Institution of higher education" means the same as that term is defined in Section <xref depth="3" refnumber="53H-1-101"><ln numlevel="1" lineno="125" slineno="1-100"/>53H-1-101</xref>.</subsection><subsection ssid="5-null-53" dnum="ii-o" numlevel="1" lineno="126" slineno="1-101" level="3" tab="1"><display>(ii)</display>"Policy governing behavior" means a policy adopted by a higher education <ln numlevel="1" lineno="127" slineno="1-102"/>institution or the Utah Board of Higher Education that:<subsection ssid="5-null-54" dnum="A-o" numlevel="1" lineno="128" slineno="1-103" level="4"><display>(A)</display>establishes a professional standard of care for preventing the conduct <ln numlevel="1" lineno="129" slineno="1-104"/>described in Subsections <xref depth="4" refnumber="63G-7-301(4)(a)(ii)(c)">(4)(a)(ii)(C)</xref> and <xref depth="4" refnumber="63G-7-301(d)">(D)</xref>;</subsection><subsection ssid="5-null-55" dnum="B-o" numlevel="1" lineno="130" slineno="1-105" level="4"><display>(B)</display>regulates behavior of a special trust employee toward a subordinate student;</subsection><subsection ssid="5-null-56" dnum="C-o" numlevel="1" lineno="131" slineno="1-106" level="4"><display>(C)</display>includes a prohibition against any sexual conduct between a special trust <ln numlevel="1" lineno="132" slineno="1-107"/>employee and a subordinate student; and</subsection><subsection ssid="5-null-57" dnum="D-o" numlevel="1" lineno="133" slineno="1-108" level="4"><display>(D)</display>includes a prohibition against a special trust employee and subordinate student <ln numlevel="1" lineno="134" slineno="1-109"/>sharing any sexually explicit or lewd communication, image, or photograph.</subsection></subsection><subsection ssid="5-null-58" dnum="iii-o" numlevel="1" lineno="135" slineno="1-110" level="3" tab="1"><display>(iii)</display>"Sexual battery" means the offense described in Section <xref depth="3" refnumber="76-5-418">76-5-418</xref>.</subsection><subsection ssid="5-null-59" dnum="iv-o" numlevel="1" lineno="136" slineno="1-111" level="3" tab="1"><display>(iv)</display>"Special trust employee" means an employee of an institution of higher education <ln numlevel="1" lineno="137" slineno="1-112"/>who is in a position of special trust, as defined in Section <xref depth="3" refnumber="76-5-404.1">76-5-404.1</xref>, with a <ln numlevel="1" lineno="138" slineno="1-113"/>higher education student.</subsection><subsection ssid="5-null-60" dnum="v-o" numlevel="1" lineno="139" slineno="1-114" level="3" tab="1"><display>(v)</display>"Subordinate student" means a student:<subsection ssid="5-null-61" dnum="A-o" numlevel="1" lineno="140" slineno="1-115" level="4"><display>(A)</display>of an institution of higher education; and</subsection><subsection ssid="5-null-62" dnum="B-o" numlevel="1" lineno="141" slineno="1-116" level="4"><display>(B)</display>whose educational opportunities could be adversely impacted by a special <ln numlevel="1" lineno="142" slineno="1-117"/>trust employee.</subsection></subsection></subsection><subsection ssid="5-null-63" dnum="b-o" numlevel="1" lineno="143" slineno="1-118" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="63G-7-101(4)">63G-7-101(4)</xref>, immunity from suit is waived as to a <ln numlevel="1" lineno="144" slineno="1-119"/>claim for an injury resulting from a sexual battery committed against a subordinate <ln numlevel="1" lineno="145" slineno="1-120"/>student by a special trust employee, unless:<subsection ssid="5-null-64" dnum="i-o" numlevel="1" lineno="146" slineno="1-121" level="3"><display>(i)</display>the institution of higher education proves that the special trust employee's <ln numlevel="1" lineno="147" slineno="1-122"/>behavior that otherwise would constitute a sexual battery was:<subsection ssid="5-null-65" dnum="A-o" numlevel="1" lineno="148" slineno="1-123" level="4"><display>(A)</display>with a subordinate student who was at least 18 years old at the time of the <ln numlevel="1" lineno="149" slineno="1-124"/>behavior; and</subsection><subsection ssid="5-null-66" dnum="B-o" numlevel="1" lineno="150" slineno="1-125" level="4"><display>(B)</display>with the student's consent; or</subsection></subsection><subsection ssid="5-null-67" dnum="ii-o" numlevel="1" lineno="151" slineno="1-126" level="3" space="false"><display>(ii)</display><subsection ssid="5-null-68" dnum="A-o" level="4" placement="sameline"><display>(A)</display>at the time of the sexual battery, the institution of higher education was <ln numlevel="1" lineno="152" slineno="1-127"/>subject to a policy governing behavior; and</subsection><subsection ssid="5-null-69" dnum="B-o" numlevel="1" lineno="153" slineno="1-128" level="4"><display>(B)</display>before the sexual battery occurred, the higher education institution had taken <ln numlevel="1" lineno="154" slineno="1-129"/>steps to implement and enforce the policy governing behavior.</subsection></subsection></subsection></subsection></section></bsec><bsec buid="3" num="78B-6-1102.1" type="enact" src="code" uid="C78B-6-S1102.1_2026050620260506" sort="78B06 11020120260506" numlevel="1" lineno="155" slineno="2-1" sn="2"><section numlevel="1" lineno="156" slineno="2-2" number="78B-6-1102.1" type="enact"><secline lineno="155">Section 2. Section <bold>78B-6-1102.1</bold> is enacted to read:</secline><catline lineno="156"><bold>78B-6-1102.1<parens/>. Nuisance -- Private right of action -- Governmental immunity not <ln numlevel="1" lineno="157" slineno="2-3"/>a defense.</bold></catline><subsection ssid="3-1-74" dnum="_-o:1-i" numlevel="1" lineno="158" slineno="2-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="3-1-75" dnum="_-o:a-i" numlevel="1" lineno="159" slineno="2-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="end">"Private individual" means an individual who is a landowner or tenant whose <ln numlevel="1" lineno="160" slineno="2-6"/>property or business is adjacent to property owned or controlled by a governmental <ln numlevel="1" lineno="161" slineno="2-7"/>entity.</amend></subsection><subsection ssid="3-1-76" dnum="_-o:b-i" numlevel="1" lineno="162" slineno="2-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="89" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">"Private nuisance" means a third party's unauthorized use of property owned or <ln numlevel="1" lineno="163" slineno="2-9"/>controlled by a governmental entity, as that term is defined in Section <xref depth="3" refnumber="63G-7-102">63G-7-102</xref>, <ln numlevel="1" lineno="164" slineno="2-10"/>upon whose continuing course of conduct, action, or series of actions constitutes:</amend><subsection ssid="3-1-77" dnum="_-o:i-i" numlevel="1" lineno="165" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="231" groupid="178" style="1" owner="jchristopherson" level="1" amendtag="end">a substantial and unreasonable interference with the private individual's use and <ln numlevel="1" lineno="166" slineno="2-12"/>comfortable enjoyment of the private individual's life or property; or</amend></subsection><subsection ssid="3-1-78" dnum="_-o:ii-i" numlevel="1" lineno="167" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="241" groupid="186" style="1" owner="jchristopherson" level="1" amendtag="end">a material interference and obstruction of the lawful operation and use of the <ln numlevel="1" lineno="168" slineno="2-14"/>private individual's place of business.</amend></subsection></subsection><subsection ssid="3-89" dnum="_-o:c-i" numlevel="1" lineno="169" slineno="2-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="327" groupid="247" style="1" owner="jchristopherson" level="1" amendtag="end">"Public nuisance" means the same as the term is defined in Section <xref depth="3" refnumber="76-9-1301">76-9-1301</xref>. </amend></subsection></subsection><subsection ssid="3-1-79" dnum="_-o:2-i" numlevel="1" lineno="170" slineno="2-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="257" groupid="199" style="1" owner="jchristopherson" level="1" amendtag="end">A private individual may bring a civil action under this section against a governmental <ln numlevel="1" lineno="171" slineno="2-17"/>entity that, either through action or inaction, permits a third party to create, contribute to, <ln numlevel="1" lineno="172" slineno="2-18"/>or maintain a public or private nuisance on property owned or controlled by the <ln numlevel="1" lineno="173" slineno="2-19"/>governmental entity.</amend></subsection><subsection ssid="3-1-80" dnum="_-o:3-i" numlevel="1" lineno="174" slineno="2-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="261" groupid="202" style="1" owner="jchristopherson" level="1" amendtag="end">A private right of action brought under this section:</amend><subsection ssid="3-1-81" dnum="_-o:a-i" numlevel="1" lineno="175" slineno="2-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="287" groupid="220" style="1" owner="jchristopherson" level="1" amendtag="end">is authorized in accordance with Subsection <xref depth="4" refnumber="78B-3-101.3(5)">78B-3-101.3(5)</xref>;</amend></subsection><subsection ssid="3-1-82" dnum="_-o:b-i" numlevel="1" lineno="176" slineno="2-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="292" groupid="224" style="1" owner="jchristopherson" level="1" amendtag="end">shall be brought in accordance with Section <xref depth="3" refnumber="78B-6-1102">78B-6-1102</xref>; and</amend></subsection><subsection ssid="3-1-83" dnum="_-o:c-i" numlevel="1" lineno="177" slineno="2-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="297" groupid="228" style="1" owner="jchristopherson" level="1" amendtag="end">shall be commenced within the time limits applicable to injury or property as <ln numlevel="1" lineno="178" slineno="2-24"/>provided by law.</amend></subsection></subsection><subsection ssid="3-1-85" dnum="_-o:4-i" numlevel="1" lineno="179" slineno="2-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="3-1-86" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1082" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">A governmental entity may not assert the defense of governmental immunity <ln numlevel="1" lineno="180" slineno="2-26"/>under Title 63G, Chapter 7, Governmental Immunity Act of Utah, in an action <ln numlevel="1" lineno="181" slineno="2-27"/>brought under this section.</amend></subsection><subsection ssid="3-1-87" dnum="_-o:b-i" numlevel="1" lineno="182" slineno="2-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="274" groupid="211" style="1" owner="jchristopherson" level="1" amendtag="end">A governmental entity is liable under this section to the same extent that a private <ln numlevel="1" lineno="183" slineno="2-29"/>individual is liable for a public or private nuisance claim against another private <ln numlevel="1" lineno="184" slineno="2-30"/>individual, whether the nuisance is caused by the actions of a third party.</amend></subsection></subsection></section></bsec><bsec buid="6" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="185" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="185">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="186"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-23-26 10:32 AM</tm></rev></foot></leg>
