Abbott</sponsorhead><otherSponsorhead>Senate Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill addresses provisions related to a prescriptive easement for water conveyance.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">provides that a municipality has first priority to establish control of a prescriptive <ln numlevel="1" lineno="9" slineno="0-9"/>easement for water conveyance upon the holder of the easement filing a notice of intent <ln numlevel="1" lineno="10" slineno="0-10"/>to abandon;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">requires a municipality that desires to establish control of a prescriptive easement for <ln numlevel="1" lineno="12" slineno="0-12"/>water conveyance to file a notice describing the use and location of the prescriptive <ln numlevel="1" lineno="13" slineno="0-13"/>easement in the office of the county recorder in which the easement is located;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">allows a municipality to convert the use of a prescriptive easement for water conveyance <ln numlevel="1" lineno="15" slineno="0-15"/>if the municipality:<hl numlevel="1" lineno="16" slineno="0-16" level="2">mails notice of the converted use of the easement to each affected landowner;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="2">files a notice describing the converted use of the easement in the office of the county <ln numlevel="1" lineno="18" slineno="0-18"/>recorder;</hl><hl numlevel="1" lineno="19" slineno="0-19" level="2">waits 120 days from the day the municipality sends notice to each affected landowner;</hl><hl numlevel="1" lineno="20" slineno="0-20" level="2">receives no written objection to the converted use from an affected landowner; and</hl><hl numlevel="1" lineno="21" slineno="0-21" level="2">limits the modified use of the easement to not burden an affected landowner's use of <ln numlevel="1" lineno="22" slineno="0-22"/>land, interfere with an existing easement, or expand the size of the easement; and</hl></hl><hl numlevel="1" lineno="23" slineno="0-23" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="24" slineno="0-24" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="25">None</moniNone><oc numlevel="1" lineno="26" slineno="0-26">Other Special Clauses:</oc><ocNone lineno="27">None</ocNone><sa numlevel="1" lineno="28" slineno="0-28">Utah Code Sections Affected:<saamd numlevel="1" lineno="29" slineno="0-29"><snhead>AMENDS:</snhead><sn num="57-13a-103" src="code" uid="C57-13a-S103_2026050620260506" buid="6" sort="57 13a01030020260506" numlevel="1" lineno="30" slineno="0-30"><bold>57-13a-103</bold>, as enacted by Laws of Utah 2007, Chapter 318</sn><sn num="57-13a-104" src="code" uid="C57-13a-S104_2026050620260506" buid="1" sort="57 13a01040020260506" numlevel="1" lineno="31" slineno="0-31"><bold>57-13a-104</bold>, as last amended by Laws of Utah 2023, Chapter 435</sn></saamd><saent numlevel="1" lineno="32" slineno="0-32"><snhead>ENACTS:</snhead><sn num="57-13a-105" src="code" uid="C57-13a-S105_2026050620260506" buid="8" sort="57 13a01050020260506" numlevel="1" lineno="33" slineno="0-33"><bold>57-13a-105</bold>, Utah Code Annotated 1953</sn></saent></sa></lt><enacthead lineno="34"/><enact numlevel="1" lineno="35" slineno="0-35">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="6" num="57-13a-103" type="amend" src="code" uid="C57-13a-S103_2026050620260506" sort="57 13a01030020260506" numlevel="1" lineno="36" slineno="1-1" sn="1"><section number="57-13a-103" numlevel="1" lineno="37" slineno="1-2" type="amend"><secline lineno="36">Section 1. Section <bold>57-13a-103</bold> is amended to read:</secline><catline lineno="37"><bold>57-13a-103<parens/>. Notice of easement.</bold></catline><subsection ssid="6-4" dnum="_-o:1-i" numlevel="1" lineno="38" slineno="1-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="both">(1)</amend></display>The holder of an easement established <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">as provided by</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">under</amend> Section <xref depth="3" refid="C57-13a-S102_1800010118000101" refnumber="57-13a-102" start="0">57-13a-102</xref> <ln numlevel="1" lineno="39" slineno="1-4"/>may file a notice describing the easement in the office of the county recorder of each <ln numlevel="1" lineno="40" slineno="1-5"/>county in which the easement or a portion of the easement is located.</subsection><subsection ssid="6-2" dnum="_-o:2-i" numlevel="1" lineno="41" slineno="1-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">A municipality that is a holder of an easement established under Section <xref depth="3" refnumber="57-13a-105">57-13a-105</xref> <ln numlevel="1" lineno="42" slineno="1-7"/>shall file a notice describing the use and location of the easement in the office of the <ln numlevel="1" lineno="43" slineno="1-8"/>county recorder in which the easement is located.</amend></subsection></section></bsec><bsec buid="1" num="57-13a-104" type="amend" src="code" uid="C57-13a-S104_2026050620260506" sort="57 13a01040020260506" numlevel="1" lineno="44" slineno="2-1" sn="2"><section number="57-13a-104" numlevel="1" lineno="45" slineno="2-2" type="amend"><secline lineno="44">Section 2. Section <bold>57-13a-104</bold> is amended to read:</secline><catline lineno="45"><bold>57-13a-104<parens/>. Abandonment of prescriptive easement for water conveyance -- <ln numlevel="1" lineno="46" slineno="2-3"/>Transfer of abandoned easement to municipality.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="47" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>A holder of a prescriptive easement for a water conveyance established under Section <xref depth="3" refnumber="57-13a-102" start="0"><ln numlevel="1" lineno="48" slineno="2-5"/>57-13a-102</xref> may, in accordance with this section, abandon all or part of the easement.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="49" slineno="2-6" level="1" space="false"><display>(2)</display><subsection ssid="1-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A holder of a prescriptive easement for a water conveyance established under <ln numlevel="1" lineno="50" slineno="2-7"/>Section <xref depth="3" refnumber="57-13a-102" start="0">57-13a-102</xref> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both">who</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">that</amend> seeks to abandon the easement or part of the easement <ln numlevel="1" lineno="51" slineno="2-8"/>shall<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="133" groupid="109" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="132" groupid="108" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend> <subsection ssid="1-30" dnum="_-o:i-i" numlevel="1" lineno="52" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>in each county where the easement or part of the easement is located, file in the <ln numlevel="1" lineno="53" slineno="2-10"/>office of the county recorder a notice of intent to abandon the prescriptive <ln numlevel="1" lineno="54" slineno="2-11"/>easement that describes the easement or part of the easement to be abandoned<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="142" groupid="117" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="140" groupid="115" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; <ln numlevel="1" lineno="55" slineno="2-12"/>and</amend></subsection><subsection ssid="1-31" dnum="_-o:ii-i" numlevel="1" lineno="56" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="114" style="1" owner="jchristopherson" level="1" amendtag="end">mail a copy of the notice of intent to abandon the prescriptive easement to each <ln numlevel="1" lineno="57" slineno="2-14"/>municipal government in which the easement or part of the easement is located.</amend></subsection></subsection><subsection ssid="1-null-4" dnum="b-o" numlevel="1" lineno="58" slineno="2-15" level="2"><display>(b)</display>A county recorder who receives a notice of intent to abandon a prescriptive easement <ln numlevel="1" lineno="59" slineno="2-16"/>shall:<subsection ssid="1-null-5" dnum="i-o" numlevel="1" lineno="60" slineno="2-17" level="3"><display>(i)</display>publish copies of the notice for the area generally served by the water conveyance <ln numlevel="1" lineno="61" slineno="2-18"/>that utilizes the easement, as a class A notice under Section <xref depth="3" refnumber="63G-30-102" start="0">63G-30-102</xref>, for at <ln numlevel="1" lineno="62" slineno="2-19"/>least 45 days; and</subsection><subsection ssid="1-null-6" dnum="ii-o" numlevel="1" lineno="63" slineno="2-20" level="3"><display>(ii)</display>mail a copy of the notice of intent to abandon the prescriptive easement to each <ln numlevel="1" lineno="64" slineno="2-21"/>municipal and county government <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="173" groupid="135" style="2" owner="jchristopherson" level="1" deltag="both">where</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="171" groupid="133" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in which</amend> the easement or part of the <ln numlevel="1" lineno="65" slineno="2-22"/>easement is located<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>.</subsection></subsection><subsection ssid="1-34" dnum="_-o:c-i" numlevel="1" lineno="66" slineno="2-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="156" groupid="125" style="1" owner="jchristopherson" level="1" amendtag="end">Upon the filing of a notice of intent to abandon a prescriptive easement under <ln numlevel="1" lineno="67" slineno="2-24"/>Subsection <xref depth="4" refnumber="57-13a-104(2)(a)(i)">(2)(a)(i)</xref>, a municipality in which the prescriptive easement is located <ln numlevel="1" lineno="68" slineno="2-25"/>shall have first priority to establish control of any portion of the easement located <ln numlevel="1" lineno="69" slineno="2-26"/>within the municipality's boundaries in accordance with the requirements of <ln numlevel="1" lineno="70" slineno="2-27"/>Subsection <xref depth="4" refnumber="57-13a-104(4)(b)">(4)(b)</xref>.</amend></subsection></subsection><subsection ssid="1-null-7" dnum="3-o" numlevel="1" lineno="71" slineno="2-28" level="1"><display>(3)</display>After meeting the requirements of Subsection <xref depth="4" refnumber="57-13a-104(2)(a)" start="0">(2)(a)</xref> and at least 45 days after the last <ln numlevel="1" lineno="72" slineno="2-29"/>day on which the county recorder posts the notice of intent to abandon the prescriptive <ln numlevel="1" lineno="73" slineno="2-30"/>easement in accordance with Subsection <xref depth="4" refnumber="57-13a-104(2)(b)" start="0">(2)(b)</xref>, the holder of the prescriptive easement <ln numlevel="1" lineno="74" slineno="2-31"/>shall file in the office of the county recorder for each county <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="174" groupid="136" style="2" owner="jchristopherson" level="1" deltag="both">where</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="172" groupid="134" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in which</amend> the <ln numlevel="1" lineno="75" slineno="2-32"/>easement or part of the easement is located a notice of abandonment that contains the <ln numlevel="1" lineno="76" slineno="2-33"/>same description required by Subsection <xref depth="4" refnumber="57-13a-104(2)(a)" start="0">(2)(a)</xref>.</subsection><subsection ssid="1-null-8" dnum="4-o" numlevel="1" lineno="77" slineno="2-34" level="1" space="false"><display>(4)</display><subsection ssid="1-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="62" style="2" owner="jchristopherson" level="1" deltag="both">Upon </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="70" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Subsection <xref depth="4" refnumber="57-13a-104(4)(b)">(4)(b)</xref>, upon </amend>completion of the <ln numlevel="1" lineno="78" slineno="2-35"/>requirements described in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="124" groupid="101" style="2" owner="jchristopherson" level="1" deltag="both">Subsection <xref depth="4" refnumber="57-13a-104(2)" start="0">(2)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="122" groupid="99" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsections <xref depth="4" refnumber="57-13a-104(2)">(2)</xref> and <xref depth="4" refnumber="57-13a-104(3)">(3)</xref></amend>:<subsection ssid="1-null-10" dnum="i-o" numlevel="1" lineno="79" slineno="2-36" level="3" tab="1"><display>(i)</display>all interest to the easement or part of the easement abandoned by the holder of the <ln numlevel="1" lineno="80" slineno="2-37"/>easement is extinguished; and</subsection><subsection ssid="1-null-11" dnum="ii-o" numlevel="1" lineno="81" slineno="2-38" level="3" tab="1"><display>(ii)</display>subject to each legal right that exists as described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="127" groupid="104" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="57-13a-104(4)(b)" start="0">(4)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="123" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="(4)(c)" depth="4">(4)(c)</xref></amend>, the <ln numlevel="1" lineno="82" slineno="2-39"/>owner of a servient estate whose land was encumbered by the easement or part of <ln numlevel="1" lineno="83" slineno="2-40"/>the easement abandoned may reclaim the land area occupied by the former <ln numlevel="1" lineno="84" slineno="2-41"/>easement or part of the easement and resume full utilization of the land without <ln numlevel="1" lineno="85" slineno="2-42"/>liability to the former holder of the easement.</subsection></subsection><subsection ssid="1-23" dnum="_-o:b-i" numlevel="1" lineno="86" slineno="2-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="57-13a-104(4)(a)">(4)(a)</xref>, a municipality may establish control of a <ln numlevel="1" lineno="87" slineno="2-44"/>prescriptive easement that is subject to a notice of intent to abandon described in <ln numlevel="1" lineno="88" slineno="2-45"/>Subsection <xref depth="4" refnumber="57-13a-104(2)">(2)</xref>, if the municipality files a notice of intent to establish control of the <ln numlevel="1" lineno="89" slineno="2-46"/>prescriptive easement:</amend><subsection ssid="1-28" dnum="_-o:i-i" numlevel="1" lineno="90" slineno="2-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">in the office of the county recorder in which the easement is located; and</amend></subsection><subsection ssid="1-29" dnum="_-o:ii-i" numlevel="1" lineno="91" slineno="2-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="end">before the easement is abandoned under Subsection <xref depth="4" refnumber="57-13a-104(4)(a)">(4)(a)</xref>.</amend></subsection></subsection><subsection ssid="1-null-12" dnum="b-o:c-i" numlevel="1" lineno="92" slineno="2-49" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1019" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>Abandonment of a prescriptive easement under this section does not affect a <ln numlevel="1" lineno="93" slineno="2-50"/>legal right to have water delivered or discharged through the water conveyance and <ln numlevel="1" lineno="94" slineno="2-51"/>easement established by a person other than the holder of the easement who abandons <ln numlevel="1" lineno="95" slineno="2-52"/>an easement as provided in this section.</subsection><subsection ssid="1-36" dnum="_-o:d-i" numlevel="1" lineno="96" slineno="2-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="166" groupid="129" style="1" owner="jchristopherson" level="1" amendtag="end">Nothing in this section limits the ability of a municipality to receive a transfer of a <ln numlevel="1" lineno="97" slineno="2-54"/>prescriptive easement for a water conveyance directly from the holder of the <ln numlevel="1" lineno="98" slineno="2-55"/>prescriptive easement.</amend></subsection></subsection><subsection ssid="1-null-13" dnum="5-o" numlevel="1" lineno="99" slineno="2-56" level="1"><display>(5)</display>A county recorder may bill the holder of the prescriptive easement for the cost of <ln numlevel="1" lineno="100" slineno="2-57"/>preparing, printing, and publishing the notice required under Subsection <xref depth="4" refnumber="57-13a-104(2)(b)" start="0">(2)(b)</xref>.</subsection></section></bsec><bsec buid="8" num="57-13a-105" type="enact" src="code" uid="C57-13a-S105_2026050620260506" sort="57 13a01050020260506" numlevel="1" lineno="101" slineno="3-1" sn="3"><section numlevel="1" lineno="102" slineno="3-2" number="57-13a-105" type="enact"><secline lineno="101">Section 3. Section <bold>57-13a-105</bold> is enacted to read:</secline><catline lineno="102"><bold>57-13a-105<parens/>. Conversion of a prescriptive easement for water conveyance by <ln numlevel="1" lineno="103" slineno="3-3"/>municipalities.</bold></catline><subsection ssid="8-37" dnum="_-o:1-i" numlevel="1" lineno="104" slineno="3-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="158" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">A municipality that establishes control of a prescriptive easement that is subject to a <ln numlevel="1" lineno="105" slineno="3-5"/>notice of intent to abandon, as described in Subsection <xref depth="4" refnumber="57-13a-104(4)(b)">57-13a-104(4)(b)</xref>, shall:</amend><subsection ssid="8-38" dnum="_-o:a-i" numlevel="1" lineno="106" slineno="3-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="166" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">file a notice describing the use and location of the easement in the office of the <ln numlevel="1" lineno="107" slineno="3-7"/>county recorder in which the easement is located; and</amend></subsection><subsection ssid="8-40" dnum="_-o:b-i" numlevel="1" lineno="108" slineno="3-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="174" groupid="111" style="1" owner="jchristopherson" level="1" amendtag="end">mail a notice that describes the use and location of the easement to each landowner <ln numlevel="1" lineno="109" slineno="3-9"/>whose land is encumbered by the easement.</amend></subsection></subsection><subsection ssid="8-4" dnum="_-o:2-i" numlevel="1" lineno="110" slineno="3-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="8-30" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">A municipality may convert the use of the prescriptive easement established under <ln numlevel="1" lineno="111" slineno="3-11"/>Subsection <xref depth="4" refnumber="57-13a-105(1)">(1)</xref> if the municipality:</amend><subsection ssid="8-5" dnum="_-o:i-i" numlevel="1" lineno="112" slineno="3-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">mails a notice of the converted use of the easement to each landowner whose land <ln numlevel="1" lineno="113" slineno="3-13"/>is encumbered by the easement;</amend></subsection><subsection ssid="8-46" dnum="_-o:ii-i" numlevel="1" lineno="114" slineno="3-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="205" groupid="132" style="1" owner="jchristopherson" level="1" amendtag="end">files a notice describing the converted use of the easement in the office of the <ln numlevel="1" lineno="115" slineno="3-15"/>county recorder in which the easement is located; and</amend></subsection><subsection ssid="8-47" dnum="_-o:iii-i" numlevel="1" lineno="116" slineno="3-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="210" groupid="136" style="1" owner="jchristopherson" level="1" amendtag="end">waits 120 days from the day the municipality mails a notice under Subsection <xref depth="4" refnumber="57-13a-105(2)(a)(i)"><ln numlevel="1" lineno="117" slineno="3-17"/>(2)(a)(i)</xref> before beginning the converted use.</amend></subsection></subsection><subsection ssid="8-31" dnum="_-o:b-i" numlevel="1" lineno="118" slineno="3-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">A municipality may not convert the use of a portion of a prescriptive easement <ln numlevel="1" lineno="119" slineno="3-19"/>established under this section if:</amend><subsection ssid="8-32" dnum="_-o:i-i" numlevel="1" lineno="120" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="end">a landowner whose land is encumbered by the portion of the easement provides a <ln numlevel="1" lineno="121" slineno="3-21"/>written objection to the converted use to the municipality; or</amend></subsection><subsection ssid="8-33" dnum="_-o:ii-i" numlevel="1" lineno="122" slineno="3-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="148" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="end">the converted use:</amend><subsection ssid="8-34" dnum="_-o:A-i" numlevel="1" lineno="123" slineno="3-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="end">puts any greater burden on the landowner's use or enjoyment of the land;</amend></subsection><subsection ssid="8-35" dnum="_-o:B-i" numlevel="1" lineno="124" slineno="3-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="152" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">interferes with other easement holders; and</amend></subsection><subsection ssid="8-36" dnum="_-o:C-i" numlevel="1" lineno="125" slineno="3-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="155" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="end">expands the size of the easement.</amend></subsection></subsection></subsection></subsection><subsection ssid="8-48" dnum="_-o:3-i" numlevel="1" lineno="126" slineno="3-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="8-50" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="212" groupid="138" style="1" owner="jchristopherson" level="1" amendtag="end">A landowner waives any objection to a converted use of a prescriptive easement <ln numlevel="1" lineno="127" slineno="3-27"/>under this section if the landowner does not submit a written objection to the <ln numlevel="1" lineno="128" slineno="3-28"/>municipality within 120 days of the municipality providing notice described in <ln numlevel="1" lineno="129" slineno="3-29"/>Subsection <xref depth="4" refnumber="57-13a-105(2)(a)(i)">(2)(a)(i)</xref>.</amend></subsection><subsection ssid="8-42" dnum="_-o:b-i" numlevel="1" lineno="130" slineno="3-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="190" groupid="121" style="1" owner="jchristopherson" level="1" amendtag="end">If a landowner objects to a municipality's converted use within 120 days of the <ln numlevel="1" lineno="131" slineno="3-31"/>municipality providing notice described in Subsection <xref depth="4" refnumber="57-13a-105(2)(a)(i)">(2)(a)(i)</xref>, the municipality shall:</amend><subsection ssid="8-49" dnum="_-o:i-i" numlevel="1" lineno="132" slineno="3-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="219" groupid="140" style="1" owner="jchristopherson" level="1" amendtag="end">cease the converted use on the landowner's portion of the easement;</amend></subsection><subsection ssid="8-43" dnum="_-o:ii-i" numlevel="1" lineno="133" slineno="3-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="194" groupid="124" style="1" owner="jchristopherson" level="1" amendtag="end">negotiate with the landowner for the purchase of an easement or other property <ln numlevel="1" lineno="134" slineno="3-34"/>interest for the converted use; or</amend></subsection><subsection ssid="8-44" dnum="_-o:iii-i" numlevel="1" lineno="135" slineno="3-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="211" groupid="137" style="1" owner="jchristopherson" level="1" amendtag="end">bring a legal action to establish an easement or other property interest for the <ln numlevel="1" lineno="136" slineno="3-36"/>converted use.</amend></subsection></subsection></subsection><subsection ssid="8-20" dnum="_-o:4-i" numlevel="1" lineno="137" slineno="3-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="97" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">Transfer of a prescriptive easement under this section does not affect a legal right to <ln numlevel="1" lineno="138" slineno="3-38"/>deliver or discharge water through a valid prescriptive easement established by a person <ln numlevel="1" lineno="139" slineno="3-39"/>other than the holder of an easement under this section.</amend></subsection><subsection ssid="8-21" dnum="_-o:5-i" numlevel="1" lineno="140" slineno="3-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">A county recorder may bill the holder of the prescriptive easement for the cost of <ln numlevel="1" lineno="141" slineno="3-41"/>preparing, printing, and publishing the notice required under Subsections <xref depth="4" refnumber="57-13a-105(1)">(1)</xref> and <xref depth="4" refnumber="57-13a-105(2)">(2)</xref><marker pairid="229"/>.</amend></subsection></section></bsec><bsec buid="11" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="142" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="142">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="143"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-23-26 9:31 PM</tm></rev></foot></leg>
