Section <bold>19-6-902</bold> is amended to read:</secline><catline lineno="32"><bold>19-6-902<parens/>. Definitions.</bold></catline><sectionText lineno="33"><tab/>As used in this part:</sectionText><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="34" slineno="1-4" level="1"><display>(1)</display>"Board" means the Waste Management and Radiation Control Board, as defined in <ln numlevel="1" lineno="35" slineno="1-5"/>Section <xref depth="3" refnumber="19-1-106" start="0">19-1-106</xref>, within the Department of Environmental Quality.</subsection><subsection ssid="2-null-2" dnum="2-o" numlevel="1" lineno="36" slineno="1-6" level="1"><display>(2)</display>"Certified decontamination specialist" means an individual who has met the standards <ln numlevel="1" lineno="37" slineno="1-7"/>for certification as a decontamination specialist and has been certified by the board <ln numlevel="1" lineno="38" slineno="1-8"/>under Subsection <xref depth="4" refnumber="19-6-906(2)" start="0">19-6-906(2)</xref>.</subsection><subsection ssid="2-null-3" dnum="3-o" numlevel="1" lineno="39" slineno="1-9" level="1"><display>(3)</display>"Contaminated" or "contamination" means:<subsection ssid="2-null-4" dnum="a-o" numlevel="1" lineno="40" slineno="1-10" level="2"><display>(a)</display>polluted by hazardous materials that cause property to be unfit for human habitation <ln numlevel="1" lineno="41" slineno="1-11"/>or use due to immediate or long-term health hazards; or</subsection><subsection ssid="2-null-5" dnum="b-o" numlevel="1" lineno="42" slineno="1-12" level="2"><display>(b)</display>that a property is polluted by hazardous materials as a result of the use, production, <ln numlevel="1" lineno="43" slineno="1-13"/>or presence of methamphetamine in excess of decontamination standards adopted by <ln numlevel="1" lineno="44" slineno="1-14"/>the Department of Health and Human Services under Section <xref depth="3" refnumber="26B-7-409" start="0">26B-7-409</xref>.</subsection></subsection><subsection ssid="2-28" dnum="_-o:4-i" numlevel="1" lineno="45" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">"Contaminating drug" means methamphetamine or fentanyl.</amend></subsection><subsection ssid="2-null-6" dnum="4-o:5-i" numlevel="1" lineno="46" slineno="1-16" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>"Contamination list" means a list maintained by the local health department of <ln numlevel="1" lineno="47" slineno="1-17"/>properties:<subsection ssid="2-null-7" dnum="a-o" numlevel="1" lineno="48" slineno="1-18" level="2"><display>(a)</display>reported to the local health department under Section <xref depth="3" refnumber="19-6-903" start="0">19-6-903</xref>; and</subsection><subsection ssid="2-null-8" dnum="b-o" numlevel="1" lineno="49" slineno="1-19" level="2"><display>(b)</display>determined by the local health department to be contaminated.</subsection></subsection><subsection ssid="2-null-9" dnum="5-o:6-i" numlevel="1" lineno="50" slineno="1-20" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1009" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display><subsection ssid="2-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Decontaminated" means property that at one time was contaminated, but the <ln numlevel="1" lineno="51" slineno="1-21"/>contaminants have been removed.</subsection><subsection ssid="2-null-11" dnum="b-o" numlevel="1" lineno="52" slineno="1-22" level="2"><display>(b)</display>"Decontaminated" for a property that was contaminated by the use, production, or <ln numlevel="1" lineno="53" slineno="1-23"/>presence of methamphetamine means that the property satisfies decontamination <ln numlevel="1" lineno="54" slineno="1-24"/>standards adopted by the Department of Health and Human Services under Section <xref depth="3" refnumber="26B-7-409" start="0"><ln numlevel="1" lineno="55" slineno="1-25"/>26B-7-409</xref>.</subsection></subsection><subsection ssid="2-null-12" dnum="6-o:7-i" numlevel="1" lineno="56" slineno="1-26" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1012" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>"Hazardous materials":<subsection ssid="2-null-13" dnum="a-o" numlevel="1" lineno="57" slineno="1-27" level="2"><display>(a)</display>has the same meaning as "hazardous or dangerous material" as defined in Section <xref depth="3" refnumber="58-37d-3" start="0"><ln numlevel="1" lineno="58" slineno="1-28"/>58-37d-3</xref>; and</subsection><subsection ssid="2-null-14" dnum="b-o" numlevel="1" lineno="59" slineno="1-29" level="2"><display>(b)</display>includes any illegally manufactured controlled substances.</subsection></subsection><subsection ssid="2-null-15" dnum="7-o:8-i" numlevel="1" lineno="60" slineno="1-30" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">"Health department" means a local health department under <xref depth="0" refnumber="26A" start="0">Title 26A, Local <ln numlevel="1" lineno="61" slineno="1-31"/>Health Authorities</xref>.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">"Local health department" means a local health department created <ln numlevel="1" lineno="62" slineno="1-32"/>under Title 26A, Local Health Authorities.</amend></subsection><subsection ssid="2-27" dnum="_-o:9-i" numlevel="1" lineno="63" slineno="1-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">"Lodging establishment" means the same as that term is defined in Section <xref depth="3" refnumber="29-2-102">29-2-102</xref>.</amend></subsection><subsection ssid="2-null-16" dnum="8-o:10-i" numlevel="1" lineno="64" slineno="1-34" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>"Owner of record":<subsection ssid="2-null-17" dnum="a-o" numlevel="1" lineno="65" slineno="1-35" level="2"><display>(a)</display>means the owner of real property as shown on the records of the county recorder in <ln numlevel="1" lineno="66" slineno="1-36"/>the county where the property is located; and</subsection><subsection ssid="2-null-18" dnum="b-o" numlevel="1" lineno="67" slineno="1-37" level="2"><display>(b)</display>may include an individual, financial institution, company, corporation, or other entity.</subsection></subsection><subsection ssid="2-null-19" dnum="9-o:11-i" numlevel="1" lineno="68" slineno="1-38" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start" space="true">(11)</amend></display><subsection ssid="2-24" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="end">(a)</amend></display>"Property":<subsection ssid="2-null-20" dnum="a-o:_-i" numlevel="1" lineno="69" slineno="1-39" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/></display>means any real property, site, structure, part of a structure, or the grounds <ln numlevel="1" lineno="70" slineno="1-40"/>surrounding a structure<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">; and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">.</amend></subsection></subsection><subsection ssid="2-null-21" dnum="b-o" numlevel="1" lineno="71" slineno="1-41" level="2"><display>(b)</display><amend anum="0" ea="amend" pairid="24" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both">"Property" </amend>includes single-family residences, outbuildings, garages, units of <ln numlevel="1" lineno="72" slineno="1-42"/>multiplexes, condominiums, apartment buildings, warehouses, hotels, motels, boats, <ln numlevel="1" lineno="73" slineno="1-43"/>motor vehicles, trailers, manufactured housing, shops, or booths.</subsection></subsection><subsection ssid="2-null-22" dnum="10-o:12-i" numlevel="1" lineno="74" slineno="1-44" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display>"Reported property" means property that is the subject of a law enforcement <ln numlevel="1" lineno="75" slineno="1-45"/>report under Section <xref depth="3" refnumber="19-6-903" start="0">19-6-903</xref>.</subsection></section></bsec><bsec buid="3" num="19-6-903" type="amend" src="code" uid="C19-6-S903_2026050620260506" sort="19 06 09030020260506" numlevel="1" lineno="76" slineno="2-1" sn="2"><section number="19-6-903" numlevel="1" lineno="77" slineno="2-2" type="amend"><secline lineno="76">Section 2. Section <bold>19-6-903</bold> is amended to read:</secline><catline lineno="77"><bold>19-6-903<parens/>. Law enforcement reporting and records.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="78" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="3-null-2" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1026" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="end">When any state or local law enforcement agency in the course of its official <ln numlevel="1" lineno="79" slineno="2-4"/>duties observes any paraphernalia of a clandestine drug laboratory operation, <ln numlevel="1" lineno="80" slineno="2-5"/>including chemicals or equipment used in the manufacture of unlawful drugs, the <ln numlevel="1" lineno="81" slineno="2-6"/>agency shall report the location where the items were observed to the local health <ln numlevel="1" lineno="82" slineno="2-7"/>department.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A state or local law enforcement agency shall report to a local health <ln numlevel="1" lineno="83" slineno="2-8"/>department:</amend><subsection ssid="3-28" dnum="_-o:a-i" numlevel="1" lineno="84" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" tab="1"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">the location of a clandestine drug laboratory operation if the agency observes any <ln numlevel="1" lineno="85" slineno="2-10"/>paraphernalia of a clandestine drug laboratory operation including chemicals or <ln numlevel="1" lineno="86" slineno="2-11"/>equipment used in the manufacture of unlawful drugs; or</amend></subsection><subsection ssid="3-29" dnum="_-o:b-i" numlevel="1" lineno="87" slineno="2-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" tab="1"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">a lodging establishment not described in Subsection <xref depth="4" refnumber="19-6-903(1)(a)">(1)(a)</xref> if the agency has:</amend><subsection ssid="3-39" dnum="_-o:i-i" numlevel="1" lineno="88" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="183" groupid="150" style="1" owner="jchristopherson" level="1" amendtag="end">reason to believe that a portion of the property is contaminated;</amend></subsection><subsection ssid="3-31" dnum="_-o:ii-i" numlevel="1" lineno="89" slineno="2-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" space="false"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><subsection ssid="3-36" dnum="_-o:A-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" placement="sameline"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1">(A)</amend></display><amend anum="0" ea="amend" pairid="163" groupid="133" style="1" owner="jchristopherson" level="1" amendtag="end">observed a contaminating drug or paraphernalia related to the use of a <ln numlevel="1" lineno="90" slineno="2-15"/>contaminating drug in the potentially contaminated portion of the property; or</amend></subsection><subsection ssid="3-37" dnum="_-o:B-i" numlevel="1" lineno="91" slineno="2-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="172" groupid="141" style="1" owner="jchristopherson" level="1" amendtag="end">obtained, from an individual with connections to the property, an admission <ln numlevel="1" lineno="92" slineno="2-17"/>regarding the use of a contaminating drug in the potentially contaminated <ln numlevel="1" lineno="93" slineno="2-18"/>portion of the property; and</amend></subsection></subsection><subsection ssid="3-38" dnum="_-o:iii-i" numlevel="1" lineno="94" slineno="2-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="176" groupid="144" style="1" owner="jchristopherson" level="1" amendtag="end">obtained a test result for a contaminating drug taken from the surface of the <ln numlevel="1" lineno="95" slineno="2-20"/>property indicating the portion of the property is potentially contaminated.</amend></subsection></subsection></subsection><subsection ssid="3-null-3" dnum="b-o:_-i" numlevel="1" lineno="96" slineno="2-21" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1034" style="2" owner="o" level="1" deltag="start">(b)</amend></display><subsection ssid="3-null-4" dnum="i-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" placement="sameline"><display><amend anum="0" ea="erase" pairid="1035" style="2" owner="o" level="1" deltag="end">(i)</amend><amendoutend style="2"/></display></subsection></subsection></subsection><subsection ssid="3-34" dnum="_-o:2-i" numlevel="1" lineno="97" slineno="2-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="3-35" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="end">(a)</amend></display>The law enforcement officer shall make the report under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="166" groupid="136" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="19-6-903(1)">(1)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="164" groupid="134" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="(1)" depth="4">(1)</xref></amend> at <ln numlevel="1" lineno="98" slineno="2-23"/>the location where the observation occurred, if making the report at that time will not <ln numlevel="1" lineno="99" slineno="2-24"/>compromise an ongoing investigation.</subsection><subsection ssid="3-null-5" dnum="ii-o:b-i" numlevel="1" lineno="100" slineno="2-25" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1038" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>If the report cannot be made at the location, the report shall be made as soon <ln numlevel="1" lineno="101" slineno="2-26"/>afterward as is practical.</subsection><subsection ssid="3-null-6" dnum="c-o" numlevel="1" lineno="102" slineno="2-27" level="2"><display>(c)</display>The report under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="167" groupid="137" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="19-6-903(1)">(1)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="165" groupid="135" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="(1)" depth="4">(1)</xref></amend> shall include:<subsection ssid="3-null-7" dnum="i-o" numlevel="1" lineno="103" slineno="2-28" level="3"><display>(i)</display>the date of the observation;</subsection><subsection ssid="3-null-8" dnum="ii-o" numlevel="1" lineno="104" slineno="2-29" level="3"><display>(ii)</display>the name of the reporting agency and the case number of the case that involves <ln numlevel="1" lineno="105" slineno="2-30"/>the location of the observation;</subsection><subsection ssid="3-null-9" dnum="iii-o" numlevel="1" lineno="106" slineno="2-31" level="3"><display>(iii)</display>the contact information of the officer involved, including name and telephone <ln numlevel="1" lineno="107" slineno="2-32"/>number;</subsection><subsection ssid="3-null-10" dnum="iv-o" numlevel="1" lineno="108" slineno="2-33" level="3"><display>(iv)</display>the address of the location and descriptions of the property that may be <ln numlevel="1" lineno="109" slineno="2-34"/>contaminated; and</subsection><subsection ssid="3-null-11" dnum="v-o" numlevel="1" lineno="110" slineno="2-35" level="3"><display>(v)</display>a brief description of the evidence at the location that led to the belief the property <ln numlevel="1" lineno="111" slineno="2-36"/>at the location may be contaminated.</subsection></subsection></subsection><subsection ssid="3-null-12" dnum="2-o:3-i" numlevel="1" lineno="112" slineno="2-37" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1045" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>The law enforcement agency shall forward to the local health department copies of <ln numlevel="1" lineno="113" slineno="2-38"/>the reports made under Subsection <xref depth="4" refnumber="19-6-903(1)" start="0">(1)</xref>.</subsection><subsection ssid="3-null-13" dnum="3-o:_-i" numlevel="1" lineno="114" slineno="2-39" ea="erase" anum="0" owner="jchristopherson" style="2" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1046" style="2" owner="o" level="1" deltag="start">(3)</amend></display><subsection ssid="3-null-14" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amend anum="0" ea="erase" pairid="1047" style="2" owner="o" level="1">(a)</amend></display><amend anum="0" ea="erase" pairid="105" groupid="88" style="2" owner="jchristopherson" level="1" deltag="end">Upon receipt of a complaint or a report from law enforcement regarding <ln numlevel="1" lineno="115" slineno="2-40"/>possibly contaminated property, the local health officer or his designee shall <ln numlevel="1" lineno="116" slineno="2-41"/>determine if reasonable evidence exists that the property is contaminated.</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-15" dnum="b-o:_-i" numlevel="1" lineno="117" slineno="2-42" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1048" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="111" groupid="94" style="2" owner="jchristopherson" level="1" deltag="end">The local health department shall place property considered to be contaminated on a <ln numlevel="1" lineno="118" slineno="2-43"/>contamination list.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="3-null-16" dnum="4-o:_-i" numlevel="1" lineno="119" slineno="2-44" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1049" style="2" owner="o" level="1" deltag="start">(4)</amend></display><amend anum="0" ea="erase" pairid="84" groupid="71" style="2" owner="jchristopherson" level="1" deltag="end">The local health departments shall maintain searchable records of the properties on <ln numlevel="1" lineno="120" slineno="2-45"/>their contamination lists and shall:</amend><amendoutend style="2"/><subsection ssid="3-null-17" dnum="a-o:_-i" numlevel="1" lineno="121" slineno="2-46" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1050" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="129" groupid="106" style="2" owner="jchristopherson" level="1" deltag="end">make the records reasonably available to the public;</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-18" dnum="b-o:_-i" numlevel="1" lineno="122" slineno="2-47" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1051" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="130" groupid="107" style="2" owner="jchristopherson" level="1" deltag="end">provide written notification to persons requesting access to the records that the <ln numlevel="1" lineno="123" slineno="2-48"/>records are only advisory in determining if specific property has been contaminated <ln numlevel="1" lineno="124" slineno="2-49"/>by clandestine drug lab activity; and</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-19" dnum="c-o:_-i" numlevel="1" lineno="125" slineno="2-50" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1052" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="131" groupid="108" style="2" owner="jchristopherson" level="1" deltag="end">remove the contaminated property from the list when the following conditions have <ln numlevel="1" lineno="126" slineno="2-51"/>been met:</amend><amendoutend style="2"/><subsection ssid="3-null-20" dnum="i-o:_-i" numlevel="1" lineno="127" slineno="2-52" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1053" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="132" groupid="109" style="2" owner="jchristopherson" level="1" deltag="end">the local health department has monitored the decontamination process and, after <ln numlevel="1" lineno="128" slineno="2-53"/>documenting that the test results meet decontamination standards, has authorized <ln numlevel="1" lineno="129" slineno="2-54"/>the removal of or purging of the contamination information from the department's <ln numlevel="1" lineno="130" slineno="2-55"/>records; or</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-21" dnum="ii-o:_-i" numlevel="1" lineno="131" slineno="2-56" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1054" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="133" groupid="110" style="2" owner="jchristopherson" level="1" deltag="end">a certified decontamination specialist submits a report to the local health <ln numlevel="1" lineno="132" slineno="2-57"/>department stating that the property is decontaminated.</amend><amendoutend style="2"/></subsection></subsection></subsection></section></bsec><bsec buid="13" num="19-6-903.1" type="enact" src="code" uid="C19-6-S903.1_2026050620260506" sort="19 06 09030120260506" numlevel="1" lineno="133" slineno="3-1" sn="3"><section numlevel="1" lineno="134" slineno="3-2" number="19-6-903.1" type="enact"><secline lineno="133">Section 3. Section <bold>19-6-903.1</bold> is enacted to read:</secline><catline lineno="134"><bold>19-6-903.1<parens/>. Local health department duties.</bold></catline><subsection ssid="13-2" dnum="_-o:1-i" numlevel="1" lineno="135" slineno="3-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn" space="false"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><subsection ssid="13-15" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">A local health department shall determine if reasonable evidence exists that a <ln numlevel="1" lineno="136" slineno="3-4"/>property described in Subsection <xref depth="4" refnumber="19-6-903(1)(a)">19-6-903(1)(a)</xref> or <xref depth="4" refnumber="19-6-903.1(b)">(b)</xref> is contaminated upon <ln numlevel="1" lineno="137" slineno="3-5"/>receiving a report from law enforcement under Section <xref depth="3" refnumber="19-6-903">19-6-903</xref>.</amend></subsection><subsection ssid="13-4" dnum="_-o:b-i" numlevel="1" lineno="138" slineno="3-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">A local health department shall place the property described in Subsection <xref depth="4" refnumber="19-6-903(1)(a)"><ln numlevel="1" lineno="139" slineno="3-7"/>19-6-903(1)(a)</xref> or <xref depth="4" refnumber="19-6-903.1(b)">(b)</xref> that is considered to be contaminated on a contamination list if <ln numlevel="1" lineno="140" slineno="3-8"/>a local health department determines the property or a portion of the property is <ln numlevel="1" lineno="141" slineno="3-9"/>contaminated.</amend></subsection></subsection><subsection ssid="13-5" dnum="_-o:2-i" numlevel="1" lineno="142" slineno="3-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">A local health department shall:</amend><subsection ssid="13-6" dnum="_-o:a-i" numlevel="1" lineno="143" slineno="3-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">maintain searchable records of the properties on the local health department's <ln numlevel="1" lineno="144" slineno="3-12"/>contamination list;<marker pairid="49"/></amend></subsection><subsection ssid="13-7" dnum="_-o:b-i" numlevel="1" lineno="145" slineno="3-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">make the records reasonably available to the public;</amend></subsection><subsection ssid="13-8" dnum="_-o:c-i" numlevel="1" lineno="146" slineno="3-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">provide written notification to persons requesting access to the records that the <ln numlevel="1" lineno="147" slineno="3-15"/>records are only advisory in determining if specific property has been contaminated;</amend></subsection><subsection ssid="13-9" dnum="_-o:d-i" numlevel="1" lineno="148" slineno="3-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">remove the contaminated property from the list when the following conditions have <ln numlevel="1" lineno="149" slineno="3-17"/>been met:</amend><subsection ssid="13-10" dnum="_-o:i-i" numlevel="1" lineno="150" slineno="3-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">the local health department has monitored the decontamination process and, after <ln numlevel="1" lineno="151" slineno="3-19"/>documenting that the test results meet decontamination standards, has authorized <ln numlevel="1" lineno="152" slineno="3-20"/>the removal of or purging of the contamination information from the local health <ln numlevel="1" lineno="153" slineno="3-21"/>department's records; or</amend></subsection><subsection ssid="13-11" dnum="_-o:ii-i" numlevel="1" lineno="154" slineno="3-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">a certified decontamination specialist submits a report to the local health <ln numlevel="1" lineno="155" slineno="3-23"/>department stating that the property is decontaminated.</amend></subsection></subsection></subsection></section></bsec><bsec buid="4" num="19-6-904" type="amend" src="code" uid="C19-6-S904_2026050620260506" sort="19 06 09040020260506" numlevel="1" lineno="156" slineno="4-1" sn="4"><section number="19-6-904" numlevel="1" lineno="157" slineno="4-2" type="amend"><secline lineno="156">Section 4. Section <bold>19-6-904</bold> is amended to read:</secline><catline lineno="157"><bold>19-6-904<parens/>. Decontamination specialist reporting to local health departments.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="158" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="4-6" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>A certified decontamination specialist is required to report to the local health <ln numlevel="1" lineno="159" slineno="4-4"/>department the location of any property that is the subject of decontamination work <ln numlevel="1" lineno="160" slineno="4-5"/>by that decontamination specialist.  </subsection><subsection ssid="4-7" dnum="_-o:b-i" numlevel="1" lineno="161" slineno="4-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>The report shall be submitted prior to commencement of the decontamination work.</subsection></subsection><subsection ssid="4-null-2" dnum="2-o" numlevel="1" lineno="162" slineno="4-7" level="1"><display>(2)</display>The report under Subsection <xref depth="4" refnumber="19-6-904(1)" start="0">(1)</xref> shall include:<subsection ssid="4-null-3" dnum="a-o" numlevel="1" lineno="163" slineno="4-8" level="2"><display>(a)</display>sufficient information to allow the local health department to investigate and verify <ln numlevel="1" lineno="164" slineno="4-9"/>the location of the property, including the address and description of the property; and</subsection><subsection ssid="4-null-4" dnum="b-o" numlevel="1" lineno="165" slineno="4-10" level="2"><display>(b)</display>a proposed work plan for decontaminating the property.</subsection></subsection><subsection ssid="4-null-5" dnum="3-o" numlevel="1" lineno="166" slineno="4-11" level="1"><display>(3)</display>Upon completion of the decontamination process, a report certifying that the property is <ln numlevel="1" lineno="167" slineno="4-12"/>decontaminated shall be submitted to the local health department within 30 days.</subsection></section></bsec><bsec buid="5" num="19-6-905" type="amend" src="code" uid="C19-6-S905_2026050620260506" sort="19 06 09050020260506" numlevel="1" lineno="168" slineno="5-1" sn="4"><section number="19-6-905" numlevel="1" lineno="169" slineno="5-2" type="amend"><secline lineno="168">Section 4. Section <bold>19-6-905</bold> is amended to read:</secline><catline lineno="169"><bold>19-6-905<parens/>. Notification of property owner -- Notification of municipality or <ln numlevel="1" lineno="170" slineno="5-3"/>county.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="171" slineno="5-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="5-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the local health department determines a property is contaminated, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">it</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the local <ln numlevel="1" lineno="172" slineno="5-5"/>health department</amend> shall<amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend><subsection ssid="5-6" dnum="_-o:i-i" numlevel="1" lineno="173" slineno="5-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="both">(i)</amend></display> notify the owner of record that the property has been placed on the contamination <ln numlevel="1" lineno="174" slineno="5-7"/>list<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="55" groupid="49" style="2" owner="jchristopherson" level="1" deltag="both"> and shall</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="39" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend> </subsection><subsection ssid="5-7" dnum="_-o:ii-i" numlevel="1" lineno="175" slineno="5-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display>provide to the owner information regarding<amend anum="0" ea="amend" pairid="26" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend><subsection ssid="5-8" dnum="_-o:A-i" numlevel="1" lineno="176" slineno="5-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="both">(A)</amend></display> remediation options<amend anum="0" ea="amend" pairid="33" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both">;</amend> and </subsection><subsection ssid="5-9" dnum="_-o:B-i" numlevel="1" lineno="177" slineno="5-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="both">(B)</amend></display>the requirements necessary to clean up the property, obtain certification that <ln numlevel="1" lineno="178" slineno="5-11"/>the property is decontaminated, and remove the property from the <ln numlevel="1" lineno="179" slineno="5-12"/>contamination list.</subsection></subsection></subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="180" slineno="5-13" level="2"><display>(b)</display>The notification shall include a deadline for the owner to provide to the local health <ln numlevel="1" lineno="181" slineno="5-14"/>department information on how the owner plans to address the contamination.</subsection><subsection ssid="5-null-4" dnum="c-o" numlevel="1" lineno="182" slineno="5-15" level="2"><display>(c)</display>This part does not require that decontamination be conducted by a certified <ln numlevel="1" lineno="183" slineno="5-16"/>decontamination specialist.  </subsection><subsection ssid="5-11" dnum="_-o:d-i" numlevel="1" lineno="184" slineno="5-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="both">(d)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="49" groupid="43" style="2" owner="jchristopherson" level="1" deltag="both">However, upon completion of the decontamination, the property must be <ln numlevel="1" lineno="185" slineno="5-18"/>determined to be decontaminated in accordance with Subsection <xref depth="4" refnumber="19-6-903(4)(c)" start="0">19-6-903(4)(c)</xref> in <ln numlevel="1" lineno="186" slineno="5-19"/>order to be removed from the contamination list</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="48" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A property previously listed on the <ln numlevel="1" lineno="187" slineno="5-20"/>contamination list may not be removed from the list unless the property meets the <ln numlevel="1" lineno="188" slineno="5-21"/>conditions described in Subsection <xref depth="4" refnumber="19-6-903.1(3)(d)">19-6-903.1(3)(d)</xref></amend>.</subsection></subsection><subsection ssid="5-null-5" dnum="2-o" numlevel="1" lineno="189" slineno="5-22" level="1"><display>(2)</display>If the local health department does not receive a response from the owner of record <ln numlevel="1" lineno="190" slineno="5-23"/>within the time period specified in the notice, or the owner of record advises the local <ln numlevel="1" lineno="191" slineno="5-24"/>health department that the owner does not intend to take action or that the reported <ln numlevel="1" lineno="192" slineno="5-25"/>property will be abandoned, the local health department shall notify the municipality in <ln numlevel="1" lineno="193" slineno="5-26"/>which the reported property is located, or the county, if the location is in an <ln numlevel="1" lineno="194" slineno="5-27"/>unincorporated area, of the owner of record's response or lack of response.</subsection></section></bsec><bsec buid="6" num="19-6-906" type="amend" src="code" uid="C19-6-S906_2026050620260506" sort="19 06 09060020260506" numlevel="1" lineno="195" slineno="6-1" sn="6"><section number="19-6-906" numlevel="1" lineno="196" slineno="6-2" type="amend"><secline lineno="195">Section 6. Section <bold>19-6-906</bold> is amended to read:</secline><catline lineno="196"><bold>19-6-906<parens/>. Decontamination standards -- Specialist certification standards -- <ln numlevel="1" lineno="197" slineno="6-3"/>Rulemaking.</bold></catline><subsection ssid="6-null-1" dnum="1-o:_-i" numlevel="1" lineno="198" slineno="6-4" ea="erase" anum="0" owner="jchristopherson" style="2" level="1" placement="noreturn"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1082" style="2" owner="o" level="1" deltag="start">(1)</amend></display><amend anum="0" ea="erase" pairid="14" groupid="10" style="2" owner="jchristopherson" level="1" deltag="end">The Department of Health shall make rules under <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="199" slineno="6-5"/>Administrative Rulemaking Act</xref>, in consultation with the local health departments and <ln numlevel="1" lineno="200" slineno="6-6"/>the Department of Environmental Quality, to establish:</amend><amendoutend style="2"/><subsection ssid="6-null-2" dnum="a-o:_-i" numlevel="1" lineno="201" slineno="6-7" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1083" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="17" groupid="13" style="2" owner="jchristopherson" level="1" deltag="end">decontamination and sampling standards and best management practices for the <ln numlevel="1" lineno="202" slineno="6-8"/>inspection and decontamination of property and the disposal of contaminated debris <ln numlevel="1" lineno="203" slineno="6-9"/>under this part;</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-3" dnum="b-o:_-i" numlevel="1" lineno="204" slineno="6-10" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1084" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="18" groupid="14" style="2" owner="jchristopherson" level="1" deltag="end">appropriate methods for the testing of buildings and interior surfaces, and <ln numlevel="1" lineno="205" slineno="6-11"/>furnishings, soil, and septic tanks for contamination; and</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-4" dnum="c-o:_-i" numlevel="1" lineno="206" slineno="6-12" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1085" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="19" groupid="15" style="2" owner="jchristopherson" level="1" deltag="end">when testing for contamination may be required.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="6-null-5" dnum="2-o:1-i" numlevel="1" lineno="207" slineno="6-13" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1086" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1087" style="1" owner="i" level="1" amendtag="both" space="true">(1)</amend></display>The <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">Department of Environmental Quality Waste Management and Radiation <ln numlevel="1" lineno="208" slineno="6-14"/>Control Board</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">board</amend> shall make rules under <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="209" slineno="6-15"/>Rulemaking Act</xref>, in consultation with the Department of Health<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"> and Human Services</amend> <ln numlevel="1" lineno="210" slineno="6-16"/>and local health departments, to establish within the Department of Environmental <ln numlevel="1" lineno="211" slineno="6-17"/>Quality Division of Environmental Response and Remediation:<subsection ssid="6-null-6" dnum="a-o" numlevel="1" lineno="212" slineno="6-18" level="2"><display>(a)</display>certification standards for any private person, firm, or entity involved in the <ln numlevel="1" lineno="213" slineno="6-19"/>decontamination of contaminated property; and</subsection><subsection ssid="6-null-7" dnum="b-o" numlevel="1" lineno="214" slineno="6-20" level="2"><display>(b)</display>a process for revoking the certification of a decontamination specialist who fails to <ln numlevel="1" lineno="215" slineno="6-21"/>maintain the certification standards.</subsection></subsection><subsection ssid="6-null-8" dnum="3-o:2-i" numlevel="1" lineno="216" slineno="6-22" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1089" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="both" space="true">(2)</amend></display>All rules made under this part shall be consistent with other state and federal <ln numlevel="1" lineno="217" slineno="6-23"/>requirements.</subsection><subsection ssid="6-null-9" dnum="4-o:3-i" numlevel="1" lineno="218" slineno="6-24" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1090" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>The board has authority to enforce the provisions <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">under Subsection <xref depth="4" refnumber="19-6-906(2)" start="0">(2)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">of this <ln numlevel="1" lineno="219" slineno="6-25"/>section</amend>.</subsection></section></bsec><bsec buid="8" num="26B-7-409" type="amend" src="code" uid="C26B-7-S409_2026050620260506" sort="26B07 04090020260506" numlevel="1" lineno="220" slineno="7-1" sn="7"><section number="26B-7-409" numlevel="1" lineno="221" slineno="7-2" type="amend"><secline lineno="220">Section 7.
