Section <bold>26B-7-126</bold> is enacted to read:</secline><catline lineno="30"><bold>26B-7-126<parens/>. Psychedelic-assisted therapy for veterans clinical study -- Funding -- <ln numlevel="1" lineno="31" slineno="1-3"/>Reports.</bold></catline><subsection ssid="1-1" dnum="_-o:1-i" numlevel="1" lineno="32" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="1-3" dnum="_-o:a-i" numlevel="1" lineno="33" slineno="1-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">"Clinical study" means the safety and feasibility study authorized in this section.</amend></subsection><subsection ssid="1-15" dnum="_-o:b-i" numlevel="1" lineno="34" slineno="1-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">"Controlled substance" means the same as that term is defined in Section <xref depth="3" refnumber="58-37-2">58-37-2</xref>.</amend></subsection><subsection ssid="1-33" dnum="_-o:c-i" numlevel="1" lineno="35" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="177" groupid="133" style="1" owner="jchristopherson" level="1" amendtag="end">"Eligible veteran" means a veteran who has treatment-resistant PTSD.</amend></subsection><subsection ssid="1-24" dnum="_-o:d-i" numlevel="1" lineno="36" slineno="1-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">"FDA" means the United States Food and Drug Administration.</amend></subsection><subsection ssid="1-118" dnum="_-o:e-i" numlevel="1" lineno="37" slineno="1-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="539" groupid="396" style="1" owner="jchristopherson" level="1" amendtag="end">"Huntsman Mental Health Institute" means the mental health and substance use <ln numlevel="1" lineno="38" slineno="1-10"/>treatment institute within the University of Utah.</amend></subsection><subsection ssid="1-21" dnum="_-o:f-i" numlevel="1" lineno="39" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="99" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="end">"Individualized dose-escalation regimen" means a regimen in which a psychedelic <ln numlevel="1" lineno="40" slineno="1-12"/>drug is administered under medical supervision in increasing doses according to <ln numlevel="1" lineno="41" slineno="1-13"/>predefined dose levels, stopping rules, therapeutic response, and clinical judgment. </amend></subsection><subsection ssid="1-25" dnum="_-o:g-i" numlevel="1" lineno="42" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="122" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="end">"Investigational drug" means an investigational new drug that the FDA has <ln numlevel="1" lineno="43" slineno="1-15"/>authorized for human subjects research under 21 C.F.R. Part 312.</amend></subsection><subsection ssid="1-106" dnum="_-o:h-i" numlevel="1" lineno="44" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="484" groupid="356" style="1" owner="jchristopherson" level="1" amendtag="end">"Investigational new drug" means the same as that term is defined in 21 C.F.R. Sec. <ln numlevel="1" lineno="45" slineno="1-17"/>312.3.</amend></subsection><subsection ssid="1-4" dnum="_-o:i-i" numlevel="1" lineno="46" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">"Psychedelic drug" means a controlled substance that is an investigational drug and <ln numlevel="1" lineno="47" slineno="1-19"/>has a hallucinogenic effect on the central nervous system, including:</amend><subsection ssid="1-9" dnum="_-o:i-i" numlevel="1" lineno="48" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">3,4-Methylenedioxymethamphetamine (MDMA);</amend></subsection><subsection ssid="1-109" dnum="_-o:ii-i" numlevel="1" lineno="49" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="498" groupid="367" style="1" owner="jchristopherson" level="1" amendtag="end">5-methoxy-N,N-dimethyltryptamine;</amend></subsection><subsection ssid="1-10" dnum="_-o:iii-i" numlevel="1" lineno="50" slineno="1-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">Dimethyltryptamine, some trade or other names: DMT;</amend></subsection><subsection ssid="1-110" dnum="_-o:iv-i" numlevel="1" lineno="51" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="502" groupid="370" style="1" owner="jchristopherson" level="1" amendtag="end">Ibogaine, some trade and other names: <ln numlevel="1" lineno="52" slineno="1-24"/>7-Ethyl-6,6,7,8,9,10,12,13-octahydro-2-methoxy-6,9-methano-5H-pyrido [1', <ln numlevel="1" lineno="53" slineno="1-25"/>2':1,2] azepino [5,4-b] indole; Tabernanthe iboga;</amend></subsection><subsection ssid="1-11" dnum="_-o:v-i" numlevel="1" lineno="54" slineno="1-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="516" groupid="381" style="1" owner="jchristopherson" level="1" amendtag="end">Lysergic acid diethylamide; or</amend></subsection><subsection ssid="1-113" dnum="_-o:vi-i" numlevel="1" lineno="55" slineno="1-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="515" groupid="380" style="1" owner="jchristopherson" level="1" amendtag="end">Psilocybin.</amend></subsection></subsection><subsection ssid="1-18" dnum="_-o:j-i" numlevel="1" lineno="56" slineno="1-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(j)</amend></display><amend anum="0" ea="amend" pairid="79" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">"Psychedelic-assisted therapy" means an intervention where:</amend><subsection ssid="1-19" dnum="_-o:i-i" numlevel="1" lineno="57" slineno="1-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="84" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">a psychedelic drug is administered to an individual with treatment-resistant PTSD:</amend><subsection ssid="1-114" dnum="_-o:A-i" numlevel="1" lineno="58" slineno="1-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="525" groupid="385" style="1" owner="jchristopherson" level="1" amendtag="end">in a controlled clinical setting; and</amend></subsection><subsection ssid="1-116" dnum="_-o:B-i" numlevel="1" lineno="59" slineno="1-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="535" groupid="393" style="1" owner="jchristopherson" level="1" amendtag="end">when appropriate, under an individualized dose-escalation regimen; and</amend></subsection></subsection><subsection ssid="1-20" dnum="_-o:ii-i" numlevel="1" lineno="60" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">a qualified therapist delivers manualized, trauma-informed preparatory and <ln numlevel="1" lineno="61" slineno="1-33"/>integrative psychotherapy to the individual before and after administration of the <ln numlevel="1" lineno="62" slineno="1-34"/>psychedelic drug.</amend></subsection></subsection><subsection ssid="1-16" dnum="_-o:k-i" numlevel="1" lineno="63" slineno="1-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(k)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">"PTSD" means post-traumatic stress disorder.</amend></subsection><subsection ssid="1-14" dnum="_-o:l-i" numlevel="1" lineno="64" slineno="1-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(l)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">"Treatment-resistant PTSD" means a clinical diagnosis of PTSD with documented <ln numlevel="1" lineno="65" slineno="1-37"/>inadequate response to one or more evidence-based treatments for PTSD.</amend></subsection></subsection><subsection ssid="1-17" dnum="_-o:2-i" numlevel="1" lineno="66" slineno="1-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="210" groupid="155" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsections <xref depth="4" refnumber="26B-7-126(4)">(4)</xref> and <xref depth="4" refnumber="26B-7-126(5)">(5)</xref>, within appropriations from the Legislature for this <ln numlevel="1" lineno="67" slineno="1-39"/>purpose and any gifts, grants, or donations the Huntsman Mental Health Institute <ln numlevel="1" lineno="68" slineno="1-40"/>receives under Subsection <xref depth="4" refnumber="26B-7-126(3)">(3)</xref>, the Huntsman Mental Health Institute shall conduct a <ln numlevel="1" lineno="69" slineno="1-41"/>clinical study to research the safety and feasibility of psychedelic-assisted therapy for <ln numlevel="1" lineno="70" slineno="1-42"/>the treatment of treatment-resistant PTSD in eligible veterans.</amend></subsection><subsection ssid="1-35" dnum="_-o:3-i" numlevel="1" lineno="71" slineno="1-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="182" groupid="137" style="1" owner="jchristopherson" level="1" amendtag="end">The Huntsman Mental Health Institute may accept gifts, grants, and donations of money <ln numlevel="1" lineno="72" slineno="1-44"/>to fund the clinical study.</amend></subsection><subsection ssid="1-36" dnum="_-o:4-i" numlevel="1" lineno="73" slineno="1-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="1-38" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="204" groupid="150" style="1" owner="jchristopherson" level="1" amendtag="end">The Huntsman Mental Health Institute shall begin the clinical study no later than <ln numlevel="1" lineno="74" slineno="1-46"/>January 1, 2027, if the total amount of legislative appropriations and gifts, grants, or <ln numlevel="1" lineno="75" slineno="1-47"/>donations the Huntsman Mental Health Institute receives under Subsection <xref depth="4" refnumber="26B-7-126(3)">(3)</xref> <ln numlevel="1" lineno="76" slineno="1-48"/>reaches an amount that is equal to or exceeds an amount the Huntsman Mental Health <ln numlevel="1" lineno="77" slineno="1-49"/>Institute determines is sufficient to begin the clinical study.</amend></subsection><subsection ssid="1-120" dnum="_-o:b-i" numlevel="1" lineno="78" slineno="1-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="560" groupid="413" style="1" owner="jchristopherson" level="1" amendtag="end">If the Huntsman Mental Health Institute begins the clinical study on or before <ln numlevel="1" lineno="79" slineno="1-51"/>January 1, 2027, the Huntsman Mental Health Institute may:</amend><subsection ssid="1-132" dnum="_-o:i-i" numlevel="1" lineno="80" slineno="1-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="611" groupid="447" style="1" owner="jchristopherson" level="1" amendtag="end">accept gifts, grants, or donations after January 1, 2027; and</amend></subsection><subsection ssid="1-133" dnum="_-o:ii-i" numlevel="1" lineno="81" slineno="1-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="616" groupid="451" style="1" owner="jchristopherson" level="1" amendtag="end">use amounts received under Subsection <xref depth="4" refnumber="26B-7-126(3)">(3)</xref>, or appropriated by the Legislature for <ln numlevel="1" lineno="82" slineno="1-54"/>this purpose, after January 1, 2027, to continue funding the clinical study.</amend></subsection></subsection></subsection><subsection ssid="1-124" dnum="_-o:5-i" numlevel="1" lineno="83" slineno="1-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="571" groupid="422" style="1" owner="jchristopherson" level="1" amendtag="end">If the Huntsman Mental Health Institute does not begin the study on or before January <ln numlevel="1" lineno="84" slineno="1-56"/>1, 2027, because the total amounts accepted and appropriated under this section are <ln numlevel="1" lineno="85" slineno="1-57"/>insufficient to begin the clinical study, the Huntsman Mental Health Institute:</amend><subsection ssid="1-127" dnum="_-o:a-i" numlevel="1" lineno="86" slineno="1-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="600" groupid="438" style="1" owner="jchristopherson" level="1" amendtag="end">may continue to accept gifts, grants, or donations, after January 1, 2027;</amend></subsection><subsection ssid="1-129" dnum="_-o:b-i" numlevel="1" lineno="87" slineno="1-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="595" groupid="434" style="1" owner="jchristopherson" level="1" amendtag="end">shall begin the clinical study when the total amount of legislative appropriations and <ln numlevel="1" determines is sufficient to begin the clinical <ln numlevel="1" lineno="90" slineno="1-62"/>study; and</amend></subsection><subsection ssid="1-131" dnum="_-o:c-i" numlevel="1" lineno="91" slineno="1-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="606" groupid="443" style="1" owner="jchristopherson" level="1" amendtag="end">may use amounts received under Subsection <xref depth="4" refnumber="26B-7-126(3)">(3)</xref>, or appropriated by the Legislature <ln numlevel="1" lineno="92" slineno="1-64"/>for this purpose, after January 1, 2027, to continue funding the clinical study.</amend></subsection></subsection><subsection ssid="1-37" dnum="_-o:6-i" numlevel="1" lineno="93" slineno="1-65" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="211" groupid="156" style="1" owner="jchristopherson" level="1" amendtag="end">The Huntsman Mental Health Institute shall return to a donor any unused gifts, grants, <ln numlevel="1" lineno="94" slineno="1-66"/>or donations the Huntsman Mental Health Institute received under Subsection <xref depth="4" refnumber="26B-7-126(3)">(3)</xref> on or <ln numlevel="1" lineno="95" slineno="1-67"/>before July 1, 2032.</amend></subsection><subsection ssid="1-76" dnum="_-o:7-i" numlevel="1" lineno="96" slineno="1-68" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="394" groupid="295" style="1" owner="jchristopherson" level="1" amendtag="end">Before beginning the clinical study, the Huntsman slineno="1-71"/>new drug application;</amend></subsection><subsection ssid="1-79" dnum="_-o:ii-i" numlevel="1" lineno="100" slineno="1-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="401" groupid="300" style="1" owner="jchristopherson" level="1" amendtag="end">maintaining a United States Drug Enforcement Agency Schedule I research <ln numlevel="1" lineno="101" slineno="1-73"/>registration and any required state controlled substance registration; and</amend></subsection><subsection ssid="1-80" dnum="_-o:iii-i" numlevel="1" lineno="102" slineno="1-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="404" groupid="302" style="1" owner="jchristopherson" level="1" amendtag="end">obtaining Institutional Review Board approval for the clinical study;</amend></subsection></subsection><subsection ssid="1-81" dnum="_-o:b-i" numlevel="1" lineno="103" slineno="1-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="407" groupid="304" style="1" owner="jchristopherson" level="1" amendtag="end">have a clinical study protocol that includes:</amend><subsection ssid="1-82" dnum="_-o:i-i" numlevel="1" lineno="104" slineno="1-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="410" groupid="306" style="1" owner="jchristopherson" level="1" amendtag="end">the study design, inclusion and exclusion criteria, objectives and endpoints, <ln numlevel="1" lineno="105" slineno="1-77"/>eligible veteran visit schedule, and schedule of follow-up assessments;</amend></subsection><subsection ssid="1-83" dnum="_-o:ii-i" numlevel="1" lineno="106" slineno="1-78" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="413" groupid="308" style="1" owner="jchristopherson" level="1" amendtag="end">informed consent procedures and participant safeguards; and</amend></subsection><subsection ssid="1-84" dnum="_-o:iii-i" numlevel="1" lineno="107" slineno="1-79" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="416" groupid="310" style="1" owner="jchristopherson" level="1" amendtag="end">data security and privacy protections, including for personal information;</amend></subsection></subsection><subsection ssid="1-85" dnum="_-o:c-i" numlevel="1" lineno="108" slineno="1-80" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="419" groupid="312" style="1" owner="jchristopherson" level="1" amendtag="end">have a drug administration plan for the clinical study that includes:</amend><subsection ssid="1-86" dnum="_-o:i-i" numlevel="1" lineno="109" slineno="1-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="422" groupid="314" style="1" owner="jchristopherson" level="1" amendtag="end">the investigational drug product description, source, formulation, route of <ln numlevel="1" lineno="110" slineno="1-82"/>administration, and dosing regimen;</amend></subsection><subsection ssid="1-87" dnum="_-o:ii-i" numlevel="1" lineno="111" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="425" groupid="316" style="1" owner="jchristopherson" level="1" amendtag="end">when appropriate, an individualized dose-escalation regimen, including <ln numlevel="1" lineno="112" slineno="1-84"/>predefined dose levels, stopping rules, and therapeutic response evaluation criteria;</amend></subsection><subsection ssid="1-88" dnum="_-o:iii-i" numlevel="1" lineno="113" slineno="1-85" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="428" groupid="318" style="1" owner="jchristopherson" level="1" amendtag="end">a clinical staffing model and monitoring procedures for the administration of the <ln numlevel="1" lineno="114" slineno="1-86"/>investigational drug;</amend></subsection><subsection ssid="1-89" dnum="_-o:iv-i" numlevel="1" lineno="115" slineno="1-87" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="431" groupid="320" style="1" owner="jchristopherson" level="1" amendtag="end">discharge criteria and transportation procedures for participants after <ln numlevel="1" lineno="116" slineno="1-88"/>psychedelic-assisted therapy; and</amend></subsection><subsection ssid="1-90" dnum="_-o:v-i" numlevel="1" lineno="117" slineno="1-89" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="434" groupid="322" style="1" owner="jchristopherson" level="1" amendtag="end">procedures for the storage, handling, chain of custody, and disposal of controlled <ln numlevel="1" lineno="118" slineno="1-90"/>substances, and an accountability plan for violations of the procedures;</amend></subsection></subsection><subsection ssid="1-91" dnum="_-o:d-i" numlevel="1" lineno="119" slineno="1-91" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="437" groupid="324" style="1" owner="jchristopherson" level="1" amendtag="end">have a safety monitoring and risk management plan for the clinical study that <ln numlevel="1" lineno="120" slineno="1-92"/>includes:</amend><subsection ssid="1-92" dnum="_-o:i-i" numlevel="1" lineno="121" slineno="1-93" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="440" groupid="326" style="1" owner="jchristopherson" level="1" amendtag="end">medical and psychiatric screening procedures;</amend></subsection><subsection ssid="1-93" dnum="_-o:ii-i" numlevel="1" lineno="122" slineno="1-94" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="443" groupid="328" style="1" owner="jchristopherson" level="1" amendtag="end">on-site emergency response procedures;</amend></subsection><subsection ssid="1-94" dnum="_-o:iii-i" numlevel="1" lineno="123" slineno="1-95" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="446" groupid="330" style="1" owner="jchristopherson" level="1" amendtag="end">adverse event and serious adverse event capture and reporting timelines; and</amend></subsection><subsection ssid="1-95" dnum="_-o:iv-i" numlevel="1" lineno="124" slineno="1-96" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="449" groupid="332" style="1" owner="jchristopherson" level="1" amendtag="end">predefined rules for pausing or stopping the clinical study; and</amend></subsection></subsection><subsection ssid="1-96" dnum="_-o:e-i" numlevel="1" lineno="125" slineno="1-97" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="452" groupid="334" style="1" owner="jchristopherson" level="1" amendtag="end">have a fidelity plan for the clinical study that includes:</amend><subsection ssid="1-97" dnum="_-o:i-i" numlevel="1" lineno="126" slineno="1-98" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="455" groupid="336" style="1" owner="jchristopherson" level="1" amendtag="end">a psychotherapy manual that describes preparatory sessions, therapeutic support <ln numlevel="1" lineno="127" slineno="1-99"/>boundaries for the administration of the investigational drug during <ln numlevel="1" lineno="128" slineno="1-100"/>psychedelic-assisted therapy sessions, and integrative sessions;</amend></subsection><subsection ssid="1-98" dnum="_-o:ii-i" numlevel="1" lineno="129" slineno="1-101" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="458" groupid="338" style="1" owner="jchristopherson" level="1" amendtag="end">therapist licensure and qualification requirements;</amend></subsection><subsection ssid="1-99" dnum="_-o:iii-i" numlevel="1" lineno="130" slineno="1-102" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="461" groupid="340" style="1" owner="jchristopherson" level="1" amendtag="end">a training, supervision, and fidelity monitoring plan; and</amend></subsection><subsection ssid="1-100" dnum="_-o:iv-i" numlevel="1" lineno="131" slineno="1-103" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="464" groupid="342" style="1" owner="jchristopherson" level="1" amendtag="end">ethical safeguards and a participant amendtag="end">submit a final written report of the clinical study to the Health and Human <ln numlevel="1" lineno="136" slineno="1-108"/>Services Interim Committee on or before the committee's first November meeting <ln numlevel="1" lineno="137" slineno="1-109"/>after the date on which the Huntsman Mental Health Institute concludes the <ln numlevel="1" lineno="138" slineno="1-110"/>clinical study.</amend></subsection></subsection><subsection ssid="1-75" dnum="_-o:b-i" numlevel="1" lineno="139" slineno="1-111" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend
