Section <bold>20A-1-502</bold> is amended to read:</secline><catline lineno="32"><bold>20A-1-502<parens/>. Midterm vacancy in office of United States senator.</bold></catline><subsection ssid="19-null-1" dnum="1-o" numlevel="1" lineno="33" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>Except as provided in Subsections <xref depth="4" refnumber="20A-1-502(2)" start="0">(2)</xref> and <xref depth="4" refnumber="20A-1-502(3)" start="0">(3)</xref>, when a vacancy occurs in the office of <ln numlevel="1" lineno="34" slineno="1-4"/>United States senator, the governor shall, within seven calendar days after the day on <ln numlevel="1" lineno="35" slineno="1-5"/>which the vacancy occurs, issue a proclamation calling a special congressional election <ln numlevel="1" lineno="36" slineno="1-6"/>to fill the vacancy that:<subsection ssid="19-null-2" dnum="a-o" numlevel="1" lineno="37" slineno="1-7" level="2"><display>(a)</display>sets a date for a primary congressional special election, and a later date for a general <ln numlevel="1" lineno="38" slineno="1-8"/>congressional special election, on the same day as one of the following elections:<subsection ssid="19-null-3" dnum="i-o" numlevel="1" lineno="39" slineno="1-9" level="3"><display>(i)</display>a municipal general election;</subsection><subsection ssid="19-null-4" dnum="ii-o" numlevel="1" lineno="40" slineno="1-10" level="3"><display>(ii)</display>a presidential primary election;</subsection><subsection ssid="19-null-5" dnum="iii-o" numlevel="1" lineno="41" slineno="1-11" level="3"><display>(iii)</display>a regular primary election; or</subsection><subsection ssid="19-null-6" dnum="iv-o" numlevel="1" lineno="42" slineno="1-12" level="3"><display>(iv)</display>a regular general election;</subsection></subsection><subsection ssid="19-null-7" dnum="b-o" numlevel="1" lineno="43" slineno="1-13" level="2"><display>(b)</display>sets the date of the primary congressional special election on the same day as the <ln numlevel="1" lineno="44" slineno="1-14"/>next election described in Subsections <xref depth="4" refnumber="20A-1-502(1)(a)(i)" start="0">(1)(a)(i)</xref> through <xref depth="4" refnumber="20A-1-502(1)(a)(iv)" start="0">(iv)</xref> that is more than 90 <ln numlevel="1" lineno="45" slineno="1-15"/>calendar days after the day on which the governor issues the proclamation;</subsection><subsection ssid="19-null-8" dnum="c-o" numlevel="1" lineno="46" slineno="1-16" level="2"><display>(c)</display>sets the date of the general special congressional election on the same day as the next <ln numlevel="1" lineno="47" slineno="1-17"/>election described in Subsection <xref depth="4" refnumber="20A-1-502(1)(a)" start="0">(1)(a)</xref> that is more than 90 calendar days after the <ln numlevel="1" lineno="48" slineno="1-18"/>primary special congressional election described in Subsection <xref depth="4" refnumber="20A-1-502(1)(b)" start="0">(1)(b)</xref>;</subsection><subsection ssid="19-null-9" dnum="d-o" numlevel="1" lineno="49" slineno="1-19" level="2"><display>(d)</display>provides each registered political party that is not a qualified political party at least <ln numlevel="1" lineno="50" slineno="1-20"/>21 calendar days, but no more than 28 calendar days, to select one candidate, in a <ln numlevel="1" lineno="51" slineno="1-21"/>manner determined by the registered political party, as a candidate for the registered <ln numlevel="1" lineno="52" slineno="1-22"/>political party;</subsection><subsection ssid="19-null-10" dnum="e-o" numlevel="1" lineno="53" slineno="1-23" level="2"><display>(e)</display>for each qualified political party, provides at least 21 calendar days, but no more than <ln numlevel="1" lineno="54" slineno="1-24"/>28 calendar days:<subsection ssid="19-null-11" dnum="i-o" numlevel="1" lineno="55" slineno="1-25" level="3"><display>(i)</display>for the qualified political party to select one candidate, using the convention <ln numlevel="1" lineno="56" slineno="1-26"/>process described in Section <xref depth="3" refnumber="20A-9-407" start="0">20A-9-407</xref>, as a candidate for the qualified political <ln numlevel="1" lineno="57" slineno="1-27"/>party; and</subsection><subsection ssid="19-null-12" dnum="ii-o" numlevel="1" lineno="58" slineno="1-28" level="3"><display>(ii)</display>for a member of the qualified political party to submit signatures to qualify as a <ln numlevel="1" lineno="59" slineno="1-29"/>candidate for the qualified political party using the signature-gathering process <ln numlevel="1" lineno="60" slineno="1-30"/>described in Section <xref depth="3" refnumber="20A-9-408" start="0">20A-9-408</xref>;</subsection></subsection><subsection ssid="19-null-13" dnum="f-o" numlevel="1" lineno="61" slineno="1-31" level="2"><display>(f)</display>consistent with the requirements of this section, establishes the deadlines, time <ln numlevel="1" lineno="62" slineno="1-32"/>frames, and procedures for filing a declaration of candidacy, giving notice of an <ln numlevel="1" lineno="63" slineno="1-33"/>election, and other election requirements; and</subsection><subsection ssid="19-null-14" dnum="g-o" numlevel="1" lineno="64" slineno="1-34" level="2"><display>(g)</display>requires an election officer to comply with the requirements of <xref depth="1" refnumber="20A-16" start="1">Chapter 16, Uniform <ln numlevel="1" lineno="65" slineno="1-35"/>Military and Overseas Voters Act</xref>.</subsection></subsection><subsection ssid="19-null-15" dnum="2-o" numlevel="1" lineno="66" slineno="1-36" level="1" space="false"><display>(2)</display><subsection ssid="19-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The governor may set a date for a primary special congressional election or a <ln numlevel="1" lineno="67" slineno="1-37"/>general special congressional election on a date other than a date described in <ln numlevel="1" lineno="68" slineno="1-38"/>Subsection <xref depth="4" refnumber="20A-1-502(1)(a)" start="0">(1)(a)</xref> if:<subsection ssid="19-null-17" dnum="i-o" numlevel="1" lineno="69" slineno="1-39" level="3" tab="1"><display>(i)</display>on the same day on which the governor issues the proclamation described in <ln numlevel="1" lineno="70" slineno="1-40"/>Subsection <xref depth="4" refnumber="20A-1-502(1)" start="0">(1)</xref> the governor calls a special session for the Legislature to <ln numlevel="1" lineno="71" slineno="1-41"/>appropriate money to hold the election on a different day; or</subsection><subsection ssid="19-null-18" dnum="ii-o" numlevel="1" lineno="72" slineno="1-42" level="3" tab="1"><display>(ii)</display>if the governor issues the proclamation described in Subsection <xref depth="4" refnumber="20A-1-502(1)" start="0">(1)</xref> on or after <ln numlevel="1" lineno="73" slineno="1-43"/>January 1, but before the end of the general session of the Legislature, and <ln numlevel="1" lineno="74" slineno="1-44"/>requests in the proclamation described in Subsection <xref depth="4" refnumber="20A-1-502(1)" start="0">(1)</xref> that the Legislature <ln numlevel="1" lineno="75" slineno="1-45"/>appropriate money to hold the election on a different day.</subsection></subsection><subsection ssid="19-null-19" dnum="b-o" numlevel="1" lineno="76" slineno="1-46" level="2"><display>(b)</display>If the Legislature does not, under Subsection <xref depth="4" refnumber="20A-1-502(2)(a)" start="0">(2)(a)</xref>, appropriate money to hold the <ln numlevel="1" lineno="77" slineno="1-47"/>election on a different day, the proclamation described in Subsection <xref depth="4" refnumber="20A-1-502(1)" start="0">(1)</xref> is void and <ln numlevel="1" lineno="78" slineno="1-48"/>the governor shall, within seven calendar days after the day on which the Legislature <ln numlevel="1" lineno="79" slineno="1-49"/>declines to appropriate money to hold the election on a different day, issue a <ln numlevel="1" lineno="80" slineno="1-50"/>proclamation, in accordance with Subsection <xref depth="4" refnumber="20A-1-502(1)" start="0">(1)</xref>, that sets the special congressional <ln numlevel="1" lineno="81" slineno="1-51"/>primary and general elections on dates described in Subsections <xref depth="4" refnumber="20A-1-502(1)(a)(i)" start="0">(1)(a)(i)</xref> through <xref depth="4" refnumber="20A-1-502(1)(a)(iv)" start="0">(iv)</xref>.</subsection></subsection><subsection ssid="19-null-20" dnum="3-o" numlevel="1" lineno="82" slineno="1-52" level="1"><display>(3)</display>A special congressional election to fill a vacancy in the office of United States senator <ln numlevel="1" lineno="83" slineno="1-53"/>will not be held if:<subsection ssid="19-null-21" dnum="a-o" numlevel="1" lineno="84" slineno="1-54" level="2"><display>(a)</display>the next regular general election that occurs after the day on which the vacancy <ln numlevel="1" lineno="85" slineno="1-55"/>occurs is the regular general election that occurs immediately before the six-year term <ln numlevel="1" lineno="86" slineno="1-56"/>for the senate office ends; and</subsection><subsection ssid="19-null-22" dnum="b-o" numlevel="1" lineno="87" slineno="1-57" level="2"><display>(b)</display>the vacancy occurs after August 1 of the year before the regular general election <ln numlevel="1" lineno="88" slineno="1-58"/>described in Subsection <xref depth="4" refnumber="20A-1-502(3)(a)" start="0">(3)(a)</xref>.</subsection></subsection><subsection ssid="19-null-23" dnum="4-o" numlevel="1" lineno="89" slineno="1-59" level="1" space="false"><display>(4)</display><subsection ssid="19-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The governor shall appoint an individual to temporarily fill a vacancy in the office <ln numlevel="1" lineno="90" slineno="1-60"/>of United States senator from one of three individuals nominated by the Legislature, <ln numlevel="1" lineno="91" slineno="1-61"/>each of whom<amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend><subsection ssid="19-32" dnum="_-o:i-i" numlevel="1" lineno="92" slineno="1-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">meets the qualifications for the office; and</amend> </subsection><subsection ssid="19-33" dnum="_-o:ii-i" numlevel="1" lineno="93" slineno="1-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display>is a member of the <amend anum="0" ea="amend" pairid="15" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both">registered </amend>political party of which the prior officeholder was a <ln numlevel="1" lineno="94" slineno="1-64"/>member at the time the prior officeholder was <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">elected</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">last elected or appointed</amend>.</subsection></subsection><subsection ssid="19-null-25" dnum="b-o" numlevel="1" lineno="95" slineno="1-65" level="2"><display>(b)</display>The individual appointed under Subsection <xref depth="4" refnumber="20A-1-502(4)(a)" start="0">(4)(a)</xref> shall serve as United States senator <ln numlevel="1" lineno="96" slineno="1-66"/>until the earlier of the day on which:<subsection ssid="19-null-26" dnum="i-o" numlevel="1" lineno="97" slineno="1-67" level="3"><display>(i)</display>the vacancy is filled by election under Subsection <xref depth="4" refnumber="20A-1-502(1)" start="0">(1)</xref> or <xref depth="4" refnumber="20A-1-502(2)" start="0">(2)</xref>; or</subsection><subsection ssid="19-null-27" dnum="ii-o" numlevel="1" lineno="98" slineno="1-68" level="3"><display>(ii)</display>the six-year term for the senate office ends.</subsection></subsection></subsection><subsection ssid="19-null-28" dnum="5-o" numlevel="1" lineno="99" slineno="1-69" level="1"><display>(5)</display>An individual elected to fill a vacancy under this section shall serve until the end of the <ln numlevel="1" lineno="100" slineno="1-70"/>current term in which the vacancy filled by the election occurs.</subsection><subsection ssid="19-null-29" dnum="6-o" numlevel="1" lineno="101" slineno="1-71" level="1"><display>(6)</display>A vacancy in the office of United States senator does not occur unless the senator:<subsection ssid="19-null-30" dnum="a-o" numlevel="1" lineno="102" slineno="1-72" level="2"><display>(a)</display>has left the office; or</subsection><subsection ssid="19-null-31" dnum="b-o" numlevel="1" lineno="103" slineno="1-73" level="2"><display>(b)</display>submits an irrevocable letter of resignation to the governor or to the president of the <ln numlevel="1" lineno="104" slineno="1-74"/>United States Senate.</subsection></subsection></section></bsec><bsec buid="4" num="20A-1-503" type="amend" src="code" uid="C20A-1-S503_2026050620260506" sort="20A01 05030020260506" numlevel="1" lineno="105" slineno="2-1" sn="2"><section number="20A-1-503" numlevel="1" lineno="106" slineno="2-2" type="amend"><secline lineno="105">Section 2. Section <bold>20A-1-503</bold> is amended to read:</secline><catline lineno="106"><bold>20A-1-503<parens/>. Midterm vacancies in the Legislature.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="107" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="4-null-2" dnum="a-o" numlevel="1" lineno="108" slineno="2-4" level="2"><display>(a)</display>"Filing deadline" means the final date for filing:<subsection ssid="4-null-3" dnum="i-o" numlevel="1" lineno="109" slineno="2-5" level="3"><display>(i)</display>a declaration of candidacy as provided in Section <xref depth="3" refnumber="20A-9-202" start="0">20A-9-202</xref>; and</subsection><subsection ssid="4-null-4" dnum="ii-o" numlevel="1" lineno="110" slineno="2-6" level="3"><display>(ii)</display>a certificate of nomination as provided in Section <xref depth="3" refnumber="20A-9-503" start="0">20A-9-503</xref>.</subsection></subsection><subsection ssid="4-null-5" dnum="b-o" numlevel="1" lineno="111" slineno="2-7" level="2"><display>(b)</display>"Party liaison" means the political party officer designated to serve as a liaison with <ln numlevel="1" lineno="112" slineno="2-8"/>the lieutenant governor on all matters relating to the political party's relationship with <ln numlevel="1" lineno="113" slineno="2-9"/>the state as required by Section <xref depth="3" refnumber="20A-8-401" start="0">20A-8-401</xref>.</subsection></subsection><subsection ssid="4-null-6" dnum="2-o" numlevel="1" lineno="114" slineno="2-10" level="1"><display>(2)</display>When a vacancy occurs for any reason in the office of representative in the Legislature, <ln numlevel="1" lineno="115" slineno="2-11"/>the governor shall fill the vacancy <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="82" groupid="62" style="2" owner="jchristopherson" level="1" deltag="both">by immediately appointing the person whose name <ln numlevel="1" lineno="116" slineno="2-12"/>was submitted by the party liaison of the same political party as the prior representative.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="117" slineno="2-13"/>by immediately appointing the individual whose name is submitted by the party liaison <ln numlevel="1" lineno="118" slineno="2-14"/>of the registered political party of which the prior officeholder was a member at the time <ln numlevel="1" lineno="119" slineno="2-15"/>the prior officeholder was last elected or appointed.</amend></subsection><subsection ssid="4-null-7" dnum="3-o" numlevel="1" lineno="120" slineno="2-16" level="1" space="false"><display>(3)</display><subsection ssid="4-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided by Subsection <xref depth="4" refnumber="20A-1-503(5)" start="0">(5)</xref>, when a vacancy occurs for any reason in <ln numlevel="1" lineno="121" slineno="2-17"/>the office of senator in the Legislature, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="80" groupid="60" style="2" owner="jchristopherson" level="1" deltag="both">it</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="75" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the vacancy</amend> shall be filled for the <ln numlevel="1" lineno="122" slineno="2-18"/>unexpired term at the next regular general election.</subsection><subsection ssid="4-null-9" dnum="b-o" numlevel="1" lineno="123" slineno="2-19" level="2"><display>(b)</display>The governor shall fill the vacancy until the next regular general election <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="83" groupid="63" style="2" owner="jchristopherson" level="1" deltag="both">by <ln numlevel="1" lineno="124" slineno="2-20"/>immediately appointing the person whose name was submitted by the party liaison of <ln numlevel="1" lineno="125" slineno="2-21"/>the same political party as the prior senator.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">by immediately appointing the <ln numlevel="1" lineno="126" slineno="2-22"/>individual whose name is submitted by the party liaison of the registered political <ln numlevel="1" lineno="127" slineno="2-23"/>party of which the prior officeholder was a member at the time the prior officeholder <ln numlevel="1" lineno="128" slineno="2-24"/>was last elected or appointed.</amend></subsection></subsection><subsection ssid="4-null-10" dnum="4-o" numlevel="1" lineno="129" slineno="2-25" level="1" space="false"><display>(4)</display><subsection ssid="4-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a vacancy described in Subsection <xref depth="4" refnumber="20A-1-503(3)(a)" start="0">(3)(a)</xref> occurs after the filing deadline but <ln numlevel="1" lineno="130" slineno="2-26"/>before August 31 of an even-numbered year in which the term of office does not <ln numlevel="1" lineno="131" slineno="2-27"/>expire, the lieutenant governor shall:<subsection ssid="4-null-12" dnum="i-o" numlevel="1" lineno="132" slineno="2-28" level="3" tab="1"><display>(i)</display>establish a date and time, which is before the date for a candidate to be certified <ln numlevel="1" lineno="133" slineno="2-29"/>for the ballot under Section <xref depth="3" refnumber="20A-9-701" start="0">20A-9-701</xref> and no later than 21 calendar days after the <ln numlevel="1" lineno="134" slineno="2-30"/>day on which the vacancy occurred, by which a person intending to obtain a <ln numlevel="1" lineno="135" slineno="2-31"/>position on the ballot for the vacant office shall file:<subsection ssid="4-null-13" dnum="A-o" numlevel="1" lineno="136" slineno="2-32" level="4"><display>(A)</display>a declaration of candidacy; or</subsection><subsection ssid="4-null-14" dnum="B-o" numlevel="1" lineno="137" slineno="2-33" level="4"><display>(B)</display>a certificate of nomination; and</subsection></subsection><subsection ssid="4-null-15" dnum="ii-o" numlevel="1" lineno="138" slineno="2-34" level="3" tab="1"><display>(ii)</display>give notice of the vacancy and the date and time described in Subsection <xref depth="4" refnumber="20A-1-503(4)(a)(i)" start="0">(4)(a)(i)</xref>:<subsection ssid="4-null-16" dnum="A-o" numlevel="1" lineno="139" slineno="2-35" level="4"><display>(A)</display>on the lieutenant governor's website; and</subsection><subsection ssid="4-null-17" dnum="B-o" numlevel="1" lineno="140" slineno="2-36" level="4"><display>(B)</display>to each registered political party.</subsection></subsection></subsection><subsection ssid="4-null-18" dnum="b-o" numlevel="1" lineno="141" slineno="2-37" level="2"><display>(b)</display>A person intending to obtain a position on the ballot for the vacant office shall:<subsection ssid="4-null-19" dnum="i-o" numlevel="1" lineno="142" slineno="2-38" level="3"><display>(i)</display>before the date and time specified in Subsection <xref depth="4" refnumber="20A-1-503(4)(a)(i)" start="0">(4)(a)(i)</xref>, file a declaration of <ln numlevel="1" lineno="143" slineno="2-39"/>candidacy or certificate of nomination according to the procedures and <ln numlevel="1" lineno="144" slineno="2-40"/>requirements of <xref depth="1" refnumber="20A-9" start="1">Chapter 9, Candidate Qualifications and Nominating Procedures</xref>; <ln numlevel="1" lineno="145" slineno="2-41"/>and</subsection><subsection ssid="4-null-20" dnum="ii-o" numlevel="1" lineno="146" slineno="2-42" level="3"><display>(ii)</display>run in the regular general election if:<subsection ssid="4-null-21" dnum="A-o" numlevel="1" lineno="147" slineno="2-43" level="4"><display>(A)</display>nominated as a party candidate; or</subsection><subsection ssid="4-null-22" dnum="B-o" numlevel="1" lineno="148" slineno="2-44" level="4"><display>(B)</display>qualified as an unaffiliated candidate as provided by <xref depth="1" refnumber="20A-9" start="1">Chapter 9, Candidate <ln numlevel="1" lineno="149" slineno="2-45"/>Qualifications and Nominating Procedures</xref>.</subsection></subsection></subsection><subsection ssid="4-null-23" dnum="c-o" numlevel="1" lineno="150" slineno="2-46" level="2"><display>(c)</display>If a vacancy described in Subsection <xref depth="4" refnumber="20A-1-503(3)(a)" start="0">(3)(a)</xref> occurs after the deadline described in <ln numlevel="1" lineno="151" slineno="2-47"/>Subsection <xref depth="4" refnumber="20A-9-202(1)(b)" start="0">20A-9-202(1)(b)</xref> and before August 31<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="50" groupid="33" style="2" owner="jchristopherson" level="1" deltag="both">, </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="85" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> </amend>of an even-numbered year in <ln numlevel="1" lineno="152" slineno="2-48"/>which the term of office does not expire, a party liaison from each registered political <ln numlevel="1" lineno="153" slineno="2-49"/>party may submit a name of a person described in Subsection <xref depth="4" refnumber="20A-1-503(4)(b)" start="0">(4)(b)</xref> to the lieutenant <ln numlevel="1" lineno="154" slineno="2-50"/>governor before 5 p.m. no later than August 30 for placement on the regular general <ln numlevel="1" lineno="155" slineno="2-51"/>election ballot.</subsection></subsection><subsection ssid="4-null-24" dnum="5-o" numlevel="1" lineno="156" slineno="2-52" level="1"><display>(5)</display>If a vacancy described in Subsection <xref depth="4" refnumber="20A-1-503(3)(a)" start="0">(3)(a)</xref> occurs on or after August 31 of an <ln numlevel="1" lineno="157" slineno="2-53"/>even-numbered year in which a term does not expire, the governor shall fill the vacancy <ln numlevel="1" lineno="158" slineno="2-54"/>for the unexpired term <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">by immediately appointing the person whose name was <ln numlevel="1" lineno="159" slineno="2-55"/>submitted by the party liaison of the same political party as the prior senator.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in <ln numlevel="1" lineno="160" slineno="2-56"/>accordance with Subsection <xref depth="4" refnumber="20A-1-503(3)(b)">(3)(b)</xref>.</amend></subsection><subsection ssid="4-null-25" dnum="6-o" numlevel="1" lineno="161" slineno="2-57" level="1" space="false"><display>(6)</display><subsection ssid="4-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref refnumber="20A-1-503(6)(b)" depth="4">(6)(b)</xref>, an individual seeking appointment to fill <ln numlevel="1" lineno="162" slineno="2-58"/>a vacancy described in this section shall, no later than the deadline for the individual <ln numlevel="1" lineno="163" slineno="2-59"/>to file an interim report under Subsection <xref refnumber="20A-11-303(3)(a)" depth="4">20A-11-303(3)(a)</xref>, make a complete <ln numlevel="1" lineno="164" slineno="2-60"/>conflict of interest disclosure on the website described in Section <xref depth="3" refnumber="20A-11-1602.5">20A-11-1602.5</xref>.</subsection><subsection ssid="4-null-27" dnum="b-o" numlevel="1" lineno="165" slineno="2-61" level="2"><display>(b)</display>An individual described in Subsection <xref depth="4" refnumber="20A-1-503(6)(a)">(6)(a)</xref> is not required to comply with <ln numlevel="1" lineno="166" slineno="2-62"/>Subsection <xref depth="4" refnumber="20A-1-503(6)(a)">(6)(a)</xref> if the individual:<subsection ssid="4-null-28" dnum="i-o" numlevel="1" lineno="167" slineno="2-63" level="3" space="false"><display>(i)</display><subsection ssid="4-null-29" dnum="A-o" level="4" placement="sameline"><display>(A)</display>currently holds the office of senator and is seeking appointment as a <ln numlevel="1" lineno="168" slineno="2-64"/>representative; or</subsection><subsection ssid="4-null-30" dnum="B-o" numlevel="1" lineno="169" slineno="2-65" level="4"><display>(B)</display>currently holds the office of representative and is seeking appointment as a <ln numlevel="1" lineno="170" slineno="2-66"/>senator;</subsection></subsection><subsection ssid="4-null-31" dnum="ii-o" numlevel="1" lineno="171" slineno="2-67" level="3"><display>(ii)</display>already, that same year, filed a conflict of interest disclosure for the office <ln numlevel="1" lineno="172" slineno="2-68"/>described in Subsection <xref tempid="405" depth="4" refnumber="20A-1-503(6)(b)(i)">(6)(b)(i)</xref>, in accordance with Section <xref depth="3" refnumber="20A-11-1604">20A-11-1604</xref>; and</subsection><subsection ssid="4-null-32" dnum="iii-o" numlevel="1" lineno="173" slineno="2-69" level="3"><display>(iii)</display>no later than the deadline described in Subsection <xref depth="4" refnumber="20A-1-503(6)(a)">(6)(a)</xref>, indicates, in a written <ln numlevel="1" lineno="174" slineno="2-70"/>statement, that the conflict of interest disclosure described in Subsection <xref tempid="290" depth="4" refnumber="20A-1-503(6)(b)(ii)">(6)(b)(ii)</xref> <ln numlevel="1" lineno="175" slineno="2-71"/>is updated and accurate as of the date of the written statement.</subsection></subsection></subsection><subsection ssid="4-null-33" dnum="7-o" numlevel="1" lineno="176" slineno="2-72" level="1"><display>(7)</display>The lieutenant governor shall make each conflict of interest disclosure made by an <ln numlevel="1" lineno="177" slineno="2-73"/>individual described in Subsection <xref refnumber="20A-1-503(6)(a)" depth="4">(6)(a)</xref> available for public inspection in accordance <ln numlevel="1" lineno="178" slineno="2-74"/>with Subsection <xref refnumber="20A-11-1603(4)" depth="4">20A-11-1603(4)</xref>.</subsection><subsection ssid="4-null-34" dnum="8-o" numlevel="1" lineno="179" slineno="2-75" level="1"><display>(8)</display>A vacancy in the office of senator or representative of the Legislature does not occur <ln numlevel="1" lineno="180" slineno="2-76"/>unless the senator or representative:<subsection ssid="4-null-35" dnum="a-o" numlevel="1" lineno="181" slineno="2-77" level="2"><display>(a)</display>has left the office; or</subsection><subsection ssid="4-null-36" dnum="b-o" numlevel="1" lineno="182" slineno="2-78" level="2"><display>(b)</display>submits an irrevocable letter of resignation to:<subsection ssid="4-null-37" dnum="i-o" numlevel="1" lineno="183" slineno="2-79" level="3"><display>(i)</display>for a senator, the president of the Senate; or</subsection><subsection ssid="4-null-38" dnum="ii-o" numlevel="1" lineno="184" slineno="2-80" level="3"><display>(ii)</display>for a representative, the speaker of the House of Representatives.</subsection></subsection></subsection></section></bsec><bsec buid="6" num="20A-1-504" type="amend" src="code" uid="C20A-1-S504_2026050620260506" sort="20A01 05040020260506" numlevel="1" lineno="185" slineno="3-1" sn="3"><section number="20A-1-504" numlevel="1" lineno="186" slineno="3-2" type="amend"><secline lineno="185">Section 3. Section <bold>20A-1-504</bold> is amended to read:</secline><catline lineno="186"><bold>20A-1-504<parens/>. Midterm vacancies in the offices of attorney general, state treasurer, <ln numlevel="1" lineno="187" slineno="3-3"/>state auditor, State Board of Education member, and lieutenant governor.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="188" slineno="3-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="6-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>When a vacancy occurs for any reason in the office of attorney general, state <ln numlevel="1" lineno="189" slineno="3-5"/>treasurer, state auditor, or State Board of Education member, the vacancy shall be <ln numlevel="1" lineno="190" slineno="3-6"/>filled for the unexpired term at the next regular general election.</subsection><subsection ssid="6-null-3" dnum="b-o:_-i" numlevel="1" lineno="191" slineno="3-7" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1073" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="16" groupid="10" style="2" owner="jchristopherson" level="1" deltag="end">The governor shall fill the vacancy until the next regular general election by:</amend><amendoutend style="2"/><subsection ssid="6-null-4" dnum="i-o:_-i" numlevel="1" lineno="192" slineno="3-8" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1074" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="17" groupid="11" style="2" owner="jchristopherson" level="1" deltag="end">appointing a person who meets the qualifications for the office from three persons <ln numlevel="1" lineno="193" slineno="3-9"/>nominated by the state central committee of the same political party as the prior <ln numlevel="1" lineno="194" slineno="3-10"/>officeholder; or</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-5" dnum="ii-o:_-i" numlevel="1" lineno="195" slineno="3-11" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1075" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="18" groupid="12" style="2" owner="jchristopherson" level="1" deltag="end">for a State Board of Education vacancy, if the individual who is being replaced:</amend><amendoutend style="2"/><subsection ssid="6-null-6" dnum="A-o:_-i" numlevel="1" lineno="196" slineno="3-12" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1076" style="2" owner="o" level="1" deltag="start">(A)</amend></display><amend anum="0" ea="erase" pairid="19" groupid="13" style="2" owner="jchristopherson" level="1" deltag="end">was elected at a nonpartisan State Board of Education election, by <ln numlevel="1" lineno="197" slineno="3-13"/>appointing, with the advice and consent of the Senate, an individual who meets <ln numlevel="1" lineno="198" slineno="3-14"/>the qualifications and residency requirements for filling the vacancy described <ln numlevel="1" lineno="199" slineno="3-15"/>in Section <xref depth="3" refnumber="20A-14-103" start="0">20A-14-103</xref>;</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-7" dnum="B-o:_-i" numlevel="1" lineno="200" slineno="3-16" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1077" style="2" owner="o" level="1" deltag="start">(B)</amend></display><amend anum="0" ea="erase" pairid="22" groupid="16" style="2" owner="jchristopherson" level="1" deltag="end">was elected at a partisan State Board of Education election, but is not a <ln numlevel="1" lineno="201" slineno="3-17"/>member of a political party, by appointing, with the advice and consent of the <ln numlevel="1" lineno="202" slineno="3-18"/>Senate, an individual who meets the qualifications and residency requirements <ln numlevel="1" lineno="203" slineno="3-19"/>for filling the vacancy described in Section <xref depth="3" refnumber="20A-14-103" start="0">20A-14-103</xref>; or</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-8" dnum="C-o:_-i" numlevel="1" lineno="204" slineno="3-20" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1078" style="2" owner="o" level="1" deltag="start">(C)</amend></display><amend anum="0" ea="erase" pairid="25" groupid="19" style="2" owner="jchristopherson" level="1" deltag="end">was elected at a partisan State Board of Education election, and is a member <ln numlevel="1" lineno="205" slineno="3-21"/>of a political party, by appointing an individual who meets the qualifications <ln numlevel="1" lineno="206" slineno="3-22"/>for the office from three persons nominated by the state central committee of <ln numlevel="1" lineno="207" slineno="3-23"/>the same political party as the prior officeholder.</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="6-23" dnum="_-o:b-i" numlevel="1" lineno="208" slineno="3-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">Until the next regular general election, the governor shall fill the vacancy by <ln numlevel="1" lineno="209" slineno="3-25"/>appointing an individual who meets the qualifications for the office from three <ln numlevel="1" lineno="210" slineno="3-26"/>persons nominated by the state central committee of the registered political party of <ln numlevel="1" lineno="211" slineno="3-27"/>which the prior officeholder was a member at the time the prior officeholder was last <ln numlevel="1" lineno="212" slineno="3-28"/>elected or appointed.</amend></subsection></subsection><subsection ssid="6-null-9" dnum="2-o" numlevel="1" lineno="213" slineno="3-29" level="1"><display>(2)</display>If a vacancy occurs in the office of lieutenant governor, the governor shall, with the <ln numlevel="1" lineno="214" slineno="3-30"/>advice and consent of the Senate, appoint a person to hold the office until the next <ln numlevel="1" lineno="215" slineno="3-31"/>regular general election at which the governor stands for election.</subsection><subsection ssid="6-null-10" dnum="3-o" numlevel="1" lineno="216" slineno="3-32" level="1" space="false"><display>(3)</display><subsection ssid="6-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref tempid="603" depth="4" refnumber="20A-1-504(3)(b)">(3)(b)</xref>, an individual seeking appointment to fill <ln numlevel="1" lineno="217" slineno="3-33"/>a vacancy described in this section shall make a complete conflict of interest <ln numlevel="1" lineno="218" slineno="3-34"/>disclosure on the website described in Section <xref depth="3" refnumber="20A-11-1602.5">20A-11-1602.5</xref>:<subsection ssid="6-null-12" dnum="i-o" numlevel="1" lineno="219" slineno="3-35" level="3" tab="1"><display>(i)</display>for a vacancy in the office of lieutenant governor, attorney general, state treasurer, <ln numlevel="1" lineno="220" slineno="3-36"/>or state auditor, no later than the deadline for the individual to file an interim <ln numlevel="1" lineno="221" slineno="3-37"/>report under Subsection <xref depth="4" refnumber="20A-11-204(3)(a)">20A-11-204(3)(a)</xref>; or</subsection><subsection ssid="6-null-13" dnum="ii-o" numlevel="1" lineno="222" slineno="3-38" level="3" tab="1"><display>(ii)</display>for a vacancy in the office of State Board of Education member, no later than the <ln numlevel="1" lineno="223" slineno="3-39"/>deadline for the individual to file an interim report under Subsection <xref depth="4" refnumber="20A-11-1303(2)(a)"><ln numlevel="1" lineno="224" slineno="3-40"/>20A-11-1303(2)(a)</xref>.</subsection></subsection><subsection ssid="6-null-14" dnum="b-o" numlevel="1" lineno="225" slineno="3-41" level="2"><display>(b)</display>An individual described in Subsection <xref depth="4" refnumber="20A-1-504(3)(a)">(3)(a)</xref> is not required to comply with <ln numlevel="1" lineno="226" slineno="3-42"/>Subsection <xref depth="4" refnumber="20A-1-504(3)(a)">(3)(a)</xref> if the individual:<subsection ssid="6-null-15" dnum="i-o" numlevel="1" lineno="227" slineno="3-43" level="3"><display>(i)</display>currently holds an office described in Subsection <xref depth="4" refnumber="20A-1-504(1)(a)">(1)(a)</xref> or <xref depth="4" refnumber="20A-1-504(2)">(2)</xref>;</subsection><subsection ssid="6-null-16" dnum="ii-o" numlevel="1" lineno="228" slineno="3-44" level="3"><display>(ii)</display>already, that same year, filed a conflict of interest disclosure for the office <ln numlevel="1" lineno="229" slineno="3-45"/>described in Subsection <xref tempid="626" depth="4" refnumber="20A-1-504(3)(b)(i)">(3)(b)(i)</xref>, in accordance with Section <xref depth="3" refnumber="20A-11-1604">20A-11-1604</xref>; and</subsection><subsection ssid="6-null-17" dnum="iii-o" numlevel="1" lineno="230" slineno="3-46" level="3"><display>(iii)</display>no later than the deadline described in Subsection <xref refnumber="20A-1-504(3)(a)" depth="4">(3)(a)</xref>, indicates, in a written <ln numlevel="1" lineno="231" slineno="3-47"/>statement, that the conflict of interest disclosure described in Subsection <xref tempid="149" depth="4" refnumber="20A-1-504(3)(b)(ii)">(3)(b)(ii)</xref> <ln numlevel="1" lineno="232" slineno="3-48"/>is updated and accurate as of the date of the written statement.</subsection></subsection></subsection><subsection ssid="6-null-18" dnum="4-o" numlevel="1" lineno="233" slineno="3-49" level="1"><display>(4)</display>The lieutenant governor shall make each conflict of interest disclosure made by an <ln numlevel="1" lineno="234" slineno="3-50"/>individual described in Subsection <xref refnumber="20A-1-504(3)(a)" depth="4">(3)(a)</xref> available for public inspection in accordance <ln numlevel="1" lineno="235" slineno="3-51"/>with Subsection <xref depth="4" refnumber="20A-11-1603(4)">20A-11-1603(4)</xref>.</subsection><subsection ssid="6-null-19" dnum="5-o" numlevel="1" lineno="236" slineno="3-52" level="1"><display>(5)</display>A vacancy in an office described in Subsection <xref depth="4" refnumber="20A-1-504(1)(a)">(1)(a)</xref> or <xref depth="4" refnumber="20A-1-504(2)">(2)</xref> does not occur unless the <ln numlevel="1" lineno="237" slineno="3-53"/>individual occupying the office:<subsection ssid="6-null-20" dnum="a-o" numlevel="1" lineno="238" slineno="3-54" level="2"><display>(a)</display>has left the office; or</subsection><subsection ssid="6-null-21" dnum="b-o" numlevel="1" lineno="239" slineno="3-55" level="2"><display>(b)</display>submits an irrevocable letter of resignation to the governor.</subsection></subsection></section></bsec><bsec buid="8" num="20A-1-508" type="amend" src="code" uid="C20A-1-S508_2026050620260506" sort="20A01 05080020260506" numlevel="1" lineno="240" slineno="4-1" sn="4"><section number="20A-1-508" numlevel="1" lineno="241" slineno="4-2" type="amend"><secline lineno="240">Section 4. Section <bold>20A-1-508</bold> is amended to read:</secline><catline lineno="241"><bold>20A-1-508<parens/>. Midterm vacancies in county elected offices -- Temporary manager <ln numlevel="1" lineno="242" slineno="4-3"/>-- Interim replacement.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="243" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="8-null-2" dnum="a-o" numlevel="1" lineno="244" slineno="4-5" level="2" space="false"><display>(a)</display><subsection ssid="8-null-3" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"County offices" includes the county executive, members of the county <ln numlevel="1" lineno="245" slineno="4-6"/>legislative body, the county treasurer, the county sheriff, the county clerk, the <ln numlevel="1" lineno="246" slineno="4-7"/>county auditor, the county recorder, the county surveyor, and the county assessor.</subsection><subsection ssid="8-null-4" dnum="ii-o" numlevel="1" lineno="247" slineno="4-8" level="3"><display>(ii)</display>"County offices" does not include the office of county attorney, district attorney, <ln numlevel="1" lineno="248" slineno="4-9"/>or judge.</subsection></subsection><subsection ssid="8-null-5" dnum="b-o" numlevel="1" lineno="249" slineno="4-10" level="2"><display>(b)</display>"Party liaison" means the political party officer designated to serve as a liaison with <ln numlevel="1" lineno="250" slineno="4-11"/>each county legislative body on all matters relating to the political party's relationship <ln numlevel="1" lineno="251" slineno="4-12"/>with a county as required by Section <xref depth="3" refnumber="20A-8-401" start="0">20A-8-401</xref>.</subsection></subsection><subsection ssid="8-null-6" dnum="2-o" numlevel="1" lineno="252" slineno="4-13" level="1" space="false"><display>(2)</display><subsection ssid="8-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="20A-1-508(2)(d)" start="0">(2)(d)</xref>, until a county legislative body appoints <ln numlevel="1" lineno="253" slineno="4-14"/>an interim replacement to fill a vacant county office under Subsection <xref depth="4" refnumber="20A-1-508(3)" start="0">(3)</xref>, the <ln numlevel="1" lineno="254" slineno="4-15"/>following shall temporarily discharge the duties of the county office as a temporary <ln numlevel="1" lineno="255" slineno="4-16"/>manager:<subsection ssid="8-null-8" dnum="i-o" numlevel="1" lineno="256" slineno="4-17" level="3" tab="1"><display>(i)</display>for a county office with one chief deputy, the chief deputy;</subsection><subsection ssid="8-null-9" dnum="ii-o" numlevel="1" lineno="257" slineno="4-18" level="3" tab="1"><display>(ii)</display>for a county office with more than one chief deputy:<subsection ssid="8-null-10" dnum="A-o" numlevel="1" lineno="258" slineno="4-19" level="4"><display>(A)</display>the chief deputy with the most cumulative time served as a chief deputy for <ln numlevel="1" lineno="259" slineno="4-20"/>the county office; or</subsection><subsection ssid="8-null-11" dnum="B-o" numlevel="1" lineno="260" slineno="4-21" level="4"><display>(B)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-1-508(2)(a)(ii)(A)" start="0">(2)(a)(ii)(A)</xref>, if, before the vacating county officer <ln numlevel="1" lineno="261" slineno="4-22"/>vacates the office, the county officer files with the county clerk a written <ln numlevel="1" lineno="262" slineno="4-23"/>statement designating one of the county officer's chief deputies to discharge the <ln numlevel="1" lineno="263" slineno="4-24"/>duties of the county office in the event the county officer vacates the office, the <ln numlevel="1" lineno="264" slineno="4-25"/>designated chief deputy; or</subsection></subsection><subsection ssid="8-null-12" dnum="iii-o" numlevel="1" lineno="265" slineno="4-26" level="3" tab="1"><display>(iii)</display>for a county office without a chief deputy:<subsection ssid="8-null-13" dnum="A-o" numlevel="1" lineno="266" slineno="4-27" level="4"><display>(A)</display>if one management-level employee serving under the county office has a <ln numlevel="1" lineno="267" slineno="4-28"/>higher-seniority management level than any other employee serving under the <ln numlevel="1" lineno="268" slineno="4-29"/>county office, that management-level employee;</subsection><subsection ssid="8-null-14" dnum="B-o" numlevel="1" lineno="269" slineno="4-30" level="4"><display>(B)</display>if two or more management-level employees serving under the county office <ln numlevel="1" lineno="270" slineno="4-31"/>have the same and highest-seniority management level, the highest-seniority <ln numlevel="1" lineno="271" slineno="4-32"/>management-level employee with the most cumulative time served in the <ln numlevel="1" lineno="272" slineno="4-33"/>employee's current position; or</subsection><subsection ssid="8-null-15" dnum="C-o" numlevel="1" lineno="273" slineno="4-34" level="4"><display>(C)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-1-508(2)(a)(iii)(A)" start="0">(2)(a)(iii)(A)</xref> or <xref depth="4" refnumber="20A-1-508(2)(a)(iii)(B)" start="0">(B)</xref>, if, before the vacating county <ln numlevel="1" lineno="274" slineno="4-35"/>officer vacates the office, the county officer files with the county clerk a <ln numlevel="1" lineno="275" slineno="4-36"/>written statement designating one of the county officer's employees to <ln numlevel="1" lineno="276" slineno="4-37"/>discharge the county officer's duties in the event the county officer vacates the <ln numlevel="1" lineno="277" slineno="4-38"/>office, the designated employee.</subsection></subsection></subsection><subsection ssid="8-null-16" dnum="b-o" numlevel="1" lineno="278" slineno="4-39" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="20A-1-508(2)(c)" start="0">(2)(c)</xref>, a temporary manager described in <ln numlevel="1" lineno="279" slineno="4-40"/>Subsection <xref depth="4" refnumber="20A-1-508(2)(a)" start="0">(2)(a)</xref> who temporarily discharges the duties of a county office holds the <ln numlevel="1" lineno="280" slineno="4-41"/>powers and duties of the county office until the county legislative body appoints an <ln numlevel="1" lineno="281" slineno="4-42"/>interim replacement under Subsection <xref depth="4" refnumber="20A-1-508(3)" start="0">(3)</xref>.</subsection><subsection ssid="8-null-17" dnum="c-o" numlevel="1" lineno="282" slineno="4-43" level="2"><display>(c)</display>The temporary manager described in Subsection <xref depth="4" refnumber="20A-1-508(2)(a)" start="0">(2)(a)</xref> who temporarily discharges <ln numlevel="1" lineno="283" slineno="4-44"/>the duties of a county office:<subsection ssid="8-null-18" dnum="i-o" numlevel="1" lineno="284" slineno="4-45" level="3"><display>(i)</display>may not take an oath of office for the county office as a temporary manager;</subsection><subsection ssid="8-null-19" dnum="ii-o" numlevel="1" lineno="285" slineno="4-46" level="3"><display>(ii)</display>shall comply with Title <xref depth="1" refnumber="17-63">17, Chapter 63</xref>, Fiscal Authority and Processes, and the <ln numlevel="1" lineno="286" slineno="4-47"/>county's budget ordinances and policies;</subsection><subsection ssid="8-null-20" dnum="iii-o" numlevel="1" lineno="287" slineno="4-48" level="3"><display>(iii)</display>unless approved by the county legislative body, may not change the <ln numlevel="1" lineno="288" slineno="4-49"/>compensation of an employee;</subsection><subsection ssid="8-null-21" dnum="iv-o" numlevel="1" lineno="289" slineno="4-50" level="3"><display>(iv)</display>unless approved by the county legislative body, may not promote or demote an <ln numlevel="1" lineno="290" slineno="4-51"/>employee or change an employee's job title;</subsection><subsection ssid="8-null-22" dnum="v-o" numlevel="1" lineno="291" slineno="4-52" level="3"><display>(v)</display>may terminate an employee only if the termination is conducted in accordance <ln numlevel="1" lineno="292" slineno="4-53"/>with:<subsection ssid="8-null-23" dnum="A-o" numlevel="1" lineno="293" slineno="4-54" level="4"><display>(A)</display>personnel rules described in Subsection <xref depth="4" refnumber="17-75-602(2)">17-75-602(2)</xref> that are approved by the <ln numlevel="1" lineno="294" slineno="4-55"/>county legislative body; and</subsection><subsection ssid="8-null-24" dnum="B-o" numlevel="1" lineno="295" slineno="4-56" level="4"><display>(B)</display>applicable law;</subsection></subsection><subsection ssid="8-null-25" dnum="vi-o" numlevel="1" lineno="296" slineno="4-57" level="3"><display>(vi)</display>unless approved by the county legislative body, may not exceed by more than 5% <ln numlevel="1" lineno="297" slineno="4-58"/>an expenditure that was planned before the county office for which the temporary <ln numlevel="1" lineno="298" slineno="4-59"/>manager discharges duties was vacated;</subsection><subsection ssid="8-null-26" dnum="vii-o" numlevel="1" lineno="299" slineno="4-60" level="3"><display>(vii)</display>except as provided in Subsection <xref depth="4" refnumber="20A-1-508(2)(c)(viii)" start="0">(2)(c)(viii)</xref>, may not receive a change in title or <ln numlevel="1" lineno="300" slineno="4-61"/>compensation; and</subsection><subsection ssid="8-null-27" dnum="viii-o" numlevel="1" lineno="301" slineno="4-62" level="3"><display>(viii)</display>if approved by the county legislative body, may receive a performance award <ln numlevel="1" lineno="302" slineno="4-63"/>after:<subsection ssid="8-null-28" dnum="A-o" numlevel="1" lineno="303" slineno="4-64" level="4"><display>(A)</display>the county legislative body appoints an interim replacement under Subsection <xref depth="4" refnumber="20A-1-508(3)" start="0"><ln numlevel="1" lineno="304" slineno="4-65"/>(3)</xref>; and</subsection><subsection ssid="8-null-29" dnum="B-o" numlevel="1" lineno="305" slineno="4-66" level="4"><display>(B)</display>the interim replacement is sworn into office.</subsection></subsection></subsection><subsection ssid="8-null-30" dnum="d-o" numlevel="1" lineno="306" slineno="4-67" level="2"><display>(d)</display>This Subsection <xref depth="4" refnumber="20A-1-508(2)" start="0">(2)</xref> does not apply to a vacancy in the office of county legislative <ln numlevel="1" lineno="307" slineno="4-68"/>body member.</subsection></subsection><subsection ssid="8-null-31" dnum="3-o" numlevel="1" lineno="308" slineno="4-69" level="1" space="false"><display>(3)</display><subsection ssid="8-null-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Until a replacement is selected as provided in this section and has qualified, the <ln numlevel="1" lineno="309" slineno="4-70"/>county legislative body shall appoint an interim replacement to fill the vacant office <ln numlevel="1" lineno="310" slineno="4-71"/>by following the procedures and requirements of this Subsection <xref depth="4" refnumber="20A-1-508(3)" start="0">(3)</xref>.</subsection><subsection ssid="8-null-33" dnum="b-o" numlevel="1" lineno="311" slineno="4-72" level="2"><display>(b)</display>In addition to this Subsection <xref refnumber="20A-1-508(3)" depth="4">(3)</xref>, an interim replacement appointed to the office of <ln numlevel="1" lineno="312" slineno="4-73"/>county auditor in a county of the first class is subject to the requirements described in <ln numlevel="1" lineno="313" slineno="4-74"/>Section <xref depth="3" refnumber="17-69-202">17-69-202</xref>.</subsection><subsection ssid="8-null-34" dnum="c-o" numlevel="1" lineno="314" slineno="4-75" level="2" space="false"><display>(c)</display><subsection ssid="8-null-35" dnum="i-o" level="3" placement="sameline"><display>(i)</display>To appoint an interim replacement, the county legislative body shall, within 10 <ln numlevel="1" lineno="315" slineno="4-76"/>calendar days after the day on which the vacancy occurs, give notice of the <ln numlevel="1" lineno="316" slineno="4-77"/>vacancy to:<subsection ssid="8-null-36" dnum="A-o" numlevel="1" lineno="317" slineno="4-78" level="4" tab="1"><display>(A)</display>the county clerk; and </subsection><subsection ssid="8-null-37" dnum="B-o" numlevel="1" lineno="318" slineno="4-79" level="4" tab="1"><display>(B)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">the party liaison of the same political party of the prior office holder</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the party <ln numlevel="1" lineno="319" slineno="4-80"/>liaison of the registered political party of which the prior officeholder was a <ln numlevel="1" lineno="320" slineno="4-81"/>member at the time the prior officeholder was last elected or appointed</amend>. </subsection></subsection><subsection ssid="8-null-38" dnum="ii-o" numlevel="1" lineno="321" slineno="4-82" level="3"><display>(ii)</display>The county legislative body shall invite the party liaison described in Subsection <xref refnumber="20A-1-508(3)(c)(i)(B)" depth="4"><ln numlevel="1" lineno="322" slineno="4-83"/>(3)(c)(i)(B)</xref> to submit the name of an individual to fill the vacancy.</subsection><subsection ssid="8-null-39" dnum="iii-o" numlevel="1" lineno="323" slineno="4-84" level="3"><display>(iii)</display>The party liaison shall, no later than 5 p.m. on the first business day that is at <ln numlevel="1" lineno="324" slineno="4-85"/>least 30 calendar days after the day on which the party liaison receives the notice <ln numlevel="1" lineno="325" slineno="4-86"/>described in Subsection <xref depth="4" refnumber="20A-1-508(3)(c)(i)(b)">(3)(c)(i)(B)</xref>, or if the party liaison does not receive the <ln numlevel="1" lineno="326" slineno="4-87"/>notice, no later than 5 p.m. on the first business day that is at least 40 calendar <ln numlevel="1" lineno="327" slineno="4-88"/>days after the day on which the vacancy occurs, submit to the county legislative <ln numlevel="1" lineno="328" slineno="4-89"/>body the name of an individual the party selects in accordance with the party's <ln numlevel="1" lineno="329" slineno="4-90"/>constitution or bylaws to serve as the interim replacement.</subsection><subsection ssid="8-null-40" dnum="iv-o" numlevel="1" lineno="330" slineno="4-91" level="3"><display>(iv)</display>The county legislative body shall, no later than seven calendar days after the day <ln numlevel="1" lineno="331" slineno="4-92"/>on which a party liaison submits the name of the individual to serve as the interim <ln numlevel="1" lineno="332" slineno="4-93"/>replacement, appoint the individual to serve out the unexpired term.</subsection></subsection><subsection ssid="8-null-41" dnum="d-o" numlevel="1" lineno="333" slineno="4-94" level="2" space="false"><display>(d)</display><subsection ssid="8-null-42" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the county legislative body fails to appoint an interim replacement to fill the <ln numlevel="1" lineno="334" slineno="4-95"/>vacancy in accordance with Subsection <xref depth="4" refnumber="20A-1-508(3)(c)(iv)">(3)(c)(iv)</xref>, the county clerk shall, no later <ln numlevel="1" lineno="335" slineno="4-96"/>than seven calendar days after the day of the deadline described in Subsection <xref depth="4" refnumber="20A-1-508(3)(c)(iv)"><ln numlevel="1" lineno="336" slineno="4-97"/>(3)(c)(iv)</xref>, send to the governor a letter that:<subsection ssid="8-null-43" dnum="A-o" numlevel="1" lineno="337" slineno="4-98" level="4" tab="1"><display>(A)</display>informs the governor that the county legislative body has failed to appoint a <ln numlevel="1" lineno="338" slineno="4-99"/>replacement within the statutory time period; and</subsection><subsection ssid="8-null-44" dnum="B-o" numlevel="1" lineno="339" slineno="4-100" level="4" tab="1"><display>(B)</display>contains the name of the individual submitted by the party liaison to fill the <ln numlevel="1" lineno="340" slineno="4-101"/>vacancy.</subsection></subsection><subsection ssid="8-null-45" dnum="ii-o" numlevel="1" lineno="341" slineno="4-102" level="3"><display>(ii)</display>The governor shall, within 10 calendar days after the day on which the governor <ln numlevel="1" lineno="342" slineno="4-103"/>receives the letter described in Subsection <xref depth="4" refnumber="20A-1-508(3)(d)(i)">(3)(d)(i)</xref>, appoint the individual named <ln numlevel="1" lineno="343" slineno="4-104"/>by the party liaison as an interim replacement to fill the vacancy.</subsection></subsection><subsection ssid="8-null-46" dnum="e-o" numlevel="1" lineno="344" slineno="4-105" level="2"><display>(e)</display>An individual appointed as interim replacement under this Subsection <xref depth="4" refnumber="20A-1-508(3)" start="0">(3)</xref> shall hold <ln numlevel="1" lineno="345" slineno="4-106"/>office until a successor is elected and has qualified.</subsection></subsection><subsection ssid="8-null-47" dnum="4-o" numlevel="1" lineno="346" slineno="4-107" level="1" space="false"><display>(4)</display><subsection ssid="8-null-48" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The requirements of this Subsection <xref depth="4" refnumber="20A-1-508(4)" start="0">(4)</xref> apply to all county offices that become <ln numlevel="1" lineno="347" slineno="4-108"/>vacant if:<subsection ssid="8-null-49" dnum="i-o" numlevel="1" lineno="348" slineno="4-109" level="3" tab="1"><display>(i)</display>the vacant office has an unexpired term of two years or more; and</subsection><subsection ssid="8-null-50" dnum="ii-o" numlevel="1" lineno="349" slineno="4-110" level="3" tab="1"><display>(ii)</display>the vacancy occurs after the election at which the officeholder was elected, but <ln numlevel="1" lineno="350" slineno="4-111"/>before the first day of the declaration of candidacy filing period described in <ln numlevel="1" lineno="351" slineno="4-112"/>Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>.</subsection></subsection><subsection ssid="8-null-51" dnum="b-o" numlevel="1" lineno="352" slineno="4-113" level="2" space="false"><display>(b)</display><subsection ssid="8-null-52" dnum="i-o" level="3" placement="sameline"><display>(i)</display>When the conditions described in Subsection <xref depth="4" refnumber="20A-1-508(4)(a)" start="0">(4)(a)</xref> are met, the county clerk <ln numlevel="1" lineno="353" slineno="4-114"/>shall as soon as practicable, but no later than 180 calendar days before the next <ln numlevel="1" lineno="354" slineno="4-115"/>regular general election, notify the public and each registered political party that <ln numlevel="1" lineno="355" slineno="4-116"/>the vacancy exists.</subsection><subsection ssid="8-null-53" dnum="ii-o" numlevel="1" lineno="356" slineno="4-117" level="3"><display>(ii)</display>An individual intending to become a party candidate for the vacant office shall <ln numlevel="1" lineno="357" slineno="4-118"/>file a declaration of candidacy in accordance with:<subsection ssid="8-null-54" dnum="A-o" numlevel="1" lineno="358" slineno="4-119" level="4"><display>(A)</display><xref depth="2" refnumber="20A-9-2" start="1">Chapter 9, Part 2, Candidate Qualifications and Declarations of Candidacy</xref>; <ln numlevel="1" lineno="359" slineno="4-120"/>and</subsection><subsection ssid="8-null-55" dnum="B-o" numlevel="1" lineno="360" slineno="4-121" level="4"><display>(B)</display>for a county commission office, Subsection <xref refnumber="17-62-201(6)" depth="4">17-62-201(6)</xref> or <xref refnumber="17-62-202(6)" depth="4">17-62-202(6)</xref>, if <ln numlevel="1" lineno="361" slineno="4-122"/>applicable.</subsection></subsection><subsection ssid="8-null-56" dnum="iii-o" numlevel="1" lineno="362" slineno="4-123" level="3"><display>(iii)</display>An individual who is nominated as a party candidate, who qualifies as an <ln numlevel="1" lineno="363" slineno="4-124"/>unaffiliated candidate for the vacant office under <xref depth="2" refnumber="20A-9-5" start="1">Chapter 9, Part 5, Candidates not <ln numlevel="1" lineno="364" slineno="4-125"/>Affiliated with a Party</xref>, or who qualifies as a write-in candidate for the vacant <ln numlevel="1" lineno="365" slineno="4-126"/>office under <xref depth="2" refnumber="20A-9-6" start="1">Chapter 9, Part 6, Write-in Candidates</xref>, shall run in the regular <ln numlevel="1" lineno="366" slineno="4-127"/>general election.</subsection></subsection></subsection><subsection ssid="8-null-57" dnum="5-o" numlevel="1" lineno="367" slineno="4-128" level="1" space="false"><display>(5)</display><subsection ssid="8-null-58" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The requirements of this Subsection <xref depth="4" refnumber="20A-1-508(5)" start="0">(5)</xref> apply to all county offices that become <ln numlevel="1" lineno="368" slineno="4-129"/>vacant if:<subsection ssid="8-null-59" dnum="i-o" numlevel="1" lineno="369" slineno="4-130" level="3" tab="1"><display>(i)</display>the vacant office has an unexpired term of two years or more; and</subsection><subsection ssid="8-null-60" dnum="ii-o" numlevel="1" lineno="370" slineno="4-131" level="3" tab="1"><display>(ii)</display>the vacancy occurs on or after the first day of the declaration of candidacy filing <ln numlevel="1" lineno="371" slineno="4-132"/>period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>, but more than 75 calendar days before <ln numlevel="1" lineno="372" slineno="4-133"/>the regular primary election.</subsection></subsection><subsection ssid="8-null-61" dnum="b-o" numlevel="1" lineno="373" slineno="4-134" level="2"><display>(b)</display>When the conditions described in Subsection <xref depth="4" refnumber="20A-1-508(5)(a)" start="0">(5)(a)</xref> are met, the county clerk shall as <ln numlevel="1" lineno="374" slineno="4-135"/>soon as practicable, but no later than 70 calendar days before the next regular primary <ln numlevel="1" lineno="375" slineno="4-136"/>election, notify the public and each registered political party:<subsection ssid="8-null-62" dnum="i-o" numlevel="1" lineno="376" slineno="4-137" level="3"><display>(i)</display>that the vacancy exists; and</subsection><subsection ssid="8-null-63" dnum="ii-o" numlevel="1" lineno="377" slineno="4-138" level="3"><display>(ii)</display>of the deadlines described in Subsection <xref depth="4" refnumber="20A-1-508(5)(c)(i)" start="0">(5)(c)(i)</xref> and the deadlines established <ln numlevel="1" lineno="378" slineno="4-139"/>under Subsection <xref depth="4" refnumber="20A-1-508(5)(d)(ii)" start="0">(5)(d)(ii)</xref>.</subsection></subsection><subsection ssid="8-null-64" dnum="c-o" numlevel="1" lineno="379" slineno="4-140" level="2" space="false"><display>(c)</display><subsection ssid="8-null-65" dnum="i-o" level="3" placement="sameline"><display>(i)</display>An individual intending to become a party candidate for a vacant office shall, <ln numlevel="1" lineno="380" slineno="4-141"/>no later than 5 p.m. on the first business day that is at least five calendar days after <ln numlevel="1" lineno="381" slineno="4-142"/>the day on which the notice is given, file a declaration of candidacy for the vacant <ln numlevel="1" lineno="382" slineno="4-143"/>office in accordance with:<subsection ssid="8-null-66" dnum="A-o" numlevel="1" lineno="383" slineno="4-144" level="4" tab="1"><display>(A)</display><xref depth="2" refnumber="20A-9-2" start="1">Chapter 9, Part 2, Candidate Qualifications and Declarations of Candidacy</xref>; <ln numlevel="1" lineno="384" slineno="4-145"/>and</subsection><subsection ssid="8-null-67" dnum="B-o" numlevel="1" lineno="385" slineno="4-146" level="4" tab="1"><display>(B)</display>for a county commission office, Subsection <xref depth="4" refnumber="17-62-201(6)">17-62-201(6)</xref> or <xref depth="4" refnumber="17-62-202(6)">17-62-202(6)</xref>, if <ln numlevel="1" lineno="386" slineno="4-147"/>applicable.</subsection></subsection><subsection ssid="8-null-68" dnum="ii-o" numlevel="1" lineno="387" slineno="4-148" level="3"><display>(ii)</display>The county central committee of each party shall:<subsection ssid="8-null-69" dnum="A-o" numlevel="1" lineno="388" slineno="4-149" level="4"><display>(A)</display>select a candidate or candidates from among those qualified candidates who <ln numlevel="1" lineno="389" slineno="4-150"/>have filed declarations of candidacy; and</subsection><subsection ssid="8-null-70" dnum="B-o" numlevel="1" lineno="390" slineno="4-151" level="4"><display>(B)</display>certify the name of the candidate or candidates to the county clerk as soon as <ln numlevel="1" lineno="391" slineno="4-152"/>practicable, but no later than 5 p.m. on the last business day that is at least 60 <ln numlevel="1" lineno="392" slineno="4-153"/>calendar days before the day of the regular primary election.</subsection></subsection></subsection><subsection ssid="8-null-71" dnum="d-o" numlevel="1" lineno="393" slineno="4-154" level="2" space="false"><display>(d)</display><subsection ssid="8-null-72" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="20A-1-508(5)(d)(ii)" start="0">(5)(d)(ii)</xref>, an individual intending to become a <ln numlevel="1" lineno="394" slineno="4-155"/>candidate for a vacant office who does not wish to affiliate with a registered <ln numlevel="1" lineno="395" slineno="4-156"/>political party shall file a verified certificate of nomination described in Section <xref depth="3" refnumber="20A-9-502" start="0"><ln numlevel="1" lineno="396" slineno="4-157"/>20A-9-502</xref> with the county clerk in accordance with <xref depth="2" refnumber="20A-9-5" start="1">Chapter 9, Part 5, Candidates <ln numlevel="1" lineno="397" slineno="4-158"/>not Affiliated with a Party</xref>.</subsection><subsection ssid="8-null-73" dnum="ii-o" numlevel="1" lineno="398" slineno="4-159" level="3" space="false"><display>(ii)</display><subsection ssid="8-null-74" dnum="A-o" level="4" placement="sameline"><display>(A)</display>The county clerk shall establish, in the clerk's reasonable discretion, a <ln numlevel="1" lineno="399" slineno="4-160"/>deadline that is no later than 5 p.m. on the last business day that is at least 65 <ln numlevel="1" lineno="400" slineno="4-161"/>calendar days before the day of the next regular general election by which an <ln numlevel="1" lineno="401" slineno="4-162"/>individual who is not affiliated with a registered political party is required to <ln numlevel="1" lineno="402" slineno="4-163"/>submit a certificate of nomination under Subsection <xref depth="4" refnumber="20A-1-508(5)(d)(i)" start="0">(5)(d)(i)</xref>.</subsection><subsection ssid="8-null-75" dnum="B-o" numlevel="1" lineno="403" slineno="4-164" level="4"><display>(B)</display>The county clerk shall establish the deadline described in Subsection <xref depth="4" refnumber="20A-1-508(5)(d)(ii)(A)" start="0"><ln numlevel="1" lineno="404" slineno="4-165"/>(5)(d)(ii)(A)</xref> in a manner that gives an unaffiliated candidate an equal <ln numlevel="1" lineno="405" slineno="4-166"/>opportunity to access the regular general election ballot.</subsection></subsection></subsection><subsection ssid="8-null-76" dnum="e-o" numlevel="1" lineno="406" slineno="4-167" level="2"><display>(e)</display>An individual who is nominated as a party candidate for the vacant office, who <ln numlevel="1" lineno="407" slineno="4-168"/>qualifies as an unaffiliated candidate for the vacant office under <xref depth="2" refnumber="20A-9-5" start="1">Chapter 9, Part 5, <ln numlevel="1" lineno="408" slineno="4-169"/>Candidates not Affiliated with a Party</xref>, or who qualifies as a write-in candidate for the <ln numlevel="1" lineno="409" slineno="4-170"/>vacant office under <xref depth="2" refnumber="20A-9-6" start="1">Chapter 9, Part 6, Write-in Candidates</xref>, shall run in the regular <ln numlevel="1" lineno="410" slineno="4-171"/>general election.</subsection></subsection><subsection ssid="8-null-77" dnum="6-o" numlevel="1" lineno="411" slineno="4-172" level="1" space="false"><display>(6)</display><subsection ssid="8-null-78" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The requirements of this Subsection <xref depth="4" refnumber="20A-1-508(6)" start="0">(6)</xref> apply to all county offices that become <ln numlevel="1" lineno="412" slineno="4-173"/>vacant:<subsection ssid="8-null-79" dnum="i-o" numlevel="1" lineno="413" slineno="4-174" level="3" tab="1"><display>(i)</display>if the vacant office has an unexpired term of two years or more; and</subsection><subsection ssid="8-null-80" dnum="ii-o" numlevel="1" lineno="414" slineno="4-175" level="3" tab="1"><display>(ii)</display>when 75 calendar days or less remain before the day of the regular primary <ln numlevel="1" lineno="415" slineno="4-176"/>election but more than 65 calendar days remain before the day of the regular <ln numlevel="1" lineno="416" slineno="4-177"/>general election.</subsection></subsection><subsection ssid="8-null-81" dnum="b-o" numlevel="1" lineno="417" slineno="4-178" level="2"><display>(b)</display>When the conditions described in Subsection <xref depth="4" refnumber="20A-1-508(6)(a)" start="0">(6)(a)</xref> are met, the county clerk shall, as <ln numlevel="1" lineno="418" slineno="4-179"/>soon as practicable, notify the public and each registered political party:<subsection ssid="8-null-82" dnum="i-o" numlevel="1" lineno="419" slineno="4-180" level="3"><display>(i)</display>that the vacancy exists; and</subsection><subsection ssid="8-null-83" dnum="ii-o" numlevel="1" lineno="420" slineno="4-181" level="3"><display>(ii)</display>of the deadlines established under Subsection <xref depth="4" refnumber="20A-1-508(6)(d)" start="0">(6)(d)</xref>.</subsection></subsection><subsection ssid="8-null-84" dnum="c-o" numlevel="1" lineno="421" slineno="4-182" level="2" space="false"><display>(c)</display><subsection ssid="8-null-85" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Before the deadline that the county clerk establishes under Subsection <xref depth="4" refnumber="20A-1-508(6)(d)(i)(A)" start="0"><ln numlevel="1" lineno="422" slineno="4-183"/>(6)(d)(i)(A)</xref>, the county central committee of each registered political party that <ln numlevel="1" lineno="423" slineno="4-184"/>wishes to submit a candidate for the office shall certify the name of one candidate <ln numlevel="1" lineno="424" slineno="4-185"/>to the county clerk for placement on the regular general election ballot.</subsection><subsection ssid="8-null-86" dnum="ii-o" numlevel="1" lineno="425" slineno="4-186" level="3"><display>(ii)</display>Before the deadline that the county clerk establishes under Subsection <xref depth="4" refnumber="20A-1-508(6)(d)(i)(B)" start="0">(6)(d)(i)(B)</xref>, <ln numlevel="1" lineno="426" slineno="4-187"/>a candidate who does not wish to affiliate with a registered political party shall file <ln numlevel="1" lineno="427" slineno="4-188"/>a verified certificate of nomination described in Section <xref depth="3" refnumber="20A-9-502" start="0">20A-9-502</xref> with the <ln numlevel="1" lineno="428" slineno="4-189"/>county clerk in accordance with <xref depth="2" refnumber="20A-9-5" start="1">Chapter 9, Part 5, Candidates not Affiliated with <ln numlevel="1" lineno="429" slineno="4-190"/>a Party</xref>.</subsection><subsection ssid="8-null-87" dnum="iii-o" numlevel="1" lineno="430" slineno="4-191" level="3"><display>(iii)</display>Before the deadline that the county clerk establishes under Subsection <xref depth="4" refnumber="20A-1-508(6)(d)(i)(C)" start="0"><ln numlevel="1" lineno="431" slineno="4-192"/>(6)(d)(i)(C)</xref>, a write-in candidate shall submit to the county clerk a declaration of <ln numlevel="1" lineno="432" slineno="4-193"/>candidacy described in Section <xref depth="3" refnumber="20A-9-601" start="0">20A-9-601</xref>.</subsection></subsection><subsection ssid="8-null-88" dnum="d-o" numlevel="1" lineno="433" slineno="4-194" level="2" space="false"><display>(d)</display><subsection ssid="8-null-89" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The county clerk shall establish, in the clerk's reasonable discretion, deadlines <ln numlevel="1" lineno="434" slineno="4-195"/>that are no later than 5 p.m. on the last business day that is at least 65 calendar <ln numlevel="1" lineno="435" slineno="4-196"/>days before the day of the next regular general election by which:<subsection ssid="8-null-90" dnum="A-o" numlevel="1" lineno="436" slineno="4-197" level="4" tab="1"><display>(A)</display>a registered political party is required to certify a name under Subsection <xref depth="4" refnumber="20A-1-508(6)(c)(i)" start="0"><ln numlevel="1" lineno="437" slineno="4-198"/>(6)(c)(i)</xref>;</subsection><subsection ssid="8-null-91" dnum="B-o" numlevel="1" lineno="438" slineno="4-199" level="4" tab="1"><display>(B)</display>an individual who does not wish to affiliate with a registered political party is <ln numlevel="1" lineno="439" slineno="4-200"/>required to submit a certificate of nomination under Subsection <xref depth="4" refnumber="20A-1-508(6)(c)(ii)" start="0">(6)(c)(ii)</xref>; and</subsection><subsection ssid="8-null-92" dnum="C-o" numlevel="1" lineno="440" slineno="4-201" level="4" tab="1"><display>(C)</display>a write-in candidate is required to submit a declaration of candidacy under <ln numlevel="1" lineno="441" slineno="4-202"/>Subsection <xref depth="4" refnumber="20A-1-508(6)(c)(iii)" start="0">(6)(c)(iii)</xref>.</subsection></subsection><subsection ssid="8-null-93" dnum="ii-o" numlevel="1" lineno="442" slineno="4-203" level="3"><display>(ii)</display>The county clerk shall establish deadlines under Subsection <xref depth="4" refnumber="20A-1-508(6)(d)(i)" start="0">(6)(d)(i)</xref> in a manner <ln numlevel="1" lineno="443" slineno="4-204"/>that gives an unaffiliated candidate or a write-in candidate an equal opportunity to <ln numlevel="1" lineno="444" slineno="4-205"/>access the regular general election ballot.</subsection></subsection><subsection ssid="8-null-94" dnum="e-o" numlevel="1" lineno="445" slineno="4-206" level="2"><display>(e)</display>An individual who is certified as a party candidate for the vacant office, who <ln numlevel="1" lineno="446" slineno="4-207"/>qualifies as an unaffiliated candidate for the vacant office under <xref depth="2" refnumber="20A-9-5" start="1">Chapter 9, Part 5, <ln numlevel="1" lineno="447" slineno="4-208"/>Candidates not Affiliated with a Party</xref>, or who qualifies as a write-in candidate for the <ln numlevel="1" lineno="448" slineno="4-209"/>vacant office under <xref depth="2" refnumber="20A-9-6" start="1">Chapter 9, Part 6, Write-in Candidates</xref>, shall run in the regular <ln numlevel="1" lineno="449" slineno="4-210"/>general election.</subsection></subsection><subsection ssid="8-null-95" dnum="7-o" numlevel="1" lineno="450" slineno="4-211" level="1" space="false"><display>(7)</display><subsection ssid="8-null-96" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The requirements of this Subsection <xref depth="4" refnumber="20A-1-508(7)" start="0">(7)</xref> apply to all county offices that become <ln numlevel="1" lineno="451" slineno="4-212"/>vacant:<subsection ssid="8-null-97" dnum="i-o" numlevel="1" lineno="452" slineno="4-213" level="3" tab="1"><display>(i)</display>if the vacant office has an unexpired term of less than two years; or</subsection><subsection ssid="8-null-98" dnum="ii-o" numlevel="1" lineno="453" slineno="4-214" level="3" tab="1"><display>(ii)</display>if the vacant office has an unexpired term of two years or more but 65 calendar <ln numlevel="1" lineno="454" slineno="4-215"/>days or less remain before the day of the next regular general election.</subsection></subsection><subsection ssid="8-null-99" dnum="b-o" numlevel="1" lineno="455" slineno="4-216" level="2" space="false"><display>(b)</display><subsection ssid="8-null-100" dnum="i-o" level="3" placement="sameline"><display>(i)</display>When the conditions described in Subsection <xref depth="4" refnumber="20A-1-508(7)(a)" start="0">(7)(a)</xref> are met, the county <ln numlevel="1" lineno="456" slineno="4-217"/>legislative body shall as soon as practicable, but no later than 10 calendar days <ln numlevel="1" lineno="457" slineno="4-218"/>after the day on which the vacancy occurs, give notice of the vacancy to:<subsection ssid="8-null-101" dnum="A-o" numlevel="1" lineno="458" slineno="4-219" level="4" tab="1"><display>(A)</display>the county clerk; and </subsection><subsection ssid="8-null-102" dnum="B-o" numlevel="1" lineno="459" slineno="4-220" level="4" tab="1"><display>(B)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">the party liaison of the same political party as the prior office holder</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the party <ln numlevel="1" lineno="460" slineno="4-221"/>liaison of the registered political party of which the prior officeholder was a <ln numlevel="1" lineno="461" slineno="4-222"/>member at the time the prior officeholder was last elected or appointed</amend>. </subsection></subsection><subsection ssid="8-null-103" dnum="ii-o" numlevel="1" lineno="462" slineno="4-223" level="3"><display>(ii)</display>The county legislative body shall invite the party liaison described in Subsection <xref depth="4" refnumber="20A-1-508(7)(b)(i)(b)"><ln numlevel="1" lineno="463" slineno="4-224"/>(7)(b)(i)(B)</xref> to submit the name of an individual to fill the vacancy.</subsection><subsection ssid="8-null-104" dnum="iii-o" numlevel="1" lineno="464" slineno="4-225" level="3"><display>(iii)</display>The party liaison shall, no later than 5 p.m. on the first business day that is at <ln numlevel="1" lineno="465" slineno="4-226"/>least 30 calendar days after the day on which the party liaison receives the notice <ln numlevel="1" lineno="466" slineno="4-227"/>described in Subsection <xref depth="4" refnumber="20A-1-508(7)(b)(i)(b)">(7)(b)(i)(B)</xref>, or if the party liaison does not receive the <ln numlevel="1" lineno="467" slineno="4-228"/>notice, no later than 5 p.m. on the first business day that is at least <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>40 calendar <ln numlevel="1" lineno="468" slineno="4-229"/>days after the day on which the vacancy occurs, submit to the county legislative <ln numlevel="1" lineno="469" slineno="4-230"/>body the name of an individual to fill the vacancy.</subsection><subsection ssid="8-null-105" dnum="iv-o" numlevel="1" lineno="470" slineno="4-231" level="3"><display>(iv)</display>The county legislative body shall, no later than seven calendar days after the day <ln numlevel="1" lineno="471" slineno="4-232"/>on which a party liaison submits the name of the individual to fill the vacancy, <ln numlevel="1" lineno="472" slineno="4-233"/>appoint the individual to serve out the unexpired term.</subsection></subsection><subsection ssid="8-null-106" dnum="c-o" numlevel="1" lineno="473" slineno="4-234" level="2" space="false"><display>(c)</display><subsection ssid="8-null-107" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the county legislative body fails to appoint an individual to fill the vacancy in <ln numlevel="1" lineno="474" slineno="4-235"/>accordance with Subsection <xref depth="4" refnumber="20A-1-508(7)(b)(iv)">(7)(b)(iv)</xref>, the county clerk shall send to the governor <ln numlevel="1" lineno="475" slineno="4-236"/>a letter that:<subsection ssid="8-null-108" dnum="A-o" numlevel="1" lineno="476" slineno="4-237" level="4" tab="1"><display>(A)</display>informs the governor that the county legislative body has failed to appoint an <ln numlevel="1" lineno="477" slineno="4-238"/>individual to fill the vacancy within the statutory time period; and</subsection><subsection ssid="8-null-109" dnum="B-o" numlevel="1" lineno="478" slineno="4-239" level="4" tab="1"><display>(B)</display>contains the name of the individual submitted by the party liaison to fill the <ln numlevel="1" lineno="479" slineno="4-240"/>vacancy.</subsection></subsection><subsection ssid="8-null-110" dnum="ii-o" numlevel="1" lineno="480" slineno="4-241" level="3"><display>(ii)</display>The governor shall, within 10 calendar days after the day on which the governor <ln numlevel="1" lineno="481" slineno="4-242"/>receives the letter described in Subsection <xref depth="4" refnumber="20A-1-508(7)(c)(i)" start="0">(7)(c)(i)</xref>, appoint the individual named <ln numlevel="1" lineno="482" slineno="4-243"/>by the party liaison to fill the vacancy.</subsection></subsection><subsection ssid="8-null-111" dnum="d-o" numlevel="1" lineno="483" slineno="4-244" level="2"><display>(d)</display>An individual appointed to fill the vacancy under this Subsection <xref depth="4" refnumber="20A-1-508(7)" start="0">(7)</xref> shall hold office <ln numlevel="1" lineno="484" slineno="4-245"/>until a successor is elected and has qualified.</subsection></subsection><subsection ssid="8-null-112" dnum="8-o" numlevel="1" lineno="485" slineno="4-246" level="1"><display>(8)</display>Except as otherwise provided by law, the county legislative body may appoint <ln numlevel="1" lineno="486" slineno="4-247"/>replacements to fill all vacancies that occur in those offices filled by appointment of the <ln numlevel="1" lineno="487" slineno="4-248"/>county legislative body.</subsection><subsection ssid="8-null-113" dnum="9-o" numlevel="1" lineno="488" slineno="4-249" level="1"><display>(9)</display>Nothing in this section prohibits a candidate that does not wish to affiliate with a <ln numlevel="1" lineno="489" slineno="4-250"/>political party from filing a certificate of nomination for a vacant office within the same <ln numlevel="1" lineno="490" slineno="4-251"/>time limits as a candidate that is affiliated with a political party.</subsection><subsection ssid="8-null-114" dnum="10-o" numlevel="1" lineno="491" slineno="4-252" level="1" space="false"><display>(10)</display><subsection ssid="8-null-115" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each individual elected under Subsection <xref depth="4" refnumber="20A-1-508(4)" start="0">(4)</xref>, <xref depth="4" refnumber="20A-1-508(5)" start="0">(5)</xref>, or <xref depth="4" refnumber="20A-1-508(6)" start="0">(6)</xref> to fill a vacancy in a <ln numlevel="1" lineno="492" slineno="4-253"/>county office shall serve for the remainder of the unexpired term of the individual <ln numlevel="1" lineno="493" slineno="4-254"/>who created the vacancy and until a successor is elected and qualified.</subsection><subsection ssid="8-null-116" dnum="b-o" numlevel="1" lineno="494" slineno="4-255" level="2"><display>(b)</display>Nothing in this section may be construed to contradict or alter the provisions of <ln numlevel="1" lineno="495" slineno="4-256"/>Section <xref depth="3" refnumber="17-66-202">17-66-202</xref>.</subsection></subsection><subsection ssid="8-null-117" dnum="11-o" numlevel="1" lineno="496" slineno="4-257" level="1" space="false"><display>(11)</display><subsection ssid="8-null-118" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref refnumber="20A-1-508(11)(b)" depth="4">(11)(b)</xref>, for an individual seeking appointment <ln numlevel="1" lineno="497" slineno="4-258"/>to fill a vacancy described in Subsection <xref refnumber="20A-1-508(3)" depth="4">(3)</xref> or <xref refnumber="20A-1-508(7)" depth="4">(7)</xref> the individual shall, no later than <ln numlevel="1" lineno="498" slineno="4-259"/>the deadline for the individual to file a financial report under Section <xref depth="3" refnumber="17-70-403">17-70-403</xref>:<subsection ssid="8-null-119" dnum="i-o" numlevel="1" lineno="499" slineno="4-260" level="3" tab="1"><display>(i)</display>complete a conflict of interest disclosure statement in accordance with Section <xref depth="3" refnumber="17-70-304"><ln numlevel="1" lineno="500" slineno="4-261"/>17-70-304</xref>; and</subsection><subsection ssid="8-null-120" dnum="ii-o" numlevel="1" lineno="501" slineno="4-262" level="3" tab="1"><display>(ii)</display>submit the conflict of interest disclosure statement to the county legislative body <ln numlevel="1" lineno="502" slineno="4-263"/>and the county clerk.</subsection></subsection><subsection ssid="8-null-121" dnum="b-o" numlevel="1" lineno="503" slineno="4-264" level="2"><display>(b)</display>An individual described in Subsection <xref depth="4" refnumber="20A-1-508(11)(a)">(11)(a)</xref> is not required to comply with <ln numlevel="1" lineno="504" slineno="4-265"/>Subsection <xref depth="4" refnumber="20A-1-508(11)(a)">(11)(a)</xref> if the individual:<subsection ssid="8-null-122" dnum="i-o" numlevel="1" lineno="505" slineno="4-266" level="3"><display>(i)</display>currently holds an office described in Subsection <xref depth="4" refnumber="20A-1-508(1)(a)(i)">(1)(a)(i)</xref>;</subsection><subsection ssid="8-null-123" dnum="ii-o" numlevel="1" lineno="506" slineno="4-267" level="3"><display>(ii)</display>already, that same year, filed a conflict of interest disclosure statement for the <ln numlevel="1" lineno="507" slineno="4-268"/>office described in Subsection <xref depth="4" refnumber="20A-1-508(11)(b)(i)">(11)(b)(i)</xref>, in accordance with Section <xref depth="3" refnumber="17-70-509">17-70-509</xref>; <ln numlevel="1" lineno="508" slineno="4-269"/>and</subsection><subsection ssid="8-null-124" dnum="iii-o" numlevel="1" lineno="509" slineno="4-270" level="3"><display>(iii)</display>no later than the deadline described in Subsection <xref depth="4" refnumber="20A-1-508(11)(a)">(11)(a)</xref>, indicates, in a written <ln numlevel="1" lineno="510" slineno="4-271"/>notice submitted to the county clerk, that the conflict of interest disclosure <ln numlevel="1" lineno="511" slineno="4-272"/>statement described in Subsection <xref depth="4" refnumber="20A-1-508(11)(b)(ii)">(11)(b)(ii)</xref> is updated and accurate as of the date <ln numlevel="1" lineno="512" slineno="4-273"/>of the written notice.</subsection></subsection></subsection><subsection ssid="8-null-125" dnum="12-o" numlevel="1" lineno="513" slineno="4-274" level="1" space="false"><display>(12)</display><subsection ssid="8-null-126" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The county clerk shall make each conflict of interest disclosure statement made <ln numlevel="1" lineno="514" slineno="4-275"/>by an individual described in Subsection <xref refnumber="20A-1-508(11)(a)" depth="4">(11)(a)</xref> available for public inspection by <ln numlevel="1" lineno="515" slineno="4-276"/>posting an electronic copy of the statement on the county's website for at least 10 <ln numlevel="1" lineno="516" slineno="4-277"/>calendar days after the day on which the county legislative body:<subsection ssid="8-null-127" dnum="i-o" numlevel="1" lineno="517" slineno="4-278" level="3" tab="1"><display>(i)</display>appoints an interim replacement under Subsection <xref refnumber="20A-1-508(3)" depth="4">(3)</xref>; or</subsection><subsection ssid="8-null-128" dnum="ii-o" numlevel="1" lineno="518" slineno="4-279" level="3" tab="1"><display>(ii)</display>appoints an individual to fill a vacancy under Subsection <xref refnumber="20A-1-508(7)" depth="4">(7)</xref>.</subsection></subsection><subsection ssid="8-null-129" dnum="b-o" numlevel="1" lineno="519" slineno="4-280" level="2"><display>(b)</display>The county clerk shall post the electronic statement described in Subsection <xref refnumber="20A-1-508(12)(a)" depth="4">(12)(a)</xref> <ln numlevel="1" lineno="520" slineno="4-281"/>no later than two business days after the day on which the county clerk receives the <ln numlevel="1" lineno="521" slineno="4-282"/>statement.</subsection></subsection><subsection ssid="8-null-130" dnum="13-o" numlevel="1" lineno="522" slineno="4-283" level="1"><display>(13)</display>A vacancy in a county office does not occur unless the individual occupying the office:<subsection ssid="8-null-131" dnum="a-o" numlevel="1" lineno="523" slineno="4-284" level="2"><display>(a)</display>has left the office; or</subsection><subsection ssid="8-null-132" dnum="b-o" numlevel="1" lineno="524" slineno="4-285" level="2"><display>(b)</display>submits an irrevocable letter of resignation to the county legislative body.</subsection></subsection></section></bsec><bsec buid="10" num="20A-1-509.1" type="amend" src="code" uid="C20A-1-S509.1_2026050620260506" sort="20A01 05090120260506" numlevel="1" lineno="525" slineno="5-1" sn="5"><section number="20A-1-509.1" numlevel="1" lineno="526" slineno="5-2" type="amend"><secline lineno="525">Section 5. Section <bold>20A-1-509.1</bold> is amended to read:</secline><catline lineno="526"><bold>20A-1-509.1<parens/>. Procedure for filling midterm vacancy in county or district with 15 <ln numlevel="1" lineno="527" slineno="5-3"/>or more attorneys.</bold></catline><subsection ssid="10-null-1" dnum="1-o" numlevel="1" lineno="528" slineno="5-4" level="1" placement="noreturn"><display>(1)</display>When a vacancy occurs in the office of county or district attorney in a county or district <ln numlevel="1" lineno="529" slineno="5-5"/>having 15 or more attorneys who are licensed active members in good standing with the <ln numlevel="1" lineno="530" slineno="5-6"/>Utah State Bar and registered voters, the vacancy shall be filled as provided in this <ln numlevel="1" lineno="531" slineno="5-7"/>section.</subsection><subsection ssid="10-null-2" dnum="2-o" numlevel="1" lineno="532" slineno="5-8" level="1" space="false"><display>(2)</display><subsection ssid="10-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The requirements of this Subsection <xref depth="4" refnumber="20A-1-509.1(2)" start="0">(2)</xref> apply when the office of county attorney <ln numlevel="1" lineno="533" slineno="5-9"/>or district attorney becomes vacant and:<subsection ssid="10-null-4" dnum="i-o" numlevel="1" lineno="534" slineno="5-10" level="3" tab="1"><display>(i)</display>the vacant office has an unexpired term of two years or more; and</subsection><subsection ssid="10-null-5" dnum="ii-o" numlevel="1" lineno="535" slineno="5-11" level="3" tab="1"><display>(ii)</display>the vacancy occurs before the first day of the applicable declaration of candidacy <ln numlevel="1" lineno="536" slineno="5-12"/>filing period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>.</subsection></subsection><subsection ssid="10-null-6" dnum="b-o" numlevel="1" lineno="537" slineno="5-13" level="2"><display>(b)</display>When the conditions established in Subsection <xref depth="4" refnumber="20A-1-509.1(2)(a)" start="0">(2)(a)</xref> are met, the county clerk shall <ln numlevel="1" lineno="538" slineno="5-14"/>notify the public and each registered political party that the vacancy exists.</subsection><subsection ssid="10-null-7" dnum="c-o" numlevel="1" lineno="539" slineno="5-15" level="2"><display>(c)</display>All persons intending to become candidates for the vacant office shall:<subsection ssid="10-null-8" dnum="i-o" numlevel="1" lineno="540" slineno="5-16" level="3"><display>(i)</display>file a declaration of candidacy according to the procedures and requirements of <xref depth="2" refnumber="20A-9-2" start="1"><ln numlevel="1" lineno="541" slineno="5-17"/>Chapter 9, Part 2, Candidate Qualifications and Declarations of Candidacy</xref>;</subsection><subsection ssid="10-null-9" dnum="ii-o" numlevel="1" lineno="542" slineno="5-18" level="3"><display>(ii)</display>if nominated as a party candidate or qualified as an independent or write-in <ln numlevel="1" lineno="543" slineno="5-19"/>candidate under <xref depth="1" refnumber="20A-9" start="1">Chapter 9, Candidate Qualifications and Nominating Procedures</xref>, <ln numlevel="1" lineno="544" slineno="5-20"/>run in the regular general election; and</subsection><subsection ssid="10-null-10" dnum="iii-o" numlevel="1" lineno="545" slineno="5-21" level="3"><display>(iii)</display>if elected, complete the unexpired term of the person who created the vacancy.</subsection></subsection><subsection ssid="10-null-11" dnum="d-o" numlevel="1" lineno="546" slineno="5-22" level="2"><display>(d)</display>If the vacancy occurs during the applicable declaration of candidacy filing period <ln numlevel="1" lineno="547" slineno="5-23"/>described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>:<subsection ssid="10-null-12" dnum="i-o" numlevel="1" lineno="548" slineno="5-24" level="3"><display>(i)</display>the time for filing a declaration of candidacy under Section <xref depth="3" refnumber="20A-9-202" start="0">20A-9-202</xref> shall be <ln numlevel="1" lineno="549" slineno="5-25"/>extended until 5 p.m. on the first business day that is no later than seven calendar <ln numlevel="1" lineno="550" slineno="5-26"/>days after the last day of the applicable declaration of candidacy filing period <ln numlevel="1" lineno="551" slineno="5-27"/>described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>; and</subsection><subsection ssid="10-null-13" dnum="ii-o" numlevel="1" lineno="552" slineno="5-28" level="3"><display>(ii)</display>the county clerk shall notify the public and each registered political party that the <ln numlevel="1" lineno="553" slineno="5-29"/>vacancy exists.</subsection></subsection></subsection><subsection ssid="10-null-14" dnum="3-o" numlevel="1" lineno="554" slineno="5-30" level="1" space="false"><display>(3)</display><subsection ssid="10-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The requirements of this Subsection <xref depth="4" refnumber="20A-1-509.1(3)" start="0">(3)</xref> apply when the office of county attorney <ln numlevel="1" lineno="555" slineno="5-31"/>or district attorney becomes vacant and:<subsection ssid="10-null-16" dnum="i-o" numlevel="1" lineno="556" slineno="5-32" level="3" tab="1"><display>(i)</display>the vacant office has an unexpired term of two years or more; and</subsection><subsection ssid="10-null-17" dnum="ii-o" numlevel="1" lineno="557" slineno="5-33" level="3" tab="1"><display>(ii)</display>the vacancy occurs after the third Thursday in March of the even-numbered year <ln numlevel="1" lineno="558" slineno="5-34"/>but more than 75 calendar days before the regular primary election.</subsection></subsection><subsection ssid="10-null-18" dnum="b-o" numlevel="1" lineno="559" slineno="5-35" level="2"><display>(b)</display>When the conditions established in Subsection <xref depth="4" refnumber="20A-1-509.1(3)(a)" start="0">(3)(a)</xref> are met, the county clerk shall:<subsection ssid="10-null-19" dnum="i-o" numlevel="1" lineno="560" slineno="5-36" level="3"><display>(i)</display>notify the public and each registered political party that the vacancy exists; and</subsection><subsection ssid="10-null-20" dnum="ii-o" numlevel="1" lineno="561" slineno="5-37" level="3"><display>(ii)</display>identify the date and time by which a person interested in becoming a candidate <ln numlevel="1" lineno="562" slineno="5-38"/>shall file a declaration of candidacy.</subsection></subsection><subsection ssid="10-null-21" dnum="c-o" numlevel="1" lineno="563" slineno="5-39" level="2"><display>(c)</display>All persons intending to become candidates for the vacant office shall:<subsection ssid="10-null-22" dnum="i-o" numlevel="1" lineno="564" slineno="5-40" level="3"><display>(i)</display>no later than 5 p.m. on the first business day that is at least five calendar days after <ln numlevel="1" lineno="565" slineno="5-41"/>the day on which the county clerk gives the notice described in Subsection <xref depth="4" refnumber="20A-1-509.1(3)(b)(i)" start="0">(3)(b)(i)</xref>, <ln numlevel="1" lineno="566" slineno="5-42"/>file a declaration of candidacy for the vacant office as required by <xref depth="2" refnumber="20A-9-2" start="1">Chapter 9, Part <ln numlevel="1" lineno="567" slineno="5-43"/>2, Candidate Qualifications and Declarations of Candidacy</xref>; and</subsection><subsection ssid="10-null-23" dnum="ii-o" numlevel="1" lineno="568" slineno="5-44" level="3"><display>(ii)</display>if elected, complete the unexpired term of the person who created the vacancy.</subsection></subsection><subsection ssid="10-null-24" dnum="d-o" numlevel="1" lineno="569" slineno="5-45" level="2"><display>(d)</display>The county central committee of each party shall:<subsection ssid="10-null-25" dnum="i-o" numlevel="1" lineno="570" slineno="5-46" level="3"><display>(i)</display>select a candidate or candidates from among those qualified candidates who have <ln numlevel="1" lineno="571" slineno="5-47"/>filed declarations of candidacy; and</subsection><subsection ssid="10-null-26" dnum="ii-o" numlevel="1" lineno="572" slineno="5-48" level="3"><display>(ii)</display>certify the name of the candidate or candidates to the county clerk:<subsection ssid="10-null-27" dnum="A-o" numlevel="1" lineno="573" slineno="5-49" level="4"><display>(A)</display>no later than 5 p.m. on the last business day that is at least 60 calendar days <ln numlevel="1" lineno="574" slineno="5-50"/>before the day of the regular primary election; or</subsection><subsection ssid="10-null-28" dnum="B-o" numlevel="1" lineno="575" slineno="5-51" level="4"><display>(B)</display>electronically, before midnight no later than 60 calendar days before the day <ln numlevel="1" lineno="576" slineno="5-52"/>of the regular primary election.</subsection></subsection></subsection></subsection><subsection ssid="10-null-29" dnum="4-o" numlevel="1" lineno="577" slineno="5-53" level="1" space="false"><display>(4)</display><subsection ssid="10-null-30" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The requirements of this Subsection <xref depth="4" refnumber="20A-1-509.1(4)" start="0">(4)</xref> apply when the office of county attorney <ln numlevel="1" lineno="578" slineno="5-54"/>or district attorney becomes vacant and:<subsection ssid="10-null-31" dnum="i-o" numlevel="1" lineno="579" slineno="5-55" level="3" tab="1"><display>(i)</display>the vacant office has an unexpired term of two years or more; and</subsection><subsection ssid="10-null-32" dnum="ii-o" numlevel="1" lineno="580" slineno="5-56" level="3" tab="1"><display>(ii)</display>75 calendar days or less remain before the regular primary election but more than <ln numlevel="1" lineno="581" slineno="5-57"/>65 calendar days remain before the regular general election.</subsection></subsection><subsection ssid="10-null-33" dnum="b-o" numlevel="1" lineno="582" slineno="5-58" level="2"><display>(b)</display>When the conditions established in Subsection <xref depth="4" refnumber="20A-1-509.1(4)(a)" start="0">(4)(a)</xref> are met, the county central <ln numlevel="1" lineno="583" slineno="5-59"/>committees of each registered political party that wishes to submit a candidate for the <ln numlevel="1" lineno="584" slineno="5-60"/>office shall, not later than five calendar days after the day on which the vacancy <ln numlevel="1" lineno="585" slineno="5-61"/>occurs, certify the name of one candidate to the county clerk for placement on the <ln numlevel="1" lineno="586" slineno="5-62"/>regular general election ballot.</subsection><subsection ssid="10-null-34" dnum="c-o" numlevel="1" lineno="587" slineno="5-63" level="2"><display>(c)</display>The candidate elected shall complete the unexpired term of the person who created <ln numlevel="1" lineno="588" slineno="5-64"/>the vacancy.</subsection></subsection><subsection ssid="10-null-35" dnum="5-o" numlevel="1" lineno="589" slineno="5-65" level="1" space="false"><display>(5)</display><subsection ssid="10-null-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The requirements of this Subsection <xref depth="4" refnumber="20A-1-509.1(5)" start="0">(5)</xref> apply when the office of county attorney <ln numlevel="1" lineno="590" slineno="5-66"/>or district attorney becomes vacant and:<subsection ssid="10-null-37" dnum="i-o" numlevel="1" lineno="591" slineno="5-67" level="3" tab="1"><display>(i)</display>the vacant office has an unexpired term of less than two years; or</subsection><subsection ssid="10-null-38" dnum="ii-o" numlevel="1" lineno="592" slineno="5-68" level="3" tab="1"><display>(ii)</display>the vacant office has an unexpired term of two years or more but 65 calendar days <ln numlevel="1" lineno="593" slineno="5-69"/>or less remain before the next regular general election.</subsection></subsection><subsection ssid="10-null-39" dnum="b-o" numlevel="1" lineno="594" slineno="5-70" level="2"><display>(b)</display>When the conditions established in Subsection <xref depth="4" refnumber="20A-1-509.1(5)(a)" start="0">(5)(a)</xref> are met, the county legislative <ln numlevel="1" lineno="595" slineno="5-71"/>body shall give notice of the vacancy to: <subsection ssid="10-null-40" dnum="i-o" numlevel="1" lineno="596" slineno="5-72" level="3"><display>(i)</display>the county clerk; and</subsection><subsection ssid="10-null-41" dnum="ii-o" numlevel="1" lineno="597" slineno="5-73" level="3"><display>(ii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">the county central committee of the same political party of the prior officeholder</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="598" slineno="5-74"/>the county central committee of the registered political party of which the prior <ln numlevel="1" lineno="599" slineno="5-75"/>officeholder was a member at the time the prior officeholder was last elected or <ln numlevel="1" lineno="600" slineno="5-76"/>appointed</amend>. </subsection></subsection><subsection ssid="10-null-42" dnum="c-o" numlevel="1" lineno="601" slineno="5-77" level="2"><display>(c)</display>The county legislative body shall invite the committee described in Subsection <xref tempid="471" depth="4" refnumber="20A-1-509.1(5)(b)(ii)"><ln numlevel="1" lineno="602" slineno="5-78"/>(5)(b)(ii)</xref> to submit the names of three nominees to fill the vacancy.</subsection><subsection ssid="10-null-43" dnum="d-o" numlevel="1" lineno="603" slineno="5-79" level="2"><display>(d)</display>The county central committee shall, within 30 calendar days after the day on which <ln numlevel="1" lineno="604" slineno="5-80"/>the county legislative body gives the notice described in Subsection <xref depth="4" refnumber="20A-1-509.1(5)(b)(ii)">(5)(b)(ii)</xref>, submit <ln numlevel="1" lineno="605" slineno="5-81"/>to the county legislative body the names of three nominees to fill the vacancy.</subsection><subsection ssid="10-null-44" dnum="e-o" numlevel="1" lineno="606" slineno="5-82" level="2"><display>(e)</display>The county legislative body shall, within 45 calendar days after the vacancy occurs, <ln numlevel="1" lineno="607" slineno="5-83"/>appoint one of those nominees to serve out the unexpired term.</subsection><subsection ssid="10-null-45" dnum="f-o" numlevel="1" lineno="608" slineno="5-84" level="2"><display>(f)</display>If the county legislative body fails to appoint a person to fill the vacancy within 45 <ln numlevel="1" lineno="609" slineno="5-85"/>calendar days, the county clerk shall send to the governor a letter that:<subsection ssid="10-null-46" dnum="i-o" numlevel="1" lineno="610" slineno="5-86" level="3"><display>(i)</display>informs the governor that the county legislative body has failed to appoint a <ln numlevel="1" lineno="611" slineno="5-87"/>person to fill the vacancy within the statutory time period; and</subsection><subsection ssid="10-null-47" dnum="ii-o" numlevel="1" lineno="612" slineno="5-88" level="3"><display>(ii)</display>contains the list of nominees submitted by the party central committee.</subsection></subsection><subsection ssid="10-null-48" dnum="g-o" numlevel="1" lineno="613" slineno="5-89" level="2"><display>(g)</display>The governor shall appoint a person to fill the vacancy from that list of nominees <ln numlevel="1" lineno="614" slineno="5-90"/>within 30 calendar days after the day on which the governor receives the letter <ln numlevel="1" lineno="615" slineno="5-91"/>described in Subsection <xref depth="4" refnumber="20A-1-509.1(5)(f)">(5)(f)</xref>.</subsection><subsection ssid="10-null-49" dnum="h-o" numlevel="1" lineno="616" slineno="5-92" level="2"><display>(h)</display>A person appointed to fill the vacancy under this Subsection <xref depth="4" refnumber="20A-1-509.1(5)" start="0">(5)</xref> shall complete the <ln numlevel="1" lineno="617" slineno="5-93"/>unexpired term of the person who created the vacancy.</subsection></subsection><subsection ssid="10-null-50" dnum="6-o" numlevel="1" lineno="618" slineno="5-94" level="1"><display>(6)</display>A person seeking appointment to fill a vacancy described in Subsection <xref depth="4" refnumber="20A-1-509.1(5)(a)">(5)(a)</xref> shall, no <ln numlevel="1" lineno="619" slineno="5-95"/>later than the deadline for the person to file a financial report under Section <xref depth="3" refnumber="17-70-403">17-70-403</xref>:<subsection ssid="10-null-51" dnum="a-o" numlevel="1" lineno="620" slineno="5-96" level="2"><display>(a)</display>complete a conflict of interest disclosure statement in accordance with Section <xref depth="3" refnumber="17-70-304"><ln numlevel="1" lineno="621" slineno="5-97"/>17-70-304</xref>; and</subsection><subsection ssid="10-null-52" dnum="b-o" numlevel="1" lineno="622" slineno="5-98" level="2"><display>(b)</display>submit the conflict of interest disclosure statement to the county legislative body and <ln numlevel="1" lineno="623" slineno="5-99"/>the county clerk.</subsection></subsection><subsection ssid="10-null-53" dnum="7-o" numlevel="1" lineno="624" slineno="5-100" level="1" space="false"><display>(7)</display><subsection ssid="10-null-54" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The county clerk shall make each conflict of interest disclosure statement made by <ln numlevel="1" lineno="625" slineno="5-101"/>a person described in Subsection <xref refnumber="20A-1-509.1(6)" depth="4">(6)</xref> available for public inspection by posting an <ln numlevel="1" lineno="626" slineno="5-102"/>electronic copy of the statement on the county's website for at least 10 calendar days <ln numlevel="1" lineno="627" slineno="5-103"/>after the day on which the county legislative body appoints a person to fill the <ln numlevel="1" lineno="628" slineno="5-104"/>vacancy.</subsection><subsection ssid="10-null-55" dnum="b-o" numlevel="1" lineno="629" slineno="5-105" level="2"><display>(b)</display>The county clerk shall post the electronic statement described in Subsection <xref refnumber="20A-1-509.1(7)(a)" depth="4">(7)(a)</xref> no <ln numlevel="1" lineno="630" slineno="5-106"/>later than two business days after the day on which the county clerk receives the <ln numlevel="1" lineno="631" slineno="5-107"/>statement.</subsection></subsection><subsection ssid="10-null-56" dnum="8-o" numlevel="1" lineno="632" slineno="5-108" level="1"><display>(8)</display>A vacancy in the office described in Subsection <xref refnumber="20A-1-509.1(1)" depth="4">(1)</xref> does not occur unless the person <ln numlevel="1" lineno="633" slineno="5-109"/>occupying the office:<subsection ssid="10-null-57" dnum="a-o" numlevel="1" lineno="634" slineno="5-110" level="2"><display>(a)</display>has left the office; or</subsection><subsection ssid="10-null-58" dnum="b-o" numlevel="1" lineno="635" slineno="5-111" level="2"><display>(b)</display>submits an irrevocable letter of resignation to the county legislative body.</subsection></subsection><subsection ssid="10-null-59" dnum="9-o" numlevel="1" lineno="636" slineno="5-112" level="1"><display>(9)</display>Nothing in this section prevents or prohibits independent candidates from filing a <ln numlevel="1" lineno="637" slineno="5-113"/>declaration of candidacy for the office within the required time limits.</subsection></section></bsec><bsec buid="11" num="20A-1-509.2" type="amend" src="code" uid="C20A-1-S509.2_2026050620260506" sort="20A01 05090220260506" numlevel="1" lineno="638" slineno="6-1" sn="6"><section number="20A-1-509.2" numlevel="1" lineno="639" slineno="6-2" type="amend"><secline lineno="638">Section 6. Section <bold>20A-1-509.2</bold> is amended to read:</secline><catline lineno="639"><bold>20A-1-509.2<parens/>. Procedure for filling vacancy in county or district with fewer than <ln numlevel="1" lineno="640" slineno="6-3"/>15 attorneys.</bold></catline><subsection ssid="11-null-1" dnum="1-o" numlevel="1" lineno="641" slineno="6-4" level="1" placement="noreturn"><display>(1)</display>When a vacancy occurs in the office of county or district attorney, including a vacancy <ln numlevel="1" lineno="642" slineno="6-5"/>created by the failure of a person to file as a candidate for the office of county or district <ln numlevel="1" lineno="643" slineno="6-6"/>attorney in an election, in a county or district having fewer than 15 attorneys who are <ln numlevel="1" lineno="644" slineno="6-7"/>licensed, active members in good standing with the Utah State Bar and registered voters, <ln numlevel="1" lineno="645" slineno="6-8"/>the vacancy shall be filled as provided in this section.</subsection><subsection ssid="11-null-2" dnum="2-o" numlevel="1" lineno="646" slineno="6-9" level="1"><display>(2)</display>The county clerk shall send a letter to each attorney residing in the county or district <ln numlevel="1" lineno="647" slineno="6-10"/>who is a licensed, active member in good standing with the Utah State Bar and a <ln numlevel="1" lineno="648" slineno="6-11"/>registered voter that:<subsection ssid="11-null-3" dnum="a-o" numlevel="1" lineno="649" slineno="6-12" level="2"><display>(a)</display>informs the attorney of the vacancy;</subsection><subsection ssid="11-null-4" dnum="b-o" numlevel="1" lineno="650" slineno="6-13" level="2"><display>(b)</display>invites the attorney to apply for the vacancy; and</subsection><subsection ssid="11-null-5" dnum="c-o" numlevel="1" lineno="651" slineno="6-14" level="2"><display>(c)</display>informs the attorney that if the attorney does not respond before 5 p.m. on the first <ln numlevel="1" lineno="652" slineno="6-15"/>business day that is at least 10 calendar days after the day on which the county clerk <ln numlevel="1" lineno="653" slineno="6-16"/>sends the letter, the attorney's candidacy to fill the vacancy will not be considered.</subsection></subsection><subsection ssid="11-null-6" dnum="3-o" numlevel="1" lineno="654" slineno="6-17" level="1" space="false"><display>(3)</display><subsection ssid="11-null-7" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="11-null-8" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>If, before the deadline described in Subsection <xref depth="4" refnumber="20A-1-509.2(2)(c)" start="0">(2)(c)</xref>, more than three <ln numlevel="1" lineno="655" slineno="6-18"/>attorneys who are licensed, active members in good standing with the Utah State <ln numlevel="1" lineno="656" slineno="6-19"/>Bar and registered voters in the county or district have applied for the vacancy, the <ln numlevel="1" lineno="657" slineno="6-20"/>county clerk shall, except as provided in Subsection <xref depth="4" refnumber="20A-1-509.2(3)(a)(ii)" start="0">(3)(a)(ii)</xref>, submit the <ln numlevel="1" lineno="658" slineno="6-21"/>applications to the county central committee <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">of the same political party of the <ln numlevel="1" lineno="659" slineno="6-22"/>prior officeholder</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">of the registered political party of which the prior officeholder <ln numlevel="1" lineno="660" slineno="6-23"/>was a member at the time the prior officeholder was last elected or appointed</amend>.</subsection><subsection ssid="11-null-9" dnum="ii-o" numlevel="1" lineno="661" slineno="6-24" level="3" tab="1"><display>(ii)</display>In multicounty prosecution districts, the clerk shall submit the applications to the <ln numlevel="1" lineno="662" slineno="6-25"/>county central committee of each county within the prosecution district.</subsection></subsection><subsection ssid="11-null-10" dnum="b-o" numlevel="1" lineno="663" slineno="6-26" level="2"><display>(b)</display>The central committee shall nominate three of the applicants and forward the <ln numlevel="1" lineno="664" slineno="6-27"/>applicants' names to the county legislative body no later than 5 p.m. on the first <ln numlevel="1" lineno="665" slineno="6-28"/>business day that is at least 20 calendar days after the day on which the county clerk <ln numlevel="1" lineno="666" slineno="6-29"/>submits the applicants' names under Subsection <xref depth="4" refnumber="20A-1-509.2(3)(a)" start="0">(3)(a)</xref>.</subsection><subsection ssid="11-null-11" dnum="c-o" numlevel="1" lineno="667" slineno="6-30" level="2"><display>(c)</display>The county legislative body shall appoint one of the nominees to fill the vacant <ln numlevel="1" lineno="668" slineno="6-31"/>position.</subsection><subsection ssid="11-null-12" dnum="d-o" numlevel="1" lineno="669" slineno="6-32" level="2"><display>(d)</display>If the central committee of the political party fails to submit at least three names to <ln numlevel="1" lineno="670" slineno="6-33"/>the county legislative body before the deadline described in Subsection <xref depth="4" refnumber="20A-1-509.2(3)(b)" start="0">(3)(b)</xref>, the <ln numlevel="1" lineno="671" slineno="6-34"/>county legislative body shall appoint one of the applicants to fill the vacant position.</subsection><subsection ssid="11-null-13" dnum="e-o" numlevel="1" lineno="672" slineno="6-35" level="2"><display>(e)</display>If the county legislative body fails to appoint a person to fill the vacancy within 120 <ln numlevel="1" lineno="673" slineno="6-36"/>calendar days after the day on which the vacancy occurs, the county clerk shall mail <ln numlevel="1" lineno="674" slineno="6-37"/>to the governor:<subsection ssid="11-null-14" dnum="i-o" numlevel="1" lineno="675" slineno="6-38" level="3"><display>(i)</display>a letter informing the governor that the county legislative body has failed to <ln numlevel="1" lineno="676" slineno="6-39"/>appoint a person to fill the vacancy; and</subsection><subsection ssid="11-null-15" dnum="ii-o" numlevel="1" lineno="677" slineno="6-40" level="3" space="false"><display>(ii)</display><subsection ssid="11-null-16" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the list of nominees, if any, submitted by the central committee of the <ln numlevel="1" lineno="678" slineno="6-41"/>political party; or</subsection><subsection ssid="11-null-17" dnum="B-o" numlevel="1" lineno="679" slineno="6-42" level="4"><display>(B)</display>if the party central committee has not submitted a list of at least three <ln numlevel="1" lineno="680" slineno="6-43"/>nominees within the required time, the names of the persons who submitted <ln numlevel="1" lineno="681" slineno="6-44"/>applications for the vacant position to the county clerk.</subsection></subsection></subsection><subsection ssid="11-null-18" dnum="f-o" numlevel="1" lineno="682" slineno="6-45" level="2"><display>(f)</display>The governor shall appoint, within 30 calendar days after the day on which the <ln numlevel="1" lineno="683" slineno="6-46"/>governor receives the letter described in Subsection <xref depth="4" refnumber="20A-1-509.2(3)(e)">(3)(e)</xref>, a person from the list to <ln numlevel="1" lineno="684" slineno="6-47"/>fill the vacancy.</subsection></subsection><subsection ssid="11-null-19" dnum="4-o" numlevel="1" lineno="685" slineno="6-48" level="1" space="false"><display>(4)</display><subsection ssid="11-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If, before the deadline described in Subsection <xref depth="4" refnumber="20A-1-509.2(2)(c)" start="0">(2)(c)</xref>, three or fewer attorneys who <ln numlevel="1" lineno="686" slineno="6-49"/>are licensed, active members in good standing with the Utah State Bar and registered <ln numlevel="1" lineno="687" slineno="6-50"/>voters in the county or district have applied for the vacancy, the county legislative <ln numlevel="1" lineno="688" slineno="6-51"/>body may:<subsection ssid="11-null-21" dnum="i-o" numlevel="1" lineno="689" slineno="6-52" level="3" tab="1"><display>(i)</display>appoint one of them to be county or district attorney; or</subsection><subsection ssid="11-null-22" dnum="ii-o" numlevel="1" lineno="690" slineno="6-53" level="3" tab="1"><display>(ii)</display>solicit additional applicants and appoint a county or district attorney as provided <ln numlevel="1" lineno="691" slineno="6-54"/>in Subsection <xref depth="4" refnumber="20A-1-509.2(4)(b)" start="0">(4)(b)</xref>.</subsection></subsection><subsection ssid="11-null-23" dnum="b-o" numlevel="1" lineno="692" slineno="6-55" level="2" space="false"><display>(b)</display><subsection ssid="11-null-24" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If three or fewer attorneys who are licensed members in good standing of the <ln numlevel="1" lineno="693" slineno="6-56"/>Utah State Bar and registered voters in the county or district submit applications, <ln numlevel="1" lineno="694" slineno="6-57"/>the county legislative body may publicly solicit and accept additional applications <ln numlevel="1" lineno="695" slineno="6-58"/>for the position from licensed, active members in good standing of the Utah State <ln numlevel="1" lineno="696" slineno="6-59"/>Bar who are not residents of the county or prosecution district.</subsection><subsection ssid="11-null-25" dnum="ii-o" numlevel="1" lineno="697" slineno="6-60" level="3"><display>(ii)</display>The county legislative body shall consider the applications submitted by the <ln numlevel="1" lineno="698" slineno="6-61"/>attorneys who are residents of and registered voters in the county or prosecution <ln numlevel="1" lineno="699" slineno="6-62"/>district and the applications submitted by the attorneys who are not residents of <ln numlevel="1" lineno="700" slineno="6-63"/>the county or prosecution district and shall appoint one of the applicants to be <ln numlevel="1" lineno="701" slineno="6-64"/>county attorney or district attorney.</subsection></subsection><subsection ssid="11-null-26" dnum="c-o" numlevel="1" lineno="702" slineno="6-65" level="2"><display>(c)</display>If the legislative body fails to appoint a person to fill the vacancy within 120 calendar <ln numlevel="1" lineno="703" slineno="6-66"/>days after the day on which the vacancy occurs, the county clerk shall:<subsection ssid="11-null-27" dnum="i-o" numlevel="1" lineno="704" slineno="6-67" level="3"><display>(i)</display>notify the governor that the legislative body has failed to fill the vacancy within <ln numlevel="1" lineno="705" slineno="6-68"/>the required time period; and</subsection><subsection ssid="11-null-28" dnum="ii-o" numlevel="1" lineno="706" slineno="6-69" level="3"><display>(ii)</display>provide the governor with a list of all the applicants.</subsection></subsection><subsection ssid="11-null-29" dnum="d-o" numlevel="1" lineno="707" slineno="6-70" level="2"><display>(d)</display>The governor shall appoint a person to fill the vacancy within 30 calendar days after <ln numlevel="1" lineno="708" slineno="6-71"/>the day on which the governor receives the notification described in Subsection <xref refnumber="20A-1-509.2(4)(c)" depth="4">(4)(c)</xref>.</subsection></subsection><subsection ssid="11-null-30" dnum="5-o" numlevel="1" lineno="709" slineno="6-72" level="1"><display>(5)</display>The person appointed to fill the vacancy shall serve for the unexpired term of the person <ln numlevel="1" lineno="710" slineno="6-73"/>who created the vacancy.</subsection><subsection ssid="11-null-31" dnum="6-o" numlevel="1" lineno="711" slineno="6-74" level="1"><display>(6)</display>A person seeking appointment to fill a vacancy under this section shall, no later than the <ln numlevel="1" lineno="712" slineno="6-75"/>deadline for the person to file a financial report under Section <xref depth="3" refnumber="17-70-403">17-70-403</xref>:<subsection ssid="11-null-32" dnum="a-o" numlevel="1" lineno="713" slineno="6-76" level="2"><display>(a)</display>complete a conflict of interest disclosure statement in accordance with Section <xref depth="3" refnumber="17-70-304"><ln numlevel="1" lineno="714" slineno="6-77"/>17-70-304</xref>; and</subsection><subsection ssid="11-null-33" dnum="b-o" numlevel="1" lineno="715" slineno="6-78" level="2"><display>(b)</display>submit the conflict of interest disclosure statement to the county legislative body and <ln numlevel="1" lineno="716" slineno="6-79"/>the county clerk.</subsection></subsection><subsection ssid="11-null-34" dnum="7-o" numlevel="1" lineno="717" slineno="6-80" level="1" space="false"><display>(7)</display><subsection ssid="11-null-35" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The county clerk shall make each conflict of interest disclosure statement made by <ln numlevel="1" lineno="718" slineno="6-81"/>a person described in Subsection <xref depth="4" refnumber="20A-1-509.2(6)">(6)</xref> available for public inspection by posting an <ln numlevel="1" lineno="719" slineno="6-82"/>electronic copy of the statement on the county's website for at least 10 calendar days <ln numlevel="1" lineno="720" slineno="6-83"/>after the day on which the county legislative body appoints a person to fill the <ln numlevel="1" lineno="721" slineno="6-84"/>vacancy.</subsection><subsection ssid="11-null-36" dnum="b-o" numlevel="1" lineno="722" slineno="6-85" level="2"><display>(b)</display>The county clerk shall post the electronic statement described in Subsection <xref depth="4" refnumber="20A-1-509.2(7)(a)">(7)(a)</xref> no <ln numlevel="1" lineno="723" slineno="6-86"/>later than two business days after the day on which the county clerk receives the <ln numlevel="1" lineno="724" slineno="6-87"/>statement.</subsection></subsection><subsection ssid="11-null-37" dnum="8-o" numlevel="1" lineno="725" slineno="6-88" level="1"><display>(8)</display>A vacancy in the office described in Subsection <xref refnumber="20A-1-509.2(1)" depth="4">(1)</xref> does not occur until the person <ln numlevel="1" lineno="726" slineno="6-89"/>occupying the office:<subsection ssid="11-null-38" dnum="a-o" numlevel="1" lineno="727" slineno="6-90" level="2"><display>(a)</display>has left the office; or</subsection><subsection ssid="11-null-39" dnum="b-o" numlevel="1" lineno="728" slineno="6-91" level="2"><display>(b)</display>submits an irrevocable letter of resignation to the county legislative body.</subsection></subsection></section></bsec><bsec buid="23" num="20A-11-204" type="amend" src="code" uid="C20A-11-S204_2026050620260506" sort="20A11 02040020260506" numlevel="1" lineno="729" slineno="7-1" sn="7"><section number="20A-11-204" numlevel="1" lineno="730" slineno="7-2" type="amend"><secline lineno="729">Section 7. Section <bold>20A-11-204</bold> is amended to read:</secline><catline lineno="730"><bold>20A-11-204<parens/>. State office candidate and state officeholder -- Financial reporting <ln numlevel="1" lineno="731" slineno="7-3"/>requirements -- Interim reports.</bold></catline><subsection ssid="23-null-1" dnum="1-o" numlevel="1" lineno="732" slineno="7-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="23-null-2" dnum="a-o" numlevel="1" lineno="733" slineno="7-5" level="2"><display>(a)</display>"Campaign account" means a separate campaign account required under Subsection <xref depth="4" refnumber="20A-11-201(1)(a)" start="0"><ln numlevel="1" lineno="734" slineno="7-6"/>20A-11-201(1)(a)</xref> or <xref depth="4" refnumber="20A-11-201(1)(c)" start="0">(c)</xref>.</subsection><subsection ssid="23-null-3" dnum="b-o" numlevel="1" lineno="735" slineno="7-7" level="2"><display>(b)</display>"Received" means:<subsection ssid="23-null-4" dnum="i-o" numlevel="1" lineno="736" slineno="7-8" level="3"><display>(i)</display>for a cash contribution, that the cash is given to a state office candidate or a <ln numlevel="1" lineno="737" slineno="7-9"/>member of the state office candidate's personal campaign committee;</subsection><subsection ssid="23-null-5" dnum="ii-o" numlevel="1" lineno="738" slineno="7-10" level="3"><display>(ii)</display>for a contribution that is a negotiable instrument or check, that the negotiable <ln numlevel="1" lineno="739" slineno="7-11"/>instrument or check is negotiated;</subsection><subsection ssid="23-null-6" dnum="iii-o" numlevel="1" lineno="740" slineno="7-12" level="3"><display>(iii)</display>for a direct deposit made into a campaign account by a person not associated <ln numlevel="1" lineno="741" slineno="7-13"/>with the campaign, the earlier of:<subsection ssid="23-null-7" dnum="A-o" numlevel="1" lineno="742" slineno="7-14" level="4"><display>(A)</display>the day on which the state office candidate or a member of the state office <ln numlevel="1" lineno="743" slineno="7-15"/>candidate's personal campaign committee becomes aware of the deposit and <ln numlevel="1" lineno="744" slineno="7-16"/>the source of the deposit;</subsection><subsection ssid="23-null-8" dnum="B-o" numlevel="1" lineno="745" slineno="7-17" level="4"><display>(B)</display>the day on which the state office candidate or a member of the state office <ln numlevel="1" lineno="746" slineno="7-18"/>candidate's personal campaign committee receives notice of the deposit and the <ln numlevel="1" lineno="747" slineno="7-19"/>source of the deposit by mail, email, text, or similar means; or</subsection><subsection ssid="23-null-9" dnum="C-o" numlevel="1" lineno="748" slineno="7-20" level="4"><display>(C)</display>31 calendar days after the day on which the direct deposit occurs; or</subsection></subsection><subsection ssid="23-null-10" dnum="iv-o" numlevel="1" lineno="749" slineno="7-21" level="3"><display>(iv)</display>for any other type of contribution, that any portion of the contribution's benefit <ln numlevel="1" lineno="750" slineno="7-22"/>inures to the state office candidate.</subsection></subsection></subsection><subsection ssid="23-null-11" dnum="2-o" numlevel="1" lineno="751" slineno="7-23" level="1"><display>(2)</display>Except as provided in Subsection <xref depth="4" refnumber="20A-11-204(3)" start="0">(3)</xref>, each state office candidate shall file an interim <ln numlevel="1" lineno="752" slineno="7-24"/>report at the following times in any year in which the candidate has filed a declaration of <ln numlevel="1" lineno="753" slineno="7-25"/>candidacy for a public office:<subsection ssid="23-null-12" dnum="a-o" numlevel="1" lineno="754" slineno="7-26" level="2" space="false"><display>(a)</display><subsection ssid="23-null-13" dnum="i-o" level="3" placement="sameline"><display>(i)</display>seven calendar days before the candidate's political convention; or</subsection><subsection ssid="23-null-14" dnum="ii-o" numlevel="1" lineno="755" slineno="7-27" level="3"><display>(ii)</display>for an unaffiliated candidate, the fourth Saturday in March;</subsection></subsection><subsection ssid="23-null-15" dnum="b-o" numlevel="1" lineno="756" slineno="7-28" level="2"><display>(b)</display>seven calendar days before the regular primary election date;</subsection><subsection ssid="23-null-16" dnum="c-o" numlevel="1" lineno="757" slineno="7-29" level="2"><display>(c)</display>September 30; and</subsection><subsection ssid="23-null-17" dnum="d-o" numlevel="1" lineno="758" slineno="7-30" level="2"><display>(d)</display>seven calendar days before the regular general election date.</subsection></subsection><subsection ssid="23-null-18" dnum="3-o" numlevel="1" lineno="759" slineno="7-31" level="1"><display>(3)</display>If a state office candidate is a state office candidate seeking appointment for a midterm <ln numlevel="1" lineno="760" slineno="7-32"/>vacancy, the state office candidate:<subsection ssid="23-null-19" dnum="a-o" numlevel="1" lineno="761" slineno="7-33" level="2"><display>(a)</display>shall file an interim report:<subsection ssid="23-null-20" dnum="i-o" numlevel="1" lineno="762" slineno="7-34" level="3"><display>(i)</display>no later than three business days before the day on which the political party of the <ln numlevel="1" lineno="763" slineno="7-35"/>party for which the state office candidate seeks nomination meets to declare a <ln numlevel="1" lineno="764" slineno="7-36"/>nominee for the governor to appoint in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="20A-1-504(1)(a)"><ln numlevel="1" lineno="765" slineno="7-37"/>20A-1-504(1)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="20A-1-504(1)(b)">20A-1-504(1)(b)</xref></amend>; or</subsection><subsection ssid="23-null-21" dnum="ii-o" numlevel="1" lineno="766" slineno="7-38" level="3"><display>(ii)</display>if a state office candidate decides to seek the appointment with less than three <ln numlevel="1" lineno="767" slineno="7-39"/>business days before the day <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">on which the political party meets</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">described in <ln numlevel="1" lineno="768" slineno="7-40"/>Subsection <xref depth="4" refnumber="20A-11-204(3)(a)(i)">(3)(a)(i)</xref></amend>, or the political party schedules the meeting <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">to declare a <ln numlevel="1" lineno="769" slineno="7-41"/>nominee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">described in Subsection <xref depth="4" refnumber="20A-11-204(3)(a)(i)">(3)(a)(i)</xref></amend> less than three business days before the <ln numlevel="1" lineno="770" slineno="7-42"/>day of the meeting, no later than 5 p.m. on the last day of business before the day <ln numlevel="1" lineno="771" slineno="7-43"/>on which the political party meets; and</subsection></subsection><subsection ssid="23-null-22" dnum="b-o" numlevel="1" lineno="772" slineno="7-44" level="2"><display>(b)</display>is not required to file an interim report at the times described in Subsection <xref depth="4" refnumber="20A-11-204(2)">(2)</xref>.</subsection></subsection><subsection ssid="23-null-23" dnum="4-o" numlevel="1" lineno="773" slineno="7-45" level="1"><display>(4)</display>Each interim report shall include the following information:<subsection ssid="23-null-24" dnum="a-o" numlevel="1" lineno="774" slineno="7-46" level="2"><display>(a)</display>the net balance of the last summary report, if any;</subsection><subsection ssid="23-null-25" dnum="b-o" numlevel="1" lineno="775" slineno="7-47" level="2"><display>(b)</display>a single figure equal to the total amount of receipts reported on all prior interim <ln numlevel="1" lineno="776" slineno="7-48"/>reports, if any, during the calendar year in which the interim report is due;</subsection><subsection ssid="23-null-26" dnum="c-o" numlevel="1" lineno="777" slineno="7-49" level="2"><display>(c)</display>a single figure equal to the total amount of expenditures reported on all prior interim <ln numlevel="1" lineno="778" slineno="7-50"/>reports, if any, filed during the calendar year in which the interim report is due;</subsection><subsection ssid="23-null-27" dnum="d-o" numlevel="1" lineno="779" slineno="7-51" level="2"><display>(d)</display>a detailed listing of:<subsection ssid="23-null-28" dnum="i-o" numlevel="1" lineno="780" slineno="7-52" level="3"><display>(i)</display>for a state office candidate, each contribution received since the last summary <ln numlevel="1" lineno="781" slineno="7-53"/>report that has not been reported in detail on a prior interim report; or</subsection><subsection ssid="23-null-29" dnum="ii-o" numlevel="1" lineno="782" slineno="7-54" level="3"><display>(ii)</display>for a state officeholder, each contribution and public service assistance received <ln numlevel="1" lineno="783" slineno="7-55"/>since the last summary report that has not been reported in detail on a prior <ln numlevel="1" lineno="784" slineno="7-56"/>interim report;</subsection></subsection><subsection ssid="23-null-30" dnum="e-o" numlevel="1" lineno="785" slineno="7-57" level="2"><display>(e)</display>for each nonmonetary contribution:<subsection ssid="23-null-31" dnum="i-o" numlevel="1" lineno="786" slineno="7-58" level="3"><display>(i)</display>the fair market value of the contribution with that information provided by the <ln numlevel="1" lineno="787" slineno="7-59"/>contributor; and</subsection><subsection ssid="23-null-32" dnum="ii-o" numlevel="1" lineno="788" slineno="7-60" level="3"><display>(ii)</display>a specific description of the contribution;</subsection></subsection><subsection ssid="23-null-33" dnum="f-o" numlevel="1" lineno="789" slineno="7-61" level="2"><display>(f)</display>a detailed listing of each expenditure made since the last summary report that has not <ln numlevel="1" lineno="790" slineno="7-62"/>been reported in detail on a prior interim report;</subsection><subsection ssid="23-null-34" dnum="g-o" numlevel="1" lineno="791" slineno="7-63" level="2"><display>(g)</display>for each nonmonetary expenditure, the fair market value of the expenditure;</subsection><subsection ssid="23-null-35" dnum="h-o" numlevel="1" lineno="792" slineno="7-64" level="2"><display>(h)</display>a net balance for the year consisting of the net balance from the last summary report, <ln numlevel="1" lineno="793" slineno="7-65"/>if any, plus all receipts since the last summary report minus all expenditures since the <ln numlevel="1" lineno="794" slineno="7-66"/>last summary report;</subsection><subsection ssid="23-null-36" dnum="i-o" numlevel="1" lineno="795" slineno="7-67" level="2"><display>(i)</display>a summary page in the form required by the lieutenant governor that identifies:<subsection ssid="23-null-37" dnum="i-o" numlevel="1" lineno="796" slineno="7-68" level="3"><display>(i)</display>beginning balance;</subsection><subsection ssid="23-null-38" dnum="ii-o" numlevel="1" lineno="797" slineno="7-69" level="3"><display>(ii)</display>total contributions and public service assistance received during the period since <ln numlevel="1" lineno="798" slineno="7-70"/>the last statement;</subsection><subsection ssid="23-null-39" dnum="iii-o" numlevel="1" lineno="799" slineno="7-71" level="3"><display>(iii)</display>total contributions and public service assistance received to date;</subsection><subsection ssid="23-null-40" dnum="iv-o" numlevel="1" lineno="800" slineno="7-72" level="3"><display>(iv)</display>total expenditures during the period since the last statement; and</subsection><subsection ssid="23-null-41" dnum="v-o" numlevel="1" lineno="801" slineno="7-73" level="3"><display>(v)</display>total expenditures to date; and</subsection></subsection><subsection ssid="23-null-42" dnum="j-o" numlevel="1" lineno="802" slineno="7-74" level="2"><display>(j)</display>the name of a political action committee for which the state office candidate or state <ln numlevel="1" lineno="803" slineno="7-75"/>officeholder is designated as an officer who has primary decision-making authority <ln numlevel="1" lineno="804" slineno="7-76"/>under Section <xref depth="3" refnumber="20A-11-601" start="0">20A-11-601</xref>.</subsection></subsection><subsection ssid="23-null-43" dnum="5-o" numlevel="1" lineno="805" slineno="7-77" level="1" space="false"><display>(5)</display><subsection ssid="23-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In preparing each interim report, all receipts and expenditures shall be reported as <ln numlevel="1" lineno="806" slineno="7-78"/>of five calendar days before the required filing date of the report.</subsection><subsection ssid="23-null-45" dnum="b-o" numlevel="1" lineno="807" slineno="7-79" level="2"><display>(b)</display>Any negotiable instrument or check received by a state office candidate or state <ln numlevel="1" lineno="808" slineno="7-80"/>officeholder more than five calendar days before the required filing date of a report <ln numlevel="1" lineno="809" slineno="7-81"/>required by this section shall be included in the interim report.</subsection></subsection></section></bsec><bsec buid="21" num="20A-11-1303" type="amend" src="code" uid="C20A-11-S1303_2026050620260506" sort="20A11 13030020260506" numlevel="1" lineno="810" slineno="8-1" sn="8"><section number="20A-11-1303" numlevel="1" lineno="811" slineno="8-2" type="amend"><secline lineno="810">Section 8. Section <bold>20A-11-1303</bold> is amended to read:</secline><catline lineno="811"><bold>20A-11-1303<parens/>. School board office candidate and school board officeholder -- <ln numlevel="1" lineno="812" slineno="8-3"/>Financial reporting requirements -- Interim reports.</bold></catline><subsection ssid="21-null-1" dnum="1-o" numlevel="1" lineno="813" slineno="8-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="21-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this section, "received" means:<subsection ssid="21-null-3" dnum="i-o" numlevel="1" lineno="814" slineno="8-5" level="3" tab="1"><display>(i)</display>for a cash contribution, that the cash is given to a school board office candidate or <ln numlevel="1" lineno="815" slineno="8-6"/>a member of the school board office candidate's personal campaign committee;</subsection><subsection ssid="21-null-4" dnum="ii-o" numlevel="1" lineno="816" slineno="8-7" level="3" tab="1"><display>(ii)</display>for a contribution that is a check or other negotiable instrument, that the check or <ln numlevel="1" lineno="817" slineno="8-8"/>other negotiable instrument is negotiated;</subsection><subsection ssid="21-null-5" dnum="iii-o" numlevel="1" lineno="818" slineno="8-9" level="3" tab="1"><display>(iii)</display>for a direct deposit made into a campaign account by a person not associated <ln numlevel="1" lineno="819" slineno="8-10"/>with the campaign, the earlier of:<subsection ssid="21-null-6" dnum="A-o" numlevel="1" lineno="820" slineno="8-11" level="4"><display>(A)</display>the day on which the school board office candidate or a member of the school <ln numlevel="1" lineno="821" slineno="8-12"/>board office candidate's personal campaign committee becomes aware of the <ln numlevel="1" lineno="822" slineno="8-13"/>deposit and the source of the deposit;</subsection><subsection ssid="21-null-7" dnum="B-o" numlevel="1" lineno="823" slineno="8-14" level="4"><display>(B)</display>the day on which the school board office candidate or a member of the school <ln numlevel="1" lineno="824" slineno="8-15"/>board office candidate's personal campaign committee receives notice of the <ln numlevel="1" lineno="825" slineno="8-16"/>deposit and the source of the deposit by mail, email, text, or similar means; or</subsection><subsection ssid="21-null-8" dnum="C-o" numlevel="1" lineno="826" slineno="8-17" level="4"><display>(C)</display>31 calendar days after the day on which the direct deposit occurs; or</subsection></subsection><subsection ssid="21-null-9" dnum="iv-o" numlevel="1" lineno="827" slineno="8-18" level="3" tab="1"><display>(iv)</display>for any other type of contribution, that any portion of the contribution's benefit <ln numlevel="1" lineno="828" slineno="8-19"/>inures to the school board office candidate.</subsection></subsection><subsection ssid="21-null-10" dnum="b-o" numlevel="1" lineno="829" slineno="8-20" level="2"><display>(b)</display>As used in this Subsection <xref depth="4" refnumber="20A-11-1303(1)" start="0">(1)</xref>, "campaign account" means a separate campaign <ln numlevel="1" lineno="830" slineno="8-21"/>account required under Subsection <xref depth="4" refnumber="20A-11-1301(1)(a)(i)" start="0">20A-11-1301(1)(a)(i)</xref> or <xref depth="4" refnumber="20A-11-1301(1)(c)(i)" start="0">(c)(i)</xref>.</subsection><subsection ssid="21-null-11" dnum="c-o" numlevel="1" lineno="831" slineno="8-22" level="2"><display>(c)</display>Except as provided in Subsection <xref refnumber="20A-11-1303(2)" depth="4">(2)</xref>, each school board office candidate shall file an <ln numlevel="1" lineno="832" slineno="8-23"/>interim report at the following times in any year in which the candidate has filed a <ln numlevel="1" lineno="833" slineno="8-24"/>declaration of candidacy for a public office:<subsection ssid="21-null-12" dnum="i-o" numlevel="1" lineno="834" slineno="8-25" level="3"><display>(i)</display>May 15;</subsection><subsection ssid="21-null-13" dnum="ii-o" numlevel="1" lineno="835" slineno="8-26" level="3"><display>(ii)</display>seven calendar days before the regular primary election date;</subsection><subsection ssid="21-null-14" dnum="iii-o" numlevel="1" lineno="836" slineno="8-27" level="3"><display>(iii)</display>September 30; and</subsection><subsection ssid="21-null-15" dnum="iv-o" numlevel="1" lineno="837" slineno="8-28" level="3"><display>(iv)</display>seven calendar days before the regular general election date.</subsection></subsection></subsection><subsection ssid="21-null-16" dnum="2-o" numlevel="1" lineno="838" slineno="8-29" level="1"><display>(2)</display>If a school board office candidate is a school board office candidate seeking <ln numlevel="1" lineno="839" slineno="8-30"/>appointment for a midterm vacancy, the school board office candidate:<subsection ssid="21-null-17" dnum="a-o" numlevel="1" lineno="840" slineno="8-31" level="2"><display>(a)</display>shall file an interim report:<subsection ssid="21-null-18" dnum="i-o:_-i" numlevel="1" lineno="841" slineno="8-32" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1385" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="end">for a vacancy described in Subsection 20A-1-504(1)(b)(ii)(A) or (B), no later <ln numlevel="1" lineno="842" slineno="8-33"/>than three business days before the day on which the Senate meets to consider the <ln numlevel="1" lineno="843" slineno="8-34"/>school board office candidate's nomination; or</amend><amendoutend style="2"/></subsection><subsection ssid="21-null-19" dnum="ii-o:_-i" numlevel="1" lineno="844" slineno="8-35" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1386" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="10" groupid="6" style="2" owner="jchristopherson" level="1" deltag="end">for a vacancy described in Subsection <xref depth="4" refnumber="20A-1-504(1)(b)(ii)(c)">20A-1-504(1)(b)(ii)(C)</xref>:</amend><amendoutend style="2"/><subsection ssid="21-null-20" dnum="A-o:_-i" numlevel="1" lineno="845" slineno="8-36" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1387" style="2" owner="o" level="1" deltag="start">(A)</amend></display><amend anum="0" ea="erase" pairid="6" groupid="3" style="2" owner="jchristopherson" level="1" deltag="end">no later than three business days before the day on which the political party <ln numlevel="1" lineno="846" slineno="8-37"/>of the party for which the school board office candidate seeks nomination <ln numlevel="1" lineno="847" slineno="8-38"/>meets to declare a nominee for the governor to appoint; or</amend><amendoutend style="2"/></subsection><subsection ssid="21-null-21" dnum="B-o:_-i" numlevel="1" lineno="848" slineno="8-39" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1388" style="2" owner="o" level="1" deltag="start">(B)</amend></display><amend anum="0" ea="erase" pairid="9" groupid="5" style="2" owner="jchristopherson" level="1" deltag="end">if the school board office candidate decides to seek the appointment with less <ln numlevel="1" lineno="849" slineno="8-40"/>than three business days before the day on which the political party meets, or <ln numlevel="1" lineno="850" slineno="8-41"/>the political party schedules the meeting to declare a nominee less than three <ln numlevel="1" lineno="851" slineno="8-42"/>business days before the day of the meeting, no later than 5 p.m. on the last day <ln numlevel="1" lineno="852" slineno="8-43"/>of business before the day on which the political party meets; and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="21-48" dnum="_-o:i-i" numlevel="1" lineno="853" slineno="8-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1389" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">no later than three business days before the day on which the political party of the <ln numlevel="1" lineno="854" slineno="8-45"/>party for which the school board office candidate seeks nomination meets to <ln numlevel="1" lineno="855" slineno="8-46"/>declare a nominee for the governor to appoint in accordance with Subsection <xref depth="4" refnumber="20A-1-504(1)(b)"><ln numlevel="1" lineno="856" slineno="8-47"/>20A-1-504(1)(b)</xref>; or</amend></subsection><subsection ssid="21-47" dnum="_-o:ii-i" numlevel="1" lineno="857" slineno="8-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1390" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">if the school board office candidate decides to seek the appointment with less <ln numlevel="1" lineno="858" slineno="8-49"/>than three business days before the day described in Subsection <xref depth="4" refnumber="20A-11-1303(2)(a)(i)">(2)(a)(i)</xref>, or the <ln numlevel="1" lineno="859" slineno="8-50"/>political party schedules the meeting described in Subsection <xref depth="4" refnumber="20A-11-1303(2)(a)(i)">(2)(a)(i)</xref> less than <ln numlevel="1" lineno="860" slineno="8-51"/>three business days before the day of the meeting, no later than 5 p.m. on the last <ln numlevel="1" lineno="861" slineno="8-52"/>day of business before the day on which the political party meets; and</amend></subsection></subsection><subsection ssid="21-null-22" dnum="b-o" numlevel="1" lineno="862" slineno="8-53" level="2"><display>(b)</display>is not required to file an interim report at the times described in Subsection <xref refnumber="20A-11-1303(1)(c)" depth="4">(1)(c)</xref>.</subsection></subsection><subsection ssid="21-null-23" dnum="3-o" numlevel="1" lineno="863" slineno="8-54" level="1"><display>(3)</display>Each interim report shall include the following information:<subsection ssid="21-null-24" dnum="a-o" numlevel="1" lineno="864" slineno="8-55" level="2"><display>(a)</display>the net balance of the last summary report, if any;</subsection><subsection ssid="21-null-25" dnum="b-o" numlevel="1" lineno="865" slineno="8-56" level="2"><display>(b)</display>a single figure equal to the total amount of receipts reported on all prior interim <ln numlevel="1" lineno="866" slineno="8-57"/>reports, if any, during the calendar year in which the interim report is due;</subsection><subsection ssid="21-null-26" dnum="c-o" numlevel="1" lineno="867" slineno="8-58" level="2"><display>(c)</display>a single figure equal to the total amount of expenditures reported on all prior interim <ln numlevel="1" lineno="868" slineno="8-59"/>reports, if any, filed during the calendar year in which the interim report is due;</subsection><subsection ssid="21-null-27" dnum="d-o" numlevel="1" lineno="869" slineno="8-60" level="2"><display>(d)</display>a detailed listing of:<subsection ssid="21-null-28" dnum="i-o" numlevel="1" lineno="870" slineno="8-61" level="3"><display>(i)</display>for a school board office candidate, each contribution received since the last <ln numlevel="1" lineno="871" slineno="8-62"/>summary report that has not been reported in detail on a prior interim report; or</subsection><subsection ssid="21-null-29" dnum="ii-o" numlevel="1" lineno="872" slineno="8-63" level="3"><display>(ii)</display>for a school board officeholder, each contribution and public service assistance <ln numlevel="1" lineno="873" slineno="8-64"/>received since the last summary report that has not been reported in detail on a <ln numlevel="1" lineno="874" slineno="8-65"/>prior interim report;</subsection></subsection><subsection ssid="21-null-30" dnum="e-o" numlevel="1" lineno="875" slineno="8-66" level="2"><display>(e)</display>for each nonmonetary contribution:<subsection ssid="21-null-31" dnum="i-o" numlevel="1" lineno="876" slineno="8-67" level="3"><display>(i)</display>the fair market value of the contribution with that information provided by the <ln numlevel="1" lineno="877" slineno="8-68"/>contributor; and</subsection><subsection ssid="21-null-32" dnum="ii-o" numlevel="1" lineno="878" slineno="8-69" level="3"><display>(ii)</display>a specific description of the contribution;</subsection></subsection><subsection ssid="21-null-33" dnum="f-o" numlevel="1" lineno="879" slineno="8-70" level="2"><display>(f)</display>a detailed listing of each expenditure made since the last summary report that has not <ln numlevel="1" lineno="880" slineno="8-71"/>been reported in detail on a prior interim report;</subsection><subsection ssid="21-null-34" dnum="g-o" numlevel="1" lineno="881" slineno="8-72" level="2"><display>(g)</display>for each nonmonetary expenditure, the fair market value of the expenditure;</subsection><subsection ssid="21-null-35" dnum="h-o" numlevel="1" lineno="882" slineno="8-73" level="2"><display>(h)</display>a net balance for the year consisting of the net balance from the last summary report, <ln numlevel="1" lineno="883" slineno="8-74"/>if any, plus all receipts since the last summary report minus all expenditures since the <ln numlevel="1" lineno="884" slineno="8-75"/>last summary report;</subsection><subsection ssid="21-null-36" dnum="i-o" numlevel="1" lineno="885" slineno="8-76" level="2"><display>(i)</display>a summary page in the form required by the lieutenant governor that identifies:<subsection ssid="21-null-37" dnum="i-o" numlevel="1" lineno="886" slineno="8-77" level="3"><display>(i)</display>beginning balance;</subsection><subsection ssid="21-null-38" dnum="ii-o" numlevel="1" lineno="887" slineno="8-78" level="3"><display>(ii)</display>total contributions during the period since the last statement;</subsection><subsection ssid="21-null-39" dnum="iii-o" numlevel="1" lineno="888" slineno="8-79" level="3"><display>(iii)</display>total contributions to date;</subsection><subsection ssid="21-null-40" dnum="iv-o" numlevel="1" lineno="889" slineno="8-80" level="3"><display>(iv)</display>total expenditures during the period since the last statement; and</subsection><subsection ssid="21-null-41" dnum="v-o" numlevel="1" lineno="890" slineno="8-81" level="3"><display>(v)</display>total expenditures to date; and</subsection></subsection><subsection ssid="21-null-42" dnum="j-o" numlevel="1" lineno="891" slineno="8-82" level="2"><display>(j)</display>the name of a political action committee for which the school board office candidate <ln numlevel="1" lineno="892" slineno="8-83"/>or school board officeholder is designated as an officer who has primary <ln numlevel="1" lineno="893" slineno="8-84"/>decision-making authority under Section <xref depth="3" refnumber="20A-11-601" start="0">20A-11-601</xref>.</subsection></subsection><subsection ssid="21-null-43" dnum="4-o" numlevel="1" lineno="894" slineno="8-85" level="1" space="false"><display>(4)</display><subsection ssid="21-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In preparing each interim report, all receipts and expenditures shall be reported as <ln numlevel="1" lineno="895" slineno="8-86"/>of five calendar days before the required filing date of the report.</subsection><subsection ssid="21-null-45" dnum="b-o" numlevel="1" lineno="896" slineno="8-87" level="2"><display>(b)</display>Any negotiable instrument or check received by a school board office candidate or <ln numlevel="1" lineno="897" slineno="8-88"/>school board officeholder more than five calendar days before the required filing date <ln numlevel="1" lineno="898" slineno="8-89"/>of a report required by this section shall be included in the interim report.</subsection></subsection></section></bsec><bsec buid="39" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="899" slineno="9-1" sn="9"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="899">Section 9.  <bold>Effective Date.</bold></secline><sectionText lineno="900"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-17-26 1:04 PM</tm></rev></foot></leg>
