Public education code definitions.</bold></catline><sectionText lineno="38"><tab/>Unless otherwise indicated, as used in this title, <xref depth="0" refnumber="53F" start="0">Title 53F, Public Education System -- <ln numlevel="1" lineno="39" slineno="1-4"/>Funding</xref>, and <xref depth="0" refnumber="53G" start="0">Title 53G, Public Education System -- Local Administration</xref>:</sectionText><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="40" slineno="1-5" level="1"><display>(1)</display>"Bullying" means the same as that term is defined in Section <xref depth="3" refnumber="53G-9-601">53G-9-601</xref>.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="41" slineno="1-6" level="1"><display>(2)</display>"Charter agreement" means an agreement made in accordance with Section <xref depth="3" refnumber="53G-5-303" start="0">53G-5-303</xref> <ln numlevel="1" lineno="42" slineno="1-7"/>that authorizes the operation of a charter school.</subsection><subsection ssid="3-null-3" dnum="3-o" numlevel="1" lineno="43" slineno="1-8" level="1"><display>(3)</display>"Charter school governing board" means the board that governs a charter school.</subsection><subsection ssid="3-null-4" dnum="4-o" numlevel="1" lineno="44" slineno="1-9" level="1"><display>(4)</display>"District school" means a public school under the control of a local school board.</subsection><subsection ssid="3-45" dnum="_-o:5-i" numlevel="1" lineno="45" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">"Dyslexia" means a specific learning disability:</amend><subsection ssid="3-52" dnum="_-o:a-i" numlevel="1" lineno="46" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">characterized by cognitive strengths in higher-level cognitive functions, including:</amend><subsection ssid="3-55" dnum="_-o:i-i" numlevel="1" lineno="47" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="121" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">reasoning;</amend></subsection><subsection ssid="3-56" dnum="_-o:ii-i" numlevel="1" lineno="48" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="124" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="end">critical thinking;</amend></subsection><subsection ssid="3-57" dnum="_-o:iii-i" numlevel="1" lineno="49" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="127" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">complex problem solving;</amend></subsection><subsection ssid="3-58" dnum="_-o:iv-i" numlevel="1" lineno="50" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">visualization; and</amend></subsection><subsection ssid="3-59" dnum="_-o:v-i" numlevel="1" lineno="51" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="133" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">persistent difficulties with accurate or fluent word recognition, spelling, and <ln numlevel="1" lineno="52" slineno="1-17"/>decoding abilities;</amend></subsection></subsection><subsection ssid="3-46" dnum="_-o:b-i" numlevel="1" lineno="53" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">characterized by difficulties in word reading or spelling, or both, involving accuracy, <ln numlevel="1" lineno="54" slineno="1-19"/>speed, or a combination of accuracy and speed, that vary depending on the <ln numlevel="1" lineno="55" slineno="1-20"/>orthography;</amend></subsection><subsection ssid="3-47" dnum="_-o:c-i" numlevel="1" lineno="56" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">that exists along a continuum of severity and persists despite instruction that is <ln numlevel="1" lineno="57" slineno="1-22"/>effective for an individual's peers;</amend></subsection><subsection ssid="3-48" dnum="_-o:d-i" numlevel="1" lineno="58" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">that has complex causes involving interacting genetic, neurobiological, and <ln numlevel="1" lineno="59" slineno="1-24"/>environmental influences across development;</amend></subsection><subsection ssid="3-49" dnum="_-o:e-i" numlevel="1" lineno="60" slineno="1-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">for which difficulties with phonological or morphological processing are common <ln numlevel="1" lineno="61" slineno="1-26"/>but not universal and early oral language weaknesses often precede later literacy <ln numlevel="1" lineno="62" slineno="1-27"/>challenges;</amend></subsection><subsection ssid="3-50" dnum="_-o:f-i" numlevel="1" lineno="63" slineno="1-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">that may result in secondary consequences, including difficulties with reading <ln numlevel="1" lineno="64" slineno="1-29"/>comprehension and reduced reading and writing experience that may impede the <ln numlevel="1" lineno="65" slineno="1-30"/>development of language, knowledge, written expression, and overall academic <ln numlevel="1" lineno="66" slineno="1-31"/>achievement and may affect psychological well-being and employment opportunities; <ln numlevel="1" lineno="67" slineno="1-32"/>and</amend></subsection><subsection ssid="3-51" dnum="_-o:g-i" numlevel="1" lineno="68" slineno="1-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">that is identifiable at any age, although language and literacy support provided before <ln numlevel="1" lineno="69" slineno="1-34"/>and during the early years of education is particularly effective.</amend></subsection></subsection><subsection ssid="3-null-5" dnum="5-o:6-i" numlevel="1" lineno="70" slineno="1-35" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>"Individualized education program" or "IEP" means a written statement for a <ln numlevel="1" lineno="71" slineno="1-36"/>student with a disability that is developed, reviewed, and revised in accordance with the <ln numlevel="1" lineno="72" slineno="1-37"/>Individuals with Disabilities Education Act, 20 U.S.C. Sec. 1400 et seq.</subsection><subsection ssid="3-null-6" dnum="6-o:7-i" numlevel="1" lineno="73" slineno="1-38" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1018" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>"LEA governing board" means:<subsection ssid="3-null-7" dnum="a-o" numlevel="1" lineno="74" slineno="1-39" level="2"><display>(a)</display>for a school district, the local school board;</subsection><subsection ssid="3-null-8" dnum="b-o" numlevel="1" lineno="75" slineno="1-40" level="2"><display>(b)</display>for a charter school, the charter school governing board; or</subsection><subsection ssid="3-null-9" dnum="c-o" numlevel="1" lineno="76" slineno="1-41" level="2"><display>(c)</display>for the Utah Schools for the Deaf and the Blind, the state board.</subsection></subsection><subsection ssid="3-null-10" dnum="7-o:8-i" numlevel="1" lineno="77" slineno="1-42" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>"Local education agency" or "LEA" means:<subsection ssid="3-null-11" dnum="a-o" numlevel="1" lineno="78" slineno="1-43" level="2"><display>(a)</display>a school district;</subsection><subsection ssid="3-null-12" dnum="b-o" numlevel="1" lineno="79" slineno="1-44" level="2"><display>(b)</display>a charter school; or</subsection><subsection ssid="3-null-13" dnum="c-o" numlevel="1" lineno="80" slineno="1-45" level="2"><display>(c)</display>the Utah Schools for the Deaf and the Blind.</subsection></subsection><subsection ssid="3-null-14" dnum="8-o:9-i" numlevel="1" lineno="81" slineno="1-46" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1026" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>"Local school board" means a board elected under <xref depth="2" refnumber="20A-14-2" start="0">Title 20A, Chapter 14, Part 2, <ln numlevel="1" lineno="82" slineno="1-47"/>Election of Members of Local Boards of Education</xref>.</subsection><subsection ssid="3-null-15" dnum="9-o:10-i" numlevel="1" lineno="83" slineno="1-48" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1027" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>"Minimum School Program" means the same as that term is defined in Section <xref depth="3" refnumber="53F-2-102" start="0"><ln numlevel="1" lineno="84" slineno="1-49"/>53F-2-102</xref>.</subsection><subsection ssid="3-null-16" dnum="10-o:11-i" numlevel="1" lineno="85" slineno="1-50" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1028" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display>"Parent" means a parent or legal guardian.</subsection><subsection ssid="3-null-17" dnum="11-o:12-i" numlevel="1" lineno="86" slineno="1-51" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display>"Public education code" means:<subsection ssid="3-null-18" dnum="a-o" numlevel="1" lineno="87" slineno="1-52" level="2"><display>(a)</display>this title;</subsection><subsection ssid="3-null-19" dnum="b-o" numlevel="1" lineno="88" slineno="1-53" level="2"><display>(b)</display><xref depth="0" refnumber="53F" start="0">Title 53F, Public Education System -- Funding</xref>; or</amend></subsection><subsection ssid="3-63" dnum="_-o:ii-i" numlevel="1" lineno="93" slineno="1-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="end">a multistate license as that term is defined in Section <xref depth="3" refnumber="58-31e-102">58-31e-102</xref>; and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-null-8" dnum="ii-o:_-i" numlevel="1" lineno="229" slineno="3-24" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1102" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="14" groupid="10" style="2" owner="jchristopherson" level="1" deltag="end">typically results from a deficit in the phonological component of language that is <ln numlevel="1" lineno="230" slineno="3-25"/>often unexpected in relation to other cognitive abilities and the provision of <ln numlevel="1" lineno="231" slineno="3-26"/>effective classroom instruction.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-null-9" dnum="d-o" numlevel="1" lineno="232" slineno="3-27" level="2"><display>(d)</display>"Evidence-based" means the same as that term is defined in Section <xref depth="3" refnumber="53G-11-303">53G-11-303</xref>.</subsection><subsection ssid="1-null-10" dnum="e-o" numlevel="1" lineno="233" slineno="3-28" level="2"><display>(e)</display>"Evidence-informed" means the same as that term is defined in Section <xref depth="3" refnumber="53G-11-303">53G-11-303</xref>.</subsection><subsection ssid="1-28" dnum="_-o:f-i" numlevel="1" lineno="234" slineno="3-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1105" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">"Screening" means the use of evidence-based measures to identify whether a student <ln numlevel="1" lineno="235" slineno="3-30"/>may:</amend><subsection ssid="1-34" dnum="_-o:i-i" numlevel="1" lineno="236" slineno="3-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">be at risk for characteristics of dyslexia; and</amend></subsection><subsection ssid="1-35" dnum="_-o:ii-i" numlevel="1" lineno="237" slineno="3-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">need additional assessment, progress monitoring, and intervention related to <ln numlevel="1" lineno="238" slineno="3-33"/>dyslexia.</amend></subsection></subsection></subsection><subsection ssid="1-null-11" dnum="2-o" numlevel="1" lineno="239" slineno="3-34" level="1"><display>(2)</display>The state board shall approve a benchmark assessment for use statewide by school <ln numlevel="1" lineno="240" slineno="3-35"/>districts and charter schools to assess the reading competency of students in grades 1 <ln numlevel="1" lineno="241" slineno="3-36"/>through 6 as provided by this section.</subsection><subsection ssid="1-null-12" dnum="3-o" numlevel="1" lineno="242" slineno="3-37" level="1"><display>(3)</display>A school district or charter school shall:<subsection ssid="1-null-13" dnum="a-o" numlevel="1" lineno="243" slineno="3-38" level="2"><display>(a)</display>administer benchmark assessments to students in grades 1, 2, and 3 at the beginning, <ln numlevel="1" lineno="244" slineno="3-39"/>middle, and end of the school year using the benchmark assessment approved by the <ln numlevel="1" lineno="245" slineno="3-40"/>state board; and</subsection><subsection ssid="1-null-14" dnum="b-o" numlevel="1" lineno="246" slineno="3-41" level="2"><display>(b)</display>after administering a benchmark assessment, report the results to a student's parent.</subsection></subsection><subsection ssid="1-null-15" dnum="4-o" numlevel="1" lineno="247" slineno="3-42" level="1" space="false"><display>(4)</display><subsection ssid="1-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a benchmark assessment or supplemental reading assessment indicates a student <ln numlevel="1" lineno="248" slineno="3-43"/>lacks competency in a reading skill, is demonstrating characteristics of dyslexia, or is <ln numlevel="1" lineno="249" slineno="3-44"/>lagging behind other students in the student's grade in acquiring a reading skill, the <ln numlevel="1" lineno="250" slineno="3-45"/>school district or charter school shall:<subsection ssid="1-null-17" dnum="i-o" numlevel="1" lineno="251" slineno="3-46" level="3" tab="1"><display>(i)</display>administer diagnostic assessments to the student;</subsection><subsection ssid="1-null-18" dnum="ii-o" numlevel="1" lineno="252" slineno="3-47" level="3" tab="1"><display>(ii)</display>using data from the diagnostic assessment, provide specific, focused, and <ln numlevel="1" lineno="253" slineno="3-48"/>individualized intervention or tutoring to develop the reading skill;</subsection><subsection ssid="1-null-19" dnum="iii-o" numlevel="1" lineno="254" slineno="3-49" level="3" tab="1"><display>(iii)</display>administer formative assessments and progress monitoring at recommended <ln numlevel="1" lineno="255" slineno="3-50"/>levels for the benchmark assessment to measure the success of the focused <ln numlevel="1" lineno="256" slineno="3-51"/>intervention;</subsection><subsection ssid="1-null-20" dnum="iv-o" numlevel="1" lineno="257" slineno="3-52" level="3" tab="1"><display>(iv)</display>inform the student's parent of activities that the parent may engage in with the <ln numlevel="1" lineno="258" slineno="3-53"/>student to assist the student in improving reading proficiency;</subsection><subsection ssid="1-null-21" dnum="v-o" numlevel="1" lineno="259" slineno="3-54" level="3" tab="1"><display>(v)</display>provide information to the parent regarding appropriate interventions available to <ln numlevel="1" lineno="260" slineno="3-55"/>the student outside of the regular school day that may include tutoring, before and <ln numlevel="1" lineno="261" slineno="3-56"/>after school programs, or summer school; and</subsection><subsection ssid="1-null-22" dnum="vi-o" numlevel="1" lineno="262" slineno="3-57" level="3" tab="1"><display>(vi)</display>provide instructional materials that are evidence-informed for core instruction <ln numlevel="1" lineno="263" slineno="3-58"/>and evidence-based for intervention and supplemental instruction.</subsection></subsection><subsection ssid="1-null-23" dnum="b-o" numlevel="1" lineno="264" slineno="3-59" level="2"><display>(b)</display>Nothing in this section or in Section <xref depth="3" refnumber="53F-4-203">53F-4-203</xref> or <xref depth="3" refnumber="53G-11-303">53G-11-303</xref> requires a reading <ln numlevel="1" lineno="265" slineno="3-60"/>software product to demonstrate the statistically significant effect size described in <ln numlevel="1" lineno="266" slineno="3-61"/>Subsection <xref depth="4" refnumber="53G-11-303(1)(a)">53G-11-303(1)(a)</xref> in order to be used as an instructional material <ln numlevel="1" lineno="267" slineno="3-62"/>described in Subsection <xref depth="4" refnumber="53E-4-307(4)(a)(vi)">(4)(a)(vi)</xref>.</subsection></subsection><subsection ssid="1-null-24" dnum="5-o" numlevel="1" lineno="268" slineno="3-63" level="1" space="false"><display>(5)</display><subsection ssid="1-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with Section <xref depth="3" refnumber="53F-4-201">53F-4-201</xref> and except as provided in Subsection <xref depth="4" refnumber="53E-4-307(5)(b)">(5)(b)</xref>, <ln numlevel="1" lineno="269" slineno="3-64"/>the state board shall contract with one or more educational technology providers for a <ln numlevel="1" lineno="270" slineno="3-65"/>benchmark assessment system for reading for students in kindergarten through grade <ln numlevel="1" lineno="271" slineno="3-66"/>6.</subsection><subsection ssid="1-null-26" dnum="b-o" numlevel="1" lineno="272" slineno="3-67" level="2"><display>(b)</display>If revenue is insufficient for the benchmark assessment system for the grades <ln numlevel="1" lineno="273" slineno="3-68"/>described in Subsection <xref depth="4" refnumber="53E-4-307(5)(a)">(5)(a)</xref>, the state board shall first prioritize funding a <ln numlevel="1" lineno="274" slineno="3-69"/>benchmark assessment for students in kindergarten through grade 3.</subsection></subsection><subsection ssid="1-null-27" dnum="6-o" numlevel="1" lineno="275" slineno="3-70" level="1"><display>(6)</display>A student with dyslexia is only eligible for special education services if the student <ln numlevel="1" lineno="276" slineno="3-71"/>meets federal eligibility criteria.</subsection><subsection ssid="1-36" dnum="_-o:7-i" numlevel="1" lineno="277" slineno="3-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><subsection ssid="1-43" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">A school district or charter school may not discipline, retaliate against, or subject <ln numlevel="1" lineno="278" slineno="3-73"/>to adverse employment action an educational professional solely for recommending <ln numlevel="1" lineno="279" slineno="3-74"/>or referring a student for dyslexia screening, consistent with:</amend><subsection ssid="1-37" dnum="_-o:i-i" numlevel="1" lineno="280" slineno="3-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="end">the Individuals with Disabilities Education Act, 20 U.S.C. Section 1400 et seq.; or</amend></subsection><subsection ssid="1-38" dnum="_-o:ii-i" numlevel="1" lineno="281" slineno="3-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. and</amend></subsection><subsection ssid="5-39" dnum="_-o:B-i" numlevel="1" lineno="320" slineno="4-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="200" groupid="155" style="1" owner="jchristopherson" level="1" amendtag="end">pay other costs incurred under the program; or</amend></subsection></subsection><subsection ssid="5-45" dnum="_-o:ii-i" numlevel="1" lineno="321" slineno="4-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="245" groupid="189" style="1" owner="jchristopherson" level="1" amendtag="end">use the free dyslexia screener the University of Utah Education Policy Center and <ln numlevel="1" lineno="322" slineno="4-39"/>University of Utah College of Education develops in accordance with Subsection <xref depth="4" refnumber="53F-5-224(5)(a)"><ln numlevel="1" lineno="323" slineno="4-40"/>(5)(a)</xref>.</amend></subsection></subsection></subsection><subsection ssid="5-12" dnum="_-o:5-i" numlevel="1" lineno="324" slineno="4-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">The University of Utah Education Policy Center and the University of Utah College of <ln numlevel="1" lineno="325" slineno="4-42"/>Education shall:</amend><subsection ssid="5-26" dnum="_-o:a-i" numlevel="1" lineno="326" slineno="4-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="128" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="end">work with the state board and stakeholders to develop and maintain a dyslexia <ln numlevel="1" lineno="327" slineno="4-44"/>screening process a district or charter school may use in accordance with the <ln numlevel="1" lineno="328" slineno="4-45"/>requirements of this section;</amend></subsection><subsection ssid="5-27" dnum="_-o:b-i" numlevel="1" lineno="329" slineno="4-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="133" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="end">ensure that the screening process described in Subsection <xref depth="4" refnumber="53F-5-224(5)(a)">(5)(a)</xref>:</amend><subsection ssid="5-44" dnum="_-o:i-i" numlevel="1" lineno="330" slineno="4-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="228" groupid="177" style="1" owner="jchristopherson" level="1" amendtag="end">is free to use for district and charter schools participating in the program;</amend></subsection><subsection ssid="5-28" dnum="_-o:ii-i" numlevel="1" lineno="331" slineno="4-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1161" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="138" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="end">uses scientifically sound, evidence-based measures;</amend></subsection><subsection ssid="5-29" dnum="_-o:iii-i" numlevel="1" lineno="332" slineno="4-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1162" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="143" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="end">aligns with nationally recognized best practices for dyslexia screening; and</amend></subsection><subsection ssid="5-30" dnum="_-o:iv-i" numlevel="1" lineno="333" slineno="4-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1163" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="148" groupid="113" style="1" owner="jchristopherson" level="1" amendtag="end">identifies indicators of risk for dyslexia for the purpose of informing:</amend><subsection ssid="5-54" dnum="_-o:A-i" numlevel="1" lineno="334" slineno="4-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1164" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="283" groupid="218" style="1" owner="jchristopherson" level="1" amendtag="end">instruction;</amend></subsection><subsection ssid="5-55" dnum="_-o:B-i" numlevel="1" lineno="335" slineno="4-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1165" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="288" groupid="222" style="1" owner="jchristopherson" level="1" amendtag="end">interventions;</amend></subsection><subsection ssid="5-56" dnum="_-o:C-i" numlevel="1" lineno="336" slineno="4-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1166" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="293" groupid="226" style="1" owner="jchristopherson" level="1" amendtag="end">progress monitoring;</amend></subsection><subsection ssid="5-57" dnum="_-o:D-i" numlevel="1" lineno="337" slineno="4-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1167" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="298" groupid="230" style="1" owner="jchristopherson" level="1" amendtag="end">reporting; and</amend></subsection><subsection ssid="5-58" dnum="_-o:E-i" numlevel="1" lineno="338" slineno="4-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1168" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="303" groupid="234" style="1" owner="jchristopherson" level="1" amendtag="end">further evaluation;</amend></subsection></subsection></subsection><subsection ssid="5-59" dnum="_-o:c-i" numlevel="1" lineno="339" slineno="4-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1169" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="308" groupid="238" style="1" owner="jchristopherson" level="1" amendtag="end">recommend to the state board the data elements the district and charter schools <ln numlevel="1" lineno="340" slineno="4-57"/>participating in the program should collect and report;</amend></subsection><subsection ssid="5-60" dnum="_-o:d-i" numlevel="1" lineno="341" slineno="4-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1170" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="313" groupid="242" style="1" owner="jchristopherson" level="1" amendtag="end">evaluate the program screener's validity, reliability, and usefulness in:</amend><subsection ssid="5-61" dnum="_-o:i-i" numlevel="1" lineno="342" slineno="4-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1171" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="318" groupid="246" style="1" owner="jchristopherson" level="1" amendtag="end">identifying a student at risk for dyslexia; and</amend></subsection><subsection ssid="5-62" dnum="_-o:ii-i" numlevel="1" lineno="343" slineno="4-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1172" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="323" groupid="250" style="1" owner="jchristopherson" level="1" amendtag="end">informing instruction and interventions;</amend></subsection></subsection><subsection ssid="5-68" dnum="_-o:e-i" numlevel="1" lineno="344" slineno="4-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1173" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="365" groupid="282" style="1" owner="jchristopherson" level="1" amendtag="end">use the reports the state board requires under Subsection <xref depth="4" refnumber="53F-5-224(8)(b)">(8)(b)</xref> to annually evaluate <ln numlevel="1" lineno="345" slineno="4-62"/>the program; and</amend></subsection><subsection ssid="5-79" dnum="_-o:f-i" numlevel="1" lineno="346" slineno="4-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1174" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="418" groupid="322" style="1" owner="jchristopherson" level="1" amendtag="end">provide professional learning for educators on:</amend><subsection ssid="5-80" dnum="_-o:i-i" numlevel="1" lineno="347" slineno="4-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1175" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="423" groupid="326" style="1" owner="jchristopherson" level="1" amendtag="end">recognizing early indicators and characteristics of dyslexia;</amend></subsection><subsection ssid="5-81" dnum="_-o:ii-i" numlevel="1" lineno="348" slineno="4-65" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1176" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="428" groupid="330" style="1" owner="jchristopherson" level="1" amendtag="end">using screeners and progress monitoring tools;</amend></subsection><subsection ssid="5-82" dnum="_-o:iii-i" numlevel="1" lineno="349" slineno="4-66" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1177" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="433" groupid="334" style="1" owner="jchristopherson" level="1" amendtag="end">implementing evidence-based instruction and intervention practices; and</amend></subsection><subsection ssid="5-83" dnum="_-o:iv-i" numlevel="1" lineno="350" slineno="4-67" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1178" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="438" groupid="338" style="1" owner="jchristopherson" level="1" amendtag="end">communicating with families.</amend></subsection></subsection></subsection><subsection ssid="5-25" dnum="_-o:6-i" numlevel="1" lineno="351" slineno="4-68" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1179" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><subsection ssid="5-34" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1180" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="178" groupid="136" style="1" owner="jchristopherson" level="1" amendtag="end">A district or charter school shall use the state board approved list described in <ln numlevel="1" lineno="352" slineno="4-69"/>Subsection <xref depth="4" refnumber="53F-5-224(3)(c)">(3)(c)</xref> when screening a student for dyslexia.</amend></subsection><subsection ssid="5-35" dnum="_-o:b-i" numlevel="1" lineno="353" slineno="4-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1181" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="172" groupid="131" style="1" owner="jchristopherson" level="1" amendtag="end">A school district or charter school may use the dyslexia screening process the <ln numlevel="1" lineno="354" slineno="4-71"/>University of Utah Education Policy Center and the University of Utah College of <ln numlevel="1" lineno="355" slineno="4-72"/>Education develops under Subsection <xref depth="4" refnumber="53F-5-224(5)(a)">(5)(a)</xref>, at no cost, to satisfy the requirements of <ln numlevel="1" lineno="356" slineno="4-73"/>this section.</amend></subsection></subsection><subsection ssid="5-4" dnum="_-o:7-i" numlevel="1" lineno="357" slineno="4-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1182" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning July 1, 2027, a school district or charter school participating in the program:</amend><subsection ssid="5-5" dnum="_-o:a-i" numlevel="1" lineno="358" slineno="4-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1183" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">shall use the state board approved screener to screen a student for dyslexia who:</amend><subsection ssid="5-84" dnum="_-o:i-i" numlevel="1" lineno="359" slineno="4-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1184" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="444" groupid="343" style="1" owner="jchristopherson" level="1" amendtag="end">scores below or well below average on the benchmark assessments described in <ln numlevel="1" lineno="360" slineno="4-77"/>Section <xref depth="3" refnumber="53E-4-307">53E-4-307</xref>; and</amend></subsection><subsection ssid="5-6" dnum="_-o:ii-i" numlevel="1" lineno="361" slineno="4-78" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1185" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">is in kindergarten, first grade, or was not tested in kindergarten or first grade and <ln numlevel="1" lineno="362" slineno="4-79"/>is demonstrating characteristics of dyslexia in second or third grade;</amend></subsection></subsection><subsection ssid="5-64" dnum="_-o:b-i" numlevel="1" lineno="363" slineno="4-80" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1186" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="342" groupid="265" style="1" owner="jchristopherson" level="1" amendtag="end">shall provide additional screening to a student in kindergarten or first grade when <ln numlevel="1" lineno="364" slineno="4-81"/>screening data, teacher observation, or parent concern, indicates characteristics of <ln numlevel="1" lineno="365" slineno="4-82"/>dyslexia; and</amend></subsection><subsection ssid="5-31" dnum="_-o:c-i" numlevel="1" lineno="366" slineno="4-83" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1187" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="190" groupid="147" style="1" owner="jchristopherson" level="1" amendtag="end">may refer a student to a state board approved dyslexia screener for dyslexia screening.</amend></subsection></subsection><subsection ssid="5-13" dnum="_-o:8-i" numlevel="1" lineno="367" slineno="4-84" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1188" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="368" slineno="4-85"/>state board shall make rules to:</amend><subsection ssid="5-36" dnum="_-o:a-i" numlevel="1" lineno="369" slineno="4-86" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="212" groupid="165" style="1" owner="jchristopherson" level="1" amendtag="end">create an application process for a district or charter school to participate in the <ln numlevel="1" lineno="370" slineno="4-87"/>program;</amend></subsection><subsection ssid="5-41" dnum="_-o:b-i" numlevel="1" lineno="371" slineno="4-88" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="220" groupid="171" style="1" owner="jchristopherson" level="1" amendtag="end">create reporting requirements for a district or charter school participating in the <ln numlevel="1" lineno="372" slineno="4-89"/>program;</amend></subsection><subsection ssid="5-43" dnum="_-o:c-i" numlevel="1" lineno="373" slineno="4-90" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1191" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="226" groupid="175" style="1" owner="jchristopherson" level="1" amendtag="end">in accordance with Subsection <xref depth="4" refnumber="53F-5-224(7)(a)">(7)(a)</xref>, enforce required dyslexia screening under the <ln numlevel="1" lineno="374" slineno="4-91"/>program;</amend></subsection><subsection ssid="5-42" dnum="_-o:d-i" numlevel="1" lineno="375" slineno="4-92" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1192" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="227" groupid="176" style="1" owner="jchristopherson" level="1" amendtag="end">create a process for reviewing and criteria for approving dyslexia screeners;</amend></subsection><subsection ssid="5-70" dnum="_-o:e-i" numlevel="1" lineno="376" slineno="4-93" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1193" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="369" groupid="285" style="1" owner="jchristopherson" level="1" amendtag="end">identify the intervals for administering the dyslexia screener; and</amend></subsection><subsection ssid="5-71" dnum="_-o:f-i" numlevel="1" lineno="377" slineno="4-94" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1194" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="374" groupid="289" style="1" owner="jchristopherson" level="1" amendtag="end">maintain accessibility for the screener for district and charter schools.</amend></subsection></subsection><subsection ssid="5-14" dnum="_-o:9-i" numlevel="1" lineno="378" slineno="4-95" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1195" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">Upon request of the Education Interim Committee, a district or charter school that <ln numlevel="1" lineno="379" slineno="4-96"/>participates in the pilot program or the state board shall report to the Education Interim <ln numlevel="1" lineno="380" slineno="4-97"/>Committee on the program's progress and outcomes.</amend></subsection></section></bsec><bsec buid="7" num="63I-1-253" type="amend" src="code" uid="C63I-1-S253_2026070120260701" sort="63I01 02530020260701" numlevel="1" lineno="381" slineno="5-1" sn="5"><section number="63I-1-253" numlevel="1" lineno="382" slineno="5-2" type="amend"><secline lineno="381">Section 5.
