</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill enacts the Utah Real Estate Cybercrime Prevention Act.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">defines terms;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">makes failing to use the real estate transaction communication network (network) <ln numlevel="1" lineno="10" slineno="0-10"/>unprofessional conduct for employees of appraisal management companies, appraisers, <ln numlevel="1" lineno="11" slineno="0-11"/>escrow agents, mortgage lenders, mortgage loan originators, real estate sales agents, real <ln numlevel="1" lineno="12" slineno="0-12"/>estate brokers, title insurance licensees, and title insurers;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">makes violating a rule from the real estate transaction communication utility (utility) <ln numlevel="1" lineno="14" slineno="0-14"/>unprofessional conduct for appraisal management companies, appraisers, escrow agents, <ln numlevel="1" lineno="15" slineno="0-15"/>mortgage lenders, mortgage loan originators, real estate sales agents, real estate brokers, <ln numlevel="1" lineno="16" slineno="0-16"/>title insurance licensees, and title insurers;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">requires covered individuals to use the network to send covered communications related <ln numlevel="1" lineno="18" slineno="0-18"/>to real estate transactions;</hl><hl numlevel="1" lineno="19" slineno="0-19" level="1">creates the Real Estate Communication Commission (commission) within the Department <ln numlevel="1" lineno="20" slineno="0-20"/>of Commerce to oversee the network;</hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">assigns the commission duties such as selecting a utility and approving fee schedules;</hl><hl numlevel="1" lineno="22" slineno="0-22" level="1">grants the commission the power to issue or revoke a certificate of authority and <ln numlevel="1" lineno="23" slineno="0-23"/>recommend enforcement actions to other regulatory agencies;</hl><hl numlevel="1" lineno="24" slineno="0-24" level="1">mandates that any person operating a network obtain a certificate of authority from the <ln numlevel="1" lineno="25" slineno="0-25"/>commission;</hl><hl numlevel="1" lineno="26" slineno="0-26" level="1">requires the utility to submit all user eligibility rules and fee schedules to the commission <ln numlevel="1" lineno="27" slineno="0-27"/>for review and approval;</hl><hl numlevel="1" lineno="28" slineno="0-28" level="1">directs the commission to perform criminal background checks on individuals who own <ln numlevel="1" lineno="29" slineno="0-29"/>10% or more of the utility;</hl><hl numlevel="1" lineno="30" slineno="0-30" level="1">directs the commission to automatically revoke a certificate of authority if an owner fails <ln numlevel="1" lineno="31" slineno="0-31"/>to accurately disclose a criminal history involving fraud or deceit;</hl><hl numlevel="1" lineno="32" slineno="0-32" level="1">establishes that a certificate of authority expires after two years and outlines the specific <ln numlevel="1" lineno="33" slineno="0-33"/>requirements for renewal; and</hl><hl numlevel="1" lineno="34" slineno="0-34" level="1">defines unprofessional conduct as violating network rules or failing to use the network for <ln numlevel="1" lineno="35" slineno="0-35"/>covered communications.</hl></hp><moni numlevel="1" lineno="36" slineno="0-36" type="amend"><secline lineno="58">Section 1. Section <bold>31A-2-404</bold> is amended to read:</secline><catline lineno="59"><bold>31A-2-404<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Duties of the commissioner and Title and Escrow <ln numlevel="1" lineno="60" slineno="1-3"/>Commission.</bold></catline><subsection ssid="77-null-1" dnum="1-o" numlevel="1" lineno="61" slineno="1-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="77-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding the other provisions of this chapter, to the extent provided in this <ln numlevel="1" lineno="62" slineno="1-5"/>part, the commissioner shall administer and enforce the provisions in this title related <ln numlevel="1" lineno="63" slineno="1-6"/>to a title insurance matter.</subsection><subsection ssid="77-null-3" dnum="b-o" numlevel="1" lineno="64" slineno="1-7" level="2" space="false"><display>(b)</display><subsection ssid="77-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">The commissioner may impose a penalty:</amend><amendoutend style="2"/><subsection ssid="77-null-5" dnum="A-o:_-i" numlevel="1" lineno="65" slineno="1-8" ea="erase" anum="0" owner="jchristopherson" style="2" level="4" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1004" style="2" owner="o" level="1" deltag="start">(A)</amend></display><amend anum="0" ea="erase" pairid="13" groupid="10" style="2" owner="jchristopherson" level="1" deltag="end">under this title related to a title insurance matter;</amend><amendoutend style="2"/><subsection ssid="77-null-6" dnum="B-o:_-i" numlevel="1" lineno="68" slineno="1-11" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1005" style="2" owner="o" level="1" deltag="start">(B)</amend></display><amend anum="0" ea="erase" pairid="14" groupid="11" style="2" owner="jchristopherson" level="1" deltag="end">after investigation by the commissioner in accordance with <xref depth="2" refnumber="31A-2-3" start="2">Part 3, Procedures <ln numlevel="1" lineno="69" slineno="1-12"/>and Enforcement</xref>; and</amend><amendoutend style="2"/><subsection ssid="77-null-7" dnum="C-o:_-i" numlevel="1" lineno="70" slineno="1-13" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="start">(C)</amend></display><amend anum="0" ea="erase" pairid="17" groupid="14" style="2" owner="jchristopherson" level="1" deltag="end">that is enforced by the commissioner.</amend><amendoutend style="2"/></subsection></subsection><amend anum="0" ea="amend" pairid="20" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">If the commissioner makes <ln numlevel="1" lineno="66" slineno="1-9"/>a finding under Subsection <xref depth="4" refnumber="31A-2-404(b)(ii)">(b)(ii)</xref>, as part of an adjudicative proceeding under <ln numlevel="1" lineno="67" slineno="1-10"/>Title 63G, Chapter 4, Administrative Procedures Act, the commissioner may:</amend></subsection><subsection ssid="77-54" dnum="_-o:A-i" numlevel="1" lineno="71" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">revoke a license. a line of authority or certificate of authority;</amend></subsection><subsection ssid="77-56" dnum="_-o:B-i" numlevel="1" lineno="72" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">suspend for a specified period of 12 months or less a license, a line of <ln numlevel="1" lineno="73" slineno="1-16"/>authority or certificate of authority;</amend></subsection><subsection ssid="77-57" dnum="_-o:C-i" numlevel="1" lineno="74" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">limit in whole or in part a license, a line of authority or certificate of authority;</amend></subsection><subsection ssid="77-58" dnum="_-o:D-i" numlevel="1" lineno="75" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">deny an application for a license, a line of authority or certificate of authority;</amend></subsection><subsection ssid="77-59" dnum="_-o:E-i" numlevel="1" lineno="76" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">assess a forfeiture under Subsection <xref depth="3" refnumber="31A-2-308">31A-2-308</xref>; or</amend></subsection><subsection ssid="77-60" dnum="_-o:F-i" numlevel="1" lineno="77" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(F)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">take a combination of actions under Subsections <xref depth="4" refnumber="31A-2-404(b)(i)(a)">(b)(i)(A)</xref> through <xref depth="4" refnumber="31A-2-404(d)">(D)</xref> and <ln numlevel="1" lineno="78" slineno="1-21"/>Subsection <xref depth="4" refnumber="31A-2-404(b)(i)(e)">(b)(i)(E)</xref>.</amend></subsection></subsection><subsection ssid="77-61" dnum="_-o:ii-i" numlevel="1" lineno="79" slineno="1-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">The commissioner may take action set forth in Subsection <xref depth="4" refnumber="31A-2-404(b)(i)">(b)(i)</xref>:</amend><subsection ssid="77-62" dnum="_-o:A-i" numlevel="1" lineno="80" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">under this title related to a title insurance matter and under Section <xref depth="3" refnumber="61-7-401">61-7-401</xref>;</amend></subsection><subsection ssid="77-63" dnum="_-o:B-i" numlevel="1" lineno="81" slineno="1-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">after investigation by the commissioner in accordance with Part 3, Procedures <ln numlevel="1" lineno="82" slineno="1-25"/>and Enforcement; and</amend></subsection><subsection ssid="77-64" dnum="_-o:C-i" numlevel="1" lineno="83" slineno="1-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">that is enforced by the commissioner. </amend></subsection></subsection><subsection ssid="77-null-8" dnum="ii-o:iii-i" numlevel="1" lineno="84" slineno="1-27" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>The commissioner shall consult with and seek concurrence of the <ln numlevel="1" lineno="85" slineno="1-28"/>commission in a meeting subject to <xref depth="1" refnumber="52-4" start="0">Title 52, Chapter 4, Open and Public Meetings <ln numlevel="1" lineno="86" slineno="1-29"/>Act</xref>, regarding the imposition of a penalty, and if concurrence cannot be reached, <ln numlevel="1" lineno="87" slineno="1-30"/>the commissioner has final authority.</subsection></subsection><subsection ssid="77-null-9" dnum="c-o" numlevel="1" lineno="88" slineno="1-31" level="2" space="false"><display>(c)</display><subsection ssid="77-null-10" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Unless a provision of this title grants specific authority to the commission, the <ln numlevel="1" lineno="89" slineno="1-32"/>commissioner has authority over the implementation of this title related to a title <ln numlevel="1" lineno="90" slineno="1-33"/>insurance matter.  </subsection><subsection ssid="77-null-11" dnum="ii-o" numlevel="1" lineno="91" slineno="1-34" level="3"><display>(ii)</display>When a provision requires concurrence between the commission and <ln numlevel="1" lineno="92" slineno="1-35"/>commissioner, and concurrence cannot be reached, the commissioner has final <ln numlevel="1" lineno="93" slineno="1-36"/>authority.</subsection></subsection><subsection ssid="77-null-12" dnum="d-o" numlevel="1" lineno="94" slineno="1-37" level="2"><display>(d)</display>Except as provided in Subsection <xref depth="4" refnumber="31A-2-404(1)(e)" start="0">(1)(e)</xref>, when this title requires concurrence <ln numlevel="1" lineno="95" slineno="1-38"/>between the commissioner and commission related to a title insurance matter:<subsection ssid="77-null-13" dnum="i-o" numlevel="1" lineno="96" slineno="1-39" level="3"><display>(i)</display>the commissioner shall report to and update the commission on a regular basis <ln numlevel="1" lineno="97" slineno="1-40"/>related to that title insurance matter; and</subsection><subsection ssid="77-null-14" dnum="ii-o" numlevel="1" lineno="98" slineno="1-41" level="3"><display>(ii)</display>the commission shall review the report submitted by the commissioner under this <ln numlevel="1" lineno="99" slineno="1-42"/>Subsection <xref depth="4" refnumber="31A-2-404(1)(d)" start="0">(1)(d)</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/> <subsection ssid="77-null-15" dnum="A-o" numlevel="1" lineno="100" slineno="1-43" level="4"><display>(A)</display>concur with the report; or</subsection><subsection ssid="77-null-16" dnum="B-o" numlevel="1" lineno="101" slineno="1-44" level="4"><display>(B)</display>provide a reason for not concurring with the report and<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"> </amend>provide <ln numlevel="1" lineno="102" slineno="1-45"/>recommendations to the commissioner.</subsection></subsection></subsection><subsection ssid="77-null-17" dnum="e-o" numlevel="1" lineno="103" slineno="1-46" level="2"><display>(e)</display>When this title requires concurrence between the commissioner and commission <ln numlevel="1" lineno="104" slineno="1-47"/>under Subsection <xref depth="4" refnumber="31A-2-404(2)" start="0">(2)</xref>, <xref depth="4" refnumber="31A-2-404(3)" start="0">(3)</xref>, or <xref depth="4" refnumber="31A-2-404(4)" start="0">(4)</xref>:<subsection ssid="77-null-18" dnum="i-o" numlevel="1" lineno="105" slineno="1-48" level="3"><display>(i)</display>the commission shall report to and update the commissioner on a regular basis <ln numlevel="1" lineno="106" slineno="1-49"/>related to that title insurance matter; and</subsection><subsection ssid="77-null-19" dnum="ii-o" numlevel="1" lineno="107" slineno="1-50" level="3"><display>(ii)</display>the commissioner shall review a report submitted by the commission under this <ln numlevel="1" lineno="108" slineno="1-51"/>Subsection <xref depth="4" refnumber="31A-2-404(1)(e)" start="0">(1)(e)</xref> and concur with the report or:<subsection ssid="77-null-20" dnum="A-o" numlevel="1" lineno="109" slineno="1-52" level="4"><display>(A)</display>provide a reason for not concurring with the report; and</subsection><subsection ssid="77-null-21" dnum="B-o" numlevel="1" lineno="110" slineno="1-53" level="4"><display>(B)</display>provide recommendations to the commission.</subsection></subsection></subsection></subsection><subsection ssid="77-null-22" dnum="2-o" numlevel="1" lineno="111" slineno="1-54" level="1"><display>(2)</display>The commission shall:<subsection ssid="77-null-23" dnum="a-o" numlevel="1" lineno="112" slineno="1-55" level="2"><display>(a)</display>subject to Subsection <xref depth="4" refnumber="31A-2-404(4)" start="0">(4)</xref>, make rules for the administration of the provisions in this <ln numlevel="1" lineno="113" slineno="1-56"/>title related to title insurance matters including rules related to:<subsection ssid="77-null-24" dnum="i-o" numlevel="1" lineno="114" slineno="1-57" level="3"><display>(i)</display>rating standards and rating methods for a title licensee, as provided in Section <xref depth="3" refnumber="31A-19a-209" start="0"><ln numlevel="1" lineno="115" slineno="1-58"/>31A-19a-209</xref>;</subsection><subsection ssid="77-null-25" dnum="ii-o" numlevel="1" lineno="116" slineno="1-59" level="3"><display>(ii)</display>the licensing for a title licensee, including the licensing requirements of Section <xref depth="3" refnumber="31A-23a-204" start="0"><ln numlevel="1" lineno="117" slineno="1-60"/>31A-23a-204</xref>;</subsection><subsection ssid="77-null-26" dnum="iii-o" numlevel="1" lineno="118" slineno="1-61" level="3"><display>(iii)</display>continuing education requirements of Section <xref depth="3" refnumber="31A-23a-202" start="0">31A-23a-202</xref>; and</subsection><subsection ssid="77-null-27" dnum="iv-o" numlevel="1" lineno="119" slineno="1-62" level="3"><display>(iv)</display>standards of conduct for a title licensee;</subsection></subsection><subsection ssid="77-null-28" dnum="b-o" numlevel="1" lineno="120" slineno="1-63" level="2"><display>(b)</display>concur in the issuance and renewal of a license in accordance with Section <xref depth="3" refnumber="31A-23a-105" start="0"><ln numlevel="1" lineno="121" slineno="1-64"/>31A-23a-105</xref> or <xref depth="3" refnumber="31A-26-203" start="0">31A-26-203</xref>;</subsection><subsection ssid="77-null-29" dnum="c-o" numlevel="1" lineno="122" slineno="1-65" level="2"><display>(c)</display>with the concurrence of the commissioner, approve a continuing education program <ln numlevel="1" lineno="123" slineno="1-66"/>required by Section <xref depth="3" refnumber="31A-23a-202" start="0">31A-23a-202</xref>;</subsection><subsection ssid="77-null-30" dnum="d-o" numlevel="1" lineno="124" slineno="1-67" level="2"><display>(d)</display>on a regular basis advise the commissioner of the most critical matters affecting the <ln numlevel="1" lineno="125" slineno="1-68"/>title insurance industry and request the commissioner to direct the department's <ln numlevel="1" lineno="126" slineno="1-69"/>investigative resources to investigate and enforce those matters;</subsection><subsection ssid="77-null-31" dnum="e-o" numlevel="1" lineno="127" slineno="1-70" level="2"><display>(e)</display>in accordance with Section <xref depth="3" refnumber="31A-23a-204" start="0">31A-23a-204</xref>, participate in the annual license testing <ln numlevel="1" lineno="128" slineno="1-71"/>evaluation conducted by the commissioner's test administrator;</subsection><subsection ssid="77-null-32" dnum="f-o" numlevel="1" lineno="129" slineno="1-72" level="2"><display>(f)</display>advise the commissioner on matters affecting the commissioner's budget related to <ln numlevel="1" lineno="130" slineno="1-73"/>title insurance; and</subsection><subsection ssid="77-null-33" dnum="g-o" numlevel="1" lineno="131" slineno="1-74" level="2"><display>(g)</display>perform other duties as provided in this title.</subsection></subsection><subsection ssid="77-null-34" dnum="3-o" numlevel="1" lineno="132" slineno="1-75" level="1"><display>(3)</display>The commission may make rules establishing an examination for a license that will <ln numlevel="1" lineno="133" slineno="1-76"/>satisfy Section <xref depth="3" refnumber="31A-23a-204" start="0">31A-23a-204</xref>:<subsection ssid="77-null-35" dnum="a-o" numlevel="1" lineno="134" slineno="1-77" level="2"><display>(a)</display>after consultation with the commissioner's test administrator; and</subsection><subsection ssid="77-null-36" dnum="b-o" numlevel="1" lineno="135" slineno="1-78" level="2"><display>(b)</display>subject to Subsection <xref depth="4" refnumber="31A-2-404(4)" start="0">(4)</xref>.</subsection></subsection><subsection ssid="77-null-37" dnum="4-o" numlevel="1" lineno="136" slineno="1-79" level="1" space="false"><display>(4)</display><subsection ssid="77-null-38" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The commission may make a rule under this title only:<subsection ssid="77-null-39" dnum="i-o" numlevel="1" lineno="137" slineno="1-80" level="3" tab="1"><display>(i)</display>in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>;</subsection><subsection ssid="77-null-40" dnum="ii-o" numlevel="1" lineno="138" slineno="1-81" level="3" tab="1"><display>(ii)</display>with the concurrence of the commissioner, except that if concurrence cannot be <ln numlevel="1" lineno="139" slineno="1-82"/>reached, the commissioner has final authority; and</subsection><subsection ssid="77-null-41" dnum="iii-o" numlevel="1" lineno="140" slineno="1-83" level="3" tab="1"><display>(iii)</display>if at the time the commission files the commission's proposed rule and rule <ln numlevel="1" lineno="141" slineno="1-84"/>analysis with the Office of Administrative Rules in accordance with Section <xref depth="3" refnumber="63G-3-301" start="0"><ln numlevel="1" lineno="142" slineno="1-85"/>63G-3-301</xref>, the commission provides the Real Estate Commission that same <ln numlevel="1" lineno="143" slineno="1-86"/>information.</subsection></subsection><subsection ssid="77-null-42" dnum="b-o" numlevel="1" lineno="144" slineno="1-87" level="2"><display>(b)</display>The commission may not make a rule regarding adjudicative procedures.</subsection><subsection ssid="77-null-43" dnum="c-o" numlevel="1" lineno="145" slineno="1-88" level="2"><display>(c)</display>In accordance with Section <xref depth="3" refnumber="31A-2-201" start="0">31A-2-201</xref>, the commissioner may make rules regarding <ln numlevel="1" lineno="146" slineno="1-89"/>adjudicative procedures.</subsection></subsection><subsection ssid="77-null-44" dnum="5-o" numlevel="1" lineno="147" slineno="1-90" level="1" space="false"><display>(5)</display><subsection ssid="77-null-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The commissioner shall annually report the information described in Subsection <xref depth="4" refnumber="31A-2-404(5)(b)" start="0"><ln numlevel="1" lineno="148" slineno="1-91"/>(5)(b)</xref> in writing to the commission.</subsection><subsection ssid="77-null-46" dnum="b-o" numlevel="1" lineno="149" slineno="1-92" level="2"><display>(b)</display>The information required to be reported under this Subsection <xref depth="4" refnumber="31A-2-404(5)" start="0">(5)</xref>:<subsection ssid="77-null-47" dnum="i-o" numlevel="1" lineno="150" slineno="1-93" level="3"><display>(i)</display>may not identify a person; and</subsection><subsection ssid="77-null-48" dnum="ii-o" numlevel="1" lineno="151" slineno="1-94" level="3"><display>(ii)</display>shall include:<subsection ssid="77-null-49" dnum="A-o" numlevel="1" lineno="152" slineno="1-95" level="4"><display>(A)</display>the number of complaints the commissioner receives with regard to <ln numlevel="1" lineno="153" slineno="1-96"/>transactions involving title insurance or a title licensee during the calendar year <ln numlevel="1" lineno="154" slineno="1-97"/>immediately proceeding the report;</subsection><subsection ssid="77-null-50" dnum="B-o" numlevel="1" lineno="155" slineno="1-98" level="4"><display>(B)</display>the type of complaints described in Subsection <xref depth="4" refnumber="31A-2-404(5)(b)(ii)(A)" start="0">(5)(b)(ii)(A)</xref>; and</subsection><subsection ssid="77-null-51" dnum="C-o" numlevel="1" lineno="156" slineno="1-99" level="4"><display>(C)</display>for each complaint described in Subsection <xref depth="4" refnumber="31A-2-404(5)(b)(ii)(A)" start="0">(5)(b)(ii)(A)</xref>:<subsection ssid="77-null-52" dnum="I-o" numlevel="1" lineno="157" slineno="1-100" level="5"><display>(I)</display>any action taken by the commissioner with regard to the complaint; and</subsection><subsection ssid="77-null-53" dnum="II-o" numlevel="1" lineno="158" slineno="1-101" level="5"><display>(II)</display>the time-period beginning the day on which a complaint is made and <ln numlevel="1" lineno="159" slineno="1-102"/>ending the day on which the commissioner determines it will take no further <ln numlevel="1" lineno="160" slineno="1-103"/>action with regard to the complaint.</subsection></subsection></subsection></subsection></subsection></section></bsec><bsec buid="13" num="61-2c-301" type="amend" src="code" uid="C61-2c-S301_2028010120280101" sort="61 02c03010020280101" numlevel="1" lineno="161" slineno="2-1" sn="2"><section number="61-2c-301" numlevel="1" lineno="162" slineno="2-2" type="amend"><secline lineno="161">Section 2. Section <bold>61-2c-301</bold> is amended to read:</secline><catline lineno="162"><bold>61-2c-301<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>01/01/28</date></paren></parens>. Prohibited conduct -- Violations of the chapter.</bold></catline><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="163" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="13-null-2" dnum="a-o" numlevel="1" lineno="164" slineno="2-4" level="2"><display>(a)</display>"Prescreened trigger lead information" means information derived from a consumer <ln numlevel="1" lineno="165" slineno="2-5"/>report that is given to a third party that is not affiliated with the consumer.</subsection><subsection ssid="13-null-3" dnum="b-o" numlevel="1" lineno="166" slineno="2-6" level="2" space="false"><display>(b)</display><subsection ssid="13-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Solicitation" means contacting a consumer to market mortgage loan services.</subsection><subsection ssid="13-null-5" dnum="ii-o" numlevel="1" lineno="167" slineno="2-7" level="3"><display>(ii)</display>"Solicitation" includes:<subsection ssid="13-null-6" dnum="A-o" numlevel="1" lineno="168" slineno="2-8" level="4"><display>(A)</display>accepting or offering to accept a mortgage loan application;</subsection><subsection ssid="13-null-7" dnum="B-o" numlevel="1" lineno="169" slineno="2-9" level="4"><display>(B)</display>helping or offering to help process a mortgage loan application;</subsection><subsection ssid="13-null-8" dnum="C-o" numlevel="1" lineno="170" slineno="2-10" level="4"><display>(C)</display>soliciting or offering to solicit a mortgage loan for a third party; or</subsection><subsection ssid="13-null-9" dnum="D-o" numlevel="1" lineno="171" slineno="2-11" level="4"><display>(D)</display>negotiating or offering to negotiate the terms of a mortgage loan with a lender <ln numlevel="1" lineno="172" slineno="2-12"/>for a third party.</subsection></subsection></subsection></subsection><subsection ssid="13-null-10" dnum="2-o" numlevel="1" lineno="173" slineno="2-13" level="1"><display>(2)</display>A person, when transacting the business of residential mortgage loans in this state, may <ln numlevel="1" lineno="174" slineno="2-14"/>not:<subsection ssid="13-null-11" dnum="a-o" numlevel="1" lineno="175" slineno="2-15" level="2"><display>(a)</display>violate Section 8 of RESPA;</subsection><subsection ssid="13-null-12" dnum="b-o" numlevel="1" lineno="176" slineno="2-16" level="2"><display>(b)</display>charge a fee in connection with a residential mortgage loan transaction:<subsection ssid="13-null-13" dnum="i-o" numlevel="1" lineno="177" slineno="2-17" level="3"><display>(i)</display>that is excessive; or</subsection><subsection ssid="13-null-14" dnum="ii-o" numlevel="1" lineno="178" slineno="2-18" level="3"><display>(ii)</display>without providing to the loan applicant a written statement signed by the loan <ln numlevel="1" lineno="179" slineno="2-19"/>applicant:<subsection ssid="13-null-15" dnum="A-o" numlevel="1" lineno="180" slineno="2-20" level="4"><display>(A)</display>stating whether the fee or deposit is refundable; and</subsection><subsection ssid="13-null-16" dnum="B-o" numlevel="1" lineno="181" slineno="2-21" level="4"><display>(B)</display>describing the conditions, if any, under which all or a portion of the fee or <ln numlevel="1" lineno="182" slineno="2-22"/>deposit will be refunded to the loan applicant;</subsection></subsection></subsection><subsection ssid="13-null-17" dnum="c-o" numlevel="1" lineno="183" slineno="2-23" level="2"><display>(c)</display>act incompetently in the transaction of the business of residential mortgage loans <ln numlevel="1" lineno="184" slineno="2-24"/>resulting in the person failing to:<subsection ssid="13-null-18" dnum="i-o" numlevel="1" lineno="185" slineno="2-25" level="3"><display>(i)</display>safeguard the interests of the public; or</subsection><subsection ssid="13-null-19" dnum="ii-o" numlevel="1" lineno="186" slineno="2-26" level="3"><display>(ii)</display>conform to acceptable standards of the residential mortgage loan industry;</subsection></subsection><subsection ssid="13-null-20" dnum="d-o" numlevel="1" lineno="187" slineno="2-27" level="2"><display>(d)</display>do any of the following as part of a residential mortgage loan transaction, regardless <ln numlevel="1" lineno="188" slineno="2-28"/>of whether the residential mortgage loan closes:<subsection ssid="13-null-21" dnum="i-o" numlevel="1" lineno="189" slineno="2-29" level="3"><display>(i)</display>make a false statement or representation;</subsection><subsection ssid="13-null-22" dnum="ii-o" numlevel="1" lineno="190" slineno="2-30" level="3"><display>(ii)</display>cause false documents to be generated; or</subsection><subsection ssid="13-null-23" dnum="iii-o" numlevel="1" lineno="191" slineno="2-31" level="3"><display>(iii)</display>knowingly permit false information to be submitted by any party;</subsection></subsection><subsection ssid="13-null-24" dnum="e-o" numlevel="1" lineno="192" slineno="2-32" level="2"><display>(e)</display>give or receive compensation or anything of value, or withhold or threaten to <ln numlevel="1" lineno="193" slineno="2-33"/>withhold payment of an appraiser fee, to influence the independent judgment of an <ln numlevel="1" lineno="194" slineno="2-34"/>appraiser in reaching a value conclusion in a residential mortgage loan transaction, <ln numlevel="1" lineno="195" slineno="2-35"/>except that it is not a violation of this section for a licensee to withhold payment <ln numlevel="1" lineno="196" slineno="2-36"/>because of a bona fide dispute regarding a failure of the appraiser to comply with the <ln numlevel="1" lineno="197" slineno="2-37"/>licensing law or the Uniform Standards of Professional Appraisal Practice;</subsection><subsection ssid="13-null-25" dnum="f-o" numlevel="1" lineno="198" slineno="2-38" level="2"><display>(f)</display>violate or not comply with:<subsection ssid="13-null-26" dnum="i-o" numlevel="1" lineno="199" slineno="2-39" level="3"><display>(i)</display>this chapter;</subsection><subsection ssid="13-null-27" dnum="ii-o" numlevel="1" lineno="200" slineno="2-40" level="3"><display>(ii)</display>an order of the commission or division; or</subsection><subsection ssid="13-null-28" dnum="iii-o" numlevel="1" lineno="201" slineno="2-41" level="3"><display>(iii)</display>a rule made by the division;</subsection></subsection><subsection ssid="13-null-29" dnum="g-o" numlevel="1" lineno="202" slineno="2-42" level="2"><display>(g)</display>fail to respond within the required time period to:<subsection ssid="13-null-30" dnum="i-o" numlevel="1" lineno="203" slineno="2-43" level="3"><display>(i)</display>a notice or complaint of the division; or</subsection><subsection ssid="13-null-31" dnum="ii-o" numlevel="1" lineno="204" slineno="2-44" level="3"><display>(ii)</display>a request for information from the division;</subsection></subsection><subsection ssid="13-null-32" dnum="h-o" numlevel="1" lineno="205" slineno="2-45" level="2"><display>(h)</display>make false representations to the division, including in a licensure statement;</subsection><subsection ssid="13-null-33" dnum="i-o" numlevel="1" lineno="206" slineno="2-46" level="2"><display>(i)</display>engage in the business of residential mortgage loans with respect to the transaction if <ln numlevel="1" lineno="207" slineno="2-47"/>the person also acts in any of the following capacities with respect to the same <ln numlevel="1" lineno="208" slineno="2-48"/>residential mortgage loan transaction:<subsection ssid="13-null-34" dnum="i-o" numlevel="1" lineno="209" slineno="2-49" level="3"><display>(i)</display>appraiser;</subsection><subsection ssid="13-null-35" dnum="ii-o" numlevel="1" lineno="210" slineno="2-50" level="3"><display>(ii)</display>escrow agent;</subsection><subsection ssid="13-null-36" dnum="iii-o" numlevel="1" lineno="211" slineno="2-51" level="3"><display>(iii)</display>real estate agent;</subsection><subsection ssid="13-null-37" dnum="iv-o" numlevel="1" lineno="212" slineno="2-52" level="3"><display>(iv)</display>general contractor; or</subsection><subsection ssid="13-null-38" dnum="v-o" numlevel="1" lineno="213" slineno="2-53" level="3"><display>(v)</display>title insurance producer;</subsection></subsection><subsection ssid="13-null-39" dnum="j-o" numlevel="1" lineno="214" slineno="2-54" level="2"><display>(j)</display>engage in unprofessional conduct as defined by rule;</subsection><subsection ssid="13-null-40" dnum="k-o" numlevel="1" lineno="215" slineno="2-55" level="2"><display>(k)</display>engage in an act or omission in transacting the business of residential mortgage loans <ln numlevel="1" lineno="216" slineno="2-56"/>that constitutes dishonesty, fraud, or misrepresentation;</subsection><subsection ssid="13-null-41" dnum="l-o" numlevel="1" lineno="217" slineno="2-57" level="2"><display>(l)</display>engage in false or misleading advertising;</subsection><subsection ssid="13-null-42" dnum="m-o" numlevel="1" lineno="218" slineno="2-58" level="2" space="false"><display>(m)</display><subsection ssid="13-null-43" dnum="i-o" level="3" placement="sameline"><display>(i)</display>fail to account for money received in connection with a residential mortgage <ln numlevel="1" lineno="219" slineno="2-59"/>loan;</subsection><subsection ssid="13-null-44" dnum="ii-o" numlevel="1" lineno="220" slineno="2-60" level="3"><display>(ii)</display>use money for a different purpose from the purpose for which the money is <ln numlevel="1" lineno="221" slineno="2-61"/>received; or</subsection><subsection ssid="13-null-45" dnum="iii-o" numlevel="1" lineno="222" slineno="2-62" level="3"><display>(iii)</display>except as provided in Subsection <xref depth="4" refnumber="61-2c-301(5)">(5)</xref>, retain money paid for services if the <ln numlevel="1" lineno="223" slineno="2-63"/>services are not performed;</subsection></subsection><subsection ssid="13-null-46" dnum="n-o" numlevel="1" lineno="224" slineno="2-64" level="2"><display>(n)</display>fail to provide a prospective borrower a copy of each appraisal and any other written <ln numlevel="1" lineno="225" slineno="2-65"/>valuation developed in connection with an application for credit that is to be secured <ln numlevel="1" lineno="226" slineno="2-66"/>by a first lien on a dwelling in accordance with Subsection <xref depth="4" refnumber="61-2c-301(6)">(6)</xref>;</subsection><subsection ssid="13-null-47" dnum="o-o" numlevel="1" lineno="227" slineno="2-67" level="2"><display>(o)</display>engage in an act that is performed to:<subsection ssid="13-null-48" dnum="i-o" numlevel="1" lineno="228" slineno="2-68" level="3"><display>(i)</display>evade this chapter; or</subsection><subsection ssid="13-null-49" dnum="ii-o" numlevel="1" lineno="229" slineno="2-69" level="3"><display>(ii)</display>assist another person to evade this chapter;</subsection></subsection><subsection ssid="13-null-50" dnum="p-o" numlevel="1" lineno="230" slineno="2-70" level="2"><display>(p)</display>recommend or encourage default, delinquency, or continuation of an existing default <ln numlevel="1" lineno="231" slineno="2-71"/>or delinquency, by a mortgage applicant on an existing indebtedness before the <ln numlevel="1" lineno="232" slineno="2-72"/>closing of a residential mortgage loan that will refinance all or part of the <ln numlevel="1" lineno="233" slineno="2-73"/>indebtedness;</subsection><subsection ssid="13-null-51" dnum="q-o" numlevel="1" lineno="234" slineno="2-74" level="2"><display>(q)</display>in the case of the lending manager of an entity or a branch office of an entity, fail to <ln numlevel="1" lineno="235" slineno="2-75"/>exercise reasonable supervision over the activities of:<subsection ssid="13-null-52" dnum="i-o" numlevel="1" lineno="236" slineno="2-76" level="3"><display>(i)</display>unlicensed staff; or</subsection><subsection ssid="13-null-53" dnum="ii-o" numlevel="1" lineno="237" slineno="2-77" level="3"><display>(ii)</display>a mortgage loan originator who is affiliated with the lending manager;</subsection></subsection><subsection ssid="13-null-54" dnum="r-o" numlevel="1" lineno="238" slineno="2-78" level="2"><display>(r)</display>pay or offer to pay an individual who does not hold a license under this chapter for <ln numlevel="1" lineno="239" slineno="2-79"/>work that requires the individual to hold a license under this chapter;</subsection><subsection ssid="13-null-55" dnum="s-o" numlevel="1" lineno="240" slineno="2-80" level="2"><display>(s)</display>in the case of a dual licensed title licensee as defined in Section <xref depth="3" refnumber="31A-2-402">31A-2-402</xref>:<subsection ssid="13-null-56" dnum="i-o" numlevel="1" lineno="241" slineno="2-81" level="3"><display>(i)</display>provide a title insurance product or service without the approval required by <ln numlevel="1" lineno="242" slineno="2-82"/>Section <xref depth="3" refnumber="31A-2-405">31A-2-405</xref>; or</subsection><subsection ssid="13-null-57" dnum="ii-o" numlevel="1" lineno="243" slineno="2-83" level="3"><display>(ii)</display>knowingly provide false or misleading information in the statement required by <ln numlevel="1" lineno="244" slineno="2-84"/>Subsection <xref depth="3" refnumber="31A-2-405">31A-2-405</xref>(2);</subsection></subsection><subsection ssid="13-null-58" dnum="t-o" numlevel="1" lineno="245" slineno="2-85" level="2"><display>(t)</display>represent to the public that the person can or will perform any act of a mortgage loan <ln numlevel="1" lineno="246" slineno="2-86"/>originator if that person is not licensed under this chapter because the person is <ln numlevel="1" lineno="247" slineno="2-87"/>exempt under Subsection <xref depth="3" refnumber="61-2c-105">61-2c-105</xref>(4), including through:<subsection ssid="13-null-59" dnum="i-o" numlevel="1" lineno="248" slineno="2-88" level="3"><display>(i)</display>advertising;</subsection><subsection ssid="13-null-60" dnum="ii-o" numlevel="1" lineno="249" slineno="2-89" level="3"><display>(ii)</display>a business card;</subsection><subsection ssid="13-null-61" dnum="iii-o" numlevel="1" lineno="250" slineno="2-90" level="3"><display>(iii)</display>stationery;</subsection><subsection ssid="13-null-62" dnum="iv-o" numlevel="1" lineno="251" slineno="2-91" level="3"><display>(iv)</display>a brochure;</subsection><subsection ssid="13-null-63" dnum="v-o" numlevel="1" lineno="252" slineno="2-92" level="3"><display>(v)</display>a sign;</subsection><subsection ssid="13-null-64" dnum="vi-o" numlevel="1" lineno="253" slineno="2-93" level="3"><display>(vi)</display>a rate list; or</subsection><subsection ssid="13-null-65" dnum="vii-o" numlevel="1" lineno="254" slineno="2-94" level="3"><display>(vii)</display>other promotional item;</subsection></subsection><subsection ssid="13-null-66" dnum="u-o" numlevel="1" lineno="255" slineno="2-95" level="2" space="false"><display>(u)</display><subsection ssid="13-null-67" dnum="i-o" level="3" placement="sameline"><display>(i)</display>engage in an act of loan modification assistance without being licensed under <ln numlevel="1" lineno="256" slineno="2-96"/>this chapter;</subsection><subsection ssid="13-null-68" dnum="ii-o" numlevel="1" lineno="257" slineno="2-97" level="3"><display>(ii)</display>engage in an act of foreclosure rescue that requires licensure as a real estate agent <ln numlevel="1" lineno="258" slineno="2-98"/>or real estate broker under Chapter 2, Division of Real Estate, without being <ln numlevel="1" lineno="259" slineno="2-99"/>licensed under that chapter;</subsection><subsection ssid="13-null-69" dnum="iii-o" numlevel="1" lineno="260" slineno="2-100" level="3"><display>(iii)</display>engage in an act of loan modification assistance without entering into a written <ln numlevel="1" lineno="261" slineno="2-101"/>agreement specifying which one or more acts of loan modification assistance will <ln numlevel="1" lineno="262" slineno="2-102"/>be completed;</subsection><subsection ssid="13-null-70" dnum="iv-o" numlevel="1" lineno="263" slineno="2-103" level="3"><display>(iv)</display>request or require a person to pay a fee before obtaining:<subsection ssid="13-null-71" dnum="A-o" numlevel="1" lineno="264" slineno="2-104" level="4"><display>(A)</display>a written offer for a loan modification from the person's lender or servicer; and</subsection><subsection ssid="13-null-72" dnum="B-o" numlevel="1" lineno="265" slineno="2-105" level="4"><display>(B)</display>the person's written acceptance of the offer from the lender or servicer;</subsection></subsection><subsection ssid="13-null-73" dnum="v-o" numlevel="1" lineno="266" slineno="2-106" level="3"><display>(v)</display>induce a person seeking a loan modification to hire the licensee to engage in an <ln numlevel="1" lineno="267" slineno="2-107"/>act of loan modification assistance by:<subsection ssid="13-null-74" dnum="A-o" numlevel="1" lineno="268" slineno="2-108" level="4"><display>(A)</display>suggesting to the person that the licensee has a special relationship with the <ln numlevel="1" lineno="269" slineno="2-109"/>person's lender or loan servicer; or</subsection><subsection ssid="13-null-75" dnum="B-o" numlevel="1" lineno="270" slineno="2-110" level="4"><display>(B)</display>falsely representing or advertising that the licensee is acting on behalf of:<subsection ssid="13-null-76" dnum="I-o" numlevel="1" lineno="271" slineno="2-111" level="5"><display>(I)</display>a government agency;</subsection><subsection ssid="13-null-77" dnum="II-o" numlevel="1" lineno="272" slineno="2-112" level="5"><display>(II)</display>the person's lender or loan servicer; or</subsection><subsection ssid="13-null-78" dnum="III-o" numlevel="1" lineno="273" slineno="2-113" level="5"><display>(III)</display>a nonprofit or charitable institution;</subsection></subsection></subsection><subsection ssid="13-null-79" dnum="vi-o" numlevel="1" lineno="274" slineno="2-114" level="3"><display>(vi)</display>recommend or participate in a loan modification that requires a person to:<subsection ssid="13-null-80" dnum="A-o" numlevel="1" lineno="275" slineno="2-115" level="4"><display>(A)</display>transfer title to real property to the licensee or to a third-party with whom the <ln numlevel="1" lineno="276" slineno="2-116"/>licensee has a business relationship or financial interest;</subsection><subsection ssid="13-null-81" dnum="B-o" numlevel="1" lineno="277" slineno="2-117" level="4"><display>(B)</display>make a mortgage payment to a person other than the person's loan servicer; or</subsection><subsection ssid="13-null-82" dnum="C-o" numlevel="1" lineno="278" slineno="2-118" level="4"><display>(C)</display>refrain from contacting the person's:<subsection ssid="13-null-83" dnum="I-o" numlevel="1" lineno="279" slineno="2-119" level="5"><display>(I)</display>lender;</subsection><subsection ssid="13-null-84" dnum="II-o" numlevel="1" lineno="280" slineno="2-120" level="5"><display>(II)</display>loan servicer;</subsection><subsection ssid="13-null-85" dnum="III-o" numlevel="1" lineno="281" slineno="2-121" level="5"><display>(III)</display>attorney;</subsection><subsection ssid="13-null-86" dnum="IV-o" numlevel="1" lineno="282" slineno="2-122" level="5"><display>(IV)</display>credit counselor; or</subsection><subsection ssid="13-null-87" dnum="V-o" numlevel="1" lineno="283" slineno="2-123" level="5"><display>(V)</display>housing counselor; or</subsection></subsection></subsection><subsection ssid="13-null-88" dnum="vii-o" numlevel="1" lineno="284" slineno="2-124" level="3"><display>(vii)</display>for an agreement for loan modification assistance entered into on or after May <ln numlevel="1" lineno="285" slineno="2-125"/>11, 2010, engage in an act of loan modification assistance without offering in <ln numlevel="1" lineno="286" slineno="2-126"/>writing to the person entering into the agreement for loan modification assistance <ln numlevel="1" lineno="287" slineno="2-127"/>a right to cancel the agreement within three business days after the day on which <ln numlevel="1" lineno="288" slineno="2-128"/>the person enters the agreement;</subsection></subsection><subsection ssid="13-null-89" dnum="v-o" numlevel="1" lineno="289" slineno="2-129" level="2"><display>(v)</display>sign or initial a document on behalf of another person, except for in a circumstance <ln numlevel="1" lineno="290" slineno="2-130"/>allowed by the division by rule, with the concurrence of the commission, made in <ln numlevel="1" lineno="291" slineno="2-131"/>accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act;</subsection><subsection ssid="13-null-90" dnum="w-o" numlevel="1" lineno="292" slineno="2-132" level="2"><display>(w)</display>violate or fail to comply with a provision of Title 57, Chapter 28, Utah Reverse <ln numlevel="1" lineno="293" slineno="2-133"/>Mortgage Act;</subsection><subsection ssid="13-null-91" dnum="x-o" numlevel="1" lineno="294" slineno="2-134" level="2"><display>(x)</display>engage in any act or practice that violates appraisal independence as defined in 15 <ln numlevel="1" lineno="295" slineno="2-135"/>U.S.C. Sec. 1639e or in the policies and procedures of:<subsection ssid="13-null-92" dnum="i-o" numlevel="1" lineno="296" slineno="2-136" level="3"><display>(i)</display>the Federal Home Loan Mortgage Corporation; or</subsection><subsection ssid="13-null-93" dnum="ii-o" numlevel="1" lineno="297" slineno="2-137" level="3"><display>(ii)</display>the Federal National Mortgage Association; or</subsection></subsection><subsection ssid="13-null-94" dnum="y-o" numlevel="1" lineno="298" slineno="2-138" level="2"><display>(y)</display>use prescreened trigger lead information to solicit a consumer who has applied for a <ln numlevel="1" lineno="299" slineno="2-139"/>mortgage loan with another financial institution, if the person:<subsection ssid="13-null-95" dnum="i-o" numlevel="1" lineno="300" slineno="2-140" level="3"><display>(i)</display>fails to state in the initial solicitation that the person is not affiliated with the <ln numlevel="1" lineno="301" slineno="2-141"/>mortgage loan company or mortgage loan broker with which the consumer <ln numlevel="1" lineno="302" slineno="2-142"/>initially applied;</subsection><subsection ssid="13-null-96" dnum="ii-o" numlevel="1" lineno="303" slineno="2-143" level="3"><display>(ii)</display>fails in the initial solicitation to conform to state and federal law relating to <ln numlevel="1" lineno="304" slineno="2-144"/>solicitations using consumer reports, including the requirement to make a firm <ln numlevel="1" lineno="305" slineno="2-145"/>offer of credit to the consumer; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">or</amend><amendoutend style="2"/></subsection><subsection ssid="13-null-97" dnum="iii-o" numlevel="1" lineno="306" slineno="2-146" level="3"><display>(iii)</display>solicits a consumer with an offer of certain rates, terms, and costs with the <ln numlevel="1" lineno="307" slineno="2-147"/>knowledge that the person will subsequently change the rates, terms, or costs to <ln numlevel="1" lineno="308" slineno="2-148"/>the detriment of the consumer<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="13-137" dnum="_-o:iv-i" numlevel="1" lineno="309" slineno="2-149" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">commits unprofessional conduct in accordance with Section <xref depth="3" refnumber="61-7-401">61-7-401</xref>.</amend></subsection></subsection></subsection><subsection ssid="13-null-98" dnum="3-o" numlevel="1" lineno="310" slineno="2-150" level="1"><display>(3)</display>Regardless of whether the crime is related to the business of residential mortgage loans, <ln numlevel="1" lineno="311" slineno="2-151"/>it is a violation of this chapter for a licensee or a person who is a certified education <ln numlevel="1" lineno="312" slineno="2-152"/>provider to:<subsection ssid="13-null-99" dnum="a-o" numlevel="1" lineno="313" slineno="2-153" level="2"><display>(a)</display>be convicted of:<subsection ssid="13-null-100" dnum="i-o" numlevel="1" lineno="314" slineno="2-154" level="3"><display>(i)</display>a felony; or</subsection><subsection ssid="13-null-101" dnum="ii-o" numlevel="1" lineno="315" slineno="2-155" level="3"><display>(ii)</display>any of the following involving fraud, misrepresentation, theft, or dishonesty:<subsection ssid="13-null-102" dnum="A-o" numlevel="1" lineno="316" slineno="2-156" level="4"><display>(A)</display>a class A misdemeanor;</subsection><subsection ssid="13-null-103" dnum="B-o" numlevel="1" lineno="317" slineno="2-157" level="4"><display>(B)</display>a class B misdemeanor; or</subsection><subsection ssid="13-null-104" dnum="C-o" numlevel="1" lineno="318" slineno="2-158" level="4"><display>(C)</display>a criminal offense comparable to a class A or class B misdemeanor;</subsection></subsection></subsection><subsection ssid="13-null-105" dnum="b-o" numlevel="1" lineno="319" slineno="2-159" level="2"><display>(b)</display>plead guilty or nolo contendere to:<subsection ssid="13-null-106" dnum="i-o" numlevel="1" lineno="320" slineno="2-160" level="3"><display>(i)</display>a felony; or</subsection><subsection ssid="13-null-107" dnum="ii-o" numlevel="1" lineno="321" slineno="2-161" level="3"><display>(ii)</display>any of the following involving fraud, misrepresentation, theft, or dishonesty:<subsection ssid="13-null-108" dnum="A-o" numlevel="1" lineno="322" slineno="2-162" level="4"><display>(A)</display>a class A misdemeanor;</subsection><subsection ssid="13-null-109" dnum="B-o" numlevel="1" lineno="323" slineno="2-163" level="4"><display>(B)</display>a class B misdemeanor; or</subsection><subsection ssid="13-null-110" dnum="C-o" numlevel="1" lineno="324" slineno="2-164" level="4"><display>(C)</display>a criminal offense comparable to a class A or class B misdemeanor; or</subsection></subsection></subsection><subsection ssid="13-null-111" dnum="c-o" numlevel="1" lineno="325" slineno="2-165" level="2"><display>(c)</display>enter into a plea in abeyance agreement in relation to:<subsection ssid="13-null-112" dnum="i-o" numlevel="1" lineno="326" slineno="2-166" level="3"><display>(i)</display>a felony; or</subsection><subsection ssid="13-null-113" dnum="ii-o" numlevel="1" lineno="327" slineno="2-167" level="3"><display>(ii)</display>any of the following involving fraud, misrepresentation, theft, or dishonesty:<subsection ssid="13-null-114" dnum="A-o" numlevel="1" lineno="328" slineno="2-168" level="4"><display>(A)</display>a class A misdemeanor;</subsection><subsection ssid="13-null-115" dnum="B-o" numlevel="1" lineno="329" slineno="2-169" level="4"><display>(B)</display>a class B misdemeanor; or</subsection><subsection ssid="13-null-116" dnum="C-o" numlevel="1" lineno="330" slineno="2-170" level="4"><display>(C)</display>a criminal offense comparable to a class A or class B misdemeanor.</subsection></subsection></subsection></subsection><subsection ssid="13-null-117" dnum="4-o" numlevel="1" lineno="331" slineno="2-171" level="1"><display>(4)</display>A lending manager does not violate Subsection <xref depth="4" refnumber="61-2c-301(2)(q)">(2)(q)</xref> if:<subsection ssid="13-null-118" dnum="a-o" numlevel="1" lineno="332" slineno="2-172" level="2"><display>(a)</display>in contravention of the lending manager's written policies and instructions, an <ln numlevel="1" lineno="333" slineno="2-173"/>affiliated licensee of the lending manager violates:<subsection ssid="13-null-119" dnum="i-o" numlevel="1" lineno="334" slineno="2-174" level="3"><display>(i)</display>this chapter; or</subsection><subsection ssid="13-null-120" dnum="ii-o" numlevel="1" lineno="335" slineno="2-175" level="3"><display>(ii)</display>rules made by the division under this chapter;</subsection></subsection><subsection ssid="13-null-121" dnum="b-o" numlevel="1" lineno="336" slineno="2-176" level="2"><display>(b)</display>the lending manager established and followed reasonable procedures to ensure that <ln numlevel="1" lineno="337" slineno="2-177"/>affiliated licensees receive adequate supervision;</subsection><subsection ssid="13-null-122" dnum="c-o" numlevel="1" lineno="338" slineno="2-178" level="2"><display>(c)</display>upon learning of a violation by an affiliated licensee, the lending manager attempted <ln numlevel="1" lineno="339" slineno="2-179"/>to prevent or mitigate the damage;</subsection><subsection ssid="13-null-123" dnum="d-o" numlevel="1" lineno="340" slineno="2-180" level="2"><display>(d)</display>the lending manager did not participate in or ratify the violation by an affiliated <ln numlevel="1" lineno="341" slineno="2-181"/>licensee; and</subsection><subsection ssid="13-null-124" dnum="e-o" numlevel="1" lineno="342" slineno="2-182" level="2"><display>(e)</display>the lending manager did not attempt to avoid learning of the violation.</subsection></subsection><subsection ssid="13-null-125" dnum="5-o" numlevel="1" lineno="343" slineno="2-183" level="1"><display>(5)</display>Notwithstanding Subsection <xref depth="4" refnumber="61-2c-301(2)(m)(iii)">(2)(m)(iii)</xref>, a licensee may, upon compliance with Section <xref depth="3" refnumber="70D-2-305"><ln numlevel="1" lineno="344" slineno="2-184"/>70D-2-305</xref>, charge a reasonable cancellation fee for work done originating a mortgage if <ln numlevel="1" lineno="345" slineno="2-185"/>the mortgage is not closed.</subsection><subsection ssid="13-null-126" dnum="6-o" numlevel="1" lineno="346" slineno="2-186" level="1" space="false"><display>(6)</display><subsection ssid="13-null-127" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="61-2c-301(6)(b)">(6)(b)</xref>, a person transacting the business of <ln numlevel="1" lineno="347" slineno="2-187"/>residential mortgage loans in this state shall provide a prospective borrower a copy of <ln numlevel="1" lineno="348" slineno="2-188"/>each appraisal and any other written valuation developed in connection with an <ln numlevel="1" lineno="349" slineno="2-189"/>application for credit that is to be secured by a first lien on a dwelling on or before <ln numlevel="1" lineno="350" slineno="2-190"/>the earlier of:<subsection ssid="13-null-128" dnum="i-o" numlevel="1" lineno="351" slineno="2-191" level="3" tab="1"><display>(i)</display>as soon as reasonably possible after the appraisal or other valuation is complete; or</subsection><subsection ssid="13-null-129" dnum="ii-o" numlevel="1" lineno="352" slineno="2-192" level="3" tab="1"><display>(ii)</display>three business days before the day of the settlement.</subsection></subsection><subsection ssid="13-null-130" dnum="b-o" numlevel="1" lineno="353" slineno="2-193" level="2"><display>(b)</display>Subject to Subsection <xref depth="4" refnumber="61-2c-301(6)(c)">(6)(c)</xref>, unless otherwise prohibited by law, a prospective <ln numlevel="1" lineno="354" slineno="2-194"/>borrower may waive the timing requirement described in Subsection <xref depth="4" refnumber="61-2c-301(6)(a)">(6)(a)</xref> and agree <ln numlevel="1" lineno="355" slineno="2-195"/>to receive each appraisal and any other written valuation:<subsection ssid="13-null-131" dnum="i-o" numlevel="1" lineno="356" slineno="2-196" level="3"><display>(i)</display>less than three business days before the day of the settlement; or</subsection><subsection ssid="13-null-132" dnum="ii-o" numlevel="1" lineno="357" slineno="2-197" level="3"><display>(ii)</display>at the settlement.</subsection></subsection><subsection ssid="13-null-133" dnum="c-o" numlevel="1" lineno="358" slineno="2-198" level="2" space="false"><display>(c)</display><subsection ssid="13-null-134" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="61-2c-301(6)(c)(ii)">(6)(c)(ii)</xref>, a prospective borrower shall submit <ln numlevel="1" lineno="359" slineno="2-199"/>a waiver described in Subsection <xref depth="4" refnumber="61-2c-301(6)(b)">(6)(b)</xref> at least three business days before the day <ln numlevel="1" lineno="360" slineno="2-200"/>of the settlement.</subsection><subsection ssid="13-null-135" dnum="ii-o" numlevel="1" lineno="361" slineno="2-201" level="3"><display>(ii)</display>Subsection <xref depth="4" refnumber="61-2c-301(6)(b)">(6)(b)</xref> does not apply if the waiver only pertains to a copy of an <ln numlevel="1" lineno="362" slineno="2-202"/>appraisal or other written valuation that contains only clerical changes from a <ln numlevel="1" lineno="363" slineno="2-203"/>previous version of the appraisal or other written valuation and the prospective <ln numlevel="1" lineno="364" slineno="2-204"/>borrower received a copy of the original appraisal or other written valuation at <ln numlevel="1" lineno="365" slineno="2-205"/>least three business days before the day of the settlement.</subsection></subsection><subsection ssid="13-null-136" dnum="d-o" numlevel="1" lineno="366" slineno="2-206" level="2"><display>(d)</display>If a prospective borrower submits a waiver described in Subsection <xref depth="4" refnumber="61-2c-301(6)(b)">(6)(b)</xref> and the <ln numlevel="1" lineno="367" slineno="2-207"/>transaction never completes, the person transacting the business of residential <ln numlevel="1" lineno="368" slineno="2-208"/>mortgage loans shall provide a copy of each appraisal or any other written valuation <ln numlevel="1" lineno="369" slineno="2-209"/>to the applicant no later than 30 days after the day on which the person knows the <ln numlevel="1" lineno="370" slineno="2-210"/>transaction will not complete.</subsection></subsection></section></bsec><bsec buid="15" num="61-2g-502" type="amend" src="code" uid="C61-2g-S502_2028010120280101" sort="61 02g05020020280101" numlevel="1" lineno="371" slineno="3-1" sn="3"><section number="61-2g-502" numlevel="1" lineno="372" slineno="3-2" type="amend"><secline lineno="371">Section 3. Section <bold>61-2g-502</bold> is amended to read:</secline><catline lineno="372"><bold>61-2g-502<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>01/01/28</date></paren></parens>. Disciplinary action -- Grounds.</bold></catline><subsection ssid="15-null-1" dnum="1-o" numlevel="1" lineno="373" slineno="3-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="15-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The board may order disciplinary action, with the concurrence of the division, <ln numlevel="1" lineno="374" slineno="3-4"/>against a person:<subsection ssid="15-null-3" dnum="i-o" numlevel="1" lineno="375" slineno="3-5" level="3" tab="1"><display>(i)</display>registered, licensed, or certified under this chapter; or</subsection><subsection ssid="15-null-4" dnum="ii-o" numlevel="1" lineno="376" slineno="3-6" level="3" tab="1"><display>(ii)</display>required to be registered, licensed, or certified under this chapter.</subsection></subsection><subsection ssid="15-null-5" dnum="b-o" numlevel="1" lineno="377" slineno="3-7" level="2"><display>(b)</display>On the basis of a ground listed in Subsection <xref depth="4" refnumber="61-2g-502(2)" start="0">(2)</xref> for disciplinary action, board action <ln numlevel="1" lineno="378" slineno="3-8"/>may include:<subsection ssid="15-null-6" dnum="i-o" numlevel="1" lineno="379" slineno="3-9" level="3"><display>(i)</display>revoking, suspending, or placing a person's registration, license, or certification on <ln numlevel="1" lineno="380" slineno="3-10"/>probation;</subsection><subsection ssid="15-null-7" dnum="ii-o" numlevel="1" lineno="381" slineno="3-11" level="3"><display>(ii)</display>denying a person's original registration, license, or certification;</subsection><subsection ssid="15-null-8" dnum="iii-o" numlevel="1" lineno="382" slineno="3-12" level="3"><display>(iii)</display>denying a person's renewal license, certification, or registration;</subsection><subsection ssid="15-null-9" dnum="iv-o" numlevel="1" lineno="383" slineno="3-13" level="3"><display>(iv)</display>in the case of denial or revocation of a registration, license, or certification, <ln numlevel="1" lineno="384" slineno="3-14"/>setting a waiting period for an applicant to apply for a registration, license, or <ln numlevel="1" lineno="385" slineno="3-15"/>certification under this chapter;</subsection><subsection ssid="15-null-10" dnum="v-o" numlevel="1" lineno="386" slineno="3-16" level="3"><display>(v)</display>ordering remedial education;</subsection><subsection ssid="15-null-11" dnum="vi-o" numlevel="1" lineno="387" slineno="3-17" level="3"><display>(vi)</display>imposing a civil penalty upon a person not to exceed the greater of:<subsection ssid="15-null-12" dnum="A-o" numlevel="1" lineno="388" slineno="3-18" level="4"><display>(A)</display>$5,000 for each violation; or</subsection><subsection ssid="15-null-13" dnum="B-o" numlevel="1" lineno="389" slineno="3-19" level="4"><display>(B)</display>the amount of any gain or economic benefit from a violation;</subsection></subsection><subsection ssid="15-null-14" dnum="vii-o" numlevel="1" lineno="390" slineno="3-20" level="3"><display>(vii)</display>issuing a cease and desist order;</subsection><subsection ssid="15-null-15" dnum="viii-o" numlevel="1" lineno="391" slineno="3-21" level="3"><display>(viii)</display>modifying an action described in Subsections <xref depth="4" refnumber="61-2g-502(1)(b)(i)" start="0">(1)(b)(i)</xref> through <xref depth="4" refnumber="61-2g-502(1)(b)(vii)" start="0">(vii)</xref> if the <ln numlevel="1" lineno="392" slineno="3-22"/>board, with the concurrence of the division, finds that the person complies with <ln numlevel="1" lineno="393" slineno="3-23"/>court ordered restitution; or</subsection><subsection ssid="15-null-16" dnum="ix-o" numlevel="1" lineno="394" slineno="3-24" level="3"><display>(ix)</display>doing any combination of Subsections <xref depth="4" refnumber="61-2g-502(1)(b)(i)" start="0">(1)(b)(i)</xref> through <xref depth="4" refnumber="61-2g-502(1)(b)(viii)" start="0">(viii)</xref>.</subsection></subsection><subsection ssid="15-null-17" dnum="c-o" numlevel="1" lineno="395" slineno="3-25" level="2" space="false"><display>(c)</display><subsection ssid="15-null-18" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the board or division issues an order that orders a fine or educational <ln numlevel="1" lineno="396" slineno="3-26"/>requirements as part of the disciplinary action against a person, including a <ln numlevel="1" lineno="397" slineno="3-27"/>stipulation and order, the board or division shall state in the order the deadline by <ln numlevel="1" lineno="398" slineno="3-28"/>which the person shall comply with the fine or educational requirements.</subsection><subsection ssid="15-null-19" dnum="ii-o" numlevel="1" lineno="399" slineno="3-29" level="3"><display>(ii)</display>If a person fails to comply with a stated deadline:<subsection ssid="15-null-20" dnum="A-o" numlevel="1" lineno="400" slineno="3-30" level="4"><display>(A)</display>the person's license, certificate, or registration is automatically suspended:<subsection ssid="15-null-21" dnum="I-o" numlevel="1" lineno="401" slineno="3-31" level="5"><display>(I)</display>beginning on the day specified in the order as the deadline for compliance; <ln numlevel="1" lineno="402" slineno="3-32"/>and</subsection><subsection ssid="15-null-22" dnum="II-o" numlevel="1" lineno="403" slineno="3-33" level="5"><display>(II)</display>ending the day on which the person complies in full with the order; and</subsection></subsection><subsection ssid="15-null-23" dnum="B-o" numlevel="1" lineno="404" slineno="3-34" level="4"><display>(B)</display>if the person fails to pay a fine required by an order, the division may begin a <ln numlevel="1" lineno="405" slineno="3-35"/>collection process:<subsection ssid="15-null-24" dnum="I-o" numlevel="1" lineno="406" slineno="3-36" level="5"><display>(I)</display>established by the division by rule made in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, <ln numlevel="1" lineno="407" slineno="3-37"/>Chapter 3, Utah Administrative Rulemaking Act</xref>; and</subsection><subsection ssid="15-null-25" dnum="II-o" numlevel="1" lineno="408" slineno="3-38" level="5"><display>(II)</display>subject to <xref depth="2" refnumber="63A-3-5" start="0">Title 63A, Chapter 3, Part 5, Office of State Debt Collection</xref>.</subsection></subsection></subsection></subsection></subsection><subsection ssid="15-null-26" dnum="2-o" numlevel="1" lineno="409" slineno="3-39" level="1"><display>(2)</display>The following are grounds for disciplinary action under this section:<subsection ssid="15-null-27" dnum="a-o" numlevel="1" lineno="410" slineno="3-40" level="2"><display>(a)</display>procuring or attempting to procure a registration, license, or certification under this <ln numlevel="1" lineno="411" slineno="3-41"/>chapter:<subsection ssid="15-null-28" dnum="i-o" numlevel="1" lineno="412" slineno="3-42" level="3"><display>(i)</display>by fraud; or</subsection><subsection ssid="15-null-29" dnum="ii-o" numlevel="1" lineno="413" slineno="3-43" level="3"><display>(ii)</display>by making a false statement, submitting false information, or making a material <ln numlevel="1" lineno="414" slineno="3-44"/>misrepresentation in an application filed with the division;</subsection></subsection><subsection ssid="15-null-30" dnum="b-o" numlevel="1" lineno="415" slineno="3-45" level="2"><display>(b)</display>paying money or attempting to pay money other than a fee provided for by this <ln numlevel="1" lineno="416" slineno="3-46"/>chapter to a member or employee of the division to procure a registration, license, or <ln numlevel="1" lineno="417" slineno="3-47"/>certification under this chapter;</subsection><subsection ssid="15-null-31" dnum="c-o" numlevel="1" lineno="418" slineno="3-48" level="2"><display>(c)</display>an act or omission in the practice of real estate appraising that constitutes dishonesty, <ln numlevel="1" lineno="419" slineno="3-49"/>fraud, or misrepresentation;</subsection><subsection ssid="15-null-32" dnum="d-o" numlevel="1" lineno="420" slineno="3-50" level="2"><display>(d)</display>entry of a judgment against a registrant, licensee, or certificate holder on grounds of <ln numlevel="1" lineno="421" slineno="3-51"/>fraud, misrepresentation, or deceit in the making of an appraisal of real estate;</subsection><subsection ssid="15-null-33" dnum="e-o" numlevel="1" lineno="422" slineno="3-52" level="2"><display>(e)</display>regardless of whether the crime is related to the appraisal business, to:<subsection ssid="15-null-34" dnum="i-o" numlevel="1" lineno="423" slineno="3-53" level="3"><display>(i)</display>be convicted of a felony;</subsection><subsection ssid="15-null-35" dnum="ii-o" numlevel="1" lineno="424" slineno="3-54" level="3"><display>(ii)</display>be convicted of any of the following involving fraud, misrepresentation, theft, or <ln numlevel="1" lineno="425" slineno="3-55"/>dishonesty:<subsection ssid="15-null-36" dnum="A-o" numlevel="1" lineno="426" slineno="3-56" level="4"><display>(A)</display>a class A misdemeanor:</subsection><subsection ssid="15-null-37" dnum="B-o" numlevel="1" lineno="427" slineno="3-57" level="4"><display>(B)</display>a class B misdemeanor; or</subsection><subsection ssid="15-null-38" dnum="C-o" numlevel="1" lineno="428" slineno="3-58" level="4"><display>(C)</display>a criminal offense comparable to a class A or class B misdemeanor;</subsection></subsection><subsection ssid="15-null-39" dnum="iii-o" numlevel="1" lineno="429" slineno="3-59" level="3"><display>(iii)</display>plead guilty or nolo contendere to a felony;</subsection><subsection ssid="15-null-40" dnum="iv-o" numlevel="1" lineno="430" slineno="3-60" level="3"><display>(iv)</display>plead guilty or nolo contendere to any of the following involving fraud, <ln numlevel="1" lineno="431" slineno="3-61"/>misrepresentation, theft, or dishonesty:<subsection ssid="15-null-41" dnum="A-o" numlevel="1" lineno="432" slineno="3-62" level="4"><display>(A)</display>a class A misdemeanor:</subsection><subsection ssid="15-null-42" dnum="B-o" numlevel="1" lineno="433" slineno="3-63" level="4"><display>(B)</display>a class B misdemeanor; or</subsection><subsection ssid="15-null-43" dnum="C-o" numlevel="1" lineno="434" slineno="3-64" level="4"><display>(C)</display>a criminal offense comparable to a class A or class B misdemeanor;</subsection></subsection><subsection ssid="15-null-44" dnum="v-o" numlevel="1" lineno="435" slineno="3-65" level="3"><display>(v)</display>enter into a plea in abeyance agreement involving a felony; or</subsection><subsection ssid="15-null-45" dnum="vi-o" numlevel="1" lineno="436" slineno="3-66" level="3"><display>(vi)</display>enter into a plea in abeyance agreement involving any of the following involving <ln numlevel="1" lineno="437" slineno="3-67"/>fraud, misrepresentation, theft, or dishonesty:<subsection ssid="15-null-46" dnum="A-o" numlevel="1" lineno="438" slineno="3-68" level="4"><display>(A)</display>a class A misdemeanor:</subsection><subsection ssid="15-null-47" dnum="B-o" numlevel="1" lineno="439" slineno="3-69" level="4"><display>(B)</display>a class B misdemeanor; or</subsection><subsection ssid="15-null-48" dnum="C-o" numlevel="1" lineno="440" slineno="3-70" level="4"><display>(C)</display>a criminal offense comparable to a class A or class B misdemeanor;</subsection></subsection></subsection><subsection ssid="15-null-49" dnum="f-o" numlevel="1" lineno="441" slineno="3-71" level="2"><display>(f)</display>engaging in the business of real estate appraising under an assumed or fictitious name <ln numlevel="1" lineno="442" slineno="3-72"/>not properly registered in this state;</subsection><subsection ssid="15-null-50" dnum="g-o" numlevel="1" lineno="443" slineno="3-73" level="2"><display>(g)</display>paying a finder's fee or a referral fee to a person not licensed or certified under this <ln numlevel="1" lineno="444" slineno="3-74"/>chapter in connection with an appraisal of real estate or real property in this state;</subsection><subsection ssid="15-null-51" dnum="h-o" numlevel="1" lineno="445" slineno="3-75" level="2"><display>(h)</display>making a false or misleading statement in:<subsection ssid="15-null-52" dnum="i-o" numlevel="1" lineno="446" slineno="3-76" level="3"><display>(i)</display>that portion of a written appraisal report that deals with professional <ln numlevel="1" lineno="447" slineno="3-77"/>qualifications; or</subsection><subsection ssid="15-null-53" dnum="ii-o" numlevel="1" lineno="448" slineno="3-78" level="3"><display>(ii)</display>testimony concerning professional qualifications;</subsection></subsection><subsection ssid="15-null-54" dnum="i-o" numlevel="1" lineno="449" slineno="3-79" level="2"><display>(i)</display>violating or disregarding:<subsection ssid="15-null-55" dnum="i-o" numlevel="1" lineno="450" slineno="3-80" level="3"><display>(i)</display>this chapter;</subsection><subsection ssid="15-null-56" dnum="ii-o" numlevel="1" lineno="451" slineno="3-81" level="3"><display>(ii)</display>an order of:<subsection ssid="15-null-57" dnum="A-o" numlevel="1" lineno="452" slineno="3-82" level="4"><display>(A)</display>the board; or</subsection><subsection ssid="15-null-58" dnum="B-o" numlevel="1" lineno="453" slineno="3-83" level="4"><display>(B)</display>the division, in a case when the board delegates to the division the authority to <ln numlevel="1" lineno="454" slineno="3-84"/>make a decision on behalf of the board; or</subsection></subsection><subsection ssid="15-null-59" dnum="iii-o" numlevel="1" lineno="455" slineno="3-85" level="3"><display>(iii)</display>a rule issued under this chapter;</subsection></subsection><subsection ssid="15-null-60" dnum="j-o" numlevel="1" lineno="456" slineno="3-86" level="2"><display>(j)</display>violating the confidential nature of governmental records to which a person <ln numlevel="1" lineno="457" slineno="3-87"/>registered, licensed, or certified under this chapter gained access through <ln numlevel="1" lineno="458" slineno="3-88"/>employment or engagement as an appraiser by a governmental agency;</subsection><subsection ssid="15-null-61" dnum="k-o" numlevel="1" lineno="459" slineno="3-89" level="2"><display>(k)</display>accepting a contingent fee for performing an appraisal if in fact the fee is or was <ln numlevel="1" lineno="460" slineno="3-90"/>contingent upon:<subsection ssid="15-null-62" dnum="i-o" numlevel="1" lineno="461" slineno="3-91" level="3"><display>(i)</display>the appraiser reporting a predetermined analysis, opinion, or conclusion;</subsection><subsection ssid="15-null-63" dnum="ii-o" numlevel="1" lineno="462" slineno="3-92" level="3"><display>(ii)</display>the analysis, opinion, conclusion, or valuation reached; or</subsection><subsection ssid="15-null-64" dnum="iii-o" numlevel="1" lineno="463" slineno="3-93" level="3"><display>(iii)</display>the consequences resulting from the appraisal assignment;</subsection></subsection><subsection ssid="15-null-65" dnum="l-o" numlevel="1" lineno="464" slineno="3-94" level="2"><display>(l)</display><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">committing </amend>unprofessional conduct as defined by statute or rule; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">or</amend><amendoutend style="2"/></subsection><subsection ssid="15-68" dnum="_-o:m-i" numlevel="1" lineno="465" slineno="3-95" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1265" style="1" owner="i" level="1" amendtag="start">(m)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">committing unprofessional conduct in accordance with Section <xref depth="3" refnumber="61-7-401">61-7-401</xref>; or</amend></subsection><subsection ssid="15-null-66" dnum="m-o:n-i" numlevel="1" lineno="466" slineno="3-96" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1266" style="2" owner="o" level="1" deltag="both">(m)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1267" style="1" owner="i" level="1" amendtag="start" space="true">(n)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">committing </amend>other conduct that constitutes dishonest dealing.</subsection></subsection><subsection ssid="15-null-67" dnum="3-o" numlevel="1" lineno="467" slineno="3-97" level="1"><display>(3)</display>A person previously licensed, certified, or registered under this chapter remains <ln numlevel="1" lineno="468" slineno="3-98"/>responsible for, and is subject to disciplinary action for, an act that the person <ln numlevel="1" lineno="469" slineno="3-99"/>committed, while the person was licensed, certified, or registered, in violation of this <ln numlevel="1" lineno="470" slineno="3-100"/>chapter or an administrative rule in effect at the time that the person committed the act, <ln numlevel="1" lineno="471" slineno="3-101"/>regardless of whether the person is currently licensed, certified, or registered.</subsection></section></bsec><bsec buid="56" num="61-7-101" type="enact" src="code" uid="C61-7-S101_2026050620260506" sort="61 07 01010020260506" numlevel="1" lineno="472" slineno="4-1" sn="4"><section numlevel="1" lineno="475" slineno="4-4" number="61-7-101" type="enact"><secline lineno="472">Section 4. level="1"><display><amend anum="0" ea="amend" pairid="1287" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="256" groupid="181" style="1" owner="jchristopherson" level="1" amendtag="end">"Executive director" means the executive director of the department.</amend></subsection><subsection ssid="56-1-67" dnum="_-o:9-i" numlevel="1" slineno="4-37"/>originator, as defined in Section <xref depth="3" refnumber="61-2c-102">61-2c-102</xref>.</amend></subsection><subsection ssid="56-1-68" dnum="_-o:10-i" numlevel="1" lineno="509" slineno="4-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1289" style="1" owner="i" level="1" amendtag="start">(10)</amend></display><amend anum="0" ea="amend" pairid="217" groupid="155" style="1" owner="jchristopherson" level="1" amendtag="end">"Real estate practitioner" means an employee of a brokerage, as defined in Section <xref depth="3" refnumber="61-2f-102"><ln numlevel="1" lineno="510" slineno="4-39"/>61-2f-102</xref>, a sales agent, as defined in Section <xref depth="3" refnumber="61-2f-102">61-2f-102</xref>, or a real estate broker, as <ln numlevel="1" lineno="511" slineno="4-40"/>defined in Section <xref depth="3" refnumber="57-21-2">57-21-2</xref>.</amend></subsection><subsection ssid="56-1-69" dnum="_-o:11-i" numlevel="1" lineno="512" slineno="4-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1290" style="1" owner="i" level="1" amendtag="start">(11)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="18" style="1" slineno="4-42"/>61-2g-102</xref>.</amend></subsection><subsection ssid="56-1-70" dnum="_-o:12-i" numlevel="1" lineno="514" slineno="4-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1291" style="1" owner="i" level="1" amendtag="start">(12)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">"Real estate transaction communication network" means a system the commission <ln numlevel="1" lineno="515" slineno="4-44"/>authorizes and oversees that a real estate transaction communication utility administers <ln numlevel="1" lineno="516" slineno="4-45"/>which provides a secure platform for covered communications.</amend></subsection><subsection ssid="56-1-71" dnum="_-o:13-i" numlevel="1" lineno="517" slineno="4-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1292" style="1" owner="i" level="1" amendtag="start">(13)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">"Real estate transaction communication utility" means a person the commission <ln numlevel="1" lineno="518" slineno="4-47"/>authorizes to establish and administer a real estate amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="121" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="end">one individual who is a sales agent, as defined in Section <xref depth="3" refnumber="61-2f-102">61-2f-102</xref>, a real estate <ln numlevel="1" lineno="540" slineno="6-11"/>broker, as defined in Section <xref depth="3" refnumber="57-21-2">57-21-2</xref>, or is an owner of a brokerage, as defined in <ln numlevel="1" lineno="541" slineno="6-12"/>Section <xref depth="3" refnumber="61-2f-102">61-2f-102</xref>; and</amend></subsection><subsection ssid="60-58" dnum="_-o:iii-i" numlevel="1" lineno="542" slineno="6-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1303" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="198" groupid="144" style="1" owner="jchristopherson" level="1" amendtag="end">one individual who is a mortgage loan originator, as defined in Section <xref depth="3" refnumber="61-2c-102">61-2c-102</xref>, <ln numlevel="1" lineno="543" slineno="6-14"/>or is an owner of an entity licensed in accordance with Chapter 2c, Utah <ln numlevel="1" lineno="544" slineno="6-15"/>Residential Mortgage Practices and Licensing Act.</amend></subsection></subsection><subsection ssid="60-7-44" dnum="_-o:c-i" numlevel="1" lineno="545" slineno="6-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1304" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="89" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">The commissioner of the Insurance Department shall appoint two individuals to the <ln numlevel="1" lineno="546" slineno="6-17"/>commission: </amend><subsection ssid="60-7-45" depth="3" refnumber="31A-41-102">31A-41-102</xref>, <ln numlevel="1" lineno="549" slineno="6-20"/>an owner of a licensed title insurance licensee, as defined in Section <xref depth="3" refnumber="31A-41-102">31A-41-102</xref>, <ln numlevel="1" lineno="550" slineno="6-21"/>or title insurer, as defined in Section <xref depth="3" refnumber="31A-23a-415">31A-23a-415</xref>; and</amend></subsection><subsection ssid="60-7-46" dnum="_-o:ii-i" numlevel="1" lineno="551" slineno="6-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1306" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="131" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">one individual who is a member of the general public and who has never been a <ln numlevel="1" lineno="552" slineno="6-23"/>covered individual.</amend></subsection></subsection></subsection><subsection ssid="60-7-48" dnum="_-o:2-i" numlevel="1" lineno="553" slineno="6-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1307" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="60-7-49" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1308" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="146" groupid="107" style="1" owner="jchristopherson" level="1" amendtag="end">Each individual shall be appointed or reappointed to a six-year term ending June <ln numlevel="1" lineno="554" slineno="6-25"/>30, except as provided in Subsection <xref depth="4" refnumber="61-7-201(4)">(4)</xref>.</amend></subsection><subsection ssid="60-7-50" dnum="_-o:b-i" numlevel="1" lineno="555" slineno="6-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1309" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="155" groupid="113" style="1" owner="jchristopherson" level="1" amendtag="end">The executive director and the appointing commissioners shall adjust terms at <ln numlevel="1" lineno="556" slineno="6-27"/>appointment or reappointment to stagger terms so that approximately half of the <ln numlevel="1" lineno="557" slineno="6-28"/>members' terms expire every three years.</amend></subsection></subsection><subsection ssid="60-7-51" dnum="_-o:3-i" numlevel="1" lineno="558" slineno="6-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1310" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="159" groupid="116" style="1" owner="jchristopherson" level="1" amendtag="end">The commission shall elect annually one of the commission members as the chair.</amend></subsection><subsection ssid="60-7-52" dnum="_-o:4-i" numlevel="1" lineno="559" slineno="6-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1311" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="145" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">In accordance with Section (1), the appropriate authority shall appoint a replacement for <ln numlevel="1" lineno="560" slineno="6-31"/>the remainder of the term when a vacancy occurs.</amend></subsection><subsection ssid="60-7-53" dnum="_-o:5-i" numlevel="1" lineno="561" slineno="6-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1312" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="165" groupid="121" style="1" owner="jchristopherson" level="1" amendtag="end">The commission shall meet at and</amend></subsection></subsection><subsection ssid="68-29-17" dnum="_-o:b-i" numlevel="1" lineno="647" slineno="10-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1364" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">any rule the commission requests for the commission's review.</amend></subsection></subsection><subsection ssid="68-29-18" dnum="_-o:2-i" numlevel="1" lineno="648" slineno="10-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1365" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="68-29-19" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1366" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">A real estate transaction communication utility shall report to the commission <ln numlevel="1" lineno="649" slineno="10-10"/>when a covered individual violates a network rule.</amend></subsection><subsection ssid="68-29-20" dnum="_-o:b-i" numlevel="1" lineno="650" slineno="10-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1367" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">A real estate transaction communication utility may not take action against a covered <ln numlevel="1" lineno="651" slineno="10-12"/>individual for a violation of a network rule.</amend></subsection></subsection><subsection ssid="68-29-21" dnum="_-o:3-i" numlevel="1" lineno="652" slineno="10-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1368" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="68-29-22" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1369" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">A real estate transaction communication utility may charge a fee to a covered <ln numlevel="1" lineno="653" slineno="10-14"/>individual for each transaction using the real estate transaction communication <ln numlevel="1" lineno="654" slineno="10-15"/>network if the real estate transaction communication utility submits to the <ln numlevel="1" lineno="655" slineno="10-16"/>commission all fee schedules, including changes to existing fee schedules, for <ln numlevel="1" lineno="656" slineno="10-17"/>approval. </amend></subsection><subsection ssid="68-29-23" dnum="_-o:b-i" numlevel="1" lineno="657" slineno="10-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1370" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">A real estate transaction communication utility may not impose a fee that has not <ln numlevel="1" lineno="658" slineno="10-19"/>been approved by the commission.</amend></subsection><subsection ssid="68-24" dnum="_-o:c-i" numlevel="1" lineno="659" slineno="10-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1371" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">A covered individual may charge a consumer the cost of the fee the covered <ln numlevel="1" lineno="660" slineno="10-21"/>individual incurs for each transaction using the real estate transaction communication <ln numlevel="1" lineno="661" slineno="10-22"/>network.</amend></subsection></subsection></section></bsec><bsec buid="70" num="61-7-303" type="enact" src="code" uid="C61-7-S303_2026050620260506" sort="61 07 03030020260506" numlevel="1" lineno="662" slineno="11-1" sn="11"><section numlevel="1" lineno="663" slineno="11-2" number="61-7-303" type="enact"><secline lineno="662">Section 11. Criminal background check -- Changes in <ln numlevel="1" lineno="664" slineno="11-3"/>ownership or controlling person -- Revocation.</bold></catline><subsection ssid="70-38-44" dnum="_-o:1-i" numlevel="1" lineno="665" slineno="11-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1372" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">The commission shall request the Department of Public Safety to complete a Federal <ln numlevel="1" lineno="666" slineno="11-5"/>Bureau of Investigation criminal background check for an individual described in <ln numlevel="1" lineno="667" slineno="11-6"/>Subsection <xref depth="4" refnumber="61-7-301(3)(e)">61-7-301(3)(e)</xref> or <xref depth="4" refnumber="61-7-303(3)(f)">(3)(f)</xref> through the national criminal history system or any <ln numlevel="1" lineno="668" slineno="11-7"/>successor system.</amend></subsection><subsection ssid="70-38-45" dnum="_-o:2-i" numlevel="1" lineno="669" slineno="11-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1373" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="70-38-46" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1374" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">The entity filing the application in accordance with Subsection <xref depth="4" refnumber="61-7-301(2)">61-7-301(2)</xref> shall <ln numlevel="1" lineno="670" slineno="11-9"/>pay the cost of the criminal background check and the fingerprinting.</amend></subsection><subsection ssid="70-38-47" dnum="_-o:b-i" numlevel="1" lineno="671" slineno="11-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1375" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">Money paid to the commission by an entity for the cost of a criminal background <ln numlevel="1" lineno="672" slineno="11-11"/>check is nonlapsing.</amend></subsection></subsection><subsection ssid="70-38-48" dnum="_-o:3-i" numlevel="1" lineno="673" slineno="11-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1376" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="70-63" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1377" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="141" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">The commission shall reject an application if an individual described in <ln numlevel="1" lineno="674" slineno="11-13"/>Subsection <xref depth="4" refnumber="61-7-301(3)(e)">61-7-301(3)(e)</xref> or <xref depth="4" refnumber="61-7-303(3)(f)">(3)(f)</xref> fails to accurately disclose a criminal history.</amend></subsection><subsection ssid="70-62" dnum="_-o:b-i" numlevel="1" lineno="675" slineno="11-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1378" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="end">The commission shall immediately and automatically revoke the certificate of <ln numlevel="1" lineno="676" slineno="11-15"/>authority if a criminal background check discloses that an individual described in <ln numlevel="1" lineno="677" slineno="11-16"/>Subsection <xref depth="4" refnumber="61-7-301(3)(e)">61-7-301(3)(e)</xref> or <xref depth="4" refnumber="61-7-303(3)(f)">(3)(f)</xref> fails to accurately disclose a criminal history <ln numlevel="1" lineno="678" slineno="11-17"/>involving:</amend><subsection ssid="70-38-51" dnum="_-o:i-i" numlevel="1" lineno="679" slineno="11-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1379" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">a violation of state or federal law; or</amend></subsection><subsection ssid="70-38-52" dnum="_-o:ii-i" numlevel="1" lineno="680" slineno="11-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1380" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">a felony conviction on the basis of an allegation of fraud, misrepresentation, or <ln numlevel="1" lineno="681" slineno="11-20"/>deceit.</amend></subsection></subsection></subsection><subsection ssid="70-38-54" dnum="_-o:4-i" numlevel="1" lineno="682" slineno="11-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1381" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="144" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="end">Within 30 days after the day on which a change occurs in an individual described in <ln numlevel="1" lineno="683" slineno="11-22"/>Subsection <xref depth="4" refnumber="61-7-301(3)(e)">61-7-301(3)(e)</xref> or <xref depth="4" refnumber="61-7-303(3)(f)">(3)(f)</xref>, the real estate transaction communication utility <ln numlevel="1" lineno="684" slineno="11-23"/>shall file with the commission:</amend><subsection ssid="70-38-56" dnum="_-o:a-i" numlevel="1" lineno="685" slineno="11-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1382" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="104" groupid="70" style="1" owner="jchristopherson" level="1" amendtag="end">the individual's name, address, and contact information;</amend></subsection><subsection ssid="70-38-57" dnum="_-o:b-i" numlevel="1" lineno="686" slineno="11-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1383" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="72" style="1" owner="jchristopherson" level="1" amendtag="end">a statement of whether the individual has had a license or certificate to engage in an <ln numlevel="1" lineno="687" slineno="11-26"/>act related to a real estate or mortgage transaction refused, denied, canceled, <ln numlevel="1" lineno="688" slineno="11-27"/>surrendered in lieu of revocation, or revoked in this state or in another state, territory, <ln numlevel="1" lineno="689" slineno="11-28"/>or the District of Columbia; and</amend></subsection><subsection ssid="70-38-58" dnum="_-o:c-i" numlevel="1" lineno="690" slineno="11-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1384" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><subsection ssid="70-38-59" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1385" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="113" groupid="76" style="1" owner="jchristopherson" level="1" amendtag="end">fingerprint cards in a form acceptable to the commission at the time the <ln numlevel="1" lineno="691" slineno="11-30"/>application is filed; and</amend></subsection><subsection ssid="70-38-60" dnum="_-o:ii-i" numlevel="1" lineno="692" slineno="11-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1386" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">consent to a criminal background check by the Bureau of Criminal Identification <ln numlevel="1" lineno="693" slineno="11-32"/>and the Federal Bureau of Investigation regarding the application.</amend></subsection></subsection></subsection><subsection ssid="70-38-61" dnum="_-o:5-i" numlevel="1" lineno="694" slineno="11-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1387" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">The commission may revoke the certificate of authority if the real estate transaction <ln numlevel="1" lineno="695" slineno="11-34"/>communication utility fails to provide and maintain an operating real estate transaction <ln numlevel="1" lineno="696" slineno="11-35"/>communication network by the later of the full effective date of this chapter, or six <ln numlevel="1" lineno="697" slineno="11-36"/>months from the grant of a certificate of authority.</amend></subsection></section></bsec><bsec buid="72" num="61-7-304" type="enact" src="code" uid="C61-7-S304_2026050620260506" sort="61 07 03040020260506" numlevel="1" lineno="698" slineno="12-1" sn="12"><section numlevel="1" lineno="699" slineno="12-2" number="61-7-304" type="enact"><secline lineno="698">Section 12. Section <bold>61-7-304</bold> is enacted to read:</secline><catline lineno="699"><bold>61-7-304<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Renewal of certificate of authority.</bold></catline><subsection ssid="72-47-34" dnum="_-o:1-i" numlevel="1" lineno="700" slineno="12-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1388" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">A certificate of authority under this chapter expires three years after the day on which <ln numlevel="1" lineno="701" slineno="12-4"/>the commission issues the certificate of authority.</amend></subsection><subsection ssid="72-47-35" dnum="_-o:2-i" numlevel="1" lineno="702" slineno="12-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1389" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">To renew a certificate of authority under this chapter, before the day on which the <ln numlevel="1" lineno="703" slineno="12-6"/>certificate of authority expires, the real estate transaction communication utility shall:</amend><subsection ssid="72-47-36" dnum="_-o:a-i" numlevel="1" lineno="704" slineno="12-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1390" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">file with the commission a renewal application on a form the commission approves; <ln numlevel="1" lineno="705" slineno="12-8"/>and</amend></subsection><subsection ssid="72-47-37" dnum="_-o:b-i" numlevel="1" lineno="706" slineno="12-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1391" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">pay to the commission a fee determined in accordance with Section <xref depth="3" refnumber="63J-1-504">63J-1-504</xref>.</amend></subsection></subsection><subsection ssid="72-47-38" dnum="_-o:3-i" numlevel="1" lineno="707" slineno="12-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1392" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">A renewal application shall include the information required under Section <xref depth="3" refnumber="61-7-301">61-7-301</xref>, <ln numlevel="1" lineno="708" slineno="12-11"/>except that for an individual described in Subsection <xref depth="4" refnumber="61-7-301(3)(e)">61-7-301(3)(e)</xref> or <xref depth="4" refnumber="61-7-304(3)(f)">(3)(f)</xref>, the real <ln numlevel="1" lineno="709" slineno="12-12"/>estate transaction communication utility shall report whether the individual has had:</amend><subsection ssid="72-47-39" dnum="_-o:a-i" numlevel="1" lineno="710" slineno="12-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1393" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><subsection ssid="72-47-40" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1394" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">a conviction of a criminal offense;</amend></subsection><subsection ssid="72-47-41" dnum="_-o:ii-i" numlevel="1" lineno="711" slineno="12-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1395" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">the entry of a plea in abeyance to a criminal offense; or</amend></subsection><subsection ssid="72-47-42" dnum="_-o:iii-i" numlevel="1" lineno="712" slineno="12-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1396" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">the potential resolution of a criminal case by:</amend><subsection ssid="72-47-43" dnum="_-o:A-i" numlevel="1" lineno="713" slineno="12-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1397" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">a diversion agreement;
