and</hl><hl numlevel="1" lineno="12" slineno="0-12" level="2">character education;</hl></hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">prohibits certain local education agency personnel from providing character education to <ln numlevel="1" lineno="14" slineno="0-14"/>a student in most instances;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">provides that this bill does not affect certain individual rights;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">requires the state auditor to:<hl numlevel="1" lineno="17" slineno="0-17" level="2">receive certain reports;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="2">conduct certain investigations; and</hl><hl numlevel="1" lineno="19" slineno="0-19" level="2">enforce the provisions of the section;</hl></hl><hl numlevel="1" lineno="20" slineno="0-20" level="1"> creates a private right of action;</hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">prohibits the State Board of Education from creating certain rules related to character <ln numlevel="1" lineno="22" slineno="0-22"/>education; Section <bold>53E-9-203</bold> is amended to read:</secline><catline lineno="38"><bold>53E-9-203<parens/>. Activities prohibited without prior written consent -- Validity of <ln numlevel="1" lineno="39" slineno="1-3"/>consent -- Qualifications -- Training on implementation.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="40" slineno="1-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="6-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="53E-9-203(8)">(8)</xref>, Section <xref depth="3" refnumber="53G-9-604">53G-9-604</xref>, and Section <xref depth="3" refnumber="53G-9-702">53G-9-702</xref>, <ln numlevel="1" lineno="41" slineno="1-5"/>an LEA shall include in policies the LEA adopts under Section <xref depth="3" refnumber="53E-9-202">53E-9-202</xref><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both"> </amend>a <ln numlevel="1" lineno="42" slineno="1-6"/>requirement for obtaining prior written consent from the student's parent when <ln numlevel="1" lineno="43" slineno="1-7"/>administering to a student:<subsection ssid="6-null-3" dnum="i-o" numlevel="1" lineno="44" slineno="1-8" level="3" tab="1"><display>(i)</display>any psychological or psychiatric examination, test, or treatment; and</subsection><subsection ssid="6-null-4" dnum="ii-o" numlevel="1" lineno="45" slineno="1-9" level="3" tab="1"><display>(ii)</display>any survey, analysis, or evaluation in which the purpose or effect is to cause the <ln numlevel="1" lineno="46" slineno="1-10"/>student to reveal information, whether the information is personally identifiable or <ln numlevel="1" lineno="47" slineno="1-11"/>not, concerning the student's or any family member's:<subsection ssid="6-null-5" dnum="A-o" numlevel="1" lineno="48" slineno="1-12" level="4"><display>(A)</display>political affiliations or, except as provided under Section <xref depth="3" refnumber="53G-10-202">53G-10-202</xref> or rules <ln numlevel="1" lineno="49" slineno="1-13"/>of the state board, political philosophies;</subsection><subsection ssid="6-null-6" dnum="B-o" numlevel="1" lineno="50" slineno="1-14" level="4"><display>(B)</display>mental or psychological problems;</subsection><subsection ssid="6-null-7" dnum="C-o" numlevel="1" lineno="51" slineno="1-15" level="4"><display>(C)</display>sexual behavior, orientation, gender identity, or attitudes;</subsection><subsection ssid="6-null-8" dnum="D-o" numlevel="1" lineno="52" slineno="1-16" level="4"><display>(D)</display>illegal, anti-social, self-incriminating, or demeaning behavior;</subsection><subsection ssid="6-null-9" dnum="E-o" numlevel="1" lineno="53" slineno="1-17" level="4"><display>(E)</display>critical appraisals of individuals with whom the student or family member has <ln numlevel="1" lineno="54" slineno="1-18"/>close family relationships;</subsection><subsection ssid="6-null-10" dnum="F-o" numlevel="1" lineno="55" slineno="1-19" level="4"><display>(F)</display>religious affiliations or beliefs;</subsection><subsection ssid="6-null-11" dnum="G-o" numlevel="1" lineno="56" slineno="1-20" level="4"><display>(G)</display>legally recognized privileged and analogous relationships, such as those with <ln numlevel="1" lineno="57" slineno="1-21"/>lawyers, medical personnel, or ministers; and</subsection><subsection ssid="6-null-12" dnum="H-o" numlevel="1" lineno="58" slineno="1-22" level="4"><display>(H)</display>income, except as required by law.</subsection></subsection></subsection><subsection ssid="6-null-13" dnum="b-o" numlevel="1" lineno="59" slineno="1-23" level="2"><display>(b)</display>An LEA shall annually obtain prior written consent for the following at the time a <ln numlevel="1" lineno="60" slineno="1-24"/>student registers with the LEA:<subsection ssid="6-null-14" dnum="i-o" numlevel="1" lineno="61" slineno="1-25" level="3"><display>(i)</display>surveys related to an early warning system described in Section <xref depth="3" refnumber="53F-4-207">53F-4-207</xref>;<amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend></subsection><subsection ssid="6-null-15" dnum="ii-o:_-i" numlevel="1" lineno="62" slineno="1-26" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1014" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">surveys that include social emotional learning questions; and</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-16" dnum="iii-o:ii-i" numlevel="1" lineno="63" slineno="1-27" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>the school climate survey described in Section <xref depth="3" refnumber="53G-8-802">53G-8-802</xref>.</subsection></subsection><subsection ssid="6-63" dnum="_-o:c-i" numlevel="1" lineno="64" slineno="1-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA shall comply with the prohibitions on character education described in <ln numlevel="1" lineno="65" slineno="1-29"/>Section <xref depth="3" refnumber="53G-10-204">53G-10-204</xref>.</amend></subsection></subsection><subsection ssid="6-null-17" dnum="2-o" numlevel="1" lineno="66" slineno="1-30" level="1"><display>(2)</display>Prior written consent under Subsection <xref depth="4" refnumber="53E-9-203(1)">(1)</xref> is required in all grades, kindergarten <ln numlevel="1" lineno="67" slineno="1-31"/>through grade 12.</subsection><subsection ssid="6-null-18" dnum="3-o" numlevel="1" lineno="68" slineno="1-32" level="1"><display>(3)</display>Except as provided in Subsection <xref depth="4" refnumber="53E-9-203(8)">(8)</xref>, Section <xref depth="3" refnumber="53G-9-604">53G-9-604</xref>, and Section <xref depth="3" refnumber="53G-9-702">53G-9-702</xref>, the <ln numlevel="1" lineno="69" slineno="1-33"/>requirements under Subsection <xref depth="4" refnumber="53E-9-203(1)">(1)</xref> shall also apply within the curriculum and other <ln numlevel="1" lineno="70" slineno="1-34"/>school activities unless prior written consent of the student's parent has been obtained.</subsection><subsection ssid="6-null-19" dnum="4-o" numlevel="1" lineno="71" slineno="1-35" level="1"><display>(4)</display>An LEA may not:<subsection ssid="6-null-20" dnum="a-o" numlevel="1" lineno="72" slineno="1-36" level="2"><display>(a)</display>use the prior written consent described in Subsection <xref depth="4" refnumber="53E-9-203(1)">(1)</xref> that a different LEA <ln numlevel="1" lineno="73" slineno="1-37"/>obtained for a student who transfers to the LEA after the beginning of the school <ln numlevel="1" lineno="74" slineno="1-38"/>year; or</subsection><subsection ssid="6-null-21" dnum="b-o" numlevel="1" lineno="75" slineno="1-39" level="2"><display>(b)</display>provide:<subsection ssid="6-null-22" dnum="i-o" numlevel="1" lineno="76" slineno="1-40" level="3"><display>(i)</display>a reward to a student for a student's participation in any psychological or <ln numlevel="1" lineno="77" slineno="1-41"/>psychiatric examination, test, treatment, survey, analysis, or evaluation; or</subsection><subsection ssid="6-null-23" dnum="ii-o" numlevel="1" lineno="78" slineno="1-42" level="3"><display>(ii)</display>a consequence to a student for a student's lack of participation in any <ln numlevel="1" lineno="79" slineno="1-43"/>psychological or psychiatric examination, test, treatment, survey, analysis, or <ln numlevel="1" lineno="80" slineno="1-44"/>evaluation.</subsection></subsection></subsection><subsection ssid="6-null-24" dnum="5-o" numlevel="1" lineno="81" slineno="1-45" level="1" space="false"><display>(5)</display><subsection ssid="6-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Written parental consent is valid only if a parent has been first given written <ln numlevel="1" lineno="82" slineno="1-46"/>notice, including notice that a copy of the educational or student survey questions to <ln numlevel="1" lineno="83" slineno="1-47"/>be asked of the student in obtaining the desired information is made available at the <ln numlevel="1" lineno="84" slineno="1-48"/>school, and a reasonable opportunity to obtain written information concerning:<subsection ssid="6-null-26" dnum="i-o" numlevel="1" lineno="85" slineno="1-49" level="3" tab="1"><display>(i)</display>records or information, including information about relationships, that may be <ln numlevel="1" lineno="86" slineno="1-50"/>examined or requested;</subsection><subsection ssid="6-null-27" dnum="ii-o" numlevel="1" lineno="87" slineno="1-51" level="3" tab="1"><display>(ii)</display>the means by which the records or information shall be examined or reviewed;</subsection><subsection ssid="6-null-28" dnum="iii-o" numlevel="1" lineno="88" slineno="1-52" level="3" tab="1"><display>(iii)</display>the means by which the information is to be obtained;</subsection><subsection ssid="6-null-29" dnum="iv-o" numlevel="1" lineno="89" slineno="1-53" level="3" tab="1"><display>(iv)</display>the purposes for which the records or information are needed;</subsection><subsection ssid="6-null-30" dnum="v-o" numlevel="1" lineno="90" slineno="1-54" level="3" tab="1"><display>(v)</display>the entities or persons, regardless of affiliation, who will have access to the <ln numlevel="1" lineno="91" slineno="1-55"/>personally identifiable information; and</subsection><subsection ssid="6-null-31" dnum="vi-o" numlevel="1" lineno="92" slineno="1-56" level="3" tab="1"><display>(vi)</display>a method by which a parent of a student can grant permission to access or <ln numlevel="1" lineno="93" slineno="1-57"/>examine the personally identifiable information.</subsection></subsection><subsection ssid="6-null-32" dnum="b-o" numlevel="1" lineno="94" slineno="1-58" level="2"><display>(b)</display>For a survey described in Subsection <xref depth="4" refnumber="53E-9-203(1)">(1)</xref>, the LEA shall ensure that the written notice <ln numlevel="1" lineno="95" slineno="1-59"/>described in Subsection <xref depth="4" refnumber="53E-9-203(5)(a)">(5)(a)</xref> includes:<subsection ssid="6-null-33" dnum="i-o" numlevel="1" lineno="96" slineno="1-60" level="3"><display>(i)</display>the survey the LEA will administer to the parent's student;</subsection><subsection ssid="6-null-34" dnum="ii-o" numlevel="1" lineno="97" slineno="1-61" level="3"><display>(ii)</display>the intended purposes and uses of the data collected;</subsection><subsection ssid="6-null-35" dnum="iii-o" numlevel="1" lineno="98" slineno="1-62" level="3"><display>(iii)</display>the types of persons or governmental entities that:<subsection ssid="6-null-36" dnum="A-o" numlevel="1" lineno="99" slineno="1-63" level="4"><display>(A)</display>share the collected data, including a list of recipients who will receive the <ln numlevel="1" lineno="100" slineno="1-64"/>student-level data; or</subsection><subsection ssid="6-null-37" dnum="B-o" numlevel="1" lineno="101" slineno="1-65" level="4"><display>(B)</display>receive the data collected from a governmental entity on a regular or <ln numlevel="1" lineno="102" slineno="1-66"/>contractual basis; and</subsection></subsection><subsection ssid="6-null-38" dnum="iv-o" numlevel="1" lineno="103" slineno="1-67" level="3"><display>(iv)</display>the record series as defined in Section <xref depth="3" refnumber="63G-2-103">63G-2-103</xref> in which the data is or will be <ln numlevel="1" lineno="104" slineno="1-68"/>included, if applicable.</subsection></subsection></subsection><subsection ssid="6-null-39" dnum="6-o" numlevel="1" lineno="105" slineno="1-69" level="1" space="false"><display>(6)</display><subsection ssid="6-null-40" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except in response to a situation which a school employee reasonably believes to <ln numlevel="1" lineno="106" slineno="1-70"/>be an emergency, as authorized under Title 80, Chapter 2, Part 6, Child Abuse and <ln numlevel="1" lineno="107" slineno="1-71"/>Neglect Reports, by order of a court, or as described in Subsection <xref depth="4" refnumber="53E-9-203(1)(b)">(1)(b)</xref>, disclosure <ln numlevel="1" lineno="108" slineno="1-72"/>to a parent must be given at least two weeks before information protected under this <ln numlevel="1" lineno="109" slineno="1-73"/>section is sought.</subsection><subsection ssid="6-null-41" dnum="b-o" numlevel="1" lineno="110" slineno="1-74" level="2"><display>(b)</display>Following disclosure, a parent may waive the two week minimum notification period.</subsection><subsection ssid="6-null-42" dnum="c-o" numlevel="1" lineno="111" slineno="1-75" level="2"><display>(c)</display>Unless otherwise agreed to by a student's parent and the person requesting written <ln numlevel="1" lineno="112" slineno="1-76"/>consent, the authorization is valid only for the activity for which it was granted.</subsection><subsection ssid="6-null-43" dnum="d-o" numlevel="1" lineno="113" slineno="1-77" level="2"><display>(d)</display>A written withdrawal of authorization submitted to the school principal by the <ln numlevel="1" lineno="114" slineno="1-78"/>authorizing parent terminates the authorization.</subsection><subsection ssid="6-null-44" dnum="e-o" numlevel="1" lineno="115" slineno="1-79" level="2"><display>(e)</display>A general consent used to approve admission to school or involvement in special <ln numlevel="1" lineno="116" slineno="1-80"/>education, remedial education, or a school activity does not constitute written consent <ln numlevel="1" lineno="117" slineno="1-81"/>under this section.</subsection></subsection><subsection ssid="6-null-45" dnum="7-o" numlevel="1" lineno="118" slineno="1-82" level="1" space="false"><display>(7)</display><subsection ssid="6-null-46" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This section does not limit the ability of a student under Section <xref depth="3" refnumber="53G-10-203">53G-10-203</xref> to <ln numlevel="1" lineno="119" slineno="1-83"/>spontaneously express sentiments or opinions otherwise protected against disclosure <ln numlevel="1" lineno="120" slineno="1-84"/>under this section.</subsection><subsection ssid="6-null-47" dnum="b-o" numlevel="1" lineno="121" slineno="1-85" level="2" space="false"><display>(b)</display><subsection ssid="6-null-48" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If a school employee or agent believes that a situation exists which presents a <ln numlevel="1" lineno="122" slineno="1-86"/>serious threat to the well-being of a student, that employee or agent shall notify <ln numlevel="1" lineno="123" slineno="1-87"/>the student's parent without delay.</subsection><subsection ssid="6-null-49" dnum="ii-o" numlevel="1" lineno="124" slineno="1-88" level="3"><display>(ii)</display>If, however, the matter has been reported to the Division of Child and Family <ln numlevel="1" lineno="125" slineno="1-89"/>Services within the Department of Human Services, it is the responsibility of the <ln numlevel="1" lineno="126" slineno="1-90"/>division to notify the student's parent of any possible investigation, prior to the <ln numlevel="1" lineno="127" slineno="1-91"/>student's return home from school.</subsection><subsection ssid="6-null-50" dnum="iii-o" numlevel="1" lineno="128" slineno="1-92" level="3"><display>(iii)</display>The division may be exempted from the notification requirements described in <ln numlevel="1" lineno="129" slineno="1-93"/>this Subsection <xref depth="4" refnumber="53E-9-203(7)(b)(ii)">(7)(b)(ii)</xref> only if it determines that the student would be <ln numlevel="1" lineno="130" slineno="1-94"/>endangered by notification of the student's parent, or if that notification is <ln numlevel="1" lineno="131" slineno="1-95"/>otherwise prohibited by state or federal law.</subsection></subsection></subsection><subsection ssid="6-null-51" dnum="8-o" numlevel="1" lineno="132" slineno="1-96" level="1" space="false"><display>(8)</display><subsection ssid="6-null-52" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a school employee, agent, or school resource officer believes a student is at-risk <ln numlevel="1" lineno="133" slineno="1-97"/>of attempting suicide, physical self-harm, or harming others, the school employee, <ln numlevel="1" lineno="134" slineno="1-98"/>agent, or school resource officer may intervene and ask a student questions regarding <ln numlevel="1" lineno="135" slineno="1-99"/>the student's suicidal thoughts, physically self-harming behavior, or thoughts of <ln numlevel="1" lineno="136" slineno="1-100"/>harming others for the purposes of:<subsection ssid="6-null-53" dnum="i-o" numlevel="1" lineno="137" slineno="1-101" level="3" tab="1"><display>(i)</display>referring the student to appropriate prevention services; and</subsection><subsection ssid="6-null-54" dnum="ii-o" numlevel="1" lineno="138" slineno="1-102" level="3" tab="1"><display>(ii)</display>informing the student's parent.</subsection></subsection><subsection ssid="6-null-55" dnum="b-o" numlevel="1" lineno="139" slineno="1-103" level="2"><display>(b)</display>An LEA shall develop and adopt a policy regarding intervention measures consistent <ln numlevel="1" lineno="140" slineno="1-104"/>with Subsection <xref depth="4" refnumber="53E-9-203(8)(a)">(8)(a)</xref> while requiring the minimum degree of intervention to <ln numlevel="1" lineno="141" slineno="1-105"/>accomplish the goals of this section.</subsection></subsection><subsection ssid="6-null-56" dnum="9-o" numlevel="1" lineno="142" slineno="1-106" level="1"><display>(9)</display>An LEA governing board shall provide inservice for teachers and administrators on the <ln numlevel="1" lineno="143" slineno="1-107"/>implementation of this section.</subsection><subsection ssid="6-null-57" dnum="10-o" numlevel="1" lineno="144" slineno="1-108" level="1"><display>(10)</display>The state board shall provide procedures for disciplinary action for violations of this <ln numlevel="1" lineno="145" slineno="1-109"/>section.</subsection><subsection ssid="6-null-58" dnum="11-o" numlevel="1" lineno="146" slineno="1-110" level="1"><display>(11)</display>Data collected from a survey described in Subsection <xref depth="4" refnumber="53E-9-203(1)">(1)</xref>:<subsection ssid="6-null-59" dnum="a-o" numlevel="1" lineno="147" slineno="1-111" level="2"><display>(a)</display>is a private record as provided in Section <xref depth="3" refnumber="63G-2-302">63G-2-302</xref>;</subsection><subsection ssid="6-null-60" dnum="b-o" numlevel="1" lineno="148" slineno="1-112" level="2"><display>(b)</display>may not be shared except in accordance with the Family Educational Rights and <ln numlevel="1" lineno="149" slineno="1-113"/>Privacy Act, 20 U.S.C. Sec. 1232g; </subsection><subsection ssid="6-null-61" dnum="c-o" numlevel="1" lineno="150" slineno="1-114" level="2"><display>(c)</display>may only be used by an individual, organization, or governmental entity, including <ln numlevel="1" lineno="151" slineno="1-115"/>the state board, for the purposes identified in the notice described in Subsection <xref depth="4" refnumber="53E-9-203(5)">(5)</xref>; <ln numlevel="1" lineno="152" slineno="1-116"/>and</subsection><subsection ssid="6-null-62" dnum="d-o" numlevel="1" lineno="153" slineno="1-117" level="2"><display>(d)</display>may not be included in a student's Student Achievement Backpack, as that term is <ln numlevel="1" lineno="154" slineno="1-118"/>defined in Section <xref depth="3" refnumber="53E-3-511">53E-3-511</xref>.</subsection></subsection></section></bsec><bsec buid="7" num="53F-4-207" type="amend" src="code" uid="C53F-4-S207_2026070120260701" sort="53F04 02070020260701" numlevel="1" lineno="155" slineno="2-1" sn="2"><section number="53F-4-207" numlevel="1" lineno="156" slineno="2-2" type="amend"><secline lineno="155">Section 2. Section <bold>53F-4-207</bold> is amended to read:</secline><catline lineno="156"><bold>53F-4-207<parens/>. Student intervention early warning program.</bold></catline><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="157" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="7-null-2" dnum="a-o" numlevel="1" lineno="158" slineno="2-4" level="2"><display>(a)</display>"Digital program" means a program that provides information for student early <ln numlevel="1" lineno="159" slineno="2-5"/>intervention as described in this section.</subsection><subsection ssid="7-null-3" dnum="b-o" numlevel="1" lineno="160" slineno="2-6" level="2"><display>(b)</display>"Online data reporting tool" means a system described in Section <xref depth="3" refnumber="53E-4-311">53E-4-311</xref>.</subsection></subsection><subsection ssid="7-null-4" dnum="2-o" numlevel="1" lineno="161" slineno="2-7" level="1" space="false"><display>(2)</display><subsection ssid="7-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall, subject to legislative appropriations:<subsection ssid="7-null-6" dnum="i-o" numlevel="1" lineno="162" slineno="2-8" level="3" tab="1"><display>(i)</display>subject to Subsection <xref depth="4" refnumber="53F-4-207(2)(c)">(2)(c)</xref>, enhance the online data reporting tool and provide <ln numlevel="1" lineno="163" slineno="2-9"/>additional formative actionable data on student outcomes; and</subsection><subsection ssid="7-null-7" dnum="ii-o" numlevel="1" lineno="164" slineno="2-10" level="3" tab="1"><display>(ii)</display>select through a competitive contract process a provider to provide to an LEA a <ln numlevel="1" lineno="165" slineno="2-11"/>digital program as described in this section.</subsection></subsection><subsection ssid="7-null-8" dnum="b-o" numlevel="1" lineno="166" slineno="2-12" level="2"><display>(b)</display>Information collected or used by the state board for purposes of enhancing the online <ln numlevel="1" lineno="167" slineno="2-13"/>data reporting tool in accordance with this section may not identify a student <ln numlevel="1" lineno="168" slineno="2-14"/>individually.</subsection><subsection ssid="7-null-9" dnum="c-o" numlevel="1" lineno="169" slineno="2-15" level="2"><display>(c)</display>The state board shall make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="170" slineno="2-16"/>Administrative Rulemaking Act, to define the primary exceptionalities described in <ln numlevel="1" lineno="171" slineno="2-17"/>Subsection <xref depth="4" refnumber="53F-4-207(3)(e)(ii)">(3)(e)(ii)</xref>.</subsection></subsection><subsection ssid="7-null-10" dnum="3-o" numlevel="1" lineno="172" slineno="2-18" level="1"><display>(3)</display>The enhancement to the online data reporting tool and the digital program shall:<subsection ssid="7-null-11" dnum="a-o" numlevel="1" lineno="173" slineno="2-19" level="2"><display>(a)</display>be designed with a user-appropriate interface for use by teachers, school <ln numlevel="1" lineno="174" slineno="2-20"/>administrators, and parents;</subsection><subsection ssid="7-null-12" dnum="b-o" numlevel="1" lineno="175" slineno="2-21" level="2"><display>(b)</display>provide reports on a student's results at the student level on:<subsection ssid="7-null-13" dnum="i-o" numlevel="1" lineno="176" slineno="2-22" level="3"><display>(i)</display>a national assessment;</subsection><subsection ssid="7-null-14" dnum="ii-o" numlevel="1" lineno="177" slineno="2-23" level="3"><display>(ii)</display>a local assessment; and</subsection><subsection ssid="7-null-15" dnum="iii-o" numlevel="1" lineno="178" slineno="2-24" level="3"><display>(iii)</display>a standards assessment described in Section <xref depth="3" refnumber="53E-4-303">53E-4-303</xref>;</subsection></subsection><subsection ssid="7-null-16" dnum="c-o" numlevel="1" lineno="179" slineno="2-25" level="2"><display>(c)</display>have the ability to provide data from aggregate student reports based on a student's:<subsection ssid="7-null-17" dnum="i-o" numlevel="1" lineno="180" slineno="2-26" level="3"><display>(i)</display>teacher;</subsection><subsection ssid="7-null-18" dnum="ii-o" numlevel="1" lineno="181" slineno="2-27" level="3"><display>(ii)</display>school;</subsection><subsection ssid="7-null-19" dnum="iii-o" numlevel="1" lineno="182" slineno="2-28" level="3"><display>(iii)</display>school district, if applicable; or</subsection><subsection ssid="7-null-20" dnum="iv-o" numlevel="1" lineno="183" slineno="2-29" level="3"><display>(iv)</display>ethnicity;</subsection></subsection><subsection ssid="7-null-21" dnum="d-o" numlevel="1" lineno="184" slineno="2-30" level="2"><display>(d)</display>provide a viewer with the ability to view the data described in Subsection <xref depth="4" refnumber="53F-4-207(2)(c)">(2)(c)</xref> on a <ln numlevel="1" lineno="185" slineno="2-31"/>single computer screen;</subsection><subsection ssid="7-null-22" dnum="e-o" numlevel="1" lineno="186" slineno="2-32" level="2"><display>(e)</display>have the ability to compare the performance of students, for each teacher, based on a <ln numlevel="1" lineno="187" slineno="2-33"/>student's:<subsection ssid="7-null-23" dnum="i-o" numlevel="1" lineno="188" slineno="2-34" level="3"><display>(i)</display>gender;</subsection><subsection ssid="7-null-24" dnum="ii-o" numlevel="1" lineno="189" slineno="2-35" level="3"><display>(ii)</display>special needs, including primary exceptionality as defined by state board rule;</subsection><subsection ssid="7-null-25" dnum="iii-o" numlevel="1" lineno="190" slineno="2-36" level="3"><display>(iii)</display>English proficiency;</subsection><subsection ssid="7-null-26" dnum="iv-o" numlevel="1" lineno="191" slineno="2-37" level="3"><display>(iv)</display>economic status;</subsection><subsection ssid="7-null-27" dnum="v-o" numlevel="1" lineno="192" slineno="2-38" level="3"><display>(v)</display>migrant status;</subsection><subsection ssid="7-null-28" dnum="vi-o" numlevel="1" lineno="193" slineno="2-39" level="3"><display>(vi)</display>ethnicity;</subsection><subsection ssid="7-null-29" dnum="vii-o" numlevel="1" lineno="194" slineno="2-40" level="3"><display>(vii)</display>response to tiered intervention;</subsection><subsection ssid="7-null-30" dnum="viii-o" numlevel="1" lineno="195" slineno="2-41" level="3"><display>(viii)</display>response to tiered intervention enrollment date;</subsection><subsection ssid="7-null-31" dnum="ix-o" numlevel="1" lineno="196" slineno="2-42" level="3"><display>(ix)</display>absence rate;</subsection><subsection ssid="7-null-32" dnum="x-o" numlevel="1" lineno="197" slineno="2-43" level="3"><display>(x)</display>feeder school;</subsection><subsection ssid="7-null-33" dnum="xi-o" numlevel="1" lineno="198" slineno="2-44" level="3"><display>(xi)</display>type of school, including primary or secondary, public or private, Title I, or other <ln numlevel="1" lineno="199" slineno="2-45"/>general school-type category;</subsection><subsection ssid="7-null-34" dnum="xii-o" numlevel="1" lineno="200" slineno="2-46" level="3"><display>(xii)</display>course failures; and</subsection><subsection ssid="7-null-35" dnum="xiii-o" numlevel="1" lineno="201" slineno="2-47" level="3"><display>(xiii)</display>other criteria, as determined by the state board; and</subsection></subsection><subsection ssid="7-null-36" dnum="f-o" numlevel="1" lineno="202" slineno="2-48" level="2"><display>(f)</display>have the ability to load data from a local, national, or other assessment in the data's <ln numlevel="1" lineno="203" slineno="2-49"/>original format within a reasonable time.</subsection></subsection><subsection ssid="7-null-37" dnum="4-o" numlevel="1" lineno="204" slineno="2-50" level="1"><display>(4)</display>Subject to legislative appropriations, the online data reporting tool and digital program <ln numlevel="1" lineno="205" slineno="2-51"/>shall:<subsection ssid="7-null-38" dnum="a-o" numlevel="1" lineno="206" slineno="2-52" level="2"><display>(a)</display>integrate criteria for early warning indicators, including the following criteria:<subsection ssid="7-null-39" dnum="i-o" numlevel="1" lineno="207" slineno="2-53" level="3"><display>(i)</display>discipline, including school safety violations;</subsection><subsection ssid="7-null-40" dnum="ii-o" numlevel="1" lineno="208" slineno="2-54" level="3"><display>(ii)</display>attendance;</subsection><subsection ssid="7-null-41" dnum="iii-o" numlevel="1" lineno="209" slineno="2-55" level="3"><display>(iii)</display>behavior;</subsection><subsection ssid="7-null-42" dnum="iv-o" numlevel="1" lineno="210" slineno="2-56" level="3"><display>(iv)</display>course failures; and</subsection><subsection ssid="7-null-43" dnum="v-o" numlevel="1" lineno="211" slineno="2-57" level="3"><display>(v)</display>other criteria as determined by a local school board or charter school governing <ln numlevel="1" lineno="212" slineno="2-58"/>board<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">, which may not include character education as that term is defined in <ln numlevel="1" lineno="213" slineno="2-59"/>Section <xref depth="3" refnumber="53G-10-204">53G-10-204</xref></amend>;</subsection></subsection><subsection ssid="7-null-44" dnum="b-o" numlevel="1" lineno="214" slineno="2-60" level="2"><display>(b)</display>provide a teacher or administrator the ability to view the early warning indicators <ln numlevel="1" lineno="215" slineno="2-61"/>described in Subsection <xref depth="4" refnumber="53F-4-207(4)(a)">(4)(a)</xref> with a student's assessment results described in <ln numlevel="1" lineno="216" slineno="2-62"/>Subsection <xref depth="4" refnumber="53F-4-207(3)(b)">(3)(b)</xref>;</subsection><subsection ssid="7-null-45" dnum="c-o" numlevel="1" lineno="217" slineno="2-63" level="2"><display>(c)</display>provide data on response to intervention using existing assessments or measures that <ln numlevel="1" lineno="218" slineno="2-64"/>are manually added, including assessment and nonacademic measures;</subsection><subsection ssid="7-null-46" dnum="d-o" numlevel="1" lineno="219" slineno="2-65" level="2"><display>(d)</display>provide a user the ability to share interventions within a reporting environment and <ln numlevel="1" lineno="220" slineno="2-66"/>add comments to inform other teachers, administrators, and parents;</subsection><subsection ssid="7-null-47" dnum="e-o" numlevel="1" lineno="221" slineno="2-67" level="2"><display>(e)</display>save and share reports among different teachers and school administrators, subject to <ln numlevel="1" lineno="222" slineno="2-68"/>the student population information a teacher or administrator has the rights to access;</subsection><subsection ssid="7-null-48" dnum="f-o" numlevel="1" lineno="223" slineno="2-69" level="2"><display>(f)</display>automatically flag a student profile when early warning thresholds, that the state <ln numlevel="1" lineno="224" slineno="2-70"/>board defines, are met so that a teacher can easily identify a student who may be in <ln numlevel="1" lineno="225" slineno="2-71"/>need of intervention;</subsection><subsection ssid="7-null-49" dnum="g-o" numlevel="1" lineno="226" slineno="2-72" level="2"><display>(g)</display>incorporate a variety of algorithms to support student learning outcomes and provide <ln numlevel="1" lineno="227" slineno="2-73"/>student growth reporting by teacher;</subsection><subsection ssid="7-null-50" dnum="h-o" numlevel="1" lineno="228" slineno="2-74" level="2"><display>(h)</display>integrate response to intervention tiers and activities as filters for the reporting of <ln numlevel="1" lineno="229" slineno="2-75"/>individual student data and aggregated data, including by ethnicity, school, or teacher;</subsection><subsection ssid="7-null-51" dnum="i-o" numlevel="1" lineno="230" slineno="2-76" level="2"><display>(i)</display>have the ability to generate parent communication to alert the parent of plans or <ln numlevel="1" lineno="231" slineno="2-77"/>interventions; and</subsection><subsection ssid="7-null-52" dnum="j-o" numlevel="1" lineno="232" slineno="2-78" level="2"><display>(j)</display>configure alerts based upon student academic results, including a student's <ln numlevel="1" lineno="233" slineno="2-79"/>performance on the previous year's standards assessment described in Section <xref depth="3" refnumber="53E-4-303"><ln numlevel="1" lineno="234" slineno="2-80"/>53E-4-303</xref> or results to appropriate behavior interventions.</subsection></subsection><subsection ssid="7-null-53" dnum="5-o" numlevel="1" lineno="235" slineno="2-81" level="1" space="false"><display>(5)</display><subsection ssid="7-null-54" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall ensure that each LEA receives access to a digital program <ln numlevel="1" lineno="236" slineno="2-82"/>through a provider described in Subsection <xref depth="4" refnumber="53F-4-207(2)(a)(ii)">(2)(a)(ii)</xref>.</subsection><subsection ssid="7-null-55" dnum="b-o" numlevel="1" lineno="237" slineno="2-83" level="2"><display>(b)</display>An LEA  shall:<subsection ssid="7-null-56" dnum="i-o" numlevel="1" lineno="238" slineno="2-84" level="3"><display>(i)</display>pay for 50% of the cost of providing access to the digital program to the LEA; and</subsection><subsection ssid="7-null-57" dnum="ii-o" numlevel="1" lineno="239" slineno="2-85" level="3"><display>(ii)</display>no later than one school year after accessing a digital program, report to the state <ln numlevel="1" lineno="240" slineno="2-86"/>board in a format required by the state board on:<subsection ssid="7-null-58" dnum="A-o" numlevel="1" lineno="241" slineno="2-87" level="4"><display>(A)</display>the effectiveness of the digital program;</subsection><subsection ssid="7-null-59" dnum="B-o" numlevel="1" lineno="242" slineno="2-88" level="4"><display>(B)</display>positive and negative attributes of the digital program;</subsection><subsection ssid="7-null-60" dnum="C-o" numlevel="1" lineno="243" slineno="2-89" level="4"><display>(C)</display>recommendations for improving the online data reporting tool; and</subsection><subsection ssid="7-null-61" dnum="D-o" numlevel="1" lineno="244" slineno="2-90" level="4"><display>(D)</display>any other information regarding a digital program requested by the state board.</subsection></subsection></subsection><subsection ssid="7-null-62" dnum="c-o" numlevel="1" lineno="245" slineno="2-91" level="2"><display>(c)</display>The state board shall consider recommendations from an LEA for changes to the <ln numlevel="1" lineno="246" slineno="2-92"/>online data reporting tool.</subsection></subsection><subsection ssid="7-null-63" dnum="6-o" numlevel="1" lineno="247" slineno="2-93" level="1"><display>(6)</display>A person shall provide or use information described in this section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>in accordance with<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>:<subsection ssid="7-null-64" dnum="a-o" numlevel="1" lineno="248" slineno="2-94" level="2"><display>(a)</display>Title 53E, Chapter 9, Student Privacy and Data Protection;</subsection><subsection ssid="7-null-65" dnum="b-o" numlevel="1" lineno="249" slineno="2-95" level="2"><display>(b)</display>Family Education Rights and Privacy Act, 20 U.S.C. Sec. 1232g;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="7-null-66" dnum="c-o" numlevel="1" lineno="250" slineno="2-96" level="2"><display>(c)</display>the parental consent requirements in Section <xref depth="3" refnumber="53E-9-203">53E-9-203</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="7-76" dnum="_-o:d-i" numlevel="1" lineno="251" slineno="2-97" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">the prohibitions on character education described in Section <xref depth="3" refnumber="53G-10-204">53G-10-204</xref>.</amend></subsection></subsection><subsection ssid="7-null-67" dnum="7-o" numlevel="1" lineno="252" slineno="2-98" level="1" space="false"><display>(7)</display><subsection ssid="7-null-68" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A parent or guardian may opt the parent's or guardian's student into participating <ln numlevel="1" lineno="253" slineno="2-99"/>in a survey prepared by an LEA's online data reporting tool described in this section.</subsection><subsection ssid="7-null-69" dnum="b-o" numlevel="1" lineno="254" slineno="2-100" level="2"><display>(b)</display>An LEA shall provide notice to a parent of:<subsection ssid="7-null-70" dnum="i-o" numlevel="1" lineno="255" slineno="2-101" level="3"><display>(i)</display>the administration of a survey described in Subsection <xref depth="4" refnumber="53F-4-207(7)(a)">(7)(a)</xref>;</subsection><subsection ssid="7-null-71" dnum="ii-o" numlevel="1" lineno="256" slineno="2-102" level="3"><display>(ii)</display>if applicable, that the survey may request information from students that is non- <ln numlevel="1" lineno="257" slineno="2-103"/>academic in nature;</subsection><subsection ssid="7-null-72" dnum="iii-o" numlevel="1" lineno="258" slineno="2-104" level="3"><display>(iii)</display>where the parent may access the survey described in Subsection <xref depth="4" refnumber="53F-4-207(7)(a)">(7)(a)</xref> to be <ln numlevel="1" lineno="259" slineno="2-105"/>administered; and</subsection><subsection ssid="7-null-73" dnum="iv-o" numlevel="1" lineno="260" slineno="2-106" level="3"><display>(iv)</display>the opportunity to opt a student out of participating in a survey as described in <ln numlevel="1" lineno="261" slineno="2-107"/>Subsection <xref depth="4" refnumber="53F-4-207(7)(a)">(7)(a)</xref>.</subsection></subsection><subsection ssid="7-null-74" dnum="c-o" numlevel="1" lineno="262" slineno="2-108" level="2"><display>(c)</display>An LEA shall annually provide notice to parents and guardians on how the  LEA <ln numlevel="1" lineno="263" slineno="2-109"/>uses student data through the online data reporting tool to provide instruction and <ln numlevel="1" lineno="264" slineno="2-110"/>intervention to students.</subsection></subsection><subsection ssid="7-null-75" dnum="8-o" numlevel="1" lineno="265" slineno="2-111" level="1"><display>(8)</display>An LEA may use a different platform from the platform described in Subsection <xref depth="4" refnumber="53F-4-207(2)(a)(ii)"><ln numlevel="1" lineno="266" slineno="2-112"/>(2)(a)(ii)</xref> if the different platform accomplishes the requirements of this section.</subsection></section></bsec><bsec buid="10" num="53G-10-204" type="repreenact" src="code" uid="C53G-10-S204_2026070120260701" sort="53G10 02040020260701" numlevel="1" lineno="267" slineno="3-1" sn="3"><section numlevel="1" lineno="268" slineno="3-2" number="53G-10-204" type="repreenact"><secline lineno="267">Section 3. Section <bold>53G-10-204</bold> is repealed and reenacted to read:</secline><catline lineno="268"><bold>53G-10-204<parens/>. Character education restrictions -- Constitutional protections -- <ln numlevel="1" lineno="269" slineno="3-3"/>Private right of action.</bold></catline><subsection ssid="10-1" dnum="_-o:1-i" numlevel="1" lineno="270" slineno="3-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="10-2" dnum="_-o:a-i" numlevel="1" lineno="271" slineno="3-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">"Administrative personnel" means the same as that term defined is in Section <xref depth="3" refnumber="53G-10-206"><ln numlevel="1" lineno="272" slineno="3-6"/>53G-10-206</xref>.</amend></subsection><subsection ssid="10-3" dnum="_-o:b-i" numlevel="1" lineno="273" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><subsection ssid="10-5" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">"Character education" means social emotional learning developed by any <ln numlevel="1" lineno="274" slineno="3-8"/>public or private source which is aligned or related to current or historical <ln numlevel="1" lineno="275" slineno="3-9"/>frameworks or models, including those from the Collaborative for Academic <ln numlevel="1" lineno="276" slineno="3-10"/>Social and Emotional Learning [CASEL], the Harvard University EASEL Lab, or <ln numlevel="1" lineno="277" slineno="3-11"/>civil society organizations and:</amend><subsection ssid="10-78" dnum="_-o:A-i" numlevel="1" lineno="278" slineno="3-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="370" groupid="290" style="1" owner="jchristopherson" level="1" amendtag="end">includes a wide array of interpersonal or intrapersonal competencies or skills <ln numlevel="1" lineno="279" slineno="3-13"/>organized into cognitive, emotional, metacognitive, psychosocial, social, or <ln numlevel="1" lineno="280" slineno="3-14"/>spiritual domains to shape attitudes, beliefs, or mindsets or to develop <ln numlevel="1" lineno="281" slineno="3-15"/>character, dispositions, identity, or values;</amend></subsection><subsection ssid="10-6" dnum="_-o:B-i" numlevel="1" lineno="282" slineno="3-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">is referred to by an array of terms, including 21st century skills, competencies, <ln numlevel="1" lineno="283" slineno="3-17"/>civic or family engagement, durable skills, lifelong learning skills, <ln numlevel="1" lineno="284" slineno="3-18"/>interventions, non-academic skills, social skills, soft skills, subjective skills, <ln numlevel="1" lineno="285" slineno="3-19"/>personalized learning, or wellbeing;</amend></subsection><subsection ssid="10-7" dnum="_-o:C-i" numlevel="1" lineno="286" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">establishes practices or rituals related to existential meaning or purpose; or</amend></subsection><subsection ssid="10-8" dnum="_-o:D-i" numlevel="1" lineno="287" slineno="3-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">uses speech-ranking indexes or tools to establish or measure the social or <ln numlevel="1" lineno="288" slineno="3-22"/>emotional value or effect of communication.</amend></subsection></subsection><subsection ssid="10-9" dnum="_-o:ii-i" numlevel="1" lineno="289" slineno="3-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">"Character education" does not include specific provisions a parent designates for <ln numlevel="1" lineno="290" slineno="3-24"/>the parent's student's IEP or 504 accommodation plan which are consistent with <ln numlevel="1" lineno="291" slineno="3-25"/>the Individuals with Disabilities Education Act or Section 504 of the <ln numlevel="1" lineno="292" slineno="3-26"/>Rehabilitation Act of 1973 as amended in the area of public elementary and <ln numlevel="1" lineno="293" slineno="3-27"/>secondary education.</amend></subsection></subsection><subsection ssid="10-10" dnum="_-o:c-i" numlevel="1" lineno="294" slineno="3-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">"Instructional personnel" means the same as that term is defined in Section <xref depth="3" refnumber="53G-10-206"><ln numlevel="1" lineno="295" slineno="3-29"/>53G-10-206</xref>.</amend></subsection><subsection ssid="10-12" dnum="_-o:d-i" numlevel="1" lineno="296" slineno="3-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1149" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="end">Student" means a student in pre-kindergarten through grade 12 who is:</amend><subsection ssid="10-13" dnum="_-o:i-i" numlevel="1" lineno="297" slineno="3-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1150" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">enrolled in a public school; or</amend></subsection><subsection ssid="10-14" dnum="_-o:ii-i" numlevel="1" lineno="298" slineno="3-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1151" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="67" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">a participant in a public school program.</amend></subsection></subsection></subsection><subsection ssid="10-15" dnum="_-o:2-i" numlevel="1" lineno="299" slineno="3-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1152" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">The provisions of this Subsection <xref depth="4" refnumber="53G-10-204(2)">(2)</xref> are non-severable from this section:</amend><subsection ssid="10-18" dnum="_-o:a-i" numlevel="1" lineno="300" slineno="3-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1153" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">the public education system shall be free from sectarian control, in accordance with <ln numlevel="1" lineno="301" slineno="3-35"/>Utah Constitution, Article X, Section 1;</amend></subsection><subsection ssid="10-19" dnum="_-o:b-i" numlevel="1" lineno="302" slineno="3-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1154" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">no religious or partisan test or qualification shall be required as a condition of <ln numlevel="1" lineno="303" slineno="3-37"/>admission or attendance in the state's education system, in accordance with Utah <ln numlevel="1" lineno="304" slineno="3-38"/>Constitution, Article X, Section 8;</amend></subsection><subsection ssid="10-20" dnum="_-o:c-i" numlevel="1" lineno="305" slineno="3-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">sectarian control and partisan tests can be either religious or secular in nature;</amend></subsection><subsection ssid="10-21" dnum="_-o:d-i" numlevel="1" lineno="306" slineno="3-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="70" style="1" owner="jchristopherson" level="1" amendtag="end">the Free Exercise Clause protects against state education institutions imposing <ln numlevel="1" lineno="307" slineno="3-41"/>sectarian or partisan tests, qualifications, or systems of thought and belief on <ln numlevel="1" lineno="308" slineno="3-42"/>students, regardless of the extent to which these align or conflict with those taught at <ln numlevel="1" lineno="309" slineno="3-43"/>home; and</amend></subsection><subsection ssid="10-22" dnum="_-o:e-i" numlevel="1" lineno="310" slineno="3-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="end">the privilege and purview to determine or provide for the character education of a <ln numlevel="1" lineno="311" slineno="3-45"/>child solely resides with a parent, and cannot be assumed by or ceded to the state.</amend></subsection></subsection><subsection ssid="10-23" dnum="_-o:3-i" numlevel="1" lineno="312" slineno="3-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="end">To serve the profound liberty interests of children and parents, and to protect against <ln numlevel="1" lineno="313" slineno="3-47"/>state arrogation of individual rights guaranteed by the Utah Constitution and the 1st, 4th, <ln numlevel="1" lineno="314" slineno="3-48"/>9th, and 14th amendments to the United States Constitution, administrative personnel <ln numlevel="1" lineno="315" slineno="3-49"/>and instructional personnel may not:</amend><subsection ssid="10-24" dnum="_-o:a-i" numlevel="1" lineno="316" slineno="3-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="105" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">categorize, grade, implement, inform, measure, monitor, or track the character <ln numlevel="1" lineno="317" slineno="3-51"/>education of a student;</amend></subsection><subsection ssid="10-25" dnum="_-o:b-i" numlevel="1" lineno="318" slineno="3-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="110" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="end">coordinate or scale character education;</amend></subsection><subsection ssid="10-26" dnum="_-o:c-i" numlevel="1" lineno="319" slineno="3-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1161" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="89" style="1" owner="jchristopherson" level="1" amendtag="end">collect data or produce information, including biometric and psychometric, on the <ln numlevel="1" lineno="320" slineno="3-54"/>character education of a student or students, including for distribution or use in any <ln numlevel="1" lineno="321" slineno="3-55"/>repository, database, or networked or interoperable system; or</amend></subsection><subsection ssid="10-27" dnum="_-o:d-i" numlevel="1" lineno="322" slineno="3-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1162" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="end">distribute, produce, or use student profiles, portfolios, transcripts, credentials, social <ln numlevel="1" lineno="323" slineno="3-57"/>credit, or other records which include character education components.</amend></subsection></subsection><subsection ssid="10-28" dnum="_-o:4-i" numlevel="1" lineno="324" slineno="3-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1163" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="124" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">Nothing in this section prohibits:</amend><subsection ssid="10-29" dnum="_-o:a-i" numlevel="1" lineno="325" slineno="3-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1164" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">administrative or instructional personnel from using basic methods of maintaining <ln numlevel="1" lineno="326" slineno="3-60"/>classroom order not described in Subsection <xref depth="4" refnumber="53G-10-204(1)(b)">(1)(b)</xref>;</amend></subsection><subsection ssid="10-30" dnum="_-o:b-i" numlevel="1" lineno="327" slineno="3-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1165" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="104" style="1" owner="jchristopherson" level="1" amendtag="end">administrative or instructional personnel from communicating an objective <ln numlevel="1" lineno="328" slineno="3-62"/>observation of student behavior or activity to a parent;</amend></subsection><subsection ssid="10-31" dnum="_-o:c-i" numlevel="1" lineno="329" slineno="3-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1166" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="108" style="1" owner="jchristopherson" level="1" amendtag="end">administrative or instructional personnel from acting to protect an individual's <ln numlevel="1" lineno="330" slineno="3-64"/>immediate physical safety, or from notifying parents or the proper authorities as <ln numlevel="1" lineno="331" slineno="3-65"/>specified in state statute of personal knowledge of criminal, delinquent, or <ln numlevel="1" lineno="332" slineno="3-66"/>discipline-related student behavior; or</amend></subsection><subsection ssid="10-33" dnum="_-o:d-i" numlevel="1" lineno="333" slineno="3-67" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1167" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="150" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="end">an LEA from keeping and sharing records specific to the behavior described in <ln numlevel="1" lineno="334" slineno="3-68"/>Subsection <xref depth="4" refnumber="53G-10-204(4)(b)">(4)(b)</xref> with:</amend><subsection ssid="10-34" dnum="_-o:i-i" numlevel="1" lineno="335" slineno="3-69" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1168" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="156" groupid="121" style="1" owner="jchristopherson" level="1" amendtag="end">the school or LEA at which a student is enrolled;</amend></subsection><subsection ssid="10-35" dnum="_-o:ii-i" numlevel="1" lineno="336" slineno="3-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1169" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="161" groupid="125" style="1" owner="jchristopherson" level="1" amendtag="end">the parent of a student; or</amend></subsection><subsection ssid="10-36" dnum="_-o:iii-i" numlevel="1" lineno="337" slineno="3-71" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1170" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="166" groupid="129" style="1" owner="jchristopherson" level="1" amendtag="end">the criminal justice system.</amend></subsection></subsection></subsection><subsection ssid="10-37" dnum="_-o:5-i" numlevel="1" lineno="338" slineno="3-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1171" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="170" groupid="132" style="1" owner="jchristopherson" level="1" amendtag="end">The state auditor shall:</amend><subsection ssid="10-38" dnum="_-o:a-i" numlevel="1" lineno="339" slineno="3-73" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1172" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="175" groupid="136" style="1" owner="jchristopherson" level="1" amendtag="end">establish a process to receive reports alleging a violation of Subsection <xref depth="4" refnumber="53G-10-204(3)">(3)</xref>;</amend></subsection><subsection ssid="10-39" dnum="_-o:b-i" numlevel="1" lineno="340" slineno="3-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1173" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="180" groupid="140" style="1" owner="jchristopherson" level="1" amendtag="end">investigate alleged violations of Subsection <xref depth="4" refnumber="53G-10-204(3)">(3)</xref>;</amend></subsection><subsection ssid="10-40" dnum="_-o:c-i" numlevel="1" lineno="341" slineno="3-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1174" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="185" groupid="144" style="1" owner="jchristopherson" level="1" amendtag="end">provide written notice of the alleged violation to the LEA responsible for employing <ln numlevel="1" lineno="342" slineno="3-76"/>or engaging the services of the administrative or instructional personnel;</amend></subsection><subsection ssid="10-41" dnum="_-o:d-i" numlevel="1" lineno="343" slineno="3-77" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1175" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="190" groupid="148" style="1" owner="jchristopherson" level="1" amendtag="end">have unrestricted access to any LEA records, systems, or properties it deems <ln numlevel="1" lineno="344" slineno="3-78"/>necessary to obtain verification of an alleged violation of Subsection <xref depth="4" refnumber="53G-10-204(3)">(3)</xref>; and</amend></subsection><subsection ssid="10-42" dnum="_-o:e-i" numlevel="1" lineno="345" slineno="3-79" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1176" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="195" groupid="152" style="1" owner="jchristopherson" level="1" amendtag="end">determine violations of Subsection <xref depth="4" refnumber="53G-10-204(3)">(3)</xref> on a prima facie basis.</amend></subsection></subsection><subsection ssid="10-43" dnum="_-o:6-i" numlevel="1" lineno="346" slineno="3-80" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1177" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="201" groupid="157" style="1" owner="jchristopherson" level="1" amendtag="end">Upon determining a violation of Subsection <xref depth="4" refnumber="53G-10-204(3)">(3)</xref>, the state auditor shall:</amend><subsection ssid="10-44" dnum="_-o:a-i" numlevel="1" lineno="347" slineno="3-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1178" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="206" groupid="161" style="1" owner="jchristopherson" level="1" amendtag="end">provide a LEA a written notice of the determined violation, which:</amend><subsection ssid="10-45" dnum="_-o:i-i" numlevel="1" lineno="348" slineno="3-82" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1179" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="211" groupid="165" style="1" owner="jchristopherson" level="1" amendtag="end">assesses the LEA an immediate fine of $2,500; and</amend></subsection><subsection ssid="10-46" dnum="_-o:ii-i" numlevel="1" lineno="349" slineno="3-83" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1180" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="216" groupid="169" style="1" owner="jchristopherson" level="1" amendtag="end">informs the LEA that the public entity has 14 calendar days to provide a written <ln numlevel="1" lineno="350" slineno="3-84"/>assurance of compliance:</amend><subsection ssid="10-47" dnum="_-o:A-i" numlevel="1" lineno="351" slineno="3-85" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1181" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="221" groupid="173" style="1" owner="jchristopherson" level="1" amendtag="end">confirming that the LEA has remedied the violation;</amend></subsection><subsection ssid="10-48" dnum="_-o:B-i" numlevel="1" lineno="352" slineno="3-86" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1182" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="226" groupid="177" style="1" owner="jchristopherson" level="1" amendtag="end">listing the actions the LEA has taken to remedy the violation; and</amend></subsection><subsection ssid="10-49" dnum="_-o:C-i" numlevel="1" lineno="353" slineno="3-87" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1183" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="231" groupid="181" style="1" owner="jchristopherson" level="1" amendtag="end">committing to the LEA preventing a recurrence of the violation;</amend></subsection></subsection></subsection><subsection ssid="10-50" dnum="_-o:b-i" numlevel="1" lineno="354" slineno="3-88" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1184" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="236" groupid="185" style="1" owner="jchristopherson" level="1" amendtag="end">publish the determined violation on a publicly-accessible dashboard of the state <ln numlevel="1" lineno="355" slineno="3-89"/>auditor's website, including the following information:</amend><subsection ssid="10-51" dnum="_-o:i-i" numlevel="1" lineno="356" slineno="3-90" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1185" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="242" groupid="190" style="1" owner="jchristopherson" level="1" amendtag="end">the name of the LEA in violation of Subsection <xref depth="4" refnumber="53G-10-204(3)">(3)</xref>;</amend></subsection><subsection ssid="10-52" dnum="_-o:ii-i" numlevel="1" lineno="357" slineno="3-91" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1186" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="247" groupid="194" style="1" owner="jchristopherson" level="1" amendtag="end">the date on which the state auditor received the report alleging a violation of <ln numlevel="1" lineno="358" slineno="3-92"/>Subsection <xref depth="4" refnumber="53G-10-204(3)">(3)</xref>;</amend></subsection><subsection ssid="10-53" dnum="_-o:iii-i" numlevel="1" lineno="359" slineno="3-93" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1187" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="252" groupid="198" style="1" owner="jchristopherson" level="1" amendtag="end">the nature of the violation;</amend></subsection><subsection ssid="10-54" dnum="_-o:iv-i" numlevel="1" lineno="360" slineno="3-94" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1188" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="257" groupid="202" style="1" owner="jchristopherson" level="1" amendtag="end">the nature of the remedy;</amend></subsection><subsection ssid="10-55" dnum="_-o:v-i" numlevel="1" lineno="361" slineno="3-95" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="262" groupid="206" style="1" owner="jchristopherson" level="1" amendtag="end">upon receipt from the LEA, a link to a copy of the written assurance of <ln numlevel="1" lineno="362" slineno="3-96"/>compliance required under Subsection <xref depth="4" refnumber="53G-10-204(6)(a)(ii)">(6)(a)(ii)</xref>; <ln numlevel="1" lineno="371" slineno="3-105"/>and</amend></subsection><subsection ssid="10-79" dnum="_-o:e-i" numlevel="1" lineno="372" slineno="3-106" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1195" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="377" groupid="295" style="1" owner="jchristopherson" level="1" amendtag="end">for an LEA with three or more determined violations of this section in a rolling <ln numlevel="1" lineno="373" slineno="3-107"/>five-year period, whether distinct or repeat violations:</amend><subsection ssid="10-61" dnum="_-o:i-i" numlevel="1" lineno="374" slineno="3-108" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1196" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="292" groupid="230" style="1" owner="jchristopherson" level="1" amendtag="end">designate, on the state auditor's website, the LEA as a non-compliant actor; and</amend></subsection><subsection ssid="10-62" dnum="_-o:ii-i" numlevel="1" lineno="375" slineno="3-109" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1197" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="297" groupid="234" style="1" owner="jchristopherson" level="1" amendtag="end">recommend the LEA to the United States Department of Justice for a possible <ln numlevel="1" lineno="376" slineno="3-110"/>violation of 18 U.S.C. 241.</amend></subsection></subsection></subsection><subsection ssid="10-63" dnum="_-o:7-i" numlevel="1" lineno="377" slineno="3-111" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1198" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><subsection ssid="10-64" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1199" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="302" groupid="238" style="1" owner="jchristopherson" level="1" amendtag="end">A parent of a student affected by a violation of Subsection <xref depth="4" refnumber="53G-10-204(3)">(3)</xref> may bring a private <ln numlevel="1" lineno="378" slineno="3-112"/>right of action against an LEA for a violation of Subsection <xref depth="4" refnumber="53G-10-204(3)">(3)</xref>.</amend></subsection><subsection ssid="10-65" dnum="_-o:b-i" numlevel="1" lineno="379" slineno="3-113" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1200" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="310" groupid="243" style="1" owner="jchristopherson" level="1" amendtag="end">A parent who brings an action described in Subsection <xref depth="4" refnumber="53G-10-204(7)(a)">(7)(a)</xref> is entitled to the <ln numlevel="1" lineno="380" slineno="3-114"/>rebuttable presumption of Subsections <xref depth="4" refnumber="53G-10-204(2)(d)">(2)(d)</xref> and <xref depth="4" refnumber="53G-10-204(2)(e)">(2)(e)</xref>.</amend></subsection><subsection ssid="10-66" dnum="_-o:c-i" numlevel="1" lineno="381" slineno="3-115" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1201" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="315" groupid="247" style="1" owner="jchristopherson" level="1" amendtag="end">If a parent prevails in an action under Subsection <xref depth="4" refnumber="53G-10-204(7)(a)">(7)(a)</xref>:</amend><subsection ssid="10-67" dnum="_-o:i-i" numlevel="1" lineno="382" slineno="3-116" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1202" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="320" groupid="251" style="1" owner="jchristopherson" level="1" amendtag="end">the court shall:</amend><subsection ssid="10-68" dnum="_-o:A-i" numlevel="1" lineno="383" slineno="3-117" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1203" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="325" groupid="255" style="1" owner="jchristopherson" level="1" amendtag="end">award reasonable costs to the parent; Section <bold>67-3-1</bold> is amended to read:</secline><catline lineno="397"><bold>67-3-1<parens/>. Functions and duties.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="398" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="4-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state auditor is the auditor of public accounts and is independent of any <ln numlevel="1" lineno="399" slineno="4-4"/>executive or administrative officers of the state.</subsection><subsection ssid="4-null-3" dnum="b-o" numlevel="1" lineno="400" slineno="4-5" level="2"><display>(b)</display>The state auditor is not limited in the selection of personnel or in the determination <ln numlevel="1" lineno="401" slineno="4-6"/>of the reasonable and necessary expenses of the state auditor's office.</subsection></subsection><subsection ssid="4-null-4" dnum="2-o" numlevel="1" lineno="402" slineno="4-7" level="1"><display>(2)</display>The state auditor shall examine and certify annually in respect to each fiscal year, <ln numlevel="1" lineno="403" slineno="4-8"/>financial statements showing:<subsection ssid="4-null-5" dnum="a-o" numlevel="1" lineno="404" slineno="4-9" level="2"><display>(a)</display>the condition of the state's finances;</subsection><subsection ssid="4-null-6" dnum="b-o" numlevel="1" lineno="405" slineno="4-10" level="2"><display>(b)</display>the revenues received or accrued;</subsection><subsection ssid="4-null-7" dnum="c-o" numlevel="1" lineno="406" slineno="4-11" level="2"><display>(c)</display>expenditures paid or accrued;</subsection><subsection ssid="4-null-8" dnum="d-o" numlevel="1" lineno="407" slineno="4-12" level="2"><display>(d)</display>the amount of unexpended or unencumbered balances of the appropriations to the <ln numlevel="1" lineno="408" slineno="4-13"/>agencies, departments, divisions, commissions, and institutions; and</subsection><subsection ssid="4-null-9" dnum="e-o" numlevel="1" lineno="409" slineno="4-14" level="2"><display>(e)</display>the cash balances of the funds in the custody of the state treasurer.</subsection></subsection><subsection ssid="4-null-10" dnum="3-o" numlevel="1" lineno="410" slineno="4-15" level="1" space="false"><display>(3)</display><subsection ssid="4-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state auditor shall:<subsection ssid="4-null-12" dnum="i-o" numlevel="1" lineno="411" slineno="4-16" level="3" tab="1"><display>(i)</display>audit each permanent fund, each special fund, the General Fund, and the accounts <ln numlevel="1" lineno="412" slineno="4-17"/>of any department of state government or any independent agency or public <ln numlevel="1" lineno="413" slineno="4-18"/>corporation as the law requires, as the auditor determines is necessary, or upon <ln numlevel="1" lineno="414" slineno="4-19"/>request of the governor or the Legislature;</subsection><subsection ssid="4-null-13" dnum="ii-o" numlevel="1" lineno="415" slineno="4-20" level="3" tab="1"><display>(ii)</display>perform the audits in accordance with generally accepted auditing standards and <ln numlevel="1" lineno="416" slineno="4-21"/>other auditing procedures as promulgated by recognized authoritative bodies; and</subsection><subsection ssid="4-null-14" dnum="iii-o" numlevel="1" lineno="417" slineno="4-22" level="3" tab="1"><display>(iii)</display>as the auditor determines is necessary, conduct the audits to determine:<subsection ssid="4-null-15" dnum="A-o" numlevel="1" lineno="418" slineno="4-23" level="4"><display>(A)</display>honesty and integrity in fiscal affairs;</subsection><subsection ssid="4-null-16" dnum="B-o" numlevel="1" lineno="419" slineno="4-24" level="4"><display>(B)</display>accuracy and reliability of financial statements;</subsection><subsection ssid="4-null-17" dnum="C-o" numlevel="1" lineno="420" slineno="4-25" level="4"><display>(C)</display>effectiveness and adequacy of financial controls; and</subsection><subsection ssid="4-null-18" dnum="D-o" numlevel="1" lineno="421" slineno="4-26" level="4"><display>(D)</display>compliance with the law.</subsection></subsection></subsection><subsection ssid="4-null-19" dnum="b-o" numlevel="1" lineno="422" slineno="4-27" level="2"><display>(b)</display>If any state entity receives federal funding, the state auditor shall ensure that the <ln numlevel="1" lineno="423" slineno="4-28"/>audit is performed in accordance with federal audit requirements.</subsection><subsection ssid="4-null-20" dnum="c-o" numlevel="1" lineno="424" slineno="4-29" level="2" space="false"><display>(c)</display><subsection ssid="4-null-21" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The costs of the federal compliance portion of the audit may be paid from an <ln numlevel="1" lineno="425" slineno="4-30"/>appropriation to the state auditor from the General Fund.</subsection><subsection ssid="4-null-22" dnum="ii-o" numlevel="1" lineno="426" slineno="4-31" level="3"><display>(ii)</display>If an appropriation is not provided, or if the federal government does not <ln numlevel="1" lineno="427" slineno="4-32"/>specifically provide for payment of audit costs, the costs of the federal compliance <ln numlevel="1" lineno="428" slineno="4-33"/>portions of the audit shall be allocated on the basis of the percentage that each <ln numlevel="1" lineno="429" slineno="4-34"/>state entity's federal funding bears to the total federal funds received by the state.</subsection><subsection ssid="4-null-23" dnum="iii-o" numlevel="1" lineno="430" slineno="4-35" level="3"><display>(iii)</display>The allocation shall be adjusted to reflect any reduced audit time required to <ln numlevel="1" lineno="431" slineno="4-36"/>audit funds passed through the state to local governments and to reflect any <ln numlevel="1" lineno="432" slineno="4-37"/>reduction in audit time obtained through the use of internal auditors working <ln numlevel="1" lineno="433" slineno="4-38"/>under the direction of the state auditor.</subsection></subsection></subsection><subsection ssid="4-null-24" dnum="4-o" numlevel="1" lineno="434" slineno="4-39" level="1" space="false"><display>(4)</display><subsection ssid="4-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="67-3-1(4)(b)">(4)(b)</xref>, the state auditor shall, in addition to <ln numlevel="1" lineno="435" slineno="4-40"/>financial audits, and as the auditor determines is necessary, conduct performance and <ln numlevel="1" lineno="436" slineno="4-41"/>special purpose audits, examinations, and reviews of any entity that receives public <ln numlevel="1" lineno="437" slineno="4-42"/>funds, including a determination of any or all of the following:<subsection ssid="4-null-26" dnum="i-o" numlevel="1" lineno="438" slineno="4-43" level="3" tab="1"><display>(i)</display>the honesty and integrity of all the entity's fiscal affairs;</subsection><subsection ssid="4-null-27" dnum="ii-o" numlevel="1" lineno="439" slineno="4-44" level="3" tab="1"><display>(ii)</display>whether the entity's administrators have faithfully complied with legislative intent;</subsection><subsection ssid="4-null-28" dnum="iii-o" numlevel="1" lineno="440" slineno="4-45" level="3" tab="1"><display>(iii)</display>whether the entity's operations have been conducted in an efficient, effective, and <ln numlevel="1" lineno="441" slineno="4-46"/>cost-efficient manner;</subsection><subsection ssid="4-null-29" dnum="iv-o" numlevel="1" lineno="442" slineno="4-47" level="3" tab="1"><display>(iv)</display>whether the entity's programs have been effective in accomplishing the intended <ln numlevel="1" lineno="443" slineno="4-48"/>objectives; and</subsection><subsection ssid="4-null-30" dnum="v-o" numlevel="1" lineno="444" slineno="4-49" level="3" tab="1"><display>(v)</display>whether the entity's management, control, and information systems are adequate, <ln numlevel="1" lineno="445" slineno="4-50"/>effective, and secure.</subsection></subsection><subsection ssid="4-null-31" dnum="b-o" numlevel="1" lineno="446" slineno="4-51" level="2"><display>(b)</display>The auditor may not conduct performance and special purpose audits, examinations, <ln numlevel="1" lineno="447" slineno="4-52"/>and reviews of any entity that receives public funds if the entity:<subsection ssid="4-null-32" dnum="i-o" numlevel="1" lineno="448" slineno="4-53" level="3"><display>(i)</display>has an elected auditor; and</subsection><subsection ssid="4-null-33" dnum="ii-o" numlevel="1" lineno="449" slineno="4-54" level="3"><display>(ii)</display>has, within the entity's last budget year, had the entity's financial statements or <ln numlevel="1" lineno="450" slineno="4-55"/>performance formally reviewed by another outside auditor.</subsection></subsection></subsection><subsection ssid="4-null-34" dnum="5-o" numlevel="1" lineno="451" slineno="4-56" level="1"><display>(5)</display>The state auditor:<subsection ssid="4-null-35" dnum="a-o" numlevel="1" lineno="452" slineno="4-57" level="2"><display>(a)</display>shall administer any oath or affirmation necessary to the performance of the duties of <ln numlevel="1" lineno="453" slineno="4-58"/>the auditor's office; and</subsection><subsection ssid="4-null-36" dnum="b-o" numlevel="1" lineno="454" slineno="4-59" level="2"><display>(b)</display>may:<subsection ssid="4-null-37" dnum="i-o" numlevel="1" lineno="455" slineno="4-60" level="3"><display>(i)</display>subpoena witnesses and documents, whether electronic or otherwise; and</subsection><subsection ssid="4-null-38" dnum="ii-o" numlevel="1" lineno="456" slineno="4-61" level="3"><display>(ii)</display>examine into any matter that the auditor considers necessary.</subsection></subsection></subsection><subsection ssid="4-null-39" dnum="6-o" numlevel="1" lineno="457" slineno="4-62" level="1"><display>(6)</display>The state auditor may require all persons who have had the disposition or management <ln numlevel="1" lineno="458" slineno="4-63"/>of any property of this state or its political subdivisions to submit statements regarding <ln numlevel="1" lineno="459" slineno="4-64"/>the property at the time and in the form that the auditor requires.</subsection><subsection ssid="4-null-40" dnum="7-o" numlevel="1" lineno="460" slineno="4-65" level="1"><display>(7)</display>The state auditor shall:<subsection ssid="4-null-41" dnum="a-o" numlevel="1" lineno="461" slineno="4-66" level="2"><display>(a)</display>except where otherwise provided by law, institute suits in Salt Lake County in <ln numlevel="1" lineno="462" slineno="4-67"/>relation to the assessment, collection, and payment of revenues against:<subsection ssid="4-null-42" dnum="i-o" numlevel="1" lineno="463" slineno="4-68" level="3"><display>(i)</display>persons who by any means have become entrusted with public money or property <ln numlevel="1" lineno="464" slineno="4-69"/>and have failed to pay over or deliver the money or property; and</subsection><subsection ssid="4-null-43" dnum="ii-o" numlevel="1" lineno="465" slineno="4-70" level="3"><display>(ii)</display>all debtors of the state;</subsection></subsection><subsection ssid="4-null-44" dnum="b-o" numlevel="1" lineno="466" slineno="4-71" level="2"><display>(b)</display>collect and pay into the state treasury all fees received by the state auditor;</subsection><subsection ssid="4-null-45" dnum="c-o" numlevel="1" lineno="467" slineno="4-72" level="2"><display>(c)</display>perform the duties of a member of all boards of which the state auditor is a member <ln numlevel="1" lineno="468" slineno="4-73"/>by the constitution or laws of the state, and any other duties that are prescribed by the <ln numlevel="1" lineno="469" slineno="4-74"/>constitution and by law;</subsection><subsection ssid="4-null-46" dnum="d-o" numlevel="1" lineno="470" slineno="4-75" level="2"><display>(d)</display>stop the payment of the salary of any state official or state employee who:<subsection ssid="4-null-47" dnum="i-o" numlevel="1" lineno="471" slineno="4-76" level="3"><display>(i)</display>refuses to settle accounts or provide required statements about the custody and <ln numlevel="1" lineno="472" slineno="4-77"/>disposition of public funds or other state property;</subsection><subsection ssid="4-null-48" dnum="ii-o" numlevel="1" lineno="473" slineno="4-78" level="3"><display>(ii)</display>refuses, neglects, or ignores the instruction of the state auditor or any controlling <ln numlevel="1" lineno="474" slineno="4-79"/>board or department head with respect to the manner of keeping prescribed <ln numlevel="1" lineno="475" slineno="4-80"/>accounts or funds; or</subsection><subsection ssid="4-null-49" dnum="iii-o" numlevel="1" lineno="476" slineno="4-81" level="3"><display>(iii)</display>fails to correct any delinquencies, improper procedures, and errors brought to the <ln numlevel="1" lineno="477" slineno="4-82"/>official's or employee's attention;</subsection></subsection><subsection ssid="4-null-50" dnum="e-o" numlevel="1" lineno="478" slineno="4-83" level="2"><display>(e)</display>establish accounting systems, methods, and forms for public accounts in all taxing or <ln numlevel="1" lineno="479" slineno="4-84"/>fee-assessing units of the state in the interest of uniformity, efficiency, and economy;</subsection><subsection ssid="4-null-51" dnum="f-o" numlevel="1" lineno="480" slineno="4-85" level="2"><display>(f)</display>superintend the contractual auditing of all state accounts;</subsection><subsection ssid="4-null-52" dnum="g-o" numlevel="1" lineno="481" slineno="4-86" level="2"><display>(g)</display>subject to Subsection <xref depth="4" refnumber="67-3-1(8)(a)">(8)(a)</xref>, withhold state allocated funds or the disbursement of <ln numlevel="1" lineno="482" slineno="4-87"/>property taxes from a state or local taxing or fee-assessing unit, if necessary, to <ln numlevel="1" lineno="483" slineno="4-88"/>ensure that officials and employees in those taxing units comply with state laws and <ln numlevel="1" lineno="484" slineno="4-89"/>procedures in the budgeting, expenditures, and financial reporting of public funds;</subsection><subsection ssid="4-null-53" dnum="h-o" numlevel="1" lineno="485" slineno="4-90" level="2"><display>(h)</display>subject to Subsection <xref depth="4" refnumber="67-3-1(9)">(9)</xref>, withhold the disbursement of tax money from any county, <ln numlevel="1" lineno="486" slineno="4-91"/>if necessary, to ensure that officials and employees in the county comply with <ln numlevel="1" lineno="487" slineno="4-92"/>Section <xref depth="3" refnumber="59-2-303.1">59-2-303.1</xref>; and</subsection><subsection ssid="4-null-54" dnum="i-o" numlevel="1" lineno="488" slineno="4-93" level="2"><display>(i)</display>withhold state allocated funds or the disbursement of property taxes from a local <ln numlevel="1" lineno="489" slineno="4-94"/>government entity or a limited purpose entity, as those terms are defined in Section <xref depth="3" refnumber="67-1a-15"><ln numlevel="1" lineno="490" slineno="4-95"/>67-1a-15</xref> if the state auditor finds the withholding necessary to ensure that the entity <ln numlevel="1" lineno="491" slineno="4-96"/>registers and maintains the entity's registration with the lieutenant governor, in <ln numlevel="1" lineno="492" slineno="4-97"/>accordance with Section <xref depth="3" refnumber="67-1a-15">67-1a-15</xref>.</subsection></subsection><subsection ssid="4-null-55" dnum="8-o" numlevel="1" lineno="493" slineno="4-98" level="1" space="false"><display>(8)</display><subsection ssid="4-null-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as otherwise provided by law, the state auditor may not withhold funds <ln numlevel="1" lineno="494" slineno="4-99"/>under Subsection <xref depth="4" refnumber="67-3-1(7)(g)">(7)(g)</xref> until a state or local taxing or fee-assessing unit has received <ln numlevel="1" lineno="495" slineno="4-100"/>formal written notice of noncompliance from the auditor and has been given 60 days <ln numlevel="1" lineno="496" slineno="4-101"/>to make the specified corrections.</subsection><subsection ssid="4-null-57" dnum="b-o" numlevel="1" lineno="497" slineno="4-102" level="2"><display>(b)</display>If, after receiving notice under Subsection <xref depth="4" refnumber="67-3-1(8)(a)">(8)(a)</xref>, a state or independent local <ln numlevel="1" lineno="498" slineno="4-103"/>fee-assessing unit that exclusively assesses fees has not made corrections to comply <ln numlevel="1" lineno="499" slineno="4-104"/>with state laws and procedures in the budgeting, expenditures, and financial reporting <ln numlevel="1" lineno="500" slineno="4-105"/>of public funds, the state auditor:<subsection ssid="4-null-58" dnum="i-o" numlevel="1" lineno="501" slineno="4-106" level="3"><display>(i)</display>shall provide a recommended timeline for corrective actions;</subsection><subsection ssid="4-null-59" dnum="ii-o" numlevel="1" lineno="502" slineno="4-107" level="3"><display>(ii)</display>may prohibit the state or local fee-assessing unit from accessing money held by <ln numlevel="1" lineno="503" slineno="4-108"/>the state; and</subsection><subsection ssid="4-null-60" dnum="iii-o" numlevel="1" lineno="504" slineno="4-109" level="3"><display>(iii)</display>may prohibit a state or local fee-assessing unit from accessing money held in an <ln numlevel="1" lineno="505" slineno="4-110"/>account of a financial institution by filing an action in a court with jurisdiction <ln numlevel="1" lineno="506" slineno="4-111"/>under Title <xref depth="0" refnumber="78A">78A, Judiciary and Judicial Administration</xref>, requesting an order of the <ln numlevel="1" lineno="507" slineno="4-112"/>court to prohibit a financial institution from providing the fee-assessing unit <ln numlevel="1" lineno="508" slineno="4-113"/>access to an account.</subsection></subsection><subsection ssid="4-null-61" dnum="c-o" numlevel="1" lineno="509" slineno="4-114" level="2"><display>(c)</display>The state auditor shall remove a limitation on accessing funds under Subsection <xref depth="4" refnumber="67-3-1(8)(b)">(8)(b)</xref> <ln numlevel="1" lineno="510" slineno="4-115"/>upon compliance with state laws and procedures in the budgeting, expenditures, and <ln numlevel="1" lineno="511" slineno="4-116"/>financial reporting of public funds.</subsection><subsection ssid="4-null-62" dnum="d-o" numlevel="1" lineno="512" slineno="4-117" level="2"><display>(d)</display>If a local taxing or fee-assessing unit has not adopted a budget in compliance with <ln numlevel="1" lineno="513" slineno="4-118"/>state law, the state auditor:<subsection ssid="4-null-63" dnum="i-o" numlevel="1" lineno="514" slineno="4-119" level="3"><display>(i)</display>shall provide notice to the taxing or fee-assessing unit of the unit's failure to <ln numlevel="1" lineno="515" slineno="4-120"/>comply;</subsection><subsection ssid="4-null-64" dnum="ii-o" numlevel="1" lineno="516" slineno="4-121" level="3"><display>(ii)</display>may prohibit the taxing or fee-assessing unit from accessing money held by the <ln numlevel="1" lineno="517" slineno="4-122"/>state; and</subsection><subsection ssid="4-null-65" dnum="iii-o" numlevel="1" lineno="518" slineno="4-123" level="3"><display>(iii)</display>may prohibit a taxing or fee-assessing unit from accessing money held in an <ln numlevel="1" lineno="519" slineno="4-124"/>account of a financial institution by:<subsection ssid="4-null-66" dnum="A-o" numlevel="1" lineno="520" slineno="4-125" level="4"><display>(A)</display>contacting the taxing or fee-assessing unit's financial institution and <ln numlevel="1" lineno="521" slineno="4-126"/>requesting that the institution prohibit access to the account; or</subsection><subsection ssid="4-null-67" dnum="B-o" numlevel="1" lineno="522" slineno="4-127" level="4"><display>(B)</display>filing an action in a court with jurisdiction under Title <xref depth="0" refnumber="78A">78A, Judiciary and <ln numlevel="1" lineno="523" slineno="4-128"/>Judicial Administration</xref>, requesting an order of the court to prohibit a financial <ln numlevel="1" lineno="524" slineno="4-129"/>institution from providing the taxing or fee-assessing unit access to an account.</subsection></subsection></subsection><subsection ssid="4-null-68" dnum="e-o" numlevel="1" lineno="525" slineno="4-130" level="2"><display>(e)</display>If the local taxing or fee-assessing unit adopts a budget in compliance with state law, <ln numlevel="1" lineno="526" slineno="4-131"/>the state auditor shall eliminate a limitation on accessing funds described in <ln numlevel="1" lineno="527" slineno="4-132"/>Subsection <xref depth="4" refnumber="67-3-1(8)(d)">(8)(d)</xref>.</subsection></subsection><subsection ssid="4-null-69" dnum="9-o" numlevel="1" lineno="528" slineno="4-133" level="1"><display>(9)</display>The state auditor may not withhold funds under Subsection <xref depth="4" refnumber="67-3-1(7)(h)">(7)(h)</xref> until a county has <ln numlevel="1" lineno="529" slineno="4-134"/>received formal written notice of noncompliance from the auditor and has been given 60 <ln numlevel="1" lineno="530" slineno="4-135"/>days to make the specified corrections.</subsection><subsection ssid="4-null-70" dnum="10-o" numlevel="1" lineno="531" slineno="4-136" level="1" space="false"><display>(10)</display><subsection ssid="4-null-71" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state auditor may not withhold funds under Subsection <xref depth="4" refnumber="67-3-1(7)(i)">(7)(i)</xref> until the state <ln numlevel="1" lineno="532" slineno="4-137"/>auditor receives a notice of non-registration, as that term is defined in Section <xref depth="3" refnumber="67-1a-15"><ln numlevel="1" lineno="533" slineno="4-138"/>67-1a-15</xref>.</subsection><subsection ssid="4-null-72" dnum="b-o" numlevel="1" lineno="534" slineno="4-139" level="2"><display>(b)</display>If the state auditor receives a notice of non-registration, the state auditor may <ln numlevel="1" lineno="535" slineno="4-140"/>prohibit the local government entity or limited purpose entity, as those terms are <ln numlevel="1" lineno="536" slineno="4-141"/>defined in Section <xref depth="3" refnumber="67-1a-15">67-1a-15</xref>, from accessing:<subsection ssid="4-null-73" dnum="i-o" numlevel="1" lineno="537" slineno="4-142" level="3"><display>(i)</display>money held by the state; and</subsection><subsection ssid="4-null-74" dnum="ii-o" numlevel="1" lineno="538" slineno="4-143" level="3"><display>(ii)</display>money held in an account of a financial institution by:<subsection ssid="4-null-75" dnum="A-o" numlevel="1" lineno="539" slineno="4-144" level="4"><display>(A)</display>contacting the entity's financial institution and requesting that the institution <ln numlevel="1" lineno="540" slineno="4-145"/>prohibit access to the account; or</subsection><subsection ssid="4-null-76" dnum="B-o" numlevel="1" lineno="541" slineno="4-146" level="4"><display>(B)</display>filing an action in a court with jurisdiction under Title <xref depth="0" refnumber="78A">78A, Judiciary and <ln numlevel="1" lineno="542" slineno="4-147"/>Judicial Administration</xref>, requesting an order of the court to prohibit a financial <ln numlevel="1" lineno="543" slineno="4-148"/>institution from providing the entity access to an account.</subsection></subsection></subsection><subsection ssid="4-null-77" dnum="c-o" numlevel="1" lineno="544" slineno="4-149" level="2"><display>(c)</display>The state auditor shall remove the prohibition on accessing funds described in <ln numlevel="1" lineno="545" slineno="4-150"/>Subsection <xref depth="4" refnumber="67-3-1(10)(b)">(10)(b)</xref> if the state auditor received a notice of registration, as that term is <ln numlevel="1" lineno="546" slineno="4-151"/>defined in Section <xref depth="3" refnumber="67-1a-15">67-1a-15</xref>, from the lieutenant governor.</subsection></subsection><subsection ssid="4-null-78" dnum="11-o" numlevel="1" lineno="547" slineno="4-152" level="1"><display>(11)</display>Notwithstanding Subsection <xref depth="4" refnumber="67-3-1(7)(g)">(7)(g)</xref>, <xref refnumber="67-3-1(7)(h)" depth="4">(7)(h)</xref>, <xref refnumber="67-3-1(7)(i)" depth="4">(7)(i</xref>), <xref refnumber="67-3-1(8)(b)" depth="4">(8)(b)</xref>, <xref refnumber="67-3-1(8)(d)" depth="4">(8)(d)</xref>, or <xref refnumber="67-3-1(10)(b)" depth="4">(10)(b</xref>), the state <ln numlevel="1" lineno="548" slineno="4-153"/>auditor:<subsection ssid="4-null-79" dnum="a-o" numlevel="1" lineno="549" slineno="4-154" level="2"><display>(a)</display>shall authorize a disbursement by a local government entity or limited purpose entity, <ln numlevel="1" lineno="550" slineno="4-155"/>as those terms are defined in Section <xref depth="3" refnumber="67-1a-15">67-1a-15</xref>, or a state or local taxing or <ln numlevel="1" lineno="551" slineno="4-156"/>fee-assessing unit if the disbursement is necessary to:<subsection ssid="4-null-80" dnum="i-o" numlevel="1" lineno="552" slineno="4-157" level="3"><display>(i)</display>avoid a major disruption in the operations of the local government entity, limited <ln numlevel="1" lineno="553" slineno="4-158"/>purpose entity, or state or local taxing or fee-assessing unit; or</subsection><subsection ssid="4-null-81" dnum="ii-o" numlevel="1" lineno="554" slineno="4-159" level="3"><display>(ii)</display>meet debt service obligations; and</subsection></subsection><subsection ssid="4-null-82" dnum="b-o" numlevel="1" lineno="555" slineno="4-160" level="2"><display>(b)</display>may authorize a disbursement by a local government entity, limited purpose entity, <ln numlevel="1" lineno="556" slineno="4-161"/>or state or local taxing or fee-assessing unit as the state auditor determines is <ln numlevel="1" lineno="557" slineno="4-162"/>appropriate.</subsection></subsection><subsection ssid="4-null-83" dnum="12-o" numlevel="1" lineno="558" slineno="4-163" level="1" space="false"><display>(12)</display><subsection ssid="4-null-84" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state auditor may seek relief under the Utah Rules of Civil Procedure to take <ln numlevel="1" lineno="559" slineno="4-164"/>temporary custody of public funds if an action is necessary to protect public funds <ln numlevel="1" lineno="560" slineno="4-165"/>from being improperly diverted from their intended public purpose.</subsection><subsection ssid="4-null-85" dnum="b-o" numlevel="1" lineno="561" slineno="4-166" level="2"><display>(b)</display>If the state auditor seeks relief under Subsection <xref depth="4" refnumber="67-3-1(12)(a)">(12)(a)</xref>:<subsection ssid="4-null-86" dnum="i-o" numlevel="1" lineno="562" slineno="4-167" level="3"><display>(i)</display>the state auditor is not required to exhaust the procedures in Subsection <xref depth="4" refnumber="67-3-1(7)">(7)</xref> or <xref depth="4" refnumber="67-3-1(8)">(8)</xref>; <ln numlevel="1" lineno="563" slineno="4-168"/>and</subsection><subsection ssid="4-null-87" dnum="ii-o" numlevel="1" lineno="564" slineno="4-169" level="3"><display>(ii)</display>the state treasurer may hold the public funds in accordance with Section <xref depth="3" refnumber="67-4-1">67-4-1</xref> if <ln numlevel="1" lineno="565" slineno="4-170"/>a court orders the public funds to be protected from improper diversion from their <ln numlevel="1" lineno="566" slineno="4-171"/>public purpose.</subsection></subsection></subsection><subsection ssid="4-null-88" dnum="13-o" numlevel="1" lineno="567" slineno="4-172" level="1"><display>(13)</display>The state auditor shall:<subsection ssid="4-null-89" dnum="a-o" numlevel="1" lineno="568" slineno="4-173" level="2"><display>(a)</display>establish audit guidelines and procedures for audits of local mental health and <ln numlevel="1" lineno="569" slineno="4-174"/>substance abuse authorities and their contract providers, conducted pursuant to Title <xref depth="1" refnumber="17-77"><ln numlevel="1" lineno="570" slineno="4-175"/>17, Chapter 77</xref>, Local Health and Human Services, Title <xref depth="1" refnumber="26B-5">26B, Chapter 5</xref>, Health Care <ln numlevel="1" lineno="571" slineno="4-176"/>- Substance Use and Mental Health, and Title <xref depth="1" refnumber="51-2a">51, Chapter 2a</xref>, Accounting Reports <ln numlevel="1" lineno="572" slineno="4-177"/>from Political Subdivisions, Interlocal Organizations, and Other Local Entities Act; <ln numlevel="1" lineno="573" slineno="4-178"/>and</subsection><subsection ssid="4-null-90" dnum="b-o" numlevel="1" lineno="574" slineno="4-179" level="2"><display>(b)</display>ensure that those guidelines and procedures provide assurances to the state that:<subsection ssid="4-null-91" dnum="i-o" numlevel="1" lineno="575" slineno="4-180" level="3"><display>(i)</display>state and federal funds appropriated to local mental health authorities are used for <ln numlevel="1" lineno="576" slineno="4-181"/>mental health purposes;</subsection><subsection ssid="4-null-92" dnum="ii-o" numlevel="1" lineno="577" slineno="4-182" level="3"><display>(ii)</display>a private provider under an annual or otherwise ongoing contract to provide <ln numlevel="1" lineno="578" slineno="4-183"/>comprehensive mental health programs or services for a local mental health <ln numlevel="1" lineno="579" slineno="4-184"/>authority is in compliance with state and local contract requirements and state and <ln numlevel="1" lineno="580" slineno="4-185"/>federal law;</subsection><subsection ssid="4-null-93" dnum="iii-o" numlevel="1" lineno="581" slineno="4-186" level="3"><display>(iii)</display>state and federal funds appropriated to local substance abuse authorities are used <ln numlevel="1" lineno="582" slineno="4-187"/>for substance abuse programs and services; and</subsection><subsection ssid="4-null-94" dnum="iv-o" numlevel="1" lineno="583" slineno="4-188" level="3"><display>(iv)</display>a private provider under an annual or otherwise ongoing contract to provide <ln numlevel="1" lineno="584" slineno="4-189"/>comprehensive substance abuse programs or services for a local substance abuse <ln numlevel="1" lineno="585" slineno="4-190"/>authority is in compliance with state and local contract requirements, and state and <ln numlevel="1" lineno="586" slineno="4-191"/>federal law.</subsection></subsection></subsection><subsection ssid="4-null-95" dnum="14-o" numlevel="1" lineno="587" slineno="4-192" level="1" space="false"><display>(14)</display><subsection ssid="4-null-96" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state auditor may, in accordance with the auditor's responsibilities for <ln numlevel="1" lineno="588" slineno="4-193"/>political subdivisions of the state as provided in Title <xref depth="1" refnumber="51-2a">51, Chapter 2a</xref>, Accounting <ln numlevel="1" lineno="589" slineno="4-194"/>Reports from Political Subdivisions, Interlocal Organizations, and Other Local <ln numlevel="1" lineno="590" slineno="4-195"/>Entities Act, initiate audits or investigations of any political subdivision that are <ln numlevel="1" lineno="591" slineno="4-196"/>necessary to determine honesty and integrity in fiscal affairs, accuracy and reliability <ln numlevel="1" lineno="592" slineno="4-197"/>of financial statements, effectiveness, and adequacy of financial controls and <ln numlevel="1" lineno="593" slineno="4-198"/>compliance with the law.</subsection><subsection ssid="4-null-97" dnum="b-o" numlevel="1" lineno="594" slineno="4-199" level="2"><display>(b)</display>If the state auditor receives notice under Subsection <xref depth="4" refnumber="11-41-104(7)">11-41-104(7)</xref> from the <ln numlevel="1" lineno="595" slineno="4-200"/>Governor's Office of Economic Opportunity on or after July 1, 2024, the state auditor <ln numlevel="1" lineno="596" slineno="4-201"/>may initiate an audit or investigation of the public entity subject to the notice to <ln numlevel="1" lineno="597" slineno="4-202"/>determine compliance with Section <xref depth="3" refnumber="11-41-103">11-41-103</xref>.</subsection></subsection><subsection ssid="4-null-98" dnum="15-o" numlevel="1" lineno="598" slineno="4-203" level="1" space="false"><display>(15)</display><subsection ssid="4-null-99" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state auditor may not audit work that the state auditor performed before <ln numlevel="1" lineno="599" slineno="4-204"/>becoming state auditor.</subsection><subsection ssid="4-null-100" dnum="b-o" numlevel="1" lineno="600" slineno="4-205" level="2"><display>(b)</display>If the state auditor has previously been a responsible official in state government <ln numlevel="1" lineno="601" slineno="4-206"/>whose work has not yet been audited, the Legislature shall:<subsection ssid="4-null-101" dnum="i-o" numlevel="1" lineno="602" slineno="4-207" level="3"><display>(i)</display>designate how that work shall be audited; and</subsection><subsection ssid="4-null-102" dnum="ii-o" numlevel="1" lineno="603" slineno="4-208" level="3"><display>(ii)</display>provide additional funding for those audits, if necessary.</subsection></subsection></subsection><subsection ssid="4-null-103" dnum="16-o" numlevel="1" lineno="604" slineno="4-209" level="1"><display>(16)</display>The state auditor shall:<subsection ssid="4-null-104" dnum="a-o" numlevel="1" lineno="605" slineno="4-210" level="2"><display>(a)</display>with the assistance, advice, and recommendations of an advisory committee <ln numlevel="1" lineno="606" slineno="4-211"/>appointed by the state auditor from among special district boards of trustees, officers, <ln numlevel="1" lineno="607" slineno="4-212"/>and employees and special service district boards, officers, and employees:<subsection ssid="4-null-105" dnum="i-o" numlevel="1" lineno="608" slineno="4-213" level="3"><display>(i)</display>prepare a Uniform Accounting Manual for Special Districts that:<subsection ssid="4-null-106" dnum="A-o" numlevel="1" lineno="609" slineno="4-214" level="4"><display>(A)</display>prescribes a uniform system of accounting and uniform budgeting and <ln numlevel="1" lineno="610" slineno="4-215"/>reporting procedures for special districts under Title <xref depth="0" refnumber="17B">17B, Limited Purpose <ln numlevel="1" lineno="611" slineno="4-216"/>Local Government Entities - Special Districts</xref>, and special service districts <ln numlevel="1" lineno="612" slineno="4-217"/>under Title <xref depth="1" refnumber="17D-1">17D, Chapter 1</xref>, Special Service District Act;</subsection><subsection ssid="4-null-107" dnum="B-o" numlevel="1" lineno="613" slineno="4-218" level="4"><display>(B)</display>conforms with generally accepted accounting principles; and</subsection><subsection ssid="4-null-108" dnum="C-o" numlevel="1" lineno="614" slineno="4-219" level="4"><display>(C)</display>prescribes reasonable exceptions and modifications for smaller districts to the <ln numlevel="1" lineno="615" slineno="4-220"/>uniform system of accounting, budgeting, and reporting;</subsection></subsection><subsection ssid="4-null-109" dnum="ii-o" numlevel="1" lineno="616" slineno="4-221" level="3"><display>(ii)</display>maintain the manual under this Subsection <xref depth="4" refnumber="67-3-1(16)(a)">(16)(a)</xref> so that the manual continues to <ln numlevel="1" lineno="617" slineno="4-222"/>reflect generally accepted accounting principles;</subsection><subsection ssid="4-null-110" dnum="iii-o" numlevel="1" lineno="618" slineno="4-223" level="3"><display>(iii)</display>conduct a continuing review and modification of procedures in order to improve <ln numlevel="1" lineno="619" slineno="4-224"/>them;</subsection><subsection ssid="4-null-111" dnum="iv-o" numlevel="1" lineno="620" slineno="4-225" level="3"><display>(iv)</display>prepare and supply each district with suitable budget and reporting forms; and</subsection><subsection ssid="4-null-112" dnum="v-o" numlevel="1" lineno="621" slineno="4-226" level="3" space="false"><display>(v)</display><subsection ssid="4-null-113" dnum="A-o" level="4" placement="sameline"><display>(A)</display>prepare instructional materials, conduct training programs, and render other <ln numlevel="1" lineno="622" slineno="4-227"/>services considered necessary to assist special districts and special service <ln numlevel="1" lineno="623" slineno="4-228"/>districts in implementing the uniform accounting, budgeting, and reporting <ln numlevel="1" lineno="624" slineno="4-229"/>procedures; and</subsection><subsection ssid="4-null-114" dnum="B-o" numlevel="1" lineno="625" slineno="4-230" level="4"><display>(B)</display>ensure that any training described in Subsection <xref depth="4" refnumber="67-3-1(16)(a)(v)(a)">(16)(a)(v)(A)</xref> complies with <ln numlevel="1" lineno="626" slineno="4-231"/>Title <xref depth="1" refnumber="63G-22">63G, Chapter 22</xref>, State Training and Certification Requirements; and</subsection></subsection></subsection><subsection ssid="4-null-115" dnum="b-o" numlevel="1" lineno="627" slineno="4-232" level="2"><display>(b)</display>continually analyze and evaluate the accounting, budgeting, and reporting practices <ln numlevel="1" lineno="628" slineno="4-233"/>and experiences of specific special districts and special service districts selected by <ln numlevel="1" lineno="629" slineno="4-234"/>the state auditor and make the information available to all districts.</subsection></subsection><subsection ssid="4-null-116" dnum="17-o" numlevel="1" lineno="630" slineno="4-235" level="1" space="false"><display>(17)</display><subsection ssid="4-null-117" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The following records in the custody or control of the state auditor are protected <ln numlevel="1" lineno="631" slineno="4-236"/>records under Title <xref depth="1" refnumber="63G-2">63G, Chapter 2</xref>, Government Records Access and Management <ln numlevel="1" lineno="632" slineno="4-237"/>Act:<subsection ssid="4-null-118" dnum="i-o" numlevel="1" lineno="633" slineno="4-238" level="3" tab="1"><display>(i)</display>records that would disclose information relating to allegations of personal <ln numlevel="1" lineno="634" slineno="4-239"/>misconduct, gross mismanagement, or illegal activity of a past or present <ln numlevel="1" lineno="635" slineno="4-240"/>governmental employee if the information or allegation cannot be corroborated by <ln numlevel="1" lineno="636" slineno="4-241"/>the state auditor through other documents or evidence, and the records relating to <ln numlevel="1" lineno="637" slineno="4-242"/>the allegation are not relied upon by the state auditor in preparing a final audit <ln numlevel="1" lineno="638" slineno="4-243"/>report;</subsection><subsection ssid="4-null-119" dnum="ii-o" numlevel="1" lineno="639" slineno="4-244" level="3" tab="1"><display>(ii)</display>records and audit workpapers to the extent the workpapers would disclose the <ln numlevel="1" lineno="640" slineno="4-245"/>identity of an individual who during the course of an audit, communicated the <ln numlevel="1" lineno="641" slineno="4-246"/>existence of any waste of public funds, property, or manpower, or a violation or <ln numlevel="1" lineno="642" slineno="4-247"/>suspected violation of a law, rule, or regulation adopted under the laws of this <ln numlevel="1" lineno="643" slineno="4-248"/>state, a political subdivision of the state, or any recognized entity of the United <ln numlevel="1" lineno="644" slineno="4-249"/>States, if the information was disclosed on the condition that the identity of the <ln numlevel="1" lineno="645" slineno="4-250"/>individual be protected;</subsection><subsection ssid="4-null-120" dnum="iii-o" numlevel="1" lineno="646" slineno="4-251" level="3" tab="1"><display>(iii)</display>before an audit is completed and the final audit report is released, records or <ln numlevel="1" lineno="647" slineno="4-252"/>drafts circulated to an individual who is not an employee or head of a <ln numlevel="1" lineno="648" slineno="4-253"/>governmental entity for the individual's response or information;</subsection><subsection ssid="4-null-121" dnum="iv-o" numlevel="1" lineno="649" slineno="4-254" level="3" tab="1"><display>(iv)</display>records that would disclose an outline or part of any audit survey plans or audit <ln numlevel="1" lineno="650" slineno="4-255"/>program; and</subsection><subsection ssid="4-null-122" dnum="v-o" numlevel="1" lineno="651" slineno="4-256" level="3" tab="1"><display>(v)</display>requests for audits, if disclosure would risk circumvention of an audit.</subsection></subsection><subsection ssid="4-null-123" dnum="b-o" numlevel="1" lineno="652" slineno="4-257" level="2"><display>(b)</display>The provisions of Subsections <xref depth="4" refnumber="67-3-1(17)(a)(i)">(17)(a)(i)</xref>, <xref refnumber="67-3-1(17)(a)(ii)" depth="4">(ii)</xref>, and <xref refnumber="67-3-1(17)(a)(iii)" depth="4">(iii) </xref>do not prohibit the disclosure <ln numlevel="1" lineno="653" slineno="4-258"/>of records or information that relate to a violation of the law by a governmental entity <ln numlevel="1" lineno="654" slineno="4-259"/>or employee to a government prosecutor or peace officer.</subsection><subsection ssid="4-null-124" dnum="c-o" numlevel="1" lineno="655" slineno="4-260" level="2"><display>(c)</display>The provisions of this Subsection <xref depth="4" refnumber="67-3-1(17)">(17)</xref> do not limit the authority otherwise given to <ln numlevel="1" lineno="656" slineno="4-261"/>the state auditor to classify a document as public, private, controlled, or protected <ln numlevel="1" lineno="657" slineno="4-262"/>under Title <xref depth="1" refnumber="63G-2">63G, Chapter 2</xref>, Government Records Access and Management Act.</subsection><subsection ssid="4-null-125" dnum="d-o" numlevel="1" lineno="658" slineno="4-263" level="2" space="false"><display>(d)</display><subsection ssid="4-null-126" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As used in this Subsection <xref depth="4" refnumber="67-3-1(17)(d)">(17)(d)</xref>, "record dispute" means a dispute between <ln numlevel="1" lineno="659" slineno="4-264"/>the state auditor and the subject of an audit performed by the state auditor as to <ln numlevel="1" lineno="660" slineno="4-265"/>whether the state auditor may release a record, as defined in Section <xref depth="3" refnumber="63G-2-103">63G-2-103</xref>, <ln numlevel="1" lineno="661" slineno="4-266"/>to the public that the state auditor gained access to in the course of the state <ln numlevel="1" lineno="662" slineno="4-267"/>auditor's audit but which the subject of the audit claims is not subject to disclosure <ln numlevel="1" lineno="663" slineno="4-268"/>under Title <xref depth="1" refnumber="63G-2">63G, Chapter 2</xref>, Government Records Access and Management Act.</subsection><subsection ssid="4-null-127" dnum="ii-o" numlevel="1" lineno="664" slineno="4-269" level="3"><display>(ii)</display>The state auditor may submit a record dispute to the director of the Government <ln numlevel="1" lineno="665" slineno="4-270"/>Records Office, created in Section <xref depth="3" refnumber="63A-12-202">63A-12-202</xref>, for a determination of whether the <ln numlevel="1" lineno="666" slineno="4-271"/>state auditor may, in conjunction with the state auditor's release of an audit report, <ln numlevel="1" lineno="667" slineno="4-272"/>release to the public the record that is the subject of the record dispute.</subsection><subsection ssid="4-null-128" dnum="iii-o" numlevel="1" lineno="668" slineno="4-273" level="3"><display>(iii)</display>The state auditor or the subject of the audit may seek judicial review of the <ln numlevel="1" lineno="669" slineno="4-274"/>director's determination, described in Subsection <xref depth="4" refnumber="67-3-1(17)(d)(ii)">(17)(d)(ii)</xref>, as provided in <ln numlevel="1" lineno="670" slineno="4-275"/>Section <xref depth="3" refnumber="63G-2-404">63G-2-404</xref>.</subsection></subsection></subsection><subsection ssid="4-null-129" dnum="18-o" numlevel="1" lineno="671" slineno="4-276" level="1"><display>(18)</display>If the state auditor conducts an audit of an entity that the state auditor has previously <ln numlevel="1" lineno="672" slineno="4-277"/>audited and finds that the entity has not implemented a recommendation made by the <ln numlevel="1" lineno="673" slineno="4-278"/>state auditor in a previous audit, the state auditor shall notify the Legislative <ln numlevel="1" lineno="674" slineno="4-279"/>Management Committee through the Legislative Management Committee's Audit <ln numlevel="1" lineno="675" slineno="4-280"/>Subcommittee that the entity has not implemented that recommendation.</subsection><subsection ssid="4-null-130" dnum="19-o" numlevel="1" lineno="676" slineno="4-281" level="1"><display>(19)</display>The state auditor shall, with the advice and consent of the Senate, appoint the state <ln numlevel="1" lineno="677" slineno="4-282"/>privacy auditor described in Section <xref depth="3" refnumber="67-3-13">67-3-13</xref>.</subsection><subsection ssid="4-null-131" dnum="20-o" numlevel="1" lineno="678" slineno="4-283" level="1"><display>(20)</display>Except as provided in Subsection <xref depth="4" refnumber="67-3-1(21)">(21)</xref>, the state auditor shall report, or ensure that <ln numlevel="1" lineno="679" slineno="4-284"/>another government entity reports, on the financial, operational, and performance <ln numlevel="1" lineno="680" slineno="4-285"/>metrics for the state system of higher education and the state system of public education, <ln numlevel="1" lineno="681" slineno="4-286"/>including metrics in relation to students, programs, and schools within those systems.</subsection><subsection ssid="4-null-132" dnum="21-o" numlevel="1" lineno="682" slineno="4-287" level="1" space="false"><display>(21)</display><subsection ssid="4-null-133" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding Subsection <xref depth="4" refnumber="67-3-1(20)">(20)</xref>, the state auditor shall conduct regular audits of:<subsection ssid="4-null-134" dnum="i-o" numlevel="1" lineno="683" slineno="4-288" level="3" tab="1"><display>(i)</display>the scholarship granting organization for the Carson Smith Opportunity <ln numlevel="1" lineno="684" slineno="4-289"/>Scholarship Program, created in Section <xref depth="3" refnumber="53E-7-402">53E-7-402</xref>;</subsection><subsection ssid="4-null-135" dnum="ii-o" numlevel="1" lineno="685" slineno="4-290" level="3" tab="1"><display>(ii)</display>the State Board of Education for the Carson Smith Scholarship Program, created <ln numlevel="1" lineno="686" slineno="4-291"/>in Section <xref depth="3" refnumber="53F-4-302">53F-4-302</xref>; and</subsection><subsection ssid="4-null-136" dnum="iii-o" numlevel="1" lineno="687" slineno="4-292" level="3" tab="1"><display>(iii)</display>the scholarship program manager for the Utah Fits All Scholarship Program, <ln numlevel="1" lineno="688" slineno="4-293"/>created in Section <xref depth="3" refnumber="53F-6-402">53F-6-402</xref>, including an analysis of the cost effectiveness of the <ln numlevel="1" lineno="689" slineno="4-294"/>program, taking into consideration the amount of the scholarship and the amount <ln numlevel="1" lineno="690" slineno="4-295"/>of state and local funds dedicated on a per-student basis within the traditional <ln numlevel="1" lineno="691" slineno="4-296"/>public education system.</subsection></subsection><subsection ssid="4-null-137" dnum="b-o" numlevel="1" lineno="692" slineno="4-297" level="2"><display>(b)</display>Nothing in this subsection limits or impairs the authority of the State Board of <ln numlevel="1" lineno="693" slineno="4-298"/>Education to administer the programs described in Subsection <xref depth="4" refnumber="67-3-1(21)(a)">(21)(a)</xref>.</subsection></subsection><subsection ssid="4-null-138" dnum="22-o" numlevel="1" lineno="694" slineno="4-299" level="1"><display>(22)</display>The state auditor shall, based on the information posted by the Office of Legislative <ln numlevel="1" lineno="695" slineno="4-300"/>Research and General Counsel under Subsection <xref depth="4" refnumber="36-12-12.1(2)">36-12-12.1(2)</xref>, for each policy, track <ln numlevel="1" lineno="696" slineno="4-301"/>and post the following information on the state auditor's website:<subsection ssid="4-null-139" dnum="a-o" numlevel="1" lineno="697" slineno="4-302" level="2"><display>(a)</display>the information posted under Subsections <xref depth="4" refnumber="36-12-12.1(2)(a)">36-12-12.1(2)(a)</xref> through <xref depth="4" refnumber="67-3-1(e)">(e)</xref>;</subsection><subsection ssid="4-null-140" dnum="b-o" numlevel="1" lineno="698" slineno="4-303" level="2"><display>(b)</display>an indication regarding whether the policy is timely adopted, adopted late, or not <ln numlevel="1" lineno="699" slineno="4-304"/>adopted;</subsection><subsection ssid="4-null-141" dnum="c-o" numlevel="1" lineno="700" slineno="4-305" level="2"><display>(c)</display>an indication regarding whether the policy complies with the requirements <ln numlevel="1" lineno="701" slineno="4-306"/>established by law for the policy; and</subsection><subsection ssid="4-null-142" dnum="d-o" numlevel="1" lineno="702" slineno="4-307" level="2"><display>(d)</display>a link to the policy.</subsection></subsection><subsection ssid="4-null-143" dnum="23-o" numlevel="1" lineno="703" slineno="4-308" level="1" space="false"><display>(23)</display><subsection ssid="4-null-144" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A legislator may request that the state auditor conduct an inquiry to determine <ln numlevel="1" lineno="704" slineno="4-309"/>whether a government entity, government official, or government employee has <ln numlevel="1" lineno="705" slineno="4-310"/>complied with a legal obligation directly imposed, by statute, on the government <ln numlevel="1" lineno="706" slineno="4-311"/>entity, government official, or government employee.</subsection><subsection ssid="4-null-145" dnum="b-o" numlevel="1" lineno="707" slineno="4-312" level="2"><display>(b)</display>The state auditor may, upon receiving a request under Subsection <xref depth="4" refnumber="67-3-1(23)(a)">(23)(a)</xref>, conduct <ln numlevel="1" lineno="708" slineno="4-313"/>the inquiry requested.</subsection><subsection ssid="4-null-146" dnum="c-o" numlevel="1" lineno="709" slineno="4-314" level="2"><display>(c)</display>If the state auditor conducts the inquiry described in Subsection <xref depth="4" refnumber="67-3-1(23)(b)">(23)(b)</xref>, the state <ln numlevel="1" lineno="710" slineno="4-315"/>auditor shall post the results of the inquiry on the state auditor's website.</subsection><subsection ssid="4-null-147" dnum="d-o" numlevel="1" lineno="711" slineno="4-316" level="2"><display>(d)</display>The state auditor may limit the inquiry described in this Subsection <xref depth="4" refnumber="67-3-1(23)">(23)</xref> to a simple <ln numlevel="1" lineno="712" slineno="4-317"/>determination, without conducting an audit, regarding whether the obligation was <ln numlevel="1" lineno="713" slineno="4-318"/>fulfilled.</subsection></subsection><subsection ssid="4-null-148" dnum="24-o" numlevel="1" lineno="714" slineno="4-319" level="1"><display>(24)</display>The state auditor shall:<subsection ssid="4-null-149" dnum="a-o" numlevel="1" lineno="715" slineno="4-320" level="2"><display>(a)</display>ensure compliance with Title <xref depth="1" refnumber="63G-31">63G, Chapter 31</xref>, Distinctions on the Basis of Sex, in <ln numlevel="1" lineno="716" slineno="4-321"/>accordance with Section <xref depth="3" refnumber="63G-31-401">63G-31-401</xref>; and</subsection><subsection ssid="4-null-150" dnum="b-o" numlevel="1" lineno="717" slineno="4-322" level="2"><display>(b)</display>report to the Legislative Management Committee, upon request, regarding the state <ln numlevel="1" lineno="718" slineno="4-323"/>auditor's actions under this Subsection <xref depth="4" refnumber="67-3-1(24)">(24)</xref>.</subsection></subsection><subsection ssid="4-null-151" dnum="25-o" numlevel="1" lineno="719" slineno="4-324" level="1"><display>(25)</display>The state auditor shall report compliance with Sections <xref depth="3" refnumber="67-27-107">67-27-107</xref>, <xref depth="3" refnumber="67-27-108">67-27-108</xref>, and <xref depth="3" refnumber="67-27-109"><ln numlevel="1" lineno="720" slineno="4-325"/>67-27-109</xref> by:<subsection ssid="4-null-152" dnum="a-o" numlevel="1" lineno="721" slineno="4-326" level="2"><display>(a)</display>establishing a process to receive and audit each alleged violation; and</subsection><subsection ssid="4-null-153" dnum="b-o" numlevel="1" lineno="722" slineno="4-327" level="2"><display>(b)</display>reporting to the Legislative Management Committee, upon request, regarding the <ln numlevel="1" lineno="723" slineno="4-328"/>state auditor's findings and recommendations under this Subsection <xref depth="4" refnumber="67-3-1(25)">(25)</xref>.</subsection></subsection><subsection ssid="4-null-154" dnum="26-o" numlevel="1" lineno="724" slineno="4-329" level="1"><display>(26)</display>The state auditor shall ensure compliance with Section <xref depth="3" refnumber="63G-1-704">63G-1-704</xref> regarding the <ln numlevel="1" lineno="725" slineno="4-330"/>display of flags in or on government property.</subsection><subsection ssid="4-183" dnum="_-o:27-i" numlevel="1" lineno="726" slineno="4-331" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1367" style="1" owner="i" level="1" amendtag="start">(27)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">The state auditor shall ensure compliance with Section <xref depth="3" refnumber="53G-10-204">53G-10-204</xref> regarding a public <ln numlevel="1" lineno="727" slineno="4-332"/>entity's use of character education.</amend></subsection><subsection ssid="4-null-155" dnum="27-o:28-i" numlevel="1" lineno="728" slineno="4-333" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1368" style="2" owner="o" level="1" deltag="both">(27)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1369" style="1" owner="i" level="1" amendtag="both" space="true">(28)</amend></display><subsection ssid="4-null-156" dnum="a-o" level="2" placement="sameline"><display>(a)</display>On or before January 31 each year, the state auditor shall prepare a report <ln numlevel="1" lineno="729" slineno="4-334"/>that states, for each entity that holds public funds as defined in Section <xref depth="3" refnumber="51-7-3">51-7-3</xref>, the <ln numlevel="1" lineno="730" slineno="4-335"/>entity's total balance, as of the last day of the immediately preceding fiscal year, of <ln numlevel="1" lineno="731" slineno="4-336"/>cash, cash equivalents, and investments, as those terms are defined under the <ln numlevel="1" lineno="732" slineno="4-337"/>standards established by the Governmental Accounting Standards Board.</subsection><subsection ssid="4-null-157" dnum="b-o" numlevel="1" lineno="733" slineno="4-338" level="2"><display>(b)</display>The state auditor shall make the report described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="84" groupid="58" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="67-3-1(27)(a)">(27)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="83" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="(28)(a)" depth="4">(28)(a)</xref></amend> <ln numlevel="1" lineno="734" slineno="4-339"/>publicly available on a website that the state auditor maintains.</subsection></subsection></section></bsec><bsec buid="12" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="735" slineno="5-1" sn="5"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="735">Section 5.  <bold>Effective Date.</bold></secline><sectionText lineno="736"><amend anum="0" ea="amend"
