Section <bold>36-2-2</bold> is amended to read:</secline><catline lineno="31"><bold>36-2-2<parens/>. Salaries and expenses of members -- Compensation of in-session <ln numlevel="1" lineno="32" slineno="1-3"/>employees.</bold></catline><subsection ssid="16-null-1" dnum="1-o" numlevel="1" lineno="33" slineno="1-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="16-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="both">Unless rejected or lowered</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except</amend> as provided in Section <xref depth="3" refnumber="36-2-3">36-2-3</xref>, beginning in <ln numlevel="1" lineno="34" slineno="1-5"/>2001 and in each odd-numbered year after that year, members of the Legislature shall <ln numlevel="1" lineno="35" slineno="1-6"/>receive a salary equal to the amount recommended by the Legislative Compensation <ln numlevel="1" lineno="36" slineno="1-7"/>Commission in the last report issued by the commission in the previous <ln numlevel="1" lineno="37" slineno="1-8"/>even-numbered year.</subsection><subsection ssid="16-null-3" dnum="b-o" numlevel="1" lineno="38" slineno="1-9" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">Unless rejected or lowered</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except</amend> as provided in Section <xref depth="3" refnumber="36-2-3">36-2-3</xref>, beginning in 2001 <ln numlevel="1" lineno="39" slineno="1-10"/>and in each odd-numbered year after that year, members of the Legislature shall <ln numlevel="1" lineno="40" slineno="1-11"/>receive a salary for attendance at a veto-override, special session, and other <ln numlevel="1" lineno="41" slineno="1-12"/>authorized legislative meetings equal to the amount recommended by the Legislative <ln numlevel="1" lineno="42" slineno="1-13"/>Compensation Commission in the last report issued by the commission in the <ln numlevel="1" lineno="43" slineno="1-14"/>previous even-numbered year.</subsection></subsection><subsection ssid="16-null-4" dnum="2-o" numlevel="1" lineno="44" slineno="1-15" level="1" space="false"><display>(2)</display><subsection ssid="16-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">Unless rejected or lowered</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except</amend> as provided in Section <xref depth="3" refnumber="36-2-3">36-2-3</xref>, beginning in <ln numlevel="1" lineno="45" slineno="1-16"/>2001 and in each odd-numbered year after that year, the president of the Senate and <ln numlevel="1" lineno="46" slineno="1-17"/>the speaker of the House of Representatives shall receive a salary equal to the amount <ln numlevel="1" lineno="47" slineno="1-18"/>recommended by the Legislative Compensation Commission in the last report issued <ln numlevel="1" lineno="48" slineno="1-19"/>by the commission in the previous even-numbered year.</subsection><subsection ssid="16-null-6" dnum="b-o" numlevel="1" lineno="49" slineno="1-20" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">Beginning</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Section <xref depth="3" refnumber="36-2-3">36-2-3</xref>, beginning</amend> in 2001 and in each <ln numlevel="1" lineno="50" slineno="1-21"/>odd-numbered year after that year, the majority and minority leadership of each <ln numlevel="1" lineno="51" slineno="1-22"/>chamber shall receive a salary equal to the amount recommended by the Legislative <ln numlevel="1" lineno="52" slineno="1-23"/>Compensation Commission in the last report issued by the commission in the <ln numlevel="1" lineno="53" slineno="1-24"/>previous even-numbered year.</subsection></subsection><subsection ssid="16-null-7" dnum="3-o" numlevel="1" lineno="54" slineno="1-25" level="1"><display>(3)</display>The Legislature shall:<subsection ssid="16-null-8" dnum="a-o" numlevel="1" lineno="55" slineno="1-26" level="2"><display>(a)</display>establish, by joint rule of the Legislature, the expenses of its members; and</subsection><subsection ssid="16-null-9" dnum="b-o" numlevel="1" lineno="56" slineno="1-27" level="2"><display>(b)</display>ensure that the rules governing expenses are based upon:<subsection ssid="16-null-10" dnum="i-o" numlevel="1" lineno="57" slineno="1-28" level="3"><display>(i)</display>payment of necessary expenses for attendance during legislative sessions;</subsection><subsection ssid="16-null-11" dnum="ii-o" numlevel="1" lineno="58" slineno="1-29" level="3"><display>(ii)</display>a mileage allowance; and</subsection><subsection ssid="16-null-12" dnum="iii-o" numlevel="1" lineno="59" slineno="1-30" level="3"><display>(iii)</display>reimbursement for other expenses involved in the performance of legislative <ln numlevel="1" lineno="60" slineno="1-31"/>duties.</subsection></subsection></subsection></section></bsec><bsec buid="17" num="36-2-3" type="amend" src="code" uid="C36-2-S3_2026050620260506" sort="36 02 00030020260506" numlevel="1" lineno="61" slineno="2-1" sn="2"><section number="36-2-3" numlevel="1" lineno="62" slineno="2-2" type="amend"><secline lineno="61">Section 2. Section <bold>36-2-3</bold> is amended to read:</secline><catline lineno="62"><bold>36-2-3<parens/>. Salaries of members set by Legislature and State Board of Education <ln numlevel="1" lineno="63" slineno="2-3"/>based on recommendations of Legislative Compensation Commission.</bold></catline><subsection ssid="17-null-1" dnum="1-o" numlevel="1" lineno="64" slineno="2-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="17-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="36-2-3(2)" start="0">(2)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both"> or <xref depth="4" refnumber="36-2-3(3)" start="0">(3)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">, (3), or (4)</amend>, the salaries of members <ln numlevel="1" lineno="65" slineno="2-5"/>of the Legislature shall automatically be set beginning January 1 of each <ln numlevel="1" lineno="66" slineno="2-6"/>odd-numbered year at the amount recommended by the Legislative Compensation <ln numlevel="1" lineno="67" slineno="2-7"/>Commission in the last report issued by the commission in the preceding <ln numlevel="1" lineno="68" slineno="2-8"/>even-numbered year.</subsection><subsection ssid="17-null-3" dnum="b-o" numlevel="1" lineno="69" slineno="2-9" level="2"><display>(b)</display>This salary recommendation shall be based on either:<subsection ssid="17-null-4" dnum="i-o" numlevel="1" lineno="70" slineno="2-10" level="3"><display>(i)</display>a daily basis:<subsection ssid="17-null-5" dnum="A-o" numlevel="1" lineno="71" slineno="2-11" level="4"><display>(A)</display>for each calendar day for annual general sessions; and</subsection><subsection ssid="17-null-6" dnum="B-o" numlevel="1" lineno="72" slineno="2-12" level="4"><display>(B)</display>for each day a legislator attends veto-override and special sessions and other <ln numlevel="1" lineno="73" slineno="2-13"/>authorized legislative meetings; or</subsection></subsection><subsection ssid="17-null-7" dnum="ii-o" numlevel="1" lineno="74" slineno="2-14" level="3"><display>(ii)</display>an annualized salary.</subsection></subsection><subsection ssid="17-null-8" dnum="c-o" numlevel="1" lineno="75" slineno="2-15" level="2"><display>(c)</display>In preparing its report, the commission may recommend salary amounts that:<subsection ssid="17-null-9" dnum="i-o" numlevel="1" lineno="76" slineno="2-16" level="3"><display>(i)</display>take into account the amounts received by legislators for legislative expenses; and</subsection><subsection ssid="17-null-10" dnum="ii-o" numlevel="1" lineno="77" slineno="2-17" level="3"><display>(ii)</display>provide alternative salary amounts based upon the occurrence of various <ln numlevel="1" lineno="78" slineno="2-18"/>contingencies.</subsection></subsection></subsection><subsection ssid="17-null-11" dnum="2-o" numlevel="1" lineno="79" slineno="2-19" level="1" space="false"><display>(2)</display><subsection ssid="17-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>During an even-numbered annual general session or special session in the year <ln numlevel="1" lineno="80" slineno="2-20"/>immediately preceding the effective date of any salary change, the Legislature may <ln numlevel="1" lineno="81" slineno="2-21"/>reject or decrease the salary recommendation, but may not increase the salary <ln numlevel="1" lineno="82" slineno="2-22"/>recommendation.</subsection><subsection ssid="17-null-13" dnum="b-o" numlevel="1" lineno="83" slineno="2-23" level="2"><display>(b)</display>If the Legislature does not act as provided in Subsection <xref depth="4" refnumber="36-2-3(2)(a)" start="0">(2)(a)</xref>, they have by law <ln numlevel="1" lineno="84" slineno="2-24"/>accepted the Legislative Compensation Commission's recommendations contained in <ln numlevel="1" lineno="85" slineno="2-25"/>the last report issued by the commission in the preceding even-numbered year.</subsection></subsection><subsection ssid="17-null-14" dnum="3-o" numlevel="1" lineno="86" slineno="2-26" level="1"><display>(3)</display>If the last report issued by the commission in an even-numbered year recommends a <ln numlevel="1" lineno="87" slineno="2-27"/>salary contingent upon certain action being taken by the Legislature, that contingent <ln numlevel="1" lineno="88" slineno="2-28"/>legislative salary:<subsection ssid="17-null-15" dnum="a-o" numlevel="1" lineno="89" slineno="2-29" level="2"><display>(a)</display>takes effect on the day after the day that the contingent action is taken by the <ln numlevel="1" lineno="90" slineno="2-30"/>Legislature; and</subsection><subsection ssid="17-null-16" dnum="b-o" numlevel="1" lineno="91" slineno="2-31" level="2"><display>(b)</display>supersedes any other salary in effect as of January 1.</subsection></subsection><subsection ssid="17-26" dnum="_-o:4-i" numlevel="1" lineno="92" slineno="2-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">If a legislator elects to use legislator leave as provided in Section <xref depth="3" refnumber="53G-11-210">53G-11-210</xref> or <xref depth="3" refnumber="63A-17-513"><ln numlevel="1" lineno="93" slineno="2-33"/>63A-17-513</xref>, the legislator may not receive salary under this part for any day for which <ln numlevel="1" lineno="94" slineno="2-34"/>the legislator elects to use legislator leave.</amend></subsection><subsection ssid="17-null-17" dnum="4-o:5-i" numlevel="1" lineno="95" slineno="2-35" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display><subsection ssid="17-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The salary for a member of the State Board of Education shall be:<subsection ssid="17-null-19" dnum="i-o" numlevel="1" lineno="96" slineno="2-36" level="3" tab="1"><display>(i)</display>the same as the salary for a member of the Legislature; and</subsection><subsection ssid="17-null-20" dnum="ii-o" numlevel="1" lineno="97" slineno="2-37" level="3" tab="1"><display>(ii)</display>except as provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="36-2-3(4)(b)" start="0">(4)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(5)(b)</amend>, set in accordance with this <ln numlevel="1" lineno="98" slineno="2-38"/>section and Subsection <xref depth="4" refnumber="36-2-2(1)" start="0">36-2-2(1)</xref>.</subsection></subsection><subsection ssid="17-null-21" dnum="b-o" numlevel="1" lineno="99" slineno="2-39" level="2"><display>(b)</display>For purposes of setting the salary for a member of the State Board of Education:<subsection ssid="17-null-22" dnum="i-o" numlevel="1" lineno="100" slineno="2-40" level="3"><display>(i)</display>a calendar day for the annual general session described in Subsection <xref depth="4" refnumber="36-2-3(1)(b)(i)(A)" start="0">(1)(b)(i)(A)</xref> <ln numlevel="1" lineno="101" slineno="2-41"/>is interpreted as a calendar day of:<subsection ssid="17-null-23" dnum="A-o" numlevel="1" lineno="102" slineno="2-42" level="4"><display>(A)</display>a meeting of the State Board of Education; and</subsection><subsection ssid="17-null-24" dnum="B-o" numlevel="1" lineno="103" slineno="2-43" level="4"><display>(B)</display>any other meeting authorized by the State Board of Education; and</subsection></subsection><subsection ssid="17-null-25" dnum="ii-o" numlevel="1" lineno="104" slineno="2-44" level="3"><display>(ii)</display>unless the Legislative Compensation Commission issues a revised report on or <ln numlevel="1" lineno="105" slineno="2-45"/>after July 1, 2016, the salary for a member of the State Board of Education <ln numlevel="1" lineno="106" slineno="2-46"/>through calendar year 2016 is $273 per day for each calendar day that a member <ln numlevel="1" lineno="107" slineno="2-47"/>attends a meeting described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="36-2-3(4)(b)(i)(A)" start="0">(4)(b)(i)(A)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(5)(b)(i)(A)</amend> or <xref depth="4" refnumber="36-2-3(4)(b)(i)(B)" start="0">(B)</xref>.</subsection></subsection></subsection></section></bsec><bsec buid="13" num="49-11-506" type="enact" src="code" uid="C49-11-S506_2026050620260506" sort="49 11 05060020260506" numlevel="1" lineno="108" slineno="3-1" sn="3"><section numlevel="1" lineno="109" slineno="3-2" number="49-11-506" type="enact"><secline lineno="108">Section 3. Section <bold>49-11-506</bold> is enacted to read:</secline><catline lineno="109"><bold>49-11-506<parens/>. Effect of legislator leave on service credit accrual and retirement <ln numlevel="1" lineno="110" slineno="3-3"/>related contributions.</bold></catline><sectionText lineno="111"><para/><amend anum="0" ea="amend" pairid="36" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both">For any day for which an employee elects to use legislator leave as provided in Section <xref depth="3" refnumber="53G-11-210"><ln numlevel="1" lineno="112" slineno="3-5"/>53G-11-210</xref> or <xref depth="3" refnumber="63A-17-513">63A-17-513</xref>:</amend></sectionText><subsection ssid="13-6" dnum="_-o:1-i" numlevel="1" lineno="113" slineno="3-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">the employee will continue to accrue service credit;</amend></subsection><subsection ssid="13-7" dnum="_-o:2-i" numlevel="1" lineno="114" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">the participating employer shall continue to pay the employee's retirement related <ln numlevel="1" lineno="115" slineno="3-8"/>contributions; and</amend></subsection><subsection ssid="13-5" dnum="_-o:3-i" numlevel="1" lineno="116" slineno="3-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">the employee may not accrue service credit or receive retirement related contributions <ln numlevel="1" lineno="117" slineno="3-10"/>for the employee's service as a legislator.</amend></subsection></section></bsec><bsec buid="5" num="53G-11-210" type="enact" src="code" uid="C53G-11-S210_2026050620260506" sort="53G11 02100020260506" numlevel="1" lineno="118" slineno="4-1" sn="4"><section numlevel="1" lineno="119" slineno="4-2" number="53G-11-210" type="enact"><secline lineno="118">Section 4. or</amend></subsection><subsection ssid="5-7" dnum="_-o:iii-i" numlevel="1" lineno="126" slineno="4-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">an individual who has been elected as a member described in Subsection <xref depth="4" refnumber="53G-11-210(1)(b)(i)">(1)(b)(i)</xref> <ln numlevel="1" lineno="127" slineno="4-10"/>or <xref depth="4" refnumber="53G-11-210(ii)">(ii)</xref>, but has not yet been sworn in or begun the individual's term of office.</amend></subsection></subsection><subsection ssid="5-20" dnum="_-o:c-i" numlevel="1" lineno="128" slineno="4-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">"Legislator leave" means the leave described in Subsection <xref depth="4" refnumber="53G-11-210(2)(a)">(2)(a)</xref>.</amend></subsection><subsection ssid="5-9" dnum="_-o:d-i" numlevel="1" lineno="129" slineno="4-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">"Teacher" means an individual employed by a school district or charter school who <ln numlevel="1" lineno="130" slineno="4-13"/>is required to hold an educator license issued by the state board and who has an <ln numlevel="1" lineno="131" slineno="4-14"/>assignment to teach in a classroom.</amend></subsection></subsection><subsection ssid="5-10" dnum="_-o:2-i" numlevel="1" lineno="132" slineno="4-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="5-17" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA shall develop a leave policy that grants a teacher who is a legislator paid <ln numlevel="1" lineno="133" slineno="4-16"/>leave for an authorized legislative day for the number of hours the legislator requests.</amend></subsection><subsection ssid="5-18" dnum="_-o:b-i" numlevel="1" lineno="134" slineno="4-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="84" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">In a policy described in Subsection <xref depth="4" refnumber="53G-11-210(2)(a)">(2)(a)</xref>, the LEA shall:</amend><subsection ssid="5-15" dnum="_-o:i-i" numlevel="1" lineno="135" slineno="4-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">require a legislator who wishes to use legislator leave for an authorized legislative <ln numlevel="1" lineno="136" slineno="4-19"/>day that is during an annual general session, to use legislator leave for the total <ln numlevel="1" lineno="137" slineno="4-20"/>number of hours that the legislator is absent from the legislator's position during <ln numlevel="1" lineno="138" slineno="4-21"/>the annual general session; and</amend></subsection><subsection ssid="5-11" dnum="_-o:ii-i" numlevel="1" lineno="139" slineno="4-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">ensure the policy is no more restrictive than the provisions of Section <xref depth="3" refnumber="63A-17-513">63A-17-513</xref>.</amend></subsection></subsection></subsection><subsection ssid="5-24" dnum="_-o:3-i" numlevel="1" lineno="140" slineno="4-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="5-28" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to legislative appropriation and Subsection <xref depth="4" refnumber="53G-11-210(3)(b)">(3)(b)</xref>, upon request by a <ln numlevel="1" lineno="141" slineno="4-24"/>legislator's employer, the legislator's chamber shall reimburse the legislator's <ln numlevel="1" lineno="142" slineno="4-25"/>employer for the cost of any legislator leave the employer granted the legislator <ln numlevel="1" lineno="143" slineno="4-26"/>during the immediately preceding annual general session.</amend></subsection><subsection ssid="5-27" dnum="_-o:b-i" numlevel="1" lineno="144" slineno="4-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">The total amount of reimbursements made under Subsection <xref depth="4" refnumber="53G-11-210(3)(a)">(3)(a)</xref> and Subsection <xref depth="4" refnumber="63A-17-513(4)"><ln numlevel="1" lineno="145" slineno="4-28"/>63A-17-513(4)</xref> may not exceed the amount equal to the total savings resulting from <ln numlevel="1" lineno="146" slineno="4-29"/>legislators' ineligibility for salary under Section <xref depth="3" refnumber="36-2-3">36-2-3</xref> and retirement related <ln numlevel="1" lineno="147" slineno="4-30"/>contributions under Section <xref depth="3" refnumber="49-11-506">49-11-506</xref>.</amend></subsection></subsection><subsection ssid="5-29" dnum="_-o:4-i" numlevel="1" lineno="148" slineno="4-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="end">If a legislator chooses not to use legislator leave for an authorized legislative day, the <ln numlevel="1" lineno="149" slineno="4-32"/>legislator and the LEA may agree to a different arrangement that accommodates the <ln numlevel="1" lineno="150" slineno="4-33"/>legislator's legislative service for the authorized legislative day.</amend></subsection></section></bsec><bsec buid="1" num="63A-17-513" type="amend" src="code" uid="C63A-17-S513_2026050620260506" sort="63A17 05130020260506" numlevel="1" lineno="151" slineno="5-1" sn="5"><section number="63A-17-513" numlevel="1" lineno="152" slineno="5-2" type="amend"><secline lineno="151">Section 5. Section <bold>63A-17-513</bold> is amended to read:</secline><catline lineno="152"><bold>63A-17-513<parens/>. State employer required to provide legislator leave.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="153" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="154" slineno="5-4" level="2"><display>(a)</display>"Authorized legislative day" means:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="155" slineno="5-5" level="3"><display>(i)</display>the day on which the Legislature convenes in annual general session, and each day <ln numlevel="1" lineno="156" slineno="5-6"/>after that day, until midnight of the 45th day of the annual general session;</subsection><subsection ssid="1-null-4" dnum="ii-o" numlevel="1" lineno="157" slineno="5-7" level="3"><display>(ii)</display>a special session day;</subsection><subsection ssid="1-null-5" dnum="iii-o" numlevel="1" lineno="158" slineno="5-8" level="3"><display>(iii)</display>a veto override session day;</subsection><subsection ssid="1-null-6" dnum="iv-o" numlevel="1" lineno="159" slineno="5-9" level="3"><display>(iv)</display>an interim day designated by the Legislative Management Committee;</subsection><subsection ssid="1-null-7" dnum="v-o" numlevel="1" lineno="160" slineno="5-10" level="3"><display>(v)</display>an authorized legislative training day; or</subsection><subsection ssid="1-null-8" dnum="vi-o" numlevel="1" lineno="161" slineno="5-11" level="3"><display>(vi)</display>any other day on which a meeting of a committee, subcommittee, commission, <ln numlevel="1" lineno="162" slineno="5-12"/>task force, or other entity is held, if:<subsection ssid="1-null-9" dnum="A-o" numlevel="1" lineno="163" slineno="5-13" level="4"><display>(A)</display>the committee, subcommittee, commission, task force, or other entity is <ln numlevel="1" lineno="164" slineno="5-14"/>created by statute or joint resolution;</subsection><subsection ssid="1-null-10" dnum="B-o" numlevel="1" lineno="165" slineno="5-15" level="4"><display>(B)</display>the legislator's attendance at the meeting is approved by the Legislative <ln numlevel="1" lineno="166" slineno="5-16"/>Management Committee; and</subsection><subsection ssid="1-null-11" dnum="C-o" numlevel="1" lineno="167" slineno="5-17" level="4"><display>(C)</display>service and payment for service by the legislator is not in violation of the Utah <ln numlevel="1" lineno="168" slineno="5-18"/>Constitution, including Article V and Article VI, Sections 6 and 7.</subsection></subsection></subsection><subsection ssid="1-null-12" dnum="b-o" numlevel="1" lineno="169" slineno="5-19" level="2"><display>(b)</display>"Authorized legislative training day" means a day that a Legislative Expenses <ln numlevel="1" lineno="170" slineno="5-20"/>Oversight Committee designates as an authorized legislative day for training or <ln numlevel="1" lineno="171" slineno="5-21"/>informational purposes, including:<subsection ssid="1-null-13" dnum="i-o" numlevel="1" lineno="172" slineno="5-22" level="3"><display>(i)</display>chair training;</subsection><subsection ssid="1-null-14" dnum="ii-o" numlevel="1" lineno="173" slineno="5-23" level="3"><display>(ii)</display>an issue briefing;</subsection><subsection ssid="1-null-15" dnum="iii-o" numlevel="1" lineno="174" slineno="5-24" level="3"><display>(iii)</display>legislative leadership instruction;</subsection><subsection ssid="1-null-16" dnum="iv-o" numlevel="1" lineno="175" slineno="5-25" level="3"><display>(iv)</display>legislative process training;</subsection><subsection ssid="1-null-17" dnum="v-o" numlevel="1" lineno="176" slineno="5-26" level="3"><display>(v)</display>legislative rules training;</subsection><subsection ssid="1-null-18" dnum="vi-o" numlevel="1" lineno="177" slineno="5-27" level="3"><display>(vi)</display>new legislator orientation; or</subsection><subsection ssid="1-null-19" dnum="vii-o" numlevel="1" lineno="178" slineno="5-28" level="3"><display>(vii)</display>another meeting to brief, instruct, orient, or train a legislator in relation to the <ln numlevel="1" lineno="179" slineno="5-29"/>legislator's official duties.</subsection></subsection><subsection ssid="1-null-20" dnum="c-o" numlevel="1" lineno="180" slineno="5-30" level="2"><display>(c)</display>"Legislator" means:<subsection ssid="1-null-21" dnum="i-o" numlevel="1" lineno="181" slineno="5-31" level="3"><display>(i)</display>a member of the Utah Senate;</subsection><subsection ssid="1-null-22" dnum="ii-o" numlevel="1" lineno="182" slineno="5-32" level="3"><display>(ii)</display>a member of the Utah House of Representatives; or</subsection><subsection ssid="1-null-23" dnum="iii-o" numlevel="1" lineno="183" slineno="5-33" level="3"><display>(iii)</display>an individual who has been elected as a member described in Subsection <xref depth="4" refnumber="63A-17-513(1)(c)(i)">(1)(c)(i)</xref> <ln numlevel="1" lineno="184" slineno="5-34"/>or <xref depth="4" refnumber="63A-17-513(ii)">(ii)</xref>, but has not yet been sworn in or begun the individual's term of office.</subsection></subsection><subsection ssid="1-40" dnum="_-o:d-i" numlevel="1" lineno="185" slineno="5-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">"Legislator leave" means the leave described in Subsection <xref depth="4" refnumber="63A-17-513(2)">(2)</xref>.</amend></subsection><subsection ssid="1-null-24" dnum="d-o:e-i" numlevel="1" lineno="186" slineno="5-36" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1082" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>"Retaliatory action" means to:<subsection ssid="1-null-25" dnum="i-o" numlevel="1" lineno="187" slineno="5-37" level="3"><display>(i)</display>dismiss the employee;</subsection><subsection ssid="1-null-26" dnum="ii-o" numlevel="1" lineno="188" slineno="5-38" level="3"><display>(ii)</display>reduce the employee's compensation;</subsection><subsection ssid="1-null-27" dnum="iii-o" numlevel="1" lineno="189" slineno="5-39" level="3"><display>(iii)</display>fail to increase the employee's compensation by an amount that the employee is <ln numlevel="1" lineno="190" slineno="5-40"/>otherwise entitled to or was promised;</subsection><subsection ssid="1-null-28" dnum="iv-o" numlevel="1" lineno="191" slineno="5-41" level="3"><display>(iv)</display>fail to promote the employee if the employee would have otherwise been <ln numlevel="1" lineno="192" slineno="5-42"/>promoted; or</subsection><subsection ssid="1-null-29" dnum="v-o" numlevel="1" lineno="193" slineno="5-43" level="3"><display>(v)</display>threaten to take an action described in Subsections <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="98" groupid="65" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63A-17-513(1)(d)(i)">(1)(d)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="97" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(1)(e)(i)</amend> through <xref depth="4" refnumber="63A-17-513(iv)">(iv)</xref>.</subsection></subsection><subsection ssid="1-null-30" dnum="e-o:f-i" numlevel="1" lineno="194" slineno="5-44" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1088" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1089" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>"State employer" means any employer in the state executive branch.</subsection></subsection><subsection ssid="1-null-31" dnum="2-o" numlevel="1" lineno="195" slineno="5-45" level="1"><display>(2)</display>A state employer who employs an individual who is a legislator:<subsection ssid="1-null-32" dnum="a-o" numlevel="1" lineno="196" slineno="5-46" level="2"><display>(a)</display><amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">subject to Subsection <xref depth="4" refnumber="63A-17-513(3)">(3)</xref>, </amend>shall grant <amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">paid </amend>leave to the individual on an authorized <ln numlevel="1" lineno="197" slineno="5-47"/>legislative day for the number of hours requested by the individual;</subsection><subsection ssid="1-null-33" dnum="b-o" numlevel="1" lineno="198" slineno="5-48" level="2"><display>(b)</display>may not interfere with, or otherwise restrain the individual from, using the leave <ln numlevel="1" lineno="199" slineno="5-49"/>described in Subsection <xref depth="4" refnumber="63A-17-513(2)(a)">(2)(a)</xref>; and</subsection><subsection ssid="1-null-34" dnum="c-o" numlevel="1" lineno="200" slineno="5-50" level="2"><display>(c)</display>may not take retaliatory action against the individual for using the leave described in <ln numlevel="1" lineno="201" slineno="5-51"/>Subsection <xref depth="4" refnumber="63A-17-513(2)(a)">(2)(a)</xref>.</subsection></subsection><subsection ssid="1-null-35" dnum="3-o:_-i" numlevel="1" lineno="202" slineno="5-52" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1093" style="2" owner="o" level="1" deltag="start">(3)</amend></display><amend anum="0" ea="erase" pairid="81" groupid="53" style="2" owner="jchristopherson" level="1" deltag="end">The leave described in Subsection (2) is leave without pay unless the state employer <ln numlevel="1" lineno="203" slineno="5-53"/>and the individual described in Subsection (2) agree to terms that are more favorable to <ln numlevel="1" lineno="204" slineno="5-54"/>the individual.</amend><amendoutend style="2"/></subsection><subsection ssid="1-36" dnum="_-o:3-i" numlevel="1" lineno="205" slineno="5-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">If a legislator wishes to use legislator leave for an authorized legislative day that is <ln numlevel="1" lineno="206" slineno="5-56"/>during an annual general session, the legislator shall use legislator leave for the total <ln numlevel="1" lineno="207" slineno="5-57"/>number of hours during the annual general session that the legislator is absent from the <ln numlevel="1" lineno="208" slineno="5-58"/>legislator's position with a state employer.</amend></subsection><subsection ssid="1-52" dnum="_-o:4-i" numlevel="1" lineno="209" slineno="5-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="1-54" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to legislative appropriation and Subsection <xref depth="4" refnumber="63A-17-513(4)(b)">(4)(b)</xref>, upon request by a <ln numlevel="1" lineno="210" slineno="5-60"/>legislator's state employer, the legislator's chamber shall reimburse the legislator's <ln numlevel="1" lineno="211" slineno="5-61"/>state employer for the cost of any legislator leave the state employer granted the <ln numlevel="1" lineno="212" slineno="5-62"/>legislator during the immediately preceding annual general session.</amend></subsection><subsection ssid="1-53" dnum="_-o:b-i" numlevel="1" lineno="213" slineno="5-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">The total amount of reimbursements made under Subsection <xref depth="4" refnumber="63A-17-513(4)(a)">(4)(a)</xref> and Subsection <xref depth="4" refnumber="53G-11-210(3)"><ln numlevel="1" lineno="214" slineno="5-64"/>53G-11-210(3)</xref> may not exceed the amount equal to the total savings resulting from <ln numlevel="1" lineno="215" slineno="5-65"/>legislators' ineligibility for salary under Section <xref depth="3" refnumber="36-2-3">36-2-3</xref> and retirement related <ln numlevel="1" lineno="216" slineno="5-66"/>contributions under Section <xref depth="3" refnumber="49-11-506">49-11-506</xref>.</amend></subsection></subsection><subsection ssid="1-55" dnum="_-o:5-i" numlevel="1" lineno="217" slineno="5-67" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">If a legislator chooses not to use legislator leave for an authorized legislative day, the <ln numlevel="1" lineno="218" slineno="5-68"/>legislator and the legislator's state employer may agree to a different arrangement that <ln numlevel="1" lineno="219" slineno="5-69"/>accommodates the legislator's legislative service for the authorized legislative day.</amend></subsection></section></bsec><bsec buid="18" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="220" slineno="6-1" sn="6"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="220">Section 6.  <bold>Effective Date.</bold></secline><sectionText lineno="221"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on
