Section <bold>17B-1-102</bold> is amended to read:</secline><catline lineno="35"><bold>17B-1-102<parens/>. Definitions.</bold></catline><sectionText lineno="36"><tab/>As used in this title:</sectionText><subsection ssid="70-null-1" dnum="1-o" numlevel="1" lineno="37" slineno="1-4" level="1"><display>(1)</display>"Appointing authority" means the person or body authorized to make an appointment to <ln numlevel="1" lineno="38" slineno="1-5"/>the board of trustees.</subsection><subsection ssid="70-null-2" dnum="2-o" numlevel="1" lineno="39" slineno="1-6" level="1"><display>(2)</display>"Basic special district":<subsection ssid="70-null-3" dnum="a-o" numlevel="1" lineno="40" slineno="1-7" level="2"><display>(a)</display>means a special district that is not a specialized special district; and</subsection><subsection ssid="70-null-4" dnum="b-o" numlevel="1" lineno="41" slineno="1-8" level="2"><display>(b)</display>includes an entity that was, under the law in effect before April 30, 2007, created and <ln numlevel="1" lineno="42" slineno="1-9"/>operated as a special district, as defined under the law in effect before April 30, 2007.</subsection></subsection><subsection ssid="70-null-5" dnum="3-o" numlevel="1" lineno="43" slineno="1-10" level="1"><display>(3)</display>"Bond" means:<subsection ssid="70-null-6" dnum="a-o" numlevel="1" lineno="44" slineno="1-11" level="2"><display>(a)</display>a written obligation to repay borrowed money, whether denominated a bond, note, <ln numlevel="1" lineno="45" slineno="1-12"/>warrant, certificate of indebtedness, or otherwise; and</subsection><subsection ssid="70-null-7" dnum="b-o" numlevel="1" lineno="46" slineno="1-13" level="2"><display>(b)</display>a lease agreement, installment purchase agreement, or other agreement that:<subsection ssid="70-null-8" dnum="i-o" numlevel="1" lineno="47" slineno="1-14" level="3"><display>(i)</display>includes an obligation by the district to pay money; and</subsection><subsection ssid="70-null-9" dnum="ii-o" numlevel="1" lineno="48" slineno="1-15" level="3"><display>(ii)</display>the district's board of trustees, in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">its</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the board's</amend> discretion, treats as a bond for <ln numlevel="1" lineno="49" slineno="1-16"/>purposes of Title 11, Chapter 14, Local Government Bonding Act, or Title 11, <ln numlevel="1" lineno="50" slineno="1-17"/>Chapter 27, Utah Refunding Bond Act.</subsection></subsection></subsection><subsection ssid="70-null-10" dnum="4-o" numlevel="1" lineno="51" slineno="1-18" level="1"><display>(4)</display>"Cemetery maintenance district" means a special district that operates under and is <ln numlevel="1" lineno="52" slineno="1-19"/>subject to the provisions of this chapter and Chapter 2a, Part 1, Cemetery Maintenance <ln numlevel="1" lineno="53" slineno="1-20"/>District Act, including an entity that was created and operated as a cemetery <ln numlevel="1" lineno="54" slineno="1-21"/>maintenance district under the law in effect before April 30, 2007.</subsection><subsection ssid="70-null-11" dnum="5-o" numlevel="1" lineno="55" slineno="1-22" level="1"><display>(5)</display>"Drainage district" means a special district that operates under and is subject to the <ln numlevel="1" lineno="56" slineno="1-23"/>provisions of this chapter and Chapter 2a, Part 2, Drainage District Act, including an <ln numlevel="1" lineno="57" slineno="1-24"/>entity that was created and operated as a drainage district under the law in effect before <ln numlevel="1" lineno="58" slineno="1-25"/>April 30, 2007.</subsection><subsection ssid="70-null-12" dnum="6-o" numlevel="1" lineno="59" slineno="1-26" level="1"><display>(6)</display>"Facility" or "facilities" includes any structure, building, system, land, water right, <ln numlevel="1" lineno="60" slineno="1-27"/>water, or other real or personal property required to provide a service that a special <ln numlevel="1" lineno="61" slineno="1-28"/>district is authorized to provide, including any related or appurtenant easement or <ln numlevel="1" lineno="62" slineno="1-29"/>right-of-way, improvement, utility, landscaping, sidewalk, road, curb, gutter, equipment, <ln numlevel="1" lineno="63" slineno="1-30"/>or furnishing.</subsection><subsection ssid="70-null-13" dnum="7-o" numlevel="1" lineno="64" slineno="1-31" level="1"><display>(7)</display>"Fire protection district" means a special district that operates under and is subject to the <ln numlevel="1" lineno="65" slineno="1-32"/>provisions of this chapter and Chapter 2a, Part 3, Fire Protection District Act, including <ln numlevel="1" lineno="66" slineno="1-33"/>an entity that was created and operated as a fire protection district under the law in effect <ln numlevel="1" lineno="67" slineno="1-34"/>before April 30, 2007.</subsection><subsection ssid="70-null-14" dnum="8-o" numlevel="1" lineno="68" slineno="1-35" level="1"><display>(8)</display>"General obligation bond":<subsection ssid="70-null-15" dnum="a-o" numlevel="1" lineno="69" slineno="1-36" level="2"><display>(a)</display>means a bond that is directly payable from and secured by ad valorem property taxes <ln numlevel="1" lineno="70" slineno="1-37"/>that are:<subsection ssid="70-null-16" dnum="i-o" numlevel="1" lineno="71" slineno="1-38" level="3"><display>(i)</display>levied:<subsection ssid="70-null-17" dnum="A-o" numlevel="1" lineno="72" slineno="1-39" level="4"><display>(A)</display>by the district that issues the bond; and</subsection><subsection ssid="70-null-18" dnum="B-o" numlevel="1" lineno="73" slineno="1-40" level="4"><display>(B)</display>on taxable property within the district; and</subsection></subsection><subsection ssid="70-null-19" dnum="ii-o" numlevel="1" lineno="74" slineno="1-41" level="3"><display>(ii)</display>in excess of the ad valorem property taxes of the district for the current fiscal <ln numlevel="1" lineno="75" slineno="1-42"/>year; and</subsection></subsection><subsection ssid="70-null-20" dnum="b-o" numlevel="1" lineno="76" slineno="1-43" level="2"><display>(b)</display>does not include:<subsection ssid="70-null-21" dnum="i-o" numlevel="1" lineno="77" slineno="1-44" level="3"><display>(i)</display>a short-term bond;</subsection><subsection ssid="70-null-22" dnum="ii-o" numlevel="1" lineno="78" slineno="1-45" level="3"><display>(ii)</display>a tax and revenue anticipation bond; or</subsection><subsection ssid="70-null-23" dnum="iii-o" numlevel="1" lineno="79" slineno="1-46" level="3"><display>(iii)</display>a special assessment bond.</subsection></subsection></subsection><subsection ssid="70-null-24" dnum="9-o" numlevel="1" lineno="80" slineno="1-47" level="1"><display>(9)</display>"Improvement assurance" means a surety bond, letter of credit, cash, or other security:<subsection ssid="70-null-25" dnum="a-o" numlevel="1" lineno="81" slineno="1-48" level="2"><display>(a)</display>to guarantee the proper completion of an improvement;</subsection><subsection ssid="70-null-26" dnum="b-o" numlevel="1" lineno="82" slineno="1-49" level="2"><display>(b)</display>that is required before a special district may provide a service requested by a service <ln numlevel="1" lineno="83" slineno="1-50"/>applicant; and</subsection><subsection ssid="70-null-27" dnum="c-o" numlevel="1" lineno="84" slineno="1-51" level="2"><display>(c)</display>that is offered to a special district to induce the special district before construction of <ln numlevel="1" lineno="85" slineno="1-52"/>an improvement begins to:<subsection ssid="70-null-28" dnum="i-o" numlevel="1" lineno="86" slineno="1-53" level="3"><display>(i)</display>provide the requested service; or</subsection><subsection ssid="70-null-29" dnum="ii-o" numlevel="1" lineno="87" slineno="1-54" level="3"><display>(ii)</display>commit to provide the requested service.</subsection></subsection></subsection><subsection ssid="70-null-30" dnum="10-o" numlevel="1" lineno="88" slineno="1-55" level="1"><display>(10)</display>"Improvement assurance warranty" means a promise that the materials and <ln numlevel="1" lineno="89" slineno="1-56"/>workmanship of an improvement:<subsection ssid="70-null-31" dnum="a-o" numlevel="1" lineno="90" slineno="1-57" level="2"><display>(a)</display>comply with standards adopted by a special district; and</subsection><subsection ssid="70-null-32" dnum="b-o" numlevel="1" lineno="91" slineno="1-58" level="2"><display>(b)</display>will not fail in any material respect within an agreed warranty period.</subsection></subsection><subsection ssid="70-null-33" dnum="11-o" numlevel="1" lineno="92" slineno="1-59" level="1"><display>(11)</display>"Improvement district" means a special district that operates under and is subject to the <ln numlevel="1" lineno="93" slineno="1-60"/>provisions of this chapter and Chapter 2a, Part 4, Improvement District Act, including an <ln numlevel="1" lineno="94" slineno="1-61"/>entity that was created and operated as a county improvement district under the law in <ln numlevel="1" lineno="95" slineno="1-62"/>effect before April 30, 2007.</subsection><subsection ssid="70-null-34" dnum="12-o" numlevel="1" lineno="96" slineno="1-63" level="1"><display>(12)</display>"Infrastructure financing district" means a special district that operates under and is <ln numlevel="1" lineno="97" slineno="1-64"/>subject to the provisions of this chapter and Chapter 2a, Part 13, Infrastructure Financing <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="98" slineno="1-65"/>Districts</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">District</amend>.</subsection><subsection ssid="70-null-35" dnum="13-o" numlevel="1" lineno="99" slineno="1-66" level="1"><display>(13)</display>"Irrigation district" means a special district that operates under and is subject to the <ln numlevel="1" lineno="100" slineno="1-67"/>provisions of this chapter and Chapter 2a, Part 5, Irrigation District Act, including an <ln numlevel="1" lineno="101" slineno="1-68"/>entity that was created and operated as an irrigation district under the law in effect <ln numlevel="1" lineno="102" slineno="1-69"/>before April 30, 2007.</subsection><subsection ssid="70-null-36" dnum="14-o" numlevel="1" lineno="103" slineno="1-70" level="1"><display>(14)</display>"Metropolitan water district" means a special district that operates under and is subject <ln numlevel="1" lineno="104" slineno="1-71"/>to the provisions of this chapter and Chapter 2a, Part 6, Metropolitan Water District Act, <ln numlevel="1" lineno="105" slineno="1-72"/>including an entity that was created and operated as a metropolitan water district under <ln numlevel="1" lineno="106" slineno="1-73"/>the law in effect before April 30, 2007.</subsection><subsection ssid="70-null-37" dnum="15-o" numlevel="1" lineno="107" slineno="1-74" level="1"><display>(15)</display>"Mosquito abatement district" means a special district that operates under and is <ln numlevel="1" lineno="108" slineno="1-75"/>subject to the provisions of this chapter and Chapter 2a, Part 7, Mosquito Abatement <ln numlevel="1" lineno="109" slineno="1-76"/>District Act, including an entity that was created and operated as a mosquito abatement <ln numlevel="1" lineno="110" slineno="1-77"/>district under the law in effect before April 30, 2007.</subsection><subsection ssid="70-null-38" dnum="16-o" numlevel="1" lineno="111" slineno="1-78" level="1"><display>(16)</display>"Municipal" means of or relating to a municipality.</subsection><subsection ssid="70-null-39" dnum="17-o" numlevel="1" lineno="112" slineno="1-79" level="1"><display>(17)</display>"Municipality" means a city or town.</subsection><subsection ssid="70-null-40" dnum="18-o" numlevel="1" lineno="113" slineno="1-80" level="1"><display>(18)</display>"Municipal services district" means a special district that operates under and is subject <ln numlevel="1" lineno="114" slineno="1-81"/>to the provisions of this chapter and Chapter 2a, Part 11, Municipal Services District Act.</subsection><subsection ssid="70-null-41" dnum="19-o" numlevel="1" lineno="115" slineno="1-82" level="1"><display>(19)</display>"Person" means an individual, corporation, partnership, organization, association, trust, <ln numlevel="1" lineno="116" slineno="1-83"/>governmental agency, or other legal entity.</subsection><subsection ssid="70-null-42" dnum="20-o" numlevel="1" lineno="117" slineno="1-84" level="1"><display>(20)</display>"Political subdivision" means a county, city, town, special district under this title, <ln numlevel="1" lineno="118" slineno="1-85"/>special service district under Title 17D, Chapter 1, Special Service District Act, an entity <ln numlevel="1" lineno="119" slineno="1-86"/>created by interlocal cooperation agreement under Title 11, Chapter 13, Interlocal <ln numlevel="1" lineno="120" slineno="1-87"/>Cooperation Act, or any other governmental entity designated in statute as a political <ln numlevel="1" lineno="121" slineno="1-88"/>subdivision of the state.</subsection><subsection ssid="70-null-43" dnum="21-o" numlevel="1" lineno="122" slineno="1-89" level="1"><display>(21)</display>"Private," with respect to real property, means not owned by the United States or any <ln numlevel="1" lineno="123" slineno="1-90"/>agency of the federal government, the state, a county, or a political subdivision.</subsection><subsection ssid="70-null-44" dnum="22-o" numlevel="1" lineno="124" slineno="1-91" level="1"><display>(22)</display>"Public entity" means:<subsection ssid="70-null-45" dnum="a-o" numlevel="1" lineno="125" slineno="1-92" level="2"><display>(a)</display>the United States or an agency of the United States;</subsection><subsection ssid="70-null-46" dnum="b-o" numlevel="1" lineno="126" slineno="1-93" level="2"><display>(b)</display>the state or an agency of the state;</subsection><subsection ssid="70-null-47" dnum="c-o" numlevel="1" lineno="127" slineno="1-94" level="2"><display>(c)</display>a political subdivision of the state or an agency of a political subdivision of the state;</subsection><subsection ssid="70-null-48" dnum="d-o" numlevel="1" lineno="128" slineno="1-95" level="2"><display>(d)</display>another state or an agency of that state; or</subsection><subsection ssid="70-null-49" dnum="e-o" numlevel="1" lineno="129" slineno="1-96" level="2"><display>(e)</display>a political subdivision of another state or an agency of that political subdivision.</subsection></subsection><subsection ssid="70-null-50" dnum="23-o" numlevel="1" lineno="130" slineno="1-97" level="1"><display>(23)</display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">"Public infrastructure district" means an entity that is created under Title 17D, Chapter <ln numlevel="1" lineno="131" slineno="1-98"/>4, Public Infrastructure District Act.</amend></subsection><subsection ssid="70-91" dnum="_-o:24-i" numlevel="1" lineno="132" slineno="1-99" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="both">(24)</amend></display>"Public transit district" means a special district that operates under and is subject to the <ln numlevel="1" lineno="133" slineno="1-100"/>provisions of this chapter and Chapter 2a, Part 8, Public Transit District Act, including <ln numlevel="1" lineno="134" slineno="1-101"/>an entity that was created and operated as a public transit district under the law in effect <ln numlevel="1" lineno="135" slineno="1-102"/>before April 30, designated taxes or other revenues other than the special <ln numlevel="1" lineno="138" slineno="1-105"/>district's ad valorem property taxes; and</subsection><subsection ssid="70-null-53" dnum="b-o" limit;</subsection><subsection ssid="70-null-55" dnum="ii-o" numlevel="1" lineno="142" slineno="1-109" level="3"><display>(ii)</display>a tax and revenue anticipation bond; or</subsection><subsection ssid="70-null-56" dnum="iii-o" numlevel="1" lineno="143" slineno="1-110" level="3"><display>(iii)</display>a special assessment bond.</subsection></subsection></subsection><subsection space="true">(27)</amend></display>"Service applicant" means a person who requests that a special district provide a <ln numlevel="1" lineno="150" slineno="1-117"/>service that the special district is lineno="181" slineno="1-148" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1084" style="2" owner="o" level="1" deltag="both">(33)</amend><amendoutend before April 30, 2007.</subsection><subsection ssid="70-null-90" dnum="37-o:38-i" numlevel="1" lineno="192" slineno="1-159" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1090" style="2" owner="o" level="1" deltag="both">(37)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1" amendtag="both" space="true">(38)</amend></display>"Works" includes a dam, reservoir, well, canal, conduit, pipeline, drain, tunnel, <ln numlevel="1" lineno="193" slineno="1-160"/>power plant, and any facility, improvement, or property necessary or convenient for <ln numlevel="1" lineno="194" slineno="1-161"/>supplying or treating water for any beneficial use, and for otherwise accomplishing the <ln numlevel="1" lineno="195" slineno="1-162"/>purposes of a special district.</subsection></section></bsec><bsec buid="60" num="17B-1-1302" type="amend" src="code" uid="C17B-1-S1302_2026050620260506" sort="17B01 13020020260506" numlevel="1" lineno="196" slineno="2-1" sn="2"><section number="17B-1-1302" numlevel="1" lineno="197" slineno="2-2" type="amend"><secline lineno="196">Section 2. Section <bold>17B-1-1302</bold> is amended to read:</secline><catline lineno="197"><bold>17B-1-1302<parens/>. Special district dissolution.</bold></catline><subsection ssid="60-null-1" dnum="1-o" numlevel="1" lineno="198" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>A special district may be dissolved as provided in this part.</subsection><subsection ssid="60-null-2" dnum="2-o" numlevel="1" lineno="199" slineno="2-4" level="1"><display>(2)</display>No later than 180 days after the payment of all debt of an infrastructure financing <ln numlevel="1" lineno="200" slineno="2-5"/>district, the board of trustees of the infrastructure financing district shall adopt a <ln numlevel="1" lineno="201" slineno="2-6"/>resolution to dissolve the infrastructure financing district.</subsection><subsection ssid="60-5" dnum="_-o:3-i" numlevel="1" lineno="202" slineno="2-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">The board of trustees of a public infrastructure district, other than a public infrastructure <ln numlevel="1" lineno="203" slineno="2-8"/>district created by a development authority that provides ongoing services, shall adopt a <ln numlevel="1" lineno="204" slineno="2-9"/>resolution to dissolve the public infrastructure district no later than 180 days after:</amend><subsection ssid="60-6" dnum="_-o:a-i" numlevel="1" lineno="205" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">the public infrastructure district has paid all the public infrastructure district's debts;</amend></subsection><subsection ssid="60-7" dnum="_-o:b-i" numlevel="1" lineno="206" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">the public infrastructure district's contractual obligations are satisfied or defeased; and</amend></subsection><subsection ssid="60-8" dnum="_-o:c-i" numlevel="1" lineno="207" slineno="2-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">the public infrastructure and improvements described in the governing document are:</amend><subsection ssid="60-9" dnum="_-o:i-i" numlevel="1" lineno="208" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">constructed, repaired, or otherwise completed; and</amend></subsection><subsection ssid="60-10" dnum="_-o:ii-i" numlevel="1" lineno="209" slineno="2-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">transferred to the public entity or utility responsible for ownership, operation, and <ln numlevel="1" lineno="210" slineno="2-15"/>maintenance of the public infrastructure and improvements.</amend></subsection></subsection></subsection></section></bsec><bsec buid="65" num="17B-1-1303" type="amend" src="code" uid="C17B-1-S1303_2026050620260506" sort="17B01 13030020260506" numlevel="1" lineno="211" slineno="3-1" sn="3"><section number="17B-1-1303" numlevel="1" lineno="212" slineno="3-2" type="amend"><secline lineno="211">Section 3. Section <bold>17B-1-1303</bold> is amended to read:</secline><catline lineno="212"><bold>17B-1-1303<parens/>. Initiation of dissolution process.</bold></catline><sectionText lineno="213"><tab/>The process to dissolve a special district may be initiated by:</sectionText><subsection ssid="65-null-1" dnum="1-o" numlevel="1" lineno="214" slineno="3-4" level="1"><display>(1)</display>for an inactive special district:<subsection ssid="65-null-2" dnum="a-o" numlevel="1" lineno="215" slineno="3-5" level="2" space="false"><display>(a)</display><subsection ssid="65-null-3" dnum="i-o" level="3" placement="sameline"><display>(i)</display>for a special district whose board of trustees is elected by electors based on the <ln numlevel="1" lineno="216" slineno="3-6"/>acre-feet of water allotted to the land owned by the elector, a petition signed by <ln numlevel="1" lineno="217" slineno="3-7"/>the owners of 25% of the acre-feet of water allotted to the land within the special <ln numlevel="1" lineno="218" slineno="3-8"/>district; or</subsection><subsection ssid="65-null-4" dnum="ii-o" numlevel="1" lineno="219" slineno="3-9" level="3"><display>(ii)</display>for all other districts:<subsection ssid="65-null-5" dnum="A-o" numlevel="1" lineno="220" slineno="3-10" level="4"><display>(A)</display>a petition signed by the owners of private real property that:<subsection ssid="65-null-6" dnum="I-o" numlevel="1" lineno="221" slineno="3-11" level="5"><display>(I)</display>is located within the special district proposed to be dissolved;</subsection><subsection ssid="65-null-7" dnum="II-o" numlevel="1" lineno="222" slineno="3-12" level="5"><display>(II)</display>covers at least 25% of the private land area within the special district; and</subsection><subsection ssid="65-null-8" dnum="III-o" numlevel="1" lineno="223" slineno="3-13" level="5"><display>(III)</display>is equal in assessed value to at least 25% of the assessed value of all <ln numlevel="1" lineno="224" slineno="3-14"/>private real property within the special district; or</subsection></subsection><subsection ssid="65-null-9" dnum="B-o" numlevel="1" lineno="225" slineno="3-15" level="4"><display>(B)</display>a petition signed by registered voters residing within the special district <ln numlevel="1" lineno="226" slineno="3-16"/>proposed to be dissolved equal in number to at least 25% of the number of <ln numlevel="1" lineno="227" slineno="3-17"/>votes cast in the district for the office of governor at the last regular general <ln numlevel="1" lineno="228" slineno="3-18"/>election before the filing of the petition; or</subsection></subsection></subsection><subsection ssid="65-null-10" dnum="b-o" numlevel="1" lineno="229" slineno="3-19" level="2"><display>(b)</display>a resolution adopted by the administrative body; </subsection></subsection><subsection ssid="65-null-11" dnum="2-o" numlevel="1" lineno="230" slineno="3-20" level="1"><display>(2)</display>for an active special district, a petition signed by:<subsection ssid="65-null-12" dnum="a-o" numlevel="1" lineno="231" slineno="3-21" level="2"><display>(a)</display>for a special district whose board of trustees is elected by electors based on the <ln numlevel="1" lineno="232" slineno="3-22"/>acre-feet of water allotted to the land owned by the elector, the owners of 33% of the <ln numlevel="1" lineno="233" slineno="3-23"/>acre-feet of water allotted to the land within the special district;</subsection><subsection ssid="65-null-13" dnum="b-o" numlevel="1" lineno="234" slineno="3-24" level="2"><display>(b)</display>for a special district created to acquire or assess a groundwater right for the <ln numlevel="1" lineno="235" slineno="3-25"/>development and execution of a groundwater management plan in coordination with <ln numlevel="1" lineno="236" slineno="3-26"/>the state engineer in accordance with Section <xref depth="3" refnumber="73-5-15">73-5-15</xref>, the owners of groundwater <ln numlevel="1" lineno="237" slineno="3-27"/>rights that:<subsection ssid="65-null-14" dnum="i-o" numlevel="1" lineno="238" slineno="3-28" level="3"><display>(i)</display>are diverted within the district; and</subsection><subsection ssid="65-null-15" dnum="ii-o" numlevel="1" lineno="239" slineno="3-29" level="3"><display>(ii)</display>cover at least 33% of the total amount of groundwater diverted in accordance <ln numlevel="1" lineno="240" slineno="3-30"/>with the groundwater rights within the district as a whole; or</subsection></subsection><subsection ssid="65-null-16" dnum="c-o" numlevel="1" lineno="241" slineno="3-31" level="2"><display>(c)</display>for all other districts:<subsection ssid="65-null-17" dnum="i-o" numlevel="1" lineno="242" slineno="3-32" level="3"><display>(i)</display>the owners of private real property that:<subsection ssid="65-null-18" dnum="A-o" numlevel="1" lineno="243" slineno="3-33" level="4"><display>(A)</display>is located within the special district proposed to be dissolved;</subsection><subsection ssid="65-null-19" dnum="B-o" numlevel="1" lineno="244" slineno="3-34" level="4"><display>(B)</display>covers at least 33% of the private land area within the special district; and</subsection><subsection ssid="65-null-20" dnum="C-o" numlevel="1" lineno="245" slineno="3-35" level="4"><display>(C)</display>is equal in assessed value to at least 25% of the assessed value of all private <ln numlevel="1" lineno="246" slineno="3-36"/>real property within the special district; or</subsection></subsection><subsection ssid="65-null-21" dnum="ii-o" numlevel="1" lineno="247" slineno="3-37" level="3"><display>(ii)</display>33% of registered voters residing within the special district proposed to be <ln numlevel="1" lineno="248" slineno="3-38"/>dissolved; or</subsection></subsection></subsection><subsection ssid="65-null-22" dnum="3-o" numlevel="1" lineno="249" slineno="3-39" level="1"><display>(3)</display>for an infrastructure financing district<amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both"> or public infrastructure district</amend>, a resolution <ln numlevel="1" lineno="250" slineno="3-40"/>adopted by the board of trustees.</subsection></section></bsec><bsec buid="61" num="17B-1-1310" type="amend" src="code" uid="C17B-1-S1310_2026050620260506" sort="17B01 13100020260506" numlevel="1" lineno="251" slineno="4-1" sn="4"><section number="17B-1-1310" numlevel="1" lineno="252" slineno="4-2" type="amend"><secline lineno="251">Section 4. Section <bold>17B-1-1310</bold> is amended to read:</secline><catline lineno="252"><bold>17B-1-1310<parens/>. Notice to lieutenant governor -- Recording requirements -- <ln numlevel="1" lineno="253" slineno="4-3"/>Distribution of remaining assets.</bold></catline><subsection ssid="61-null-1" dnum="1-o" numlevel="1" lineno="254" slineno="4-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="61-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Within the time specified in Subsection (1)(b), an administrative body shall file <ln numlevel="1" lineno="255" slineno="4-5"/>with the lieutenant governor a copy of a notice of an impending boundary action, as <ln numlevel="1" lineno="256" slineno="4-6"/>defined in Section <xref depth="3" refnumber="67-1a-6.5">67-1a-6.5</xref>, that meets the requirements of Subsection <xref depth="3" refnumber="67-1a-6.5">67-1a-6.5</xref>(3).</subsection><subsection ssid="61-null-3" dnum="b-o" numlevel="1" lineno="257" slineno="4-7" level="2"><display>(b)</display>The administrative body shall file a notice of an impending boundary action under <ln numlevel="1" lineno="258" slineno="4-8"/>Subsection (1)(a) within 30 days after the day on which, as applicable:<subsection ssid="61-null-4" dnum="i-o" numlevel="1" lineno="259" slineno="4-9" level="3"><display>(i)</display>the administrative body adopts a resolution approving the dissolution of an <ln numlevel="1" lineno="260" slineno="4-10"/>inactive special district; </subsection><subsection ssid="61-null-5" dnum="ii-o" numlevel="1" lineno="261" slineno="4-11" level="3"><display>(ii)</display>a majority of the voters within an active special district approve the dissolution of <ln numlevel="1" lineno="262" slineno="4-12"/>the special district in an election described in Subsection <xref depth="3" refnumber="17B-1-1309">17B-1-1309</xref>(2); or</subsection><subsection ssid="61-null-6" dnum="iii-o" numlevel="1" lineno="263" slineno="4-13" level="3"><display>(iii)</display>for an infrastructure financing district<amend anum="0" ea="amend" pairid="12" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both"> or public infrastructure district</amend>, the <ln numlevel="1" lineno="264" slineno="4-14"/>administrative body adopts a resolution to dissolve the infrastructure financing <ln numlevel="1" lineno="265" slineno="4-15"/>district<amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both"> or public infrastructure district</amend>.</subsection></subsection></subsection><subsection ssid="61-null-7" dnum="2-o" numlevel="1" lineno="266" slineno="4-16" level="1"><display>(2)</display>Upon the lieutenant governor's issuance of a certificate of dissolution under Section <xref depth="3" refnumber="67-1a-6.5"><ln numlevel="1" lineno="267" slineno="4-17"/>67-1a-6.5</xref>, the administrative body shall:<subsection ssid="61-null-8" dnum="a-o" numlevel="1" lineno="268" slineno="4-18" level="2"><display>(a)</display>if the special district was located within the boundary of a single county, submit to <ln numlevel="1" lineno="269" slineno="4-19"/>the recorder of that county:<subsection ssid="61-null-9" dnum="i-o" numlevel="1" lineno="270" slineno="4-20" level="3"><display>(i)</display>the original:<subsection ssid="61-null-10" dnum="A-o" numlevel="1" lineno="271" slineno="4-21" level="4"><display>(A)</display>notice of an impending boundary action; and</subsection><subsection ssid="61-null-11" dnum="B-o" numlevel="1" lineno="272" slineno="4-22" level="4"><display>(B)</display>certificate of dissolution; and</subsection></subsection><subsection ssid="61-null-12" dnum="ii-o" numlevel="1" lineno="273" slineno="4-23" level="3"><display>(ii)</display>a certified copy of the resolution that the administrative body adopts under <ln numlevel="1" lineno="274" slineno="4-24"/>Subsection <xref depth="3" refnumber="17B-1-1308">17B-1-1308</xref>(1); or</subsection></subsection><subsection ssid="61-null-13" dnum="b-o" numlevel="1" lineno="275" slineno="4-25" level="2"><display>(b)</display>if the special district was located within the boundaries of more than a single county:<subsection ssid="61-null-14" dnum="i-o" numlevel="1" lineno="276" slineno="4-26" level="3"><display>(i)</display>submit to the recorder of one of those counties:<subsection ssid="61-null-15" dnum="A-o" numlevel="1" lineno="277" slineno="4-27" level="4"><display>(A)</display>the original notice of an impending boundary action and certificate of <ln numlevel="1" lineno="278" slineno="4-28"/>dissolution; and</subsection><subsection ssid="61-null-16" dnum="B-o" numlevel="1" lineno="279" slineno="4-29" level="4"><display>(B)</display>if applicable, a certified copy of the resolution that the administrative body <ln numlevel="1" lineno="280" slineno="4-30"/>adopts under Subsection <xref depth="3" refnumber="17B-1-1308">17B-1-1308</xref>(1); and</subsection></subsection><subsection ssid="61-null-17" dnum="ii-o" numlevel="1" lineno="281" slineno="4-31" level="3"><display>(ii)</display>submit to the recorder of each other county:<subsection ssid="61-null-18" dnum="A-o" numlevel="1" lineno="282" slineno="4-32" level="4"><display>(A)</display>a certified copy of the notice of an impending boundary action and certificate <ln numlevel="1" lineno="283" slineno="4-33"/>of dissolution; and</subsection><subsection ssid="61-null-19" dnum="B-o" numlevel="1" lineno="284" slineno="4-34" level="4"><display>(B)</display>if applicable, a certified copy of the resolution that the administrative body <ln numlevel="1" lineno="285" slineno="4-35"/>adopts under Subsection <xref depth="3" refnumber="17B-1-1308">17B-1-1308</xref>(1).</subsection></subsection></subsection></subsection><subsection ssid="61-null-20" dnum="3-o" numlevel="1" lineno="286" slineno="4-36" level="1"><display>(3)</display>Upon the lieutenant governor's issuance of the certificate of dissolution under Section <xref depth="3" refnumber="67-1a-6.5"><ln numlevel="1" lineno="287" slineno="4-37"/>67-1a-6.5</xref>, the special district is dissolved.</subsection><subsection ssid="61-null-21" dnum="4-o" numlevel="1" lineno="288" slineno="4-38" level="1" space="false"><display>(4)</display><subsection ssid="61-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>After the dissolution of a special district under this part, the administrative body <ln numlevel="1" lineno="289" slineno="4-39"/>shall use any assets of the special district remaining after paying all debts and other <ln numlevel="1" lineno="290" slineno="4-40"/>obligations of the special district to pay costs associated with the dissolution process.</subsection><subsection ssid="61-null-23" dnum="b-o" numlevel="1" lineno="291" slineno="4-41" level="2"><display>(b)</display>If the administrative body is not the board of trustees of the dissolved special district, <ln numlevel="1" lineno="292" slineno="4-42"/>the administrative body shall pay any costs of the dissolution process remaining after <ln numlevel="1" lineno="293" slineno="4-43"/>exhausting the remaining assets of the special district as described in Subsection <ln numlevel="1" lineno="294" slineno="4-44"/>(4)(a).</subsection><subsection ssid="61-null-24" dnum="c-o" numlevel="1" lineno="295" slineno="4-45" level="2"><display>(c)</display>If the administrative body is the board of trustees of the dissolved special district, <ln numlevel="1" lineno="296" slineno="4-46"/>each entity that has committed to provide a service that the dissolved special district <ln numlevel="1" lineno="297" slineno="4-47"/>previously provided, as described in Subsection <xref depth="3" refnumber="17B-1-1308">17B-1-1308</xref>(2)(b), shall pay, in the <ln numlevel="1" lineno="298" slineno="4-48"/>same proportion that the services the entity commits to provide bear to all of the <ln numlevel="1" lineno="299" slineno="4-49"/>services the special district provided, any costs of the dissolution process remaining <ln numlevel="1" lineno="300" slineno="4-50"/>after exhausting the remaining assets of the dissolved  special district described in <ln numlevel="1" lineno="301" slineno="4-51"/>Subsection (4)(a).</subsection></subsection><subsection ssid="61-null-25" dnum="5-o" numlevel="1" lineno="302" slineno="4-52" level="1"><display>(5)</display>The administrative body shall distribute any assets of the special district that remain <ln numlevel="1" lineno="303" slineno="4-53"/>after the payment of debts, obligations, and costs under Subsection (4) in the following <ln numlevel="1" lineno="304" slineno="4-54"/>order of priority:<subsection ssid="61-null-26" dnum="a-o" numlevel="1" lineno="305" slineno="4-55" level="2"><display>(a)</display>if there is a readily identifiable connection between the remaining assets and a <ln numlevel="1" lineno="306" slineno="4-56"/>financial burden borne by the real property owners in the dissolved special district, <ln numlevel="1" lineno="307" slineno="4-57"/>proportionately to those real property owners;</subsection><subsection ssid="61-null-27" dnum="b-o" numlevel="1" lineno="308" slineno="4-58" level="2"><display>(b)</display>if there is a readily identifiable connection between the remaining assets and a <ln numlevel="1" lineno="309" slineno="4-59"/>financial burden borne by the recipients of a service that the dissolved special district <ln numlevel="1" lineno="310" slineno="4-60"/>provided, proportionately to those recipients; and</subsection><subsection ssid="61-null-28" dnum="c-o" numlevel="1" lineno="311" slineno="4-61" level="2"><display>(c)</display>subject to Subsection (6), to each entity that has committed to provide a service that <ln numlevel="1" lineno="312" slineno="4-62"/>the dissolved special district previously provided, as described in Subsection <xref depth="3" refnumber="17B-1-1308"><ln numlevel="1" lineno="313" slineno="4-63"/>17B-1-1308</xref>(2)(b)(i), in the same proportion that the services the entity commits to <ln numlevel="1" lineno="314" slineno="4-64"/>provide bear to all of the services the special district provided.</subsection></subsection><subsection ssid="61-null-29" dnum="6-o" numlevel="1" lineno="315" slineno="4-65" level="1"><display>(6)</display>An entity that receives cash reserves of the dissolved special district under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="316" slineno="4-66"/>(5)(a)(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(5)(c)</amend> may not use the cash reserves:<subsection ssid="61-null-30" dnum="a-o" numlevel="1" lineno="317" slineno="4-67" level="2"><display>(a)</display>in any way other than for the purpose the special district originally intended; amendtag="both"> estate</amend> property owners within the applicable area consenting to the <ln numlevel="1" lineno="347" slineno="6-8"/>creation of the public infrastructure district.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="348" slineno="6-9" level="2" space="false"><display>(b)</display><subsection ssid="1-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As used in this Subsection <xref depth="4" refnumber="17D-4-201(1)(b)" start="0">(1)(b)</xref>:<subsection ssid="1-null-5" dnum="A-o" numlevel="1" lineno="349" slineno="6-10" level="4" tab="1"><display>(A)</display>"Military land" means the same as that term is defined in Section <xref depth="3" refnumber="63H-1-102" start="0">63H-1-102</xref>.</subsection><subsection ssid="1-null-6" dnum="B-o" numlevel="1" lineno="350" slineno="6-11" level="4" tab="1"><display>(B)</display>"Project area" means the same as that term is defined in Section <xref depth="3" refnumber="63H-1-102" start="0">63H-1-102</xref>.</subsection></subsection><subsection ssid="1-null-7" dnum="ii-o" numlevel="1" lineno="351" slineno="6-12" level="3"><display>(ii)</display>Notwithstanding <xref depth="2" refnumber="17B-1-2" start="0">Title 17B, Chapter 1, Part 2, Creation of a Special District</xref>, and <ln numlevel="1" lineno="352" slineno="6-13"/>any other provision of this chapter, a development authority may adopt a <ln numlevel="1" lineno="353" slineno="6-14"/>resolution creating a public infrastructure district if all owners of surface<amend anum="0" ea="amend" pairid="200" groupid="158" style="1" owner="jchristopherson" level="1" amendtag="both"> estate</amend> <ln numlevel="1" lineno="354" slineno="6-15"/>property proposed to be included within the public infrastructure district consent <ln numlevel="1" lineno="355" slineno="6-16"/>in writing to the creation of the public infrastructure district.</subsection><subsection ssid="1-null-8" dnum="iii-o" numlevel="1" lineno="356" slineno="6-17" level="3"><display>(iii)</display>For purposes of Subsection <xref depth="4" refnumber="17D-4-201(1)(b)(ii)" start="0">(1)(b)(ii)</xref>, if the surface<amend anum="0" ea="amend" pairid="201" groupid="159" style="1" owner="jchristopherson" level="1" amendtag="both"> estate</amend> property proposed to <ln numlevel="1" lineno="357" slineno="6-18"/>be included within the public infrastructure district includes military land that is <ln numlevel="1" lineno="358" slineno="6-19"/>within a project area, the owner of the military land within the project area is the <ln numlevel="1" lineno="359" slineno="6-20"/>lessee of the military land.</subsection><subsection ssid="1-null-9" dnum="iv-o" numlevel="1" lineno="360" slineno="6-21" level="3"><display>(iv)</display>A public infrastructure district created under Subsection <xref depth="4" refnumber="17D-4-201(1)(b)(ii)" start="0">(1)(b)(ii)</xref> may be created <ln numlevel="1" lineno="361" slineno="6-22"/>as a subsidiary of the development authority that adopts the resolution creating the <ln numlevel="1" lineno="362" slineno="6-23"/>public infrastructure district.</subsection></subsection></subsection><subsection ssid="1-null-10" dnum="2-o" numlevel="1" lineno="363" slineno="6-24" level="1" space="false"><display>(2)</display><subsection ssid="1-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The following do not apply to the creation of a public infrastructure district:<subsection ssid="1-null-12" dnum="i-o" numlevel="1" lineno="364" slineno="6-25" level="3" tab="1"><display>(i)</display>Section <xref depth="3" refnumber="17B-1-203" start="0">17B-1-203</xref>;</subsection><subsection ssid="1-null-13" dnum="ii-o" numlevel="1" lineno="365" slineno="6-26" level="3" tab="1"><display>(ii)</display>Section <xref depth="3" refnumber="17B-1-204" start="0">17B-1-204</xref>;</subsection><subsection ssid="1-null-14" dnum="iii-o" numlevel="1" lineno="366" slineno="6-27" level="3" tab="1"><display>(iii)</display>Subsection <xref depth="4" refnumber="17B-1-208(2)" start="0">17B-1-208(2)</xref>;</subsection><subsection ssid="1-null-15" dnum="iv-o" numlevel="1" lineno="367" slineno="6-28" level="3" tab="1"><display>(iv)</display>Section <xref depth="3" refnumber="17B-1-212" start="0">17B-1-212</xref>; or</subsection><subsection ssid="1-null-16" dnum="v-o" numlevel="1" lineno="368" slineno="6-29" level="3" tab="1"><display>(v)</display>Section <xref depth="3" refnumber="17B-1-214" start="0">17B-1-214</xref>.</subsection></subsection><subsection ssid="1-null-17" dnum="b-o" numlevel="1" lineno="369" slineno="6-30" level="2"><display>(b)</display>The protest period described in Section <xref depth="3" refnumber="17B-1-213" start="0">17B-1-213</xref> may be waived in whole or in <ln numlevel="1" lineno="370" slineno="6-31"/>part with the consent of 100% of the surface<amend anum="0" ea="amend" pairid="202" groupid="160" style="1" owner="jchristopherson" level="1" amendtag="both"> estate</amend> property owners within the <ln numlevel="1" lineno="371" slineno="6-32"/>applicable area approving the creation of the public infrastructure district.</subsection><subsection ssid="1-null-18" dnum="c-o" numlevel="1" lineno="372" slineno="6-33" level="2"><display>(c)</display>If the protest period is waived under Subsection <xref depth="4" refnumber="17D-4-201(2)(b)" start="0">(2)(b)</xref>, a resolution approving the <ln numlevel="1" lineno="373" slineno="6-34"/>creation of the public infrastructure district may be adopted in accordance with <ln numlevel="1" lineno="374" slineno="6-35"/>Subsection <xref depth="4" refnumber="17B-1-213(5)" start="0">17B-1-213(5)</xref>.</subsection><subsection ssid="1-null-19" dnum="d-o" numlevel="1" lineno="375" slineno="6-36" level="2"><display>(d)</display>A petition meeting the requirements of Subsection <xref depth="4" refnumber="17D-4-201(1)" start="0">(1)</xref> may be certified under Section <xref depth="3" refnumber="17B-1-209" start="0"><ln numlevel="1" lineno="376" slineno="6-37"/>17B-1-209</xref>.</subsection><subsection ssid="1-null-20" dnum="e-o" numlevel="1" lineno="377" slineno="6-38" level="2"><display>(e)</display>Notwithstanding Subsection <xref tempid="382" depth="4" refnumber="17B-1-215(1)(b)">17B-1-215(1)(b)</xref>, the district applicant shall file the <ln numlevel="1" lineno="378" slineno="6-39"/>items required by Subsection <xref tempid="238" depth="4" refnumber="17B-1-215(1)(a)">17B-1-215(1)(a)</xref> with the lieutenant governor within 30 <ln numlevel="1" lineno="379" slineno="6-40"/>days of the day on which a resolution creating a public infrastructure district is <ln numlevel="1" lineno="380" slineno="6-41"/>adopted.</subsection></subsection><subsection ssid="1-null-21" dnum="3-o" numlevel="1" lineno="381" slineno="6-42" level="1"><display>(3)</display>Notwithstanding <xref depth="2" refnumber="17B-1-4" start="0">Title 17B, Chapter 1, Part 4, Annexation</xref>, an area outside of the <ln numlevel="1" lineno="382" slineno="6-43"/>boundaries of a public infrastructure district may be annexed into the public <ln numlevel="1" lineno="383" slineno="6-44"/>infrastructure district if the following requirements are met:<subsection ssid="1-null-22" dnum="a-o:_-i" numlevel="1" lineno="384" slineno="6-45" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1182" style="2" owner="o" level="1" deltag="start">(a)</amend></display><subsection ssid="1-null-23" dnum="i-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" placement="sameline"><display><amend anum="0" ea="erase" pairid="1183" style="2" owner="o" level="1">(i)</amend></display><amend anum="0" ea="erase" pairid="208" groupid="166" style="2" owner="jchristopherson" level="1" deltag="end">adoption of resolutions of the board and the creating entity, each approving of <ln numlevel="1" lineno="385" slineno="6-46"/>the annexation; or</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-24" dnum="ii-o:_-i" numlevel="1" lineno="386" slineno="6-47" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1184" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="219" groupid="173" style="2" owner="jchristopherson" level="1" deltag="end">adoption of a resolution of the board to annex the area, provided that the <ln numlevel="1" lineno="387" slineno="6-48"/>governing document or creation resolution for the public infrastructure district <ln numlevel="1" lineno="388" slineno="6-49"/>authorizes the board to annex an area outside of the boundaries of the public <ln numlevel="1" lineno="389" slineno="6-50"/>infrastructure district without future consent of the creating entity; and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-95" dnum="_-o:a-i" numlevel="1" lineno="390" slineno="6-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1185" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="209" groupid="167" style="1" owner="jchristopherson" level="1" amendtag="end">the board adopts a resolution approving the annexation;</amend></subsection><subsection ssid="1-96" dnum="_-o:b-i" numlevel="1" lineno="391" slineno="6-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1186" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="224" groupid="177" style="1" owner="jchristopherson" level="1" amendtag="end">the governing document or resolution creating the public infrastructure district <ln numlevel="1" lineno="392" slineno="6-53"/>authorizes the public infrastructure district to annex the proposed annexation area;</amend></subsection><subsection ssid="1-null-25" dnum="b-o:c-i" numlevel="1" lineno="393" slineno="6-54" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1187" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1188" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>a petition is filed with the public infrastructure district that contains the <ln numlevel="1" lineno="394" slineno="6-55"/>signatures of 100% of surface<amend anum="0" ea="amend" pairid="203" groupid="161" style="1" owner="jchristopherson" level="1" amendtag="both"> estate</amend> property owners within the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="187" groupid="148" style="2" owner="jchristopherson" level="1" deltag="both">area proposed to be <ln numlevel="1" lineno="395" slineno="6-56"/>annexed</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="186" groupid="147" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">proposed annexation area</amend>, demonstrating the surface<amend anum="0" ea="amend" pairid="207" groupid="165" style="1" owner="jchristopherson" level="1" amendtag="both"> estate</amend> property owners' <ln numlevel="1" lineno="396" slineno="6-57"/>consent to the annexation into the public infrastructure district<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="169" groupid="133" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="1-93" dnum="_-o:d-i" numlevel="1" lineno="397" slineno="6-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1188" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="174" groupid="137" style="1" owner="jchristopherson" level="1" amendtag="end">if the creating entity is a county or municipality and the proposed annexation area is <ln numlevel="1" lineno="398" slineno="6-59"/>outside the boundaries of the creating entity:</amend><subsection ssid="1-91" dnum="_-o:i-i" numlevel="1" lineno="399" slineno="6-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="162" groupid="127" style="1" owner="jchristopherson" level="1" amendtag="end">for an area that is unincorporated, the legislative body of the county where the <ln numlevel="1" lineno="400" slineno="6-61"/>area is located adopts a resolution approving the annexation; or</amend></subsection><subsection ssid="1-92" dnum="_-o:ii-i" numlevel="1" lineno="401" slineno="6-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="167" groupid="131" style="1" owner="jchristopherson" level="1" amendtag="end">for an area that is within the boundaries of a municipality, the legislative body of <ln numlevel="1" lineno="402" slineno="6-63"/>the municipality where the area is located adopts a resolution approving the <ln numlevel="1" lineno="403" slineno="6-64"/>annexation.</amend></subsection></subsection></subsection><subsection ssid="1-null-26" dnum="4-o" numlevel="1" lineno="404" slineno="6-65" level="1" space="false"><display>(4)</display><subsection ssid="1-null-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding <xref depth="2" refnumber="17B-1-5" start="0">Title 17B, Chapter 1, Part 5, Withdrawal</xref>, property may be <ln numlevel="1" lineno="405" slineno="6-66"/>withdrawn from a public infrastructure district if the following requirements are met:<subsection ssid="1-null-28" dnum="i-o" numlevel="1" lineno="406" slineno="6-67" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="1-null-29" dnum="A-o" level="4" placement="sameline"><display>(A)</display>adoption of resolutions of the board and the creating entity, each approving <ln numlevel="1" lineno="407" slineno="6-68"/>of the withdrawal; or</subsection><subsection ssid="1-null-30" dnum="B-o" numlevel="1" lineno="408" slineno="6-69" level="4"><display>(B)</display>adoption of a resolution of the board to withdraw the property, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both">provided that</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="409" slineno="6-70"/>if</amend> the governing document or creation resolution for the public infrastructure <ln numlevel="1" lineno="410" slineno="6-71"/>district authorizes the board to withdraw property from the public <ln numlevel="1" lineno="411" slineno="6-72"/>infrastructure district without further consent from the creating entity; and</subsection></subsection><subsection ssid="1-null-31" dnum="ii-o" numlevel="1" lineno="412" slineno="6-73" level="3" tab="1"><display>(ii)</display>a petition is filed with the public infrastructure district that contains the signatures <ln numlevel="1" lineno="413" slineno="6-74"/>of 100% of surface<amend anum="0" ea="amend" pairid="204" groupid="162" style="1" owner="jchristopherson" level="1" amendtag="both"> estate</amend> property owners within the area proposed to be <ln numlevel="1" lineno="414" slineno="6-75"/>withdrawn, demonstrating that the surface<amend anum="0" ea="amend" pairid="205" groupid="163" style="1" owner="jchristopherson" level="1" amendtag="both"> estate</amend> property owners consent to the <ln numlevel="1" lineno="415" slineno="6-76"/>withdrawal from the public infrastructure district.</subsection></subsection><subsection ssid="1-null-32" dnum="b-o" numlevel="1" lineno="416" slineno="6-77" level="2"><display>(b)</display>If any bonds that the public infrastructure district issues are allocable to the area to <ln numlevel="1" lineno="417" slineno="6-78"/>be withdrawn remain unpaid at the time of the proposed withdrawal, the property <ln numlevel="1" lineno="418" slineno="6-79"/>remains subject to any taxes, fees, or assessments that the public infrastructure <ln numlevel="1" lineno="419" slineno="6-80"/>district imposes until the bonds or any associated refunding bonds are paid.</subsection><subsection ssid="1-null-33" dnum="c-o" numlevel="1" lineno="420" slineno="6-81" level="2"><display>(c)</display>Upon meeting the requirements of Subsection <xref refnumber="17D-4-201(3)" depth="4">(3)</xref> or <xref depth="4" refnumber="17D-4-201(4)(a)" start="0">(4)(a)</xref>, the board shall:<subsection ssid="1-null-34" dnum="i-o" numlevel="1" lineno="421" slineno="6-82" level="3"><display>(i)</display>within 30 days of the day on which a resolution is adopted or a petition is filed <ln numlevel="1" lineno="422" slineno="6-83"/>under Subsection <xref refnumber="17D-4-201(3)" depth="4">(3)</xref> or (4)(a), file with the lieutenant governor:<subsection ssid="1-null-35" dnum="A-o" numlevel="1" lineno="423" slineno="6-84" level="4"><display>(A)</display>a copy of a notice of impending boundary action, as defined in Section <xref depth="3" refnumber="67-1a-6.5"><ln numlevel="1" lineno="424" slineno="6-85"/>67-1a-6.5</xref>, that meets the requirements of Subsection <xref depth="4" refnumber="67-1a-6.5(3)">67-1a-6.5(3)</xref>; and</subsection><subsection ssid="1-null-36" dnum="B-o" numlevel="1" lineno="425" slineno="6-86" level="4"><display>(B)</display>a copy of an approved final local entity plat, as defined in Section <xref depth="3" refnumber="67-1a-6.5">67-1a-6.5</xref>; <ln numlevel="1" lineno="426" slineno="6-87"/>and</subsection></subsection><subsection ssid="1-null-37" dnum="ii-o" numlevel="1" lineno="427" slineno="6-88" level="3"><display>(ii)</display>comply with the requirements of Section <xref depth="3" refnumber="17B-1-512" start="0">17B-1-512</xref>, except:<subsection ssid="1-null-38" dnum="A-o" numlevel="1" lineno="428" slineno="6-89" level="4"><display>(A)</display>Subsections <xref tempid="795" depth="4" refnumber="17B-1-512(1)(b)">17B-1-512(1)(b)</xref> and (c) do not apply; and</subsection><subsection ssid="1-null-39" dnum="B-o" numlevel="1" lineno="429" slineno="6-90" level="4"><display>(B)</display>the time periods described in this section govern.</subsection></subsection></subsection></subsection><subsection ssid="1-null-40" dnum="5-o" numlevel="1" lineno="430" slineno="6-91" level="1"><display>(5)</display>A creating entity may impose limitations on the powers of a public infrastructure district <ln numlevel="1" lineno="431" slineno="6-92"/>through the governing document.</subsection><subsection ssid="1-null-41" dnum="6-o" numlevel="1" lineno="432" slineno="6-93" level="1" space="false"><display>(6)</display><subsection ssid="1-null-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A public infrastructure district is separate and distinct from the creating entity.</subsection><subsection ssid="1-null-43" dnum="b-o" numlevel="1" lineno="433" slineno="6-94" level="2" space="false"><display>(b)</display><subsection ssid="1-null-44" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="17D-4-201(6)(b)(ii)" start="0">(6)(b)(ii)</xref>, any financial burden of a public <ln numlevel="1" lineno="434" slineno="6-95"/>infrastructure district:<subsection ssid="1-null-45" dnum="A-o" numlevel="1" lineno="435" slineno="6-96" level="4" tab="1"><display>(A)</display>is borne solely by the public infrastructure district; and</subsection><subsection ssid="1-null-46" dnum="B-o" numlevel="1" lineno="436" slineno="6-97" level="4" tab="1"><display>(B)</display>is not borne by the creating entity, by the state, or by any municipality, <ln numlevel="1" lineno="437" slineno="6-98"/>county, or other political subdivision.</subsection></subsection><subsection ssid="1-null-47" dnum="ii-o" numlevel="1" lineno="438" slineno="6-99" level="3"><display>(ii)</display>Notwithstanding Subsection <xref depth="4" refnumber="17D-4-201(6)(b)(i)" start="0">(6)(b)(i)</xref> and Section <xref depth="3" refnumber="17B-1-216" start="0">17B-1-216</xref>, the governing <ln numlevel="1" lineno="439" slineno="6-100"/>document may require:<subsection ssid="1-null-48" dnum="A-o" numlevel="1" lineno="440" slineno="6-101" level="4"><display>(A)</display>the district applicant to bear the initial costs of the public infrastructure <ln numlevel="1" lineno="441" slineno="6-102"/>district; and</subsection><subsection ssid="1-null-49" dnum="B-o" numlevel="1" lineno="442" slineno="6-103" level="4"><display>(B)</display>the public infrastructure district to reimburse the district applicant for the <ln numlevel="1" lineno="443" slineno="6-104"/>initial costs the creating entity bears.</subsection></subsection><subsection ssid="1-null-50" dnum="iii-o" numlevel="1" lineno="444" slineno="6-105" level="3"><display>(iii)</display>Nothing in this Subsection <xref refnumber="17D-4-201(6)" depth="4">(6)</xref> precludes a public infrastructure district from <ln numlevel="1" lineno="445" slineno="6-106"/>qualifying directly for an impact fee offset, credit, or refund under Title 11, <ln numlevel="1" lineno="446" slineno="6-107"/>Chapter 36a, Impact Fees Act, regarding any qualifying system improvements <ln numlevel="1" lineno="447" slineno="6-108"/>financed by the public infrastructure district.</subsection></subsection><subsection ssid="1-null-51" dnum="c-o" numlevel="1" lineno="448" slineno="6-109" level="2"><display>(c)</display>Any liability, judgment, or claim against a public infrastructure district:<subsection ssid="1-null-52" dnum="i-o" numlevel="1" lineno="449" slineno="6-110" level="3"><display>(i)</display>is the sole responsibility of the public infrastructure district; and</subsection><subsection ssid="1-null-53" dnum="ii-o" numlevel="1" lineno="450" slineno="6-111" level="3"><display>(ii)</display>does not constitute a liability, judgment, or claim against the creating entity, the <ln numlevel="1" lineno="451" slineno="6-112"/>state, or any municipality, county, or other political subdivision.</subsection></subsection><subsection ssid="1-null-54" dnum="d-o" numlevel="1" lineno="452" slineno="6-113" level="2" space="false"><display>(d)</display><subsection ssid="1-null-55" dnum="i-o" level="3" placement="sameline" space="false"><display>(i)</display><subsection ssid="1-null-56" dnum="A-o" level="4" tab="1" placement="sameline"><display>(A)</display>The public infrastructure district solely bears the responsibility of any <ln numlevel="1" lineno="453" slineno="6-114"/>collection, enforcement, or foreclosure proceeding with regard to any fee or <ln numlevel="1" lineno="454" slineno="6-115"/>assessment the public infrastructure district imposes.</subsection><subsection ssid="1-null-57" dnum="B-o" numlevel="1" lineno="455" slineno="6-116" level="4" tab="1"><display>(B)</display>The creating entity does not bear the responsibility described in Subsection <xref depth="4" refnumber="17D-4-201(6)(d)(i)(A)" start="0"><ln numlevel="1" lineno="456" slineno="6-117"/>(6)(d)(i)(A)</xref>.</subsection></subsection><subsection ssid="1-null-58" dnum="ii-o" numlevel="1" lineno="457" slineno="6-118" level="3"><display>(ii)</display>A public infrastructure district, and not the creating entity, shall undertake the <ln numlevel="1" lineno="458" slineno="6-119"/>enforcement responsibility described in, as applicable, Subsection <xref depth="4" refnumber="17D-4-201(6)(d)(i)" start="0">(6)(d)(i)</xref> in <ln numlevel="1" lineno="459" slineno="6-120"/>accordance with <xref depth="1" refnumber="11-42" start="0">Title 11, Chapter 42, Assessment Area Act</xref>.</subsection></subsection></subsection><subsection ssid="1-null-59" dnum="7-o" numlevel="1" lineno="460" slineno="6-121" level="1"><display>(7)</display>A creating entity may establish criteria in determining whether to approve or disapprove <ln numlevel="1" lineno="461" slineno="6-122"/>of the creation of a public infrastructure district, including:<subsection ssid="1-null-60" dnum="a-o" numlevel="1" lineno="462" slineno="6-123" level="2"><display>(a)</display>historical performance of the district applicant;</subsection><subsection ssid="1-null-61" dnum="b-o" numlevel="1" lineno="463" slineno="6-124" level="2"><display>(b)</display>compliance with the creating entity's master plan;</subsection><subsection ssid="1-null-62" dnum="c-o" numlevel="1" lineno="464" slineno="6-125" level="2"><display>(c)</display>credit worthiness of the district applicant;</subsection><subsection ssid="1-null-63" dnum="d-o" numlevel="1" lineno="465" slineno="6-126" level="2"><display>(d)</display>plan of finance of the public infrastructure district; and</subsection><subsection ssid="1-null-64" dnum="e-o" numlevel="1" lineno="466" slineno="6-127" level="2"><display>(e)</display>proposed development within the public infrastructure district.</subsection></subsection><subsection ssid="1-null-65" dnum="8-o" numlevel="1" lineno="467" slineno="6-128" level="1" space="false"><display>(8)</display><subsection ssid="1-null-66" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The creation of a public infrastructure district is subject to the sole discretion of <ln numlevel="1" lineno="468" slineno="6-129"/>the creating entity responsible for approving or rejecting the creation of the public <ln numlevel="1" lineno="469" slineno="6-130"/>infrastructure district.</subsection><subsection ssid="1-null-67" dnum="b-o" numlevel="1" lineno="470" slineno="6-131" level="2"><display>(b)</display>The proposed creating entity bears no liability for rejecting the proposed creation of <ln numlevel="1" lineno="471" slineno="6-132"/>a public infrastructure district.</subsection></subsection></section></bsec><bsec buid="2" num="17D-4-202" type="amend" src="code" uid="C17D-4-S202_2026050620260506" sort="17D04 02020020260506" numlevel="1" lineno="472" slineno="7-1" sn="7"><section number="17D-4-202" numlevel="1" lineno="473" slineno="7-2" type="amend"><secline lineno="472">Section 7. Section <bold>17D-4-202</bold> is amended to read:</secline><catline lineno="473"><bold>17D-4-202<parens/>. Public infrastructure district board -- Governing document.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="474" slineno="7-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="2-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The legislative body or board of the creating entity shall appoint the initial <ln numlevel="1" lineno="475" slineno="7-4"/>members of the board of a public infrastructure district, in accordance with the <ln numlevel="1" lineno="476" slineno="7-5"/>governing document.</subsection><subsection ssid="2-null-3" dnum="b-o" numlevel="1" lineno="477" slineno="7-6" level="2"><display>(b)</display>A governing document approved by the legislative body or board of the creating <ln numlevel="1" lineno="478" slineno="7-7"/>entity may provide for the board of a public infrastructure district to, upon a vacancy <ln numlevel="1" lineno="479" slineno="7-8"/>on the board, appoint an individual to the board <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">so long as</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">if</amend> the individual meets <ln numlevel="1" lineno="480" slineno="7-9"/>the requirements to serve on a public infrastructure district board described in this <ln numlevel="1" lineno="481" slineno="7-10"/>section.</subsection><subsection ssid="2-null-4" dnum="c-o" numlevel="1" lineno="482" slineno="7-11" level="2"><display>(c)</display>For public infrastructure districts not described in Subsection <xref refnumber="17D-4-202(1)(b)" depth="4">(1)(b)</xref>, and except as <ln numlevel="1" lineno="483" slineno="7-12"/>provided in Subsection <xref depth="4" refnumber="17D-4-202(1)(d)">(1)(d)</xref>:<subsection ssid="2-null-5" dnum="i-o" numlevel="1" lineno="484" slineno="7-13" level="3"><display>(i)</display>if there is a vacancy on the board of a public infrastructure district, or a board <ln numlevel="1" lineno="485" slineno="7-14"/>member provides notice to the legislative body or board of the creating entity of <ln numlevel="1" lineno="486" slineno="7-15"/>the board member's intention to resign from the board, the legislative body or <ln numlevel="1" lineno="487" slineno="7-16"/>board of the creating entity shall appoint a replacement board member within 45 <ln numlevel="1" lineno="488" slineno="7-17"/>days from the day on which the vacancy first occurs or the board member <ln numlevel="1" lineno="489" slineno="7-18"/>provides notice of the board member's intent to resign; and</subsection><subsection ssid="2-null-6" dnum="ii-o" numlevel="1" lineno="490" slineno="7-19" level="3"><display>(ii)</display>if a legislative body or board of the creating entity fails to fill a vacancy on the <ln numlevel="1" lineno="491" slineno="7-20"/>board within the time period described in Subsection <xref refnumber="17D-4-202(1)(c)" depth="4">(1)(c)</xref>(i), the board of the <ln numlevel="1" lineno="492" slineno="7-21"/>public infrastructure district may appoint an individual who is eligible to serve on <ln numlevel="1" lineno="493" slineno="7-22"/>the board according to the requirements of this section to fill the board vacancy.</subsection></subsection><subsection ssid="2-null-7" dnum="d-o" numlevel="1" lineno="494" slineno="7-23" level="2"><display>(d)</display>If a public infrastructure district board position has transitioned from appointment to <ln numlevel="1" lineno="495" slineno="7-24"/>election, as described in Subsection <xref refnumber="17D-4-202(4)" depth="4">(4)</xref>, and an elected board position becomes <ln numlevel="1" lineno="496" slineno="7-25"/>vacant, the provisions of Section <xref depth="3" refnumber="20A-1-512">20A-1-512</xref> apply to fill the vacancy.</subsection></subsection><subsection ssid="2-null-8" dnum="2-o" numlevel="1" lineno="497" slineno="7-26" level="1" space="false"><display>(2)</display><subsection ssid="2-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Unless otherwise limited in the governing document and except as provided in <ln numlevel="1" lineno="498" slineno="7-27"/>Subsection <xref depth="4" refnumber="17D-4-202(2)(b)" start="0">(2)(b)</xref>, the initial term of each member of the board is four years.</subsection><subsection ssid="2-null-10" dnum="b-o" numlevel="1" lineno="499" slineno="7-28" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="17D-4-202(2)(a)" start="0">(2)(a)</xref>, approximately half of the members of the initial <ln numlevel="1" lineno="500" slineno="7-29"/>board shall serve a six-year term so that, after the expiration of the initial term, the <ln numlevel="1" lineno="501" slineno="7-30"/>term of approximately half the board members expires every two years.</subsection><subsection ssid="2-null-11" dnum="c-o" numlevel="1" lineno="502" slineno="7-31" level="2"><display>(c)</display>A board may elect that a majority of the board serve an initial term of six years.</subsection><subsection ssid="2-null-12" dnum="d-o" numlevel="1" lineno="503" slineno="7-32" level="2"><display>(d)</display>After the initial term, the term of each member of the board is four years.</subsection><subsection ssid="2-null-13" dnum="e-o" numlevel="1" lineno="504" slineno="7-33" level="2"><display>(e)</display>A member of the board who is appointed shall continue to serve on the board of the <ln numlevel="1" lineno="505" slineno="7-34"/>public infrastructure district until a replacement board member is appointed.</subsection></subsection><subsection ssid="2-null-14" dnum="3-o" numlevel="1" lineno="506" slineno="7-35" level="1" space="false"><display>(3)</display><subsection ssid="2-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding Subsection <xref depth="4" refnumber="17B-1-302(1)(b)" start="0">17B-1-302(1)(b)</xref>, a board member is not required to <ln numlevel="1" lineno="507" slineno="7-36"/>be a resident within the boundaries of the public infrastructure district if:<subsection ssid="2-null-16" dnum="i-o" numlevel="1" lineno="508" slineno="7-37" level="3" tab="1"><display>(i)</display>all of the surface<amend anum="0" ea="amend" pairid="49" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="both"> estate</amend> property owners consent to the waiver of the residency <ln numlevel="1" lineno="509" slineno="7-38"/>requirement;</subsection><subsection ssid="2-null-17" dnum="ii-o" numlevel="1" lineno="510" slineno="7-39" level="3" tab="1"><display>(ii)</display>there are no residents within the boundaries of the public infrastructure district;</subsection><subsection ssid="2-null-18" dnum="iii-o" numlevel="1" lineno="511" slineno="7-40" level="3" tab="1"><display>(iii)</display>no qualified candidate timely files to be considered for appointment to the board; <ln numlevel="1" lineno="512" slineno="7-41"/>or</subsection><subsection ssid="2-null-19" dnum="iv-o" numlevel="1" lineno="513" slineno="7-42" level="3" tab="1"><display>(iv)</display>no qualified individual files a declaration of candidacy for a board position in <ln numlevel="1" lineno="514" slineno="7-43"/>accordance with Subsection <xref depth="4" refnumber="17B-1-306(5)" start="0">17B-1-306(5)</xref>.</subsection></subsection><subsection ssid="2-null-20" dnum="b-o" numlevel="1" lineno="515" slineno="7-44" level="2"><display>(b)</display>Except under the circumstances described in Subsection <xref depth="4" refnumber="17D-4-202(3)(a)(iii)" start="0">(3)(a)(iii)</xref> or <xref depth="4" refnumber="17D-4-202(3)(a)(iv)" start="0">(iv)</xref>, the <ln numlevel="1" lineno="516" slineno="7-45"/>residency requirement in Subsection <xref depth="4" refnumber="17B-1-302(1)(b)" start="0">17B-1-302(1)(b)</xref> is applicable to any board <ln numlevel="1" lineno="517" slineno="7-46"/>member elected for a division or board position that has transitioned from an <ln numlevel="1" lineno="518" slineno="7-47"/>appointed to an elected board member in accordance with this section.</subsection><subsection ssid="2-null-21" dnum="c-o" numlevel="1" lineno="519" slineno="7-48" level="2"><display>(c)</display>An individual who is not a resident within the boundaries of the public infrastructure <ln numlevel="1" lineno="520" slineno="7-49"/>district may not serve as a board member unless the individual is:<subsection ssid="2-null-22" dnum="i-o" numlevel="1" lineno="521" slineno="7-50" level="3"><display>(i)</display>an owner of land or an agent or officer of the owner of land within the boundaries <ln numlevel="1" lineno="522" slineno="7-51"/>of the public infrastructure district; and</subsection><subsection ssid="2-null-23" dnum="ii-o" numlevel="1" lineno="523" slineno="7-52" level="3"><display>(ii)</display>a registered voter at the individual's primary residence.</subsection></subsection><subsection ssid="2-null-24" dnum="d-o" numlevel="1" lineno="524" slineno="7-53" level="2"><display>(d)</display>If the creating entity determines that a public infrastructure district is not anticipated <ln numlevel="1" lineno="525" slineno="7-54"/>to have permanent residents within the public infrastructure district's boundaries, or is <ln numlevel="1" lineno="526" slineno="7-55"/>anticipated to be primarily composed of non-residential property or non-primary <ln numlevel="1" lineno="527" slineno="7-56"/>residential property, a governing document may allow the creating entity to continue <ln numlevel="1" lineno="528" slineno="7-57"/>to appoint a property owner, or the agent of a property owner, to the public <ln numlevel="1" lineno="529" slineno="7-58"/>infrastructure district board.</subsection><subsection ssid="2-null-25" dnum="e-o" numlevel="1" lineno="530" slineno="7-59" level="2"><display>(e)</display>A governing document may allow for a property owner to recommend a property <ln numlevel="1" lineno="531" slineno="7-60"/>owner or a property owner's agent for appointment to the public infrastructure district <ln numlevel="1" lineno="532" slineno="7-61"/>board in numbers proportional to the property owner's ownership of land, or value of <ln numlevel="1" lineno="533" slineno="7-62"/>land, within a public infrastructure district.</subsection></subsection><subsection ssid="2-null-26" dnum="4-o" numlevel="1" lineno="534" slineno="7-63" level="1" space="false"><display>(4)</display><subsection ssid="2-null-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A governing document may provide for a transition from legislative body <ln numlevel="1" lineno="535" slineno="7-64"/>appointment under Subsection <xref depth="4" refnumber="17D-4-202(1)" start="0">(1)</xref> to a method of election by registered voters based <ln numlevel="1" lineno="536" slineno="7-65"/>upon milestones or events that the governing document identifies, including a <ln numlevel="1" lineno="537" slineno="7-66"/>milestone for each division or individual board position providing that when the <ln numlevel="1" lineno="538" slineno="7-67"/>milestone is reached:<subsection ssid="2-null-28" dnum="i-o" numlevel="1" lineno="539" slineno="7-68" level="3" tab="1"><display>(i)</display>for a division, the registered voters of the division elect a member of the board in <ln numlevel="1" lineno="540" slineno="7-69"/>place of an appointed member at the next municipal general election for the board <ln numlevel="1" lineno="541" slineno="7-70"/>position; or</subsection><subsection ssid="2-null-29" dnum="ii-o" numlevel="1" lineno="542" slineno="7-71" level="3" tab="1"><display>(ii)</display>for an at large board position established in the governing document, the <ln numlevel="1" lineno="543" slineno="7-72"/>registered voters of the public infrastructure district elect a member of the board in <ln numlevel="1" lineno="544" slineno="7-73"/>place of an appointed member at the next municipal general election for the board <ln numlevel="1" lineno="545" slineno="7-74"/>position.</subsection></subsection><subsection ssid="2-null-30" dnum="b-o" numlevel="1" lineno="546" slineno="7-75" level="2"><display>(b)</display>Regardless of whether a board member is elected under Subsection <xref depth="4" refnumber="17D-4-202(4)(a)" start="0">(4)(a)</xref>, the <ln numlevel="1" lineno="547" slineno="7-76"/>position of each remaining board member shall continue to be appointed under <ln numlevel="1" lineno="548" slineno="7-77"/>Subsection <xref depth="4" refnumber="17D-4-202(1)" start="0">(1)</xref> until the member's respective division or board position surpasses the <ln numlevel="1" lineno="549" slineno="7-78"/>density milestone described in the governing document.</subsection></subsection><subsection ssid="2-null-31" dnum="5-o" numlevel="1" lineno="550" slineno="7-79" level="1" space="false"><display>(5)</display><subsection ssid="2-null-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="17D-4-202(5)(c)" start="0">(5)(c)</xref>, the board may, in the board's discretion but no more <ln numlevel="1" lineno="551" slineno="7-80"/>frequently than every four years, reestablish the boundaries of each division so that <ln numlevel="1" lineno="552" slineno="7-81"/>each division that has reached a milestone specified in the governing document, as <ln numlevel="1" lineno="553" slineno="7-82"/>described in Subsection <xref depth="4" refnumber="17D-4-202(4)(a)" start="0">(4)(a)</xref>, has, as nearly as possible, the same number of eligible <ln numlevel="1" lineno="554" slineno="7-83"/>voters.</subsection><subsection ssid="2-null-33" dnum="b-o" numlevel="1" lineno="555" slineno="7-84" level="2"><display>(b)</display>In reestablishing division boundaries under Subsection <xref depth="4" refnumber="17D-4-202(5)(a)" start="0">(5)(a)</xref>, the board shall <ln numlevel="1" lineno="556" slineno="7-85"/>consider existing or potential developments within the divisions that, when <ln numlevel="1" lineno="557" slineno="7-86"/>completed, would increase or decrease the number of eligible voters within the <ln numlevel="1" lineno="558" slineno="7-87"/>division.</subsection><subsection ssid="2-null-34" dnum="c-o" numlevel="1" lineno="559" slineno="7-88" level="2"><display>(c)</display>The governing document may prohibit the board from reestablishing, without the <ln numlevel="1" lineno="560" slineno="7-89"/>consent of the creating entity, the division boundaries as described in Subsection <xref depth="4" refnumber="17D-4-202(5)(a)" start="0"><ln numlevel="1" lineno="561" slineno="7-90"/>(5)(a)</xref>.</subsection></subsection><subsection ssid="2-null-35" dnum="6-o" numlevel="1" lineno="562" slineno="7-91" level="1"><display>(6)</display>A public infrastructure district may not compensate a board member for the member's <ln numlevel="1" lineno="563" slineno="7-92"/>service on the board under Section <xref depth="3" refnumber="17B-1-307" start="0">17B-1-307</xref> unless the board member is a resident <ln numlevel="1" lineno="564" slineno="7-93"/>within the boundaries of the public infrastructure district.</subsection><subsection ssid="2-null-36" dnum="7-o" numlevel="1" lineno="565" slineno="7-94" level="1"><display>(7)</display>A governing document shall:<subsection ssid="2-null-37" dnum="a-o" numlevel="1" lineno="566" slineno="7-95" level="2"><display>(a)</display>include a boundary description and a map of the public infrastructure district;</subsection><subsection ssid="2-61" dnum="_-o:b-i" numlevel="1" lineno="567" slineno="7-96" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1270" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">describe the public infrastructure and improvements the public infrastructure district <ln numlevel="1" lineno="568" slineno="7-97"/>is being created to construct, repair, or otherwise complete;</amend></subsection><subsection ssid="2-null-38" dnum="b-o:c-i" numlevel="1" lineno="569" slineno="7-98" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1271" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1272" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>state the number of board members;</subsection><subsection ssid="2-null-39" dnum="c-o:d-i" numlevel="1" lineno="570" slineno="7-99" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1272" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1273" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>describe any divisions of the public infrastructure district;</subsection><subsection ssid="2-null-40" dnum="d-o:e-i" numlevel="1" lineno="571" slineno="7-100" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1273" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1274" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>establish any applicable property tax levy rate limit for the public infrastructure <ln numlevel="1" lineno="572" slineno="7-101"/>district;</subsection><subsection ssid="2-null-41" dnum="e-o:f-i" numlevel="1" lineno="573" slineno="7-102" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1274" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1275" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>establish any applicable limitation on the principal amount of indebtedness for <ln numlevel="1" lineno="574" slineno="7-103"/>the public infrastructure district;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="2-60" dnum="_-o:g-i" numlevel="1" lineno="575" slineno="7-104" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1275" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">establish conflict of interest disclosure requirements for appointed board members <ln numlevel="1" lineno="576" slineno="7-105"/>that:</amend><subsection ssid="2-62" dnum="_-o:i-i" numlevel="1" lineno="577" slineno="7-106" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1276" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">require an appointed board member to make, and regularly update, a conflict of <ln numlevel="1" lineno="578" slineno="7-107"/>interest disclosure that includes the information and items described in <ln numlevel="1" lineno="579" slineno="7-108"/>Subsections <xref depth="4" refnumber="20A-11-1604(6)(a)">20A-11-1604(6)(a)</xref> through <xref depth="4" refnumber="17D-4-202(n)">(n)</xref>; and</amend></subsection><subsection ssid="2-64" dnum="_-o:ii-i" numlevel="1" lineno="580" slineno="7-109" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1277" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">require public posting of the conflict of interest disclosure on the Utah Public <ln numlevel="1" lineno="581" slineno="7-110"/>Notice Website and the public infrastructure district's website, if any; and</amend></subsection></subsection><subsection ssid="2-null-42" dnum="f-o:h-i" numlevel="1" lineno="582" slineno="7-111" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1278" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1279" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display>include other information that the public infrastructure district or the creating <ln numlevel="1" lineno="583" slineno="7-112"/>entity determines to be necessary or advisable.</subsection></subsection><subsection ssid="2-null-43" dnum="8-o" numlevel="1" lineno="584" slineno="7-113" level="1" space="false"><display>(8)</display><subsection ssid="2-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="17D-4-202(8)(b)" start="0">(8)(b)</xref>, the board and the governing body of the <ln numlevel="1" lineno="585" slineno="7-114"/>creating entity may amend a governing document by each adopting a resolution that <ln numlevel="1" lineno="586" slineno="7-115"/>approves the amended governing document.</subsection><subsection ssid="2-null-45" dnum="b-o" numlevel="1" lineno="587" slineno="7-116" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="17D-4-202(8)(a)" start="0">(8)(a)</xref>, any amendment to increase a property tax levy <ln numlevel="1" lineno="588" slineno="7-117"/>rate limitation requires the consent of 100% of surface<amend anum="0" ea="amend" pairid="50" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="both"> estate</amend> property owners within <ln numlevel="1" lineno="589" slineno="7-118"/>the boundaries of the public infrastructure district.</subsection></subsection><subsection ssid="2-null-46" dnum="9-o" numlevel="1" lineno="590" slineno="7-119" level="1"><display>(9)</display>A board member is not in violation of Section <xref depth="3" refnumber="67-16-9" start="0">67-16-9</xref> if the board member:<subsection ssid="2-null-47" dnum="a-o" numlevel="1" lineno="591" slineno="7-120" level="2"><display>(a)</display>discloses a business relationship in accordance with Sections <xref depth="3" refnumber="67-16-7" start="0">67-16-7</xref> and <xref depth="3" refnumber="67-16-8" start="0">67-16-8</xref> <ln numlevel="1" lineno="592" slineno="7-121"/>and files the disclosure with the creating entity:<subsection ssid="2-null-48" dnum="i-o" numlevel="1" lineno="593" slineno="7-122" level="3"><display>(i)</display>before any appointment or election; and</subsection><subsection ssid="2-null-49" dnum="ii-o" numlevel="1" lineno="594" slineno="7-123" level="3"><display>(ii)</display>upon any significant change in the business relationship; and</subsection></subsection><subsection ssid="2-null-50" dnum="b-o" numlevel="1" lineno="595" slineno="7-124" level="2"><display>(b)</display>conducts the affairs of the public infrastructure district in accordance with this title <ln numlevel="1" lineno="596" slineno="7-125"/>and any parameters described in the governing document.</subsection></subsection><subsection ssid="2-null-51" dnum="10-o" numlevel="1" lineno="597" slineno="7-126" level="1"><display>(10)</display>Notwithstanding any other provision of this section, the governing document governs <ln numlevel="1" lineno="598" slineno="7-127"/>the number, appointment, and terms of board members of a public infrastructure district <ln numlevel="1" lineno="599" slineno="7-128"/>created by the development authority.</subsection></section></bsec><bsec buid="98" num="17D-4-202.1" type="amend" src="code" uid="C17D-4-S202.1_2026050620260506" sort="17D04 02020120260506" numlevel="1" lineno="600" slineno="8-1" sn="8"><section number="17D-4-202.1" numlevel="1" lineno="601" slineno="8-2" type="amend"><secline lineno="600">Section 8. Section <bold>17D-4-202.1</bold> is amended to read:</secline><catline lineno="601"><bold>17D-4-202.1<parens/>. Convention center public infrastructure -- District board -- <ln numlevel="1" lineno="602" slineno="8-3"/>Petition and process requirements -- Governing document.</bold></catline><subsection ssid="98-null-1" dnum="1-o" numlevel="1" lineno="603" slineno="8-4" level="1" placement="noreturn"><display>(1)</display>As used is this section:<subsection ssid="98-null-2" dnum="a-o" numlevel="1" lineno="604" slineno="8-5" level="2"><display>(a)</display>"City" means a municipality of the first class located in a county of the first class in <ln numlevel="1" lineno="605" slineno="8-6"/>which a convention center is located.</subsection><subsection ssid="98-null-3" dnum="b-o" numlevel="1" lineno="606" slineno="8-7" level="2"><display>(b)</display>"County" means a county in which a convention center is located.</subsection><subsection ssid="98-null-4" dnum="c-o" numlevel="1" lineno="607" slineno="8-8" level="2"><display>(c)</display>"Lessee" means a lessee of property within the proposed convention center public <ln numlevel="1" lineno="608" slineno="8-9"/>infrastructure district that leases the property from the city or county for a term of at <ln numlevel="1" lineno="609" slineno="8-10"/>least 10 years.</subsection><subsection ssid="98-null-5" dnum="d-o" numlevel="1" lineno="610" slineno="8-11" level="2" space="false"><display>(d)</display><subsection ssid="98-null-6" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Petitioner" means:<subsection ssid="98-null-7" dnum="A-o" numlevel="1" lineno="611" slineno="8-12" level="4" tab="1"><display>(A)</display>a surface <amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">estate </amend>property owner, a property owner, or lessee of property within <ln numlevel="1" lineno="612" slineno="8-13"/>a proposed convention center public infrastructure district's boundaries that <ln numlevel="1" lineno="613" slineno="8-14"/>initiates the formation of a convention center public infrastructure district; or</subsection><subsection ssid="98-null-8" dnum="B-o" numlevel="1" lineno="614" slineno="8-15" level="4" tab="1"><display>(B)</display>a surface <amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">estate </amend>property owner under this chapter, and Title 17B, Chapter 1, <ln numlevel="1" lineno="615" slineno="8-16"/>Provisions Applicable to All Special Districts, in relation to a convention <ln numlevel="1" lineno="616" slineno="8-17"/>center public infrastructure district.</subsection></subsection><subsection ssid="98-null-9" dnum="ii-o" numlevel="1" lineno="617" slineno="8-18" level="3"><display>(ii)</display>"Petitioner" does not include a city, county, or other public entity.</subsection></subsection></subsection><subsection ssid="98-null-10" dnum="2-o" numlevel="1" lineno="618" slineno="8-19" level="1"><display>(2)</display>A convention center public infrastructure district shall be created in a city upon the <ln numlevel="1" lineno="619" slineno="8-20"/>submission of a petition in accordance with this part and shall have all the powers of a <ln numlevel="1" lineno="620" slineno="8-21"/>public infrastructure district under this chapter.</subsection><subsection ssid="98-null-11" dnum="3-o" numlevel="1" lineno="621" slineno="8-22" level="1"><display>(3)</display>A convention center public infrastructure district may only be created within a city in <ln numlevel="1" lineno="622" slineno="8-23"/>which a convention center is located.</subsection><subsection ssid="98-null-12" dnum="4-o" numlevel="1" lineno="623" slineno="8-24" level="1"><display>(4)</display>The petition described in Subsection <xref tempid="369" depth="4" refnumber="(2)">(2)</xref> shall:<subsection ssid="98-null-13" dnum="a-o" numlevel="1" lineno="624" slineno="8-25" level="2"><display>(a)</display>include the governing document; and</subsection><subsection ssid="98-null-14" dnum="b-o" numlevel="1" lineno="625" slineno="8-26" level="2"><display>(b)</display>for a petition to a city which has previously authorized revitalization taxes described <ln numlevel="1" lineno="626" slineno="8-27"/>in Section <xref depth="3" refnumber="63N-3-1403">63N-3-1403</xref>, include as part of the governing document approval and <ln numlevel="1" lineno="627" slineno="8-28"/>authorization of an interlocal agreement pledging and securing the revitalization <ln numlevel="1" lineno="628" slineno="8-29"/>taxes for debt of the proposed convention center public infrastructure district.</subsection></subsection><subsection ssid="98-null-15" dnum="5-o" numlevel="1" lineno="629" slineno="8-30" level="1" space="false"><display>(5)</display><subsection ssid="98-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The process for creating a convention center public infrastructure district or a <ln numlevel="1" lineno="630" slineno="8-31"/>convention center public infrastructure district in a capital city shall be initiated by <ln numlevel="1" lineno="631" slineno="8-32"/>the submission of a petition and a governing document to the city, except that:<subsection ssid="98-null-17" dnum="i-o" numlevel="1" lineno="632" slineno="8-33" level="3" tab="1"><display>(i)</display>the city recorder shall certify the petition within 14 days from the day the <ln numlevel="1" lineno="633" slineno="8-34"/>petitioner submits the petition to the city recorder;</subsection><subsection ssid="98-null-18" dnum="ii-o" numlevel="1" lineno="634" slineno="8-35" level="3" tab="1"><display>(ii)</display>if the city recorder fails to certify the petition within the time described in <ln numlevel="1" lineno="635" slineno="8-36"/>Subsection (5)(a)(i), the petition shall be considered certified; and</subsection><subsection ssid="98-null-19" dnum="iii-o" numlevel="1" lineno="636" slineno="8-37" level="3" tab="1"><display>(iii)</display>within 30 days from the day that the petitioner submits the petition to the city <ln numlevel="1" lineno="637" slineno="8-38"/>recorder, or if the city and the petitioner have come to an agreement as described <ln numlevel="1" lineno="638" slineno="8-39"/>in Subsection <xref tempid="958" depth="4" refnumber="(5)(b)">(5)(b)</xref>, the city shall adopt a resolution to approve:<subsection ssid="98-null-20" dnum="A-o" numlevel="1" lineno="639" slineno="8-40" level="4"><display>(A)</display>the governing document the petitioner submitted with the petition; and</subsection><subsection ssid="98-null-21" dnum="B-o" numlevel="1" lineno="640" slineno="8-41" level="4"><display>(B)</display>the creation of a convention center public infrastructure district or a <ln numlevel="1" lineno="641" slineno="8-42"/>convention center public infrastructure district in a capital city.</subsection></subsection></subsection><subsection ssid="98-null-22" dnum="b-o" numlevel="1" lineno="642" slineno="8-43" level="2"><display>(b)</display>Notwithstanding Subsection <xref tempid="843" depth="4" refnumber="(5)(a)">(5)(a)</xref>, the city and petitioner may negotiate the finalized <ln numlevel="1" lineno="643" slineno="8-44"/>terms of the petition, including the terms of an interlocal agreement, within a time <ln numlevel="1" lineno="644" slineno="8-45"/>period agreed upon by the city and petitioner.</subsection></subsection><subsection ssid="98-null-23" dnum="6-o" numlevel="1" lineno="645" slineno="8-46" level="1" space="false"><display>(6)</display><subsection ssid="98-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The boundaries of a convention center public infrastructure district shall be <ln numlevel="1" lineno="646" slineno="8-47"/>limited to an area within a one-half-mile radius of a convention center.</subsection><subsection ssid="98-null-25" dnum="b-o" numlevel="1" lineno="647" slineno="8-48" level="2"><display>(b)</display>If a parcel is intersected by the radius described in Subsection (6)(a), the entire parcel <ln numlevel="1" lineno="648" slineno="8-49"/>may be included in the district.</subsection></subsection><subsection ssid="98-null-26" dnum="7-o" numlevel="1" lineno="649" slineno="8-50" level="1"><display>(7)</display>A convention center public infrastructure district shall be subject to the following <ln numlevel="1" lineno="650" slineno="8-51"/>provisions regarding taxation and financing:<subsection ssid="98-null-27" dnum="a-o" numlevel="1" lineno="651" slineno="8-52" level="2"><display>(a)</display>a convention center public infrastructure district may levy an administrative tax of up <ln numlevel="1" lineno="652" slineno="8-53"/>to 0.0005 per dollar of taxable value on taxable property within the district; and</subsection><subsection ssid="98-null-28" dnum="b-o" numlevel="1" lineno="653" slineno="8-54" level="2"><display>(b)</display>the administrative tax shall be used exclusively for administrative expenses and may <ln numlevel="1" lineno="654" slineno="8-55"/>not be used for capital costs or debt payment.</subsection></subsection><subsection ssid="98-null-29" dnum="8-o" numlevel="1" lineno="655" slineno="8-56" level="1"><display>(8)</display>A convention center public infrastructure district shall be governed by the governing <ln numlevel="1" lineno="656" slineno="8-57"/>document submitted and approved as described in this section.</subsection><subsection ssid="98-null-30" dnum="9-o" numlevel="1" lineno="657" slineno="8-58" level="1"><display>(9)</display>The convention center public infrastructure board shall consist of five members as <ln numlevel="1" lineno="658" slineno="8-59"/>follows:<subsection ssid="98-null-31" dnum="a-o" numlevel="1" lineno="659" slineno="8-60" level="2"><display>(a)</display>three members shall be representatives of the petitioner and selected by the petitioner;</subsection><subsection ssid="98-null-32" dnum="b-o" numlevel="1" lineno="660" slineno="8-61" level="2"><display>(b)</display>one member may be a representative of the city and selected by the mayor of the <ln numlevel="1" lineno="661" slineno="8-62"/>city; and</subsection><subsection ssid="98-null-33" dnum="c-o" numlevel="1" lineno="662" slineno="8-63" level="2"><display>(c)</display>one member may be a representative of the county and selected by the mayor of the <ln numlevel="1" lineno="663" slineno="8-64"/>county.</subsection></subsection><subsection ssid="98-null-34" dnum="10-o" numlevel="1" lineno="664" slineno="8-65" level="1"><display>(10)</display>If a city or county mayor chooses not to select a member of the board as described in <ln numlevel="1" lineno="665" slineno="8-66"/>Subsection (9)(b) or (c), elects in writing to permanently abdicate the board seat, or <ln numlevel="1" lineno="666" slineno="8-67"/>chooses to vacate a member at any time, the petitioner shall select a member for the <ln numlevel="1" lineno="667" slineno="8-68"/>replacement who shall not be a representative of the city or county in which the <ln numlevel="1" lineno="668" slineno="8-69"/>convention center is located.</subsection><subsection ssid="98-null-35" dnum="11-o" numlevel="1" lineno="669" slineno="8-70" level="1" space="false"><display>(11)</display><subsection ssid="98-null-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A convention center public infrastructure district shall enter into an interlocal <ln numlevel="1" lineno="670" slineno="8-71"/>agreement with the relevant county that provides that, for any revenue that is <ln numlevel="1" lineno="671" slineno="8-72"/>transferred to the convention center public infrastructure district from a convention <ln numlevel="1" lineno="672" slineno="8-73"/>center reinvestment zone created pursuant to Title 63N, Chapter 3, Part 6, Housing <ln numlevel="1" lineno="673" slineno="8-74"/>and Transit Reinvestment Zone Act, the mayor of the county shall have approval <ln numlevel="1" lineno="674" slineno="8-75"/>authority for the expenditure of any revenue related to a convention center <ln numlevel="1" lineno="675" slineno="8-76"/>revitalization project, as that term is defined in Section <xref depth="3" refnumber="63N-3-602">63N-3-602</xref>.</subsection><subsection ssid="98-null-37" dnum="b-o" numlevel="1" lineno="676" slineno="8-77" level="2"><display>(b)</display>The approval authority described in Subsection <xref tempid="768" depth="4" refnumber="(11)(a)">(11)(a)</xref> does not include approval <ln numlevel="1" lineno="677" slineno="8-78"/>authority over:<subsection ssid="98-null-38" dnum="i-o" numlevel="1" lineno="678" slineno="8-79" level="3"><display>(i)</display>any bonds or debt or related terms issued by the convention center public <ln numlevel="1" lineno="679" slineno="8-80"/>infrastructure district; or</subsection><subsection ssid="98-null-39" dnum="ii-o" numlevel="1" lineno="680" slineno="8-81" level="3"><display>(ii)</display>revenue subject to a participation agreement entered into pursuant to Title 63N, <ln numlevel="1" lineno="681" slineno="8-82"/>Chapter 3, Part 14, Capital City Revitalization Zone.</subsection></subsection></subsection></section></bsec><bsec buid="84" num="17D-4-301" type="amend" src="code" uid="C17D-4-S301_2026050620260506" sort="17D04 03010020260506" numlevel="1" lineno="682" slineno="9-1" sn="9"><section number="17D-4-301" numlevel="1" lineno="683" slineno="9-2" type="amend"><secline lineno="682">Section 9. Section <bold>17D-4-301</bold> is amended to read:</secline><catline lineno="683"><bold>17D-4-301<parens/>. Public infrastructure district bonds.</bold></catline><subsection ssid="84-null-1" dnum="1-o" numlevel="1" lineno="684" slineno="9-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="84-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="17D-4-301(1)(b)" start="0">(1)(b)</xref>, a public infrastructure district may issue negotiable <ln numlevel="1" lineno="685" slineno="9-4"/>bonds or other debt instruments for the purposes described in Section <xref depth="3" refnumber="17D-4-203" start="0">17D-4-203</xref>, as <ln numlevel="1" lineno="686" slineno="9-5"/>provided in, as applicable:<subsection ssid="84-null-3" dnum="i-o" numlevel="1" lineno="687" slineno="9-6" level="3" tab="1"><display>(i)</display><xref depth="1" refnumber="11-14" start="0">Title 11, Chapter 14, Local Government Bonding Act</xref>;</subsection><subsection ssid="84-null-4" dnum="ii-o" numlevel="1" lineno="688" slineno="9-7" level="3" tab="1"><display>(ii)</display><xref depth="1" refnumber="11-27" start="0">Title 11, Chapter 27, Utah Refunding Bond Act</xref>;</subsection><subsection ssid="84-null-5" dnum="iii-o" numlevel="1" lineno="689" slineno="9-8" level="3" tab="1"><display>(iii)</display><xref depth="1" refnumber="11-42" start="0">Title 11, Chapter 42, Assessment Area Act</xref>; </subsection><subsection ssid="84-null-6" dnum="iv-o" numlevel="1" lineno="690" slineno="9-9" level="3" tab="1"><display>(iv)</display>Title 11, Chapter 42a, Commercial Property Assessed Clean Energy Act; and</subsection><subsection ssid="84-null-7" dnum="v-o" numlevel="1" lineno="691" slineno="9-10" level="3" tab="1"><display>(v)</display>this section.</subsection></subsection><subsection ssid="84-null-8" dnum="b-o" numlevel="1" lineno="692" slineno="9-11" level="2"><display>(b)</display>A public infrastructure district created by a bonding political subdivision, as defined <ln numlevel="1" lineno="693" slineno="9-12"/>in Section <xref depth="3" refnumber="63C-25-101" start="0">63C-25-101</xref>, may not issue bonds under this part unless the board first:<subsection ssid="84-null-9" dnum="i-o" numlevel="1" lineno="694" slineno="9-13" level="3"><display>(i)</display>adopts a parameters resolution for the bonds that sets forth:<subsection ssid="84-null-10" dnum="A-o" numlevel="1" lineno="695" slineno="9-14" level="4"><display>(A)</display>the maximum:<subsection ssid="84-null-11" dnum="I-o" numlevel="1" lineno="696" slineno="9-15" level="5"><display>(I)</display>amount of bonds;</subsection><subsection ssid="84-null-12" dnum="II-o" numlevel="1" lineno="697" slineno="9-16" level="5"><display>(II)</display>term; and</subsection><subsection ssid="84-null-13" dnum="III-o" numlevel="1" lineno="698" slineno="9-17" level="5"><display>(III)</display>interest rate; and</subsection></subsection><subsection ssid="84-null-14" dnum="B-o" numlevel="1" lineno="699" slineno="9-18" level="4"><display>(B)</display>the expected security for the bonds; and</subsection></subsection><subsection ssid="84-null-15" dnum="ii-o" numlevel="1" lineno="700" slineno="9-19" level="3"><display>(ii)</display>submits the parameters resolution for review and recommendation to the State <ln numlevel="1" lineno="701" slineno="9-20"/>Finance Review Commission created in Section <xref depth="3" refnumber="63C-25-201" start="0">63C-25-201</xref>.</subsection></subsection></subsection><subsection ssid="84-null-16" dnum="2-o" numlevel="1" lineno="702" slineno="9-21" level="1"><display>(2)</display>A public infrastructure district bond shall mature within 40 years of the date of issuance.</subsection><subsection ssid="84-null-17" dnum="3-o" numlevel="1" lineno="703" slineno="9-22" level="1" space="false"><display>(3)</display><subsection ssid="84-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A public infrastructure district may issue a limited tax bond, in the same manner <ln numlevel="1" lineno="704" slineno="9-23"/>as a general obligation bond:<subsection ssid="84-null-19" dnum="i-o" numlevel="1" lineno="705" slineno="9-24" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="84-null-20" dnum="A-o" level="4" placement="sameline"><display>(A)</display>with the consent of 100% of surface<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"> estate</amend> property owners within the <ln numlevel="1" lineno="706" slineno="9-25"/>boundaries of the public infrastructure district; and</subsection><subsection ssid="84-null-21" dnum="B-o" numlevel="1" lineno="707" slineno="9-26" level="4"><display>(B)</display>with the consent of a majority of the registered voters, if any, within the <ln numlevel="1" lineno="708" slineno="9-27"/>boundaries of the proposed public infrastructure district as of the day on which <ln numlevel="1" lineno="709" slineno="9-28"/>the board finds that the consent of a majority of registered voters has been <ln numlevel="1" lineno="710" slineno="9-29"/>obtained; or</subsection></subsection><subsection ssid="84-null-22" dnum="ii-o" numlevel="1" lineno="711" slineno="9-30" level="3" tab="1"><display>(ii)</display>upon approval of a majority of the registered voters within the boundaries of the <ln numlevel="1" lineno="712" slineno="9-31"/>public infrastructure district voting in an election held for that purpose under <xref depth="1" refnumber="11-14" start="0">Title <ln numlevel="1" lineno="713" slineno="9-32"/>11, Chapter 14, Local Government Bonding Act</xref>.</subsection></subsection><subsection ssid="84-null-23" dnum="b-o" numlevel="1" lineno="714" slineno="9-33" level="2"><display>(b)</display>A limited tax bond described in Subsection <xref depth="4" refnumber="17D-4-301(3)(a)" start="0">(3)(a)</xref>:<subsection ssid="84-null-24" dnum="i-o" numlevel="1" lineno="715" slineno="9-34" level="3"><display>(i)</display>is not subject to the limitation on a general obligation bond described in <ln numlevel="1" lineno="716" slineno="9-35"/>Subsection <xref depth="4" refnumber="17B-1-1102(4)" start="0">17B-1-1102(4)</xref>; and</subsection><subsection ssid="84-null-25" dnum="ii-o" numlevel="1" lineno="717" slineno="9-36" level="3"><display>(ii)</display>is subject to a limitation, if any, on the principal amount of indebtedness as <ln numlevel="1" lineno="718" slineno="9-37"/>described in the governing document.</subsection></subsection><subsection ssid="84-null-26" dnum="c-o" numlevel="1" lineno="719" slineno="9-38" level="2"><display>(c)</display>Unless limited tax bonds are initially purchased exclusively by one or more qualified <ln numlevel="1" lineno="720" slineno="9-39"/>institutional buyers as defined in Rule 144A, 17 C.F.R. Sec. 230.144A, or an <ln numlevel="1" lineno="721" slineno="9-40"/>investment grade rating is obtained for the limited tax bonds by one or more <ln numlevel="1" lineno="722" slineno="9-41"/>nationally recognized rating agencies, the public infrastructure district may only issue <ln numlevel="1" lineno="723" slineno="9-42"/>limited tax bonds in denominations of not less than $500,000, and in integral <ln numlevel="1" lineno="724" slineno="9-43"/>multiples above $500,000 of not less than $1,000 each.</subsection><subsection ssid="84-null-27" dnum="d-o" numlevel="1" lineno="725" slineno="9-44" level="2" space="false"><display>(d)</display><subsection ssid="84-null-28" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Without any further election or consent of property owners or registered voters, <ln numlevel="1" lineno="726" slineno="9-45"/>a public infrastructure district may convert a limited tax bond described in <ln numlevel="1" lineno="727" slineno="9-46"/>Subsection <xref depth="4" refnumber="17D-4-301(3)(a)" start="0">(3)(a)</xref> to a general obligation bond if the principal amount of the <ln numlevel="1" lineno="728" slineno="9-47"/>related limited tax bond together with the principal amount of other related <ln numlevel="1" lineno="729" slineno="9-48"/>outstanding general obligation bonds of the public infrastructure district does not <ln numlevel="1" lineno="730" slineno="9-49"/>exceed 15% of the fair market value of taxable property in the public <ln numlevel="1" lineno="731" slineno="9-50"/>infrastructure district securing the general obligation bonds, determined by:<subsection ssid="84-null-29" dnum="A-o" numlevel="1" lineno="732" slineno="9-51" level="4" tab="1"><display>(A)</display>an appraisal from an appraiser who is a member of the Appraisal Institute that <ln numlevel="1" lineno="733" slineno="9-52"/>is addressed to the public infrastructure district or a financial institution; or</subsection><subsection ssid="84-null-30" dnum="B-o" numlevel="1" lineno="734" slineno="9-53" level="4" tab="1"><display>(B)</display>the most recent market value of the property from the assessor of the county in <ln numlevel="1" lineno="735" slineno="9-54"/>which the property is located.</subsection></subsection><subsection ssid="84-null-31" dnum="ii-o" numlevel="1" lineno="736" slineno="9-55" level="3"><display>(ii)</display>The consent to the issuance of a limited tax bond described in Subsection <xref depth="4" refnumber="17D-4-301(3)(a)" start="0">(3)(a)</xref> is <ln numlevel="1" lineno="737" slineno="9-56"/>sufficient to meet any statutory or constitutional election requirement necessary <ln numlevel="1" lineno="738" slineno="9-57"/>for the issuance of the limited tax bond and any general obligation bond to be <ln numlevel="1" lineno="739" slineno="9-58"/>issued in place of the limited tax bond upon meeting the requirements of this <ln numlevel="1" lineno="740" slineno="9-59"/>Subsection <xref depth="4" refnumber="17D-4-301(3)(d)" start="0">(3)(d)</xref>.</subsection></subsection><subsection ssid="84-null-32" dnum="e-o" numlevel="1" lineno="741" slineno="9-60" level="2"><display>(e)</display>A public infrastructure district that levies a property tax for payment of debt service <ln numlevel="1" lineno="742" slineno="9-61"/>on a limited tax bond issued under this section is not required to comply with the <ln numlevel="1" lineno="743" slineno="9-62"/>notice and hearing requirements of Section <xref depth="3" refnumber="59-2-919" start="0">59-2-919</xref> unless the rate exceeds the rate <ln numlevel="1" lineno="744" slineno="9-63"/>established in:<subsection ssid="84-null-33" dnum="i-o" numlevel="1" lineno="745" slineno="9-64" level="3"><display>(i)</display>Section <xref depth="3" refnumber="17D-4-303" start="0">17D-4-303</xref>, except as provided in Subsection (13);</subsection><subsection ssid="84-null-34" dnum="ii-o" numlevel="1" lineno="746" slineno="9-65" level="3"><display>(ii)</display>the governing document; or</subsection><subsection ssid="84-null-35" dnum="iii-o" numlevel="1" lineno="747" slineno="9-66" level="3"><display>(iii)</display>the documents relating to the issuance of the limited tax bond.</subsection></subsection></subsection><subsection ssid="84-null-36" dnum="4-o" numlevel="1" lineno="748" slineno="9-67" level="1" space="false"><display>(4)</display><subsection ssid="84-null-37" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For a public infrastructure district seeking the consent described in Subsection <xref tempid="440" depth="4" refnumber="17D-4-301(3)(a)(i)"><ln numlevel="1" lineno="749" slineno="9-68"/>(3)(a)(i)</xref>(B), a public infrastructure district may:<subsection ssid="84-null-38" dnum="i-o" numlevel="1" lineno="750" slineno="9-69" level="3" tab="1"><display>(i)</display>post a class A notice under Section <xref depth="3" refnumber="63G-30-102">63G-30-102</xref> for at least 30 days; and</subsection><subsection ssid="84-null-39" dnum="ii-o" numlevel="1" lineno="751" slineno="9-70" level="3" tab="1"><display>(ii)</display>mail a request for consent to each registered voter within the boundaries of the <ln numlevel="1" lineno="752" slineno="9-71"/>public infrastructure district according to voter registration records.</subsection></subsection><subsection ssid="84-null-40" dnum="b-o" numlevel="1" lineno="753" slineno="9-72" level="2"><display>(b)</display>The request for consent described in Subsection <xref tempid="794" depth="4" refnumber="17D-4-301(4)(a)(ii)">(4)(a)(ii)</xref> shall include:<subsection ssid="84-null-41" dnum="i-o" numlevel="1" lineno="754" slineno="9-73" level="3"><display>(i)</display>the purpose for the issuance of the bonds;</subsection><subsection ssid="84-null-42" dnum="ii-o" numlevel="1" lineno="755" slineno="9-74" level="3"><display>(ii)</display>the maximum principal amount of the bonds to be issued;</subsection><subsection ssid="84-null-43" dnum="iii-o" numlevel="1" lineno="756" slineno="9-75" level="3"><display>(iii)</display>the maximum tax rate proposed to be pledged for the repayment of the bonds;</subsection><subsection ssid="84-null-44" dnum="iv-o" numlevel="1" lineno="757" slineno="9-76" level="3"><display>(iv)</display>the words "For the issuance of bonds" and "Against the issuance of bonds," with <ln numlevel="1" lineno="758" slineno="9-77"/>appropriate boxes in which the voter may indicate the voter's choice; and</subsection><subsection ssid="84-null-45" dnum="v-o" numlevel="1" lineno="759" slineno="9-78" level="3"><display>(v)</display>a return address and phone number where additional information may be obtained <ln numlevel="1" lineno="760" slineno="9-79"/>from the public infrastructure district.</subsection></subsection><subsection ssid="84-null-46" dnum="c-o" numlevel="1" lineno="761" slineno="9-80" level="2"><display>(c)</display>Any registered voter who does not return the request for consent within 30 days of <ln numlevel="1" lineno="762" slineno="9-81"/>the day they are mailed to the voter is considered:<subsection ssid="84-null-47" dnum="i-o" numlevel="1" lineno="763" slineno="9-82" level="3"><display>(i)</display>non-participatory in the request for consent; and</subsection><subsection ssid="84-null-48" dnum="ii-o" numlevel="1" lineno="764" slineno="9-83" level="3"><display>(ii)</display>shall not be included in a calculation to determine the percentage of registered <ln numlevel="1" lineno="765" slineno="9-84"/>voters who consent to the issuance of bonds.</subsection></subsection><subsection ssid="84-null-49" dnum="d-o" numlevel="1" lineno="766" slineno="9-85" level="2"><display>(d)</display>If a majority of the registered voters who return the request for consent under this <ln numlevel="1" lineno="767" slineno="9-86"/>Subsection <xref refnumber="17D-4-301(4)" depth="4">(4)</xref> indicate "For the issuance of bonds," or if no registered voters return <ln numlevel="1" lineno="768" slineno="9-87"/>the request for consent within the time frame described in Subsection <xref refnumber="17D-4-301(4)(c)" depth="4">(4)(c)</xref>, the <ln numlevel="1" lineno="769" slineno="9-88"/>requirement described in Subsection (3)(a)(i)(B) is met.</subsection><subsection ssid="84-null-50" dnum="e-o" numlevel="1" lineno="770" slineno="9-89" level="2"><display>(e)</display>Nothing in this Subsection <xref refnumber="17D-4-301(4)" depth="4">(4)</xref>:<subsection ssid="84-null-51" dnum="i-o" numlevel="1" lineno="771" slineno="9-90" level="3"><display>(i)</display>prevents a public infrastructure district from obtaining the consent of registered <ln numlevel="1" lineno="772" slineno="9-91"/>voters for the issuance of a bond through another method; or</subsection><subsection ssid="84-null-52" dnum="ii-o" numlevel="1" lineno="773" slineno="9-92" level="3"><display>(ii)</display>shall be interpreted to affect or otherwise interfere with any consents of registered <ln numlevel="1" lineno="774" slineno="9-93"/>voters obtained before the effective date of this bill.</subsection></subsection></subsection><subsection ssid="84-null-53" dnum="5-o" numlevel="1" lineno="775" slineno="9-94" level="1"><display>(5)</display>Nothing in this section shall be interpreted to:<subsection ssid="84-null-54" dnum="a-o" numlevel="1" lineno="776" slineno="9-95" level="2"><display>(a)</display>prevent a public infrastructure district from withdrawing property from the public <ln numlevel="1" lineno="777" slineno="9-96"/>infrastructure district's boundaries where the property owners or registered voters <ln numlevel="1" lineno="778" slineno="9-97"/>associated with that property do not consent to the issuance of bonds or vote against <ln numlevel="1" lineno="779" slineno="9-98"/>the issuance of bonds; or</subsection><subsection ssid="84-null-55" dnum="b-o" numlevel="1" lineno="780" slineno="9-99" level="2"><display>(b)</display>require a public infrastructure district to withdraw property from the public <ln numlevel="1" lineno="781" slineno="9-100"/>infrastructure district's boundaries where the property owners or registered voters <ln numlevel="1" lineno="782" slineno="9-101"/>associated with that property do not consent to the issuance of bonds or vote against <ln numlevel="1" lineno="783" slineno="9-102"/>the issuance of bonds.</subsection></subsection><subsection ssid="84-null-56" dnum="6-o" numlevel="1" lineno="784" slineno="9-103" level="1" space="false"><display>(6)</display><subsection ssid="84-null-57" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Beginning on the effective date of this bill, once consent or approval is obtained <ln numlevel="1" lineno="785" slineno="9-104"/>under Subsection <xref refnumber="17D-4-301(3)(a)" depth="4">(3)(a)</xref>, the consent or approval is valid for a period of 10 years from <ln numlevel="1" lineno="786" slineno="9-105"/>the day on which the board:<subsection ssid="84-null-58" dnum="i-o" numlevel="1" lineno="787" slineno="9-106" level="3" tab="1"><display>(i)</display>adopts a resolution or ordinance finding that the consent or approval is obtained; <ln numlevel="1" lineno="788" slineno="9-107"/>and</subsection><subsection ssid="84-null-59" dnum="ii-o" numlevel="1" lineno="789" slineno="9-108" level="3" tab="1"><display>(ii)</display>publishes a notice of the resolution or ordinance described in Subsection <xref refnumber="17D-4-301(6)(a)" depth="4">(6)(a)</xref>(i) <ln numlevel="1" lineno="790" slineno="9-109"/>as a class A notice under Section <xref depth="3" refnumber="63G-30-102">63G-30-102</xref> for at least 30 days.</subsection></subsection><subsection ssid="84-null-60" dnum="b-o" numlevel="1" lineno="791" slineno="9-110" level="2"><display>(b)</display>The tolling provisions of Section <xref depth="3" refnumber="11-14-301">11-14-301</xref> apply during the 10-year period <ln numlevel="1" lineno="792" slineno="9-111"/>described in Subsection <xref refnumber="17D-4-301(6)(a)" depth="4">(6)(a)</xref>.</subsection><subsection ssid="84-null-61" dnum="c-o" numlevel="1" lineno="793" slineno="9-112" level="2"><display>(c)</display>After a public infrastructure district obtains consent or approval under Subsection <xref refnumber="17D-4-301(3)(a)" depth="4"><ln numlevel="1" lineno="794" slineno="9-113"/>(3)(a)</xref>, the public infrastructure district does not require any additional consent to or <ln numlevel="1" lineno="795" slineno="9-114"/>approval of the issuance of bonds, and the subsequent annexation of property to, or <ln numlevel="1" lineno="796" slineno="9-115"/>withdrawal of property from, the public infrastructure district does not impact:<subsection ssid="84-null-62" dnum="i-o" numlevel="1" lineno="797" slineno="9-116" level="3"><display>(i)</display>the validity of already obtained consent or approval;</subsection><subsection ssid="84-null-63" dnum="ii-o" numlevel="1" lineno="798" slineno="9-117" level="3"><display>(ii)</display>the 10-year period described in Subsection <xref refnumber="17D-4-301(6)(a)" depth="4">(6)(a)</xref>; or</subsection><subsection ssid="84-null-64" dnum="iii-o" numlevel="1" lineno="799" slineno="9-118" level="3"><display>(iii)</display>any bond issued, or to be issued, pursuant to the consent or approval that was <ln numlevel="1" lineno="800" slineno="9-119"/>obtained under Subsection <xref refnumber="17D-4-301(3)(a)" depth="4">(3)(a)</xref>.</subsection></subsection><subsection ssid="84-null-65" dnum="d-o" numlevel="1" lineno="801" slineno="9-120" level="2"><display>(d)</display>Subsection <xref refnumber="17D-4-301(6)(a)" depth="4">(6)(a)</xref> does not invalidate or alter any consent or approval, or finding of <ln numlevel="1" lineno="802" slineno="9-121"/>consent or approval, that occurred before the effective date of this bill.</subsection></subsection><subsection ssid="84-null-66" dnum="7-o" numlevel="1" lineno="803" slineno="9-122" level="1" space="false"><display>(7)</display><subsection ssid="84-null-67" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref refnumber="17D-4-301(7)(b)" depth="4">(7)(b)</xref>, there is no limitation on the duration of <ln numlevel="1" lineno="804" slineno="9-123"/>revenues that a public infrastructure district may receive to cover any shortfall in the <ln numlevel="1" lineno="805" slineno="9-124"/>payment of principal of and interest on a bond that the public infrastructure district <ln numlevel="1" lineno="806" slineno="9-125"/>issues.</subsection><subsection ssid="84-null-68" dnum="b-o" numlevel="1" lineno="807" slineno="9-126" level="2"><display>(b)</display>A public infrastructure governing document or bond documents may limit the <ln numlevel="1" lineno="808" slineno="9-127"/>duration of time described in Subsection <xref refnumber="17D-4-301(7)" depth="4">(7)</xref>(a).</subsection></subsection><subsection ssid="84-null-69" dnum="8-o" numlevel="1" lineno="809" slineno="9-128" level="1"><display>(8)</display>Section <xref depth="3" refnumber="11-42-106">11-42-106</xref> governs any action to challenge an assessment imposed by a public <ln numlevel="1" lineno="810" slineno="9-129"/>infrastructure district or any proceeding to designate an assessment area conducted by a <ln numlevel="1" lineno="811" slineno="9-130"/>public infrastructure district.</subsection><subsection ssid="84-null-70" dnum="9-o" numlevel="1" lineno="812" slineno="9-131" level="1"><display>(9)</display>A public infrastructure district is not a municipal corporation for purposes of the debt <ln numlevel="1" lineno="813" slineno="9-132"/>limitation of <ext_ref type="Utah Constitution">Utah Constitution, Article XIV, Section 4.</ext_ref></subsection><subsection ssid="84-null-71" dnum="10-o" numlevel="1" lineno="814" slineno="9-133" level="1"><display>(10)</display>Notwithstanding any other provision, the board may directly or by resolution delegate <ln numlevel="1" lineno="815" slineno="9-134"/>to one or more officers of the public infrastructure district the authority to:<subsection ssid="84-null-72" dnum="a-o" numlevel="1" lineno="816" slineno="9-135" level="2"><display>(a)</display>in accordance and within the parameters set forth in a resolution adopted in <ln numlevel="1" lineno="817" slineno="9-136"/>accordance with Section <xref depth="3" refnumber="11-14-302" start="0">11-14-302</xref>, approve the final interest rate, price, principal <ln numlevel="1" lineno="818" slineno="9-137"/>amount, maturity, redemption features, and other terms of the bond;</subsection><subsection ssid="84-null-73" dnum="b-o" numlevel="1" lineno="819" slineno="9-138" level="2"><display>(b)</display>approve and execute any document or contract relating to the issuance of a bond; and</subsection><subsection ssid="84-null-74" dnum="c-o" numlevel="1" lineno="820" slineno="9-139" level="2"><display>(c)</display>approve any contract related to the acquisition and construction of the improvements, <ln numlevel="1" lineno="821" slineno="9-140"/>facilities, or property to be financed with a bond.</subsection></subsection><subsection ssid="84-null-75" dnum="11-o" numlevel="1" lineno="822" slineno="9-141" level="1" space="false"><display>(11)</display><subsection ssid="84-null-76" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref tempid="962" depth="4" refnumber="17D-4-301(11)(b)">(11)(b)</xref>, before a public infrastructure district may issue a <ln numlevel="1" lineno="823" slineno="9-142"/>limited tax bond or assessment bond, the public infrastructure district shall engage a <ln numlevel="1" lineno="824" slineno="9-143"/>municipal advisor who, in connection with the issuance of bonds, shall deliver a <ln numlevel="1" lineno="825" slineno="9-144"/>certificate stating that:<subsection ssid="84-null-77" dnum="i-o" numlevel="1" lineno="826" slineno="9-145" level="3" tab="1"><display>(i)</display>the municipal advisor qualifies to serve as a municipal advisor, as defined in <ln numlevel="1" lineno="827" slineno="9-146"/>Section <xref depth="3" refnumber="17D-4-102">17D-4-102</xref>, including the basis for the municipal advisor's qualifications;</subsection><subsection ssid="84-null-78" dnum="ii-o" numlevel="1" lineno="828" slineno="9-147" level="3" tab="1"><display>(ii)</display>the structure of the limited tax bond or assessment bond the public infrastructure <ln numlevel="1" lineno="829" slineno="9-148"/>district is about to issue is a reasonable structure, as of the date of the issuance of <ln numlevel="1" lineno="830" slineno="9-149"/>the limited tax bond or assessment bond, as applicable; and</subsection><subsection ssid="84-null-79" dnum="iii-o" numlevel="1" lineno="831" slineno="9-150" level="3" tab="1"><display>(iii)</display>the interest rate of the limited tax bond or assessment bond the public <ln numlevel="1" lineno="832" slineno="9-151"/>infrastructure district is about to offer is a reasonable market rate, as of the date of <ln numlevel="1" lineno="833" slineno="9-152"/>the issuance of the limited tax bond or assessment bond, as applicable.</subsection></subsection><subsection ssid="84-null-80" dnum="b-o" numlevel="1" lineno="834" slineno="9-153" level="2"><display>(b)</display>The provisions of this Subsection <xref refnumber="17D-4-301(11)" depth="4">(11)</xref> do not apply to a public infrastructure district <ln numlevel="1" lineno="835" slineno="9-154"/>created by a development authority.</subsection></subsection><subsection ssid="84-null-81" dnum="12-o" numlevel="1" lineno="836" slineno="9-155" level="1" space="false"><display>(12)</display><subsection ssid="84-null-82" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Any person may contest the legality of the issuance of a public infrastructure <ln numlevel="1" lineno="837" slineno="9-156"/>district bond or any provisions for the security and payment of the bond for a period <ln numlevel="1" lineno="838" slineno="9-157"/>of 30 days after:<subsection ssid="84-null-83" dnum="i-o" numlevel="1" lineno="839" slineno="9-158" level="3" tab="1"><display>(i)</display>posting the resolution authorizing the bond as a class A notice under Section <xref depth="3" refnumber="63G-30-102"><ln numlevel="1" lineno="840" slineno="9-159"/>63G-30-102</xref>; or</subsection><subsection ssid="84-null-84" dnum="ii-o" numlevel="1" lineno="841" slineno="9-160" level="3" tab="1"><display>(ii)</display>posting a notice of bond containing substantially the items required under <ln numlevel="1" lineno="842" slineno="9-161"/>Subsection <xref depth="4" refnumber="11-14-316(2)" start="0">11-14-316(2)</xref> as a class A notice under Section <xref depth="3" refnumber="63G-30-102">63G-30-102</xref>.</subsection></subsection><subsection ssid="84-null-85" dnum="b-o" numlevel="1" lineno="843" slineno="9-162" level="2"><display>(b)</display>After the 30-day period described in Subsection (12)(a), no person may bring a <ln numlevel="1" lineno="844" slineno="9-163"/>lawsuit or other proceeding contesting the regularity, formality, or legality of the <ln numlevel="1" lineno="845" slineno="9-164"/>bond for any reason.</subsection></subsection><subsection ssid="84-null-86" dnum="13-o" numlevel="1" lineno="846" slineno="9-165" level="1" space="false"><display>(13)</display><subsection ssid="84-null-87" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In the event of any statutory change in the methodology of assessment or <ln numlevel="1" lineno="847" slineno="9-166"/>collection of property taxes in a manner that reduces the amounts which are devoted <ln numlevel="1" lineno="848" slineno="9-167"/>or pledged to the repayment of limited tax bonds, a public infrastructure district may <ln numlevel="1" lineno="849" slineno="9-168"/>charge a rate sufficient to receive the amount of property taxes or assessment the <ln numlevel="1" lineno="850" slineno="9-169"/>public infrastructure district would have received before the statutory change in order <ln numlevel="1" lineno="851" slineno="9-170"/>to pay the debt service on outstanding limited tax bonds.</subsection><subsection ssid="84-null-88" dnum="b-o" numlevel="1" lineno="852" slineno="9-171" level="2"><display>(b)</display>The rate increase described in Subsection (13)(a) may exceed the limit described in <ln numlevel="1" lineno="853" slineno="9-172"/>Section <xref depth="3" refnumber="17D-4-303" start="0">17D-4-303</xref>.</subsection><subsection ssid="84-null-89" dnum="c-o" numlevel="1" lineno="854" slineno="9-173" level="2"><display>(c)</display>The public infrastructure district may charge the rate increase described in <ln numlevel="1" lineno="855" slineno="9-174"/>Subsection (13)(a) until the bonds, including any associated refunding bonds, or other <ln numlevel="1" lineno="856" slineno="9-175"/>securities, together with applicable interest, are fully met and discharged.</subsection></subsection><subsection ssid="84-null-90" dnum="14-o" numlevel="1" lineno="857" slineno="9-176" level="1"><display>(14)</display>No later than 60 days after the closing of any bonds by a public infrastructure district <ln numlevel="1" lineno="858" slineno="9-177"/>created by a bonding political subdivision, as defined in Section <xref depth="3" refnumber="63C-25-101" start="0">63C-25-101</xref>, the public <ln numlevel="1" lineno="859" slineno="9-178"/>infrastructure district shall report the bond issuance, including the amount of the bonds, <ln numlevel="1" lineno="860" slineno="9-179"/>terms, interest rate, and security, to:<subsection ssid="84-null-91" dnum="a-o" numlevel="1" lineno="861" slineno="9-180" level="2"><display>(a)</display>the Executive Appropriations Committee; and</subsection><subsection ssid="84-null-92" dnum="b-o" numlevel="1" lineno="862" slineno="9-181" level="2"><display>(b)</display>the State Finance Review Commission created in Section <xref depth="3" refnumber="63C-25-201" start="0">63C-25-201</xref>.</subsection></subsection></section></bsec><bsec buid="54" num="17D-4-303" type="amend" src="code" uid="C17D-4-S303_2026050620260506" sort="17D04 03030020260506" numlevel="1" lineno="863" slineno="10-1" sn="10"><section number="17D-4-303" numlevel="1" lineno="864" slineno="10-2" type="amend"><secline lineno="863">Section 10. Section <bold>17D-4-303</bold> is amended to read:</secline><catline lineno="864"><bold>17D-4-303<parens/>. Limits on public infrastructure district property tax levy -- Notice <ln numlevel="1" lineno="865" slineno="10-3"/>requirements.</bold></catline><subsection ssid="54-null-1" dnum="1-o" numlevel="1" lineno="866" slineno="10-4" level="1" placement="noreturn"><display>(1)</display>The property tax levy of a public infrastructure district, for all purposes, including <ln numlevel="1" lineno="867" slineno="10-5"/>payment of debt service on limited tax bonds, may not exceed .015 per dollar of taxable <ln numlevel="1" lineno="868" slineno="10-6"/>value of taxable property in the district.</subsection><subsection ssid="54-null-2" dnum="2-o" numlevel="1" lineno="869" slineno="10-7" level="1"><display>(2)</display>The limitation described in Subsection <xref depth="4" refnumber="17D-4-303(1)" start="0">(1)</xref> does not apply to the levy by the public <ln numlevel="1" lineno="870" slineno="10-8"/>infrastructure district to pay principal of and interest on a general obligation bond that <ln numlevel="1" lineno="871" slineno="10-9"/>the public infrastructure district issues.</subsection><subsection ssid="54-null-3" dnum="3-o" numlevel="1" lineno="872" slineno="10-10" level="1" space="false"><display>(3)</display><subsection ssid="54-null-4" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Within 30 days after the day on which the lieutenant governor issues a certificate <ln numlevel="1" lineno="873" slineno="10-11"/>of incorporation for the public infrastructure district under Section <xref depth="3" refnumber="67-1a-6.5" start="0">67-1a-6.5</xref>, the <ln numlevel="1" lineno="874" slineno="10-12"/>board shall record a notice with the recorder of the county in which property within <ln numlevel="1" lineno="875" slineno="10-13"/>the public infrastructure district is located.</subsection><subsection ssid="54-null-5" dnum="b-o" numlevel="1" lineno="876" slineno="10-14" level="2"><display>(b)</display>The notice described in Subsection <xref depth="4" refnumber="17D-4-303(3)(a)" start="0">(3)(a)</xref> shall:<subsection ssid="54-null-6" dnum="i-o" numlevel="1" lineno="877" slineno="10-15" level="3"><display>(i)</display>contain a description of the boundaries of the public infrastructure district;</subsection><subsection ssid="54-null-7" dnum="ii-o" numlevel="1" lineno="878" slineno="10-16" level="3"><display>(ii)</display>state that a copy of the governing document is on file at the office of the creating <ln numlevel="1" lineno="879" slineno="10-17"/>entity;</subsection><subsection ssid="54-18" dnum="_-o:iii-i" numlevel="1" lineno="880" slineno="10-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1426" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">state the purpose of the public infrastructure district and the benefit the public <ln numlevel="1" lineno="881" slineno="10-19"/>infrastructure district provides to property included in the public infrastructure <ln numlevel="1" lineno="882" slineno="10-20"/>district;</amend></subsection><subsection ssid="54-19" dnum="_-o:iv-i" numlevel="1" lineno="883" slineno="10-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1427" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">provide a summary of the public infrastructure and improvements the public <ln numlevel="1" lineno="884" slineno="10-22"/>infrastructure district intends to build;</amend></subsection><subsection ssid="54-null-8" dnum="iii-o:v-i" numlevel="1" lineno="885" slineno="10-23" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1428" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1429" style="1" owner="i" level="1" amendtag="both" space="true">(v)</amend></display>state that the public infrastructure district may finance and repay <ln numlevel="1" lineno="886" slineno="10-24"/>infrastructure and other improvements through the levy of a property tax<amend anum="0" ea="amend" pairid="19" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both"> on the <ln numlevel="1" lineno="887" slineno="10-25"/>property described in Subsection <xref depth="4" refnumber="17D-4-303(3)(b)(i)">(3)(b)(i)</xref></amend>;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="54-null-9" dnum="iv-o:vi-i" numlevel="1" lineno="888" slineno="10-26" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1429" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1430" style="1" owner="i" level="1" amendtag="both" space="true">(vi)</amend></display>state the maximum rate that the public infrastructure district may levy<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="54-15" dnum="_-o:vii-i" numlevel="1" lineno="889" slineno="10-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1430" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">state any applicable limitation on the principal amount of indebtedness for the <ln numlevel="1" lineno="890" slineno="10-28"/>public infrastructure district;</amend></subsection><subsection ssid="54-16" dnum="_-o:viii-i" numlevel="1" lineno="891" slineno="10-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1431" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">state that the burden of the public infrastructure district is intended to run with <ln numlevel="1" lineno="892" slineno="10-30"/>the land and to bind successors in interest and assigns; and</amend></subsection><subsection ssid="54-21" dnum="_-o:ix-i" numlevel="1" lineno="893" slineno="10-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1432" style="1" owner="i" level="1" amendtag="start">(ix)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">provide a name and contact information for a person who potential purchasers of <ln numlevel="1" lineno="894" slineno="10-32"/>property in the public infrastructure district may contact to receive information to <ln numlevel="1" lineno="895" slineno="10-33"/>determine the actual assessment against a property within the public infrastructure <ln numlevel="1" lineno="896" slineno="10-34"/>district.</amend></subsection></subsection><subsection ssid="54-22" dnum="_-o:c-i" numlevel="1" lineno="897" slineno="10-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1433" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">The notice described in Subsection (3)(a) may be recorded as a single instrument that <ln numlevel="1" lineno="898" slineno="10-36"/>covers more than one parcel if the notice includes, in the body of the notice or an <ln numlevel="1" lineno="899" slineno="10-37"/>attached exhibit, the parcel number and legal description of each parcel covered by <ln numlevel="1" lineno="900" slineno="10-38"/>the notice.</amend></subsection><subsection ssid="54-null-10" dnum="c-o:d-i" numlevel="1" lineno="901" slineno="10-39" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1434" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1435" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>The effective date of the public infrastructure district for purposes of assessing <ln numlevel="1" lineno="902" slineno="10-40"/>property tax is the day on which the notice is recorded in the office of the recorder of <ln numlevel="1" lineno="903" slineno="10-41"/>each county in which the public infrastructure district is located, as described in <ln numlevel="1" lineno="904" slineno="10-42"/>Section <xref depth="3" refnumber="59-2-305.5">59-2-305.5</xref>.</subsection></subsection><subsection ssid="54-null-11" dnum="4-o" numlevel="1" lineno="905" slineno="10-43" level="1"><display>(4)</display>If the board fails to record a notice as described in Subsection <xref refnumber="17D-4-303(3)" depth="4">(3)</xref>:<subsection ssid="54-null-12" dnum="a-o" numlevel="1" lineno="906" slineno="10-44" level="2"><display>(a)</display>the public infrastructure district is still created as of the day the lieutenant governor <ln numlevel="1" lineno="907" slineno="10-45"/>issues a certificate of incorporation for the public infrastructure district;</subsection><subsection ssid="54-null-13" dnum="b-o" numlevel="1" lineno="908" slineno="10-46" level="2"><display>(b)</display>any bonds issued by the public infrastructure district are still valid; and</subsection><subsection ssid="54-null-14" dnum="c-o" numlevel="1" lineno="909" slineno="10-47" level="2"><display>(c)</display>the public infrastructure district may not levy a tax or levy or collect a fee until the <ln numlevel="1" lineno="910" slineno="10-48"/>board records the notice described in Subsection <xref refnumber="17D-4-303(3)" depth="4">(3)</xref>.</subsection></subsection></section></bsec><bsec buid="101" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="911" slineno="11-1" sn="11"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="911">Section 11.  <bold>Effective
