Section <bold>67-1-2</bold> is amended to read:</secline><catline lineno="39"><bold>67-1-2<parens/>. Senate confirmation of a gubernatorial nominee or a judicial appointee.</bold></catline><subsection ssid="15-null-1" dnum="1-o" numlevel="1" lineno="40" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="15-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="67-1-2(3)" start="0">(3)</xref>, at least 30 days before the day of an <ln numlevel="1" lineno="41" slineno="1-4"/>extraordinary session of the Senate to confirm a gubernatorial nominee, the governor <ln numlevel="1" lineno="42" slineno="1-5"/>shall send to each member of the Senate and to the Office of Legislative Research <ln numlevel="1" lineno="43" slineno="1-6"/>and General Counsel the following information for each nominee:<subsection ssid="15-null-3" dnum="i-o" numlevel="1" lineno="44" slineno="1-7" level="3" tab="1"><display>(i)</display>the nominee's name and biographical information, including a resume and <ln numlevel="1" lineno="45" slineno="1-8"/>curriculum vitae with personal contact information, including home address, email <ln numlevel="1" lineno="46" slineno="1-9"/>address, and telephone number, redacted, except that the governor shall send to <ln numlevel="1" lineno="47" slineno="1-10"/>the Office of Legislative Research and General Counsel the contact information <ln numlevel="1" lineno="48" slineno="1-11"/>for the nominee;</subsection><subsection ssid="15-null-4" dnum="ii-o" numlevel="1" lineno="49" slineno="1-12" level="3" tab="1"><display>(ii)</display>a detailed list, with citations, of the legal requirements for the appointed position;</subsection><subsection ssid="15-null-5" dnum="iii-o" numlevel="1" lineno="50" slineno="1-13" level="3" tab="1"><display>(iii)</display>a detailed list with supporting documents explaining how, and verifying that, the <ln numlevel="1" lineno="51" slineno="1-14"/>nominee meets each statutory and constitutional requirement for the appointed <ln numlevel="1" lineno="52" slineno="1-15"/>position;</subsection><subsection ssid="15-null-6" dnum="iv-o" numlevel="1" lineno="53" slineno="1-16" level="3" tab="1"><display>(iv)</display>a written certification by the governor that the nominee satisfies all requirements <ln numlevel="1" lineno="54" slineno="1-17"/>for the appointment; and</subsection><subsection ssid="15-null-7" dnum="v-o" numlevel="1" lineno="55" slineno="1-18" level="3" tab="1"><display>(v)</display>public comment information collected in accordance with Section <xref depth="3" refnumber="63G-24-204" start="0">63G-24-204</xref>.</subsection></subsection><subsection ssid="15-null-8" dnum="b-o" numlevel="1" lineno="56" slineno="1-19" level="2"><display>(b)</display>This Subsection <xref depth="4" refnumber="67-1-2(1)" start="0">(1)</xref> does not apply to a judicial appointee.</subsection></subsection><subsection ssid="15-null-9" dnum="2-o" numlevel="1" lineno="57" slineno="1-20" level="1" space="false"><display>(2)</display><subsection ssid="15-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A majority of the president of the Senate, the Senate majority leader, and the <ln numlevel="1" lineno="58" slineno="1-21"/>Senate minority leader may waive the 30-day requirement described in Subsection <xref depth="4" refnumber="67-1-2(1)" start="0">(1)</xref> <ln numlevel="1" lineno="59" slineno="1-22"/>for a gubernatorial nominee other than a nominee for the following:<subsection ssid="15-null-11" dnum="i-o" numlevel="1" lineno="60" slineno="1-23" level="3" tab="1"><display>(i)</display>the executive director of a department;</subsection><subsection ssid="15-null-12" dnum="ii-o" numlevel="1" lineno="61" slineno="1-24" level="3" tab="1"><display>(ii)</display>the executive director of the Governor's Office of Economic Opportunity;</subsection><subsection ssid="15-null-13" dnum="iii-o" numlevel="1" lineno="62" slineno="1-25" level="3" tab="1"><display>(iii)</display>the executive director of the Labor Commission;</subsection><subsection ssid="15-null-14" dnum="iv-o" numlevel="1" lineno="63" slineno="1-26" level="3" tab="1"><display>(iv)</display>a member of the State Tax Commission;</subsection><subsection ssid="15-null-15" dnum="v-o" numlevel="1" lineno="64" slineno="1-27" level="3" tab="1"><display>(v)</display>a member of the State Board of Education;</subsection><subsection ssid="15-null-16" dnum="vi-o" numlevel="1" lineno="65" slineno="1-28" level="3" tab="1"><display>(vi)</display>a member of the Utah Board of Higher Education; or</subsection><subsection ssid="15-null-17" dnum="vii-o" numlevel="1" lineno="66" slineno="1-29" level="3" tab="1"><display>(vii)</display>an individual:<subsection ssid="15-null-18" dnum="A-o" numlevel="1" lineno="67" slineno="1-30" level="4"><display>(A)</display>whose appointment requires the advice and consent of the Senate; and</subsection><subsection ssid="15-null-19" dnum="B-o" numlevel="1" lineno="68" slineno="1-31" level="4"><display>(B)</display>whom the governor designates as a member of the governor's cabinet.</subsection></subsection></subsection><subsection ssid="15-null-20" dnum="b-o" numlevel="1" lineno="69" slineno="1-32" level="2"><display>(b)</display>The Senate shall hold a confirmation hearing for a nominee for an individual <ln numlevel="1" lineno="70" slineno="1-33"/>described in Subsection <xref depth="4" refnumber="67-1-2(2)(a)" start="0">(2)(a)</xref>.</subsection></subsection><subsection ssid="15-null-21" dnum="3-o" numlevel="1" lineno="71" slineno="1-34" level="1"><display>(3)</display>The governor shall:<subsection ssid="15-null-22" dnum="a-o" numlevel="1" lineno="72" slineno="1-35" level="2"><display>(a)</display>if the governor is aware of an upcoming vacancy in a position that requires Senate <ln numlevel="1" lineno="73" slineno="1-36"/>confirmation, provide notice of the upcoming vacancy to the president of the Senate, <ln numlevel="1" lineno="74" slineno="1-37"/>the Senate minority leader, and the Office of Legislative Research and General <ln numlevel="1" lineno="75" slineno="1-38"/>Counsel at least 30 days before the day on which the vacancy occurs; and</subsection><subsection ssid="15-null-23" dnum="b-o" numlevel="1" lineno="76" slineno="1-39" level="2"><display>(b)</display>establish a process for government entities and other relevant organizations to <ln numlevel="1" lineno="77" slineno="1-40"/>provide input on gubernatorial appointments.</subsection></subsection><subsection ssid="15-null-24" dnum="4-o" numlevel="1" lineno="78" slineno="1-41" level="1"><display>(4)</display>When the governor makes a judicial appointment, the governor shall immediately <ln numlevel="1" lineno="79" slineno="1-42"/>provide to the president of the Senate and the Office of Legislative Research and <ln numlevel="1" lineno="80" slineno="1-43"/>General Counsel:<subsection ssid="15-null-25" dnum="a-o" numlevel="1" lineno="81" slineno="1-44" level="2"><display>(a)</display>the name of the judicial appointee;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="15-null-26" dnum="b-o:_-i" numlevel="1" lineno="82" slineno="1-45" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1025" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="62" groupid="42" style="2" owner="jchristopherson" level="1" deltag="end">the judicial appointee's:</amend><amendoutend style="2"/><subsection ssid="15-null-27" dnum="i-o:_-i" numlevel="1" lineno="83" slineno="1-46" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1026" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="63" groupid="43" style="2" owner="jchristopherson" level="1" deltag="end">resume;</amend><amendoutend style="2"/></subsection><subsection ssid="15-null-28" dnum="ii-o:_-i" numlevel="1" lineno="84" slineno="1-47" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1027" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="64" groupid="44" style="2" owner="jchristopherson" level="1" deltag="end">complete file of all the application materials the governor received from the <ln numlevel="1" lineno="85" slineno="1-48"/>judicial nominating commission; and</amend><amendoutend style="2"/></subsection><subsection ssid="15-null-29" dnum="iii-o:_-i" numlevel="1" lineno="86" slineno="1-49" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1028" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="65" groupid="45" style="2" owner="jchristopherson" level="1" deltag="end">any other related documents, including any letters received by the governor <ln numlevel="1" lineno="87" slineno="1-50"/>about the appointee, unless the letter specifically directs that the letter may not be <ln numlevel="1" lineno="88" slineno="1-51"/>shared.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="15-41" dnum="_-o:b-i" numlevel="1" lineno="89" slineno="1-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">the judicial appointee's resume;</amend></subsection><subsection ssid="15-42" dnum="_-o:c-i" numlevel="1" lineno="90" slineno="1-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">if the judicial appointee was certified to the governor by a judicial nominating <ln numlevel="1" lineno="91" slineno="1-54"/>commission under Section <xref depth="3" refnumber="78A-10a-203">78A-10a-203</xref>, a complete file of all the application <ln numlevel="1" lineno="92" slineno="1-55"/>materials the governor received from the judicial nominating commission; and</amend></subsection><subsection ssid="15-43" dnum="_-o:d-i" numlevel="1" lineno="93" slineno="1-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">any other related documents, including any letters the governor received about the <ln numlevel="1" lineno="94" slineno="1-57"/>appointee, unless the letter specifically directs that the governor may not share the <ln numlevel="1" lineno="95" slineno="1-58"/>letter.</amend></subsection></subsection><subsection ssid="15-null-30" dnum="5-o" numlevel="1" lineno="96" slineno="1-59" level="1"><display>(5)</display>The governor shall inform the president of the Senate and the Office of Legislative <ln numlevel="1" lineno="97" slineno="1-60"/>Research and General Counsel of the number of letters withheld <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="86" groupid="66" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="85" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in <ln numlevel="1" lineno="98" slineno="1-61"/>accordance with</amend> Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="68" groupid="48" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="67-1-2(4)(b)(iii)" start="0">(4)(b)(iii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="67" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(4)(d)</amend>.</subsection><subsection ssid="15-null-31" dnum="6-o" numlevel="1" lineno="99" slineno="1-62" level="1" space="false"><display>(6)</display><subsection ssid="15-null-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Letters of inquiry submitted by any judge at the request of any judicial nominating <ln numlevel="1" lineno="100" slineno="1-63"/>commission are classified as private in accordance with Section <xref depth="3" refnumber="63G-2-302" start="0">63G-2-302</xref>.</subsection><subsection ssid="15-null-33" dnum="b-o" numlevel="1" lineno="101" slineno="1-64" level="2"><display>(b)</display>All other records received from the governor <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="83" groupid="63" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="82" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in accordance with</amend> this <ln numlevel="1" lineno="102" slineno="1-65"/>Subsection <xref depth="4" refnumber="67-1-2(6)" start="0">(6)</xref> may be classified as private in accordance with Section <xref depth="3" refnumber="63G-2-302" start="0">63G-2-302</xref>.</subsection></subsection><subsection ssid="15-null-34" dnum="7-o" numlevel="1" lineno="103" slineno="1-66" level="1"><display>(7)</display>The Senate shall consent or refuse to give the Senate's consent to a nomination or <ln numlevel="1" lineno="104" slineno="1-67"/>judicial appointment.</subsection></section></bsec><bsec buid="1" num="78A-10a-102" type="amend" src="code" uid="C78A-10a-S102_2027010120270101" sort="78A10a01020020270101" numlevel="1" lineno="105" slineno="2-1" sn="2"><section number="78A-10a-102" numlevel="1" lineno="106" slineno="2-2" type="amend"><secline lineno="105">Section 2. Nomination, appointment, and confirmation of judges.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="107" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>On and after July 1, 2023, judges for courts of record in this state are nominated, <ln numlevel="1" lineno="108" slineno="2-4"/>appointed, and confirmed in accordance with this chapter, Section <xref depth="3" refnumber="67-1-2" start="0">67-1-2</xref>, and <ext_ref type="Utah Constitution">Utah <ln numlevel="1" lineno="109" slineno="2-5"/>Constitution, Article VIII, Section 8.</ext_ref></subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="110" slineno="2-6" level="1"><display>(2)</display>A commission, the governor,<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both"> the chief justice of the Supreme Court,</amend><amendoutend style="2"/> and the Senate <ln numlevel="1" lineno="111" slineno="2-7"/>shall nominate and select judges based solely upon consideration of fitness for office <ln numlevel="1" lineno="112" slineno="2-8"/>without regard to any partisan political consideration.</subsection></section></bsec><bsec buid="3" num="78A-10a-201" type="amend" src="code" uid="C78A-10a-S201_2027010120270101" sort="78A10a02010020270101" numlevel="1" lineno="113" slineno="3-1" sn="3"><section number="78A-10a-201" numlevel="1" lineno="114" slineno="3-2" type="amend"><secline lineno="113">Section 3. Section <bold>78A-10a-201</bold> is amended to read:</secline><catline lineno="114"><bold>78A-10a-201<parens/>. State Commission on Criminal and Juvenile Justice -- Duties -- <ln numlevel="1" lineno="115" slineno="3-3"/>Rulemaking.</bold></catline><sectionText lineno="116"><tab/>The State Commission on Criminal and Juvenile Justice shall:</sectionText><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="117" slineno="3-5" level="1"><display>(1)</display>enact rules establishing procedures for the meetings of a commission in accordance with <xref depth="1" refnumber="63G-3" start="0"><ln numlevel="1" lineno="118" slineno="3-6"/>Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>; and</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="119" slineno="3-7" level="1"><display>(2)</display>ensure that the rules described in Subsection <xref depth="4" refnumber="78A-10a-201(1)" start="0">(1)</xref>:<subsection ssid="3-null-3" dnum="a-o" numlevel="1" lineno="120" slineno="3-8" level="2"><display>(a)</display>comply with the requirements of this chapter;</subsection><subsection ssid="3-null-4" dnum="b-o" numlevel="1" lineno="121" slineno="3-9" level="2"><display>(b)</display>include standards that:<subsection ssid="3-null-5" dnum="i-o" numlevel="1" lineno="122" slineno="3-10" level="3"><display>(i)</display>maintain the confidentiality of applications for a judicial vacancy and related <ln numlevel="1" lineno="123" slineno="3-11"/>documents;</subsection><subsection ssid="3-null-6" dnum="ii-o" numlevel="1" lineno="124" slineno="3-12" level="3"><display>(ii)</display>address destroying the records of the names of applicants, applications, and <ln numlevel="1" lineno="125" slineno="3-13"/>related documents upon the completion of the judicial nomination process; and</subsection><subsection ssid="3-null-7" dnum="iii-o" numlevel="1" lineno="126" slineno="3-14" level="3"><display>(iii)</display>govern a commissioner's disqualification and inability to serve;</subsection></subsection><subsection ssid="3-null-8" dnum="c-o" numlevel="1" lineno="127" slineno="3-15" level="2"><display>(c)</display>allow for public comment concerning the judicial nomination process, qualifications <ln numlevel="1" lineno="128" slineno="3-16"/>for judicial office, and individual applicants;</subsection><subsection ssid="3-null-9" dnum="d-o" numlevel="1" lineno="129" slineno="3-17" level="2"><display>(d)</display>include evaluation criteria for the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">selection</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">nomination</amend> of judicial nominees; and</subsection><subsection ssid="3-null-10" dnum="e-o" numlevel="1" lineno="130" slineno="3-18" level="2"><display>(e)</display>address procedures for:<subsection ssid="3-null-11" dnum="i-o" numlevel="1" lineno="131" slineno="3-19" level="3"><display>(i)</display>taking summary minutes at a commission meeting;</subsection><subsection ssid="3-null-12" dnum="ii-o" numlevel="1" lineno="132" slineno="3-20" level="3"><display>(ii)</display>simultaneously forwarding the names of <amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">judicial </amend>nominees to the governor, the <ln numlevel="1" lineno="133" slineno="3-21"/>president of the Senate, and the Office of Legislative Research and General <ln numlevel="1" lineno="134" slineno="3-22"/>Counsel as described in Subsection <xref depth="4" refnumber="78A-10a-203(5)" start="0">78A-10a-203(5)</xref>; and</subsection><subsection ssid="3-null-13" dnum="iii-o" numlevel="1" lineno="135" slineno="3-23" level="3"><display>(iii)</display>requiring the Administrative Office of the Courts to immediately inform the <ln numlevel="1" lineno="136" slineno="3-24"/>governor when a judge is removed, resigns, or retires.</subsection></subsection></subsection></section></bsec><bsec buid="5" num="78A-10a-202" type="amend" src="code" uid="C78A-10a-S202_2027010120270101" sort="78A10a02020020270101" numlevel="1" lineno="137" slineno="4-1" sn="4"><section number="78A-10a-202" numlevel="1" lineno="138" slineno="4-2" type="amend"><secline lineno="137">Section 4. Section <bold>78A-10a-202</bold> is amended to read:</secline><catline lineno="138"><bold>78A-10a-202<parens/>. Governor request for judicial nominees -- Recruitment period for <ln numlevel="1" lineno="139" slineno="4-3"/>judicial vacancy -- Convening a judicial nominating commission.</bold></catline><subsection ssid="5-null-1" dnum="1-o:_-i" numlevel="1" lineno="140" slineno="4-4" ea="erase" anum="0" owner="jchristopherson" style="2" level="1" placement="noreturn" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1052" style="2" owner="o" level="1" deltag="start">(1)</amend></display><subsection ssid="5-null-2" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amend anum="0" ea="erase" pairid="1053" style="2" owner="o" level="1">(a)</amend></display><amend anum="0" ea="erase" pairid="5" groupid="4" style="2" owner="jchristopherson" level="1" deltag="end">Unless a hiring freeze is implemented in accordance with Section <xref depth="3" refnumber="78A-2-113" start="0">78A-2-113</xref>, <ln numlevel="1" lineno="141" slineno="4-5"/>the governor shall ensure that:</amend><amendoutend style="2"/><subsection ssid="5-null-3" dnum="i-o:_-i" numlevel="1" lineno="142" slineno="4-6" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1054" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="37" groupid="27" style="2" owner="jchristopherson" level="1" deltag="end">except as provided in Subsection <xref depth="4" refnumber="78A-10a-202(1)(a)(ii)" start="0">(1)(a)(ii)</xref>, the recruitment period to fill a judicial <ln numlevel="1" lineno="143" slineno="4-7"/>vacancy begins 235 days before the effective date of the judicial vacancy;</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-4" dnum="ii-o:_-i" numlevel="1" lineno="144" slineno="4-8" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1055" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="42" groupid="29" style="2" owner="jchristopherson" level="1" deltag="end">if sufficient notice of a judicial vacancy is not given to the governor, the <ln numlevel="1" lineno="145" slineno="4-9"/>recruitment period to fill a judicial vacancy begins within 10 days after the day on <ln numlevel="1" lineno="146" slineno="4-10"/>which the governor receives notice;</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-5" dnum="iii-o:_-i" numlevel="1" lineno="147" slineno="4-11" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1056" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="81" groupid="53" style="2" owner="jchristopherson" level="1" deltag="end">except as provided in Subsection <xref depth="4" refnumber="78A-10a-202(1)(b)" start="0">(1)(b)</xref>, the recruitment period is a minimum of <ln numlevel="1" lineno="148" slineno="4-12"/>at least 30 days but no more than 90 days; and</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-6" dnum="iv-o:_-i" numlevel="1" lineno="149" slineno="4-13" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1057" style="2" owner="o" level="1" deltag="start">(iv)</amend></display><amend anum="0" ea="erase" pairid="84" groupid="56" style="2" owner="jchristopherson" level="1" deltag="end">the chair of the commission having authority over the vacancy convenes a <ln numlevel="1" lineno="150" slineno="4-14"/>meeting no more than 10 days after the close of the recruitment period.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="5-null-7" dnum="b-o:_-i" numlevel="1" lineno="151" slineno="4-15" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1058" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="86" groupid="58" style="2" owner="jchristopherson" level="1" deltag="end">If fewer than nine applications are received for a judicial vacancy, the governor may <ln numlevel="1" lineno="152" slineno="4-16"/>extend the recruitment period described in Subsection <xref depth="4" refnumber="78A-10a-202(1)(a)(iii)" start="0">(1)(a)(iii)</xref> up to 30 days.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="5-26" dnum="_-o:1-i" numlevel="1" lineno="153" slineno="4-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section, "recruitment period" means the time period during which a <ln numlevel="1" lineno="154" slineno="4-18"/>commission may accept applications from individuals seeking nomination to fill a <ln numlevel="1" lineno="155" slineno="4-19"/>judicial vacancy.</amend></subsection><subsection ssid="5-28" dnum="_-o:2-i" numlevel="1" lineno="156" slineno="4-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="105" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">The governor may request a commission for the court in which a judicial vacancy <ln numlevel="1" lineno="157" slineno="4-21"/>occurs to provide a list of judicial nominees to assist the governor in filling the vacancy.</amend></subsection><subsection ssid="5-16" dnum="_-o:3-i" numlevel="1" lineno="158" slineno="4-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="5-25" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">If the governor makes a request described in Subsection <xref depth="4" refnumber="78A-10a-202(2)">(2)</xref>, and except as <ln numlevel="1" lineno="159" slineno="4-23"/>otherwise provided in this section:</amend><subsection ssid="5-17" dnum="_-o:i-i" numlevel="1" lineno="160" slineno="4-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">the recruitment period begins:</amend><subsection ssid="5-18" dnum="_-o:A-i" numlevel="1" lineno="161" slineno="4-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">235 days before the effective date of the judicial vacancy; or</amend></subsection><subsection ssid="5-19" dnum="_-o:B-i" numlevel="1" lineno="162" slineno="4-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">if the governor makes a request described in Subsection <xref depth="4" refnumber="78A-10a-202(2)">(2)</xref> fewer than 235 <ln numlevel="1" lineno="163" slineno="4-27"/>days before the effective date of the judicial vacancy, within 10 days after the <ln numlevel="1" lineno="164" slineno="4-28"/>day on which the governor makes the request;</amend></subsection></subsection><subsection ssid="5-20" dnum="_-o:ii-i" numlevel="1" lineno="165" slineno="4-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">the recruitment period is a minimum of 30 days but no more than 90 days; and</amend></subsection><subsection ssid="5-21" dnum="_-o:iii-i" numlevel="1" lineno="166" slineno="4-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">the chair of the commission shall convene a meeting no more than 10 days after <ln numlevel="1" lineno="167" slineno="4-31"/>the day on which the recruitment period closes.</amend></subsection></subsection><subsection ssid="5-22" dnum="_-o:b-i" numlevel="1" lineno="168" slineno="4-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">If fewer than nine applications are received for a judicial vacancy, the governor may <ln numlevel="1" lineno="169" slineno="4-33"/>extend the recruitment period described in Subsection <xref depth="4" refnumber="78A-10a-202(3)(a)(ii)">(3)(a)(ii)</xref> up to 30 days.</amend></subsection></subsection><subsection ssid="5-null-8" dnum="2-o:4-i" numlevel="1" lineno="170" slineno="4-34" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1069" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="96" groupid="68" style="2" owner="jchristopherson" level="1" deltag="both">If </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="92" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">If the governor makes a request described in Subsection <xref depth="4" refnumber="78A-10a-202(2)">(2)</xref> and </amend>there is a hiring <ln numlevel="1" lineno="171" slineno="4-35"/>freeze implemented in accordance with Section <xref depth="3" refnumber="78A-2-113" start="0">78A-2-113</xref>, the time periods described <ln numlevel="1" lineno="172" slineno="4-36"/>in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="97" groupid="69" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78A-10a-202(1)" start="0">(1)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="93" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)</amend> shall begin to run on the day that the hiring freeze ends.</subsection></section></bsec><bsec buid="7" num="78A-10a-203" type="amend" src="code" uid="C78A-10a-S203_2027010120270101" sort="78A10a02030020270101" numlevel="1" lineno="173" slineno="5-1" sn="5"><section number="78A-10a-203" numlevel="1" lineno="174" slineno="5-2" type="amend"><secline lineno="173">Section 5. Section <bold>78A-10a-203</bold> is amended to read:</secline><catline lineno="174"><bold>78A-10a-203<parens/>. Procedures for judicial nomination commission -- Meetings -- <ln numlevel="1" lineno="175" slineno="5-3"/>Certification -- Governor appointment.</bold></catline><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="176" slineno="5-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="7-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">A</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">If the governor makes a request described in Subsection <xref depth="4" refnumber="78A-10a-202(2)">78A-10a-202(2)</xref>, a</amend> <ln numlevel="1" lineno="177" slineno="5-5"/>commission may:<subsection ssid="7-null-3" dnum="i-o" numlevel="1" lineno="178" slineno="5-6" level="3" tab="1"><display>(i)</display>meet as necessary to perform the commission's function; and</subsection><subsection ssid="7-null-4" dnum="ii-o" numlevel="1" lineno="179" slineno="5-7" level="3" tab="1"><display>(ii)</display>investigate the applicants of a judicial vacancy, including seeking input from <ln numlevel="1" lineno="180" slineno="5-8"/>members and employees of the judiciary and the community.</subsection></subsection><subsection ssid="7-null-5" dnum="b-o" numlevel="1" lineno="181" slineno="5-9" level="2"><display>(b)</display>A commission may consult with the Judicial Council regarding the applicants for a <ln numlevel="1" lineno="182" slineno="5-10"/>judicial vacancy.</subsection><subsection ssid="7-null-6" dnum="c-o" numlevel="1" lineno="183" slineno="5-11" level="2"><display>(c)</display>A commission is exempt from the requirements of <xref depth="1" refnumber="52-4" start="0">Title 52, Chapter 4, Open and <ln numlevel="1" lineno="184" slineno="5-12"/>Public Meetings Act</xref>.</subsection></subsection><subsection ssid="7-null-7" dnum="2-o" numlevel="1" lineno="185" slineno="5-13" level="1"><display>(2)</display>In determining which of the applicants are the most qualified, a commission shall <ln numlevel="1" lineno="186" slineno="5-14"/>determine by a majority vote of the commissioners present which of the applicants best <ln numlevel="1" lineno="187" slineno="5-15"/>possess the ability, temperament, training, and experience that qualifies an applicant for <ln numlevel="1" lineno="188" slineno="5-16"/>the office.</subsection><subsection ssid="7-null-8" dnum="3-o" numlevel="1" lineno="189" slineno="5-17" level="1" space="false"><display>(3)</display><subsection ssid="7-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided under Subsection <xref depth="4" refnumber="78A-10a-203(3)(b)" start="0">(3)(b)</xref>:<subsection ssid="7-null-10" dnum="i-o" numlevel="1" lineno="190" slineno="5-18" level="3" tab="1"><display>(i)</display>the appellate court nominating commission shall certify to the governor a list of <ln numlevel="1" lineno="191" slineno="5-19"/>the seven most qualified applicants per judicial vacancy;</subsection><subsection ssid="7-null-11" dnum="ii-o" numlevel="1" lineno="192" slineno="5-20" level="3" tab="1"><display>(ii)</display>a district and juvenile court nominating commission shall certify to the governor a <ln numlevel="1" lineno="193" slineno="5-21"/>list of the five most qualified applicants per judicial vacancy; and</subsection><subsection ssid="7-null-12" dnum="iii-o" numlevel="1" lineno="194" slineno="5-22" level="3" tab="1"><display>(iii)</display>the business and chancery court nominating commission shall certify to the <ln numlevel="1" lineno="195" slineno="5-23"/>governor a list of the seven most qualified applicants per judicial vacancy.</subsection></subsection><subsection ssid="7-null-13" dnum="b-o" numlevel="1" lineno="196" slineno="5-24" level="2"><display>(b)</display>If a commission is considering applicants for more than one judicial vacancy existing <ln numlevel="1" lineno="197" slineno="5-25"/>at the same time and for the same court, the commission shall include one additional <ln numlevel="1" lineno="198" slineno="5-26"/>applicant for each additional judicial vacancy in the court in the list of applicants the <ln numlevel="1" lineno="199" slineno="5-27"/>commission certifies to the governor.</subsection></subsection><subsection ssid="7-null-14" dnum="4-o" numlevel="1" lineno="200" slineno="5-28" level="1"><display>(4)</display>A commission shall certify a list to the governor under Subsection <xref depth="4" refnumber="78A-10a-203(3)" start="0">(3)</xref> no more than 45 <ln numlevel="1" lineno="201" slineno="5-29"/>days after convening in accordance with Section <xref depth="3" refnumber="78A-10a-202" start="0">78A-10a-202</xref>.</subsection><subsection ssid="7-null-15" dnum="5-o" numlevel="1" lineno="202" slineno="5-30" level="1"><display>(5)</display>A commission shall, at the time that the commission certifies a list of the most qualified <ln numlevel="1" lineno="203" slineno="5-31"/>applicants to the governor, submit the same list to the president of the Senate, the Senate <ln numlevel="1" lineno="204" slineno="5-32"/>minority leader, and the Office of Legislative Research and General Counsel.</subsection><subsection ssid="7-null-16" dnum="6-o" numlevel="1" lineno="205" slineno="5-33" level="1"><display>(6)</display>A commission shall ensure that the list of applicants certified to the governor:<subsection ssid="7-null-17" dnum="a-o" numlevel="1" lineno="206" slineno="5-34" level="2"><display>(a)</display>meet the qualifications required by law to fill the office; and</subsection><subsection ssid="7-null-18" dnum="b-o" numlevel="1" lineno="207" slineno="5-35" level="2"><display>(b)</display>are willing to serve.</subsection></subsection><subsection ssid="7-null-19" dnum="7-o" numlevel="1" lineno="208" slineno="5-36" level="1"><display>(7)</display>In determining which of the applicants are the most qualified, a commission may not <ln numlevel="1" lineno="209" slineno="5-37"/>decline to certify an applicant's name to the governor because:<subsection ssid="7-null-20" dnum="a-o" numlevel="1" lineno="210" slineno="5-38" level="2"><display>(a)</display>the commission declined to submit that applicant's name to the governor to fill a <ln numlevel="1" lineno="211" slineno="5-39"/>previous judicial vacancy;</subsection><subsection ssid="7-null-21" dnum="b-o" numlevel="1" lineno="212" slineno="5-40" level="2"><display>(b)</display>a previous commission declined to submit that applicant's name to the governor; or</subsection><subsection ssid="7-null-22" dnum="c-o" numlevel="1" lineno="213" slineno="5-41" level="2"><display>(c)</display>the commission or a previous commission submitted the applicant's name to the <ln numlevel="1" lineno="214" slineno="5-42"/>governor and the governor selected another individual to fill the judicial vacancy.</subsection></subsection><subsection ssid="7-null-23" dnum="8-o" numlevel="1" lineno="215" slineno="5-43" level="1"><display>(8)</display>A commission may not certify:<subsection ssid="7-null-24" dnum="a-o" numlevel="1" lineno="216" slineno="5-44" level="2"><display>(a)</display>an applicant who is a justice or judge that was not retained by the voters for the <ln numlevel="1" lineno="217" slineno="5-45"/>office for which the justice or judge was defeated until after the expiration of that <ln numlevel="1" lineno="218" slineno="5-46"/>justice's or judge's term of office; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">or</amend></subsection><subsection ssid="7-null-25" dnum="b-o" numlevel="1" lineno="219" slineno="5-47" level="2"><display>(b)</display>an applicant who has served on a commission within six months after the day on <ln numlevel="1" lineno="220" slineno="5-48"/>which the commission was last convened.</subsection></subsection><subsection ssid="7-null-26" dnum="9-o:_-i" numlevel="1" lineno="221" slineno="5-49" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1095" style="2" owner="o" level="1" deltag="start">(9)</amend></display><amend anum="0" ea="erase" pairid="44" groupid="32" style="2" owner="jchristopherson" level="1" deltag="end">The governor shall fill a judicial vacancy within 30 days after the day on which the <ln numlevel="1" lineno="222" slineno="5-50"/>governor received the list of nominees from the commission.</amend><amendoutend style="2"/></subsection><subsection ssid="7-null-27" dnum="10-o:_-i" numlevel="1" lineno="223" slineno="5-51" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1096" style="2" owner="o" level="1" deltag="start">(10)</amend></display><amend anum="0" ea="erase" pairid="47" groupid="34" style="2" owner="jchristopherson" level="1" deltag="end">If the governor fails to fill a judicial vacancy within 30 days after the day on which <ln numlevel="1" lineno="224" slineno="5-52"/>the governor received the list of nominees from the commission, the chief justice of the <ln numlevel="1" lineno="225" slineno="5-53"/>Supreme Court shall, within 20 days, appoint an applicant from the list of nominees <ln numlevel="1" lineno="226" slineno="5-54"/>certified to the governor by the commission.</amend><amendoutend style="2"/></subsection><subsection ssid="7-32" dnum="_-o:9-i" numlevel="1" lineno="227" slineno="5-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">A list of applicants certified by a commission:</amend><subsection ssid="7-33" dnum="_-o:a-i" numlevel="1" lineno="228" slineno="5-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">is advisory only; and</amend></subsection><subsection ssid="7-34" dnum="_-o:b-i" numlevel="1" lineno="229" slineno="5-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1099" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">does not limit the governor's authority to appoint to a judicial vacancy any individual <ln numlevel="1" lineno="230" slineno="5-58"/>who meets the qualifications described in Utah Constitution, Article VIII, Section 7.</amend></subsection></subsection></section></bsec><bsec buid="9" num="78A-10a-303" type="amend" src="code" uid="C78A-10a-S303_2027010120270101" sort="78A10a03030020270101" numlevel="1" lineno="231" slineno="6-1" sn="6"><section number="78A-10a-303" numlevel="1" lineno="232" slineno="6-2" type="amend"><secline lineno="231">Section 6. Section <bold>78A-10a-303</bold> is amended to read:</secline><catline lineno="232"><bold>78A-10a-303<parens/>. Membership -- Vacancies -- Removal.</bold></catline><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="233" slineno="6-3" level="1" placement="noreturn"><display>(1)</display>The Appellate Court Nominating Commission shall consist of seven commissioners, <ln numlevel="1" lineno="234" slineno="6-4"/>each appointed by the governor to serve a four-year term.</subsection><subsection ssid="9-null-2" dnum="2-o" numlevel="1" lineno="235" slineno="6-5" level="1"><display>(2)</display>A commissioner shall:<subsection ssid="9-null-3" dnum="a-o" numlevel="1" lineno="236" slineno="6-6" level="2"><display>(a)</display>be a United States citizen;</subsection><subsection ssid="9-null-4" dnum="b-o" numlevel="1" lineno="237" slineno="6-7" level="2"><display>(b)</display>be a resident of Utah; and</subsection><subsection ssid="9-null-5" dnum="c-o" numlevel="1" lineno="238" slineno="6-8" level="2"><display>(c)</display>serve until the commissioner's successor is appointed.</subsection></subsection><subsection ssid="9-null-6" dnum="3-o" numlevel="1" lineno="239" slineno="6-9" level="1"><display>(3)</display>The governor may not appoint:<subsection ssid="9-null-7" dnum="a-o" numlevel="1" lineno="240" slineno="6-10" level="2"><display>(a)</display>a commissioner to serve successive terms; or</subsection><subsection ssid="9-null-8" dnum="b-o" numlevel="1" lineno="241" slineno="6-11" level="2"><display>(b)</display>a member of the Legislature to serve as a commissioner.</subsection></subsection><subsection ssid="9-null-9" dnum="4-o" numlevel="1" lineno="242" slineno="6-12" level="1"><display>(4)</display>In determining whether to appoint an individual to serve as a commissioner, the <ln numlevel="1" lineno="243" slineno="6-13"/>governor shall consider whether the individual's appointment would ensure that the <ln numlevel="1" lineno="244" slineno="6-14"/>commission <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">selects</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">nominates</amend> applicants without any regard to partisan political <ln numlevel="1" lineno="245" slineno="6-15"/>consideration.</subsection><subsection ssid="9-null-10" dnum="5-o" numlevel="1" lineno="246" slineno="6-16" level="1"><display>(5)</display>The governor shall appoint the chair of the commission from among the membership of <ln numlevel="1" lineno="247" slineno="6-17"/>the commission.</subsection><subsection ssid="9-null-11" dnum="6-o" numlevel="1" lineno="248" slineno="6-18" level="1"><display>(6)</display>The governor shall fill any vacancy on the commission caused by the expiration of a <ln numlevel="1" lineno="249" slineno="6-19"/>commissioner's term.</subsection><subsection ssid="9-null-12" dnum="7-o" numlevel="1" lineno="250" slineno="6-20" level="1" space="false"><display>(7)</display><subsection ssid="9-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a commissioner is disqualified, removed, or is otherwise unable to serve, the <ln numlevel="1" lineno="251" slineno="6-21"/>governor shall appoint a replacement commissioner to fill the vacancy for the <ln numlevel="1" lineno="252" slineno="6-22"/>unexpired term.</subsection><subsection ssid="9-null-14" dnum="b-o" numlevel="1" lineno="253" slineno="6-23" level="2"><display>(b)</display>A replacement commissioner appointed under Subsection <xref depth="4" refnumber="78A-10a-303(7)(a)" start="0">(7)(a)</xref> may not be <ln numlevel="1" lineno="254" slineno="6-24"/>reappointed upon expiration of the term of service.</subsection></subsection><subsection ssid="9-null-15" dnum="8-o" numlevel="1" lineno="255" slineno="6-25" level="1"><display>(8)</display>The governor may remove a commissioner from the commission at any time with or <ln numlevel="1" lineno="256" slineno="6-26"/>without cause.</subsection></section></bsec><bsec buid="11" num="78A-10a-403" type="amend" src="code" uid="C78A-10a-S403_2027010120270101" sort="78A10a04030020270101" numlevel="1" lineno="257" slineno="7-1" sn="7"><section number="78A-10a-403" numlevel="1" lineno="258" slineno="7-2" type="amend"><secline lineno="257">Section 7.
