Section <bold>26B-1-506</bold> is amended to read:</secline><catline lineno="24"><bold>26B-1-506<parens/>. Fatality review committee report -- Response to report.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="25" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>Within 20 days after the day on which the committee proceedings described in Section <xref depth="3" refnumber="26B-1-505"><ln numlevel="1" lineno="26" slineno="1-4"/>26B-1-505</xref> end, the committee shall submit:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="27" slineno="1-5" level="2"><display>(a)</display>a written report to the executive director that includes:<subsection ssid="3-null-3" dnum="i-o" numlevel="1" lineno="28" slineno="1-6" level="3"><display>(i)</display>the advisory opinions made under Subsection <xref depth="4" refnumber="26B-1-505(6)">26B-1-505(6)</xref>; and</subsection><subsection ssid="3-null-4" dnum="ii-o" numlevel="1" lineno="29" slineno="1-7" level="3"><display>(ii)</display>any recommendations regarding action that should be taken in relation to an <ln numlevel="1" lineno="30" slineno="1-8"/>employee of the department or a person who contracts with the department; and</subsection></subsection><subsection ssid="3-null-5" dnum="b-o" numlevel="1" lineno="31" slineno="1-9" level="2"><display>(b)</display>a copy of the report described in Subsection <xref depth="4" refnumber="26B-1-506(1)(a)">(1)(a)</xref> to:<subsection ssid="3-null-6" dnum="i-o" numlevel="1" lineno="32" slineno="1-10" level="3"><display>(i)</display>the director, or the director's designee, of the office or division to which the near <ln numlevel="1" lineno="33" slineno="1-11"/>fatality or the death relates; and</subsection><subsection ssid="3-null-7" dnum="ii-o" numlevel="1" lineno="34" slineno="1-12" level="3"><display>(ii)</display>the regional director, or the regional director's designee, of the region to which <ln numlevel="1" lineno="35" slineno="1-13"/>the near fatality or the death relates.</subsection></subsection></subsection><subsection ssid="3-null-8" dnum="2-o" numlevel="1" lineno="36" slineno="1-14" level="1"><display>(2)</display>Within 60 days after the day on which the director described in Subsection <xref depth="4" refnumber="26B-1-506(1)(b)(i)">(1)(b)(i)</xref> <ln numlevel="1" lineno="37" slineno="1-15"/>receives a copy of the report described in Subsection <xref depth="4" refnumber="26B-1-506(1)(a)">(1)(a)</xref>, the department shall provide <ln numlevel="1" lineno="38" slineno="1-16"/>a written response, with only <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">identifying information</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">surnames and addresses</amend> redacted, <ln numlevel="1" lineno="39" slineno="1-17"/>to the Office of Legislative Research and General Counsel, if the report:<subsection ssid="3-null-9" dnum="a-o" numlevel="1" lineno="40" slineno="1-18" level="2"><display>(a)</display>indicates that a law, rule, policy, or procedure was not complied with;</subsection><subsection ssid="3-null-10" dnum="b-o" numlevel="1" lineno="41" slineno="1-19" level="2"><display>(b)</display>indicates that the near fatality or the death was not responded to properly;</subsection><subsection ssid="3-null-11" dnum="c-o" numlevel="1" lineno="42" slineno="1-20" level="2"><display>(c)</display>recommends that a law, rule, policy, or procedure be changed; or</subsection><subsection ssid="3-null-12" dnum="d-o" numlevel="1" lineno="43" slineno="1-21" level="2"><display>(d)</display>indicates that additional training is needed.</subsection></subsection><subsection ssid="3-null-13" dnum="3-o" numlevel="1" lineno="44" slineno="1-22" level="1"><display>(3)</display>The response described in Subsection <xref depth="4" refnumber="26B-1-506(2)">(2)</xref> shall include:<subsection ssid="3-null-14" dnum="a-o" numlevel="1" lineno="45" slineno="1-23" level="2"><display>(a)</display>a plan of action to implement any recommended improvements within the <ln numlevel="1" lineno="46" slineno="1-24"/>department; and</subsection><subsection ssid="3-null-15" dnum="b-o" numlevel="1" lineno="47" slineno="1-25" level="2"><display>(b)</display>the approval of the executive director or the executive director's designee for the plan <ln numlevel="1" lineno="48" slineno="1-26"/>described in Subsection <xref depth="4" refnumber="26B-1-506(3)(a)">(3)(a)</xref>.</subsection></subsection><subsection ssid="3-null-16" dnum="4-o" numlevel="1" lineno="49" slineno="1-27" level="1"><display>(4)</display>A report described in Subsection <xref depth="4" refnumber="26B-1-506(1)">(1)</xref> and the response described in Subsection <xref depth="4" refnumber="26B-1-506(2)">(2)</xref> is a <ln numlevel="1" lineno="50" slineno="1-28"/>protected record.</subsection><subsection ssid="3-null-17" dnum="5-o" numlevel="1" lineno="51" slineno="1-29" level="1" space="false"><display>(5)</display><subsection ssid="3-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="26B-1-506(5)">(5)</xref>, "fatality review document" means any document <ln numlevel="1" lineno="52" slineno="1-30"/>created in connection with, or as a result of, a formal review of a near fatality or a <ln numlevel="1" lineno="53" slineno="1-31"/>death, or a decision whether to conduct a formal review of a near fatality or a death, <ln numlevel="1" lineno="54" slineno="1-32"/>including:<subsection ssid="3-null-19" dnum="i-o" numlevel="1" lineno="55" slineno="1-33" level="3" tab="1"><display>(i)</display>a report described in Subsection <xref depth="4" refnumber="26B-1-506(1)">(1)</xref>;</subsection><subsection ssid="3-null-20" dnum="ii-o" numlevel="1" lineno="56" slineno="1-34" level="3" tab="1"><display>(ii)</display>a response described in Subsection <xref depth="4" refnumber="26B-1-506(2)">(2)</xref>;</subsection><subsection ssid="3-null-21" dnum="iii-o" numlevel="1" lineno="57" slineno="1-35" level="3" tab="1"><display>(iii)</display>a recommendation regarding whether a formal review should be conducted;</subsection><subsection ssid="3-null-22" dnum="iv-o" numlevel="1" lineno="58" slineno="1-36" level="3" tab="1"><display>(iv)</display>a decision to conduct a formal review;</subsection><subsection ssid="3-null-23" dnum="v-o" numlevel="1" lineno="59" slineno="1-37" level="3" tab="1"><display>(v)</display>notes of a person who participates in a formal review;</subsection><subsection ssid="3-null-24" dnum="vi-o" numlevel="1" lineno="60" slineno="1-38" level="3" tab="1"><display>(vi)</display>notes of a person who reviews a formal review report;</subsection><subsection ssid="3-null-25" dnum="vii-o" numlevel="1" lineno="61" slineno="1-39" level="3" tab="1"><display>(vii)</display>minutes of a formal review;</subsection><subsection ssid="3-null-26" dnum="viii-o" numlevel="1" lineno="62" slineno="1-40" level="3" tab="1"><display>(viii)</display>minutes of a meeting where a formal review report is reviewed; and</subsection><subsection ssid="3-null-27" dnum="ix-o" numlevel="1" lineno="63" slineno="1-41" level="3" tab="1"><display>(ix)</display>minutes of, documents received in relation to, and documents generated in <ln numlevel="1" lineno="64" slineno="1-42"/>relation to, the portion of a meeting of the Health and Human Services Interim <ln numlevel="1" lineno="65" slineno="1-43"/>Committee or the Child Welfare Legislative Oversight Panel that a formal review <ln numlevel="1" lineno="66" slineno="1-44"/>report or a document described in this Subsection <xref depth="4" refnumber="26B-1-506(5)(a)">(5)(a)</xref> is reviewed or discussed.</subsection></subsection><subsection ssid="3-null-28" dnum="b-o" numlevel="1" lineno="67" slineno="1-45" level="2"><display>(b)</display>A fatality review document is not subject to discovery, subpoena, or similar <ln numlevel="1" lineno="68" slineno="1-46"/>compulsory process in any civil, judicial, or administrative proceeding, nor shall any <ln numlevel="1" lineno="69" slineno="1-47"/>individual or organization with lawful access to the data be compelled to testify with <ln numlevel="1" lineno="70" slineno="1-48"/>regard to a report described in Subsection <xref depth="4" refnumber="26B-1-506(1)">(1)</xref> or a response described in Subsection <xref depth="4" refnumber="26B-1-506(2)"><ln numlevel="1" lineno="71" slineno="1-49"/>(2)</xref>.</subsection><subsection ssid="3-null-29" dnum="c-o" numlevel="1" lineno="72" slineno="1-50" level="2"><display>(c)</display>The following are not admissible as evidence in a civil, judicial, or administrative <ln numlevel="1" lineno="73" slineno="1-51"/>proceeding:<subsection ssid="3-null-30" dnum="i-o" numlevel="1" lineno="74" slineno="1-52" level="3"><display>(i)</display>a fatality review document; and</subsection><subsection ssid="3-null-31" dnum="ii-o" numlevel="1" lineno="75" slineno="1-53" level="3"><display>(ii)</display>an executive summary described in Subsection <xref depth="4" refnumber="26B-1-507(4)">26B-1-507(4)</xref>.</subsection></subsection></subsection></section></bsec><bsec buid="6" num="26B-1-507" type="amend" src="code" uid="C26B-1-S507_2026050620260506" sort="26B01 05070020260506" numlevel="1" lineno="76" slineno="2-1" sn="2"><section number="26B-1-507" numlevel="1" lineno="77" slineno="2-2" type="amend"><secline lineno="76">Section 2. Section <bold>26B-1-507</bold> is amended to read:</secline><catline lineno="77"><bold>26B-1-507<parens/>. Reporting to, and review by, legislative committees.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="78" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>On or before September 1 of each year, the department shall provide, with only <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="79" slineno="2-4"/>identifying information</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">surnames and addresses</amend> redacted, a copy of the report described <ln numlevel="1" lineno="80" slineno="2-5"/>in Subsection <xref depth="4" refnumber="26B-1-506(1)">26B-1-506(1)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">(b),</amend><amendoutend style="2"/> and the response described in Subsection <xref depth="4" refnumber="26B-1-506(2)">26B-1-506(2)</xref> <ln numlevel="1" lineno="81" slineno="2-6"/>to the Office of Legislative Research and General Counsel and the chairs of:<subsection ssid="6-null-2" dnum="a-o" numlevel="1" lineno="82" slineno="2-7" level="2"><display>(a)</display>the Health and Human Services Interim Committee; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">and</amend></subsection><subsection ssid="6-null-3" dnum="b-o" numlevel="1" lineno="83" slineno="2-8" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">if the qualified individual who is the subject of the report is an individual described <ln numlevel="1" lineno="84" slineno="2-9"/>in Subsection 26B-1-501(7)(c), (d), or (h), </amend><amendoutend style="2"/>the Child Welfare Legislative Oversight <ln numlevel="1" lineno="85" slineno="2-10"/>Panel<amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">, if the individual who is the subject of the report is a qualified individual <ln numlevel="1" lineno="86" slineno="2-11"/>described in Subsection <xref depth="4" refnumber="26B-1-501(7)(c)">26B-1-501(7)(c)</xref>, <xref refnumber="(d)" depth="4">(d)</xref>, or <xref refnumber="(h)" depth="4">(h)</xref></amend>.</subsection></subsection><subsection ssid="6-null-4" dnum="2-o" numlevel="1" lineno="87" slineno="2-12" level="1" space="false"><display>(2)</display><subsection ssid="6-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Health and Human Services Interim Committee may, in a closed meeting, <ln numlevel="1" lineno="88" slineno="2-13"/>review a report described in Subsection <xref depth="4" refnumber="26B-1-506(1)">26B-1-506(1)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>.</subsection><subsection ssid="6-null-6" dnum="b-o" numlevel="1" lineno="89" slineno="2-14" level="2"><display>(b)</display>The Child Welfare Legislative Oversight Panel shall, in a closed meeting, review a <ln numlevel="1" lineno="90" slineno="2-15"/>report described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="26B-1-506(1)">(1)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="26B-1-506(1)">26B-1-506(1)</xref></amend>.</subsection></subsection><subsection ssid="6-null-7" dnum="3-o" numlevel="1" lineno="91" slineno="2-16" level="1" space="false"><display>(3)</display><subsection ssid="6-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Health and Human Services Interim Committee and the Child Welfare <ln numlevel="1" lineno="92" slineno="2-17"/>Legislative Oversight Panel may not interfere with, or make recommendations <ln numlevel="1" lineno="93" slineno="2-18"/>regarding, the resolution of a particular case.</subsection><subsection ssid="6-null-9" dnum="b-o" numlevel="1" lineno="94" slineno="2-19" level="2"><display>(b)</display>The purpose of a review described in Subsection <xref depth="4" refnumber="26B-1-507(2)">(2)</xref> is to assist a committee or panel <ln numlevel="1" lineno="95" slineno="2-20"/>described in Subsection <xref depth="4" refnumber="26B-1-507(2)">(2)</xref> in determining whether to recommend a change in the <ln numlevel="1" lineno="96" slineno="2-21"/>law.</subsection><subsection ssid="6-null-10" dnum="c-o" numlevel="1" lineno="97" slineno="2-22" level="2"><display>(c)</display>Any recommendation, described in Subsection <xref depth="4" refnumber="26B-1-507(3)(b)">(3)(b)</xref>, by a committee or panel for a <ln numlevel="1" lineno="98" slineno="2-23"/>change in the law shall be made in an open meeting.</subsection></subsection><subsection ssid="6-null-11" dnum="4-o" numlevel="1" lineno="99" slineno="2-24" level="1"><display>(4)</display>On or before September 1 of each year, the department shall provide an executive <ln numlevel="1" lineno="100" slineno="2-25"/>summary of all formal review reports for the preceding state fiscal year to:<subsection ssid="6-null-12" dnum="a-o" numlevel="1" lineno="101" slineno="2-26" level="2"><display>(a)</display>the Office of Legislative Research and General Counsel;</subsection><subsection ssid="6-null-13" dnum="b-o" numlevel="1" lineno="102" slineno="2-27" level="2"><display>(b)</display>the Health and Human Services Interim Committee; and</subsection><subsection ssid="6-null-14" dnum="c-o" numlevel="1" lineno="103" slineno="2-28" level="2"><display>(c)</display>the Child Welfare Legislative Oversight Panel.</subsection></subsection><subsection ssid="6-null-15" dnum="5-o" numlevel="1" lineno="104" slineno="2-29" level="1"><display>(5)</display>The executive summary described in Subsection <xref depth="4" refnumber="26B-1-507(4)">(4)</xref>:<subsection ssid="6-null-16" dnum="a-o" numlevel="1" lineno="105" slineno="2-30" level="2"><display>(a)</display>may not include any names or identifying information;</subsection><subsection ssid="6-null-17" dnum="b-o" numlevel="1" lineno="106" slineno="2-31" level="2"><display>(b)</display>shall include:<subsection ssid="6-null-18" dnum="i-o" numlevel="1" lineno="107" slineno="2-32" level="3"><display>(i)</display>all recommendations regarding changes to the law that were made during the <ln numlevel="1" lineno="108" slineno="2-33"/>preceding fiscal year under Subsection <xref depth="4" refnumber="26B-1-505(6)">26B-1-505(6)</xref>;</subsection><subsection ssid="6-null-19" dnum="ii-o" numlevel="1" lineno="109" slineno="2-34" level="3"><display>(ii)</display>all changes made, or in the process of being made, to a law, rule, policy, or <ln numlevel="1" lineno="110" slineno="2-35"/>procedure in response to a formal review that occurred during the preceding fiscal <ln numlevel="1" lineno="111" slineno="2-36"/>year;</subsection><subsection ssid="6-null-20" dnum="iii-o" numlevel="1" lineno="112" slineno="2-37" level="3"><display>(iii)</display>a description of the training that has been completed in response to a formal <ln numlevel="1" lineno="113" slineno="2-38"/>review that occurred during the preceding fiscal year;</subsection><subsection ssid="6-null-21" dnum="iv-o" numlevel="1" lineno="114" slineno="2-39" level="3"><display>(iv)</display>statistics for the preceding fiscal year regarding:<subsection ssid="6-null-22" dnum="A-o" numlevel="1" lineno="115" slineno="2-40" level="4"><display>(A)</display>the number of qualified individuals and the type of deaths and near fatalities <ln numlevel="1" lineno="116" slineno="2-41"/>that are known to the department;</subsection><subsection ssid="6-null-23" dnum="B-o" numlevel="1" lineno="117" slineno="2-42" level="4"><display>(B)</display>the number of formal reviews conducted;</subsection><subsection ssid="6-null-24" dnum="C-o" numlevel="1" lineno="118" slineno="2-43" level="4"><display>(C)</display>the categories described in Subsection <xref depth="4" refnumber="26B-1-501(7)">26B-1-501(7)</xref> of qualified individuals;</subsection><subsection ssid="6-null-25" dnum="D-o" numlevel="1" lineno="119" slineno="2-44" level="4"><display>(D)</display>the gender, age, race, and other significant categories of qualified individuals; <ln numlevel="1" lineno="120" slineno="2-45"/>and</subsection><subsection ssid="6-null-26" dnum="E-o" numlevel="1" lineno="121" slineno="2-46" level="4"><display>(E)</display>the number of fatalities of qualified individuals known to the department that <ln numlevel="1" lineno="122" slineno="2-47"/>are identified as suicides; and</subsection></subsection><subsection ssid="6-null-27" dnum="v-o" numlevel="1" lineno="123" slineno="2-48" level="3"><display>(v)</display>action taken by the Division of Licensing and Background Checks in response to <ln numlevel="1" lineno="124" slineno="2-49"/>the near fatality or the death of a qualified individual; L.
