Section <bold>10-20-911</bold> is amended to read:</secline><catline lineno="32"><bold>10-20-911<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Exactions -- Exaction for water interest -- <ln numlevel="1" lineno="33" slineno="1-3"/>Requirement to offer to original owner property acquired by exaction.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="34" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>A municipality may impose an exaction or exactions on development proposed in a land <ln numlevel="1" lineno="35" slineno="1-5"/>use application, including, subject to Subsection <xref depth="4" refnumber="10-9a-508(3)" start="0">(3)</xref>, an exaction for a water interest, if:<subsection ssid="8-null-2" dnum="a-o" numlevel="1" lineno="36" slineno="1-6" level="2"><display>(a)</display>an essential link exists between a legitimate governmental interest and each exaction; <ln numlevel="1" lineno="37" slineno="1-7"/>and</subsection><subsection ssid="8-null-3" dnum="b-o" numlevel="1" lineno="38" slineno="1-8" level="2"><display>(b)</display>each exaction is roughly proportionate, both in nature and extent, to the impact of the <ln numlevel="1" lineno="39" slineno="1-9"/>proposed development.</subsection></subsection><subsection ssid="8-null-4" dnum="2-o" numlevel="1" lineno="40" slineno="1-10" level="1"><display>(2)</display>If a land use authority imposes an exaction for another governmental entity:<subsection ssid="8-null-5" dnum="a-o" numlevel="1" lineno="41" slineno="1-11" level="2"><display>(a)</display>the governmental entity shall request the exaction; and</subsection><subsection ssid="8-null-6" dnum="b-o" numlevel="1" lineno="42" slineno="1-12" level="2"><display>(b)</display>the land use authority shall transfer the exaction to the governmental entity for which <ln numlevel="1" lineno="43" slineno="1-13"/>it was exacted.</subsection></subsection><subsection ssid="8-null-7" dnum="3-o" numlevel="1" lineno="44" slineno="1-14" level="1" space="false"><display>(3)</display><subsection ssid="8-null-8" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="8-null-9" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>Subject to the requirements of this Subsection <xref depth="4" refnumber="10-9a-508(3)" start="0">(3)</xref>, a municipality shall base <ln numlevel="1" lineno="45" slineno="1-15"/>an exaction for a water interest on the culinary water authority's established <ln numlevel="1" lineno="46" slineno="1-16"/>calculations of projected water interest requirements.</subsection><subsection ssid="8-null-10" dnum="ii-o" numlevel="1" lineno="47" slineno="1-17" level="3" tab="1"><display>(ii)</display>Except as described in Subsection <xref depth="4" refnumber="10-9a-508(3)(a)(iii)" start="0">(3)(a)(iii)</xref>, a culinary water authority shall base <ln numlevel="1" lineno="48" slineno="1-18"/>an exaction for a culinary water interest on:<subsection ssid="8-null-11" dnum="A-o" numlevel="1" lineno="49" slineno="1-19" level="4"><display>(A)</display>consideration of the system-wide minimum sizing standards established for <ln numlevel="1" lineno="50" slineno="1-20"/>the culinary water authority by the Division of Drinking Water in accordance <ln numlevel="1" lineno="51" slineno="1-21"/>with Section <xref depth="3" refnumber="19-4-114" start="0">19-4-114</xref>; and</subsection><subsection ssid="8-null-12" dnum="B-o" numlevel="1" lineno="52" slineno="1-22" level="4"><display>(B)</display>the number of equivalent residential connections associated with the culinary <ln numlevel="1" lineno="53" slineno="1-23"/>water demand for each specific development proposed in the development's <ln numlevel="1" lineno="54" slineno="1-24"/>land use application, applying lower exactions for developments with lower <ln numlevel="1" lineno="55" slineno="1-25"/>equivalent residential connections as demonstrated by at least five years of <ln numlevel="1" lineno="56" slineno="1-26"/>usage data for like land uses within the municipality.</subsection></subsection><subsection ssid="8-null-13" dnum="iii-o" numlevel="1" lineno="57" slineno="1-27" level="3" tab="1"><display>(iii)</display>A municipality may impose an exaction for a culinary water interest that results <ln numlevel="1" lineno="58" slineno="1-28"/>in less water being exacted than would otherwise be exacted under Subsection <xref depth="4" refnumber="10-9a-508(3)(a)(ii)" start="0"><ln numlevel="1" lineno="59" slineno="1-29"/>(3)(a)(ii)</xref> if the municipality, at the municipality's sole discretion, determines there <ln numlevel="1" lineno="60" slineno="1-30"/>is good cause to do so.</subsection><subsection ssid="8-null-14" dnum="iv-o" numlevel="1" lineno="61" slineno="1-31" level="3" tab="1" space="false"><display>(iv)</display><subsection ssid="8-null-15" dnum="A-o" level="4" placement="sameline"><display>(A)</display>A municipality shall make public the methodology used to comply with <ln numlevel="1" lineno="62" slineno="1-32"/>Subsection <xref depth="4" refnumber="10-9a-508(3)(a)(ii)(B)" start="0">(3)(a)(ii)(B)</xref>.  </subsection><subsection ssid="8-null-16" dnum="B-o" numlevel="1" lineno="63" slineno="1-33" level="4"><display>(B)</display>A land use applicant may appeal to the municipality's governing body an <ln numlevel="1" lineno="64" slineno="1-34"/>exaction calculation used by the municipality under Subsection <xref depth="4" refnumber="10-9a-508(3)(a)(ii)" start="0">(3)(a)(ii)</xref>.  </subsection><subsection ssid="8-null-17" dnum="C-o" numlevel="1" lineno="65" slineno="1-35" level="4"><display>(C)</display>A land use applicant may present data and other information that illustrates a <ln numlevel="1" lineno="66" slineno="1-36"/>need for an exaction recalculation and the municipality's governing body shall <ln numlevel="1" lineno="67" slineno="1-37"/>respond with due process.</subsection></subsection><subsection ssid="8-null-18" dnum="v-o" numlevel="1" lineno="68" slineno="1-38" level="3" tab="1"><display>(v)</display>Upon an applicant's request, the culinary water authority shall provide the <ln numlevel="1" lineno="69" slineno="1-39"/>applicant with the basis for the culinary water authority's calculations under <ln numlevel="1" lineno="70" slineno="1-40"/>Subsection <xref depth="4" refnumber="10-9a-508(3)(a)(i)" start="0">(3)(a)(i)</xref> on which an exaction for a water interest is based.</subsection></subsection><subsection ssid="8-null-19" dnum="b-o" numlevel="1" lineno="71" slineno="1-41" level="2" space="false"><display>(b)</display><subsection ssid="8-55" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>A municipality may not impose an exaction for a water interest if<amend anum="0" ea="amend" pairid="25" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="8-58" dnum="_-o:A-i" numlevel="1" lineno="72" slineno="1-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="both">(A)</amend></display>the culinary water authority's existing available water interests exceed the <ln numlevel="1" lineno="73" slineno="1-43"/>water interests needed to meet the reasonable future water requirement of the <ln numlevel="1" lineno="74" slineno="1-44"/>public<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">, as determined under Subsection <xref depth="4" refnumber="73-1-4(2)(f)" start="0">73-1-4(2)(f)</xref>.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="8-59" dnum="_-o:B-i" numlevel="1" lineno="75" slineno="1-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">the municipality or the municipality's culinary water authority does not have a <ln numlevel="1" lineno="76" slineno="1-46"/>written plan described in Subsection <xref depth="4" refnumber="10-20-911(3)(b)(ii)">(3)(b)(ii)</xref>.</amend></subsection></subsection><subsection ssid="8-56" dnum="_-o:ii-i" numlevel="1" lineno="77" slineno="1-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning on January 1, 2027, a municipality shall determine the municipality's <ln numlevel="1" lineno="78" slineno="1-48"/>water interests needed to meet the reasonable future water requirement of the <ln numlevel="1" lineno="79" slineno="1-49"/>public by completing a written plan described in Subsection <xref depth="4" refnumber="73-1-4(2)(f)">73-1-4(2)(f)</xref>.</amend></subsection></subsection></subsection><subsection ssid="8-null-20" dnum="4-o" numlevel="1" lineno="80" slineno="1-50" level="1" space="false"><display>(4)</display><subsection ssid="8-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a municipality plans to dispose of surplus real property that was acquired under <ln numlevel="1" lineno="81" slineno="1-51"/>this section and has been owned by the municipality for less than 15 years, the <ln numlevel="1" lineno="82" slineno="1-52"/>municipality shall first offer to reconvey the property, without receiving additional <ln numlevel="1" lineno="83" slineno="1-53"/>consideration, to the person who granted the property to the municipality.</subsection><subsection ssid="8-null-22" dnum="b-o" numlevel="1" lineno="84" slineno="1-54" level="2"><display>(b)</display>A person to whom a municipality offers to reconvey property under Subsection <xref depth="4" refnumber="10-9a-508(4)(a)" start="0">(4)(a)</xref> <ln numlevel="1" lineno="85" slineno="1-55"/>has 90 days to accept or reject the municipality's offer.</subsection><subsection ssid="8-null-23" dnum="c-o" numlevel="1" lineno="86" slineno="1-56" level="2"><display>(c)</display>If a person to whom a municipality offers to reconvey property declines the offer, the <ln numlevel="1" lineno="87" slineno="1-57"/>municipality may offer the property for sale.</subsection><subsection ssid="8-null-24" dnum="d-o" numlevel="1" lineno="88" slineno="1-58" level="2"><display>(d)</display>Subsection <xref depth="4" refnumber="10-9a-508(4)(a)" start="0">(4)(a)</xref> does not apply to the disposal of property acquired by exaction by <ln numlevel="1" lineno="89" slineno="1-59"/>a community reinvestment agency.</subsection></subsection><subsection ssid="8-null-25" dnum="5-o" numlevel="1" lineno="90" slineno="1-60" level="1" space="false"><display>(5)</display><subsection ssid="8-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A municipality may not, as part of an infrastructure improvement, require the <ln numlevel="1" lineno="91" slineno="1-61"/>installation of pavement on a residential roadway at a width in excess of 32 feet.</subsection><subsection ssid="8-null-27" dnum="b-o" numlevel="1" lineno="92" slineno="1-62" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="10-9a-508(5)(a)" start="0">(5)(a)</xref> does not apply if a municipality requires the installation of <ln numlevel="1" lineno="93" slineno="1-63"/>pavement in excess of 32 feet:<subsection ssid="8-null-28" dnum="i-o" numlevel="1" lineno="94" slineno="1-64" level="3"><display>(i)</display>in a vehicle turnaround area;</subsection><subsection ssid="8-null-29" dnum="ii-o" numlevel="1" lineno="95" slineno="1-65" level="3"><display>(ii)</display>in a cul-de-sac;</subsection><subsection ssid="8-null-30" dnum="iii-o" numlevel="1" lineno="96" slineno="1-66" level="3"><display>(iii)</display>to address specific traffic flow constraints at an intersection, mid-block <ln numlevel="1" lineno="97" slineno="1-67"/>crossings, or other areas;</subsection><subsection ssid="8-null-31" dnum="iv-o" numlevel="1" lineno="98" slineno="1-68" level="3"><display>(iv)</display>to address an applicable general or master plan improvement, including <ln numlevel="1" lineno="99" slineno="1-69"/>transportation, bicycle lanes, trails, or other similar improvements that are not <ln numlevel="1" lineno="100" slineno="1-70"/>included within an impact fee area;</subsection><subsection ssid="8-null-32" dnum="v-o" numlevel="1" lineno="101" slineno="1-71" level="3"><display>(v)</display>to address traffic flow constraints for service to or abutting higher density <ln numlevel="1" lineno="102" slineno="1-72"/>developments or uses that generate higher traffic volumes, including community <ln numlevel="1" lineno="103" slineno="1-73"/>centers, schools, and other similar uses;</subsection><subsection ssid="8-null-33" dnum="vi-o" numlevel="1" lineno="104" slineno="1-74" level="3"><display>(vi)</display>as needed for the installation or location of a utility which is maintained by the <ln numlevel="1" lineno="105" slineno="1-75"/>municipality and is considered a transmission line or requires additional roadway <ln numlevel="1" lineno="106" slineno="1-76"/>width;</subsection><subsection ssid="8-null-34" dnum="vii-o" numlevel="1" lineno="107" slineno="1-77" level="3"><display>(vii)</display>for third-party utility lines that have an easement preventing the installation of <ln numlevel="1" lineno="108" slineno="1-78"/>utilities maintained by the municipality within the roadway;</subsection><subsection ssid="8-null-35" dnum="viii-o" numlevel="1" lineno="109" slineno="1-79" level="3"><display>(viii)</display>for utilities over 12 feet in depth;</subsection><subsection ssid="8-null-36" dnum="ix-o" numlevel="1" lineno="110" slineno="1-80" level="3"><display>(ix)</display>for roadways with a design speed that exceeds 25 miles per hour;</subsection><subsection ssid="8-null-37" dnum="x-o" numlevel="1" lineno="111" slineno="1-81" level="3"><display>(x)</display>as needed for flood and stormwater routing;</subsection><subsection ssid="8-null-38" dnum="xi-o" numlevel="1" lineno="112" slineno="1-82" level="3"><display>(xi)</display>as needed to meet fire code requirements for parking and hydrants; or</subsection><subsection ssid="8-null-39" dnum="xii-o" numlevel="1" lineno="113" slineno="1-83" level="3"><display>(xii)</display>as needed to accommodate street parking.</subsection></subsection><subsection ssid="8-null-40" dnum="c-o" numlevel="1" lineno="114" slineno="1-84" level="2"><display>(c)</display>Nothing in this section shall be construed to prevent a municipality from approving a <ln numlevel="1" lineno="115" slineno="1-85"/>road cross section with a pavement width less than 32 feet.</subsection><subsection ssid="8-null-41" dnum="d-o" numlevel="1" lineno="116" slineno="1-86" level="2" space="false"><display>(d)</display><subsection ssid="8-null-42" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A land use applicant may appeal a municipal requirement for pavement in <ln numlevel="1" lineno="117" slineno="1-87"/>excess of 32 feet on a residential roadway.</subsection><subsection ssid="8-null-43" dnum="ii-o" numlevel="1" lineno="118" slineno="1-88" level="3"><display>(ii)</display>A land use applicant that has appealed a municipal specification for a residential <ln numlevel="1" lineno="119" slineno="1-89"/>roadway pavement width in excess of 32 feet may request that the municipality <ln numlevel="1" lineno="120" slineno="1-90"/>assemble a panel of qualified experts to serve as the appeal authority for purposes <ln numlevel="1" lineno="121" slineno="1-91"/>of determining the technical aspects of the appeal.</subsection><subsection ssid="8-null-44" dnum="iii-o" numlevel="1" lineno="122" slineno="1-92" level="3"><display>(iii)</display>Unless otherwise agreed by the applicant and the municipality, the panel <ln numlevel="1" lineno="123" slineno="1-93"/>described in Subsection <xref depth="4" refnumber="10-9a-508(5)(d)(ii)" start="0">(5)(d)(ii)</xref> shall consist of the following three experts:<subsection ssid="8-null-45" dnum="A-o" numlevel="1" lineno="124" slineno="1-94" level="4"><display>(A)</display>one licensed engineer, designated by the municipality;</subsection><subsection ssid="8-null-46" dnum="B-o" numlevel="1" lineno="125" slineno="1-95" level="4"><display>(B)</display>one licensed engineer, designated by the land use applicant; and</subsection><subsection ssid="8-null-47" dnum="C-o" numlevel="1" lineno="126" slineno="1-96" level="4"><display>(C)</display>one licensed engineer, agreed upon and designated by the two designated <ln numlevel="1" lineno="127" slineno="1-97"/>engineers under Subsections <xref depth="4" refnumber="10-9a-508(5)(d)(iii)(A)" start="0">(5)(d)(iii)(A)</xref> and <xref depth="4" refnumber="10-9a-508(5)(d)(iii)(B)" start="0">(B)</xref>.</subsection></subsection><subsection ssid="8-null-48" dnum="iv-o" numlevel="1" lineno="128" slineno="1-98" level="3"><display>(iv)</display>A member of the panel assembled by the municipality under Subsection <xref depth="4" refnumber="10-9a-508(5)(d)(ii)" start="0">(5)(d)(ii)</xref> <ln numlevel="1" lineno="129" slineno="1-99"/>may not have an interest in the application that is the subject of the appeal.</subsection><subsection ssid="8-null-49" dnum="v-o" numlevel="1" lineno="130" slineno="1-100" level="3"><display>(v)</display>The land use applicant shall pay:<subsection ssid="8-null-50" dnum="A-o" numlevel="1" lineno="131" slineno="1-101" level="4"><display>(A)</display>50% of the cost of the panel; and</subsection><subsection ssid="8-null-51" dnum="B-o" numlevel="1" lineno="132" slineno="1-102" level="4"><display>(B)</display>the municipality's published appeal fee.</subsection></subsection><subsection ssid="8-null-52" dnum="vi-o" numlevel="1" lineno="133" slineno="1-103" level="3"><display>(vi)</display>The decision of the panel is a final decision, subject to a petition for review under <ln numlevel="1" lineno="134" slineno="1-104"/>Subsection <xref depth="4" refnumber="10-9a-508(5)(d)(vii)" start="0">(5)(d)(vii)</xref>.</subsection><subsection ssid="8-null-53" dnum="vii-o" numlevel="1" lineno="135" slineno="1-105" level="3"><display>(vii)</display>In accordance with Section <xref depth="3" refnumber="10-20-1109">10-20-1109</xref>, a land use applicant or the municipality <ln numlevel="1" lineno="136" slineno="1-106"/>may file a petition for review of the decision with the district court within 30 days <ln numlevel="1" lineno="137" slineno="1-107"/>after the date that the decision is final.</subsection></subsection></subsection><subsection ssid="8-null-54" dnum="6-o" numlevel="1" lineno="138" slineno="1-108" level="1"><display>(6)</display>A provider of culinary or secondary water that commits to provide a water service <ln numlevel="1" lineno="139" slineno="1-109"/>required by a land use application process is subject to the provisions of this section the <ln numlevel="1" lineno="140" slineno="1-110"/>same as if the provider were a municipality.</subsection></section></bsec><bsec buid="10" num="17-79-812" type="amend" src="code" uid="C17-79-S812_2026050620260506" sort="17 79 08120020260506" numlevel="1" lineno="141" slineno="2-1" sn="2"><section number="17-79-812" numlevel="1" lineno="142" slineno="2-2" type="amend"><secline lineno="141">Section 2. Section <bold>17-79-812</bold> is amended to read:</secline><catline lineno="142"><bold>17-79-812<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Exactions -- Exaction for water interest -- <ln numlevel="1" lineno="143" slineno="2-3"/>Requirement to offer to original owner property acquired by exaction.</bold></catline><subsection ssid="10-null-1" dnum="1-o" numlevel="1" lineno="144" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>A county may impose an exaction or exactions on development proposed in a land use <ln numlevel="1" lineno="145" slineno="2-5"/>application, including, subject to Subsection <xref depth="4" refnumber="17-27a-507(3)" start="0">(3)</xref>, an exaction for a water interest, if:<subsection ssid="10-null-2" dnum="a-o" numlevel="1" lineno="146" slineno="2-6" level="2"><display>(a)</display>an essential link exists between a legitimate governmental interest and each exaction; <ln numlevel="1" lineno="147" slineno="2-7"/>and</subsection><subsection ssid="10-null-3" dnum="b-o" numlevel="1" lineno="148" slineno="2-8" level="2"><display>(b)</display>each exaction is roughly proportionate, both in nature and extent, to the impact of the <ln numlevel="1" lineno="149" slineno="2-9"/>proposed development.</subsection></subsection><subsection ssid="10-null-4" dnum="2-o" numlevel="1" lineno="150" slineno="2-10" level="1"><display>(2)</display>If a land use authority imposes an exaction for another governmental entity:<subsection ssid="10-null-5" dnum="a-o" numlevel="1" lineno="151" slineno="2-11" level="2"><display>(a)</display>the governmental entity shall request the exaction; and</subsection><subsection ssid="10-null-6" dnum="b-o" numlevel="1" lineno="152" slineno="2-12" level="2"><display>(b)</display>the land use authority shall transfer the exaction to the governmental entity for which <ln numlevel="1" lineno="153" slineno="2-13"/>it was exacted.</subsection></subsection><subsection ssid="10-null-7" dnum="3-o" numlevel="1" lineno="154" slineno="2-14" level="1" space="false"><display>(3)</display><subsection ssid="10-null-8" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="10-null-9" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>Subject to the requirements of this Subsection <xref depth="4" refnumber="17-27a-507(3)" start="0">(3)</xref>, a county or, if applicable, <ln numlevel="1" lineno="155" slineno="2-15"/>the county's culinary water authority shall base any exaction for a water interest <ln numlevel="1" lineno="156" slineno="2-16"/>on the culinary water authority's established calculations of projected water <ln numlevel="1" lineno="157" slineno="2-17"/>interest requirements.</subsection><subsection ssid="10-null-10" dnum="ii-o" numlevel="1" lineno="158" slineno="2-18" level="3" tab="1"><display>(ii)</display>Except as described in Subsection <xref depth="4" refnumber="17-27a-507(3)(a)(iii)" start="0">(3)(a)(iii)</xref>, a culinary water authority shall base <ln numlevel="1" lineno="159" slineno="2-19"/>an exaction for a culinary water interest on:<subsection ssid="10-null-11" dnum="A-o" numlevel="1" lineno="160" slineno="2-20" level="4"><display>(A)</display>consideration of the system-wide minimum sizing standards established for <ln numlevel="1" lineno="161" slineno="2-21"/>the culinary water authority by the Division of Drinking Water in accordance <ln numlevel="1" lineno="162" slineno="2-22"/>with Section <xref depth="3" refnumber="19-4-114" start="0">19-4-114</xref>; and</subsection><subsection ssid="10-null-12" dnum="B-o" numlevel="1" lineno="163" slineno="2-23" level="4"><display>(B)</display>the number of equivalent residential connections associated with the culinary <ln numlevel="1" lineno="164" slineno="2-24"/>water demand for each specific development proposed in the development's <ln numlevel="1" lineno="165" slineno="2-25"/>land use application, applying lower exactions for developments with lower <ln numlevel="1" lineno="166" slineno="2-26"/>equivalent residential connections as demonstrated by at least five years of <ln numlevel="1" lineno="167" slineno="2-27"/>usage data for like land uses within the county.</subsection></subsection><subsection ssid="10-null-13" dnum="iii-o" numlevel="1" lineno="168" slineno="2-28" level="3" tab="1"><display>(iii)</display>A county or culinary water authority may impose an exaction for a culinary <ln numlevel="1" lineno="169" slineno="2-29"/>water interest that results in less water being exacted than would otherwise be <ln numlevel="1" lineno="170" slineno="2-30"/>exacted under Subsection <xref depth="4" refnumber="17-27a-507(3)(a)(ii)" start="0">(3)(a)(ii)</xref> if the county or culinary water authority, at the <ln numlevel="1" lineno="171" slineno="2-31"/>county's or culinary water authority's sole discretion, determines there is good <ln numlevel="1" lineno="172" slineno="2-32"/>cause to do so.</subsection><subsection ssid="10-null-14" dnum="iv-o" numlevel="1" lineno="173" slineno="2-33" level="3" tab="1"><display>(iv)</display>A county shall make public the methodology used to comply with Subsection <xref depth="4" refnumber="17-27a-507(3)(a)(ii)(B)" start="0"><ln numlevel="1" lineno="174" slineno="2-34"/>(3)(a)(ii)(B)</xref>. A land use applicant may appeal to the county's governing body an <ln numlevel="1" lineno="175" slineno="2-35"/>exaction calculation used by the county or the county's culinary water authority <ln numlevel="1" lineno="176" slineno="2-36"/>under Subsection <xref depth="4" refnumber="17-27a-507(3)(a)(ii)" start="0">(3)(a)(ii)</xref>.  A land use applicant may present data and other <ln numlevel="1" lineno="177" slineno="2-37"/>information that illustrates a need for an exaction recalculation and the county's <ln numlevel="1" lineno="178" slineno="2-38"/>governing body shall respond with due process.</subsection><subsection ssid="10-null-15" dnum="v-o" numlevel="1" lineno="179" slineno="2-39" level="3" tab="1"><display>(v)</display>Upon an applicant's request, the culinary water authority shall provide the <ln numlevel="1" lineno="180" slineno="2-40"/>applicant with the basis for the culinary water authority's calculations under <ln numlevel="1" lineno="181" slineno="2-41"/>Subsection <xref depth="4" refnumber="17-27a-507(3)(a)(i)" start="0">(3)(a)(i)</xref> on which an exaction for a water interest is based.</subsection></subsection><subsection ssid="10-null-16" dnum="b-o" numlevel="1" lineno="182" slineno="2-42" level="2" space="false"><display>(b)</display><subsection ssid="10-51" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>A county or the county's culinary water authority may not impose an exaction <ln numlevel="1" lineno="183" slineno="2-43"/>for a water interest if<amend anum="0" ea="amend" pairid="13" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="10-53" dnum="_-o:A-i" numlevel="1" lineno="184" slineno="2-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="both">(A)</amend></display>the culinary water authority's existing available water interests exceed the <ln numlevel="1" lineno="185" slineno="2-45"/>water interests needed to meet the reasonable future water requirement of the <ln numlevel="1" lineno="186" slineno="2-46"/>public<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">, as determined under Subsection <xref depth="4" refnumber="73-1-4(2)(f)" start="0">73-1-4(2)(f)</xref>.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="10-55" dnum="_-o:B-i" numlevel="1" lineno="187" slineno="2-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">the county or the county's culinary water authority does not have a written <ln numlevel="1" lineno="188" slineno="2-48"/>plan described in Subsection <xref depth="4" refnumber="17-79-812(3)(b)(ii)">(3)(b)(ii)</xref>.</amend></subsection></subsection><subsection ssid="10-52" dnum="_-o:ii-i" numlevel="1" lineno="189" slineno="2-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning on January 1, 2027, a county shall determine the county's water <ln numlevel="1" lineno="190" slineno="2-50"/>interests needed to meet the reasonable future water requirement of the public by <ln numlevel="1" lineno="191" slineno="2-51"/>completing a written plan described in Subsection <xref depth="4" refnumber="73-1-4(2)(f)">73-1-4(2)(f)</xref>.</amend></subsection></subsection></subsection><subsection ssid="10-null-17" dnum="4-o" numlevel="1" lineno="192" slineno="2-52" level="1" space="false"><display>(4)</display><subsection ssid="10-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a county plans to dispose of surplus real property under Section <xref depth="3" refnumber="17-78-103">17-78-103</xref> that <ln numlevel="1" lineno="193" slineno="2-53"/>was acquired under this section and has been owned by the county for less than 15 <ln numlevel="1" lineno="194" slineno="2-54"/>years, the county shall first offer to reconvey the property, without receiving <ln numlevel="1" lineno="195" slineno="2-55"/>additional consideration, to the person who granted the property to the county.</subsection><subsection ssid="10-null-19" dnum="b-o" numlevel="1" lineno="196" slineno="2-56" level="2"><display>(b)</display>A person to whom a county offers to reconvey property under Subsection <xref depth="4" refnumber="17-27a-507(4)(a)" start="0">(4)(a)</xref> has <ln numlevel="1" lineno="197" slineno="2-57"/>90 days to accept or reject the county's offer.</subsection><subsection ssid="10-null-20" dnum="c-o" numlevel="1" lineno="198" slineno="2-58" level="2"><display>(c)</display>If a person to whom a county offers to reconvey property declines the offer, the <ln numlevel="1" lineno="199" slineno="2-59"/>county may offer the property for sale.</subsection><subsection ssid="10-null-21" dnum="d-o" numlevel="1" lineno="200" slineno="2-60" level="2"><display>(d)</display>Subsection <xref depth="4" refnumber="17-27a-507(4)(a)" start="0">(4)(a)</xref> does not apply to the disposal of property acquired by exaction by <ln numlevel="1" lineno="201" slineno="2-61"/>a community development or urban renewal agency.</subsection></subsection><subsection ssid="10-null-22" dnum="5-o" numlevel="1" lineno="202" slineno="2-62" level="1" space="false"><display>(5)</display><subsection ssid="10-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A county may not, as part of an infrastructure improvement, require the <ln numlevel="1" lineno="203" slineno="2-63"/>installation of pavement on a residential roadway at a width in excess of 32 feet.</subsection><subsection ssid="10-null-24" dnum="b-o" numlevel="1" lineno="204" slineno="2-64" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="17-27a-507(5)(a)" start="0">(5)(a)</xref> does not apply if a county requires the installation of pavement in <ln numlevel="1" lineno="205" slineno="2-65"/>excess of 32 feet:<subsection ssid="10-null-25" dnum="i-o" numlevel="1" lineno="206" slineno="2-66" level="3"><display>(i)</display>in a vehicle turnaround area;</subsection><subsection ssid="10-null-26" dnum="ii-o" numlevel="1" lineno="207" slineno="2-67" level="3"><display>(ii)</display>in a cul-de-sac;</subsection><subsection ssid="10-null-27" dnum="iii-o" numlevel="1" lineno="208" slineno="2-68" level="3"><display>(iii)</display>to address specific traffic flow constraints at an intersection, mid-block <ln numlevel="1" lineno="209" slineno="2-69"/>crossings, or other areas;</subsection><subsection ssid="10-null-28" dnum="iv-o" numlevel="1" lineno="210" slineno="2-70" level="3"><display>(iv)</display>to address an applicable general or master plan improvement, including <ln numlevel="1" lineno="211" slineno="2-71"/>transportation, bicycle lanes, trails, or other similar improvements that are not <ln numlevel="1" lineno="212" slineno="2-72"/>included within an impact fee area;</subsection><subsection ssid="10-null-29" dnum="v-o" numlevel="1" lineno="213" slineno="2-73" level="3"><display>(v)</display>to address traffic flow constraints for service to or abutting higher density <ln numlevel="1" lineno="214" slineno="2-74"/>developments or uses that generate higher traffic volumes, including community <ln numlevel="1" lineno="215" slineno="2-75"/>centers, schools, and other similar uses;</subsection><subsection ssid="10-null-30" dnum="vi-o" numlevel="1" lineno="216" slineno="2-76" level="3"><display>(vi)</display>as needed for the installation or location of a utility which is maintained by the <ln numlevel="1" lineno="217" slineno="2-77"/>county and is considered a transmission line or requires additional roadway width;</subsection><subsection ssid="10-null-31" dnum="vii-o" numlevel="1" lineno="218" slineno="2-78" level="3"><display>(vii)</display>for third-party utility lines that have an easement preventing the installation of <ln numlevel="1" lineno="219" slineno="2-79"/>utilities maintained by the county within the roadway;</subsection><subsection ssid="10-null-32" dnum="viii-o" numlevel="1" lineno="220" slineno="2-80" level="3"><display>(viii)</display>for utilities over 12 feet in depth;</subsection><subsection ssid="10-null-33" dnum="ix-o" numlevel="1" lineno="221" slineno="2-81" level="3"><display>(ix)</display>for roadways with a design speed that exceeds 25 miles per hour;</subsection><subsection ssid="10-null-34" dnum="x-o" numlevel="1" lineno="222" slineno="2-82" level="3"><display>(x)</display>as needed for flood and stormwater routing;</subsection><subsection ssid="10-null-35" dnum="xi-o" numlevel="1" lineno="223" slineno="2-83" level="3"><display>(xi)</display>as needed to meet fire code requirements for parking and hydrants; or</subsection><subsection ssid="10-null-36" dnum="xii-o" numlevel="1" lineno="224" slineno="2-84" level="3"><display>(xii)</display>as needed to accommodate street parking.</subsection></subsection><subsection ssid="10-null-37" dnum="c-o" numlevel="1" lineno="225" slineno="2-85" level="2"><display>(c)</display>Nothing in this section shall be construed to prevent a county from approving a road <ln numlevel="1" lineno="226" slineno="2-86"/>cross section with a pavement width less than 32 feet.</subsection><subsection ssid="10-null-38" dnum="d-o" numlevel="1" lineno="227" slineno="2-87" level="2" space="false"><display>(d)</display><subsection ssid="10-null-39" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A land use applicant may appeal a municipal requirement for pavement in <ln numlevel="1" lineno="228" slineno="2-88"/>excess of 32 feet on a residential roadway.</subsection><subsection ssid="10-null-40" dnum="ii-o" numlevel="1" lineno="229" slineno="2-89" level="3"><display>(ii)</display>A land use applicant that has appealed a municipal specification for a residential <ln numlevel="1" lineno="230" slineno="2-90"/>roadway pavement width in excess of 32 feet may request that the county <ln numlevel="1" lineno="231" slineno="2-91"/>assemble a panel of qualified experts to serve as the appeal authority for purposes <ln numlevel="1" lineno="232" slineno="2-92"/>of determining the technical aspects of the appeal.</subsection><subsection ssid="10-null-41" dnum="iii-o" numlevel="1" lineno="233" slineno="2-93" level="3"><display>(iii)</display>Unless otherwise agreed by the applicant and the county, the panel described in <ln numlevel="1" lineno="234" slineno="2-94"/>Subsection <xref depth="4" refnumber="17-27a-507(5)(d)(ii)" start="0">(5)(d)(ii)</xref> shall consist of the following three experts:<subsection ssid="10-null-42" dnum="A-o" numlevel="1" lineno="235" slineno="2-95" level="4"><display>(A)</display>one licensed engineer, designated by the county;</subsection><subsection ssid="10-null-43" dnum="B-o" numlevel="1" lineno="236" slineno="2-96" level="4"><display>(B)</display>one licensed engineer, designated by the land use applicant; and</subsection><subsection ssid="10-null-44" dnum="C-o" numlevel="1" lineno="237" slineno="2-97" level="4"><display>(C)</display>one licensed engineer, agreed upon and designated by the two designated <ln numlevel="1" lineno="238" slineno="2-98"/>engineers under Subsections <xref depth="4" refnumber="17-27a-507(5)(d)(iii)(A)" start="0">(5)(d)(iii)(A)</xref> and <xref depth="4" refnumber="17-27a-507(5)(d)(iii)(B)" start="0">(B)</xref>.</subsection></subsection><subsection ssid="10-null-45" dnum="iv-o" numlevel="1" lineno="239" slineno="2-99" level="3"><display>(iv)</display>A member of the panel assembled by the county under Subsection <xref depth="4" refnumber="17-27a-507(5)(d)(ii)" start="0">(5)(d)(ii)</xref> may <ln numlevel="1" lineno="240" slineno="2-100"/>not have an interest in the application that is the subject of the appeal.</subsection><subsection ssid="10-null-46" dnum="v-o" numlevel="1" lineno="241" slineno="2-101" level="3"><display>(v)</display>The land use applicant shall pay:<subsection ssid="10-null-47" dnum="A-o" numlevel="1" lineno="242" slineno="2-102" level="4"><display>(A)</display>50% of the cost of the panel; and</subsection><subsection ssid="10-null-48" dnum="B-o" numlevel="1" lineno="243" slineno="2-103" level="4"><display>(B)</display>the county's published appeal fee.</subsection></subsection><subsection ssid="10-null-49" dnum="vi-o" numlevel="1" lineno="244" slineno="2-104" level="3"><display>(vi)</display>The decision of the panel is a final decision, subject to a petition for review under <ln numlevel="1" lineno="245" slineno="2-105"/>Subsection <xref depth="4" refnumber="17-27a-507(5)(d)(vii)" start="0">(5)(d)(vii)</xref>.</subsection><subsection ssid="10-null-50" dnum="vii-o" numlevel="1" lineno="246" slineno="2-106" level="3"><display>(vii)</display>In accordance with Section <xref depth="3" refnumber="17-79-1009">17-79-1009</xref>, a land use applicant or the county may <ln numlevel="1" lineno="247" slineno="2-107"/>file a petition for review of the decision with the district court within 30 days after <ln numlevel="1" lineno="248" slineno="2-108"/>the date that the decision is final.</subsection></subsection></subsection></section></bsec><bsec buid="12" num="17B-1-120" type="amend" src="code" uid="C17B-1-S120_2026050620260506" sort="17B01 01200020260506" numlevel="1" lineno="249" slineno="3-1" sn="3"><section number="17B-1-120" numlevel="1" lineno="250" slineno="3-2" type="amend"><secline lineno="249">Section 3. Section <bold>17B-1-120</bold> is amended to read:</secline><catline lineno="250"><bold>17B-1-120<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Exactions -- Exaction for water interest -- <ln numlevel="1" lineno="251" slineno="3-3"/>Requirement to offer to original owner property acquired by exaction.</bold></catline><subsection ssid="12-null-1" dnum="1-o" numlevel="1" lineno="252" slineno="3-4" level="1" placement="noreturn"><display>(1)</display>A special district may impose an exaction on a service received by an applicant, <ln numlevel="1" lineno="253" slineno="3-5"/>including, subject to Subsection <xref depth="4" refnumber="17B-1-120(2)" start="0">(2)</xref>, an exaction for a water interest if:<subsection ssid="12-null-2" dnum="a-o" numlevel="1" lineno="254" slineno="3-6" level="2"><display>(a)</display>the special district establishes that a legitimate special district interest makes the <ln numlevel="1" lineno="255" slineno="3-7"/>exaction essential; and</subsection><subsection ssid="12-null-3" dnum="b-o" numlevel="1" lineno="256" slineno="3-8" level="2"><display>(b)</display>the exaction is roughly proportionate, both in nature and extent, to the impact of the <ln numlevel="1" lineno="257" slineno="3-9"/>proposed service on the special district.</subsection></subsection><subsection ssid="12-null-4" dnum="2-o" numlevel="1" lineno="258" slineno="3-10" level="1" space="false"><display>(2)</display><subsection ssid="12-null-5" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="12-null-6" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>Subject to the requirements of this Subsection <xref depth="4" refnumber="17B-1-120(2)" start="0">(2)</xref>, a special district shall <ln numlevel="1" lineno="259" slineno="3-11"/>base an exaction for a water interest on the culinary water authority's established <ln numlevel="1" lineno="260" slineno="3-12"/>calculations of projected water interest requirements.</subsection><subsection ssid="12-null-7" dnum="ii-o" numlevel="1" lineno="261" slineno="3-13" level="3" tab="1"><display>(ii)</display>Except as described in Subsection <xref depth="4" refnumber="17B-1-120(2)(a)(iii)" start="0">(2)(a)(iii)</xref>, a culinary water authority shall base <ln numlevel="1" lineno="262" slineno="3-14"/>an exaction for a culinary water interest on:<subsection ssid="12-null-8" dnum="A-o" numlevel="1" lineno="263" slineno="3-15" level="4"><display>(A)</display>consideration of the system-wide minimum sizing standards established for <ln numlevel="1" lineno="264" slineno="3-16"/>the culinary water authority by the Division of Drinking Water <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in <ln numlevel="1" lineno="265" slineno="3-17"/>accordance with</amend> Section <xref depth="3" refnumber="19-4-114" start="0">19-4-114</xref>; and</subsection><subsection ssid="12-null-9" dnum="B-o" numlevel="1" lineno="266" slineno="3-18" level="4"><display>(B)</display>the number of equivalent residential connections associated with the culinary <ln numlevel="1" lineno="267" slineno="3-19"/>water demand for each specific development proposed in the development's <ln numlevel="1" lineno="268" slineno="3-20"/>land use application, applying lower exactions for developments with lower <ln numlevel="1" lineno="269" slineno="3-21"/>equivalent residential connections as demonstrated by at least five years of <ln numlevel="1" lineno="270" slineno="3-22"/>usage data for like land uses within the special district.</subsection></subsection><subsection ssid="12-null-10" dnum="iii-o" numlevel="1" lineno="271" slineno="3-23" level="3" tab="1"><display>(iii)</display>A special district may impose an exaction for a culinary water interest that <ln numlevel="1" lineno="272" slineno="3-24"/>results in less water being exacted than would otherwise be exacted under <ln numlevel="1" lineno="273" slineno="3-25"/>Subsection <xref depth="4" refnumber="17B-1-120(2)(a)(ii)" start="0">(2)(a)(ii)</xref> if the special district, at the special district's sole discretion, <ln numlevel="1" lineno="274" slineno="3-26"/>determines there is good cause to do so.</subsection><subsection ssid="12-null-11" dnum="iv-o" numlevel="1" lineno="275" slineno="3-27" level="3" tab="1"><display>(iv)</display>A special district shall make public the methodology used to comply with <ln numlevel="1" lineno="276" slineno="3-28"/>Subsection <xref depth="4" refnumber="17B-1-120(2)(a)(ii)(B)" start="0">(2)(a)(ii)(B)</xref>. A service applicant may appeal to the special district's <ln numlevel="1" lineno="277" slineno="3-29"/>governing body an exaction calculation used by the special district under <ln numlevel="1" lineno="278" slineno="3-30"/>Subsection <xref depth="4" refnumber="17B-1-120(2)(a)(ii)" start="0">(2)(a)(ii)</xref>. A service applicant may present data and other information <ln numlevel="1" lineno="279" slineno="3-31"/>that illustrates a need for an exaction recalculation and the special district's <ln numlevel="1" lineno="280" slineno="3-32"/>governing body shall respond with due process.</subsection><subsection ssid="12-null-12" dnum="v-o" numlevel="1" lineno="281" slineno="3-33" level="3" tab="1"><display>(v)</display>If requested by a service applicant, the culinary authority shall provide the basis <ln numlevel="1" lineno="282" slineno="3-34"/>for the culinary water authority's calculations described in Subsection <xref depth="4" refnumber="17B-1-120(2)(a)(i)" start="0">(2)(a)(i)</xref>.</subsection></subsection><subsection ssid="12-null-13" dnum="b-o" numlevel="1" lineno="283" slineno="3-35" level="2" space="false"><display>(b)</display><subsection ssid="12-20" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>A special district may not impose an exaction for a water interest if<amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="12-18" dnum="_-o:A-i" numlevel="1" lineno="284" slineno="3-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1" amendtag="both">(A)</amend></display>the culinary water authority's existing available water interests exceed the <ln numlevel="1" lineno="285" slineno="3-37"/>water interests needed to meet the reasonable future water requirement of the <ln numlevel="1" lineno="286" slineno="3-38"/>public<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">, as determined in accordance with Section <xref depth="3" refnumber="73-1-4" start="0">73-1-4</xref>.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="12-22" dnum="_-o:B-i" numlevel="1" lineno="287" slineno="3-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">the special district or the special district's culinary water authority does not <ln numlevel="1" lineno="288" slineno="3-40"/>have a written plan described in Subsection <xref depth="4" refnumber="17B-1-120(2)(b)(ii)">(2)(b)(ii)</xref>.</amend></subsection></subsection><subsection ssid="12-21" dnum="_-o:ii-i" numlevel="1" lineno="289" slineno="3-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning on January 1, 2027, a special district shall determine the special <ln numlevel="1" lineno="290" slineno="3-42"/>district's water interests needed to meet the reasonable future water requirement of <ln numlevel="1" lineno="291" slineno="3-43"/>the public by completing a written plan described in Subsection <xref depth="4" refnumber="73-1-4(2)(f)">73-1-4(2)(f)</xref>.</amend></subsection></subsection></subsection><subsection ssid="12-null-14" dnum="3-o" numlevel="1" lineno="292" slineno="3-44" level="1" space="false"><display>(3)</display><subsection ssid="12-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a special district plans to dispose of surplus real property that was acquired <ln numlevel="1" lineno="293" slineno="3-45"/>under this section and has been owned by the special district for less than 15 years, <ln numlevel="1" lineno="294" slineno="3-46"/>the special district shall offer to reconvey the surplus real property, without receiving <ln numlevel="1" lineno="295" slineno="3-47"/>additional consideration, first to a person who granted the real property to the special <ln numlevel="1" lineno="296" slineno="3-48"/>district.</subsection><subsection ssid="12-null-16" dnum="b-o" numlevel="1" lineno="297" slineno="3-49" level="2"><display>(b)</display>The person described in Subsection <xref depth="4" refnumber="17B-1-120(3)(a)" start="0">(3)(a)</xref> shall, within 90 days after the day on <ln numlevel="1" lineno="298" slineno="3-50"/>which a special district makes an offer under Subsection <xref depth="4" refnumber="17B-1-120(3)(a)" start="0">(3)(a)</xref>, accept or reject the <ln numlevel="1" lineno="299" slineno="3-51"/>offer.</subsection><subsection ssid="12-null-17" dnum="c-o" numlevel="1" lineno="300" slineno="3-52" level="2"><display>(c)</display>If a person rejects an offer under Subsection <xref depth="4" refnumber="17B-1-120(3)(b)" start="0">(3)(b)</xref>, the special district may sell the <ln numlevel="1" lineno="301" slineno="3-53"/>real property.</subsection></subsection></section></bsec><bsec buid="4" num="73-1-4" type="amend" src="code" uid="C73-1-S4_2026050620260506" sort="73 01 00040020260506" numlevel="1" lineno="302" slineno="4-1" sn="4"><section number="73-1-4" numlevel="1" lineno="303" slineno="4-2" type="amend"><secline lineno="302">Section 4. Section <bold>73-1-4</bold> is amended to read:</secline><catline lineno="303"><bold>73-1-4<parens><paren sort="00" type="original" show="true" display="space"><effect>Effective </effect><date>05/06/26</date></paren><paren sort="00" type="original" show="true"><effect>Partially Repealed </effect><date>12/31/30</date></paren></parens>. Reversion to the public <ln numlevel="1" lineno="304" slineno="4-3"/>by abandonment or forfeiture for nonuse within seven years -- Saved water -- Nonuse <ln numlevel="1" lineno="305" slineno="4-4"/>application.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="306" slineno="4-5" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="4-null-2" dnum="a-o" numlevel="1" lineno="307" slineno="4-6" level="2"><display>(a)</display>"Public entity" means:<subsection ssid="4-null-3" dnum="i-o" numlevel="1" lineno="308" slineno="4-7" level="3"><display>(i)</display>the United States;</subsection><subsection ssid="4-null-4" dnum="ii-o" numlevel="1" lineno="309" slineno="4-8" level="3"><display>(ii)</display>an agency of the United States;</subsection><subsection ssid="4-null-5" dnum="iii-o" numlevel="1" lineno="310" slineno="4-9" level="3"><display>(iii)</display>the state;</subsection><subsection ssid="4-null-6" dnum="iv-o" numlevel="1" lineno="311" slineno="4-10" level="3"><display>(iv)</display>a state agency;</subsection><subsection ssid="4-null-7" dnum="v-o" numlevel="1" lineno="312" slineno="4-11" level="3"><display>(v)</display>a political subdivision of the state; or</subsection><subsection ssid="4-null-8" dnum="vi-o" numlevel="1" lineno="313" slineno="4-12" level="3"><display>(vi)</display>an agency of a political subdivision of the state.</subsection></subsection><subsection ssid="4-null-9" dnum="b-o" numlevel="1" lineno="314" slineno="4-13" level="2"><display>(b)</display>"Public water supplier" means an entity that:<subsection ssid="4-null-10" dnum="i-o" numlevel="1" lineno="315" slineno="4-14" level="3"><display>(i)</display>supplies water, directly or indirectly, to the public for municipal, domestic, or <ln numlevel="1" lineno="316" slineno="4-15"/>industrial use; and</subsection><subsection ssid="4-null-11" dnum="ii-o" numlevel="1" lineno="317" slineno="4-16" level="3"><display>(ii)</display>is:<subsection ssid="4-null-12" dnum="A-o" numlevel="1" lineno="318" slineno="4-17" level="4"><display>(A)</display>a public entity;</subsection><subsection ssid="4-null-13" dnum="B-o" numlevel="1" lineno="319" slineno="4-18" level="4"><display>(B)</display>a water corporation, as defined in Section <xref depth="3" refnumber="54-2-1">54-2-1</xref>, that is regulated by the <ln numlevel="1" lineno="320" slineno="4-19"/>Public Service Commission;</subsection><subsection ssid="4-null-14" dnum="C-o" numlevel="1" lineno="321" slineno="4-20" level="4"><display>(C)</display>a community water system:<subsection ssid="4-null-15" dnum="I-o" numlevel="1" lineno="322" slineno="4-21" level="5"><display>(I)</display>that:<subsection ssid="4-null-16" dnum="Aa-o" numlevel="1" lineno="323" slineno="4-22" level="6"><display>(Aa)</display>supplies water to at least 100 service connections used by year-round <ln numlevel="1" lineno="324" slineno="4-23"/>residents; or</subsection><subsection ssid="4-null-17" dnum="Bb-o" numlevel="1" lineno="325" slineno="4-24" level="6"><display>(Bb)</display>regularly serves at least 200 year-round residents; and</subsection></subsection><subsection ssid="4-null-18" dnum="II-o" numlevel="1" lineno="326" slineno="4-25" level="5"><display>(II)</display>whose voting members:<subsection ssid="4-null-19" dnum="Aa-o" numlevel="1" lineno="327" slineno="4-26" level="6"><display>(Aa)</display>own a share in the community water system;</subsection><subsection ssid="4-null-20" dnum="Bb-o" numlevel="1" lineno="328" slineno="4-27" level="6"><display>(Bb)</display>receive water from the community water system in proportion to the <ln numlevel="1" lineno="329" slineno="4-28"/>member's share in the community water system; and</subsection><subsection ssid="4-null-21" dnum="Cc-o" numlevel="1" lineno="330" slineno="4-29" level="6"><display>(Cc)</display>pay the rate set by the community water system based on the water the <ln numlevel="1" lineno="331" slineno="4-30"/>member receives; or</subsection></subsection></subsection><subsection ssid="4-null-22" dnum="D-o" numlevel="1" lineno="332" slineno="4-31" level="4"><display>(D)</display>a water users association:<subsection ssid="4-null-23" dnum="I-o" numlevel="1" lineno="333" slineno="4-32" level="5"><display>(I)</display>in which one or more public entities own at least 70% of the outstanding <ln numlevel="1" lineno="334" slineno="4-33"/>shares; and</subsection><subsection ssid="4-null-24" dnum="II-o" numlevel="1" lineno="335" slineno="4-34" level="5"><display>(II)</display>that is a local sponsor of a water project constructed by the United States <ln numlevel="1" lineno="336" slineno="4-35"/>Bureau of Reclamation.</subsection></subsection></subsection></subsection><subsection ssid="4-141" dnum="_-o:c-i" numlevel="1" lineno="337" slineno="4-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">"Qualified entity" mean a person authorized by statute to:</amend><subsection ssid="4-142" dnum="_-o:i-i" numlevel="1" lineno="338" slineno="4-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">acquire or lease water or water rights for the benefit of the Great Salt Lake;</amend></subsection><subsection ssid="4-143" dnum="_-o:ii-i" numlevel="1" lineno="339" slineno="4-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">manage sovereign lands, as that term is defined in Section <xref depth="3" refnumber="65A-1-1">65A-1-1</xref>; or</amend></subsection><subsection ssid="4-144" dnum="_-o:iii-i" numlevel="1" lineno="340" slineno="4-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">develop a management plan for the protection and development of the Colorado <ln numlevel="1" lineno="341" slineno="4-40"/>River system.</amend></subsection></subsection><subsection ssid="4-null-25" dnum="c-o:d-i" numlevel="1" lineno="342" slineno="4-41" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1161" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1162" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>"Saved water" means the same as that term is defined in Section <xref depth="3" refnumber="73-3-3">73-3-3</xref>.</subsection><subsection ssid="4-null-26" dnum="d-o:e-i" numlevel="1" lineno="343" slineno="4-42" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1162" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1163" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>"Shareholder" means the same as that term is defined in Section <xref depth="3" refnumber="73-3-3.5">73-3-3.5</xref>.</subsection><subsection ssid="4-null-27" dnum="e-o:f-i" numlevel="1" lineno="344" slineno="4-43" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1163" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1164" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>"Water company" means the same as that term is defined in Section <xref depth="3" refnumber="73-3-3.5">73-3-3.5</xref>.</subsection><subsection ssid="4-null-28" dnum="f-o:g-i" numlevel="1" lineno="345" slineno="4-44" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1164" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1165" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>"Water supply entity" means an entity that supplies water as a utility service or <ln numlevel="1" lineno="346" slineno="4-45"/>for irrigation purposes and is also:<subsection ssid="4-null-29" dnum="i-o" numlevel="1" lineno="347" slineno="4-46" level="3"><display>(i)</display>a municipality, water conservancy district, metropolitan water district, irrigation <ln numlevel="1" lineno="348" slineno="4-47"/>district, or other public agency;</subsection><subsection ssid="4-null-30" dnum="ii-o" numlevel="1" lineno="349" slineno="4-48" level="3"><display>(ii)</display>a water company regulated by the Public Service Commission; or</subsection><subsection ssid="4-null-31" dnum="iii-o" numlevel="1" lineno="350" slineno="4-49" level="3"><display>(iii)</display>any other owner of a community water system.</subsection></subsection></subsection><subsection ssid="4-null-32" dnum="2-o" numlevel="1" lineno="351" slineno="4-50" level="1" space="false"><display>(2)</display><subsection ssid="4-null-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="73-1-4(2)(b)">(2)(b)</xref> or <xref depth="4" refnumber="73-1-4(e)">(e)</xref>, when an appropriator or the <ln numlevel="1" lineno="352" slineno="4-51"/>appropriator's successor in interest abandons or ceases to beneficially use all or a <ln numlevel="1" lineno="353" slineno="4-52"/>portion of a water right for a period of at least seven years, the water right or the <ln numlevel="1" lineno="354" slineno="4-53"/>unused portion of that water right is subject to forfeiture in accordance with <ln numlevel="1" lineno="355" slineno="4-54"/>Subsection <xref depth="4" refnumber="73-1-4(2)(c)">(2)(c)</xref>.</subsection><subsection ssid="4-null-34" dnum="b-o" numlevel="1" lineno="356" slineno="4-55" level="2" space="false"><display>(b)</display><subsection ssid="4-null-35" dnum="i-o" level="3" placement="sameline"><display>(i)</display>An appropriator or the appropriator's successor in interest may file an <ln numlevel="1" lineno="357" slineno="4-56"/>application for nonuse with the state engineer.</subsection><subsection ssid="4-null-36" dnum="ii-o" numlevel="1" lineno="358" slineno="4-57" level="3"><display>(ii)</display>A nonuse application may be filed on all or a portion of the water right, including <ln numlevel="1" lineno="359" slineno="4-58"/>water rights held by a water company.</subsection><subsection ssid="4-null-37" dnum="iii-o" numlevel="1" lineno="360" slineno="4-59" level="3"><display>(iii)</display>After giving written notice to the water company, a shareholder may file a <ln numlevel="1" lineno="361" slineno="4-60"/>nonuse application with the state engineer on the water represented by the stock.</subsection><subsection ssid="4-null-38" dnum="iv-o" numlevel="1" lineno="362" slineno="4-61" level="3" space="false"><display>(iv)</display><subsection ssid="4-null-39" dnum="A-o" level="4" placement="sameline"><display>(A)</display>The approval of a nonuse application excuses the requirement of <ln numlevel="1" lineno="363" slineno="4-62"/>beneficial use of water from the date of filing.</subsection><subsection ssid="4-null-40" dnum="B-o" numlevel="1" lineno="364" slineno="4-63" level="4"><display>(B)</display>The time during which an approved nonuse application is in effect does not <ln numlevel="1" lineno="365" slineno="4-64"/>count toward the seven-year period described in Subsection <xref depth="4" refnumber="73-1-4(2)(a)">(2)(a)</xref>.</subsection></subsection><subsection ssid="4-null-41" dnum="v-o" numlevel="1" lineno="366" slineno="4-65" level="3"><display>(v)</display>The filing or approval of a nonuse application or a series of nonuse applications <ln numlevel="1" lineno="367" slineno="4-66"/>under Subsection <xref depth="4" refnumber="73-1-4(3)">(3)</xref> does not:<subsection ssid="4-null-42" dnum="A-o" numlevel="1" lineno="368" slineno="4-67" level="4"><display>(A)</display>constitute beneficial use of a water right;</subsection><subsection ssid="4-null-43" dnum="B-o" numlevel="1" lineno="369" slineno="4-68" level="4"><display>(B)</display>protect a water right that is already subject to forfeiture under this section; or</subsection><subsection ssid="4-null-44" dnum="C-o" numlevel="1" lineno="370" slineno="4-69" level="4"><display>(C)</display>bar a water right owner from:<subsection ssid="4-null-45" dnum="I-o" numlevel="1" lineno="371" slineno="4-70" level="5"><display>(I)</display>using the water under the water right as permitted under the water right; or</subsection><subsection ssid="4-null-46" dnum="II-o" numlevel="1" lineno="372" slineno="4-71" level="5"><display>(II)</display>claiming the benefit of Subsection <xref depth="4" refnumber="73-1-4(2)(e)">(2)(e)</xref> or any other forfeiture defense <ln numlevel="1" lineno="373" slineno="4-72"/>provided by law.</subsection></subsection></subsection></subsection><subsection ssid="4-null-47" dnum="c-o" numlevel="1" lineno="374" slineno="4-73" level="2" space="false"><display>(c)</display><subsection ssid="4-null-48" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="73-1-4(2)(c)(ii)">(2)(c)(ii)</xref>, a water right or a portion of the <ln numlevel="1" lineno="375" slineno="4-74"/>water right may not be forfeited unless a judicial action to declare the right <ln numlevel="1" lineno="376" slineno="4-75"/>forfeited is commenced:<subsection ssid="4-null-49" dnum="A-o" numlevel="1" lineno="377" slineno="4-76" level="4" tab="1"><display>(A)</display>within 15 years from the end of the latest period of nonuse of at least seven <ln numlevel="1" lineno="378" slineno="4-77"/>years; or</subsection><subsection ssid="4-null-50" dnum="B-o" numlevel="1" lineno="379" slineno="4-78" level="4" tab="1"><display>(B)</display>within the combined time of 15 years from the end of the most recent period <ln numlevel="1" lineno="380" slineno="4-79"/>of nonuse of at least seven years and the time the water right was subject to one <ln numlevel="1" lineno="381" slineno="4-80"/>or more nonuse applications.</subsection></subsection><subsection ssid="4-null-51" dnum="ii-o" numlevel="1" lineno="382" slineno="4-81" level="3" space="false"><display>(ii)</display><subsection ssid="4-null-52" dnum="A-o" level="4" placement="sameline"><display>(A)</display>The state engineer, in a proposed determination of rights filed with the <ln numlevel="1" lineno="383" slineno="4-82"/>court and prepared in accordance with Section <xref depth="3" refnumber="73-4-11">73-4-11</xref>, may not assert that a <ln numlevel="1" lineno="384" slineno="4-83"/>water right was forfeited unless the most recent period of nonuse of seven <ln numlevel="1" lineno="385" slineno="4-84"/>years ends or occurs:<subsection ssid="4-null-53" dnum="I-o" numlevel="1" lineno="386" slineno="4-85" level="5" tab="1"><display>(I)</display>during the 15 years immediately preceding the day on which the state <ln numlevel="1" lineno="387" slineno="4-86"/>engineer files the proposed determination of rights with the court; or</subsection><subsection ssid="4-null-54" dnum="II-o" numlevel="1" lineno="388" slineno="4-87" level="5" tab="1"><display>(II)</display>during the combined time immediately preceding the day on which the <ln numlevel="1" lineno="389" slineno="4-88"/>state engineer files the proposed determination of rights consisting of 15 <ln numlevel="1" lineno="390" slineno="4-89"/>years and the time the water right was subject to one or more approved <ln numlevel="1" lineno="391" slineno="4-90"/>nonuse applications.</subsection></subsection><subsection ssid="4-null-55" dnum="B-o" numlevel="1" lineno="392" slineno="4-91" level="4"><display>(B)</display>After the day on which a proposed determination of rights is filed with the <ln numlevel="1" lineno="393" slineno="4-92"/>court a person may not assert that a water right subject to that determination <ln numlevel="1" lineno="394" slineno="4-93"/>was forfeited before the issuance of the proposed determination, unless the <ln numlevel="1" lineno="395" slineno="4-94"/>state engineer asserts forfeiture in the proposed determination, or a person, in <ln numlevel="1" lineno="396" slineno="4-95"/>accordance with Section <xref depth="3" refnumber="73-4-11">73-4-11</xref>, makes an objection to the proposed <ln numlevel="1" lineno="397" slineno="4-96"/>determination that asserts forfeiture.</subsection></subsection><subsection ssid="4-null-56" dnum="iii-o" numlevel="1" lineno="398" slineno="4-97" level="3"><display>(iii)</display>A water right, found to be valid in a decree entered in an action for general <ln numlevel="1" lineno="399" slineno="4-98"/>determination of rights under Chapter 4, Determination of Water Rights, is subject <ln numlevel="1" lineno="400" slineno="4-99"/>to a claim of forfeiture based on a seven-year period of nonuse that begins after <ln numlevel="1" lineno="401" slineno="4-100"/>the day on which the state engineer filed the related proposed determination of <ln numlevel="1" lineno="402" slineno="4-101"/>rights with the court, unless the decree provides otherwise.</subsection><subsection ssid="4-null-57" dnum="iv-o" numlevel="1" lineno="403" slineno="4-102" level="3"><display>(iv)</display>If in a judicial action a court declares a water right forfeited, on the date on which <ln numlevel="1" lineno="404" slineno="4-103"/>the water right is forfeited:<subsection ssid="4-null-58" dnum="A-o" numlevel="1" lineno="405" slineno="4-104" level="4"><display>(A)</display>the right to beneficially use the water reverts to the public; and</subsection><subsection ssid="4-null-59" dnum="B-o" numlevel="1" lineno="406" slineno="4-105" level="4"><display>(B)</display>the water made available by the forfeiture:<subsection ssid="4-null-60" dnum="I-o" numlevel="1" lineno="407" slineno="4-106" level="5"><display>(I)</display>first, satisfies other water rights in the hydrologic system in order of priority <ln numlevel="1" lineno="408" slineno="4-107"/>date; and</subsection><subsection ssid="4-null-61" dnum="II-o" numlevel="1" lineno="409" slineno="4-108" level="5"><display>(II)</display>second, may be appropriated as provided in this title.</subsection></subsection></subsection></subsection><subsection ssid="4-null-62" dnum="d-o" numlevel="1" lineno="410" slineno="4-109" level="2"><display>(d)</display>Except as provided in Subsection <xref depth="4" refnumber="73-1-4(2)(e)">(2)(e)</xref>, this section applies whether the unused or <ln numlevel="1" lineno="411" slineno="4-110"/>abandoned water or a portion of the water is:<subsection ssid="4-null-63" dnum="i-o" numlevel="1" lineno="412" slineno="4-111" level="3"><display>(i)</display>permitted to run to waste; or</subsection><subsection ssid="4-null-64" dnum="ii-o" numlevel="1" lineno="413" slineno="4-112" level="3"><display>(ii)</display>beneficially used by others without right with the knowledge of the water right <ln numlevel="1" lineno="414" slineno="4-113"/>holder.</subsection></subsection><subsection ssid="4-null-65" dnum="e-o" numlevel="1" lineno="415" slineno="4-114" level="2"><display>(e)</display>This section does not apply to:<subsection ssid="4-null-66" dnum="i-o" numlevel="1" lineno="416" slineno="4-115" level="3"><display>(i)</display>the beneficial use of water according to a written, terminable lease or other <ln numlevel="1" lineno="417" slineno="4-116"/>agreement with the appropriator or the appropriator's successor in interest;</subsection><subsection ssid="4-null-67" dnum="ii-o" numlevel="1" lineno="418" slineno="4-117" level="3"><display>(ii)</display>a water right if its place of use is contracted under an approved state agreement or <ln numlevel="1" lineno="419" slineno="4-118"/>federal conservation fallowing program;</subsection><subsection ssid="4-null-68" dnum="iii-o" numlevel="1" lineno="420" slineno="4-119" level="3"><display>(iii)</display>those periods of time when a surface water or groundwater source fails to yield <ln numlevel="1" lineno="421" slineno="4-120"/>sufficient water to satisfy the water right;</subsection><subsection ssid="4-null-69" dnum="iv-o" numlevel="1" lineno="422" slineno="4-121" level="3"><display>(iv)</display>a water right when water is unavailable because of the water right's priority date;</subsection><subsection ssid="4-null-70" dnum="v-o" numlevel="1" lineno="423" slineno="4-122" level="3"><display>(v)</display>a water right to store water in a surface reservoir, or an aquifer in accordance with <ln numlevel="1" lineno="424" slineno="4-123"/>Chapter 3b, Groundwater Recharge and Recovery Act, if the water is stored for <ln numlevel="1" lineno="425" slineno="4-124"/>present or future beneficial use;</subsection><subsection ssid="4-null-71" dnum="vi-o" numlevel="1" lineno="426" slineno="4-125" level="3"><display>(vi)</display>a water right if a water user has beneficially used substantially all of the water <ln numlevel="1" lineno="427" slineno="4-126"/>right within a seven-year period, provided that this exemption does not apply to <ln numlevel="1" lineno="428" slineno="4-127"/>the adjudication of a water right in a general determination of water rights under <ln numlevel="1" lineno="429" slineno="4-128"/>Chapter <xref depth="1" refnumber="73-4">4</xref>, Determination of Water Rights;</subsection><subsection ssid="4-null-72" dnum="vii-o" numlevel="1" lineno="430" slineno="4-129" level="3"><display>(vii)</display>except as provided by Subsection <xref depth="4" refnumber="73-1-4(2)(g)">(2)(g)</xref>, a water right:<subsection ssid="4-null-73" dnum="A-o" numlevel="1" lineno="431" slineno="4-130" level="4" space="false"><display>(A)</display><subsection ssid="4-null-74" dnum="I-o" level="5" placement="sameline"><display>(I)</display>owned by a public water supplier;</subsection><subsection ssid="4-null-75" dnum="II-o" numlevel="1" lineno="432" slineno="4-131" level="5"><display>(II)</display>represented by a public water supplier's ownership interest in a water <ln numlevel="1" lineno="433" slineno="4-132"/>company; or</subsection><subsection ssid="4-null-76" dnum="III-o" numlevel="1" lineno="434" slineno="4-133" level="5"><display>(III)</display>to which a public water supplier owns the right of beneficial use; and</subsection></subsection><subsection ssid="4-null-77" dnum="B-o" numlevel="1" lineno="435" slineno="4-134" level="4"><display>(B)</display>conserved or held for the reasonable future water requirement of the public, <ln numlevel="1" lineno="436" slineno="4-135"/>which is determined according to Subsection <xref depth="4" refnumber="73-1-4(2)(f)">(2)(f)</xref>;</subsection></subsection><subsection ssid="4-null-78" dnum="viii-o" numlevel="1" lineno="437" slineno="4-136" level="3"><display>(viii)</display>a supplemental water right during a period of time when another water right <ln numlevel="1" lineno="438" slineno="4-137"/>available to the appropriator or the appropriator's successor in interest provides <ln numlevel="1" lineno="439" slineno="4-138"/>sufficient water so as to not require beneficial use of the supplemental water right;</subsection><subsection ssid="4-null-79" dnum="ix-o" numlevel="1" lineno="440" slineno="4-139" level="3"><display>(ix)</display>a period of nonuse of a water right during the time the water right is subject to an <ln numlevel="1" lineno="441" slineno="4-140"/>approved change application where the applicant is diligently pursuing <ln numlevel="1" lineno="442" slineno="4-141"/>certification;</subsection><subsection ssid="4-null-80" dnum="x-o" numlevel="1" lineno="443" slineno="4-142" level="3"><display>(x)</display>a water right to store water in a surface reservoir if:<subsection ssid="4-null-81" dnum="A-o" numlevel="1" lineno="444" slineno="4-143" level="4"><display>(A)</display>storage is limited by a safety, regulatory, or engineering restraint that the <ln numlevel="1" lineno="445" slineno="4-144"/>appropriator or the appropriator's successor in interest cannot reasonably <ln numlevel="1" lineno="446" slineno="4-145"/>correct; and</subsection><subsection ssid="4-null-82" dnum="B-o" numlevel="1" lineno="447" slineno="4-146" level="4"><display>(B)</display>not longer than seven years have elapsed since the limitation described in <ln numlevel="1" lineno="448" slineno="4-147"/>Subsection <xref depth="4" refnumber="73-1-4(2)(e)(x)(a)">(2)(e)(x)(A)</xref> is imposed; </subsection></subsection><subsection ssid="4-null-83" dnum="xi-o" numlevel="1" lineno="449" slineno="4-148" level="3"><display>(xi)</display>a water right subject to an approved change application for use within a water <ln numlevel="1" lineno="450" slineno="4-149"/>bank that has been authorized but not dissolved under Chapter 31, Water Banking <ln numlevel="1" lineno="451" slineno="4-150"/>Act, during the period of time the state engineer authorizes the water right to be <ln numlevel="1" lineno="452" slineno="4-151"/>used within the water bank; or</subsection><subsection ssid="4-null-84" dnum="xii-o" numlevel="1" lineno="453" slineno="4-152" level="3"><display>(xii)</display>subject to Subsection <xref depth="4" refnumber="73-1-4(2)(h)">(2)(h)</xref>, that portion of a water right that is quantified as <ln numlevel="1" lineno="454" slineno="4-153"/>saved water in a final order from the state engineer approving a change <ln numlevel="1" lineno="455" slineno="4-154"/>application, but not to exceed the amount subsequently verified by the state <ln numlevel="1" lineno="456" slineno="4-155"/>engineer in a certificate issued under Section <xref depth="3" refnumber="73-3-17">73-3-17</xref>.</subsection></subsection><subsection ssid="4-null-85" dnum="f-o" numlevel="1" lineno="457" slineno="4-156" level="2" space="false"><display>(f)</display><subsection ssid="4-null-86" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The reasonable future water requirement of the public is the amount of water <ln numlevel="1" lineno="458" slineno="4-157"/>needed in the next 40 years by:<subsection ssid="4-null-87" dnum="A-o" numlevel="1" lineno="459" slineno="4-158" level="4" tab="1"><display>(A)</display>the persons within the public water supplier's reasonably anticipated service <ln numlevel="1" lineno="460" slineno="4-159"/>area based on reasonably anticipated population growth; or</subsection><subsection ssid="4-null-88" dnum="B-o" numlevel="1" lineno="461" slineno="4-160" level="4" tab="1"><display>(B)</display>other water use demand.</subsection></subsection><subsection ssid="4-null-89" dnum="ii-o" numlevel="1" lineno="462" slineno="4-161" level="3"><display>(ii)</display>For purposes of Subsection <xref depth="4" refnumber="73-1-4(2)(f)(i)">(2)(f)(i)</xref>, a community water system's reasonably <ln numlevel="1" lineno="463" slineno="4-162"/>anticipated service area:<subsection ssid="4-null-90" dnum="A-o" numlevel="1" lineno="464" slineno="4-163" level="4"><display>(A)</display>is the area served by the community water system's distribution facilities; and</subsection><subsection ssid="4-null-91" dnum="B-o" numlevel="1" lineno="465" slineno="4-164" level="4"><display>(B)</display>expands as the community water system expands the distribution facilities in <ln numlevel="1" lineno="466" slineno="4-165"/>accordance with Title 19, Chapter 4, Safe Drinking Water Act.</subsection></subsection><subsection ssid="4-null-92" dnum="iii-o:_-i" numlevel="1" lineno="467" slineno="4-166" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1228" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="124" groupid="92" style="2" owner="jchristopherson" level="1" deltag="end">The state engineer shall by rule made in accordance with Subsection <xref depth="3" refnumber="73-2-1">73-2-1</xref>(4) <ln numlevel="1" lineno="468" slineno="4-167"/>establish standards for a written plan that may be presented as evidence in <ln numlevel="1" lineno="469" slineno="4-168"/>conformance with this Subsection (2)(f), except that before a rule establishing <ln numlevel="1" lineno="470" slineno="4-169"/>standards for a written plan under this Subsection (2)(f) takes effect, in addition to <ln numlevel="1" lineno="471" slineno="4-170"/>complying with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="472" slineno="4-171"/>state engineer shall present the rule to:</amend><amendoutend style="2"/><subsection ssid="4-null-93" dnum="A-o:_-i" numlevel="1" lineno="473" slineno="4-172" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1229" style="2" owner="o" level="1" deltag="start">(A)</amend></display><amend anum="0" ea="erase" pairid="127" groupid="95" style="2" owner="jchristopherson" level="1" deltag="end">if the Legislature is not in session, the Natural Resources, Agriculture, and <ln numlevel="1" lineno="474" slineno="4-173"/>Environment Interim Committee; or</amend><amendoutend style="2"/></subsection><subsection ssid="4-null-94" dnum="B-o:_-i" numlevel="1" lineno="475" slineno="4-174" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1230" style="2" owner="o" level="1" deltag="start">(B)</amend></display><amend anum="0" ea="erase" pairid="128" groupid="96" style="2" owner="jchristopherson" level="1" deltag="end">if the Legislature is in session, the House of Representatives and Senate <ln numlevel="1" lineno="476" slineno="4-175"/>Natural Resources, Agriculture, and Environment standing committees.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="4-157" dnum="_-o:iii-i" numlevel="1" lineno="477" slineno="4-176" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1231" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="end">In accordance with Subsection <xref depth="4" refnumber="73-2-1(4)">73-2-1(4)</xref> and Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="478" slineno="4-177"/>Administrative Rulemaking Act, the state engineer shall make rules to establish <ln numlevel="1" lineno="479" slineno="4-178"/>standards for a written plan under this Subsection <xref depth="4" refnumber="73-1-4(2)(f)">(2)(f)</xref> that:</amend><subsection ssid="4-169" dnum="_-o:A-i" numlevel="1" lineno="480" slineno="4-179" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1232" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="166" groupid="123" style="1" owner="jchristopherson" level="1" amendtag="end">determines the reasonable future water requirement of the public for a public <ln numlevel="1" lineno="481" slineno="4-180"/>water supplier; and</amend></subsection><subsection ssid="4-168" dnum="_-o:B-i" numlevel="1" lineno="482" slineno="4-181" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1233" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="165" groupid="122" style="1" owner="jchristopherson" level="1" amendtag="end">a public water supplier shall complete to demonstrate compliance with this <ln numlevel="1" lineno="483" slineno="4-182"/>Subsection <xref depth="4" refnumber="73-1-4(2)(f)">(2)(f)</xref>.</amend></subsection></subsection><subsection ssid="4-162" dnum="_-o:iv-i" numlevel="1" lineno="484" slineno="4-183" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1234" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="132" groupid="99" style="1" owner="jchristopherson" level="1" amendtag="end">The state engineer shall present rules developed under Subsection <xref depth="4" refnumber="73-1-4(2)(f)(iii)">(2)(f)(iii)</xref>, <ln numlevel="1" lineno="485" slineno="4-184"/>before the rules take effect, to:</amend><subsection ssid="4-164" dnum="_-o:A-i" numlevel="1" lineno="486" slineno="4-185" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1235" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="141" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">if the Legislature is not in session, the Natural Resources, Agriculture, and <ln numlevel="1" lineno="487" slineno="4-186"/>Environment Interim Committee; or</amend></subsection><subsection ssid="4-165" dnum="_-o:B-i" numlevel="1" lineno="488" slineno="4-187" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1236" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="144" groupid="108" style="1" owner="jchristopherson" level="1" amendtag="end">if the Legislature is in session, the House and Senate Natural Resources, <ln numlevel="1" lineno="489" slineno="4-188"/>Agriculture, and Environment standing committees.</amend></subsection></subsection><subsection ssid="4-136" dnum="_-o:v-i" numlevel="1" lineno="490" slineno="4-189" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1237" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="0" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">The rules that the state engineer makes to establish standards for a written plan in <ln numlevel="1" lineno="491" slineno="4-190"/>accordance with Subsection <xref depth="4" refnumber="73-1-4(2)(f)(iii)">(2)(f)(iii)</xref> shall include a standard for determining:</amend><subsection ssid="4-146" dnum="_-o:A-i" numlevel="1" lineno="492" slineno="4-191" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1238" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">a population estimate, including current population and anticipated population <ln numlevel="1" lineno="493" slineno="4-192"/>growth;</amend></subsection><subsection ssid="4-148" dnum="_-o:B-i" numlevel="1" lineno="494" slineno="4-193" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1239" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="79" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">an impact of current and future drought conditions;</amend></subsection><subsection ssid="4-154" dnum="_-o:C-i" numlevel="1" lineno="495" slineno="4-194" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1240" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">an anticipated loss of a water source due to a natural disaster, including an <ln numlevel="1" lineno="496" slineno="4-195"/>earthquake or a change in climate;</amend></subsection><subsection ssid="4-155" dnum="_-o:D-i" numlevel="1" lineno="497" slineno="4-196" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1241" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="93" groupid="71" style="1" owner="jchristopherson" level="1" amendtag="end">an impact of a water conservation activity described in a public water <ln numlevel="1" lineno="498" slineno="4-197"/>supplier's water conservation plan described in Section <xref depth="3" refnumber="73-10-32">73-10-32</xref>;</amend></subsection><subsection ssid="4-153" dnum="_-o:E-i" numlevel="1" lineno="499" slineno="4-198" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1242" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">the amount of water a public water supplier needs per capita; and</amend></subsection><subsection ssid="4-156" dnum="_-o:F-i" numlevel="1" lineno="500" slineno="4-199" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1243" style="1" owner="i" level="1" amendtag="start">(F)</amend></display><amend anum="0" ea="amend" pairid="99" groupid="76" style="1" owner="jchristopherson" level="1" amendtag="end">any other factor relevant to establishing the reasonable future water <ln numlevel="1" lineno="501" slineno="4-200"/>requirement of the public for a public water supplier.</amend></subsection></subsection></subsection><subsection ssid="4-null-95" dnum="g-o" numlevel="1" lineno="502" slineno="4-201" level="2"><display>(g)</display>For a water right acquired by a public water supplier on or after May 5, 2008, <ln numlevel="1" lineno="503" slineno="4-202"/>Subsection <xref depth="4" refnumber="73-1-4(2)(e)(vii)">(2)(e)(vii)</xref> applies if:<subsection ssid="4-null-96" dnum="i-o" numlevel="1" lineno="504" slineno="4-203" level="3"><display>(i)</display>the public water supplier submits a change application under Section <xref depth="3" refnumber="73-3-3">73-3-3</xref>; and</subsection><subsection ssid="4-null-97" dnum="ii-o" numlevel="1" lineno="505" slineno="4-204" level="3"><display>(ii)</display>the state engineer approves the change application.</subsection></subsection><subsection ssid="4-null-98" dnum="h-o" numlevel="1" lineno="506" slineno="4-205" level="2"><display>(h)</display>Saved water does not retain the protection of Subsection <xref depth="4" refnumber="73-1-4(2)(e)(xii)">(2)(e)(xii)</xref> and any period of <ln numlevel="1" lineno="507" slineno="4-206"/>nonuse for saved water begins to run the day on which:<subsection ssid="4-null-99" dnum="i-o" numlevel="1" lineno="508" slineno="4-207" level="3"><display>(i)</display>the underlying water right that serves as the basis for the saved water is declared <ln numlevel="1" lineno="509" slineno="4-208"/>by court decree to have been lost due to forfeiture under this section; or</subsection><subsection ssid="4-null-100" dnum="ii-o" numlevel="1" lineno="510" slineno="4-209" level="3"><display>(ii)</display>the title of a right to saved water segregated under Section <xref depth="3" refnumber="73-3-27">73-3-27</xref> is conveyed <ln numlevel="1" lineno="511" slineno="4-210"/>independent of the underlying water right.</subsection></subsection></subsection><subsection ssid="4-null-101" dnum="3-o" numlevel="1" lineno="512" slineno="4-211" level="1" space="false"><display>(3)</display><subsection ssid="4-null-102" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state engineer shall furnish a nonuse application form requiring the following <ln numlevel="1" lineno="513" slineno="4-212"/>information:<subsection ssid="4-null-103" dnum="i-o" numlevel="1" lineno="514" slineno="4-213" level="3" tab="1"><display>(i)</display>the name and address of the applicant;</subsection><subsection ssid="4-null-104" dnum="ii-o" numlevel="1" lineno="515" slineno="4-214" level="3" tab="1"><display>(ii)</display>a description of the water right or a portion of the water right, including the point <ln numlevel="1" lineno="516" slineno="4-215"/>of diversion, place of use, and priority;</subsection><subsection ssid="4-null-105" dnum="iii-o" numlevel="1" lineno="517" slineno="4-216" level="3" tab="1"><display>(iii)</display>the quantity of water;</subsection><subsection ssid="4-null-106" dnum="iv-o" numlevel="1" lineno="518" slineno="4-217" level="3" tab="1"><display>(iv)</display>the period of use;</subsection><subsection ssid="4-null-107" dnum="v-o" numlevel="1" lineno="519" slineno="4-218" level="3" tab="1"><display>(v)</display>the extension of time applied for;</subsection><subsection ssid="4-null-108" dnum="vi-o" numlevel="1" lineno="520" slineno="4-219" level="3" tab="1"><display>(vi)</display>a statement of the reason for the nonuse of the water; and</subsection><subsection ssid="4-null-109" dnum="vii-o" numlevel="1" lineno="521" slineno="4-220" level="3" tab="1"><display>(vii)</display>any other information that the state engineer requires.</subsection></subsection><subsection ssid="4-null-110" dnum="b-o" numlevel="1" lineno="522" slineno="4-221" level="2" space="false"><display>(b)</display><subsection ssid="4-null-111" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Upon receipt of the application, the state engineer shall publish a notice of the <ln numlevel="1" lineno="523" slineno="4-222"/>application once a week for two successive weeks:<subsection ssid="4-null-112" dnum="A-o" numlevel="1" lineno="524" slineno="4-223" level="4" tab="1"><display>(A)</display>in a newspaper of general circulation in the county in which the source of the <ln numlevel="1" lineno="525" slineno="4-224"/>water supply is located and where the water is to be beneficially used; and</subsection><subsection ssid="4-null-113" dnum="B-o" numlevel="1" lineno="526" slineno="4-225" level="4" tab="1"><display>(B)</display>as required in Section <xref depth="3" refnumber="45-1-101">45-1-101</xref>.</subsection></subsection><subsection ssid="4-null-114" dnum="ii-o" numlevel="1" lineno="527" slineno="4-226" level="3"><display>(ii)</display>The notice shall:<subsection ssid="4-null-115" dnum="A-o" numlevel="1" lineno="528" slineno="4-227" level="4"><display>(A)</display>state that an application has been made; and</subsection><subsection ssid="4-null-116" dnum="B-o" numlevel="1" lineno="529" slineno="4-228" level="4"><display>(B)</display>specify where the interested party may obtain additional information relating <ln numlevel="1" lineno="530" slineno="4-229"/>to the application.</subsection></subsection></subsection><subsection ssid="4-null-117" dnum="c-o" numlevel="1" lineno="531" slineno="4-230" level="2"><display>(c)</display>An interested person may file a written protest with the state engineer against the <ln numlevel="1" lineno="532" slineno="4-231"/>granting of the application:<subsection ssid="4-null-118" dnum="i-o" numlevel="1" lineno="533" slineno="4-232" level="3"><display>(i)</display>within 20 days after the notice is published, if the adjudicative proceeding is <ln numlevel="1" lineno="534" slineno="4-233"/>informal; and</subsection><subsection ssid="4-null-119" dnum="ii-o" numlevel="1" lineno="535" slineno="4-234" level="3"><display>(ii)</display>within 30 days after the notice is published, if the adjudicative proceeding is <ln numlevel="1" lineno="536" slineno="4-235"/>formal.</subsection></subsection><subsection ssid="4-null-120" dnum="d-o" numlevel="1" lineno="537" slineno="4-236" level="2"><display>(d)</display>In a proceeding to determine whether the nonuse application should be approved or <ln numlevel="1" lineno="538" slineno="4-237"/>rejected, the state engineer shall follow Title 63G, Chapter 4, Administrative <ln numlevel="1" lineno="539" slineno="4-238"/>Procedures Act.</subsection><subsection ssid="4-null-121" dnum="e-o" numlevel="1" lineno="540" slineno="4-239" level="2"><display>(e)</display>After further investigation, the state engineer may approve or reject the application.</subsection></subsection><subsection ssid="4-null-122" dnum="4-o" numlevel="1" lineno="541" slineno="4-240" level="1" space="false"><display>(4)</display><subsection ssid="4-null-123" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state engineer shall grant a nonuse application on all or a portion of a water <ln numlevel="1" lineno="542" slineno="4-241"/>right for a period of time not exceeding seven years if the applicant shows a <ln numlevel="1" lineno="543" slineno="4-242"/>reasonable cause for nonuse.</subsection><subsection ssid="4-null-124" dnum="b-o" numlevel="1" lineno="544" slineno="4-243" level="2"><display>(b)</display>A reasonable cause for nonuse includes:<subsection ssid="4-null-125" dnum="i-o" numlevel="1" lineno="545" slineno="4-244" level="3"><display>(i)</display>a demonstrable financial hardship or economic depression;</subsection><subsection ssid="4-null-126" dnum="ii-o" numlevel="1" lineno="546" slineno="4-245" level="3"><display>(ii)</display>a physical cause or change that renders use beyond the reasonable control of the <ln numlevel="1" lineno="547" slineno="4-246"/>water right owner so long as the water right owner acts with reasonable diligence <ln numlevel="1" lineno="548" slineno="4-247"/>to resume or restore the use;</subsection><subsection ssid="4-null-127" dnum="iii-o" numlevel="1" lineno="549" slineno="4-248" level="3"><display>(iii)</display>the initiation of water conservation or an efficiency practice, or the operation of a <ln numlevel="1" lineno="550" slineno="4-249"/>groundwater recharge recovery program approved by the state engineer;</subsection><subsection ssid="4-null-128" dnum="iv-o" numlevel="1" lineno="551" slineno="4-250" level="3"><display>(iv)</display>operation of a legal proceeding;</subsection><subsection ssid="4-null-129" dnum="v-o" numlevel="1" lineno="552" slineno="4-251" level="3"><display>(v)</display>the holding of a water right or stock in a mutual water company without use by a <ln numlevel="1" lineno="553" slineno="4-252"/>water supply entity to meet the reasonable future requirements of the public;</subsection><subsection ssid="4-null-130" dnum="vi-o" numlevel="1" lineno="554" slineno="4-253" level="3"><display>(vi)</display>situations where, in the opinion of the state engineer, the nonuse would assist in <ln numlevel="1" lineno="555" slineno="4-254"/>implementing an existing, approved water management plan;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both"> or</amend><amendoutend style="2"/></subsection><subsection ssid="4-null-131" dnum="vii-o" numlevel="1" lineno="556" slineno="4-255" level="3"><display>(vii)</display>the loss of capacity caused by deterioration of the water supply or delivery <ln numlevel="1" lineno="557" slineno="4-256"/>equipment if the applicant submits, with the application, a specific plan to resume <ln numlevel="1" lineno="558" slineno="4-257"/>full use of the water right by replacing, restoring, or improving the equipment<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; <ln numlevel="1" lineno="559" slineno="4-258"/>or</amend></subsection><subsection ssid="4-137" dnum="_-o:viii-i" numlevel="1" lineno="560" slineno="4-259" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1281" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">the non-diversion of water under a water right if the water right is leased by, <ln numlevel="1" lineno="561" slineno="4-260"/>under agreement with, or acknowledged in writing by a qualified entity for the <ln numlevel="1" lineno="562" slineno="4-261"/>purpose of:</amend><subsection ssid="4-138" dnum="_-o:A-i" numlevel="1" lineno="563" slineno="4-262" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1282" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">benefiting the Great Salt Lake; or</amend></subsection><subsection ssid="4-139" dnum="_-o:B-i" numlevel="1" lineno="564" slineno="4-263" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1283" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">complying with an interstate water compact ratified by the state.</amend></subsection></subsection></subsection></subsection><subsection ssid="4-null-132" dnum="5-o" numlevel="1" lineno="565" slineno="4-264" level="1" space="false"><display>(5)</display><subsection ssid="4-null-133" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Sixty days before the expiration of a nonuse application, the state engineer shall <ln numlevel="1" lineno="566" slineno="4-265"/>notify the applicant by mail or by a form of electronic communication through which <ln numlevel="1" lineno="567" slineno="4-266"/>receipt is verifiable, of the date when the nonuse application will expire.</subsection><subsection ssid="4-null-134" dnum="b-o" numlevel="1" lineno="568" slineno="4-267" level="2"><display>(b)</display>An applicant may file a subsequent nonuse application in accordance with this <ln numlevel="1" lineno="569" slineno="4-268"/>section.</subsection></subsection></section></bsec><bsec buid="13" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="570" slineno="5-1" sn="5"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="570">Section 5.  <bold>Effective Date.</bold></secline><sectionText lineno="571"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-30-26 11:29 AM</tm></rev></foot></leg>
