Section <bold>53F-2-423</bold> is amended to read:</secline><catline lineno="32"><bold>53F-2-423<parens/>. School meal program.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="33" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="6-null-2" dnum="a-o" numlevel="1" lineno="34" slineno="1-4" level="2"><display>(a)</display>"Education model health and wellness policy on nutrition" means state board policy <ln numlevel="1" lineno="35" slineno="1-5"/>emphasizing that an LEA promote efficient meal scheduling, provide adequate time <ln numlevel="1" lineno="36" slineno="1-6"/>for eating, and implement practices that help reduce food waste.</subsection><subsection ssid="6-null-3" dnum="b-o" numlevel="1" lineno="37" slineno="1-7" level="2"><display>(b)</display>"Eligible student" means a student enrolled in kindergarten through grade 12 who <ln numlevel="1" lineno="38" slineno="1-8"/>qualifies for reduced-price meals based on household size and income levels under <ln numlevel="1" lineno="39" slineno="1-9"/>the National School Lunch Program.</subsection><subsection ssid="6-null-4" dnum="c-o" numlevel="1" lineno="40" slineno="1-10" level="2"><display>(c)</display>"National School Lunch Program" means the same as that term is defined in 7 C.F.R. <ln numlevel="1" lineno="41" slineno="1-11"/>Sec. 210.2.</subsection><subsection ssid="6-null-5" dnum="d-o" numlevel="1" lineno="42" slineno="1-12" level="2"><display>(d)</display>"Share table program" means a system in a school where a student may return <ln numlevel="1" lineno="43" slineno="1-13"/>unopened, uneaten food or beverages to a designated location for redistribution to <ln numlevel="1" lineno="44" slineno="1-14"/>other students.</subsection></subsection><subsection ssid="6-null-6" dnum="2-o" numlevel="1" lineno="45" slineno="1-15" level="1"><display>(2)</display>An LEA participating in the National School Lunch Program shall provide lunch to an <ln numlevel="1" lineno="46" slineno="1-16"/>eligible student on a school day at no charge.</subsection><subsection ssid="6-null-7" dnum="3-o" numlevel="1" lineno="47" slineno="1-17" level="1"><display>(3)</display>The state board:<subsection ssid="6-null-8" dnum="a-o" numlevel="1" lineno="48" slineno="1-18" level="2"><display>(a)</display>shall:<subsection ssid="6-null-9" dnum="i-o" numlevel="1" lineno="49" slineno="1-19" level="3"><display>(i)</display>subject to legislative appropriations, reimburse an LEA for each reimbursable <ln numlevel="1" lineno="50" slineno="1-20"/>lunch provided under this section in an amount equal to the difference between the <ln numlevel="1" lineno="51" slineno="1-21"/>federal reimbursement rates for a meal and a reduced-price meal, as determined <ln numlevel="1" lineno="52" slineno="1-22"/>annually by the United States Department of Agriculture;</subsection><subsection ssid="6-null-10" dnum="ii-o" numlevel="1" lineno="53" slineno="1-23" level="3"><display>(ii)</display>establish a reimbursement system where the board provides a monthly <ln numlevel="1" lineno="54" slineno="1-24"/>reimbursement to an LEA that provides a meal under Subsection <xref refnumber="53F-2-422(2)" depth="4">(2)</xref>; and</subsection><subsection ssid="6-null-11" dnum="iii-o" numlevel="1" lineno="55" slineno="1-25" level="3"><display>(iii)</display>accept private donations and grants for the purpose of funding the school meal <ln numlevel="1" lineno="56" slineno="1-26"/>program described in this section; and</subsection></subsection><subsection ssid="6-null-12" dnum="b-o" numlevel="1" lineno="57" slineno="1-27" level="2"><display>(b)</display>may provide guidance and support to a school implementing the food waste <ln numlevel="1" lineno="58" slineno="1-28"/>prevention strategies described in Subsection <xref refnumber="53F-2-422(6)" depth="4">(6)</xref>.</subsection></subsection><subsection ssid="6-null-13" dnum="4-o" numlevel="1" lineno="59" slineno="1-29" level="1"><display>(4)</display>An LEA may not:<subsection ssid="6-null-14" dnum="a-o" numlevel="1" lineno="60" slineno="1-30" level="2"><display>(a)</display>publicly identify or stigmatize a student unable to pay for a meal; or</subsection><subsection ssid="6-null-15" dnum="b-o" numlevel="1" lineno="61" slineno="1-31" level="2"><display>(b)</display>require a student to perform chores to pay for a meal unless the requirement applies <ln numlevel="1" lineno="62" slineno="1-32"/>equally to all students regardless of whether the student pays for the meal.</subsection></subsection><subsection ssid="6-null-16" dnum="5-o" numlevel="1" lineno="63" slineno="1-33" level="1"><display>(5)</display>An LEA shall direct communications regarding a student's meal debt only to the <ln numlevel="1" lineno="64" slineno="1-34"/>student's parent.</subsection><subsection ssid="6-null-17" dnum="6-o" numlevel="1" lineno="65" slineno="1-35" level="1"><display>(6)</display>An LEA participating in the National School Lunch Program shall consider, where <ln numlevel="1" lineno="66" slineno="1-36"/>feasible, reducing food waste by<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">:</amend><amendoutend style="2"/><subsection ssid="6-null-18" dnum="a-o:_-i" numlevel="1" lineno="67" slineno="1-37" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> </amend>following the education model health and wellness policy on nutrition<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">; and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">.</amend></subsection><subsection ssid="6-null-19" dnum="b-o:_-i" numlevel="1" lineno="68" slineno="1-38" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1018" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="7" groupid="5" style="2" owner="jchristopherson" level="1" deltag="end">establishing a share table program.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="6-23" dnum="_-o:7-i" numlevel="1" lineno="69" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA shall establish and implement a share table program at each school within the <ln numlevel="1" lineno="70" slineno="1-40"/>LEA's jurisdiction.</amend></subsection><subsection ssid="6-null-20" dnum="7-o:8-i" numlevel="1" lineno="71" slineno="1-41" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display><subsection ssid="6-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding Subsection <xref tempid="726" depth="4" refnumber="53F-2-422(3)(a)(i)">(3)(a)(i)</xref>, if appropriations are insufficient to <ln numlevel="1" lineno="72" slineno="1-42"/>fully reimburse each LEA for the cost of a reimbursable lunch described in this <ln numlevel="1" lineno="73" slineno="1-43"/>section, the state board shall distribute the available funds in the fourth quarter of the <ln numlevel="1" lineno="74" slineno="1-44"/>fiscal year to each LEA on a pro rata basis, not exceeding the available funds.</subsection><subsection ssid="6-null-22" dnum="b-o" numlevel="1" lineno="75" slineno="1-45" level="2"><display>(b)</display>An LEA may ask the parent of an eligible student to cover the remaining cost of a <ln numlevel="1" lineno="76" slineno="1-46"/>subsidized lunch under this section.</subsection></subsection></section></bsec><bsec buid="16" num="53G-7-1202" type="amend" src="code" uid="C53G-7-S1202_2026070120260701" sort="53G07 12020020260701" numlevel="1" lineno="77" slineno="2-1" sn="2"><section number="53G-7-1202" numlevel="1" lineno="78" slineno="2-2" type="amend"><secline lineno="77">Section 2. Section <bold>53G-7-1202</bold> is amended to read:</secline><catline lineno="78"><bold>53G-7-1202<parens/>. School community councils -- Duties -- Composition -- Election <ln numlevel="1" lineno="79" slineno="2-3"/>procedures and selection of members.</bold></catline><subsection ssid="16-null-1" dnum="1-o" numlevel="1" lineno="80" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="16-null-2" dnum="a-o" numlevel="1" lineno="81" slineno="2-5" level="2"><display>(a)</display>"Digital citizenship" means the norms of appropriate, responsible, and healthy <ln numlevel="1" lineno="82" slineno="2-6"/>behavior related to technology use, including digital literacy, ethics, etiquette, and <ln numlevel="1" lineno="83" slineno="2-7"/>security.</subsection><subsection ssid="16-null-3" dnum="b-o" numlevel="1" lineno="84" slineno="2-8" level="2"><display>(b)</display>"Educator" means the same as that term is defined in Section <xref depth="3" refnumber="53E-6-102">53E-6-102</xref>.</subsection><subsection ssid="16-null-4" dnum="c-o" numlevel="1" lineno="85" slineno="2-9" level="2" space="false"><display>(c)</display><subsection ssid="16-null-5" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Parent member" means a member of a school community council who is a <ln numlevel="1" lineno="86" slineno="2-10"/>parent of a student who:<subsection ssid="16-null-6" dnum="A-o" numlevel="1" lineno="87" slineno="2-11" level="4" tab="1"><display>(A)</display>is attending the school; or</subsection><subsection ssid="16-null-7" dnum="B-o" numlevel="1" lineno="88" slineno="2-12" level="4" tab="1"><display>(B)</display>will be enrolled at the school during the parent's term of office.</subsection></subsection><subsection ssid="16-null-8" dnum="ii-o" numlevel="1" lineno="89" slineno="2-13" level="3"><display>(ii)</display>"Parent member" may not include an educator who is employed at the school.</subsection></subsection><subsection ssid="16-null-9" dnum="d-o" numlevel="1" lineno="90" slineno="2-14" level="2"><display>(d)</display>"Safety principles" means safety principles that, when incorporated into programs <ln numlevel="1" lineno="91" slineno="2-15"/>and resources, impact academic achievement by strengthening a safe and wholesome <ln numlevel="1" lineno="92" slineno="2-16"/>learning environment, including continual efforts for safe technology utilization and <ln numlevel="1" lineno="93" slineno="2-17"/>digital citizenship.</subsection><subsection ssid="16-null-10" dnum="e-o" numlevel="1" lineno="94" slineno="2-18" level="2"><display>(e)</display>"School community council" means a council established at a district school in <ln numlevel="1" lineno="95" slineno="2-19"/>accordance with this section.</subsection><subsection ssid="16-null-11" dnum="f-o" numlevel="1" lineno="96" slineno="2-20" level="2"><display>(f)</display>"School employee member" means a member of a school community council who is <ln numlevel="1" lineno="97" slineno="2-21"/>a person employed at the school by the school or school district, including the <ln numlevel="1" lineno="98" slineno="2-22"/>principal.</subsection><subsection ssid="16-null-12" dnum="g-o" numlevel="1" lineno="99" slineno="2-23" level="2"><display>(g)</display>"School LAND Trust Program money" means money allocated to a school pursuant <ln numlevel="1" lineno="100" slineno="2-24"/>to Section <xref depth="3" refnumber="53F-2-404">53F-2-404</xref>.</subsection></subsection><subsection ssid="16-null-13" dnum="2-o" numlevel="1" lineno="101" slineno="2-25" level="1"><display>(2)</display>A district school, in consultation with the district school's local school board, shall <ln numlevel="1" lineno="102" slineno="2-26"/>establish a school community council at the school building level for the purpose of:<subsection ssid="16-null-14" dnum="a-o" numlevel="1" lineno="103" slineno="2-27" level="2"><display>(a)</display>involving parents of students in decision making at the school level;</subsection><subsection ssid="16-null-15" dnum="b-o" numlevel="1" lineno="104" slineno="2-28" level="2"><display>(b)</display>improving the education of students;</subsection><subsection ssid="16-null-16" dnum="c-o" numlevel="1" lineno="105" slineno="2-29" level="2"><display>(c)</display>prudently expending School LAND Trust Program money for the improvement of <ln numlevel="1" lineno="106" slineno="2-30"/>students' education through collaboration among parents, school employees, and the <ln numlevel="1" lineno="107" slineno="2-31"/>local school board; and</subsection><subsection ssid="16-null-17" dnum="d-o" numlevel="1" lineno="108" slineno="2-32" level="2"><display>(d)</display>increasing public awareness of:<subsection ssid="16-null-18" dnum="i-o" numlevel="1" lineno="109" slineno="2-33" level="3"><display>(i)</display>school trust lands and related land policies;</subsection><subsection ssid="16-null-19" dnum="ii-o" numlevel="1" lineno="110" slineno="2-34" level="3"><display>(ii)</display>management of the State School Fund established in Utah Constitution Article X, <ln numlevel="1" lineno="111" slineno="2-35"/>Section V; and</subsection><subsection ssid="16-null-20" dnum="iii-o" numlevel="1" lineno="112" slineno="2-36" level="3"><display>(iii)</display>educational excellence.</subsection></subsection></subsection><subsection ssid="16-null-21" dnum="3-o" numlevel="1" lineno="113" slineno="2-37" level="1" space="false"><display>(3)</display><subsection ssid="16-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (3)(b), a school community council shall:<subsection ssid="16-null-23" dnum="i-o" numlevel="1" lineno="114" slineno="2-38" level="3" tab="1"><display>(i)</display>create the School LAND Trust Program and LAND Trust plan in accordance with <ln numlevel="1" lineno="115" slineno="2-39"/>Section <xref depth="3" refnumber="53G-7-1206">53G-7-1206</xref>;</subsection><subsection ssid="16-102" dnum="_-o:ii-i" numlevel="1" lineno="116" slineno="2-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">hold a school lunch planning meeting in accordance with Section 53G-7-1207;</amend></subsection><subsection ssid="16-null-24" dnum="ii-o:iii-i" numlevel="1" lineno="117" slineno="2-41" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1047" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>advise and make recommendations to school and school district <ln numlevel="1" lineno="118" slineno="2-42"/>administrators and the local school board regarding:<subsection ssid="16-null-25" dnum="A-o" numlevel="1" lineno="119" slineno="2-43" level="4"><display>(A)</display>the school and its programs;</subsection><subsection ssid="16-null-26" dnum="B-o" numlevel="1" lineno="120" slineno="2-44" level="4"><display>(B)</display>school district programs;</subsection><subsection ssid="16-null-27" dnum="C-o" numlevel="1" lineno="121" slineno="2-45" level="4"><display>(C)</display>a child access routing plan in accordance with Section <xref depth="3" refnumber="53G-4-402">53G-4-402</xref>;</subsection><subsection ssid="16-null-28" dnum="D-o" numlevel="1" lineno="122" slineno="2-46" level="4"><display>(D)</display>safe technology utilization and digital citizenship; and</subsection><subsection ssid="16-null-29" dnum="E-o" numlevel="1" lineno="123" slineno="2-47" level="4"><display>(E)</display>other issues relating to the community environment for students;</subsection></subsection><subsection ssid="16-null-30" dnum="iii-o:iv-i" numlevel="1" lineno="124" slineno="2-48" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1053" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>provide for education and awareness on safe technology utilization and <ln numlevel="1" lineno="125" slineno="2-49"/>digital citizenship that empowers:<subsection ssid="16-null-31" dnum="A-o" numlevel="1" lineno="126" slineno="2-50" level="4"><display>(A)</display>a student to make smart media and online choices; and</subsection><subsection ssid="16-null-32" dnum="B-o" numlevel="1" lineno="127" slineno="2-51" level="4"><display>(B)</display>a parent to know how to discuss safe technology use with the parent's child;</subsection></subsection><subsection ssid="16-null-33" dnum="iv-o:v-i" numlevel="1" lineno="128" slineno="2-52" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1056" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="both" space="true">(v)</amend></display>partner with the school's principal and other administrators to ensure that <ln numlevel="1" lineno="129" slineno="2-53"/>adequate on and off campus Internet filtering is installed and consistently <ln numlevel="1" lineno="130" slineno="2-54"/>configured to prevent viewing of harmful content by students and school <ln numlevel="1" lineno="131" slineno="2-55"/>personnel, in accordance with local school board policy and Subsection <xref depth="3" refnumber="53G-7-216">53G-7-216</xref><ln numlevel="1" lineno="132" slineno="2-56"/>(3);</subsection><subsection ssid="16-null-34" dnum="v-o:vi-i" numlevel="1" lineno="133" slineno="2-57" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1057" style="2" owner="o" level="1" deltag="both">(v)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="both" space="true">(vi)</amend></display>in accordance with state board rule regarding school community council <ln numlevel="1" lineno="134" slineno="2-58"/>expenditures and funding limits:<subsection ssid="16-null-35" dnum="A-o" numlevel="1" lineno="135" slineno="2-59" level="4"><display>(A)</display>work with students, families, and educators to develop and incorporate safety <ln numlevel="1" lineno="136" slineno="2-60"/>principles at the school; and</subsection><subsection ssid="16-null-36" dnum="B-o" numlevel="1" lineno="137" slineno="2-61" level="4"><display>(B)</display>hold at least an annual discussion with the school's principal and district <ln numlevel="1" lineno="138" slineno="2-62"/>administrators regarding safety principles at the school and district level in <ln numlevel="1" lineno="139" slineno="2-63"/>order to coordinate the school community council's effort to develop and <ln numlevel="1" lineno="140" slineno="2-64"/>incorporate safety principles at the school; and</subsection></subsection><subsection ssid="16-null-37" dnum="vi-o:vii-i" numlevel="1" lineno="141" slineno="2-65" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1060" style="2" owner="o" level="1" deltag="both">(vi)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="both" space="true">(vii)</amend></display>provide input to the school's principal on a positive behaviors plan in <ln numlevel="1" lineno="142" slineno="2-66"/>accordance with Section <xref depth="3" refnumber="53G-10-407">53G-10-407</xref>.</subsection></subsection><subsection ssid="16-null-38" dnum="b-o" numlevel="1" lineno="143" slineno="2-67" level="2"><display>(b)</display>To fulfill the school community council's duties described in Subsections (3)(a)(iii) <ln numlevel="1" lineno="144" slineno="2-68"/>and (iv), a school community council may:<subsection ssid="16-null-39" dnum="i-o" numlevel="1" lineno="145" slineno="2-69" level="3"><display>(i)</display>partner with one or more non-profit organizations; or</subsection><subsection ssid="16-null-40" dnum="ii-o" numlevel="1" lineno="146" slineno="2-70" level="3"><display>(ii)</display>create a subcommittee.</subsection></subsection><subsection ssid="16-null-41" dnum="c-o" numlevel="1" lineno="147" slineno="2-71" level="2"><display>(c)</display>A school or school district administrator may not prohibit or discourage a school <ln numlevel="1" lineno="148" slineno="2-72"/>community council from discussing issues, or offering advice or recommendations, <ln numlevel="1" lineno="149" slineno="2-73"/>regarding the school and its programs, school district programs, the curriculum, or <ln numlevel="1" lineno="150" slineno="2-74"/>the community environment for students.</subsection></subsection><subsection ssid="16-null-42" dnum="4-o" numlevel="1" lineno="151" slineno="2-75" level="1" space="false"><display>(4)</display><subsection ssid="16-null-43" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (4)(e), each school community council shall <ln numlevel="1" lineno="152" slineno="2-76"/>consist of school employee members and parent members in accordance with this <ln numlevel="1" lineno="153" slineno="2-77"/>section.</subsection><subsection ssid="16-null-44" dnum="b-o" numlevel="1" lineno="154" slineno="2-78" level="2"><display>(b)</display>Except as provided in Subsection (4)(c) or (d):<subsection ssid="16-null-45" dnum="i-o" numlevel="1" lineno="155" slineno="2-79" level="3"><display>(i)</display>each school community council for a high school shall have six parent members <ln numlevel="1" lineno="156" slineno="2-80"/>and four school employee members, including the principal; and</subsection><subsection ssid="16-null-46" dnum="ii-o" numlevel="1" lineno="157" slineno="2-81" level="3"><display>(ii)</display>each school community council for a school other than a high school shall have <ln numlevel="1" lineno="158" slineno="2-82"/>four parent members and two school employee members, including the principal.</subsection></subsection><subsection ssid="16-null-47" dnum="c-o" numlevel="1" lineno="159" slineno="2-83" level="2"><display>(c)</display>A school community council may determine the size of the school community <ln numlevel="1" lineno="160" slineno="2-84"/>council by a majority vote of a quorum of the school community council provided <ln numlevel="1" lineno="161" slineno="2-85"/>that:<subsection ssid="16-null-48" dnum="i-o" numlevel="1" lineno="162" slineno="2-86" level="3"><display>(i)</display>the membership includes two or more parent members than the number of school <ln numlevel="1" lineno="163" slineno="2-87"/>employee members; and</subsection><subsection ssid="16-null-49" dnum="ii-o" numlevel="1" lineno="164" slineno="2-88" level="3"><display>(ii)</display>there are at least two school employee members on the school community council.</subsection></subsection><subsection ssid="16-null-50" dnum="d-o" numlevel="1" lineno="165" slineno="2-89" level="2" space="false"><display>(d)</display><subsection ssid="16-null-51" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The number of parent members of a school community council who are not <ln numlevel="1" lineno="166" slineno="2-90"/>educators employed by the school district shall exceed the number of parent <ln numlevel="1" lineno="167" slineno="2-91"/>members who are educators employed by the school district.</subsection><subsection ssid="16-null-52" dnum="ii-o" numlevel="1" lineno="168" slineno="2-92" level="3"><display>(ii)</display>If, after an election, the number of parent members who are not educators <ln numlevel="1" lineno="169" slineno="2-93"/>employed by the school district does not exceed the number of parent members <ln numlevel="1" lineno="170" slineno="2-94"/>who are educators employed by the school district, the parent members of the <ln numlevel="1" lineno="171" slineno="2-95"/>school community council shall appoint one or more parent members to the school <ln numlevel="1" lineno="172" slineno="2-96"/>community council so that the number of parent members who are not educators <ln numlevel="1" lineno="173" slineno="2-97"/>employed by the school district exceeds the number of parent members who are <ln numlevel="1" lineno="174" slineno="2-98"/>educators employed by the school district.</subsection></subsection><subsection ssid="16-null-53" dnum="e-o" numlevel="1" lineno="175" slineno="2-99" level="2"><display>(e)</display>The state board may make rules, in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="176" slineno="2-100"/>Administrative Rulemaking Act, governing a school community council when, under <ln numlevel="1" lineno="177" slineno="2-101"/>unique circumstances that the state board identifies, there are insufficient members to <ln numlevel="1" lineno="178" slineno="2-102"/>fill the positions described in this Subsection (4).</subsection></subsection><subsection ssid="16-null-54" dnum="5-o" numlevel="1" lineno="179" slineno="2-103" level="1" space="false"><display>(5)</display><subsection ssid="16-null-55" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (5)(f), a school employee member, other than <ln numlevel="1" lineno="180" slineno="2-104"/>the principal, shall be elected by secret ballot by a majority vote of the school <ln numlevel="1" lineno="181" slineno="2-105"/>employees and serve a two-year term.  The principal shall serve as an ex officio <ln numlevel="1" lineno="182" slineno="2-106"/>member with full voting privileges.</subsection><subsection ssid="16-null-56" dnum="b-o" numlevel="1" lineno="183" slineno="2-107" level="2" space="false"><display>(b)</display><subsection ssid="16-null-57" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection (5)(f), a parent member shall be elected by <ln numlevel="1" lineno="184" slineno="2-108"/>secret ballot at an election held at the school by a majority vote of those voting at <ln numlevel="1" lineno="185" slineno="2-109"/>the election and serve a two-year term.</subsection><subsection ssid="16-null-58" dnum="ii-o" numlevel="1" lineno="186" slineno="2-110" level="3" space="false"><display>(ii)</display><subsection ssid="16-null-59" dnum="A-o" level="4" placement="sameline"><display>(A)</display>Except as provided in Subsection (5)(b)(ii)(B), only a parent of a student <ln numlevel="1" lineno="187" slineno="2-111"/>attending the school may vote in, or run as a candidate in, the election under <ln numlevel="1" lineno="188" slineno="2-112"/>Subsection (5)(b)(i).</subsection><subsection ssid="16-null-60" dnum="B-o" numlevel="1" lineno="189" slineno="2-113" level="4"><display>(B)</display>If an election is held in the spring, a parent of a student who will be attending <ln numlevel="1" lineno="190" slineno="2-114"/>the school the following school year may vote in, and run as a candidate in, the <ln numlevel="1" lineno="191" slineno="2-115"/>election under Subsection (5)(b)(i).</subsection></subsection><subsection ssid="16-null-61" dnum="iii-o" numlevel="1" lineno="192" slineno="2-116" level="3"><display>(iii)</display>Any parent of a student who meets the qualifications of this section may file or <ln numlevel="1" lineno="193" slineno="2-117"/>declare the parent's candidacy for election to a school community council.</subsection><subsection ssid="16-null-62" dnum="iv-o" numlevel="1" lineno="194" slineno="2-118" level="3" space="false"><display>(iv)</display><subsection ssid="16-null-63" dnum="A-o" level="4" placement="sameline"><display>(A)</display>Subject to Subsections (5)(b)(iv)(B) and (5)(b)(iv)(C), a timeline for the <ln numlevel="1" lineno="195" slineno="2-119"/>election of parent members of a school community council shall be established <ln numlevel="1" lineno="196" slineno="2-120"/>by a local school board for the schools within the school district.</subsection><subsection ssid="16-null-64" dnum="B-o" numlevel="1" lineno="197" slineno="2-121" level="4"><display>(B)</display>An election for the parent members of a school community council shall be <ln numlevel="1" lineno="198" slineno="2-122"/>held near the beginning of the school year or held in the spring and completed <ln numlevel="1" lineno="199" slineno="2-123"/>before the last week of school.</subsection><subsection ssid="16-null-65" dnum="C-o" numlevel="1" lineno="200" slineno="2-124" level="4"><display>(C)</display>Each school shall establish a time period for the election of parent members of <ln numlevel="1" lineno="201" slineno="2-125"/>a school community council under Subsection (5)(b)(iv)(B) that is consistent <ln numlevel="1" lineno="202" slineno="2-126"/>for at least a four-year period.</subsection></subsection></subsection><subsection ssid="16-null-66" dnum="c-o" numlevel="1" lineno="203" slineno="2-127" level="2" space="false"><display>(c)</display><subsection ssid="16-null-67" dnum="i-o" level="3" placement="sameline"><display>(i)</display>At least 10 days before the date that voting commences for the elections held <ln numlevel="1" lineno="204" slineno="2-128"/>under Subsections (5)(a) and (5)(b), the principal of the school, or the principal's <ln numlevel="1" lineno="205" slineno="2-129"/>designee, shall provide notice to each school employee or parent of the <ln numlevel="1" lineno="206" slineno="2-130"/>opportunity to vote in, and run as a candidate in, an election under this Subsection <ln numlevel="1" lineno="207" slineno="2-131"/>(5).</subsection><subsection ssid="16-null-68" dnum="ii-o" numlevel="1" lineno="208" slineno="2-132" level="3"><display>(ii)</display>The notice shall include:<subsection ssid="16-null-69" dnum="A-o" numlevel="1" lineno="209" slineno="2-133" level="4"><display>(A)</display>the dates and times of the elections;</subsection><subsection ssid="16-null-70" dnum="B-o" numlevel="1" lineno="210" slineno="2-134" level="4"><display>(B)</display>a list of council positions that are up for election; and</subsection><subsection ssid="16-null-71" dnum="C-o" numlevel="1" lineno="211" slineno="2-135" level="4"><display>(C)</display>instructions for becoming a candidate for a community council position.</subsection></subsection><subsection ssid="16-null-72" dnum="iii-o" numlevel="1" lineno="212" slineno="2-136" level="3"><display>(iii)</display>The principal of the school, or the principal's designee, shall oversee the <ln numlevel="1" lineno="213" slineno="2-137"/>elections held under Subsections (5)(a) and (5)(b).</subsection><subsection ssid="16-null-73" dnum="iv-o" numlevel="1" lineno="214" slineno="2-138" level="3"><display>(iv)</display>Ballots cast in an election held under Subsection (5)(b) shall be deposited in a <ln numlevel="1" lineno="215" slineno="2-139"/>secure ballot box.</subsection></subsection><subsection ssid="16-null-74" dnum="d-o" numlevel="1" lineno="216" slineno="2-140" level="2"><display>(d)</display>Results of the elections held under Subsections (5)(a) and (5)(b) shall be made <ln numlevel="1" lineno="217" slineno="2-141"/>available to the public upon request.</subsection><subsection ssid="16-null-75" dnum="e-o" numlevel="1" lineno="218" slineno="2-142" level="2" space="false"><display>(e)</display><subsection ssid="16-null-76" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If a parent position on a school community council remains unfilled after an <ln numlevel="1" lineno="219" slineno="2-143"/>election is held, the other parent members of the council shall appoint a parent <ln numlevel="1" lineno="220" slineno="2-144"/>who meets the qualifications of this section to fill the position.</subsection><subsection ssid="16-null-77" dnum="ii-o" numlevel="1" lineno="221" slineno="2-145" level="3"><display>(ii)</display>If a school employee position on a school community council remains unfilled <ln numlevel="1" lineno="222" slineno="2-146"/>after an election is held, the other school employee members of the council shall <ln numlevel="1" lineno="223" slineno="2-147"/>appoint a school employee to fill the position.</subsection><subsection ssid="16-null-78" dnum="iii-o" numlevel="1" lineno="224" slineno="2-148" level="3"><display>(iii)</display>A member appointed to a school community council under Subsection (5)(e)(i) <ln numlevel="1" lineno="225" slineno="2-149"/>or (ii) shall serve a two-year term.</subsection></subsection><subsection ssid="16-null-79" dnum="f-o" numlevel="1" lineno="226" slineno="2-150" level="2" space="false"><display>(f)</display><subsection ssid="16-null-80" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the number of candidates who file for a parent position or school employee <ln numlevel="1" lineno="227" slineno="2-151"/>position on a school community council is less than or equal to the number of <ln numlevel="1" lineno="228" slineno="2-152"/>open positions, an election is not required.</subsection><subsection ssid="16-null-81" dnum="ii-o" numlevel="1" lineno="229" slineno="2-153" level="3"><display>(ii)</display>If an election is not held pursuant to Subsection (5)(f)(i) and a parent position <ln numlevel="1" lineno="230" slineno="2-154"/>remains unfilled, the other parent members of the council shall appoint a parent <ln numlevel="1" lineno="231" slineno="2-155"/>who meets the qualifications of this section to fill the position.</subsection><subsection ssid="16-null-82" dnum="iii-o" numlevel="1" lineno="232" slineno="2-156" level="3"><display>(iii)</display>If an election is not held pursuant to Subsection (5)(f)(i) and a school employee <ln numlevel="1" lineno="233" slineno="2-157"/>position remains unfilled, the other school employee members of the council shall <ln numlevel="1" lineno="234" slineno="2-158"/>appoint a school employee who meets the qualifications of this section to fill the <ln numlevel="1" lineno="235" slineno="2-159"/>position.</subsection></subsection><subsection ssid="16-null-83" dnum="g-o" numlevel="1" lineno="236" slineno="2-160" level="2"><display>(g)</display>The principal shall enter the names of the council members on the School LAND <ln numlevel="1" lineno="237" slineno="2-161"/>Trust website on or before October 20 of each year, pursuant to Section <xref depth="3" refnumber="53G-7-1203">53G-7-1203</xref>.</subsection><subsection ssid="16-null-84" dnum="h-o" numlevel="1" lineno="238" slineno="2-162" level="2"><display>(h)</display>Terms shall be staggered so that approximately half of the council members stand for <ln numlevel="1" lineno="239" slineno="2-163"/>election each year.</subsection><subsection ssid="16-null-85" dnum="i-o" numlevel="1" lineno="240" slineno="2-164" level="2"><display>(i)</display>A school community council member may serve successive terms provided the <ln numlevel="1" lineno="241" slineno="2-165"/>member continues to meet the definition of a parent member or school employee <ln numlevel="1" lineno="242" slineno="2-166"/>member as specified in Subsection (1).</subsection><subsection ssid="16-null-86" dnum="j-o" numlevel="1" lineno="243" slineno="2-167" level="2"><display>(j)</display>Each school community council shall elect:<subsection ssid="16-null-87" dnum="i-o" numlevel="1" lineno="244" slineno="2-168" level="3"><display>(i)</display>a chair from its parent members; and</subsection><subsection ssid="16-null-88" dnum="ii-o" numlevel="1" lineno="245" slineno="2-169" level="3"><display>(ii)</display>a vice chair from either its parent members or school employee members, <ln numlevel="1" lineno="246" slineno="2-170"/>excluding the principal.</subsection></subsection></subsection><subsection ssid="16-null-89" dnum="6-o" numlevel="1" lineno="247" slineno="2-171" level="1" space="false"><display>(6)</display><subsection ssid="16-null-90" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A school community council may create subcommittees or task forces to:<subsection ssid="16-null-91" dnum="i-o" numlevel="1" lineno="248" slineno="2-172" level="3" tab="1"><display>(i)</display>advise or make recommendations to the council; or</subsection><subsection ssid="16-null-92" dnum="ii-o" numlevel="1" lineno="249" slineno="2-173" level="3" tab="1"><display>(ii)</display>develop all or part of a plan listed in Subsection (3).</subsection></subsection><subsection ssid="16-null-93" dnum="b-o" numlevel="1" lineno="250" slineno="2-174" level="2"><display>(b)</display>Any plan or part of a plan developed by a subcommittee or task force shall be subject <ln numlevel="1" lineno="251" slineno="2-175"/>to the approval of the school community council.</subsection><subsection ssid="16-null-94" dnum="c-o" numlevel="1" lineno="252" slineno="2-176" level="2"><display>(c)</display>A school community council may appoint individuals who are not council members <ln numlevel="1" lineno="253" slineno="2-177"/>to serve on a subcommittee or task force, including parents, school employees, or <ln numlevel="1" lineno="254" slineno="2-178"/>other community members.</subsection></subsection><subsection ssid="16-null-95" dnum="7-o" numlevel="1" lineno="255" slineno="2-179" level="1" space="false"><display>(7)</display><subsection ssid="16-null-96" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A majority of the members of a school community council is a quorum for the <ln numlevel="1" lineno="256" slineno="2-180"/>transaction of business.</subsection><subsection ssid="16-null-97" dnum="b-o" numlevel="1" lineno="257" slineno="2-181" level="2"><display>(b)</display>The action of a majority of the members of a quorum is the action of the school <ln numlevel="1" lineno="258" slineno="2-182"/>community council.</subsection></subsection><subsection ssid="16-null-98" dnum="8-o" numlevel="1" lineno="259" slineno="2-183" level="1"><display>(8)</display>A local school board shall provide training for a school community council each year, <ln numlevel="1" lineno="260" slineno="2-184"/>including training:<subsection ssid="16-null-99" dnum="a-o" numlevel="1" lineno="261" slineno="2-185" level="2"><display>(a)</display>for the chair and vice chair about their responsibilities;</subsection><subsection ssid="16-null-100" dnum="b-o" numlevel="1" lineno="262" slineno="2-186" level="2"><display>(b)</display>on resources available on the School LAND Trust website; and</subsection><subsection ssid="16-null-101" dnum="c-o" numlevel="1" lineno="263" slineno="2-187" level="2"><display>(c)</display>on this part.</subsection></subsection></section></bsec><bsec buid="19" num="53G-7-1205" type="amend" src="code" uid="C53G-7-S1205_2026070120260701" sort="53G07 12050020260701" numlevel="1" lineno="264" slineno="3-1" sn="3"><section number="53G-7-1205" numlevel="1" lineno="265" slineno="3-2" type="amend"><secline lineno="264">Section 3. Section <bold>53G-7-1205</bold> is amended to read:</secline><catline lineno="265"><bold>53G-7-1205<parens/>. Charter trust land councils.</bold></catline><subsection ssid="19-null-1" dnum="1-o" numlevel="1" lineno="266" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "council" means a charter trust land council described in this <ln numlevel="1" lineno="267" slineno="3-4"/>section.</subsection><subsection ssid="19-null-2" dnum="2-o" numlevel="1" lineno="268" slineno="3-5" level="1"><display>(2)</display>To receive School LAND Trust Program funding as described in Sections <xref depth="3" refnumber="53F-2-404" start="0">53F-2-404</xref> <ln numlevel="1" lineno="269" slineno="3-6"/>and <xref depth="3" refnumber="53G-7-1206" start="0">53G-7-1206</xref>, a charter school governing board shall establish a charter trust land <ln numlevel="1" lineno="270" slineno="3-7"/>council, which shall prepare a plan for the use of School LAND Trust Program money <ln numlevel="1" lineno="271" slineno="3-8"/>that includes the elements described in Subsection <xref depth="4" refnumber="53G-7-1206(4)" start="0">53G-7-1206(4)</xref>.</subsection><subsection ssid="19-null-3" dnum="3-o" numlevel="1" lineno="272" slineno="3-9" level="1" space="false"><display>(3)</display><subsection ssid="19-null-4" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The membership of the council shall include parents or grandparents of students <ln numlevel="1" lineno="273" slineno="3-10"/>enrolled at the charter school and may include other members.</subsection><subsection ssid="19-null-5" dnum="b-o" numlevel="1" lineno="274" slineno="3-11" level="2"><display>(b)</display>The number of council members who are parents or grandparents of students <ln numlevel="1" lineno="275" slineno="3-12"/>enrolled at the charter school shall exceed all other members combined by at least <ln numlevel="1" lineno="276" slineno="3-13"/>two.</subsection></subsection><subsection ssid="19-null-6" dnum="4-o" numlevel="1" lineno="277" slineno="3-14" level="1"><display>(4)</display>A charter school governing board may serve as the charter school's council if the <ln numlevel="1" lineno="278" slineno="3-15"/>membership of the charter school governing board meets the requirements of Subsection <xref depth="4" refnumber="53G-7-1205(3)(b)" start="0"><ln numlevel="1" lineno="279" slineno="3-16"/>(3)(b)</xref>.</subsection><subsection ssid="19-null-7" dnum="5-o" numlevel="1" lineno="280" slineno="3-17" level="1" space="false"><display>(5)</display><subsection ssid="19-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="53G-7-1205(5)(b)" start="0">(5)(b)</xref>, council members who are parents or <ln numlevel="1" lineno="281" slineno="3-18"/>grandparents of students enrolled at the school shall be elected in accordance with <ln numlevel="1" lineno="282" slineno="3-19"/>procedures established by the charter school governing board.</subsection><subsection ssid="19-null-9" dnum="b-o" numlevel="1" lineno="283" slineno="3-20" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="53G-7-1205(5)(a)" start="0">(5)(a)</xref> does not apply to a charter school governing board that serves as a <ln numlevel="1" lineno="284" slineno="3-21"/>council.</subsection></subsection><subsection ssid="19-null-10" dnum="6-o" numlevel="1" lineno="285" slineno="3-22" level="1"><display>(6)</display>A parent or grandparents of a student enrolled at a charter school shall serve as chair or <ln numlevel="1" lineno="286" slineno="3-23"/>co-chair of the charter school's council.</subsection><subsection ssid="19-null-11" dnum="7-o" numlevel="1" lineno="287" slineno="3-24" level="1"><display>(7)</display>In accordance with state board rule regarding charter trust land council expenditures and <ln numlevel="1" lineno="288" slineno="3-25"/>funding limits, a charter trust land council shall:<subsection ssid="19-null-12" dnum="a-o" numlevel="1" lineno="289" slineno="3-26" level="2"><display>(a)</display>work with students, families, and educators to develop and incorporate safety <ln numlevel="1" lineno="290" slineno="3-27"/>principles, as defined in Section <xref depth="3" refnumber="53G-7-1202" start="0">53G-7-1202</xref>, at the school; and</subsection><subsection ssid="19-null-13" dnum="b-o" numlevel="1" lineno="291" slineno="3-28" level="2"><display>(b)</display>hold at least an annual discussion with charter school administrators to coordinate <ln numlevel="1" lineno="292" slineno="3-29"/>efforts to develop and incorporate safety principles, as defined in Section <xref depth="3" refnumber="53G-7-1202" start="0">53G-7-1202</xref>, <ln numlevel="1" lineno="293" slineno="3-30"/>at the school level. </subsection></subsection><subsection ssid="19-null-14" dnum="8-o" numlevel="1" lineno="294" slineno="3-31" level="1"><display>(8)</display>A charter trust land council shall provide input to the school's principal on a positive <ln numlevel="1" lineno="295" slineno="3-32"/>behaviors plan in accordance with Section <xref depth="3" refnumber="53G-10-407" start="0">53G-10-407</xref>.</subsection><subsection ssid="19-16" dnum="_-o:9-i" numlevel="1" lineno="296" slineno="3-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">A charter trust land council shall hold a school lunch planning meeting in accordance <ln numlevel="1" lineno="297" slineno="3-34"/>with Section 53G-7-1207.</amend></subsection></section></bsec><bsec buid="13" num="53G-7-1207" type="enact" src="code" uid="C53G-7-S1207_2026070120260701" sort="53G07 12070020260701" numlevel="1" lineno="298" slineno="4-1" sn="4"><section numlevel="1" lineno="299" slineno="4-2" number="53G-7-1207" type="enact"><secline lineno="298">Section 4. Section <bold>53G-7-1207</bold> is enacted to read:</secline><catline lineno="299"><bold>53G-7-1207<parens/>. School lunch planning meeting -- Target goal.</bold></catline><subsection ssid="13-35" dnum="_-o:1-i" numlevel="1" lineno="300" slineno="4-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="108" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="13-50" dnum="_-o:a-i" numlevel="1" lineno="301" slineno="4-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="207" groupid="146" style="1" owner="jchristopherson" level="1" amendtag="end">"School" means a district or charter school that provides instruction to a student in <ln numlevel="1" lineno="302" slineno="4-5"/>kindergarten or grade 1, 2, 3, 4, 5, or 6.</amend></subsection><subsection ssid="13-48" dnum="_-o:b-i" numlevel="1" lineno="303" slineno="4-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="202" groupid="142" style="1" owner="jchristopherson" level="1" amendtag="end">"School lunch target goal" means a minimum standard that each elementary school <ln numlevel="1" lineno="304" slineno="4-7"/>seeks to achieve by:</amend><subsection ssid="13-43" dnum="_-o:i-i" numlevel="1" lineno="305" slineno="4-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="181" groupid="126" style="1" owner="jchristopherson" level="1" amendtag="end">providing a student with a minimum of 20 minutes of seated eating time to <ln numlevel="1" lineno="306" slineno="4-9"/>consume lunch; and</amend></subsection><subsection ssid="13-44" dnum="_-o:ii-i" numlevel="1" lineno="307" slineno="4-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="184" groupid="128" style="1" owner="jchristopherson" level="1" amendtag="end">scheduling lunch recess to occur immediately prior to the lunch period in the <ln numlevel="1" lineno="308" slineno="4-11"/>daily schedule.</amend></subsection></subsection></subsection><subsection ssid="13-34" dnum="_-o:2-i" numlevel="1" lineno="309" slineno="4-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="end">A school community council and a charter trust land council shall:</amend><subsection ssid="13-6" dnum="_-o:a-i" numlevel="1" lineno="310" slineno="4-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">hold a school lunch planning meeting to:</amend><subsection ssid="13-29" dnum="_-o:i-i" numlevel="1" lineno="311" slineno="4-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">review and discuss:</amend><subsection ssid="13-33" dnum="_-o:A-i" numlevel="1" lineno="312" slineno="4-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="144" groupid="103" style="1" owner="jchristopherson" level="1" amendtag="end">the state board's model policy on health and wellness;</amend></subsection><subsection ssid="13-32" dnum="_-o:B-i" numlevel="1" lineno="313" slineno="4-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1149" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="143" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">the research the state board provides in under Subsection (3), on recess <ln numlevel="1" lineno="314" slineno="4-17"/>schedules and student eating time; and</amend></subsection><subsection ssid="13-54" dnum="_-o:C-i" numlevel="1" lineno="315" slineno="4-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1150" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="229" groupid="160" style="1" owner="jchristopherson" level="1" amendtag="end">the survey results from the survey described in Subsection (c)(i);</amend></subsection></subsection><subsection ssid="13-52" dnum="_-o:ii-i" numlevel="1" lineno="316" slineno="4-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1151" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="214" groupid="151" style="1" owner="jchristopherson" level="1" amendtag="end">plan how each school can work toward achieving the school lunch target goal; and</amend></subsection><subsection ssid="13-3" dnum="_-o:iii-i" numlevel="1" lineno="317" slineno="4-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1152" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">create a plan for the school's lunch and recess times, including:</amend><subsection ssid="13-57" dnum="_-o:A-i" numlevel="1" lineno="318" slineno="4-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1153" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="247" groupid="172" style="1" owner="jchristopherson" level="1" amendtag="end">how much seated time a student will have to eat lunch; and</amend></subsection><subsection ssid="13-58" dnum="_-o:B-i" numlevel="1" lineno="319" slineno="4-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1154" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="252" groupid="176" style="1" owner="jchristopherson" level="1" amendtag="end">if midday recess will be before or after lunch;</amend></subsection></subsection></subsection><subsection ssid="13-5" dnum="_-o:b-i" numlevel="1" lineno="320" slineno="4-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">ensure that the meeting described in Subsection (2)(a):</amend><subsection ssid="13-14" dnum="_-o:i-i" numlevel="1" lineno="321" slineno="4-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="end">is open to members of the public; and</amend></subsection><subsection ssid="13-15" dnum="_-o:ii-i" numlevel="1" lineno="322" slineno="4-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">allows for public comment during the course of the meeting without the <ln numlevel="1" lineno="323" slineno="4-26"/>requirement that a member of the public sign up to speak before the meeting starts;</amend></subsection></subsection><subsection ssid="13-16" dnum="_-o:c-i" numlevel="1" lineno="324" slineno="4-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">at least one week in advance of the date on which the meeting is set to occur:</amend><subsection ssid="13-60" dnum="_-o:i-i" numlevel="1" lineno="325" slineno="4-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="258" groupid="181" style="1" owner="jchristopherson" level="1" amendtag="end">before holding the meeting described in Subsection (2)(a) instruct the principal of <ln numlevel="1" lineno="326" slineno="4-29"/>each school to send a survey to each parent of a student enrolled at the school <ln numlevel="1" lineno="327" slineno="4-30"/>through email to collect the parent's input on the:</amend><subsection ssid="13-62" dnum="_-o:A-i" numlevel="1" lineno="328" slineno="4-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="267" groupid="187" style="1" owner="jchristopherson" level="1" amendtag="end">school lunch target goal; and</amend></subsection><subsection ssid="13-63" dnum="_-o:B-i" numlevel="1" lineno="329" slineno="4-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1161" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="270" groupid="189" style="1" owner="jchristopherson" level="1" amendtag="end">school lunch plan the school community council plans to discuss in the <ln numlevel="1" lineno="330" slineno="4-33"/>meeting; and</amend></subsection></subsection><subsection ssid="13-59" dnum="_-o:ii-i" numlevel="1" lineno="331" slineno="4-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1162" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="257" groupid="180" style="1" owner="jchristopherson" level="1" amendtag="end">notify each parent of a student enrolled at the school of:</amend><subsection ssid="13-28" dnum="_-o:A-i" numlevel="1" lineno="332" slineno="4-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1163" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="126" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">the research that the school community council plans to review and discuss at <ln numlevel="1" lineno="333" slineno="4-36"/>the planning meeting, in accordance with Subsection (2)(a)(i);</amend></subsection><subsection ssid="13-17" dnum="_-o:B-i" numlevel="1" lineno="334" slineno="4-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1164" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">the meeting's time; and</amend></subsection><subsection ssid="13-18" dnum="_-o:C-i" numlevel="1" lineno="335" slineno="4-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1165" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">the meeting's location;</amend></subsection></subsection></subsection><subsection ssid="13-7" dnum="_-o:d-i" numlevel="1" lineno="336" slineno="4-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1166" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">hold the meeting described in Subsection (2)(a):</amend><subsection ssid="13-9" dnum="_-o:i-i" numlevel="1" lineno="337" slineno="4-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1167" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">once per year for five years; or</amend></subsection><subsection ssid="13-10" dnum="_-o:ii-i" numlevel="1" lineno="338" slineno="4-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1168" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">until the school community council's plan meets the school lunch target goal; and</amend></subsection></subsection><subsection ssid="13-13" dnum="_-o:e-i" numlevel="1" lineno="339" slineno="4-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1169" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="109" groupid="76" style="1" owner="jchristopherson" level="1" amendtag="end">after holding the meeting described in Subsection (2)(a) instruct the principal of each <ln numlevel="1" lineno="340" slineno="4-43"/>school to:</amend><subsection ssid="13-25" dnum="_-o:i-i" numlevel="1" lineno="341" slineno="4-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1170" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="end">send a signed, written assurance to the state board on the agreed upon plan <ln numlevel="1" lineno="342" slineno="4-45"/>discussed at the meeting; and</amend></subsection><subsection ssid="13-26" dnum="_-o:ii-i" numlevel="1" lineno="343" slineno="4-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1171" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="125" groupid="89" style="1" owner="jchristopherson" level="1" amendtag="end">if the school community council does not agree to work toward the school lunch <ln numlevel="1" lineno="344" slineno="4-47"/>target goal, provide a signed, written assurance to the state board detailing why <ln numlevel="1" lineno="345" slineno="4-48"/>the school community council failed to implement the school lunch target goal.</amend></subsection></subsection></subsection><subsection ssid="13-36" dnum="_-o:3-i" numlevel="1" lineno="346" slineno="4-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1172" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="158" groupid="110" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall:</amend><subsection ssid="13-37" dnum="_-o:a-i" numlevel="1" lineno="347" slineno="4-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1173" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="162" groupid="113" style="1" owner="jchristopherson" level="1" amendtag="end">research best practices in schools on:</amend><subsection ssid="13-38" dnum="_-o:i-i" numlevel="1" lineno="348" slineno="4-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1174" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="165" groupid="115" style="1" owner="jchristopherson" level="1" amendtag="end">recess scheduling; Recess in an elementary school.</bold></catline><subsection ssid="1-57" dnum="_-o:1-i" numlevel="1" lineno="354" slineno="5-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1177" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="270" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="1-58" dnum="_-o:a-i" numlevel="1" lineno="355" slineno="5-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1178" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="273" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">"Elementary school" means a district or charter school that provides instruction to a <ln numlevel="1" lineno="356" slineno="5-5"/>student in kindergarten or grade 1, 2, 3, 4, or 5.</amend></subsection><subsection ssid="1-59" dnum="_-o:b-i" numlevel="1" lineno="357" slineno="5-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1179" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="276" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">"Elementary school student" means the same as that term is defined in Section <ln numlevel="1" lineno="358" slineno="5-7"/>53G-7-501.</amend></subsection></subsection><subsection ssid="1-60" dnum="_-o:2-i" numlevel="1" lineno="359" slineno="5-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1180" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="279" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">An elementary school may not:</amend><subsection ssid="1-61" dnum="_-o:a-i" numlevel="1" lineno="360" slineno="5-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1181" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="282" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">withhold, from an elementary school student, recess, physical education, or other <ln numlevel="1" lineno="361" slineno="5-10"/>physical activity, as a punishment for:</amend><subsection ssid="1-62" dnum="_-o:i-i" numlevel="1" lineno="362" slineno="5-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1182" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="285" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">poor behavior;</amend></subsection><subsection ssid="1-63" dnum="_-o:ii-i" numlevel="1" lineno="363" slineno="5-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1183" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="288" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">incomplete classwork; or</amend></subsection><subsection ssid="1-64" dnum="_-o:iii-i" numlevel="1" lineno="364" slineno="5-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1184" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="291" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">remediation purposes; and</amend></subsection></subsection><subsection ssid="1-65" dnum="_-o:b-i" numlevel="1" lineno="365" slineno="5-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1185" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="294" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">reduce the total minutes of daily recess for any grade level to meet the school lunch <ln numlevel="1" lineno="366" slineno="5-15"/>target goal as that term is defined in Section 53G-7-1207.</amend></subsection></subsection><subsection ssid="1-66" dnum="_-o:3-i" numlevel="1" lineno="367" slineno="5-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1186" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="297" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding Subsection (2), an educator or administrator may withhold recess, <ln numlevel="1" lineno="368" slineno="5-17"/>physical education, or other physical activities from an elementary school student if:</amend><subsection ssid="1-67" dnum="_-o:a-i" numlevel="1" lineno="369" slineno="5-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1187" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="300" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">the restriction is consistent with the elementary student's:</amend><subsection ssid="1-68" dnum="_-o:i-i" numlevel="1" lineno="370" slineno="5-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1188" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="303" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">IEP<marker pairid="123"/>; or</amend></subsection><subsection ssid="1-69" dnum="_-o:ii-i" numlevel="1" lineno="371" slineno="5-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="306" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">Section 504 accommodation plan; or</amend></subsection></subsection><subsection ssid="1-70" dnum="_-o:b-i" numlevel="1" lineno="372" slineno="5-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="309" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">there is an immediate or significant risk to the health or safety of the elementary <ln numlevel="1" lineno="373" slineno="5-22"/>student or others.</amend></subsection></subsection></section></bsec><bsec buid="20" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="374" slineno="6-1" sn="6"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="374">Section 6.  <bold>Effective Date.</bold></secline><sectionText lineno="375"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="7/1/2026">July 1, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-12-26 3:26 PM</tm></rev></foot></leg>
