Section <bold>53F-2-301.1</bold> is enacted to read:</secline><catline lineno="43"><bold>53F-2-301.1<parens/>. Definitions.</bold></catline><sectionText lineno="44"><para/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">As used in this part: </amend></sectionText><subsection ssid="13-5" dnum="_-o:1-i" numlevel="1" lineno="45" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">"Services eligible for the self-contained WPU" means specialized instruction of 180 <ln numlevel="1" lineno="46" slineno="1-5"/>minutes or more per day provided to a student with a disability in accordance with the <ln numlevel="1" lineno="47" slineno="1-6"/>student's IEP.</amend></subsection><subsection ssid="13-8" dnum="_-o:2-i" numlevel="1" lineno="48" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">"Specialized instruction" means specially designed instruction and related services as <ln numlevel="1" lineno="49" slineno="1-8"/>defined by the state board in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="50" slineno="1-9"/>Rulemaking Act.</amend></subsection></section></bsec><bsec buid="2" num="53F-2-310" type="amend" src="code" uid="C53F-2-S310_2026070120260701" sort="53F02 03100020260701" numlevel="1" lineno="51" slineno="2-1" sn="2"><section number="53F-2-310" numlevel="1" lineno="52" slineno="2-2" type="amend"><secline lineno="51">Section 2. Section <bold>53F-2-310</bold> is amended to read:</secline><catline lineno="52"><bold>53F-2-310<parens/>. Stipends for special educators for additional days of work.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="53" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="54" slineno="2-4" level="2"><display>(a)</display>"Special education teacher" means a teacher whose primary assignment is the <ln numlevel="1" lineno="55" slineno="2-5"/>instruction of students with disabilities who are eligible for special education services.</subsection><subsection ssid="2-null-3" dnum="b-o" numlevel="1" lineno="56" slineno="2-6" level="2"><display>(b)</display>"Special educator" means a person employed by a school district, charter school, or <ln numlevel="1" lineno="57" slineno="2-7"/>the Utah Schools for the Deaf and the Blind who holds:<subsection ssid="2-null-4" dnum="i-o" numlevel="1" lineno="58" slineno="2-8" level="3"><display>(i)</display>a license issued by the state board; and</subsection><subsection ssid="2-null-5" dnum="ii-o" numlevel="1" lineno="59" slineno="2-9" level="3"><display>(ii)</display>a position as a:<subsection ssid="2-null-6" dnum="A-o" numlevel="1" lineno="60" slineno="2-10" level="4"><display>(A)</display>special education teacher;</subsection><subsection ssid="2-null-7" dnum="B-o" numlevel="1" lineno="61" slineno="2-11" level="4"><display>(B)</display>speech-language pathologist; or</subsection><subsection ssid="2-null-8" dnum="C-o" numlevel="1" lineno="62" slineno="2-12" level="4"><display>(C)</display>teacher of the deaf or hard of hearing<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">.</amend></subsection></subsection></subsection></subsection><subsection ssid="2-null-9" dnum="2-o" numlevel="1" lineno="63" slineno="2-13" level="1"><display>(2)</display>The Legislature shall annually appropriate money for stipends to special educators for <ln numlevel="1" lineno="64" slineno="2-14"/>additional days of work:<subsection ssid="2-null-10" dnum="a-o" numlevel="1" lineno="65" slineno="2-15" level="2"><display>(a)</display>in recognition of the added duties and responsibilities assumed by special educators <ln numlevel="1" lineno="66" slineno="2-16"/>to comply with federal law regulating the education of students with disabilities and <ln numlevel="1" lineno="67" slineno="2-17"/>the need to attract and retain qualified special educators; and</subsection><subsection ssid="2-null-11" dnum="b-o" numlevel="1" lineno="68" slineno="2-18" level="2"><display>(b)</display>subject to future budget constraints.</subsection></subsection><subsection ssid="2-null-12" dnum="3-o" numlevel="1" lineno="69" slineno="2-19" level="1" space="false"><display>(3)</display><subsection ssid="2-36" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="0" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall compute the number of weighted pupil units for stipends for <ln numlevel="1" lineno="70" slineno="2-20"/>special educators by dividing the total appropriation by the weighted pupil unit value.</amend></subsection><subsection ssid="2-null-13" dnum="a-o:b-i" numlevel="1" lineno="71" slineno="2-21" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>The state board shall distribute money appropriated under this section to school <ln numlevel="1" lineno="72" slineno="2-22"/>districts, charter schools, and the Utah Schools for the Deaf and the Blind for <ln numlevel="1" lineno="73" slineno="2-23"/>stipends for special educators in the amount of $200 per day for up to 10 additional <ln numlevel="1" lineno="74" slineno="2-24"/>working days.</subsection><subsection ssid="2-null-14" dnum="b-o:c-i" numlevel="1" lineno="75" slineno="2-25" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>Money distributed under this section shall include, in addition to the $200 per <ln numlevel="1" lineno="76" slineno="2-26"/>day stipend, money for the following employer-paid benefits:<subsection ssid="2-null-15" dnum="i-o" numlevel="1" lineno="77" slineno="2-27" level="3"><display>(i)</display>retirement;</subsection><subsection ssid="2-null-16" dnum="ii-o" numlevel="1" lineno="78" slineno="2-28" level="3"><display>(ii)</display>workers' compensation;</subsection><subsection ssid="2-null-17" dnum="iii-o" numlevel="1" lineno="79" slineno="2-29" level="3"><display>(iii)</display>Social Security; and</subsection><subsection ssid="2-null-18" dnum="iv-o" numlevel="1" lineno="80" slineno="2-30" level="3"><display>(iv)</display>Medicare.</subsection></subsection></subsection><subsection ssid="2-null-19" dnum="4-o" numlevel="1" lineno="81" slineno="2-31" level="1"><display>(4)</display>A special educator receiving a stipend shall:<subsection ssid="2-null-20" dnum="a-o" numlevel="1" lineno="82" slineno="2-32" level="2"><display>(a)</display>work an additional day beyond the number of days contracted with the special <ln numlevel="1" lineno="83" slineno="2-33"/>educator's school district or school for each daily stipend;</subsection><subsection ssid="2-null-21" dnum="b-o" numlevel="1" lineno="84" slineno="2-34" level="2"><display>(b)</display>schedule the additional days of work before or after the school year; and</subsection><subsection ssid="2-null-22" dnum="c-o" numlevel="1" lineno="85" slineno="2-35" level="2"><display>(c)</display>use the additional days of work to perform duties related to the IEP process, <ln numlevel="1" lineno="86" slineno="2-36"/>including:<subsection ssid="2-null-23" dnum="i-o" numlevel="1" lineno="87" slineno="2-37" level="3"><display>(i)</display>administering student assessments;</subsection><subsection ssid="2-null-24" dnum="ii-o" numlevel="1" lineno="88" slineno="2-38" level="3"><display>(ii)</display>conducting IEP meetings;</subsection><subsection ssid="2-null-25" dnum="iii-o" numlevel="1" lineno="89" slineno="2-39" level="3"><display>(iii)</display>writing IEPs;</subsection><subsection ssid="2-null-26" dnum="iv-o" numlevel="1" lineno="90" slineno="2-40" level="3"><display>(iv)</display>conferring with parents; and</subsection><subsection ssid="2-null-27" dnum="v-o" numlevel="1" lineno="91" slineno="2-41" level="3"><display>(v)</display>maintaining records and preparing reports.</subsection></subsection></subsection><subsection ssid="2-null-28" dnum="5-o" numlevel="1" lineno="92" slineno="2-42" level="1"><display>(5)</display>A special educator may:<subsection ssid="2-null-29" dnum="a-o" numlevel="1" lineno="93" slineno="2-43" level="2"><display>(a)</display>elect to receive a stipend for one to 10 days of additional work; or</subsection><subsection ssid="2-null-30" dnum="b-o" numlevel="1" lineno="94" slineno="2-44" level="2"><display>(b)</display>elect to not receive a stipend.</subsection></subsection><subsection ssid="2-null-31" dnum="6-o" numlevel="1" lineno="95" slineno="2-45" level="1"><display>(6)</display>A person who does not hold a full-time position as a special educator is eligible for a <ln numlevel="1" lineno="96" slineno="2-46"/>partial stipend equal to the percentage of a full-time special educator position the person <ln numlevel="1" lineno="97" slineno="2-47"/>assumes.</subsection></section></bsec><bsec buid="4" num="53F-2-317" type="enact" src="code" uid="C53F-2-S317_2026070120260701" sort="53F02 03170020260701" numlevel="1" lineno="98" slineno="3-1" sn="3"><section numlevel="1" lineno="99" slineno="3-2" number="53F-2-317" type="enact"><secline lineno="98">Section 3. Section <bold>53F-2-317</bold> is enacted to read:</secline><catline lineno="99"><bold>53F-2-317<parens/>. Special Education Self-Contained Program.</bold></catline><subsection ssid="4-1" dnum="_-o:1-i" numlevel="1" lineno="100" slineno="3-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to appropriation by the Legislature, the state board shall distribute money <ln numlevel="1" lineno="101" slineno="3-4"/>appropriated for the Special Education Self-Contained Program to an LEA to provide <ln numlevel="1" lineno="102" slineno="3-5"/>special education services to students with disabilities receiving services eligible for the <ln numlevel="1" lineno="103" slineno="3-6"/>self-contained WPU.</amend></subsection><subsection ssid="4-2" dnum="_-o:2-i" numlevel="1" lineno="104" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="4-3" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall compute the number of weighted pupil units for the Special <ln numlevel="1" lineno="105" slineno="3-8"/>Education Self-Contained Program by determining the number of students with <ln numlevel="1" lineno="106" slineno="3-9"/>disabilities receiving services eligible for the self-contained WPU enrolled in each <ln numlevel="1" lineno="107" slineno="3-10"/>LEA based on average daily membership from two years before the current fiscal <ln numlevel="1" lineno="108" slineno="3-11"/>year.</amend></subsection><subsection ssid="4-6" dnum="_-o:b-i" numlevel="1" lineno="109" slineno="3-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">Students with disabilities receiving services eligible for the self-contained WPU are <ln numlevel="1" lineno="110" slineno="3-13"/>not included in the calculation of weighted pupil units under Section <xref depth="3" refnumber="53F-2-302">53F-2-302</xref>.</amend></subsection></subsection><subsection ssid="4-7" dnum="_-o:3-i" numlevel="1" lineno="111" slineno="3-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA shall use money distributed under this section only for special education <ln numlevel="1" lineno="112" slineno="3-15"/>purposes and may not use the money to supplement other school programs.</amend></subsection><subsection ssid="4-8" dnum="_-o:4-i" numlevel="1" lineno="113" slineno="3-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="114" slineno="3-17"/>Administrative Rulemaking Act, to establish procedures for an LEA to:</amend><subsection ssid="4-9" dnum="_-o:a-i" numlevel="1" lineno="115" slineno="3-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">identify and report students with disabilities receiving services eligible for the <ln numlevel="1" lineno="116" slineno="3-19"/>self-contained WPU; and</amend></subsection><subsection ssid="4-10" dnum="_-o:b-i" numlevel="1" lineno="117" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">account for expenditures under this section.</amend></subsection></subsection></section></bsec><bsec buid="5" num="53F-2-318" type="enact" src="code" uid="C53F-2-S318_2026070120260701" sort="53F02 03180020260701" numlevel="1" lineno="118" slineno="4-1" sn="4"><section numlevel="1" lineno="119" slineno="4-2" number="53F-2-318" type="enact"><secline lineno="118">Section 4. Section <bold>53F-2-318</bold> is enacted to read:</secline><catline lineno="119"><bold>53F-2-318<parens/>. Special Education Self-Contained Support Add-on Program.</bold></catline><subsection ssid="5-1" dnum="_-o:1-i" numlevel="1" lineno="120" slineno="4-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to appropriation by the Legislature, the state board shall distribute money <ln numlevel="1" lineno="121" slineno="4-4"/>appropriated for the Special Education Self-Contained Support Add-on Program to an <ln numlevel="1" lineno="122" slineno="4-5"/>LEA to provide additional resources for students with significant disabilities.</amend></subsection><subsection ssid="5-2" dnum="_-o:2-i" numlevel="1" lineno="123" slineno="4-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="5-3" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall compute the number of weighted pupil units for the Special <ln numlevel="1" lineno="124" slineno="4-7"/>Education Self-Contained Support Add-on Program by:</amend><subsection ssid="5-4" dnum="_-o:i-i" numlevel="1" lineno="125" slineno="4-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">determining the number of students with disabilities receiving services eligible for <ln numlevel="1" lineno="126" slineno="4-9"/>the self-contained WPU enrolled in each LEA; and</amend></subsection><subsection ssid="5-5" dnum="_-o:ii-i" numlevel="1" lineno="127" slineno="4-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">multiplying the number determined under Subsection <xref depth="4" refnumber="53F-2-318(2)(a)(i)">(2)(a)(i)</xref> by 1.0 weighted <ln numlevel="1" lineno="128" slineno="4-11"/>pupil unit.</amend></subsection></subsection><subsection ssid="5-6" dnum="_-o:b-i" numlevel="1" lineno="129" slineno="4-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">A student with a disability receiving services eligible for the self-contained WPU <ln numlevel="1" lineno="130" slineno="4-13"/>qualifies for the add-on weighted pupil unit described in this section in addition to:</amend><subsection ssid="5-7" dnum="_-o:i-i" numlevel="1" lineno="131" slineno="4-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">the weighted pupil unit described in Section <xref depth="3" refnumber="53F-2-317">53F-2-317</xref>; and</amend></subsection><subsection ssid="5-8" dnum="_-o:ii-i" numlevel="1" lineno="132" slineno="4-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">the special education add-on weighted pupil unit described in Section <xref depth="3" refnumber="53F-2-307">53F-2-307</xref>.</amend></subsection></subsection></subsection><subsection ssid="5-9" dnum="_-o:3-i" numlevel="1" lineno="133" slineno="4-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="5-10" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA shall account for expenditures under this section as part of the LEA's <ln numlevel="1" lineno="134" slineno="4-17"/>special education program.</amend></subsection><subsection ssid="5-11" dnum="_-o:b-i" numlevel="1" lineno="135" slineno="4-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA may use up to 25% of the money distributed to the LEA under this section <ln numlevel="1" lineno="136" slineno="4-19"/>to support general education costs.</amend></subsection></subsection><subsection ssid="5-15" dnum="_-o:4-i" numlevel="1" lineno="137" slineno="4-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="138" slineno="4-21"/>Administrative Rulemaking Act, to establish procedures for an LEA to:</amend><subsection ssid="5-16" dnum="_-o:a-i" numlevel="1" lineno="139" slineno="4-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">identify and report students with disabilities receiving services eligible for the <ln numlevel="1" lineno="140" slineno="4-23"/>self-contained WPU; and</amend></subsection><subsection ssid="5-17" dnum="_-o:b-i" numlevel="1" lineno="141" slineno="4-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">account for expenditures under this section.</amend></subsection></subsection></section></bsec><bsec buid="6" num="53F-2-319" type="enact" src="code" uid="C53F-2-S319_2026070120260701" sort="53F02 03190020260701" numlevel="1" lineno="142" slineno="5-1" sn="5"><section numlevel="1" lineno="143" slineno="5-2" number="53F-2-319" type="enact"><secline lineno="142">Section 5. Section <bold>53F-2-319</bold> is enacted to read:</secline><catline lineno="143"><bold>53F-2-319<parens/>. Special Education Preschool Program.</bold></catline><subsection ssid="6-1" dnum="_-o:1-i" numlevel="1" lineno="144" slineno="5-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section, "preschool student with a disability" means a student who:</amend><subsection ssid="6-2" dnum="_-o:a-i" numlevel="1" lineno="145" slineno="5-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">is age three, four, or five years old;</amend></subsection><subsection ssid="6-3" dnum="_-o:b-i" numlevel="1" lineno="146" slineno="5-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">is not enrolled in kindergarten; and</amend></subsection><subsection ssid="6-4" dnum="_-o:c-i" numlevel="1" lineno="147" slineno="5-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">has an individualized education program.</amend></subsection></subsection><subsection ssid="6-5" dnum="_-o:2-i" numlevel="1" lineno="148" slineno="5-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="6-6" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to appropriation by the Legislature, the state board shall distribute money <ln numlevel="1" lineno="149" slineno="5-8"/>appropriated for the Special Education Preschool Program to an LEA to provide a <ln numlevel="1" lineno="150" slineno="5-9"/>free appropriate public education to preschool students with a disability, as required <ln numlevel="1" lineno="151" slineno="5-10"/>by the Individuals with Disabilities Education Act, 20 U.S.C. Sec. 1400 et seq.</amend></subsection><subsection ssid="6-7" dnum="_-o:b-i" numlevel="1" lineno="152" slineno="5-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall distribute money under this section on the basis of an LEA's <ln numlevel="1" lineno="153" slineno="5-12"/>count of preschool students with a disability on December 1 of the previous year.</amend></subsection></subsection><subsection ssid="6-8" dnum="_-o:3-i" numlevel="1" lineno="154" slineno="5-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="6-9" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall compute the number of weighted pupil units for the Special <ln numlevel="1" lineno="155" slineno="5-14"/>Education Preschool Program by:</amend><subsection ssid="6-10" dnum="_-o:i-i" numlevel="1" lineno="156" slineno="5-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">counting the number of preschool students with a disability enrolled in each LEA <ln numlevel="1" lineno="157" slineno="5-16"/>on December 1 of the previous year; and</amend></subsection><subsection ssid="6-11" dnum="_-o:ii-i" numlevel="1" lineno="158" slineno="5-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">multiplying the number determined under Subsection <xref depth="4" refnumber="53F-2-319(3)(a)(i)">(3)(a)(i)</xref> by:</amend><subsection ssid="6-12" dnum="_-o:A-i" numlevel="1" lineno="159" slineno="5-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="54" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">1.47; and</amend></subsection><subsection ssid="6-13" dnum="_-o:B-i" numlevel="1" lineno="160" slineno="5-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">the weighted pupil unit value for the current fiscal year.</amend></subsection></subsection></subsection><subsection ssid="6-14" dnum="_-o:b-i" numlevel="1" lineno="161" slineno="5-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall limit the growth in the total number of preschool students with <ln numlevel="1" lineno="162" slineno="5-21"/>a disability statewide to 8% over the prior year's December 1 count.</amend></subsection><subsection ssid="6-15" dnum="_-o:c-i" numlevel="1" lineno="163" slineno="5-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="67" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">If the total number of preschool students with a disability statewide exceeds the 8% <ln numlevel="1" lineno="164" slineno="5-23"/>growth limit described in Subsection <xref depth="4" refnumber="53F-2-319(3)(b)">(3)(b)</xref>, the state board shall distribute money to <ln numlevel="1" lineno="165" slineno="5-24"/>each LEA based on the LEA's proportion of the total statewide enrollment of <ln numlevel="1" lineno="166" slineno="5-25"/>preschool students with a disability.</amend></subsection><subsection ssid="6-21" dnum="_-o:d-i" numlevel="1" lineno="167" slineno="5-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">If the total WPU allocated for the state is different from the allocation amount, the <ln numlevel="1" lineno="168" slineno="5-27"/>difference is prorated across all districts.</amend></subsection></subsection><subsection ssid="6-17" dnum="_-o:4-i" numlevel="1" lineno="169" slineno="5-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall:</amend><subsection ssid="6-18" dnum="_-o:a-i" numlevel="1" lineno="170" slineno="5-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">develop guidelines to implement the funding formula described in this section; and</amend></subsection><subsection ssid="6-20" dnum="_-o:b-i" numlevel="1" lineno="171" slineno="5-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">make rules in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="172" slineno="5-31"/>Rulemaking Act, to administer the Special Education Preschool Program.</amend></subsection></subsection></section></bsec><bsec buid="7" num="53F-2-320" type="enact" src="code" uid="C53F-2-S320_2026070120260701" sort="53F02 03200020260701" numlevel="1" lineno="173" slineno="6-1" sn="6"><section numlevel="1" lineno="174" slineno="6-2" number="53F-2-320" type="enact"><secline lineno="173">Section 6. Section <bold>53F-2-320</bold> is enacted to read:</secline><catline lineno="174"><bold>53F-2-320<parens/>. Extended School Year for Students With Disabilities Program.</bold></catline><subsection ssid="7-1" dnum="_-o:1-i" numlevel="1" lineno="175" slineno="6-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section, "extended school year services" means special education and <ln numlevel="1" lineno="176" slineno="6-4"/>related services that:</amend><subsection ssid="7-3" dnum="_-o:a-i" numlevel="1" lineno="177" slineno="6-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">are provided to a student with a disability beyond the normal school year;</amend></subsection><subsection ssid="7-4" dnum="_-o:b-i" numlevel="1" lineno="178" slineno="6-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">are in accordance with the student's individualized education program; and</amend></subsection><subsection ssid="7-14" dnum="_-o:iii-i" numlevel="1" lineno="188" slineno="6-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">distributing remaining funds to an LEA based on each LEA's percentage <ln numlevel="1" lineno="189" slineno="6-17"/>enrollment of students with disabilities for an LEA that reports to the state board <ln numlevel="1" lineno="190" slineno="6-18"/>that the LEA has provided Extended School Year services in the prior school year.</amend></subsection></subsection><subsection ssid="7-24" dnum="_-o:b-i" numlevel="1" lineno="191" slineno="6-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="113" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">If the total WPU for the state is different from the allocation amount determined by <ln numlevel="1" lineno="192" slineno="6-20"/>the formula described in this section, the state board shall distribute the difference in <ln numlevel="1" lineno="193" slineno="6-21"/>a prorated amount across all LEAs.</amend></subsection></subsection><subsection ssid="7-15" dnum="_-o:4-i" numlevel="1" lineno="194" slineno="6-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1086" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA shall use money distributed under this section only for students with <ln numlevel="1" lineno="195" slineno="6-23"/>disabilities whose individualized education program teams have determined that the <ln numlevel="1" lineno="196" slineno="6-24"/>students require extended school year services necessary to provide a free appropriate <ln numlevel="1" lineno="197" slineno="6-25"/>public education in accordance with federal law.</amend></subsection><subsection ssid="7-16" dnum="_-o:5-i" numlevel="1" lineno="198" slineno="6-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="199" slineno="6-27"/>Administrative Rulemaking Act, to:</amend><subsection ssid="7-17" dnum="_-o:a-i" numlevel="1" lineno="200" slineno="6-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">establish criteria for determining which students with disabilities qualify for services <ln numlevel="1" lineno="201" slineno="6-29"/>described in this section;</amend></subsection><subsection ssid="7-18" dnum="_-o:b-i" numlevel="1" lineno="202" slineno="6-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">establish procedures for an LEA to:</amend><subsection ssid="7-19" dnum="_-o:i-i" numlevel="1" lineno="203" slineno="6-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="71" style="1" owner="jchristopherson" level="1" amendtag="end">identify and report students receiving extended school year services; and</amend></subsection><subsection ssid="7-20" dnum="_-o:ii-i" numlevel="1" lineno="204" slineno="6-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="97" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">account for expenditures under this section; and</amend></subsection></subsection><subsection ssid="7-21" dnum="_-o:c-i" numlevel="1" lineno="205" slineno="6-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1092" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">determine base funding amounts for an LEA under Subsection <xref depth="4" refnumber="53F-2-320(3)(a)">(3)(a)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="19" num="53F-2-321" type="enact" src="code" uid="C53F-2-S321_2026070120260701" sort="53F02 03210020260701" numlevel="1" lineno="206" slineno="7-1" sn="7"><section numlevel="1" lineno="207" slineno="7-2" number="53F-2-321" type="enact"><secline lineno="206">Section 7. Section <bold>53F-2-321</bold> is enacted to read:</secline><catline lineno="207"><bold>53F-2-321<parens/>. Special education program implementation impact aid.</bold></catline><subsection ssid="19-1" dnum="_-o:1-i" numlevel="1" lineno="208" slineno="7-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to appropriation by the Legislature, the state board shall distribute money <ln numlevel="1" lineno="209" slineno="7-4"/>appropriated for special education program implementation impact aid to provide special <ln numlevel="1" lineno="210" slineno="7-5"/>education services to students in state care, as the state board defines, and to support <ln numlevel="1" lineno="211" slineno="7-6"/>special education administrative functions for LEAs that qualify under criteria the state <ln numlevel="1" lineno="212" slineno="7-7"/>board establishes.</amend></subsection><subsection ssid="19-2" dnum="_-o:2-i" numlevel="1" lineno="213" slineno="7-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="214" slineno="7-9"/>state board shall make rules to establish criteria and procedures for distributing money <ln numlevel="1" lineno="215" slineno="7-10"/>under this section.</amend></subsection></section></bsec><bsec buid="11" type="repealer" src="code" sort="TRepealer" numlevel="1" lineno="216" slineno="8-1" sn="8"><secline>Section 8. <bold>Repealer.</bold></secline><rhead lineno="217"/><sectionText><repsec num="53F-2-308" uid="C53F-2-S308_2026070120260701" sort="53F02 03080020260701" src="code" sn="7" numlevel="1" lineno="218" slineno="8-3"><parens/>Preschool special education appropriation -- Extended year program <ln numlevel="1" lineno="219" slineno="8-4"/>appropriation -- Appropriation for special education programs in state institutions -- <ln numlevel="1" lineno="220" slineno="8-5"/>Appropriations for stipends for special educators.</repsec></sectionText></bsec><bsec buid="20" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="221" slineno="9-1" sn="9"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="221">Section 9.  <bold>Effective Date.</bold></secline><sectionText lineno="222"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="7/1/2026">July 1, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-2-26 12:53 PM</tm></rev></foot></leg>
