Section <bold>63I-2-280</bold> is amended to read:</secline><catline lineno="22"><bold>63I-2-280<parens/>. Repeal dates: Title 80.</bold></catline><sectionText lineno="23"><tab/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="ahaskell" level="1" deltag="both">Reserved.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Subsection 80-5-201(6), regarding a requirement for the Division of Juvenile <ln numlevel="1" lineno="24" slineno="1-4"/>Justice and Youth Services to report to the Judiciary Interim Committee, is repealed January 1, <ln numlevel="1" lineno="25" slineno="1-5"/>2027.</amend></sectionText></section></bsec><bsec buid="8" num="80-5-201" type="amend" src="code" uid="C80-5-S201_2026050620260506" sort="80 05 02010020260506" numlevel="1" lineno="26" slineno="2-1" sn="2"><section number="80-5-201" numlevel="1" lineno="28" slineno="2-3" type="amend"><secline lineno="26">Section 2. Section <bold>80-5-201</bold> is amended to read:</secline><headchap number="80-5" numlevel="1" lineno="27" slineno="2-2">5. Juvenile Justice and Youth Services</headchap><catline lineno="28"><bold>80-5-201<parens/>. Division responsibilities.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="29" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>The division is responsible for all minors committed to the division by juvenile courts <ln numlevel="1" lineno="30" slineno="2-5"/>under Sections <xref depth="3" refnumber="80-6-703">80-6-703</xref> and <xref depth="3" refnumber="80-6-705">80-6-705</xref>.</subsection><subsection ssid="8-null-2" dnum="2-o" numlevel="1" lineno="31" slineno="2-6" level="1"><display>(2)</display>The division shall:<subsection ssid="8-null-3" dnum="a-o" numlevel="1" lineno="32" slineno="2-7" level="2"><display>(a)</display>establish and administer a continuum of community, secure, and nonsecure programs <ln numlevel="1" lineno="33" slineno="2-8"/>for all minors committed to the division;</subsection><subsection ssid="8-null-4" dnum="b-o" numlevel="1" lineno="34" slineno="2-9" level="2"><display>(b)</display>establish and maintain all detention and secure care facilities and set minimum <ln numlevel="1" lineno="35" slineno="2-10"/>standards for all detention and secure care facilities;</subsection><subsection ssid="8-null-5" dnum="c-o" numlevel="1" lineno="36" slineno="2-11" level="2"><display>(c)</display>establish and operate prevention and early intervention youth services programs for <ln numlevel="1" lineno="37" slineno="2-12"/>nonadjudicated minors placed with the division;</subsection><subsection ssid="8-null-6" dnum="d-o" numlevel="1" lineno="38" slineno="2-13" level="2"><display>(d)</display>establish observation and assessment programs necessary to serve minors in a <ln numlevel="1" lineno="39" slineno="2-14"/>nonresidential setting under Subsection <xref depth="3" refnumber="80-6-706">80-6-706</xref>(1);</subsection><subsection ssid="8-null-7" dnum="e-o" numlevel="1" lineno="40" slineno="2-15" level="2"><display>(e)</display>place minors committed to the division under Section <xref depth="3" refnumber="80-6-703">80-6-703</xref> in the most <ln numlevel="1" lineno="41" slineno="2-16"/>appropriate program for supervision and treatment;</subsection><subsection ssid="8-null-8" dnum="f-o" numlevel="1" lineno="42" slineno="2-17" level="2"><display>(f)</display>employ staff necessary to:<subsection ssid="8-null-9" dnum="i-o" numlevel="1" lineno="43" slineno="2-18" level="3"><display>(i)</display>supervise and control minors committed to the division for secure care or <ln numlevel="1" lineno="44" slineno="2-19"/>placement in the community;</subsection><subsection ssid="8-null-10" dnum="ii-o" numlevel="1" lineno="45" slineno="2-20" level="3"><display>(ii)</display>supervise and coordinate treatment of minors committed to the division for <ln numlevel="1" lineno="46" slineno="2-21"/>placement in community-based programs; and</subsection><subsection ssid="8-null-11" dnum="iii-o" numlevel="1" lineno="47" slineno="2-22" level="3"><display>(iii)</display>control and supervise adjudicated and nonadjudicated minors placed with the <ln numlevel="1" lineno="48" slineno="2-23"/>division for temporary services in juvenile receiving centers, youth services, and <ln numlevel="1" lineno="49" slineno="2-24"/>other programs established by the division;</subsection></subsection><subsection ssid="8-null-12" dnum="g-o" numlevel="1" lineno="50" slineno="2-25" level="2"><display>(g)</display>control or detain a minor committed to the division, or in the temporary custody of <ln numlevel="1" lineno="51" slineno="2-26"/>the division, in a manner that is consistent with public safety and rules made by the <ln numlevel="1" lineno="52" slineno="2-27"/>division;</subsection><subsection ssid="8-null-13" dnum="h-o" numlevel="1" lineno="53" slineno="2-28" level="2"><display>(h)</display>establish and operate work programs for minors committed to the division by the <ln numlevel="1" lineno="54" slineno="2-29"/>juvenile court that:<subsection ssid="8-null-14" dnum="i-o" numlevel="1" lineno="55" slineno="2-30" level="3"><display>(i)</display>are not residential;</subsection><subsection ssid="8-null-15" dnum="ii-o" numlevel="1" lineno="56" slineno="2-31" level="3"><display>(ii)</display>provide labor to help in the operation, repair, and maintenance of public facilities, <ln numlevel="1" lineno="57" slineno="2-32"/>parks, highways, and other programs designated by the division;</subsection><subsection ssid="8-null-16" dnum="iii-o" numlevel="1" lineno="58" slineno="2-33" level="3"><display>(iii)</display>provide educational and prevocational programs in cooperation with the State <ln numlevel="1" lineno="59" slineno="2-34"/>Board of Education for minors placed in the program; and</subsection><subsection ssid="8-null-17" dnum="iv-o" numlevel="1" lineno="60" slineno="2-35" level="3"><display>(iv)</display>provide counseling to minors;</subsection></subsection><subsection ssid="8-null-18" dnum="i-o" numlevel="1" lineno="61" slineno="2-36" level="2"><display>(i)</display>establish minimum standards for the operation of all private residential and <ln numlevel="1" lineno="62" slineno="2-37"/>nonresidential rehabilitation facilities that provide services to minors who have <ln numlevel="1" lineno="63" slineno="2-38"/>committed an offense in this state or in any other state;</subsection><subsection ssid="8-null-19" dnum="j-o" numlevel="1" lineno="64" slineno="2-39" level="2"><display>(j)</display>provide regular training for secure care staff, detention staff, case management staff, <ln numlevel="1" lineno="65" slineno="2-40"/>and staff of the community-based programs;</subsection><subsection ssid="8-null-20" dnum="k-o" numlevel="1" lineno="66" slineno="2-41" level="2"><display>(k)</display>designate employees to obtain the saliva DNA specimens required under Section <xref depth="3" refnumber="53-10-403"><ln numlevel="1" lineno="67" slineno="2-42"/>53-10-403</xref>;</subsection><subsection ssid="8-null-21" dnum="l-o" numlevel="1" lineno="68" slineno="2-43" level="2"><display>(l)</display>ensure that the designated employees receive appropriate training and that the <ln numlevel="1" lineno="69" slineno="2-44"/>specimens are obtained in accordance with accepted protocol;</subsection><subsection ssid="8-null-22" dnum="m-o" numlevel="1" lineno="70" slineno="2-45" level="2"><display>(m)</display>register an individual with the Department of Public Safety who:<subsection ssid="8-null-23" dnum="i-o" numlevel="1" lineno="71" slineno="2-46" level="3"><display>(i)</display>is adjudicated for an offense that would result in the individual being a child abuse <ln numlevel="1" lineno="72" slineno="2-47"/>offender under Subsection <xref depth="4" refnumber="53-29-202(2)(a)">53-29-202(2)(a)</xref> or a sex offender under Subsection <xref depth="4" refnumber="53-29-202(2)(b)"><ln numlevel="1" lineno="73" slineno="2-48"/>53-29-202(2)(b)</xref>;</subsection><subsection ssid="8-null-24" dnum="ii-o" numlevel="1" lineno="74" slineno="2-49" level="3"><display>(ii)</display>is committed to the division for secure care; and</subsection><subsection ssid="8-null-25" dnum="iii-o" numlevel="1" lineno="75" slineno="2-50" level="3" space="false"><display>(iii)</display><subsection ssid="8-null-26" dnum="A-o" level="4" placement="sameline"><display>(A)</display>if the individual is a youth offender, remains in the division's custody 30 <ln numlevel="1" lineno="76" slineno="2-51"/>days before the individual's 21st birthday; or</subsection><subsection ssid="8-null-27" dnum="B-o" numlevel="1" lineno="77" slineno="2-52" level="4"><display>(B)</display>if the individual is a serious youth offender, remains in the division's custody <ln numlevel="1" lineno="78" slineno="2-53"/>30 days before the individual's 25th birthday; and</subsection></subsection></subsection><subsection ssid="8-null-28" dnum="n-o" numlevel="1" lineno="79" slineno="2-54" level="2"><display>(n)</display>ensure that a program delivered to a minor under this section is an evidence-based <ln numlevel="1" lineno="80" slineno="2-55"/>program in accordance with Section <xref depth="3" refnumber="63M-7-208">63M-7-208</xref>.</subsection></subsection><subsection ssid="8-null-29" dnum="3-o" numlevel="1" lineno="81" slineno="2-56" level="1" space="false"><display>(3)</display><subsection ssid="8-null-30" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division is authorized to employ special function officers, as defined in <ln numlevel="1" lineno="82" slineno="2-57"/>Section <xref depth="3" refnumber="53-13-105">53-13-105</xref>, to:<subsection ssid="8-null-31" dnum="i-o" numlevel="1" lineno="83" slineno="2-58" level="3" tab="1"><display>(i)</display>locate and apprehend minors who have absconded from division custody;</subsection><subsection ssid="8-null-32" dnum="ii-o" numlevel="1" lineno="84" slineno="2-59" level="3" tab="1"><display>(ii)</display>transport minors taken into custody in accordance with division policy;</subsection><subsection ssid="8-null-33" dnum="iii-o" numlevel="1" lineno="85" slineno="2-60" level="3" tab="1"><display>(iii)</display>investigate cases; and</subsection><subsection ssid="8-null-34" dnum="iv-o" numlevel="1" lineno="86" slineno="2-61" level="3" tab="1"><display>(iv)</display>carry out other duties as assigned by the division.</subsection></subsection><subsection ssid="8-null-35" dnum="b-o" numlevel="1" lineno="87" slineno="2-62" level="2"><display>(b)</display>A special function officer may be:<subsection ssid="8-null-36" dnum="i-o" numlevel="1" lineno="88" slineno="2-63" level="3"><display>(i)</display>employed through a contract with the Department of Public Safety, or any law <ln numlevel="1" lineno="89" slineno="2-64"/>enforcement agency certified by the Peace Officer Standards and Training <ln numlevel="1" lineno="90" slineno="2-65"/>Division; or</subsection><subsection ssid="8-null-37" dnum="ii-o" numlevel="1" lineno="91" slineno="2-66" level="3"><display>(ii)</display>directly hired by the division.</subsection></subsection></subsection><subsection ssid="8-null-38" dnum="4-o" numlevel="1" lineno="92" slineno="2-67" level="1"><display>(4)</display>In the event of an unauthorized leave from secure care, detention, a community-based <ln numlevel="1" lineno="93" slineno="2-68"/>program, a juvenile receiving center, a home, or any other designated placement of a <ln numlevel="1" lineno="94" slineno="2-69"/>minor, a division employee has the authority and duty to locate and apprehend the <ln numlevel="1" lineno="95" slineno="2-70"/>minor, or to initiate action with a local law enforcement agency for assistance.</subsection><subsection ssid="8-null-39" dnum="5-o" numlevel="1" lineno="96" slineno="2-71" level="1"><display>(5)</display>The division may proceed with an initial medical screening or assessment of a child <ln numlevel="1" lineno="97" slineno="2-72"/>admitted to a detention facility to ensure the safety of the child and others in the <ln numlevel="1" lineno="98" slineno="2-73"/>detention facility if the division makes a good faith effort to obtain consent for the <ln numlevel="1" lineno="99" slineno="2-74"/>screening or assessment from the child's parent or guardian.</subsection><subsection ssid="8-40" dnum="_-o:6-i" numlevel="1" lineno="100" slineno="2-75" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">On or before October 31, 2026, the division shall report to the Judiciary Interim <ln numlevel="1" lineno="101" slineno="2-76"/>Committee regarding the capacity and occupancy of each detention and secure care <ln numlevel="1" lineno="102" slineno="2-77"/>facility for each quarter of the preceding fiscal year, including:</amend><subsection ssid="8-41" dnum="_-o:a-i" numlevel="1" lineno="103" slineno="2-78" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="16" style="1" owner="ahaskell" level="1" amendtag="end">the total number of beds used or available for use by a minor;</amend></subsection><subsection ssid="8-44" dnum="_-o:b-i" numlevel="1" lineno="104" slineno="2-79" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="19" style="1" owner="ahaskell" level="1" amendtag="end">the average number of beds available for use by a minor that were unoccupied; and</amend></subsection><subsection ssid="8-42" dnum="_-o:c-i" numlevel="1" lineno="105" slineno="2-80" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="15" style="1" owner="ahaskell" level="1" amendtag="end">the average number of minors in custody at the detention or secure care facility.</amend></subsection></subsection></section></bsec><bsec buid="13" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="106" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="106">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="107"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>3-6-26 10:18 PM</tm></rev></foot></leg>
