Section <bold>4-41-102</bold> is amended to read:</secline><catline lineno="27"><bold>4-41-102<parens/>. Definitions.</bold></catline><sectionText lineno="28"><tab/>As used in this chapter:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="29" slineno="1-4" level="1"><display>(1)</display>"Adulterant" means any poisonous or deleterious substance in a quantity that may be <ln numlevel="1" lineno="30" slineno="1-5"/>injurious to human health, including:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="31" slineno="1-6" level="2"><display>(a)</display>pesticides;</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="32" slineno="1-7" level="2"><display>(b)</display>heavy metals;</subsection><subsection ssid="1-null-4" dnum="c-o" numlevel="1" lineno="33" slineno="1-8" level="2"><display>(c)</display>solvents;</subsection><subsection ssid="1-null-5" dnum="d-o" numlevel="1" lineno="34" slineno="1-9" level="2"><display>(d)</display>microbial life;</subsection><subsection ssid="1-null-6" dnum="e-o" numlevel="1" lineno="35" slineno="1-10" level="2"><display>(e)</display>artificially derived cannabinoids;</subsection><subsection ssid="1-null-7" dnum="f-o" numlevel="1" lineno="36" slineno="1-11" level="2"><display>(f)</display>toxins; or</subsection><subsection ssid="1-null-8" dnum="g-o" numlevel="1" lineno="37" slineno="1-12" level="2"><display>(g)</display>foreign matter.</subsection></subsection><subsection ssid="1-null-9" dnum="2-o" numlevel="1" lineno="38" slineno="1-13" level="1" space="false"><display>(2)</display><subsection ssid="1-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Artificially derived cannabinoid" means a chemical substance that is created by a <ln numlevel="1" lineno="39" slineno="1-14"/>chemical reaction that changes the molecular structure of any chemical substances <ln numlevel="1" lineno="40" slineno="1-15"/>derived from the cannabis plant.</subsection><subsection ssid="1-null-11" dnum="b-o" numlevel="1" lineno="41" slineno="1-16" level="2"><display>(b)</display>"Artificially derived cannabinoid" does not include:<subsection ssid="1-null-12" dnum="i-o" numlevel="1" lineno="42" slineno="1-17" level="3"><display>(i)</display>a naturally occurring chemical substance that is separated from the cannabis plant <ln numlevel="1" lineno="43" slineno="1-18"/>by a chemical or mechanical extraction process; or</subsection><subsection ssid="1-null-13" dnum="ii-o" numlevel="1" lineno="44" slineno="1-19" level="3"><display>(ii)</display>cannabinoids that are produced by decarboxylation from a naturally occurring <ln numlevel="1" lineno="45" slineno="1-20"/>cannabinoid acid without the use of a chemical catalyst.</subsection></subsection></subsection><subsection ssid="1-null-14" dnum="3-o" numlevel="1" lineno="46" slineno="1-21" level="1"><display>(3)</display>"Cannabidiol" or "CBD" means the cannabinoid identified as CAS# 13956-29-1.</subsection><subsection ssid="1-null-15" dnum="4-o" numlevel="1" lineno="47" slineno="1-22" level="1"><display>(4)</display>"Cannabidiolic acid" or "CBDA" means the cannabinoid identified as CAS# 1244-58-2.</subsection><subsection ssid="1-null-16" dnum="5-o" numlevel="1" lineno="48" slineno="1-23" level="1"><display>(5)</display>"Cannabinoid processor license" means a license that the department issues to a person <ln numlevel="1" lineno="49" slineno="1-24"/>for the purpose of processing a cannabinoid product.</subsection><subsection ssid="1-null-17" dnum="6-o" numlevel="1" lineno="50" slineno="1-25" level="1"><display>(6)</display>"Cannabinoid product" means a product that:<subsection ssid="1-null-18" dnum="a-o" numlevel="1" lineno="51" slineno="1-26" level="2"><display>(a)</display>contains or is represented to contain one or more naturally occurring cannabinoids; </subsection><subsection ssid="1-null-19" dnum="b-o" numlevel="1" lineno="52" slineno="1-27" level="2"><display>(b)</display>contains less than the cannabinoid product THC level, by dry weight;</subsection><subsection ssid="1-null-20" dnum="c-o" numlevel="1" lineno="53" slineno="1-28" level="2"><display>(c)</display>contains a combined amount of total THC and any THC analog that does not exceed <ln numlevel="1" lineno="54" slineno="1-29"/>10% of the total cannabinoid content;</subsection><subsection ssid="1-null-21" dnum="d-o" numlevel="1" lineno="55" slineno="1-30" level="2"><display>(d)</display>does not exceed a total of THC and any THC analog that is greater than:<subsection ssid="1-null-22" dnum="i-o" numlevel="1" lineno="56" slineno="1-31" level="3"><display>(i)</display>5 milligrams per serving; and</subsection><subsection ssid="1-null-23" dnum="ii-o" numlevel="1" lineno="57" slineno="1-32" level="3"><display>(ii)</display>150 milligrams per package; and</subsection></subsection><subsection ssid="1-null-24" dnum="e-o" numlevel="1" lineno="58" slineno="1-33" level="2"><display>(e)</display>unless the product is in an oil based suspension, has a serving size that:<subsection ssid="1-null-25" dnum="i-o" numlevel="1" lineno="59" slineno="1-34" level="3"><display>(i)</display>is an integer; and</subsection><subsection ssid="1-null-26" dnum="ii-o" numlevel="1" lineno="60" slineno="1-35" level="3"><display>(ii)</display>is a discrete unit of the cannabinoid product.</subsection></subsection></subsection><subsection ssid="1-null-27" dnum="7-o" numlevel="1" lineno="61" slineno="1-36" level="1"><display>(7)</display>"Cannabinoid product class" means a group of cannabinoid products that:<subsection ssid="1-null-28" dnum="a-o" numlevel="1" lineno="62" slineno="1-37" level="2"><display>(a)</display>have all ingredients in common; and</subsection><subsection ssid="1-null-29" dnum="b-o" numlevel="1" lineno="63" slineno="1-38" level="2"><display>(b)</display>are produced by or for the same company.</subsection></subsection><subsection ssid="1-null-30" dnum="8-o" numlevel="1" lineno="64" slineno="1-39" level="1"><display>(8)</display>"Cannabinoid product THC level" means a combined concentration of total THC and <ln numlevel="1" lineno="65" slineno="1-40"/>any THC analog of less than 0.3% on a dry weight basis if laboratory testing confirms a <ln numlevel="1" lineno="66" slineno="1-41"/>result within a measurement of uncertainty that includes the combined concentration of <ln numlevel="1" lineno="67" slineno="1-42"/>0.3%<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="14" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="ahaskell" level="1" amendtag="both" space="true">.</amend></subsection><subsection ssid="1-null-31" dnum="9-o" numlevel="1" lineno="68" slineno="1-43" level="1"><display>(9)</display>"Cannabis" means the same as that term is defined in Section <xref depth="3" refnumber="26B-4-201">26B-4-201</xref>.</subsection><subsection ssid="1-null-32" dnum="10-o" numlevel="1" lineno="69" slineno="1-44" level="1"><display>(10)</display>"Delta-9-tetrahydrocannabinol" or "delta-9-THC" means the cannabinoid identified as <ln numlevel="1" lineno="70" slineno="1-45"/>CAS# 1972-08-3, the primary psychotropic cannabinoid in cannabis.</subsection><subsection ssid="1-89" dnum="_-o:11-i" numlevel="1" lineno="71" slineno="1-46" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(11)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="35" style="1" owner="ahaskell" level="1" amendtag="end">"Hazardous waste laws" means:</amend><subsection ssid="1-90" dnum="_-o:a-i" numlevel="1" lineno="72" slineno="1-47" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="37" style="1" owner="ahaskell" level="1" amendtag="end">federal and state laws, rules, and regulations related to hazardous waste;</amend></subsection><subsection ssid="1-91" dnum="_-o:b-i" numlevel="1" lineno="73" slineno="1-48" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="39" style="1" owner="ahaskell" level="1" amendtag="end">the Resource Conservation and Recovery Act, 42 U.S.C. Sec. 6991 et seq.; and</amend></subsection><subsection ssid="1-92" dnum="_-o:c-i" numlevel="1" lineno="74" slineno="1-49" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="41" style="1" owner="ahaskell" level="1" amendtag="end">Title 19, Chapter 6, Part 5, Solid Waste Management Act.</amend></subsection></subsection><subsection ssid="1-null-33" dnum="11-o:12-i" numlevel="1" lineno="75" slineno="1-50" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1036" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display>"Industrial hemp" means any part of a cannabis plant, whether growing or not, <ln numlevel="1" lineno="76" slineno="1-51"/>with a concentration of less than 0.3% tetrahydrocannabinol by dry weight.</subsection><subsection ssid="1-null-34" dnum="12-o:13-i" numlevel="1" lineno="77" slineno="1-52" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1037" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="both" space="true">(13)</amend></display>"Industrial hemp producer registration" means a registration that the department <ln numlevel="1" lineno="78" slineno="1-53"/>issues to a person for the purpose of processing industrial hemp or an industrial hemp <ln numlevel="1" lineno="79" slineno="1-54"/>product.</subsection><subsection ssid="1-null-35" dnum="13-o:14-i" numlevel="1" lineno="80" slineno="1-55" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1038" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="both" space="true">(14)</amend></display><subsection ssid="1-null-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Industrial hemp product" means a product made by processing industrial <ln numlevel="1" lineno="81" slineno="1-56"/>hemp plants or industrial hemp parts.</subsection><subsection ssid="1-null-37" dnum="b-o" numlevel="1" lineno="82" slineno="1-57" level="2"><display>(b)</display>"Industrial hemp product" does not include cannabinoid material or a cannabinoid <ln numlevel="1" lineno="83" slineno="1-58"/>product.</subsection></subsection><subsection ssid="1-null-38" dnum="14-o:15-i" numlevel="1" lineno="84" slineno="1-59" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1041" style="2" owner="o" level="1" deltag="both">(14)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="both" space="true">(15)</amend></display>"Industrial hemp retailer permit" means a permit that the department issues to a <ln numlevel="1" lineno="85" slineno="1-60"/>retailer who sells any viable industrial hemp seed or cannabinoid product.</subsection><subsection ssid="1-null-39" dnum="15-o:16-i" numlevel="1" lineno="86" slineno="1-61" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1042" style="2" owner="o" level="1" deltag="both">(15)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="both" space="true">(16)</amend></display>"Key participant" means any of the following:<subsection ssid="1-null-40" dnum="a-o" numlevel="1" lineno="87" slineno="1-62" level="2"><display>(a)</display>a licensee;</subsection><subsection ssid="1-null-41" dnum="b-o" numlevel="1" lineno="88" slineno="1-63" level="2"><display>(b)</display>an operation manager;</subsection><subsection ssid="1-null-42" dnum="c-o" numlevel="1" lineno="89" slineno="1-64" level="2"><display>(c)</display>a site manager; or</subsection><subsection ssid="1-null-43" dnum="d-o" numlevel="1" lineno="90" slineno="1-65" level="2"><display>(d)</display>an employee who has access to any industrial hemp material with a THC <ln numlevel="1" lineno="91" slineno="1-66"/>concentration above 0.3%.</subsection></subsection><subsection ssid="1-null-44" dnum="16-o:17-i" numlevel="1" lineno="92" slineno="1-67" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1047" style="2" owner="o" level="1" deltag="both">(16)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="both" space="true">(17)</amend></display>"Licensee" means a person possessing a cannabinoid processor license that the <ln numlevel="1" lineno="93" slineno="1-68"/>department issues under this chapter.</subsection><subsection ssid="1-null-45" dnum="17-o:18-i" numlevel="1" lineno="94" slineno="1-69" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1048" style="2" owner="o" level="1" deltag="both">(17)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="both" space="true">(18)</amend></display>"Newly identified cannabinoid" means a cannabinoid that:<subsection ssid="1-null-46" dnum="a-o" numlevel="1" lineno="95" slineno="1-70" level="2"><display>(a)</display>is not expressly identified by chemical name or CAS number in this chapter; and</subsection><subsection ssid="1-null-47" dnum="b-o" numlevel="1" lineno="96" slineno="1-71" level="2"><display>(b)</display>is identified by the department under Section <xref depth="3" refnumber="4-41-405">4-41-405</xref>.</subsection></subsection><subsection ssid="1-null-48" dnum="18-o:19-i" numlevel="1" lineno="97" slineno="1-72" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1051" style="2" owner="o" level="1" deltag="both">(18)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="both" space="true">(19)</amend></display>"Non-compliant material" means:<subsection ssid="1-null-49" dnum="a-o" numlevel="1" lineno="98" slineno="1-73" level="2"><display>(a)</display>a hemp plant that does not comply with this chapter, including a cannabis plant with <ln numlevel="1" lineno="99" slineno="1-74"/>a concentration of 0.3% tetrahydrocannabinol or greater by dry weight;</subsection><subsection ssid="1-null-50" dnum="b-o" numlevel="1" lineno="100" slineno="1-75" level="2"><display>(b)</display>a cannabinoid product, chemical, or compound with a concentration that exceeds the <ln numlevel="1" lineno="101" slineno="1-76"/>cannabinoid product THC level; and</subsection><subsection ssid="1-null-51" dnum="c-o" numlevel="1" lineno="102" slineno="1-77" level="2"><display>(c)</display>a cannabinoid product containing any of the following:<subsection ssid="1-null-52" dnum="i-o" numlevel="1" lineno="103" slineno="1-78" level="3"><display>(i)</display>delta-9-tetrahydrocannabiphorol (THCP), the cannabinoid identified as CAS# <ln numlevel="1" lineno="104" slineno="1-79"/>54763-99-4;</subsection><subsection ssid="1-null-53" dnum="ii-o" numlevel="1" lineno="105" slineno="1-80" level="3"><display>(ii)</display>delta-8-tetrahydrocannabiphorol (THCP), the cannabinoid identified as CAS# <ln numlevel="1" lineno="106" slineno="1-81"/>51768-60-6;</subsection><subsection ssid="1-null-54" dnum="iii-o" numlevel="1" lineno="107" slineno="1-82" level="3"><display>(iii)</display>delta-9-tetrahyrdocannabinol (THC) acetate, the cannabinoid identified as CAS# <ln numlevel="1" lineno="108" slineno="1-83"/>23132-17-4;</subsection><subsection ssid="1-null-55" dnum="iv-o" numlevel="1" lineno="109" slineno="1-84" level="3"><display>(iv)</display>delta-8-tetrahydrocannabinol (THC) acetate, the cannabinoid identified as CAS# <ln numlevel="1" lineno="110" slineno="1-85"/>23050-54-6;</subsection><subsection ssid="1-null-56" dnum="v-o" numlevel="1" lineno="111" slineno="1-86" level="3"><display>(v)</display>9(s)-hexahydrocannabinol (HHC), the cannabinoid identified as CAS# <ln numlevel="1" lineno="112" slineno="1-87"/>36403-91-5; and</subsection><subsection ssid="1-null-61" dnum="b-o" numlevel="1" lineno="120" slineno="1-95" level="2"><display>(b)</display>an agent or employee of an individual, partnership, association, firm, trust, limited <ln numlevel="1" lineno="121" slineno="1-96"/>liability company, or corporation.</subsection></subsection><subsection ssid="1-null-62" dnum="21-o:22-i" numlevel="1" lineno="122" slineno="1-97" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1065" style="2" owner="o" level="1" deltag="both">(21)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="both" space="true">(22)</amend></display>"Retailer permittee" means a person possessing an industrial hemp retailer permit <ln numlevel="1" lineno="123" slineno="1-98"/>that the department issues under this chapter.</subsection><subsection ssid="1-null-63" dnum="22-o:23-i" numlevel="1" lineno="124" slineno="1-99" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1066" style="2" owner="o" level="1" deltag="both">(22)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="both" space="true">(23)</amend></display>"Tetrahydrocannabinol" or "THC" means a delta-9-tetrahydrocannabinol, the <ln numlevel="1" lineno="125" slineno="1-100"/>cannabinoid identified as CAS# 1972-08-3.</subsection><subsection ssid="1-null-64" dnum="23-o:24-i" numlevel="1" lineno="126" slineno="1-101" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1067" style="2" owner="o" level="1" deltag="both">(23)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="both" space="true">(24)</amend></display><subsection ssid="1-null-65" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"THC analog" means a substance that is structurally or pharmacologically <ln numlevel="1" lineno="127" slineno="1-102"/>substantially similar to, or is represented as being similar to, delta-9-THC.</subsection><subsection ssid="1-null-66" dnum="b-o" numlevel="1" lineno="128" slineno="1-103" level="2"><display>(b)</display>"THC analog" does not include the following substances or the naturally occurring <ln numlevel="1" lineno="129" slineno="1-104"/>acid forms of the following substances:<subsection ssid="1-null-67" dnum="i-o" numlevel="1" lineno="130" slineno="1-105" level="3"><display>(i)</display>cannabichromene (CBC), the cannabinoid identified as CAS# 20675-51-8;</subsection><subsection ssid="1-null-68" dnum="ii-o" numlevel="1" lineno="131" slineno="1-106" level="3"><display>(ii)</display>cannabicyclol (CBL), the cannabinoid identified as CAS# 21366-63-2;</subsection><subsection ssid="1-null-69" dnum="iii-o" numlevel="1" lineno="132" slineno="1-107" level="3"><display>(iii)</display>cannabidiol (CBD), the cannabinoid identified as CAS# 13956-29-1;</subsection><subsection ssid="1-null-70" dnum="iv-o" numlevel="1" lineno="133" slineno="1-108" level="3"><display>(iv)</display>cannabidivarol (CBDV), the cannabinoid identified as CAS# 24274-48-4;</subsection><subsection ssid="1-null-71" dnum="v-o" numlevel="1" lineno="134" slineno="1-109" level="3"><display>(v)</display>cannabielsoin (CBE), the cannabinoid identified as CAS# 52025-76-0;</subsection><subsection ssid="1-null-72" dnum="vi-o" numlevel="1" lineno="135" slineno="1-110" level="3"><display>(vi)</display>cannabigerol (CBG), the cannabinoid identified as CAS# 25654-31-3;</subsection><subsection ssid="1-null-73" dnum="vii-o" numlevel="1" lineno="136" slineno="1-111" level="3"><display>(vii)</display>cannabigerovarin (CBGV), the cannabinoid identified as CAS# 55824-11-8;</subsection><subsection ssid="1-null-74" dnum="viii-o" numlevel="1" lineno="137" slineno="1-112" level="3"><display>(viii)</display>cannabinol (CBN), the cannabinoid identified as CAS# <xref depth="3" refnumber="521-35-7">521-35-7</xref>;</subsection><subsection ssid="1-null-75" dnum="ix-o" numlevel="1" lineno="138" slineno="1-113" level="3"><display>(ix)</display>cannabivarin  (CBV), the cannabinoid identified as CAS# 33745-21-0; or</subsection><subsection ssid="1-null-76" dnum="x-o" numlevel="1" lineno="139" slineno="1-114" level="3"><display>(x)</display>delta-9-tetrahydrocannabivarin (THCV), the cannabinoid identified as CAS# <ln numlevel="1" lineno="140" slineno="1-115"/>31262-37-0.</subsection></subsection></subsection><subsection ssid="1-null-77" dnum="24-o:25-i" numlevel="1" lineno="141" slineno="1-116" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1080" style="2" owner="o" level="1" deltag="both">(24)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="both" space="true">(25)</amend></display>"Total cannabidiol" or "total CBD" means the combined amounts of cannabidiol <ln numlevel="1" lineno="142" slineno="1-117"/>and cannabidiolic acid, calculated as "total CBD = CBD + (CBDA x 0.877)".</subsection><subsection ssid="1-null-78" dnum="25-o:26-i" numlevel="1" lineno="143" slineno="1-118" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1081" style="2" owner="o" level="1" deltag="both">(25)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1082" style="1" owner="i" level="1" amendtag="both" space="true">(26)</amend></display>"Total tetrahydrocannabinol" or "total THC" means the sum of the determined <ln numlevel="1" lineno="144" slineno="1-119"/>amounts of delta-9-THC, tertrahydrocannabinolic acid, calculated as "total THC = <ln numlevel="1" lineno="145" slineno="1-120"/>delta-9-THC + (THCA x 0.877)".</subsection><subsection ssid="1-null-79" dnum="26-o:27-i" numlevel="1" lineno="146" slineno="1-121" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1082" style="2" owner="o" level="1" deltag="both">(26)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="both" space="true">(27)</amend></display>"Transportable industrial hemp concentrate" means any amount of a natural <ln numlevel="1" lineno="147" slineno="1-122"/>cannabinoid in a purified state that:<subsection ssid="1-null-80" dnum="a-o" numlevel="1" lineno="148" slineno="1-123" level="2"><display>(a)</display>is the product of any chemical or physical process applied to naturally occurring <ln numlevel="1" lineno="149" slineno="1-124"/>biomass that concentrates or isolates the cannabinoids contained in the biomass;</subsection><subsection ssid="1-null-81" dnum="b-o" numlevel="1" lineno="150" slineno="1-125" level="2"><display>(b)</display>is derived from a cannabis plant that, based on sampling that was collected no more <ln numlevel="1" lineno="151" slineno="1-126"/>than 30 days before the day on which the cannabis plant was harvested, contains a <ln numlevel="1" lineno="152" slineno="1-127"/>combined concentration of total THC and any THC analog of less than 0.3% on a dry <ln numlevel="1" lineno="153" slineno="1-128"/>weight basis;</subsection><subsection ssid="1-null-82" dnum="c-o" numlevel="1" lineno="154" slineno="1-129" level="2"><display>(c)</display>has a THC and THC analog concentration total that is less than 20% when <ln numlevel="1" lineno="155" slineno="1-130"/>concentrated from the cannabis plant to the purified state; and</subsection><subsection ssid="1-null-83" dnum="d-o" numlevel="1" lineno="156" slineno="1-131" level="2"><display>(d)</display>is intended to be processed into a cannabinoid product.</subsection></subsection></section></bsec><bsec buid="2" num="4-41-103.2" type="amend" src="code" uid="C4-41-S103.2_2026050620260506" sort="04 41 01030220260506" numlevel="1" lineno="157" slineno="2-1" sn="2"><section number="4-41-103.2" numlevel="1" lineno="158" slineno="2-2" type="amend"><secline lineno="157">Section 2. Section <bold>4-41-103.2</bold> is amended to read:</secline><catline lineno="158"><bold>4-41-103.2<parens/>. Cannabinoid processor license.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="159" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>The department or a licensee of the department may process a cannabinoid product.</subsection><subsection ssid="2-null-2" dnum="2-o" numlevel="1" lineno="160" slineno="2-4" level="1"><display>(2)</display>A person seeking a cannabinoid processor license shall provide to the department:<subsection ssid="2-null-3" dnum="a-o" numlevel="1" lineno="161" slineno="2-5" level="2"><display>(a)</display>the legal description and global positioning coordinates sufficient for locating the <ln numlevel="1" lineno="162" slineno="2-6"/>facility the person uses to process industrial hemp; and</subsection><subsection ssid="2-null-4" dnum="b-o" numlevel="1" lineno="163" slineno="2-7" level="2"><display>(b)</display>written consent allowing a representative of the department and local law <ln numlevel="1" lineno="164" slineno="2-8"/>enforcement to enter all premises where the person processes or stores industrial <ln numlevel="1" lineno="165" slineno="2-9"/>hemp for the purpose of:<subsection ssid="2-null-5" dnum="i-o" numlevel="1" lineno="166" slineno="2-10" level="3"><display>(i)</display>conducting a physical inspection; or</subsection><subsection ssid="2-null-6" dnum="ii-o" numlevel="1" lineno="167" slineno="2-11" level="3"><display>(ii)</display>ensuring compliance with the requirements of this chapter.</subsection></subsection></subsection><subsection ssid="2-null-7" dnum="3-o" numlevel="1" lineno="168" slineno="2-12" level="1"><display>(3)</display>The department may set a fee in accordance with Subsection <xref depth="4" refnumber="4-2-103(2)" start="0">4-2-103(2)</xref> for the <ln numlevel="1" lineno="169" slineno="2-13"/>application for a cannabinoid processor license.</subsection><subsection ssid="2-null-8" dnum="4-o" numlevel="1" lineno="170" slineno="2-14" level="1"><display>(4)</display>A licensee<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="ahaskell" level="1" amendtag="both">:</amend> <subsection ssid="2-18" dnum="_-o:a-i" numlevel="1" lineno="171" slineno="2-15" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>may only market a cannabinoid product that the licensee processes<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="2-19" dnum="_-o:b-i" numlevel="1" lineno="172" slineno="2-16" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">shall dispose of waste and unused material from the production of a cannabinoid <ln numlevel="1" lineno="173" slineno="2-17"/>product in accordance with hazardous waste laws.</amend></subsection></subsection><subsection ssid="2-null-9" dnum="5-o" numlevel="1" lineno="174" slineno="2-18" level="1" space="false"><display>(5)</display><subsection ssid="2-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An applicant for a cannabinoid processor license shall:<subsection ssid="2-null-11" dnum="i-o" numlevel="1" lineno="175" slineno="2-19" level="3" tab="1"><display>(i)</display>be at least 18 years old; and</subsection><subsection ssid="2-null-12" dnum="ii-o" numlevel="1" lineno="176" slineno="2-20" level="3" tab="1"><display>(ii)</display>submit a nationwide criminal history from the Federal Bureau of Investigation to <ln numlevel="1" lineno="177" slineno="2-21"/>the department.</subsection></subsection><subsection ssid="2-null-13" dnum="b-o" numlevel="1" lineno="178" slineno="2-22" level="2"><display>(b)</display>The department shall reject an individual's application for a cannabinoid processor <ln numlevel="1" lineno="179" slineno="2-23"/>license if the criminal history described in Subsection <xref depth="4" refnumber="4-41-103.2(5)(a)(ii)">(5)(a)(ii)</xref> was not completed in <ln numlevel="1" lineno="180" slineno="2-24"/>the previous 90 days before the day the applicant submits the license application to <ln numlevel="1" lineno="181" slineno="2-25"/>the department.</subsection></subsection><subsection ssid="2-null-14" dnum="6-o" numlevel="1" lineno="182" slineno="2-26" level="1"><display>(6)</display>An applicant is not eligible to receive a cannabinoid processor license if the applicant <ln numlevel="1" lineno="183" slineno="2-27"/>has:<subsection ssid="2-null-15" dnum="a-o" numlevel="1" lineno="184" slineno="2-28" level="2"><display>(a)</display>been convicted of a felony; or</subsection><subsection ssid="2-null-16" dnum="b-o" numlevel="1" lineno="185" slineno="2-29" level="2"><display>(b)</display>been convicted of a drug-related misdemeanor within the previous 10 years.</subsection></subsection></section></bsec><bsec buid="3" num="4-41-103.3" type="amend" src="code" uid="C4-41-S103.3_2026050620260506" sort="04 41 01030320260506" numlevel="1" lineno="186" slineno="3-1" sn="3"><section number="4-41-103.3" numlevel="1" lineno="187" slineno="3-2" type="amend"><secline lineno="186">Section 3. Section <bold>4-41-103.3</bold> is amended to read:</secline><catline lineno="187"><bold>4-41-103.3<parens/>. Industrial hemp retailer permit.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="188" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>Except as provided in Subsection <xref depth="4" refnumber="4-41-103.3(5)">(5)</xref>, a retailer permittee of the department may market <ln numlevel="1" lineno="189" slineno="3-4"/>or sell a cannabinoid product or a viable industrial hemp seed.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="190" slineno="3-5" level="1"><display>(2)</display>A person seeking an industrial hemp retailer permit shall provide to the department:<subsection ssid="3-null-3" dnum="a-o" numlevel="1" lineno="191" slineno="3-6" level="2"><display>(a)</display>the name of the person that is seeking to market or sell a cannabinoid product or a <ln numlevel="1" lineno="192" slineno="3-7"/>viable industrial hemp seed;</subsection><subsection ssid="3-null-4" dnum="b-o" numlevel="1" lineno="193" slineno="3-8" level="2"><display>(b)</display>the address of each location where a cannabinoid product or a viable industrial hemp <ln numlevel="1" lineno="194" slineno="3-9"/>seed will be sold; and</subsection><subsection ssid="3-null-5" dnum="c-o" numlevel="1" lineno="195" slineno="3-10" level="2"><display>(c)</display>written consent allowing a representative of the department to enter all premises <ln numlevel="1" lineno="196" slineno="3-11"/>where the person is selling a cannabinoid product or a viable industrial hemp seed for <ln numlevel="1" lineno="197" slineno="3-12"/>the purpose of:<subsection ssid="3-null-6" dnum="i-o" numlevel="1" lineno="198" slineno="3-13" level="3"><display>(i)</display>conducting a physical inspection; or</subsection><subsection ssid="3-null-7" dnum="ii-o" numlevel="1" lineno="199" slineno="3-14" level="3"><display>(ii)</display>ensuring compliance with the requirements of this chapter.</subsection></subsection></subsection><subsection ssid="3-null-8" dnum="3-o:_-i" numlevel="1" lineno="200" slineno="3-15" ea="erase" anum="0" owner="ahaskell" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1112" style="2" owner="o" level="1" deltag="start">(3)</amend></display><amend anum="0" ea="erase" pairid="16" groupid="12" style="2" owner="ahaskell" level="1" deltag="end">Beginning January 1, 2026, an industrial hemp retailer permittee shall:</amend><amendoutend style="2"/><subsection ssid="3-null-9" dnum="a-o:_-i" numlevel="1" lineno="201" slineno="3-16" ea="erase" anum="0" owner="ahaskell" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1113" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="65" groupid="49" style="2" owner="ahaskell" level="1" deltag="end">maintain a video surveillance system that:</amend><amendoutend style="2"/><subsection ssid="3-null-10" dnum="i-o:_-i" numlevel="1" lineno="202" slineno="3-17" ea="erase" anum="0" owner="ahaskell" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1114" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="66" groupid="50" style="2" owner="ahaskell" level="1" deltag="end">is able to monitor who purchases a cannabinoid product from the permittee;</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-11" dnum="ii-o:_-i" numlevel="1" lineno="203" slineno="3-18" ea="erase" anum="0" owner="ahaskell" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1115" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="67" groupid="51" style="2" owner="ahaskell" level="1" deltag="end">is tamper proof; and</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-12" dnum="iii-o:_-i" numlevel="1" lineno="204" slineno="3-19" ea="erase" anum="0" owner="ahaskell" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1116" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="68" groupid="52" style="2" owner="ahaskell" level="1" deltag="end">stores a video record for at least 45 days; and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="3-null-13" dnum="b-o:_-i" numlevel="1" lineno="205" slineno="3-20" ea="erase" anum="0" owner="ahaskell" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1117" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="69" groupid="53" style="2" owner="ahaskell" level="1" deltag="end">provide the department access to the video surveillance system upon request.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="3-16" dnum="_-o:3-i" numlevel="1" lineno="206" slineno="3-21" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1118" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">An industrial hemp retailer permittee shall:</amend><subsection ssid="3-24" dnum="_-o:a-i" numlevel="1" lineno="207" slineno="3-22" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1119" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="36" style="1" owner="ahaskell" level="1" amendtag="end">check the identification of any individual purchasing a <marker pairid="71"/>cannabinoid<marker pairid="72"/> product to ensure <ln numlevel="1" lineno="208" slineno="3-23"/>the individual is at least 21 years old; and</amend></subsection><subsection ssid="3-25" dnum="_-o:b-i" numlevel="1" lineno="209" slineno="3-24" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1120" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="41" style="1" owner="ahaskell" level="1" amendtag="end">dispose of waste and unused material related to a cannabinoid product in accordance <ln numlevel="1" lineno="210" slineno="3-25"/>with hazardous waste laws.</amend></subsection></subsection><subsection ssid="3-null-14" dnum="4-o" numlevel="1" lineno="211" slineno="3-26" level="1"><display>(4)</display>The department may set a fee in accordance with Subsection <xref depth="4" refnumber="4-2-103(2)" start="0">4-2-103(2)</xref> for the <ln numlevel="1" lineno="212" slineno="3-27"/>application for an industrial hemp retailer permit.</subsection><subsection ssid="3-null-15" dnum="5-o" numlevel="1" lineno="213" slineno="3-28" level="1"><display>(5)</display>Any marketing for a cannabinoid product or a viable industrial hemp seed shall include <ln numlevel="1" lineno="214" slineno="3-29"/>a notice to consumers that the product is hemp and is not cannabis or medical cannabis, <ln numlevel="1" lineno="215" slineno="3-30"/>as those terms are defined in Section <xref depth="3" refnumber="26B-4-201" start="0">26B-4-201</xref>.</subsection></section></bsec><bsec buid="8" num="4-41-103.4" type="amend" src="code" uid="C4-41-S103.4_2026050620260506" sort="04 41 01030420260506" numlevel="1" lineno="216" slineno="4-1" sn="4"><section number="4-41-103.4" numlevel="1" lineno="217" slineno="4-2" type="amend"><secline lineno="216">Section 4. Section <bold>4-41-103.4</bold> is amended to read:</secline><catline lineno="217"><bold>4-41-103.4<parens/>. Industrial hemp laboratory testing.</bold></catline><subsection ssid="8-null-1" dnum="1-o:_-i" numlevel="1" lineno="218" slineno="4-3" ea="erase" anum="0" owner="ahaskell" style="2" level="1" placement="noreturn"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1123" style="2" owner="o" level="1" deltag="start">(1)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="ahaskell" level="1" deltag="end">The department or a laboratory contracted with the department may test industrial <ln numlevel="1" lineno="219" slineno="4-4"/>hemp and cannabinoid products.</amend><amendoutend style="2"/></subsection><subsection ssid="8-null-2" dnum="2-o:_-i" numlevel="1" lineno="220" slineno="4-5" ea="erase" anum="0" owner="ahaskell" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1124" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/></display>The department or a laboratory contracted with the department<amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="ahaskell" level="1" amendtag="both">:</amend> <subsection ssid="8-3" dnum="_-o:1-i" numlevel="1" lineno="221" slineno="4-6" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="25" style="1" owner="ahaskell" level="1" amendtag="end">may test industrial hemp and cannabinoid products;</amend></subsection><subsection ssid="8-6" dnum="_-o:2-i" numlevel="1" lineno="222" slineno="4-7" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1" amendtag="both">(2)</amend></display>may dispose of non-compliant material<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="16" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="14" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="8-5" dnum="_-o:3-i" numlevel="1" lineno="223" slineno="4-8" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="21" style="1" owner="ahaskell" level="1" amendtag="end">shall dispose of waste and unused material related to a cannabinoid product in <ln numlevel="1" lineno="224" slineno="4-9"/>accordance with hazardous waste laws.</amend></subsection></subsection></section></bsec><bsec buid="12" num="4-41-105" type="amend" src="code" uid="C4-41-S105_2026050620260506" sort="04 41 01050020260506" numlevel="1" lineno="225" slineno="5-1" sn="5"><section number="4-41-105" numlevel="1" lineno="226" slineno="5-2" type="amend"><secline lineno="225">Section 5. Section <bold>4-41-105</bold> is amended to read:</secline><catline lineno="226"><bold>4-41-105<parens/>. Unlawful acts.</bold></catline><subsection ssid="12-null-1" dnum="1-o" numlevel="1" lineno="227" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>It is unlawful for a person to handle, process, or market living industrial hemp plants, <ln numlevel="1" lineno="228" slineno="5-4"/>viable hemp seeds, leaf materials, or floral materials derived from industrial hemp <ln numlevel="1" lineno="229" slineno="5-5"/>without the appropriate license or permit issued by the department under this chapter.</subsection><subsection ssid="12-null-2" dnum="2-o" numlevel="1" lineno="230" slineno="5-6" level="1" space="false"><display>(2)</display><subsection ssid="12-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>It is unlawful for any person to:<subsection ssid="12-null-4" dnum="i-o" numlevel="1" lineno="231" slineno="5-7" level="3" tab="1"><display>(i)</display>distribute, sell, or market a cannabinoid product that is:<subsection ssid="12-null-5" dnum="A-o" numlevel="1" lineno="232" slineno="5-8" level="4"><display>(A)</display>not registered with the department under Section <xref depth="3" refnumber="4-41-104">4-41-104</xref>; or</subsection><subsection ssid="12-null-6" dnum="B-o" numlevel="1" lineno="233" slineno="5-9" level="4"><display>(B)</display>noncompliant material;</subsection></subsection><subsection ssid="12-null-7" dnum="ii-o" numlevel="1" lineno="234" slineno="5-10" level="3" tab="1"><display>(ii)</display>except as provided in Subsection <xref depth="4" refnumber="4-41-105(2)(b)">(2)(b)</xref>, transport into or out of the state extracted <ln numlevel="1" lineno="235" slineno="5-11"/>material or final product that contains 0.3% or more of total THC and any THC <ln numlevel="1" lineno="236" slineno="5-12"/>analog;</subsection><subsection ssid="12-null-8" dnum="iii-o" numlevel="1" lineno="237" slineno="5-13" level="3" tab="1"><display>(iii)</display>sell or use a cannabinoid product that is:<subsection ssid="12-null-9" dnum="A-o" numlevel="1" lineno="238" slineno="5-14" level="4"><display>(A)</display>added to a conventional food or beverage, as the department further defines in <ln numlevel="1" lineno="239" slineno="5-15"/>rules described in Section <xref depth="3" refnumber="4-41-403">4-41-403</xref>;</subsection><subsection ssid="12-null-10" dnum="B-o" numlevel="1" lineno="240" slineno="5-16" level="4"><display>(B)</display>marketed or manufactured to be enticing to children, as further defined in <ln numlevel="1" lineno="241" slineno="5-17"/>rules described in Section <xref depth="3" refnumber="4-41-403">4-41-403</xref>; or</subsection><subsection ssid="12-null-11" dnum="C-o" numlevel="1" lineno="242" slineno="5-18" level="4"><display>(C)</display>smokable flower; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="5" style="2" owner="ahaskell" level="1" deltag="both">or</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="12-null-12" dnum="iv-o" numlevel="1" lineno="243" slineno="5-19" level="3" tab="1"><display>(iv)</display>knowingly or intentionally sell or give a cannabinoid product that contains THC <ln numlevel="1" lineno="244" slineno="5-20"/>or a THC analog in the course of business to an individual who is not at least 21 <ln numlevel="1" lineno="245" slineno="5-21"/>years old<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="4" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="12-20" dnum="_-o:v-i" numlevel="1" lineno="246" slineno="5-22" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">delay or deny an inspection authorized under this chapter.</amend></subsection></subsection><subsection ssid="12-null-13" dnum="b-o" numlevel="1" lineno="247" slineno="5-23" level="2"><display>(b)</display>A person may transport transportable industrial hemp concentrate if the person:<subsection ssid="12-null-14" dnum="i-o" numlevel="1" lineno="248" slineno="5-24" level="3"><display>(i)</display>complies with rules created by the department under Section <xref depth="3" refnumber="4-41-103.1">4-41-103.1</xref> related to <ln numlevel="1" lineno="249" slineno="5-25"/>transportable industrial hemp concentrate; and</subsection><subsection ssid="12-null-15" dnum="ii-o" numlevel="1" lineno="250" slineno="5-26" level="3" space="false"><display>(ii)</display><subsection ssid="12-null-16" dnum="A-o" level="4" placement="sameline"><display>(A)</display>has a cannabinoid processor license; or</subsection><subsection ssid="12-null-17" dnum="B-o" numlevel="1" lineno="251" slineno="5-27" level="4"><display>(B)</display>the equivalent to a cannabinoid processor license from another state.</subsection></subsection></subsection></subsection><subsection ssid="12-null-18" dnum="3-o" numlevel="1" lineno="252" slineno="5-28" level="1"><display>(3)</display>The department may seize and destroy non-compliant material.</subsection><subsection ssid="12-null-19" dnum="4-o" numlevel="1" lineno="253" slineno="5-29" level="1"><display>(4)</display>Nothing in this chapter authorizes any person to violate federal law, regulation, or any <ln numlevel="1" lineno="254" slineno="5-30"/>provision of this title.</subsection></section></bsec><bsec buid="13" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="255" slineno="6-1" sn="6"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="255">Section 6.  <bold>Effective Date.</bold></secline><sectionText lineno="256"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-9-26 12:13 PM</tm></rev></foot></leg>
