Section <bold>10-20-909</bold> is amended to read:</secline><catline lineno="28"><bold>10-20-909<parens/>. Fees collected for construction approval -- Approval of plans.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="29" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="30" slineno="1-4" level="2"><display>(a)</display>"Automated review" means a computerized process used to conduct a plan review, <ln numlevel="1" lineno="31" slineno="1-5"/>including through the use of software and algorithms to assess compliance with an <ln numlevel="1" lineno="32" slineno="1-6"/>applicable building code, regulation, or ordinance to ensure that a plan meets all of a <ln numlevel="1" lineno="33" slineno="1-7"/>municipality's required criteria for approval.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="34" slineno="1-8" level="2"><display>(b)</display>"Business day" means the same as that term is defined in Section <xref depth="3" refnumber="10-20-908">10-20-908</xref>.</subsection><subsection ssid="1-null-4" dnum="c-o" numlevel="1" lineno="35" slineno="1-9" level="2"><display>(c)</display>"Construction project" means: <subsection ssid="1-null-5" dnum="i-o" numlevel="1" lineno="36" slineno="1-10" level="3"><display>(i)</display>the same as that term is defined in Section <xref depth="3" refnumber="38-1a-102">38-1a-102</xref>; or</subsection><subsection ssid="1-null-6" dnum="ii-o" numlevel="1" lineno="37" slineno="1-11" level="3"><display>(ii)</display>any work requiring a permit for construction of or on a one- or two-family <ln numlevel="1" lineno="38" slineno="1-12"/>dwelling, a townhome, or other residential structure built under the State <ln numlevel="1" lineno="39" slineno="1-13"/>Construction Code and State Fire Code.</subsection></subsection><subsection ssid="1-null-7" dnum="d-o" numlevel="1" lineno="40" slineno="1-14" level="2"><display>(d)</display>"Lodging establishment" means a place providing temporary sleeping <ln numlevel="1" lineno="41" slineno="1-15"/>accommodations to the public, including<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both"> any of the following</amend><amendoutend style="2"/>:<subsection ssid="1-null-8" dnum="i-o" numlevel="1" lineno="42" slineno="1-16" level="3"><display>(i)</display>a bed and breakfast establishment;</subsection><subsection ssid="1-null-9" dnum="ii-o" numlevel="1" lineno="43" slineno="1-17" level="3"><display>(ii)</display>a boarding house;</subsection><subsection ssid="1-null-10" dnum="iii-o" numlevel="1" lineno="44" slineno="1-18" level="3"><display>(iii)</display>a dormitory;</subsection><subsection ssid="1-null-11" dnum="iv-o" numlevel="1" lineno="45" slineno="1-19" level="3"><display>(iv)</display>a hotel;</subsection><subsection ssid="1-null-12" dnum="v-o" numlevel="1" lineno="46" slineno="1-20" level="3"><display>(v)</display>an inn;</subsection><subsection ssid="1-null-13" dnum="vi-o" numlevel="1" lineno="47" slineno="1-21" level="3"><display>(vi)</display>a lodging house;</subsection><subsection ssid="1-null-14" dnum="vii-o" numlevel="1" lineno="48" slineno="1-22" level="3"><display>(vii)</display>a motel;</subsection><subsection ssid="1-null-15" dnum="viii-o" numlevel="1" lineno="49" slineno="1-23" level="3"><display>(viii)</display>a resort; or</subsection><subsection ssid="1-null-16" dnum="ix-o" numlevel="1" lineno="50" slineno="1-24" level="3"><display>(ix)</display>a rooming house.</subsection></subsection><subsection ssid="1-null-17" dnum="e-o" numlevel="1" lineno="51" slineno="1-25" level="2" space="false"><display>(e)</display><subsection ssid="1-null-18" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Plan review" means all of the reviews and approvals of a plan that a <ln numlevel="1" lineno="52" slineno="1-26"/>municipality, including all relevant divisions or departments within a <ln numlevel="1" lineno="53" slineno="1-27"/>municipality, requires before issuing a building permit, with a scope that may not <ln numlevel="1" lineno="54" slineno="1-28"/>exceed a review to verify:<subsection ssid="1-null-19" dnum="A-o" numlevel="1" lineno="55" slineno="1-29" level="4" tab="1"><display>(A)</display>that the construction project complies with <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="159" groupid="140" style="2" owner="jchristopherson" level="1" deltag="both">the provisions of </amend><amendoutend style="2"/>the State <ln numlevel="1" lineno="56" slineno="1-30"/>Construction Code;</subsection><subsection ssid="1-null-20" dnum="B-o" numlevel="1" lineno="57" slineno="1-31" level="4" tab="1"><display>(B)</display>that the construction project complies with the energy code adopted under <ln numlevel="1" lineno="58" slineno="1-32"/>Section <xref depth="3" refnumber="15A-2-103">15A-2-103</xref>;</subsection><subsection ssid="1-null-21" dnum="C-o" numlevel="1" lineno="59" slineno="1-33" level="4" tab="1"><display>(C)</display>that the construction project complies with local ordinances;</subsection><subsection ssid="1-null-22" dnum="D-o" numlevel="1" lineno="60" slineno="1-34" level="4" tab="1"><display>(D)</display>that the applicant paid <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="58" groupid="54" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> required fees;</subsection><subsection ssid="1-null-23" dnum="E-o" numlevel="1" lineno="61" slineno="1-35" level="4" tab="1"><display>(E)</display>that the applicant obtained final approvals from <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="59" groupid="55" style="2" owner="jchristopherson" level="1" deltag="both">any other</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> required <ln numlevel="1" lineno="62" slineno="1-36"/>reviewing agencies;</subsection><subsection ssid="1-null-24" dnum="F-o" numlevel="1" lineno="63" slineno="1-37" level="4" tab="1"><display>(F)</display>that the construction project received a structural review;</subsection><subsection ssid="1-null-25" dnum="G-o" numlevel="1" lineno="64" slineno="1-38" level="4" tab="1"><display>(G)</display>the total square footage for each building level of finished, garage, and <ln numlevel="1" lineno="65" slineno="1-39"/>unfinished space; and</subsection><subsection ssid="1-null-26" dnum="H-o" numlevel="1" lineno="66" slineno="1-40" level="4" tab="1"><display>(H)</display>that the plans include a printed statement indicating that, before the <ln numlevel="1" lineno="67" slineno="1-41"/>disturbance of land and during the actual construction, the applicant will <ln numlevel="1" lineno="68" slineno="1-42"/>comply with applicable federal, state, and local laws and ordinances, including <ln numlevel="1" lineno="69" slineno="1-43"/>any storm water protection laws and ordinances.</subsection></subsection><subsection ssid="1-null-27" dnum="ii-o" numlevel="1" lineno="70" slineno="1-44" level="3"><display>(ii)</display>"Plan review" does not mean a review of:<subsection ssid="1-null-28" dnum="A-o" numlevel="1" lineno="71" slineno="1-45" level="4"><display>(A)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both">a document required to be re-submitted</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="211" groupid="184" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a document that an applicant is <ln numlevel="1" lineno="72" slineno="1-46"/>required by the municipality to resubmit</amend> for a construction project other than a <ln numlevel="1" lineno="73" slineno="1-47"/>construction project for a one-or two-family dwelling or townhome if<amend anum="0" ea="amend" pairid="53" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="both"> the plan <ln numlevel="1" lineno="74" slineno="1-48"/>review identifies</amend> additional modifications or substantive changes<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="60" groupid="56" style="2" owner="jchristopherson" level="1" deltag="both"> are <ln numlevel="1" lineno="75" slineno="1-49"/>identified by the plan review</amend><amendoutend style="2"/>;</subsection><subsection ssid="1-null-29" dnum="B-o" numlevel="1" lineno="76" slineno="1-50" level="4"><display>(B)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="33" style="2" owner="jchristopherson" level="1" deltag="both">a document submitted </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="212" groupid="185" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a document that an applicant submits </amend>as part of a <ln numlevel="1" lineno="77" slineno="1-51"/>deferred submittal when requested by the applicant and approved by the <ln numlevel="1" lineno="78" slineno="1-52"/>building official; </subsection><subsection ssid="1-null-30" dnum="C-o" numlevel="1" lineno="79" slineno="1-53" level="4"><display>(C)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="40" groupid="36" style="2" owner="jchristopherson" level="1" deltag="both">a document that,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="213" groupid="186" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a document that a third party reviews</amend> due to the document's <ln numlevel="1" lineno="80" slineno="1-54"/>technical nature or on the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="61" groupid="57" style="2" owner="jchristopherson" level="1" deltag="both">request of the applicant, is reviewed by a third party</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="54" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="81" slineno="1-55"/>applicant's request</amend>; or</subsection><subsection ssid="1-null-31" dnum="D-o" numlevel="1" lineno="82" slineno="1-56" level="4"><display>(D)</display>a storm water permit.</subsection></subsection></subsection><subsection ssid="1-null-32" dnum="f-o" numlevel="1" lineno="83" slineno="1-57" level="2"><display>(f)</display>"Screening period" means the three business days following the day on which an <ln numlevel="1" lineno="84" slineno="1-58"/>applicant submits an application.</subsection><subsection ssid="1-null-33" dnum="g-o" numlevel="1" lineno="85" slineno="1-59" level="2"><display>(g)</display>"State Construction Code" means the same as that term is defined in Section <xref depth="3" refnumber="15A-1-102"><ln numlevel="1" lineno="86" slineno="1-60"/>15A-1-102</xref>.</subsection><subsection ssid="1-null-34" dnum="h-o" numlevel="1" lineno="87" slineno="1-61" level="2"><display>(h)</display>"State Fire Code" means the same as that term is defined in Section <xref depth="3" refnumber="15A-1-102">15A-1-102</xref>.</subsection><subsection ssid="1-null-35" dnum="i-o" numlevel="1" lineno="88" slineno="1-62" level="2"><display>(i)</display>"Storm water permit" means the same as that term is defined in Section <xref depth="3" refnumber="19-5-108.5">19-5-108.5</xref>.</subsection><subsection ssid="1-null-36" dnum="j-o" numlevel="1" lineno="89" slineno="1-63" level="2"><display>(j)</display>"Structural review" means:<subsection ssid="1-null-37" dnum="i-o" numlevel="1" lineno="90" slineno="1-64" level="3"><display>(i)</display>a review that verifies that a construction project complies with the following:<subsection ssid="1-null-38" dnum="A-o" numlevel="1" lineno="91" slineno="1-65" level="4"><display>(A)</display>footing size and bar placement;</subsection><subsection ssid="1-null-39" dnum="B-o" numlevel="1" lineno="92" slineno="1-66" level="4"><display>(B)</display>foundation thickness and bar placement;</subsection><subsection ssid="1-null-40" dnum="C-o" numlevel="1" lineno="93" slineno="1-67" level="4"><display>(C)</display>beam and header sizes;</subsection><subsection ssid="1-null-41" dnum="D-o" numlevel="1" lineno="94" slineno="1-68" level="4"><display>(D)</display>nailing patterns;</subsection><subsection ssid="1-null-42" dnum="E-o" numlevel="1" lineno="95" slineno="1-69" level="4"><display>(E)</display>bearing points;</subsection><subsection ssid="1-null-43" dnum="F-o" numlevel="1" lineno="96" slineno="1-70" level="4"><display>(F)</display>structural member size and span; and</subsection><subsection ssid="1-null-44" dnum="G-o" numlevel="1" lineno="97" slineno="1-71" level="4"><display>(G)</display>sheathing; or</subsection></subsection><subsection ssid="1-null-45" dnum="ii-o" numlevel="1" lineno="98" slineno="1-72" level="3"><display>(ii)</display>if the review exceeds the scope of the review described in Subsection <xref depth="4" refnumber="10-9a-542(1)(j)(i)">(1)(j)(i)</xref>, a <ln numlevel="1" lineno="99" slineno="1-73"/>review that a licensed engineer conducts.</subsection></subsection><subsection ssid="1-null-46" dnum="k-o" numlevel="1" lineno="100" slineno="1-74" level="2"><display>(k)</display>"Technical nature" means a characteristic that places an item outside the training and <ln numlevel="1" lineno="101" slineno="1-75"/>expertise of an individual who regularly performs plan reviews.</subsection></subsection><subsection ssid="1-null-47" dnum="2-o" numlevel="1" lineno="102" slineno="1-76" level="1" space="false"><display>(2)</display><subsection ssid="1-null-48" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a municipality collects a fee for the inspection of a construction project, the <ln numlevel="1" lineno="103" slineno="1-77"/>municipality shall ensure that the construction project receives a prompt inspection as <ln numlevel="1" lineno="104" slineno="1-78"/>described in Subsection <xref depth="4" refnumber="10-9a-542(2)(b)">(2)(b)</xref>.</subsection><subsection ssid="1-null-49" dnum="b-o" numlevel="1" lineno="105" slineno="1-79" level="2"><display>(b)</display>If a municipality cannot provide a building inspection within three business days <ln numlevel="1" lineno="106" slineno="1-80"/>after the day on which the municipality receives the request for the inspection, the <ln numlevel="1" lineno="107" slineno="1-81"/>building permit applicant may engage a third-party inspection firm from the <ln numlevel="1" lineno="108" slineno="1-82"/>third-party inspection firm list described in Section <xref depth="3" refnumber="15A-1-105">15A-1-105</xref>.</subsection><subsection ssid="1-null-50" dnum="c-o" numlevel="1" lineno="109" slineno="1-83" level="2"><display>(c)</display>Notwithstanding Subsection <xref depth="4" refnumber="10-9a-542(2)(b)">(2)(b)</xref>, if an applicant requests that an inspection take <ln numlevel="1" lineno="110" slineno="1-84"/>place on a date that is more than three days from the day on which the applicant <ln numlevel="1" lineno="111" slineno="1-85"/>requests the inspection, the municipality shall conduct the inspection on the date <ln numlevel="1" lineno="112" slineno="1-86"/>requested.</subsection><subsection ssid="1-null-51" dnum="d-o" numlevel="1" lineno="113" slineno="1-87" level="2"><display>(d)</display>If an inspector identifies one or more violations of the State Construction Code or <ln numlevel="1" lineno="114" slineno="1-88"/>State Fire Code during an inspection, the inspector shall give the permit holder <ln numlevel="1" lineno="115" slineno="1-89"/>written notification that:<subsection ssid="1-null-52" dnum="i-o" numlevel="1" lineno="116" slineno="1-90" level="3"><display>(i)</display>identifies each violation;</subsection><subsection ssid="1-null-53" dnum="ii-o" numlevel="1" lineno="117" slineno="1-91" level="3"><display>(ii)</display>upon request by the permit holder, includes a reference to each applicable <ln numlevel="1" lineno="118" slineno="1-92"/>provision of the State Construction Code or <amend anum="0" ea="amend" pairid="79" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="both">the </amend>State Fire Code; and</subsection><subsection ssid="1-null-54" dnum="iii-o" numlevel="1" lineno="119" slineno="1-93" level="3"><display>(iii)</display>is delivered:<subsection ssid="1-null-55" dnum="A-o" numlevel="1" lineno="120" slineno="1-94" level="4"><display>(A)</display>in hardcopy or by electronic means; and</subsection><subsection ssid="1-null-56" dnum="B-o" numlevel="1" lineno="121" slineno="1-95" level="4"><display>(B)</display><amend anum="0" ea="amend" pairid="215" groupid="188" style="1" owner="jchristopherson" level="1" amendtag="both">on </amend>the day on which the inspection occurs.</subsection></subsection></subsection></subsection><subsection ssid="1-null-57" dnum="3-o" numlevel="1" lineno="122" slineno="1-96" level="1" space="false"><display>(3)</display><subsection ssid="1-null-58" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="1-null-59" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>A municipality that receives an application for a plan review shall determine <ln numlevel="1" lineno="123" slineno="1-97"/>if the application is complete, as described in Subsection <xref depth="4" refnumber="10-9a-542(12)">(12)</xref>, within the <ln numlevel="1" lineno="124" slineno="1-98"/>screening period.</subsection><subsection ssid="1-null-60" dnum="ii-o" numlevel="1" lineno="125" slineno="1-99" level="3" tab="1"><display>(ii)</display>If the municipality determines an application for a plan review is complete as <ln numlevel="1" lineno="126" slineno="1-100"/>described in Subsection <xref depth="4" refnumber="10-9a-542(12)">(12)</xref> within the screening period, the municipality shall <ln numlevel="1" lineno="127" slineno="1-101"/>begin the plan review process described in Subsection <xref depth="4" refnumber="10-9a-542(4)">(4)</xref>.</subsection></subsection><subsection ssid="1-null-61" dnum="b-o" numlevel="1" lineno="128" slineno="1-102" level="2"><display>(b)</display>If the municipality determines that an application for a plan review is not complete <ln numlevel="1" lineno="129" slineno="1-103"/>as described in Subsection <xref depth="4" refnumber="10-9a-542(12)">(12)</xref>, and if the municipality notifies the applicant of the <ln numlevel="1" lineno="130" slineno="1-104"/>municipality's determination:<subsection ssid="1-null-62" dnum="i-o" numlevel="1" lineno="131" slineno="1-105" level="3"><display>(i)</display>before 5 p.m. on the last day of the screening period, the municipality may:<subsection ssid="1-null-63" dnum="A-o" numlevel="1" lineno="132" slineno="1-106" level="4"><display>(A)</display>pause the screening period until the applicant ensures the application meets <ln numlevel="1" lineno="133" slineno="1-107"/>the requirements of Subsection <xref depth="4" refnumber="10-9a-542(12)">(12)</xref>; or</subsection><subsection ssid="1-null-64" dnum="B-o" numlevel="1" lineno="134" slineno="1-108" level="4"><display>(B)</display>reject the incomplete application; or</subsection></subsection><subsection ssid="1-null-65" dnum="ii-o" numlevel="1" lineno="135" slineno="1-109" level="3"><display>(ii)</display>after 5 p.m. on the last day of the screening period, the municipality may not <ln numlevel="1" lineno="136" slineno="1-110"/>pause the screening period and shall begin the plan review process described in <ln numlevel="1" lineno="137" slineno="1-111"/>Subsection <xref depth="4" refnumber="10-9a-542(4)">(4)</xref>.</subsection></subsection><subsection ssid="1-null-66" dnum="c-o" numlevel="1" lineno="138" slineno="1-112" level="2"><display>(c)</display>If an application is rejected as described in Subsection <xref depth="4" refnumber="10-9a-542(3)(b)(i)(b)">(3)(b)(i)(B)</xref> and an applicant <ln numlevel="1" lineno="139" slineno="1-113"/>resubmits the application, the resubmission begins a new screening period in which <ln numlevel="1" lineno="140" slineno="1-114"/>the municipality shall review the resubmitted application <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="62" groupid="58" style="2" owner="jchristopherson" level="1" deltag="both">to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="56" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">and</amend> determine if the <ln numlevel="1" lineno="141" slineno="1-115"/>application is complete as described in Subsection <xref depth="4" refnumber="10-9a-542(12)">(12)</xref>.</subsection><subsection ssid="1-null-67" dnum="d-o" numlevel="1" lineno="142" slineno="1-116" level="2"><display>(d)</display>If the municipality gives notice of an incomplete application after 5 p.m. on the last <ln numlevel="1" lineno="143" slineno="1-117"/>day of the screening period, the municipality:<subsection ssid="1-null-68" dnum="i-o" numlevel="1" lineno="144" slineno="1-118" level="3"><display>(i)</display>shall immediately notify the applicant that the municipality has determined the <ln numlevel="1" lineno="145" slineno="1-119"/>application is not complete and the basis for the determination;</subsection><subsection ssid="1-null-69" dnum="ii-o" numlevel="1" lineno="146" slineno="1-120" level="3"><display>(ii)</display>may not, except as provided in Subsection <xref depth="4" refnumber="10-9a-542(3)(d)(iii)">(3)(d)(iii)</xref>, pause the relevant time <ln numlevel="1" lineno="147" slineno="1-121"/>period described in Subsection <xref depth="4" refnumber="10-9a-542(4)">(4)</xref>; and</subsection><subsection ssid="1-null-70" dnum="iii-o" numlevel="1" lineno="148" slineno="1-122" level="3"><display>(iii)</display>may pause the relevant time period described in Subsection <xref depth="4" refnumber="10-9a-542(4)(a)">(4)(a)</xref> or <amend anum="0" ea="amend" pairid="206" groupid="179" style="1" owner="jchristopherson" level="1" amendtag="both">(4)</amend><xref depth="4" refnumber="10-9a-542(b)">(b)</xref> as <ln numlevel="1" lineno="149" slineno="1-123"/>described in Subsection <xref depth="4" refnumber="10-9a-542(4)(c)">(4)(c)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-71" dnum="4-o" numlevel="1" lineno="150" slineno="1-124" level="1" space="false"><display>(4)</display><subsection ssid="1-null-72" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="10-9a-542(7)">(7)</xref>, once a municipality determines an <ln numlevel="1" lineno="151" slineno="1-125"/>application is complete, or proceeds to review an incomplete application for plan <ln numlevel="1" lineno="152" slineno="1-126"/>review under Subsection <xref tempid="948" depth="4" refnumber="10-6-160(3)(b)(ii)">(3)(b)(ii)</xref>, the municipality shall complete a plan review of a <ln numlevel="1" lineno="153" slineno="1-127"/>construction project for a one-or two-family dwelling or townhome by no later than <ln numlevel="1" lineno="154" slineno="1-128"/>14 business days after the day on which the screening period for the application ends.</subsection><subsection ssid="1-null-73" dnum="b-o" numlevel="1" lineno="155" slineno="1-129" level="2"><display>(b)</display> Except as provided in Subsection <xref refnumber="10-6-160(7)" depth="4">(7)</xref>, once a municipality determines an application <ln numlevel="1" lineno="156" slineno="1-130"/>is complete, or proceeds to review an incomplete application for plan review under <ln numlevel="1" lineno="157" slineno="1-131"/>Subsection <xref tempid="306" depth="4" refnumber="10-6-160(3)(b)(ii)">(3)(b)(ii)</xref>, the municipality shall complete a plan review of a construction <ln numlevel="1" lineno="158" slineno="1-132"/>project for a residential structure built under the State Construction Code that is not a <ln numlevel="1" lineno="159" slineno="1-133"/>one- or two-family dwelling, townhome, or a lodging establishment, by no later than <ln numlevel="1" lineno="160" slineno="1-134"/>21 business days after the day on which the screening period for the application ends.</subsection><subsection ssid="1-null-74" dnum="c-o" numlevel="1" lineno="161" slineno="1-135" level="2"><display>(c)</display>If a municipality gives notice of an incomplete application as described in Subsection <xref depth="4" refnumber="10-9a-542(3)(d)"><ln numlevel="1" lineno="162" slineno="1-136"/>(3)(d)</xref>, the municipality:<subsection ssid="1-null-75" dnum="i-o" numlevel="1" lineno="163" slineno="1-137" level="3"><display>(i)</display>may pause the time period described in Subsection <xref depth="4" refnumber="10-9a-542(4)(a)">(4)(a)</xref> or <amend anum="0" ea="amend" pairid="207" groupid="180" style="1" owner="jchristopherson" level="1" amendtag="both">(4)</amend><xref depth="4" refnumber="10-9a-542(b)">(b)</xref>:<subsection ssid="1-null-76" dnum="A-o" numlevel="1" lineno="164" slineno="1-138" level="4"><display>(A)</display>within the last five days of the relevant time period; and</subsection><subsection ssid="1-null-77" dnum="B-o" numlevel="1" lineno="165" slineno="1-139" level="4"><display>(B)</display>until the applicant provides the municipality with the information necessary to <ln numlevel="1" lineno="166" slineno="1-140"/>consider the application complete under Subsection <xref depth="4" refnumber="10-9a-542(12)">(12)</xref>; and</subsection></subsection><subsection ssid="1-null-78" dnum="ii-o" numlevel="1" lineno="167" slineno="1-141" level="3"><display>(ii)</display>shall resume the relevant time period upon receipt of the information necessary to <ln numlevel="1" lineno="168" slineno="1-142"/>consider the application complete; and</subsection><subsection ssid="1-null-79" dnum="iii-o" numlevel="1" lineno="169" slineno="1-143" level="3"><display>(iii)</display>may, if necessary, use five additional days beginning the day on which the <ln numlevel="1" lineno="170" slineno="1-144"/>municipality receives the information described in Subsection <xref depth="4" refnumber="10-9a-542(4)(c)(ii)">(4)(c)(ii)</xref> to <ln numlevel="1" lineno="171" slineno="1-145"/>consider whether the application meets the requirements for a building permit, <ln numlevel="1" lineno="172" slineno="1-146"/>even if the five additional days extend beyond the relevant time period described <ln numlevel="1" lineno="173" slineno="1-147"/>in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="218" groupid="191" style="2" owner="jchristopherson" level="1" deltag="both">4(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="217" groupid="190" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="10-20-909(4)(a)" depth="4">(4)(a)</xref></amend> or <xref depth="4" refnumber="10-20-909(b)">(b)</xref>.</subsection></subsection><subsection ssid="1-null-80" dnum="d-o" numlevel="1" lineno="174" slineno="1-148" level="2"><display>(d)</display>If, at the conclusion of plan review, the municipality determines the application <ln numlevel="1" lineno="175" slineno="1-149"/>meets the requirements for a building permit, the municipality shall approve the <ln numlevel="1" lineno="176" slineno="1-150"/>application and, subject to Subsection <xref depth="4" refnumber="10-9a-542(10)(b)">(10)(b)</xref>, issue the building permit to the <ln numlevel="1" lineno="177" slineno="1-151"/>applicant.</subsection></subsection><subsection ssid="1-null-81" dnum="5-o" numlevel="1" lineno="178" slineno="1-152" level="1" space="false"><display>(5)</display><subsection ssid="1-null-82" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A municipality may utilize another government entity to determine if an <ln numlevel="1" lineno="179" slineno="1-153"/>application is complete or perform a plan review, in whole or in part.</subsection><subsection ssid="1-null-83" dnum="b-o" numlevel="1" lineno="180" slineno="1-154" level="2"><display>(b)</display>A municipality that utilizes another government entity to determine if an application <ln numlevel="1" lineno="181" slineno="1-155"/>is complete or perform a plan review, as described in Subsection <xref depth="4" refnumber="10-9a-542(5)(a)">(5)(a)</xref>, shall:<subsection ssid="1-null-84" dnum="i-o" numlevel="1" lineno="182" slineno="1-156" level="3"><display>(i)</display>notify any other government entities, including water providers, within 24 hours <ln numlevel="1" lineno="183" slineno="1-157"/>of receiving any building permit application; and</subsection><subsection ssid="1-null-85" dnum="ii-o" numlevel="1" lineno="184" slineno="1-158" level="3"><display>(ii)</display>provide the government entity <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="83" groupid="79" style="2" owner="jchristopherson" level="1" deltag="both">all</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="81" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> documents necessary to determine if an <ln numlevel="1" lineno="185" slineno="1-159"/>application is complete or perform a plan review, in whole or in part, as requested <ln numlevel="1" lineno="186" slineno="1-160"/>by the municipality.</subsection></subsection></subsection><subsection ssid="1-null-86" dnum="6-o" numlevel="1" lineno="187" slineno="1-161" level="1"><display>(6)</display>A government entity determining if an application is complete or performing a plan <ln numlevel="1" lineno="188" slineno="1-162"/>review, in whole or in part, as requested by a municipality, shall:<subsection ssid="1-null-87" dnum="a-o" numlevel="1" lineno="189" slineno="1-163" level="2"><display>(a)</display>comply with the requirements of this chapter; and</subsection><subsection ssid="1-null-88" dnum="b-o" numlevel="1" lineno="190" slineno="1-164" level="2"><display>(b)</display>notify the municipality within the screening period whether the application, or a <ln numlevel="1" lineno="191" slineno="1-165"/>portion of the application, is complete.</subsection></subsection><subsection ssid="1-null-89" dnum="7-o" numlevel="1" lineno="192" slineno="1-166" level="1"><display>(7)</display>An applicant may:<subsection ssid="1-null-90" dnum="a-o" numlevel="1" lineno="193" slineno="1-167" level="2"><display>(a)</display>waive the plan review time requirements described in Subsection <xref refnumber="10-6-160(4)" depth="4">(4)</xref>; or</subsection><subsection ssid="1-null-91" dnum="b-o" numlevel="1" lineno="194" slineno="1-168" level="2"><display>(b)</display>with the municipality's written consent, establish an alternative plan review time <ln numlevel="1" lineno="195" slineno="1-169"/>requirement.</subsection></subsection><subsection ssid="1-null-92" dnum="8-o" numlevel="1" lineno="196" slineno="1-170" level="1" space="false"><display>(8)</display><subsection ssid="1-null-93" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A municipality may not enforce a requirement to have a plan review if:<subsection ssid="1-null-94" dnum="i-o" numlevel="1" lineno="197" slineno="1-171" level="3" tab="1"><display>(i)</display>the municipality does not complete the plan review within the relevant time period <ln numlevel="1" lineno="198" slineno="1-172"/>described in Subsection <xref depth="4" refnumber="10-9a-542(4)">(4)</xref>; and</subsection><subsection ssid="1-null-95" dnum="ii-o" numlevel="1" lineno="199" slineno="1-173" level="3" tab="1"><display>(ii)</display>a licensed architect or structural engineer, or both when required by law, stamps <ln numlevel="1" lineno="200" slineno="1-174"/>the plan.</subsection></subsection><subsection ssid="1-null-96" dnum="b-o" numlevel="1" lineno="201" slineno="1-175" level="2"><display>(b)</display>If a municipality is prohibited from enforcing a requirement to have a plan review <ln numlevel="1" lineno="202" slineno="1-176"/>under Subsection <xref depth="4" refnumber="10-9a-542(8)(a)">(8)(a)</xref>, the municipality shall return to the applicant the plan review <ln numlevel="1" lineno="203" slineno="1-177"/>fee.</subsection></subsection><subsection ssid="1-null-97" dnum="9-o" numlevel="1" lineno="204" slineno="1-178" level="1" space="false"><display>(9)</display><subsection ssid="1-null-98" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A municipality may attach to a reviewed plan a list that includes:<subsection ssid="1-null-99" dnum="i-o" numlevel="1" lineno="205" slineno="1-179" level="3" tab="1"><display>(i)</display>items with which the municipality is concerned and may enforce during <ln numlevel="1" lineno="206" slineno="1-180"/>construction; and</subsection><subsection ssid="1-null-100" dnum="ii-o" numlevel="1" lineno="207" slineno="1-181" level="3" tab="1"><display>(ii)</display>building code violations found in the plan.</subsection></subsection><subsection ssid="1-null-101" dnum="b-o" numlevel="1" lineno="208" slineno="1-182" level="2"><display>(b)</display>A municipality may not require an applicant to redraft a plan if the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="199" groupid="172" style="2" owner="jchristopherson" level="1" deltag="both">city</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="197" groupid="170" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">municipality</amend> <ln numlevel="1" lineno="209" slineno="1-183"/>requests minor changes to the plan that the list described in Subsection <xref depth="4" refnumber="10-9a-542(9)(a)">(9)(a)</xref> <ln numlevel="1" lineno="210" slineno="1-184"/>identifies.</subsection><subsection ssid="1-null-102" dnum="c-o" numlevel="1" lineno="211" slineno="1-185" level="2"><display>(c)</display>A municipality may only require a single resubmittal of plans for a one- or <ln numlevel="1" lineno="212" slineno="1-186"/>two-family dwelling or townhome if deficiencies in the plan would affect the site <ln numlevel="1" lineno="213" slineno="1-187"/>plan interaction or footprint of the design.</subsection></subsection><subsection ssid="1-null-103" dnum="10-o" numlevel="1" lineno="214" slineno="1-188" level="1" space="false"><display>(10)</display><subsection ssid="1-null-104" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a municipality charges a fee for a building permit, the municipality may not <ln numlevel="1" lineno="215" slineno="1-189"/>refuse payment of the fee at the time the applicant submits an application under <ln numlevel="1" lineno="216" slineno="1-190"/>Subsection <xref depth="4" refnumber="10-9a-542(3)">(3)</xref>.</subsection><subsection ssid="1-null-105" dnum="b-o" numlevel="1" lineno="217" slineno="1-191" level="2"><display>(b)</display>If a municipality charges a fee for a building permit and does not require the fee for a <ln numlevel="1" lineno="218" slineno="1-192"/>building permit <amend anum="0" ea="amend" pairid="194" groupid="167" style="1" owner="jchristopherson" level="1" amendtag="both">to </amend>be included in an application for plan review, upon approval of an <ln numlevel="1" lineno="219" slineno="1-193"/>application for plan review under Subsection <xref depth="4" refnumber="10-9a-542(4)(d)">(4)(d)</xref>, the municipality may require the <ln numlevel="1" lineno="220" slineno="1-194"/>applicant to pay the fee for the building permit before the municipality issues the <ln numlevel="1" lineno="221" slineno="1-195"/>building permit.</subsection></subsection><subsection ssid="1-null-106" dnum="11-o" numlevel="1" lineno="222" slineno="1-196" level="1"><display>(11)</display>A municipality may not limit the number of applications submitted under Subsection <xref depth="4" refnumber="10-9a-542(3)"><ln numlevel="1" lineno="223" slineno="1-197"/>(3)</xref>.</subsection><subsection ssid="1-null-107" dnum="12-o" numlevel="1" lineno="224" slineno="1-198" level="1"><display>(12)</display>For purposes of Subsection <xref depth="4" refnumber="10-9a-542(3)">(3)</xref>, an application for plan review is complete if the <ln numlevel="1" lineno="225" slineno="1-199"/>application contains:<subsection ssid="1-null-108" dnum="a-o" numlevel="1" lineno="226" slineno="1-200" level="2"><display>(a)</display>the name, address, and contact information of:<subsection ssid="1-null-109" dnum="i-o" numlevel="1" lineno="227" slineno="1-201" level="3"><display>(i)</display>the applicant; and</subsection><subsection ssid="1-null-110" dnum="ii-o" numlevel="1" lineno="228" slineno="1-202" level="3"><display>(ii)</display>the construction manager/general contractor, as defined in Section <xref depth="3" refnumber="63G-6a-103">63G-6a-103</xref>, <ln numlevel="1" lineno="229" slineno="1-203"/>for the construction project;</subsection></subsection><subsection ssid="1-null-111" dnum="b-o" numlevel="1" lineno="230" slineno="1-204" level="2"><display>(b)</display>a site plan for the construction project that:<subsection ssid="1-null-112" dnum="i-o" numlevel="1" lineno="231" slineno="1-205" level="3"><display>(i)</display>is drawn to scale;</subsection><subsection ssid="1-null-113" dnum="ii-o" numlevel="1" lineno="232" slineno="1-206" level="3"><display>(ii)</display>includes a north arrow and legend; and</subsection><subsection ssid="1-null-114" dnum="iii-o" numlevel="1" lineno="233" slineno="1-207" level="3"><display>(iii)</display>provides specifications for the following:<subsection ssid="1-null-115" dnum="A-o" numlevel="1" lineno="234" slineno="1-208" level="4"><display>(A)</display>lot size and dimensions;</subsection><subsection ssid="1-null-116" dnum="B-o" numlevel="1" lineno="235" slineno="1-209" level="4"><display>(B)</display>setbacks and overhangs for setbacks;</subsection><subsection ssid="1-null-117" dnum="C-o" numlevel="1" lineno="236" slineno="1-210" level="4"><display>(C)</display>easements;</subsection><subsection ssid="1-null-118" dnum="D-o" numlevel="1" lineno="237" slineno="1-211" level="4"><display>(D)</display>property lines;</subsection><subsection ssid="1-null-119" dnum="E-o" numlevel="1" lineno="238" slineno="1-212" level="4"><display>(E)</display>topographical details, if the slope of the lot is greater than 10%;</subsection><subsection ssid="1-null-120" dnum="F-o" numlevel="1" lineno="239" slineno="1-213" level="4"><display>(F)</display>retaining walls;</subsection><subsection ssid="1-null-121" dnum="G-o" numlevel="1" lineno="240" slineno="1-214" level="4"><display>(G)</display>hard surface areas;</subsection><subsection ssid="1-null-122" dnum="H-o" numlevel="1" lineno="241" slineno="1-215" level="4"><display>(H)</display>curb and gutter elevations as indicated in the subdivision documents;</subsection><subsection ssid="1-null-123" dnum="I-o" numlevel="1" lineno="242" slineno="1-216" level="4"><display>(I)</display>existing and proposed utilities, including water, sewer, and subsurface drainage <ln numlevel="1" lineno="243" slineno="1-217"/>facilities;</subsection><subsection ssid="1-null-124" dnum="J-o" numlevel="1" lineno="244" slineno="1-218" level="4"><display>(J)</display>street names;</subsection><subsection ssid="1-null-125" dnum="K-o" numlevel="1" lineno="245" slineno="1-219" level="4"><display>(K)</display>driveway locations;</subsection><subsection ssid="1-null-126" dnum="L-o" numlevel="1" lineno="246" slineno="1-220" level="4"><display>(L)</display>defensible space provisions and elevations, if required by the Utah Wildland <ln numlevel="1" lineno="247" slineno="1-221"/>Urban Interface Code adopted under Section <xref depth="3" refnumber="15A-2-103">15A-2-103</xref>; and</subsection><subsection ssid="1-null-127" dnum="M-o" numlevel="1" lineno="248" slineno="1-222" level="4"><display>(M)</display>the location of the nearest hydrant;</subsection></subsection></subsection><subsection ssid="1-null-128" dnum="c-o" numlevel="1" lineno="249" slineno="1-223" level="2"><display>(c)</display>construction plans and drawings, including:<subsection ssid="1-null-129" dnum="i-o" numlevel="1" lineno="250" slineno="1-224" level="3"><display>(i)</display>elevations, only if the construction project is new construction;</subsection><subsection ssid="1-null-130" dnum="ii-o" numlevel="1" lineno="251" slineno="1-225" level="3"><display>(ii)</display>floor plans for each level, including the location and size of doors, windows, and <ln numlevel="1" lineno="252" slineno="1-226"/>egress;</subsection><subsection ssid="1-null-131" dnum="iii-o" numlevel="1" lineno="253" slineno="1-227" level="3"><display>(iii)</display>foundation, structural, and framing detail; </subsection><subsection ssid="1-null-132" dnum="iv-o" numlevel="1" lineno="254" slineno="1-228" level="3"><display>(iv)</display>electrical, mechanical, and plumbing design;</subsection><subsection ssid="1-null-133" dnum="v-o" numlevel="1" lineno="255" slineno="1-229" level="3"><display>(v)</display>a licensed architect's or structural engineer's stamp, when <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="67" style="2" owner="jchristopherson" level="1" deltag="both">required by law</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="70" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the <ln numlevel="1" lineno="256" slineno="1-230"/>law requires</amend>; and</subsection><subsection ssid="1-null-134" dnum="vi-o" numlevel="1" lineno="257" slineno="1-231" level="3"><display>(vi)</display>fire suppression details, when <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="74" groupid="70" style="2" owner="jchristopherson" level="1" deltag="both">required by fire code</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="82" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the State Fire Code requires</amend>;</subsection></subsection><subsection ssid="1-null-135" dnum="d-o" numlevel="1" lineno="258" slineno="1-232" level="2"><display>(d)</display>documentation of energy code compliance;</subsection><subsection ssid="1-null-136" dnum="e-o" numlevel="1" lineno="259" slineno="1-233" level="2"><display>(e)</display>structural calculations, except for trusses;</subsection><subsection ssid="1-null-137" dnum="f-o" numlevel="1" lineno="260" slineno="1-234" level="2"><display>(f)</display>a geotechnical report, including a slope stability evaluation and retaining wall design, <ln numlevel="1" lineno="261" slineno="1-235"/>if:<subsection ssid="1-null-138" dnum="i-o" numlevel="1" lineno="262" slineno="1-236" level="3"><display>(i)</display>the slope of the lot is greater than 15%; and</subsection><subsection ssid="1-null-139" dnum="ii-o" numlevel="1" lineno="263" slineno="1-237" level="3"><display>(ii)</display>required by the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="201" groupid="174" style="2" owner="jchristopherson" level="1" deltag="both">city</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="198" groupid="171" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">municipality</amend>; </subsection></subsection><subsection ssid="1-null-140" dnum="g-o" numlevel="1" lineno="264" slineno="1-238" level="2"><display>(g)</display>a statement indicating:<subsection ssid="1-null-141" dnum="i-o" numlevel="1" lineno="265" slineno="1-239" level="3"><display>(i)</display>before land disturbance occurs on the subject property, the applicant will obtain a <ln numlevel="1" lineno="266" slineno="1-240"/>storm water permit; and</subsection><subsection ssid="1-null-142" dnum="ii-o" numlevel="1" lineno="267" slineno="1-241" level="3"><display>(ii)</display>during actual construction, the applicant shall comply with applicable local <ln numlevel="1" lineno="268" slineno="1-242"/>ordinances and building codes; and</subsection></subsection><subsection ssid="1-null-143" dnum="h-o" numlevel="1" lineno="269" slineno="1-243" level="2"><display>(h)</display>the fees, if any, established by ordinance for the municipality to perform a plan <ln numlevel="1" lineno="270" slineno="1-244"/>review.</subsection></subsection><subsection ssid="1-null-144" dnum="13-o" numlevel="1" lineno="271" slineno="1-245" level="1"><display>(13)</display>A municipality may, at the municipality's discretion, utilize automated review to fulfill, <ln numlevel="1" lineno="272" slineno="1-246"/>in whole or in part, the municipality's obligation to conduct a plan review described in <ln numlevel="1" lineno="273" slineno="1-247"/>this section.</subsection><subsection ssid="1-164" dnum="_-o:14-i" numlevel="1" lineno="274" slineno="1-248" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(14)</amend></display><subsection ssid="1-182" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">The municipality shall automatically approve an application for a plan review if:</amend><subsection ssid="1-165" dnum="_-o:i-i" numlevel="1" lineno="275" slineno="1-249" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">the application is for an alteration to an owner-occupied, single-family dwelling;</amend></subsection><subsection ssid="1-180" dnum="_-o:ii-i" numlevel="1" lineno="276" slineno="1-250" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="164" groupid="144" style="1" owner="jchristopherson" level="1" amendtag="end">the application is complete, as described in Subsection <xref depth="4" refnumber="10-20-909(12)">(12)</xref>;</amend></subsection><subsection ssid="1-166" dnum="_-o:iii-i" numlevel="1" lineno="277" slineno="1-251" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="97" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">the applicant includes in the application a signed statement from an individual <ln numlevel="1" lineno="278" slineno="1-252"/>who is licensed and certified as a combination building inspector under Title 58, <ln numlevel="1" lineno="279" slineno="1-253"/>Chapter 56, Building Inspector and Factory Built Housing Licensing Act, <ln numlevel="1" lineno="280" slineno="1-254"/>affirming that:</amend><subsection ssid="1-169" dnum="_-o:A-i" numlevel="1" lineno="281" slineno="1-255" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1149" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">the construction project complies with the provisions of the State Construction <ln numlevel="1" lineno="282" slineno="1-256"/>Code; and</amend></subsection><subsection ssid="1-168" dnum="_-o:B-i" numlevel="1" lineno="283" slineno="1-257" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1150" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="end">the construction project complies with local ordinances; and</amend></subsection></subsection><subsection ssid="1-174" dnum="_-o:iv-i" numlevel="1" lineno="284" slineno="1-258" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1151" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="137" groupid="122" style="1" owner="jchristopherson" level="1" amendtag="end">the statement described in Subsection <xref depth="4" refnumber="10-20-909(14)(a)(iii)">(14)(a)(iii)</xref> identifies the inspector's license <ln numlevel="1" lineno="285" slineno="1-259"/>number.</amend></subsection></subsection><subsection ssid="1-181" dnum="_-o:b-i" numlevel="1" lineno="286" slineno="1-260" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1152" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="169" groupid="148" style="1" owner="jchristopherson" level="1" amendtag="end">Approval under this Subsection <xref depth="4" refnumber="10-20-909(14)">(14)</xref> does not:</amend><subsection ssid="1-183" dnum="_-o:i-i" numlevel="1" lineno="287" slineno="1-261" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1153" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="177" groupid="153" style="1" owner="jchristopherson" level="1" amendtag="end">relieve the owner or contractor of the obligation to comply with the State <ln numlevel="1" lineno="288" slineno="1-262"/>Construction Code or other applicable laws;</amend></subsection><subsection ssid="1-184" dnum="_-o:ii-i" numlevel="1" lineno="289" slineno="1-263" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1154" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="182" groupid="157" style="1" owner="jchristopherson" level="1" amendtag="end">limit the authority of the municipality to conduct inspections during construction; <ln numlevel="1" lineno="290" slineno="1-264"/>or</amend></subsection><subsection ssid="1-185" dnum="_-o:iii-i" numlevel="1" lineno="291" slineno="1-265" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="187" groupid="161" style="1" owner="jchristopherson" level="1" amendtag="end">impose liability on the municipality for errors or omissions in the plans or <ln numlevel="1" lineno="292" slineno="1-266"/>documents.</amend></subsection></subsection></subsection></section></bsec><bsec buid="2" num="15A-1-105" type="amend" src="code" uid="C15A-1-S105_2026050620260506" sort="15A01 01050020260506" numlevel="1" lineno="293" slineno="2-1" sn="2"><section number="15A-1-105" numlevel="1" lineno="294" slineno="2-2" type="amend"><secline lineno="293">Section 2. Section <bold>15A-1-105</bold> is amended to read:</secline><catline lineno="294"><bold>15A-1-105<parens/>. Third-party inspection firms.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="295" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="296" slineno="2-4" level="2"><display>(a)</display>"Building permit applicant" means an individual who applies to a local regulator for <ln numlevel="1" lineno="297" slineno="2-5"/>a building permit.</subsection><subsection ssid="2-null-3" dnum="b-o" numlevel="1" lineno="298" slineno="2-6" level="2"><display>(b)</display>"Inspection" means a physical examination of all aspects of a structure to ensure <ln numlevel="1" lineno="299" slineno="2-7"/>compliance with the State Construction Code.</subsection><subsection ssid="2-null-4" dnum="c-o" numlevel="1" lineno="300" slineno="2-8" level="2"><display>(c)</display>"Local regulator" means the same as that <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">terms</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">term</amend> is defined in Section <xref depth="3" refnumber="15A-1-202">15A-1-202</xref>.</subsection><subsection ssid="2-null-5" dnum="d-o" numlevel="1" lineno="301" slineno="2-9" level="2"><display>(d)</display>"Third-party inspection firm" means an entity that:<subsection ssid="2-null-6" dnum="i-o" numlevel="1" lineno="302" slineno="2-10" level="3"><display>(i)</display>employs or contracts with licensed building inspectors to enforce building codes <ln numlevel="1" lineno="303" slineno="2-11"/>adopted in this title;</subsection><subsection ssid="2-null-7" dnum="ii-o" numlevel="1" lineno="304" slineno="2-12" level="3"><display>(ii)</display>is independent, but may include a building inspector for an adjacent <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">city</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="305" slineno="2-13"/>municipality</amend> or county; and</subsection><subsection ssid="2-null-8" dnum="iii-o" numlevel="1" lineno="306" slineno="2-14" level="3"><display>(iii)</display>is included on the local regulator's third-party inspection firm list.</subsection></subsection><subsection ssid="2-null-9" dnum="e-o" numlevel="1" lineno="307" slineno="2-15" level="2"><display>(e)</display>"Third-party inspection firm list" means a list of:<subsection ssid="2-null-10" dnum="i-o" numlevel="1" lineno="308" slineno="2-16" level="3"><display>(i)</display>for a first, second, third, or fourth class county, as classified under Section <xref depth="3" refnumber="17-60-104"><ln numlevel="1" lineno="309" slineno="2-17"/>17-60-104</xref>, or a municipality located within a first, second, third, or fourth class <ln numlevel="1" lineno="310" slineno="2-18"/>county, three or more third-party inspection firms approved by the local regulator; <ln numlevel="1" lineno="311" slineno="2-19"/>or</subsection><subsection ssid="2-null-11" dnum="ii-o" numlevel="1" lineno="312" slineno="2-20" level="3"><display>(ii)</display>for a fifth or sixth class county, as classified under Section <xref depth="3" refnumber="17-60-104">17-60-104</xref>, or a <ln numlevel="1" lineno="313" slineno="2-21"/>municipality located within a fifth or sixth class county, one or more third-party <ln numlevel="1" lineno="314" slineno="2-22"/>inspection firms approved by the local regulator.</subsection></subsection></subsection><subsection ssid="2-null-12" dnum="2-o" numlevel="1" lineno="315" slineno="2-23" level="1" space="false"><display>(2)</display><subsection ssid="2-null-13" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="2-25" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1169" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>Subject to the provisions of this section and Subsections <xref depth="4" refnumber="10-20-909(2)">10-20-909(2)</xref> and <xref depth="4" refnumber="17-79-810(2)"><ln numlevel="1" lineno="316" slineno="2-24"/>17-79-810(2)</xref>, after submitting a request for inspection, a building permit applicant <ln numlevel="1" lineno="317" slineno="2-25"/>may engage a third-party inspection firm from the local regulator's third-party <ln numlevel="1" lineno="318" slineno="2-26"/>inspection firm list to conduct or complete an inspection for the scope of work <ln numlevel="1" lineno="319" slineno="2-27"/>identified under the original request for inspection.</subsection><subsection ssid="2-26" dnum="_-o:ii-i" numlevel="1" lineno="320" slineno="2-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1170" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">A building permit applicant for an alteration to an owner-occupied, single-family <ln numlevel="1" lineno="321" slineno="2-29"/>dwelling may engage a third-party inspection firm to conduct or complete an <ln numlevel="1" lineno="322" slineno="2-30"/>inspection for the scope of work identified.</amend></subsection></subsection><subsection ssid="2-null-14" dnum="b-o" numlevel="1" lineno="323" slineno="2-31" level="2"><display>(b)</display>If a building permit applicant wishes to engage a third-party inspection firm in <ln numlevel="1" lineno="324" slineno="2-32"/>accordance with Subsection <xref depth="4" refnumber="15A-1-105(2)(a)">(2)(a)</xref>, the building permit applicant shall first notify the <ln numlevel="1" lineno="325" slineno="2-33"/>local regulator of the third-party inspection firm the building permit applicant intends <ln numlevel="1" lineno="326" slineno="2-34"/>to engage.</subsection><subsection ssid="2-null-15" dnum="c-o" numlevel="1" lineno="327" slineno="2-35" level="2"><display>(c)</display>Upon completing the inspection, the third-party inspection firm shall submit the <ln numlevel="1" lineno="328" slineno="2-36"/>inspection report to the local regulator.</subsection><subsection ssid="2-null-16" dnum="d-o" numlevel="1" lineno="329" slineno="2-37" level="2" space="false"><display>(d)</display><subsection ssid="2-null-17" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The local regulator shall pay the cost of the inspection to the third-party <ln numlevel="1" lineno="330" slineno="2-38"/>inspection firm after the local regulator receives the third-party inspection report <ln numlevel="1" lineno="331" slineno="2-39"/>indicating the third-party inspection firm completed the inspection.</subsection><subsection ssid="2-null-18" dnum="ii-o" numlevel="1" lineno="332" slineno="2-40" level="3"><display>(ii)</display>This section does not require a local regulator to pay for an inspection that <ln numlevel="1" lineno="333" slineno="2-41"/>exceeds the scope of work identified under the original request for inspection.</subsection></subsection></subsection><subsection ssid="2-null-19" dnum="3-o" numlevel="1" lineno="334" slineno="2-42" level="1" space="false"><display>(3)</display><subsection ssid="2-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The local regulator shall issue a certificate of occupancy to the building permit <ln numlevel="1" lineno="335" slineno="2-43"/>applicant if the third-party inspection firm:<subsection ssid="2-null-21" dnum="i-o" numlevel="1" lineno="336" slineno="2-44" level="3" tab="1"><display>(i)</display>completes the inspection; and</subsection><subsection ssid="2-null-22" dnum="ii-o" numlevel="1" lineno="337" slineno="2-45" level="3" tab="1"><display>(ii)</display>submits the inspection report to the local regulator.</subsection></subsection><subsection ssid="2-null-23" dnum="b-o" numlevel="1" lineno="338" slineno="2-46" level="2"><display>(b)</display>The local regulator shall promptly issue the certificate of occupancy or letter of <ln numlevel="1" lineno="339" slineno="2-47"/>completion after the third-party inspection firm submits the final inspection report to <ln numlevel="1" lineno="340" slineno="2-48"/>the local regulator as described in Subsection <xref depth="4" refnumber="15A-1-105(3)(a)(ii)">(3)(a)(ii)</xref>.</subsection></subsection><subsection ssid="2-null-24" dnum="4-o" numlevel="1" lineno="341" slineno="2-49" level="1"><display>(4)</display>A local regulator is not liable for any inspection performed by a third-party inspection <ln numlevel="1" lineno="342" slineno="2-50"/>firm.</subsection></section></bsec><bsec buid="3" num="17-79-810" type="amend" src="code" uid="C17-79-S810_2026050620260506" sort="17 79 08100020260506" numlevel="1" lineno="343" slineno="3-1" sn="3"><section number="17-79-810" numlevel="1" lineno="344" slineno="3-2" type="amend"><secline lineno="343">Section 3. Section <bold>17-79-810</bold> is amended to read:</secline><catline lineno="344"><bold>17-79-810<parens/>. Fees collected for construction approval -- Approval of plans.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="345" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="346" slineno="3-4" level="2"><display>(a)</display>"Automated review" means a computerized process used to conduct a plan review, <ln numlevel="1" lineno="347" slineno="3-5"/>including through the use of software and algorithms to assess compliance with an <ln numlevel="1" lineno="348" slineno="3-6"/>applicable building code, regulation, or ordinance to ensure that a plan meets all of a <ln numlevel="1" lineno="349" slineno="3-7"/>county's required criteria for approval.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="350" slineno="3-8" level="2"><display>(b)</display>"Business day" means the same as that term is defined in Section <xref depth="3" refnumber="17-79-809">17-79-809</xref>.</subsection><subsection ssid="3-null-4" dnum="c-o" numlevel="1" lineno="351" slineno="3-9" level="2"><display>(c)</display>"Construction project" means: <subsection ssid="3-null-5" dnum="i-o" numlevel="1" lineno="352" slineno="3-10" level="3"><display>(i)</display>the same as that term is defined in Section <xref depth="3" refnumber="38-1a-102">38-1a-102</xref>; or</subsection><subsection ssid="3-null-6" dnum="ii-o" numlevel="1" lineno="353" slineno="3-11" level="3"><display>(ii)</display>any work requiring a permit for construction of or on a one- or two-family <ln numlevel="1" lineno="354" slineno="3-12"/>dwelling, a townhome, or other residential structure built under the State <ln numlevel="1" lineno="355" slineno="3-13"/>Construction Code and <amend anum="0" ea="amend" pairid="32" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both">the </amend>State Fire Code.</subsection></subsection><subsection ssid="3-null-7" dnum="d-o" numlevel="1" lineno="356" slineno="3-14" level="2"><display>(d)</display>"Lodging establishment" means a place providing temporary sleeping <ln numlevel="1" lineno="357" slineno="3-15"/>accommodations to the public, including<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both"> any of the following</amend><amendoutend style="2"/>:<subsection ssid="3-null-8" dnum="i-o" numlevel="1" lineno="358" slineno="3-16" level="3"><display>(i)</display>a bed and breakfast establishment;</subsection><subsection ssid="3-null-9" dnum="ii-o" numlevel="1" lineno="359" slineno="3-17" level="3"><display>(ii)</display>a boarding house;</subsection><subsection ssid="3-null-10" dnum="iii-o" numlevel="1" lineno="360" slineno="3-18" level="3"><display>(iii)</display>a dormitory;</subsection><subsection ssid="3-null-11" dnum="iv-o" numlevel="1" lineno="361" slineno="3-19" level="3"><display>(iv)</display>a hotel;</subsection><subsection ssid="3-null-12" dnum="v-o" numlevel="1" lineno="362" slineno="3-20" level="3"><display>(v)</display>an inn;</subsection><subsection ssid="3-null-13" dnum="vi-o" numlevel="1" lineno="363" slineno="3-21" level="3"><display>(vi)</display>a lodging house;</subsection><subsection ssid="3-null-14" dnum="vii-o" numlevel="1" lineno="364" slineno="3-22" level="3"><display>(vii)</display>a motel;</subsection><subsection ssid="3-null-15" dnum="viii-o" numlevel="1" lineno="365" slineno="3-23" level="3"><display>(viii)</display>a resort; or</subsection><subsection ssid="3-null-16" dnum="ix-o" numlevel="1" lineno="366" slineno="3-24" level="3"><display>(ix)</display>a rooming house.</subsection></subsection><subsection ssid="3-null-17" dnum="e-o" numlevel="1" lineno="367" slineno="3-25" level="2" space="false"><display>(e)</display><subsection ssid="3-null-18" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Plan review" means all of the reviews and approvals of a plan that a county, <ln numlevel="1" lineno="368" slineno="3-26"/>including all relevant divisions or departments within a county, requires before <ln numlevel="1" lineno="369" slineno="3-27"/>issuing a building permit, with a scope that may not exceed a review to verify: <subsection ssid="3-null-19" dnum="A-o" numlevel="1" lineno="370" slineno="3-28" level="4" tab="1"><display>(A)</display>that the construction project complies with <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="111" groupid="93" style="2" owner="jchristopherson" level="1" deltag="both">the provisions of </amend><amendoutend style="2"/>the State <ln numlevel="1" lineno="371" slineno="3-29"/>Construction Code<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="58" groupid="53" style="2" owner="jchristopherson" level="1" deltag="both"> under Title <xref depth="0" refnumber="15A">15A, State Construction and Fire Codes Act</xref></amend><amendoutend style="2"/>;</subsection><subsection ssid="3-null-20" dnum="B-o" numlevel="1" lineno="372" slineno="3-30" level="4" tab="1"><display>(B)</display>that the construction project complies with the energy code adopted under <ln numlevel="1" lineno="373" slineno="3-31"/>Section <xref depth="3" refnumber="15A-2-103">15A-2-103</xref>;</subsection><subsection ssid="3-null-21" dnum="C-o" numlevel="1" lineno="374" slineno="3-32" level="4" tab="1"><display>(C)</display>that the construction project complies with local ordinances;</subsection><subsection ssid="3-null-22" dnum="D-o" numlevel="1" lineno="375" slineno="3-33" level="4" tab="1"><display>(D)</display>that the applicant paid <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="60" groupid="55" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="49" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> required fees;</subsection><subsection ssid="3-null-23" dnum="E-o" numlevel="1" lineno="376" slineno="3-34" level="4" tab="1"><display>(E)</display>that the applicant obtained final approvals from <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="62" groupid="57" style="2" owner="jchristopherson" level="1" deltag="both">any other</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> required <ln numlevel="1" lineno="377" slineno="3-35"/>reviewing agencies;</subsection><subsection ssid="3-null-24" dnum="F-o" numlevel="1" lineno="378" slineno="3-36" level="4" tab="1"><display>(F)</display>that the construction project received a structural review;</subsection><subsection ssid="3-null-25" dnum="G-o" numlevel="1" lineno="379" slineno="3-37" level="4" tab="1"><display>(G)</display>the total square footage for each building level of finished, garage, and <ln numlevel="1" lineno="380" slineno="3-38"/>unfinished space; and</subsection><subsection ssid="3-null-26" dnum="H-o" numlevel="1" lineno="381" slineno="3-39" level="4" tab="1"><display>(H)</display>that the plans include a printed statement indicating that, before the <ln numlevel="1" lineno="382" slineno="3-40"/>disturbance of land and during the actual construction, the applicant will <ln numlevel="1" lineno="383" slineno="3-41"/>comply with applicable federal, state, and local laws and ordinances, including <ln numlevel="1" lineno="384" slineno="3-42"/>any storm water protection laws and ordinances.</subsection></subsection><subsection ssid="3-null-27" dnum="ii-o" numlevel="1" lineno="385" slineno="3-43" level="3"><display>(ii)</display>"Plan review" does not mean a review of:<subsection ssid="3-null-28" dnum="A-o" numlevel="1" lineno="386" slineno="3-44" level="4"><display>(A)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="63" groupid="58" style="2" owner="jchristopherson" level="1" deltag="both">a document required to be re-submitted</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="190" groupid="150" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a document that an applicant is <ln numlevel="1" lineno="387" slineno="3-45"/>required by the county to resubmit</amend> for a construction project other than a <ln numlevel="1" lineno="388" slineno="3-46"/>construction project for a one-or two-family dwelling or townhome if<amend anum="0" ea="amend" pairid="52" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="both"> the plan <ln numlevel="1" lineno="389" slineno="3-47"/>review identifies</amend> additional modifications or substantive changes<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="64" groupid="59" style="2" owner="jchristopherson" level="1" deltag="both"> are <ln numlevel="1" lineno="390" slineno="3-48"/>identified by the plan review</amend><amendoutend style="2"/>;</subsection><subsection ssid="3-null-29" dnum="B-o" numlevel="1" lineno="391" slineno="3-49" level="4"><display>(B)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="183" groupid="143" style="2" owner="jchristopherson" level="1" deltag="both">a document submitted</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="191" groupid="151" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a document that an applicant submits</amend> as part of a <ln numlevel="1" lineno="392" slineno="3-50"/>deferred submittal when requested by the applicant and approved by the <ln numlevel="1" lineno="393" slineno="3-51"/>building official; </subsection><subsection ssid="3-null-30" dnum="C-o" numlevel="1" lineno="394" slineno="3-52" level="4"><display>(C)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="65" groupid="60" style="2" owner="jchristopherson" level="1" deltag="both">a document that, </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="53" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a document that an applicant submits </amend>due to the document's <ln numlevel="1" lineno="395" slineno="3-53"/>technical nature or on the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="66" groupid="61" style="2" owner="jchristopherson" level="1" deltag="both">request of the applicant, is reviewed by a third party</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="54" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="396" slineno="3-54"/>applicant's request</amend>; or</subsection><subsection ssid="3-null-31" dnum="D-o" numlevel="1" lineno="397" slineno="3-55" level="4"><display>(D)</display>a storm water permit.</subsection></subsection></subsection><subsection ssid="3-null-32" dnum="f-o" numlevel="1" lineno="398" slineno="3-56" level="2"><display>(f)</display>"Screening period" means the three business days following the day on which an <ln numlevel="1" lineno="399" slineno="3-57"/>applicant submits an application.</subsection><subsection ssid="3-null-33" dnum="g-o" numlevel="1" lineno="400" slineno="3-58" level="2"><display>(g)</display>"State Construction Code" means the same as that term is defined in Section <xref depth="3" refnumber="15A-1-102"><ln numlevel="1" lineno="401" slineno="3-59"/>15A-1-102</xref>.</subsection><subsection ssid="3-null-34" dnum="h-o" numlevel="1" lineno="402" slineno="3-60" level="2"><display>(h)</display>"State Fire Code" means the same as that term is defined in Section <xref depth="3" refnumber="15A-1-102">15A-1-102</xref>.</subsection><subsection ssid="3-null-35" dnum="i-o" numlevel="1" lineno="403" slineno="3-61" level="2"><display>(i)</display>"Storm water permit" means the same as that term is defined in Section <xref depth="3" refnumber="19-5-108.5">19-5-108.5</xref>.</subsection><subsection ssid="3-null-36" dnum="j-o" numlevel="1" lineno="404" slineno="3-62" level="2"><display>(j)</display>"Structural review" means:<subsection ssid="3-null-37" dnum="i-o" numlevel="1" lineno="405" slineno="3-63" level="3"><display>(i)</display>a review that verifies that a construction project complies with the following: <subsection ssid="3-null-38" dnum="A-o" numlevel="1" lineno="406" slineno="3-64" level="4"><display>(A)</display>footing size and bar placement;</subsection><subsection ssid="3-null-39" dnum="B-o" numlevel="1" lineno="407" slineno="3-65" level="4"><display>(B)</display>foundation thickness and bar placement;</subsection><subsection ssid="3-null-40" dnum="C-o" numlevel="1" lineno="408" slineno="3-66" level="4"><display>(C)</display>beam and header sizes;</subsection><subsection ssid="3-null-41" dnum="D-o" numlevel="1" lineno="409" slineno="3-67" level="4"><display>(D)</display>nailing patterns;</subsection><subsection ssid="3-null-42" dnum="E-o" numlevel="1" lineno="410" slineno="3-68" level="4"><display>(E)</display>bearing points;</subsection><subsection ssid="3-null-43" dnum="F-o" numlevel="1" lineno="411" slineno="3-69" level="4"><display>(F)</display>structural member size and span; and</subsection><subsection ssid="3-null-44" dnum="G-o" numlevel="1" lineno="412" slineno="3-70" level="4"><display>(G)</display>sheathing; or</subsection></subsection><subsection ssid="3-null-45" dnum="ii-o" numlevel="1" lineno="413" slineno="3-71" level="3"><display>(ii)</display>if the review exceeds the scope of the review described in Subsection <xref depth="4" refnumber="17-27a-537(1)(j)(i)">(1)(j)(i)</xref>, a <ln numlevel="1" lineno="414" slineno="3-72"/>review that a licensed engineer conducts.</subsection></subsection><subsection ssid="3-null-46" dnum="k-o" numlevel="1" lineno="415" slineno="3-73" level="2"><display>(k)</display>"Technical nature" means a characteristic that places an item outside the training and <ln numlevel="1" lineno="416" slineno="3-74"/>expertise of an individual who regularly performs plan reviews. </subsection></subsection><subsection ssid="3-null-47" dnum="2-o" numlevel="1" lineno="417" slineno="3-75" level="1" space="false"><display>(2)</display><subsection ssid="3-null-48" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a county collects a fee for the inspection of a construction project, the county <ln numlevel="1" lineno="418" slineno="3-76"/>shall ensure that the construction project receives a prompt inspection.</subsection><subsection ssid="3-null-49" dnum="b-o" numlevel="1" lineno="419" slineno="3-77" level="2"><display>(b)</display>If a county cannot provide a building inspection within three business days after the <ln numlevel="1" lineno="420" slineno="3-78"/>day on which the county receives the request for the inspection, the applicant may <ln numlevel="1" lineno="421" slineno="3-79"/>engage an inspection with a third-party inspection firm from the third-party <ln numlevel="1" lineno="422" slineno="3-80"/>inspection firm list, as described in Section <xref depth="3" refnumber="15A-1-105">15A-1-105</xref>.</subsection><subsection ssid="3-null-50" dnum="c-o" numlevel="1" lineno="423" slineno="3-81" level="2"><display>(c)</display>If an inspector identifies one or more violations of the State Construction Code or <amend anum="0" ea="amend" pairid="33" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="both">the </amend><ln numlevel="1" lineno="424" slineno="3-82"/>State Fire Code during an inspection, the inspector shall give the permit holder <ln numlevel="1" lineno="425" slineno="3-83"/>written notification that:<subsection ssid="3-null-51" dnum="i-o" numlevel="1" lineno="426" slineno="3-84" level="3"><display>(i)</display>identifies each violation;</subsection><subsection ssid="3-null-52" dnum="ii-o" numlevel="1" lineno="427" slineno="3-85" level="3"><display>(ii)</display>upon request by the permit holder, includes a reference to each applicable <ln numlevel="1" lineno="428" slineno="3-86"/>provision of the State Construction Code or <amend anum="0" ea="amend" pairid="36" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="both">the </amend>State Fire Code; and</subsection><subsection ssid="3-null-53" dnum="iii-o" numlevel="1" lineno="429" slineno="3-87" level="3"><display>(iii)</display>is delivered:<subsection ssid="3-null-54" dnum="A-o" numlevel="1" lineno="430" slineno="3-88" level="4"><display>(A)</display>in hardcopy or by electronic means; and</subsection><subsection ssid="3-null-55" dnum="B-o" numlevel="1" lineno="431" slineno="3-89" level="4"><display>(B)</display><amend anum="0" ea="amend" pairid="193" groupid="153" style="1" owner="jchristopherson" level="1" amendtag="both">on </amend>the day on which the inspection occurs.</subsection></subsection></subsection></subsection><subsection ssid="3-null-56" dnum="3-o" numlevel="1" lineno="432" slineno="3-90" level="1" space="false"><display>(3)</display><subsection ssid="3-null-57" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="3-null-58" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>A county that receives an application for a plan review shall determine if the <ln numlevel="1" lineno="433" slineno="3-91"/>application is complete, as described in Subsection <xref depth="4" refnumber="17-27a-537(12)">(12)</xref>, within the screening <ln numlevel="1" lineno="434" slineno="3-92"/>period.</subsection><subsection ssid="3-null-59" dnum="ii-o" numlevel="1" lineno="435" slineno="3-93" level="3" tab="1"><display>(ii)</display>If the county determines an application for a plan review is complete, as <ln numlevel="1" lineno="436" slineno="3-94"/>described in Subsection <xref depth="4" refnumber="17-27a-537(12)">(12)</xref>, within the screening period, the county shall begin <ln numlevel="1" lineno="437" slineno="3-95"/>the plan review process described in Subsection <xref depth="4" refnumber="17-27a-537(4)">(4)</xref>.</subsection></subsection><subsection ssid="3-null-60" dnum="b-o" numlevel="1" lineno="438" slineno="3-96" level="2"><display>(b)</display>If the county determines that an application for a plan review is not complete as <ln numlevel="1" lineno="439" slineno="3-97"/>described in Subsection <xref depth="4" refnumber="17-27a-537(12)">(12)</xref>, and if the county notifies the applicant of the county's <ln numlevel="1" lineno="440" slineno="3-98"/>determination:<subsection ssid="3-null-61" dnum="i-o" numlevel="1" lineno="441" slineno="3-99" level="3"><display>(i)</display>before 5 p.m. on the last day of the screening period, the county may:<subsection ssid="3-null-62" dnum="A-o" numlevel="1" lineno="442" slineno="3-100" level="4"><display>(A)</display>pause the screening period until the applicant ensures the application meets <ln numlevel="1" lineno="443" slineno="3-101"/>the requirements of Subsection <xref depth="4" refnumber="17-27a-537(12)">(12)</xref>; or</subsection><subsection ssid="3-null-63" dnum="B-o" numlevel="1" lineno="444" slineno="3-102" level="4"><display>(B)</display>reject the incomplete application; or</subsection></subsection><subsection ssid="3-null-64" dnum="ii-o" numlevel="1" lineno="445" slineno="3-103" level="3"><display>(ii)</display>after 5 p.m. on the last day of the screening period, the county may not pause the <ln numlevel="1" lineno="446" slineno="3-104"/>screening period and shall begin the plan review process described in Subsection <xref depth="4" refnumber="17-27a-537(4)"><ln numlevel="1" lineno="447" slineno="3-105"/>(4)</xref>.</subsection></subsection><subsection ssid="3-null-65" dnum="c-o" numlevel="1" lineno="448" slineno="3-106" level="2"><display>(c)</display>If an application is rejected as described in Subsection <xref depth="4" refnumber="17-27a-537(3)(b)(i)(b)">(3)(b)(i)(B)</xref> and an applicant <ln numlevel="1" lineno="449" slineno="3-107"/>resubmits the application, the resubmission begins a new screening period in which <ln numlevel="1" lineno="450" slineno="3-108"/>the county shall review the resubmitted application <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="67" groupid="62" style="2" owner="jchristopherson" level="1" deltag="both">to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="55" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">and</amend> determine if the <ln numlevel="1" lineno="451" slineno="3-109"/>application is complete as described in Subsection <xref depth="4" refnumber="17-27a-537(12)">(12)</xref>.</subsection><subsection ssid="3-null-66" dnum="d-o" numlevel="1" lineno="452" slineno="3-110" level="2"><display>(d)</display>If the county gives notice of an incomplete application after 5 p.m. on the last day of <ln numlevel="1" lineno="453" slineno="3-111"/>the screening period, the county:<subsection ssid="3-null-67" dnum="i-o" numlevel="1" lineno="454" slineno="3-112" level="3"><display>(i)</display>shall immediately notify the applicant that the county has determined the <ln numlevel="1" lineno="455" slineno="3-113"/>application is not complete and the basis for the determination;</subsection><subsection ssid="3-null-68" dnum="ii-o" numlevel="1" lineno="456" slineno="3-114" level="3"><display>(ii)</display>may not, except as provided in Subsection <xref depth="4" refnumber="17-27a-537(3)(d)(iii)">(3)(d)(iii)</xref>, pause the relevant time <ln numlevel="1" lineno="457" slineno="3-115"/>period described in Subsection <xref depth="4" refnumber="17-27a-537(4)">(4)</xref>; and</subsection><subsection ssid="3-null-69" dnum="iii-o" numlevel="1" lineno="458" slineno="3-116" level="3"><display>(iii)</display>may pause the relevant time period described in Subsection <xref refnumber="17-36-55(4)(a)" depth="4">(4)(a)</xref> or (b) as <ln numlevel="1" lineno="459" slineno="3-117"/>described in Subsection <xref refnumber="17-36-55(4)(c)" depth="4">(4)(c)</xref>.</subsection></subsection></subsection><subsection ssid="3-null-70" dnum="4-o" numlevel="1" lineno="460" slineno="3-118" level="1" space="false"><display>(4)</display><subsection ssid="3-null-71" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="17-27a-537(7)">(7)</xref>, once a county determines an application for <ln numlevel="1" lineno="461" slineno="3-119"/>plan review is complete, or proceeds to review an incomplete application for plan <ln numlevel="1" lineno="462" slineno="3-120"/>review under Subsection <xref depth="4" refnumber="17-27a-537(3)(b)(ii)">(3)(b)(ii)</xref>, the county shall complete a plan review of a <ln numlevel="1" lineno="463" slineno="3-121"/>construction project for a one- or two-family dwelling or townhome by no later than <ln numlevel="1" lineno="464" slineno="3-122"/>14 business days after the day on which the screening period for the application ends.</subsection><subsection ssid="3-null-72" dnum="b-o" numlevel="1" lineno="465" slineno="3-123" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="17-27a-537(7)">(7)</xref>, once a county determines an application for <ln numlevel="1" lineno="466" slineno="3-124"/>plan review is complete, or proceeds to review an incomplete application for plan <ln numlevel="1" lineno="467" slineno="3-125"/>review under Subsection <xref tempid="133" depth="4" refnumber="17-36-55(3)(b)(ii)">(3)(b)(ii)</xref>, the county shall complete a plan review of a <ln numlevel="1" lineno="468" slineno="3-126"/>construction project for a residential structure built under the State Construction Code <ln numlevel="1" lineno="469" slineno="3-127"/>that is not a one- or two-family dwelling, townhome, or a lodging establishment, by <ln numlevel="1" lineno="470" slineno="3-128"/>no later than 21 business days after the day on which the screening period for the <ln numlevel="1" lineno="471" slineno="3-129"/>application ends.</subsection><subsection ssid="3-null-73" dnum="c-o" numlevel="1" lineno="472" slineno="3-130" level="2"><display>(c)</display>If a county gives notice of an incomplete application as described in Subsection <xref refnumber="17-36-55(3)(d)" depth="4">(3)(d)</xref>, <ln numlevel="1" lineno="473" slineno="3-131"/>the county:<subsection ssid="3-null-74" dnum="i-o" numlevel="1" lineno="474" slineno="3-132" level="3"><display>(i)</display>may pause the time period described in Subsection <xref depth="4" refnumber="17-27a-537(4)(a)">(4)(a)</xref> or <xref depth="4" refnumber="17-27a-537(b)">(b)</xref>:<subsection ssid="3-null-75" dnum="A-o" numlevel="1" lineno="475" slineno="3-133" level="4"><display>(A)</display>within the last five days of the relevant time period; and</subsection><subsection ssid="3-null-76" dnum="B-o" numlevel="1" lineno="476" slineno="3-134" level="4"><display>(B)</display>until the applicant provides the county with the information necessary to <ln numlevel="1" lineno="477" slineno="3-135"/>consider the application complete under Subsection <xref refnumber="17-36-55(12)" depth="4">(12)</xref>;</subsection></subsection><subsection ssid="3-null-77" dnum="ii-o" numlevel="1" lineno="478" slineno="3-136" level="3"><display>(ii)</display>shall resume the relevant time period upon receipt of the information necessary to <ln numlevel="1" lineno="479" slineno="3-137"/>consider the application complete; and</subsection><subsection ssid="3-null-78" dnum="iii-o" numlevel="1" lineno="480" slineno="3-138" level="3"><display>(iii)</display>may, if necessary, use five additional days beginning the day on which the <ln numlevel="1" lineno="481" slineno="3-139"/>county receives the information described in Subsection <xref depth="4" refnumber="17-27a-537(4)(c)(ii)">(4)(c)(ii)</xref> to consider <ln numlevel="1" lineno="482" slineno="3-140"/>whether the application meets the requirements for a building permit, even if the <ln numlevel="1" lineno="483" slineno="3-141"/>five additional days extend beyond the relevant time period described in <ln numlevel="1" lineno="484" slineno="3-142"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="196" groupid="156" style="2" owner="jchristopherson" level="1" deltag="both">4(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="195" groupid="155" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="17-79-810(4)(a)" depth="4">(4)(a</xref>)</amend> or <xref depth="4" refnumber="17-79-810(b)">(b)</xref>.</subsection></subsection><subsection ssid="3-null-79" dnum="d-o" numlevel="1" lineno="485" slineno="3-143" level="2"><display>(d)</display>If, at the conclusion of plan review, the county determines the application meets the <ln numlevel="1" lineno="486" slineno="3-144"/>requirements for a building permit, the county shall approve the application and, <ln numlevel="1" lineno="487" slineno="3-145"/>subject to Subsection <xref depth="4" refnumber="17-27a-537(10)(b)">(10)(b)</xref>, issue the building permit to the applicant.</subsection></subsection><subsection ssid="3-null-80" dnum="5-o" numlevel="1" lineno="488" slineno="3-146" level="1" space="false"><display>(5)</display><subsection ssid="3-null-81" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A county may utilize another government entity to determine if an application is <ln numlevel="1" lineno="489" slineno="3-147"/>complete or perform a plan review, in whole or in part.</subsection><subsection ssid="3-null-82" dnum="b-o" numlevel="1" lineno="490" slineno="3-148" level="2"><display>(b)</display>A county that utilizes another government entity to determine if an application is <ln numlevel="1" lineno="491" slineno="3-149"/>complete or perform a plan review, as described in Subsection <xref depth="4" refnumber="17-27a-537(5)(a)">(5)(a)</xref>, shall:<subsection ssid="3-null-83" dnum="i-o" numlevel="1" lineno="492" slineno="3-150" level="3"><display>(i)</display>notify any other government entities, including water providers, within 24 hours <ln numlevel="1" lineno="493" slineno="3-151"/>of receiving any building permit application; and</subsection><subsection ssid="3-null-84" dnum="ii-o" numlevel="1" lineno="494" slineno="3-152" level="3"><display>(ii)</display>provide the government entity <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="69" groupid="64" style="2" owner="jchristopherson" level="1" deltag="both">all</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="57" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> documents necessary to determine if an <ln numlevel="1" lineno="495" slineno="3-153"/>application is complete or perform a plan review, in whole or in part, as requested <ln numlevel="1" lineno="496" slineno="3-154"/>by the county.</subsection></subsection></subsection><subsection ssid="3-null-85" dnum="6-o" numlevel="1" lineno="497" slineno="3-155" level="1"><display>(6)</display>A government entity determining if an application is complete or performing a plan <ln numlevel="1" lineno="498" slineno="3-156"/>review, in whole or in part, as requested by a county, shall:<subsection ssid="3-null-86" dnum="a-o" numlevel="1" lineno="499" slineno="3-157" level="2"><display>(a)</display>comply with the requirements of this chapter; and</subsection><subsection ssid="3-null-87" dnum="b-o" numlevel="1" lineno="500" slineno="3-158" level="2"><display>(b)</display>notify the county within the screening period whether the application, or a portion of <ln numlevel="1" lineno="501" slineno="3-159"/>the application, is complete.</subsection></subsection><subsection ssid="3-null-88" dnum="7-o" numlevel="1" lineno="502" slineno="3-160" level="1"><display>(7)</display>An applicant may:<subsection ssid="3-null-89" dnum="a-o" numlevel="1" lineno="503" slineno="3-161" level="2"><display>(a)</display>waive the plan review time requirements described in Subsection <xref refnumber="17-36-55(4)" depth="4">(4)</xref>; or</subsection><subsection ssid="3-null-90" dnum="b-o" numlevel="1" lineno="504" slineno="3-162" level="2"><display>(b)</display>with the county's written consent, establish an alternative plan review time <ln numlevel="1" lineno="505" slineno="3-163"/>requirement.</subsection></subsection><subsection ssid="3-null-91" dnum="8-o" numlevel="1" lineno="506" slineno="3-164" level="1" space="false"><display>(8)</display><subsection ssid="3-null-92" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A county may not enforce a requirement to have a plan review if:<subsection ssid="3-null-93" dnum="i-o" numlevel="1" lineno="507" slineno="3-165" level="3" tab="1"><display>(i)</display>the county does not complete the plan review within the relevant time period <ln numlevel="1" lineno="508" slineno="3-166"/>described in Subsection <xref depth="4" refnumber="17-27a-537(4)">(4)</xref>; and</subsection><subsection ssid="3-null-94" dnum="ii-o" numlevel="1" lineno="509" slineno="3-167" level="3" tab="1"><display>(ii)</display>a licensed architect or structural engineer, or both when required by law, stamps <ln numlevel="1" lineno="510" slineno="3-168"/>the plan.</subsection></subsection><subsection ssid="3-null-95" dnum="b-o" numlevel="1" lineno="511" slineno="3-169" level="2"><display>(b)</display>If a county is prohibited from enforcing a requirement to have a plan review under <ln numlevel="1" lineno="512" slineno="3-170"/>Subsection <xref depth="4" refnumber="17-27a-537(8)(a)">(8)(a)</xref>, the county shall return to the applicant the plan review fee.</subsection></subsection><subsection ssid="3-null-96" dnum="9-o" numlevel="1" lineno="513" slineno="3-171" level="1" space="false"><display>(9)</display><subsection ssid="3-null-97" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A county may attach to a reviewed plan a list that includes:<subsection ssid="3-null-98" dnum="i-o" numlevel="1" lineno="514" slineno="3-172" level="3" tab="1"><display>(i)</display>items with which the county is concerned and may enforce during construction; <ln numlevel="1" lineno="515" slineno="3-173"/>and</subsection><subsection ssid="3-null-99" dnum="ii-o" numlevel="1" lineno="516" slineno="3-174" level="3" tab="1"><display>(ii)</display>building code violations found in the plan.</subsection></subsection><subsection ssid="3-null-100" dnum="b-o" numlevel="1" lineno="517" slineno="3-175" level="2"><display>(b)</display>A county may not require an applicant to redraft a plan if the county requests minor <ln numlevel="1" lineno="518" slineno="3-176"/>changes to the plan that the list described in Subsection <xref depth="4" refnumber="17-27a-537(9)(a)">(9)(a)</xref> identifies.</subsection><subsection ssid="3-null-101" dnum="c-o" numlevel="1" lineno="519" slineno="3-177" level="2"><display>(c)</display>A county may require a single resubmittal of plans for a one- or two-family dwelling <ln numlevel="1" lineno="520" slineno="3-178"/>or townhome if deficiencies in the plan would affect the site plan interaction or <ln numlevel="1" lineno="521" slineno="3-179"/>footprint of the design.</subsection></subsection><subsection ssid="3-null-102" dnum="10-o" numlevel="1" lineno="522" slineno="3-180" level="1" space="false"><display>(10)</display><subsection ssid="3-null-103" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a county charges a fee for a building permit, the county may not refuse <ln numlevel="1" lineno="523" slineno="3-181"/>payment of the fee at the time the applicant submits an application under Subsection <xref depth="4" refnumber="17-27a-537(3)"><ln numlevel="1" lineno="524" slineno="3-182"/>(3)</xref>.</subsection><subsection ssid="3-null-104" dnum="b-o" numlevel="1" lineno="525" slineno="3-183" level="2"><display>(b)</display>If a county charges a fee for a building permit and does not require the fee for a <ln numlevel="1" lineno="526" slineno="3-184"/>building permit to be included in an application for plan review, upon approval of an <ln numlevel="1" lineno="527" slineno="3-185"/>application for plan review under Subsection <xref depth="4" refnumber="17-27a-537(4)(d)">(4)(d)</xref>, the county may require the <ln numlevel="1" lineno="528" slineno="3-186"/>applicant to pay the fee for the building permit before the county issues the building <ln numlevel="1" lineno="529" slineno="3-187"/>permit.</subsection></subsection><subsection ssid="3-null-105" dnum="11-o" numlevel="1" lineno="530" slineno="3-188" level="1"><display>(11)</display>A county may not limit the number of  applications submitted under Subsection <xref depth="4" refnumber="17-27a-537(3)">(3)</xref>.</subsection><subsection ssid="3-null-106" dnum="12-o" numlevel="1" lineno="531" slineno="3-189" level="1"><display>(12)</display>For purposes of Subsection <xref depth="4" refnumber="17-27a-537(3)">(3)</xref>, an application for plan review is complete if the <ln numlevel="1" lineno="532" slineno="3-190"/>application contains:<subsection ssid="3-null-107" dnum="a-o" numlevel="1" lineno="533" slineno="3-191" level="2"><display>(a)</display>the name, address, and contact information of:<subsection ssid="3-null-108" dnum="i-o" numlevel="1" lineno="534" slineno="3-192" level="3"><display>(i)</display>the applicant; and</subsection><subsection ssid="3-null-109" dnum="ii-o" numlevel="1" lineno="535" slineno="3-193" level="3"><display>(ii)</display>the construction manager/general contractor, as defined in Section <xref depth="3" refnumber="63G-6a-103">63G-6a-103</xref>, <ln numlevel="1" lineno="536" slineno="3-194"/>for the construction project;</subsection></subsection><subsection ssid="3-null-110" dnum="b-o" numlevel="1" lineno="537" slineno="3-195" level="2"><display>(b)</display>a site plan for the construction project that:<subsection ssid="3-null-111" dnum="i-o" numlevel="1" lineno="538" slineno="3-196" level="3"><display>(i)</display>is drawn to scale;</subsection><subsection ssid="3-null-112" dnum="ii-o" numlevel="1" lineno="539" slineno="3-197" level="3"><display>(ii)</display>includes a north arrow and legend; and</subsection><subsection ssid="3-null-113" dnum="iii-o" numlevel="1" lineno="540" slineno="3-198" level="3"><display>(iii)</display>provides specifications for the following:<subsection ssid="3-null-114" dnum="A-o" numlevel="1" lineno="541" slineno="3-199" level="4"><display>(A)</display>lot size and dimensions;</subsection><subsection ssid="3-null-115" dnum="B-o" numlevel="1" lineno="542" slineno="3-200" level="4"><display>(B)</display>setbacks and overhangs for setbacks;</subsection><subsection ssid="3-null-116" dnum="C-o" numlevel="1" lineno="543" slineno="3-201" level="4"><display>(C)</display>easements;</subsection><subsection ssid="3-null-117" dnum="D-o" numlevel="1" lineno="544" slineno="3-202" level="4"><display>(D)</display>property lines;</subsection><subsection ssid="3-null-118" dnum="E-o" numlevel="1" lineno="545" slineno="3-203" level="4"><display>(E)</display>topographical details, if the slope of the lot is greater than 10%;</subsection><subsection ssid="3-null-119" dnum="F-o" numlevel="1" lineno="546" slineno="3-204" level="4"><display>(F)</display>retaining walls;</subsection><subsection ssid="3-null-120" dnum="G-o" numlevel="1" lineno="547" slineno="3-205" level="4"><display>(G)</display>hard surface areas;</subsection><subsection ssid="3-null-121" dnum="H-o" numlevel="1" lineno="548" slineno="3-206" level="4"><display>(H)</display>curb and gutter elevations as indicated in the subdivision documents;</subsection><subsection ssid="3-null-122" dnum="I-o" numlevel="1" lineno="549" slineno="3-207" level="4"><display>(I)</display>existing and proposed utilities, including water, sewer, and subsurface drainage <ln numlevel="1" lineno="550" slineno="3-208"/>facilities;</subsection><subsection ssid="3-null-123" dnum="J-o" numlevel="1" lineno="551" slineno="3-209" level="4"><display>(J)</display>street names;</subsection><subsection ssid="3-null-124" dnum="K-o" numlevel="1" lineno="552" slineno="3-210" level="4"><display>(K)</display>driveway locations;</subsection><subsection ssid="3-null-125" dnum="L-o" numlevel="1" lineno="553" slineno="3-211" level="4"><display>(L)</display>defensible space provisions and elevations, if required by the Utah Wildland <ln numlevel="1" lineno="554" slineno="3-212"/>Urban Interface Code adopted under Section <xref depth="3" refnumber="15A-2-103">15A-2-103</xref>; and</subsection><subsection ssid="3-null-126" dnum="M-o" numlevel="1" lineno="555" slineno="3-213" level="4"><display>(M)</display>the location of the nearest hydrant;</subsection></subsection></subsection><subsection ssid="3-null-127" dnum="c-o" numlevel="1" lineno="556" slineno="3-214" level="2"><display>(c)</display>construction plans and drawings, including:<subsection ssid="3-null-128" dnum="i-o" numlevel="1" lineno="557" slineno="3-215" level="3"><display>(i)</display>elevations, only if the construction project is new construction;</subsection><subsection ssid="3-null-129" dnum="ii-o" numlevel="1" lineno="558" slineno="3-216" level="3"><display>(ii)</display>floor plans for each level, including the location and size of doors, windows, and <ln numlevel="1" lineno="559" slineno="3-217"/>egress;</subsection><subsection ssid="3-null-130" dnum="iii-o" numlevel="1" lineno="560" slineno="3-218" level="3"><display>(iii)</display>foundation, structural, and framing detail; </subsection><subsection ssid="3-null-131" dnum="iv-o" numlevel="1" lineno="561" slineno="3-219" level="3"><display>(iv)</display>electrical, mechanical, and plumbing design;</subsection><subsection ssid="3-null-132" dnum="v-o" numlevel="1" lineno="562" slineno="3-220" level="3"><display>(v)</display>a licensed architect's or structural engineer's stamp, when <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">required by law</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the <ln numlevel="1" lineno="563" slineno="3-221"/>law requires</amend>; and</subsection><subsection ssid="3-null-133" dnum="vi-o" numlevel="1" lineno="564" slineno="3-222" level="3"><display>(vi)</display>fire suppression details, when <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">required by fire code</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="37" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the State Fire Code requires</amend>;</subsection></subsection><subsection ssid="3-null-134" dnum="d-o" numlevel="1" lineno="565" slineno="3-223" level="2"><display>(d)</display>documentation of energy code compliance;</subsection><subsection ssid="3-null-135" dnum="e-o" numlevel="1" lineno="566" slineno="3-224" level="2"><display>(e)</display>structural calculations, except for trusses;</subsection><subsection ssid="3-null-136" dnum="f-o" numlevel="1" lineno="567" slineno="3-225" level="2"><display>(f)</display>a geotechnical report, including a slope stability evaluation and retaining wall design, <ln numlevel="1" lineno="568" slineno="3-226"/>if:<subsection ssid="3-null-137" dnum="i-o" numlevel="1" lineno="569" slineno="3-227" level="3"><display>(i)</display>the slope of the lot is greater than 15%; and</subsection><subsection ssid="3-null-138" dnum="ii-o" numlevel="1" lineno="570" slineno="3-228" level="3"><display>(ii)</display>required by the county; </subsection></subsection><subsection ssid="3-null-139" dnum="g-o" numlevel="1" lineno="571" slineno="3-229" level="2"><display>(g)</display>a statement indicating that:<subsection ssid="3-null-140" dnum="i-o" numlevel="1" lineno="572" slineno="3-230" level="3"><display>(i)</display>before land disturbance occurs on the subject property, the applicant will obtain a <ln numlevel="1" lineno="573" slineno="3-231"/>storm water permit; and</subsection><subsection ssid="3-null-141" dnum="ii-o" numlevel="1" lineno="574" slineno="3-232" level="3"><display>(ii)</display>during actual construction, the applicant shall comply with applicable local <ln numlevel="1" lineno="575" slineno="3-233"/>ordinances and building codes; and</subsection></subsection><subsection ssid="3-null-142" dnum="h-o" numlevel="1" lineno="576" slineno="3-234" level="2"><display>(h)</display>the fees, if any, established by ordinance for the county to perform a plan review.</subsection></subsection><subsection ssid="3-null-143" dnum="13-o" numlevel="1" lineno="577" slineno="3-235" level="1"><display>(13)</display>A county may, at the county's discretion, utilize automated review to fulfill, in whole <ln numlevel="1" lineno="578" slineno="3-236"/>or in part, the county's obligation to conduct a plan review described in this section.</subsection><subsection ssid="3-163" dnum="_-o:14-i" numlevel="1" lineno="579" slineno="3-237" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1325" style="1" owner="i" level="1" amendtag="start">(14)</amend></display><subsection ssid="3-181" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1326" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="end">The county shall automatically approve an application for a plan review if:</amend><subsection ssid="3-164" dnum="_-o:i-i" numlevel="1" lineno="580" slineno="3-238" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1327" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">the application is for an alteration to an owner-occupied, single-family dwelling;</amend></subsection><subsection ssid="3-182" dnum="_-o:ii-i" numlevel="1" lineno="581" slineno="3-239" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1328" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="178" groupid="138" style="1" owner="jchristopherson" level="1" amendtag="end">the application is complete, as described in Subsection <xref depth="4" refnumber="17-79-810(12)">(12)</xref>;</amend></subsection><subsection ssid="3-166" dnum="_-o:iii-i" numlevel="1" lineno="582" slineno="3-240" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1329" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="126" groupid="104" style="1" owner="jchristopherson" level="1" amendtag="end">the applicant includes in the application a signed statement from an individual <ln numlevel="1" lineno="583" slineno="3-241"/>who is licensed and certified as a combination building inspector under Title 58, <ln numlevel="1" lineno="584" slineno="3-242"/>Chapter 56, Building Inspector and Factory Built Housing Licensing Act, <ln numlevel="1" lineno="585" slineno="3-243"/>affirming that:</amend><subsection ssid="3-167" dnum="_-o:A-i" numlevel="1" lineno="586" slineno="3-244" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1330" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">the construction project complies with the provisions of the State Construction <ln numlevel="1" lineno="587" slineno="3-245"/>Code; and</amend></subsection><subsection ssid="3-168" dnum="_-o:B-i" numlevel="1" lineno="588" slineno="3-246" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1331" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="132" groupid="108" style="1" owner="jchristopherson" level="1" amendtag="end">the construction project complies with local ordinances; and </amend></subsection></subsection><subsection ssid="3-175" dnum="_-o:iv-i" numlevel="1" lineno="589" slineno="3-247" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1332" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="153" groupid="122" style="1" owner="jchristopherson" level="1" amendtag="end">the statement described in Subsection <xref depth="4" refnumber="17-79-810(14)(a)(iii)">(14)(a)(iii)</xref> identifies the inspector's license <ln numlevel="1" lineno="590" slineno="3-248"/>number.</amend></subsection></subsection><subsection ssid="3-176" dnum="_-o:b-i" numlevel="1" lineno="591" slineno="3-249" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1333" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="156" groupid="124" style="1" owner="jchristopherson" level="1" amendtag="end">Approval under this Subsection <xref depth="4" refnumber="17-79-810(14)">(14)</xref> does not:</amend><subsection ssid="3-177" dnum="_-o:i-i" numlevel="1" lineno="592" slineno="3-250" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1334" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="159" groupid="126" style="1" owner="jchristopherson" level="1" amendtag="end">relieve the owner or contractor of the obligation to comply with the State <ln numlevel="1" lineno="593" slineno="3-251"/>Construction Code or other applicable laws;</amend></subsection><subsection ssid="3-178" dnum="_-o:ii-i" numlevel="1" lineno="594" slineno="3-252" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1335" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="162" groupid="128" style="1" owner="jchristopherson" level="1" amendtag="end">limit the authority of the county to conduct inspections during construction;
