Section <bold>57-22-2</bold> is amended to read:</secline><catline lineno="23"><bold>57-22-2<parens/>. Definitions.</bold></catline><sectionText lineno="24"><tab/>As used in this chapter:</sectionText><subsection ssid="1-6" dnum="_-o:1-i" numlevel="1" lineno="25" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">"Low-income housing tax credit" means the same as that term is defined in Section <xref depth="3" refnumber="59-2-102"><ln numlevel="1" lineno="26" slineno="1-5"/>59-2-102</xref>.</amend></subsection><subsection ssid="1-null-1" dnum="1-o:2-i" numlevel="1" lineno="27" slineno="1-6" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1001" style="2" owner="o" level="1" deltag="both">(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" space="true">"Owner" includes a </amend>managing agent, leasing agent, or resident manager is <ln numlevel="1" lineno="29" slineno="1-8"/>considered an owner for purposes of notice and other communication required or <ln numlevel="1" lineno="30" slineno="1-9"/>allowed under this chapter unless the agent or manager specifies otherwise in writing <ln numlevel="1" lineno="31" slineno="1-10"/>in the rental agreement.</subsection></subsection><subsection ssid="1-null-2" dnum="2-o:3-i" numlevel="1" lineno="32" slineno="1-11" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1004" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>"Rental agreement" means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="35" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an</amend> agreement, written or oral, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="41" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">which</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="36" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">that</amend> <ln numlevel="1" lineno="33" slineno="1-12"/>establishes or modifies the terms, conditions, rules, or any other provisions regarding the <ln numlevel="1" lineno="34" slineno="1-13"/>use and occupancy of a residential rental unit.</subsection><subsection ssid="1-null-3" dnum="3-o:4-i" numlevel="1" lineno="35" slineno="1-14" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1005" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>"Rental application" means an application required by an owner as a prerequisite to <ln numlevel="1" lineno="36" slineno="1-15"/>the owner entering into a rental agreement for a residential rental unit.</subsection><subsection ssid="1-null-4" dnum="4-o:5-i" numlevel="1" lineno="37" slineno="1-16" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>"Renter" means any person entitled under a rental agreement to occupy a residential <ln numlevel="1" lineno="38" slineno="1-17"/>rental unit to the exclusion of others.</subsection><subsection ssid="1-null-5" dnum="5-o:6-i" numlevel="1" lineno="39" slineno="1-18" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1007" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start" space="true">(6)</amend></display><subsection ssid="1-12" amendtag="end">(a)</amend></display>"Residential rental unit" means a renter's principal place of residence<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="57" groupid="42" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="82" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">.</amend></subsection><subsection ssid="1-16" dnum="_-o:b-i" numlevel="1" lineno="40" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="both">(b)</amend></display> <amend anum="0" ea="amend" pairid="86" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="both">"Residential rental unit" </amend>includes<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="66" groupid="50" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="95" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="1-17" dnum="_-o:i-i" numlevel="1" lineno="41" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>the appurtenances, grounds, and facilities held out for the use of the residential <ln numlevel="1" lineno="42" slineno="1-21"/>renter generally<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="67" groupid="51" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="65" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend> and</subsection><subsection ssid="1-18" dnum="_-o:ii-i" numlevel="1" lineno="43" slineno="1-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="72" groupid="55" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>any other area or facility provided to the renter in the rental agreement.</subsection></subsection><subsection ssid="1-15" dnum="_-o:c-i" numlevel="1" lineno="44" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="both">(c)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="76" groupid="59" style="2" owner="jchristopherson" level="1" deltag="both">  It</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="75" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">"Residential rental unit"</amend> does not include facilities contained in a boarding or <ln numlevel="1" lineno="45" slineno="1-24"/>rooming house or similar facility, mobile home lot, or recreational property rented on <ln numlevel="1" lineno="46" slineno="1-25"/>an occasional basis.</subsection></subsection></section></bsec><bsec buid="2" num="57-22-4" type="amend" src="code" uid="C57-22-S4_2026050620260506" sort="57 22 00040020260506" numlevel="1" lineno="47" slineno="2-1" sn="2"><section number="57-22-4" numlevel="1" lineno="48" slineno="2-2" type="amend"><secline lineno="47">Section 2. Section <bold>57-22-4</bold> is amended to read:</secline><catline lineno="48"><bold>57-22-4<parens/>. Owner's duties.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="49" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>To protect the physical health and safety of the ordinary renter, an owner:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="50" slineno="2-4" level="2"><display>(a)</display>may not rent the premises unless they are safe, sanitary, and fit for human <ln numlevel="1" lineno="51" slineno="2-5"/>occupancy; and</subsection><subsection ssid="2-null-3" dnum="b-o" numlevel="1" lineno="52" slineno="2-6" level="2"><display>(b)</display>shall:<subsection ssid="2-null-4" dnum="i-o" numlevel="1" lineno="53" slineno="2-7" level="3"><display>(i)</display>maintain common areas of the residential rental unit in a sanitary and safe <ln numlevel="1" lineno="54" slineno="2-8"/>condition;</subsection><subsection ssid="2-null-5" dnum="ii-o" numlevel="1" lineno="55" slineno="2-9" level="3"><display>(ii)</display>maintain electrical systems, plumbing, heating, and hot and cold water;</subsection><subsection ssid="2-null-6" dnum="iii-o" numlevel="1" lineno="56" slineno="2-10" level="3"><display>(iii)</display>maintain any air conditioning system in an operable condition;</subsection><subsection ssid="2-null-7" dnum="iv-o" numlevel="1" lineno="57" slineno="2-11" level="3"><display>(iv)</display>maintain other appliances and facilities as specifically contracted in the rental <ln numlevel="1" lineno="58" slineno="2-12"/>agreement; and</subsection><subsection ssid="2-null-8" dnum="v-o" numlevel="1" lineno="59" slineno="2-13" level="3"><display>(v)</display>for buildings containing more than two residential rental units, provide and <ln numlevel="1" lineno="60" slineno="2-14"/>maintain appropriate receptacles for garbage and other waste and arrange for <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="43" style="2" owner="jchristopherson" level="1" deltag="both">its </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="61" slineno="2-15"/>the </amend>removal<amend anum="0" ea="amend" pairid="51" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="both"> of the garbage and other waste</amend>, except to the extent that the renter and <ln numlevel="1" lineno="62" slineno="2-16"/>owner otherwise agree.</subsection></subsection></subsection><subsection ssid="2-null-9" dnum="2-o" numlevel="1" lineno="63" slineno="2-17" level="1"><display>(2)</display>Except as otherwise provided in the rental agreement, an owner shall provide the renter <ln numlevel="1" lineno="64" slineno="2-18"/>at least 24 hours prior notice of the owner's entry into the renter's residential rental unit.</subsection><subsection ssid="2-null-10" dnum="3-o" numlevel="1" lineno="65" slineno="2-19" level="1" space="false"><display>(3)</display><subsection ssid="2-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Before an owner accepts an application fee or any other payment from a <ln numlevel="1" lineno="66" slineno="2-20"/>prospective renter, the owner shall disclose in writing to the prospective renter:<subsection ssid="2-null-12" dnum="i-o" numlevel="1" lineno="67" slineno="2-21" level="3" tab="1"><display>(i)</display>a good faith estimate of:<subsection ssid="2-null-13" dnum="A-o" numlevel="1" lineno="68" slineno="2-22" level="4"><display>(A)</display>the rent amount; and</subsection><subsection ssid="2-null-14" dnum="B-o" numlevel="1" lineno="69" slineno="2-23" level="4"><display>(B)</display>the amount of each fixed, non-rent expense that is part of the rental agreement;</subsection></subsection><subsection ssid="2-null-15" dnum="ii-o" numlevel="1" lineno="70" slineno="2-24" level="3" tab="1"><display>(ii)</display>the type of each use-based, non-rent expense that is part of the rental agreement;</subsection><subsection ssid="2-null-16" dnum="iii-o" numlevel="1" lineno="71" slineno="2-25" level="3" tab="1"><display>(iii)</display>the day on which the residential rental unit is scheduled to be available;</subsection><subsection ssid="2-null-17" dnum="iv-o" numlevel="1" lineno="72" slineno="2-26" level="3" tab="1"><display>(iv)</display>the criteria that the owner will consider in determining the prospective renter's <ln numlevel="1" lineno="73" slineno="2-27"/>eligibility as a renter in the residential rental unit, including criteria related to the <ln numlevel="1" lineno="74" slineno="2-28"/>prospective renter's criminal history, credit, income, employment, or rental <ln numlevel="1" lineno="75" slineno="2-29"/>history; and</subsection><subsection ssid="2-null-18" dnum="v-o" numlevel="1" lineno="76" slineno="2-30" level="3" tab="1"><display>(v)</display>the requirements and process for the prospective renter to recover money the <ln numlevel="1" lineno="77" slineno="2-31"/>prospective renter pays in relation to the residential rental unit, as described in <ln numlevel="1" lineno="78" slineno="2-32"/>Subsection <xref depth="4" refnumber="57-22-4(4)" start="0">(4)</xref>.</subsection></subsection><subsection ssid="2-null-19" dnum="b-o" numlevel="1" lineno="79" slineno="2-33" level="2"><display>(b)</display>An owner may satisfy the written disclosure requirement described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="44" groupid="35" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="57-22-4(3)(a)(i)" start="0"><ln numlevel="1" lineno="80" slineno="2-34"/>(3)(a)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)(a)</amend> through a rental application, deposit agreement, or written summary.</subsection></subsection><subsection ssid="2-null-20" dnum="4-o" numlevel="1" lineno="81" slineno="2-35" level="1" space="false"><display>(4)</display><subsection ssid="2-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A prospective renter may make a written demand to the owner of a residential <ln numlevel="1" lineno="82" slineno="2-36"/>rental unit requesting the return of money the prospective renter paid in relation to <ln numlevel="1" lineno="83" slineno="2-37"/>the rental of the residential rental unit, if:<subsection ssid="2-null-22" dnum="i-o" numlevel="1" lineno="84" slineno="2-38" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="2-null-23" dnum="A-o" level="4" placement="sameline"><display>(A)</display>an amount the owner provides in the good-faith estimate described in <ln numlevel="1" lineno="85" slineno="2-39"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="45" groupid="36" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="57-22-4(3)" start="0">(3)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="43" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)(a)(i)</amend> is different than the amount in the rental agreement; or</subsection><subsection ssid="2-null-24" dnum="B-o" numlevel="1" lineno="86" slineno="2-40" level="4"><display>(B)</display>the rental agreement includes a type of use-based, non-rent expense that was <ln numlevel="1" lineno="87" slineno="2-41"/>not disclosed under Subsection <xref depth="4" refnumber="57-22-4(3)" start="0">(3)</xref>; and</subsection></subsection><subsection ssid="2-null-25" dnum="ii-o" numlevel="1" lineno="88" slineno="2-42" level="3" tab="1"><display>(ii)</display>the prospective renter:<subsection ssid="2-null-26" dnum="A-o" numlevel="1" lineno="89" slineno="2-43" level="4"><display>(A)</display>makes the written demand within five business days after the day on which <ln numlevel="1" lineno="90" slineno="2-44"/>the prospective renter receives the rental agreement; and</subsection><subsection ssid="2-null-27" dnum="B-o" numlevel="1" lineno="91" slineno="2-45" level="4"><display>(B)</display>at the time the prospective renter makes the written demand, has not signed <ln numlevel="1" lineno="92" slineno="2-46"/>the rental agreement or taken possession of the residential rental unit.</subsection></subsection></subsection><subsection ssid="2-null-28" dnum="b-o" numlevel="1" lineno="93" slineno="2-47" level="2"><display>(b)</display>If a prospective renter makes a written demand in accordance with Subsection <xref depth="4" refnumber="57-22-4(4)(a)" start="0">(4)(a)</xref>, <ln numlevel="1" lineno="94" slineno="2-48"/>the owner shall return all money the prospective renter paid the owner within five <ln numlevel="1" lineno="95" slineno="2-49"/>business days after the day on which the owner receives the written demand.</subsection></subsection><subsection ssid="2-null-29" dnum="5-o" numlevel="1" lineno="96" slineno="2-50" level="1"><display>(5)</display>An owner may not charge a renter:<subsection ssid="2-null-30" dnum="a-o" numlevel="1" lineno="97" slineno="2-51" level="2"><display>(a)</display>a late fee that exceeds the greater of:<subsection ssid="2-null-31" dnum="i-o" numlevel="1" lineno="98" slineno="2-52" level="3"><display>(i)</display>10% of the rent agreed to in the rental agreement; or</subsection><subsection ssid="2-null-32" dnum="ii-o" numlevel="1" lineno="99" slineno="2-53" level="3"><display>(ii)</display>$75; or</subsection></subsection><subsection ssid="2-null-33" dnum="b-o" numlevel="1" lineno="100" slineno="2-54" level="2"><display>(b)</display>a fee, fine, assessment, interest, or other cost:<subsection ssid="2-null-34" dnum="i-o" numlevel="1" lineno="101" slineno="2-55" level="3"><display>(i)</display>in an amount greater than the amount agreed to in the rental agreement; or</subsection><subsection ssid="2-null-35" dnum="ii-o" numlevel="1" lineno="102" slineno="2-56" level="3"><display>(ii)</display>that is not included in the rental agreement, unless:<subsection ssid="2-null-36" dnum="A-o" numlevel="1" lineno="103" slineno="2-57" level="4"><display>(A)</display>the rental agreement is on a month-to-month basis; and</subsection><subsection ssid="2-null-37" dnum="B-o" numlevel="1" lineno="104" slineno="2-58" level="4"><display>(B)</display>the owner provides the renter a 15-day notice of the charge.</subsection></subsection></subsection></subsection><subsection ssid="2-null-38" dnum="6-o" numlevel="1" lineno="105" slineno="2-59" level="1"><display>(6)</display>Before an owner and a prospective renter enter into a rental agreement, the owner shall:<subsection ssid="2-null-39" dnum="a-o" numlevel="1" lineno="106" slineno="2-60" level="2"><display>(a)</display>provide the prospective renter a written inventory of the condition of the residential <ln numlevel="1" lineno="107" slineno="2-61"/>rental unit, excluding ordinary wear and tear;</subsection><subsection ssid="2-null-40" dnum="b-o" numlevel="1" lineno="108" slineno="2-62" level="2"><display>(b)</display>furnish the renter a form to document the condition of the residential rental unit and <ln numlevel="1" lineno="109" slineno="2-63"/>then allow the resident a reasonable time after the renter's occupancy of the <ln numlevel="1" lineno="110" slineno="2-64"/>residential rental unit to complete and return the form; or</subsection><subsection ssid="2-null-41" dnum="c-o" numlevel="1" lineno="111" slineno="2-65" level="2"><display>(c)</display>provide the prospective renter an opportunity to conduct a walkthrough inspection of <ln numlevel="1" lineno="112" slineno="2-66"/>the residential rental unit.</subsection></subsection><subsection ssid="2-null-42" dnum="7-o" numlevel="1" lineno="113" slineno="2-67" level="1"><display>(7)</display>At or before the commencement of the rental term under a rental agreement, an owner <ln numlevel="1" lineno="114" slineno="2-68"/>shall:<subsection ssid="2-null-43" dnum="a-o" numlevel="1" lineno="115" slineno="2-69" level="2"><display>(a)</display>disclose in writing to the renter:<subsection ssid="2-null-44" dnum="i-o" numlevel="1" lineno="116" slineno="2-70" level="3"><display>(i)</display>the owner's name, address, and telephone number; or</subsection><subsection ssid="2-null-45" dnum="ii-o" numlevel="1" lineno="117" slineno="2-71" level="3" space="false"><display>(ii)</display><subsection ssid="2-null-46" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the name, address, and telephone number of any person authorized to <ln numlevel="1" lineno="118" slineno="2-72"/>manage the residential rental unit; or</subsection><subsection ssid="2-null-47" dnum="B-o" numlevel="1" lineno="119" slineno="2-73" level="4"><display>(B)</display>the name, address, and telephone number of any person authorized to act for <ln numlevel="1" lineno="120" slineno="2-74"/>and on behalf of the owner for purposes of receiving notice under this chapter <ln numlevel="1" lineno="121" slineno="2-75"/>or performing the owner's duties under this chapter or under the rental <ln numlevel="1" lineno="122" slineno="2-76"/>agreement, if the person authorized to manage the residential rental unit does <ln numlevel="1" lineno="123" slineno="2-77"/>not have authority to receive notice under this chapter; and</subsection></subsection></subsection><subsection ssid="2-null-48" dnum="b-o" numlevel="1" lineno="124" slineno="2-78" level="2"><display>(b)</display>provide the renter:<subsection ssid="2-null-49" dnum="i-o" numlevel="1" lineno="125" slineno="2-79" level="3"><display>(i)</display>an executed copy of the rental agreement, if the rental agreement is a written <ln numlevel="1" lineno="126" slineno="2-80"/>agreement; and</subsection><subsection ssid="2-null-50" dnum="ii-o" numlevel="1" lineno="127" slineno="2-81" level="3"><display>(ii)</display>a copy of any rules and regulations applicable to the residential rental unit.</subsection></subsection></subsection><subsection ssid="2-null-51" dnum="8-o" numlevel="1" lineno="128" slineno="2-82" level="1"><display>(8)</display>Nothing in this section prohibits any fee, fine, assessment, interest, or cost that is <ln numlevel="1" lineno="129" slineno="2-83"/>allowed by law or stated in the rental agreement.</subsection><subsection ssid="2-55" dnum="_-o:9-i" numlevel="1" lineno="130" slineno="2-84" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><subsection ssid="2-61" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">An owner shall provide notice of an increase in the monthly rental amount 60 <ln numlevel="1" lineno="131" slineno="2-85"/>days before the day on which the rent increase takes effect unless:</amend><subsection ssid="2-56" dnum="_-o:i-i" numlevel="1" lineno="132" slineno="2-86" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">the renter is on a month-to-month basis; or</amend></subsection><subsection ssid="2-57" dnum="_-o:ii-i" numlevel="1" lineno="133" slineno="2-87" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">the increase in the monthly rental amount is in response to an increase in <ln numlevel="1" lineno="134" slineno="2-88"/>maximum rent allowed in:</amend><subsection ssid="2-58" dnum="_-o:A-i" numlevel="1" lineno="135" slineno="2-89" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">a low-income tax credit community; or</amend></subsection><subsection ssid="2-59" dnum="_-o:B-i" numlevel="1" lineno="136" slineno="2-90" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">housing subject to Section 8 of the Housing Act of 1937, 42 U.S.C. Sec. 1437f <ln numlevel="1" lineno="137" slineno="2-91"/>et seq.</amend></subsection></subsection></subsection><subsection ssid="2-62" dnum="_-o:b-i" numlevel="1" lineno="138" slineno="2-92" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">Nothing in this Subsection <xref depth="4" refnumber="57-22-4(9)">(9)</xref> prevents an owner from increasing the amount the <ln numlevel="1" lineno="139" slineno="2-93"/>renter pays for any cost, fee, assessment, or fine allowed under the rental agreement, <ln numlevel="1" lineno="140" slineno="2-94"/>including an automatic increase to a cost, fee, assessment, or fine provided in the <ln numlevel="1" lineno="141" slineno="2-95"/>rental agreement.</amend></subsection></subsection><subsection ssid="2-null-52" dnum="9-o:10-i" numlevel="1" lineno="142" slineno="2-96" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1071" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>A renter may not use an owner's failure to comply with a requirement of <ln numlevel="1" lineno="143" slineno="2-97"/>Subsection <xref depth="4" refnumber="57-22-4(2)" start="0">(2)</xref>, <xref depth="4" refnumber="57-22-4(3)" start="0">(3)</xref>, <xref depth="4" refnumber="57-22-4(4)" start="0">(4)</xref>, <xref depth="4" refnumber="57-22-4(5)" start="0">(5)</xref>, <xref depth="4" refnumber="57-22-4(6)" start="0">(6)</xref>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">or </amend><amendoutend style="2"/><xref depth="4" refnumber="57-22-4(7)" start="0">(7)</xref><amend anum="0" ea="amend" pairid="38" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both">, or (9)</amend> as a basis:<subsection ssid="2-null-53" dnum="a-o" numlevel="1" lineno="144" slineno="2-98" level="2"><display>(a)</display>to excuse the renter's compliance with a rental agreement; or</subsection><subsection ssid="2-null-54" dnum="b-o" numlevel="1" lineno="145" slineno="2-99" level="2"><display>(b)</display>to bring a cause of action against the owner.</subsection></subsection></section></bsec><bsec buid="3" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="146" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="146">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="147"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-20-26 9:53 AM</tm></rev></foot></leg>
