Section <bold>57-31-101</bold> is amended to read:</secline><catline lineno="20"><bold>57-31-101<parens/>. Definitions.</bold></catline><sectionText lineno="21"><tab/>As used in this chapter:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="22" slineno="1-4" level="1" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Deed" means an instrument in writing, including <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> conveyance that affects, <ln numlevel="1" lineno="23" slineno="1-5"/>purports to affect, describes, or otherwise concerns <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> right, <amend anum="0" ea="amend" pairid="28" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both">a </amend>title, or <amend anum="0" ea="amend" pairid="29" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both">an </amend>interest <ln numlevel="1" lineno="24" slineno="1-6"/>in real property.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="25" slineno="1-7" level="2"><display>(b)</display>"Deed" does not include<amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend><subsection ssid="1-11" dnum="_-o:i-i" numlevel="1" lineno="26" slineno="1-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="both">(i)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>governing documents as defined in Section <xref depth="3" refnumber="57-8-3">57-8-3</xref> or <xref depth="3" refnumber="57-8a-102">57-8a-102</xref><amend anum="0" ea="amend" pairid="19" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both">;</amend> or</subsection><subsection ssid="1-12" dnum="_-o:ii-i" numlevel="1" lineno="27" slineno="1-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>a reinvestment fee covenant recorded in accordance with Section <xref depth="3" refnumber="57-1-46">57-1-46</xref>.</subsection></subsection></subsection><subsection ssid="1-null-4" dnum="2-o" numlevel="1" lineno="28" slineno="1-10" level="1"><display>(2)</display>"Fraudulent deed" means a deed that is not executed or authorized to be executed by the <ln numlevel="1" lineno="29" slineno="1-11"/>record interest holder.</subsection><subsection ssid="1-null-5" dnum="3-o" numlevel="1" lineno="30" slineno="1-12" level="1"><display>(3)</display>"Interest holder" means a person who holds or possesses <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both">a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="37" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> present, lawful property <ln numlevel="1" lineno="31" slineno="1-13"/>interest in real property<amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both"> that the deed purports to convey or affect</amend>.</subsection><subsection ssid="1-null-6" dnum="4-o" numlevel="1" lineno="32" slineno="1-14" level="1"><display>(4)</display>"Purported grantee" means a person who is identified as the grantee on a fraudulent <ln numlevel="1" lineno="33" slineno="1-15"/>deed.</subsection><subsection ssid="1-null-7" dnum="5-o" numlevel="1" lineno="34" slineno="1-16" level="1"><display>(5)</display>"Purported grantor" means a person who executes or causes to be executed a fraudulent <ln numlevel="1" lineno="35" slineno="1-17"/>deed.</subsection><subsection ssid="1-null-8" dnum="6-o" numlevel="1" lineno="36" slineno="1-18" level="1"><display>(6)</display>"Record interest holder" means a person:<subsection ssid="1-null-9" dnum="a-o" numlevel="1" lineno="37" slineno="1-19" level="2"><display>(a)</display>who holds or possesses <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="40" groupid="38" style="2" owner="jchristopherson" level="1" deltag="both">a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="38" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> present, lawful property interest in real property<amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both"> that <ln numlevel="1" lineno="38" slineno="1-20"/>the deed purports to convey or affect</amend>; and</subsection><subsection ssid="1-null-10" dnum="b-o" numlevel="1" lineno="39" slineno="1-21" level="2"><display>(b)</display>whose name and interest in the real property appears in the county recorder's records <ln numlevel="1" lineno="40" slineno="1-22"/>for the county in which the property is located.</subsection></subsection></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="41" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="41">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="42"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on
