</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">requires social studies instruction on American Exceptionalism and comparative <ln numlevel="1" lineno="14" slineno="0-14"/>government systems;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">requires instruction on the Bible as a literary and historical text;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">requires integration of founding documents in English language arts assessments;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">requires instruction on the roles and responsibilities of government officials;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">allows local education agencies to determine whether applied crafts and technical arts <ln numlevel="1" lineno="19" slineno="0-19"/>courses meet fine arts credit requirements; Section <bold>53E-4-202</bold> is amended to read:</secline><catline lineno="37"><bold>53E-4-202<parens><paren sort="00" type="original" show="true" display="space"><effect>Effective </effect><date>07/01/26</date></paren><paren sort="00" type="original" show="true"><effect>Partially Repealed </effect><date>01/01/28</date></paren></parens>. Core standards for <ln numlevel="1" lineno="38" slineno="1-3"/>Utah public schools -- Notice and hearing requirements.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="39" slineno="1-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="2-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In establishing minimum standards related to curriculum and instruction <ln numlevel="1" lineno="40" slineno="1-5"/>requirements under Section <xref depth="3" refnumber="53E-3-501">53E-3-501</xref>, the state board shall, in consultation with <ln numlevel="1" lineno="41" slineno="1-6"/>local school boards, school superintendents, teachers, employers, and parents <ln numlevel="1" lineno="42" slineno="1-7"/>implement core standards for Utah public schools that will enable students to, among <ln numlevel="1" lineno="43" slineno="1-8"/>other objectives:<subsection ssid="2-null-3" dnum="i-o" numlevel="1" lineno="44" slineno="1-9" level="3" tab="1"><display>(i)</display>communicate effectively, both verbally and through written communication;</subsection><subsection ssid="2-null-4" dnum="ii-o" numlevel="1" lineno="45" slineno="1-10" level="3" tab="1"><display>(ii)</display>apply mathematics; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="2-null-5" dnum="iii-o" numlevel="1" lineno="46" slineno="1-11" level="3" tab="1"><display>(iii)</display>access, analyze, and apply information<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="2-33" dnum="_-o:iv-i" numlevel="1" lineno="47" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">understand history and government as described in Sections <xref depth="3" refnumber="53E-4-208">53E-4-208</xref> and <xref depth="3" refnumber="53G-10-302"><ln numlevel="1" lineno="48" slineno="1-13"/>53G-10-302</xref>.</amend></subsection></subsection><subsection ssid="2-null-6" dnum="b-o" numlevel="1" lineno="49" slineno="1-14" level="2"><display>(b)</display>Except as provided in this public education code, the state board may recommend <ln numlevel="1" lineno="50" slineno="1-15"/>but may not require a local school board or charter school governing board to use:<subsection ssid="2-null-7" dnum="i-o" numlevel="1" lineno="51" slineno="1-16" level="3"><display>(i)</display>a particular curriculum or instructional material; or</subsection><subsection ssid="2-null-8" dnum="ii-o" numlevel="1" lineno="52" slineno="1-17" level="3"><display>(ii)</display>a model curriculum or instructional material.</subsection></subsection></subsection><subsection ssid="2-null-9" dnum="2-o" numlevel="1" lineno="53" slineno="1-18" level="1"><display>(2)</display>The state board shall, in establishing the core standards for Utah public schools:<subsection ssid="2-null-10" dnum="a-o" numlevel="1" lineno="54" slineno="1-19" level="2"><display>(a)</display>identify the basic knowledge, skills, and competencies each student is expected to <ln numlevel="1" lineno="55" slineno="1-20"/>acquire or master as the student advances through the public education system; and</subsection><subsection ssid="2-null-11" dnum="b-o" numlevel="1" lineno="56" slineno="1-21" level="2"><display>(b)</display>align with each other the core standards for Utah public schools and the assessments <ln numlevel="1" lineno="57" slineno="1-22"/>described in Section <xref depth="3" refnumber="53E-4-303">53E-4-303</xref>.</subsection></subsection><subsection ssid="2-null-12" dnum="3-o" numlevel="1" lineno="58" slineno="1-23" level="1"><display>(3)</display>The basic knowledge, skills, and competencies identified <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in accordance <ln numlevel="1" lineno="59" slineno="1-24"/>with</amend> Subsection <xref depth="4" refnumber="53E-4-202(2)(a)">(2)(a)</xref> shall increase in depth and complexity from year to year and <ln numlevel="1" lineno="60" slineno="1-25"/>focus on consistent and continual progress within and between grade levels and courses <ln numlevel="1" lineno="61" slineno="1-26"/>in the basic academic areas of:<subsection ssid="2-null-13" dnum="a-o" numlevel="1" lineno="62" slineno="1-27" level="2"><display>(a)</display>English, including explicit phonics, spelling, grammar, reading, writing, vocabulary, <ln numlevel="1" lineno="63" slineno="1-28"/>speech, and listening; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="2-null-14" dnum="b-o" numlevel="1" lineno="64" slineno="1-29" level="2"><display>(b)</display>mathematics, including basic computational skills<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="2-34" dnum="_-o:c-i" numlevel="1" lineno="65" slineno="1-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">social studies, including history and government as described in Sections <xref depth="3" refnumber="53E-4-208">53E-4-208</xref> <ln numlevel="1" lineno="66" slineno="1-31"/>and <xref depth="3" refnumber="53G-10-302">53G-10-302</xref>.</amend></subsection></subsection><subsection ssid="2-null-15" dnum="4-o" numlevel="1" lineno="67" slineno="1-32" level="1"><display>(4)</display>Before adopting core standards for Utah public schools, the state board shall:<subsection ssid="2-null-16" dnum="a-o" numlevel="1" lineno="68" slineno="1-33" level="2"><display>(a)</display>publicize draft core standards for Utah public schools for the state, as a class A <ln numlevel="1" lineno="69" slineno="1-34"/>notice under Section <xref depth="3" refnumber="63G-30-102">63G-30-102</xref>, for at least 90 days;</subsection><subsection ssid="2-null-17" dnum="b-o" numlevel="1" lineno="70" slineno="1-35" level="2"><display>(b)</display>invite public comment on the draft core standards for Utah public schools for a <ln numlevel="1" lineno="71" slineno="1-36"/>period of not less than 90 days; and</subsection><subsection ssid="2-null-18" dnum="c-o" numlevel="1" lineno="72" slineno="1-37" level="2"><display>(c)</display>conduct three public hearings that are held in different regions of the state on the <ln numlevel="1" lineno="73" slineno="1-38"/>draft core standards for Utah public schools.</subsection></subsection><subsection ssid="2-null-19" dnum="5-o" numlevel="1" lineno="74" slineno="1-39" level="1"><display>(5)</display>LEA governing boards shall design their school programs, that are supported by <ln numlevel="1" lineno="75" slineno="1-40"/>generally accepted scientific standards of evidence, to focus on the core standards for <ln numlevel="1" lineno="76" slineno="1-41"/>Utah public schools with the expectation that each program will enhance or help achieve <ln numlevel="1" lineno="77" slineno="1-42"/>mastery of the core standards for Utah public schools.</subsection><subsection ssid="2-null-20" dnum="6-o" numlevel="1" lineno="78" slineno="1-43" level="1"><display>(6)</display>Except as provided in Sections <xref depth="3" refnumber="53G-10-103">53G-10-103</xref> and <xref depth="3" refnumber="53G-10-402">53G-10-402</xref>, each school may select <ln numlevel="1" lineno="79" slineno="1-44"/>instructional materials and methods of teaching, that are supported by generally accepted <ln numlevel="1" lineno="80" slineno="1-45"/>scientific standards of evidence, that the school considers most appropriate to meet the <ln numlevel="1" lineno="81" slineno="1-46"/>core standards for Utah public schools.</subsection><subsection ssid="2-null-21" dnum="7-o" numlevel="1" lineno="82" slineno="1-47" level="1"><display>(7)</display>The state may exit any agreement, contract, memorandum of understanding, or <ln numlevel="1" lineno="83" slineno="1-48"/>consortium that cedes control of the core standards for Utah public schools to any other <ln numlevel="1" lineno="84" slineno="1-49"/>entity, including a federal agency or consortium, for any reason, including:<subsection ssid="2-null-22" dnum="a-o" numlevel="1" lineno="85" slineno="1-50" level="2"><display>(a)</display>the cost of developing or implementing the core standards for Utah public schools;</subsection><subsection ssid="2-null-23" dnum="b-o" numlevel="1" lineno="86" slineno="1-51" level="2"><display>(b)</display>the proposed core standards for Utah public schools are inconsistent with community <ln numlevel="1" lineno="87" slineno="1-52"/>values; or</subsection><subsection ssid="2-null-24" dnum="c-o" numlevel="1" lineno="88" slineno="1-53" level="2"><display>(c)</display>the agreement, contract, memorandum of understanding, or consortium:<subsection ssid="2-null-25" dnum="i-o" numlevel="1" lineno="89" slineno="1-54" level="3"><display>(i)</display>was entered into in violation of Chapter 3, Part 8, Implementing Federal or <ln numlevel="1" lineno="90" slineno="1-55"/>National Education Programs, or Title 63J, Chapter 5, Federal Funds Procedures <ln numlevel="1" lineno="91" slineno="1-56"/>Act;</subsection><subsection ssid="2-null-26" dnum="ii-o" numlevel="1" lineno="92" slineno="1-57" level="3"><display>(ii)</display>conflicts with Utah law;</subsection><subsection ssid="2-null-27" dnum="iii-o" numlevel="1" lineno="93" slineno="1-58" level="3"><display>(iii)</display>requires Utah student data to be included in a national or multi-state database;</subsection><subsection ssid="2-null-28" dnum="iv-o" numlevel="1" lineno="94" slineno="1-59" level="3"><display>(iv)</display>requires records of teacher performance to be included in a national or multi-state <ln numlevel="1" lineno="95" slineno="1-60"/>database; or</subsection><subsection ssid="2-null-29" dnum="v-o" numlevel="1" lineno="96" slineno="1-61" level="3"><display>(v)</display>imposes curriculum, assessment, or data tracking requirements on home school or <ln numlevel="1" lineno="97" slineno="1-62"/>private school students.</subsection></subsection></subsection><subsection ssid="2-null-30" dnum="8-o" numlevel="1" lineno="98" slineno="1-63" level="1"><display>(8)</display>The state board shall:<subsection ssid="2-null-31" dnum="a-o" numlevel="1" lineno="99" slineno="1-64" level="2"><display>(a)</display>submit a report in accordance with Section <xref depth="3" refnumber="53E-1-203">53E-1-203</xref> on the development and <ln numlevel="1" lineno="100" slineno="1-65"/>implementation of the core standards for Utah public schools, including the time line <ln numlevel="1" lineno="101" slineno="1-66"/>established for the review of the core standards for Utah public schools; and</subsection><subsection ssid="2-null-32" dnum="b-o" numlevel="1" lineno="102" slineno="1-67" level="2"><display>(b)</display>ensure that the report described in Subsection <xref depth="4" refnumber="53E-4-202(8)(a)">(8)(a)</xref> includes the time line <ln numlevel="1" lineno="103" slineno="1-68"/>established for the review of the core standards for Utah public schools by a <ln numlevel="1" lineno="104" slineno="1-69"/>standards review committee and the recommendations of a standards review <ln numlevel="1" lineno="105" slineno="1-70"/>committee established under Section <xref depth="3" refnumber="53E-4-203">53E-4-203</xref>.</subsection></subsection></section></bsec><bsec buid="14" num="53E-4-208" type="enact" src="code" uid="C53E-4-S208_2026070120260701" sort="53E04 02080020260701" numlevel="1" lineno="106" slineno="2-1" sn="2"><section numlevel="1" lineno="107" slineno="2-2" number="53E-4-208" type="enact"><secline lineno="106">Section 2. Section <bold>53E-4-208</bold> is enacted to read:</secline><catline lineno="107"><bold>53E-4-208<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/26</date></paren></parens>. High-quality open educational resource <ln numlevel="1" lineno="108" slineno="2-3"/>instructional materials for social studies and civics education.</bold></catline><subsection ssid="14-1" dnum="_-o:1-i" numlevel="1" lineno="109" slineno="2-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="14-2" dnum="_-o:a-i" numlevel="1" lineno="110" slineno="2-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">"Open education resource instructional material" means teaching, learning, and <ln numlevel="1" lineno="111" slineno="2-6"/>research resources that are in the public domain or have been released under an <ln numlevel="1" lineno="112" slineno="2-7"/>intellectual property license that allows for free use, reuse, modification, and sharing <ln numlevel="1" lineno="113" slineno="2-8"/>with others, including full courses, course materials, modules, textbooks, streaming <ln numlevel="1" lineno="114" slineno="2-9"/>videos, tests, software, and any other tools, materials, or techniques used to support <ln numlevel="1" lineno="115" slineno="2-10"/>access to knowledge.</amend></subsection><subsection ssid="14-3" dnum="_-o:b-i" numlevel="1" lineno="116" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">"Utah core standards" means the standards described in Section <xref depth="3" refnumber="53E-4-202">53E-4-202</xref>.</amend></subsection></subsection><subsection ssid="14-4" dnum="_-o:2-i" numlevel="1" lineno="117" slineno="2-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding any other provision in this part, and subject to legislative <ln numlevel="1" lineno="118" slineno="2-13"/>appropriation, the state board shall:</amend><subsection ssid="14-5" dnum="_-o:a-i" numlevel="1" lineno="119" slineno="2-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">develop comprehensive open educational resource instructional materials for social <ln numlevel="1" lineno="120" slineno="2-15"/>studies and civics education for students in kindergarten through grade 12 that:</amend><subsection ssid="14-6" dnum="_-o:i-i" numlevel="1" lineno="121" slineno="2-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="end">the open educational resource instructional materials are openly licensed under a <ln numlevel="1" lineno="154" slineno="2-49"/>Creative Commons license or equivalent license to allow an LEA to use, adapt, <ln numlevel="1" lineno="155" slineno="2-50"/>customize, and distribute the materials without charge; and</amend></subsection></subsection><subsection ssid="14-32" dnum="_-o:e-i" numlevel="1" lineno="156" slineno="2-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="150" groupid="118" style="1" owner="jchristopherson" level="1" amendtag="end">make the open educational resource instructional materials available through a <ln numlevel="1" lineno="157" slineno="2-52"/>centralized digital platform accessible to all LEAs and the public.</amend></subsection></subsection><subsection ssid="14-33" dnum="_-o:3-i" numlevel="1" lineno="158" slineno="2-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="153" groupid="120" style="1" owner="jchristopherson" level="1" amendtag="end">In developing open educational resource instructional materials under this section, the <ln numlevel="1" lineno="159" slineno="2-54"/>state board shall:</amend><subsection ssid="14-34" dnum="_-o:a-i" numlevel="1" lineno="160" slineno="2-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="160" groupid="125" style="1" owner="jchristopherson" level="1" amendtag="end">consult with LEAs, teachers, curriculum specialists, and other education stakeholders;</amend></subsection><subsection ssid="14-35" dnum="_-o:b-i" numlevel="1" lineno="161" slineno="2-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="165" groupid="129" style="1" owner="jchristopherson" level="1" amendtag="end">establish timelines for phased development and implementation;</amend></subsection><subsection ssid="14-36" dnum="_-o:c-i" numlevel="1" lineno="162" slineno="2-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="170" groupid="133" style="1" owner="jchristopherson" level="1" amendtag="end">provide opportunities for pilot programs and field testing before statewide release;</amend></subsection><subsection ssid="14-37" dnum="_-o:d-i" numlevel="1" lineno="163" slineno="2-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="175" groupid="137" style="1" owner="jchristopherson" level="1" amendtag="end">ensure ongoing review and updates to maintain alignment with Utah core standards <ln numlevel="1" lineno="164" slineno="2-59"/>and educational best practices;</amend></subsection><subsection ssid="14-38" dnum="_-o:e-i" numlevel="1" lineno="165" slineno="2-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="180" groupid="141" style="1" owner="jchristopherson" level="1" amendtag="end">ensure open education resource instructional materials are available to all students, <ln numlevel="1" lineno="166" slineno="2-61"/>parents, classroom teachers, and LEAs in this state free of charge, except for a fee for <ln numlevel="1" lineno="167" slineno="2-62"/>the printing or shipping of the material; and</amend></subsection><subsection ssid="14-39" dnum="_-o:f-i" numlevel="1" lineno="168" slineno="2-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="185" groupid="145" style="1" owner="jchristopherson" level="1" amendtag="end">review and update the open educational resource instructional materials whenever the <ln numlevel="1" lineno="169" slineno="2-64"/>state board updates or revises social studies core standards to ensure continued <ln numlevel="1" lineno="170" slineno="2-65"/>alignment with the revised standards and the requirements of Section <xref depth="3" refnumber="53G-10-302">53G-10-302</xref>.</amend></subsection></subsection><subsection ssid="14-40" dnum="_-o:4-i" numlevel="1" lineno="171" slineno="2-66" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="186" groupid="146" style="1" owner="jchristopherson" level="1" amendtag="end">The state board may not require an LEA to adopt or use the open educational resource <ln numlevel="1" lineno="172" slineno="2-67"/>instructional materials developed under this section.</amend></subsection><subsection ssid="14-41" dnum="_-o:5-i" numlevel="1" lineno="173" slineno="2-68" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="189" groupid="148" style="1" owner="jchristopherson" level="1" amendtag="end">The state board may:</amend><subsection ssid="14-42" dnum="_-o:a-i" numlevel="1" lineno="174" slineno="2-69" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="196" groupid="153" style="1" owner="jchristopherson" level="1" amendtag="end">make rules in accordance with level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="211" groupid="165" style="1" owner="jchristopherson" level="1" amendtag="end">establish procedures for LEA access to and use of the open educational resource <ln numlevel="1" lineno="180" slineno="2-75"/>instructional materials; and</amend></subsection><subsection ssid="14-46" dnum="_-o:iv-i" numlevel="1" updates, and maintenance of the open <ln numlevel="1" lineno="182" slineno="2-77"/>educational resource instructional materials;</amend></subsection></subsection><subsection ssid="14-47" dnum="_-o:b-i" numlevel="1" lineno="183" slineno="2-78" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="221" groupid="173" style="1" owner="jchristopherson" level="1" amendtag="end">upon request, report to the Education Interim Committee regarding:</amend><subsection ssid="14-48" dnum="_-o:i-i" numlevel="1" lineno="184" slineno="2-79" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="51" groupid="43" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="12-null-10" dnum="b-o" numlevel="1" lineno="218" slineno="3-28" level="2"><display>(b)</display>ensure that an assessment described in Subsection <xref depth="4" refnumber="53E-4-303(2)(a)" start="0">(2)(a)</xref> is:<subsection ssid="12-null-11" dnum="i-o" numlevel="1" lineno="219" slineno="3-29" level="3"><display>(i)</display>a criterion referenced assessment;</subsection><subsection ssid="12-null-12" dnum="ii-o" numlevel="1" lineno="220" slineno="3-30" level="3"><display>(ii)</display>administered online;</subsection><subsection ssid="12-null-13" dnum="iii-o" numlevel="1" lineno="221" slineno="3-31" level="3"><display>(iii)</display>aligned with the core standards for Utah public schools; and</subsection><subsection ssid="12-null-14" dnum="iv-o" numlevel="1" lineno="222" slineno="3-32" level="3"><display>(iv)</display>adaptable to personalized, competency-based learning, as that term is defined in <ln numlevel="1" lineno="223" slineno="3-33"/>Section <xref depth="3" refnumber="53F-5-501" start="0">53F-5-501</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="47" groupid="39" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="12-44" dnum="_-o:iii-i" numlevel="1" lineno="234" slineno="3-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1113" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">ensuring that the passages and questions described in Subsection <xref depth="4" refnumber="53E-4-303(2)(c)(i)">(2)(c)(i)</xref> assess <ln numlevel="1" lineno="235" slineno="3-45"/>English language arts skills, including reading comprehension, analysis, and <ln numlevel="1" lineno="236" slineno="3-46"/>interpretation of complex texts.</amend></subsection></subsection></subsection><subsection ssid="12-null-15" dnum="3-o" numlevel="1" lineno="237" slineno="3-47" level="1"><display>(3)</display>A school district or charter school shall annually administer the standards assessment <ln numlevel="1" lineno="238" slineno="3-48"/>adopted by the state board under Subsection <xref depth="4" refnumber="53E-4-303(2)" start="0">(2)</xref> to all students in the subjects and grade <ln numlevel="1" lineno="239" slineno="3-49"/>levels described in Subsection <xref depth="4" refnumber="53E-4-303(2)" start="0">(2)</xref>.</subsection><subsection ssid="12-null-16" dnum="4-o" numlevel="1" lineno="240" slineno="3-50" level="1" space="false"><display>(4)</display><subsection ssid="12-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="53E-4-303(4)(b)" start="0">(4)(b)</xref>, a student's score on the standards <ln numlevel="1" lineno="241" slineno="3-51"/>assessment adopted under Subsection <xref depth="4" refnumber="53E-4-303(2)" start="0">(2)</xref> may not be considered in determining:<subsection ssid="12-null-18" dnum="i-o" numlevel="1" lineno="242" slineno="3-52" level="3" tab="1"><display>(i)</display>the student's academic grade for a course; or</subsection><subsection ssid="12-null-19" dnum="ii-o" numlevel="1" lineno="243" slineno="3-53" level="3" tab="1"><display>(ii)</display>whether the student may advance to the next grade level.</subsection></subsection><subsection ssid="12-null-20" dnum="b-o" numlevel="1" lineno="244" slineno="3-54" level="2"><display>(b)</display>A teacher may use a student's score on the standards assessment adopted under <ln numlevel="1" lineno="245" slineno="3-55"/>Subsection <xref depth="4" refnumber="53E-4-303(2)" start="0">(2)</xref> to improve the student's academic grade for or demonstrate the <ln numlevel="1" lineno="246" slineno="3-56"/>student's competency within a relevant course.</subsection></subsection><subsection ssid="12-null-21" dnum="5-o" numlevel="1" lineno="247" slineno="3-57" level="1" space="false"><display>(5)</display><subsection ssid="12-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall establish a committee consisting of 15 parents of Utah public <ln numlevel="1" lineno="248" slineno="3-58"/>education students to review all standards assessment questions.</subsection><subsection ssid="12-null-23" dnum="b-o" numlevel="1" lineno="249" slineno="3-59" level="2"><display>(b)</display>The committee established in Subsection <xref depth="4" refnumber="53E-4-303(5)(a)" start="0">(5)(a)</xref> shall include the following parent <ln numlevel="1" lineno="250" slineno="3-60"/>members:<subsection ssid="12-null-24" dnum="i-o" numlevel="1" lineno="251" slineno="3-61" level="3"><display>(i)</display>five members appointed by the chair of the state board;</subsection><subsection ssid="12-null-25" dnum="ii-o" numlevel="1" lineno="252" slineno="3-62" level="3"><display>(ii)</display>five members appointed by the speaker of the House of Representatives or the <ln numlevel="1" lineno="253" slineno="3-63"/>speaker's designee; and</subsection><subsection ssid="12-null-26" dnum="iii-o" numlevel="1" lineno="254" slineno="3-64" level="3"><display>(iii)</display>five members appointed by the president of the Senate or the president's designee.</subsection></subsection><subsection ssid="12-null-27" dnum="c-o" numlevel="1" lineno="255" slineno="3-65" level="2"><display>(c)</display>The state board shall provide staff support to the parent committee.</subsection><subsection ssid="12-null-28" dnum="d-o" numlevel="1" lineno="256" slineno="3-66" level="2"><display>(d)</display>The term of office of each member appointed in Subsection <xref depth="4" refnumber="53E-4-303(5)(b)" start="0">(5)(b)</xref> is four years.</subsection><subsection ssid="12-null-29" dnum="e-o" numlevel="1" lineno="257" slineno="3-67" level="2"><display>(e)</display>The chair of the state board, the speaker of the House of Representatives, and the <ln numlevel="1" lineno="258" slineno="3-68"/>president of the Senate shall adjust the length of terms to stagger the terms of <ln numlevel="1" lineno="259" slineno="3-69"/>committee members so that approximately half of the committee members are <ln numlevel="1" lineno="260" slineno="3-70"/>appointed every two years.</subsection><subsection ssid="12-null-30" dnum="f-o" numlevel="1" lineno="261" slineno="3-71" level="2"><display>(f)</display>No member may receive compensation or benefits for the member's service on the <ln numlevel="1" lineno="262" slineno="3-72"/>committee.</subsection></subsection></section></bsec><bsec buid="8" num="53G-10-302" type="amend" src="code" uid="C53G-10-S302_2026070120260701" sort="53G10 03020020260701" numlevel="1" lineno="263" slineno="4-1" sn="4"><section number="53G-10-302" numlevel="1" lineno="264" slineno="4-2" type="amend"><secline lineno="263">Section 4. amendtag="end">single-party authoritarian rule; or</amend></subsection><subsection ssid="8-32" dnum="_-o:iv-i" numlevel="1" lineno="284" slineno="4-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">suppression of individual rights and liberties in favor of collective goals.</amend></subsection></subsection><subsection ssid="8-28" dnum="_-o:c-i" numlevel="1" lineno="285" slineno="4-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="both">(c)</amend></display>"Ten Commandments" means the Decalogue, known as the Ten Commandments, as <ln numlevel="1" lineno="286" slineno="4-24"/>recorded in the Hebrew Scriptures in Exodus 20:2-17 and Deuteronomy 5:6-21.</subsection></subsection><subsection ssid="8-null-2" dnum="2-o" numlevel="1" lineno="287" slineno="4-25" level="1"><display>(2)</display>The Legislature <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="833" groupid="651" style="2" owner="jchristopherson" level="1" deltag="both">recognizes</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="831" groupid="649" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">finds</amend> that<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="921" groupid="720" style="2" owner="jchristopherson" level="1" deltag="both"> a proper understanding of American history and <ln numlevel="1" lineno="288" slineno="4-26"/>government is essential to good citizenship, and that the public schools are the primary <ln numlevel="1" lineno="289" slineno="4-27"/>public institutions charged with responsibility for assisting children and youth in gaining <ln numlevel="1" lineno="290" slineno="4-28"/>that understanding.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="920" groupid="719" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="8-199" dnum="_-o:a-i" numlevel="1" lineno="291" slineno="4-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="835" groupid="653" style="1" owner="jchristopherson" level="1" amendtag="end">under Article III of the Utah Constitution, the Legislature has an irrevocable <ln numlevel="1" lineno="292" slineno="4-30"/>obligation to make laws for the establishment and maintenance of a system of public <ln numlevel="1" lineno="293" slineno="4-31"/>schools open to all children of the state;</amend></subsection><subsection ssid="8-207" dnum="_-o:b-i" numlevel="1" lineno="294" slineno="4-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="877" groupid="684" style="1" owner="jchristopherson" level="1" amendtag="end">the Utah Constitution's Preamble declares the purpose "to secure and perpetuate the <ln numlevel="1" lineno="295" slineno="4-33"/>principles of free government";</amend></subsection><subsection ssid="8-208" dnum="_-o:c-i" numlevel="1" lineno="296" slineno="4-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="882" groupid="688" style="1" owner="jchristopherson" level="1" amendtag="end">fulfilling these constitutional duties requires that a student receive effective <ln numlevel="1" lineno="297" slineno="4-35"/>instruction in American history and government; and</amend></subsection><subsection ssid="8-209" dnum="_-o:d-i" numlevel="1" lineno="298" slineno="4-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="887" groupid="692" style="1" owner="jchristopherson" level="1" amendtag="end">such instruction is essential to good citizenship, and the public schools are the <ln numlevel="1" lineno="299" slineno="4-37"/>primary public institutions charged with responsibility for assisting children and <ln numlevel="1" lineno="300" slineno="4-38"/>youth in gaining that understanding.</amend></subsection></subsection><subsection ssid="8-null-3" dnum="3-o" numlevel="1" lineno="301" slineno="4-39" level="1" space="false"><display>(3)</display><subsection ssid="8-null-4" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board and local school boards shall periodically review school curricula <ln numlevel="1" lineno="302" slineno="4-40"/>and activities to ensure that effective instruction in American history and government <ln numlevel="1" lineno="303" slineno="4-41"/>is taking place in the public schools.</subsection><subsection ssid="8-null-5" dnum="b-o" numlevel="1" lineno="304" slineno="4-42" level="2"><display>(b)</display>The boards shall solicit public input as part of the review process.</subsection><subsection ssid="8-null-6" dnum="c-o" numlevel="1" lineno="305" slineno="4-43" level="2"><display>(c)</display>Instruction in American history and government shall include a study of:<subsection ssid="8-null-7" dnum="i-o" numlevel="1" lineno="306" slineno="4-44" level="3"><display>(i)</display>forms of government, such as a republic, a pure democracy, a monarchy, and an <ln numlevel="1" lineno="307" slineno="4-45"/>oligarchy;</subsection><subsection ssid="8-null-8" dnum="ii-o" numlevel="1" lineno="308" slineno="4-46" level="3"><display>(ii)</display>political philosophies and economic systems, such as socialism, individualism, <ln numlevel="1" lineno="309" slineno="4-47"/>and free market capitalism; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="421" groupid="320" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="8-null-9" dnum="iii-o" numlevel="1" lineno="310" slineno="4-48" level="3"><display>(iii)</display>the United States' form of government, a compound constitutional republic<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="303" groupid="226" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="301" groupid="224" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="8-113" dnum="_-o:iv-i" numlevel="1" lineno="311" slineno="4-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="690" groupid="534" style="1" owner="jchristopherson" level="1" amendtag="end">the roles and responsibilities of government officials, including:</amend><subsection ssid="8-170" dnum="_-o:A-i" manner that examines historical impact; and</amend></subsection><subsection ssid="8-193" dnum="_-o:q-i" numlevel="1" lineno="370" slineno="4-108" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1199" style="1" owner="i" level="1" amendtag="start">(q)</amend></display><amend anum="0" ea="amend" pairid="822" groupid="642" style="1" owner="jchristopherson" level="1" amendtag="end">the Utah Constitution and other founding documents and influential writings that <ln numlevel="1" lineno="371" slineno="4-109"/>shaped American constitutional history and civic thought.</amend></subsection></subsection><subsection ssid="8-null-24" dnum="5-o" numlevel="1" lineno="372" slineno="4-110" level="1"><display>(5)</display>To increase student understanding of, and familiarity with, American historical <ln numlevel="1" lineno="373" slineno="4-111"/>documents, public schools may display historically important excerpts from, or copies <ln numlevel="1" lineno="374" slineno="4-112"/>of, those documents in school classrooms and common areas as appropriate.</subsection><subsection ssid="8-null-25" dnum="6-o" numlevel="1" lineno="375" slineno="4-113" level="1"><display>(6)</display>There shall be no content-based censorship of American history and heritage documents <ln numlevel="1" lineno="376" slineno="4-114"/>referred to in this section due to their religious or cultural nature.</subsection><subsection ssid="8-null-26" dnum="7-o" numlevel="1" lineno="377" slineno="4-115" level="1"><display>(7)</display>Public schools shall display "In God we trust," which is declared in 36 U.S.C. 302 to be <ln numlevel="1" lineno="378" slineno="4-116"/>the national motto of the United States, in one or more prominent places within each <ln numlevel="1" lineno="379" slineno="4-117"/>school building.</subsection><subsection ssid="8-34" dnum="_-o:8-i" numlevel="1" lineno="380" slineno="4-118" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1203" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="422" groupid="321" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning in the 2028-2029 school year, the state board shall ensure that social studies <ln numlevel="1" lineno="381" slineno="4-119"/>core standards for students in grade 4 through grade 12 include instruction that compares <ln numlevel="1" lineno="382" slineno="4-120"/>and contrasts the principles and outcomes of the United States anum="0" ea="amend" pairid="1255" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="898" groupid="701" style="1" owner="jchristopherson" level="1" amendtag="end">neither promotes nor disparages any particular religious or nonreligious viewpoint;</amend></subsection><subsection ssid="8-212" dnum="_-o:c-i" numlevel="1" lineno="465" slineno="4-203" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1256" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="903" groupid="705" style="1" owner="jchristopherson" level="1" amendtag="end">focuses on religious texts' literary forms, historical context, and documented <ln numlevel="1" lineno="466" slineno="4-204"/>influence on American civic thought and Utah's settlement history rather than on <ln numlevel="1" lineno="467" slineno="4-205"/>theological or doctrinal questions;</amend></subsection><subsection ssid="8-213" dnum="_-o:d-i" numlevel="1" lineno="468" slineno="4-206" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1257" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="908" groupid="709" style="1" owner="jchristopherson" level="1" amendtag="end">may use multiple translations of religious texts for comparative literary and historical <ln numlevel="1" lineno="469" slineno="4-207"/>analysis;</amend></subsection><subsection ssid="8-214" dnum="_-o:e-i" numlevel="1" lineno="470" slineno="4-208" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1258" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="913" groupid="713" style="1" owner="jchristopherson" level="1" amendtag="end"> acknowledges diverse interpretations of religious texts and their application to <ln numlevel="1" lineno="471" slineno="4-209"/>political thought and settlement history; and</amend></subsection><subsection ssid="8-215" dnum="_-o:f-i" numlevel="1" lineno="472" slineno="4-210" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1259" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="918" groupid="717" style="1" owner="jchristopherson" level="1" amendtag="end">for instruction under Subsection <xref depth="4" refnumber="53G-10-302(10)">(10)</xref>, is integrated with the study of founding <ln numlevel="1" lineno="473" slineno="4-211"/>documents and principles.</amend></subsection></subsection><subsection ssid="8-194" dnum="_-o:12-i" numlevel="1" lineno="474" slineno="4-212" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1260" style="1" owner="i" level="1" amendtag="start">(12)</amend></display><amend anum="0" ea="amend" pairid="823" groupid="643" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall ensure that each review and revision of social studies core <ln numlevel="1" lineno="475" slineno="4-213"/>standards includes the requirements of this section, including instruction on American <ln numlevel="1" lineno="476" slineno="4-214"/>Exceptionalism, comparative government systems, founding documents, and the <ln numlevel="1" lineno="477" slineno="4-215"/>historical and literary context of American civic thought.</amend></subsection><subsection ssid="8-169" dnum="_-o:13-i" numlevel="1" lineno="478" slineno="4-216" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1261" style="1" owner="i" level="1" amendtag="start">(13)</amend></display><amend anum="0" ea="amend" pairid="687" groupid="532" style="1" owner="jchristopherson" level="1" amendtag="end">An LEA shall implement curriculum and instructional materials that align with the <ln numlevel="1" lineno="479" slineno="4-217"/>social studies core standards established under this section and may utilize the open <ln numlevel="1" lineno="480" slineno="4-218"/>educational resource instructional materials developed under Section <xref depth="3" refnumber="53E-4-208">53E-4-208</xref>.</amend></subsection><subsection ssid="8-58" dnum="_-o:14-i" numlevel="1" lineno="481" slineno="4-219" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1262" style="1" owner="i" level="1" amendtag="start">(14)</amend></display><amend anum="0" ea="amend" pairid="136" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="end">Nothing in this section prohibits an LEA from exceeding the minimum standards <ln numlevel="1" lineno="482" slineno="4-220"/>established by the state board under this section.</amend></subsection></section></bsec><bsec buid="3" num="53G-10-307" type="amend" src="code" uid="C53G-10-S307_2026070120260701" sort="53G10 03070020260701" numlevel="1" Section <bold>53G-10-307</bold> is amended to read:</secline><catline lineno="484"><bold>53G-10-307<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/26</date></paren></parens>. Art or fine arts education -- Definition -- Credit <ln numlevel="1" lineno="485" slineno="5-3"/>requirements.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="486" slineno="5-4" level="1" placement="noreturn"><display>(1)</display>As used in this section,  "art" or "fine arts" means:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="487" slineno="5-5" level="2"><display>(a)</display>courses, instruction, or experiences in visual arts, music, dance, or theater;</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="488" slineno="5-6" level="2"><display>(b)</display>courses, instruction, or experiences in applied crafts and technical arts that <ln numlevel="1" lineno="489" slineno="5-7"/>incorporate artistic elements, including:<subsection ssid="3-null-4" dnum="i-o" numlevel="1" lineno="490" slineno="5-8" level="3"><display>(i)</display>woodworking;</subsection><subsection ssid="3-null-5" dnum="ii-o" numlevel="1" lineno="491" slineno="5-9" level="3"><display>(ii)</display>metalworking and welding;</subsection><subsection ssid="3-null-6" dnum="iii-o" numlevel="1" lineno="492" slineno="5-10" level="3"><display>(iii)</display>traditional handcrafts;</subsection><subsection ssid="3-null-7" dnum="iv-o" numlevel="1" lineno="493" slineno="5-11" level="3"><display>(iv)</display>architectural trades, including carpentry, plumbing, masonry, and stonework;</subsection><subsection ssid="3-null-8" dnum="v-o" numlevel="1" lineno="494" slineno="5-12" level="3"><display>(v)</display>automotive design and customization;</subsection><subsection ssid="3-null-9" dnum="vi-o" numlevel="1" lineno="495" slineno="5-13" level="3"><display>(vi)</display>digital design and animation; or</subsection><subsection ssid="3-null-10" dnum="vii-o" numlevel="1" lineno="496" slineno="5-14" level="3"><display>(vii)</display>other similar courses that combine technical skill with artistic expression; and</subsection></subsection><subsection ssid="3-null-11" dnum="c-o" numlevel="1" lineno="497" slineno="5-15" level="2"><display>(c)</display>other forms of creative or interpretive expression as an LEA determines.</subsection></subsection><subsection ssid="3-null-12" dnum="2-o" numlevel="1" lineno="498" slineno="5-16" level="1"><display>(2)</display>For purposes of meeting art or fine arts credit requirements the state board establishes, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="499" slineno="5-17"/>the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an</amend> LEA shall<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both"> accept for an art or fine arts credit any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> determine whether a</amend> course <ln numlevel="1" lineno="500" slineno="5-18"/>listed in Subsection <xref depth="4" refnumber="53G-10-307(1)">(1)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both"> that</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> meets art or fine arts credit requirements and shall accept <ln numlevel="1" lineno="501" slineno="5-19"/>the course for an art or fine arts credit if the LEA determines the course</amend>:<subsection ssid="3-null-13" dnum="a-o" numlevel="1" lineno="502" slineno="5-20" level="2"><display>(a)</display>incorporates artistic or creative elements in the curriculum;</subsection><subsection ssid="3-null-14" dnum="b-o" numlevel="1" lineno="503" slineno="5-21" level="2"><display>(b)</display>includes instruction in principles of design, form, or aesthetic expression; and</subsection><subsection ssid="3-null-15" dnum="c-o" numlevel="1" lineno="504" slineno="5-22" level="2"><display>(c)</display>provides students opportunities for creative expression and artistic application of <ln numlevel="1" lineno="505" slineno="5-23"/>technical skills.</subsection></subsection><subsection ssid="3-null-16" dnum="3-o" numlevel="1" lineno="506" slineno="5-24" level="1"><display>(3)</display>Nothing in this section:<subsection ssid="3-null-17" dnum="a-o" numlevel="1" lineno="507" slineno="5-25" level="2"><display>(a)</display>prevents an LEA from:<subsection ssid="3-null-18" dnum="i-o" numlevel="1" lineno="508" slineno="5-26" level="3"><display>(i)</display>establishing the LEA's own additional criteria for <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">artistic and creative elements in <ln numlevel="1" lineno="509" slineno="5-27"/>courses accepted for fine arts credit</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">courses accepted for fine arts credit</amend>;
