Section <bold>73-18-2</bold> is amended to read:</secline><catline lineno="26"><bold>73-18-2<parens/>. Definitions.</bold></catline><sectionText lineno="27"><tab/>As used in this chapter:</sectionText><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="28" slineno="1-4" level="1"><display>(1)</display>"Anchored" means a vessel that is temporarily attached to the bed or shoreline of a <ln numlevel="1" lineno="29" slineno="1-5"/>waterbody by any method and the hull of the vessel is not touching the bed or shoreline.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="30" slineno="1-6" level="1"><display>(2)</display>"Beached" means that a vessel's hull is resting on the bed or shoreline of a waterbody.</subsection><subsection ssid="3-null-3" dnum="3-o" numlevel="1" lineno="31" slineno="1-7" level="1"><display>(3)</display>"Boat livery" means a person that holds a vessel for renting or leasing.</subsection><subsection ssid="3-null-4" dnum="4-o" numlevel="1" lineno="32" slineno="1-8" level="1"><display>(4)</display>"Carrying passengers for hire" means to transport persons on vessels or to lead persons <ln numlevel="1" lineno="33" slineno="1-9"/>on vessels for consideration.</subsection><subsection ssid="3-null-5" dnum="5-o" numlevel="1" lineno="34" slineno="1-10" level="1"><display>(5)</display>"Commission" means the Outdoor Adventure Commission.</subsection><subsection ssid="3-null-6" dnum="6-o" numlevel="1" lineno="35" slineno="1-11" level="1"><display>(6)</display>"Consideration" means something of value given or done in exchange for something <ln numlevel="1" lineno="36" slineno="1-12"/>given or done by another.</subsection><subsection ssid="3-null-7" dnum="7-o" numlevel="1" lineno="37" slineno="1-13" level="1"><display>(7)</display>"Dealer" means any person who is licensed by the appropriate authority to engage in <ln numlevel="1" lineno="38" slineno="1-14"/>and who is engaged in the business of buying and selling vessels or of manufacturing <ln numlevel="1" lineno="39" slineno="1-15"/>them for sale.</subsection><subsection ssid="3-null-8" dnum="8-o" numlevel="1" lineno="40" slineno="1-16" level="1"><display>(8)</display>"Derelict vessel":<subsection ssid="3-null-9" dnum="a-o" numlevel="1" lineno="41" slineno="1-17" level="2"><display>(a)</display>means a vessel that is left, stored, or abandoned upon the waters of this state in a <ln numlevel="1" lineno="42" slineno="1-18"/>wrecked, junked, or substantially dismantled condition; and</subsection><subsection ssid="3-null-10" dnum="b-o" numlevel="1" lineno="43" slineno="1-19" level="2"><display>(b)</display>includes:<subsection ssid="3-null-11" dnum="i-o" numlevel="1" lineno="44" slineno="1-20" level="3"><display>(i)</display>a vessel left at a Utah port or marina without consent of the agency or other entity <ln numlevel="1" lineno="45" slineno="1-21"/>administering the port or marine area; and</subsection><subsection ssid="3-null-12" dnum="ii-o" numlevel="1" lineno="46" slineno="1-22" level="3"><display>(ii)</display>a vessel left docked or grounded upon a property without the property owner's <ln numlevel="1" lineno="47" slineno="1-23"/>consent.</subsection></subsection></subsection><subsection ssid="3-null-13" dnum="9-o" numlevel="1" lineno="48" slineno="1-24" level="1"><display>(9)</display>"Division" means the Division of Outdoor Recreation.</subsection><subsection ssid="3-null-14" dnum="10-o" numlevel="1" lineno="49" slineno="1-25" level="1"><display>(10)</display>"Moored" means long term, on the water vessel storage in an area designated and <ln numlevel="1" lineno="50" slineno="1-26"/>properly marked by the division or other applicable managing agency.</subsection><subsection ssid="3-null-15" dnum="11-o" numlevel="1" lineno="51" slineno="1-27" level="1"><display>(11)</display>"Motorboat" means any vessel propelled by machinery, whether or not the machinery <ln numlevel="1" lineno="52" slineno="1-28"/>is the principal source of propulsion.</subsection><subsection ssid="3-null-16" dnum="12-o" numlevel="1" lineno="53" slineno="1-29" level="1"><display>(12)</display>"Operate" means to navigate, control, or otherwise use a vessel.</subsection><subsection ssid="3-null-17" dnum="13-o" numlevel="1" lineno="54" slineno="1-30" level="1"><display>(13)</display>"Operator" means the person who is in control of a vessel while it is in use.</subsection><subsection ssid="3-null-18" dnum="14-o" numlevel="1" lineno="55" slineno="1-31" level="1"><display>(14)</display>"Outfitting company" means any person who, for consideration:<subsection ssid="3-null-19" dnum="a-o" numlevel="1" lineno="56" slineno="1-32" level="2"><display>(a)</display>provides equipment to transport persons on all waters of this state; and</subsection><subsection ssid="3-null-20" dnum="b-o" numlevel="1" lineno="57" slineno="1-33" level="2"><display>(b)</display>supervises a person who:<subsection ssid="3-null-21" dnum="i-o" numlevel="1" lineno="58" slineno="1-34" level="3"><display>(i)</display>operates a vessel to transport passengers; or</subsection><subsection ssid="3-null-22" dnum="ii-o" numlevel="1" lineno="59" slineno="1-35" level="3"><display>(ii)</display>leads a person on a vessel.</subsection></subsection></subsection><subsection ssid="3-null-23" dnum="15-o" numlevel="1" lineno="60" slineno="1-36" level="1" space="false"><display>(15)</display><subsection ssid="3-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Owner" means a person, other than a lien holder, holding a proprietary interest <ln numlevel="1" lineno="61" slineno="1-37"/>in or the title to a vessel.</subsection><subsection ssid="3-null-25" dnum="b-o" numlevel="1" lineno="62" slineno="1-38" level="2"><display>(b)</display>"Owner" includes a person entitled to the use or possession of a vessel subject to an <ln numlevel="1" lineno="63" slineno="1-39"/>interest by another person, reserved or created by agreement and securing payment or <ln numlevel="1" lineno="64" slineno="1-40"/>performance of an obligation.</subsection><subsection ssid="3-null-26" dnum="c-o" numlevel="1" lineno="65" slineno="1-41" level="2"><display>(c)</display>"Owner" does not include a lessee under a lease not intended as security.</subsection></subsection><subsection ssid="3-null-27" dnum="16-o" numlevel="1" lineno="66" slineno="1-42" level="1" space="false"><display>(16)</display><subsection ssid="3-null-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Personal watercraft" means a motorboat that is:<subsection ssid="3-null-29" dnum="i-o" numlevel="1" lineno="67" slineno="1-43" level="3" tab="1"><display>(i)</display>less than 16 feet in length;</subsection><subsection ssid="3-null-30" dnum="ii-o" numlevel="1" lineno="68" slineno="1-44" level="3" tab="1"><display>(ii)</display>propelled by a water jet pump or other machinery as the motorboat's primary <ln numlevel="1" lineno="69" slineno="1-45"/>source of motive power; and</subsection><subsection ssid="3-null-31" dnum="iii-o" numlevel="1" lineno="70" slineno="1-46" level="3" tab="1"><display>(iii)</display>designed to be operated by a person sitting, standing, or kneeling on the vessel, <ln numlevel="1" lineno="71" slineno="1-47"/>rather than sitting or standing inside the vessel.</subsection></subsection><subsection ssid="3-null-32" dnum="b-o" numlevel="1" lineno="72" slineno="1-48" level="2"><display>(b)</display>"Personal watercraft" includes a water jet device as part of the personal water craft <ln numlevel="1" lineno="73" slineno="1-49"/>vessel if the water jet device is connected to the personal water craft.</subsection></subsection><subsection ssid="3-null-33" dnum="17-o" numlevel="1" lineno="74" slineno="1-50" level="1"><display>(17)</display>"Racing shell" means a long, narrow watercraft:<subsection ssid="3-null-34" dnum="a-o" numlevel="1" lineno="75" slineno="1-51" level="2"><display>(a)</display>outfitted with long oars and sliding seats; and</subsection><subsection ssid="3-null-35" dnum="b-o" numlevel="1" lineno="76" slineno="1-52" level="2"><display>(b)</display>specifically designed for racing or exercise.</subsection></subsection><subsection ssid="3-null-36" dnum="18-o" numlevel="1" lineno="77" slineno="1-53" level="1"><display>(18)</display>"Sailboat" means any vessel having one or more sails and propelled by wind.</subsection><subsection ssid="3-null-37" dnum="19-o" numlevel="1" lineno="78" slineno="1-54" level="1" space="false"><display>(19)</display><subsection ssid="3-44" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>"Vessel" means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">every</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> type of watercraft, other than a seaplane on the water, <ln numlevel="1" lineno="79" slineno="1-55"/>used or capable of being used as a means of transportation on water.</subsection><subsection ssid="3-43" dnum="_-o:b-i" numlevel="1" lineno="80" slineno="1-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">"Vessel" does not include:</amend><subsection ssid="3-45" dnum="_-o:i-i" numlevel="1" lineno="81" slineno="1-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">an air mattress; or</amend></subsection><subsection ssid="3-46" dnum="_-o:ii-i" numlevel="1" lineno="82" slineno="1-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">an inner tube.</amend></subsection></subsection></subsection><subsection ssid="3-null-38" dnum="20-o" numlevel="1" lineno="83" slineno="1-59" level="1" space="false"><display>(20)</display><subsection ssid="3-41" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>"Wakeless speed" means an operating speed at which the vessel does not create <ln numlevel="1" lineno="84" slineno="1-60"/>or make a wake or white water trailing the vessel.<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">  This speed is not in excess of five <ln numlevel="1" lineno="85" slineno="1-61"/>miles per hour.</amend><amendoutend style="2"/></subsection><subsection ssid="3-42" dnum="_-o:b-i" numlevel="1" lineno="86" slineno="1-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">"Wakeless speed" may not exceed five miles per hour.</amend></subsection></subsection><subsection ssid="3-null-39" dnum="21-o" numlevel="1" lineno="87" slineno="1-63" level="1"><display>(21)</display>"Water jet device" means a device with which an individual rides a hydro-powered <ln numlevel="1" lineno="88" slineno="1-64"/>apparatus above the surface of the water while connected to a personal watercraft or <ln numlevel="1" lineno="89" slineno="1-65"/>other power source that supplies thrust to the water jet device through a hose connecting <ln numlevel="1" lineno="90" slineno="1-66"/>the two devices.</subsection><subsection ssid="3-null-40" dnum="22-o" numlevel="1" lineno="91" slineno="1-67" level="1"><display>(22)</display>"Waters of this state" means any waters within the territorial limits of this state.</subsection></section></bsec><bsec buid="1" num="73-18-8" type="amend" src="code" uid="C73-18-S8_2026050620260506" sort="73 18 00080020260506" numlevel="1" lineno="92" slineno="2-1" sn="2"><section number="73-18-8" numlevel="1" lineno="93" slineno="2-2" type="amend"><secline lineno="92">Section 2. Section <bold>73-18-8</bold> is amended to read:</secline><catline lineno="93"><bold>73-18-8<parens/>. Safety equipment required to be on board vessels -- Penalties.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="94" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="73-18-8(1)(c)" start="0">(1)(c)</xref>, each vessel shall have, for each person on <ln numlevel="1" lineno="95" slineno="2-4"/>board, one wearable personal flotation device that is approved for the type of use by <ln numlevel="1" lineno="96" slineno="2-5"/>the commandant of the United States Coast Guard.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="97" slineno="2-6" level="2"><display>(b)</display>Each personal flotation device shall be:<subsection ssid="1-null-4" dnum="i-o" numlevel="1" lineno="98" slineno="2-7" level="3"><display>(i)</display>in serviceable condition;</subsection><subsection ssid="1-null-5" dnum="ii-o" numlevel="1" lineno="99" slineno="2-8" level="3"><display>(ii)</display>legally marked with the United States Coast Guard approval number; and</subsection><subsection ssid="1-null-6" dnum="iii-o" numlevel="1" lineno="100" slineno="2-9" level="3"><display>(iii)</display>of an appropriate size for the person for whom it is intended.</subsection></subsection><subsection ssid="1-null-7" dnum="c-o" numlevel="1" lineno="101" slineno="2-10" level="2" space="false"><display>(c)</display><subsection ssid="1-null-8" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Sailboards and racing shells are exempt from the provisions of Subsections <xref depth="4" refnumber="73-18-8(1)(a)" start="0"><ln numlevel="1" lineno="102" slineno="2-11"/>(1)(a)</xref> and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="38" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="73-18-8(1)(e)" start="0">(e)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(f)</amend>.</subsection><subsection ssid="1-null-9" dnum="ii-o" numlevel="1" lineno="103" slineno="2-12" level="3"><display>(ii)</display>The division, after notifying the commission, may exempt certain types of vessels <ln numlevel="1" lineno="104" slineno="2-13"/>from the provisions of Subsection <xref depth="4" refnumber="73-18-8(1)(a)" start="0">(1)(a)</xref> under certain conditions or upon certain <ln numlevel="1" lineno="105" slineno="2-14"/>waters.</subsection></subsection><subsection ssid="1-null-10" dnum="d-o" numlevel="1" lineno="106" slineno="2-15" level="2"><display>(d)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">The</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subject to Subsection <xref depth="4" refnumber="73-18-8(1)(e)">(1)(e)</xref>, and in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="107" slineno="2-16"/>Administrative Rulemaking Act, the</amend> division may require by rule, after notifying the <ln numlevel="1" lineno="108" slineno="2-17"/>commission, for personal flotation devices to be worn:<subsection ssid="1-null-11" dnum="i-o" numlevel="1" lineno="109" slineno="2-18" level="3"><display>(i)</display>while a person is on board a certain type of vessel;</subsection><subsection ssid="1-null-12" dnum="ii-o" numlevel="1" lineno="110" slineno="2-19" level="3"><display>(ii)</display>by a person under a certain age; or</subsection><subsection ssid="1-null-13" dnum="iii-o" numlevel="1" lineno="111" slineno="2-20" level="3"><display>(iii)</display>on certain waters of the state.</subsection></subsection><subsection ssid="1-24" dnum="_-o:e-i" numlevel="1" lineno="112" slineno="2-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><subsection ssid="1-29" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">The division may not require a personal flotation device for use:</amend><subsection ssid="1-25" dnum="_-o:A-i" numlevel="1" lineno="113" slineno="2-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">on flatwater, as defined in rule as described in Section <xref depth="3" refnumber="73-18b-1">73-18b-1</xref>;</amend></subsection><subsection ssid="1-26" dnum="_-o:B-i" numlevel="1" lineno="114" slineno="2-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">in a designated and marked swimming area; or</amend></subsection><subsection ssid="1-27" dnum="_-o:C-i" numlevel="1" lineno="115" slineno="2-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">in an area within 50 feet of the shore of a body of water other than whitewater <ln numlevel="1" lineno="116" slineno="2-25"/>designated in rule as described in Section <xref depth="3" refnumber="73-18b-1">73-18b-1</xref>.</amend></subsection></subsection><subsection ssid="1-30" dnum="_-o:ii-i" numlevel="1" lineno="117" slineno="2-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">If a personal flotation device is not required to be worn in a vessel propelled only <ln numlevel="1" lineno="118" slineno="2-27"/>by human power, the division may not require the individual to have a personal <ln numlevel="1" lineno="119" slineno="2-28"/>flotation device on board the vessel.</amend></subsection></subsection><subsection ssid="1-null-14" dnum="e-o:f-i" numlevel="1" lineno="120" slineno="2-29" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1065" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>For vessels 16 feet or more in length, there shall also be on board one throwable <ln numlevel="1" lineno="121" slineno="2-30"/>personal flotation device which is approved for this use by the commandant of the <ln numlevel="1" lineno="122" slineno="2-31"/>United States Coast Guard.</subsection></subsection><subsection ssid="1-null-15" dnum="2-o" numlevel="1" lineno="123" slineno="2-32" level="1"><display>(2)</display>The operator of a vessel operated between sunset and sunrise shall display lighted <ln numlevel="1" lineno="124" slineno="2-33"/>navigation lights approved by the division.</subsection><subsection ssid="1-null-16" dnum="3-o" numlevel="1" lineno="125" slineno="2-34" level="1"><display>(3)</display>If a vessel is not entirely open and it carries or uses any flammable or toxic fluid in any <ln numlevel="1" lineno="126" slineno="2-35"/>enclosure for any purpose, the vessel shall be equipped with an efficient natural or <ln numlevel="1" lineno="127" slineno="2-36"/>mechanical ventilation system that is capable of removing resulting gases before and <ln numlevel="1" lineno="128" slineno="2-37"/>during the time the vessel is occupied by any person.</subsection><subsection ssid="1-null-17" dnum="4-o" numlevel="1" lineno="129" slineno="2-38" level="1"><display>(4)</display>Each vessel shall have fire extinguishing equipment on board.</subsection><subsection ssid="1-null-18" dnum="5-o" numlevel="1" lineno="130" slineno="2-39" level="1"><display>(5)</display>Any inboard gasoline engine shall be equipped with a carburetor backfire flame control <ln numlevel="1" lineno="131" slineno="2-40"/>device.</subsection><subsection ssid="1-null-19" dnum="6-o" numlevel="1" lineno="132" slineno="2-41" level="1"><display>(6)</display>The division may, after notifying the commission:<subsection ssid="1-null-20" dnum="a-o" numlevel="1" lineno="133" slineno="2-42" level="2"><display>(a)</display>require additional safety equipment by rule; and</subsection><subsection ssid="1-null-21" dnum="b-o" numlevel="1" lineno="134" slineno="2-43" level="2"><display>(b)</display>adopt rules conforming with the requirements of this section which govern <ln numlevel="1" lineno="135" slineno="2-44"/>specifications for and the use of safety equipment.</subsection></subsection><subsection ssid="1-null-22" dnum="7-o" numlevel="1" lineno="136" slineno="2-45" level="1"><display>(7)</display>A person may not operate or give permission for the operation of a vessel that is not <ln numlevel="1" lineno="137" slineno="2-46"/>equipped as required by this section or rules promulgated under this section.</subsection><subsection ssid="1-null-23" dnum="8-o" numlevel="1" lineno="138" slineno="2-47" level="1"><display>(8)</display>A violation of this section is an infraction.</subsection></section></bsec><bsec buid="7" num="73-18b-1" type="amend" src="code" uid="C73-18b-S1_2026050620260506" sort="73 18b00010020260506" numlevel="1" lineno="139" slineno="3-1" sn="3"><section number="73-18b-1" numlevel="1" lineno="140" slineno="3-2" type="amend"><secline lineno="139">Section 3. Section <bold>73-18b-1</bold> is amended to read:</secline><catline lineno="140"><bold>73-18b-1<parens/>. Water safety rules and regulations -- Adoption.</bold></catline><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="141" slineno="3-3" level="1" placement="noreturn"><display>(1)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">The</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subject to Subsection <xref depth="4" refnumber="73-18b-1(3)">(3)</xref>, in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="142" slineno="3-4"/>Administrative Rulemaking Act, the</amend> Division of Outdoor Recreation, after notifying the <ln numlevel="1" lineno="143" slineno="3-5"/>Outdoor Adventure Commission, may make rules necessary to promote safety in <ln numlevel="1" lineno="144" slineno="3-6"/>swimming, scuba diving, and related activities on any waters where public boating is <ln numlevel="1" lineno="145" slineno="3-7"/>permitted.</subsection><subsection ssid="7-null-2" dnum="2-o" numlevel="1" lineno="146" slineno="3-8" level="1"><display>(2)</display>The Division of Outdoor Recreation may consider recommendations of and cooperate <ln numlevel="1" lineno="147" slineno="3-9"/>with other state agencies and the owners or operators of those waters.</subsection><subsection ssid="7-3" dnum="_-o:3-i" numlevel="1" lineno="148" slineno="3-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="7-5" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">In rules made as described in Subsection <xref depth="4" refnumber="73-18b-1(1)">(1)</xref>, the Division of Outdoor Recreation, <ln numlevel="1" lineno="149" slineno="3-11"/>subject to Subsection <xref depth="4" refnumber="73-18b-1(3)(b)">(3)(b)</xref>, shall designate all rivers as flatwater.</amend></subsection><subsection ssid="7-6" dnum="_-o:b-i" numlevel="1" lineno="150" slineno="3-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">In rules made as described in Subsection <xref depth="4" refnumber="73-18b-1(1)">(1)</xref>, the Division of Outdoor Recreation:</amend><subsection ssid="7-7" dnum="_-o:i-i" numlevel="1" lineno="151" slineno="3-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">shall designate specific portions of a river as whitewater; and</amend></subsection><subsection ssid="7-8" dnum="_-o:ii-i" numlevel="1" lineno="152" slineno="3-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">may not designate an entire river system as whitewater.</amend></subsection></subsection></subsection></section></bsec><bsec buid="9" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="153" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="153">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="154"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-5-26 9:52 AM</tm></rev></foot></leg>
