Sandall</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill addresses regulation of the provision of water.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">exempts a water fee from certain rate setting requirements for municipalities and public <ln numlevel="1" lineno="9" slineno="0-9"/>water systems;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">defines terms;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">makes legislative findings;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">directs modification of contracts that do not comply with metering and usage-based <ln numlevel="1" lineno="13" slineno="0-13"/>billing requirements;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">requires certain notices to secondary water suppliers regarding transfer of real property;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">allows for the imposition of penalties; </hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">requires the collection of certain local contribution amounts for water infrastructure as a <ln numlevel="1" lineno="17" slineno="0-17"/>condition of receiving state money;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">requires local entities to collect certain local contribution amounts for drinking water and <ln numlevel="1" lineno="19" slineno="0-19"/>wastewater by a date certain;</hl><hl numlevel="1" lineno="20" slineno="0-20" level="1">addresses the exemption of secondary water from certain fees;</hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">modifies a reporting requirement; Section <bold>10-8-22</bold> is amended to read:</secline><catline lineno="40"><bold>10-8-22<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Water rates.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="41" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="42" slineno="1-4" level="2"><display>(a)</display>"Designated water service area" means the area defined by a municipality in <ln numlevel="1" lineno="43" slineno="1-5"/>accordance with the <ext_ref type="Utah Constitution">Utah Constitution, Article XI, Section 6</ext_ref>, Subsection <xref depth="4" refnumber="10-8-22(1)(c)" start="0">(1)(c)</xref>.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="44" slineno="1-6" level="2"><display>(b)</display>"Large municipal drinking water system" means a municipally owned and operated <ln numlevel="1" lineno="45" slineno="1-7"/>drinking water system serving a population of 10,000 or more.</subsection><subsection ssid="3-null-4" dnum="c-o" numlevel="1" lineno="46" slineno="1-8" level="2"><display>(c)</display>"Retail customer" means an end user:<subsection ssid="3-null-5" dnum="i-o" numlevel="1" lineno="47" slineno="1-9" level="3"><display>(i)</display>who receives culinary water directly from a municipality's waterworks system; and</subsection><subsection ssid="3-null-6" dnum="ii-o" numlevel="1" lineno="48" slineno="1-10" level="3"><display>(ii)</display>whom the municipality described in Subsection <xref depth="4" refnumber="10-8-22(1)(c)(i)" start="0">(1)(c)(i)</xref> bills for water service.</subsection></subsection></subsection><subsection ssid="3-null-7" dnum="2-o" numlevel="1" lineno="49" slineno="1-11" level="1"><display>(2)</display>A municipality shall fix the rates to be paid for the use of water furnished by the <ln numlevel="1" lineno="50" slineno="1-12"/>municipality.</subsection><subsection ssid="3-null-8" dnum="3-o" numlevel="1" lineno="51" slineno="1-13" level="1"><display>(3)</display>The setting of municipal water rates is a legislative act.</subsection><subsection ssid="3-null-9" dnum="4-o" numlevel="1" lineno="52" slineno="1-14" level="1"><display>(4)</display>Within the municipality's designated water service area, a municipality shall:<subsection ssid="3-null-10" dnum="a-o" numlevel="1" lineno="53" slineno="1-15" level="2"><display>(a)</display>establish, by ordinance, reasonable rates for the services provided to the <ln numlevel="1" lineno="54" slineno="1-16"/>municipality's retail customers;</subsection><subsection ssid="3-null-11" dnum="b-o" numlevel="1" lineno="55" slineno="1-17" level="2"><display>(b)</display>use the same method of providing notice to all retail customers of proposed rate <ln numlevel="1" lineno="56" slineno="1-18"/>changes; and</subsection><subsection ssid="3-null-12" dnum="c-o" numlevel="1" lineno="57" slineno="1-19" level="2"><display>(c)</display>allow all retail customers the same opportunity to appear and participate in a public <ln numlevel="1" lineno="58" slineno="1-20"/>meeting addressing water rates.</subsection></subsection><subsection ssid="3-null-13" dnum="5-o" numlevel="1" lineno="59" slineno="1-21" level="1" space="false"><display>(5)</display><subsection ssid="3-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A municipality may establish different rates for different classifications of retail <ln numlevel="1" lineno="60" slineno="1-22"/>customers within the municipality's designated water service area, if the rates and <ln numlevel="1" lineno="61" slineno="1-23"/>classifications have a reasonable basis.</subsection><subsection ssid="3-null-15" dnum="b-o" numlevel="1" lineno="62" slineno="1-24" level="2"><display>(b)</display>A reasonable basis for charging different rates for different classifications may <ln numlevel="1" lineno="63" slineno="1-25"/>include, among other things, a situation in which:<subsection ssid="3-null-16" dnum="i-o" numlevel="1" lineno="64" slineno="1-26" level="3"><display>(i)</display>there is a difference in the cost of providing service to a particular classification;</subsection><subsection ssid="3-null-17" dnum="ii-o" numlevel="1" lineno="65" slineno="1-27" level="3"><display>(ii)</display>one classification bears more risk in relation to a system operation or obligation;</subsection><subsection ssid="3-null-18" dnum="iii-o" numlevel="1" lineno="66" slineno="1-28" level="3"><display>(iii)</display>retail customers in one classification invested or contributed to acquire a water <ln numlevel="1" lineno="67" slineno="1-29"/>source or supply or build or maintain a system differently than retail customers in <ln numlevel="1" lineno="68" slineno="1-30"/>another classification;</subsection><subsection ssid="3-null-19" dnum="iv-o" numlevel="1" lineno="69" slineno="1-31" level="3"><display>(iv)</display>the needs or conditions of one classification:<subsection ssid="3-null-20" dnum="A-o" numlevel="1" lineno="70" slineno="1-32" level="4"><display>(A)</display>are distinguishable from the needs or conditions of another classification; and</subsection><subsection ssid="3-null-21" dnum="B-o" numlevel="1" lineno="71" slineno="1-33" level="4"><display>(B)</display>based on economic, public policy, or other identifiable elements, support a <ln numlevel="1" lineno="72" slineno="1-34"/>different rate; </subsection></subsection><subsection ssid="3-null-22" dnum="v-o" numlevel="1" lineno="73" slineno="1-35" level="3"><display>(v)</display>there is a differential between the classifications based on a cost of service <ln numlevel="1" lineno="74" slineno="1-36"/>standard or a generally accepted rate setting method, including a standard or <ln numlevel="1" lineno="75" slineno="1-37"/>method the American Water Works Association establishes; or</subsection><subsection ssid="3-null-23" dnum="vi-o" numlevel="1" lineno="76" slineno="1-38" level="3"><display>(vi)</display>water conservation is used as an element in determining the rate charged for a <ln numlevel="1" lineno="77" slineno="1-39"/>block unit of water as provided in Section <xref depth="3" refnumber="73-10-32.5">73-10-32.5</xref>.</subsection></subsection><subsection ssid="3-null-24" dnum="c-o" numlevel="1" lineno="78" slineno="1-40" level="2"><display>(c)</display>An adjustment based solely on the fact that a particular classification of retail <ln numlevel="1" lineno="79" slineno="1-41"/>customers is located either inside or outside of the municipality's corporate boundary <ln numlevel="1" lineno="80" slineno="1-42"/>is not a reasonable basis.</subsection><subsection ssid="3-37" dnum="_-o:d-i" numlevel="1" lineno="81" slineno="1-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning July 1, 2026, Subsection <xref depth="4" refnumber="10-8-22(5)(b)">(5)(b)</xref> does not apply to a rate or rate increase <ln numlevel="1" lineno="82" slineno="1-44"/>that is for the amount needed to pay a fee imposed on a municipality under Section <xref depth="3" refnumber="73-10g-607"><ln numlevel="1" lineno="83" slineno="1-45"/>73-10g-607</xref>.</amend></subsection></subsection><subsection ssid="3-null-25" dnum="6-o" numlevel="1" lineno="84" slineno="1-46" level="1" space="false"><display>(6)</display><subsection ssid="3-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If more than 10% of the retail customers within a large municipal drinking water <ln numlevel="1" lineno="85" slineno="1-47"/>system's designated water service area are located outside of the municipality's <ln numlevel="1" lineno="86" slineno="1-48"/>corporate boundary, the municipality shall:<subsection ssid="3-null-27" dnum="i-o" numlevel="1" lineno="87" slineno="1-49" level="3" tab="1"><display>(i)</display>post on the municipality's website the rates assessed to retail customers within the <ln numlevel="1" lineno="88" slineno="1-50"/>designated water service area; and</subsection><subsection ssid="3-null-28" dnum="ii-o" numlevel="1" lineno="89" slineno="1-51" level="3" tab="1"><display>(ii)</display>establish an advisory board to make recommendations to the municipal legislative <ln numlevel="1" lineno="90" slineno="1-52"/>body regarding water rates, capital projects, and other water service standards.</subsection></subsection><subsection ssid="3-null-29" dnum="b-o" numlevel="1" lineno="91" slineno="1-53" level="2"><display>(b)</display>In establishing an advisory board described in Subsection <xref depth="4" refnumber="10-8-22(6)(a)(ii)" start="0">(6)(a)(ii)</xref>, a municipality <ln numlevel="1" lineno="92" slineno="1-54"/>shall:<subsection ssid="3-null-30" dnum="i-o" numlevel="1" lineno="93" slineno="1-55" level="3"><display>(i)</display>if more than 10% but no more than 30% of the municipality's retail customers <ln numlevel="1" lineno="94" slineno="1-56"/>receive service outside the municipality's municipal boundary, ensure that at least <ln numlevel="1" lineno="95" slineno="1-57"/>20% of the advisory board's members represent the municipality's retail customers <ln numlevel="1" lineno="96" slineno="1-58"/>receiving service outside the municipality's municipal boundary;</subsection><subsection ssid="3-null-31" dnum="ii-o" numlevel="1" lineno="97" slineno="1-59" level="3"><display>(ii)</display>if more than 30% of the municipality's retail customers receive service outside of <ln numlevel="1" lineno="98" slineno="1-60"/>the municipality's municipal boundary, ensure that at least 40% of the advisory <ln numlevel="1" lineno="99" slineno="1-61"/>board's members represent the municipality's retail customers receiving service <ln numlevel="1" lineno="100" slineno="1-62"/>outside of the municipality's municipal boundary; and</subsection><subsection ssid="3-null-32" dnum="iii-o" numlevel="1" lineno="101" slineno="1-63" level="3"><display>(iii)</display>in appointing board members who represent retail customers receiving service <ln numlevel="1" lineno="102" slineno="1-64"/>outside of the municipality's municipal boundary, as required in Subsections <xref depth="4" refnumber="10-8-22(6)(b)(i)" start="0"><ln numlevel="1" lineno="103" slineno="1-65"/>(6)(b)(i)</xref> and <xref depth="4" refnumber="10-8-22(6)(b)(ii)" start="0">(ii)</xref>, solicit recommendations from each municipality and county <ln numlevel="1" lineno="104" slineno="1-66"/>outside of the municipality's municipal boundary whose residents are retail <ln numlevel="1" lineno="105" slineno="1-67"/>customers within the municipality's designated water service area.</subsection></subsection></subsection><subsection ssid="3-null-33" dnum="7-o" numlevel="1" lineno="106" slineno="1-68" level="1"><display>(7)</display>A municipality that supplies water outside of the municipality's designated water service <ln numlevel="1" lineno="107" slineno="1-69"/>area shall supply the water only by contract and shall include in the contract the terms <ln numlevel="1" lineno="108" slineno="1-70"/>and conditions under which the contract can be terminated.</subsection><subsection ssid="3-null-34" dnum="8-o" numlevel="1" lineno="109" slineno="1-71" level="1"><display>(8)</display>A municipality shall:<subsection ssid="3-null-35" dnum="a-o" numlevel="1" lineno="110" slineno="1-72" level="2"><display>(a)</display>notify the director of the Division of Drinking Water of a contract the municipality <ln numlevel="1" lineno="111" slineno="1-73"/>enters into with a person outside of the municipality's designated water service area, <ln numlevel="1" lineno="112" slineno="1-74"/>including the name and contact information of the person named in each contract; and</subsection><subsection ssid="3-null-36" dnum="b-o" numlevel="1" lineno="113" slineno="1-75" level="2"><display>(b)</display>each year, provide to the director of the Division of Drinking Water any <ln numlevel="1" lineno="114" slineno="1-76"/>supplementing or new information regarding a contract described in Subsection <xref depth="4" refnumber="10-8-22(8)(a)" start="0">(8)(a)</xref>, <ln numlevel="1" lineno="115" slineno="1-77"/>including whether there is no new information to provide at that time.</subsection></subsection></section></bsec><bsec buid="4" num="73-10-32.5" type="amend" src="code" uid="C73-10-S32.5_2026050620260506" sort="73 10 00320520260506" numlevel="1" lineno="116" slineno="2-1" sn="2"><section number="73-10-32.5" numlevel="1" lineno="117" slineno="2-2" type="amend"><secline lineno="116">Section 2. Section <bold>73-10-32.5</bold> is amended to read:</secline><catline lineno="117"><bold>73-10-32.5<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Culinary water pricing structure.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="118" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="4-null-2" dnum="a-o" numlevel="1" lineno="119" slineno="2-4" level="2"><display>(a)</display>"Public water system" means the same as that term is defined in Section <xref depth="3" refnumber="19-4-102">19-4-102</xref>.</subsection><subsection ssid="4-null-3" dnum="b-o" numlevel="1" lineno="120" slineno="2-5" level="2"><display>(b)</display>"Retail water supplier" means the same as that term is defined in Section <xref depth="3" refnumber="19-4-102" start="0">19-4-102</xref>.</subsection><subsection ssid="4-null-4" dnum="c-o" numlevel="1" lineno="121" slineno="2-6" level="2" space="false"><display>(c)</display><subsection ssid="4-null-5" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Water conservation effort" means a program that is designed to incentivize, <ln numlevel="1" lineno="122" slineno="2-7"/>encourage, or result in reduced water usage or more efficient use of water.</subsection><subsection ssid="4-null-6" dnum="ii-o" numlevel="1" lineno="123" slineno="2-8" level="3"><display>(ii)</display>"Water conservation effort" includes the costs associated with designing, <ln numlevel="1" lineno="124" slineno="2-9"/>implementing, and operating a program described in Subsection <xref tempid="170" depth="4" refnumber="73-10-32.5(1)(c)(i)">(1)(c)(i)</xref>.</subsection></subsection><subsection ssid="4-null-7" dnum="d-o" numlevel="1" lineno="125" slineno="2-10" level="2"><display>(d)</display>"Wholesale water supplier" means the same as that term is defined in Section <xref depth="3" refnumber="19-4-102"><ln numlevel="1" lineno="126" slineno="2-11"/>19-4-102</xref>.</subsection></subsection><subsection ssid="4-null-8" dnum="2-o" numlevel="1" lineno="127" slineno="2-12" level="1" space="false"><display>(2)</display><subsection ssid="4-34" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>A retail water supplier shall:<subsection ssid="4-null-9" dnum="a-o:i-i" numlevel="1" lineno="128" slineno="2-13" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1046" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>consider water conservation, including at least one water conservation effort, <ln numlevel="1" lineno="129" slineno="2-14"/>in setting water rates with the goal of encouraging efficient water use and <ln numlevel="1" lineno="130" slineno="2-15"/>eliminating wasteful or excessive water use;</subsection><subsection ssid="4-null-10" dnum="b-o:ii-i" numlevel="1" lineno="131" slineno="2-16" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1047" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>establish a culinary water rate structure that:<subsection ssid="4-null-11" dnum="i-o:A-i" numlevel="1" lineno="132" slineno="2-17" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1048" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>incorporates increasing block units of water used; </subsection><subsection ssid="4-null-12" dnum="ii-o:B-i" numlevel="1" lineno="133" slineno="2-18" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1049" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>provides for an increase in the rate charged for additional block units of <ln numlevel="1" lineno="134" slineno="2-19"/>water used as usage increases from one block unit to the next;</subsection><subsection ssid="4-null-13" dnum="iii-o:C-i" numlevel="1" lineno="135" slineno="2-20" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1050" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="both" space="true">(C)</amend></display>by July 1, 2027, includes one or more water conservation efforts as an <ln numlevel="1" lineno="136" slineno="2-21"/>element in determining the rate charged for at least the highest usage block unit <ln numlevel="1" lineno="137" slineno="2-22"/>of water for a customer classification that primarily serves residential <ln numlevel="1" lineno="138" slineno="2-23"/>customers; and</subsection><subsection ssid="4-null-14" dnum="iv-o:D-i" numlevel="1" lineno="139" slineno="2-24" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1051" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="both" space="true">(D)</amend></display>is based on a generally accepted rate setting method, including a <ln numlevel="1" lineno="140" slineno="2-25"/>standard or method established by the American Water Works Association;</subsection></subsection><subsection ssid="4-null-15" dnum="c-o:iii-i" numlevel="1" lineno="141" slineno="2-26" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1052" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>provide in customer billing notices, or in a notice that is distributed to <ln numlevel="1" lineno="142" slineno="2-27"/>customers at least annually, block unit rates and the customer's billing cycle; </subsection><subsection ssid="4-null-16" dnum="d-o:iv-i" numlevel="1" lineno="143" slineno="2-28" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1053" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>include individual customer water usage in customer billing notices; and</subsection><subsection ssid="4-null-17" dnum="e-o:v-i" numlevel="1" lineno="144" slineno="2-29" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1054" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="both" space="true">(v)</amend></display>consider urban farming that improves food security, reduces pollution, and <ln numlevel="1" lineno="145" slineno="2-30"/>creates green spaces in setting rates.</subsection></subsection><subsection ssid="4-36" dnum="_-o:b-i" numlevel="1" lineno="146" slineno="2-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning July 1, 2026, Subsection <xref depth="4" refnumber="73-10-32.5(2)(a)(ii)(d)">(2)(a)(ii)(D)</xref> does not apply to a rate or rate <ln numlevel="1" lineno="147" slineno="2-32"/>increase that is for the amount needed to pay a fee imposed on a public water system <ln numlevel="1" lineno="148" slineno="2-33"/>under Section <xref depth="3" refnumber="73-10g-607">73-10g-607</xref>.</amend></subsection></subsection><subsection ssid="4-null-18" dnum="3-o" numlevel="1" lineno="149" slineno="2-34" level="1"><display>(3)</display>This section does not prohibit:<subsection ssid="4-null-19" dnum="a-o" numlevel="1" lineno="150" slineno="2-35" level="2"><display>(a)</display>a public water system with 500 or fewer service connections from taking an action or <ln numlevel="1" lineno="151" slineno="2-36"/>adopting a culinary water rate structure described in Subsection <xref depth="4" refnumber="73-10-32.5(2)">(2)</xref>; or</subsection><subsection ssid="4-null-20" dnum="b-o" numlevel="1" lineno="152" slineno="2-37" level="2"><display>(b)</display>a retail water supplier from including water conservation and a water conservation <ln numlevel="1" lineno="153" slineno="2-38"/>effort as an element in setting rates for customer classifications that do not primarily <ln numlevel="1" lineno="154" slineno="2-39"/>serve residential customers.</subsection></subsection><subsection ssid="4-null-21" dnum="4-o" numlevel="1" lineno="155" slineno="2-40" level="1"><display>(4)</display>A public water system:<subsection ssid="4-null-22" dnum="a-o" numlevel="1" lineno="156" slineno="2-41" level="2"><display>(a)</display>is not required to establish or show that the portion of the rate designed to encourage <ln numlevel="1" lineno="157" slineno="2-42"/>water conservation, and fund a water conservation effort, within the highest usage <ln numlevel="1" lineno="158" slineno="2-43"/>block unit of water for a customer classification:<subsection ssid="4-null-23" dnum="i-o" numlevel="1" lineno="159" slineno="2-44" level="3"><display>(i)</display>is based on the public water system's actual cost of service;</subsection><subsection ssid="4-null-24" dnum="ii-o" numlevel="1" lineno="160" slineno="2-45" level="3"><display>(ii)</display>has a reasonable basis when compared to rates the public water system charges:<subsection ssid="4-null-25" dnum="A-o" numlevel="1" lineno="161" slineno="2-46" level="4"><display>(A)</display>for other block units of water within a customer classification; or</subsection><subsection ssid="4-null-26" dnum="B-o" numlevel="1" lineno="162" slineno="2-47" level="4"><display>(B)</display>for block units of water in other customer classifications; or</subsection></subsection><subsection ssid="4-null-27" dnum="iii-o" numlevel="1" lineno="163" slineno="2-48" level="3"><display>(iii)</display>is limited to a reasonable profit or return on investment;</subsection></subsection><subsection ssid="4-null-28" dnum="b-o" numlevel="1" lineno="164" slineno="2-49" level="2"><display>(b)</display>may include in a customer billing a fee, surcharge, penalty, or other charge that is <ln numlevel="1" lineno="165" slineno="2-50"/>collected pursuant to an agreement between the public water system and the <ln numlevel="1" lineno="166" slineno="2-51"/>wholesale water supplier from whom the public water system purchases water; and</subsection><subsection ssid="4-null-29" dnum="c-o" numlevel="1" lineno="167" slineno="2-52" level="2"><display>(c)</display>if the public water system is a for-profit entity, may not use revenue from the highest <ln numlevel="1" lineno="168" slineno="2-53"/>usage block unit of water designed to encourage water conservation to pay profits or <ln numlevel="1" lineno="169" slineno="2-54"/>dividends to the public water system's investors or owners.</subsection></subsection><subsection ssid="4-null-30" dnum="5-o" numlevel="1" lineno="170" slineno="2-55" level="1"><display>(5)</display>The use of revenue collected from the portion of any block unit of water designed to <ln numlevel="1" lineno="171" slineno="2-56"/>encourage water conservation may include funding water conservation efforts that are <ln numlevel="1" lineno="172" slineno="2-57"/>shared with or administered by another public water system or a wholesale water <ln numlevel="1" lineno="173" slineno="2-58"/>supplier.</subsection><subsection ssid="4-null-31" dnum="6-o" numlevel="1" lineno="174" slineno="2-59" level="1"><display>(6)</display>The adoption and implementation of that portion of a public water system's water rate <ln numlevel="1" lineno="175" slineno="2-60"/>that includes water conservation as an element in determining the rate charged for the <ln numlevel="1" lineno="176" slineno="2-61"/>highest usage block unit of water, as provided in this section, is conclusively presumed:<subsection ssid="4-null-32" dnum="a-o" numlevel="1" lineno="177" slineno="2-62" level="2"><display>(a)</display>to be reasonable; and</subsection><subsection ssid="4-null-33" dnum="b-o" numlevel="1" lineno="178" slineno="2-63" level="2"><display>(b)</display>to reflect the reasonable estimated cost of delivering the service for which the fee <ln numlevel="1" lineno="179" slineno="2-64"/>was paid.</subsection></subsection></section></bsec><bsec buid="1" num="73-10-34" type="amend" src="code" uid="C73-10-S34_2026050620260506" sort="73 10 00340020260506" numlevel="1" lineno="180" slineno="3-1" sn="3"><section number="73-10-34" numlevel="1" lineno="181" slineno="3-2" type="amend"><secline lineno="180">Section 3. placement="sameline"><display>(i)</display>"Commercial user" means a secondary water user that is a place of business.</subsection><subsection ssid="1-null-5" dnum="ii-o" numlevel="1" lineno="187" slineno="3-8" level="3"><display>(ii)</display>"Commercial user" does not include a multi-family residence, an agricultural <ln numlevel="1" lineno="188" slineno="3-9"/>user, or a customer that falls within the industrial or institutional classification.</subsection></subsection><subsection ssid="1-null-6" dnum="c-o" numlevel="1" lineno="189" slineno="3-10" level="2"><display>(c)</display>"Critical area" means an area:<subsection ssid="1-null-7" dnum="i-o" numlevel="1" lineno="190" slineno="3-11" level="3"><display>(i)</display>serviced by one of the four largest water conservancy districts, as defined in <ln numlevel="1" lineno="191" slineno="3-12"/>Section <xref depth="3" refnumber="17B-1-102">17B-1-102</xref>, measured by operating budgets; or</subsection><subsection ssid="1-null-8" dnum="ii-o" numlevel="1" lineno="192" slineno="3-13" level="3"><display>(ii)</display>within the Great Salt Lake basin, which includes:<subsection ssid="1-null-9" dnum="A-o" numlevel="1" lineno="193" slineno="3-14" level="4"><display>(A)</display>the surveyed meander line of the Great Salt Lake;</subsection><subsection ssid="1-null-10" dnum="B-o" numlevel="1" lineno="194" slineno="3-15" level="4"><display>(B)</display>the drainage areas of the Bear River or the Bear River's tributaries;</subsection><subsection ssid="1-null-11" dnum="C-o" numlevel="1" lineno="195" slineno="3-16" level="4"><display>(C)</display>the drainage areas of Bear Lake or Bear Lake's tributaries;</subsection><subsection ssid="1-null-12" dnum="D-o" numlevel="1" lineno="196" slineno="3-17" level="4"><display>(D)</display>the drainage areas of the Weber River or the Weber River's tributaries;</subsection><subsection ssid="1-null-13" dnum="E-o" numlevel="1" lineno="197" slineno="3-18" level="4"><display>(E)</display>the drainage areas of the Jordan River or the Jordan River's tributaries;</subsection><subsection ssid="1-null-14" dnum="F-o" numlevel="1" lineno="198" slineno="3-19" level="4"><display>(F)</display>the drainage areas of Utah Lake or Utah Lake's tributaries;</subsection><subsection ssid="1-null-15" dnum="G-o" numlevel="1" lineno="199" slineno="3-20" level="4"><display>(G)</display>other water drainages lying between the Bear River and the Jordan River that <ln numlevel="1" lineno="200" slineno="3-21"/>are tributary to the Great Salt Lake and not included in the drainage areas <ln numlevel="1" lineno="201" slineno="3-22"/>described in Subsections <xref depth="4" refnumber="73-10-34(1)(c)(ii)(b)">(1)(c)(ii)(B)</xref> through <xref depth="4" refnumber="73-10-34(f)">(F)</xref>; and</subsection><subsection ssid="1-null-16" dnum="H-o" numlevel="1" lineno="202" slineno="3-23" level="4"><display>(H)</display>the drainage area of Tooele Valley.</subsection></subsection></subsection><subsection ssid="1-null-17" dnum="d-o" numlevel="1" lineno="203" slineno="3-24" level="2"><display>(d)</display>"Full metering" means that use of secondary water is accurately metered by a meter <ln numlevel="1" lineno="204" slineno="3-25"/>that is installed and maintained on every secondary water connection of a secondary <ln numlevel="1" lineno="205" slineno="3-26"/>water supplier.</subsection><subsection ssid="1-null-18" dnum="e-o" numlevel="1" lineno="206" slineno="3-27" level="2" space="false"><display>(e)</display><subsection ssid="1-null-19" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Industrial user" means a secondary water user that manufactures or produces <ln numlevel="1" lineno="207" slineno="3-28"/>materials.</subsection><subsection ssid="1-null-20" dnum="ii-o" numlevel="1" lineno="208" slineno="3-29" level="3"><display>(ii)</display>"Industrial user" includes a manufacturing plant, an oil and gas producer, and a <ln numlevel="1" lineno="209" slineno="3-30"/>mining company.</subsection></subsection><subsection ssid="1-null-21" dnum="f-o" numlevel="1" lineno="210" slineno="3-31" level="2" space="false"><display>(f)</display><subsection ssid="1-null-22" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Institutional user" means a secondary water user that is dedicated to public <ln numlevel="1" lineno="211" slineno="3-32"/>service, regardless of ownership.</subsection><subsection ssid="1-null-23" dnum="ii-o" numlevel="1" lineno="212" slineno="3-33" level="3"><display>(ii)</display>"Institutional user" includes a school, church, hospital, park, golf course, and <ln numlevel="1" lineno="213" slineno="3-34"/>government facility.</subsection></subsection><subsection ssid="1-null-24" dnum="g-o" numlevel="1" lineno="214" slineno="3-35" level="2"><display>(g)</display>"Power generation use" means water used in the production of energy, such as use in <ln numlevel="1" lineno="215" slineno="3-36"/>an electric generation facility, natural gas refinery, or coal processing plant.</subsection><subsection ssid="1-null-25" dnum="h-o" numlevel="1" lineno="216" slineno="3-37" level="2" space="false"><display>(h)</display><subsection ssid="1-null-26" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Residential user" means a secondary water user in a residence.</subsection><subsection ssid="1-null-27" dnum="ii-o" numlevel="1" lineno="217" slineno="3-38" level="3"><display>(ii)</display>"Residential user" includes a single-family or multi-family home, apartment, <ln numlevel="1" lineno="218" slineno="3-39"/>duplex, twin home, condominium, or planned community.</subsection></subsection><subsection ssid="1-null-28" dnum="i-o" numlevel="1" lineno="219" slineno="3-40" level="2"><display>(i)</display>"Secondary water" means water that is:<subsection ssid="1-null-29" dnum="i-o" numlevel="1" lineno="220" slineno="3-41" level="3"><display>(i)</display>not culinary or water used on land assessed under Title 59, Chapter 2, Part 5, <ln numlevel="1" lineno="221" slineno="3-42"/>Farmland Assessment Act; and</subsection><subsection ssid="1-null-30" dnum="ii-o" numlevel="1" lineno="222" slineno="3-43" level="3"><display>(ii)</display>delivered to and used by an end user for the irrigation of landscaping or a garden.</subsection></subsection><subsection ssid="1-null-31" dnum="j-o" numlevel="1" lineno="223" slineno="3-44" level="2"><display>(j)</display>"Secondary water connection" means the location at which the water leaves the <ln numlevel="1" lineno="224" slineno="3-45"/>secondary water supplier's pipeline and enters into the remainder of the pipes that are <ln numlevel="1" lineno="225" slineno="3-46"/>owned by another person to supply water to an end user.</subsection><subsection ssid="1-null-32" dnum="k-o" numlevel="1" lineno="226" slineno="3-47" level="2"><display>(k)</display>"Secondary water supplier" means an entity that supplies pressurized secondary <ln numlevel="1" lineno="227" slineno="3-48"/>water.</subsection><subsection ssid="1-null-33" dnum="l-o" numlevel="1" lineno="228" slineno="3-49" level="2"><display>(l)</display>"Small secondary water retail supplier" means an entity that:<subsection ssid="1-null-34" dnum="i-o" numlevel="1" lineno="229" slineno="3-50" level="3"><display>(i)</display>supplies pressurized secondary water only to the end user of the secondary water; <ln numlevel="1" lineno="230" slineno="3-51"/>and</subsection><subsection ssid="1-null-35" dnum="ii-o" numlevel="1" lineno="231" slineno="3-52" level="3" space="false"><display>(ii)</display><subsection ssid="1-null-36" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is a city or town; or</subsection><subsection ssid="1-null-37" dnum="B-o" numlevel="1" lineno="232" slineno="3-53" level="4"><display>(B)</display>supplies 5,000 or fewer secondary water connections.</subsection></subsection></subsection><subsection ssid="1-204" dnum="_-o:m-i" numlevel="1" lineno="233" slineno="3-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="i" level="1" amendtag="start">(m)</amend></display><amend anum="0" ea="amend" pairid="110" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="end">"Title agent" means a title insurance producer licensed as an organization under <ln numlevel="1" lineno="234" slineno="3-55"/>Title 31A, Chapter 23a, Part 2, Producers and Consultants.</amend></subsection></subsection><subsection ssid="1-null-38" dnum="2-o" numlevel="1" lineno="235" slineno="3-56" level="1" space="false"><display>(2)</display><subsection ssid="1-null-39" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="1-null-40" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>A secondary water supplier that supplies secondary water within a county of <ln numlevel="1" lineno="236" slineno="3-57"/>the first or second class and begins design work for new service on or after April <ln numlevel="1" lineno="237" slineno="3-58"/>1, 2020, to a commercial, industrial, institutional, or residential user shall meter <ln numlevel="1" lineno="238" slineno="3-59"/>the use of pressurized secondary water by the users receiving that new service.</subsection><subsection ssid="1-null-41" dnum="ii-o" numlevel="1" lineno="239" slineno="3-60" level="3" tab="1"><display>(ii)</display>A secondary water supplier that supplies secondary water within a county of the <ln numlevel="1" lineno="240" slineno="3-61"/>third, fourth, fifth, or sixth class and begins design work for new service on or <ln numlevel="1" lineno="241" slineno="3-62"/>after May 4, 2022, to a commercial, industrial, institutional, or residential user <ln numlevel="1" lineno="242" slineno="3-63"/>shall meter the use of pressurized secondary water by the users receiving that new <ln numlevel="1" lineno="243" slineno="3-64"/>service.</subsection></subsection><subsection ssid="1-null-42" dnum="b-o" numlevel="1" lineno="244" slineno="3-65" level="2"><display>(b)</display>By no later than January 1, 2030, a secondary water supplier shall install and <ln numlevel="1" lineno="245" slineno="3-66"/>maintain a meter of the use of pressurized secondary water by each user receiving <ln numlevel="1" lineno="246" slineno="3-67"/>secondary water service from the secondary water supplier.</subsection><subsection ssid="1-null-43" dnum="c-o" numlevel="1" lineno="247" slineno="3-68" level="2"><display>(c)</display>Beginning January 1, 2022, a secondary water supplier shall establish a meter <ln numlevel="1" lineno="248" slineno="3-69"/>installation reserve for metering installation and replacement projects.</subsection><subsection ssid="1-null-44" dnum="d-o" numlevel="1" lineno="249" slineno="3-70" level="2"><display>(d)</display>A secondary water supplier, including a small secondary water retail supplier, may <ln numlevel="1" lineno="250" slineno="3-71"/>not raise the rates charged for secondary water:<subsection ssid="1-null-45" dnum="i-o" numlevel="1" lineno="251" slineno="3-72" level="3"><display>(i)</display>by more than 10% in a calendar year for costs associated with metering secondary <ln numlevel="1" lineno="252" slineno="3-73"/>water unless the rise in rates is necessary because the secondary water supplier <ln numlevel="1" lineno="253" slineno="3-74"/>experiences a catastrophic failure or other similar event; or</subsection><subsection ssid="1-null-46" dnum="ii-o" numlevel="1" lineno="254" slineno="3-75" level="3"><display>(ii)</display>unless, before raising the rates on the end user, the entity charging the end user <ln numlevel="1" lineno="255" slineno="3-76"/>provides a statement explaining the basis for why the needs of the secondary <ln numlevel="1" lineno="256" slineno="3-77"/>water supplier required an increase in rates.</subsection></subsection><subsection ssid="1-null-47" dnum="e-o" numlevel="1" lineno="257" slineno="3-78" level="2" space="false"><display>(e)</display><subsection ssid="1-null-48" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A secondary water supplier that provides pressurized secondary water to a <ln numlevel="1" lineno="258" slineno="3-79"/>commercial, industrial, institutional, or residential user shall develop a plan, or if <ln numlevel="1" lineno="259" slineno="3-80"/>the secondary water supplier previously filed a similar plan, update the plan for <ln numlevel="1" lineno="260" slineno="3-81"/>metering the use of the pressurized water.</subsection><subsection ssid="1-null-49" dnum="ii-o" numlevel="1" lineno="261" slineno="3-82" level="3"><display>(ii)</display>The plan required by this Subsection <xref depth="4" refnumber="73-10-34(2)(e)">(2)(e)</xref> shall be filed or updated with the <ln numlevel="1" lineno="262" slineno="3-83"/>Division of Water Resources by no later than December 31, 2025, and address the <ln numlevel="1" lineno="263" slineno="3-84"/>process the secondary water supplier will follow to implement metering, including:<subsection ssid="1-null-50" dnum="A-o" numlevel="1" lineno="264" slineno="3-85" level="4"><display>(A)</display>the costs of full metering by the secondary water supplier;</subsection><subsection ssid="1-null-51" dnum="B-o" numlevel="1" lineno="265" slineno="3-86" level="4"><display>(B)</display>how long it would take the secondary water supplier to complete full <ln numlevel="1" lineno="266" slineno="3-87"/>metering, including an anticipated beginning date and completion date, except <ln numlevel="1" lineno="267" slineno="3-88"/>a secondary water supplier shall achieve full metering by no later than January <ln numlevel="1" lineno="268" slineno="3-89"/>1, 2030; and</subsection><subsection ssid="1-null-52" dnum="C-o" numlevel="1" lineno="269" slineno="3-90" level="4"><display>(C)</display>how the secondary water supplier will finance metering.</subsection></subsection></subsection></subsection><subsection ssid="1-null-53" dnum="3-o" numlevel="1" lineno="270" slineno="3-91" level="1"><display>(3)</display>A secondary water supplier shall on or before March 31 of each year, report to the <ln numlevel="1" lineno="271" slineno="3-92"/>Division of Water Rights:<subsection ssid="1-null-54" dnum="a-o" numlevel="1" lineno="272" slineno="3-93" level="2"><display>(a)</display>for commercial, industrial, institutional, and residential users whose pressurized <ln numlevel="1" lineno="273" slineno="3-94"/>secondary water use is metered, the number of acre feet of pressurized secondary <ln numlevel="1" lineno="274" slineno="3-95"/>water the secondary water supplier supplied to the commercial, industrial, <ln numlevel="1" lineno="275" slineno="3-96"/>institutional, and residential users during the preceding 12-month period;</subsection><subsection ssid="1-null-55" dnum="b-o" numlevel="1" lineno="276" slineno="3-97" level="2"><display>(b)</display>the number of secondary water meters within the secondary water supplier's service <ln numlevel="1" lineno="277" slineno="3-98"/>boundary;</subsection><subsection ssid="1-null-56" dnum="c-o" numlevel="1" lineno="278" slineno="3-99" level="2"><display>(c)</display>a description of the secondary water supplier's service boundary;</subsection><subsection ssid="1-null-57" dnum="d-o" numlevel="1" lineno="279" slineno="3-100" level="2"><display>(d)</display>the number of secondary water connections in each of the following categories <ln numlevel="1" lineno="280" slineno="3-101"/>through which the secondary water supplier supplies pressurized secondary water:<subsection ssid="1-null-58" dnum="i-o" numlevel="1" lineno="281" slineno="3-102" level="3"><display>(i)</display>commercial;</subsection><subsection ssid="1-null-59" dnum="ii-o" numlevel="1" lineno="282" slineno="3-103" level="3"><display>(ii)</display>industrial;</subsection><subsection ssid="1-null-60" dnum="iii-o" numlevel="1" lineno="283" slineno="3-104" level="3"><display>(iii)</display>institutional; and</subsection><subsection ssid="1-null-61" dnum="iv-o" numlevel="1" lineno="284" slineno="3-105" level="3"><display>(iv)</display>residential;</subsection></subsection><subsection ssid="1-null-62" dnum="e-o" numlevel="1" lineno="285" slineno="3-106" level="2"><display>(e)</display>the total volume of water that the secondary water supplier receives from the <ln numlevel="1" lineno="286" slineno="3-107"/>secondary water supplier's sources; and</subsection><subsection ssid="1-null-63" dnum="f-o" numlevel="1" lineno="287" slineno="3-108" level="2"><display>(f)</display>the dates of service during the preceding 12-month period in which the secondary <ln numlevel="1" lineno="288" slineno="3-109"/>water supplier supplied pressurized secondary water.</subsection></subsection><subsection ssid="1-null-64" dnum="4-o" numlevel="1" lineno="289" slineno="3-110" level="1" space="false"><display>(4)</display><subsection ssid="1-null-65" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Beginning July 1, 2019, the Board of Water Resources may make up to <ln numlevel="1" lineno="290" slineno="3-111"/>$10,000,000 in low-interest loans available each year:<subsection ssid="1-null-66" dnum="i-o" numlevel="1" lineno="291" slineno="3-112" level="3" tab="1"><display>(i)</display>from the Water Resources Conservation and Development Fund, created in <ln numlevel="1" lineno="292" slineno="3-113"/>Section <xref depth="3" refnumber="73-10-24">73-10-24</xref>; and</subsection><subsection ssid="1-null-67" dnum="ii-o" numlevel="1" lineno="293" slineno="3-114" level="3" tab="1"><display>(ii)</display>for financing the cost of secondary water metering.</subsection></subsection><subsection ssid="1-null-68" dnum="b-o" numlevel="1" lineno="294" slineno="3-115" level="2"><display>(b)</display>The Division of Water Resources and the Board of Water Resources shall make rules <ln numlevel="1" lineno="295" slineno="3-116"/>in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, <ln numlevel="1" lineno="296" slineno="3-117"/>establishing the criteria and process for receiving a loan described in this Subsection <xref depth="4" refnumber="73-10-34(4)"><ln numlevel="1" lineno="297" slineno="3-118"/>(4)</xref>, except the rules may not include prepayment penalties.</subsection></subsection><subsection ssid="1-null-69" dnum="5-o" numlevel="1" lineno="298" slineno="3-119" level="1" space="false"><display>(5)</display><subsection ssid="1-null-70" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Beginning July 1, 2021, subject to appropriation, the Division of Water Resources <ln numlevel="1" lineno="299" slineno="3-120"/>may make matching grants each year for financing the cost of secondary water <ln numlevel="1" lineno="300" slineno="3-121"/>metering for a commercial, industrial, institutional, or residential user by a small <ln numlevel="1" lineno="301" slineno="3-122"/>secondary water retail supplier that:<subsection ssid="1-null-71" dnum="i-o" numlevel="1" lineno="302" slineno="3-123" level="3" tab="1"><display>(i)</display>is not for new service described in Subsection <xref depth="4" refnumber="73-10-34(2)(a)">(2)(a)</xref>; and</subsection><subsection ssid="1-null-72" dnum="ii-o" numlevel="1" lineno="303" slineno="3-124" level="3" tab="1"><display>(ii)</display>matches the amount of the grant.</subsection></subsection><subsection ssid="1-null-73" dnum="b-o" numlevel="1" lineno="304" slineno="3-125" level="2"><display>(b)</display>For purposes of issuing grants under this section, the division shall prioritize the <ln numlevel="1" lineno="305" slineno="3-126"/>small secondary water retail suppliers that can demonstrate the greatest need or <ln numlevel="1" lineno="306" slineno="3-127"/>greatest inability to pay the entire cost of installing secondary water meters.</subsection><subsection ssid="1-null-74" dnum="c-o" numlevel="1" lineno="307" slineno="3-128" level="2"><display>(c)</display>The amount of a grant under this Subsection <xref depth="4" refnumber="73-10-34(5)">(5)</xref> may not:<subsection ssid="1-null-75" dnum="i-o" numlevel="1" lineno="308" slineno="3-129" level="3"><display>(i)</display>exceed 50% of the small secondary water retail supplier's cost of installing <ln numlevel="1" lineno="309" slineno="3-130"/>secondary water meters; or</subsection><subsection ssid="1-null-76" dnum="ii-o" numlevel="1" lineno="310" slineno="3-131" level="3"><display>(ii)</display>supplant federal, state, or local money previously allocated to pay the small <ln numlevel="1" lineno="311" slineno="3-132"/>secondary water retail supplier's cost of installing secondary water meters.</subsection></subsection><subsection ssid="1-null-77" dnum="d-o" numlevel="1" lineno="312" slineno="3-133" level="2"><display>(d)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="313" slineno="3-134"/>Board of Water Resources shall make rules establishing:<subsection ssid="1-null-78" dnum="i-o" numlevel="1" lineno="314" slineno="3-135" level="3"><display>(i)</display>the procedure for applying for a grant under this Subsection <xref depth="4" refnumber="73-10-34(5)">(5)</xref>; and</subsection><subsection ssid="1-null-79" dnum="ii-o" numlevel="1" lineno="315" slineno="3-136" level="3"><display>(ii)</display>how a small secondary water retail supplier can establish that the small secondary <ln numlevel="1" lineno="316" slineno="3-137"/>water retail supplier meets the eligibility requirements of this Subsection <xref depth="4" refnumber="73-10-34(5)">(5)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-80" dnum="6-o" numlevel="1" lineno="317" slineno="3-138" level="1"><display>(6)</display>Nothing in this section affects a water right holder's obligation to measure and report <ln numlevel="1" lineno="318" slineno="3-139"/>water usage as described in Sections <xref depth="3" refnumber="73-5-4">73-5-4</xref> and <xref depth="3" refnumber="73-5-8">73-5-8</xref>.</subsection><subsection ssid="1-null-81" dnum="7-o" numlevel="1" lineno="319" slineno="3-140" level="1"><display>(7)</display>If a secondary water supplier fails to comply with Subsection <xref depth="4" refnumber="73-10-34(2)(b)">(2)(b)</xref>, the secondary <ln numlevel="1" lineno="320" slineno="3-141"/>water supplier:<subsection ssid="1-null-82" dnum="a-o" numlevel="1" lineno="321" slineno="3-142" level="2"><display>(a)</display>beginning January 1, 2030, may not receive state money for water related purposes <ln numlevel="1" lineno="322" slineno="3-143"/>until the secondary water supplier completes full metering; and</subsection><subsection ssid="1-null-83" dnum="b-o" numlevel="1" lineno="323" slineno="3-144" level="2"><display>(b)</display>is subject to an enforcement action of the state engineer in accordance with <ln numlevel="1" lineno="324" slineno="3-145"/>Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref>.</subsection></subsection><subsection ssid="1-null-84" dnum="8-o" numlevel="1" lineno="325" slineno="3-146" level="1" space="false"><display>(8)</display><subsection ssid="1-null-85" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="1-null-86" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>The state engineer shall commence an enforcement action under this <ln numlevel="1" lineno="326" slineno="3-147"/>Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref> if the state engineer receives a referral from the director of the <ln numlevel="1" lineno="327" slineno="3-148"/>Division of Water Resources.</subsection><subsection ssid="1-null-87" dnum="ii-o" numlevel="1" lineno="328" slineno="3-149" level="3" tab="1"><display>(ii)</display>The director of the Division of Water Resources shall submit a referral to the state <ln numlevel="1" lineno="329" slineno="3-150"/>engineer if the director:<subsection ssid="1-null-88" dnum="A-o" numlevel="1" lineno="330" slineno="3-151" level="4"><display>(A)</display>finds that a secondary water supplier fails to fully meter secondary water as <ln numlevel="1" lineno="331" slineno="3-152"/>required by this section; and</subsection><subsection ssid="1-null-89" dnum="B-o" numlevel="1" lineno="332" slineno="3-153" level="4"><display>(B)</display>determines an enforcement action is necessary to conserve or protect a water <ln numlevel="1" lineno="333" slineno="3-154"/>resource in the state.</subsection></subsection></subsection><subsection ssid="1-null-90" dnum="b-o" numlevel="1" lineno="334" slineno="3-155" level="2"><display>(b)</display>To commence an enforcement action under this Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref>, the state engineer <ln numlevel="1" lineno="335" slineno="3-156"/>shall issue a notice of violation that includes notice of the administrative fine to <ln numlevel="1" lineno="336" slineno="3-157"/>which a secondary water supplier is subject.</subsection><subsection ssid="1-null-91" dnum="c-o" numlevel="1" lineno="337" slineno="3-158" level="2"><display>(c)</display>The state engineer's issuance and enforcement of a notice of violation is exempt from <ln numlevel="1" lineno="338" slineno="3-159"/>Title 63G, Chapter 4, Administrative Procedures Act.</subsection><subsection ssid="1-null-92" dnum="d-o" numlevel="1" lineno="339" slineno="3-160" level="2"><display>(d)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="340" slineno="3-161"/>state engineer shall make rules necessary to enforce a notice of violation, that <ln numlevel="1" lineno="341" slineno="3-162"/>includes:<subsection ssid="1-null-93" dnum="i-o" numlevel="1" lineno="342" slineno="3-163" level="3"><display>(i)</display>provisions consistent with this Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref> for enforcement of the notice if a <ln numlevel="1" lineno="343" slineno="3-164"/>secondary water supplier to whom a notice is issued fails to respond to the notice <ln numlevel="1" lineno="344" slineno="3-165"/>or abate the violation;</subsection><subsection ssid="1-null-94" dnum="ii-o" numlevel="1" lineno="345" slineno="3-166" level="3"><display>(ii)</display>the right to a hearing, upon request by a secondary water supplier against whom <ln numlevel="1" lineno="346" slineno="3-167"/>the notice is issued; and</subsection><subsection ssid="1-null-95" dnum="iii-o" numlevel="1" lineno="347" slineno="3-168" level="3"><display>(iii)</display>provisions for timely issuance of a final order after the secondary water supplier <ln numlevel="1" lineno="348" slineno="3-169"/>to whom the notice is issued fails to respond to the notice or abate the violation, or <ln numlevel="1" lineno="349" slineno="3-170"/>after a hearing held under Subsection <xref depth="4" refnumber="73-10-34(8)(d)(ii)">(8)(d)(ii)</xref>.</subsection></subsection><subsection ssid="1-null-96" dnum="e-o" numlevel="1" lineno="350" slineno="3-171" level="2"><display>(e)</display>A person may not intervene in an enforcement action commenced under this section.</subsection><subsection ssid="1-null-97" dnum="f-o" numlevel="1" lineno="351" slineno="3-172" level="2"><display>(f)</display>After issuance of a final order under rules made pursuant to Subsection <xref depth="4" refnumber="73-10-34(8)(d)">(8)(d)</xref>, the <ln numlevel="1" lineno="352" slineno="3-173"/>state engineer shall serve a copy of the final order on the secondary water supplier <ln numlevel="1" lineno="353" slineno="3-174"/>against whom the order is issued by:<subsection ssid="1-null-98" dnum="i-o" numlevel="1" lineno="354" slineno="3-175" level="3"><display>(i)</display>personal service under Utah Rules of Civil Procedure, Rule 5; or</subsection><subsection ssid="1-null-99" dnum="ii-o" numlevel="1" lineno="355" slineno="3-176" level="3"><display>(ii)</display>certified mail.</subsection></subsection><subsection ssid="1-null-100" dnum="g-o" numlevel="1" lineno="356" slineno="3-177" level="2" space="false"><display>(g)</display><subsection ssid="1-null-101" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The state engineer's final order may be reviewed by trial de novo by the court <ln numlevel="1" lineno="357" slineno="3-178"/>with jurisdiction in Salt Lake County or the county where the violation occurred.</subsection><subsection ssid="1-null-102" dnum="ii-o" numlevel="1" lineno="358" slineno="3-179" level="3"><display>(ii)</display>A secondary water supplier shall file a petition for judicial review of the state <ln numlevel="1" lineno="359" slineno="3-180"/>engineer's final order issued under this section within 20 days from the day on <ln numlevel="1" lineno="360" slineno="3-181"/>which the final order was served on the secondary water supplier.</subsection></subsection><subsection ssid="1-null-103" dnum="h-o" numlevel="1" lineno="361" slineno="3-182" level="2"><display>(h)</display>The state engineer may bring suit in a court of competent jurisdiction to enforce a <ln numlevel="1" lineno="362" slineno="3-183"/>final order issued under this Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref>.</subsection><subsection ssid="1-null-104" dnum="i-o" numlevel="1" lineno="363" slineno="3-184" level="2"><display>(i)</display>If the state engineer prevails in an action brought under Subsection <xref depth="4" refnumber="73-10-34(8)(g)">(8)(g)</xref> or <xref depth="4" refnumber="73-10-34(h)">(h)</xref>, the <ln numlevel="1" lineno="364" slineno="3-185"/>state may recover court costs and a reasonable attorney fee.</subsection><subsection ssid="1-null-105" dnum="j-o" numlevel="1" lineno="365" slineno="3-186" level="2"><display>(j)</display>As part of a final order issued under this Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref>, the state engineer shall order <ln numlevel="1" lineno="366" slineno="3-187"/>that a secondary water supplier to whom an order is issued pay an administrative fine <ln numlevel="1" lineno="367" slineno="3-188"/>equal to:<subsection ssid="1-null-106" dnum="i-o" numlevel="1" lineno="368" slineno="3-189" level="3"><display>(i)</display>$10 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="369" slineno="3-190"/>supplier for failure to comply with full metering by January 1, 2030;</subsection><subsection ssid="1-null-107" dnum="ii-o" numlevel="1" lineno="370" slineno="3-191" level="3"><display>(ii)</display>$20 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="371" slineno="3-192"/>supplier for failure to comply with full metering by January 1, 2031;</subsection><subsection ssid="1-null-108" dnum="iii-o" numlevel="1" lineno="372" slineno="3-193" level="3"><display>(iii)</display>$30 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="373" slineno="3-194"/>supplier for failure to comply with full metering by January 1, 2032;</subsection><subsection ssid="1-null-109" dnum="iv-o" numlevel="1" lineno="374" slineno="3-195" level="3"><display>(iv)</display>$40 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="375" slineno="3-196"/>supplier for failure to comply with full metering by January 1, 2033; and</subsection><subsection ssid="1-null-110" dnum="v-o" numlevel="1" lineno="376" slineno="3-197" level="3"><display>(v)</display>$50 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="377" slineno="3-198"/>supplier for failure to comply with full metering by January 1, 2034, and for each <ln numlevel="1" lineno="378" slineno="3-199"/>subsequent year the secondary water supplier fails to comply with full metering.</subsection></subsection><subsection ssid="1-null-111" dnum="k-o" numlevel="1" lineno="379" slineno="3-200" level="2"><display>(k)</display>Money collected under this Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref> shall be deposited into the Water <ln numlevel="1" lineno="380" slineno="3-201"/>Resources Conservation and Development Fund, created in Section <xref depth="3" refnumber="73-10-24">73-10-24</xref>.</subsection></subsection><subsection ssid="1-null-112" dnum="9-o" numlevel="1" lineno="381" slineno="3-202" level="1"><display>(9)</display>A secondary water supplier located within a county of the fifth or sixth class is exempt <ln numlevel="1" lineno="382" slineno="3-203"/>from Subsections <xref depth="4" refnumber="73-10-34(2)(a)">(2)(a)</xref>, (2)(b), (2)(c), (2)(e), (7), and (8) if:<subsection ssid="1-null-113" dnum="a-o" numlevel="1" lineno="383" slineno="3-204" level="2"><display>(a)</display>the owner or operator of the secondary water supplier seeks an exemption under this <ln numlevel="1" lineno="384" slineno="3-205"/>Subsection <xref depth="4" refnumber="73-10-34(9)">(9)</xref> by establishing with the Division of Water Resources that the cost of <ln numlevel="1" lineno="385" slineno="3-206"/>purchasing, installing, and upgrading systems to accept meters exceeds 25% of the <ln numlevel="1" lineno="386" slineno="3-207"/>total operating budget of the owner or operator of the secondary water supplier;</subsection><subsection ssid="1-null-114" dnum="b-o" numlevel="1" lineno="387" slineno="3-208" level="2"><display>(b)</display>the secondary water supplier agrees to not add a new secondary water connection to <ln numlevel="1" lineno="388" slineno="3-209"/>the secondary water supplier's system on or after May 4, 2022;</subsection><subsection ssid="1-null-115" dnum="c-o" numlevel="1" lineno="389" slineno="3-210" level="2"><display>(c)</display>within six months of  when the secondary water supplier seeks an exemption under <ln numlevel="1" lineno="390" slineno="3-211"/>Subsection <xref depth="4" refnumber="73-10-34(9)(a)">(9)(a)</xref>, the secondary water supplier provides to the Division of Water <ln numlevel="1" lineno="391" slineno="3-212"/>Resources a plan for conservation within the secondary water supplier's service area <ln numlevel="1" lineno="392" slineno="3-213"/>that does not require metering;</subsection><subsection ssid="1-null-116" dnum="d-o" numlevel="1" lineno="393" slineno="3-214" level="2"><display>(d)</display>the secondary water supplier annually reports to the Division of Water Resources on <ln numlevel="1" lineno="394" slineno="3-215"/>the results of the plan described in Subsection <xref depth="4" refnumber="73-10-34(9)(c)">(9)(c)</xref>; and</subsection><subsection ssid="1-null-117" dnum="e-o" numlevel="1" lineno="395" slineno="3-216" level="2"><display>(e)</display>the secondary water supplier submits to evaluations by the Division of Water <ln numlevel="1" lineno="396" slineno="3-217"/>Resources of the effectiveness of the plan described in Subsection <xref depth="4" refnumber="73-10-34(9)(c)">(9)(c)</xref>.</subsection></subsection><subsection ssid="1-null-118" dnum="10-o" numlevel="1" lineno="397" slineno="3-218" level="1"><display>(10)</display>A secondary water supplier is exempt from Subsections <xref depth="4" refnumber="73-10-34(2)(a)">(2)(a)</xref>, (2)(b), (2)(c), (2)(e), <ln numlevel="1" lineno="398" slineno="3-219"/>(7), and (8) to the extent that the secondary water supplier:<subsection ssid="1-null-119" dnum="a-o" numlevel="1" lineno="399" slineno="3-220" level="2"><display>(a)</display>is unable to obtain a meter that a meter manufacturer will warranty because of the <ln numlevel="1" lineno="400" slineno="3-221"/>water quality within a specific location served by the secondary water supplier;</subsection><subsection ssid="1-null-120" dnum="b-o" numlevel="1" lineno="401" slineno="3-222" level="2"><display>(b)</display>submits reasonable proof to the Division of Water Resources that the secondary <ln numlevel="1" lineno="402" slineno="3-223"/>water supplier is unable to obtain a meter as described in Subsection <xref depth="4" refnumber="73-10-34(10)(a)">(10)(a)</xref>;</subsection><subsection ssid="1-null-121" dnum="c-o" numlevel="1" lineno="403" slineno="3-224" level="2"><display>(c)</display>within six months of when the secondary water supplier submits reasonable proof <ln numlevel="1" lineno="404" slineno="3-225"/>under Subsection <xref depth="4" refnumber="73-10-34(10)(b)">(10)(b)</xref>, provides to the Division of Water Resources a plan for <ln numlevel="1" lineno="405" slineno="3-226"/>conservation within the secondary water supplier's service area that does not require <ln numlevel="1" lineno="406" slineno="3-227"/>metering;</subsection><subsection ssid="1-null-122" dnum="d-o" numlevel="1" lineno="407" slineno="3-228" level="2"><display>(d)</display>annually reports to the Division of Water Resources on the results of the plan <ln numlevel="1" lineno="408" slineno="3-229"/>described in Subsection <xref depth="4" refnumber="73-10-34(10)(c)">(10)(c)</xref>; and</subsection><subsection ssid="1-null-123" dnum="e-o" numlevel="1" lineno="409" slineno="3-230" level="2"><display>(e)</display>submits to evaluations by the Division of Water Resources of the effectiveness of the <ln numlevel="1" lineno="410" slineno="3-231"/>plan described in Subsection <xref depth="4" refnumber="73-10-34(10)(c)">(10)(c)</xref>.</subsection></subsection><subsection ssid="1-null-124" dnum="11-o" numlevel="1" lineno="411" slineno="3-232" level="1"><display>(11)</display>A secondary water supplier that is located within a critical management area that is <ln numlevel="1" lineno="412" slineno="3-233"/>subject to a groundwater management plan adopted or amended under Section <xref depth="3" refnumber="73-5-15">73-5-15</xref> <ln numlevel="1" lineno="413" slineno="3-234"/>on or after May 1, 2006, is exempt from Subsections <xref depth="4" refnumber="73-10-34(2)(a)">(2)(a)</xref>, (2)(b), (2)(c), (2)(e), (7), and <ln numlevel="1" lineno="414" slineno="3-235"/>(8).</subsection><subsection ssid="1-null-125" dnum="12-o" numlevel="1" lineno="415" slineno="3-236" level="1"><display>(12)</display>If a secondary water supplier is required to have a water conservation plan under <ln numlevel="1" lineno="416" slineno="3-237"/>Section <xref depth="3" refnumber="73-10-32">73-10-32</xref>, that water conservation plan satisfies the requirements of Subsection <xref depth="4" refnumber="73-10-34(9)(c)"><ln numlevel="1" lineno="417" slineno="3-238"/>(9)(c)</xref> or (10)(c).</subsection><subsection ssid="1-null-126" dnum="13-o" numlevel="1" lineno="418" slineno="3-239" level="1" space="false"><display>(13)</display><subsection ssid="1-null-127" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding the other provisions of this section and unless exempt under <ln numlevel="1" lineno="419" slineno="3-240"/>Subsection <xref depth="4" refnumber="73-10-34(9)">(9)</xref>, (10), or (11), to comply with this section, a secondary water supplier <ln numlevel="1" lineno="420" slineno="3-241"/>is not required to meter every secondary water connection of the secondary water <ln numlevel="1" lineno="421" slineno="3-242"/>supplier's system, but shall meter at strategic points of the system as approved by the <ln numlevel="1" lineno="422" slineno="3-243"/>state engineer under this Subsection <xref depth="4" refnumber="73-10-34(13)">(13)</xref> if:<subsection ssid="1-null-128" dnum="i-o" numlevel="1" lineno="423" slineno="3-244" level="3" tab="1"><display>(i)</display>the system has no or minimal storage and relies primarily on stream flow;</subsection><subsection ssid="1-null-129" dnum="ii-o" numlevel="1" lineno="424" slineno="3-245" level="3" tab="1" space="false"><display>(ii)</display><subsection ssid="1-null-130" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the majority of secondary water users on the system are associated with <ln numlevel="1" lineno="425" slineno="3-246"/>agriculture use or power generation use; and</subsection><subsection ssid="1-null-131" dnum="B-o" numlevel="1" lineno="426" slineno="3-247" level="4"><display>(B)</display>less than 50% of the secondary water is used by residential secondary water <ln numlevel="1" lineno="427" slineno="3-248"/>users; or</subsection></subsection><subsection ssid="1-null-132" dnum="iii-o" numlevel="1" lineno="428" slineno="3-249" level="3" tab="1"><display>(iii)</display>the system has a mix of pressurized lines and open ditches and:<subsection ssid="1-null-133" dnum="A-o" numlevel="1" lineno="429" slineno="3-250" level="4"><display>(A)</display>1,000 or fewer users if any part of the system is within a critical area; or</subsection><subsection ssid="1-null-134" dnum="B-o" numlevel="1" lineno="430" slineno="3-251" level="4"><display>(B)</display>2,500 or fewer users for a system not described in Subsection <xref depth="4" refnumber="73-10-34(13)(a)(iii)(a)">(13)(a)(iii)(A)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-135" dnum="b-o" numlevel="1" lineno="431" slineno="3-252" level="2" space="false"><display>(b)</display><subsection ssid="1-null-136" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A secondary water supplier may obtain the approval by the state engineer of <ln numlevel="1" lineno="432" slineno="3-253"/>strategic points where metering is to occur as required under this Subsection <xref depth="4" refnumber="73-10-34(13)">(13)</xref> <ln numlevel="1" lineno="433" slineno="3-254"/>by filing an application with the state engineer in the form established by the state <ln numlevel="1" lineno="434" slineno="3-255"/>engineer.</subsection><subsection ssid="1-null-137" dnum="ii-o" numlevel="1" lineno="435" slineno="3-256" level="3"><display>(ii)</display>The state engineer may by rule, made in accordance with Title 63G, Chapter 3, <ln numlevel="1" lineno="436" slineno="3-257"/>Utah Administrative Rulemaking Act, establish procedures for approving strategic <ln numlevel="1" lineno="437" slineno="3-258"/>points for metering under this Subsection <xref depth="4" refnumber="73-10-34(13)">(13)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-138" dnum="14-o" numlevel="1" lineno="438" slineno="3-259" level="1" space="false"><display>(14)</display><subsection ssid="1-null-139" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A contract entered into or renewed on or after July 1, 2025, between a secondary <ln numlevel="1" lineno="439" slineno="3-260"/>water supplier and an end user shall allow for billing by tiered conservation rates.</subsection><subsection ssid="1-null-140" dnum="b-o" numlevel="1" lineno="440" slineno="3-261" level="2"><display>(b)</display>Except as provided in Subsection <xref tempid="385" depth="4" refnumber="73-10-34(14)(f)">(14)(f)</xref>, by no later than July 1, 2030, regardless of <ln numlevel="1" lineno="441" slineno="3-262"/>whether the secondary water supplier is fully metered or has modified existing <ln numlevel="1" lineno="442" slineno="3-263"/>contracts with end users, a secondary water supplier shall begin billing an end user <ln numlevel="1" lineno="443" slineno="3-264"/>using a tiered conservation rate that considers:<subsection ssid="1-null-141" dnum="i-o" numlevel="1" lineno="444" slineno="3-265" level="3"><display>(i)</display>revenue stability;</subsection><subsection ssid="1-null-142" dnum="ii-o" numlevel="1" lineno="445" slineno="3-266" level="3"><display>(ii)</display>water conservation; and</subsection><subsection ssid="1-null-143" dnum="iii-o" numlevel="1" lineno="446" slineno="3-267" level="3"><display>(iii)</display>cost of service.</subsection></subsection><subsection ssid="1-null-144" dnum="c-o" numlevel="1" lineno="447" slineno="3-268" level="2"><display>(c)</display>A secondary water supplier may comply with Subsection <xref depth="4" refnumber="73-10-34(14)(b)">(14)(b)</xref> by entering into a <ln numlevel="1" lineno="448" slineno="3-269"/>contract with a third-party, including the public water system that serves an end user <ln numlevel="1" lineno="449" slineno="3-270"/>of the secondary water supplier, to bill the end user according to end user's usage of <ln numlevel="1" lineno="450" slineno="3-271"/>secondary water and the secondary water supplier's tiered conservation rate.</subsection><subsection ssid="1-null-145" dnum="d-o" numlevel="1" lineno="451" slineno="3-272" level="2"><display>(d)</display>By no later than April 1, 2030, a secondary water supplier shall provide an <ln numlevel="1" lineno="452" slineno="3-273"/>educational component for end users as determined by the division by rule made in <ln numlevel="1" lineno="453" slineno="3-274"/>accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, either <ln numlevel="1" lineno="454" slineno="3-275"/>on a monthly statement or by an end user specific Internet portal that provides <ln numlevel="1" lineno="455" slineno="3-276"/>information on the end user's usage more frequently than monthly.</subsection><subsection ssid="1-null-146" dnum="e-o" numlevel="1" lineno="456" slineno="3-277" level="2"><display>(e)</display>A public water system:<subsection ssid="1-null-147" dnum="i-o" numlevel="1" lineno="457" slineno="3-278" level="3"><display>(i)</display>shall enter into a contract with a secondary water supplier described in Subsection <xref refnumber="73-10-34(14)(c)" depth="4"><ln numlevel="1" lineno="458" slineno="3-279"/>(14)(c)</xref> upon request from the secondary water supplier if the secondary water <ln numlevel="1" lineno="459" slineno="3-280"/>supplier agrees to provide water use and other data necessary for accurate billing <ln numlevel="1" lineno="460" slineno="3-281"/>in a file format compatible with the public water supplier's billing system;</subsection><subsection ssid="1-null-148" dnum="ii-o" numlevel="1" lineno="461" slineno="3-282" level="3"><display>(ii)</display>may collect the costs associated with billing on behalf of a secondary water <ln numlevel="1" lineno="462" slineno="3-283"/>supplier under this section from the secondary water end users, including <ln numlevel="1" lineno="463" slineno="3-284"/>reasonable administrative and overhead expenses; and</subsection><subsection ssid="1-null-149" dnum="iii-o" numlevel="1" lineno="464" slineno="3-285" level="3"><display>(iii)</display>shall, as the public water supplier and the secondary water supplier find <ln numlevel="1" lineno="465" slineno="3-286"/>necessary or convenient, exchange with the secondary water supplier, for the <ln numlevel="1" lineno="466" slineno="3-287"/>purpose of maintaining accurate records, relevant information with regard to an <ln numlevel="1" lineno="467" slineno="3-288"/>end user of the secondary water supplier, such as:<subsection ssid="1-null-150" dnum="A-o" numlevel="1" lineno="468" slineno="3-289" level="4"><display>(A)</display>a billing address;</subsection><subsection ssid="1-null-151" dnum="B-o" numlevel="1" lineno="469" slineno="3-290" level="4"><display>(B)</display>an address where the secondary water is delivered;</subsection><subsection ssid="1-null-152" dnum="C-o" numlevel="1" lineno="470" slineno="3-291" level="4"><display>(C)</display>a parcel identification number; and</subsection><subsection ssid="1-null-153" dnum="D-o" numlevel="1" lineno="471" slineno="3-292" level="4"><display>(D)</display>ownership information.</subsection></subsection></subsection><subsection ssid="1-null-154" dnum="f-o" numlevel="1" lineno="472" slineno="3-293" level="2" space="false"><display>(f)</display><subsection ssid="1-null-155" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A secondary water supplier is not required to bill an end user a tiered <ln numlevel="1" lineno="473" slineno="3-294"/>conservation rate if the secondary water supplier is:<subsection ssid="1-null-156" dnum="A-o" numlevel="1" lineno="474" slineno="3-295" level="4" tab="1"><display>(A)</display>exempt from metering under Subsection <xref depth="4" refnumber="73-10-34(9)">(9)</xref>, (10), or (11); or</subsection><subsection ssid="1-null-157" dnum="B-o" numlevel="1" lineno="475" slineno="3-296" level="4" tab="1"><display>(B)</display>authorized to meter at strategic points of the system under Subsection <xref depth="4" refnumber="73-10-34(13)">(13)</xref>.</subsection></subsection><subsection ssid="1-null-158" dnum="ii-o" numlevel="1" lineno="476" slineno="3-297" level="3"><display>(ii)</display>Notwithstanding the other provisions of this section, on or after July 1, 2030, a <ln numlevel="1" lineno="477" slineno="3-298"/>secondary water supplier with a tiered conservation rate under this Subsection <xref depth="4" refnumber="73-10-34(14)">(14)</xref> <ln numlevel="1" lineno="478" slineno="3-299"/>shall charge an end user at the lowest rate of the tiered conservation rate if the end <ln numlevel="1" lineno="479" slineno="3-300"/>user is using a portion of the water to grow food, including growing a garden, fruit <ln numlevel="1" lineno="480" slineno="3-301"/>trees, or pasture for grazing.</subsection></subsection><subsection ssid="1-null-159" dnum="g-o" numlevel="1" lineno="481" slineno="3-302" level="2" space="false"><display>(g)</display><subsection ssid="1-null-160" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If a secondary water supplier violates this Subsection <xref refnumber="73-10-34(14)" depth="4">(14)</xref> on or after April 1, <ln numlevel="1" lineno="482" slineno="3-303"/>2030, the secondary water supplier:<subsection ssid="1-null-161" dnum="A-o" numlevel="1" lineno="483" slineno="3-304" level="4" tab="1"><display>(A)</display>may not receive state money for water related purposes until the secondary <ln numlevel="1" lineno="484" slineno="3-305"/>water supplier complies with this Subsection <xref refnumber="73-10-34(14)" depth="4">(14)</xref>; and</subsection><subsection ssid="1-null-162" dnum="B-o" numlevel="1" lineno="485" slineno="3-306" level="4" tab="1"><display>(B)</display>is subject to an enforcement action of the state engineer in accordance with <ln numlevel="1" lineno="486" slineno="3-307"/>this Subsection <xref depth="4" refnumber="73-10-34(14)(g)">(14)(g)</xref>.</subsection></subsection><subsection ssid="1-null-163" dnum="ii-o" numlevel="1" lineno="487" slineno="3-308" level="3"><display>(ii)</display>The state engineer shall commence an enforcement action under this Subsection <xref depth="4" refnumber="73-10-34(14)(g)"><ln numlevel="1" lineno="488" slineno="3-309"/>(14)(g)</xref> if the state engineer receives a referral from the director of the Division of <ln numlevel="1" lineno="489" slineno="3-310"/>Water Resources.</subsection><subsection ssid="1-null-164" dnum="iii-o" numlevel="1" lineno="490" slineno="3-311" level="3"><display>(iii)</display>The director of the Division of Water Resources shall submit a referral to the <ln numlevel="1" lineno="491" slineno="3-312"/>state engineer if the director:<subsection ssid="1-null-165" dnum="A-o" numlevel="1" lineno="492" slineno="3-313" level="4"><display>(A)</display>finds that a secondary water supplier fails to comply with this Subsection <xref refnumber="73-10-34(14)" depth="4">(14)</xref>; <ln numlevel="1" lineno="493" slineno="3-314"/>and</subsection><subsection ssid="1-null-166" dnum="B-o" numlevel="1" lineno="494" slineno="3-315" level="4"><display>(B)</display>determines an enforcement action is necessary to conserve or protect a water <ln numlevel="1" lineno="495" slineno="3-316"/>resource in the state.</subsection></subsection><subsection ssid="1-null-167" dnum="iv-o" numlevel="1" lineno="496" slineno="3-317" level="3"><display>(iv)</display>To commence an enforcement action under this Subsection <xref depth="4" refnumber="73-10-34(14)(g)">(14)(g)</xref>, the state <ln numlevel="1" lineno="497" slineno="3-318"/>engineer shall issue a notice of violation that includes notice of the administrative <ln numlevel="1" lineno="498" slineno="3-319"/>fine described in Subsection <xref tempid="1057" depth="4" refnumber="73-10-34(14)(g)(xiii)">(14)(g)(xiii)</xref> to which a secondary water supplier is <ln numlevel="1" lineno="499" slineno="3-320"/>subject.</subsection><subsection ssid="1-null-168" dnum="v-o" numlevel="1" lineno="500" slineno="3-321" level="3"><display>(v)</display>The state engineer's issuance and enforcement of a notice of violation is exempt <ln numlevel="1" lineno="501" slineno="3-322"/>from Title 63G, Chapter 4, Administrative Procedures Act.</subsection><subsection ssid="1-null-169" dnum="vi-o" numlevel="1" lineno="502" slineno="3-323" level="3"><display>(vi)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, <ln numlevel="1" lineno="503" slineno="3-324"/>the state engineer shall make rules necessary to enforce a notice of violation, that <ln numlevel="1" lineno="504" slineno="3-325"/>includes:<subsection ssid="1-null-170" dnum="A-o" numlevel="1" lineno="505" slineno="3-326" level="4"><display>(A)</display>provisions consistent with this Subsection <xref refnumber="73-10-34(14)(g)" depth="4">(14)(g)</xref> for enforcement of the <ln numlevel="1" lineno="506" slineno="3-327"/>notice if a secondary water supplier to whom a notice is issued fails to respond <ln numlevel="1" lineno="507" slineno="3-328"/>to the notice or abate the violation;</subsection><subsection ssid="1-null-171" dnum="B-o" numlevel="1" lineno="508" slineno="3-329" level="4"><display>(B)</display>the right to a hearing, upon request by a secondary water supplier against <ln numlevel="1" lineno="509" slineno="3-330"/>whom the notice is issued; and</subsection><subsection ssid="1-null-172" dnum="C-o" numlevel="1" lineno="510" slineno="3-331" level="4"><display>(C)</display>provisions for timely issuance of a final order after the secondary water <ln numlevel="1" lineno="511" slineno="3-332"/>supplier to whom the notice is issued fails to respond to the notice or abate the <ln numlevel="1" lineno="512" slineno="3-333"/>violation, or after a hearing held under Subsection <xref depth="4" refnumber="73-10-34(14)(g)(vi)(b)">(14)(g)(vi)(B)</xref>.</subsection></subsection><subsection ssid="1-null-173" dnum="vii-o" numlevel="1" lineno="513" slineno="3-334" level="3"><display>(vii)</display>A person may not intervene in an enforcement action commenced under this <ln numlevel="1" lineno="514" slineno="3-335"/>Subsection <xref refnumber="73-10-34(14)(g)" depth="4">(14)(g)</xref>.</subsection><subsection ssid="1-null-174" dnum="viii-o" numlevel="1" lineno="515" slineno="3-336" level="3"><display>(viii)</display>After issuance of a final order under rules made pursuant to Subsection <xref depth="4" refnumber="73-10-34(14)(g)(vi)"><ln numlevel="1" lineno="516" slineno="3-337"/>(14)(g)(vi)</xref>, the state engineer shall serve a copy of the final order on the <ln numlevel="1" lineno="517" slineno="3-338"/>secondary water supplier against whom the order is issued by:<subsection ssid="1-null-175" dnum="A-o" numlevel="1" lineno="518" slineno="3-339" level="4"><display>(A)</display>personal service under Utah Rules of Civil Procedure, Rule 5; or</subsection><subsection ssid="1-null-176" dnum="B-o" numlevel="1" lineno="519" slineno="3-340" level="4"><display>(B)</display>certified mail.</subsection></subsection><subsection ssid="1-null-177" dnum="ix-o" numlevel="1" lineno="520" slineno="3-341" level="3"><display>(ix)</display>The state engineer's final order may be reviewed by trial de novo by a court with <ln numlevel="1" lineno="521" slineno="3-342"/>jurisdiction in Salt Lake County or the county where the violation occurred.</subsection><subsection ssid="1-null-178" dnum="x-o" numlevel="1" lineno="522" slineno="3-343" level="3"><display>(x)</display>A secondary water supplier shall file a petition for judicial review of the state <ln numlevel="1" lineno="523" slineno="3-344"/>engineer's final order issued under this Subsection <xref refnumber="73-10-34(14)(g)" depth="4">(14)(g)</xref> within 20 days from the <ln numlevel="1" lineno="524" slineno="3-345"/>day on which the final order was served on the secondary water supplier.</subsection><subsection ssid="1-null-179" dnum="xi-o" numlevel="1" lineno="525" slineno="3-346" level="3"><display>(xi)</display>The state engineer may bring suit in a court to enforce a final order issued under <ln numlevel="1" lineno="526" slineno="3-347"/>this Subsection <xref depth="4" refnumber="73-10-34(14)(g)">(14)(g)</xref>.</subsection><subsection ssid="1-null-180" dnum="xii-o" numlevel="1" lineno="527" slineno="3-348" level="3"><display>(xii)</display>If the state engineer prevails in an action brought under Subsection <xref depth="4" refnumber="73-10-34(14)(g)(x)">(14)(g)(x)</xref> or <xref depth="4" refnumber="73-10-34(xi)"><ln numlevel="1" lineno="528" slineno="3-349"/>(xi)</xref>, the state may recover court costs and reasonable attorney fees.</subsection><subsection ssid="1-null-181" dnum="xiii-o" numlevel="1" lineno="529" slineno="3-350" level="3"><display>(xiii)</display>The administrative fine imposed under this section shall be an amount not to <ln numlevel="1" lineno="530" slineno="3-351"/>exceed the sum of any money received by the secondary water supplier under this <ln numlevel="1" lineno="531" slineno="3-352"/>section or Section <xref depth="3" refnumber="73-10-34.5">73-10-34.5</xref> to fund costs related to metering.</subsection><subsection ssid="1-null-182" dnum="xiv-o" numlevel="1" lineno="532" slineno="3-353" level="3"><display>(xiv)</display>Money collected under this Subsection <xref depth="4" refnumber="73-10-34(14)">(14)</xref> shall be deposited into the Water <ln numlevel="1" lineno="533" slineno="3-354"/>Resources Conservation and Development Fund, created in Section <xref depth="3" refnumber="73-10-24">73-10-24</xref>.</subsection></subsection></subsection><subsection ssid="1-183" dnum="_-o:15-i" numlevel="1" lineno="534" slineno="3-355" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1255" style="1" anum="0" ea="amend" pairid="1256" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">The Legislature finds that requiring a secondary water supplier to modify a <ln numlevel="1" lineno="535" slineno="3-356"/>contract to allow for compliance with metering and usage-based billing requirements <ln numlevel="1" lineno="536" slineno="3-357"/>under this chapter is in the public interest and reasonably necessary to achieve needed <ln numlevel="1" lineno="537" slineno="3-358"/>water conservation.</amend></subsection><subsection ssid="1-185" dnum="_-o:b-i" numlevel="1" lineno="538" slineno="3-359" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1257" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">If necessary to comply with the usage-based billing requirements under this chapter, <ln numlevel="1" lineno="539" slineno="3-360"/>a secondary water supplier shall modify a contract that:</amend><subsection ssid="1-186" dnum="_-o:i-i" numlevel="1" lineno="540" slineno="3-361" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1258" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">existed before July 1, 2025; and</amend></subsection><subsection ssid="1-187" dnum="_-o:ii-i" numlevel="1" lineno="541" slineno="3-362" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1259" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">does not comply with metering and usage-based billing requirements under this <ln numlevel="1" lineno="542" slineno="3-363"/>chapter.</amend></subsection></subsection><subsection ssid="1-188" dnum="_-o:c-i" numlevel="1" lineno="543" slineno="3-364" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1260" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">Upon modification of a contract described in Subsection <xref depth="4" refnumber="73-10-34(15)(b)">(15)(b)</xref>, a secondary water <ln numlevel="1" lineno="544" slineno="3-365"/>supplier:</amend><subsection ssid="1-189" dnum="_-o:i-i" numlevel="1" lineno="545" slineno="3-366" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1261" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">shall execute contract terms that:</amend><subsection ssid="1-190" dnum="_-o:A-i" numlevel="1" lineno="546" slineno="3-367" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1262" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">authorize metering and volumetric billing; and</amend></subsection><subsection ssid="1-191" dnum="_-o:B-i" numlevel="1" lineno="547" slineno="3-368" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1263" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">apply a secondary water rate, which includes a tiered conservation rate set in <ln numlevel="1" lineno="548" slineno="3-369"/>accordance with Subsection <xref depth="4" refnumber="73-10-34(14)">(14)</xref>; and</amend></subsection></subsection><subsection ssid="1-192" dnum="_-o:ii-i" numlevel="1" lineno="549" slineno="3-370" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1264" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">may execute contract terms that:</amend><subsection ssid="1-193" dnum="_-o:A-i" numlevel="1" lineno="550" slineno="3-371" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1265" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">bind a real property owner to delivery obligations; and</amend></subsection><subsection ssid="1-194" dnum="_-o:B-i" numlevel="1" lineno="551" slineno="3-372" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1266" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">mandate a subsequent real property owner to execute a successor contract <ln numlevel="1" lineno="552" slineno="3-373"/>upon transfer of the real property.</amend></subsection></subsection></subsection><subsection ssid="1-195" dnum="_-o:d-i" numlevel="1" lineno="553" slineno="3-374" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1267" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">A covenant ensuring compliance with this Subsection <xref depth="4" refnumber="73-10-34(15)">(15)</xref> runs with the real <ln numlevel="1" lineno="554" slineno="3-375"/>property and is enforceable against a successor in ssid="1-205" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1270" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">To facilitate the execution of a successor contract described in Subsection <xref depth="4" refnumber="73-10-34(15)(c)"><ln numlevel="1" lineno="556" slineno="3-377"/>(15)(c)</xref> upon the transfer of real property as described in this Subsection <xref depth="4" refnumber="73-10-34(16)(a)">(16)(a)</xref>, a <ln numlevel="1" lineno="557" slineno="3-378"/>title agent involved in a real property transaction that affects secondary water shall <ln numlevel="1" lineno="558" slineno="3-379"/>notify the applicable secondary water supplier of a change in ownership of <ln numlevel="1" lineno="559" slineno="3-380"/>property receiving secondary water services within 10 business days of the closing <ln numlevel="1" lineno="560" slineno="3-381"/>of the real property transaction.</amend></subsection><subsection ssid="1-206" dnum="_-o:ii-i" numlevel="1" lineno="561" slineno="3-382" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1271" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">If a title agent is not involved in a transaction affecting secondary water, the seller <ln numlevel="1" lineno="562" slineno="3-383"/>is responsible for making the notification described in Subsection <xref depth="4" refnumber="73-10-34(16)(a)(i)">(16)(a)(i)</xref> in <ln numlevel="1" lineno="563" slineno="3-384"/>accordance with this Subsection <xref depth="4" refnumber="73-10-34(16)">(16)</xref>.</amend></subsection></subsection><subsection ssid="1-198" dnum="_-o:b-i" numlevel="1" lineno="564" slineno="3-385" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1272" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">A notification described in Subsection <xref depth="4" refnumber="73-10-34(16)(a)">(16)(a)</xref> shall include:</amend><subsection ssid="1-199" dnum="_-o:i-i" numlevel="1" lineno="565" slineno="3-386" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1273" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">the new owner's name and contact information;</amend></subsection><subsection ssid="1-200" dnum="_-o:ii-i" numlevel="1" lineno="566" slineno="3-387" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1274" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">the effective date of the transfer; and</amend></subsection><subsection ssid="1-201" dnum="_-o:iii-i" numlevel="1" lineno="567" slineno="3-388" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1275" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="end">relevant parcel identification information.</amend></subsection></subsection><subsection ssid="1-202" dnum="_-o:c-i" numlevel="1" lineno="568" slineno="3-389" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1276" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">A secondary water supplier shall maintain a publicly accessible database of serviced <ln numlevel="1" lineno="569" slineno="3-390"/>real properties to enable a title agent described in Subsection <xref depth="4" refnumber="73-10-34(16)(a)">(16)(a)</xref> to identify the <ln numlevel="1" lineno="570" slineno="3-391"/>applicable secondary water supplier during a real property transaction.</amend></subsection><subsection ssid="1-203" dnum="_-o:d-i" numlevel="1" lineno="571" slineno="3-392" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1277" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="end">The Division of Water Resources may impose an administrative penalty not to <ln numlevel="1" lineno="572" slineno="3-393"/>exceed $500 per violation for the failure to provide notification under Subsection <xref depth="4" refnumber="73-10-34(16)(a)"><ln numlevel="1" lineno="573" slineno="3-394"/>(16)(a)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="9" num="73-10g-607" type="amend" src="code" uid="C73-10g-S607_2026070120260701" sort="73 10g06070020260701" numlevel="1" lineno="574" slineno="4-1" sn="4"><section number="73-10g-607" numlevel="1" lineno="575" slineno="4-2" type="amend"><secline lineno="574">Section 4. Section <bold>73-10g-607</bold> is amended to read:</secline><catline lineno="575"><bold>73-10g-607<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/26</date></paren></parens>. Fee schedule -- Approval of fee schedule -- <ln numlevel="1" lineno="576" slineno="4-3"/>Exemption -- Report -- Monitoring of fees.</bold></catline><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="577" slineno="4-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="9-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref tempid="196" depth="4" refnumber="(2)">(2)</xref>, the state council may establish a fee schedule for public <ln numlevel="1" lineno="578" slineno="4-5"/>water systems for water service and delivery in the state.</subsection><subsection ssid="9-null-3" dnum="b-o" numlevel="1" lineno="579" slineno="4-6" level="2"><display>(b)</display>To create a fee schedule for public water systems, the state council shall use the <ln numlevel="1" lineno="580" slineno="4-7"/>findings from the review described in Section <xref depth="3" refnumber="73-10-39">73-10-39</xref>.</subsection></subsection><subsection ssid="9-null-4" dnum="2-o" numlevel="1" lineno="581" slineno="4-8" level="1"><display>(2)</display>The state council may not charge or collect a fee described in Subsection <xref tempid="661" depth="4" refnumber="(1)">(1)</xref> without <ln numlevel="1" lineno="582" slineno="4-9"/>approval of the fee schedule by the Legislature in accordance with Section <xref depth="3" refnumber="63J-1-504">63J-1-504</xref>.</subsection><subsection ssid="9-null-5" dnum="3-o" numlevel="1" lineno="583" slineno="4-10" level="1"><display>(3)</display>Agricultural water <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">is</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">and secondary water, as defined in Section <xref depth="3" refnumber="73-10-34">73-10-34</xref>, are</amend> exempt <ln numlevel="1" lineno="584" slineno="4-11"/>from a fee established under Subsection <xref tempid="330" depth="4" refnumber="(1)">(1)</xref>.</subsection><subsection ssid="9-null-6" dnum="4-o" numlevel="1" lineno="585" slineno="4-12" level="1"><display>(4)</display>Subject to Subsection <xref tempid="378" depth="4" refnumber="(2)">(2)</xref>, a public water system shall submit payment of the fee <ln numlevel="1" lineno="586" slineno="4-13"/>established in Subsection <xref tempid="502" depth="4" refnumber="(1)">(1)</xref> into the Water Infrastructure Fund created in Section <xref depth="3" refnumber="73-10g-107"><ln numlevel="1" lineno="587" slineno="4-14"/>73-10g-107</xref>:<subsection ssid="9-null-7" dnum="a-o" numlevel="1" lineno="588" slineno="4-15" level="2"><display>(a)</display>in accordance with a schedule provided by the state council; and</subsection><subsection ssid="9-null-8" dnum="b-o" numlevel="1" lineno="589" slineno="4-16" level="2"><display>(b)</display>using a form provided by the state council.</subsection></subsection><subsection ssid="9-null-9" dnum="5-o" numlevel="1" lineno="590" slineno="4-17" level="1"><display>(5)</display>On or before October 31, 2026, the state council shall report to the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">Natural Resources, <ln numlevel="1" lineno="591" slineno="4-18"/>Agriculture, and Environment Interim Committee </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Natural Resources, Agriculture, and <ln numlevel="1" lineno="592" slineno="4-19"/>Environmental Quality Appropriations Subcommittee </amend>regarding the development of the <ln numlevel="1" lineno="593" slineno="4-20"/>fee schedule described in Subsection <xref tempid="318" depth="4" refnumber="(1)">(1)</xref>.</subsection><subsection ssid="9-null-10" dnum="6-o" numlevel="1" lineno="594" slineno="4-21" level="1"><display>(6)</display>The Office of the Legislative Fiscal Analyst shall monitor any fees collected under this <ln numlevel="1" lineno="595" slineno="4-22"/>section.</subsection></section></bsec><bsec buid="56" num="73-10g-801" type="enact" src="code" uid="C73-10g-S801_2026050620260506" sort="73 10g08010020260506" numlevel="1" lineno="596" slineno="5-1" sn="5"><section numlevel="1" lineno="598" slineno="5-3" number="73-10g-801" type="enact"><secline lineno="596">Section 5. Local contribution amount requirements to <ln numlevel="1" lineno="610" slineno="6-3"/>receive state money.</bold></catline><subsection ssid="58-25-38" dnum="_-o:1-i" numlevel="1" lineno="611" slineno="6-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn" space="false"><display><amend anum="0" ea="amend" pairid="1292" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><subsection ssid="58-60" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1293" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="127" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning January 1, 2027, to qualify for receipt of state money for water <ln numlevel="1" lineno="612" slineno="6-5"/>infrastructure or water development, a public water system shall establish that as of <ln numlevel="1" lineno="613" slineno="6-6"/>the day on which the public water system receives the state money the public water <ln numlevel="1" lineno="614" slineno="6-7"/>system<marker pairid="174"> collects a</marker>n amount that equals or exceeds the local contribution amount.</amend></subsection><subsection ssid="58-25-39" dnum="_-o:b-i" numlevel="1" lineno="615" slineno="6-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1294" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">The state council shall by no later than July 1, 2026, determine for each public water <ln numlevel="1" lineno="616" slineno="6-9"/>system a local contribution amount that is calculated by:</amend><subsection ssid="58-51" dnum="_-o:i-i" numlevel="1" lineno="617" slineno="6-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1295" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="89" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">determining the median adjusted gross income for the service area within which <ln numlevel="1" lineno="618" slineno="6-11"/>the public water system provides services;</amend></subsection><subsection ssid="58-52" dnum="_-o:ii-i" numlevel="1" lineno="619" slineno="6-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1296" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="71" style="1" owner="jchristopherson" level="1" amendtag="end">multiplying the number determined under Subsection <xref depth="4" refnumber="73-10g-802(1)(b)(i)">(1)(b)(i)</xref> by:</amend><subsection ssid="58-53" dnum="_-o:A-i" numlevel="1" lineno="620" slineno="6-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1297" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="99" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">1.5% if the public water system bills a customer for drinking water <ln numlevel="1" lineno="621" slineno="6-14"/>independent of services provided by a wastewater service provider; or</amend></subsection><subsection ssid="58-54" dnum="_-o:B-i" numlevel="1" lineno="622" slineno="6-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1298" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="104" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">3% if the public water system bills a customer for both drinking water and <ln numlevel="1" lineno="623" slineno="6-16"/>services provided by a wastewater service provider; and</amend></subsection></subsection><subsection ssid="58-66" dnum="_-o:iii-i" numlevel="1" lineno="624" slineno="6-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1299" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="end">multiplying the number determined under Subsection <xref depth="4" refnumber="73-10g-802(1)(b)(ii)">(1)(b)(ii)</xref> by the number of <ln numlevel="1" lineno="625" slineno="6-18"/>connections of the public water system.</amend></subsection></subsection></subsection><subsection ssid="58-55" dnum="_-o:2-i" numlevel="1" lineno="626" slineno="6-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1300" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="58-65" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1301" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="112" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning January 1, 2027, to qualify for receipt of state money for water <ln numlevel="1" lineno="627" slineno="6-20"/>infrastructure or water development, a wastewater service provider shall establish <ln numlevel="1" lineno="628" slineno="6-21"/>that as of the day on which the wastewater service provider receives the state money <ln numlevel="1" lineno="629" slineno="6-22"/>the wastewater service<marker pairid="175"> provider collects</marker>, either directly or through a public water <ln numlevel="1" lineno="630" slineno="6-23"/>system, an amount that equals or exceeds the local contribution amount.</amend></subsection><subsection ssid="58-64" dnum="_-o:b-i" numlevel="1" lineno="631" slineno="6-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1302" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="145" groupid="110" style="1" owner="jchristopherson" level="1" amendtag="end">The state council shall by no later than July 1, 2026, determine for each wastewater <ln numlevel="1" lineno="632" slineno="6-25"/>service provider a local contribution amount that is calculated by:</amend><subsection ssid="58-56" dnum="_-o:i-i" numlevel="1" lineno="633" slineno="6-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1303" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="end">determining the median adjusted gross income for the service area within which <ln numlevel="1" lineno="634" slineno="6-27"/>the wastewater service provider provides services;</amend></subsection><subsection ssid="58-57" dnum="_-o:ii-i" numlevel="1" lineno="635" slineno="6-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1304" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="114" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">multiplying the number determined under Subsection <xref depth="4" refnumber="73-10g-802(2)(b)(i)">(2)(b)(i)</xref> by:</amend><subsection ssid="58-58" dnum="_-o:A-i" numlevel="1" lineno="636" slineno="6-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1305" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="89" style="1" owner="jchristopherson" level="1" amendtag="end">1.5% if the wastewater service provider bills customers independent of a <ln numlevel="1" lineno="637" slineno="6-30"/>public water system; and</amend></subsection><subsection ssid="58-59" dnum="_-o:B-i" numlevel="1" lineno="638" slineno="6-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1306" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="91" style="1" owner="jchristopherson" level="1" amendtag="end">3% if the waste service provider bills through a public water system that bills <ln numlevel="1" lineno="639" slineno="6-32"/>for drinking water and services provided by a wastewater service provider; and</amend></subsection></subsection><subsection ssid="58-67" dnum="_-o:iii-i" numlevel="1" lineno="640" slineno="6-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1307" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="159" groupid="121" style="1" owner="jchristopherson" level="1" amendtag="end">multiplying the number determined under Subsection <xref depth="4" refnumber="73-10g-802(2)(b)(ii)">(2)(b)(ii)</xref> by the number of <ln numlevel="1" lineno="641" slineno="6-34"/>connections of the wastewater service provider.</amend></subsection></subsection></subsection><subsection ssid="58-25-46" dnum="_-o:3-i" numlevel="1" lineno="642" slineno="6-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1308" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">At least every five years the state council shall:</amend><subsection ssid="58-68" dnum="_-o:a-i" numlevel="1" lineno="643" slineno="6-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1309" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="164" groupid="125" style="1" owner="jchristopherson" level="1" amendtag="end">update the local contribution amount for a public water system or wastewater service <ln numlevel="1" lineno="644" slineno="6-37"/>provider; and</amend></subsection><subsection ssid="58-69" dnum="_-o:b-i" numlevel="1" lineno="645" slineno="6-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1310" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="169" groupid="129" style="1" owner="jchristopherson" level="1" amendtag="end">recommend to the Natural Resources, Agriculture, and Environment Interim <ln numlevel="1" lineno="646" slineno="6-39"/>Committee whether the Legislature should adjust the multiplier under Subsection <xref depth="4" refnumber="73-10g-802(1)(b)(ii)"><ln numlevel="1" lineno="647" slineno="6-40"/>(1)(b)(ii)</xref> or <xref depth="4" refnumber="73-10g-802(2)(b)(ii)">(2)(b)(ii)</xref> to reflect the financial capability of a household to pay <ln numlevel="1" lineno="648" slineno="6-41"/>expenses for drinking water or services of a wastewater service provider, inclusive of <ln numlevel="1" lineno="649" slineno="6-42"/>applicable property taxes, without undue hardship.</amend></subsection></subsection><subsection ssid="58-25-47" dnum="_-o:4-i" numlevel="1" lineno="650" slineno="6-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1311" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">The state council may make rules, in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="651" slineno="6-44"/>Administrative Rulemaking Act, to establish procedures for calculating a local <ln numlevel="1" lineno="652" slineno="6-45"/>contribution amount.</amend></subsection></section></bsec><bsec buid="60" num="73-10g-803" type="enact" src="code" uid="C73-10g-S803_2026050620260506" sort="73 10g08030020260506" numlevel="1" lineno="653" slineno="7-1" sn="7"><section numlevel="1" lineno="654" slineno="7-2" number="73-10g-803" type="enact"><secline lineno="653">Section 7. Section <bold>73-10g-803</bold> is enacted to read:</secline><catline lineno="654"><bold>73-10g-803<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Local contribution amount general <ln numlevel="1" lineno="655" slineno="7-3"/>requirements.</bold></catline><subsection ssid="60-27-5" dnum="_-o:1-i" numlevel="1" lineno="656" slineno="7-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1312" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding whether a public water system or wastewater service provider seeks to <ln numlevel="1" lineno="657" slineno="7-5"/>qualify for receipt of state money under Section <xref depth="3" refnumber="73-10g-802">73-10g-802</xref>, beginning on January 1, <ln numlevel="1" lineno="658" slineno="7-6"/>2031:</amend><subsection ssid="60-7" dnum="_-o:a-i" numlevel="1" lineno="659" slineno="7-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1313" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">the public water system shall collect from the public water system's customers an <ln numlevel="1" lineno="660" slineno="7-8"/>amount that equals or exceeds the local contribution amount for the public water <ln numlevel="1" lineno="661" slineno="7-9"/>system; and</amend></subsection><subsection ssid="60-8" dnum="_-o:b-i" numlevel="1" lineno="662" slineno="7-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1314" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">the wastewater service provider, either directly or through a public water system, <ln numlevel="1" lineno="663" slineno="7-11"/>shall collect from the wastewater service provider's customers an amount that equals <ln numlevel="1" lineno="664" slineno="7-12"/>or exceeds the local contribution amount for the wastewater service provider.</amend></subsection></subsection><subsection ssid="60-27-6" dnum="_-o:2-i" numlevel="1" lineno="665" slineno="7-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1315" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">For the purpose of complying with this section, before January 1, 2031, a public water <ln numlevel="1" lineno="666" slineno="7-14"/>system or wastewater service provider shall plan for and implement regular incremental <ln numlevel="1" lineno="667" slineno="7-15"/>increases to rates of the public water system or wastewater service provider.</amend></subsection></section></bsec><bsec buid="65" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="668" slineno="8-1" sn="8"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="668">Section 8.  <bold>Effective Date.</bold></secline><subsection ssid="65-1" dnum="_-o:1-i" numlevel="1" lineno="669" slineno="8-2" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1316" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="2" style="1" owner="jchristopherson" level="1" m-anum="0" m-ea="amend" m-pairid="5" m-groupid="4" m-style="1" m-owner="jchristopherson" m-level="1" amendtag="end">Except as provided in Subsection (2), this bill takes effect <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></subsection><subsection ssid="65-2" dnum="_-o:2-i" numlevel="1" lineno="670" slineno="8-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1317" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">The actions affecting Section 73-10g-607 <parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/26</date></paren></parens> take effect on <effdate uid="code" date="7/1/2026">July 1, <ln numlevel="1" lineno="671" slineno="8-4"/>2026</effdate>.</amend></subsection></section></bsec></bdy><foot><rev><tm>2-5-26 10:16 AM</tm></rev></foot></leg>
