Section <bold>73-10-34</bold> is amended to read:</secline><catline lineno="30"><bold>73-10-34<parens/>. Secondary water metering -- Loans and grants -- Contract terms.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="31" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="32" slineno="1-4" level="2"><display>(a)</display>"Agriculture use" means water used on land assessed under Title 59, Chapter 2, Part <ln numlevel="1" lineno="33" slineno="1-5"/>5, Farmland Assessment Act.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="34" slineno="1-6" level="2" space="false"><display>(b)</display><subsection ssid="1-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Commercial user" means a secondary water user that is a place of business.</subsection><subsection ssid="1-null-5" dnum="ii-o" numlevel="1" lineno="35" slineno="1-7" level="3"><display>(ii)</display>"Commercial user" does not include a multi-family residence, an agricultural <ln numlevel="1" lineno="36" slineno="1-8"/>user, or a customer that falls within the industrial or institutional classification.</subsection></subsection><subsection ssid="1-null-6" dnum="c-o" numlevel="1" lineno="37" slineno="1-9" level="2"><display>(c)</display>"Critical area" means an area:<subsection ssid="1-null-7" dnum="i-o" numlevel="1" lineno="38" slineno="1-10" level="3"><display>(i)</display>serviced by one of the four largest water conservancy districts, as defined in <ln numlevel="1" lineno="39" slineno="1-11"/>Section <xref depth="3" refnumber="17B-1-102">17B-1-102</xref>, measured by operating budgets; or</subsection><subsection ssid="1-null-8" dnum="ii-o" numlevel="1" lineno="40" slineno="1-12" level="3"><display>(ii)</display>within the Great Salt Lake basin, which includes:<subsection ssid="1-null-9" dnum="A-o" numlevel="1" lineno="41" slineno="1-13" level="4"><display>(A)</display>the surveyed meander line of the Great Salt Lake;</subsection><subsection ssid="1-null-10" dnum="B-o" numlevel="1" lineno="42" slineno="1-14" level="4"><display>(B)</display>the drainage areas of the Bear River or the Bear River's tributaries;</subsection><subsection ssid="1-null-11" dnum="C-o" numlevel="1" lineno="43" slineno="1-15" level="4"><display>(C)</display>the drainage areas of Bear Lake or Bear Lake's tributaries;</subsection><subsection ssid="1-null-12" dnum="D-o" numlevel="1" lineno="44" slineno="1-16" level="4"><display>(D)</display>the drainage areas of the Weber River or the Weber River's tributaries;</subsection><subsection ssid="1-null-13" dnum="E-o" numlevel="1" lineno="45" slineno="1-17" level="4"><display>(E)</display>the drainage areas of the Jordan River or the Jordan River's tributaries;</subsection><subsection ssid="1-null-14" dnum="F-o" numlevel="1" lineno="46" slineno="1-18" level="4"><display>(F)</display>the drainage areas of Utah Lake or Utah Lake's tributaries;</subsection><subsection ssid="1-null-15" dnum="G-o" numlevel="1" lineno="47" slineno="1-19" level="4"><display>(G)</display>other water drainages lying between the Bear River and the Jordan River that <ln numlevel="1" lineno="48" slineno="1-20"/>are tributary to the Great Salt Lake and not included in the drainage areas <ln numlevel="1" lineno="49" slineno="1-21"/>described in Subsections <xref depth="4" refnumber="73-10-34(1)(c)(ii)(b)">(1)(c)(ii)(B)</xref> through <xref depth="4" refnumber="73-10-34(f)">(F)</xref>; and</subsection><subsection ssid="1-null-16" dnum="H-o" numlevel="1" lineno="50" slineno="1-22" level="4"><display>(H)</display>the drainage area of Tooele Valley.</subsection></subsection></subsection><subsection ssid="1-null-17" dnum="d-o" numlevel="1" lineno="51" slineno="1-23" level="2"><display>(d)</display>"Full metering" means that use of secondary water is accurately metered by a meter <ln numlevel="1" lineno="52" slineno="1-24"/>that is installed and maintained on every secondary water connection of a secondary <ln numlevel="1" lineno="53" slineno="1-25"/>water supplier.</subsection><subsection ssid="1-null-18" dnum="e-o" numlevel="1" lineno="54" slineno="1-26" level="2" space="false"><display>(e)</display><subsection ssid="1-null-19" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Industrial user" means a secondary water user that manufactures or produces <ln numlevel="1" lineno="55" slineno="1-27"/>materials.</subsection><subsection ssid="1-null-20" dnum="ii-o" numlevel="1" lineno="56" slineno="1-28" level="3"><display>(ii)</display>"Industrial user" includes a manufacturing plant, an oil and gas producer, and a <ln numlevel="1" lineno="57" slineno="1-29"/>mining company.</subsection></subsection><subsection ssid="1-null-21" dnum="f-o" numlevel="1" lineno="58" slineno="1-30" level="2" space="false"><display>(f)</display><subsection ssid="1-null-22" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Institutional user" means a secondary water user that is dedicated to public <ln numlevel="1" lineno="59" slineno="1-31"/>service, regardless of ownership.</subsection><subsection ssid="1-null-23" dnum="ii-o" numlevel="1" lineno="60" slineno="1-32" level="3"><display>(ii)</display>"Institutional user" includes a school, church, hospital, park, golf course, and <ln numlevel="1" lineno="61" slineno="1-33"/>government facility.</subsection></subsection><subsection ssid="1-null-24" dnum="g-o" numlevel="1" lineno="62" slineno="1-34" level="2"><display>(g)</display>"Power generation use" means water used in the production of energy, such as use in <ln numlevel="1" lineno="63" slineno="1-35"/>an electric generation facility, natural gas refinery, or coal processing plant.</subsection><subsection ssid="1-null-25" dnum="h-o" numlevel="1" lineno="64" slineno="1-36" level="2" space="false"><display>(h)</display><subsection ssid="1-null-26" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Residential user" means a secondary water user in a residence.</subsection><subsection ssid="1-null-27" dnum="ii-o" numlevel="1" lineno="65" slineno="1-37" level="3"><display>(ii)</display>"Residential user" includes a single-family or multi-family home, apartment, <ln numlevel="1" lineno="66" slineno="1-38"/>duplex, twin home, condominium, or planned community.</subsection></subsection><subsection ssid="1-null-28" dnum="i-o" numlevel="1" lineno="67" slineno="1-39" level="2"><display>(i)</display>"Secondary water" means water that is:<subsection ssid="1-null-29" dnum="i-o" numlevel="1" lineno="68" slineno="1-40" level="3"><display>(i)</display>not culinary or water used on land assessed under Title 59, Chapter 2, Part 5, <ln numlevel="1" lineno="69" slineno="1-41"/>Farmland Assessment Act; and</subsection><subsection ssid="1-null-30" dnum="ii-o" numlevel="1" lineno="70" slineno="1-42" level="3"><display>(ii)</display>delivered to and used by an end user for the irrigation of landscaping or a garden.</subsection></subsection><subsection ssid="1-null-31" dnum="j-o" numlevel="1" lineno="71" slineno="1-43" level="2"><display>(j)</display>"Secondary water connection" means the location at which the water leaves the <ln numlevel="1" lineno="72" slineno="1-44"/>secondary water supplier's pipeline and enters into the remainder of the pipes that are <ln numlevel="1" lineno="73" slineno="1-45"/>owned by another person to supply water to an end user.</subsection><subsection ssid="1-null-32" dnum="k-o" numlevel="1" lineno="74" slineno="1-46" level="2"><display>(k)</display>"Secondary water supplier" means an entity that supplies pressurized secondary <ln numlevel="1" lineno="75" slineno="1-47"/>water.</subsection><subsection ssid="1-null-33" dnum="l-o" numlevel="1" lineno="76" slineno="1-48" level="2"><display>(l)</display>"Small secondary water retail supplier" means an entity that:<subsection ssid="1-null-34" dnum="i-o" numlevel="1" lineno="77" slineno="1-49" level="3"><display>(i)</display>supplies pressurized secondary water only to the end user of the secondary water; <ln numlevel="1" lineno="78" slineno="1-50"/>and</subsection><subsection ssid="1-null-35" dnum="ii-o" numlevel="1" lineno="79" slineno="1-51" level="3" space="false"><display>(ii)</display><subsection ssid="1-null-36" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is a city or town; or</subsection><subsection ssid="1-null-37" dnum="B-o" numlevel="1" lineno="80" slineno="1-52" level="4"><display>(B)</display>supplies 5,000 or fewer secondary water connections.</subsection></subsection></subsection></subsection><subsection ssid="1-null-38" dnum="2-o" numlevel="1" lineno="81" slineno="1-53" level="1" space="false"><display>(2)</display><subsection ssid="1-null-39" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="1-null-40" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>A secondary water supplier that supplies secondary water within a county of <ln numlevel="1" lineno="82" slineno="1-54"/>the first or second class and begins design work for new service on or after April <ln numlevel="1" lineno="83" slineno="1-55"/>1, 2020, to a commercial, industrial, institutional, or residential user shall meter <ln numlevel="1" lineno="84" slineno="1-56"/>the use of pressurized secondary water by the users receiving that new service.</subsection><subsection ssid="1-null-41" dnum="ii-o" numlevel="1" lineno="85" slineno="1-57" level="3" tab="1"><display>(ii)</display>A secondary water supplier that supplies secondary water within a county of the <ln numlevel="1" lineno="86" slineno="1-58"/>third, fourth, fifth, or sixth class and begins design work for new service on or <ln numlevel="1" lineno="87" slineno="1-59"/>after May 4, 2022, to a commercial, industrial, institutional, or residential user <ln numlevel="1" lineno="88" slineno="1-60"/>shall meter the use of pressurized secondary water by the users receiving that new <ln numlevel="1" lineno="89" slineno="1-61"/>service.</subsection></subsection><subsection ssid="1-null-42" dnum="b-o" numlevel="1" lineno="90" slineno="1-62" level="2"><display>(b)</display>By no later than January 1, 2030, a secondary water supplier shall install and <ln numlevel="1" lineno="91" slineno="1-63"/>maintain a meter of the use of pressurized secondary water by each user receiving <ln numlevel="1" lineno="92" slineno="1-64"/>secondary water service from the secondary water supplier.</subsection><subsection ssid="1-null-43" dnum="c-o" numlevel="1" lineno="93" slineno="1-65" level="2"><display>(c)</display>Beginning January 1, 2022, a secondary water supplier shall establish a meter <ln numlevel="1" lineno="94" slineno="1-66"/>installation reserve for metering installation and replacement projects.</subsection><subsection ssid="1-null-44" dnum="d-o" numlevel="1" lineno="95" slineno="1-67" level="2"><display>(d)</display>A secondary water supplier, including a small secondary water retail supplier, may <ln numlevel="1" lineno="96" slineno="1-68"/>not raise the rates charged for secondary water:<subsection ssid="1-null-45" dnum="i-o" numlevel="1" lineno="97" slineno="1-69" level="3"><display>(i)</display>by more than 10% in a calendar year for costs associated with metering secondary <ln numlevel="1" lineno="98" slineno="1-70"/>water unless the rise in rates is necessary because the secondary water supplier <ln numlevel="1" lineno="99" slineno="1-71"/>experiences a catastrophic failure or other similar event; or</subsection><subsection ssid="1-null-46" dnum="ii-o" numlevel="1" lineno="100" slineno="1-72" level="3"><display>(ii)</display>unless, before raising the rates on the end user, the entity charging the end user <ln numlevel="1" lineno="101" slineno="1-73"/>provides a statement explaining the basis for why the needs of the secondary <ln numlevel="1" lineno="102" slineno="1-74"/>water supplier required an increase in rates.</subsection></subsection><subsection ssid="1-null-47" dnum="e-o" numlevel="1" lineno="103" slineno="1-75" level="2" space="false"><display>(e)</display><subsection ssid="1-null-48" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A secondary water supplier that provides pressurized secondary water to a <ln numlevel="1" lineno="104" slineno="1-76"/>commercial, industrial, institutional, or residential user shall develop a plan, or if <ln numlevel="1" lineno="105" slineno="1-77"/>the secondary water supplier previously filed a similar plan, update the plan for <ln numlevel="1" lineno="106" slineno="1-78"/>metering the use of the pressurized water.</subsection><subsection ssid="1-null-49" dnum="ii-o" numlevel="1" lineno="107" slineno="1-79" level="3"><display>(ii)</display>The plan required by this Subsection <xref depth="4" refnumber="73-10-34(2)(e)">(2)(e)</xref> shall be filed or updated with the <ln numlevel="1" lineno="108" slineno="1-80"/>Division of Water Resources by no later than December 31, 2025, and address the <ln numlevel="1" lineno="109" slineno="1-81"/>process the secondary water supplier will follow to implement metering, including:<subsection ssid="1-null-50" dnum="A-o" numlevel="1" lineno="110" slineno="1-82" level="4"><display>(A)</display>the costs of full metering by the secondary water supplier;</subsection><subsection ssid="1-null-51" dnum="B-o" numlevel="1" lineno="111" slineno="1-83" level="4"><display>(B)</display>how long it would take the secondary water supplier to complete full <ln numlevel="1" lineno="112" slineno="1-84"/>metering, including an anticipated beginning date and completion date, except <ln numlevel="1" lineno="113" slineno="1-85"/>a secondary water supplier shall achieve full metering by no later than January <ln numlevel="1" lineno="114" slineno="1-86"/>1, 2030; and</subsection><subsection ssid="1-null-52" dnum="C-o" numlevel="1" lineno="115" slineno="1-87" level="4"><display>(C)</display>how the secondary water supplier will finance metering.</subsection></subsection></subsection></subsection><subsection ssid="1-null-53" dnum="3-o" numlevel="1" lineno="116" slineno="1-88" level="1"><display>(3)</display>A secondary water supplier shall on or before March 31 of each year, report to the <ln numlevel="1" lineno="117" slineno="1-89"/>Division of Water Rights:<subsection ssid="1-null-54" dnum="a-o" numlevel="1" lineno="118" slineno="1-90" level="2"><display>(a)</display>for commercial, industrial, institutional, and residential users whose pressurized <ln numlevel="1" lineno="119" slineno="1-91"/>secondary water use is metered, the number of acre feet of pressurized secondary <ln numlevel="1" lineno="120" slineno="1-92"/>water the secondary water supplier supplied to the commercial, industrial, <ln numlevel="1" lineno="121" slineno="1-93"/>institutional, and residential users during the preceding 12-month period;</subsection><subsection ssid="1-null-55" dnum="b-o" numlevel="1" lineno="122" slineno="1-94" level="2"><display>(b)</display>the number of secondary water meters within the secondary water supplier's service <ln numlevel="1" lineno="123" slineno="1-95"/>boundary;</subsection><subsection ssid="1-null-56" dnum="c-o" numlevel="1" lineno="124" slineno="1-96" level="2"><display>(c)</display>a description of the secondary water supplier's service boundary;</subsection><subsection ssid="1-null-57" dnum="d-o" numlevel="1" lineno="125" slineno="1-97" level="2"><display>(d)</display>the number of secondary water connections in each of the following categories <ln numlevel="1" lineno="126" slineno="1-98"/>through which the secondary water supplier supplies pressurized secondary water:<subsection ssid="1-null-58" dnum="i-o" numlevel="1" lineno="127" slineno="1-99" level="3"><display>(i)</display>commercial;</subsection><subsection ssid="1-null-59" dnum="ii-o" numlevel="1" lineno="128" slineno="1-100" level="3"><display>(ii)</display>industrial;</subsection><subsection ssid="1-null-60" dnum="iii-o" numlevel="1" lineno="129" slineno="1-101" level="3"><display>(iii)</display>institutional; and</subsection><subsection ssid="1-null-61" dnum="iv-o" numlevel="1" lineno="130" slineno="1-102" level="3"><display>(iv)</display>residential;</subsection></subsection><subsection ssid="1-null-62" dnum="e-o" numlevel="1" lineno="131" slineno="1-103" level="2"><display>(e)</display>the total volume of water that the secondary water supplier receives from the <ln numlevel="1" lineno="132" slineno="1-104"/>secondary water supplier's sources; and</subsection><subsection ssid="1-null-63" dnum="f-o" numlevel="1" lineno="133" slineno="1-105" level="2"><display>(f)</display>the dates of service during the preceding 12-month period in which the secondary <ln numlevel="1" lineno="134" slineno="1-106"/>water supplier supplied pressurized secondary water.</subsection></subsection><subsection ssid="1-null-64" dnum="4-o" numlevel="1" lineno="135" slineno="1-107" level="1" space="false"><display>(4)</display><subsection ssid="1-null-65" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Beginning July 1, 2019, the Board of Water Resources may make up to <ln numlevel="1" lineno="136" slineno="1-108"/>$10,000,000 in low-interest loans available each year:<subsection ssid="1-null-66" dnum="i-o" numlevel="1" lineno="137" slineno="1-109" level="3" tab="1"><display>(i)</display>from the Water Resources Conservation and Development Fund, created in <ln numlevel="1" lineno="138" slineno="1-110"/>Section <xref depth="3" refnumber="73-10-24">73-10-24</xref>; and</subsection><subsection ssid="1-null-67" dnum="ii-o" numlevel="1" lineno="139" slineno="1-111" level="3" tab="1"><display>(ii)</display>for financing the cost of secondary water metering.</subsection></subsection><subsection ssid="1-null-68" dnum="b-o" numlevel="1" lineno="140" slineno="1-112" level="2"><display>(b)</display>The Division of Water Resources and the Board of Water Resources shall make rules <ln numlevel="1" lineno="141" slineno="1-113"/>in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, <ln numlevel="1" lineno="142" slineno="1-114"/>establishing the criteria and process for receiving a loan described in this Subsection <xref depth="4" refnumber="73-10-34(4)"><ln numlevel="1" lineno="143" slineno="1-115"/>(4)</xref>, except the rules may not include prepayment penalties.</subsection></subsection><subsection ssid="1-null-69" dnum="5-o" numlevel="1" lineno="144" slineno="1-116" level="1" space="false"><display>(5)</display><subsection ssid="1-null-70" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Beginning July 1, 2021, subject to appropriation, the Division of Water Resources <ln numlevel="1" lineno="145" slineno="1-117"/>may make matching grants each year for financing the cost of secondary water <ln numlevel="1" lineno="146" slineno="1-118"/>metering for a commercial, industrial, institutional, or residential user by a small <ln numlevel="1" lineno="147" slineno="1-119"/>secondary water retail supplier that:<subsection ssid="1-null-71" dnum="i-o" numlevel="1" lineno="148" slineno="1-120" level="3" tab="1"><display>(i)</display>is not for new service described in Subsection <xref depth="4" refnumber="73-10-34(2)(a)">(2)(a)</xref>; and</subsection><subsection ssid="1-null-72" dnum="ii-o" numlevel="1" lineno="149" slineno="1-121" level="3" tab="1"><display>(ii)</display>matches the amount of the grant.</subsection></subsection><subsection ssid="1-null-73" dnum="b-o" numlevel="1" lineno="150" slineno="1-122" level="2"><display>(b)</display>For purposes of issuing grants under this section, the division shall prioritize the <ln numlevel="1" lineno="151" slineno="1-123"/>small secondary water retail suppliers that can demonstrate the greatest need or <ln numlevel="1" lineno="152" slineno="1-124"/>greatest inability to pay the entire cost of installing secondary water meters.</subsection><subsection ssid="1-null-74" dnum="c-o" numlevel="1" lineno="153" slineno="1-125" level="2"><display>(c)</display>The amount of a grant under this Subsection <xref depth="4" refnumber="73-10-34(5)">(5)</xref> may not:<subsection ssid="1-null-75" dnum="i-o" numlevel="1" lineno="154" slineno="1-126" level="3"><display>(i)</display>exceed 50% of the small secondary water retail supplier's cost of installing <ln numlevel="1" lineno="155" slineno="1-127"/>secondary water meters; or</subsection><subsection ssid="1-null-76" dnum="ii-o" numlevel="1" lineno="156" slineno="1-128" level="3"><display>(ii)</display>supplant federal, state, or local money previously allocated to pay the small <ln numlevel="1" lineno="157" slineno="1-129"/>secondary water retail supplier's cost of installing secondary water meters.</subsection></subsection><subsection ssid="1-null-77" dnum="d-o" numlevel="1" lineno="158" slineno="1-130" level="2"><display>(d)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="159" slineno="1-131"/>Board of Water Resources shall make rules establishing:<subsection ssid="1-null-78" dnum="i-o" numlevel="1" lineno="160" slineno="1-132" level="3"><display>(i)</display>the procedure for applying for a grant under this Subsection <xref depth="4" refnumber="73-10-34(5)">(5)</xref>; and</subsection><subsection ssid="1-null-79" dnum="ii-o" numlevel="1" lineno="161" slineno="1-133" level="3"><display>(ii)</display>how a small secondary water retail supplier can establish that the small secondary <ln numlevel="1" lineno="162" slineno="1-134"/>water retail supplier meets the eligibility requirements of this Subsection <xref depth="4" refnumber="73-10-34(5)">(5)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-80" dnum="6-o" numlevel="1" lineno="163" slineno="1-135" level="1"><display>(6)</display>Nothing in this section affects a water right holder's obligation to measure and report <ln numlevel="1" lineno="164" slineno="1-136"/>water usage as described in Sections <xref depth="3" refnumber="73-5-4">73-5-4</xref> and <xref depth="3" refnumber="73-5-8">73-5-8</xref>.</subsection><subsection ssid="1-null-81" dnum="7-o" numlevel="1" lineno="165" slineno="1-137" level="1"><display>(7)</display>If a secondary water supplier fails to comply with Subsection <xref depth="4" refnumber="73-10-34(2)(b)">(2)(b)</xref>, the secondary <ln numlevel="1" lineno="166" slineno="1-138"/>water supplier:<subsection ssid="1-null-82" dnum="a-o" numlevel="1" lineno="167" slineno="1-139" level="2"><display>(a)</display>beginning January 1, 2030, may not receive state money for water related purposes <ln numlevel="1" lineno="168" slineno="1-140"/>until the secondary water supplier completes full metering; and</subsection><subsection ssid="1-null-83" dnum="b-o" numlevel="1" lineno="169" slineno="1-141" level="2"><display>(b)</display>is subject to an enforcement action of the state engineer in accordance with <ln numlevel="1" lineno="170" slineno="1-142"/>Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref>.</subsection></subsection><subsection ssid="1-null-84" dnum="8-o" numlevel="1" lineno="171" slineno="1-143" level="1" space="false"><display>(8)</display><subsection ssid="1-null-85" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="1-null-86" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>The state engineer shall commence an enforcement action under this <ln numlevel="1" lineno="172" slineno="1-144"/>Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref> if the state engineer receives a referral from the director of the <ln numlevel="1" lineno="173" slineno="1-145"/>Division of Water Resources.</subsection><subsection ssid="1-null-87" dnum="ii-o" numlevel="1" lineno="174" slineno="1-146" level="3" tab="1"><display>(ii)</display>The director of the Division of Water Resources shall submit a referral to the state <ln numlevel="1" lineno="175" slineno="1-147"/>engineer if the director:<subsection ssid="1-null-88" dnum="A-o" numlevel="1" lineno="176" slineno="1-148" level="4"><display>(A)</display>finds that a secondary water supplier fails to fully meter secondary water as <ln numlevel="1" lineno="177" slineno="1-149"/>required by this section; and</subsection><subsection ssid="1-null-89" dnum="B-o" numlevel="1" lineno="178" slineno="1-150" level="4"><display>(B)</display>determines an enforcement action is necessary to conserve or protect a water <ln numlevel="1" lineno="179" slineno="1-151"/>resource in the state.</subsection></subsection></subsection><subsection ssid="1-null-90" dnum="b-o" numlevel="1" lineno="180" slineno="1-152" level="2"><display>(b)</display>To commence an enforcement action under this Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref>, the state engineer <ln numlevel="1" lineno="181" slineno="1-153"/>shall issue a notice of violation that includes notice of the administrative fine to <ln numlevel="1" lineno="182" slineno="1-154"/>which a secondary water supplier is subject.</subsection><subsection ssid="1-null-91" dnum="c-o" numlevel="1" lineno="183" slineno="1-155" level="2"><display>(c)</display>The state engineer's issuance and enforcement of a notice of violation is exempt from <ln numlevel="1" lineno="184" slineno="1-156"/>Title 63G, Chapter 4, Administrative Procedures Act.</subsection><subsection ssid="1-null-92" dnum="d-o" numlevel="1" lineno="185" slineno="1-157" level="2"><display>(d)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="186" slineno="1-158"/>state engineer shall make rules necessary to enforce a notice of violation, that <ln numlevel="1" lineno="187" slineno="1-159"/>includes:<subsection ssid="1-null-93" dnum="i-o" numlevel="1" lineno="188" slineno="1-160" level="3"><display>(i)</display>provisions consistent with this Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref> for enforcement of the notice if a <ln numlevel="1" lineno="189" slineno="1-161"/>secondary water supplier to whom a notice is issued fails to respond to the notice <ln numlevel="1" lineno="190" slineno="1-162"/>or abate the violation;</subsection><subsection ssid="1-null-94" dnum="ii-o" numlevel="1" lineno="191" slineno="1-163" level="3"><display>(ii)</display>the right to a hearing, upon request by a secondary water supplier against whom <ln numlevel="1" lineno="192" slineno="1-164"/>the notice is issued; and</subsection><subsection ssid="1-null-95" dnum="iii-o" numlevel="1" lineno="193" slineno="1-165" level="3"><display>(iii)</display>provisions for timely issuance of a final order after the secondary water supplier <ln numlevel="1" lineno="194" slineno="1-166"/>to whom the notice is issued fails to respond to the notice or abate the violation, or <ln numlevel="1" lineno="195" slineno="1-167"/>after a hearing held under Subsection <xref depth="4" refnumber="73-10-34(8)(d)(ii)">(8)(d)(ii)</xref>.</subsection></subsection><subsection ssid="1-null-96" dnum="e-o" numlevel="1" lineno="196" slineno="1-168" level="2"><display>(e)</display>A person may not intervene in an enforcement action commenced under this section.</subsection><subsection ssid="1-null-97" dnum="f-o" numlevel="1" lineno="197" slineno="1-169" level="2"><display>(f)</display>After issuance of a final order under rules made <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="175" groupid="140" style="2" owner="ahaskell" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="174" groupid="139" style="1" owner="ahaskell" level="1" amendtag="both" space="true">in accordance with</amend> <ln numlevel="1" lineno="198" slineno="1-170"/>Subsection <xref depth="4" refnumber="73-10-34(8)(d)">(8)(d)</xref>, the state engineer shall serve a copy of the final order on the <ln numlevel="1" lineno="199" slineno="1-171"/>secondary water supplier against whom the order is issued by:<subsection ssid="1-null-98" dnum="i-o" numlevel="1" lineno="200" slineno="1-172" level="3"><display>(i)</display>personal service under Utah Rules of Civil Procedure, Rule 5; or</subsection><subsection ssid="1-null-99" dnum="ii-o" numlevel="1" lineno="201" slineno="1-173" level="3"><display>(ii)</display>certified mail.</subsection></subsection><subsection ssid="1-null-100" dnum="g-o" numlevel="1" lineno="202" slineno="1-174" level="2" space="false"><display>(g)</display><subsection ssid="1-null-101" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The state engineer's final order may be reviewed by trial de novo by the court <ln numlevel="1" lineno="203" slineno="1-175"/>with jurisdiction in Salt Lake County or the county where the violation occurred.</subsection><subsection ssid="1-null-102" dnum="ii-o" numlevel="1" lineno="204" slineno="1-176" level="3"><display>(ii)</display>A secondary water supplier shall file a petition for judicial review of the state <ln numlevel="1" lineno="205" slineno="1-177"/>engineer's final order issued under this section within 20 days from the day on <ln numlevel="1" lineno="206" slineno="1-178"/>which the final order was served on the secondary water supplier.</subsection></subsection><subsection ssid="1-null-103" dnum="h-o" numlevel="1" lineno="207" slineno="1-179" level="2"><display>(h)</display>The state engineer may bring suit in a court of competent jurisdiction to enforce a <ln numlevel="1" lineno="208" slineno="1-180"/>final order issued under this Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref>.</subsection><subsection ssid="1-null-104" dnum="i-o" numlevel="1" lineno="209" slineno="1-181" level="2"><display>(i)</display>If the state engineer prevails in an action brought under Subsection <xref depth="4" refnumber="73-10-34(8)(g)">(8)(g)</xref> or <xref depth="4" refnumber="73-10-34(h)">(h)</xref>, the <ln numlevel="1" lineno="210" slineno="1-182"/>state may recover court costs and a reasonable attorney fee.</subsection><subsection ssid="1-null-105" dnum="j-o" numlevel="1" lineno="211" slineno="1-183" level="2"><display>(j)</display>As part of a final order issued under this Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref>, the state engineer shall order <ln numlevel="1" lineno="212" slineno="1-184"/>that a secondary water supplier to whom an order is issued pay an administrative fine <ln numlevel="1" lineno="213" slineno="1-185"/>equal to:<subsection ssid="1-null-106" dnum="i-o" numlevel="1" lineno="214" slineno="1-186" level="3"><display>(i)</display>$10 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="215" slineno="1-187"/>supplier for failure to comply with full metering by January 1, 2030;</subsection><subsection ssid="1-null-107" dnum="ii-o" numlevel="1" lineno="216" slineno="1-188" level="3"><display>(ii)</display>$20 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="217" slineno="1-189"/>supplier for failure to comply with full metering by January 1, 2031;</subsection><subsection ssid="1-null-108" dnum="iii-o" numlevel="1" lineno="218" slineno="1-190" level="3"><display>(iii)</display>$30 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="219" slineno="1-191"/>supplier for failure to comply with full metering by January 1, 2032;</subsection><subsection ssid="1-null-109" dnum="iv-o" numlevel="1" lineno="220" slineno="1-192" level="3"><display>(iv)</display>$40 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="221" slineno="1-193"/>supplier for failure to comply with full metering by January 1, 2033; and</subsection><subsection ssid="1-null-110" dnum="v-o" numlevel="1" lineno="222" slineno="1-194" level="3"><display>(v)</display>$50 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="223" slineno="1-195"/>supplier for failure to comply with full metering by January 1, 2034, and for each <ln numlevel="1" lineno="224" slineno="1-196"/>subsequent year the secondary water supplier fails to comply with full metering.</subsection></subsection><subsection ssid="1-null-111" dnum="k-o" numlevel="1" lineno="225" slineno="1-197" level="2"><display>(k)</display>Money collected under this Subsection <xref depth="4" refnumber="73-10-34(8)">(8)</xref> shall be deposited into the Water <ln numlevel="1" lineno="226" slineno="1-198"/>Resources Conservation and Development Fund, created in Section <xref depth="3" refnumber="73-10-24">73-10-24</xref>.</subsection></subsection><subsection ssid="1-null-112" dnum="9-o" numlevel="1" lineno="227" slineno="1-199" level="1"><display>(9)</display>A secondary water supplier located within a county of the fifth or sixth class is exempt <ln numlevel="1" lineno="228" slineno="1-200"/>from Subsections <xref depth="4" refnumber="73-10-34(2)(a)">(2)(a)</xref>, (2)(b), (2)(c), (2)(e), (7), and (8) if:<subsection ssid="1-null-113" dnum="a-o" numlevel="1" lineno="229" slineno="1-201" level="2"><display>(a)</display>the owner or operator of the secondary water supplier seeks an exemption under this <ln numlevel="1" lineno="230" slineno="1-202"/>Subsection <xref depth="4" refnumber="73-10-34(9)">(9)</xref> by establishing with the Division of Water Resources that the cost of <ln numlevel="1" lineno="231" slineno="1-203"/>purchasing, installing, and upgrading systems to accept meters exceeds 25% of the <ln numlevel="1" lineno="232" slineno="1-204"/>total operating budget of the owner or operator of the secondary water supplier;</subsection><subsection ssid="1-null-114" dnum="b-o" numlevel="1" lineno="233" slineno="1-205" level="2"><display>(b)</display>the secondary water supplier agrees to not add a new secondary water connection to <ln numlevel="1" lineno="234" slineno="1-206"/>the secondary water supplier's system on or after May 4, 2022;</subsection><subsection ssid="1-null-115" dnum="c-o" numlevel="1" lineno="235" slineno="1-207" level="2"><display>(c)</display>within six months of  when the secondary water supplier seeks an exemption under <ln numlevel="1" lineno="236" slineno="1-208"/>Subsection <xref depth="4" refnumber="73-10-34(9)(a)">(9)(a)</xref>, the secondary water supplier provides to the Division of Water <ln numlevel="1" lineno="237" slineno="1-209"/>Resources a plan for conservation within the secondary water supplier's service area <ln numlevel="1" lineno="238" slineno="1-210"/>that does not require metering;</subsection><subsection ssid="1-null-116" dnum="d-o" numlevel="1" lineno="239" slineno="1-211" level="2"><display>(d)</display>the secondary water supplier annually reports to the Division of Water Resources on <ln numlevel="1" lineno="240" slineno="1-212"/>the results of the plan described in Subsection <xref depth="4" refnumber="73-10-34(9)(c)">(9)(c)</xref>; and</subsection><subsection ssid="1-null-117" dnum="e-o" numlevel="1" lineno="241" slineno="1-213" level="2"><display>(e)</display>the secondary water supplier submits to evaluations by the Division of Water <ln numlevel="1" lineno="242" slineno="1-214"/>Resources of the effectiveness of the plan described in Subsection <xref depth="4" refnumber="73-10-34(9)(c)">(9)(c)</xref>.</subsection></subsection><subsection ssid="1-null-118" dnum="10-o" numlevel="1" lineno="243" slineno="1-215" level="1"><display>(10)</display>A secondary water supplier is exempt from Subsections <xref depth="4" refnumber="73-10-34(2)(a)">(2)(a)</xref>, (2)(b), (2)(c), (2)(e), <ln numlevel="1" lineno="244" slineno="1-216"/>(7), and (8) to the extent that the secondary water supplier:<subsection ssid="1-null-119" dnum="a-o" numlevel="1" lineno="245" slineno="1-217" level="2"><display>(a)</display>is unable to obtain a meter that a meter manufacturer will warranty because of the <ln numlevel="1" lineno="246" slineno="1-218"/>water quality within a specific location served by the secondary water supplier;</subsection><subsection ssid="1-null-120" dnum="b-o" numlevel="1" lineno="247" slineno="1-219" level="2"><display>(b)</display>submits reasonable proof to the Division of Water Resources that the secondary <ln numlevel="1" lineno="248" slineno="1-220"/>water supplier is unable to obtain a meter as described in Subsection <xref depth="4" refnumber="73-10-34(10)(a)">(10)(a)</xref>;</subsection><subsection ssid="1-null-121" dnum="c-o" numlevel="1" lineno="249" slineno="1-221" level="2"><display>(c)</display>within six months of when the secondary water supplier submits reasonable proof <ln numlevel="1" lineno="250" slineno="1-222"/>under Subsection <xref depth="4" refnumber="73-10-34(10)(b)">(10)(b)</xref>, provides to the Division of Water Resources a plan for <ln numlevel="1" lineno="251" slineno="1-223"/>conservation within the secondary water supplier's service area that does not require <ln numlevel="1" lineno="252" slineno="1-224"/>metering;</subsection><subsection ssid="1-null-122" dnum="d-o" numlevel="1" lineno="253" slineno="1-225" level="2"><display>(d)</display>annually reports to the Division of Water Resources on the results of the plan <ln numlevel="1" lineno="254" slineno="1-226"/>described in Subsection <xref depth="4" refnumber="73-10-34(10)(c)">(10)(c)</xref>; and</subsection><subsection ssid="1-null-123" dnum="e-o" numlevel="1" lineno="255" slineno="1-227" level="2"><display>(e)</display>submits to evaluations by the Division of Water Resources of the effectiveness of the <ln numlevel="1" lineno="256" slineno="1-228"/>plan described in Subsection <xref depth="4" refnumber="73-10-34(10)(c)">(10)(c)</xref>.</subsection></subsection><subsection ssid="1-null-124" dnum="11-o" numlevel="1" lineno="257" slineno="1-229" level="1"><display>(11)</display>A secondary water supplier that is located within a critical management area that is <ln numlevel="1" lineno="258" slineno="1-230"/>subject to a groundwater management plan adopted or amended under Section <xref depth="3" refnumber="73-5-15">73-5-15</xref> <ln numlevel="1" lineno="259" slineno="1-231"/>on or after May 1, 2006, is exempt from Subsections <xref depth="4" refnumber="73-10-34(2)(a)">(2)(a)</xref>, (2)(b), (2)(c), (2)(e), (7), and <ln numlevel="1" lineno="260" slineno="1-232"/>(8).</subsection><subsection ssid="1-null-125" dnum="12-o" numlevel="1" lineno="261" slineno="1-233" level="1"><display>(12)</display>If a secondary water supplier is required to have a water conservation plan under <ln numlevel="1" lineno="262" slineno="1-234"/>Section <xref depth="3" refnumber="73-10-32">73-10-32</xref>, that water conservation plan satisfies the requirements of Subsection <xref depth="4" refnumber="73-10-34(9)(c)"><ln numlevel="1" lineno="263" slineno="1-235"/>(9)(c)</xref> or (10)(c).</subsection><subsection ssid="1-null-126" dnum="13-o" numlevel="1" lineno="264" slineno="1-236" level="1" space="false"><display>(13)</display><subsection ssid="1-null-127" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding the other provisions of this section and unless exempt under <ln numlevel="1" lineno="265" slineno="1-237"/>Subsection <xref depth="4" refnumber="73-10-34(9)">(9)</xref>, (10), or (11), to comply with this section, a secondary water supplier <ln numlevel="1" lineno="266" slineno="1-238"/>is not required to meter every secondary water connection of the secondary water <ln numlevel="1" lineno="267" slineno="1-239"/>supplier's system, but shall meter at strategic points of the system as approved by the <ln numlevel="1" lineno="268" slineno="1-240"/>state engineer under this Subsection <xref depth="4" refnumber="73-10-34(13)">(13)</xref> if:<subsection ssid="1-null-128" dnum="i-o" numlevel="1" lineno="269" slineno="1-241" level="3" tab="1"><display>(i)</display>the system has no or minimal storage and relies primarily on stream flow;</subsection><subsection ssid="1-null-129" dnum="ii-o" numlevel="1" lineno="270" slineno="1-242" level="3" tab="1" space="false"><display>(ii)</display><subsection ssid="1-null-130" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the majority of secondary water users on the system are associated with <ln numlevel="1" lineno="271" slineno="1-243"/>agriculture use or power generation use; and</subsection><subsection ssid="1-null-131" dnum="B-o" numlevel="1" lineno="272" slineno="1-244" level="4"><display>(B)</display>less than 50% of the secondary water is used by residential secondary water <ln numlevel="1" lineno="273" slineno="1-245"/>users; or</subsection></subsection><subsection ssid="1-null-132" dnum="iii-o" numlevel="1" lineno="274" slineno="1-246" level="3" tab="1"><display>(iii)</display>the system has a mix of pressurized lines and open ditches and:<subsection ssid="1-null-133" dnum="A-o" numlevel="1" lineno="275" slineno="1-247" level="4"><display>(A)</display>1,000 or fewer users if any part of the system is within a critical area; or</subsection><subsection ssid="1-null-134" dnum="B-o" numlevel="1" lineno="276" slineno="1-248" level="4"><display>(B)</display>2,500 or fewer users for a system not described in Subsection <xref depth="4" refnumber="73-10-34(13)(a)(iii)(a)">(13)(a)(iii)(A)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-135" dnum="b-o" numlevel="1" lineno="277" slineno="1-249" level="2" space="false"><display>(b)</display><subsection ssid="1-null-136" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A secondary water supplier may obtain the approval by the state engineer of <ln numlevel="1" lineno="278" slineno="1-250"/>strategic points where metering is to occur as required under this Subsection <xref depth="4" refnumber="73-10-34(13)">(13)</xref> <ln numlevel="1" lineno="279" slineno="1-251"/>by filing an application with the state engineer in the form established by the state <ln numlevel="1" lineno="280" slineno="1-252"/>engineer.</subsection><subsection ssid="1-null-137" dnum="ii-o" numlevel="1" lineno="281" slineno="1-253" level="3"><display>(ii)</display>The state engineer may by rule, made in accordance with Title 63G, Chapter 3, <ln numlevel="1" lineno="282" slineno="1-254"/>Utah Administrative Rulemaking Act, establish procedures for approving strategic <ln numlevel="1" lineno="283" slineno="1-255"/>points for metering under this Subsection <xref depth="4" refnumber="73-10-34(13)">(13)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-138" dnum="14-o" numlevel="1" lineno="284" slineno="1-256" level="1" space="false"><display>(14)</display><subsection ssid="1-null-139" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A contract entered into or renewed on or after July 1, 2025, between a secondary <ln numlevel="1" lineno="285" slineno="1-257"/>water supplier and an end user shall allow for billing by tiered conservation rates.</subsection><subsection ssid="1-null-140" dnum="b-o" numlevel="1" lineno="286" slineno="1-258" level="2"><display>(b)</display>Except as provided in Subsection <xref tempid="385" depth="4" refnumber="73-10-34(14)(f)">(14)(f)</xref>, by no later than July 1, 2030, regardless of <ln numlevel="1" lineno="287" slineno="1-259"/>whether the secondary water supplier is fully metered or has modified existing <ln numlevel="1" lineno="288" slineno="1-260"/>contracts with end users, a secondary water supplier shall begin billing an end user <ln numlevel="1" lineno="289" slineno="1-261"/>using a tiered conservation rate that considers:<subsection ssid="1-null-141" dnum="i-o" numlevel="1" lineno="290" slineno="1-262" level="3"><display>(i)</display>revenue stability;</subsection><subsection ssid="1-null-142" dnum="ii-o" numlevel="1" lineno="291" slineno="1-263" level="3"><display>(ii)</display>water conservation; and</subsection><subsection ssid="1-null-143" dnum="iii-o" numlevel="1" lineno="292" slineno="1-264" level="3"><display>(iii)</display>cost of service.</subsection></subsection><subsection ssid="1-null-144" dnum="c-o" numlevel="1" lineno="293" slineno="1-265" level="2"><display>(c)</display>A secondary water supplier may comply with Subsection <xref depth="4" refnumber="73-10-34(14)(b)">(14)(b)</xref> by entering into a <ln numlevel="1" lineno="294" slineno="1-266"/>contract with a third-party, including the public water system that serves an end user <ln numlevel="1" lineno="295" slineno="1-267"/>of the secondary water supplier, to bill the end user according to end user's usage of <ln numlevel="1" lineno="296" slineno="1-268"/>secondary water and the secondary water supplier's tiered conservation rate.</subsection><subsection ssid="1-null-145" dnum="d-o" numlevel="1" lineno="297" slineno="1-269" level="2"><display>(d)</display>By no later than April 1, 2030, a secondary water supplier shall provide an <ln numlevel="1" lineno="298" slineno="1-270"/>educational component for end users as determined by the division by rule made in <ln numlevel="1" lineno="299" slineno="1-271"/>accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, either <ln numlevel="1" lineno="300" slineno="1-272"/>on a monthly statement or by an end user specific Internet portal that provides <ln numlevel="1" lineno="301" slineno="1-273"/>information on the end user's usage more frequently than monthly.</subsection><subsection ssid="1-null-146" dnum="e-o" numlevel="1" lineno="302" slineno="1-274" level="2"><display>(e)</display>A public water system:<subsection ssid="1-null-147" dnum="i-o" numlevel="1" lineno="303" slineno="1-275" level="3"><display>(i)</display>shall enter into a contract with a secondary water supplier described in Subsection <xref refnumber="73-10-34(14)(c)" depth="4"><ln numlevel="1" lineno="304" slineno="1-276"/>(14)(c)</xref> upon request from the secondary water supplier if the secondary water <ln numlevel="1" lineno="305" slineno="1-277"/>supplier agrees to provide water use and other data necessary for accurate billing <ln numlevel="1" lineno="306" slineno="1-278"/>in a file format compatible with the public water supplier's billing system;</subsection><subsection ssid="1-null-148" dnum="ii-o" numlevel="1" lineno="307" slineno="1-279" level="3"><display>(ii)</display>may collect the costs associated with billing on behalf of a secondary water <ln numlevel="1" lineno="308" slineno="1-280"/>supplier under this section from the secondary water end users, including <ln numlevel="1" lineno="309" slineno="1-281"/>reasonable administrative and overhead expenses; and</subsection><subsection ssid="1-null-149" dnum="iii-o" numlevel="1" lineno="310" slineno="1-282" level="3"><display>(iii)</display>shall, as the public water supplier and the secondary water supplier find <ln numlevel="1" lineno="311" slineno="1-283"/>necessary or convenient, exchange with the secondary water supplier, for the <ln numlevel="1" lineno="312" slineno="1-284"/>purpose of maintaining accurate records, relevant information with regard to an <ln numlevel="1" lineno="313" slineno="1-285"/>end user of the secondary water supplier, such as:<subsection ssid="1-null-150" dnum="A-o" numlevel="1" lineno="314" slineno="1-286" level="4"><display>(A)</display>a billing address;</subsection><subsection ssid="1-null-151" dnum="B-o" numlevel="1" lineno="315" slineno="1-287" level="4"><display>(B)</display>an address where the secondary water is delivered;</subsection><subsection ssid="1-null-152" dnum="C-o" numlevel="1" lineno="316" slineno="1-288" level="4"><display>(C)</display>a parcel identification number; and</subsection><subsection ssid="1-null-153" dnum="D-o" numlevel="1" lineno="317" slineno="1-289" level="4"><display>(D)</display>ownership information.</subsection></subsection></subsection><subsection ssid="1-null-154" dnum="f-o" numlevel="1" lineno="318" slineno="1-290" level="2" space="false"><display>(f)</display><subsection ssid="1-null-155" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A secondary water supplier is not required to bill an end user a tiered <ln numlevel="1" lineno="319" slineno="1-291"/>conservation rate if the secondary water supplier is:<subsection ssid="1-null-156" dnum="A-o" numlevel="1" lineno="320" slineno="1-292" level="4" tab="1"><display>(A)</display>exempt from metering under Subsection <xref depth="4" refnumber="73-10-34(9)">(9)</xref>, (10), or (11); or</subsection><subsection ssid="1-null-157" dnum="B-o" numlevel="1" lineno="321" slineno="1-293" level="4" tab="1"><display>(B)</display>authorized to meter at strategic points of the system under Subsection <xref depth="4" refnumber="73-10-34(13)">(13)</xref>.</subsection></subsection><subsection ssid="1-null-158" dnum="ii-o" numlevel="1" lineno="322" slineno="1-294" level="3"><display>(ii)</display>Notwithstanding the other provisions of this section, on or after July 1, 2030, a <ln numlevel="1" lineno="323" slineno="1-295"/>secondary water supplier with a tiered conservation rate under this Subsection <xref depth="4" refnumber="73-10-34(14)">(14)</xref> <ln numlevel="1" lineno="324" slineno="1-296"/>shall charge an end user at the lowest rate of the tiered conservation rate if the end <ln numlevel="1" lineno="325" slineno="1-297"/>user is using a portion of the water to grow food, including growing a garden, fruit <ln numlevel="1" lineno="326" slineno="1-298"/>trees, or pasture for grazing.</subsection></subsection><subsection ssid="1-null-159" dnum="g-o" numlevel="1" lineno="327" slineno="1-299" level="2" space="false"><display>(g)</display><subsection ssid="1-null-160" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If a secondary water supplier violates this Subsection <xref refnumber="73-10-34(14)" depth="4">(14)</xref> on or after April 1, <ln numlevel="1" lineno="328" slineno="1-300"/>2030, the secondary water supplier:<subsection ssid="1-null-161" dnum="A-o" numlevel="1" lineno="329" slineno="1-301" level="4" tab="1"><display>(A)</display>may not receive state money for water related purposes until the secondary <ln numlevel="1" lineno="330" slineno="1-302"/>water supplier complies with this Subsection <xref refnumber="73-10-34(14)" depth="4">(14)</xref>; and</subsection><subsection ssid="1-null-162" dnum="B-o" numlevel="1" lineno="331" slineno="1-303" level="4" tab="1"><display>(B)</display>is subject to an enforcement action of the state engineer in accordance with <ln numlevel="1" lineno="332" slineno="1-304"/>this Subsection <xref depth="4" refnumber="73-10-34(14)(g)">(14)(g)</xref>.</subsection></subsection><subsection ssid="1-null-163" dnum="ii-o" numlevel="1" lineno="333" slineno="1-305" level="3"><display>(ii)</display>The state engineer shall commence an enforcement action under this Subsection <xref depth="4" refnumber="73-10-34(14)(g)"><ln numlevel="1" lineno="334" slineno="1-306"/>(14)(g)</xref> if the state engineer receives a referral from the director of the Division of <ln numlevel="1" lineno="335" slineno="1-307"/>Water Resources.</subsection><subsection ssid="1-null-164" dnum="iii-o" numlevel="1" lineno="336" slineno="1-308" level="3"><display>(iii)</display>The director of the Division of Water Resources shall submit a referral to the <ln numlevel="1" lineno="337" slineno="1-309"/>state engineer if the director:<subsection ssid="1-null-165" dnum="A-o" numlevel="1" lineno="338" slineno="1-310" level="4"><display>(A)</display>finds that a secondary water supplier fails to comply with this Subsection <xref refnumber="73-10-34(14)" depth="4">(14)</xref>; <ln numlevel="1" lineno="339" slineno="1-311"/>and</subsection><subsection ssid="1-null-166" dnum="B-o" numlevel="1" lineno="340" slineno="1-312" level="4"><display>(B)</display>determines an enforcement action is necessary to conserve or protect a water <ln numlevel="1" lineno="341" slineno="1-313"/>resource in the state.</subsection></subsection><subsection ssid="1-null-167" dnum="iv-o" numlevel="1" lineno="342" slineno="1-314" level="3"><display>(iv)</display>To commence an enforcement action under this Subsection <xref depth="4" refnumber="73-10-34(14)(g)">(14)(g)</xref>, the state <ln numlevel="1" lineno="343" slineno="1-315"/>engineer shall issue a notice of violation that includes notice of the administrative <ln numlevel="1" lineno="344" slineno="1-316"/>fine described in Subsection <xref tempid="1057" depth="4" refnumber="73-10-34(14)(g)(xiii)">(14)(g)(xiii)</xref> to which a secondary water supplier is <ln numlevel="1" lineno="345" slineno="1-317"/>subject.</subsection><subsection ssid="1-null-168" dnum="v-o" numlevel="1" lineno="346" slineno="1-318" level="3"><display>(v)</display>The state engineer's issuance and enforcement of a notice of violation is exempt <ln numlevel="1" lineno="347" slineno="1-319"/>from Title 63G, Chapter 4, Administrative Procedures Act.</subsection><subsection ssid="1-null-169" dnum="vi-o" numlevel="1" lineno="348" slineno="1-320" level="3"><display>(vi)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, <ln numlevel="1" lineno="349" slineno="1-321"/>the state engineer shall make rules necessary to enforce a notice of violation, that <ln numlevel="1" lineno="350" slineno="1-322"/>includes:<subsection ssid="1-null-170" dnum="A-o" numlevel="1" lineno="351" slineno="1-323" level="4"><display>(A)</display>provisions consistent with this Subsection <xref refnumber="73-10-34(14)(g)" depth="4">(14)(g)</xref> for enforcement of the <ln numlevel="1" lineno="352" slineno="1-324"/>notice if a secondary water supplier to whom a notice is issued fails to respond <ln numlevel="1" lineno="353" slineno="1-325"/>to the notice or abate the violation;</subsection><subsection ssid="1-null-171" dnum="B-o" numlevel="1" lineno="354" slineno="1-326" level="4"><display>(B)</display>the right to a hearing, upon request by a secondary water supplier against <ln numlevel="1" lineno="355" slineno="1-327"/>whom the notice is issued; and</subsection><subsection ssid="1-null-172" dnum="C-o" numlevel="1" lineno="356" slineno="1-328" level="4"><display>(C)</display>provisions for timely issuance of a final order after the secondary water <ln numlevel="1" lineno="357" slineno="1-329"/>supplier to whom the notice is issued fails to respond to the notice or abate the <ln numlevel="1" lineno="358" slineno="1-330"/>violation, or after a hearing held under Subsection <xref depth="4" refnumber="73-10-34(14)(g)(vi)(b)">(14)(g)(vi)(B)</xref>.</subsection></subsection><subsection ssid="1-null-173" dnum="vii-o" numlevel="1" lineno="359" slineno="1-331" level="3"><display>(vii)</display>A person may not intervene in an enforcement action commenced under this <ln numlevel="1" lineno="360" slineno="1-332"/>Subsection <xref refnumber="73-10-34(14)(g)" depth="4">(14)(g)</xref>.</subsection><subsection ssid="1-null-174" dnum="viii-o" numlevel="1" lineno="361" slineno="1-333" level="3"><display>(viii)</display>After issuance of a final order under rules made pursuant to Subsection <xref depth="4" refnumber="73-10-34(14)(g)(vi)"><ln numlevel="1" lineno="362" slineno="1-334"/>(14)(g)(vi)</xref>, the state engineer shall serve a copy of the final order on the <ln numlevel="1" lineno="363" slineno="1-335"/>secondary water supplier against whom the order is issued by:<subsection ssid="1-null-175" dnum="A-o" numlevel="1" lineno="364" slineno="1-336" level="4"><display>(A)</display>personal service under Utah Rules of Civil Procedure, Rule 5; or</subsection><subsection ssid="1-null-176" dnum="B-o" numlevel="1" lineno="365" slineno="1-337" level="4"><display>(B)</display>certified mail.</subsection></subsection><subsection ssid="1-null-177" dnum="ix-o" numlevel="1" lineno="366" slineno="1-338" level="3"><display>(ix)</display>The state engineer's final order may be reviewed by trial de novo by a court with <ln numlevel="1" lineno="367" slineno="1-339"/>jurisdiction in Salt Lake County or the county where the violation occurred.</subsection><subsection ssid="1-null-178" dnum="x-o" numlevel="1" lineno="368" slineno="1-340" level="3"><display>(x)</display>A secondary water supplier shall file a petition for judicial review of the state <ln numlevel="1" lineno="369" slineno="1-341"/>engineer's final order issued under this Subsection <xref refnumber="73-10-34(14)(g)" depth="4">(14)(g)</xref> within 20 days from the <ln numlevel="1" lineno="370" slineno="1-342"/>day on which the final order was served on the secondary water supplier.</subsection><subsection ssid="1-null-179" dnum="xi-o" numlevel="1" lineno="371" slineno="1-343" level="3"><display>(xi)</display>The state engineer may bring suit in a court to enforce a final order issued under <ln numlevel="1" lineno="372" slineno="1-344"/>this Subsection <xref depth="4" refnumber="73-10-34(14)(g)">(14)(g)</xref>.</subsection><subsection ssid="1-null-180" dnum="xii-o" numlevel="1" lineno="373" slineno="1-345" level="3"><display>(xii)</display>If the state engineer prevails in an action brought under Subsection <xref depth="4" refnumber="73-10-34(14)(g)(x)">(14)(g)(x)</xref> or <xref depth="4" refnumber="73-10-34(xi)"><ln numlevel="1" lineno="374" slineno="1-346"/>(xi)</xref>, the state may recover court costs and reasonable attorney fees.</subsection><subsection ssid="1-null-181" dnum="xiii-o" numlevel="1" lineno="375" slineno="1-347" level="3"><display>(xiii)</display>The administrative fine imposed under this section shall be an amount not to <ln numlevel="1" lineno="376" slineno="1-348"/>exceed the sum of any money received by the secondary water supplier under this <ln numlevel="1" lineno="377" slineno="1-349"/>section or Section <xref depth="3" refnumber="73-10-34.5">73-10-34.5</xref> to fund costs related to metering.</subsection><subsection ssid="1-null-182" dnum="xiv-o" numlevel="1" lineno="378" slineno="1-350" level="3"><display>(xiv)</display>Money collected under this Subsection <xref depth="4" refnumber="73-10-34(14)">(14)</xref> shall be deposited into the Water <ln numlevel="1" lineno="379" slineno="1-351"/>Resources Conservation and Development Fund, created in Section <xref depth="3" refnumber="73-10-24">73-10-24</xref>.</subsection></subsection></subsection><subsection ssid="1-183" dnum="_-o:15-i" numlevel="1" lineno="380" slineno="1-352" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1182" style="1" owner="i" level="1" amendtag="start">(15)</amend></display><subsection ssid="1-184" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1183" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">The Legislature finds that requiring a secondary water supplier to modify a <ln numlevel="1" lineno="381" slineno="1-353"/>contract to allow for compliance with metering and usage-based billing requirements <ln numlevel="1" lineno="382" slineno="1-354"/>under this chapter is in the public interest and reasonably necessary to achieve the <ln numlevel="1" lineno="383" slineno="1-355"/>needed public purpose of demand reduction for water use by sending appropriate <ln numlevel="1" lineno="384" slineno="1-356"/>price signals regarding water use.</amend></subsection><subsection ssid="1-185" dnum="_-o:b-i" numlevel="1" lineno="385" slineno="1-357" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1184" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="13" style="1" owner="ahaskell" level="1" amendtag="end">To the extent necessary to comply with the usage-based billing requirements under <ln numlevel="1" lineno="386" slineno="1-358"/>this chapter, a secondary water supplier shall use best efforts to comply with <ln numlevel="1" lineno="387" slineno="1-359"/>metering and usage-based billing requirements under this section by modifying a <ln numlevel="1" lineno="388" slineno="1-360"/>contract that:</amend><subsection ssid="1-186" dnum="_-o:i-i" numlevel="1" lineno="389" slineno="1-361" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1185" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="17" style="1" owner="ahaskell" level="1" amendtag="end">existed before July 1, 2025; and</amend></subsection><subsection ssid="1-187" dnum="_-o:ii-i" numlevel="1" lineno="390" slineno="1-362" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1186" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="21" style="1" owner="ahaskell" level="1" amendtag="end">does not comply with metering and usage-based billing requirements under this <ln numlevel="1" lineno="391" slineno="1-363"/>chapter.</amend></subsection></subsection><subsection ssid="1-188" dnum="_-o:c-i" numlevel="1" lineno="392" slineno="1-364" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1187" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="25" style="1" owner="ahaskell" level="1" amendtag="end">Upon modification of a contract described in Subsection <xref depth="4" refnumber="73-10-34(15)(b)">(15)(b)</xref>, a secondary water <ln numlevel="1" lineno="393" slineno="1-365"/>supplier:</amend><subsection ssid="1-189" dnum="_-o:i-i" numlevel="1" lineno="394" slineno="1-366" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1188" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="29" style="1" owner="ahaskell" level="1" amendtag="end">shall execute contract terms that:</amend><subsection ssid="1-190" dnum="_-o:A-i" numlevel="1" lineno="395" slineno="1-367" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="33" style="1" owner="ahaskell" level="1" amendtag="end">authorize metering and volumetric billing; and</amend></subsection><subsection ssid="1-191" dnum="_-o:B-i" numlevel="1" lineno="396" slineno="1-368" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="37" style="1" owner="ahaskell" level="1" amendtag="end">apply a secondary water rate, which includes a tiered conservation rate set in <ln numlevel="1" lineno="397" slineno="1-369"/>accordance with Subsection <xref depth="4" refnumber="73-10-34(14)">(14)</xref>; and</amend></subsection></subsection><subsection ssid="1-192" dnum="_-o:ii-i" numlevel="1" lineno="398" slineno="1-370" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1191" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="41" style="1" owner="ahaskell" level="1" amendtag="end">may execute contract terms that:</amend><subsection ssid="1-193" dnum="_-o:A-i" numlevel="1" lineno="399" slineno="1-371" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1192" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="45" style="1" owner="ahaskell" level="1" amendtag="end">bind a real property owner to delivery obligations; and</amend></subsection><subsection ssid="1-194" dnum="_-o:B-i" numlevel="1" lineno="400" slineno="1-372" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1193" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="49" style="1" owner="ahaskell" level="1" amendtag="end">mandate a subsequent real property owner to execute a successor contract <ln numlevel="1" lineno="401" slineno="1-373"/>upon transfer of the real property.</amend></subsection></subsection></subsection><subsection ssid="1-195" dnum="_-o:d-i" numlevel="1" lineno="402" slineno="1-374" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1194" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="53" style="1" owner="ahaskell" level="1" amendtag="end">A covenant ensuring compliance with this Subsection <xref depth="4" refnumber="73-10-34(15)">(15)</xref> runs with the real <ln numlevel="1" lineno="403" slineno="1-375"/>property and is enforceable against a successor in interest.</amend></subsection></subsection><subsection ssid="1-196" dnum="_-o:16-i" numlevel="1" amendtag="end">the name of the grantor;</amend></subsection><subsection ssid="1-209" dnum="_-o:iii-i" numlevel="1" lineno="408" slineno="1-380" ea="amend" anum="0" owner="ahaskell" style="1" level="3" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1200" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="131" groupid="105" style="1" owner="ahaskell" level="1" amendtag="end">the recording date.</amend></subsection></subsection><subsection ssid="1-211" dnum="_-o:b-i" numlevel="1" lineno="410" slineno="1-382" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1201" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="136" groupid="109" style="1" owner="ahaskell" level="1" amendtag="end">A secondary water supplier may register with the county recorder of the county in <ln numlevel="1" lineno="411" slineno="1-383"/>which the secondary water supplier's service area is located to receive a property <ln numlevel="1" lineno="412" slineno="1-384"/>transfer report.</amend></subsection><subsection ssid="1-212" dnum="_-o:c-i" numlevel="1" lineno="413" slineno="1-385" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1202" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="141" groupid="113" style="1" owner="ahaskell" level="1" amendtag="end">To register under Subsection <xref depth="4" refnumber="73-10-34(16)(b)">(16)(b)</xref>, the secondary water supplier shall request <ln numlevel="1" lineno="414" slineno="1-386"/>receipt of a property transfer report in writing to the county recorder.</amend></subsection><subsection ssid="1-218" dnum="_-o:d-i" numlevel="1" lineno="415" slineno="1-387" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1203" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="170" groupid="136" style="1" owner="ahaskell" level="1" amendtag="end">Upon receiving a valid registration under Subsection <xref depth="4" refnumber="73-10-34(16)(c)">(16)(c)</xref>, the county recorder <ln numlevel="1" lineno="416" slineno="1-388"/>shall, on at least a monthly basis, automatically transmit a property transfer report to <ln numlevel="1" lineno="417" slineno="1-389"/>the registered secondary water supplier.</amend></subsection><subsection ssid="1-217" dnum="_-o:e-i" numlevel="1" lineno="418" slineno="1-390" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1204" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="167" groupid="134" style="1" owner="ahaskell" level="1" amendtag="end">The county recorder shall provide the property transfer report until a secondary water <ln numlevel="1" lineno="419" slineno="1-391"/>supplier submits in writing to the county recorder a request that transmission of the <ln numlevel="1" lineno="420" slineno="1-392"/>property transfer report be discontinued.</amend></subsection><subsection ssid="1-215" dnum="_-o:f-i" numlevel="1" lineno="421" slineno="1-393" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1205" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="156" groupid="125" style="1" owner="ahaskell" level="1" amendtag="end">The county recorder shall limit a property transfer report to a property transfer or <ln numlevel="1" lineno="422" slineno="1-394"/>parcel identification adjustment that occurred within the secondary water supplier's <ln numlevel="1" lineno="423" slineno="1-395"/>designated service area during the preceding reporting period.</amend></subsection><subsection ssid="1-216" dnum="_-o:g-i" numlevel="1" lineno="424" slineno="1-396" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1206" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="161" groupid="129" style="1" owner="ahaskell" level="1" amendtag="end">A county recorder may charge a reasonable administrative fee to a secondary water <ln numlevel="1" lineno="425" slineno="1-397"/>supplier to cover the actual costs of creating and transmitting a property transfer <ln numlevel="1" lineno="426" slineno="1-398"/>report.</amend></subsection></subsection></section></bsec><bsec buid="56" num="73-10g-801" type="enact" src="code" uid="C73-10g-S801_2026050620260506" sort="73 10g08010020260506" numlevel="1" lineno="427" slineno="2-1" sn="2"><section numlevel="1" lineno="429" slineno="2-3" number="73-10g-801" type="enact"><secline lineno="427">Section 2. Local Investment Requirement</headpart><catline lineno="429"><bold>73-10g-801<parens/>. and</amend></subsection><subsection ssid="56-38" dnum="_-o:c-i" numlevel="1" lineno="434" slineno="2-8" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1210" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="75" style="1" owner="ahaskell" level="1" amendtag="end">is determined by the state council for a public water system or wastewater service <ln numlevel="1" lineno="435" slineno="2-9"/>provider in accordance with Section <xref depth="3" refnumber="73-10g-802">73-10g-802</xref>.</amend></subsection></subsection><subsection ssid="56-23-23" dnum="_-o:2-i" numlevel="1" lineno="436" slineno="2-10" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1211" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="ahaskell" level="1" amendtag="end">"Public water system" means the same as that term is defined in Section <xref depth="3" refnumber="19-4-102">19-4-102</xref>.</amend></subsection><subsection ssid="56-23-26" dnum="_-o:3-i" numlevel="1" lineno="437" slineno="2-11" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1212" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="36" style="1" owner="ahaskell" level="1" amendtag="end">"State council" means the Water Development Coordinating Council created in Sections <xref depth="3" refnumber="73-10c-3"><ln numlevel="1" lineno="438" slineno="2-12"/>73-10c-3</xref> and <xref depth="3" refnumber="79-2-201">79-2-201</xref>.</amend></subsection><subsection ssid="56-36" dnum="_-o:4-i" numlevel="1" lineno="439" slineno="2-13" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1213" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="67" style="1" owner="ahaskell" level="1" amendtag="end">"State money" means money distributed or administered by the state, including federal <ln numlevel="1" lineno="440" slineno="2-14"/>grant or money revolved or generated by a program described in Section <xref depth="3" refnumber="73-10c-5">73-10c-5</xref>.</amend></subsection><subsection ssid="56-31" dnum="_-o:5-i" numlevel="1" lineno="441" slineno="2-15" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="56-32" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1215" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="54" groupid="52" style="1" owner="ahaskell" level="1" amendtag="end">"Wastewater service provider," except as provided in Subsection <xref depth="4" refnumber="73-10g-801(5)(b)">(5)(b)</xref>, means the <ln numlevel="1" lineno="442" slineno="2-16"/>same as that term is defined in Section <xref depth="3" refnumber="19-5-201">19-5-201</xref>.</amend></subsection><subsection ssid="56-33" dnum="_-o:b-i" numlevel="1" lineno="443" slineno="2-17" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="55" style="1" owner="ahaskell" level="1" amendtag="end">"Wastewater service provider" does not include a regional wastewater service <ln numlevel="1" lineno="444" slineno="2-18"/>provider that provides treatment and service to multiple municipalities.</amend></subsection></subsection></section></bsec><bsec buid="58" num="73-10g-802" type="enact" src="code" uid="C73-10g-S802_2026050620260506" sort="73 10g08020020260506" numlevel="1" lineno="445" slineno="3-1" sn="3"><section numlevel="1" lineno="446" slineno="3-2" number="73-10g-802" type="enact"><secline lineno="445">Section 3. Local investment requirement to receive state money.</bold></catline><subsection ssid="58-25-38" dnum="_-o:1-i" numlevel="1" lineno="447" slineno="3-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn" space="false"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><subsection ssid="58-60" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1218" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="127" groupid="96" style="1" owner="ahaskell" level="1" amendtag="end">On and after January 1, 2027, to qualify for receipt of state money for water <ln numlevel="1" lineno="448" slineno="3-4"/>infrastructure or water development, a public water system that delivers retail water <ln numlevel="1" lineno="449" slineno="3-5"/>shall establish that as of the day on which the public water system receives the state <ln numlevel="1" lineno="450" slineno="3-6"/>money the public water system:</amend><subsection ssid="58-76" dnum="_-o:i-i" numlevel="1" lineno="451" slineno="3-7" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1219" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="193" groupid="148" style="1" owner="ahaskell" level="1" amendtag="end">collects for connections to which the public water system delivers retail water an <ln numlevel="1" lineno="452" slineno="3-8"/>amount that equals or exceeds the local investment requirement; or</amend></subsection><subsection ssid="58-77" dnum="_-o:ii-i" numlevel="1" lineno="453" slineno="3-9" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1220" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="198" groupid="152" style="1" owner="ahaskell" level="1" amendtag="end">has a plan, acceptable to the agency distributing or administering the state money, <ln numlevel="1" lineno="454" slineno="3-10"/>to collect beginning in two years from receipt of the state money for connections <ln numlevel="1" lineno="455" slineno="3-11"/>to which the public water system delivers retail w<marker pairid="397">ater</marker><marker pairid="398">,</marker> an amount that equals or <ln numlevel="1" lineno="456" slineno="3-12"/>exceeds the local investment requirement.</amend></subsection></subsection><subsection ssid="58-25-39" dnum="_-o:b-i" numlevel="1" lineno="457" slineno="3-13" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1221" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="18" style="1" owner="ahaskell" level="1" amendtag="end">The state council shall by no later than July 1, 2026, determine for each public water <ln numlevel="1" lineno="458" slineno="3-14"/>system that delivers retail water a local investment requirement that is calculated by:</amend><subsection ssid="58-51" dnum="_-o:i-i" numlevel="1" lineno="459" slineno="3-15" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1222" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="89" groupid="67" style="1" owner="ahaskell" level="1" amendtag="end">determining the median adjusted gross income for the service area within which <ln numlevel="1" lineno="460" slineno="3-16"/>the public water system provides retail services;</amend></subsection><subsection ssid="58-52" dnum="_-o:ii-i" numlevel="1" lineno="461" slineno="3-17" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1223" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="71" style="1" owner="ahaskell" level="1" amendtag="end">multiplying the number determined under Subsection <xref depth="4" refnumber="73-10g-802(1)(b)(i)">(1)(b)(i)</xref> by:</amend><subsection ssid="58-53" dnum="_-o:A-i" numlevel="1" lineno="462" slineno="3-18" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1224" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="99" groupid="75" style="1" owner="ahaskell" level="1" amendtag="end">1.5% if the public water system bills a retail customer for drinking water <ln numlevel="1" lineno="463" slineno="3-19"/>independent of services provided by a wastewater service provider; or</amend></subsection><subsection ssid="58-54" dnum="_-o:B-i" numlevel="1" lineno="464" slineno="3-20" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1225" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="104" groupid="79" style="1" owner="ahaskell" level="1" amendtag="end">3% if the public water system bills a retail customer for both drinking water <ln numlevel="1" lineno="465" slineno="3-21"/>and services provided by a wastewater service provider; and</amend></subsection></subsection><subsection ssid="58-66" dnum="_-o:iii-i" numlevel="1" lineno="466" slineno="3-22" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1226" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="117" style="1" owner="ahaskell" level="1" amendtag="end">multiplying the number determined under Subsection <xref depth="4" refnumber="73-10g-802(1)(b)(ii)">(1)(b)(ii)</xref> by the number of <ln numlevel="1" lineno="467" slineno="3-23"/>connections to which the public water system provides retail water.</amend></subsection></subsection><subsection ssid="58-88" dnum="_-o:c-i" numlevel="1" lineno="468" slineno="3-24" ea="amend" anum="0" owner="ahaskell" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1227" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><subsection ssid="58-102" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1228" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="320" groupid="247" style="1" owner="ahaskell" level="1" amendtag="end">The local investment requirement for a public water system, to the extent that <ln numlevel="1" lineno="469" slineno="3-25"/>the local investment requirement is collected through water rates, is subject to <ln numlevel="1" lineno="470" slineno="3-26"/>applicable requirements set forth in Sections <xref depth="3" refnumber="10-8-22">10-8-22</xref> and <xref depth="3" refnumber="73-10-32.5">73-10-32.5</xref> and <ln numlevel="1" lineno="471" slineno="3-27"/>generally accepted rate setting methods, including methods established by the <ln numlevel="1" lineno="472" slineno="3-28"/>American Water Works Association.</amend></subsection><subsection ssid="58-103" dnum="_-o:ii-i" numlevel="1" lineno="473" slineno="3-29" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1229" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="325" groupid="251" style="1" owner="ahaskell" level="1" amendtag="end">A public water system is not required to set rates for all rate payers at the <ln numlevel="1" lineno="474" slineno="3-30"/>percentages under <marker pairid="395">Subsection</marker> (1)(b)(ii)(A) or (B).</amend></subsection><subsection ssid="58-104" dnum="_-o:iii-i" numlevel="1" lineno="475" slineno="3-31" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1230" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="330" groupid="255" style="1" owner="ahaskell" level="1" amendtag="end">As part of rate setting to meet the local investment requirement, the public water <ln numlevel="1" lineno="476" slineno="3-32"/>system may consider rate structures that support:</amend><subsection ssid="58-105" dnum="_-o:A-i" numlevel="1" lineno="477" slineno="3-33" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1231" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="335" groupid="259" style="1" owner="ahaskell" level="1" amendtag="end">affordability and low-income assistance;</amend></subsection><subsection ssid="58-106" dnum="_-o:B-i" numlevel="1" lineno="478" slineno="3-34" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1232" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="340" groupid="263" style="1" owner="ahaskell" level="1" amendtag="end">revenue reliability;</amend></subsection><subsection ssid="58-107" dnum="_-o:C-i" numlevel="1" lineno="479" slineno="3-35" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1233" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="345" groupid="267" style="1" owner="ahaskell" level="1" amendtag="end">water demand reduction;</amend></subsection><subsection ssid="58-108" dnum="_-o:D-i" numlevel="1" lineno="480" slineno="3-36" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1234" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="350" groupid="271" style="1" owner="ahaskell" level="1" amendtag="end">fairness and equity across customer classifications; and</amend></subsection><subsection ssid="58-109" dnum="_-o:E-i" numlevel="1" lineno="481" slineno="3-37" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1235" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="355" groupid="275" style="1" owner="ahaskell" level="1" amendtag="end">system specific priorities.</amend></subsection></subsection></subsection></subsection><subsection ssid="58-55" dnum="_-o:2-i" numlevel="1" lineno="482" slineno="3-38" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1236" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="58-65" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1237" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="112" style="1" owner="ahaskell" level="1" amendtag="end">On and after January 1, 2027, to qualify for receipt of state money for water <ln numlevel="1" lineno="483" slineno="3-39"/>infrastructure or water development, a wastewater service provider shall establish <ln numlevel="1" lineno="484" slineno="3-40"/>that as of the day on which the wastewater service provider receives the state money <ln numlevel="1" lineno="485" slineno="3-41"/>the wastewater service provider:</amend><subsection ssid="58-78" dnum="_-o:i-i" numlevel="1" lineno="486" slineno="3-42" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1238" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="203" groupid="156" style="1" owner="ahaskell" level="1" amendtag="end">collects, either directly or through a public water system, an amount that equals or <ln numlevel="1" lineno="487" slineno="3-43"/>exceeds the local investment requirement; or</amend></subsection><subsection ssid="58-79" dnum="_-o:ii-i" numlevel="1" lineno="488" slineno="3-44" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1239" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="208" groupid="160" style="1" owner="ahaskell" level="1" amendtag="end">has a plan, acceptable to the agency distributing or administering the state money, <ln numlevel="1" lineno="489" slineno="3-45"/>to collect, either directly or through a public water system, beginning in two years <ln numlevel="1" lineno="490" slineno="3-46"/>from receipt of the state money an amount that equals or exceeds the local <ln numlevel="1" lineno="491" slineno="3-47"/>investment requirement.</amend></subsection></subsection><subsection ssid="58-64" dnum="_-o:b-i" numlevel="1" lineno="492" slineno="3-48" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1240" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="145" groupid="110" style="1" owner="ahaskell" level="1" amendtag="end">The state council shall by no later than July 1, 2026, determine for each wastewater <ln numlevel="1" lineno="493" slineno="3-49"/>service provider a local investment requirement that is calculated by:</amend><subsection ssid="58-56" dnum="_-o:i-i" numlevel="1" lineno="494" slineno="3-50" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1241" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="85" style="1" owner="ahaskell" level="1" amendtag="end">determining the median adjusted gross income for the service area within which <ln numlevel="1" lineno="495" slineno="3-51"/>the wastewater service provider provides services;</amend></subsection><subsection ssid="58-57" dnum="_-o:ii-i" numlevel="1" lineno="496" slineno="3-52" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1242" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="114" groupid="87" style="1" owner="ahaskell" level="1" amendtag="end">multiplying the number determined under Subsection <xref depth="4" refnumber="73-10g-802(2)(b)(i)">(2)(b)(i)</xref> by:</amend><subsection ssid="58-58" dnum="_-o:A-i" numlevel="1" lineno="497" slineno="3-53" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1243" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="89" style="1" owner="ahaskell" level="1" amendtag="end">1.5% if the wastewater service provider bills customers independent of a <ln numlevel="1" lineno="498" slineno="3-54"/>public water system; and</amend></subsection><subsection ssid="58-59" dnum="_-o:B-i" numlevel="1" lineno="499" slineno="3-55" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1244" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="91" style="1" owner="ahaskell" level="1" amendtag="end">3% if the wastewater service provider bills through a public water system that <ln numlevel="1" lineno="500" slineno="3-56"/>bills for drinking water and services provided by a wastewater service <ln numlevel="1" lineno="501" slineno="3-57"/>provider; and</amend></subsection></subsection><subsection ssid="58-67" dnum="_-o:iii-i" numlevel="1" lineno="502" slineno="3-58" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1245" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="159" groupid="121" style="1" owner="ahaskell" level="1" amendtag="end">multiplying the number determined under Subsection <xref depth="4" refnumber="73-10g-802(2)(b)(ii)">(2)(b)(ii)</xref> by the number of <ln numlevel="1" lineno="503" slineno="3-59"/>connections of the wastewater service provider.</amend></subsection></subsection><subsection ssid="58-93" dnum="_-o:c-i" numlevel="1" lineno="504" slineno="3-60" ea="amend" anum="0" owner="ahaskell" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1246" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><subsection ssid="58-110" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1247" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="359" groupid="278" style="1" owner="ahaskell" level="1" amendtag="end">The local investment requirement for a wastewater service provider, to the <ln numlevel="1" lineno="505" slineno="3-61"/>extent that the local investment requirement is collected through sewer rates, is <ln numlevel="1" lineno="506" slineno="3-62"/>subject to generally accepted rate setting methods, including methods established <ln numlevel="1" lineno="507" slineno="3-63"/>by the American Water Works Association and the Water Environment Federation.</amend></subsection><subsection ssid="58-111" dnum="_-o:ii-i" numlevel="1" lineno="508" slineno="3-64" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1248" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="364" groupid="282" style="1" owner="ahaskell" level="1" amendtag="end">A wastewater service provider is not required to set rates for all rate payers at the <ln numlevel="1" lineno="509" slineno="3-65"/>percentages under <marker pairid="396">Subsection </marker>(2)(b)(ii)(A) or (B).</amend></subsection><subsection ssid="58-112" dnum="_-o:iii-i" numlevel="1" lineno="510" slineno="3-66" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1249" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="369" groupid="286" style="1" owner="ahaskell" level="1" amendtag="end">As part of rate setting to meet the local investment requirement, the wastewater <ln numlevel="1" lineno="511" slineno="3-67"/>service provider may consider rate structures that support:</amend><subsection ssid="58-113" dnum="_-o:A-i" numlevel="1" lineno="512" slineno="3-68" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1250" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="374" groupid="290" style="1" owner="ahaskell" level="1" amendtag="end">affordability and low-income assistance;</amend></subsection><subsection ssid="58-114" dnum="_-o:B-i" numlevel="1" lineno="513" slineno="3-69" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1251" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="379" groupid="294" style="1" owner="ahaskell" level="1" amendtag="end">revenue reliability;</amend></subsection><subsection ssid="58-115" dnum="_-o:C-i" numlevel="1" lineno="514" slineno="3-70" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1252" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="384" groupid="298" style="1" owner="ahaskell" level="1" amendtag="end">waste volume and strength;</amend></subsection><subsection ssid="58-116" dnum="_-o:D-i" numlevel="1" lineno="515" slineno="3-71" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1253" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="389" groupid="302" style="1" owner="ahaskell" level="1" amendtag="end">fairness and equity across customer classifications; and</amend></subsection><subsection ssid="58-117" dnum="_-o:E-i" numlevel="1" lineno="516" slineno="3-72" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1254" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="394" groupid="306" style="1" owner="ahaskell" level="1" amendtag="end">system specific priorities.</amend></subsection></subsection></subsection></subsection><subsection ssid="58-73" dnum="_-o:3-i" numlevel="1" lineno="517" slineno="3-73" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1255" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="58-74" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1256" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="182" groupid="139" style="1" owner="ahaskell" level="1" amendtag="end">A public water system or wastewater service provider may meet the required local <ln numlevel="1" lineno="518" slineno="3-74"/>investment requirement through the aggregate of revenue resources that exist before <ln numlevel="1" lineno="519" slineno="3-75"/>May 6, 2026, and new revenue resources imposed on or after May 6, 2026.</amend></subsection><subsection ssid="58-75" dnum="_-o:b-i" numlevel="1" lineno="520" slineno="3-76" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1257" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="188" groupid="144" style="1" owner="ahaskell" level="1" amendtag="end">A public water system or wastewater service provider may expend money collected <ln numlevel="1" lineno="521" slineno="3-77"/>as the local investment requirement in the manner allowed by law other than this <ln numlevel="1" lineno="522" slineno="3-78"/>section. Amounts collected under the local investment requirement belong to the <ln numlevel="1" lineno="523" slineno="3-79"/>public water system or wastewater service provider.</amend></subsection></subsection><subsection ssid="58-25-46" dnum="_-o:4-i" numlevel="1" lineno="524" slineno="3-80" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1258" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="22" style="1" owner="ahaskell" level="1" amendtag="end">At least every five years the state council shall:</amend><subsection ssid="58-68" dnum="_-o:a-i" numlevel="1" lineno="525" slineno="3-81" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1259" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="164" groupid="125" style="1" owner="ahaskell" level="1" amendtag="end">update the local investment requirement for a public water system that delivers retail <ln numlevel="1" lineno="526" slineno="3-82"/>water or wastewater service provider; and</amend></subsection><subsection ssid="58-69" dnum="_-o:b-i" numlevel="1" lineno="527" slineno="3-83" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1260" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="169" groupid="129" style="1" owner="ahaskell" level="1" amendtag="end">recommend to the Natural Resources, Agriculture, and Environment Interim <ln numlevel="1" lineno="528" slineno="3-84"/>Committee whether the Legislature should adjust the multiplier under Subsection <xref depth="4" refnumber="73-10g-802(1)(b)(ii)"><ln numlevel="1" lineno="529" slineno="3-85"/>(1)(b)(ii)</xref> or <xref depth="4" refnumber="73-10g-802(2)(b)(ii)">(2)(b)(ii)</xref> to reflect the financial capability of a household to pay <ln numlevel="1" lineno="530" slineno="3-86"/>expenses for drinking water or services of a wastewater service provider, inclusive of <ln numlevel="1" lineno="531" slineno="3-87"/>applicable property taxes, without undue hardship.</amend></subsection></subsection><subsection ssid="58-25-47" dnum="_-o:5-i" numlevel="1" lineno="532" slineno="3-88" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1261" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="51" style="1" owner="ahaskell" level="1" amendtag="end">The state council may make rules, in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="533" slineno="3-89"/>Administrative Rulemaking Act, to establish procedures for calculating a local <ln numlevel="1" lineno="534" slineno="3-90"/>investment requirement.</amend></subsection><subsection ssid="58-80" dnum="_-o:6-i" numlevel="1" lineno="535" slineno="3-91" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1262" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="213" groupid="164" style="1" owner="ahaskell" level="1" amendtag="end">This section does not prevent any of the following boards from requiring an applicant to <ln numlevel="1" lineno="536" slineno="3-92"/>meet a rate standard or revenue requirement in addition to the local investment <ln numlevel="1" lineno="537" slineno="3-93"/>requirement to obtain a loan or grant issued by the board:</amend><subsection ssid="58-81" dnum="_-o:a-i" numlevel="1" lineno="538" slineno="3-94" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1263" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="218" groupid="168" style="1" owner="ahaskell" level="1" amendtag="end">the Drinking Water Board, appointed under Section <xref depth="3" refnumber="19-4-103">19-4-103</xref>;</amend></subsection><subsection ssid="58-82" dnum="_-o:b-i" numlevel="1" lineno="539" slineno="3-95" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1264" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="223" groupid="172" style="1" owner="ahaskell" level="1" amendtag="end">the Water Quality Board, appointed under Section <xref depth="3" refnumber="19-5-103">19-5-103</xref>; or</amend></subsection><subsection ssid="58-83" dnum="_-o:c-i" numlevel="1" lineno="540" slineno="3-96" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1265" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="228" groupid="176" style="1" owner="ahaskell" level="1" amendtag="end">the Board of Water Resources, created in Section <xref depth="3" refnumber="73-10-1.5">73-10-1.5</xref>.</amend></subsection></subsection><subsection ssid="58-84" dnum="_-o:7-i" numlevel="1" lineno="541" slineno="3-97" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1266" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="232" groupid="179" style="1" owner="ahaskell" level="1" amendtag="end">Notwithstanding the other provisions of this section, a public water system or <ln numlevel="1" lineno="542" slineno="3-98"/>wastewater service provider is exempt from the requirements of this section if the public <ln numlevel="1" lineno="543" slineno="3-99"/>water system or wastewater service provider:</amend><subsection ssid="58-87" dnum="_-o:a-i" numlevel="1" lineno="544" slineno="3-100" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1267" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="247" groupid="189" style="1" owner="ahaskell" level="1" amendtag="end">serves a population of 3,300 or fewer; and</amend></subsection><subsection ssid="58-86" dnum="_-o:b-i" numlevel="1" lineno="545" slineno="3-101" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1268" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="249" groupid="191" style="1" owner="ahaskell" level="1" amendtag="end">establishes to the satisfaction of the agency distributing or administering the state <ln numlevel="1" lineno="546" slineno="3-102"/>money that meeting the local investment requirement would impose an undue <ln numlevel="1" lineno="547" slineno="3-103"/>hardship on the public water system or wastewater service provider or the public <ln numlevel="1" lineno="548" slineno="3-104"/>water system's or wastewater service provider's customers.</amend></subsection></subsection></section></bsec><bsec buid="69" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="549" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="549">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="550"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-24-26 10:12 AM</tm></rev></foot></leg>
