Cullimore</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill modifies the process to incorporate as a preliminary municipality.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">defines terms and modifies definitions;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">requires an applicant to engage in good faith coordination with a county for 18 months <ln numlevel="1" lineno="10" slineno="0-10"/>before the applicant may file a feasibility request as part of an application to incorporate <ln numlevel="1" lineno="11" slineno="0-11"/>an area as a preliminary municipality;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">modifies the process for a person to apply to incorporate an area as a preliminary <ln numlevel="1" lineno="13" slineno="0-13"/>municipality by requiring a feasibility consultant to consider information the county <ln numlevel="1" lineno="14" slineno="0-14"/>provides to the feasibility consultant;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">authorizes a sponsor and a county to submit data, information, and analysis to the <ln numlevel="1" lineno="16" slineno="0-16"/>feasibility consultant;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">requires the feasibility consultant to rely on data, information, and analysis that is <ln numlevel="1" lineno="18" slineno="0-18"/>objective, reliable, and grounded in area-specific information from the preceding 10 <ln numlevel="1" lineno="19" slineno="0-19"/>years, including nearby areas;</hl><hl numlevel="1" lineno="20" slineno="0-20" level="1">modifies the requirements to file a petition for incorporation of a preliminary <ln numlevel="1" lineno="21" slineno="0-21"/>municipality, including:<hl numlevel="1" lineno="22" slineno="0-22" level="2">modifying the requirements for a bond, cash deposit, or letter of credit;</hl><hl numlevel="1" lineno="23" slineno="0-23" level="2">requiring a property owner to include an executed improvement warranty; and</hl><hl numlevel="1" lineno="24" slineno="0-24" level="2">requiring a certification that the preliminary municipality will be developed in <ln numlevel="1" lineno="25" slineno="0-25"/>accordance with the description in the certified feasibility request; and</hl><marker pairid="0"/><marker level="1"><display>(1)</display>"Affordable housing" means housing occupied or reserved for occupancy by households <ln numlevel="1" lineno="60" slineno="1-5"/>with a gross household income equal to or less than 80% of the median gross income of <ln numlevel="1" lineno="61" slineno="1-6"/>the applicable municipal or county statistical area for households of the same size.</subsection><subsection ssid="16-30" dnum="_-o:2-i" numlevel="1" lineno="62" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">"Applicant" means an individual or person who applies to incorporate an area as a <ln numlevel="1" lineno="63" slineno="1-8"/>preliminary municipality by filing a feasibility request.</amend></subsection><subsection ssid="16-null-2" dnum="2-o:3-i" numlevel="1" lineno="64" slineno="1-9" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1002" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>"Board," in relation to a preliminary municipality, means the same as a council <ln numlevel="1" lineno="65" slineno="1-10"/>described in Section <xref depth="3" refnumber="10-3b-402">10-3b-402</xref>.</subsection><subsection ssid="16-null-3" dnum="3-o:4-i" numlevel="1" lineno="66" slineno="1-11" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1003" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>"Board chair," in relation to a preliminary municipality, means the same as a mayor <ln numlevel="1" lineno="67" slineno="1-12"/>described in Section <xref depth="3" refnumber="10-3b-402">10-3b-402</xref>.</subsection><subsection ssid="16-31" dnum="_-o:5-i" numlevel="1" lineno="68" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">"Certified feasibility request" means the document that is certified by the lieutenant <ln numlevel="1" lineno="69" slineno="1-14"/>governor under Section <xref depth="3" refnumber="10-2a-503">10-2a-503</xref>.</amend></subsection><subsection ssid="16-null-4" dnum="4-o:6-i" numlevel="1" lineno="70" slineno="1-15" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1005" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>"Contiguous" means the same as that term is defined in Section <xref depth="3" refnumber="10-2a-102">10-2a-102</xref>.</subsection><subsection ssid="16-null-5" a petition to <ln numlevel="1" lineno="74" slineno="1-19"/>incorporate a preliminary municipality under this part.</subsection></subsection><subsection ssid="16-null-8" dnum="6-o:8-i" numlevel="1" lineno="75" slineno="1-20" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1009" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>"Feasibility request" means a request, described in Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>, for a <ln numlevel="1" lineno="76" slineno="1-21"/>feasibility study for the proposed incorporation of a preliminary municipality.</subsection><subsection ssid="16-28" dnum="_-o:9-i" numlevel="1" lineno="77" slineno="1-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">"Feasibility study" means an analysis of a certified feasibility request, as described in <ln numlevel="1" lineno="78" slineno="1-23"/>Section <xref depth="3" refnumber="10-2a-504">10-2a-504</xref>, conducted by a feasibility consultant.</amend></subsection><subsection ssid="16-32" dnum="_-o:10-i" numlevel="1" lineno="79" slineno="1-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(10)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" style="2"/><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">applicant</amend> filed the feasibility request <ln numlevel="1" lineno="82" slineno="1-27"/>under Section <xref depth="3" refnumber="20A-1-501">20A-1-501</xref>.</subsection><subsection ssid="16-null-10" dnum="8-o:12-i" numlevel="1" lineno="83" slineno="1-28" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1013" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display>"Municipal service" means the same as that term is defined in Section <xref depth="3" refnumber="10-2a-102">10-2a-102</xref>.</subsection><subsection ssid="16-null-11" dnum="9-o:13-i" numlevel="1" lineno="84" slineno="1-29" level="1"><display><amendoutstart style="2"/><amend anum="0" space="true">(13)</amend></display>"Pending annexation area" means an area proposed for annexation in an <ln numlevel="1" lineno="85" slineno="1-30"/>annexation petition described in Section <xref depth="3" refnumber="10-2-806">10-2-806</xref> that is filed before, and is still pending <ln numlevel="1" lineno="86" slineno="1-31"/>when, a person files the applicable request for a feasibility study under Section <xref depth="3" refnumber="10-2a-502"><ln numlevel="1" lineno="87" slineno="1-32"/>10-2a-502</xref>.</subsection><subsection ssid="16-27" dnum="_-o:14-i" numlevel="1" lineno="88" slineno="1-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(14)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">"Population" means the number of individuals who are full-time residents of a defined <ln numlevel="1" lineno="89" slineno="1-34"/>area.</amend></subsection><subsection ssid="16-null-12" dnum="10-o:15-i" numlevel="1" lineno="90" slineno="1-35" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both" space="true">(15)</amend></display>"Primary sponsor contact" means:<subsection ssid="16-null-13" dnum="a-o" numlevel="1" lineno="91" slineno="1-36" level="2"><display>(a)</display>in relation to a feasibility request:<subsection ssid="16-null-14" dnum="i-o" numlevel="1" lineno="92" slineno="1-37" level="3"><display>(i)</display>the individual designated as the primary sponsor contact for a feasibility request <ln numlevel="1" lineno="93" slineno="1-38"/>under Subsection <xref depth="4" refnumber="10-2a-502(5)(c)">10-2a-502(5)(c)</xref>; or</subsection><subsection ssid="16-null-15" dnum="ii-o" numlevel="1" lineno="94" slineno="1-39" level="3"><display>(ii)</display>an individual designated, in writing, by the initial landowners if a replacement <ln numlevel="1" lineno="95" slineno="1-40"/>primary sponsor contact is needed; or</subsection></subsection><subsection ssid="16-null-16" dnum="b-o" numlevel="1" lineno="96" slineno="1-41" level="2"><display>(b)</display>in relation to a petition for incorporation of a preliminary municipality:<subsection ssid="16-null-17" dnum="i-o" numlevel="1" lineno="97" slineno="1-42" level="3"><display>(i)</display>the individual designated as the primary sponsor contact for a petition for <ln numlevel="1" lineno="98" slineno="1-43"/>incorporation of a preliminary municipality under Subsection <xref depth="4" refnumber="10-2a-507(1)(d)">10-2a-507(1)(d)</xref>; or</subsection><subsection ssid="16-null-18" dnum="ii-o" numlevel="1" lineno="99" slineno="1-44" level="3"><display>(ii)</display>an individual designated, in writing, by the initial landowners if a replacement <ln numlevel="1" lineno="100" slineno="1-45"/>primary sponsor contact is needed.</subsection></subsection></subsection><subsection ssid="16-null-19" dnum="11-o:16-i" numlevel="1" lineno="101" slineno="1-46" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="both" space="true">(16)</amend></display>"Private," in relation to real property, means taxable real property.</subsection><subsection ssid="16-null-21" dnum="13-o:18-i" numlevel="1" lineno="104" slineno="1-49" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1025" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="both" space="true">(18)</amend></display>"System infrastructure" means, as shown on the map or plat described in <ln numlevel="1" lineno="105" slineno="1-50"/>Subsection <xref depth="4" refnumber="10-2a-502(5)(e)">10-2a-502(5)(e)</xref> for the proposed preliminary municipal area:<subsection ssid="16-null-22" dnum="a-o" numlevel="1" lineno="106" slineno="1-51" level="2"><display>(a)</display>the main thoroughfares within the proposed preliminary <marker pairid="56"><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="59" groupid="48" style="2" owner="jchristopherson" level="1" deltag="both">municipal</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="58" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">municipality</amend></marker> <ln numlevel="1" lineno="107" slineno="1-52"/>area, including the roads that connect the proposed preliminary municipality area to <ln numlevel="1" lineno="108" slineno="1-53"/>an existing road outside the proposed preliminary municipality area; and</subsection><subsection ssid="16-null-23" dnum="b-o" numlevel="1" lineno="109" slineno="1-54" level="2"><display>(b)</display>the main lines that will connect a utility<amend anum="0" ea="amend" pairid="52" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="both">, including culinary water and wastewater <ln numlevel="1" lineno="110" slineno="1-55"/>treatment services,</amend> to the proposed preliminary municipality area, including the stubs <ln numlevel="1" lineno="111" slineno="1-56"/>that will connect the main lines to the development in the proposed preliminary <ln numlevel="1" lineno="112" slineno="1-57"/>municipality area<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="55" groupid="45" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="53" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="16-38" dnum="_-o:c-i" numlevel="1" lineno="113" slineno="1-58" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">construction of culinary water facilities, wastewater treatment facilities, or both, if no <ln numlevel="1" lineno="114" slineno="1-59"/>services exist that would meet the requirements of the proposed preliminary <ln numlevel="1" lineno="115" slineno="1-60"/>municipality area.</amend></subsection></subsection><subsection ssid="16-29" dnum="_-o:19-i" numlevel="1" lineno="116" slineno="1-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(19)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">"Utah Population Committee" means the committee created in Section <xref depth="3" refnumber="63C-20-103">63C-20-103</xref>.</amend></subsection></section></bsec><bsec buid="2" num="10-2a-502" type="amend" src="code" amendtag="end">has the authority to represent the person; and</amend></subsection><subsection ssid="2-57" dnum="_-o:ii-i" numlevel="1" lineno="127" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">will serve as the point of contact for the application.</amend></subsection></subsection></subsection><subsection ssid="2-null-2" dnum="2-o" numlevel="1" lineno="128" slineno="2-12" level="1"><display>(2)</display>Subject to Subsection <xref depth="4" refnumber="10-2a-502(6)">(6)</xref>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="128" groupid="108" style="2" owner="jchristopherson" level="1" deltag="both">a person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="68" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an applicant</amend> may file a feasibility request in relation <ln numlevel="1" lineno="129" slineno="2-13"/>to an area that the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="119" groupid="101" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="116" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">applicant</amend> seeks to incorporate as a preliminary municipality if:<subsection ssid="2-null-3" dnum="a-o" numlevel="1" lineno="130" slineno="2-14" level="2"><display>(a)</display>the area is contiguous;</subsection><subsection ssid="2-null-4" dnum="b-o" numlevel="1" lineno="131" slineno="2-15" level="2"><display>(b)</display>no part of the area is within a county of the first class or second class;</subsection><subsection ssid="2-null-5" dnum="c-o" numlevel="1" lineno="132" slineno="2-16" level="2"><display>(c)</display>no part of the area is within, or within .25 miles of, a municipality;</subsection><subsection ssid="2-null-6" dnum="d-o" numlevel="1" lineno="133" slineno="2-17" level="2"><display>(d)</display>on the day on which the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="121" groupid="103" style="2" owner="jchristopherson" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="117" groupid="99" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">applicant</amend> files the feasibility request:<subsection ssid="2-null-7" dnum="i-o" numlevel="1" lineno="134" slineno="2-18" level="3"><display>(i)</display>the area is owned by no more than three persons, all of whom consent to <ln numlevel="1" lineno="135" slineno="2-19"/>incorporation as a preliminary municipality; and</subsection><subsection ssid="2-null-8" dnum="ii-o" numlevel="1" lineno="136" slineno="2-20" level="3"><display>(ii)</display>at least 50% of the area is undeveloped;</subsection></subsection><subsection ssid="2-null-9" dnum="e-o" numlevel="1" lineno="137" slineno="2-21" level="2"><display>(e)</display>the persons who sign the feasibility request intend to<amend anum="0" ea="amend" pairid="131" groupid="110" style="1" owner="jchristopherson" level="1" amendtag="both"> and, if the preliminary <ln numlevel="1" lineno="138" slineno="2-22"/>municipality is incorporated, shall</amend> develop the area to the point that:<subsection ssid="2-null-10" dnum="i-o" numlevel="1" lineno="139" slineno="2-23" level="3"><display>(i)</display>at least 100 individuals reside<amend anum="0" ea="amend" pairid="69" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="both"> full-time</amend> in the area;</subsection><subsection ssid="2-null-11" dnum="ii-o" numlevel="1" lineno="140" slineno="2-24" level="3"><display>(ii)</display>the area will have an average population density of no less than seven individuals <ln numlevel="1" lineno="141" slineno="2-25"/>per square mile, unless:<subsection ssid="2-null-12" dnum="A-o" numlevel="1" lineno="142" slineno="2-26" level="4"><display>(A)</display>a population density of less than seven individuals per square mile is <ln numlevel="1" lineno="143" slineno="2-27"/>necessary in order to connect separate areas that share a demonstrable <ln numlevel="1" lineno="144" slineno="2-28"/>community interest; and</subsection><subsection ssid="2-null-13" dnum="B-o" numlevel="1" lineno="145" slineno="2-29" level="4"><display>(B)</display>the average population of the area has a population density of no less than <ln numlevel="1" lineno="146" slineno="2-30"/>seven individuals per square mile if the land necessary to connect the separate <ln numlevel="1" lineno="147" slineno="2-31"/>areas described in Subsection <xref depth="4" refnumber="10-2a-502(2)(e)(ii)(a)">(2)(e)(ii)(A)</xref> is not included in the calculation; <ln numlevel="1" lineno="148" slineno="2-32"/>and</subsection></subsection><subsection ssid="2-null-14" dnum="iii-o" numlevel="1" lineno="149" slineno="2-33" level="3"><display>(iii)</display>at least 10% of the housing in the preliminary municipality is affordable housing;</subsection></subsection><subsection ssid="2-null-15" dnum="f-o" numlevel="1" lineno="150" slineno="2-34" level="2"><display>(f)</display>the area does not include land owned by the United States government unless:<subsection ssid="2-null-16" dnum="i-o" numlevel="1" lineno="151" slineno="2-35" level="3"><display>(i)</display>the area, including the land owned by the United States government, is <ln numlevel="1" lineno="152" slineno="2-36"/>contiguous; and</subsection><subsection ssid="2-null-17" dnum="ii-o" numlevel="1" lineno="153" slineno="2-37" level="3" space="false"><display>(ii)</display><subsection ssid="2-null-18" dnum="A-o" level="4" placement="sameline"><display>(A)</display>incorporating the land is necessary to connect separate areas that share a <ln numlevel="1" lineno="154" slineno="2-38"/>demonstrable community interest; or</subsection><subsection ssid="2-null-19" dnum="B-o" numlevel="1" lineno="155" slineno="2-39" level="4"><display>(B)</display>excluding the land from the area would create an unincorporated island within <ln numlevel="1" lineno="156" slineno="2-40"/>the proposed preliminary municipality;</subsection></subsection></subsection><subsection ssid="2-null-20" dnum="g-o" numlevel="1" lineno="157" slineno="2-41" level="2"><display>(g)</display>the area is entirely within one county; </subsection><subsection ssid="2-52" dnum="_-o:h-i" numlevel="1" lineno="158" slineno="2-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="end">the applicant has complied with Section <xref depth="3" refnumber="10-2a-502.5">10-2a-502.5</xref>; </amend>and</subsection><subsection ssid="2-null-21" dnum="h-o:i-i" numlevel="1" lineno="159" slineno="2-43" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1057" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>the feasibility request complies with Subsection <xref depth="4" refnumber="10-2a-502(3)">(3)</xref>.</subsection></subsection><subsection ssid="2-null-22" dnum="3-o" numlevel="1" lineno="160" slineno="2-44" level="1" space="false"><display>(3)</display><subsection ssid="2-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A proposed preliminary municipality area may not include all or part of a pending <ln numlevel="1" lineno="161" slineno="2-45"/>annexation area, unless:<subsection ssid="2-null-24" dnum="i-o" numlevel="1" lineno="162" slineno="2-46" level="3" tab="1"><display>(i)</display>the portion of the pending annexation area included in the proposed preliminary <ln numlevel="1" lineno="163" slineno="2-47"/>municipality area does not exceed 20% of the proposed preliminary municipality <ln numlevel="1" lineno="164" slineno="2-48"/>area; and</subsection><subsection ssid="2-null-25" dnum="ii-o" numlevel="1" lineno="165" slineno="2-49" level="3" tab="1"><display>(ii)</display>the feasibility request would comply with the requirements of this section <ln numlevel="1" lineno="166" slineno="2-50"/>regardless of whether the portion of the pending annexation area included in the <ln numlevel="1" lineno="167" slineno="2-51"/>proposed preliminary municipality area is excluded from, or remains included in, <ln numlevel="1" lineno="168" slineno="2-52"/>the proposed preliminary municipality area.</subsection></subsection><subsection ssid="2-null-26" dnum="b-o" numlevel="1" lineno="169" slineno="2-53" level="2"><display>(b)</display>A proposed preliminary municipality area may not include all or part of an area that <ln numlevel="1" lineno="170" slineno="2-54"/>is the subject of a completed feasibility study or supplemental feasibility study that <ln numlevel="1" lineno="171" slineno="2-55"/>qualifies to proceed under Subsection <xref depth="4" refnumber="10-2a-205(5)(a)">10-2a-205(5)(a)</xref>, unless<amend anum="0" ea="amend" pairid="149" groupid="124" style="1" owner="jchristopherson" level="1" amendtag="both"> </amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both">:</amend><amendoutend style="2"/><subsection ssid="2-null-27" dnum="i-o:_-i" numlevel="1" lineno="172" slineno="2-56" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1063" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="18" groupid="15" style="2" owner="jchristopherson" level="1" deltag="end">the proposed incorporation that is the subject of the completed feasibility study or <ln numlevel="1" lineno="173" slineno="2-57"/>supplemental feasibility study has been defeated by the voters at an election under <ln numlevel="1" lineno="174" slineno="2-58"/>Section <xref depth="3" refnumber="10-2a-210">10-2a-210</xref>; or</amend><amendoutend style="2"/></subsection><subsection ssid="2-null-28" dnum="ii-o:_-i" numlevel="1" lineno="175" slineno="2-59" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1064" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/></display>the time described in Subsection <xref depth="4" refnumber="10-2a-208(1)">10-2a-208(1)</xref> for filing an incorporation <ln numlevel="1" lineno="176" slineno="2-60"/>petition based on the completed feasibility study or supplemental feasibility study <ln numlevel="1" lineno="177" slineno="2-61"/>has elapsed without the sponsors filing an incorporation petition under Section <xref depth="3" refnumber="10-2a-208"><ln numlevel="1" lineno="178" slineno="2-62"/>10-2a-208</xref>.</subsection></subsection><subsection ssid="2-null-29" dnum="c-o" numlevel="1" lineno="179" slineno="2-63" level="2"><display>(c)</display>A proposed preliminary municipality area may not include all or part of an area that <ln numlevel="1" lineno="180" slineno="2-64"/>is the subject of a completed feasibility study or supplemental feasibility study whose <ln numlevel="1" lineno="181" slineno="2-65"/>results comply with Subsection <xref depth="4" refnumber="10-2a-504(4)">10-2a-504(4)</xref>, unless the time described in Subsection <xref depth="4" refnumber="10-2a-507(1)"><ln numlevel="1" lineno="182" slineno="2-66"/>10-2a-507(1)</xref> for filing a petition for incorporation based on the completed feasibility <ln numlevel="1" lineno="183" slineno="2-67"/>study or supplemental feasibility study has elapsed without the sponsors filing a <ln numlevel="1" lineno="184" slineno="2-68"/>petition for incorporation under Section <xref depth="3" refnumber="10-2a-507">10-2a-507</xref>.</subsection></subsection><subsection ssid="2-null-30" dnum="4-o" numlevel="1" lineno="185" slineno="2-69" level="1"><display>(4)</display>Except as provided in Section <xref depth="3" refnumber="10-2a-505">10-2a-505</xref>, the lieutenant governor shall consider each <ln numlevel="1" lineno="186" slineno="2-70"/>feasibility request that includes an area described in Subsection <xref depth="4" refnumber="10-2a-502(3)(a)">(3)(a)</xref> as if the request <ln numlevel="1" lineno="187" slineno="2-71"/>does not include the area described in Subsection <xref depth="4" refnumber="10-2a-502(3)(a)">(3)(a)</xref>.</subsection><subsection ssid="2-null-31" dnum="5-o" numlevel="1" lineno="188" slineno="2-72" level="1" space="false"><display>(5)</display><subsection ssid="2-65" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="both">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="123" groupid="105" style="2" owner="jchristopherson" level="1" deltag="both">A person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="118" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">An applicant</amend> who files a feasibility request under this section shall file <ln numlevel="1" lineno="189" slineno="2-73"/>the feasibility request with the lieutenant governor, including in the feasibility request:<subsection ssid="2-null-32" dnum="a-o:i-i" numlevel="1" lineno="190" slineno="2-74" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1069" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>the signatures of all owners of real property included in the proposed <ln numlevel="1" lineno="191" slineno="2-75"/>preliminary municipality area, showing that the owners consent to including the <ln numlevel="1" lineno="192" slineno="2-76"/>real property in the proposed preliminary municipality area;</subsection><subsection ssid="2-null-33" dnum="b-o:ii-i" numlevel="1" lineno="193" slineno="2-77" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1070" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>the name, address, and phone number of each owner signing the feasibility <ln numlevel="1" lineno="194" slineno="2-78"/>request;</subsection><subsection individual who signs the feasibility request as the <ln numlevel="1" lineno="196" slineno="2-80"/>primary sponsor contact for the feasibility request;</subsection><subsection ssid="2-null-35" dnum="d-o:iv-i" numlevel="1" lineno="197" slineno="2-81" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1072" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>a description of the proposed preliminary municipality area;</subsection><subsection ssid="2-null-36" dnum="e-o:v-i" numlevel="1" lineno="198" slineno="2-82" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1073" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="both" space="true">(v)</amend></display>an accurate map or plat, prepared by a licensed surveyor, showing:<subsection ssid="2-null-37" dnum="i-o:A-i" numlevel="1" lineno="199" slineno="2-83" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1074" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>a legal description of the boundaries of the proposed preliminary <ln numlevel="1" lineno="200" slineno="2-84"/>municipality area and each phase of the proposed preliminary municipality <ln numlevel="1" lineno="201" slineno="2-85"/>area;</subsection><subsection ssid="2-null-38" dnum="ii-o:B-i" numlevel="1" lineno="202" slineno="2-86" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1075" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>all development planned for the proposed preliminary municipality area;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="112" groupid="94" style="2" owner="jchristopherson" level="1" deltag="both"> <ln numlevel="1" lineno="203" slineno="2-87"/>and</amend><amendoutend style="2"/></subsection><subsection ssid="2-null-39" dnum="iii-o:C-i" numlevel="1" lineno="204" slineno="2-88" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1076" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="both" space="true">(C)</amend></display>that the first phase of the proposed preliminary municipality area is <ln numlevel="1" lineno="205" slineno="2-89"/>projected to have at least 100 <amend anum="0" ea="amend" pairid="73" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="both">full-time </amend>residents when completed; </subsection><subsection ssid="2-62" dnum="_-o:D-i" numlevel="1" lineno="206" slineno="2-90" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="end">that at least 10% of all housing included in the planned development shall <ln numlevel="1" lineno="207" slineno="2-91"/>qualify as affordable housing;</amend></subsection><subsection ssid="2-71" dnum="_-o:E-i" numlevel="1" lineno="208" slineno="2-92" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="174" groupid="145" style="1" owner="jchristopherson" level="1" amendtag="end">that at least 10% of the development qualifies as open space; and</amend></subsection><subsection ssid="2-63" dnum="_-o:F-i" numlevel="1" lineno="209" slineno="2-93" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(F)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">that no more than 30% of all housing included in the planned development <ln numlevel="1" lineno="210" slineno="2-94"/>shall be utilized for short-term rentals;</amend></subsection></subsection><subsection ssid="2-53" dnum="_-o:vi-i" numlevel="1" lineno="211" slineno="2-95" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="156" groupid="130" style="1" owner="jchristopherson" level="1" amendtag="end">an explanation of how the applicant intends to ensure that the requirements of <ln numlevel="1" lineno="212" slineno="2-96"/>Subsections <xref depth="4" refnumber="10-2a-502(5)(a)(v)(d)">(5)(a)(v)(D)</xref> and <xref depth="4" refnumber="10-2a-502(e)">(E)</xref> will be met;</amend></subsection><subsection ssid="2-68" dnum="_-o:vii-i" numlevel="1" lineno="213" slineno="2-97" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="150" groupid="125" style="1" owner="jchristopherson" level="1" amendtag="end">confirmation that the applicant has complied with the requirements of Section <xref depth="3" refnumber="10-2a-502.5"><ln numlevel="1" lineno="214" slineno="2-98"/>10-2a-502.5</xref> before filing; </amend>and</subsection><subsection ssid="2-null-40" dnum="f-o:viii-i" numlevel="1" lineno="215" slineno="2-99" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1082" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="both" space="true">(viii)</amend></display>a request that the lieutenant governor commission a study to determine the <ln numlevel="1" lineno="216" slineno="2-100"/>feasibility of incorporating the area as a preliminary municipality.</subsection></subsection><subsection ssid="2-66" dnum="_-o:b-i" numlevel="1" lineno="217" slineno="2-101" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="122" style="1" owner="jchristopherson" level="1" amendtag="end">An applicant may provide development plans in the alternative in the feasibility <ln numlevel="1" lineno="218" slineno="2-102"/>request by indicating which plan is the primary plan and which plans may be used if <ln numlevel="1" lineno="219" slineno="2-103"/>there are market shifts or other market developments, if each plan meets the <ln numlevel="1" lineno="220" slineno="2-104"/>requirements of Subsection <xref depth="4" refnumber="10-2a-502(5)(a)">(5)(a)</xref>.</amend></subsection><subsection ssid="2-67" dnum="_-o:c-i" numlevel="1" lineno="221" slineno="2-105" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="144" groupid="119" style="1" owner="jchristopherson" level="1" amendtag="end">A feasibility request described in Subsection <xref depth="4" refnumber="10-2a-502(5)(a)">(5)(a)</xref> may not include a material <ln numlevel="1" lineno="222" slineno="2-106"/>change from the proposed development about which the applicant and county <ln numlevel="1" lineno="223" slineno="2-107"/>engaged in good faith coordination, as described in Section <xref depth="3" refnumber="10-2a-502.5">10-2a-502.5</xref>.</amend></subsection></subsection><subsection ssid="2-null-41" dnum="6-o" numlevel="1" lineno="224" slineno="2-108" level="1" space="false"><display>(6)</display><subsection ssid="2-null-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The provisions of this part, providing for the incorporation of a preliminary <ln numlevel="1" lineno="225" slineno="2-109"/>municipality, is a pilot project that ends on January 1, 2031.</subsection><subsection ssid="2-null-43" dnum="b-o" numlevel="1" lineno="226" slineno="2-110" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="10-2a-502(7)">(7)</xref>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="83" groupid="68" style="2" owner="jchristopherson" level="1" deltag="both">a person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="74" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an applicant</amend> may not file a feasibility <ln numlevel="1" lineno="227" slineno="2-111"/>request under this part in a calendar year during which two or more requests have <ln numlevel="1" lineno="228" slineno="2-112"/>already been filed in the state.</subsection></subsection><subsection ssid="2-null-44" dnum="7-o" numlevel="1" lineno="229" slineno="2-113" level="1"><display>(7)</display>A feasibility request does not count towards the limit described in Subsection <xref depth="4" refnumber="10-2a-502(6)(b)">(6)(b)</xref> if:<subsection ssid="2-null-45" dnum="a-o" numlevel="1" lineno="230" slineno="2-114" level="2"><display>(a)</display>the sponsors who file the request withdraw the request;</subsection><subsection ssid="2-null-46" dnum="b-o" numlevel="1" lineno="231" slineno="2-115" level="2"><display>(b)</display>the lieutenant governor rejects the feasibility request under Subsection <xref depth="4" refnumber="10-2a-503(4)">10-2a-503(4)</xref> <ln numlevel="1" lineno="232" slineno="2-116"/>or <xref depth="4" refnumber="10-2a-502(5)(b)">(5)(b)</xref>, and the sponsors:<subsection ssid="2-null-47" dnum="i-o" numlevel="1" lineno="233" slineno="2-117" level="3"><display>(i)</display>do not timely amend the feasibility request under Subsection <xref depth="4" refnumber="10-2a-503(7)(b)">10-2a-503(7)(b)</xref>; or</subsection><subsection ssid="2-null-48" dnum="ii-o" numlevel="1" lineno="234" slineno="2-118" level="3"><display>(ii)</display>are prohibited from amending the feasibility request under Subsection <xref depth="4" refnumber="10-2a-503(7)(c)"><ln numlevel="1" lineno="235" slineno="2-119"/>10-2a-503(7)(c)</xref>; or</subsection></subsection><subsection ssid="2-null-49" dnum="c-o" numlevel="1" lineno="236" slineno="2-120" level="2"><display>(c)</display>the process to incorporate is prohibited from proceeding under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="10-2a-504(7)(a)"><ln numlevel="1" lineno="237" slineno="2-121"/>10-2a-504(5)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">10-2a-504(7)(a)</amend> and the sponsors:<subsection ssid="2-null-50" dnum="i-o" numlevel="1" lineno="238" slineno="2-122" level="3"><display>(i)</display>do not timely file a modified feasibility request under Subsection <xref depth="4" refnumber="10-2a-505(1)(b)(i)"><ln numlevel="1" lineno="239" slineno="2-123"/>10-2a-505(1)(b)(i)</xref>; or</subsection><subsection ssid="2-null-51" dnum="ii-o" numlevel="1" lineno="240" slineno="2-124" level="3"><display>(ii)</display>are prohibited from filing a modified feasibility request under Subsection <xref depth="4" refnumber="10-2a-505(3)"><ln numlevel="1" lineno="241" slineno="2-125"/>10-2a-505(3)</xref>.</subsection></subsection></subsection></section></bsec><bsec buid="8" num="10-2a-502.5" type="enact" src="code" uid="C10-2a-S502.5_2026050620260506" sort="10 02a05020520260506" numlevel="1" lineno="242" slineno="3-1" sn="3"><section numlevel="1" lineno="243" slineno="3-2" number="10-2a-502.5" or</amend></subsection><subsection ssid="8-41" dnum="_-o:iii-i" numlevel="1" lineno="252" slineno="3-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="189" groupid="138" style="1" owner="jchristopherson" level="1" amendtag="end">a development agreement between the applicant and the count<marker pairid="357"><marker pairid="358">y;</marker></marker></amend></subsection></subsection><subsection ssid="8-40" dnum="_-o:b-i" numlevel="1" lineno="253" slineno="3-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1102" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="174" groupid="127" style="1" owner="jchristopherson" level="1" amendtag="end">the county to provide the applicant with a meaningful opportunity for the applicant to <ln numlevel="1" lineno="254" slineno="3-13"/>consult with county staff and officials about the planned development; and</amend></subsection><subsection ssid="8-44" dnum="_-o:c-i" numlevel="1" lineno="255" slineno="3-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1103" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="198" groupid="145" style="1" owner="jchristopherson" level="1" amendtag="end">both the applicant and the county:</amend><subsection ssid="8-45" dnum="_-o:i-i" numlevel="1" lineno="256" slineno="3-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1104" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="203" groupid="149" style="1" owner="jchristopherson" level="1" amendtag="end">to make reasonable efforts to find areas in which compromise is possible or <ln numlevel="1" lineno="257" slineno="3-16"/>alternative solutions may be found; and</amend></subsection><subsection ssid="8-46" dnum="_-o:ii-i" numlevel="1" lineno="258" slineno="3-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1105" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="208" groupid="153" style="1" owner="jchristopherson" level="1" amendtag="end">to identify the specific issues upon which the applicant and county are unable to <ln numlevel="1" lineno="259" slineno="3-18"/>reach a mutually agreeable solution, including the factors that make a mutually <ln numlevel="1" lineno="260" slineno="3-19"/>agreeable solution impossible or impractical.</amend></subsection></subsection></subsection><subsection ssid="8-65" dnum="_-o:3-i" numlevel="1" lineno="261" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="309" groupid="229" style="1" owner="jchristopherson" level="1" amendtag="end">The application, petition, or proposed development agreement described in Subsection <xref depth="4" refnumber="10-2a-502.5(2)(a)"><ln numlevel="1" lineno="262" slineno="3-21"/>(2)(a)</xref> shall make clear to the county:</amend><subsection ssid="8-67" dnum="_-o:a-i" numlevel="1" lineno="263" slineno="3-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="316" groupid="235" style="1" owner="jchristopherson" level="1" amendtag="end">what the applicant is proposing to do with land in the county;</amend></subsection><subsection ssid="8-68" dnum="_-o:b-i" numlevel="1" lineno="264" slineno="3-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1108" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="319" groupid="237" style="1" owner="jchristopherson" level="1" amendtag="end">what the applicant is requesting from the county in order to proceed; and</amend></subsection><subsection ssid="8-69" dnum="_-o:c-i" numlevel="1" lineno="265" slineno="3-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="322" groupid="239" style="1" owner="jchristopherson" level="1" amendtag="end">that the applicant intends to apply to incorporate an area as a preliminary <ln numlevel="1" lineno="266" slineno="3-25"/>municipality if the applicant and county are unable to reach a mutually agreeable <ln numlevel="1" lineno="267" slineno="3-26"/>resolution.</amend></subsection></subsection><subsection ssid="8-70" dnum="_-o:4-i" numlevel="1" lineno="268" slineno="3-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="331" groupid="244" style="1" owner="jchristopherson" level="1" amendtag="end">A county shall:</amend><subsection ssid="8-71" dnum="_-o:a-i" numlevel="1" lineno="269" slineno="3-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="336" groupid="248" style="1" owner="jchristopherson" level="1" amendtag="end">accept an application described in Subsection <xref depth="4" refnumber="10-2a-502.5(2)(a)">(2)(a)</xref> if the application is complete, as <ln numlevel="1" lineno="270" slineno="3-29"/>described in Section <xref depth="3" refnumber="17-79-803">17-79-803<marker pairid="356"/></xref><marker pairid="355">;</marker> and</amend></subsection><subsection ssid="8-73" dnum="_-o:b-i" numlevel="1" lineno="271" slineno="3-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1112" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><subsection ssid="8-74" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1113" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="341" groupid="252" style="1" owner="jchristopherson" level="1" amendtag="end">accept a petition or proposed development agreement described in Subsection <xref depth="4" refnumber="10-2a-502.5(2)(a)"><ln numlevel="1" lineno="272" slineno="3-31"/>(2)(a)</xref> for consideration if the petition or proposed development agreement is <ln numlevel="1" lineno="273" slineno="3-32"/>sufficiently clear to begin good faith coordination with the applicant; or</amend></subsection><subsection ssid="8-75" dnum="_-o:ii-i" numlevel="1" lineno="274" slineno="3-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1114" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="352" groupid="259" style="1" owner="jchristopherson" level="1" amendtag="end">provide a written explanation of why a petition or proposed development <ln numlevel="1" lineno="275" slineno="3-34"/>agreement is not sufficiently clear, including what information the county requires <ln numlevel="1" lineno="276" slineno="3-35"/>to render the petition or proposed development agreement sufficiently clear, <ln numlevel="1" lineno="277" slineno="3-36"/>within 10 business days of the day on which the county receives the petition or <ln numlevel="1" lineno="278" slineno="3-37"/>proposed development agreement.</amend></subsection></subsection></subsection><subsection ssid="8-17" dnum="_-o:5-i" numlevel="1" lineno="279" slineno="3-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1115" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="8-47" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1116" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">No earlier than 18 months after the day on which an applicant takes the action <ln numlevel="1" lineno="280" slineno="3-39"/>described in Subsection <xref depth="4" refnumber="10-2a-502.5(2)(a)">(2)(a)</xref>, an applicant that intends to file a feasibility request <ln numlevel="1" lineno="281" slineno="3-40"/>under Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref> may submit a request to the county that the county <ln numlevel="1" lineno="282" slineno="3-41"/>acknowledge the good faith coordination between the applicant and the county.</amend></subsection><subsection ssid="8-48" dnum="_-o:b-i" numlevel="1" lineno="283" slineno="3-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1117" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="217" groupid="157" style="1" owner="jchristopherson" level="1" amendtag="end">The applicant shall include in the request described in Subsection <xref depth="4" refnumber="10-2a-502.5(5)(a)">(5)(a)</xref>:</amend><subsection ssid="8-49" dnum="_-o:i-i" numlevel="1" lineno="284" slineno="3-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1118" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="223" groupid="162" style="1" owner="jchristopherson" level="1" amendtag="end">a description explaining that:</amend><subsection ssid="8-58" dnum="_-o:A-i" numlevel="1" lineno="285" slineno="3-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1119" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="272" groupid="201" style="1" owner="jchristopherson" level="1" amendtag="end">the requirements of this section have been met; or</amend></subsection><subsection ssid="8-59" dnum="_-o:B-i" numlevel="1" lineno="286" slineno="3-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1120" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="277" groupid="205" style="1" owner="jchristopherson" level="1" amendtag="end">the requirements of this section have been met but for the county's failure to <ln numlevel="1" lineno="287" slineno="3-46"/>provide the applicant with a meaningful opportunity to consult or make <ln numlevel="1" lineno="288" slineno="3-47"/>reasonable efforts to find compromise or alternative solutions, or both, as <ln numlevel="1" lineno="289" slineno="3-48"/>required in Subsections <xref depth="4" refnumber="10-2a-502.5(2)(b)">(2)(b)</xref> and <xref depth="4" refnumber="10-2a-502.5(c)">(c)</xref>; and</amend></subsection></subsection><subsection ssid="8-50" dnum="_-o:ii-i" numlevel="1" lineno="290" slineno="3-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="228" groupid="166" style="1" owner="jchristopherson" level="1" amendtag="end">that the applicant intends to file a feasibility request under Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>.</amend></subsection></subsection><subsection ssid="8-51" dnum="_-o:c-i" numlevel="1" lineno="291" slineno="3-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="233" groupid="170" style="1" owner="jchristopherson" level="1" amendtag="end">A county that receives a request described in Subsection <xref depth="4" refnumber="10-2a-502.5(5)(a)">(5)(a)</xref> shall respond to the <ln numlevel="1" lineno="292" slineno="3-51"/>request in writing within five business days:</amend><subsection ssid="8-52" dnum="_-o:i-i" numlevel="1" lineno="293" slineno="3-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1123" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="238" groupid="174" style="1" owner="jchristopherson" level="1" amendtag="end">concurring with the applicant's assertion that the applicant and county have <ln numlevel="1" lineno="294" slineno="3-53"/>engaged in good faith coordination, as described in this section, but have been <ln numlevel="1" lineno="295" slineno="3-54"/>unable to reach a mutually agreeable solution;</amend></subsection><subsection ssid="8-53" dnum="_-o:ii-i" numlevel="1" lineno="296" slineno="3-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="243" groupid="178" style="1" owner="jchristopherson" level="1" amendtag="end">disputing the applicant's assertion that the applicant and county have engaged in <ln numlevel="1" lineno="297" slineno="3-56"/>good faith coordination; or</amend></subsection><subsection ssid="8-60" dnum="_-o:iii-i" numlevel="1" lineno="298" slineno="3-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="282" groupid="209" style="1" owner="jchristopherson" level="1" amendtag="end">asserting that the county has engaged in good faith coordination but that the <ln numlevel="1" lineno="299" slineno="3-58"/>applicant has failed to make reasonable efforts to find compromise or alternative <ln numlevel="1" lineno="300" slineno="3-59"/>solutions.</amend></subsection></subsection><subsection ssid="8-54" dnum="_-o:d-i" numlevel="1" lineno="301" slineno="3-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="250" groupid="183" style="1" owner="jchristopherson" level="1" amendtag="end">If Subsection <xref depth="4" refnumber="10-2a-502.5(5)(c)(ii)">(5)(c)(ii)</xref> or <xref depth="4" refnumber="10-2a-502.5(iii)">(iii)</xref> apply, the county shall provide a rationale for the <ln numlevel="1" lineno="302" slineno="3-61"/>county's dispute or assertion in the response described in Subsection <xref depth="4" refnumber="10-2a-502.5(5)(c)">(5)(c)</xref>.</amend></subsection></subsection><subsection ssid="8-14" dnum="_-o:6-i" numlevel="1" lineno="303" slineno="3-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="262" groupid="193" style="1" owner="jchristopherson" level="1" amendtag="end">An applicant may file a feasibility request under Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>:</amend><subsection ssid="8-56" dnum="_-o:a-i" numlevel="1" lineno="304" slineno="3-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="261" groupid="192" style="1" owner="jchristopherson" level="1" amendtag="end">after the applicant receives the county's response, as described in Subsection <xref depth="4" refnumber="10-2a-502.5(5)(c)">(5)(c)</xref>; or</amend></subsection><subsection ssid="8-57" dnum="_-o:b-i" numlevel="1" lineno="305" slineno="3-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="267" groupid="197" style="1" owner="jchristopherson" level="1" amendtag="end">if a county fails to timely respond, after the sixth business day following the day on <ln numlevel="1" lineno="306" slineno="3-65"/>which the applicant makes a request under Subsection <xref depth="4" refnumber="10-2a-502.5(5)(a)">(5)(a)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="4" num="10-2a-503" type="amend" src="code" uid="C10-2a-S503_2026050620260506" sort="10 02a05030020260506" numlevel="1" lineno="307" slineno="4-1" sn="4"><section number="10-2a-503" numlevel="1" lineno="308" slineno="4-2" type="amend"><secline lineno="307">Section 4. Section <bold>10-2a-503</bold> is amended to read:</secline><catline lineno="308"><bold>10-2a-503<parens><paren sort="00" type="original" show="true" display="space"><effect>Effective </effect><date>05/06/26</date></paren><paren sort="00" type="original" show="true"><effect>Repealed </effect><date>01/01/31</date></paren></parens>. Processing a feasibility <ln numlevel="1" lineno="309" slineno="4-3"/>request  -- Certification or rejection  -- Processing priority -- Determination by the Utah <ln numlevel="1" lineno="310" slineno="4-4"/>Population Committee.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="311" slineno="4-5" level="1" placement="noreturn"><display>(1)</display>Within 45 days after the day on which an individual files a feasibility request under <ln numlevel="1" lineno="312" slineno="4-6"/>Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>, the lieutenant governor shall:<subsection ssid="4-null-2" dnum="a-o" numlevel="1" lineno="313" slineno="4-7" level="2"><display>(a)</display>determine whether the feasibility request complies with Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>; and</subsection><subsection ssid="4-null-3" dnum="b-o" numlevel="1" lineno="314" slineno="4-8" level="2"><display>(b)</display>notify the clerk of the county where the proposed preliminary municipality area is <ln numlevel="1" lineno="315" slineno="4-9"/>located, in writing, of the determination made under Subsection <xref depth="4" refnumber="10-2a-503(1)(a)">(1)(a)</xref> and the <ln numlevel="1" lineno="316" slineno="4-10"/>grounds for the determination.</subsection></subsection><subsection ssid="4-null-4" dnum="2-o" numlevel="1" lineno="317" slineno="4-11" level="1"><display>(2)</display>A county clerk shall<amend anum="0" ea="amend" pairid="52" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend><subsection ssid="4-30" dnum="_-o:a-i" numlevel="1" lineno="318" slineno="4-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">inform the lieutenant governor if the applicant does not meet the requirements of <ln numlevel="1" lineno="319" slineno="4-13"/>Subsection <xref depth="4" refnumber="10-2a-502.5(6)">10-2a-502.5(6)</xref>; and</amend></subsection><subsection ssid="4-31" dnum="_-o:b-i" numlevel="1" lineno="320" slineno="4-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1" amendtag="both">(b)</amend></display> comply with a request by the lieutenant governor to provide information or a record <ln numlevel="1" lineno="321" slineno="4-15"/>to the lieutenant governor or to a sponsor of the feasibility request, to assist in <ln numlevel="1" lineno="322" slineno="4-16"/>complying with this part, within five calendar days after the day on which the <ln numlevel="1" lineno="323" slineno="4-17"/>lieutenant governor makes the request.</subsection></subsection><subsection ssid="4-null-5" dnum="3-o" numlevel="1" lineno="324" slineno="4-18" level="1"><display>(3)</display>If the lieutenant governor determines that the feasibility request complies with Section <xref depth="3" refnumber="10-2a-502"><ln numlevel="1" lineno="325" slineno="4-19"/>10-2a-502</xref>, the lieutenant governor shall:<subsection ssid="4-null-6" dnum="a-o" numlevel="1" lineno="326" slineno="4-20" level="2"><display>(a)</display>certify the feasibility request; and</subsection><subsection ssid="4-null-7" dnum="b-o" numlevel="1" lineno="327" slineno="4-21" level="2"><display>(b)</display>transmit written notification of the certification to<amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="4-23" dnum="_-o:i-i" numlevel="1" lineno="328" slineno="4-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>the primary sponsor contact<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend> </subsection><subsection ssid="4-24" dnum="_-o:ii-i" numlevel="1" lineno="329" slineno="4-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="both">(ii)</amend></display>the county clerk<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend> and </subsection><subsection ssid="4-25" dnum="_-o:iii-i" numlevel="1" lineno="330" slineno="4-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="i" level="1" amendtag="both">(iii)</amend></display>the Utah Population Committee.</subsection></subsection></subsection><subsection ssid="4-null-8" dnum="4-o" numlevel="1" lineno="331" slineno="4-25" level="1"><display>(4)</display>If the lieutenant governor determines that the feasibility request fails to comply with <ln numlevel="1" lineno="332" slineno="4-26"/>Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>, the lieutenant governor shall reject the feasibility request and notify <ln numlevel="1" lineno="333" slineno="4-27"/>the primary sponsor contact and the county clerk, in writing, of the rejection and the <ln numlevel="1" lineno="334" slineno="4-28"/>grounds for the rejection.</subsection><subsection ssid="4-null-9" dnum="5-o" numlevel="1" lineno="335" slineno="4-29" level="1" space="false"><display>(5)</display><subsection ssid="4-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Within 20 days after the day on which the lieutenant governor transmits written <ln numlevel="1" lineno="336" slineno="4-30"/>notification under Subsection <xref depth="4" refnumber="10-2a-503(3)(b)">(3)(b)</xref>, the Utah Population Committee shall:<subsection ssid="4-null-11" dnum="i-o" numlevel="1" lineno="337" slineno="4-31" level="3" tab="1"><display>(i)</display>determine whether, based on the map or plat described in Subsection <xref depth="4" refnumber="10-2a-502(5)(e)"><ln numlevel="1" lineno="338" slineno="4-32"/>10-2a-502(5)(e)</xref>, the proposed preliminary municipality will, when all phases of <ln numlevel="1" lineno="339" slineno="4-33"/>the map or plat are completed, likely comply with the population, population <ln numlevel="1" lineno="340" slineno="4-34"/>density, and contiguity requirements described in Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>; and</subsection><subsection ssid="4-null-12" dnum="ii-o" numlevel="1" lineno="341" slineno="4-35" level="3" tab="1"><display>(ii)</display>provide notice of the determination to the lieutenant governor and the county <ln numlevel="1" lineno="342" slineno="4-36"/>clerk.</subsection></subsection><subsection ssid="4-null-13" dnum="b-o" numlevel="1" lineno="343" slineno="4-37" level="2"><display>(b)</display>If the Utah Population Committee determines, under Subsection <xref depth="4" refnumber="10-2a-503(5)(a)(i)">(5)(a)(i)</xref>, that, when <ln numlevel="1" lineno="344" slineno="4-38"/>all phases of the plan or plat are completed, the proposed preliminary  municipality <ln numlevel="1" lineno="345" slineno="4-39"/>will not likely comply with the population, population density, and contiguity <ln numlevel="1" lineno="346" slineno="4-40"/>requirements described in Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>, the lieutenant governor shall rescind <ln numlevel="1" lineno="347" slineno="4-41"/>the certification described in Subsection <xref depth="4" refnumber="10-2a-503(3)">(3)</xref> and reject the feasibility request.</subsection></subsection><subsection ssid="4-null-14" dnum="6-o" numlevel="1" lineno="348" slineno="4-42" level="1"><display>(6)</display>The lieutenant governor shall certify or reject feasibility requests in the order in which <ln numlevel="1" lineno="349" slineno="4-43"/>the requests are filed.</subsection><subsection ssid="4-null-15" dnum="7-o" numlevel="1" lineno="350" slineno="4-44" level="1" space="false"><display>(7)</display><subsection ssid="4-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the lieutenant governor determines, under Subsection <xref depth="4" refnumber="10-2a-503(4)">(4)</xref>, that the feasibility <ln numlevel="1" lineno="351" slineno="4-45"/>request fails to comply with Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>, or rejects the feasibility request under <ln numlevel="1" lineno="352" slineno="4-46"/>Subsection <xref depth="4" refnumber="10-2a-503(5)(b)">(5)(b)</xref>, the sponsors may, subject to Section <xref depth="3" refnumber="10-2a-505">10-2a-505</xref>, amend the <ln numlevel="1" lineno="353" slineno="4-47"/>feasibility request to correct the deficiencies and refile the feasibility request with the <ln numlevel="1" lineno="354" slineno="4-48"/>lieutenant governor.</subsection><subsection ssid="4-null-17" dnum="b-o" numlevel="1" lineno="355" slineno="4-49" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="10-2a-503(7)(c)">(7)(c)</xref>, the sponsors may submit an amended <ln numlevel="1" lineno="356" slineno="4-50"/>feasibility request within 90 days after the day on which the lieutenant governor <ln numlevel="1" lineno="357" slineno="4-51"/>makes the determination or rejection described in Subsection <xref depth="4" refnumber="10-2a-503(7)(a)">(7)(a)</xref>.</subsection><subsection ssid="4-null-18" dnum="c-o" numlevel="1" lineno="358" slineno="4-52" level="2"><display>(c)</display>The sponsors may not submit an amended feasibility request more than once.</subsection><subsection ssid="4-null-19" dnum="d-o" numlevel="1" lineno="359" slineno="4-53" level="2"><display>(d)</display>The lieutenant governor shall consider a feasibility request that is amended and <ln numlevel="1" lineno="360" slineno="4-54"/>refiled under Subsection <xref depth="4" refnumber="10-2a-503(7)(a)">(7)(a)</xref> as a newly filed feasibility request and process the <ln numlevel="1" lineno="361" slineno="4-55"/>feasibility request in accordance with this section.</subsection></subsection><subsection ssid="4-22" dnum="_-o:8-i" numlevel="1" lineno="362" slineno="4-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1154" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">Any individual in the Office of the Lieutenant Governor or on the Utah Population <ln numlevel="1" lineno="363" slineno="4-57"/>Committee who plays a role in the preliminary municipality approval process described <ln numlevel="1" lineno="364" slineno="4-58"/>in this part shall be independent of and not affiliated with an applicant or a sponsor of a <ln numlevel="1" lineno="365" slineno="4-59"/>petition to incorporate a preliminary municipality.</amend></subsection></section></bsec><bsec buid="6" num="10-2a-504" type="amend" src="code" uid="C10-2a-S504_2026050620260506" sort="10 02a05040020260506" numlevel="1" lineno="366" slineno="5-1" sn="5"><section number="10-2a-504" numlevel="1" lineno="367" slineno="5-2" type="amend"><secline lineno="366">Section 5. the certification under Subsection <xref depth="4" refnumber="10-2a-503(5)(b)"><ln numlevel="1" lineno="370" slineno="5-5"/>10-2a-503(5)(b)</xref>, the lieutenant governor shall, within 90 days after the day on which <ln numlevel="1" lineno="371" slineno="5-6"/>the lieutenant governor certifies a feasibility request under Subsection <xref depth="4" refnumber="10-2a-503(3)(a)"><ln numlevel="1" lineno="372" slineno="5-7"/>10-2a-503(3)(a)</xref>, in accordance with Subsection <xref depth="4" refnumber="10-2a-504(2)">(2)</xref>, engage a feasibility consultant to <ln numlevel="1" lineno="373" slineno="5-8"/>conduct a feasibility study<amend anum="0" ea="amend" pairid="130" groupid="111" style="1" owner="jchristopherson" level="1" amendtag="both"> on the proposed preliminary municipality, as the proposed <ln numlevel="1" lineno="374" slineno="5-9"/>preliminary municipality is described in the certified feasibility request</amend>.</subsection><subsection ssid="6-78" dnum="_-o:b-i" numlevel="1" lineno="375" slineno="5-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="204" groupid="163" style="1" owner="jchristopherson" level="1" amendtag="end">If the primary sponsor desires that the feasibility study described in this section be <ln numlevel="1" lineno="376" slineno="5-11"/>based off a development plan that is materially different than what is described in the <ln numlevel="1" lineno="377" slineno="5-12"/>certified feasibility request:</amend><subsection ssid="6-79" dnum="_-o:i-i" numlevel="1" lineno="378" slineno="5-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="209" groupid="167" style="1" owner="jchristopherson" level="1" amendtag="end">the primary sponsor shall notify the lieutenant governor and the lieutenant <ln numlevel="1" lineno="379" slineno="5-14"/>governor shall rescind the certification of the feasibility request;</amend></subsection><subsection ssid="6-80" dnum="_-o:ii-i" numlevel="1" lineno="380" slineno="5-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="214" groupid="171" style="1" owner="jchristopherson" level="1" amendtag="end">the primary sponsor is required to comply with Section <xref depth="3" refnumber="10-2a-502.5">10-2a-502.5</xref> regarding the <ln numlevel="1" lineno="381" slineno="5-16"/>new development plan; and</amend></subsection><subsection ssid="6-81" dnum="_-o:iii-i" numlevel="1" lineno="382" slineno="5-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="219" groupid="175" style="1" owner="jchristopherson" level="1" amendtag="end">the primary sponsor may submit a new feasibility request as described in Section <xref depth="3" refnumber="10-2a-502"><ln numlevel="1" lineno="383" slineno="5-18"/>10-2a-502</xref>.</amend></subsection></subsection></subsection><subsection ssid="6-null-2" dnum="2-o" numlevel="1" lineno="384" slineno="5-19" level="1"><display>(2)</display>The lieutenant governor shall:<subsection ssid="6-null-3" dnum="a-o" numlevel="1" lineno="385" slineno="5-20" level="2"><display>(a)</display>select a feasibility consultant in accordance with Title 63G, Chapter 6a, Utah <ln numlevel="1" lineno="386" slineno="5-21"/>Procurement Code;</subsection><subsection ssid="6-null-4" dnum="b-o" numlevel="1" lineno="387" slineno="5-22" level="2"><display>(b)</display>ensure that the feasibility consultant:<subsection ssid="6-null-5" dnum="i-o" numlevel="1" lineno="388" slineno="5-23" level="3"><display>(i)</display>has expertise in the processes and economics of local government;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-6" dnum="ii-o" numlevel="1" lineno="389" slineno="5-24" level="3"><display>(ii)</display>is not affiliated with a sponsor of the feasibility request or the county in which the <ln numlevel="1" lineno="390" slineno="5-25"/>proposed municipality is located;<amend anum="0" ea="amend" pairid="83" groupid="71" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend> </subsection><subsection ssid="6-48" dnum="_-o:iii-i" numlevel="1" lineno="391" slineno="5-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1166" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">comply with the relevant provisions of this part; </amend>and</subsection></subsection><subsection ssid="6-null-7" dnum="c-o" numlevel="1" lineno="392" slineno="5-27" level="2"><display>(c)</display>require the feasibility consultant to:<subsection ssid="6-null-8" dnum="i-o" numlevel="1" lineno="393" slineno="5-28" level="3"><display>(i)</display>submit a draft of the feasibility study to each applicable person with whom the <ln numlevel="1" lineno="394" slineno="5-29"/>feasibility consultant is required to consult under Subsection <xref depth="4" refnumber="10-2a-504(3)(c)">(3)(c)</xref> within <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="310" groupid="254" style="2" owner="jchristopherson" level="1" deltag="both">90</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="308" groupid="252" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">120</amend> <ln numlevel="1" lineno="395" slineno="5-30"/>days after the day on which the lieutenant governor engages the feasibility <ln numlevel="1" lineno="396" slineno="5-31"/>consultant to conduct the study;</subsection><subsection ssid="6-null-9" dnum="ii-o" numlevel="1" lineno="397" slineno="5-32" level="3"><display>(ii)</display>allow each person to whom the consultant provides a draft under Subsection <xref depth="4" refnumber="10-2a-504(2)(c)(i)"><ln numlevel="1" lineno="398" slineno="5-33"/>(2)(c)(i)</xref> to review and provide comment on the draft;</subsection><subsection ssid="6-null-10" dnum="iii-o" numlevel="1" lineno="399" slineno="5-34" level="3"><display>(iii)</display>submit<amend anum="0" ea="amend" pairid="128" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="both"> on the same day</amend> a completed feasibility study, including a one-page <ln numlevel="1" lineno="400" slineno="5-35"/>summary of the results, to the following within <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="311" groupid="255" style="2" owner="jchristopherson" level="1" deltag="both">120</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="309" groupid="253" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">180</amend> days after the day on <ln numlevel="1" lineno="401" slineno="5-36"/>which the lieutenant governor engages the feasibility consultant to conduct the <ln numlevel="1" lineno="402" slineno="5-37"/>feasibility study:<subsection ssid="6-null-11" dnum="A-o" numlevel="1" lineno="403" slineno="5-38" level="4"><display>(A)</display>the lieutenant governor;</subsection><subsection ssid="6-null-12" dnum="B-o" numlevel="1" lineno="404" slineno="5-39" level="4"><display>(B)</display>the county legislative body of the county in which the proposed preliminary <ln numlevel="1" lineno="405" slineno="5-40"/>municipality area is located;</subsection><subsection ssid="6-null-13" dnum="C-o" numlevel="1" lineno="406" slineno="5-41" level="4"><display>(C)</display>the primary sponsor contact; and</subsection><subsection ssid="6-null-14" dnum="D-o" numlevel="1" lineno="407" slineno="5-42" level="4"><display>(D)</display>each person to whom the consultant provided a draft under Subsection <xref depth="4" refnumber="10-2a-504(2)(c)(i)">(2)(c)(i)</xref>; <ln numlevel="1" lineno="408" slineno="5-43"/>and</subsection></subsection><subsection ssid="6-null-15" dnum="iv-o" numlevel="1" lineno="409" slineno="5-44" level="3"><display>(iv)</display>attend the public hearings described in Section <xref depth="3" refnumber="10-2a-506">10-2a-506</xref> to present the <ln numlevel="1" lineno="410" slineno="5-45"/>feasibility study results and respond to questions from the public.</subsection></subsection></subsection><subsection ssid="6-null-16" dnum="3-o" numlevel="1" lineno="411" slineno="5-46" level="1" space="false"><display>(3)</display><subsection ssid="6-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The feasibility study shall include:<subsection ssid="6-null-18" dnum="i-o" numlevel="1" lineno="412" slineno="5-47" level="3" tab="1"><display>(i)</display>an analysis of:<subsection ssid="6-null-19" dnum="A-o" numlevel="1" lineno="413" slineno="5-48" level="4"><display>(A)</display>the likely population and population density within the proposed preliminary <ln numlevel="1" lineno="414" slineno="5-49"/>municipality area when all phases of the map or plat for the proposed <ln numlevel="1" lineno="415" slineno="5-50"/>preliminary municipality area are completed;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="81" groupid="69" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-20" dnum="B-o" numlevel="1" lineno="416" slineno="5-51" level="4"><display>(B)</display>the population and population density of the area surrounding the proposed <ln numlevel="1" lineno="417" slineno="5-52"/>preliminary municipality area on the day on which the feasibility request was <ln numlevel="1" lineno="418" slineno="5-53"/>submitted;<amend anum="0" ea="amend" pairid="79" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend></subsection><subsection ssid="6-57" dnum="_-o:C-i" numlevel="1" lineno="419" slineno="5-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1181" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">any land use entitlements already established within the proposed preliminary <ln numlevel="1" lineno="420" slineno="5-55"/>municipality area;</amend></subsection></subsection><subsection ssid="6-null-21" dnum="ii-o" numlevel="1" lineno="421" slineno="5-56" level="3" tab="1"><display>(ii)</display>an analysis of the following, determined as if, at the time of the analysis, the <ln numlevel="1" lineno="422" slineno="5-57"/>proposed <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="87" groupid="75" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>preliminary municipality area is incorporated as a town with a <ln numlevel="1" lineno="423" slineno="5-58"/>population of 100 <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="133" groupid="114" style="2" owner="jchristopherson" level="1" deltag="both">people</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="132" groupid="113" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individuals</amend>:<subsection ssid="6-null-22" dnum="A-o" numlevel="1" lineno="424" slineno="5-59" level="4"><display>(A)</display>the initial<amend anum="0" ea="amend" pairid="263" groupid="211" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="278" groupid="226" style="2" owner="jchristopherson" level="1" deltag="both">and projected </amend><amendoutend style="2"/>five-year<amend anum="0" ea="amend" pairid="264" groupid="212" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> <amend anum="0" ea="amend" pairid="265" groupid="213" style="1" owner="jchristopherson" level="1" amendtag="both">and 10-year projected </amend>demographics and <ln numlevel="1" lineno="425" slineno="5-60"/>tax base within the boundaries of the proposed preliminary municipality area <ln numlevel="1" lineno="426" slineno="5-61"/>and the surrounding area, including household size and income, commercial <ln numlevel="1" lineno="427" slineno="5-62"/>and industrial development, and public facilities;</subsection><subsection ssid="6-null-23" dnum="B-o" numlevel="1" lineno="428" slineno="5-63" level="4"><display>(B)</display>subject to Subsection <xref depth="4" refnumber="10-2a-504(3)(b)">(3)(b)</xref>, the initial<amend anum="0" ea="amend" pairid="266" groupid="214" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="281" groupid="229" style="2" owner="jchristopherson" level="1" deltag="both">and </amend><amendoutend style="2"/>five-year<amend anum="0" ea="amend" pairid="267" groupid="215" style="1" owner="jchristopherson" level="1" amendtag="both">, and 10-year</amend> projected <ln numlevel="1" lineno="429" slineno="5-64"/>cost of providing <amend anum="0" ea="amend" pairid="172" groupid="140" style="1" owner="jchristopherson" level="1" amendtag="both">all </amend>municipal services to the proposed preliminary <ln numlevel="1" lineno="430" slineno="5-65"/>municipality area, including administrative costs<amend anum="0" ea="amend" pairid="173" groupid="141" style="1" owner="jchristopherson" level="1" amendtag="both"> and the costs of public <ln numlevel="1" lineno="431" slineno="5-66"/>infrastructure required to provide each municipal service to the proposed <ln numlevel="1" lineno="432" slineno="5-67"/>preliminary municipality area</amend>;</subsection><subsection ssid="6-null-24" dnum="C-o" numlevel="1" lineno="433" slineno="5-68" level="4"><display>(C)</display>assuming the same tax categories and tax rates as imposed by the county and <ln numlevel="1" lineno="434" slineno="5-69"/>all other current service providers at the time during which the feasibility <ln numlevel="1" lineno="435" slineno="5-70"/>consultant prepares the feasibility study, the initial<amend anum="0" ea="amend" pairid="269" groupid="217" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="282" groupid="230" style="2" owner="jchristopherson" level="1" deltag="both">and </amend><amendoutend style="2"/>five-year<amend anum="0" ea="amend" pairid="270" groupid="218" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> <amend anum="0" ea="amend" pairid="271" groupid="219" style="1" owner="jchristopherson" level="1" amendtag="both">and <ln numlevel="1" lineno="436" slineno="5-71"/>10-year </amend>projected revenue for the proposed preliminary municipality area;</subsection><subsection ssid="6-null-25" dnum="D-o" numlevel="1" lineno="437" slineno="5-72" level="4"><display>(D)</display>the risks and opportunities that might affect the actual costs described in <ln numlevel="1" lineno="438" slineno="5-73"/>Subsection <xref depth="4" refnumber="10-2a-504(3)(a)(ii)(b)">(3)(a)(ii)(B)</xref> or the revenues described in Subsection <xref depth="4" refnumber="10-2a-504(3)(a)(ii)(c)">(3)(a)(ii)(C)</xref> of <ln numlevel="1" lineno="439" slineno="5-74"/>the proposed preliminary municipality area;</subsection><subsection ssid="6-null-26" dnum="E-o" numlevel="1" lineno="440" slineno="5-75" level="4"><display>(E)</display>new revenue sources that may be available to the proposed preliminary <ln numlevel="1" lineno="441" slineno="5-76"/>municipality area that are not available before the area incorporates, including <ln numlevel="1" lineno="442" slineno="5-77"/>an analysis of the amount of revenues the proposed preliminary municipality <ln numlevel="1" lineno="443" slineno="5-78"/>area might obtain from those revenue sources;</subsection><subsection ssid="6-null-27" dnum="F-o" numlevel="1" lineno="444" slineno="5-79" level="4"><display>(F)</display>the projected tax burden per household of any new taxes that may be levied <ln numlevel="1" lineno="445" slineno="5-80"/>within the proposed preliminary municipality area within five <amend anum="0" ea="amend" pairid="272" groupid="220" style="1" owner="jchristopherson" level="1" amendtag="both">and 10 </amend>years <ln numlevel="1" lineno="446" slineno="5-81"/>after incorporation as a town; and</subsection><subsection ssid="6-null-28" dnum="G-o" numlevel="1" lineno="447" slineno="5-82" level="4"><display>(G)</display>the fiscal impact of the proposed preliminary municipality area's incorporation <ln numlevel="1" lineno="448" slineno="5-83"/>as a town on unincorporated areas, other municipalities, special districts, <ln numlevel="1" lineno="449" slineno="5-84"/>special service districts, and other governmental entities in the county; and</subsection></subsection><subsection ssid="6-null-29" dnum="iii-o" numlevel="1" lineno="450" slineno="5-85" level="3" tab="1"><display>(iii)</display>an analysis regarding whether sufficient water will be available to support the <ln numlevel="1" lineno="451" slineno="5-86"/>proposed preliminary municipality area when the development of the area is <ln numlevel="1" lineno="452" slineno="5-87"/>complete.</subsection></subsection><subsection ssid="6-null-30" dnum="b-o" numlevel="1" lineno="453" slineno="5-88" level="2" space="false"><display>(b)</display><subsection ssid="6-null-31" dnum="i-o" level="3" placement="sameline"><display>(i)</display>In calculating the projected costs under Subsection <xref depth="4" refnumber="10-2a-504(3)(a)(ii)(b)">(3)(a)(ii)(B)</xref>, the feasibility <ln numlevel="1" lineno="454" slineno="5-89"/>consultant shall assume the proposed preliminary municipality area will provide a <ln numlevel="1" lineno="455" slineno="5-90"/>level and quality of municipal services that fairly and reasonably approximate the <ln numlevel="1" lineno="456" slineno="5-91"/>level and quality of municipal services that are provided to the area surrounding <ln numlevel="1" lineno="457" slineno="5-92"/>the proposed preliminary municipality area at the time the feasibility consultant <ln numlevel="1" lineno="458" slineno="5-93"/>conducts the feasibility study.</subsection><subsection ssid="6-null-32" dnum="ii-o" numlevel="1" lineno="459" slineno="5-94" level="3"><display>(ii)</display>In calculating the current cost of a municipal service under Subsection <xref depth="4" refnumber="10-2a-504(3)(a)(ii)(b)"><ln numlevel="1" lineno="460" slineno="5-95"/>(3)(a)(ii)(B)</xref>, the feasibility consultant shall consider:<subsection ssid="6-null-33" dnum="A-o" numlevel="1" lineno="461" slineno="5-96" level="4"><display>(A)</display>the amount it would cost the proposed preliminary municipality area to <ln numlevel="1" lineno="462" slineno="5-97"/>provide the municipal service for the first five years<amend anum="0" ea="amend" pairid="273" groupid="221" style="1" owner="jchristopherson" level="1" amendtag="both"> and 10 years</amend> after the area <ln numlevel="1" lineno="463" slineno="5-98"/>incorporates as a town; and</subsection><subsection ssid="6-null-34" dnum="B-o" numlevel="1" lineno="464" slineno="5-99" level="4"><display>(B)</display>the proposed or current municipal service provider's initial<amend anum="0" ea="amend" pairid="274" groupid="222" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="283" groupid="231" style="2" owner="jchristopherson" level="1" deltag="both">and </amend><amendoutend style="2"/>five-year<amend anum="0" ea="amend" pairid="275" groupid="223" style="1" owner="jchristopherson" level="1" amendtag="both">, <ln numlevel="1" lineno="465" slineno="5-100"/>and 10-year</amend> projected cost of providing the municipal service after the <ln numlevel="1" lineno="466" slineno="5-101"/>proposed preliminary municipality area incorporates as a town.</subsection></subsection><subsection ssid="6-null-35" dnum="iii-o" numlevel="1" lineno="467" slineno="5-102" level="3"><display>(iii)</display>In calculating costs under Subsection <xref depth="4" refnumber="10-2a-504(3)(a)(ii)(b)">(3)(a)(ii)(B)</xref>, the feasibility consultant shall <ln numlevel="1" lineno="468" slineno="5-103"/>account for inflation and anticipated growth.</subsection></subsection><subsection ssid="6-null-36" dnum="c-o" numlevel="1" lineno="469" slineno="5-104" level="2"><display>(c)</display>In conducting the feasibility study, the feasibility consultant shall consult with the <ln numlevel="1" lineno="470" slineno="5-105"/>following before submitting a draft of the feasibility study under Subsection <xref depth="4" refnumber="10-2a-504(2)(c)(iii)">(2)(c)(iii)</xref>:<subsection ssid="6-null-37" dnum="i-o" numlevel="1" lineno="471" slineno="5-106" level="3"><display>(i)</display>if the proposed preliminary municipality will include lands owned by the United <ln numlevel="1" lineno="472" slineno="5-107"/>States federal government, the entity within the United States federal government <ln numlevel="1" lineno="473" slineno="5-108"/>that has jurisdiction over the land;</subsection><subsection ssid="6-null-38" dnum="ii-o" numlevel="1" lineno="474" slineno="5-109" level="3"><display>(ii)</display>if the proposed preliminary municipality will include lands owned by the state, <ln numlevel="1" lineno="475" slineno="5-110"/>the entity within state government that has jurisdiction over the land;</subsection><subsection ssid="6-null-39" dnum="iii-o" numlevel="1" lineno="476" slineno="5-111" level="3"><display>(iii)</display>each entity that provides, or is proposed to provide, a municipal service to a <ln numlevel="1" lineno="477" slineno="5-112"/>portion of the proposed preliminary municipality area;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-40" dnum="iv-o" numlevel="1" lineno="478" slineno="5-113" level="3"><display>(iv)</display>each other special service district that provides, or is proposed to provide, <ln numlevel="1" lineno="479" slineno="5-114"/>services to a portion of the proposed preliminary municipality area<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="6-47" dnum="_-o:v-i" numlevel="1" lineno="480" slineno="5-115" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1202" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">the legislative body of the county in which the preliminary municipality area is <ln numlevel="1" lineno="481" slineno="5-116"/>located.</amend></subsection></subsection></subsection><subsection ssid="6-49" dnum="_-o:4-i" numlevel="1" lineno="482" slineno="5-117" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1203" style="1" owner="i" level="1" the county in which the preliminary municipality area is <ln numlevel="1" lineno="483" slineno="5-118"/>located may provide the feasibility consultant with data, information, and analysis the <ln numlevel="1" lineno="484" slineno="5-119"/>legislative body considers relevant to the feasibility study.</amend></subsection><subsection ssid="6-61" dnum="_-o:b-i" numlevel="1" lineno="485" slineno="5-120" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1205" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="91" style="1" owner="jchristopherson" level="1" amendtag="end">Data, information, and analysis described in Subsection <xref depth="4" refnumber="10-2a-504(4)(a)">(4)(a)</xref> may include:</amend><subsection ssid="6-62" dnum="_-o:i-i" numlevel="1" lineno="486" slineno="5-121" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1206" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="295" groupid="241" style="1" owner="jchristopherson" level="1" amendtag="end">areas in which the county and applicant were able to reach a mutually agreeable <ln numlevel="1" lineno="487" slineno="5-122"/>solution during the good faith coordination required by Section <xref depth="3" refnumber="10-2a-502.5">10-2a-502.5</xref>;</amend></subsection><subsection ssid="6-90" dnum="_-o:ii-i" numlevel="1" lineno="488" slineno="5-123" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1207" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="294" groupid="240" style="1" owner="jchristopherson" level="1" amendtag="end">information supporting or explaining the county's position in regard to issues <ln numlevel="1" lineno="489" slineno="5-124"/>upon which the applicant and county were unable to reach a mutually agreeable <ln numlevel="1" lineno="490" slineno="5-125"/>solution, including the factors that make a mutually agreeable solution impossible <ln numlevel="1" lineno="491" slineno="5-126"/>or impractical, during the good faith coordination required by Section <xref depth="3" refnumber="10-2a-502.5">10-2a-502.5</xref>;</amend></subsection><subsection ssid="6-89" dnum="_-o:iii-i" numlevel="1" lineno="492" slineno="5-127" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1208" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="288" groupid="235" style="1" owner="jchristopherson" level="1" amendtag="end">the county's assessment of the necessary system infrastructure to support the <ln numlevel="1" lineno="493" slineno="5-128"/>proposed development, including any fill and grading required before paved roads <ln numlevel="1" lineno="494" slineno="5-129"/>can be placed;</amend></subsection><subsection ssid="6-88" dnum="_-o:iv-i" numlevel="1" lineno="495" slineno="5-130" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1209" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="245" groupid="193" style="1" owner="jchristopherson" level="1" amendtag="end">projected needs for future property tax increases;</amend></subsection><subsection ssid="6-65" dnum="_-o:v-i" numlevel="1" lineno="496" slineno="5-131" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1210" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="126" groupid="107" style="1" owner="jchristopherson" level="1" amendtag="end">projected county costs in regard to development of the proposed preliminary <ln numlevel="1" lineno="497" slineno="5-132"/>municipality area, including development costs outside but adjacent to the <ln numlevel="1" lineno="498" slineno="5-133"/>proposed preliminary municipality area;</amend></subsection><subsection ssid="6-63" dnum="_-o:vi-i" numlevel="1" lineno="499" slineno="5-134" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1211" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="99" style="1" owner="jchristopherson" level="1" amendtag="end">deferred maintenance costs in or near the proposed preliminary municipality <ln numlevel="1" lineno="500" slineno="5-135"/>area; and</amend></subsection><subsection ssid="6-64" dnum="_-o:vii-i" numlevel="1" lineno="501" slineno="5-136" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1212" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">unique factors about the county or the proposed preliminary municipality or <ln numlevel="1" lineno="502" slineno="5-137"/>both that may create a strain on county resources in the future.</amend></subsection></subsection><subsection ssid="6-51" dnum="_-o:c-i" numlevel="1" lineno="503" slineno="5-138" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1213" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">The feasibility consultant shall consider data, information, and analysis provided by <ln numlevel="1" lineno="504" slineno="5-139"/>the county under Subsection <xref depth="4" refnumber="10-2a-504(4)(a)">(4)(a)</xref>, and use the data, information, and analysis in the <ln numlevel="1" lineno="505" slineno="5-140"/>feasibility study in accordance with Subsection <xref depth="4" refnumber="10-2a-504(5)">(5)</xref>.</amend></subsection></subsection><subsection ssid="6-82" dnum="_-o:5-i" numlevel="1" lineno="506" slineno="5-141" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="6-84" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1215" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="229" groupid="182" style="1" owner="jchristopherson" level="1" amendtag="end">The analysis required by Subsection <xref depth="4" refnumber="10-2a-504(3)">(3)</xref> shall be based on:</amend><subsection ssid="6-92" dnum="_-o:i-i" numlevel="1" lineno="507" slineno="5-142" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="300" groupid="245" style="1" owner="jchristopherson" level="1" amendtag="end">data, information, and analysis that is objective, reliable, and grounded in <ln numlevel="1" lineno="508" slineno="5-143"/>area-specific information from the preceding 10 years, including nearby areas; and</amend></subsection><subsection ssid="6-93" dnum="_-o:ii-i" numlevel="1" lineno="509" slineno="5-144" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="305" groupid="249" style="1" owner="jchristopherson" level="1" amendtag="end"><marker pairid="315"/>professional or market-based studies, including market absorption, pricing, and <ln numlevel="1" lineno="510" slineno="5-145"/>existing available lots in the area and nearby areas.</amend></subsection></subsection><subsection ssid="6-85" dnum="_-o:b-i" numlevel="1" lineno="511" slineno="5-146" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1218" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="232" groupid="184" style="1" owner="jchristopherson" level="1" amendtag="end">The feasibility consultant shall:</amend><subsection ssid="6-86" dnum="_-o:i-i" numlevel="1" lineno="512" slineno="5-147" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1219" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="235" groupid="186" style="1" owner="jchristopherson" level="1" amendtag="end">only use data, information, or analysis provided by a sponsor or a county if the <ln numlevel="1" lineno="513" slineno="5-148"/>feasibility consultant determines the data, information, or analysis can be <ln numlevel="1" lineno="514" slineno="5-149"/>independently verified to meet the requirements of Subsection (5)(a); and</amend></subsection><subsection ssid="6-87" dnum="_-o:ii-i" numlevel="1" lineno="515" slineno="5-150" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1220" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="238" groupid="188" style="1" owner="jchristopherson" level="1" amendtag="end">provide an explanation of the determination described in Subsection <xref depth="4" refnumber="10-2a-504(5)(b)(i)">(5)(b)(i)</xref> in <ln numlevel="1" lineno="516" slineno="5-151"/>the feasibility study.</amend></subsection></subsection></subsection><subsection ssid="6-null-41" dnum="4-o:6-i" numlevel="1" lineno="517" slineno="5-152" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1221" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1222" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>If the five-year <amend anum="0" ea="amend" pairid="276" groupid="224" style="1" owner="jchristopherson" level="1" amendtag="both">and 10-year </amend>projected revenues calculated under Subsection <xref depth="4" refnumber="10-2a-504(3)(a)(ii)(c)"><ln numlevel="1" lineno="518" slineno="5-153"/>(3)(a)(ii)(C)</xref> exceed the five-year<amend anum="0" ea="amend" pairid="277" groupid="225" style="1" owner="jchristopherson" level="1" amendtag="both"> and 10-year</amend> projected costs calculated under <ln numlevel="1" lineno="519" slineno="5-154"/>Subsection <xref depth="4" refnumber="10-2a-504(3)(a)(ii)(b)">(3)(a)(ii)(B)</xref> by more than 5%, the feasibility consultant shall project and <ln numlevel="1" lineno="520" slineno="5-155"/>report the expected annual revenue surplus to<amend anum="0" ea="amend" pairid="59" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="6-54" dnum="_-o:a-i" numlevel="1" lineno="521" slineno="5-156" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1222" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>the primary sponsor contact<amend anum="0" ea="amend" pairid="66" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="both">;</amend></subsection><subsection ssid="6-55" dnum="_-o:b-i" numlevel="1" lineno="522" slineno="5-157" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1223" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">the legislative body of the county in which the preliminary municipality area is <ln numlevel="1" lineno="523" slineno="5-158"/>located;</amend> and </subsection><subsection ssid="6-56" dnum="_-o:c-i" numlevel="1" lineno="524" slineno="5-159" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1224" style="1" owner="i" level="1" amendtag="both">(c)</amend></display>the lieutenant governor.</subsection></subsection><subsection ssid="6-null-42" dnum="5-o:7-i" numlevel="1" lineno="525" slineno="5-160" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1225" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1226" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display><subsection ssid="6-null-43" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="10-2a-504(6)(b)">(5)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(7)(b)</amend>, if the results of the feasibility <ln numlevel="1" lineno="526" slineno="5-161"/>study, or a supplemental feasibility study described in Section <xref depth="3" refnumber="10-2a-505">10-2a-505</xref>, show that <ln numlevel="1" lineno="527" slineno="5-162"/>the average annual amount of revenue calculated under Subsection <xref depth="4" refnumber="10-2a-504(3)(a)(ii)(c)">(3)(a)(ii)(C)</xref> does <ln numlevel="1" lineno="528" slineno="5-163"/>not exceed the average annual cost calculated under Subsection <xref depth="4" refnumber="10-2a-504(3)(a)(ii)(b)">(3)(a)(ii)(B)</xref> by more <ln numlevel="1" lineno="529" slineno="5-164"/>than 5%, the process to incorporate the area that is the subject of the feasibility study <ln numlevel="1" lineno="530" slineno="5-165"/>or supplemental feasibility study may not proceed.</subsection><subsection ssid="6-null-44" dnum="b-o" numlevel="1" lineno="531" slineno="5-166" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="10-2a-505(3)">10-2a-505(3)</xref>, the process to incorporate an area <ln numlevel="1" lineno="532" slineno="5-167"/>described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="10-2a-504(6)(a)">(5)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(<marker pairid="313">7)(a)</marker></amend><marker pairid="312"> </marker>may proceed if a subsequent supplemental <ln numlevel="1" (5)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">that the average annual amount of <ln numlevel="1" lineno="535" slineno="5-170"/>revenue calculated under Subsection <xref depth="4" refnumber="10-2a-504(3)(a)(ii)(c)">(3)(a)(ii)(C)</xref> does exceed the average annual <ln numlevel="1" lineno="536" slineno="5-171"/>cost calculated under Subsection <xref depth="4" refnumber="10-2a-504(3)(a)(ii)(b)">(3)(a)(ii)(B)</xref> by more than 5%</amend>.</subsection></subsection><subsection ssid="6-null-45" dnum="6-o:8-i" numlevel="1" lineno="537" slineno="5-172" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1228" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1229" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>If the results of the feasibility study or revised feasibility study do not comply with <ln numlevel="1" lineno="538" slineno="5-173"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="33" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="10-2a-504(6)">(5)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="33" pairid="39" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="10-2a-504(6)">(5)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="34" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(7)</amend>, unless the sponsors are precluded from <ln numlevel="1" lineno="542" slineno="5-177"/>modifying the feasibility request under Subsection <xref depth="4" refnumber="10-2a-505(3)">10-2a-505(3)</xref>.</subsection><subsection ssid="6-null-46" dnum="7-o:9-i" numlevel="1" lineno="543" slineno="5-178" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1229" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1230" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>The lieutenant governor shall post a copy of the feasibility study, and any <ln numlevel="1" lineno="544" slineno="5-179"/>supplemental feasibility study described in Section <xref depth="3" refnumber="10-2a-505">10-2a-505</xref>, on the lieutenant <ln numlevel="1" lineno="545" slineno="5-180"/>governor's website and make a copy available for public review at the lieutenant <ln numlevel="1" lineno="546" slineno="5-181"/>governor's office.</subsection></section></bsec><bsec placement="sameline"><display>(i)</display>The sponsors of a feasibility request may not file a modified request under <ln numlevel="1" lineno="562" slineno="6-16"/>Subsection <xref depth="4" refnumber="10-2a-505(1)(a)(i)">(1)(a)(i)</xref> more than 90 days after the day on which the feasibility <ln numlevel="1" lineno="563" slineno="6-17"/>consultant submits the final results of the slineno="6-20"/>Subsection <xref depth="4" refnumber="10-2a-505(1)(a)(ii)">(1)(a)(ii)</xref> more than 18 months after filing the original feasibility <ln numlevel="1" lineno="567" slineno="6-21"/>request under Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>.</subsection></subsection><subsection ssid="10-null-11" dnum="c-o" numlevel="1" lineno="568" slineno="6-22" level="2"><display>(c)</display>A modified feasibility request under Subsection <xref depth="4" refnumber="10-2a-505(1)(a)">(1)(a)</xref> shall comply with Subsections <xref depth="4" refnumber="10-2a-502(1)"><ln numlevel="1" lineno="569" slineno="6-23"/>10-2a-502(1)</xref> through <xref depth="4" refnumber="10-2a-505(4)">(4)</xref>.</subsection><subsection ssid="10-null-12" dnum="d-o" numlevel="1" lineno="570" slineno="6-24" level="2"><display>(d)</display>Within 20 days after the day on which the lieutenant governor receives the modified <ln numlevel="1" lineno="571" slineno="6-25"/>request, the lieutenant governor shall follow the same procedure described in <ln numlevel="1" lineno="572" slineno="6-26"/>Subsections <xref depth="4" refnumber="10-2a-503(1)">10-2a-503(1)</xref> through <xref depth="4" refnumber="10-2a-505(4)">(4)</xref> for the modified feasibility request as for an <ln numlevel="1" lineno="573" slineno="6-27"/>original feasibility request.</subsection></subsection><subsection ssid="10-null-13" dnum="2-o" numlevel="1" lineno="574" slineno="6-28" level="1"><display>(2)</display>The timely filing of a modified feasibility request under Subsection <xref depth="4" refnumber="10-2a-505(1)">(1)</xref> gives the <ln numlevel="1" lineno="575" slineno="6-29"/>modified feasibility request the same processing priority under Subsection <xref depth="4" refnumber="10-2a-503(6)">10-2a-503(6)</xref> <ln numlevel="1" lineno="576" slineno="6-30"/>as the original feasibility request.</subsection><subsection ssid="10-null-14" dnum="3-o" numlevel="1" lineno="577" slineno="6-31" level="1"><display>(3)</display>The sponsors of a feasibility request may not file a modified feasibility request under <ln numlevel="1" lineno="578" slineno="6-32"/>Subsection <xref depth="4" refnumber="10-2a-505(1)(a)(i)">(1)(a)(i)</xref> more than once.</subsection><subsection ssid="10-null-15" dnum="4-o" numlevel="1" lineno="579" slineno="6-33" level="1"><display>(4)</display>Within 10 days after the day on which the county clerk receives a modified feasibility <ln numlevel="1" lineno="580" slineno="6-34"/>request under Subsection <xref depth="4" refnumber="10-2a-505(1)(a)">(1)(a)</xref> that relates to a request for which a feasibility study has <ln numlevel="1" lineno="581" slineno="6-35"/>already been completed, the lieutenant governor shall commission the feasibility <ln numlevel="1" lineno="582" slineno="6-36"/>consultant who conducted the feasibility study to conduct a supplemental feasibility <ln numlevel="1" lineno="583" slineno="6-37"/>study that accounts for the modified feasibility request.</subsection><subsection ssid="10-null-16" dnum="5-o" numlevel="1" lineno="584" slineno="6-38" level="1"><display>(5)</display>The lieutenant governor shall require the feasibility consultant to:<subsection ssid="10-null-17" dnum="a-o" numlevel="1" lineno="585" slineno="6-39" level="2"><display>(a)</display><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">comply with the requirement to:</amend><subsection ssid="10-29" dnum="_-o:i-i" numlevel="1" lineno="586" slineno="6-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1247" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">consider data, information, and analysis provided by the county as described in <ln numlevel="1" lineno="587" slineno="6-41"/>Subsection <xref depth="4" refnumber="10-2a-504(4)">10-2a-504(4)</xref>; and</amend></subsection><subsection ssid="10-30" dnum="_-o:ii-i" numlevel="1" lineno="588" slineno="6-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1248" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">only use data, information, and analysis that meets the requirements of <ln numlevel="1" lineno="589" slineno="6-43"/>Subsection <xref depth="4" refnumber="10-2a-504(5)">10-2a-504(5)</xref>;</amend></subsection></subsection><subsection ssid="10-28" dnum="_-o:b-i" numlevel="1" lineno="590" slineno="6-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1249" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>submit a draft of the supplemental feasibility study to each applicable person with <ln numlevel="1" lineno="591" slineno="6-45"/>whom the feasibility consultant is required to consult under Subsection <xref depth="4" refnumber="10-2a-504(3)(c)"><ln numlevel="1" lineno="592" slineno="6-46"/>10-2a-504(3)(c)</xref> within <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both">30</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="34" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">45</amend> days after the day on which the feasibility consultant <ln numlevel="1" lineno="593" slineno="6-47"/>is engaged to conduct the supplemental study;</subsection><subsection ssid="10-null-18" dnum="b-o:c-i" numlevel="1" lineno="594" slineno="6-48" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1250" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1251" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>allow each person to whom the consultant provided a draft under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="10-2a-505(5)(b)"><ln numlevel="1" lineno="595" slineno="6-49"/>(5)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(5)(b)</amend> to review and provide comment on the draft; and</subsection><subsection ssid="10-null-19" dnum="c-o:d-i" numlevel="1" lineno="596" slineno="6-50" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1251" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1252" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>submit <amend anum="0" ea="amend" pairid="22" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both">on the same day </amend>a completed supplemental feasibility study, to the <ln numlevel="1" lineno="597" slineno="6-51"/>following within <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="33" style="2" owner="jchristopherson" level="1" deltag="both">45</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="35" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">60</amend> days after the day on which the feasibility consultant is <ln numlevel="1" lineno="598" slineno="6-52"/>engaged to conduct the feasibility study:<subsection ssid="10-null-20" dnum="i-o" numlevel="1" lineno="599" slineno="6-53" level="3"><display>(i)</display>the lieutenant governor;</subsection><subsection ssid="10-null-21" dnum="ii-o" numlevel="1" lineno="600" slineno="6-54" level="3"><display>(ii)</display>the county legislative body of the county in which the incorporation is proposed;</subsection><subsection ssid="10-null-22" dnum="iii-o" numlevel="1" lineno="601" slineno="6-55" level="3"><display>(iii)</display>the primary sponsor contact; and</subsection><subsection ssid="10-null-23" dnum="iv-o" numlevel="1" lineno="602" slineno="6-56" level="3"><display>(iv)</display>each person to whom the consultant provided a draft under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="10-2a-505(5)(b)">(5)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="603" slineno="6-57"/>(5)(b)</amend>.</subsection></subsection></subsection><subsection ssid="10-null-24" dnum="6-o" numlevel="1" lineno="604" slineno="6-58" level="1" space="false"><display>(6)</display><subsection ssid="10-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsections <xref depth="4" refnumber="10-2a-505(3)">(3)</xref> and <xref depth="4" refnumber="10-2a-505(6)(b)">(6)(b)</xref>, if the results of the supplemental feasibility <ln numlevel="1" lineno="605" slineno="6-59"/>study do not comply with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">10-2a-504(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="10-2a-504(5)">10-2a-504(5)</xref></amend>, the sponsors may <ln numlevel="1" lineno="606" slineno="6-60"/>further modify the request in accordance with Subsection <xref depth="4" refnumber="10-2a-505(1)">(1)</xref>.</subsection><subsection ssid="10-null-26" dnum="b-o" numlevel="1" lineno="607" slineno="6-61" level="2"><display>(b)</display>Subsections <xref depth="4" refnumber="10-2a-505(1)(d)">(1)(d)</xref>, (4), and (5) apply to a modified feasibility request described in <ln numlevel="1" lineno="608" slineno="6-62"/>Subsection <xref depth="4" refnumber="10-2a-505(6)(a)">(6)(a)</xref>.</subsection><subsection ssid="10-null-27" dnum="c-o" numlevel="1" lineno="609" slineno="6-63" level="2"><display>(c)</display>The lieutenant governor shall consider a modified feasibility request described in <ln numlevel="1" lineno="610" slineno="6-64"/>Subsection <xref depth="4" refnumber="10-2a-505(6)(a)">(6)(a)</xref> as an original feasibility request for purposes of determining the <ln numlevel="1" lineno="611" slineno="6-65"/>modified feasibility request's processing priority under Subsection <xref depth="4" refnumber="10-2a-503(6)">10-2a-503(6)</xref>.</subsection></subsection></section></bsec><bsec buid="14" num="10-2a-505.5" type="enact" src="code" uid="C10-2a-S505.5_2026050620260506" sort="10 02a05050520260506" numlevel="1" lineno="612" slineno="7-1" sn="7"><section numlevel="1" lineno="613" slineno="7-2" number="10-2a-505.5" type="enact"><secline lineno="612">Section 7. Section <bold>10-2a-505.5</bold> is enacted to read:</secline><catline lineno="613"><bold>10-2a-505.5<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. County audit of a feasibility study or <ln numlevel="1" lineno="614" slineno="7-3"/>supplemental feasibility study.</bold></catline><subsection ssid="14-1" dnum="_-o:1-i" numlevel="1" lineno="615" slineno="7-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1260" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">Upon receipt of a complete feasibility study under Section <xref depth="3" refnumber="10-2a-504">10-2a-504</xref> or a complete <ln numlevel="1" lineno="616" slineno="7-5"/>supplemental feasibility study under Section <xref depth="3" refnumber="10-2a-505">10-2a-505</xref>, the county shall post the study <ln numlevel="1" lineno="617" slineno="7-6"/>or a summary of the study on the county website within one business day of receipt.</amend></subsection><subsection ssid="14-2" dnum="_-o:2-i" numlevel="1" lineno="618" slineno="7-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1261" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">The county may, at the county's own cost, hire a consultant to:</amend><subsection ssid="14-9" dnum="_-o:a-i" numlevel="1" lineno="619" slineno="7-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1262" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">audit the feasibility study or supplemental feasibility study; and</amend></subsection><subsection ssid="14-10" dnum="_-o:b-i" numlevel="1" lineno="620" slineno="7-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1263" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">provide a written report on the feasibility study or supplemental feasibility study that <ln numlevel="1" lineno="621" slineno="7-10"/>confirms or disputes the results of the study.</amend></subsection></subsection></section></bsec><bsec buid="12" num="10-2a-506" type="amend" src="code" uid="C10-2a-S506_2026050620260506" sort="10 02a05060020260506" numlevel="1" lineno="622" slineno="8-1" sn="8"><section number="10-2a-506" numlevel="1" lineno="623" slineno="8-2" type="amend"><secline lineno="622">Section 8. Public hearings on feasibility <ln numlevel="1" lineno="624" slineno="8-3"/>study results -- Notice of hearings.</bold></catline><subsection ssid="12-null-1" dnum="1-o" numlevel="1" lineno="625" slineno="8-4" level="1" placement="noreturn"><display>(1)</display>If the results of the feasibility study or supplemental feasibility study comply with <ln numlevel="1" lineno="626" slineno="8-5"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">10-2a-504(4), </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="143" groupid="112" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="10-2a-504(5)">10-2a-504(5)</xref>, </amend>the lieutenant governor shall, after receipt of <ln numlevel="1" lineno="627" slineno="8-6"/>the results of the feasibility study or supplemental feasibility study, conduct public <ln numlevel="1" lineno="628" slineno="8-7"/>hearings in accordance with this section.</subsection><subsection ssid="12-null-2" dnum="2-o" numlevel="1" lineno="629" slineno="8-8" level="1" space="false"><display>(2)</display><subsection ssid="12-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a portion of the proposed preliminary municipality area is approved for <ln numlevel="1" lineno="630" slineno="8-9"/>annexation after the feasibility study or supplemental feasibility study is conducted <ln numlevel="1" lineno="631" slineno="8-10"/>but before the lieutenant governor conducts a public hearing under Subsection <xref depth="4" refnumber="10-2a-506(4)">(4)</xref>, <ln numlevel="1" lineno="632" slineno="8-11"/>the lieutenant governor may not conduct the public hearing under Subsection <xref depth="4" refnumber="10-2a-506(4)">(4)</xref> <ln numlevel="1" lineno="633" slineno="8-12"/>unless:<subsection ssid="12-null-4" dnum="i-o" numlevel="1" lineno="634" slineno="8-13" level="3" tab="1"><display>(i)</display>the sponsors of the feasibility study file a modified feasibility request in <ln numlevel="1" lineno="635" slineno="8-14"/>accordance with Section <xref depth="3" refnumber="10-2a-505">10-2a-505</xref>; and</subsection><subsection ssid="12-null-5" dnum="ii-o" numlevel="1" lineno="636" slineno="8-15" level="3" tab="1"><display>(ii)</display>the results of the supplemental feasibility study comply with Subsection <xref depth="4" refnumber="10-2a-504(4)"><ln numlevel="1" lineno="637" slineno="8-16"/>10-2a-504(4)</xref>.</subsection></subsection><subsection ssid="12-null-6" dnum="b-o" numlevel="1" lineno="638" slineno="8-17" level="2"><display>(b)</display>For purposes of Subsection <xref depth="4" refnumber="10-2a-506(2)(a)">(2)(a)</xref>, an area is approved for annexation if a municipal <ln numlevel="1" lineno="639" slineno="8-18"/>legislative body:<subsection ssid="12-null-7" dnum="i-o" numlevel="1" lineno="640" slineno="8-19" level="3"><display>(i)</display>approves an annexation petition proposing the annexation of an area that is part of <ln numlevel="1" lineno="641" slineno="8-20"/>the proposed preliminary municipality area under Section <xref depth="3" refnumber="10-2-810">10-2-810</xref> or <xref depth="3" refnumber="10-2-811">10-2-811</xref>; or</subsection><subsection ssid="12-null-8" dnum="ii-o" numlevel="1" lineno="642" slineno="8-21" level="3"><display>(ii)</display>adopts an ordinance approving the annexation of an area that is part of the <ln numlevel="1" lineno="643" slineno="8-22"/>proposed preliminary municipality area under Section <xref depth="3" refnumber="10-2-812">10-2-812</xref>.</subsection></subsection></subsection><subsection ssid="12-null-9" dnum="3-o" numlevel="1" lineno="644" slineno="8-23" level="1"><display>(3)</display>The lieutenant governor shall conduct a public hearing:<subsection ssid="12-null-10" dnum="a-o" numlevel="1" lineno="645" slineno="8-24" level="2"><display>(a)</display>within 60 days after the day on which the lieutenant governor receives the results <ln numlevel="1" lineno="646" slineno="8-25"/>under Subsection <xref depth="4" refnumber="10-2a-506(1)">(1)</xref> or <xref depth="4" refnumber="10-2a-506(2)(a)(ii)">(2)(a)(ii)</xref>;</subsection><subsection ssid="12-null-11" dnum="b-o" numlevel="1" lineno="647" slineno="8-26" level="2"><display>(b)</display>at a location within or near the proposed preliminary municipality; and</subsection><subsection ssid="12-null-12" dnum="c-o" numlevel="1" lineno="648" slineno="8-27" level="2"><display>(c)</display>to allow the feasibility consultant to present the results of the feasibility study and <ln numlevel="1" lineno="649" slineno="8-28"/>inform the public about the results.</subsection></subsection><subsection ssid="12-null-13" dnum="4-o" numlevel="1" lineno="650" slineno="8-29" level="1"><display>(4)</display>The lieutenant governor shall:<subsection ssid="12-null-14" dnum="a-o" numlevel="1" lineno="651" slineno="8-30" level="2"><display>(a)</display>conduct an additional public hearing following each occasion when, after the day of <ln numlevel="1" lineno="652" slineno="8-31"/>the initial public hearing, the lieutenant governor receives the results of a <ln numlevel="1" lineno="653" slineno="8-32"/>supplemental feasibility study that comply with Subsection <xref depth="4" refnumber="10-2a-504(4)">10-2a-504(4)</xref>; and</subsection><subsection ssid="12-null-15" dnum="b-o" numlevel="1" lineno="654" slineno="8-33" level="2"><display>(b)</display>hold the public hearing described in Subsection <xref depth="4" refnumber="10-2a-506(4)(a)">(4)(a)</xref>:<subsection ssid="12-null-16" dnum="i-o" numlevel="1" lineno="655" slineno="8-34" level="3"><display>(i)</display>within 30 days after the day on which the lieutenant governor receives the results <ln numlevel="1" lineno="656" slineno="8-35"/>of the supplemental feasibility study;</subsection><subsection ssid="12-null-17" dnum="ii-o" numlevel="1" lineno="657" slineno="8-36" level="3"><display>(ii)</display>at a location within or near the proposed preliminary municipality;</subsection><subsection ssid="12-null-18" dnum="iii-o" numlevel="1" lineno="658" slineno="8-37" level="3"><display>(iii)</display>to inform the public that the feasibility presented to the public at the preceding <ln numlevel="1" lineno="659" slineno="8-38"/>public hearing does not apply; and</subsection><subsection ssid="12-null-19" dnum="iv-o" numlevel="1" lineno="660" slineno="8-39" level="3"><display>(iv)</display>to allow the feasibility consultant to present the results of the supplemental <ln numlevel="1" lineno="661" slineno="8-40"/>feasibility study and inform the public about the results.</subsection></subsection></subsection><subsection ssid="12-null-20" dnum="5-o" numlevel="1" lineno="662" slineno="8-41" level="1"><display>(5)</display>At each public hearing required under this section, the lieutenant governor shall:<subsection ssid="12-null-21" dnum="a-o" numlevel="1" lineno="663" slineno="8-42" level="2"><display>(a)</display>provide a map or plat of the boundary of the proposed preliminary municipality;</subsection><subsection ssid="12-null-22" dnum="b-o" numlevel="1" lineno="664" slineno="8-43" level="2"><display>(b)</display>provide a copy of the applicable feasibility study for public review;</subsection><subsection ssid="12-null-23" dnum="c-o" numlevel="1" lineno="665" slineno="8-44" level="2"><display>(c)</display>allow members of the public to express views about the proposed preliminary <ln numlevel="1" lineno="666" slineno="8-45"/>municipality, including views about the proposed boundaries; and</subsection><subsection ssid="12-null-24" dnum="d-o" numlevel="1" lineno="667" slineno="8-46" level="2"><display>(d)</display>allow the public to ask the feasibility consultant questions about the applicable <ln numlevel="1" lineno="668" slineno="8-47"/>feasibility study.</subsection></subsection><subsection ssid="12-null-25" dnum="6-o" numlevel="1" lineno="669" slineno="8-48" level="1"><display>(6)</display>The lieutenant governor shall publish notice of each public hearing required under this <ln numlevel="1" lineno="670" slineno="8-49"/>section for the proposed preliminary municipality area, as a class B notice under Section <xref depth="3" refnumber="63G-30-102"><ln numlevel="1" lineno="671" slineno="8-50"/>63G-30-102</xref>, for at least three weeks before the day of the public hearing.</subsection><subsection ssid="12-null-26" dnum="7-o" numlevel="1" lineno="672" slineno="8-51" level="1" space="false"><display>(7)</display><subsection ssid="12-null-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="10-2a-506(7)(b)">(7)(b)</xref>, for a hearing described in this section, <ln numlevel="1" lineno="673" slineno="8-52"/>the notice described in Subsection <xref depth="4" refnumber="10-2a-506(6)">(6)</xref> shall:<subsection ssid="12-null-28" dnum="i-o" numlevel="1" lineno="674" slineno="8-53" level="3" tab="1"><display>(i)</display>include the feasibility study summary described in Subsection <xref depth="4" refnumber="10-2a-504(2)(c)(iii)">10-2a-504(2)(c)(iii)</xref>; <ln numlevel="1" lineno="675" slineno="8-54"/>and</subsection><subsection ssid="12-null-29" dnum="ii-o" numlevel="1" lineno="676" slineno="8-55" level="3" tab="1"><display>(ii)</display>indicate that a full copy of the feasibility study is available on the lieutenant <ln numlevel="1" lineno="677" slineno="8-56"/>governor's website and for inspection at the lieutenant governor's office.</subsection></subsection><subsection ssid="12-null-30" dnum="b-o" numlevel="1" lineno="678" slineno="8-57" level="2"><display>(b)</display>Instead of publishing the feasibility summary under Subsection <xref depth="4" refnumber="10-2a-506(7)(a)(i)">(7)(a)(i)</xref>, the <ln numlevel="1" lineno="679" slineno="8-58"/>lieutenant governor may publish a statement that specifies the following sources <ln numlevel="1" lineno="680" slineno="8-59"/>where a person may view or obtain a copy of the feasibility study:<subsection ssid="12-null-31" dnum="i-o" numlevel="1" lineno="681" slineno="8-60" level="3"><display>(i)</display>the lieutenant governor's website;</subsection><subsection ssid="12-null-32" dnum="ii-o" numlevel="1" lineno="682" slineno="8-61" level="3"><display>(ii)</display>the lieutenant governor's office; and</subsection><subsection ssid="12-null-33" dnum="iii-o" numlevel="1" lineno="683" slineno="8-62" level="3"><display>(iii)</display>a mailing address and telephone number.</subsection></subsection></subsection></section></bsec><bsec buid="18" num="10-2a-507" type="amend" src="code" uid="C10-2a-S507_2026050620260506" sort="10 02a05070020260506" numlevel="1" lineno="684" slineno="9-1" sn="9"><section number="10-2a-507" numlevel="1" lineno="685" slineno="9-2" type="amend"><secline lineno="684">Section 9. level="1" placement="noreturn"><display>(1)</display>At any time within one year after the day on which the lieutenant governor completes <ln numlevel="1" lineno="688" slineno="9-5"/>the public hearings required under Section <xref depth="3" refnumber="10-2a-506">10-2a-506</xref>, the owners of the property who <ln numlevel="1" lineno="689" slineno="9-6"/>filed the feasibility request under Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref> for the proposed preliminary <ln numlevel="1" lineno="690" slineno="9-7"/>municipality area may proceed with the incorporation process by filing a petition for <ln numlevel="1" lineno="691" slineno="9-8"/>incorporation of the proposed preliminary municipality that:<subsection ssid="18-null-2" dnum="a-o" numlevel="1" lineno="692" slineno="9-9" level="2"><display>(a)</display>includes the typed or printed name, signature, address, and phone number of the <ln numlevel="1" lineno="693" slineno="9-10"/>initial landowners;</subsection><subsection ssid="18-null-3" dnum="b-o" numlevel="1" lineno="694" slineno="9-11" level="2"><display>(b)</display>describes the proposed preliminary municipality area, as described in the feasibility <ln numlevel="1" lineno="695" slineno="9-12"/>request or the modified feasibility request;</subsection><subsection ssid="18-null-4" dnum="c-o" numlevel="1" lineno="696" slineno="9-13" level="2"><display>(c)</display>demonstrates compliance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="2"><display>(f)</display>designates the board chair and three of the four board members who will serve as a <ln numlevel="1" lineno="700" slineno="9-17"/>five member council form of government for the preliminary municipality, described <ln numlevel="1" lineno="701" slineno="9-18"/>in Section <xref depth="3" refnumber="10-3b-402">10-3b-402</xref>, for the preliminary municipality;</subsection><subsection ssid="18-null-8" dnum="g-o" numlevel="1" lineno="702" slineno="9-19" level="2"><display>(g)</display>is accompanied by an accurate map or plat, prepared by a licensed surveyor, <amend anum="0" ea="amend" pairid="25" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both">that <ln numlevel="1" lineno="703" slineno="9-20"/>conforms to the information, including planning and phasing, that was included in the <ln numlevel="1" lineno="704" slineno="9-21"/>certified feasibility request </amend>showing:<subsection ssid="18-null-9" dnum="i-o" numlevel="1" lineno="705" slineno="9-22" level="3"><display>(i)</display>the boundaries of the proposed preliminary municipality;</subsection><subsection ssid="18-null-10" dnum="ii-o" slineno="9-24"/>the development;<amend anum="0" ea="amend" pairid="125" groupid="103" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend></subsection><subsection ssid="18-46" dnum="_-o:iii-i" numlevel="1" lineno="708" slineno="9-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1307" style="1" owner="i" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1310" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">is in favor of the county in which the preliminary municipality area is located, up <ln numlevel="1" lineno="714" slineno="9-31"/>and until the time the preliminary municipality is incorporated as a town, to <ln numlevel="1" lineno="715" slineno="9-32"/>guarantee that the initial landowners will complete any infrastructure for which <ln numlevel="1" lineno="716" slineno="9-33"/>construction has <marker pairid="151"/>begun or which is necessary, under state law or county ordinance, <ln numlevel="1" lineno="717" slineno="9-34"/>for any developed parcels;</amend></subsection><subsection ssid="18-null-13" dnum="ii-o:iii-i" numlevel="1" lineno="718" slineno="9-35" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1311" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1312" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>is in favor of the<amend anum="0" ea="amend" pairid="39" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="both"> town that is incorporated from the</amend> proposed preliminary <ln numlevel="1" lineno="719" slineno="9-36"/>municipality, to guarantee that the initial landowners will complete the system <ln numlevel="1" lineno="720" slineno="9-37"/>infrastructure no later than six years after the day on which the initial landowners <ln numlevel="1" lineno="721" slineno="9-38"/>file the petition for incorporation described in this section;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="40" groupid="35" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="18-null-14" dnum="iii-o:iv-i" numlevel="1" lineno="722" slineno="9-39" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1312" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1313" style="1" owner="i" level="1" amendtag="start" space="true">(iv)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="122" style="1" owner="jchristopherson" level="1" amendtag="end">meets the requirements of Subsection <xref depth="4" slineno="9-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1314" style="1" owner="i" level="1" amendtag="both">(vi)</amend></display>will be refunded to the initial landowners in percentages that reflect the progress <ln numlevel="1" lineno="725" slineno="9-42"/>toward completing the system infrastructure;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="150" groupid="123" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="18-null-15" dnum="i-o" numlevel="1" lineno="726" slineno="9-43" level="2"><display>(i)</display><amend anum="0" ea="amend" pairid="77" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="both">is accompanied by an executed improvement warranty for the improvement warranty <ln numlevel="1" lineno="727" slineno="9-44"/>period, which may be a cash deposit, surety bond, letter of credit, or other similar <ln numlevel="1" lineno="728" slineno="9-45"/>security, as required by the county, in the amount of up to 10% of the lesser of the:</amend><subsection ssid="18-38" dnum="_-o:i-i" numlevel="1" lineno="729" slineno="9-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1316" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">county engineer's estimated cost of completion; or</amend></subsection><subsection ssid="18-39" dnum="_-o:ii-i" numlevel="1" lineno="730" slineno="9-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1317" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="73" style="1" owner="jchristopherson" level="1" m-anum="0" m-ea="amend" m-pairid="83" m-groupid="71" m-style="1" m-owner="jchristopherson" m-level="1" amendtag="end">the initial landowner's reasonable proven cost of completion;</amend></subsection></subsection><subsection ssid="18-37" dnum="_-o:j-i" numlevel="1" lineno="731" slineno="9-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1318" style="1" owner="i" level="1" amendtag="both">(j)</amend></display>is accompanied by payment in full, from the initial landowners, of the costs incurred <ln numlevel="1" lineno="732" slineno="9-49"/>by the lieutenant governor for the feasibility study, the public notices, the hearings, <ln numlevel="1" lineno="733" slineno="9-50"/>and the other expenses incurred by the lieutenant governor to comply with the <ln numlevel="1" lineno="734" slineno="9-51"/>requirements of this part in relation to the proposed preliminary municipality<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="58" groupid="50" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="56" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="18-33" dnum="_-o:k-i" numlevel="1" lineno="735" slineno="9-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1319" style="1" owner="i" level="1" amendtag="start">(k)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">includes a signed certification indicating that the sponsor will develop the <ln numlevel="1" lineno="736" slineno="9-53"/>preliminary municipality in accordance with the description in the certified feasibility <ln numlevel="1" lineno="737" slineno="9-54"/>request, or an alternate description included in the certified feasibility request, subject <ln numlevel="1" lineno="738" slineno="9-55"/>to conditions identified in the final feasibility study, including the overall master plan <ln numlevel="1" lineno="739" slineno="9-56"/>layout, number of housing units, build schedule phasing, affordable housing <ln numlevel="1" lineno="740" slineno="9-57"/>requirements, and structure described in Subsection <xref depth="4" refnumber="10-2a-507(1)(g)(iii)">(1)(g)(iii)</xref>.</amend></subsection></subsection><subsection ssid="18-null-16" dnum="2-o" numlevel="1" lineno="741" slineno="9-58" level="1" space="false"><display>(2)</display><subsection ssid="18-40" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1321" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>If, within six years after the day on which the initial landowners file a petition for <ln numlevel="1" lineno="742" slineno="9-59"/>incorporation under Subsection <xref depth="4" refnumber="10-2a-507(1)">(1)</xref>, the system infrastructure for the preliminary <ln numlevel="1" lineno="743" slineno="9-60"/>municipality is not completed, the portion of the bond, cash deposit, or letter of credit <ln numlevel="1" lineno="744" slineno="9-61"/>described in Subsection <xref depth="4" refnumber="10-2a-507(1)(h)">(1)(h)</xref> that has not been refunded to the initial landowners <ln numlevel="1" lineno="745" slineno="9-62"/>shall forfeit to<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="116" groupid="95" style="2" owner="jchristopherson" level="1" deltag="both"> the preliminary municipality</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="64" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="18-34" dnum="_-o:i-i" numlevel="1" lineno="746" slineno="9-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1322" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">the county, if the preliminary municipality has not incorporated as a town; or</amend></subsection><subsection ssid="18-35" dnum="_-o:ii-i" numlevel="1" lineno="747" slineno="9-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1323" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">the town</amend>.</subsection></subsection><subsection ssid="18-41" dnum="_-o:b-i" numlevel="1" lineno="748" slineno="9-65" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1324" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="end">If, within the improvement warranty period, an improvement is not completed, fails, <ln numlevel="1" lineno="749" slineno="9-66"/>or is demonstrated to be faulty or substandard, the executed improvement warranty <ln numlevel="1" lineno="750" slineno="9-67"/>described in Subsection <xref depth="4" refnumber="10-2a-507(1)(i)">(1)(i)</xref> shall forfeit to:</amend><subsection ssid="18-44" dnum="_-o:i-i" numlevel="1" lineno="751" slineno="9-68" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1325" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="end">the county, if the preliminary municipality has not incorporated as a town; or</amend></subsection><subsection ssid="18-45" dnum="_-o:ii-i" numlevel="1" lineno="752" slineno="9-69" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1326" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="114" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="end">the town.</amend></subsection></subsection></subsection><subsection ssid="18-null-17" dnum="3-o" numlevel="1" lineno="753" slineno="9-70" level="1"><display>(3)</display>If, within four years after the day on which the first residential certificate of occupancy <ln numlevel="1" lineno="754" slineno="9-71"/>is issued for the development described in Subsection <xref depth="4" refnumber="10-2a-503(5)(e)">10-2a-503(5)(e)</xref>, or six years after <ln numlevel="1" lineno="755" slineno="9-72"/>the day on which the initial landowners file a petition for incorporation under Subsection <xref depth="4" refnumber="10-2a-507(1)"><ln numlevel="1" lineno="756" slineno="9-73"/>(1)</xref>, the preliminary municipality has not transitioned to a town:<subsection ssid="18-null-18" dnum="a-o" numlevel="1" lineno="757" slineno="9-74" level="2"><display>(a)</display>the lieutenant governor shall issue a certificate dissolving the preliminary <ln numlevel="1" lineno="758" slineno="9-75"/>municipality;</subsection><subsection ssid="18-null-19" dnum="b-o" numlevel="1" lineno="759" slineno="9-76" level="2"><display>(b)</display>all roads and infrastructure within the preliminary municipality revert to the county <ln numlevel="1" lineno="760" slineno="9-77"/>in which the preliminary municipality is located;</subsection><subsection ssid="18-null-20" dnum="c-o" numlevel="1" lineno="761" slineno="9-78" level="2"><display>(c)</display>the area within the proposed municipality falls under the jurisdiction of the county <ln numlevel="1" lineno="762" slineno="9-79"/>and is no longer incorporated; and</subsection><subsection ssid="18-null-21" dnum="d-o" numlevel="1" lineno="763" slineno="9-80" level="2"><display>(d)</display>the initial landowners are liable to the county for damages caused to the county due <ln numlevel="1" lineno="764" slineno="9-81"/>to the dissolution of the preliminary municipality.</subsection></subsection><subsection ssid="18-47" dnum="_-o:4-i" numlevel="1" lineno="765" slineno="9-82" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1332" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">The amount of the bond, cash deposit, or letter of credit required by Subsection <xref depth="4" refnumber="10-2a-507(1)(h)">(1)(h)</xref> <ln numlevel="1" lineno="766" slineno="9-83"/>shall be determined:</amend><subsection ssid="18-48" dnum="_-o:a-i" numlevel="1" lineno="767" slineno="9-84" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1333" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="110" style="1" owner="jchristopherson" level="1" amendtag="end">based on engineering estimates or construction bids; and</amend></subsection><subsection ssid="18-49" dnum="_-o:b-i" numlevel="1" lineno="768" slineno="9-85" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1334" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="114" style="1" owner="jchristopherson" level="1" amendtag="end">by an independent financial or risk management consultant retained by the county, <ln numlevel="1" lineno="769" slineno="9-86"/>subject to consultation with the sponsor.</amend></subsection></subsection><subsection ssid="18-43" dnum="_-o:5-i" numlevel="1" lineno="770" slineno="9-87" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1335" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">The improvement warranty period and improvement warranty described in Subsection <xref depth="4" refnumber="10-2a-507(1)(i)"><ln numlevel="1" lineno="771" slineno="9-88"/>(1)(i)</xref> shall be determined by the county for each type of improvement, according to the <ln numlevel="1" lineno="772" slineno="9-89"/>same standards and requirements the county utilizes under Sections <xref depth="3" refnumber="17-79-707">17-79-707</xref> and <xref depth="3" refnumber="17-79-805"><ln numlevel="1" lineno="773" slineno="9-90"/>17-79-805</xref>.</amend></subsection></section></bsec><bsec buid="20" num="10-2a-508" type="amend" src="code" uid="C10-2a-S508_2026050620260506" sort="10 02a05080020260506" numlevel="1" lineno="774" slineno="10-1" sn="10"><section number="10-2a-508" numlevel="1" lineno="775" slineno="10-2" type="amend"><secline lineno="774">Section 10. Section <bold>10-2a-508</bold> is amended to read:</secline><catline lineno="775"><bold>10-2a-508<parens><paren sort="00" type="original" show="true" display="space"><effect>Effective </effect><date>05/06/26</date></paren><paren sort="00" type="original" show="true"><effect>Repealed </effect><date>01/01/31</date></paren></parens>. Processing of petition by <ln numlevel="1" lineno="776" slineno="10-3"/>lieutenant governor -- Certification or rejection -- Petition modification.</bold></catline><subsection ssid="20-null-1" dnum="1-o" numlevel="1" lineno="777" slineno="10-4" level="1" placement="noreturn"><display>(1)</display>Within 45 days after the day on which a petition for incorporation is filed under Section <xref depth="3" refnumber="10-2a-507"><ln numlevel="1" lineno="778" slineno="10-5"/>10-2a-507</xref>, the lieutenant governor shall:<subsection ssid="20-null-2" dnum="a-o" numlevel="1" lineno="779" slineno="10-6" level="2"><display>(a)</display>determine whether the petition for incorporation complies with Section <xref depth="3" refnumber="10-2a-507">10-2a-507</xref>; <ln numlevel="1" lineno="780" slineno="10-7"/>and</subsection><subsection ssid="20-null-3" dnum="b-o" numlevel="1" lineno="781" slineno="10-8" level="2" space="false"><display>(b)</display><subsection ssid="20-null-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>if the lieutenant governor determines that the petition for incorporation <ln numlevel="1" lineno="782" slineno="10-9"/>complies with Section <xref depth="3" refnumber="10-2a-507">10-2a-507</xref>, incorporate the preliminary municipality, issue <ln numlevel="1" lineno="783" slineno="10-10"/>a certificate of incorporation, and appoint the board chair and three board <ln numlevel="1" lineno="784" slineno="10-11"/>members designated under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">10-2a-507(1)(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="10-2a-507(1)(f)">10-2a-507(1)(f)</xref></amend>; or</subsection><subsection ssid="20-null-5" dnum="ii-o" numlevel="1" lineno="785" slineno="10-12" level="3"><display>(ii)</display>if the lieutenant governor determines that the petition for incorporation fails to <ln numlevel="1" lineno="786" slineno="10-13"/>comply with Section <xref depth="3" refnumber="10-2a-507">10-2a-507</xref>, reject the petition for incorporation and notify the <ln numlevel="1" lineno="787" slineno="10-14"/>primary sponsor contact in writing of the rejection and the reasons for the <ln numlevel="1" lineno="788" slineno="10-15"/>rejection.</subsection></subsection></subsection><subsection ssid="20-null-6" dnum="2-o" numlevel="1" lineno="789" slineno="10-16" level="1" space="false"><display>(2)</display><subsection ssid="20-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the lieutenant governor rejects a petition for incorporation under Subsection <xref depth="4" refnumber="10-2a-508(1)(b)(ii)"><ln numlevel="1" lineno="790" slineno="10-17"/>(1)(b)(ii)</xref>, the sponsors of the petition for incorporation may correct the deficiencies <ln numlevel="1" lineno="791" slineno="10-18"/>for which the petition for incorporation was rejected and refile the petition for <ln numlevel="1" lineno="792" slineno="10-19"/>incorporation with the lieutenant governor.</subsection><subsection ssid="20-null-8" dnum="b-o" numlevel="1" lineno="793" slineno="10-20" level="2"><display>(b)</display>Notwithstanding the deadline described in Subsection <xref depth="4" refnumber="10-2a-507(1)">10-2a-507(1)</xref>, the sponsors of <ln numlevel="1" lineno="794" slineno="10-21"/>the petition for incorporation may file a modified petition for incorporation under <ln numlevel="1" lineno="795" slineno="10-22"/>Subsection <xref depth="4" refnumber="10-2a-508(2)(a)">(2)(a)</xref> no later than 30 days after the day on which the lieutenant governor <ln numlevel="1" lineno="796" slineno="10-23"/>notifies the primary sponsor contact of the rejection under Subsection <xref depth="4" refnumber="10-2a-508(1)(b)(ii)">(1)(b)(ii)</xref>.</subsection></subsection><subsection ssid="20-null-9" dnum="3-o" numlevel="1" lineno="797" slineno="10-24" level="1" space="false"><display>(3)</display><subsection ssid="20-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Within 20 days after the day on which the lieutenant governor receives a modified <ln numlevel="1" lineno="798" slineno="10-25"/>petition for incorporation under Subsection <xref depth="4" refnumber="10-2a-508(2)(a)">(2)(a)</xref>, the lieutenant governor shall <ln numlevel="1" lineno="799" slineno="10-26"/>review the modified petition for incorporation in accordance with Subsection <xref depth="4" refnumber="10-2a-508(1)">(1)</xref>.</subsection><subsection ssid="20-null-11" dnum="b-o" numlevel="1" lineno="800" slineno="10-27" level="2"><display>(b)</display>The sponsors of a petition for incorporation may not modify the petition for <ln numlevel="1" lineno="801" slineno="10-28"/>incorporation more than once.</subsection></subsection></section></bsec><bsec buid="22" num="10-2a-509" type="amend" src="code" uid="C10-2a-S509_2026050620260506" sort="10 02a05090020260506" numlevel="1" lineno="802" slineno="11-1" sn="11"><section number="10-2a-509" numlevel="1" lineno="803" slineno="11-2" type="amend"><secline lineno="802">Section 11. Section <bold>10-2a-509</bold> is amended to read:</secline><catline lineno="803"><bold>10-2a-509<parens><paren sort="00" type="original" show="true" display="space"><effect>Effective </effect><date>05/06/26</date></paren><paren sort="00" type="original" show="true"><effect>Repealed </effect><date>01/01/31</date></paren></parens>. Governance of preliminary <ln numlevel="1" lineno="804" slineno="11-3"/>municipality -- Utilities -- Road maintenance. </bold></catline><subsection ssid="22-null-1" dnum="1-o" numlevel="1" lineno="805" slineno="11-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="22-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Within 30 days after the day on which the lieutenant governor issues a certificate <ln numlevel="1" lineno="806" slineno="11-5"/>of incorporation described in Subsection <xref depth="4" refnumber="10-2a-508(1)(b)(i)">10-2a-508(1)(b)(i)</xref>, the county in which the <ln numlevel="1" lineno="807" slineno="11-6"/>preliminary municipality is located shall appoint one board member for the <ln numlevel="1" lineno="808" slineno="11-7"/>preliminary municipality.</subsection><subsection ssid="22-null-3" dnum="b-o" numlevel="1" lineno="809" slineno="11-8" level="2"><display>(b)</display>If the county fails to timely comply with Subsection <xref depth="4" refnumber="10-2a-509(1)(a)">(1)(a)</xref>, the board chair and the <ln numlevel="1" lineno="810" slineno="11-9"/>three board members appointed under Subsection <xref depth="4" refnumber="10-2a-508(1)(b)(i)">10-2a-508(1)(b)(i)</xref> shall, by <ln numlevel="1" lineno="811" slineno="11-10"/>majority vote, appoint the final board member.</subsection></subsection><subsection ssid="22-null-4" dnum="2-o" numlevel="1" lineno="812" slineno="11-11" level="1"><display>(2)</display>The board chair and board members, described in Subsection <xref depth="4" refnumber="10-2a-509(1)">(1)</xref>, of a preliminary <ln numlevel="1" lineno="813" slineno="11-12"/>municipality:<subsection ssid="22-null-5" dnum="a-o" numlevel="1" lineno="814" slineno="11-13" level="2"><display>(a)</display>are not required to be residents of the preliminary municipality; and</subsection><subsection ssid="22-null-6" dnum="b-o" numlevel="1" lineno="815" slineno="11-14" level="2"><display>(b)</display>shall serve as the board for the preliminary municipality until replaced by election <ln numlevel="1" lineno="816" slineno="11-15"/>under Section <xref depth="3" refnumber="10-2a-510">10-2a-510</xref>.</subsection></subsection><subsection ssid="22-null-7" dnum="3-o" numlevel="1" lineno="817" slineno="11-16" level="1" space="false"><display>(3)</display><subsection ssid="22-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Within 14 days after the day on which the first residential certificate of occupancy <ln numlevel="1" lineno="818" slineno="11-17"/>is issued for the development described in Subsection <xref depth="4" refnumber="10-2a-503(5)(e)">10-2a-503(5)(e)</xref>, the engineer <ln numlevel="1" lineno="819" slineno="11-18"/>described in Subsection <xref refnumber="10-2a-509(6)" depth="4">10-2a-509(6)</xref>, shall notify the county and the lieutenant <ln numlevel="1" lineno="820" slineno="11-19"/>governor, in writing:<subsection ssid="22-null-9" dnum="i-o" numlevel="1" lineno="821" slineno="11-20" level="3" tab="1"><display>(i)</display>that the first residential certificate of occupancy has been issued for the <ln numlevel="1" lineno="822" slineno="11-21"/>preliminary municipality;</subsection><subsection ssid="22-null-10" dnum="ii-o" numlevel="1" lineno="823" slineno="11-22" level="3" tab="1"><display>(ii)</display>of the date on which the first residential certificate of occupancy was issued; and</subsection><subsection ssid="22-null-11" dnum="iii-o" numlevel="1" lineno="824" slineno="11-23" level="3" tab="1"><display>(iii)</display>of the physical address for which the first residential certificate of occupancy <ln numlevel="1" lineno="825" slineno="11-24"/>was issued.</subsection></subsection><subsection ssid="22-null-12" dnum="b-o" numlevel="1" lineno="826" slineno="11-25" level="2"><display>(b)</display>No later than the next municipal general election, or regular general election, that is <ln numlevel="1" lineno="827" slineno="11-26"/>at least 30 days after the date described in Subsection <xref depth="4" refnumber="10-2a-509(3)(a)(ii)">(3)(a)(ii)</xref>, the initial landowners <ln numlevel="1" lineno="828" slineno="11-27"/>shall:<subsection ssid="22-null-13" dnum="i-o" numlevel="1" lineno="829" slineno="11-28" level="3"><display>(i)</display>replace the board chair or a board member with an individual who is a resident of <ln numlevel="1" lineno="830" slineno="11-29"/>the preliminary municipality; and</subsection><subsection ssid="22-null-14" dnum="ii-o" numlevel="1" lineno="831" slineno="11-30" level="3"><display>(ii)</display>notify the county and the lieutenant governor of the appointment, in writing.</subsection></subsection></subsection><subsection ssid="22-null-15" dnum="4-o" numlevel="1" lineno="832" slineno="11-31" level="1" space="false"><display>(4)</display><subsection ssid="22-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="10-2a-509(4)(b)">(4)(b)</xref>, a preliminary municipality has all the powers and <ln numlevel="1" lineno="833" slineno="11-32"/>duties of a municipality.</subsection><subsection ssid="22-null-17" dnum="b-o" numlevel="1" lineno="834" slineno="11-33" level="2"><display>(b)</display>A preliminary municipality:<subsection ssid="22-null-18" dnum="i-o" numlevel="1" lineno="835" slineno="11-34" level="3"><display>(i)</display>may not impose a tax;</subsection><subsection ssid="22-null-19" dnum="ii-o" numlevel="1" lineno="836" slineno="11-35" level="3"><display>(ii)</display>may enter into an interlocal agreement with a special district to provide utility <ln numlevel="1" lineno="837" slineno="11-36"/>services to the preliminary municipality;</subsection><subsection ssid="22-null-20" dnum="iii-o" numlevel="1" lineno="838" slineno="11-37" level="3"><display>(iii)</display>has the same authority as another municipality to make decisions regarding <ln numlevel="1" lineno="839" slineno="11-38"/>zoning and land use;</subsection><subsection ssid="22-null-21" dnum="iv-o" numlevel="1" lineno="840" slineno="11-39" level="3"><display>(iv)</display>may not receive an allocation of sales tax or gas tax; and</subsection><subsection ssid="22-null-22" dnum="v-o" numlevel="1" lineno="841" slineno="11-40" level="3"><display>(v)</display>may not exercise eminent domain authority.</subsection></subsection></subsection><subsection ssid="22-null-23" dnum="5-o" numlevel="1" lineno="842" slineno="11-41" level="1"><display>(5)</display>As needed, the county shall provide all services and utility connections to the <ln numlevel="1" lineno="843" slineno="11-42"/>preliminary municipality that the county provides other areas in the county if the <ln numlevel="1" lineno="844" slineno="11-43"/>preliminary municipality:<subsection ssid="22-null-24" dnum="a-o" numlevel="1" lineno="845" slineno="11-44" level="2"><display>(a)</display>pays the uniformly assessed rates for the services and utilities and reasonable <ln numlevel="1" lineno="846" slineno="11-45"/>connection fees; and</subsection><subsection ssid="22-null-25" dnum="b-o" numlevel="1" lineno="847" slineno="11-46" level="2"><display>(b)</display>complies with the county's established regulations and specifications for the <ln numlevel="1" lineno="848" slineno="11-47"/>construction and connection of the local improvements.</subsection></subsection><subsection ssid="22-null-26" dnum="6-o" numlevel="1" lineno="849" slineno="11-48" level="1" space="false"><display>(6)</display><subsection ssid="22-41" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1373" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>The preliminary municipality <amend anum="0" ea="amend" pairid="48" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="both">and subsequently incorporated town </amend>shall maintain <ln numlevel="1" lineno="850" slineno="11-49"/>and repair<amend anum="0" ea="amend" pairid="5" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">, or cause to be maintained and repaired,</amend> any roadway that, on the day on <ln numlevel="1" lineno="851" slineno="11-50"/>which the individual filed the feasibility request under Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>:<subsection ssid="22-null-27" dnum="a-o:i-i" numlevel="1" lineno="852" slineno="11-51" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1374" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1375" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>existed within the preliminary municipality;</subsection><subsection ssid="22-null-28" dnum="b-o:ii-i" numlevel="1" lineno="853" slineno="11-52" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1375" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1376" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>was within a public right of way that abuts the preliminary municipality; or</subsection><subsection ssid="22-null-29" dnum="c-o:iii-i" numlevel="1" lineno="854" slineno="11-53" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1376" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1377" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>was within 1/2 mile of the preliminary municipality and connected to, or <ln numlevel="1" lineno="855" slineno="11-54"/>was proposed in the feasibility request to be connected to, the preliminary <ln numlevel="1" lineno="856" slineno="11-55"/>municipality.</subsection></subsection><subsection ssid="22-42" dnum="_-o:b-i" numlevel="1" lineno="857" slineno="11-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1377" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">Roads on unincorporated land outside of the preliminary municipality area continue <ln numlevel="1" lineno="858" slineno="11-57"/>to be governed by the provisions of Title 17, Chapter 79, County Land Use, <ln numlevel="1" lineno="859" slineno="11-58"/>Development, and Management Act.</amend></subsection></subsection><subsection ssid="22-null-30" dnum="7-o" numlevel="1" lineno="860" slineno="11-59" level="1"><display>(7)</display>Before<amend anum="0" ea="amend" pairid="41" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both"> any development occurs within the preliminary municipality area or</amend> the <ln numlevel="1" lineno="861" slineno="11-60"/>preliminary municipality submits a petition to transition to a town, the preliminary <ln numlevel="1" lineno="862" slineno="11-61"/>municipality shall select an independent third-party engineer to review and approve all <ln numlevel="1" lineno="863" slineno="11-62"/>building permit applications within the preliminary municipality to ensure compliance <ln numlevel="1" lineno="864" slineno="11-63"/>with the law.</subsection><subsection ssid="22-null-31" dnum="8-o" numlevel="1" lineno="865" slineno="11-64" level="1"><display>(8)</display>Chapter 2, Classification, Boundaries, Consolidation, and Dissolution of Municipalities, <ln numlevel="1" lineno="866" slineno="11-65"/>does not apply to a preliminary municipality.</subsection></section></bsec><bsec buid="38" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="867" slineno="12-1" sn="12"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="867">Section 12.  <bold>Effective Date.</bold></secline><sectionText lineno="868"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-25-26 11:18 AM</tm></rev></foot></leg>
