Section <bold>63G-6a-506</bold> is amended to read:</secline><catline lineno="33"><bold>63G-6a-506<parens/>. Small purchases.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="34" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="35" slineno="1-4" level="2"><display>(a)</display>"Annual cumulative threshold" means the maximum total annual amount, established <ln numlevel="1" lineno="36" slineno="1-5"/>by the rulemaking authority under Subsection <xref depth="4" refnumber="63G-6a-506(2)" start="0">(2)</xref>, that a procurement unit may <ln numlevel="1" lineno="37" slineno="1-6"/>expend to obtain procurement items from the same source under this section.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="38" slineno="1-7" level="2"><display>(b)</display>"Individual procurement item threshold" means the maximum amount, established <ln numlevel="1" lineno="39" slineno="1-8"/>by the rulemaking authority under Subsection <xref depth="4" refnumber="63G-6a-506(2)" start="0">(2)</xref>, for which a procurement unit may <ln numlevel="1" lineno="40" slineno="1-9"/>purchase a procurement item under this section.</subsection><subsection ssid="3-46" dnum="_-o:c-i" numlevel="1" lineno="41" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">"Resident supplier" means the same as that term is defined in Section <xref depth="3" refnumber="63G-6a-1005">63G-6a-1005</xref>.</amend></subsection><subsection ssid="3-null-4" dnum="c-o:d-i" numlevel="1" lineno="42" slineno="1-11" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1004" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>"Single procurement aggregate threshold" means the maximum total amount, <ln numlevel="1" lineno="43" slineno="1-12"/>established by the rulemaking authority under Subsection <xref depth="4" refnumber="63G-6a-506(2)" start="0">(2)</xref>, that a procurement unit <ln numlevel="1" lineno="44" slineno="1-13"/>may expend to obtain multiple procurement items from one source at one time under <ln numlevel="1" lineno="45" slineno="1-14"/>this section.</subsection></subsection><subsection ssid="3-null-5" dnum="2-o" numlevel="1" lineno="46" slineno="1-15" level="1" space="false"><display>(2)</display><subsection ssid="3-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The rulemaking authority may make rules governing small purchases of any <ln numlevel="1" lineno="47" slineno="1-16"/>procurement item, including construction, job order contracting, design professional <ln numlevel="1" lineno="48" slineno="1-17"/>services, other professional services, information technology, and goods.</subsection><subsection ssid="3-null-7" dnum="b-o" numlevel="1" lineno="49" slineno="1-18" level="2"><display>(b)</display>Rules under Subsection <xref depth="4" refnumber="63G-6a-506(2)(a)" start="0">(2)(a)</xref> may include provisions:<subsection ssid="3-null-8" dnum="i-o" numlevel="1" lineno="50" slineno="1-19" level="3"><display>(i)</display>establishing expenditure thresholds, including:<subsection ssid="3-null-9" dnum="A-o" numlevel="1" lineno="51" slineno="1-20" level="4"><display>(A)</display>an annual cumulative threshold;</subsection><subsection ssid="3-null-10" dnum="B-o" numlevel="1" lineno="52" slineno="1-21" level="4"><display>(B)</display>an individual procurement item threshold; and</subsection><subsection ssid="3-null-11" dnum="C-o" numlevel="1" lineno="53" slineno="1-22" level="4"><display>(C)</display>a single procurement aggregate threshold;</subsection></subsection><subsection ssid="3-null-12" dnum="ii-o" numlevel="1" lineno="54" slineno="1-23" level="3"><display>(ii)</display>establishing procurement requirements relating to the thresholds described in <ln numlevel="1" lineno="55" slineno="1-24"/>Subsection <xref depth="4" refnumber="63G-6a-506(2)(b)(i)" start="0">(2)(b)(i)</xref>;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-13" dnum="iii-o" numlevel="1" lineno="56" slineno="1-25" level="3"><display>(iii)</display>providing for the use of electronic, telephone, or written quotes<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="3-45" dnum="_-o:iv-i" numlevel="1" lineno="57" slineno="1-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">encouraging procurements from resident suppliers over non-resident suppliers, <ln numlevel="1" lineno="58" slineno="1-27"/>when available.</amend></subsection></subsection><subsection ssid="3-null-14" dnum="c-o" numlevel="1" lineno="59" slineno="1-28" level="2"><display>(c)</display>If a procurement unit obtains administrative law judge service through a small <ln numlevel="1" lineno="60" slineno="1-29"/>purchase standard procurement process, rules made under Subsection <xref depth="4" refnumber="63G-6a-506(2)(a)" start="0">(2)(a)</xref> shall <ln numlevel="1" lineno="61" slineno="1-30"/>provide that the process for the procurement of administrative law judge service <ln numlevel="1" lineno="62" slineno="1-31"/>include an evaluation committee described in Subsection <xref depth="4" refnumber="63G-6a-116(3)" start="0">63G-6a-116(3)</xref>. </subsection></subsection><subsection ssid="3-null-15" dnum="3-o" numlevel="1" lineno="63" slineno="1-32" level="1"><display>(3)</display>Expenditures made under this section by a procurement unit may not exceed a threshold <ln numlevel="1" lineno="64" slineno="1-33"/>established by the rulemaking authority, unless the procurement official gives written <ln numlevel="1" lineno="65" slineno="1-34"/>authorization to exceed the threshold that includes the reasons for exceeding the <ln numlevel="1" lineno="66" slineno="1-35"/>threshold.</subsection><subsection ssid="3-null-16" dnum="4-o" numlevel="1" lineno="67" slineno="1-36" level="1"><display>(4)</display>Except as provided in Subsection <xref depth="4" refnumber="63G-6a-506(5)" start="0">(5)</xref>, an executive branch procurement unit may not <ln numlevel="1" lineno="68" slineno="1-37"/>obtain a procurement item through a small purchase standard procurement process if the <ln numlevel="1" lineno="69" slineno="1-38"/>procurement item may be obtained through a state cooperative contract or a contract <ln numlevel="1" lineno="70" slineno="1-39"/>awarded by the chief procurement officer under Subsection <xref depth="4" refnumber="63G-6a-2105(1)" start="0">63G-6a-2105(1)</xref>.</subsection><subsection ssid="3-null-17" dnum="5-o" numlevel="1" lineno="71" slineno="1-40" level="1"><display>(5)</display>Subsection <xref depth="4" refnumber="63G-6a-506(4)" start="0">(4)</xref> does not apply if:<subsection ssid="3-null-18" dnum="a-o" numlevel="1" lineno="72" slineno="1-41" level="2"><display>(a)</display>the procurement item is obtained for an unanticipated, urgent, or emergency <ln numlevel="1" lineno="73" slineno="1-42"/>condition, including:<subsection ssid="3-null-19" dnum="i-o" numlevel="1" lineno="74" slineno="1-43" level="3"><display>(i)</display>an item needed to avoid stopping a public construction project;</subsection><subsection ssid="3-null-20" dnum="ii-o" numlevel="1" lineno="75" slineno="1-44" level="3"><display>(ii)</display>an immediate repair to a facility or equipment; or</subsection><subsection ssid="3-null-21" dnum="iii-o" numlevel="1" lineno="76" slineno="1-45" level="3"><display>(iii)</display>another emergency condition; or</subsection></subsection><subsection ssid="3-null-22" dnum="b-o" numlevel="1" lineno="77" slineno="1-46" level="2"><display>(b)</display>the chief procurement officer or the procurement official of a procurement unit that <ln numlevel="1" lineno="78" slineno="1-47"/>is an executive branch procurement unit with independent procurement authority:<subsection ssid="3-null-23" dnum="i-o" numlevel="1" lineno="79" slineno="1-48" level="3"><display>(i)</display>determines in writing that it is in the best interest of the procurement unit to obtain <ln numlevel="1" lineno="80" slineno="1-49"/>an individual procurement item outside of the state contract, comparing:<subsection ssid="3-null-24" dnum="A-o" numlevel="1" lineno="81" slineno="1-50" level="4"><display>(A)</display>the contract terms and conditions applicable to the procurement item under the <ln numlevel="1" lineno="82" slineno="1-51"/>state contract with the contract terms and conditions applicable to the <ln numlevel="1" lineno="83" slineno="1-52"/>procurement item if the procurement item is obtained outside of the state <ln numlevel="1" lineno="84" slineno="1-53"/>contract;</subsection><subsection ssid="3-null-25" dnum="B-o" numlevel="1" lineno="85" slineno="1-54" level="4"><display>(B)</display>the maintenance and service applicable to the procurement item under the <ln numlevel="1" lineno="86" slineno="1-55"/>state contract with the maintenance and service applicable to the procurement <ln numlevel="1" lineno="87" slineno="1-56"/>item if the procurement item is obtained outside of the state contract;</subsection><subsection ssid="3-null-26" dnum="C-o" numlevel="1" lineno="88" slineno="1-57" level="4"><display>(C)</display>the warranties applicable to the procurement item under the state contract with <ln numlevel="1" lineno="89" slineno="1-58"/>the warranties applicable to the procurement item if the procurement item is <ln numlevel="1" lineno="90" slineno="1-59"/>obtained outside of the state contract;</subsection><subsection ssid="3-null-27" dnum="D-o" numlevel="1" lineno="91" slineno="1-60" level="4"><display>(D)</display>the quality of the procurement item under the state contract with the quality of <ln numlevel="1" lineno="92" slineno="1-61"/>the procurement item if the procurement item is obtained outside of the state <ln numlevel="1" lineno="93" slineno="1-62"/>contract; and</subsection><subsection ssid="3-null-28" dnum="E-o" numlevel="1" lineno="94" slineno="1-63" level="4"><display>(E)</display>the ability of the vendor under the state contract to match the quoted cost of <ln numlevel="1" lineno="95" slineno="1-64"/>the procurement item if the procurement item is obtained outside of the state <ln numlevel="1" lineno="96" slineno="1-65"/>contract;</subsection></subsection><subsection ssid="3-null-29" dnum="ii-o" numlevel="1" lineno="97" slineno="1-66" level="3"><display>(ii)</display>for a procurement item that, if defective in its manufacture, installation, or <ln numlevel="1" lineno="98" slineno="1-67"/>performance, may result in serious physical injury, death, or substantial property <ln numlevel="1" lineno="99" slineno="1-68"/>damage, determines in writing that the terms and conditions, relating to liability <ln numlevel="1" lineno="100" slineno="1-69"/>for injury, death, or property damage, available from the source other than the <ln numlevel="1" lineno="101" slineno="1-70"/>contractor who holds the state contract, are similar to, or better than, the terms and <ln numlevel="1" lineno="102" slineno="1-71"/>conditions available under the state contract; and</subsection><subsection ssid="3-null-30" dnum="iii-o" numlevel="1" lineno="103" slineno="1-72" level="3"><display>(iii)</display>grants an exception, in writing, to the requirement described in Subsection <xref depth="4" refnumber="63G-6a-506(4)" start="0">(4)</xref>.</subsection></subsection></subsection><subsection ssid="3-null-31" dnum="6-o" numlevel="1" lineno="104" slineno="1-73" level="1"><display>(6)</display>Except as otherwise expressly provided in this section, a procurement unit:<subsection ssid="3-null-32" dnum="a-o" numlevel="1" lineno="105" slineno="1-74" level="2"><display>(a)</display>may not use the small purchase standard procurement process described in this <ln numlevel="1" lineno="106" slineno="1-75"/>section for ongoing, continuous, and regularly scheduled procurements that exceed <ln numlevel="1" lineno="107" slineno="1-76"/>the annual cumulative threshold; and</subsection><subsection ssid="3-null-33" dnum="b-o" numlevel="1" lineno="108" slineno="1-77" level="2"><display>(b)</display>shall make its ongoing, continuous, and regularly scheduled procurements that <ln numlevel="1" lineno="109" slineno="1-78"/>exceed the annual cumulative threshold through a contract awarded through another <ln numlevel="1" lineno="110" slineno="1-79"/>standard procurement process described in this chapter or an applicable exception to <ln numlevel="1" lineno="111" slineno="1-80"/>another standard procurement process, described in <xref depth="2" refnumber="63G-6a-8" start="2">Part 8, Exceptions to <ln numlevel="1" lineno="112" slineno="1-81"/>Procurement Requirements</xref>.</subsection></subsection><subsection ssid="3-null-34" dnum="7-o" numlevel="1" lineno="113" slineno="1-82" level="1"><display>(7)</display>This section does not prohibit regularly scheduled payments for a procurement item <ln numlevel="1" lineno="114" slineno="1-83"/>obtained under another provision of this chapter.</subsection><subsection ssid="3-null-35" dnum="8-o" numlevel="1" lineno="115" slineno="1-84" level="1" space="false"><display>(8)</display><subsection ssid="3-null-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>It is unlawful for a person knowingly to divide a single procurement into multiple <ln numlevel="1" lineno="116" slineno="1-85"/>smaller procurements, including by dividing an invoice or purchase order into <ln numlevel="1" lineno="117" slineno="1-86"/>multiple invoices or purchase orders, if:<subsection ssid="3-null-37" dnum="i-o" numlevel="1" lineno="118" slineno="1-87" level="3" tab="1"><display>(i)</display>the single procurement would not have qualified as a small purchase under this <ln numlevel="1" lineno="119" slineno="1-88"/>section;</subsection><subsection ssid="3-null-38" dnum="ii-o" numlevel="1" lineno="120" slineno="1-89" level="3" tab="1"><display>(ii)</display>one or more of the multiple smaller procurements qualify as a small purchase <ln numlevel="1" lineno="121" slineno="1-90"/>under this section; and</subsection><subsection ssid="3-null-39" dnum="iii-o" numlevel="1" lineno="122" slineno="1-91" level="3" tab="1"><display>(iii)</display>the division is done with the intent to:<subsection ssid="3-null-40" dnum="A-o" numlevel="1" lineno="123" slineno="1-92" level="4"><display>(A)</display>avoid having to use a standard procurement process, other than the small <ln numlevel="1" lineno="124" slineno="1-93"/>purchase process, that the person would otherwise be required to use for the <ln numlevel="1" lineno="125" slineno="1-94"/>single procurement; or</subsection><subsection ssid="3-null-41" dnum="B-o" numlevel="1" lineno="126" slineno="1-95" level="4"><display>(B)</display>make one or more of the multiple smaller procurements fall below a small <ln numlevel="1" lineno="127" slineno="1-96"/>purchase expenditure threshold established by rule under Subsection <xref depth="4" refnumber="63G-6a-506(2)(b)" start="0">(2)(b)</xref> that <ln numlevel="1" lineno="128" slineno="1-97"/>the single procurement would not have fallen below without the division.</subsection></subsection></subsection><subsection ssid="3-null-42" dnum="b-o" numlevel="1" lineno="129" slineno="1-98" level="2"><display>(b)</display>A violation of Subsection <xref depth="4" refnumber="63G-6a-506(8)(a)" start="0">(8)(a)</xref> is subject to penalties as provided in Subsection <xref depth="4" refnumber="63G-6a-2404.3(2)" start="0"><ln numlevel="1" lineno="130" slineno="1-99"/>63G-6a-2404.3(2)</xref>.</subsection></subsection><subsection ssid="3-null-43" dnum="9-o" numlevel="1" lineno="131" slineno="1-100" level="1"><display>(9)</display>The Division of Finance within the Department of Government Operations may conduct <ln numlevel="1" lineno="132" slineno="1-101"/>an audit of an executive branch procurement unit to verify compliance with the <ln numlevel="1" lineno="133" slineno="1-102"/>requirements of this section.</subsection><subsection ssid="3-null-44" dnum="10-o" numlevel="1" lineno="134" slineno="1-103" level="1"><display>(10)</display>An executive branch procurement unit may not make a small purchase after January 1, <ln numlevel="1" lineno="135" slineno="1-104"/>2014, unless the chief procurement officer certifies that the person responsible for <ln numlevel="1" lineno="136" slineno="1-105"/>procurements in the procurement unit has satisfactorily completed training on this <ln numlevel="1" lineno="137" slineno="1-106"/>section and the rules made under this section.</subsection></section></bsec><bsec buid="8" num="63G-6a-507" type="amend" src="code" uid="C63G-6a-S507_2026050620260506" sort="63G06a05070020260506" numlevel="1" lineno="138" slineno="2-1" sn="2"><section number="63G-6a-507" numlevel="1" lineno="139" slineno="2-2" type="amend"><secline lineno="138">Section 2. Section <bold>63G-6a-507</bold> is amended to read:</secline><catline lineno="139"><bold>63G-6a-507<parens/>. Approved vendor list procurement process.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="140" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="8-null-2" dnum="a-o" numlevel="1" lineno="141" slineno="2-4" level="2"><display>(a)</display>"Closed-ended approved vendor list" means an approved vendor list that is subject to:<subsection ssid="8-null-3" dnum="i-o" numlevel="1" lineno="142" slineno="2-5" level="3"><display>(i)</display>a short period of time, specified by the procurement unit, during which vendors <ln numlevel="1" lineno="143" slineno="2-6"/>may be added to the list; and</subsection><subsection ssid="8-null-4" dnum="ii-o" numlevel="1" lineno="144" slineno="2-7" level="3"><display>(ii)</display>a specified period of time after which the list will expire.</subsection></subsection><subsection ssid="8-null-5" dnum="b-o" numlevel="1" lineno="145" slineno="2-8" level="2"><display>(b)</display>"Open-ended approved vendor list" means an approved vendor list that is subject to:<subsection ssid="8-null-6" dnum="i-o" numlevel="1" lineno="146" slineno="2-9" level="3"><display>(i)</display>an indeterminate period of time during which vendors may be added to the list;</subsection><subsection ssid="8-null-7" dnum="ii-o" numlevel="1" lineno="147" slineno="2-10" level="3"><display>(ii)</display>the addition of vendors to the list throughout the term of the list; and</subsection><subsection ssid="8-null-8" dnum="iii-o" numlevel="1" lineno="148" slineno="2-11" level="3"><display>(iii)</display>a specified period of time after which the procurement unit is required to verify <ln numlevel="1" lineno="149" slineno="2-12"/>that vendors on the list continue to meet the minimum mandatory requirements, <ln numlevel="1" lineno="150" slineno="2-13"/>evaluation criteria, and applicable score thresholds.</subsection></subsection><subsection ssid="8-39" dnum="_-o:c-i" numlevel="1" lineno="151" slineno="2-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">"Resident supplier" means the same as that term is defined in Section <xref depth="3" refnumber="63G-6a-1005">63G-6a-1005</xref>.</amend></subsection></subsection><subsection ssid="8-null-9" dnum="2-o" numlevel="1" lineno="152" slineno="2-15" level="1"><display>(2)</display>A procurement unit may not establish an approved vendor list unless the procurement <ln numlevel="1" lineno="153" slineno="2-16"/>unit has first completed the statement of qualifications process described in Section <xref depth="3" refnumber="63G-6a-410" start="0"><ln numlevel="1" lineno="154" slineno="2-17"/>63G-6a-410</xref>.</subsection><subsection ssid="8-null-10" dnum="3-o" numlevel="1" lineno="155" slineno="2-18" level="1" space="false"><display>(3)</display><subsection ssid="8-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A procurement unit may establish an approved vendor list for:<subsection ssid="8-null-12" dnum="i-o" numlevel="1" lineno="156" slineno="2-19" level="3" tab="1"><display>(i)</display>a specific, fully defined procurement item; or</subsection><subsection ssid="8-null-13" dnum="ii-o" numlevel="1" lineno="157" slineno="2-20" level="3" tab="1"><display>(ii)</display>a future procurement item that is not specifically and fully defined, if the request <ln numlevel="1" lineno="158" slineno="2-21"/>for statement of qualifications contains a general description of:<subsection ssid="8-null-14" dnum="A-o" numlevel="1" lineno="159" slineno="2-22" level="4"><display>(A)</display>the procurement item; and</subsection><subsection ssid="8-null-15" dnum="B-o" numlevel="1" lineno="160" slineno="2-23" level="4"><display>(B)</display>the type of vendor that the procurement unit seeks to provide the procurement <ln numlevel="1" lineno="161" slineno="2-24"/>item.</subsection></subsection></subsection><subsection ssid="8-null-16" dnum="b-o" numlevel="1" lineno="162" slineno="2-25" level="2"><display>(b)</display>A procurement unit may not award a contract to a vendor on an approved vendor list <ln numlevel="1" lineno="163" slineno="2-26"/>for a procurement item that is outside the scope of the general description of the <ln numlevel="1" lineno="164" slineno="2-27"/>procurement item contained in the request for statement of qualifications.</subsection></subsection><subsection ssid="8-null-17" dnum="4-o" numlevel="1" lineno="165" slineno="2-28" level="1"><display>(4)</display>After receiving the statements of qualifications and evaluation scores submitted by the <ln numlevel="1" lineno="166" slineno="2-29"/>evaluation committee under Subsection <xref depth="4" refnumber="63G-6a-410(9)(f)" start="0">63G-6a-410(9)(f)</xref>, the procurement official of <ln numlevel="1" lineno="167" slineno="2-30"/>the procurement unit using the request for statement of qualifications process under <ln numlevel="1" lineno="168" slineno="2-31"/>Section <xref depth="3" refnumber="63G-6a-410" start="0">63G-6a-410</xref> as part of an approved vendor list process shall:<subsection ssid="8-null-18" dnum="a-o" numlevel="1" lineno="169" slineno="2-32" level="2"><display>(a)</display>include on an approved vendor list those vendors meeting the minimum mandatory <ln numlevel="1" lineno="170" slineno="2-33"/>requirements, evaluation criteria, and applicable score thresholds;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="8-null-19" dnum="b-o" numlevel="1" lineno="171" slineno="2-34" level="2"><display>(b)</display>reject any vendor not meeting the minimum mandatory requirements, evaluation <ln numlevel="1" lineno="172" slineno="2-35"/>criteria, and applicable score thresholds as ineligible for inclusion on the approved <ln numlevel="1" lineno="173" slineno="2-36"/>vendor list<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="8-40" dnum="_-o:c-i" numlevel="1" lineno="174" slineno="2-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">indicate on an approved vendor list those vendors that qualify as a resident supplier, <ln numlevel="1" lineno="175" slineno="2-38"/>if the vendor includes that information in the vendor's statement of qualifications.</amend></subsection></subsection><subsection ssid="8-null-20" dnum="5-o" numlevel="1" lineno="176" slineno="2-39" level="1" space="false"><display>(5)</display><subsection ssid="8-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A procurement unit shall include approved vendors on a closed-ended approved <ln numlevel="1" lineno="177" slineno="2-40"/>vendor list or an open-ended approved vendor list.</subsection><subsection ssid="8-null-22" dnum="b-o" numlevel="1" lineno="178" slineno="2-41" level="2" space="false"><display>(b)</display><subsection ssid="8-null-23" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A closed-ended approved vendor list shall expire no later than 18 months after <ln numlevel="1" lineno="179" slineno="2-42"/>the publication of the closed-ended approved vendor list.</subsection><subsection ssid="8-null-24" dnum="ii-o" numlevel="1" lineno="180" slineno="2-43" level="3"><display>(ii)</display>A procurement unit shall verify, no less frequently than every 18 months, by a <ln numlevel="1" lineno="181" slineno="2-44"/>method approved by the procurement official, that each vendor on an open-ended <ln numlevel="1" lineno="182" slineno="2-45"/>approved vendor list continues to meet the minimum mandatory requirements, <ln numlevel="1" lineno="183" slineno="2-46"/>evaluation criteria, and applicable score thresholds.</subsection></subsection></subsection><subsection ssid="8-null-25" dnum="6-o" numlevel="1" lineno="184" slineno="2-47" level="1"><display>(6)</display>A procurement unit may:<subsection ssid="8-null-26" dnum="a-o" numlevel="1" lineno="185" slineno="2-48" level="2" space="false"><display>(a)</display><subsection ssid="8-null-27" dnum="i-o" level="3" placement="sameline"><display>(i)</display>using a bidding process, request for proposals process, small purchase process, <ln numlevel="1" lineno="186" slineno="2-49"/>or design professional procurement process, award a contract to a vendor on an <ln numlevel="1" lineno="187" slineno="2-50"/>approved vendor list for any procurement item or type of procurement item <ln numlevel="1" lineno="188" slineno="2-51"/>specified by the procurement unit in the request for statement of qualifications, <ln numlevel="1" lineno="189" slineno="2-52"/>including procurement items that the procurement unit intends to acquire in a <ln numlevel="1" lineno="190" slineno="2-53"/>series of future procurements described in the request for statement of <ln numlevel="1" lineno="191" slineno="2-54"/>qualifications; and</subsection><subsection ssid="8-null-28" dnum="ii-o" numlevel="1" lineno="192" slineno="2-55" level="3"><display>(ii)</display>limit participation in a bidding process, request for proposals process, small <ln numlevel="1" lineno="193" slineno="2-56"/>purchase process, or design professional procurement process to vendors on an <ln numlevel="1" lineno="194" slineno="2-57"/>approved vendor list; or</subsection></subsection><subsection ssid="8-null-29" dnum="b-o" numlevel="1" lineno="195" slineno="2-58" level="2"><display>(b)</display>award a contract to a vendor on an approved vendor list at a price established as <ln numlevel="1" lineno="196" slineno="2-59"/>provided in Section <xref depth="3" refnumber="63G-6a-113" start="0">63G-6a-113</xref>.</subsection></subsection><subsection ssid="8-null-30" dnum="7-o" numlevel="1" lineno="197" slineno="2-60" level="1" space="false"><display>(7)</display><subsection ssid="8-null-31" dnum="a-o" level="2" placement="sameline"><display>(a)</display>After establishing an approved vendor list as provided in this section, a <ln numlevel="1" lineno="198" slineno="2-61"/>conducting procurement unit shall, before using the approved vendor list, submit the <ln numlevel="1" lineno="199" slineno="2-62"/>approved vendor list to the issuing procurement unit.</subsection><subsection ssid="8-null-32" dnum="b-o" numlevel="1" lineno="200" slineno="2-63" level="2"><display>(b)</display>An issuing procurement unit that receives an approved vendor list under Subsection <xref depth="4" refnumber="63G-6a-507(7)(a)" start="0"><ln numlevel="1" lineno="201" slineno="2-64"/>(7)(a)</xref> shall make the approved vendor list available to the public.</subsection></subsection><subsection ssid="8-null-33" dnum="8-o" numlevel="1" lineno="202" slineno="2-65" level="1"><display>(8)</display>A conducting procurement unit administering an open-ended approved vendor list shall:<subsection ssid="8-null-34" dnum="a-o" numlevel="1" lineno="203" slineno="2-66" level="2"><display>(a)</display>require a vendor seeking inclusion on the approved vendor list to submit a statement <ln numlevel="1" lineno="204" slineno="2-67"/>of qualifications that complies with all requirements applicable at the time of the <ln numlevel="1" lineno="205" slineno="2-68"/>initial request for statement of qualifications; and</subsection><subsection ssid="8-null-35" dnum="b-o" numlevel="1" lineno="206" slineno="2-69" level="2"><display>(b)</display>if modifying the requirements for inclusion on the approved vendor list, apply any <ln numlevel="1" lineno="207" slineno="2-70"/>new or additional requirement to all vendors equally, whether a vendor is seeking <ln numlevel="1" lineno="208" slineno="2-71"/>inclusion on the approved vendor list for the first time or is already included on the <ln numlevel="1" lineno="209" slineno="2-72"/>approved vendor list.</subsection></subsection><subsection ssid="8-null-36" dnum="9-o" numlevel="1" lineno="210" slineno="2-73" level="1"><display>(9)</display>A rulemaking authority shall make rules pertaining to an approved vendor list process, <ln numlevel="1" lineno="211" slineno="2-74"/>including:<subsection ssid="8-null-37" dnum="a-o" numlevel="1" lineno="212" slineno="2-75" level="2"><display>(a)</display>procedures to ensure that<amend anum="0" ea="amend" pairid="40" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="8-45" dnum="_-o:i-i" numlevel="1" lineno="213" slineno="2-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>all vendors on an approved vendor list <amend anum="0" ea="amend" pairid="47" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="both">that are resident suppliers </amend>have a fair and <ln numlevel="1" lineno="214" slineno="2-77"/>equitable opportunity to compete for a contract for a procurement item<amend anum="0" ea="amend" pairid="48" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="both"> in <ln numlevel="1" lineno="215" slineno="2-78"/>comparison to other resident suppliers on the approved vendor list;</amend></subsection><subsection ssid="8-48" dnum="_-o:ii-i" numlevel="1" lineno="216" slineno="2-79" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1086" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">all vendors on an approved vendor list that are not resident suppliers have a fair <ln numlevel="1" lineno="217" slineno="2-80"/>and equitable opportunity to compete for a contract for a procurement item in <ln numlevel="1" lineno="218" slineno="2-81"/>comparison to other non-resident suppliers on the approved vendor list; and</amend></subsection><subsection ssid="8-49" dnum="_-o:iii-i" numlevel="1" lineno="219" slineno="2-82" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">vendors on an approved vendor list that are resident suppliers have a greater <ln numlevel="1" lineno="220" slineno="2-83"/>opportunity to compete for a contract for a procurement item in comparison to <ln numlevel="1" lineno="221" slineno="2-84"/>non-resident suppliers on the approved vendor list</amend>; and</subsection></subsection><subsection ssid="8-null-38" dnum="b-o" numlevel="1" lineno="222" slineno="2-85" level="2"><display>(b)</display>requirements for using an approved vendor list with the small purchase process.</subsection></subsection></section></bsec><bsec buid="1" num="63G-6a-1005" type="enact" src="code" uid="C63G-6a-S1005_2026050620260506" sort="63G06a10050020260506" numlevel="1" lineno="223" slineno="3-1" sn="3"><section numlevel="1" lineno="224" slineno="3-2" number="63G-6a-1005" type="enact"><secline lineno="223">Section 3. Section <bold>63G-6a-1005</bold> is enacted to read:</secline><catline lineno="224"><bold>63G-6a-1005<parens/>. Preference for resident suppliers.</bold></catline><subsection ssid="1-1" dnum="_-o:1-i" numlevel="1" lineno="225" slineno="3-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section, "resident supplier" means a person, partnership, corporation, or <ln numlevel="1" lineno="226" slineno="3-4"/>other business entity that:</amend><subsection ssid="1-4" dnum="_-o:a-i" numlevel="1" lineno="227" slineno="3-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">maintains a principal place of business in Utah;</amend></subsection><subsection ssid="1-15" dnum="_-o:b-i" numlevel="1" lineno="228" slineno="3-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">is registered and in good standing with the Division of Corporations and Commercial <ln numlevel="1" lineno="229" slineno="3-7"/>Code created in Section <xref depth="3" refnumber="13-1a-1">13-1a-1</xref>; and</amend></subsection><subsection ssid="1-6" dnum="_-o:c-i" numlevel="1" lineno="230" slineno="3-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1092" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">has maintained the principal place of business described in Subsection <xref depth="4" refnumber="63G-6a-1005(1)(a)">(1)(a)</xref> for at <ln numlevel="1" lineno="231" slineno="3-9"/>least one year before the day on which bids or requests for qualifications were first <ln numlevel="1" lineno="232" slineno="3-10"/>solicited.</amend></subsection></subsection><subsection ssid="1-14" dnum="_-o:2-i" numlevel="1" lineno="233" slineno="3-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1093" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">The provisions of this section apply if the provisions of Sections <xref depth="3" refnumber="63G-6a-1002">63G-6a-1002</xref> and <xref depth="3" refnumber="63G-6a-1003"><ln numlevel="1" lineno="234" slineno="3-12"/>63G-6a-1003</xref> do not apply.</amend></subsection><subsection ssid="1-3" dnum="_-o:3-i" numlevel="1" lineno="235" slineno="3-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="1-7" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">For a procurement that is awarded based on evaluation criteria with assigned point <ln numlevel="1" lineno="236" slineno="3-14"/>values, an issuing procurement unit shall award a resident supplier additional points <ln numlevel="1" lineno="237" slineno="3-15"/>equal to 10% of the total available evaluation points.</amend></subsection><subsection ssid="1-16" dnum="_-o:b-i" numlevel="1" lineno="238" slineno="3-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="85" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">The additional points described in Subsection <xref depth="4" refnumber="63G-6a-1005(3)(a)">(3)(a)</xref> shall be added to the resident <ln numlevel="1" lineno="239" slineno="3-17"/>supplier's final evaluation score.</amend></subsection><subsection ssid="1-8" dnum="_-o:c-i" numlevel="1" lineno="240" slineno="3-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">The preference described in this Subsection <xref depth="4" refnumber="63G-6a-1005(3)">(3)</xref>:</amend><subsection ssid="1-18" dnum="_-o:i-i" numlevel="1" lineno="241" slineno="3-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="71" style="1" owner="jchristopherson" level="1" amendtag="end">is waived if the certification that the bidder qualifies as a resident supplier does <ln numlevel="1" lineno="242" slineno="3-20"/>not appear on the bid or proposal; and</amend></subsection><subsection ssid="1-19" dnum="_-o:ii-i" numlevel="1" lineno="243" slineno="3-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1099" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="end">does not apply if application of the preference might jeopardize the receipt of <ln numlevel="1" lineno="244" slineno="3-22"/>federal funds.</amend></subsection></subsection></subsection></section></bsec><bsec buid="9" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="245" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="245">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="246"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-17-26 4:31 PM</tm></rev></foot></leg>
