Sandall</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions relating to unlawful detainer.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">provides that a renter may take commercially reasonable steps to correct a deficient <ln numlevel="1" lineno="9" slineno="0-9"/>condition in a residential rental unit;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">defines terms;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">amends the circumstances under which a tenant is guilty of unlawful detainer;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">provides that a tenant is guilty of unlawful detainer if an animal under control of the <ln numlevel="1" lineno="13" slineno="0-13"/>tenant engages in certain acts;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">provides that a tenant is guilty of unlawful detainer if the tenant violates a provision of the <ln numlevel="1" lineno="15" slineno="0-15"/>lease agreement that the lease agreement designates as an incurable violation; and</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">makes technical changes.</hl></hp><moni numlevel="1" lineno="17" slineno="0-17" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="18">None</moniNone><oc numlevel="1" lineno="19" slineno="0-19">Other Special Clauses:</oc><ocNone lineno="20">None</ocNone><sa numlevel="1" lineno="21" slineno="0-21">Utah Code Sections Affected:<saamd numlevel="1" lineno="22" slineno="0-22"><snhead>AMENDS:</snhead><sn num="57-22-6" src="code" uid="C57-22-S6_2026050620260506" buid="1" sort="57 22 00060020260506" numlevel="1" lineno="23" slineno="0-23"><bold>57-22-6</bold>, as last amended by Laws of Utah 2023, Chapter 401</sn><sn num="78B-6-801" src="code" uid="C78B-6-S801_2026050620260506" buid="3" sort="78B06 08010020260506" numlevel="1" lineno="24" slineno="0-24"><bold>78B-6-801</bold>, as last amended by Laws of Utah 2016, Chapter 264</sn><sn num="78B-6-802" src="code" uid="C78B-6-S802_2026050620260506" buid="5" sort="78B06 08020020260506" numlevel="1" lineno="25" slineno="0-25"><bold>78B-6-802</bold>, as last amended by Laws of Utah 2020, Sixth Special Session, Chapter 19</sn></saamd></sa></lt><enacthead lineno="26"/><enact numlevel="1" lineno="27" slineno="0-27">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" num="57-22-6" type="amend" src="code" uid="C57-22-S6_2026050620260506" sort="57 22 00060020260506" numlevel="1" lineno="28" slineno="1-1" sn="1"><section number="57-22-6" numlevel="1" lineno="29" slineno="1-2" type="amend"><secline lineno="28">Section 1. Section <bold>57-22-6</bold> is amended to read:</secline><catline lineno="29"><bold>57-22-6<parens/>. Renter remedies for deficient condition of residential rental unit.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="30" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="31" slineno="1-4" level="2"><display>(a)</display>"Corrective period" means:<subsection ssid="1-null-3" dnum="i-o" numlevel="1" lineno="32" slineno="1-5" level="3"><display>(i)</display>for a standard of habitability, three calendar days; and</subsection><subsection ssid="1-null-4" dnum="ii-o" numlevel="1" lineno="33" slineno="1-6" level="3"><display>(ii)</display>for a requirement imposed by a rental agreement, 10 calendar days.</subsection></subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="34" slineno="1-7" level="2"><display>(b)</display>"Deficient condition" means a condition of a residential rental unit that:<subsection ssid="1-null-6" dnum="i-o" numlevel="1" lineno="35" slineno="1-8" level="3"><display>(i)</display>violates a standard of habitability or a requirement of the rental agreement; and</subsection><subsection ssid="1-null-7" dnum="ii-o" numlevel="1" lineno="36" slineno="1-9" level="3"><display>(ii)</display>is not caused by:<subsection ssid="1-null-8" dnum="A-o" numlevel="1" lineno="37" slineno="1-10" level="4"><display>(A)</display>the renter, the renter's family, or the renter's guest or invitee; and</subsection><subsection ssid="1-null-9" dnum="B-o" numlevel="1" lineno="38" slineno="1-11" level="4"><display>(B)</display>a use that would violate:<subsection ssid="1-null-10" dnum="I-o" numlevel="1" lineno="39" slineno="1-12" level="5"><display>(I)</display>the rental agreement; or</subsection><subsection ssid="1-null-11" dnum="II-o" numlevel="1" lineno="40" slineno="1-13" level="5"><display>(II)</display>a law applicable to the renter's use of the residential rental unit.</subsection></subsection></subsection></subsection><subsection ssid="1-null-12" dnum="c-o" numlevel="1" lineno="41" slineno="1-14" level="2"><display>(c)</display>"Notice of deficient condition" means the notice described in Subsection <xref depth="4" refnumber="57-22-6(2)" start="0">(2)</xref>.</subsection><subsection ssid="1-null-13" dnum="d-o" numlevel="1" lineno="42" slineno="1-15" level="2"><display>(d)</display>"Rent abatement remedy" means the remedy described in Subsection <xref depth="4" refnumber="57-22-6(4)(a)(i)" start="0">(4)(a)(i)</xref>.</subsection><subsection ssid="1-null-14" dnum="e-o" numlevel="1" lineno="43" slineno="1-16" level="2"><display>(e)</display>"Renter remedy" means:<subsection ssid="1-null-15" dnum="i-o" numlevel="1" lineno="44" slineno="1-17" level="3"><display>(i)</display>a rent abatement remedy; or</subsection><subsection ssid="1-null-16" dnum="ii-o" numlevel="1" lineno="45" slineno="1-18" level="3"><display>(ii)</display>a repair and deduct remedy.</subsection></subsection><subsection ssid="1-null-17" dnum="f-o" numlevel="1" lineno="46" slineno="1-19" level="2"><display>(f)</display>"Repair and deduct remedy" means the remedy described in Subsection <xref depth="4" refnumber="57-22-6(4)(a)(ii)" start="0">(4)(a)(ii)</xref>.</subsection><subsection ssid="1-null-18" dnum="g-o" numlevel="1" lineno="47" slineno="1-20" level="2"><display>(g)</display>"Standard of habitability" means a standard:<subsection ssid="1-null-19" dnum="i-o" numlevel="1" lineno="48" slineno="1-21" level="3"><display>(i)</display>relating to the condition of a residential rental unit; and</subsection><subsection ssid="1-null-20" dnum="ii-o" numlevel="1" lineno="49" slineno="1-22" level="3"><display>(ii)</display>that an owner is required to ensure that the residential rental unit meets as <ln numlevel="1" lineno="50" slineno="1-23"/>required under Subsection <xref depth="4" refnumber="57-22-3(1)" start="0">57-22-3(1)</xref> or Subsection <xref depth="4" refnumber="57-22-4(1)(a)" start="0">57-22-4(1)(a)</xref> or <xref depth="4" refnumber="57-22-4(1)(b)(i)" start="0">(b)(i)</xref>, <xref depth="4" refnumber="57-22-4(1)(b)(ii)" start="0">(ii)</xref>, or <xref depth="4" refnumber="57-22-4(1)(b)(iii)" start="0"><ln numlevel="1" lineno="51" slineno="1-24"/>(iii)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-21" dnum="2-o" numlevel="1" lineno="52" slineno="1-25" level="1" space="false"><display>(2)</display><subsection ssid="1-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a renter believes that the renter's residential rental unit has a deficient condition, <ln numlevel="1" lineno="53" slineno="1-26"/>the renter may give the owner written notice as provided in Subsection <xref depth="4" refnumber="57-22-6(2)(b)" start="0">(2)(b)</xref>.</subsection><subsection ssid="1-null-23" dnum="b-o" numlevel="1" lineno="54" slineno="1-27" level="2"><display>(b)</display>A notice under Subsection <xref depth="4" refnumber="57-22-6(2)(a)" start="0">(2)(a)</xref> shall:<subsection ssid="1-null-24" dnum="i-o" numlevel="1" lineno="55" slineno="1-28" level="3"><display>(i)</display>describe each deficient condition;</subsection><subsection ssid="1-null-25" dnum="ii-o" numlevel="1" lineno="56" slineno="1-29" level="3"><display>(ii)</display>state that the owner has the corrective period, stated in terms of the applicable <ln numlevel="1" lineno="57" slineno="1-30"/>number of days, to correct each deficient condition;</subsection><subsection ssid="1-null-26" dnum="iii-o" numlevel="1" lineno="58" slineno="1-31" level="3"><display>(iii)</display>state the renter remedy that the renter has chosen if the owner does not, within <ln numlevel="1" lineno="59" slineno="1-32"/>the corrective period, take substantial action toward correcting each deficient <ln numlevel="1" lineno="60" slineno="1-33"/>condition;</subsection><subsection ssid="1-null-27" dnum="iv-o" numlevel="1" lineno="61" slineno="1-34" level="3"><display>(iv)</display>provide the owner permission to enter the residential rental unit to make <ln numlevel="1" lineno="62" slineno="1-35"/>corrective action; and</subsection><subsection ssid="1-null-28" dnum="v-o" numlevel="1" lineno="63" slineno="1-36" level="3"><display>(v)</display>be served on the owner as provided in:<subsection ssid="1-null-29" dnum="A-o" numlevel="1" lineno="64" slineno="1-37" level="4"><display>(A)</display>Section <xref depth="3" refnumber="78B-6-805" start="0">78B-6-805</xref>; or</subsection><subsection ssid="1-null-30" dnum="B-o" numlevel="1" lineno="65" slineno="1-38" level="4"><display>(B)</display>the rental agreement.</subsection></subsection></subsection></subsection><subsection ssid="1-null-31" dnum="3-o" numlevel="1" lineno="66" slineno="1-39" level="1" space="false"><display>(3)</display><subsection ssid="1-null-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="57-22-6(3)" start="0">(3)</xref>, "dangerous condition" means a deficient condition <ln numlevel="1" lineno="67" slineno="1-40"/>that poses a substantial risk of:<subsection ssid="1-null-33" dnum="i-o" numlevel="1" lineno="68" slineno="1-41" level="3" tab="1"><display>(i)</display>imminent loss of life; or</subsection><subsection ssid="1-null-34" dnum="ii-o" numlevel="1" lineno="69" slineno="1-42" level="3" tab="1"><display>(ii)</display>significant physical harm.</subsection></subsection><subsection ssid="1-null-35" dnum="b-o" numlevel="1" lineno="70" slineno="1-43" level="2"><display>(b)</display>If a renter believes that the renter's residential rental unit has a dangerous condition, <ln numlevel="1" lineno="71" slineno="1-44"/>the renter may notify the owner of the dangerous condition by any means that is <ln numlevel="1" lineno="72" slineno="1-45"/>reasonable under the circumstances.</subsection><subsection ssid="1-null-36" dnum="c-o" numlevel="1" lineno="73" slineno="1-46" level="2"><display>(c)</display>An owner shall:<subsection ssid="1-null-37" dnum="i-o" numlevel="1" lineno="74" slineno="1-47" level="3"><display>(i)</display>within 24 hours after receiving notice under Subsection <xref depth="4" refnumber="57-22-6(3)(b)" start="0">(3)(b)</xref> of a dangerous <ln numlevel="1" lineno="75" slineno="1-48"/>condition, commence remedial action to correct the dangerous condition; and</subsection><subsection ssid="1-null-38" dnum="ii-o" numlevel="1" lineno="76" slineno="1-49" level="3"><display>(ii)</display>diligently pursue remedial action to completion.</subsection></subsection><subsection ssid="1-null-39" dnum="d-o" numlevel="1" lineno="77" slineno="1-50" level="2"><display>(d)</display>Notice under Subsection <xref depth="4" refnumber="57-22-6(3)(b)" start="0">(3)(b)</xref> of a dangerous condition does not constitute a notice <ln numlevel="1" lineno="78" slineno="1-51"/>of deficient condition, unless the notice also meets the requirements of Subsection <xref depth="4" refnumber="57-22-6(2)" start="0">(2)</xref>.</subsection></subsection><subsection ssid="1-null-40" dnum="4-o" numlevel="1" lineno="79" slineno="1-52" level="1" space="false"><display>(4)</display><subsection ssid="1-null-41" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="57-22-6(4)(b)" start="0">(4)(b)</xref>, if an owner fails to take substantial action, before the <ln numlevel="1" lineno="80" slineno="1-53"/>end of the corrective period, toward correcting a deficient condition described in a <ln numlevel="1" lineno="81" slineno="1-54"/>notice of deficient condition:<subsection ssid="1-null-42" dnum="i-o" numlevel="1" lineno="82" slineno="1-55" level="3" tab="1"><display>(i)</display>if the renter chose the rent abatement remedy in the notice of deficient condition:<subsection ssid="1-null-43" dnum="A-o" numlevel="1" lineno="83" slineno="1-56" level="4"><display>(A)</display>the renter's rent is abated as of the date of the notice of deficient condition to <ln numlevel="1" lineno="84" slineno="1-57"/>the owner;</subsection><subsection ssid="1-null-44" dnum="B-o" numlevel="1" lineno="85" slineno="1-58" level="4"><display>(B)</display>the rental agreement is terminated;</subsection><subsection ssid="1-null-45" dnum="C-o" numlevel="1" lineno="86" slineno="1-59" level="4"><display>(C)</display>the owner shall immediately pay to the renter:<subsection ssid="1-null-46" dnum="I-o" numlevel="1" lineno="87" slineno="1-60" level="5"><display>(I)</display>the entire security deposit that the renter paid under the rental agreement; <ln numlevel="1" lineno="88" slineno="1-61"/>and</subsection><subsection ssid="1-null-47" dnum="II-o" numlevel="1" lineno="89" slineno="1-62" level="5"><display>(II)</display>a prorated refund for any prepaid rent, including any rent the renter paid for <ln numlevel="1" lineno="90" slineno="1-63"/>the period after the date on which the renter gave the owner the notice of <ln numlevel="1" lineno="91" slineno="1-64"/>deficient condition; and</subsection></subsection><subsection ssid="1-null-48" dnum="D-o" numlevel="1" lineno="92" slineno="1-65" level="4"><display>(D)</display>the renter shall vacate the residential rental unit within 10 calendar days after <ln numlevel="1" lineno="93" slineno="1-66"/>the expiration of the corrective period; or</subsection></subsection><subsection ssid="1-null-49" dnum="ii-o" numlevel="1" lineno="94" slineno="1-67" level="3" tab="1"><display>(ii)</display>if the renter chose the repair and deduct remedy in the notice of deficient <ln numlevel="1" lineno="95" slineno="1-68"/>condition, and subject to Subsection <xref depth="4" refnumber="57-22-6(4)(d)">(4)(c)</xref>, the renter:<subsection ssid="1-null-50" dnum="A-o" numlevel="1" lineno="96" slineno="1-69" level="4"><display>(A)</display>may:<subsection ssid="1-null-51" dnum="I-o" numlevel="1" lineno="97" slineno="1-70" level="5"><display>(I)</display><amend anum="0" ea="amend" pairid="30" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both">take commercially reasonable steps to hire a licensed and insured contractor <ln numlevel="1" lineno="98" slineno="1-71"/>to </amend>correct the deficient condition described in the notice of deficient <ln numlevel="1" lineno="99" slineno="1-72"/>condition; and</subsection><subsection ssid="1-null-52" dnum="II-o" numlevel="1" lineno="100" slineno="1-73" level="5"><display>(II)</display>deduct from future rent the amount the renter paid to correct the deficient <ln numlevel="1" lineno="101" slineno="1-74"/>condition, not to exceed an amount equal to two months' rent; and</subsection></subsection><subsection ssid="1-null-53" dnum="B-o" numlevel="1" lineno="102" slineno="1-75" level="4"><display>(B)</display>shall:<subsection ssid="1-null-54" dnum="I-o" numlevel="1" lineno="103" slineno="1-76" level="5"><display>(I)</display>maintain all receipts documenting the amount the renter paid to correct the <ln numlevel="1" lineno="104" slineno="1-77"/>deficient condition; and</subsection><subsection ssid="1-null-55" dnum="II-o" numlevel="1" lineno="105" slineno="1-78" level="5"><display>(II)</display>provide a copy of those receipts to the owner within five calendar days <ln numlevel="1" lineno="106" slineno="1-79"/>after the beginning of the next rental period.</subsection></subsection></subsection></subsection><subsection ssid="1-null-56" dnum="b-o" numlevel="1" lineno="107" slineno="1-80" level="2"><display>(b)</display>A renter is not entitled to a renter remedy if the renter is not in compliance with all <ln numlevel="1" lineno="108" slineno="1-81"/>requirements under Section <xref depth="3" refnumber="57-22-5" start="0">57-22-5</xref>.</subsection><subsection ssid="1-null-57" dnum="c-o" numlevel="1" lineno="109" slineno="1-82" level="2" space="false"><display>(c)</display><subsection ssid="1-null-58" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If a residential rental unit is not fit for occupancy, an owner may:<subsection ssid="1-null-59" dnum="A-o" numlevel="1" lineno="110" slineno="1-83" level="4" tab="1"><display>(A)</display>determine not to correct a deficient condition described in a notice of deficient <ln numlevel="1" lineno="111" slineno="1-84"/>condition; and</subsection><subsection ssid="1-null-60" dnum="B-o" numlevel="1" lineno="112" slineno="1-85" level="4" tab="1"><display>(B)</display>terminate the rental agreement.</subsection></subsection><subsection ssid="1-null-61" dnum="ii-o" numlevel="1" lineno="113" slineno="1-86" level="3"><display>(ii)</display>If an owner determines not to correct a deficient condition and terminates the <ln numlevel="1" lineno="114" slineno="1-87"/>rental agreement under Subsection <xref depth="4" refnumber="57-22-6(4)(d)(i)">(4)(c)(i)</xref>:<subsection ssid="1-null-62" dnum="A-o" numlevel="1" lineno="115" slineno="1-88" level="4"><display>(A)</display>the owner shall:<subsection ssid="1-null-63" dnum="I-o" numlevel="1" lineno="116" slineno="1-89" level="5"><display>(I)</display>notify the renter in writing no later than the end of the corrective period; and</subsection><subsection ssid="1-null-64" dnum="II-o" numlevel="1" lineno="117" slineno="1-90" level="5"><display>(II)</display>within 10 calendar days after the owner terminates the rental agreement, <ln numlevel="1" lineno="118" slineno="1-91"/>pay to the renter:<subsection ssid="1-null-65" dnum="Aa-o" numlevel="1" lineno="119" slineno="1-92" level="6"><display>(Aa)</display>any prepaid rent, prorated as provided in Subsection <xref depth="4" refnumber="57-22-6(4)(d)(ii)(b)">(4)(c)(ii)(B)</xref>; and</subsection><subsection ssid="1-null-66" dnum="Bb-o" numlevel="1" lineno="120" slineno="1-93" level="6"><display>(Bb)</display>any deposit due the renter;</subsection></subsection></subsection><subsection ssid="1-null-67" dnum="B-o" numlevel="1" lineno="121" slineno="1-94" level="4"><display>(B)</display>the rent shall be prorated to the date the owner terminates the rental agreement <ln numlevel="1" lineno="122" slineno="1-95"/>under Subsection <xref depth="4" refnumber="57-22-6(4)(d)(i)">(4)(c)(i)</xref>; and</subsection><subsection ssid="1-null-68" dnum="C-o" numlevel="1" lineno="123" slineno="1-96" level="4"><display>(C)</display>the renter may not be required to vacate the residential rental unit sooner than <ln numlevel="1" lineno="124" slineno="1-97"/>10 calendar days after the owner notifies the renter under Subsection <xref depth="4" refnumber="57-22-6(4)(d)(ii)(a)(i)"><ln numlevel="1" lineno="125" slineno="1-98"/>(4)(c)(ii)(A)(I)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="1-null-69" dnum="5-o" numlevel="1" lineno="126" slineno="1-99" level="1" space="false"><display>(5)</display><subsection ssid="1-null-70" dnum="a-o" level="2" placement="sameline"><display>(a)</display>After the corrective period expires, a renter may bring an action in a court with <ln numlevel="1" lineno="127" slineno="1-100"/>jurisdiction under <xref depth="0" refnumber="78A" start="0">Title 78A, Judiciary and Judicial Administration</xref>, to enforce the <ln numlevel="1" lineno="128" slineno="1-101"/>renter remedy that the renter chose in the notice of deficient condition.</subsection><subsection ssid="1-null-71" dnum="b-o" numlevel="1" lineno="129" slineno="1-102" level="2"><display>(b)</display>In an action under Subsection <xref depth="4" refnumber="57-22-6(5)(a)" start="0">(5)(a)</xref>, the court shall endorse on the summons that the <ln numlevel="1" lineno="130" slineno="1-103"/>owner is required to appear and defend the action within three business days.</subsection><subsection ssid="1-null-72" dnum="c-o" numlevel="1" lineno="131" slineno="1-104" level="2"><display>(c)</display>If, in an action under Subsection <xref depth="4" refnumber="57-22-6(5)(a)" start="0">(5)(a)</xref>, the court finds that the owner unjustifiably <ln numlevel="1" lineno="132" slineno="1-105"/>refused to correct a deficient condition or failed to use due diligence to correct a <ln numlevel="1" lineno="133" slineno="1-106"/>deficient condition, the renter is entitled to any damages, in addition to the applicable <ln numlevel="1" lineno="134" slineno="1-107"/>renter remedy.</subsection><subsection ssid="1-null-73" dnum="d-o" numlevel="1" lineno="135" slineno="1-108" level="2"><display>(d)</display>An owner who disputes that a condition of the residential rental unit violates a <ln numlevel="1" lineno="136" slineno="1-109"/>requirement of the rental agreement may file a counterclaim in an action brought <ln numlevel="1" lineno="137" slineno="1-110"/>against the owner under Subsection <xref depth="4" refnumber="57-22-6(5)(a)" start="0">(5)(a)</xref>.</subsection></subsection><subsection ssid="1-null-74" dnum="6-o" numlevel="1" lineno="138" slineno="1-111" level="1"><display>(6)</display>An owner may not be held liable under this chapter for a claim for mental suffering or <ln numlevel="1" lineno="139" slineno="1-112"/>anguish.</subsection><subsection ssid="1-null-75" dnum="7-o" numlevel="1" lineno="140" slineno="1-113" level="1"><display>(7)</display>In an action under this chapter, the court may award costs and reasonable attorney fees <ln numlevel="1" lineno="141" slineno="1-114"/>to the prevailing party.</subsection></section></bsec><bsec buid="3" num="78B-6-801" type="amend" src="code" uid="C78B-6-S801_2026050620260506" sort="78B06 08010020260506" numlevel="1" lineno="142" slineno="2-1" sn="2"><section number="78B-6-801" numlevel="1" lineno="143" slineno="2-2" type="amend"><secline lineno="142">Section 2. Section <bold>78B-6-801</bold> is amended to read:</secline><catline lineno="143"><bold>78B-6-801<parens/>. Definitions.</bold></catline><sectionText lineno="144"><para/><amend anum="0" ea="amend" pairid="0" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">As used in this chapter:</amend></sectionText><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="145" slineno="2-4" level="1"><display>(1)</display>"Commercial tenant" means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> tenant who may be a body politic and corporate, <ln numlevel="1" lineno="146" slineno="2-5"/>partnership, association, or company.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="147" slineno="2-6" level="1"><display>(2)</display>"Forcible detainer" means:<subsection ssid="3-null-3" dnum="a-o" numlevel="1" lineno="148" slineno="2-7" level="2"><display>(a)</display>holding and keeping by force, or by menaces and threats of violence, the possession <ln numlevel="1" lineno="149" slineno="2-8"/>of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">any </amend><amendoutend style="2"/>real property, whether acquired peaceably or otherwise; or</subsection><subsection ssid="3-null-4" dnum="b-o" numlevel="1" lineno="150" slineno="2-9" level="2"><display>(b)</display>unlawfully entering real property during the absence of the occupants or at night, <ln numlevel="1" lineno="151" slineno="2-10"/>and, after demand is made for the surrender of the property, refusing for a period of <ln numlevel="1" lineno="152" slineno="2-11"/>three days to surrender the property to the former occupant.</subsection></subsection><subsection ssid="3-null-5" dnum="3-o" numlevel="1" lineno="153" slineno="2-12" level="1"><display>(3)</display>"Forcible entry" means:<subsection ssid="3-null-6" dnum="a-o" numlevel="1" lineno="154" slineno="2-13" level="2"><display>(a)</display>entering <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">any </amend><amendoutend style="2"/>real property by:<subsection ssid="3-null-7" dnum="i-o" numlevel="1" lineno="155" slineno="2-14" level="3"><display>(i)</display>breaking open doors, windows, or other parts of a house;</subsection><subsection ssid="3-null-8" dnum="ii-o" numlevel="1" lineno="156" slineno="2-15" level="3"><display>(ii)</display>fraud, intimidation, or stealth; or</subsection><subsection ssid="3-null-9" dnum="iii-o" numlevel="1" lineno="157" slineno="2-16" level="3"><display>(iii)</display>any kind of violence or circumstances of terror; or</subsection></subsection><subsection ssid="3-null-10" dnum="b-o" numlevel="1" lineno="158" slineno="2-17" level="2"><display>(b)</display>after entering peaceably upon real property, turning out by force, threats, or <ln numlevel="1" lineno="159" slineno="2-18"/>menacing conduct the party in actual possession.</subsection></subsection><subsection ssid="3-null-11" dnum="4-o" numlevel="1" lineno="160" slineno="2-19" level="1"><display>(4)</display>"Occupant of real property" means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both">one</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an individual</amend> who<amend anum="0" ea="amend" pairid="13" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> within five days <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="35" style="2" owner="jchristopherson" level="1" deltag="both">preceding</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="34" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="161" slineno="2-20"/>before</amend> an unlawful entry<amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> was in the peaceable and undisturbed possession of the <ln numlevel="1" lineno="162" slineno="2-21"/>property.</subsection><subsection ssid="3-null-12" dnum="5-o" numlevel="1" lineno="163" slineno="2-22" level="1"><display>(5)</display>"Owner":<subsection ssid="3-null-13" dnum="a-o" numlevel="1" lineno="164" slineno="2-23" level="2"><display>(a)</display>means the actual owner of the premises;</subsection><subsection ssid="3-null-14" dnum="b-o" numlevel="1" lineno="165" slineno="2-24" level="2"><display>(b)</display>has the same meaning as landlord under common law and the statutes of this state; <ln numlevel="1" lineno="166" slineno="2-25"/>and</subsection><subsection ssid="3-null-15" dnum="c-o" numlevel="1" lineno="167" slineno="2-26" level="2"><display>(c)</display>includes the owner's designated agent or successor to the estate.</subsection></subsection><subsection ssid="3-null-16" dnum="6-o" numlevel="1" lineno="168" slineno="2-27" level="1" space="false"><display>(6)</display><subsection ssid="3-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Peaceable possession" means having a legal right to possession.</subsection><subsection ssid="3-null-18" dnum="b-o" numlevel="1" lineno="169" slineno="2-28" level="2"><display>(b)</display>"Peaceable possession" does not include:<subsection ssid="3-null-19" dnum="i-o" numlevel="1" lineno="170" slineno="2-29" level="3"><display>(i)</display>the occupation of premises by a trespasser; or</subsection><subsection ssid="3-null-20" dnum="ii-o" numlevel="1" lineno="171" slineno="2-30" level="3"><display>(ii)</display>continuing to occupy real property after being served with<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="28" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/> an order of <ln numlevel="1" lineno="172" slineno="2-31"/>restitution issued by a court <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">of competent</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">with</amend> jurisdiction .</subsection></subsection></subsection><subsection ssid="3-29" dnum="_-o:7-i" numlevel="1" lineno="173" slineno="2-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">"Quit" means to vacate the premises.</amend></subsection><subsection ssid="3-null-21" dnum="7-o:8-i" numlevel="1" lineno="174" slineno="2-33" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1096" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display><subsection ssid="3-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Tenant" means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> natural person and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an</amend> individual, including a <ln numlevel="1" lineno="175" slineno="2-34"/>commercial tenant.</subsection><subsection ssid="3-null-23" dnum="b-o" numlevel="1" lineno="176" slineno="2-35" level="2"><display>(b)</display>"Tenant" does not include a person or entity that has no legal right to the premises.</subsection></subsection><subsection ssid="3-null-24" dnum="8-o:9-i" numlevel="1" lineno="177" slineno="2-36" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1099" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1100" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>"Trespasser" means a person or entity that occupies real property but never had <ln numlevel="1" lineno="178" slineno="2-37"/>possessory rights in the premises.</subsection><subsection ssid="3-null-25" dnum="9-o:10-i" numlevel="1" lineno="179" slineno="2-38" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1100" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1101" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>"Unlawful detainer" means unlawfully remaining in possession of property after <ln numlevel="1" lineno="180" slineno="2-39"/>receiving a notice to quit, served as required by this chapter, and failing to comply with <ln numlevel="1" lineno="181" slineno="2-40"/>that notice.</subsection><subsection ssid="3-null-26" dnum="10-o:11-i" numlevel="1" lineno="182" slineno="2-41" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1101" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1102" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display>"Willful exclusion" means preventing the tenant from entering into the premises <ln numlevel="1" lineno="183" slineno="2-42"/>with intent to deprive the tenant of entry.</subsection></section></bsec><bsec buid="5" num="78B-6-802" type="amend" src="code" uid="C78B-6-S802_2026050620260506" sort="78B06 08020020260506" numlevel="1" lineno="184" slineno="3-1" sn="3"><section number="78B-6-802" numlevel="1" lineno="185" slineno="3-2" type="amend"><secline lineno="184">Section 3. Section <bold>78B-6-802</bold> is amended to read:</secline><catline lineno="185"><bold>78B-6-802<parens/>. Unlawful detainer by tenant for a term less than life.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="186" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>A tenant holding real property for a term less than life is guilty of an unlawful detainer <ln numlevel="1" lineno="187" slineno="3-4"/>if the tenant<amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both">, in person or by subtenant, guest, or invitee</amend>:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="188" slineno="3-5" level="2"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="125" groupid="108" style="2" owner="jchristopherson" level="1" deltag="both">continues in possession, in person or by subtenant, of the property or any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="52" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">remains <ln numlevel="1" lineno="189" slineno="3-6"/>on the premises or a</amend> part of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="214" groupid="194" style="2" owner="jchristopherson" level="1" deltag="both">property</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="210" groupid="190" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">premises</amend>, after the expiration of the <ln numlevel="1" lineno="190" slineno="3-7"/>specified term or period for which <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="145" groupid="126" style="2" owner="jchristopherson" level="1" deltag="both">it</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="138" groupid="119" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the premises</amend> is let to the tenant, which specified <ln numlevel="1" lineno="191" slineno="3-8"/>term or period, whether established by express or implied contract, or whether <ln numlevel="1" lineno="192" slineno="3-9"/>written or parol, shall be terminated without notice at the expiration of the specified <ln numlevel="1" lineno="193" slineno="3-10"/>term or period;</subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="194" slineno="3-11" level="2"><display>(b)</display>having leased <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="222" groupid="202" style="2" owner="jchristopherson" level="1" deltag="both">real property</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="220" groupid="200" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the premises</amend> for an indefinite time with monthly or <ln numlevel="1" lineno="195" slineno="3-12"/>other periodic rent reserved:<subsection ssid="5-null-4" dnum="i-o" numlevel="1" lineno="196" slineno="3-13" level="3"><display>(i)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="146" groupid="127" style="2" owner="jchristopherson" level="1" deltag="both">continues in possession of </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="186" groupid="167" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">remains on </amend>the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="215" groupid="195" style="2" owner="jchristopherson" level="1" deltag="both">property in person or by subtenant </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="212" groupid="192" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="197" slineno="3-14"/>premises </amend>after the end of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> month or period, in cases where the owner, the <ln numlevel="1" lineno="198" slineno="3-15"/>owner's designated agent, or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="58" groupid="57" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="53" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> successor in estate of the owner, 15 calendar <ln numlevel="1" lineno="199" slineno="3-16"/>days or more before the end of that month or period, has served notice requiring <ln numlevel="1" lineno="200" slineno="3-17"/>the tenant to quit <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">the premises </amend><amendoutend style="2"/>at the expiration of that month or period; or</subsection><subsection ssid="5-null-5" dnum="ii-o" numlevel="1" lineno="201" slineno="3-18" level="3"><display>(ii)</display>in cases of tenancies at will, remains in possession of the premises after the <ln numlevel="1" lineno="202" slineno="3-19"/>expiration of a notice of not less than five calendar days;</subsection></subsection><subsection ssid="5-null-6" dnum="c-o" numlevel="1" lineno="203" slineno="3-20" level="2"><display>(c)</display>continues in possession, in person or by subtenant, after default in the payment of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="204" slineno="3-21"/>any </amend><amendoutend style="2"/>rent or other amounts due and after a notice in writing requiring in the <ln numlevel="1" lineno="205" slineno="3-22"/>alternative the payment of the rent and other amounts due or the surrender of the <ln numlevel="1" lineno="206" slineno="3-23"/>detained premises, has remained uncomplied with for a period of three business days <ln numlevel="1" lineno="207" slineno="3-24"/>after service, which notice may be served at any time after the rent becomes due;</subsection><subsection ssid="5-null-7" dnum="d-o" numlevel="1" lineno="208" slineno="3-25" level="2"><display>(d)</display>assigns or sublets the leased premises contrary to the covenants of the lease, or <ln numlevel="1" lineno="209" slineno="3-26"/>commits or permits waste on the premises<amend anum="0" ea="amend" pairid="170" groupid="151" style="1" owner="jchristopherson" level="1" amendtag="both"> and remains on the premises</amend> after service <ln numlevel="1" lineno="210" slineno="3-27"/>of a three calendar days' notice to quit;</subsection><subsection ssid="5-null-8" dnum="e-o" numlevel="1" lineno="211" slineno="3-28" level="2"><display>(e)</display>sets up or carries on <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">any </amend><amendoutend style="2"/>unlawful business on or in the premises <amend anum="0" ea="amend" pairid="217" groupid="197" style="1" owner="jchristopherson" level="1" amendtag="both">and remains on <ln numlevel="1" lineno="212" slineno="3-29"/>the premises </amend>after service of a three calendar days' notice to quit;</subsection><subsection ssid="5-null-9" dnum="f-o" numlevel="1" lineno="213" slineno="3-30" level="2"><display>(f)</display>suffers, permits, or maintains on or about the premises <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="223" groupid="203" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="221" groupid="201" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> nuisance, including <ln numlevel="1" lineno="214" slineno="3-31"/>nuisance as<amend anum="0" ea="amend" pairid="20" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both"> that term is</amend> defined in Section <xref depth="3" refnumber="78B-6-1107" start="0">78B-6-1107</xref> <amend anum="0" ea="amend" pairid="21" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both">and remains on the premises </amend><ln numlevel="1" lineno="215" slineno="3-32"/>after service of a three calendar days' notice to quit;</subsection><subsection ssid="5-27" dnum="_-o:g-i" numlevel="1" lineno="216" slineno="3-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><subsection ssid="5-36" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1112" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="119" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">has charge, care, custody, or control of an animal that attacks a person, <ln numlevel="1" lineno="217" slineno="3-34"/>domestic animal, or a species of protected wildlife, regardless of whether:</amend><subsection ssid="5-31" dnum="_-o:A-i" numlevel="1" lineno="218" slineno="3-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1113" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">the charge, care, custody, or control is temporary; and</amend></subsection><subsection ssid="5-35" dnum="_-o:ii-i" numlevel="1" lineno="223" slineno="3-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1118" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="end">remains on the premises after service of three calendar days' notice to quit;</amend></subsection></subsection><subsection ssid="5-null-10" dnum="g-o:i-i" numlevel="1" lineno="224" slineno="3-41" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1119" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1120" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>commits a criminal act on the premises and remains <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="60" groupid="59" style="2" owner="jchristopherson" level="1" deltag="both">in possession</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="54" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">on the <ln numlevel="1" lineno="225" slineno="3-42"/>premises</amend> after service of a three calendar days' notice to quit;</subsection><subsection ssid="5-null-11" dnum="h-o:j-i" numlevel="1" lineno="226" slineno="3-43" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1120" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1121" style="1" owner="i" level="1" amendtag="both" space="true">(j)</amend></display>continues in possession<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="67" groupid="66" style="2" owner="jchristopherson" level="1" deltag="both">, in person or by subtenant,</amend><amendoutend style="2"/> after a neglect or failure to <ln numlevel="1" lineno="227" slineno="3-44"/>perform <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="40" groupid="40" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> condition or covenant of the lease or agreement under which the<amend anum="0" ea="amend" pairid="171" groupid="152" style="1" owner="jchristopherson" level="1" amendtag="both"> real</amend> <ln numlevel="1" lineno="228" slineno="3-45"/>property is held, other than those previously mentioned, and after notice in writing <ln numlevel="1" lineno="229" slineno="3-46"/>requiring in the alternative the performance of the conditions or covenant or the <ln numlevel="1" lineno="230" slineno="3-47"/>surrender of the <amend anum="0" ea="amend" pairid="172" groupid="153" style="1" owner="jchristopherson" level="1" amendtag="both">real </amend>property, served upon the tenant and upon <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="42" groupid="42" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> subtenant in <ln numlevel="1" lineno="231" slineno="3-48"/>actual occupation of the premises remains uncomplied with for three calendar days <ln numlevel="1" lineno="232" slineno="3-49"/>after service; or</subsection><subsection ssid="5-null-12" dnum="i-o:k-i" numlevel="1" lineno="233" slineno="3-50" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1121" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1122" style="1" owner="i" level="1" amendtag="both" space="true">(k)</amend></display><subsection ssid="5-null-13" dnum="i-o" level="3" placement="sameline"><display>(i)</display>is a tenant under a bona fide tenancy as described in Section 702 of the <ln numlevel="1" lineno="234" slineno="3-51"/>Protecting Tenants at Foreclosure Act; and</subsection><subsection ssid="5-null-14" dnum="ii-o" numlevel="1" lineno="235" slineno="3-52" level="3"><display>(ii)</display>continues in possession after the effective date of a notice to vacate given in <ln numlevel="1" lineno="236" slineno="3-53"/>accordance with Section 702 of the Protecting Tenants at Foreclosure Act.</subsection></subsection></subsection><subsection ssid="5-null-15" dnum="2-o" numlevel="1" lineno="237" slineno="3-54" level="1"><display>(2)</display>After service of the notice and the time period required for the notice, the tenant, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="44" groupid="44" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> <ln numlevel="1" lineno="238" slineno="3-55"/>subtenant in actual occupation of the premises, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="46" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> mortgagee of the term, or other <ln numlevel="1" lineno="239" slineno="3-56"/>person interested in the lease's continuance may perform the condition or covenant and <ln numlevel="1" lineno="240" slineno="3-57"/>save the lease from forfeiture, except that if the covenants and conditions of the lease <ln numlevel="1" lineno="241" slineno="3-58"/>violated by the lessee cannot afterwards be performed, or the violation cannot be <ln numlevel="1" lineno="242" slineno="3-59"/>brought into compliance, a notice provided for in Subsections <xref depth="4" refnumber="78B-6-802(1)(d)" start="0">(1)(d)</xref> through <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="201" groupid="182" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78B-6-802(1)(g)" start="0">(g)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="194" groupid="175" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(i)</amend> <ln numlevel="1" lineno="243" slineno="3-60"/>may be given.</subsection><subsection ssid="5-null-16" dnum="3-o" numlevel="1" lineno="244" slineno="3-61" level="1"><display>(3)</display>Unlawful detainer by an owner resident of a mobile home is determined under <xref depth="1" refnumber="57-16" start="0">Title 57, <ln numlevel="1" lineno="245" slineno="3-62"/>Chapter 16, Mobile Home Park Residency Act</xref>.</subsection><subsection ssid="5-null-17" dnum="4-o" numlevel="1" lineno="246" slineno="3-63" level="1"><display>(4)</display>The notice provisions for nuisance in Subsections <xref depth="4" refnumber="78B-6-802(1)(d)" start="0">(1)(d)</xref> through <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="202" groupid="183" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78B-6-802(1)(g)" start="0">(g)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="195" groupid="176" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(i)</amend> do not apply to <ln numlevel="1" lineno="247" slineno="3-64"/>nuisance actions provided in Sections <xref depth="3" refnumber="78B-6-1107" start="0">78B-6-1107</xref> through <xref depth="3" refnumber="78B-6-1114" start="0">78B-6-1114</xref>.</subsection><subsection ssid="5-null-18" dnum="5-o" numlevel="1" lineno="248" slineno="3-65" level="1"><display>(5)</display>The notice to vacate requirement under 15 U.S.C. <amend anum="0" ea="amend" pairid="196" groupid="177" style="1" owner="jchristopherson" level="1" amendtag="both">Sec. </amend>9058(c), which is part of the <ln numlevel="1" lineno="249" slineno="3-66"/>Coronavirus Aid, Relief, and Economic Security Act, Pub.
