Section <bold>78A-6-356</bold> is amended to read:</secline><catline lineno="23"><bold>78A-6-356<parens/>. Child support obligation when custody of a child is vested in an <ln numlevel="1" lineno="24" slineno="1-3"/>individual or institution.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="25" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="26" slineno="1-5" level="2"><display>(a)</display>"Office" means the Office of Recovery Services.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="27" slineno="1-6" level="2"><display>(b)</display>"State custody" means that a child is in the custody of a state department, division, or <ln numlevel="1" lineno="28" slineno="1-7"/>agency, including secure care.</subsection></subsection><subsection ssid="3-null-4" dnum="2-o" numlevel="1" lineno="29" slineno="1-8" level="1"><display>(2)</display>Under this section, a juvenile court may not issue a child support order against an <ln numlevel="1" lineno="30" slineno="1-9"/>individual unless:<subsection ssid="3-null-5" dnum="a-o" numlevel="1" lineno="31" slineno="1-10" level="2"><display>(a)</display>the individual is served with notice that specifies the date and time of a hearing to <ln numlevel="1" lineno="32" slineno="1-11"/>determine the financial support of a specified child;</subsection><subsection ssid="3-null-6" dnum="b-o" numlevel="1" lineno="33" slineno="1-12" level="2"><display>(b)</display>the individual makes a voluntary appearance; or</subsection><subsection ssid="3-null-7" dnum="c-o" numlevel="1" lineno="34" slineno="1-13" level="2"><display>(c)</display>the individual submits a waiver of service.</subsection></subsection><subsection ssid="3-null-8" dnum="3-o" numlevel="1" lineno="35" slineno="1-14" level="1"><display>(3)</display>Except as provided in Subsection <xref depth="4" refnumber="78A-6-356(11)">(11)</xref>, when a juvenile court places a child in state <ln numlevel="1" lineno="36" slineno="1-15"/>custody or if the guardianship of the child has been granted to another party and an <ln numlevel="1" lineno="37" slineno="1-16"/>agreement for a guardianship subsidy has been signed by the guardian, the juvenile court:<subsection ssid="3-null-9" dnum="a-o" numlevel="1" lineno="38" slineno="1-17" level="2"><display>(a)</display>shall order the child's parent, guardian, or other obligated individual to pay child <ln numlevel="1" lineno="39" slineno="1-18"/>support for each month the child is in state custody or cared for under a grant of <ln numlevel="1" lineno="40" slineno="1-19"/>guardianship;</subsection><subsection ssid="3-null-10" dnum="b-o" numlevel="1" lineno="41" slineno="1-20" level="2"><display>(b)</display>shall inform the child's parent, guardian, or other obligated individual, verbally and <ln numlevel="1" lineno="42" slineno="1-21"/>in writing, of the requirement to pay child support in accordance with Title 81, <ln numlevel="1" lineno="43" slineno="1-22"/>Chapter 6, Child Support, and Title 81, Chapter 7, Payment and Enforcement of <ln numlevel="1" lineno="44" slineno="1-23"/>Spousal and Child Support; and</subsection><subsection ssid="3-null-11" dnum="c-o" numlevel="1" lineno="45" slineno="1-24" level="2"><display>(c)</display>may refer the establishment of a child support order to the office.</subsection></subsection><subsection ssid="3-null-12" dnum="4-o" numlevel="1" lineno="46" slineno="1-25" level="1"><display>(4)</display>When a juvenile court chooses to refer a case to the office to determine support <ln numlevel="1" lineno="47" slineno="1-26"/>obligation amounts in accordance with Title 81, Chapter 6, Child Support, the juvenile <ln numlevel="1" lineno="48" slineno="1-27"/>court shall:<subsection ssid="3-null-13" dnum="a-o" numlevel="1" lineno="49" slineno="1-28" level="2"><display>(a)</display>make the referral within three working days after the day on which the juvenile court <ln numlevel="1" lineno="50" slineno="1-29"/>holds the hearing described in Subsection <xref depth="4" refnumber="78A-6-356(2)(a)">(2)(a)</xref>; and</subsection><subsection ssid="3-null-14" dnum="b-o" numlevel="1" lineno="51" slineno="1-30" level="2"><display>(b)</display>inform the child's parent, guardian, or other obligated individual of:<subsection ssid="3-null-15" dnum="i-o" numlevel="1" lineno="52" slineno="1-31" level="3"><display>(i)</display>the requirement to contact the office within 30 days after the day on which the <ln numlevel="1" lineno="53" slineno="1-32"/>juvenile court holds the hearing described in Subsection <xref depth="4" refnumber="78A-6-356(2)(a)">(2)(a)</xref>; and</subsection><subsection ssid="3-null-16" dnum="ii-o" numlevel="1" lineno="54" slineno="1-33" level="3"><display>(ii)</display>the penalty described in Subsection <xref depth="4" refnumber="78A-6-356(6)">(6)</xref> for failure to contact the office.</subsection></subsection></subsection><subsection ssid="3-null-17" dnum="5-o" numlevel="1" lineno="55" slineno="1-34" level="1"><display>(5)</display>Liability for child support ordered under Subsection <xref depth="4" refnumber="78A-6-356(3)">(3)</xref> shall accrue:<subsection ssid="3-null-18" dnum="a-o" numlevel="1" lineno="56" slineno="1-35" level="2"><display>(a)</display>except as provided in Subsection <xref depth="4" refnumber="78A-6-356(5)(b)">(5)(b)</xref>, beginning on day 61 after the day on which <ln numlevel="1" lineno="57" slineno="1-36"/>the juvenile court holds the hearing described in Subsection <xref depth="4" refnumber="78A-6-356(2)(a)">(2)(a)</xref> if there is no <ln numlevel="1" lineno="58" slineno="1-37"/>existing child support order for the child; or</subsection><subsection ssid="3-null-19" dnum="b-o" numlevel="1" lineno="59" slineno="1-38" level="2"><display>(b)</display>beginning on the day the child is removed from the child's home, including time <ln numlevel="1" lineno="60" slineno="1-39"/>spent in detention or sheltered care, if the child is removed after having been returned <ln numlevel="1" lineno="61" slineno="1-40"/>to the child's home from state custody.</subsection></subsection><subsection ssid="3-null-20" dnum="6-o" numlevel="1" lineno="62" slineno="1-41" level="1" space="false"><display>(6)</display><subsection ssid="3-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the child's parent, guardian, or other obligated individual contacts the office <ln numlevel="1" lineno="63" slineno="1-42"/>within 30 days after the day on which the court holds the hearing described in <ln numlevel="1" lineno="64" slineno="1-43"/>Subsection <xref depth="4" refnumber="78A-6-356(2)(a)">(2)(a)</xref>, the child support order may not include a judgment for past due <ln numlevel="1" lineno="65" slineno="1-44"/>support for more than two months.</subsection><subsection ssid="3-null-22" dnum="b-o" numlevel="1" lineno="66" slineno="1-45" level="2"><display>(b)</display>Notwithstanding Subsections <xref depth="4" refnumber="78A-6-356(5)">(5)</xref> and <xref depth="4" refnumber="78A-6-356(6)(a)">(6)(a)</xref>, the juvenile court may order the liability <ln numlevel="1" lineno="67" slineno="1-46"/>of support to begin to accrue from the date of the proceeding referenced in <ln numlevel="1" lineno="68" slineno="1-47"/>Subsection <xref depth="4" refnumber="78A-6-356(3)">(3)</xref> if:<subsection ssid="3-null-23" dnum="i-o" numlevel="1" lineno="69" slineno="1-48" level="3"><display>(i)</display>the court informs the child's parent, guardian, or other obligated individual, as <ln numlevel="1" lineno="70" slineno="1-49"/>described in Subsection <xref depth="4" refnumber="78A-6-356(4)(b)">(4)(b)</xref>, and the parent, guardian, or other obligated <ln numlevel="1" lineno="71" slineno="1-50"/>individual fails to contact the office within 30 days after the day on which the <ln numlevel="1" lineno="72" slineno="1-51"/>court holds the hearing described in Subsection <xref depth="4" refnumber="78A-6-356(2)(a)">(2)(a)</xref>; and</subsection><subsection ssid="3-null-24" dnum="ii-o" numlevel="1" lineno="73" slineno="1-52" level="3"><display>(ii)</display>the office took reasonable steps under the circumstances to contact the child's <ln numlevel="1" lineno="74" slineno="1-53"/>parent, guardian, or other obligated individual within 30 days after the last day on <ln numlevel="1" lineno="75" slineno="1-54"/>which the parent, guardian, or other obligated individual was required to contact <ln numlevel="1" lineno="76" slineno="1-55"/>the office to facilitate the establishment of a child support order.</subsection></subsection><subsection ssid="3-null-25" dnum="c-o" numlevel="1" lineno="77" slineno="1-56" level="2"><display>(c)</display>For purposes of Subsection <xref depth="4" refnumber="78A-6-356(6)(b)(ii)">(6)(b)(ii)</xref>, the office is presumed to have taken reasonable <ln numlevel="1" lineno="78" slineno="1-57"/>steps if the office:<subsection ssid="3-null-26" dnum="i-o" numlevel="1" lineno="79" slineno="1-58" level="3"><display>(i)</display>has a signed, returned receipt for a certified letter mailed to the address of the <ln numlevel="1" lineno="80" slineno="1-59"/>child's parent, guardian, or other obligated individual regarding the requirement <ln numlevel="1" lineno="81" slineno="1-60"/>that a child support order be established; or</subsection><subsection ssid="3-null-27" dnum="ii-o" numlevel="1" lineno="82" slineno="1-61" level="3"><display>(ii)</display>has had a documented conversation, whether by telephone or in person, with the <ln numlevel="1" lineno="83" slineno="1-62"/>child's parent, guardian, or other obligated individual regarding the requirement <ln numlevel="1" lineno="84" slineno="1-63"/>that a child support order be established.</subsection></subsection></subsection><subsection ssid="3-null-28" dnum="7-o" numlevel="1" lineno="85" slineno="1-64" level="1"><display>(7)</display>In collecting arrears, the office shall comply with Section <xref depth="3" refnumber="26B-9-219">26B-9-219</xref> in setting a <ln numlevel="1" lineno="86" slineno="1-65"/>payment schedule or demanding payment in full.</subsection><subsection ssid="3-null-29" dnum="8-o" numlevel="1" lineno="87" slineno="1-66" level="1" space="false"><display>(8)</display><subsection ssid="3-null-30" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Unless a court orders otherwise, the child's parent, guardian, or other obligated <ln numlevel="1" lineno="88" slineno="1-67"/>individual shall pay the child support to the office.</subsection><subsection ssid="3-null-31" dnum="b-o" numlevel="1" lineno="89" slineno="1-68" level="2"><display>(b)</display>The clerk of the juvenile court, the office, or the department and the department's <ln numlevel="1" lineno="90" slineno="1-69"/>divisions shall have authority to receive periodic payments for the care and <ln numlevel="1" lineno="91" slineno="1-70"/>maintenance of the child, such as social security payments or railroad retirement <ln numlevel="1" lineno="92" slineno="1-71"/>payments made in the name of or for the benefit of the child.</subsection></subsection><subsection ssid="3-null-32" dnum="9-o" numlevel="1" lineno="93" slineno="1-72" level="1"><display>(9)</display>An existing child support order payable to a parent or other individual shall be assigned <ln numlevel="1" lineno="94" slineno="1-73"/>to the department as provided in Section <xref depth="3" refnumber="26B-9-111">26B-9-111</xref>.</subsection><subsection ssid="3-null-33" dnum="10-o" numlevel="1" lineno="95" slineno="1-74" level="1" space="false"><display>(10)</display><subsection ssid="3-null-34" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subsections <xref depth="4" refnumber="78A-6-356(4)">(4)</xref> through <xref depth="4" refnumber="78A-6-356(9)">(9)</xref> do not apply if legal custody of a child is vested by <ln numlevel="1" lineno="96" slineno="1-75"/>the juvenile court in an individual.</subsection><subsection ssid="3-null-35" dnum="b-o" numlevel="1" lineno="97" slineno="1-76" level="2" space="false"><display>(b)</display><subsection ssid="3-null-36" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If legal custody of a child is vested by the juvenile court in an individual, the <ln numlevel="1" lineno="98" slineno="1-77"/>court may order the child's parent, guardian, or other obligated individual to pay <ln numlevel="1" lineno="99" slineno="1-78"/>child support to the individual in whom custody is vested.</subsection><subsection ssid="3-null-37" dnum="ii-o" numlevel="1" lineno="100" slineno="1-79" level="3"><display>(ii)</display>In the same proceeding, the juvenile court shall inform the child's parent, <ln numlevel="1" lineno="101" slineno="1-80"/>guardian, or other obligated individual, verbally and in writing, of the requirement <ln numlevel="1" lineno="102" slineno="1-81"/>to pay child support in accordance with Title 81, Chapter 6, Child Support, and <ln numlevel="1" lineno="103" slineno="1-82"/>Title 81, Chapter 7, Payment and Enforcement of Spousal and Child Support.</subsection></subsection></subsection><subsection ssid="3-null-38" dnum="11-o" numlevel="1" lineno="104" slineno="1-83" level="1"><display>(11)</display>The juvenile court may not order an individual to pay child support for a child in state <ln numlevel="1" lineno="105" slineno="1-84"/>custody if:<subsection ssid="3-null-39" dnum="a-o" numlevel="1" lineno="106" slineno="1-85" level="2"><display>(a)</display>the individual's only form of income is a government-issued disability benefit;</subsection><subsection ssid="3-null-40" dnum="b-o" numlevel="1" lineno="107" slineno="1-86" level="2"><display>(b)</display>the benefit described in Subsection <xref depth="4" refnumber="78A-6-356(11)(a)">(11)(a)</xref> is issued because of the individual's <ln numlevel="1" lineno="108" slineno="1-87"/>disability, and not the child's disability; and</subsection><subsection ssid="3-null-41" dnum="c-o" numlevel="1" lineno="109" slineno="1-88" level="2"><display>(c)</display>the individual provides the juvenile court and the office evidence that the individual <ln numlevel="1" lineno="110" slineno="1-89"/>meets the requirements of Subsections <xref depth="4" refnumber="78A-6-356(11)(a)">(11)(a)</xref> and <xref depth="4" refnumber="78A-6-356(b)">(b)</xref>.</subsection></subsection><subsection ssid="3-null-42" dnum="12-o" numlevel="1" lineno="111" slineno="1-90" level="1" space="false"><display>(12)</display><subsection ssid="3-null-43" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The child's parent or another obligated individual is not responsible for child <ln numlevel="1" lineno="112" slineno="1-91"/>support for the period of time that the child is removed from the child's home by the <ln numlevel="1" lineno="113" slineno="1-92"/>Division of Child and Family Services if:<subsection ssid="3-null-44" dnum="i-o" numlevel="1" lineno="114" slineno="1-93" level="3" tab="1"><display>(i)</display>the juvenile court finds that there were insufficient grounds for the removal of the <ln numlevel="1" lineno="115" slineno="1-94"/>child; and</subsection><subsection ssid="3-null-45" dnum="ii-o" numlevel="1" lineno="116" slineno="1-95" level="3" tab="1"><display>(ii)</display>the child is returned to the home of the child's parent or guardian based on the <ln numlevel="1" lineno="117" slineno="1-96"/>finding described in Subsection <xref depth="4" refnumber="78A-6-356(12)(a)(i)">(12)(a)(i)</xref>.</subsection></subsection><subsection ssid="3-null-46" dnum="b-o" numlevel="1" lineno="118" slineno="1-97" level="2"><display>(b)</display>If the juvenile court finds insufficient grounds for the removal of the child under <ln numlevel="1" lineno="119" slineno="1-98"/>Subsection <xref depth="4" refnumber="78A-6-356(12)(a)">(12)(a)</xref>, but that the child is to remain in state custody, the juvenile court <ln numlevel="1" lineno="120" slineno="1-99"/>shall order that the child's parent or another obligated individual is responsible for <ln numlevel="1" lineno="121" slineno="1-100"/>child support beginning on the day on which it became improper to return the child to <ln numlevel="1" lineno="122" slineno="1-101"/>the home of the child's parent or guardian.</subsection></subsection><subsection ssid="3-null-47" dnum="13-o" numlevel="1" lineno="123" slineno="1-102" level="1"><display>(13)</display>After the juvenile court or the office establishes an individual's child support obligation <ln numlevel="1" lineno="124" slineno="1-103"/>ordered under Subsection <xref depth="4" refnumber="78A-6-356(3)">(3)</xref>, the office shall waive the obligation without further order <ln numlevel="1" lineno="125" slineno="1-104"/>of the juvenile court if:<subsection ssid="3-null-48" dnum="a-o" numlevel="1" lineno="126" slineno="1-105" level="2"><display>(a)</display>the individual's child support obligation is established in accordance with a low <ln numlevel="1" lineno="127" slineno="1-106"/>income table described in Title 81, Chapter 6, Part 3, Child Support Tables; or</subsection><subsection ssid="3-null-49" dnum="b-o" numlevel="1" lineno="128" slineno="1-107" level="2"><display>(b)</display>the individual's only source of income is a means-tested, income replacement <ln numlevel="1" lineno="129" slineno="1-108"/>payment of aid, including:<subsection ssid="3-null-50" dnum="i-o" numlevel="1" lineno="130" slineno="1-109" level="3"><display>(i)</display>cash assistance provided under Title 35A, Chapter 3, Part 3, Family Employment <ln numlevel="1" lineno="131" slineno="1-110"/>Program; or</subsection><subsection ssid="3-null-51" dnum="ii-o" numlevel="1" lineno="132" slineno="1-111" level="3"><display>(ii)</display>cash benefits received under General Assistance, social security income, or social <ln numlevel="1" lineno="133" slineno="1-112"/>security disability income.</subsection></subsection></subsection><subsection ssid="3-52" dnum="_-o:14-i" numlevel="1" lineno="134" slineno="1-113" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(14)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">If there is an abuse, neglect, or dependency proceeding pending before the juvenile <ln numlevel="1" lineno="135" slineno="1-114"/>court and the juvenile court or the Division of Child and Family Services places the <ln numlevel="1" lineno="136" slineno="1-115"/>child who is the subject of the proceeding with a relative who is not the child's other <ln numlevel="1" lineno="137" slineno="1-116"/>parent, the office shall waive, without an order from a court, an individual's child <ln numlevel="1" lineno="138" slineno="1-117"/>support obligation for the child if:</amend><subsection ssid="3-54" dnum="_-o:a-i" numlevel="1" lineno="139" slineno="1-118" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">the individual's child support obligation is established in accordance with a low <ln numlevel="1" lineno="140" slineno="1-119"/>income table described in Title 81, Chapter 6, Part 3, Child Support Tables; pairid="1058" style="2" owner="o" level="1" deltag="start">(b)</amend></display><subsection ssid="6-null-4" dnum="i-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" placement="sameline"><display><amend anum="0" ea="erase" pairid="1059" style="2" owner="o" level="1">(i)</amend></display><amend anum="0" ea="erase" pairid="36" groupid="29" style="2" owner="jchristopherson" level="1" deltag="end">If the issue is raised prior to the adjudication, genetic testing may be ordered <ln numlevel="1" lineno="155" slineno="2-9"/>by the tribunal in testing may result in an <ln numlevel="1" lineno="157" slineno="2-11"/>order allowing a motherless calculation of parentage.  </amend><amendoutend style="2"/></subsection><subsection ssid="6-null-6" dnum="iii-o:_-i" numlevel="1" lineno="158" slineno="2-12" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1061" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="55" groupid="41" style="2" owner="jchristopherson" level="1" deltag="end">Failure of the birth mother to make the child available may not result in a <ln numlevel="1" lineno="159" slineno="2-13"/>determination that the presumed father is not the father, but shall allow for <ln numlevel="1" lineno="160" slineno="2-14"/>appropriate proceedings to compel the cooperation of the birth mother.  </amend><amendoutend style="2"/></subsection><subsection ssid="6-null-7" dnum="iv-o:_-i" numlevel="1" lineno="161" slineno="2-15" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1062" style="2" owner="o" level="1" deltag="start">(iv)</amend></display><amend anum="0" ea="erase" pairid="56" groupid="42" style="2" owner="jchristopherson" level="1" deltag="end">If the question of parentage has been raised in the pleadings in a divorce and the <ln numlevel="1" lineno="162" slineno="2-16"/>tribunal addresses the issue and enters an order, the parties are estopped from <ln numlevel="1" lineno="163" slineno="2-17"/>raising the issue again, and the order of the tribunal may not be challenged on the <ln numlevel="1" lineno="164" slineno="2-18"/>basis of material mistake of fact.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="6-null-8" dnum="c-o:_-i" numlevel="1" lineno="165" slineno="2-19" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1063" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="99" groupid="71" style="2" owner="jchristopherson" level="1" deltag="end">If the presumed father seeks to rebut the presumption of parentage, then denial of a <ln numlevel="1" lineno="166" slineno="2-20"/>motion seeking an order for genetic testing or a decision to disregard genetic test <ln numlevel="1" lineno="167" slineno="2-21"/>results shall be based on a preponderance of the evidence.</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-9" dnum="d-o:_-i" numlevel="1" lineno="168" slineno="2-22" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1064" style="2" owner="o" level="1" deltag="start">(d)</amend></display><amend anum="0" ea="erase" pairid="100" groupid="72" style="2" owner="jchristopherson" level="1" deltag="end">If the birth mother seeks to rebut the presumption of parentage, the birth mother has <ln numlevel="1" lineno="169" slineno="2-23"/>the burden to show by a preponderance of the evidence that it would be in the best <ln numlevel="1" lineno="170" slineno="2-24"/>interests of the child to disestablish the parent-child relationship.</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-10" dnum="e-o:_-i" numlevel="1" lineno="171" slineno="2-25" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1065" style="2" owner="o" level="1" deltag="start">(e)</amend></display><subsection ssid="6-null-11" dnum="i-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" placement="sameline"><display><amend anum="0" ea="erase" pairid="1066" style="2" owner="o" level="1">(i)</amend></display><amend anum="0" ea="erase" pairid="101" groupid="73" style="2" owner="jchristopherson" level="1" deltag="end">If a child support services agency seeks to rebut the presumption of parentage <ln numlevel="1" lineno="172" slineno="2-26"/>and the presumed father opposes the rebuttal, the agency's request shall be denied.  </amend><amendoutend style="2"/></subsection><subsection ssid="6-null-12" dnum="ii-o:_-i" numlevel="1" lineno="173" slineno="2-27" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1067" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="102" groupid="74" style="2" owner="jchristopherson" level="1" deltag="end">Otherwise, the denial of the agency's motion seeking an order for genetic testing <ln numlevel="1" lineno="174" slineno="2-28"/>or a decision to disregard genetic test results shall be based on a preponderance of <ln numlevel="1" lineno="175" slineno="2-29"/>the evidence, taking into account the best interests of the child.</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="6-24" dnum="_-o:1-i" numlevel="1" lineno="176" slineno="2-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><subsection ssid="6-31" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">The presumed father, the birth mother, or a child support services agency may <ln numlevel="1" lineno="177" slineno="2-31"/>raise the parentage of a child conceived or born during a marriage between the <ln numlevel="1" lineno="178" slineno="2-32"/>presumed father and birth mother if:</amend><subsection ssid="6-25" dnum="_-o:i-i" numlevel="1" lineno="179" slineno="2-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">the presumption of the father's parentage arises from Subsection <xref depth="4" refnumber="81-5-204(1)(a)">81-5-204(1)(a)</xref>, <ln numlevel="1" lineno="180" slineno="2-34"/>(b), or (c); and</amend></subsection><subsection ssid="6-26" dnum="_-o:ii-i" numlevel="1" lineno="181" slineno="2-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">the issue is raised before the filing of an action for divorce or in the pleadings at <ln numlevel="1" lineno="182" slineno="2-36"/>the time of the divorce.</amend></subsection></subsection><subsection ssid="6-27" dnum="_-o:b-i" numlevel="1" lineno="183" slineno="2-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">If the issue of parentage is raised before the adjudication of the divorce:</amend><subsection ssid="6-28" dnum="_-o:i-i" numlevel="1" lineno="184" slineno="2-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">subject to Subsection <xref depth="4" refnumber="81-5-607(1)(c)">(1)(c)</xref>, the presumed father may rebut the presumption by <ln numlevel="1" lineno="185" slineno="2-39"/>providing genetic test results to a tribunal that exclude the presumed father as the <ln numlevel="1" lineno="186" slineno="2-40"/>genetic father of the child; or</amend></subsection><subsection ssid="6-29" dnum="_-o:ii-i" numlevel="1" lineno="187" slineno="2-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">a tribunal may order genetic testing as described in Section <xref depth="3" refnumber="81-5-608">81-5-608</xref>.</amend></subsection></subsection><subsection ssid="6-30" dnum="_-o:c-i" numlevel="1" lineno="188" slineno="2-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="end">If the birth mother challenges the presumed father's genetic test results under <ln numlevel="1" lineno="189" slineno="2-43"/>Subsection <xref depth="4" refnumber="81-5-607(1)(b)(i)">(1)(b)(i)</xref>, the tribunal shall order genetic testing under Subsection <xref depth="4" refnumber="81-5-607(1)(b)(ii)">(1)(b)(ii)</xref>.</amend></subsection><subsection ssid="6-32" dnum="_-o:d-i" numlevel="1" lineno="190" slineno="2-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">If the presumed father seeks to rebut the presumption of parentage, the denial of a <ln numlevel="1" lineno="191" slineno="2-45"/>motion seeking an order for genetic testing, or a decision to disregard genetic test <ln numlevel="1" lineno="192" slineno="2-46"/>results, is based on a preponderance of the evidence.</amend></subsection><subsection ssid="6-33" dnum="_-o:e-i" numlevel="1" lineno="193" slineno="2-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">If the birth mother seeks to rebut the presumption of parentage, the birth mother has <ln numlevel="1" lineno="194" slineno="2-48"/>the burden to show, by a preponderance of the evidence, that it would be in the best <ln numlevel="1" lineno="195" slineno="2-49"/>interest of the child to disestablish the parent-child relationship.</amend></subsection><subsection ssid="6-34" dnum="_-o:f-i" numlevel="1" lineno="196" slineno="2-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="123" groupid="91" style="1" owner="jchristopherson" level="1" amendtag="end">If a child support services agency seeks to rebut the presumption of parentage, and <ln numlevel="1" lineno="197" slineno="2-51"/>the presumed father opposes the rebuttal, the tribunal shall deny the agency's request.</amend></subsection><subsection ssid="6-35" dnum="_-o:g-i" numlevel="1" lineno="198" slineno="2-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="135" groupid="99" style="1" owner="jchristopherson" level="1" amendtag="end">Except for Subsection <xref depth="4" refnumber="81-5-607(1)(f)">(1)(f)</xref>, the denial of a child support services agency's motion <ln numlevel="1" lineno="199" slineno="2-53"/>seeking an order for genetic testing, or a decision to disregard test results, is based on <ln numlevel="1" lineno="200" slineno="2-54"/>a preponderance of the evidence, taking into account the best interest of the child.</amend></subsection></subsection><subsection ssid="6-null-13" dnum="2-o" numlevel="1" lineno="201" slineno="2-55" level="1"><display>(2)</display>For the presumption outside of marriage described in Subsection <xref refnumber="81-5-204(1)(d)" depth="4">81-5-204(1)(d)</xref>, the <ln numlevel="1" lineno="202" slineno="2-56"/>presumption may be rebutted at any time if the tribunal determines that the presumed <ln numlevel="1" lineno="203" slineno="2-57"/>father and the birth mother of the child neither cohabited nor engaged in sexual <ln numlevel="1" lineno="204" slineno="2-58"/>intercourse with each other during the probable time of conception.</subsection><subsection ssid="6-null-14" dnum="3-o" numlevel="1" lineno="205" slineno="2-59" level="1"><display>(3)</display>The presumption may be rebutted by:<subsection ssid="6-null-15" dnum="a-o" numlevel="1" lineno="206" slineno="2-60" level="2"><display>(a)</display>genetic test results that exclude the presumed father;</subsection><subsection ssid="6-null-16" dnum="b-o" numlevel="1" lineno="207" slineno="2-61" level="2"><display>(b)</display>genetic test results that rebuttably identify another man as the father in accordance <ln numlevel="1" lineno="208" slineno="2-62"/>with Section <xref depth="3" refnumber="81-5-505">81-5-505</xref>;</subsection><subsection ssid="6-null-17" dnum="c-o" numlevel="1" lineno="209" slineno="2-63" level="2"><display>(c)</display>evidence that the presumed father and the birth mother of the child neither cohabited <ln numlevel="1" lineno="210" slineno="2-64"/>nor engaged in sexual intercourse with each other during the probable time of <ln numlevel="1" lineno="211" slineno="2-65"/>conception; or</subsection><subsection ssid="6-null-18" dnum="d-o" numlevel="1" lineno="212" slineno="2-66" level="2"><display>(d)</display>an adjudication under this part.</subsection></subsection><subsection ssid="6-null-19" dnum="4-o" numlevel="1" lineno="213" slineno="2-67" level="1"><display>(4)</display>There is no presumption to rebut if the presumed father was properly served and there <ln numlevel="1" lineno="214" slineno="2-68"/>has been a final adjudication of the issue.</subsection></section></bsec><bsec buid="7" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="215" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="215">Section 3.  <bold>Effective
