Monson</sponsorhead><otherSponsorhead>Senate Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill creates the School-b<marker pairid="0"/>ased Behavioral Health Pilot Program.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">defines terms;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">requires a report upon request;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">creates the School-based Behavioral Health Pilot Program (program) to award program <ln numlevel="1" lineno="11" slineno="0-11"/>funds to an implementation partner to:<hl numlevel="1" lineno="12" slineno="0-12" level="2">implement a multi-tiered system of mental health support; and</hl><hl numlevel="1" lineno="13" slineno="0-13" level="2">enhance mental health in schools;</hl></hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">requires the Department of Health and Human Services to:<hl numlevel="1" lineno="15" slineno="0-15" level="2">solicit proposals to participate in the program;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="2"> coordinate the implementation of the program with another, similar grant program;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="2">enter into a contract or memorandum of understanding with certain entities to <ln numlevel="1" lineno="18" slineno="0-18"/>administer the program; and</hl><hl numlevel="1" lineno="19" slineno="0-19" level="2">distribute program funds;</hl></hl><hl numlevel="1" lineno="20" slineno="0-20" level="1">requires a local education agency (LEA) or regional education service agency (RESA) <ln numlevel="1" lineno="21" slineno="0-21"/>participating in the program to:<hl numlevel="1" lineno="22" slineno="0-22" level="2">contract with an implementation partner;</hl><hl numlevel="1" lineno="23" slineno="0-23" level="2">comply with certain requirements; and</hl><hl numlevel="1" lineno="24" slineno="0-24" level="2">submit an application to the Department of Health and Human Services;</hl></hl><hl numlevel="1" lineno="25" slineno="0-25" level="1">requires an implementation partner to:<hl numlevel="1" lineno="26" slineno="0-26" level="2">contract with and provide certain support to a participating LEA or RESA;</hl><hl numlevel="1" lineno="27" slineno="0-27" level="2">use program funds for certain eligible initiatives; and</hl><hl numlevel="1" lineno="28" slineno="0-28" level="2">support the implementation of the program;</hl></hl><hl numlevel="1" lineno="29" slineno="0-29" level="1">creates a repeal date for the program; and</hl><hl numlevel="1" lineno="30" slineno="0-30" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="31" slineno="0-31" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="32">None</moniNone><oc numlevel="1" lineno="33" slineno="0-33">Other Special Clauses:<ocl type="effdate" sort="2" numlevel="1" lineno="34" slineno="0-34">This bill provides a special effective date.</ocl></oc><sa numlevel="1" lineno="35" slineno="0-35">Utah Code Sections Affected:<saamd numlevel="1" lineno="36" slineno="0-36"><snhead>AMENDS:</snhead><sn num="53F-9-204" src="code" uid="C53F-9-S204_2026070120260701" buid="15" sort="53F09 02040020260701" numlevel="1" lineno="37" slineno="0-37"><bold>53F-9-204</bold>, as last amended by Laws of Utah 2025, Chapters 413, 433</sn><sn num="53G-9-902" src="code" uid="C53G-9-S902_2026070120260701" buid="20" sort="53G09 09020020260701" numlevel="1" lineno="38" slineno="0-38"><bold>53G-9-902</bold>, as last amended by Laws of Utah 2025, First Special Session, Chapter 9</sn><sn num="63I-1-253" src="code" uid="C63I-1-S253_2026070120260701" buid="12" sort="63I01 02530020260701" numlevel="1" lineno="39" slineno="0-39"><bold>63I-1-253</bold>, as last amended by Laws of Utah 2025, First Special Session, Chapter 9</sn></saamd><saent numlevel="1" lineno="40" slineno="0-40"><snhead>ENACTS:</snhead><sn num="53F-5-224" src="code" uid="C53F-5-S224_2026070120260701" buid="6" sort="53F05 02240020260701" numlevel="1" lineno="41" slineno="0-41"><bold>53F-5-224</bold>, Utah Code Annotated 1953</sn></saent></sa></lt><enacthead lineno="42"/><enact numlevel="1" lineno="43" slineno="0-43">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="6" num="53F-5-224" type="enact" src="code" uid="C53F-5-S224_2026070120260701" sort="53F05 02240020260701" numlevel="1" lineno="44" slineno="1-1" sn="1"><section numlevel="1" lineno="45" slineno="1-2" number="53F-5-224" type="enact"><secline lineno="44">Section 1. Section <bold>53F-5-224</bold> is enacted to read:</secline><catline lineno="45"><bold>53F-5-224<parens/>. School-based Behavioral Health Pilot Program.</bold></catline><subsection ssid="6-2" dnum="_-o:1-i" numlevel="1" lineno="46" slineno="1-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="6-181" dnum="_-o:a-i" numlevel="1" lineno="47" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="880" groupid="648" style="1" owner="jchristopherson" level="1" amendtag="end">"Group-based mental health services" means structured mental health or behavioral <ln numlevel="1" lineno="48" slineno="1-5"/>health services that qualified personnel deliver to more than one student at the same <ln numlevel="1" lineno="49" slineno="1-6"/>time, if:</amend><subsection ssid="6-182" dnum="_-o:i-i" numlevel="1" lineno="50" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="887" groupid="652" style="1" owner="jchristopherson" level="1" amendtag="end">each student who participates has documented parental consent;</amend></subsection><subsection ssid="6-183" dnum="_-o:ii-i" numlevel="1" lineno="51" slineno="1-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="892" groupid="656" style="1" owner="jchristopherson" level="1" amendtag="end">qualified personnel deliver the services in a setting where only students who have <ln numlevel="1" lineno="52" slineno="1-9"/>expressed consent are present; and</amend></subsection><subsection ssid="6-184" dnum="_-o:iii-i" numlevel="1" lineno="53" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="897" groupid="660" style="1" owner="jchristopherson" level="1" amendtag="end">qualified personnel deliver the services in a manner consistent with state and <ln numlevel="1" lineno="54" slineno="1-11"/>federal law.</amend></subsection></subsection><subsection ssid="6-53" dnum="_-o:b-i" numlevel="1" lineno="55" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="339" groupid="242" style="1" owner="jchristopherson" level="1" amendtag="end">"Implementation partner" means a public institution of higher education or other <ln numlevel="1" lineno="56" slineno="1-13"/>entity receiving state funds with demonstrated expertise in school-based behavioral <ln numlevel="1" lineno="57" slineno="1-14"/>health, workforce development, and coordination of behavioral health services that <ln numlevel="1" lineno="58" slineno="1-15"/>enters into a contract or memorandum of understanding with the Department of <ln numlevel="1" lineno="59" slineno="1-16"/>Health and Human Services to support implementation of the program.</amend></subsection><subsection ssid="6-28" dnum="_-o:c-i" numlevel="1" lineno="60" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><subsection ssid="6-30" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="136" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="end">"Multi-tiered system of support" means a coordinated, data-informed <ln numlevel="1" lineno="61" slineno="1-18"/>framework for delivering school-based mental health supports, prevention <ln numlevel="1" lineno="62" slineno="1-19"/>services, and behavioral health interventions through layered tiers of increasing <ln numlevel="1" lineno="63" slineno="1-20"/>intensity, implemented as a coordinated system in active collaboration with a:</amend><subsection ssid="6-175" dnum="_-o:A-i" numlevel="1" lineno="64" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="855" groupid="628" style="1" owner="jchristopherson" level="1" amendtag="end">parent;</amend></subsection><subsection ssid="6-178" dnum="_-o:B-i" numlevel="1" lineno="65" slineno="1-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="869" groupid="639" style="1" owner="jchristopherson" level="1" amendtag="end">school;</amend></subsection><subsection ssid="6-177" dnum="_-o:C-i" numlevel="1" lineno="66" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="865" groupid="636" style="1" owner="jchristopherson" level="1" amendtag="end">local mental health authority;</amend></subsection><subsection ssid="6-179" dnum="_-o:D-i" numlevel="1" lineno="67" slineno="1-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="874" groupid="643" style="1" owner="jchristopherson" level="1" amendtag="end">community coalition or prevention network; and</amend></subsection><subsection ssid="6-198" dnum="_-o:ii-i" numlevel="1" lineno="114" slineno="1-71" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="960" groupid="707" style="1" owner="jchristopherson" level="1" amendtag="end">contracts with an implementation partner to implement the program.</amend></subsection></subsection><subsection ssid="6-65" dnum="_-o:f-i" numlevel="1" lineno="115" slineno="1-72" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="330" groupid="235" style="1" owner="jchristopherson" level="1" amendtag="end">"Program" means the School-based Behavioral Health Pilot Program created in <ln numlevel="1" lineno="116" slineno="1-73"/>Subsection <xref depth="4" refnumber="53F-5-224(2)">(2)</xref>.</amend></subsection><subsection ssid="6-15" dnum="_-o:g-i" numlevel="1" lineno="117" slineno="1-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">"Regional education service agency" or "RESA" means the same as the term is <ln numlevel="1" lineno="118" slineno="1-75"/>defined in Section <xref depth="3" refnumber="53G-4-410">53G-4-410</xref>.</amend></subsection><subsection ssid="6-45" dnum="_-o:h-i" numlevel="1" lineno="119" slineno="1-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="238" groupid="163" style="1" owner="jchristopherson" level="1" amendtag="end">"Telehealth services" means the same as that term is defined in <xref depth="3" refnumber="26B-4-704">26B-4-704</xref>.</amend></subsection></subsection><subsection ssid="6-5" dnum="_-o:2-i" numlevel="1" lineno="120" slineno="1-77" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">There is created a three-year pilot program known as the School-based Behavioral <ln numlevel="1" lineno="121" slineno="1-78"/>Health Pilot Program, that the Department of Health and Human Services administers, to <ln numlevel="1" lineno="122" slineno="1-79"/>support implementation of a coordinated, statewide approach to school-based behavioral <ln numlevel="1" lineno="123" slineno="1-80"/>health services through:</amend><subsection ssid="6-78" dnum="_-o:a-i" numlevel="1" lineno="124" slineno="1-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="395" groupid="284" style="1" owner="jchristopherson" level="1" amendtag="end">delivery of technical assistance and training to implement a multi-tiered system of <ln numlevel="1" lineno="125" slineno="1-82"/>support; and</amend></subsection><subsection ssid="6-79" dnum="_-o:b-i" numlevel="1" lineno="126" slineno="1-83" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="400" groupid="288" style="1" owner="jchristopherson" level="1" amendtag="end">enhancement of mental health service operations in schools, including:</amend><subsection ssid="6-80" dnum="_-o:i-i" numlevel="1" lineno="127" slineno="1-84" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="405" groupid="292" style="1" owner="jchristopherson" level="1" amendtag="end">prevention;</amend></subsection><subsection ssid="6-81" dnum="_-o:ii-i" numlevel="1" lineno="128" slineno="1-85" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="410" groupid="296" style="1" owner="jchristopherson" level="1" amendtag="end">intervention; and</amend></subsection><subsection ssid="6-82" dnum="_-o:iii-i" numlevel="1" lineno="129" slineno="1-86" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="415" groupid="300" style="1" owner="jchristopherson" level="1" amendtag="end">recovery services.</amend></subsection></subsection></subsection><subsection ssid="6-6" dnum="_-o:3-i" numlevel="1" lineno="130" slineno="1-87" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">The Department of Health and Human Services shall:</amend><subsection ssid="6-14" dnum="_-o:a-i" numlevel="1" lineno="131" slineno="1-88" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">solicit proposals from:</amend><subsection ssid="6-200" dnum="_-o:i-i" numlevel="1" lineno="132" slineno="1-89" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="965" groupid="711" style="1" owner="jchristopherson" level="1" amendtag="end">an LEA or RESA to participate in the program; and</amend></subsection><subsection ssid="6-201" dnum="_-o:ii-i" numlevel="1" lineno="133" slineno="1-90" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="971" groupid="716" style="1" owner="jchristopherson" level="1" amendtag="end">an implementation partner to receive program funds;</amend></subsection></subsection><subsection ssid="6-16" dnum="_-o:b-i" numlevel="1" lineno="134" slineno="1-91" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="74" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">subject to legislative appropriations:</amend><subsection ssid="6-157" dnum="_-o:i-i" numlevel="1" lineno="135" slineno="1-92" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="762" groupid="562" style="1" owner="jchristopherson" level="1" amendtag="end">award program funds to an implementation partner on a competitive basis; and</amend></subsection><subsection ssid="6-167" dnum="_-o:D-i" numlevel="1" lineno="142" slineno="1-99" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="818" groupid="604" style="1" owner="jchristopherson" level="1" amendtag="end">evaluation;</amend></subsection></subsection></subsection><subsection ssid="6-168" dnum="_-o:c-i" numlevel="1" lineno="143" slineno="1-100" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="822" groupid="607" style="1" owner="jchristopherson" level="1" amendtag="end">evaluate how the program's standards, infrastructure, and outcomes compare to <ln numlevel="1" lineno="144" slineno="1-101"/>implementation of the grant program described in Section <xref depth="3" refnumber="53F-2-415">53F-2-415</xref>, including <ln numlevel="1" lineno="145" slineno="1-102"/>identification of statutory, regulatory, or programmatic gaps that limit statewide <ln numlevel="1" lineno="146" slineno="1-103"/>consistency, accountability, or equitable access to school-based behavioral health <ln numlevel="1" lineno="147" slineno="1-104"/>services;</amend></subsection><subsection ssid="6-162" dnum="_-o:d-i" numlevel="1" lineno="148" slineno="1-105" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="791" groupid="584" style="1" owner="jchristopherson" level="1" amendtag="end">coordinate the implementation of the program with behavioral health, Medicaid, and <ln numlevel="1" lineno="149" slineno="1-106"/>school-based health initiatives, to:</amend><subsection ssid="6-163" dnum="_-o:i-i" numlevel="1" lineno="150" slineno="1-107" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="796" groupid="588" style="1" owner="jchristopherson" level="1" amendtag="end">avoid duplication; and</amend></subsection><subsection ssid="6-164" dnum="_-o:ii-i" numlevel="1" lineno="151" slineno="1-108" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="801" groupid="592" style="1" owner="jchristopherson" level="1" amendtag="end">promote alignment with practices established for the program, including:</amend><subsection ssid="6-165" dnum="_-o:A-i" numlevel="1" lineno="152" slineno="1-109" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="806" groupid="596" style="1" owner="jchristopherson" level="1" amendtag="end">statewide screening; and</amend></subsection><subsection ssid="6-166" dnum="_-o:B-i" numlevel="1" lineno="153" slineno="1-110" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="811" groupid="600" style="1" owner="jchristopherson" level="1" amendtag="end">referral, training, and data-reporting practices;</amend></subsection></subsection></subsection><subsection ssid="6-170" dnum="_-o:e-i" numlevel="1" lineno="154" slineno="1-111" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="831" groupid="610" style="1" owner="jchristopherson" level="1" amendtag="end">on or before December 31, 2028, submit to the Health and Human Services Interim <ln numlevel="1" lineno="155" slineno="1-112"/>Committee findings and recommendations regarding how to apply the requirements, <ln numlevel="1" lineno="156" slineno="1-113"/>standards, or practices the program develops more broadly to strengthen the grant <ln numlevel="1" lineno="157" slineno="1-114"/>program described in Section <xref depth="3" refnumber="53F-2-415">53F-2-415</xref>;</amend></subsection><subsection ssid="6-90" dnum="_-o:f-i" numlevel="1" lineno="158" slineno="1-115" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="449" groupid="325" style="1" owner="jchristopherson" level="1" amendtag="end">retain responsibility for program administration, fiscal oversight, accountability, and <ln numlevel="1" lineno="159" slineno="1-116"/>reporting related to school-based behavioral health services under the program; and</amend></subsection><subsection ssid="6-240" dnum="_-o:D-i" numlevel="1" lineno="180" slineno="1-137" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="1142" groupid="812" style="1" owner="jchristopherson" level="1" amendtag="end">outlining metrics the LEA or RESA will use to measure program <ln numlevel="1" lineno="181" slineno="1-138"/>effectiveness;</amend></subsection></subsection><subsection ssid="6-202" dnum="_-o:ii-i" numlevel="1" lineno="182" slineno="1-139" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="972" groupid="717" style="1" owner="jchristopherson" level="1" amendtag="end">contract with an implementation partner to which the Department of Health and <ln numlevel="1" lineno="183" slineno="1-140"/>Human Services awards program funds;</amend></subsection><subsection ssid="6-99" dnum="_-o:iii-i" numlevel="1" lineno="184" slineno="1-141" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="491" groupid="358" style="1" owner="jchristopherson" level="1" amendtag="end">implement statewide student mental health screening practices in accordance <ln numlevel="1" lineno="185" slineno="1-142"/>with Section <xref depth="3" refnumber="53F-2-522">53F-2-522</xref>;</amend></subsection><subsection ssid="6-104" dnum="_-o:iv-i" numlevel="1" lineno="186" slineno="1-143" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1086" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="516" groupid="374" style="1" owner="jchristopherson" level="1" amendtag="end">comply the with parental notification and consent requirements described in <ln numlevel="1" lineno="187" slineno="1-144"/>Section <xref depth="3" refnumber="53G-9-902">53G-9-902</xref>;</amend></subsection><subsection ssid="6-101" dnum="_-o:v-i" numlevel="1" lineno="188" slineno="1-145" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="501" groupid="362" style="1" owner="jchristopherson" level="1" amendtag="end">implement statewide referral protocols;</amend></subsection><subsection ssid="6-102" dnum="_-o:vi-i" numlevel="1" lineno="189" slineno="1-146" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="506" groupid="366" style="1" owner="jchristopherson" level="1" amendtag="end">participate in statewide data collection and reporting requirements; Section <bold>53F-9-204</bold> is amended to read:</secline><catline lineno="249"><bold>53F-9-204<parens/>. Public Education Economic Stabilization Restricted Account.</bold></catline><subsection ssid="15-null-1" dnum="1-o" numlevel="1" lineno="250" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>There is created within the Uniform School Fund a restricted account known as the <ln numlevel="1" lineno="251" slineno="2-4"/>"Public Education Economic Stabilization Restricted Account."</subsection><subsection ssid="15-null-2" dnum="2-o" numlevel="1" lineno="252" slineno="2-5" level="1" space="false"><display>(2)</display><subsection ssid="15-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="53F-9-204(2)(b)">(2)(b)</xref>, the account shall be funded from the <ln numlevel="1" lineno="253" slineno="2-6"/>following revenue sources:<subsection ssid="15-null-4" dnum="i-o" numlevel="1" lineno="254" slineno="2-7" level="3" tab="1"><display>(i)</display>15% of the difference between, as determined by the Office of the Legislative <ln numlevel="1" lineno="255" slineno="2-8"/>Fiscal Analyst:<subsection ssid="15-null-5" dnum="A-o" numlevel="1" lineno="256" slineno="2-9" level="4"><display>(A)</display>the estimated amount of ongoing Income Tax Fund and Uniform School Fund <ln numlevel="1" lineno="257" slineno="2-10"/>revenue available for the Legislature to appropriate for the next fiscal year; and</subsection><subsection ssid="15-null-6" dnum="B-o" numlevel="1" lineno="258" slineno="2-11" level="4"><display>(B)</display>the amount of ongoing appropriations from the Income Tax Fund and Uniform <ln numlevel="1" lineno="259" slineno="2-12"/>School Fund in the current fiscal year; and</subsection></subsection><subsection ssid="15-null-7" dnum="ii-o" numlevel="1" lineno="260" slineno="2-13" level="3" tab="1"><display>(ii)</display>other appropriations as the Legislature may designate.</subsection></subsection><subsection ssid="15-null-8" dnum="b-o" numlevel="1" lineno="261" slineno="2-14" level="2"><display>(b)</display>If the appropriation described in Subsection <xref depth="4" refnumber="53F-9-204(2)(a)">(2)(a)</xref> would cause the ongoing <ln numlevel="1" lineno="262" slineno="2-15"/>appropriations to the account to exceed 11% of Uniform School Fund appropriations <ln numlevel="1" lineno="263" slineno="2-16"/>described in Section <xref depth="3" refnumber="53F-9-201.1">53F-9-201.1</xref> for the same fiscal year, the Legislature shall <ln numlevel="1" lineno="264" slineno="2-17"/>appropriate only those funds necessary to ensure that the ongoing appropriations to <ln numlevel="1" lineno="265" slineno="2-18"/>the account equal 11% of Uniform School Fund appropriations for that fiscal year.</subsection></subsection><subsection ssid="15-null-9" dnum="3-o" numlevel="1" lineno="266" slineno="2-19" level="1" format="full"><display>(3)</display>Subject to the availability of ongoing appropriations to the account, in accordance with <eol numlevel="1" lineno="267" slineno="2-20"/>Utah Constitution, Article X, Section 5, Subsection <xref depth="4" refnumber="53F-9-204(4)">(4)</xref>, the ongoing appropriation to the <ln numlevel="1" lineno="268" slineno="2-21"/>account shall be used to fund:<subsection ssid="15-null-10" dnum="a-o" numlevel="1" lineno="269" slineno="2-22" level="2"><display>(a)</display>except for a year described in Subsection <xref depth="4" refnumber="53F-9-204(3)(b)">(3)(b)</xref> or <xref depth="4" refnumber="53F-9-204(c)">(c)</xref>, one-time appropriations to the <ln numlevel="1" lineno="270" slineno="2-23"/>public education system, including at least $65,000,000 to the Catalyst Center Grant <ln numlevel="1" lineno="271" slineno="2-24"/>Program described in Section <xref depth="3" refnumber="53E-3-507.1">53E-3-507.1</xref>;</subsection><subsection ssid="15-null-11" dnum="b-o" numlevel="1" lineno="272" slineno="2-25" level="2"><display>(b)</display>the Minimum School Program for a year in which Income Tax Fund revenue and <ln numlevel="1" lineno="273" slineno="2-26"/>Uniform School Fund revenue are insufficient to fund:<subsection ssid="15-null-12" dnum="i-o" numlevel="1" lineno="274" slineno="2-27" level="3"><display>(i)</display>ongoing appropriations to the public education system; and</subsection><subsection ssid="15-null-13" dnum="ii-o" numlevel="1" lineno="275" slineno="2-28" level="3"><display>(ii)</display>enrollment growth and inflation estimates, as defined in Section <xref depth="3" refnumber="53F-9-201.1">53F-9-201.1</xref>; and</subsection></subsection><subsection ssid="15-null-14" dnum="c-o" numlevel="1" lineno="276" slineno="2-29" level="2"><display>(c)</display>the minimum basic local amount as defined in Section <xref depth="3" refnumber="53F-2-301">53F-2-301</xref> for a year in which <ln numlevel="1" lineno="277" slineno="2-30"/>the minimum basic tax rate, as defined in Section <xref depth="3" refnumber="53F-2-301">53F-2-301</xref>, is insufficient to <ln numlevel="1" lineno="278" slineno="2-31"/>generate the amount described in Subsection <xref refnumber="53F-2-301(2)(a)" depth="4">53F-2-301(2)(a)</xref>.</subsection></subsection><subsection ssid="15-null-15" dnum="4-o" numlevel="1" lineno="279" slineno="2-32" level="1" space="false"><display>(4)</display><subsection ssid="15-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The account shall earn interest.</subsection><subsection ssid="15-null-17" dnum="b-o" numlevel="1" lineno="280" slineno="2-33" level="2"><display>(b)</display>All interest earned on account money shall be deposited in the account.</subsection></subsection><subsection ssid="15-null-18" dnum="5-o" numlevel="1" lineno="281" slineno="2-34" level="1"><display>(5)</display>On or before December 31, 2023, and every three years thereafter, the Office of the <ln numlevel="1" lineno="282" slineno="2-35"/>Legislative Fiscal Analyst shall:<subsection ssid="15-null-19" dnum="a-o" numlevel="1" lineno="283" slineno="2-36" level="2"><display>(a)</display>review the percentages described in Subsections <xref depth="4" refnumber="53F-9-204(2)(a)(i)">(2)(a)(i)</xref> and <xref depth="4" refnumber="53F-9-204(2)(b)">(2)(b)</xref>; and</subsection><subsection ssid="15-null-20" dnum="b-o" numlevel="1" lineno="284" slineno="2-37" level="2"><display>(b)</display>recommend to the Executive Appropriations Committee any changes based on the <ln numlevel="1" lineno="285" slineno="2-38"/>review described in Subsection <xref depth="4" refnumber="53F-9-204(5)(a)">(5)(a)</xref>.</subsection></subsection><subsection ssid="15-null-21" dnum="6-o" numlevel="1" lineno="286" slineno="2-39" level="1"><display>(6)</display>In preparing budget bills for a given fiscal year, the Executive Appropriations <ln numlevel="1" lineno="287" slineno="2-40"/>Committee shall make the one-time appropriations described in Subsection <xref depth="4" refnumber="53F-9-204(3)(a)">(3)(a)</xref> by <ln numlevel="1" lineno="288" slineno="2-41"/>appropriating at least the lesser of 10% of the total amount of the one-time <ln numlevel="1" lineno="289" slineno="2-42"/>appropriations to:<subsection ssid="15-null-22" dnum="a-o" numlevel="1" lineno="290" slineno="2-43" level="2"><display>(a)</display>the cost of providing 32 paid professional hours for teachers in accordance with <ln numlevel="1" lineno="291" slineno="2-44"/>Section <xref depth="3" refnumber="53F-7-203">53F-7-203</xref>;</subsection><subsection ssid="15-null-23" dnum="b-o" numlevel="1" lineno="292" slineno="2-45" level="2"><display>(b)</display>the amount to make the distribution required under Section <xref depth="3" refnumber="53F-2-527">53F-2-527</xref>;</subsection><subsection ssid="15-null-24" dnum="c-o" numlevel="1" lineno="293" slineno="2-46" level="2"><display>(c)</display>the cost of the Stipends for Future Educators Grant Program described in Section <xref depth="3" refnumber="53F-5-223"><ln numlevel="1" lineno="294" slineno="2-47"/>53F-5-223</xref>;</subsection><subsection ssid="15-29" dnum="_-o:d-i" numlevel="1" lineno="295" slineno="2-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="both">(d)</amend></display> <amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both">the cost of the School-Based Behavioral Health Pilot Program described in Section <xref depth="3" refnumber="53F-5-224"><ln numlevel="1" lineno="296" slineno="2-49"/>53F-5-224</xref>; </amend>and</subsection><subsection ssid="15-null-25" dnum="d-o:e-i" numlevel="1" lineno="297" slineno="2-50" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1159" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>the cost of the Rural School Sports Facilities Grant Program described in <ln numlevel="1" lineno="298" slineno="2-51"/>Section <xref depth="3" refnumber="53F-10-303">53F-10-303</xref>.</subsection></subsection><subsection ssid="15-null-26" dnum="7-o" numlevel="1" lineno="299" slineno="2-52" level="1"><display>(7)</display>No later than October 15 of each year, the state board shall report to the Office of the <ln numlevel="1" lineno="300" slineno="2-53"/>Legislative Fiscal Analyst an estimated cost for each of the one-time appropriations <ln numlevel="1" lineno="301" slineno="2-54"/>described in Subsection <xref refnumber="53F-9-204(6)" depth="4">(6)</xref>.</subsection></section></bsec><bsec buid="20" num="53G-9-902" type="amend" src="code" uid="C53G-9-S902_2026070120260701" sort="53G09 09020020260701" numlevel="1" lineno="302" slineno="3-1" sn="3"><section number="53G-9-902" numlevel="1" lineno="303" slineno="3-2" type="amend"><secline lineno="302">Section 3. or</subsection><subsection ssid="20-null-5" dnum="ii-o" numlevel="1" lineno="309" slineno="3-8" level="3"><display>(ii)</display><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">except as provided in the School-Based Behavioral Health Pilot Program <ln numlevel="1" lineno="310" slineno="3-9"/>described in Section <xref depth="3" refnumber="53F-5-224">53F-5-224</xref>, </amend>with other students present.</subsection></subsection></subsection><subsection ssid="20-null-6" dnum="2-o" numlevel="1" lineno="311" slineno="3-10" level="1"><display>(2)</display>For authorized personnel to provide a restricted service:<subsection ssid="20-null-7" dnum="a-o" numlevel="1" lineno="312" slineno="3-11" level="2"><display>(a)</display>the relevant LEA, school, or authorized personnel shall obtain informed written <ln numlevel="1" lineno="313" slineno="3-12"/>parental consent before the first session of a restricted service in a given school year, <ln numlevel="1" lineno="314" slineno="3-13"/>using a standard form that includes:<subsection ssid="20-null-8" dnum="i-o" numlevel="1" lineno="315" slineno="3-14" level="3"><display>(i)</display>fields for at least the following information:<subsection ssid="20-null-9" dnum="A-o" numlevel="1" lineno="316" slineno="3-15" level="4"><display>(A)</display>the name of the student;</subsection><subsection ssid="20-null-10" dnum="B-o" numlevel="1" lineno="317" slineno="3-16" level="4"><display>(B)</display>the name of the individual giving informed consent; and</subsection><subsection ssid="20-null-11" dnum="C-o" numlevel="1" lineno="318" slineno="3-17" level="4"><display>(C)</display>the name of each authorized personnel who has authority under the informed <ln numlevel="1" lineno="319" slineno="3-18"/>written consent to provide a restricted service;</subsection></subsection><subsection ssid="20-null-12" dnum="ii-o" numlevel="1" lineno="320" slineno="3-19" level="3"><display>(ii)</display>a statement that the authorized personnel will provide information about the <ln numlevel="1" lineno="321" slineno="3-20"/>restricted service in accordance with Subsection <xref refnumber="53G-9-902(2)(b)" depth="4">(2)(b)</xref>, including that the parent <ln numlevel="1" lineno="322" slineno="3-21"/>has the right to opt out of receiving notifications at any time; and</subsection><subsection ssid="20-null-13" dnum="iii-o" numlevel="1" lineno="323" slineno="3-22" level="3"><display>(iii)</display>a statement that authorized personnel will adhere to the topics or issues the <ln numlevel="1" lineno="324" slineno="3-23"/>parent identifies, in collaboration with authorized personnel, for discussion or <ln numlevel="1" lineno="325" slineno="3-24"/>exclusion with the student under Subsection <xref refnumber="53G-9-902(3)(a)" depth="4">(3)(a)</xref>, except that the authorized <ln numlevel="1" lineno="326" slineno="3-25"/>personnel may address topics if the omission would compromise the student's <ln numlevel="1" lineno="327" slineno="3-26"/>immediate safety, the omission would violate mandatory reporting obligations, or, <ln numlevel="1" lineno="328" slineno="3-27"/>based on behaviors or statements the authorized personnel observes, the <ln numlevel="1" lineno="329" slineno="3-28"/>authorized personnel determines a need to assess the student's safety; and</subsection></subsection><subsection ssid="20-null-14" dnum="b-o" numlevel="1" lineno="330" slineno="3-29" level="2"><display>(b)</display>unless the student's parent opts out of receiving notifications from the authorized <ln numlevel="1" lineno="331" slineno="3-30"/>personnel under this Subsection <xref refnumber="53G-9-902(2)(b)" depth="4">(2)(b)</xref>, within one business day after each session of <ln numlevel="1" lineno="332" slineno="3-31"/>a restricted service, the authorized personnel shall provide to the student's parent:<subsection ssid="20-null-15" dnum="i-o" numlevel="1" lineno="333" slineno="3-32" level="3"><display>(i)</display>notice that the restricted service took place; and</subsection><subsection ssid="20-null-16" dnum="ii-o" numlevel="1" lineno="334" slineno="3-33" level="3"><display>(ii)</display>a description of the topic of the restricted service.</subsection></subsection></subsection><subsection ssid="20-null-17" dnum="3-o" numlevel="1" lineno="335" slineno="3-34" level="1" space="false"><display>(3)</display><subsection ssid="20-null-18" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="20-null-19" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>When obtaining the informed written parental consent described in <ln numlevel="1" lineno="336" slineno="3-35"/>Subsection <xref refnumber="53G-9-902(2)(a)" depth="4">(2)(a)</xref>, the LEA, school, or authorized personnel shall, through <ln numlevel="1" lineno="337" slineno="3-36"/>consultation with the parent, provide the parent an opportunity to identify topics <ln numlevel="1" lineno="338" slineno="3-37"/>or issues the parent intends the authorized personnel to address or to not address <ln numlevel="1" lineno="339" slineno="3-38"/>with the student.</subsection><subsection ssid="20-null-20" dnum="ii-o" numlevel="1" lineno="340" slineno="3-39" level="3" tab="1"><display>(ii)</display>Except as described in Subsection <xref tempid="251" depth="4" refnumber="53G-9-902(3)(a)(iii)">(3)(a)(iii)</xref>, authorized personnel may not <ln numlevel="1" lineno="341" slineno="3-40"/>address a topic or issue for which a parent has expressly stated an intent for <ln numlevel="1" lineno="342" slineno="3-41"/>authorized personnel to not address with the student under this Subsection <xref refnumber="53G-9-902(3)(a)" depth="4">(3)(a)</xref>.</subsection><subsection ssid="20-null-21" dnum="iii-o" numlevel="1" lineno="343" slineno="3-42" level="3" tab="1"><display>(iii)</display>Subsection <xref tempid="368" depth="4" refnumber="53G-9-902(3)(a)(ii)">(3)(a)(ii)</xref> does not apply if:<subsection ssid="20-null-22" dnum="A-o" numlevel="1" lineno="344" slineno="3-43" level="4"><display>(A)</display>an omission within a restricted service would compromise the student's <ln numlevel="1" lineno="345" slineno="3-44"/>immediate safety; or</subsection><subsection ssid="20-null-23" dnum="B-o" numlevel="1" lineno="346" slineno="3-45" level="4"><display>(B)</display>the student discloses information that creates a duty on the authorized <ln numlevel="1" lineno="347" slineno="3-46"/>personnel to make a mandatory report for the purpose of discussing the <ln numlevel="1" lineno="348" slineno="3-47"/>information with the student to the extent necessary to make the report, <ln numlevel="1" lineno="349" slineno="3-48"/>including for suspected cases of child abuse or neglect under Section <xref depth="3" refnumber="80-2-602">80-2-602</xref>, <ln numlevel="1" lineno="350" slineno="3-49"/>abuse of a student under Section <xref depth="3" refnumber="53E-6-701">53E-6-701</xref>, or any other legally mandated <ln numlevel="1" lineno="351" slineno="3-50"/>duty to report an incident.</subsection></subsection></subsection><subsection ssid="20-null-24" dnum="b-o" numlevel="1" lineno="352" slineno="3-51" level="2" space="false"><display>(b)</display><subsection ssid="20-null-25" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The requirement to obtain prior informed written parental consent before <ln numlevel="1" lineno="353" slineno="3-52"/>providing a restricted service described in Subsection <xref refnumber="53G-9-902(2)(a)" depth="4">(2)(a)</xref> does not apply in a <ln numlevel="1" lineno="354" slineno="3-53"/>case in which a delay to contact a parent would create an immediate serious risk <ln numlevel="1" lineno="355" slineno="3-54"/>of suicide or serious bodily injury, as defined in Section <xref depth="3" refnumber="76-1-101.5">76-1-101.5</xref>, to the student <ln numlevel="1" lineno="356" slineno="3-55"/>or to another individual.</subsection><subsection ssid="20-null-26" dnum="ii-o" numlevel="1" lineno="357" slineno="3-56" level="3"><display>(ii)</display>For a circumstance described in Subsection <xref tempid="999" depth="4" refnumber="53G-9-902(3)(b)(i)">(3)(b)(i)</xref>, the LEA, school, or <ln numlevel="1" lineno="358" slineno="3-57"/>authorized personnel shall notify a parent in accordance with Section <xref depth="3" refnumber="53G-9-604">53G-9-604</xref>.</subsection></subsection><subsection ssid="20-null-27" dnum="c-o" numlevel="1" lineno="359" slineno="3-58" level="2"><display>(c)</display>A student's IEP or Section 504 accommodation plan that includes a restricted service <ln numlevel="1" lineno="360" slineno="3-59"/>satisfies the informed parental consent requirement described in Subsection <xref refnumber="53G-9-902(2)(a)" depth="4">(2)(a)</xref>.</subsection></subsection><subsection ssid="20-null-28" dnum="4-o" numlevel="1" lineno="361" slineno="3-60" level="1" space="false"><display>(4)</display><subsection ssid="20-null-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board may make rules, in accordance with <xref depth="1" refnumber="63G-3">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="362" slineno="3-61"/>Administrative Rulemaking Act</xref>, regarding the application of this section to the <ln numlevel="1" lineno="363" slineno="3-62"/>actions of educators and staff in the public education system.</subsection><subsection ssid="20-null-30" dnum="b-o" numlevel="1" lineno="364" slineno="3-63" level="2"><display>(b)</display>The state board shall, in consultation with the Department of Health and Human <ln numlevel="1" lineno="365" slineno="3-64"/>Services, provide guidance to authorized personnel, educators, and school support <ln numlevel="1" lineno="366" slineno="3-65"/>staff on conduct and practices that constitute and do not constitute a restricted service.</subsection></subsection><subsection ssid="20-null-31" dnum="5-o" numlevel="1" lineno="367" slineno="3-66" level="1"><display>(5)</display>Nothing in this part authorizes an individual to take an action that exceeds the scope of <ln numlevel="1" lineno="368" slineno="3-67"/>the individual's license or certification.</subsection><subsection ssid="20-null-32" dnum="6-o" numlevel="1" lineno="369" slineno="3-68" level="1"><display>(6)</display>This section does not apply to a service a student accesses through the SafeUT Crisis <ln numlevel="1" lineno="370" slineno="3-69"/>Line established in Section <xref depth="3" refnumber="53H-4-210">53H-4-210</xref>.</subsection></section></bsec><bsec buid="12" num="63I-1-253" type="amend" src="code" uid="C63I-1-S253_2026070120260701" sort="63I01 02530020260701" numlevel="1" lineno="371" slineno="4-1" sn="4"><section number="63I-1-253" numlevel="1" lineno="372" slineno="4-2" type="amend"><secline lineno="371">Section 4.
