Section <bold>53-5a-103</bold> is amended to read:</secline><catline lineno="32"><bold>53-5a-103<parens/>. Liability for discharge of a firearm on property.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="33" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="34" slineno="1-4" level="2"><display>(a)</display>"Firearm possessor" means an individual who may lawfully possess a firearm.</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="35" slineno="1-5" level="2"><display>(b)</display>"Property occupant" means:<subsection ssid="3-null-4" dnum="i-o" numlevel="1" lineno="36" slineno="1-6" level="3"><display>(i)</display>a private property owner; or</subsection><subsection ssid="3-null-5" dnum="ii-o" numlevel="1" lineno="37" slineno="1-7" level="3"><display>(ii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">an individual</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a person</amend> who has the right to occupy<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both"> a private</amend><amendoutend style="2"/> property under an <ln numlevel="1" lineno="38" slineno="1-8"/>agreement.</subsection></subsection></subsection><subsection ssid="3-null-6" dnum="2-o" numlevel="1" lineno="39" slineno="1-9" level="1"><display>(2)</display>Except as provided under Subsection <xref depth="4" refnumber="53-5a-103(3)" start="0">(3)</xref>, a property occupant, who knowingly allows a <ln numlevel="1" lineno="40" slineno="1-10"/>firearm possessor to lawfully bring a firearm onto the property occupant's property, is <ln numlevel="1" lineno="41" slineno="1-11"/>not civilly or criminally liable for any damage or harm resulting from the discharge of <ln numlevel="1" lineno="42" slineno="1-12"/>the firearm by the firearm possessor while on the property occupant's property.</subsection><subsection ssid="3-null-7" dnum="3-o" numlevel="1" lineno="43" slineno="1-13" level="1"><display>(3)</display>Subsection <xref depth="4" refnumber="53-5a-103(2)" start="0">(2)</xref> does not apply if the property occupant solicits, requests, commands, <ln numlevel="1" lineno="44" slineno="1-14"/>encourages, or intentionally aids the firearm possessor in discharging the firearm while <ln numlevel="1" lineno="45" slineno="1-15"/>on the property occupant's property for a purpose other than the lawful defense of an <ln numlevel="1" lineno="46" slineno="1-16"/>individual on the property.</subsection><subsection ssid="3-null-8" dnum="4-o" numlevel="1" lineno="47" slineno="1-17" level="1"><display>(4)</display>This section does not alter the responsibilities a tenant owes to a landlord under the <ln numlevel="1" lineno="48" slineno="1-18"/>terms of the lease agreement entered into between the tenant and landlord.</subsection></section></bsec><bsec buid="1" num="63G-7-201" type="amend" src="code" uid="C63G-7-S201_2026050620260506" sort="63G07 02010020260506" numlevel="1" lineno="49" slineno="2-1" sn="2"><section number="63G-7-201" numlevel="1" lineno="50" slineno="2-2" type="amend"><secline lineno="49">Section 2. Section <bold>63G-7-201</bold> is amended to read:</secline><catline lineno="50"><bold>63G-7-201<parens/>. Immunity of governmental entities and employees from suit.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="51" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>Except as otherwise provided in this chapter, each governmental entity and each <ln numlevel="1" lineno="52" slineno="2-4"/>employee of a governmental entity are immune from suit for any injury that results from <ln numlevel="1" lineno="53" slineno="2-5"/>the exercise of a governmental function.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="54" slineno="2-6" level="1"><display>(2)</display>Notwithstanding the waiver of immunity provisions of Section <xref depth="3" refnumber="63G-7-301" start="0">63G-7-301</xref>, a <ln numlevel="1" lineno="55" slineno="2-7"/>governmental entity, its officers, and its employees are immune from suit:<subsection ssid="1-null-3" dnum="a-o" numlevel="1" lineno="56" slineno="2-8" level="2"><display>(a)</display>as provided in Section <xref depth="3" refnumber="78B-4-517" start="0">78B-4-517</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-4" dnum="b-o" numlevel="1" lineno="57" slineno="2-9" level="2"><display>(b)</display>for any injury or damage resulting from the implementation of or the failure to <ln numlevel="1" lineno="58" slineno="2-10"/>implement measures to:<subsection ssid="1-null-5" dnum="i-o" numlevel="1" lineno="59" slineno="2-11" level="3"><display>(i)</display>control the causes of epidemic and communicable diseases and other conditions <ln numlevel="1" lineno="60" slineno="2-12"/>significantly affecting the public health or necessary to protect the public health as <ln numlevel="1" lineno="61" slineno="2-13"/>set out in <xref depth="1" refnumber="26A-1" start="0">Title 26A, Chapter 1, Local Health Departments</xref>;</subsection><subsection ssid="1-null-6" dnum="ii-o" numlevel="1" lineno="62" slineno="2-14" level="3"><display>(ii)</display>investigate and control suspected bioterrorism and disease as set out in Sections <xref depth="3" refnumber="26B-7-316" start="0"><ln numlevel="1" lineno="63" slineno="2-15"/>26B-7-316</xref> through <xref depth="3" refnumber="26B-7-324" start="0">26B-7-324</xref>;</subsection><subsection ssid="1-null-7" dnum="iii-o" numlevel="1" lineno="64" slineno="2-16" level="3"><display>(iii)</display>respond to a national, state, or local emergency, a public health emergency as <ln numlevel="1" lineno="65" slineno="2-17"/>defined in Section <xref depth="3" refnumber="26B-7-301" start="0">26B-7-301</xref>, or a declaration by the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">President</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">president</amend> of the <ln numlevel="1" lineno="66" slineno="2-18"/>United States or other federal official requesting public health related activities, <ln numlevel="1" lineno="67" slineno="2-19"/>including the use, provision, operation, and management of:<subsection ssid="1-null-8" dnum="A-o" numlevel="1" lineno="68" slineno="2-20" level="4"><display>(A)</display>an emergency shelter;</subsection><subsection ssid="1-null-9" dnum="B-o" numlevel="1" lineno="69" slineno="2-21" level="4"><display>(B)</display>housing;</subsection><subsection ssid="1-null-10" dnum="C-o" numlevel="1" lineno="70" slineno="2-22" level="4"><display>(C)</display>a staging place; or</subsection><subsection ssid="1-null-11" dnum="D-o" numlevel="1" lineno="71" slineno="2-23" level="4"><display>(D)</display>a medical facility; and</subsection></subsection><subsection ssid="1-null-12" dnum="iv-o" numlevel="1" lineno="72" slineno="2-24" level="3"><display>(iv)</display>adopt methods or measures, in accordance with Section <xref depth="3" refnumber="26B-1-202" start="0">26B-1-202</xref>, for health <ln numlevel="1" lineno="73" slineno="2-25"/>care providers, public health entities, and health care insurers to coordinate among <ln numlevel="1" lineno="74" slineno="2-26"/>themselves to verify the identity of the individuals they serve<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection></subsection><subsection ssid="1-80" dnum="_-o:c-i" numlevel="1" lineno="75" slineno="2-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><subsection ssid="1-81" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">for any injury or damage resulting from the discharge of a firearm by an <ln numlevel="1" lineno="76" slineno="2-28"/>individual who may lawfully possess a firearm, if the injury or damage arises out <ln numlevel="1" lineno="77" slineno="2-29"/>of or in connection with, or results from the governmental entity, officer, or <ln numlevel="1" lineno="78" slineno="2-30"/>employee allowing firearm possession, in accordance with law, policy, or practice, <ln numlevel="1" lineno="79" slineno="2-31"/>on property owned, leased, or controlled by the governmental entity.</amend></subsection><subsection ssid="1-82" dnum="_-o:ii-i" numlevel="1" lineno="80" slineno="2-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">Subsection <xref depth="4" refnumber="63G-7-201(2)(c)(i)">(2)(c)(i)</xref> does not apply if the governmental entity, officer, or <ln numlevel="1" lineno="81" slineno="2-33"/>employee solicits, requests, commands, encourages, or intentionally aids the <ln numlevel="1" lineno="82" slineno="2-34"/>individual in discharging the firearm for a purpose other than the lawful defense <ln numlevel="1" lineno="83" slineno="2-35"/>of an individual.</amend></subsection></subsection></subsection><subsection ssid="1-null-13" dnum="3-o" numlevel="1" lineno="84" slineno="2-36" level="1" space="false"><display>(3)</display><subsection ssid="1-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A governmental entity, its officers, and its employees are immune from suit, and <ln numlevel="1" lineno="85" slineno="2-37"/>immunity is not waived, for any injury if the injury arises out of or in connection <ln numlevel="1" lineno="86" slineno="2-38"/>with, or results from:<subsection ssid="1-null-15" dnum="i-o" numlevel="1" lineno="87" slineno="2-39" level="3" tab="1"><display>(i)</display>a latent dangerous or latent defective condition of:<subsection ssid="1-null-16" dnum="A-o" numlevel="1" lineno="88" slineno="2-40" level="4"><display>(A)</display>any highway, road, street, alley, crosswalk, sidewalk, culvert, tunnel, bridge, <ln numlevel="1" lineno="89" slineno="2-41"/>or viaduct; or</subsection><subsection ssid="1-null-17" dnum="B-o" numlevel="1" lineno="90" slineno="2-42" level="4"><display>(B)</display>another structure located on any of the items listed in this Subsection <xref depth="4" refnumber="63G-7-201(3)(a)(i)" start="0">(3)(a)(i)</xref>; <ln numlevel="1" lineno="91" slineno="2-43"/>or</subsection></subsection><subsection ssid="1-null-18" dnum="ii-o" numlevel="1" lineno="92" slineno="2-44" level="3" tab="1"><display>(ii)</display>a latent dangerous or latent defective condition of any public building, structure, <ln numlevel="1" lineno="93" slineno="2-45"/>dam, reservoir, or other public improvement.</subsection></subsection><subsection ssid="1-null-19" dnum="b-o" numlevel="1" lineno="94" slineno="2-46" level="2" space="false"><display>(b)</display><subsection ssid="1-null-20" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As used in this Subsection <xref depth="4" refnumber="63G-7-201(3)(b)" start="0">(3)(b)</xref>:<subsection ssid="1-null-21" dnum="A-o" numlevel="1" lineno="95" slineno="2-47" level="4" tab="1"><display>(A)</display>"Contaminated land" means the same as that term is defined in Section <xref depth="3" refnumber="11-58-102" start="0"><ln numlevel="1" lineno="96" slineno="2-48"/>11-58-102</xref>.</subsection><subsection ssid="1-null-22" dnum="B-o" numlevel="1" lineno="97" slineno="2-49" level="4" tab="1"><display>(B)</display>"Contamination" means the condition of land that results from the placement, <ln numlevel="1" lineno="98" slineno="2-50"/>disposal, or release of hazardous matter on, in, or under the land, including any <ln numlevel="1" lineno="99" slineno="2-51"/>seeping or escaping of the hazardous matter from the land.</subsection><subsection ssid="1-null-23" dnum="C-o" numlevel="1" lineno="100" slineno="2-52" level="4" tab="1"><display>(C)</display>"Damage" means any property damage, personal injury, or other injury or any <ln numlevel="1" lineno="101" slineno="2-53"/>loss of any kind, however denominated.</subsection><subsection ssid="1-null-24" dnum="D-o" numlevel="1" lineno="102" slineno="2-54" level="4" tab="1"><display>(D)</display>"Environmentally compliant" means, as applicable, obtaining a certificate of <ln numlevel="1" lineno="103" slineno="2-55"/>completion from the Department of Environmental Quality under Section <xref depth="3" refnumber="19-8-111" start="0"><ln numlevel="1" lineno="104" slineno="2-56"/>19-8-111</xref> following participation in a voluntary cleanup under <xref depth="1" refnumber="19-8" start="0">Title 19, Chapter <ln numlevel="1" lineno="105" slineno="2-57"/>8, Voluntary Cleanup Program</xref>, obtaining an administrative letter from the <ln numlevel="1" lineno="106" slineno="2-58"/>Department of Environmental Quality for a discrete phase of a voluntary <ln numlevel="1" lineno="107" slineno="2-59"/>cleanup that is conducted under a remedial action plan as defined in Section <xref depth="3" refnumber="11-58-605" start="0"><ln numlevel="1" lineno="108" slineno="2-60"/>11-58-605</xref>, or complying with the terms of an environmental covenant, as <ln numlevel="1" lineno="109" slineno="2-61"/>defined in Section <xref depth="3" refnumber="57-25-102" start="0">57-25-102</xref>, signed by an agency, as defined in Section <xref depth="3" refnumber="57-25-102" start="0"><ln numlevel="1" lineno="110" slineno="2-62"/>57-25-102</xref>, and duly recorded in the office of the recorder of the county in <ln numlevel="1" lineno="111" slineno="2-63"/>which the contaminated land is located.</subsection><subsection ssid="1-null-25" dnum="E-o" numlevel="1" lineno="112" slineno="2-64" level="4" tab="1"><display>(E)</display>"Government owner" means a governmental entity, including an independent <ln numlevel="1" lineno="113" slineno="2-65"/>entity, as defined in Section <xref depth="3" refnumber="63E-1-102" start="0">63E-1-102</xref>, that acquires an ownership interest in <ln numlevel="1" lineno="114" slineno="2-66"/>land that was contaminated land before the governmental entity or independent <ln numlevel="1" lineno="115" slineno="2-67"/>entity acquired an ownership interest in the land.</subsection><subsection ssid="1-null-26" dnum="F-o" numlevel="1" lineno="116" slineno="2-68" level="4" tab="1"><display>(F)</display>"Hazardous matter" means hazardous materials, as defined in Section <xref depth="3" refnumber="19-6-302" start="0">19-6-302</xref>,  <ln numlevel="1" lineno="117" slineno="2-69"/>hazardous substances, as defined in Section <xref depth="3" refnumber="19-6-302" start="0">19-6-302</xref>, or landfill material, as <ln numlevel="1" lineno="118" slineno="2-70"/>defined in Section <xref depth="3" refnumber="11-58-102" start="0">11-58-102</xref>.</subsection><subsection ssid="1-null-27" dnum="G-o" numlevel="1" lineno="119" slineno="2-71" level="4" tab="1"><display>(G)</display>"Remediation" means the same as that term is defined in Section <xref depth="3" refnumber="11-58-102" start="0">11-58-102</xref>.</subsection></subsection><subsection ssid="1-null-28" dnum="ii-o" numlevel="1" lineno="120" slineno="2-72" level="3" space="false"><display>(ii)</display><subsection ssid="1-null-29" dnum="A-o" level="4" placement="sameline"><display>(A)</display>A government owner and the government owner's officers and employees <ln numlevel="1" lineno="121" slineno="2-73"/>are immune from suit, and immunity is not waived, for any claim for damage <ln numlevel="1" lineno="122" slineno="2-74"/>that arises out of or in connection with, or results from, contamination of <ln numlevel="1" lineno="123" slineno="2-75"/>contaminated land.</subsection><subsection ssid="1-null-30" dnum="B-o" numlevel="1" lineno="124" slineno="2-76" level="4"><display>(B)</display>A government owner's ownership of contaminated land may not be the basis <ln numlevel="1" lineno="125" slineno="2-77"/>of a claim against the government owner for damage that arises out of or in <ln numlevel="1" lineno="126" slineno="2-78"/>connection with, or results from, contamination of contaminated land.</subsection></subsection><subsection ssid="1-null-31" dnum="iii-o" numlevel="1" lineno="127" slineno="2-79" level="3"><display>(iii)</display>Subsection <xref depth="4" refnumber="63G-7-201(3)(b)(ii)" start="0">(3)(b)(ii)</xref> does not limit or affect:<subsection ssid="1-null-32" dnum="A-o" numlevel="1" lineno="128" slineno="2-80" level="4"><display>(A)</display>the liability of a person that placed, disposed of, or released hazardous matter <ln numlevel="1" lineno="129" slineno="2-81"/>on, in, or under the land; or</subsection><subsection ssid="1-null-33" dnum="B-o" numlevel="1" lineno="130" slineno="2-82" level="4"><display>(B)</display>a worker compensation claim of an employee of an entity that conducts work <ln numlevel="1" lineno="131" slineno="2-83"/>on or related to contaminated land.</subsection></subsection><subsection ssid="1-null-34" dnum="iv-o" numlevel="1" lineno="132" slineno="2-84" level="3"><display>(iv)</display>Immunity under Subsection <xref depth="4" refnumber="63G-7-201(3)(b)(ii)(A)" start="0">(3)(b)(ii)(A)</xref> is not affected by a government owner's <ln numlevel="1" lineno="133" slineno="2-85"/>remediation of contaminated land if the government owner is environmentally <ln numlevel="1" lineno="134" slineno="2-86"/>compliant.</subsection></subsection></subsection><subsection ssid="1-null-35" dnum="4-o" numlevel="1" lineno="135" slineno="2-87" level="1"><display>(4)</display>A governmental entity, its officers, and its employees are immune from suit, and <ln numlevel="1" lineno="136" slineno="2-88"/>immunity is not waived, for any injury proximately caused by a negligent act or <ln numlevel="1" lineno="137" slineno="2-89"/>omission of an employee committed within the scope of employment, if the injury arises <ln numlevel="1" lineno="138" slineno="2-90"/>out of or in connection with, or results from:<subsection ssid="1-null-36" dnum="a-o" numlevel="1" lineno="139" slineno="2-91" level="2"><display>(a)</display>the exercise or performance, or the failure to exercise or perform, a discretionary <ln numlevel="1" lineno="140" slineno="2-92"/>function, whether or not the discretion is abused;</subsection><subsection ssid="1-null-37" dnum="b-o" numlevel="1" lineno="141" slineno="2-93" level="2"><display>(b)</display>except as provided in Subsections <xref depth="4" refnumber="63G-7-301(2)(j)" start="0">63G-7-301(2)(j)</xref>, <xref depth="4" refnumber="63G-7-301(3)" start="0">(3)</xref>, and <xref depth="4" refnumber="63G-7-301(4)" start="0">(4)</xref>, assault, battery, <ln numlevel="1" lineno="142" slineno="2-94"/>false imprisonment, false arrest, malicious prosecution, intentional trespass, abuse of <ln numlevel="1" lineno="143" slineno="2-95"/>process, libel, slander, deceit, interference with contract rights, infliction of mental <ln numlevel="1" lineno="144" slineno="2-96"/>anguish, or violation of civil rights;</subsection><subsection ssid="1-null-38" dnum="c-o" numlevel="1" lineno="145" slineno="2-97" level="2"><display>(c)</display>the issuance, denial, suspension, or revocation of, or the failure or refusal to issue, <ln numlevel="1" lineno="146" slineno="2-98"/>deny, suspend, or revoke, any permit, license, certificate, approval, order, or similar <ln numlevel="1" lineno="147" slineno="2-99"/>authorization;</subsection><subsection ssid="1-null-39" dnum="d-o" numlevel="1" lineno="148" slineno="2-100" level="2"><display>(d)</display>a failure to make an inspection or making an inadequate or negligent inspection;</subsection><subsection ssid="1-null-40" dnum="e-o" numlevel="1" lineno="149" slineno="2-101" level="2"><display>(e)</display>the institution or prosecution of any judicial or administrative proceeding, even if <ln numlevel="1" lineno="150" slineno="2-102"/>malicious or without probable cause;</subsection><subsection ssid="1-null-41" dnum="f-o" numlevel="1" lineno="151" slineno="2-103" level="2"><display>(f)</display>a misrepresentation by an employee whether or not the misrepresentation is negligent <ln numlevel="1" lineno="152" slineno="2-104"/>or intentional;</subsection><subsection ssid="1-null-42" dnum="g-o" numlevel="1" lineno="153" slineno="2-105" level="2"><display>(g)</display>a riot, unlawful assembly, public demonstration, mob violence, or civil disturbance;</subsection><subsection ssid="1-null-43" dnum="h-o" numlevel="1" lineno="154" slineno="2-106" level="2"><display>(h)</display>the collection or assessment of taxes;</subsection><subsection ssid="1-null-44" dnum="i-o" numlevel="1" lineno="155" slineno="2-107" level="2"><display>(i)</display>an activity of the Utah National Guard;</subsection><subsection ssid="1-null-45" dnum="j-o" numlevel="1" lineno="156" slineno="2-108" level="2"><display>(j)</display>the incarceration of a person in a state prison, county or city jail, or other place of <ln numlevel="1" lineno="157" slineno="2-109"/>legal confinement;</subsection><subsection ssid="1-null-46" dnum="k-o" numlevel="1" lineno="158" slineno="2-110" level="2"><display>(k)</display>a natural condition on publicly owned or controlled land;</subsection><subsection ssid="1-null-47" dnum="l-o" numlevel="1" lineno="159" slineno="2-111" level="2"><display>(l)</display>a condition existing in connection with an abandoned mine or mining operation;</subsection><subsection ssid="1-null-48" dnum="m-o" numlevel="1" lineno="160" slineno="2-112" level="2"><display>(m)</display>an activity authorized by the School and Institutional Trust Lands Administration or <ln numlevel="1" lineno="161" slineno="2-113"/>the Division of Forestry, Fire, and State Lands;</subsection><subsection ssid="1-null-49" dnum="n-o" numlevel="1" lineno="162" slineno="2-114" level="2"><display>(n)</display>the operation or existence of a trail that is along a water facility, as defined in Section <xref depth="3" refnumber="73-1-8" start="0"><ln numlevel="1" lineno="163" slineno="2-115"/>73-1-8</xref>, stream, or river, regardless of ownership or operation of the water facility, <ln numlevel="1" lineno="164" slineno="2-116"/>stream, or river, if:<subsection ssid="1-null-50" dnum="i-o" numlevel="1" lineno="165" slineno="2-117" level="3"><display>(i)</display>the trail is designated under a general plan adopted by a municipality under <ln numlevel="1" lineno="166" slineno="2-118"/>Section <xref depth="3" refnumber="10-20-401">10-20-401</xref> or by a county under Section <xref depth="3" refnumber="17-79-401">17-79-401</xref>;</subsection><subsection ssid="1-null-51" dnum="ii-o" numlevel="1" lineno="167" slineno="2-119" level="3"><display>(ii)</display>the trail right-of-way or the right-of-way where the trail is located is open to <ln numlevel="1" lineno="168" slineno="2-120"/>public use as evidenced by a written agreement between:<subsection ssid="1-null-52" dnum="A-o" numlevel="1" lineno="169" slineno="2-121" level="4"><display>(A)</display>the owner or operator of the trail right-of-way or of the right-of-way where the <ln numlevel="1" lineno="170" slineno="2-122"/>trail is located; and</subsection><subsection ssid="1-null-53" dnum="B-o" numlevel="1" lineno="171" slineno="2-123" level="4"><display>(B)</display>the municipality or county where the trail is located; and</subsection></subsection><subsection ssid="1-null-54" dnum="iii-o" numlevel="1" lineno="172" slineno="2-124" level="3"><display>(iii)</display>the written agreement:<subsection ssid="1-null-55" dnum="A-o" numlevel="1" lineno="173" slineno="2-125" level="4"><display>(A)</display>contains a plan for operation and maintenance of the trail; and</subsection><subsection ssid="1-null-56" dnum="B-o" numlevel="1" lineno="174" slineno="2-126" level="4"><display>(B)</display>provides that an owner or operator of the trail right-of-way or of the <ln numlevel="1" lineno="175" slineno="2-127"/>right-of-way where the trail is located has, at a minimum, the same level of <ln numlevel="1" lineno="176" slineno="2-128"/>immunity from suit as the governmental entity in connection with or resulting <ln numlevel="1" lineno="177" slineno="2-129"/>from the use of the trail;</subsection></subsection></subsection><subsection ssid="1-null-57" dnum="o-o" numlevel="1" lineno="178" slineno="2-130" level="2"><display>(o)</display>research or implementation of cloud management or seeding for the clearing of fog;</subsection><subsection ssid="1-null-58" dnum="p-o" numlevel="1" lineno="179" slineno="2-131" level="2"><display>(p)</display>the management of flood waters, earthquakes, or natural disasters;</subsection><subsection ssid="1-null-59" dnum="q-o" numlevel="1" lineno="180" slineno="2-132" level="2"><display>(q)</display>the construction, repair, or operation of flood or storm systems;</subsection><subsection ssid="1-null-60" dnum="r-o" numlevel="1" lineno="181" slineno="2-133" level="2"><display>(r)</display>the operation of an emergency vehicle, while being driven in accordance with the <ln numlevel="1" lineno="182" slineno="2-134"/>requirements of Section <xref depth="3" refnumber="41-6a-212" start="0">41-6a-212</xref>;</subsection><subsection ssid="1-null-61" dnum="s-o" numlevel="1" lineno="183" slineno="2-135" level="2"><display>(s)</display>the activity of:<subsection ssid="1-null-62" dnum="i-o" numlevel="1" lineno="184" slineno="2-136" level="3"><display>(i)</display>providing emergency medical assistance;</subsection><subsection ssid="1-null-63" dnum="ii-o" numlevel="1" lineno="185" slineno="2-137" level="3"><display>(ii)</display>fighting fire;</subsection><subsection ssid="1-null-64" dnum="iii-o" numlevel="1" lineno="186" slineno="2-138" level="3"><display>(iii)</display>regulating, mitigating, or handling hazardous materials or hazardous wastes;</subsection><subsection ssid="1-null-65" dnum="iv-o" numlevel="1" lineno="187" slineno="2-139" level="3"><display>(iv)</display>an emergency evacuation;</subsection><subsection ssid="1-null-66" dnum="v-o" numlevel="1" lineno="188" slineno="2-140" level="3"><display>(v)</display>transporting or removing an injured person to a place where emergency medical <ln numlevel="1" lineno="189" slineno="2-141"/>assistance can be rendered or where the person can be transported by a licensed <ln numlevel="1" lineno="190" slineno="2-142"/>ambulance service; or</subsection><subsection ssid="1-null-67" dnum="vi-o" numlevel="1" lineno="191" slineno="2-143" level="3"><display>(vi)</display>intervening during a dam emergency;</subsection></subsection><subsection ssid="1-null-68" dnum="t-o" numlevel="1" lineno="192" slineno="2-144" level="2"><display>(t)</display>the exercise or performance, or the failure to exercise or perform, any function in <ln numlevel="1" lineno="193" slineno="2-145"/>accordance with <xref depth="1" refnumber="73-10" start="0">Title 73, Chapter 10, Board of Water Resources - Division of Water <ln numlevel="1" lineno="194" slineno="2-146"/>Resources</xref>;</subsection><subsection ssid="1-null-69" dnum="u-o" numlevel="1" lineno="195" slineno="2-147" level="2"><display>(u)</display>an unauthorized access to government records, data, or electronic information <ln numlevel="1" lineno="196" slineno="2-148"/>systems by any person or entity;</subsection><subsection ssid="1-null-70" dnum="v-o" numlevel="1" lineno="197" slineno="2-149" level="2"><display>(v)</display>an activity of wildlife, as defined in Section <xref depth="3" refnumber="23A-1-101" start="0">23A-1-101</xref>, that arises during the use of <ln numlevel="1" lineno="198" slineno="2-150"/>a public or private road;</subsection><subsection ssid="1-null-71" dnum="w-o" numlevel="1" lineno="199" slineno="2-151" level="2"><display>(w)</display>a communication between employees of one or more law enforcement agencies <ln numlevel="1" lineno="200" slineno="2-152"/>related to the employment, disciplinary history, character, professional competence, <ln numlevel="1" lineno="201" slineno="2-153"/>or physical or mental health of a peace officer, or a former, current, or prospective <ln numlevel="1" lineno="202" slineno="2-154"/>employee of a law enforcement agency, including any communication made in <ln numlevel="1" lineno="203" slineno="2-155"/>accordance with Section <xref depth="3" refnumber="53-14-103" start="0">53-14-103</xref>; or</subsection><subsection ssid="1-null-72" dnum="x-o" numlevel="1" lineno="204" slineno="2-156" level="2"><display>(x)</display>providing or failing to provide information under Section <xref depth="3" refnumber="53-27-102" start="0">53-27-102</xref> or Subsection <xref depth="4" refnumber="41-1a-213(6)" start="0"><ln numlevel="1" lineno="205" slineno="2-157"/>41-1a-213(6)</xref>, <xref depth="4" refnumber="41-1a-213(7)" start="0">(7)</xref>, or <xref depth="4" refnumber="41-1a-213(8)" start="0">(8)</xref>, <xref depth="4" refnumber="53-3-207(4)" start="0">53-3-207(4)</xref>, or <xref depth="4" refnumber="53-3-805(5)" start="0">53-3-805(5)</xref>.</subsection></subsection><subsection ssid="1-null-73" dnum="5-o" numlevel="1" lineno="206" slineno="2-158" level="1"><display>(5)</display>The following are immune from suit, and immunity is not waived for an action or <ln numlevel="1" lineno="207" slineno="2-159"/>failure to act within the scope of duties or employment, if the injury arises out of, in <ln numlevel="1" lineno="208" slineno="2-160"/>connection with, or results from the implementation of Section <xref depth="3" refnumber="17E-7-401">17E-7-401</xref> to the extent <ln numlevel="1" lineno="209" slineno="2-161"/>it addresses evaluating and classifying high risk wildland urban interface property, <ln numlevel="1" lineno="210" slineno="2-162"/>Section <xref depth="3" refnumber="31A-22-1310">31A-22-1310</xref>, or Title 65A, Chapter 8, Part 4, Wildland Urban Interface <ln numlevel="1" lineno="211" slineno="2-163"/>Property:<subsection ssid="1-null-74" dnum="a-o" numlevel="1" lineno="212" slineno="2-164" level="2"><display>(a)</display>the Division of Forestry, Fire, and State Lands;</subsection><subsection ssid="1-null-75" dnum="b-o" numlevel="1" lineno="213" slineno="2-165" level="2"><display>(b)</display>an officer, employee, or consultant of the Division of Forestry, Fire, and State Lands;</subsection><subsection ssid="1-null-76" dnum="c-o" numlevel="1" lineno="214" slineno="2-166" level="2"><display>(c)</display>a county;</subsection><subsection ssid="1-null-77" dnum="d-o" numlevel="1" lineno="215" slineno="2-167" level="2"><display>(d)</display>a wildland urban interface coordinator, as defined in Section <xref depth="3" refnumber="65A-8-401">65A-8-401</xref>;</subsection><subsection ssid="1-null-78" dnum="e-o" numlevel="1" lineno="216" slineno="2-168" level="2"><display>(e)</display>the Insurance Department; or</subsection><subsection ssid="1-null-79" dnum="f-o" numlevel="1" lineno="217" slineno="2-169" level="2"><display>(f)</display>an officer, employee, or consultant of the Insurance Department.</subsection></subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="218" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="218">Section 3.
