Section <bold>63H-8-501</bold> is amended to read:</secline><catline lineno="22"><bold>63H-8-501<parens/>. Definitions.</bold></catline><sectionText lineno="23"><tab/>As used in this part:</sectionText><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="24" slineno="1-4" level="1" space="false"><display>(1)</display><subsection ssid="2-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"First-time homebuyer" means an individual who satisfies:<subsection ssid="2-null-3" dnum="i-o" numlevel="1" lineno="25" slineno="1-5" level="3" tab="1"><display>(i)</display>the three-year requirement described in Section 143(d) of the Internal Revenue <ln numlevel="1" lineno="26" slineno="1-6"/>Code of 1986, as amended, and any corresponding federal regulations; and</subsection><subsection ssid="2-null-4" dnum="ii-o" numlevel="1" lineno="27" slineno="1-7" level="3" tab="1"><display>(ii)</display><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">the </amend>requirements made by the corporation by rule, as described in Section <xref depth="3" refnumber="63H-8-502"><ln numlevel="1" lineno="28" slineno="1-8"/>63H-8-502</xref>.</subsection></subsection><subsection ssid="2-null-5" dnum="b-o" numlevel="1" lineno="29" slineno="1-9" level="2"><display>(b)</display>"First-time homebuyer" includes a single parent, as defined by the corporation by rule<amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="30" slineno="1-10"/>made </amend><amendoutend style="2"/>as described in Section <xref depth="3" refnumber="63H-8-502">63H-8-502</xref>, who would meet the three-year <ln numlevel="1" lineno="31" slineno="1-11"/>requirement described in Subsection <xref depth="4" refnumber="63H-8-501(1)(a)(i)">(1)(a)(i)</xref> but for a present ownership interest in a <ln numlevel="1" lineno="32" slineno="1-12"/>principal residence in which the single parent:<subsection ssid="2-null-6" dnum="i-o" numlevel="1" lineno="33" slineno="1-13" level="3"><display>(i)</display>had a present ownership interest with the single parent's former spouse during the <ln numlevel="1" lineno="34" slineno="1-14"/>three-year period;</subsection><subsection ssid="2-null-7" dnum="ii-o" numlevel="1" lineno="35" slineno="1-15" level="3"><display>(ii)</display>resided while married during the three-year period; and</subsection><subsection ssid="2-null-8" dnum="iii-o" numlevel="1" lineno="36" slineno="1-16" level="3"><display>(iii)</display>no longer:<subsection ssid="2-null-9" dnum="A-o" numlevel="1" lineno="37" slineno="1-17" level="4"><display>(A)</display>has a present ownership interest; or</subsection><subsection ssid="2-null-10" dnum="B-o" numlevel="1" lineno="38" slineno="1-18" level="4"><display>(B)</display>resides.</subsection></subsection></subsection></subsection><subsection ssid="2-null-11" dnum="2-o" numlevel="1" lineno="39" slineno="1-19" level="1"><display>(2)</display>"Home equity amount" means the difference between:<subsection ssid="2-null-12" dnum="a-o" numlevel="1" lineno="40" slineno="1-20" level="2" space="false"><display>(a)</display><subsection ssid="2-null-13" dnum="i-o" level="3" placement="sameline"><display>(i)</display>in the case of a sale, the sales price for which the qualifying residential unit is <ln numlevel="1" lineno="41" slineno="1-21"/>sold by the recipient in a bona fide sale to a third party with no right to repurchase <ln numlevel="1" lineno="42" slineno="1-22"/>less an amount up to 1% of the sales price used for seller-paid closing costs; or</subsection><subsection ssid="2-null-14" dnum="ii-o" numlevel="1" lineno="43" slineno="1-23" level="3"><display>(ii)</display>in the case of a refinance, the current appraised value of the qualifying residential <ln numlevel="1" lineno="44" slineno="1-24"/>unit; and</subsection></subsection><subsection ssid="2-null-15" dnum="b-o" numlevel="1" lineno="45" slineno="1-25" level="2"><display>(b)</display>the total payoff amount of any qualifying mortgage loan that was used to finance the <ln numlevel="1" lineno="46" slineno="1-26"/>purchase of the qualifying residential unit.</subsection></subsection><subsection ssid="2-null-16" dnum="3-o" numlevel="1" lineno="47" slineno="1-27" level="1"><display>(3)</display>"Program" means the First-Time Homebuyer Assistance Program created in Section <xref depth="3" refnumber="63H-8-502"><ln numlevel="1" lineno="48" slineno="1-28"/>63H-8-502</xref>.</subsection><subsection ssid="2-null-17" dnum="4-o" numlevel="1" lineno="49" slineno="1-29" level="1"><display>(4)</display>"Program funds" means money appropriated for the program.</subsection><subsection ssid="2-null-18" dnum="5-o" numlevel="1" lineno="50" slineno="1-30" level="1"><display>(5)</display>"Qualifying mortgage loan" means a mortgage loan that:<subsection ssid="2-null-19" dnum="a-o" numlevel="1" lineno="51" slineno="1-31" level="2"><display>(a)</display>is purchased by the corporation; and</subsection><subsection ssid="2-null-20" dnum="b-o" numlevel="1" lineno="52" slineno="1-32" level="2"><display>(b)</display>is subject to a document that is recorded in the office of the county recorder of the <ln numlevel="1" lineno="53" slineno="1-33"/>county in which the residential unit is located.</subsection></subsection><subsection ssid="2-null-21" dnum="6-o" numlevel="1" lineno="54" slineno="1-34" level="1"><display>(6)</display>"Qualifying residential unit" means a residential unit that:<subsection ssid="2-null-22" dnum="a-o" numlevel="1" lineno="55" slineno="1-35" level="2"><display>(a)</display>is located in the state;</subsection><subsection ssid="2-null-23" dnum="b-o:_-i" numlevel="1" lineno="56" slineno="1-36" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">is new construction or newly constructed but not yet inhabited;</amend><amendoutend style="2"/></subsection><subsection ssid="2-null-24" dnum="c-o:b-i" numlevel="1" lineno="57" slineno="1-37" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>is financed by a qualifying mortgage loan;</subsection><subsection ssid="2-null-25" dnum="d-o:c-i" numlevel="1" lineno="58" slineno="1-38" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>is owner-occupied within 60 days of purchase, or in the case of a two-unit <ln numlevel="1" lineno="59" slineno="1-39"/>dwelling, at least one unit is owner-occupied within 60 days of purchase; and</subsection><subsection ssid="2-null-26" dnum="e-o:d-i" numlevel="1" lineno="60" slineno="1-40" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1025" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>is purchased for an amount that does not exceed:<subsection ssid="2-null-27" dnum="i-o" numlevel="1" lineno="61" slineno="1-41" level="3"><display>(i)</display>$450,000; or</subsection><subsection ssid="2-null-28" dnum="ii-o" numlevel="1" lineno="62" slineno="1-42" level="3"><display>(ii)</display>if applicable, the maximum purchase price established by the corporation under <ln numlevel="1" lineno="63" slineno="1-43"/>Section <xref depth="3" refnumber="63H-8-502">63H-8-502</xref>.</subsection></subsection></subsection><subsection ssid="2-null-29" dnum="7-o" numlevel="1" lineno="64" slineno="1-44" level="1"><display>(7)</display>"Recipient" means a first-time homebuyer who receives program funds.</subsection><subsection ssid="2-null-30" dnum="8-o" numlevel="1" lineno="65" slineno="1-45" level="1" space="false"><display>(8)</display><subsection ssid="2-null-31" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Residential unit" means a house, condominium, townhome, or similar residential <ln numlevel="1" lineno="66" slineno="1-46"/>structure that serves as a one-unit dwelling or forms part of a two-unit dwelling.</subsection><subsection ssid="2-null-32" dnum="b-o" numlevel="1" lineno="67" slineno="1-47" level="2"><display>(b)</display>"Residential unit" includes a manufactured home or modular home that is attached to <ln numlevel="1" lineno="68" slineno="1-48"/>a permanent foundation.</subsection></subsection></section></bsec><bsec buid="3" num="63H-8-502" type="amend" src="code" uid="C63H-8-S502_2026050620260506" sort="63H08 05020020260506" numlevel="1" lineno="69" slineno="2-1" sn="2"><section number="63H-8-502" numlevel="1" lineno="70" slineno="2-2" type="amend"><secline lineno="69">Section 2. Section <bold>63H-8-502</bold> is amended to read:</secline><catline lineno="70"><bold>63H-8-502<parens/>. First-Time Homebuyer Assistance Program.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="71" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>There is created the First-Time Homebuyer Assistance Program administered by the <ln numlevel="1" lineno="72" slineno="2-4"/>corporation.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="73" slineno="2-5" level="1"><display>(2)</display>Subject to appropriations from the Legislature, the corporation shall distribute program <ln numlevel="1" lineno="74" slineno="2-6"/>funds to:<subsection ssid="3-null-3" dnum="a-o" numlevel="1" lineno="75" slineno="2-7" level="2"><display>(a)</display>first-time homebuyers to provide support for the purchase of qualifying residential <ln numlevel="1" lineno="76" slineno="2-8"/>units; and</subsection><subsection ssid="3-null-4" dnum="b-o" numlevel="1" lineno="77" slineno="2-9" level="2"><display>(b)</display>reimburse the corporation for a distribution of funds under Subsection <xref depth="4" refnumber="63H-8-502(2)(a)">(2)(a)</xref> that <ln numlevel="1" lineno="78" slineno="2-10"/>took place on or after July 1, 2023.</subsection></subsection><subsection ssid="3-null-5" dnum="3-o" numlevel="1" lineno="79" slineno="2-11" level="1" space="false"><display>(3)</display><subsection ssid="3-42" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>The maximum amount of program funds that a first-time homebuyer may receive <ln numlevel="1" lineno="80" slineno="2-12"/>under the program<amend anum="0" ea="amend" pairid="43" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="both"> for a qualifying residential unit that is new construction or newly <ln numlevel="1" lineno="81" slineno="2-13"/>constructed but not yet inhabited</amend> is $20,000.</subsection><subsection ssid="3-40" dnum="_-o:b-i" numlevel="1" lineno="82" slineno="2-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">The maximum amount of program funds that a first-time homebuyer may receive <ln numlevel="1" lineno="83" slineno="2-15"/>under the program for an existing qualifying residential unit is $10,000.</amend></subsection><subsection ssid="3-41" dnum="_-o:c-i" numlevel="1" lineno="84" slineno="2-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">No more than $1,000,000 of the program funds may be used for purposes described <ln numlevel="1" lineno="85" slineno="2-17"/>in Subsection <xref depth="4" refnumber="63H-8-502(3)(b)">(3)(b)</xref>.</amend></subsection></subsection><subsection ssid="3-null-6" dnum="4-o" numlevel="1" lineno="86" slineno="2-18" level="1" space="false"><display>(4)</display><subsection ssid="3-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A recipient may use program funds to pay for:<subsection ssid="3-null-8" dnum="i-o" numlevel="1" lineno="87" slineno="2-19" level="3" tab="1"><display>(i)</display>the down payment on a qualifying residential unit;</subsection><subsection ssid="3-null-9" dnum="ii-o" numlevel="1" lineno="88" slineno="2-20" level="3" tab="1"><display>(ii)</display>closing costs associated with the purchase of a qualifying residential unit;</subsection><subsection ssid="3-null-10" dnum="iii-o" numlevel="1" lineno="89" slineno="2-21" level="3" tab="1"><display>(iii)</display>a permanent reduction in the advertised par interest rate on a qualifying mortgage <ln numlevel="1" lineno="90" slineno="2-22"/>loan that is used to finance a qualifying residential unit; or</subsection><subsection ssid="3-null-11" dnum="iv-o" numlevel="1" lineno="91" slineno="2-23" level="3" tab="1"><display>(iv)</display>any combination of Subsections <xref depth="4" refnumber="63H-8-502(4)(a)(i)">(4)(a)(i)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="84" groupid="73" style="2" owner="jchristopherson" level="1" deltag="both">, (ii), and (iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="82" groupid="71" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> through <xref depth="4" refnumber="63H-8-502(iii)">(iii)</xref></amend>.</subsection></subsection><subsection ssid="3-null-12" dnum="b-o" numlevel="1" lineno="92" slineno="2-24" level="2"><display>(b)</display>The corporation shall direct the disbursement of program funds for a purpose <ln numlevel="1" lineno="93" slineno="2-25"/>authorized in Subsection <xref depth="4" refnumber="63H-8-502(4)(a)">(4)(a)</xref>.</subsection><subsection ssid="3-null-13" dnum="c-o" numlevel="1" lineno="94" slineno="2-26" level="2"><display>(c)</display>A recipient may not receive a payout or distribution of program funds upon closing.</subsection></subsection><subsection ssid="3-null-14" dnum="5-o" numlevel="1" lineno="95" slineno="2-27" level="1"><display>(5)</display>The builder or developer of a qualifying residential unit may not increase the price of <ln numlevel="1" lineno="96" slineno="2-28"/>the qualifying residential unit on the basis of program funds being used towards the <ln numlevel="1" lineno="97" slineno="2-29"/>purchase of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="85" groupid="74" style="2" owner="jchristopherson" level="1" deltag="both">that</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="83" groupid="72" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the</amend> qualifying residential unit.</subsection><subsection ssid="3-null-15" dnum="6-o" numlevel="1" lineno="98" slineno="2-30" level="1" space="false"><display>(6)</display><subsection ssid="3-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with rules made by the corporation under Subsection <xref depth="4" refnumber="63H-8-502(9)">(9)</xref>, the <ln numlevel="1" lineno="99" slineno="2-31"/>corporation may adjust the maximum purchase price of a qualifying residential unit <ln numlevel="1" lineno="100" slineno="2-32"/>for which a first-time homebuyer qualifies to receive program funds in order to <ln numlevel="1" lineno="101" slineno="2-33"/>reflect current market conditions.</subsection><subsection ssid="3-null-17" dnum="b-o" numlevel="1" lineno="102" slineno="2-34" level="2"><display>(b)</display>In connection with an adjustment made under Subsection <xref depth="4" refnumber="63H-8-502(6)(a)">(6)(a)</xref>, the corporation may <ln numlevel="1" lineno="103" slineno="2-35"/>establish one or more maximum purchase prices corresponding by residential unit <ln numlevel="1" lineno="104" slineno="2-36"/>type, geographic location, or any other factor the corporation considers relevant.</subsection><subsection ssid="3-null-18" dnum="c-o" numlevel="1" lineno="105" slineno="2-37" level="2"><display>(c)</display>The corporation may adjust a maximum purchase price under this Subsection <xref depth="4" refnumber="63H-8-502(6)">(6)</xref> no <ln numlevel="1" lineno="106" slineno="2-38"/>more frequently than once each calendar year.</subsection></subsection><subsection ssid="3-null-19" dnum="7-o" numlevel="1" lineno="107" slineno="2-39" level="1" space="false"><display>(7)</display><subsection ssid="3-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="63H-8-502(7)(b)">(7)(b)</xref>, if the recipient sells the qualifying <ln numlevel="1" lineno="108" slineno="2-40"/>residential unit or refinances the qualifying mortgage loan that was used to finance <ln numlevel="1" lineno="109" slineno="2-41"/>the purchase of the qualifying residential unit before the end of the original term of <ln numlevel="1" lineno="110" slineno="2-42"/>the qualifying mortgage loan, the recipient shall repay to the corporation an amount <ln numlevel="1" lineno="111" slineno="2-43"/>equal to the lesser of:<subsection ssid="3-null-21" dnum="i-o" numlevel="1" lineno="112" slineno="2-44" level="3" tab="1"><display>(i)</display>the amount of program funds the recipient received; or</subsection><subsection ssid="3-null-22" dnum="ii-o" numlevel="1" lineno="113" slineno="2-45" level="3" tab="1"><display>(ii)</display>50% of the recipient's home equity amount.</subsection></subsection><subsection ssid="3-null-23" dnum="b-o" numlevel="1" lineno="114" slineno="2-46" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="63H-8-502(7)(a)">(7)(a)</xref> does not apply to a qualifying mortgage loan that is refinanced <ln numlevel="1" lineno="115" slineno="2-47"/>with a new qualifying mortgage loan if any subordinate qualifying mortgage loan, or <ln numlevel="1" lineno="116" slineno="2-48"/>loan from program funds used on the purchase of the qualifying residential unit, is <ln numlevel="1" lineno="117" slineno="2-49"/>resubordinated only to the new qualifying mortgage loan.</subsection></subsection><subsection ssid="3-null-24" dnum="8-o" numlevel="1" lineno="118" slineno="2-50" level="1"><display>(8)</display>Any funds repaid to the corporation under Subsection <xref depth="4" refnumber="63H-8-502(7)">(7)</xref> shall be used for program <ln numlevel="1" lineno="119" slineno="2-51"/>distributions.</subsection><subsection ssid="3-null-25" dnum="9-o" numlevel="1" lineno="120" slineno="2-52" level="1"><display>(9)</display>Subject to Subsection <xref depth="4" refnumber="63H-8-502(9)(b)">(9)(b)</xref>, the corporation shall make rules, in accordance with Title <ln numlevel="1" lineno="121" slineno="2-53"/>63G, Chapter 3, Utah Administrative Rulemaking Act:<subsection ssid="3-null-26" dnum="a-o" numlevel="1" lineno="122" slineno="2-54" level="2"><display>(a)</display>governing the application form, process, and criteria the corporation will use to <ln numlevel="1" lineno="123" slineno="2-55"/>distribute program funds to first-time homebuyers; and</subsection><subsection ssid="3-null-27" dnum="b-o" numlevel="1" lineno="124" slineno="2-56" level="2"><display>(b)</display>subject to appropriations from the Legislature, establishing an incentive program for <ln numlevel="1" lineno="125" slineno="2-57"/>qualified borrowers to utilize funding from the subordinate shared appreciation loan <ln numlevel="1" lineno="126" slineno="2-58"/>program for the purposes of assisting with the purchase of construction liability <ln numlevel="1" lineno="127" slineno="2-59"/>insurance for a qualifying condominium project.</subsection></subsection><subsection ssid="3-null-28" dnum="10-o" numlevel="1" lineno="128" slineno="2-60" level="1"><display>(10)</display>The corporation may use up to 5% of program funds for administration.</subsection><subsection ssid="3-null-29" dnum="11-o" numlevel="1" lineno="129" slineno="2-61" level="1"><display>(11)</display>The corporation shall report annually to the Economic and Community Development <ln numlevel="1" lineno="130" slineno="2-62"/>Appropriations Subcommittee on disbursements from the program and any adjustments <ln numlevel="1" lineno="131" slineno="2-63"/>made to the maximum purchase price or maximum purchase prices of a qualifying <ln numlevel="1" lineno="132" slineno="2-64"/>residential unit under Subsection <xref depth="4" refnumber="63H-8-502(6)">(6)</xref>.</subsection></section></bsec><bsec buid="5" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="133" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="133">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="134"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-11-26 8:41 AM</tm></rev></foot></leg>
