Section <bold>17-79-101</bold> is amended to read:</secline><catline lineno="28"><bold>17-79-101<parens/>. Purposes -- General land use authority -- Limitations.</bold></catline><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="29" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="6-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The purposes of this chapter are to:<subsection ssid="6-null-3" dnum="i-o" numlevel="1" lineno="30" slineno="1-4" level="3" tab="1"><display>(i)</display>provide for the health, safety, and welfare;</subsection><subsection ssid="6-null-4" dnum="ii-o" numlevel="1" lineno="31" slineno="1-5" level="3" tab="1"><display>(ii)</display>promote the prosperity;</subsection><subsection ssid="6-null-5" dnum="iii-o" numlevel="1" lineno="32" slineno="1-6" level="3" tab="1"><display>(iii)</display>improve the morals, peace, good order, comfort, convenience, and aesthetics of <ln numlevel="1" lineno="33" slineno="1-7"/>each county and each county's present and future inhabitants and businesses;</subsection><subsection ssid="6-null-6" dnum="iv-o" numlevel="1" lineno="34" slineno="1-8" level="3" tab="1"><display>(iv)</display>protect the tax base;</subsection><subsection ssid="6-null-7" dnum="v-o" numlevel="1" lineno="35" slineno="1-9" level="3" tab="1"><display>(v)</display>secure economy in governmental expenditures;</subsection><subsection ssid="6-null-8" dnum="vi-o" numlevel="1" lineno="36" slineno="1-10" level="3" tab="1"><display>(vi)</display>foster the state's agricultural and other industries;</subsection><subsection ssid="6-null-9" dnum="vii-o" numlevel="1" lineno="37" slineno="1-11" level="3" tab="1"><display>(vii)</display>protect both urban and nonurban development;</subsection><subsection ssid="6-null-10" dnum="viii-o" numlevel="1" lineno="38" slineno="1-12" level="3" tab="1"><display>(viii)</display>protect and ensure access to sunlight for solar energy devices;</subsection><subsection ssid="6-null-11" dnum="ix-o" numlevel="1" lineno="39" slineno="1-13" level="3" tab="1"><display>(ix)</display>provide fundamental fairness in land use regulation;</subsection><subsection ssid="6-null-12" dnum="x-o" numlevel="1" lineno="40" slineno="1-14" level="3" tab="1"><display>(x)</display>facilitate orderly growth, allow growth in a variety of housing types, and <ln numlevel="1" lineno="41" slineno="1-15"/>contribute toward housing affordability;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="6-null-13" dnum="xi-o" numlevel="1" lineno="42" slineno="1-16" level="3" tab="1"><display>(xi)</display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">protect property rights; and</amend></subsection><subsection ssid="6-40" dnum="_-o:xii-i" numlevel="1" lineno="43" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="both">(xii)</amend></display>protect property values.</subsection></subsection><subsection ssid="6-null-14" dnum="b-o" numlevel="1" lineno="44" slineno="1-18" level="2"><display>(b)</display>Subject to Subsection <xref depth="4" refnumber="17-27a-102(4)" start="0">(4)</xref> and Section <xref depth="3" refnumber="11-41-103" start="0">11-41-103</xref>, to accomplish the purposes of this <ln numlevel="1" lineno="45" slineno="1-19"/>chapter, a county may enact all ordinances<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="42" groupid="38" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="41" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> and</amend> resolutions, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="39" style="2" owner="jchristopherson" level="1" deltag="both">and rules</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">adopt all <ln numlevel="1" lineno="46" slineno="1-20"/>policies,</amend> and may enter into other forms of land use controls and development <ln numlevel="1" lineno="47" slineno="1-21"/>agreements that the county considers necessary or appropriate for the use and <ln numlevel="1" lineno="48" slineno="1-22"/>development of land within the unincorporated area of the county or a designated <ln numlevel="1" lineno="49" slineno="1-23"/>mountainous planning district, including ordinances, resolutions, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">rules</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">policies</amend>, <ln numlevel="1" lineno="50" slineno="1-24"/>restrictive covenants, easements, and development agreements governing:<subsection ssid="6-null-15" dnum="i-o" numlevel="1" lineno="51" slineno="1-25" level="3"><display>(i)</display>uses;</subsection><subsection ssid="6-null-16" dnum="ii-o" numlevel="1" lineno="52" slineno="1-26" level="3"><display>(ii)</display>density;</subsection><subsection ssid="6-null-17" dnum="iii-o" numlevel="1" lineno="53" slineno="1-27" level="3"><display>(iii)</display>open spaces;</subsection><subsection ssid="6-null-18" dnum="iv-o" numlevel="1" lineno="54" slineno="1-28" level="3"><display>(iv)</display>structures;</subsection><subsection ssid="6-null-19" dnum="v-o" numlevel="1" lineno="55" slineno="1-29" level="3"><display>(v)</display>buildings;</subsection><subsection ssid="6-null-20" dnum="vi-o" numlevel="1" lineno="56" slineno="1-30" level="3"><display>(vi)</display>energy-efficiency;</subsection><subsection ssid="6-null-21" dnum="vii-o" numlevel="1" lineno="57" slineno="1-31" level="3"><display>(vii)</display>light and air;</subsection><subsection ssid="6-null-22" dnum="viii-o" numlevel="1" lineno="58" slineno="1-32" level="3"><display>(viii)</display>air quality;</subsection><subsection ssid="6-null-23" dnum="ix-o" numlevel="1" lineno="59" slineno="1-33" level="3"><display>(ix)</display>transportation and public or alternative transportation;</subsection><subsection ssid="6-null-24" dnum="x-o" numlevel="1" lineno="60" slineno="1-34" level="3"><display>(x)</display>infrastructure;</subsection><subsection ssid="6-null-25" dnum="xi-o" numlevel="1" lineno="61" slineno="1-35" level="3"><display>(xi)</display>street and building orientation and width requirements;</subsection><subsection ssid="6-null-26" dnum="xii-o" numlevel="1" lineno="62" slineno="1-36" level="3"><display>(xii)</display>public facilities;</subsection><subsection ssid="6-null-27" dnum="xiii-o" numlevel="1" lineno="63" slineno="1-37" level="3"><display>(xiii)</display>fundamental fairness in land use regulation; and</subsection><subsection ssid="6-null-28" dnum="xiv-o" numlevel="1" lineno="64" slineno="1-38" level="3"><display>(xiv)</display>considerations of surrounding land uses to balance the foregoing purposes with <ln numlevel="1" lineno="65" slineno="1-39"/>a landowner's private property interests and associated statutory and constitutional <ln numlevel="1" lineno="66" slineno="1-40"/>protections.</subsection></subsection></subsection><subsection ssid="6-null-29" dnum="2-o" numlevel="1" lineno="67" slineno="1-41" level="1"><display>(2)</display>Each county shall comply with the mandatory provisions of this part before any <ln numlevel="1" lineno="68" slineno="1-42"/>agreement or contract to provide goods, services, or municipal-type services to any <ln numlevel="1" lineno="69" slineno="1-43"/>storage facility or transfer facility for high-level nuclear waste, or greater than class C <ln numlevel="1" lineno="70" slineno="1-44"/>radioactive waste, may be executed or implemented.</subsection><subsection ssid="6-null-30" dnum="3-o" numlevel="1" lineno="71" slineno="1-45" level="1" space="false"><display>(3)</display><subsection ssid="6-null-31" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Any ordinance<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> or</amend> resolution<amend anum="0" ea="amend" pairid="24" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both"> a county enacts</amend>, or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both">rule enacted by a county</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a <ln numlevel="1" lineno="72" slineno="1-46"/>policy that a county adopts</amend> in accordance with the county's authority under this <ln numlevel="1" lineno="73" slineno="1-47"/>chapter shall comply with the state's exclusive jurisdiction to regulate oil and gas <ln numlevel="1" lineno="74" slineno="1-48"/>activity, as described in Section <xref depth="3" refnumber="40-6-2.5" start="0">40-6-2.5</xref>.</subsection><subsection ssid="6-null-32" dnum="b-o" numlevel="1" lineno="75" slineno="1-49" level="2"><display>(b)</display>A county may enact an ordinance<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> or</amend> resolution, or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="35" style="2" owner="jchristopherson" level="1" deltag="both">rule</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">adopt a policy</amend> that <ln numlevel="1" lineno="76" slineno="1-50"/>regulates surface activity incident to an oil and gas activity if the county demonstrates <ln numlevel="1" lineno="77" slineno="1-51"/>that the regulation:<subsection ssid="6-null-33" dnum="i-o" numlevel="1" lineno="78" slineno="1-52" level="3"><display>(i)</display>is necessary for the purposes of this chapter;</subsection><subsection ssid="6-null-34" dnum="ii-o" numlevel="1" lineno="79" slineno="1-53" level="3"><display>(ii)</display>does not effectively or unduly limit, ban, or prohibit an oil and gas activity; and</subsection><subsection ssid="6-null-35" dnum="iii-o" numlevel="1" lineno="80" slineno="1-54" level="3"><display>(iii)</display>does not interfere with the state's exclusive jurisdiction to regulate oil and gas <ln numlevel="1" lineno="81" slineno="1-55"/>activity, as described in Section <xref depth="3" refnumber="40-6-2.5" start="0">40-6-2.5</xref>.</subsection></subsection></subsection><subsection ssid="6-null-36" dnum="4-o" numlevel="1" lineno="82" slineno="1-56" level="1" space="false"><display>(4)</display><subsection ssid="6-null-37" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This Subsection <xref depth="4" refnumber="17-27a-102(4)" start="0">(4)</xref> applies to development agreements entered into on or after <ln numlevel="1" lineno="83" slineno="1-57"/>May 5, 2021.</subsection><subsection ssid="6-null-38" dnum="b-o" numlevel="1" lineno="84" slineno="1-58" level="2"><display>(b)</display>A provision in a county development agreement is unenforceable if the provision <ln numlevel="1" lineno="85" slineno="1-59"/>requires an individual or an entity, as a condition for issuing building permits or <ln numlevel="1" lineno="86" slineno="1-60"/>otherwise regulating development activities within an unincorporated area of the <ln numlevel="1" lineno="87" slineno="1-61"/>county, to initiate a process for a municipality to annex the unincorporated area in <ln numlevel="1" lineno="88" slineno="1-62"/>accordance with Title <xref depth="2" refnumber="10-2-8">10, Chapter 2, Part 8</xref>, Annexation.</subsection><subsection ssid="6-null-39" dnum="c-o" numlevel="1" lineno="89" slineno="1-63" level="2"><display>(c)</display>Subsection <xref depth="4" refnumber="17-27a-102(4)(b)" start="0">(4)(b)</xref> does not affect or impair the enforceability of any other provision <ln numlevel="1" lineno="90" slineno="1-64"/>in the development agreement.</subsection></subsection></section></bsec><bsec buid="3" num="17-79-621" type="enact" src="code" uid="C17-79-S621_2026050620260506" sort="17 79 06210020260506" numlevel="1" lineno="91" slineno="2-1" sn="2"><section numlevel="1" lineno="92" slineno="2-2" number="17-79-621" type="enact"><secline lineno="91">Section 2. Section <bold>17-79-621</bold> is enacted to read:</secline><catline lineno="92"><bold>17-79-621<parens/>. Qualifying parcel application and approval for single-family dwelling <ln numlevel="1" lineno="93" slineno="2-3"/>building permit.</bold></catline><subsection ssid="3-1" dnum="_-o:1-i" numlevel="1" lineno="94" slineno="2-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="3-2" dnum="_-o:a-i" numlevel="1" lineno="95" slineno="2-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="246" groupid="194" style="1" owner="jchristopherson" level="1" amendtag="end">"Plan review" means the same as that term is defined in S<marker pairid="289"/><marker pairid="290"/><marker pairid="291"/>ection <xref depth="3" refnumber="17-79-810">17-79-810</xref>.</amend></subsection><subsection ssid="3-50" dnum="_-o:b-i" numlevel="1" lineno="96" slineno="2-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="243" groupid="191" style="1" owner="jchristopherson" level="1" amendtag="end">"Qualifying parcel" means a parcel of land in a county that:</amend><subsection ssid="3-38" dnum="_-o:i-i" numlevel="1" lineno="97" slineno="2-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="189" groupid="148" style="1" owner="jchristopherson" level="1" amendtag="end">was created by a written instrument, other than a subdivision plat, before the <ln numlevel="1" lineno="98" slineno="2-8"/>county adopted a land use ordinance regulating the parcel; or</amend></subsection><subsection ssid="3-39" dnum="_-o:ii-i" numlevel="1" lineno="99" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="193" groupid="151" style="1" owner="jchristopherson" level="1" amendtag="end">is similar to a lot or parcel that:</amend><subsection ssid="3-52" dnum="_-o:A-i" numlevel="1" lineno="100" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="256" groupid="202" style="1" owner="jchristopherson" level="1" amendtag="end">has the same zoning designation; and</amend></subsection><subsection ssid="3-54" dnum="_-o:B-i" numlevel="1" lineno="101" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" space="false"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><subsection ssid="3-55" dnum="_-o:I-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="5" placement="sameline"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1">(I)</amend></display><amend anum="0" ea="amend" pairid="206" groupid="161" style="1" owner="jchristopherson" level="1" amendtag="end">conforms to applicable development standards for a single-family <ln numlevel="1" lineno="102" slineno="2-12"/>residential lot;</amend></subsection><subsection ssid="3-43" dnum="_-o:II-i" numlevel="1" lineno="103" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="5"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(II)</amend></display><amend anum="0" ea="amend" pairid="211" groupid="165" style="1" owner="jchristopherson" level="1" amendtag="end">at some point in the past was approved, recognized, or treated as a lot or <ln numlevel="1" lineno="104" slineno="2-14"/>parcel for which a single-family dwelling was a conforming use; or</amend></subsection><subsection ssid="3-44" dnum="_-o:III-i" numlevel="1" lineno="105" slineno="2-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="5"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(III)</amend></display><amend anum="0" ea="amend" pairid="216" groupid="169" style="1" owner="jchristopherson" level="1" amendtag="end">contains a single-family dwelling that the county recognizes as a <ln numlevel="1" lineno="106" slineno="2-16"/>conforming use.</amend></subsection></subsection></subsection></subsection></subsection><subsection ssid="3-12" dnum="_-o:2-i" numlevel="1" lineno="107" slineno="2-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref depth="4" refnumber="17-79-621(3)">(3)</xref> and Section <xref depth="3" refnumber="17-79-810">17-79-810</xref>, a county shall accept and process a <ln numlevel="1" lineno="108" slineno="2-18"/>plan review application for a single-family dwelling on a qualifying parcel that is made <ln numlevel="1" lineno="109" slineno="2-19"/>by the qualifying parcel's owner of record, if:</amend><subsection ssid="3-56" dnum="_-o:a-i" numlevel="1" lineno="110" slineno="2-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="267" groupid="209" style="1" owner="jchristopherson" level="1" amendtag="end">the proposed building meets the minimum setback requirements of the zoning <ln numlevel="1" lineno="111" slineno="2-21"/>designation where the qualifying parcel is located;</amend></subsection><subsection ssid="3-57" dnum="_-o:b-i" numlevel="1" lineno="112" slineno="2-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="272" groupid="213" style="1" owner="jchristopherson" level="1" amendtag="end">applicable utility providers review and approve the plan review application;</amend></subsection><subsection ssid="3-58" dnum="_-o:c-i" numlevel="1" lineno="113" slineno="2-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="277" groupid="217" style="1" owner="jchristopherson" level="1" amendtag="end">to the extent required by county ordinance, the local health department reviews and <ln numlevel="1" lineno="114" slineno="2-24"/>approves the plan review application; and</amend></subsection><subsection ssid="3-59" dnum="_-o:d-i" numlevel="1" lineno="115" slineno="2-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="282" groupid="221" style="1" owner="jchristopherson" level="1" amendtag="end">to the extent required by county ordinance, the owner of the qualifying parcel <ln numlevel="1" lineno="116" slineno="2-26"/>dedicates a portion of the qualifying parcel for street frontage.</amend></subsection></subsection><subsection ssid="3-60" dnum="_-o:3-i" numlevel="1" lineno="117" slineno="2-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="287" groupid="225" style="1" owner="jchristopherson" level="1" amendtag="end">The owner of a parcel has the burden, under Subsection <xref depth="4" refnumber="17-79-621(2)">(2)</xref>, of establishing by <ln numlevel="1" lineno="118" slineno="2-28"/>substantial evidence that the parcel is a qualifying parcel.</amend></subsection><subsection ssid="3-49" dnum="_-o:4-i" numlevel="1" lineno="119" slineno="2-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="237" groupid="186" style="1" owner="jchristopherson" level="1" amendtag="end">A county accepting and processing a plan review or approval of a building permit under <ln numlevel="1" lineno="120" slineno="2-30"/>Subsection <xref depth="4" refnumber="17-79-621(2)">(2)</xref> does not:</amend><subsection ssid="3-26" dnum="_-o:a-i" numlevel="1" lineno="121" slineno="2-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="131" groupid="104" style="1" owner="jchristopherson" level="1" amendtag="end">require the county to accept or maintain a street or other right-of-way;</amend></subsection><subsection ssid="3-27" dnum="_-o:b-i" numlevel="1" lineno="122" slineno="2-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="136" groupid="108" style="1" owner="jchristopherson" level="1" amendtag="end">require the county, a special district, or a utility provider to extend or provide a <ln numlevel="1" lineno="123" slineno="2-33"/>utility to a qualifying parcel; or</amend></subsection><subsection ssid="3-28" dnum="_-o:c-i" numlevel="1" lineno="124" slineno="2-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="141" groupid="112" style="1" owner="jchristopherson" level="1" amendtag="end">limit the county's authority to enforce the provisions of this chapter or other law <ln numlevel="1" lineno="125" slineno="2-35"/>against a person who divides a parcel without required county approval.</amend></subsection></subsection></section></bsec><bsec buid="7" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="126" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="126">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="127"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-11-26 8:53 AM</tm></rev></foot></leg>
