and</hl><hl numlevel="1" lineno="15" slineno="0-15" level="2">report to the State Commission on Criminal and Juvenile Justice the number of <ln numlevel="1" lineno="16" slineno="0-16"/>complaints, and the outcomes of those complaints, that the department receives <ln numlevel="1" lineno="17" slineno="0-17"/>regarding transnational repression to be included in the public safety data portal;</hl></hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">requires the Utah Board of Higher Education to direct the state's institutions of higher <ln numlevel="1" lineno="19" slineno="0-19"/>education to provide information on transnational repression to international students <ln numlevel="1" lineno="20" slineno="0-20"/>and how to report transnational repression to law enforcement;   </hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">creates a criminal penalty enhancement for any crime if the crime is committed by an <ln numlevel="1" lineno="22" slineno="0-22"/>individual at the direction of a foreign government or an agent of a foreign terrorist <ln numlevel="1" lineno="23" slineno="0-23"/>organization in order to cause a victim to undertake, or refrain from undertaking, certain <ln numlevel="1" lineno="24" slineno="0-24"/>conduct; Section <bold>53-10-1101</bold> is enacted to read:</secline><headpart number="53-10-11" numlevel="1" lineno="43" slineno="1-2">11. Transnational Repression Training and Awareness</headpart><catline lineno="44"><bold>53-10-1101<parens/>. Definitions.</bold></catline><sectionText lineno="45"><para/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">As used in this part:</amend></sectionText><subsection ssid="8-11" dnum="_-o:1-i" numlevel="1" lineno="46" slineno="1-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">"Agent of a foreign government" means an individual who acts at the direction of, under <ln numlevel="1" lineno="47" slineno="1-6"/>the control of, or as a proxy for, a foreign government.</amend></subsection><subsection ssid="8-12" dnum="_-o:2-i" numlevel="1" lineno="48" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">"Agent of a foreign terrorist organization" means an individual who acts at the direction <ln numlevel="1" lineno="49" slineno="1-8"/>of, under the control of, or as a proxy for, a foreign terrorist organization designated by <ln numlevel="1" lineno="50" slineno="1-9"/>the federal government in accordance with 8 U.S.C. Sec. 1189.</amend></subsection><subsection ssid="8-1" dnum="_-o:3-i" numlevel="1" lineno="51" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">"Transnational repression" means conduct by an agent of a foreign government or an <ln numlevel="1" lineno="52" slineno="1-11"/>agent of a foreign terrorist organization that is:</amend><subsection ssid="8-17" dnum="_-o:a-i" numlevel="1" lineno="53" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">directed at an individual located within the United States, such as:</amend><subsection ssid="8-19" dnum="_-o:i-i" numlevel="1" lineno="54" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">harassment, intimidation, or censorship;</amend></subsection><subsection ssid="8-20" dnum="_-o:ii-i" numlevel="1" lineno="55" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">threats or use of physical force;</amend></subsection><subsection ssid="8-21" dnum="_-o:iii-i" numlevel="1" lineno="56" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">electronic or digital surveillance or targeting;</amend></subsection><subsection ssid="8-22" dnum="_-o:iv-i" numlevel="1" lineno="57" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">a threat of punishment, harassment, or retaliation against another individual <ln numlevel="1" lineno="58" slineno="1-17"/>under the foreign government's or foreign terrorist organization's effective control;</amend></subsection><subsection ssid="8-23" dnum="_-o:v-i" numlevel="1" lineno="59" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="84" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">financial coercion, including a threat or use of confiscation, expropriation, or <ln numlevel="1" lineno="60" slineno="1-19"/>denial of access to property or financial services;</amend></subsection><subsection ssid="8-24" dnum="_-o:vi-i" numlevel="1" lineno="61" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">abuse of administrative or immigration processes;</amend></subsection><subsection ssid="8-25" dnum="_-o:vii-i" numlevel="1" lineno="62" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="end">selective prosecution or enforcement of generally applicable laws; or</amend></subsection><subsection ssid="8-26" dnum="_-o:viii-i" numlevel="1" lineno="63" slineno="1-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="93" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">use or direction of social media, telecommunications, or similar entities to carry <ln numlevel="1" lineno="64" slineno="1-23"/>out conduct described in Subsections <xref depth="4" refnumber="53-10-1101(3)(a)(i)">(3)(a)(i)</xref> through <xref depth="4" refnumber="53-10-1101(vii)">(vii)</xref>; and</amend></subsection></subsection><subsection ssid="8-14" dnum="_-o:b-i" numlevel="1" lineno="65" slineno="1-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">done with the purpose of extending a foreign government's or foreign terrorist <ln numlevel="1" lineno="66" slineno="1-25"/>organization's ability to influence, control, or impose preferences on the individual's <ln numlevel="1" lineno="67" slineno="1-26"/>behavior while the individual is outside the foreign government's or foreign terrorist <ln numlevel="1" lineno="68" slineno="1-27"/>organization's area of control.</amend></subsection></subsection></section></bsec><bsec buid="9" num="53-10-1102" type="enact" src="code" uid="C53-10-S1102_2026050620260506" sort="53 10 11020020260506" numlevel="1" lineno="69" slineno="2-1" sn="2"><section numlevel="1" lineno="70" slineno="2-2" number="53-10-1102" type="enact"><secline lineno="69">Section 2. Section <bold>53-10-1102</bold> is enacted to read:</secline><catline lineno="70"><bold>53-10-1102<parens/>. Transnational repression law enforcement training and awareness <ln numlevel="1" lineno="71" slineno="2-3"/>campaign.</bold></catline><subsection ssid="9-1" dnum="_-o:1-i" numlevel="1" lineno="72" slineno="2-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref depth="4" refnumber="53-10-1102(2)">(2)</xref>, the department shall create a transnational repression <ln numlevel="1" lineno="73" slineno="2-5"/>recognition and response training offered to all certified law enforcement officers in the <ln numlevel="1" lineno="74" slineno="2-6"/>state.</amend></subsection><subsection ssid="9-14" dnum="_-o:2-i" numlevel="1" lineno="75" slineno="2-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">The training described in Subsection <xref depth="4" refnumber="53-10-1102(1)">(1)</xref>:</amend><subsection ssid="9-29" dnum="_-o:a-i" numlevel="1" lineno="76" slineno="2-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="end">may be offered through an online course developed by the department; and</amend></subsection><subsection ssid="9-30" dnum="_-o:b-i" numlevel="1" lineno="77" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="138" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="end">shall include the following:</amend><subsection ssid="9-4" dnum="_-o:i-i" numlevel="1" lineno="78" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">how to identify different tactics and signs of transnational repression;</amend></subsection><subsection ssid="9-5" dnum="_-o:ii-i" numlevel="1" lineno="79" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">descriptions of the foreign governments and terrorist organizations that are <ln numlevel="1" lineno="80" slineno="2-12"/>commonly known to employ transnational repression;</amend></subsection><subsection ssid="9-16" dnum="_-o:iii-i" numlevel="1" lineno="81" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">the tools foreign governments and terrorist organizations use to undertake <ln numlevel="1" lineno="82" slineno="2-14"/>transnational repression;</amend></subsection><subsection ssid="9-6" dnum="_-o:iv-i" numlevel="1" lineno="83" slineno="2-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">best practices for local and state law enforcement prevention, reporting, and <ln numlevel="1" lineno="84" slineno="2-16"/>response tactics to transnational repression;</amend></subsection><subsection ssid="9-17" dnum="_-o:v-i" numlevel="1" lineno="85" slineno="2-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">information about communities typically targeted by transnational repression; and</amend></subsection><subsection ssid="9-18" dnum="_-o:vi-i" numlevel="1" lineno="86" slineno="2-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">any other information or training the department determines is necessary.</amend></subsection></subsection></subsection><subsection ssid="9-31" dnum="_-o:3-i" numlevel="1" lineno="87" slineno="2-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="143" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall regularly update the training described in Subsection <xref depth="4" refnumber="53-10-1102(1)">(1)</xref> to ensure <ln numlevel="1" lineno="88" slineno="2-20"/>the training is up to date on emerging threats and the tactics used by foreign <ln numlevel="1" lineno="89" slineno="2-21"/>governments and terrorist organizations when undertaking transnational repression.</amend></subsection></section></bsec><bsec buid="15" num="53-10-1103" type="enact" src="code" uid="C53-10-S1103_2026050620260506" sort="53 10 11030020260506" numlevel="1" lineno="90" slineno="3-1" sn="3"><section numlevel="1" lineno="91" slineno="3-2" number="53-10-1103" type="enact"><secline lineno="90">Section 3. Transnational repression public awareness campaign and reporting.</bold></catline><subsection ssid="15-2" dnum="_-o:1-i" numlevel="1" lineno="92" slineno="3-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall develop a public awareness campaign to provide information to <ln numlevel="1" lineno="93" slineno="3-4"/>the public about:</amend><subsection ssid="15-7" dnum="_-o:a-i" numlevel="1" lineno="94" slineno="3-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">how to identify and report instances of transnational repression; and</amend></subsection><subsection ssid="15-8" dnum="_-o:b-i" numlevel="1" lineno="95" slineno="3-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">the tools and remedies that are available for victims of transnational repression.</amend></subsection></subsection><subsection ssid="15-3" dnum="_-o:2-i" numlevel="1" lineno="96" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="15-4" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall create a readily accessible public website and hotline for <ln numlevel="1" lineno="97" slineno="3-8"/>reporting instances of transnational repression.</amend></subsection><subsection ssid="15-5" dnum="_-o:b-i" numlevel="1" lineno="98" slineno="3-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall make the website and hotline described in Subsection <xref depth="4" refnumber="53-10-1103(2)(a)">(2)(a)</xref> <ln numlevel="1" lineno="99" slineno="3-10"/>available in multiple languages, including in the languages of communities the <ln numlevel="1" lineno="100" slineno="3-11"/>department determines are commonly victimized through transnational repression.</amend></subsection></subsection><subsection ssid="15-6" dnum="_-o:3-i" numlevel="1" lineno="101" slineno="3-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall report the number of complaints received, and the outcomes of the <ln numlevel="1" lineno="102" slineno="3-13"/>complaints, to the State Commission on Criminal and Juvenile Justice created in Section <xref depth="3" refnumber="63M-7-201"><ln numlevel="1" lineno="103" slineno="3-14"/>63M-7-201</xref>.</amend></subsection></section></bsec><bsec buid="13" num="53H-1-203" type="amend" src="code" uid="C53H-1-S203_2026050620260506" sort="53H01 02030020260506" numlevel="1" lineno="104" slineno="4-1" sn="4"><section number="53H-1-203" numlevel="1" lineno="105" slineno="4-2" type="amend"><secline lineno="104">Section 4. Section <bold>53H-1-203</bold> is amended to read:</secline><catline lineno="105"><bold>53H-1-203<parens/>. Establishment of board -- Powers, duties, and authority -- Reports.</bold></catline><subsection ssid="13-null-1" dnum="1-o" numlevel="1" lineno="106" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="13-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>There is established the Utah Board of Higher Education, which:<subsection ssid="13-null-3" dnum="i-o" numlevel="1" lineno="107" slineno="4-4" level="3" tab="1"><display>(i)</display>is the governing board for the institutions of higher education; and</subsection><subsection ssid="13-null-4" dnum="ii-o" numlevel="1" lineno="108" slineno="4-5" level="3" tab="1"><display>(ii)</display>controls, oversees, and regulates the Utah System of Higher Education in a <ln numlevel="1" lineno="109" slineno="4-6"/>manner consistent with the purpose of this title and the specific powers and <ln numlevel="1" lineno="110" slineno="4-7"/>responsibilities granted to the board.</subsection></subsection><subsection ssid="13-null-5" dnum="b-o" numlevel="1" lineno="111" slineno="4-8" level="2" space="false"><display>(b)</display><subsection ssid="13-null-6" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The University of Utah shall provide administrative support for the board.</subsection><subsection ssid="13-null-7" dnum="ii-o" numlevel="1" lineno="112" slineno="4-9" level="3"><display>(ii)</display>Notwithstanding Subsection <xref depth="4" refnumber="53B-1-402(1)(b)(i)">(1)(b)(i)</xref>, the board shall maintain the board's <ln numlevel="1" lineno="113" slineno="4-10"/>independence, including in relation to the powers and responsibilities granted to <ln numlevel="1" lineno="114" slineno="4-11"/>the board.</subsection></subsection></subsection><subsection ssid="13-null-8" dnum="2-o" numlevel="1" lineno="115" slineno="4-12" level="1"><display>(2)</display>The board shall:<subsection ssid="13-null-9" dnum="a-o" numlevel="1" lineno="116" slineno="4-13" level="2"><display>(a)</display>establish and promote a state-level vision and goals for higher education that <ln numlevel="1" lineno="117" slineno="4-14"/>emphasize data-driven retrospective and prospective system priorities, including:<subsection ssid="13-null-10" dnum="i-o" numlevel="1" lineno="118" slineno="4-15" level="3"><display>(i)</display>quality;</subsection><subsection ssid="13-null-11" dnum="ii-o" numlevel="1" lineno="119" slineno="4-16" level="3"><display>(ii)</display>affordability;</subsection><subsection ssid="13-null-12" dnum="iii-o" numlevel="1" lineno="120" slineno="4-17" level="3"><display>(iii)</display>access and equity;</subsection><subsection ssid="13-null-13" dnum="iv-o" numlevel="1" lineno="121" slineno="4-18" level="3"><display>(iv)</display>completion;</subsection><subsection ssid="13-null-14" dnum="v-o" numlevel="1" lineno="122" slineno="4-19" level="3"><display>(v)</display>workforce alignment and preparation for high-quality jobs; and</subsection><subsection ssid="13-null-15" dnum="vi-o" numlevel="1" lineno="123" slineno="4-20" level="3"><display>(vi)</display>economic growth;</subsection></subsection><subsection ssid="13-null-16" dnum="b-o" numlevel="1" lineno="124" slineno="4-21" level="2"><display>(b)</display>establish system policies and practices that advance the vision and goals;</subsection><subsection ssid="13-null-17" dnum="c-o" numlevel="1" lineno="125" slineno="4-22" level="2"><display>(c)</display>establish metrics to demonstrate and monitor:<subsection ssid="13-null-18" dnum="i-o" numlevel="1" lineno="126" slineno="4-23" level="3"><display>(i)</display>performance related to the goals; and</subsection><subsection ssid="13-null-19" dnum="ii-o" numlevel="1" lineno="127" slineno="4-24" level="3"><display>(ii)</display>performance on measures of operational efficiency;</subsection></subsection><subsection ssid="13-null-20" dnum="d-o" numlevel="1" lineno="128" slineno="4-25" level="2"><display>(d)</display>collect and analyze data including economic data, demographic data, and data related <ln numlevel="1" lineno="129" slineno="4-26"/>to the metrics;</subsection><subsection ssid="13-null-21" dnum="e-o" numlevel="1" lineno="130" slineno="4-27" level="2"><display>(e)</display>govern data quality and collection across institutions;</subsection><subsection ssid="13-null-22" dnum="f-o" numlevel="1" lineno="131" slineno="4-28" level="2"><display>(f)</display>establish, approve, and oversee each institution's mission and role in accordance with <ln numlevel="1" lineno="132" slineno="4-29"/>Section <xref depth="3" refnumber="53H-3-602">53H-3-602</xref>;</subsection><subsection ssid="13-null-23" dnum="g-o" numlevel="1" lineno="133" slineno="4-30" level="2"><display>(g)</display>assess an institution's performance in accomplishing the institution's mission and role;</subsection><subsection ssid="13-null-24" dnum="h-o" numlevel="1" lineno="134" slineno="4-31" level="2"><display>(h)</display>participate in the establishment and review of programs of instruction in accordance <ln numlevel="1" lineno="135" slineno="4-32"/>with Section <xref depth="3" refnumber="53H-3-603">53H-3-603</xref>;</subsection><subsection ssid="13-null-25" dnum="i-o" numlevel="1" lineno="136" slineno="4-33" level="2"><display>(i)</display>perform the following duties related to an institution of higher education president, <ln numlevel="1" lineno="137" slineno="4-34"/>including:<subsection ssid="13-null-26" dnum="i-o" numlevel="1" lineno="138" slineno="4-35" level="3"><display>(i)</display>hiring an institution of higher education president in accordance with Section <xref depth="3" refnumber="53H-3-302"><ln numlevel="1" lineno="139" slineno="4-36"/>53H-3-302</xref>;</subsection><subsection ssid="13-null-27" dnum="ii-o" numlevel="1" lineno="140" slineno="4-37" level="3"><display>(ii)</display>through the commissioner and the board's executive committee:<subsection ssid="13-null-28" dnum="A-o" numlevel="1" lineno="141" slineno="4-38" level="4"><display>(A)</display>providing support and guidance to an institution of higher education president; <ln numlevel="1" lineno="142" slineno="4-39"/>and</subsection><subsection ssid="13-null-29" dnum="B-o" numlevel="1" lineno="143" slineno="4-40" level="4"><display>(B)</display>evaluating an institution of higher education president based on institution <ln numlevel="1" lineno="144" slineno="4-41"/>performance and progress toward systemwide priorities;</subsection></subsection><subsection ssid="13-null-30" dnum="iii-o" numlevel="1" lineno="145" slineno="4-42" level="3"><display>(iii)</display>setting the terms of employment for an institution of higher education president, <ln numlevel="1" lineno="146" slineno="4-43"/>including performance-based compensation, through an employment contract or <ln numlevel="1" lineno="147" slineno="4-44"/>another method of establishing employment; and</subsection><subsection ssid="13-null-31" dnum="iv-o" numlevel="1" lineno="148" slineno="4-45" level="3"><display>(iv)</display>establishing, through a confidential process, a statewide succession plan to <ln numlevel="1" lineno="149" slineno="4-46"/>develop potential institution presidents from within the system;</subsection></subsection><subsection ssid="13-null-32" dnum="j-o" numlevel="1" lineno="150" slineno="4-47" level="2"><display>(j)</display>create and implement a strategic finance plan for higher education, including by:<subsection ssid="13-null-33" dnum="i-o" numlevel="1" lineno="151" slineno="4-48" level="3"><display>(i)</display>establishing comprehensive budget and finance priorities for academic education <ln numlevel="1" lineno="152" slineno="4-49"/>and technical education;</subsection><subsection ssid="13-null-34" dnum="ii-o" numlevel="1" lineno="153" slineno="4-50" level="3"><display>(ii)</display>allocating statewide resources to institutions;</subsection><subsection ssid="13-null-35" dnum="iii-o" numlevel="1" lineno="154" slineno="4-51" level="3"><display>(iii)</display>setting tuition for each institution;</subsection><subsection ssid="13-null-36" dnum="iv-o" numlevel="1" lineno="155" slineno="4-52" level="3"><display>(iv)</display>administering state financial aid programs;</subsection><subsection ssid="13-null-37" dnum="v-o" numlevel="1" lineno="156" slineno="4-53" level="3"><display>(v)</display>administering performance funding in accordance with Chapter <xref depth="2" refnumber="53B-8-3">8, Part 3</xref>, <ln numlevel="1" lineno="157" slineno="4-54"/>Performance Funding; and</subsection><subsection ssid="13-null-38" dnum="vi-o" numlevel="1" lineno="158" slineno="4-55" level="3"><display>(vi)</display>developing a strategic capital facility plan and prioritization process in <ln numlevel="1" lineno="159" slineno="4-56"/>accordance with Chapter <xref depth="2" refnumber="53B-9-5">9, Part 5</xref>, General Capital Developments, and Sections <xref depth="3" refnumber="53H-9-604"><ln numlevel="1" lineno="160" slineno="4-57"/>53H-9-604</xref> and <xref depth="3" refnumber="53H-9-605">53H-9-605</xref>;</subsection></subsection><subsection ssid="13-null-39" dnum="k-o" numlevel="1" lineno="161" slineno="4-58" level="2"><display>(k)</display>create and annually report to the Higher Education Appropriations Subcommittee on <ln numlevel="1" lineno="162" slineno="4-59"/>a seamless articulated education system for Utah students that responds to changing <ln numlevel="1" lineno="163" slineno="4-60"/>demographics and workforce, including by:<subsection ssid="13-null-40" dnum="i-o" numlevel="1" lineno="164" slineno="4-61" level="3"><display>(i)</display>providing for statewide prior learning assessment, in accordance with Section <xref depth="3" refnumber="53H-3-702"><ln numlevel="1" lineno="165" slineno="4-62"/>53H-3-702</xref>;</subsection><subsection ssid="13-null-41" dnum="ii-o" numlevel="1" lineno="166" slineno="4-63" level="3"><display>(ii)</display>establishing and maintaining clear pathways for articulation and transfer, in <ln numlevel="1" lineno="167" slineno="4-64"/>accordance with Section <xref depth="3" refnumber="53H-3-604">53H-3-604</xref>;</subsection><subsection ssid="13-null-42" dnum="iii-o" numlevel="1" lineno="168" slineno="4-65" level="3"><display>(iii)</display>establishing degree program requirement guidelines, including credit hour limits;</subsection><subsection ssid="13-null-43" dnum="iv-o" numlevel="1" lineno="169" slineno="4-66" level="3"><display>(iv)</display>aligning general education requirements across degree-granting institutions;</subsection><subsection ssid="13-null-44" dnum="v-o" numlevel="1" lineno="170" slineno="4-67" level="3"><display>(v)</display>coordinating and incentivizing collaboration and partnerships between institutions <ln numlevel="1" lineno="171" slineno="4-68"/>in delivering programs;</subsection><subsection ssid="13-null-45" dnum="vi-o" numlevel="1" lineno="172" slineno="4-69" level="3"><display>(vi)</display>coordinating distance delivery of programs;</subsection><subsection ssid="13-null-46" dnum="vii-o" numlevel="1" lineno="173" slineno="4-70" level="3"><display>(vii)</display>coordinating work-based learning; and</subsection><subsection ssid="13-null-47" dnum="viii-o" numlevel="1" lineno="174" slineno="4-71" level="3"><display>(viii)</display>emphasizing the system priorities and metrics described in Subsections <xref depth="4" refnumber="53B-1-402(2)(a)">(2)(a)</xref> <ln numlevel="1" lineno="175" slineno="4-72"/>and <xref depth="4" refnumber="53B-1-402(c)">(c)</xref>;</subsection></subsection><subsection ssid="13-null-48" dnum="l-o" numlevel="1" lineno="176" slineno="4-73" level="2"><display>(l)</display>coordinate with the public education system:<subsection ssid="13-null-49" dnum="i-o" numlevel="1" lineno="177" slineno="4-74" level="3"><display>(i)</display>regarding public education programs that provide postsecondary credit or <ln numlevel="1" lineno="178" slineno="4-75"/>certificates; and</subsection><subsection ssid="13-null-50" dnum="ii-o" numlevel="1" lineno="179" slineno="4-76" level="3"><display>(ii)</display>to ensure that an institution of higher education providing technical education <ln numlevel="1" lineno="180" slineno="4-77"/>serves secondary students in the public education system;</subsection></subsection><subsection ssid="13-null-51" dnum="m-o" numlevel="1" lineno="181" slineno="4-78" level="2"><display>(m)</display>delegate to an institution board of trustees certain duties related to institution <ln numlevel="1" lineno="182" slineno="4-79"/>governance including:<subsection ssid="13-null-52" dnum="i-o" numlevel="1" lineno="183" slineno="4-80" level="3"><display>(i)</display>guidance and support for the institution president;</subsection><subsection ssid="13-null-53" dnum="ii-o" numlevel="1" lineno="184" slineno="4-81" level="3"><display>(ii)</display>effective administration;</subsection><subsection ssid="13-null-54" dnum="iii-o" numlevel="1" lineno="185" slineno="4-82" level="3"><display>(iii)</display>the institution's responsibility for contributing to progress toward achieving <ln numlevel="1" lineno="186" slineno="4-83"/>systemwide goals; and</subsection><subsection ssid="13-null-55" dnum="iv-o" numlevel="1" lineno="187" slineno="4-84" level="3"><display>(iv)</display>other responsibilities determined by the board;</subsection></subsection><subsection ssid="13-null-56" dnum="n-o" numlevel="1" lineno="188" slineno="4-85" level="2"><display>(n)</display>delegate to an institution of higher education president management of the institution <ln numlevel="1" lineno="189" slineno="4-86"/>of higher education;</subsection><subsection ssid="13-null-57" dnum="o-o" numlevel="1" lineno="190" slineno="4-87" level="2"><display>(o)</display>consult with an institution of higher education board of trustees or institution of <ln numlevel="1" lineno="191" slineno="4-88"/>higher education president before acting on matters pertaining to the institution of <ln numlevel="1" lineno="192" slineno="4-89"/>higher education;</subsection><subsection ssid="13-null-58" dnum="p-o" numlevel="1" lineno="193" slineno="4-90" level="2"><display>(p)</display>maximize efficiency throughout the Utah System of Higher Education by identifying <ln numlevel="1" lineno="194" slineno="4-91"/>and establishing shared administrative services, beginning with:<subsection ssid="13-null-59" dnum="i-o" numlevel="1" lineno="195" slineno="4-92" level="3"><display>(i)</display>commercialization;</subsection><subsection ssid="13-null-60" dnum="ii-o" numlevel="1" lineno="196" slineno="4-93" level="3"><display>(ii)</display>services for compliance with Title IX of the Education Amendments of 1972, 20 <ln numlevel="1" lineno="197" slineno="4-94"/>U.S.C. Sec. 1681 et seq.;</subsection><subsection ssid="13-null-61" dnum="iii-o" numlevel="1" lineno="198" slineno="4-95" level="3"><display>(iii)</display>information technology services; and</subsection><subsection ssid="13-null-62" dnum="iv-o" numlevel="1" lineno="199" slineno="4-96" level="3"><display>(iv)</display>human resources, payroll, and benefits administration;</subsection></subsection><subsection ssid="13-null-63" dnum="q-o" numlevel="1" lineno="200" slineno="4-97" level="2"><display>(q)</display>develop strategies for providing higher education, including career and technical <ln numlevel="1" lineno="201" slineno="4-98"/>education, in rural areas;</subsection><subsection ssid="13-null-64" dnum="r-o" numlevel="1" lineno="202" slineno="4-99" level="2"><display>(r)</display>manage and facilitate a process for initiating, prioritizing, and implementing <ln numlevel="1" lineno="203" slineno="4-100"/>education reform initiatives, beginning with common applications and direct <ln numlevel="1" lineno="204" slineno="4-101"/>admissions;</subsection><subsection ssid="13-null-65" dnum="s-o" numlevel="1" lineno="205" slineno="4-102" level="2"><display>(s)</display>provide ongoing quality review of programs;</subsection><subsection ssid="13-null-66" dnum="t-o" numlevel="1" lineno="206" slineno="4-103" level="2"><display>(t)</display>before each annual legislative general session, provide to the Higher Education <ln numlevel="1" lineno="207" slineno="4-104"/>Appropriations Subcommittee a prioritization of all projects and proposals for which <ln numlevel="1" lineno="208" slineno="4-105"/>the board or an institution of higher education seeks an appropriation;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="13-null-67" dnum="u-o" numlevel="1" lineno="209" slineno="4-106" level="2"><display>(u)</display>coordinate with the Department of Corrections to establish educational programs for <ln numlevel="1" lineno="210" slineno="4-107"/>inmates as described in Section <xref depth="3" refnumber="64-13-6">64-13-6</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="13-93" dnum="_-o:v-i" numlevel="1" lineno="211" slineno="4-108" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">require that institutions provide information to international students regarding <ln numlevel="1" lineno="212" slineno="4-109"/>transnational repression, as that term is defined in Section <xref depth="3" refnumber="53-10-1101">53-10-1101</xref>, and how to <ln numlevel="1" lineno="213" slineno="4-110"/>report instances of transnational repression to law enforcement as described in <ln numlevel="1" lineno="214" slineno="4-111"/>Section <xref depth="3" refnumber="53-10-1103">53-10-1103</xref>.</amend></subsection></subsection><subsection ssid="13-null-68" dnum="3-o" numlevel="1" lineno="215" slineno="4-112" level="1"><display>(3)</display>The board shall submit an annual report of the board's activities and performance <ln numlevel="1" lineno="216" slineno="4-113"/>against the board's goals and metrics to:<subsection ssid="13-null-69" dnum="a-o" numlevel="1" lineno="217" slineno="4-114" level="2"><display>(a)</display>the Education Interim Committee;</subsection><subsection ssid="13-null-70" dnum="b-o" numlevel="1" lineno="218" slineno="4-115" level="2"><display>(b)</display>the Higher Education Appropriations Subcommittee;</subsection><subsection ssid="13-null-71" dnum="c-o" numlevel="1" lineno="219" slineno="4-116" level="2"><display>(c)</display>the governor; and</subsection><subsection ssid="13-null-72" dnum="d-o" numlevel="1" lineno="220" slineno="4-117" level="2"><display>(d)</display>each institution of higher education.</subsection></subsection><subsection ssid="13-null-73" dnum="4-o" numlevel="1" lineno="221" slineno="4-118" level="1"><display>(4)</display>The board shall prepare and submit an annual report detailing the board's progress and <ln numlevel="1" lineno="222" slineno="4-119"/>recommendations on workforce related issues, including career and technical education, <ln numlevel="1" lineno="223" slineno="4-120"/>to the governor and to the Education Interim Committee by December 1 of each year, <ln numlevel="1" lineno="224" slineno="4-121"/>including information detailing:<subsection ssid="13-null-74" dnum="a-o" numlevel="1" lineno="225" slineno="4-122" level="2"><display>(a)</display>how institutions of higher education are meeting the career and technical education <ln numlevel="1" lineno="226" slineno="4-123"/>needs of secondary students;</subsection><subsection ssid="13-null-75" dnum="b-o" numlevel="1" lineno="227" slineno="4-124" level="2"><display>(b)</display>how the system emphasized high demand, high wage, and high skill jobs in business <ln numlevel="1" lineno="228" slineno="4-125"/>and industry;</subsection><subsection ssid="13-null-76" dnum="c-o" numlevel="1" lineno="229" slineno="4-126" level="2"><display>(c)</display>performance outcomes, including:<subsection ssid="13-null-77" dnum="i-o" numlevel="1" lineno="230" slineno="4-127" level="3"><display>(i)</display>entered employment;</subsection><subsection ssid="13-null-78" dnum="ii-o" numlevel="1" lineno="231" slineno="4-128" level="3"><display>(ii)</display>job retention; and</subsection><subsection ssid="13-null-79" dnum="iii-o" numlevel="1" lineno="232" slineno="4-129" level="3"><display>(iii)</display>earnings;</subsection></subsection><subsection ssid="13-null-80" dnum="d-o" numlevel="1" lineno="233" slineno="4-130" level="2"><display>(d)</display>an analysis of workforce needs and efforts to meet workforce needs; and</subsection><subsection ssid="13-null-81" dnum="e-o" numlevel="1" lineno="234" slineno="4-131" level="2"><display>(e)</display>student tuition and fees.</subsection></subsection><subsection ssid="13-null-82" dnum="5-o" numlevel="1" lineno="235" slineno="4-132" level="1"><display>(5)</display>The board may modify the name of an institution of higher education to reflect the role <ln numlevel="1" lineno="236" slineno="4-133"/>and general course of study of the institution.</subsection><subsection ssid="13-null-83" dnum="6-o" numlevel="1" lineno="237" slineno="4-134" level="1"><display>(6)</display>The board may not take action relating to merging a technical college with another <ln numlevel="1" lineno="238" slineno="4-135"/>institution of higher education without legislative approval.</subsection><subsection ssid="13-null-84" dnum="7-o" numlevel="1" lineno="239" slineno="4-136" level="1"><display>(7)</display>This section does not affect the power and authority vested in the State Board of <ln numlevel="1" lineno="240" slineno="4-137"/>Education to apply for, accept, and manage federal appropriations for the establishment <ln numlevel="1" lineno="241" slineno="4-138"/>and maintenance of career and technical education.</subsection><subsection ssid="13-null-85" dnum="8-o" numlevel="1" lineno="242" slineno="4-139" level="1"><display>(8)</display>The board shall ensure that any training or certification that an employee of the higher <ln numlevel="1" lineno="243" slineno="4-140"/>education system is required to complete under this title or by board rule complies with <ln numlevel="1" lineno="244" slineno="4-141"/>Title <xref depth="1" refnumber="63G-22">63G, Chapter 22</xref>, State Training and Certification Requirements.</subsection><subsection ssid="13-null-86" dnum="9-o" numlevel="1" lineno="245" slineno="4-142" level="1"><display>(9)</display>The board shall demonstrate compliance with Subsection <xref refnumber="53B-1-402(2)(p)" depth="4">(2)(p)</xref> by providing to the <ln numlevel="1" lineno="246" slineno="4-143"/>Higher Education Appropriations Subcommittee:<subsection ssid="13-null-87" dnum="a-o" numlevel="1" lineno="247" slineno="4-144" level="2"><display>(a)</display>on or before October 1, 2024, evidence of implementation of at least one shared <ln numlevel="1" lineno="248" slineno="4-145"/>administrative service;</subsection><subsection ssid="13-null-88" dnum="b-o" numlevel="1" lineno="249" slineno="4-146" level="2"><display>(b)</display>on or before October 1, 2025, evidence of implementation of at least two shared <ln numlevel="1" lineno="250" slineno="4-147"/>administrative services; and</subsection><subsection ssid="13-null-89" dnum="c-o" numlevel="1" lineno="251" slineno="4-148" level="2"><display>(c)</display>on or before October 1, 2026, evidence of implementation of at least three shared <ln numlevel="1" lineno="252" slineno="4-149"/>administrative services.</subsection></subsection><subsection ssid="13-null-90" dnum="10-o" numlevel="1" lineno="253" slineno="4-150" level="1"><display>(10)</display>If the Higher Education Appropriations Subcommittee finds the board to be out of <ln numlevel="1" lineno="254" slineno="4-151"/>compliance with Subsection <xref refnumber="53B-1-402(9)" depth="4">(9)</xref>, the Legislature shall:<subsection ssid="13-null-91" dnum="a-o" numlevel="1" lineno="255" slineno="4-152" level="2"><display>(a)</display>deduct 10% of the appropriation described in Section <xref depth="3" refnumber="53H-8-302">53H-8-302</xref> for the following <ln numlevel="1" lineno="256" slineno="4-153"/>fiscal year; and</subsection><subsection ssid="13-null-92" dnum="b-o" numlevel="1" lineno="257" slineno="4-154" level="2"><display>(b)</display>deduct an additional 10% of the appropriation described in Section <xref depth="3" refnumber="53H-8-302">53H-8-302</xref> for <ln numlevel="1" lineno="258" slineno="4-155"/>each subsequent year of noncompliance up to a maximum deduction of 30%.</subsection></subsection></section></bsec><bsec buid="11" num="63A-16-1002" type="amend" src="code" uid="C63A-16-S1002_2026050620260506" sort="63A16 10020020260506" numlevel="1" lineno="259" slineno="5-1" sn="5"><section number="63A-16-1002" numlevel="1" lineno="260" slineno="5-2" type="amend"><secline lineno="259">Section 5. Section <bold>63A-16-1002</bold> is amended to read:</secline><catline lineno="260"><bold>63A-16-1002<parens/>. Public safety portal.</bold></catline><subsection ssid="11-null-1" dnum="1-o" numlevel="1" lineno="261" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>The commission shall oversee the creation and management of a public safety portal for <ln numlevel="1" lineno="262" slineno="5-4"/>information and data required to be reported to the commission and accessible to all <ln numlevel="1" lineno="263" slineno="5-5"/>criminal justice agencies in the state.</subsection><subsection ssid="11-null-2" dnum="2-o" numlevel="1" lineno="264" slineno="5-6" level="1"><display>(2)</display>The division shall assist with the development and management of the public safety <ln numlevel="1" lineno="265" slineno="5-7"/>portal.</subsection><subsection ssid="11-null-3" dnum="3-o" numlevel="1" lineno="266" slineno="5-8" level="1"><display>(3)</display>The division, in collaboration with the commission, shall create:<subsection ssid="11-null-4" dnum="a-o" numlevel="1" lineno="267" slineno="5-9" level="2"><display>(a)</display>master standards and formats for information submitted to the public safety portal;</subsection><subsection ssid="11-null-5" dnum="b-o" numlevel="1" lineno="268" slineno="5-10" level="2"><display>(b)</display>a gateway, bridge, website, or other method for reporting entities to provide the <ln numlevel="1" lineno="269" slineno="5-11"/>information;</subsection><subsection ssid="11-null-6" dnum="c-o" numlevel="1" lineno="270" slineno="5-12" level="2"><display>(c)</display>a master data management index or system to assist in the retrieval of information <ln numlevel="1" lineno="271" slineno="5-13"/>from the public safety portal;</subsection><subsection ssid="11-null-7" dnum="d-o" numlevel="1" lineno="272" slineno="5-14" level="2"><display>(d)</display>a protocol for accessing information in the public safety portal that complies with <ln numlevel="1" lineno="273" slineno="5-15"/>state privacy regulations; and</subsection><subsection ssid="11-null-8" dnum="e-o" numlevel="1" lineno="274" slineno="5-16" level="2"><display>(e)</display>a protocol for real-time audit capability of all data accessed from the public safety <ln numlevel="1" lineno="275" slineno="5-17"/>portal by participating data source, data use entities, and regulators.</subsection></subsection><subsection ssid="11-null-9" dnum="4-o" numlevel="1" lineno="276" slineno="5-18" level="1"><display>(4)</display>The public safety portal shall be the repository for the statutorily required data described <ln numlevel="1" lineno="277" slineno="5-19"/>in:<subsection ssid="11-null-10" dnum="a-o" numlevel="1" lineno="278" slineno="5-20" level="2"><display>(a)</display>Section <xref depth="3" refnumber="13-53-111">13-53-111</xref>, Recidivism reporting requirements;</subsection><subsection ssid="11-null-11" dnum="b-o" numlevel="1" lineno="279" slineno="5-21" level="2"><display>(b)</display>Section <xref depth="3" refnumber="17-72-408">17-72-408</xref>, County jail reporting requirements;</subsection><subsection ssid="11-null-12" dnum="c-o" numlevel="1" space="true">(aa)</amend></display>any other statutes that require the collection of specific data and the reporting of <ln numlevel="1" lineno="309" slineno="5-51"/>that data to the commission.</subsection></subsection><subsection ssid="11-null-36" dnum="5-o" numlevel="1" lineno="310" slineno="5-52" level="1"><display>(5)</display>Before October 1, 2025, the commission shall report all data collected to the Law <ln numlevel="1" lineno="311" slineno="5-53"/>Enforcement and Criminal Justice Interim Committee.</subsection><subsection ssid="11-null-37" dnum="6-o" numlevel="1" lineno="312" slineno="5-54" level="1"><display>(6)</display>The commission may:<subsection ssid="11-null-38" dnum="a-o" numlevel="1" lineno="313" slineno="5-55" level="2"><display>(a)</display>enter into contracts with private or governmental entities to assist entities in <ln numlevel="1" lineno="314" slineno="5-56"/>complying with the data reporting requirements of Subsection <xref depth="4" refnumber="63A-16-1002(4)">(4)</xref>; and</subsection><subsection ssid="11-null-39" dnum="b-o" numlevel="1" lineno="315" slineno="5-57" level="2"><display>(b)</display>make, in accordance with Title <xref depth="1" refnumber="63G-3">63G, Chapter 3</xref>, Utah Administrative Rulemaking <ln numlevel="1" lineno="316" slineno="5-58"/>Act, rules to administer this section, including establishing requirements and <ln numlevel="1" lineno="317" slineno="5-59"/>procedures for collecting the data described in Subsection <xref depth="4" refnumber="63A-16-1002(4)">(4)</xref>.</subsection></subsection></section></bsec><bsec buid="6" num="76-3-203.21" type="enact" src="code" uid="C76-3-S203.21_2026050620260506" sort="76 03 02032120260506" numlevel="1" lineno="318" slineno="6-1" sn="6"><section numlevel="1" lineno="319" slineno="6-2" number="76-3-203.21" type="enact"><secline lineno="318">Section 6. Section <bold>76-3-203.21</bold> is enacted to read:</secline><catline lineno="319"><bold>76-3-203.21<parens/>. or</amend></subsection><subsection ssid="6-55" dnum="_-o:ii-i" numlevel="1" lineno="330" slineno="6-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1170" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="164" groupid="126" style="1" owner="jchristopherson" level="1" amendtag="end">acted at the direction, request, command, or otherwise under the influence of, a <ln numlevel="1" lineno="331" slineno="6-14"/>foreign government or foreign terrorist organization; and</amend></subsection></subsection><subsection ssid="6-56" dnum="_-o:b-i" numlevel="1" lineno="332" slineno="6-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1171" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="170" groupid="131" style="1" owner="jchristopherson" level="1" amendtag="end">committed the criminal offense with the intent to:</amend><subsection ssid="6-57" dnum="_-o:i-i" numlevel="1" lineno="333" slineno="6-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" space="false"><display><amend anum="0" ea="amend" pairid="1172" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><subsection ssid="6-62" dnum="_-o:A-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" placement="sameline"><display><amend anum="0" ea="amend" pairid="1173" style="1" owner="i" level="1">(A)</amend></display><amend anum="0" ea="amend" pairid="175" groupid="135" style="1" owner="jchristopherson" level="1" amendtag="end">cause an individual to act on behalf of a foreign government or foreign <ln numlevel="1" lineno="334" slineno="6-17"/>terrorist organization;</amend></subsection><subsection ssid="6-58" dnum="_-o:B-i" numlevel="1" lineno="335" slineno="6-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1174" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="180" groupid="139" style="1" owner="jchristopherson" level="1" amendtag="end">cause an individual to leave the United States or cause another individual to <ln numlevel="1" lineno="336" slineno="6-19"/>leave the United States; or</amend></subsection><subsection ssid="6-61" dnum="_-o:C-i" numlevel="1" lineno="337" slineno="6-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1175" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="194" groupid="150" style="1" owner="jchristopherson" level="1" amendtag="end">compel the victim to do any other act against the victim's will;
