Section <bold>10-2a-215</bold> is amended to read:</secline><catline lineno="23"><bold>10-2a-215<parens/>. Election of officers of new municipality -- Primary and final election <ln numlevel="1" lineno="24" slineno="1-3"/>dates -- Notice of election -- County clerk duties -- Candidate duties -- Occupation of <ln numlevel="1" lineno="25" slineno="1-4"/>office.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="26" slineno="1-5" level="1" placement="noreturn"><display>(1)</display>For the election of municipal officers, the county legislative body shall:<subsection ssid="8-null-2" dnum="a-o" numlevel="1" lineno="27" slineno="1-6" level="2"><display>(a)</display>unless a primary election is <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">prohibited</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">not authorized</amend> under Subsection <xref depth="4" refnumber="20A-9-404(2)" start="0"><ln numlevel="1" lineno="28" slineno="1-7"/>20A-9-404(2)</xref>, hold a primary election; and</subsection><subsection ssid="8-null-3" dnum="b-o" numlevel="1" lineno="29" slineno="1-8" level="2"><display>(b)</display>unless the election may be cancelled in accordance with Section <xref depth="3" refnumber="20A-1-206" start="0">20A-1-206</xref>, hold a <ln numlevel="1" lineno="30" slineno="1-9"/>final election.</subsection></subsection><subsection ssid="8-null-4" dnum="2-o" numlevel="1" lineno="31" slineno="1-10" level="1"><display>(2)</display>Each election described in Subsection <xref depth="4" refnumber="10-2a-215(1)" start="0">(1)</xref> shall be held:<subsection ssid="8-null-5" dnum="a-o" numlevel="1" lineno="32" slineno="1-11" level="2"><display>(a)</display>consistent with the petition sponsors' determination of the length of each council <ln numlevel="1" lineno="33" slineno="1-12"/>member's initial term; and</subsection><subsection ssid="8-null-6" dnum="b-o" numlevel="1" lineno="34" slineno="1-13" level="2"><display>(b)</display>for the incorporation of a city:<subsection ssid="8-null-7" dnum="i-o" numlevel="1" lineno="35" slineno="1-14" level="3"><display>(i)</display>appropriate to the form of government chosen by the voters at the incorporation <ln numlevel="1" lineno="36" slineno="1-15"/>election;</subsection><subsection ssid="8-null-8" dnum="ii-o" numlevel="1" lineno="37" slineno="1-16" level="3"><display>(ii)</display>consistent with the voters' decision about whether to elect city council members <ln numlevel="1" lineno="38" slineno="1-17"/>by district and, if applicable, consistent with the boundaries of those districts as <ln numlevel="1" lineno="39" slineno="1-18"/>determined by the petition sponsors; and</subsection><subsection ssid="8-null-9" dnum="iii-o" numlevel="1" lineno="40" slineno="1-19" level="3"><display>(iii)</display>consistent with the sponsors' determination of the number of city council <ln numlevel="1" lineno="41" slineno="1-20"/>members to be elected.</subsection></subsection></subsection><subsection ssid="8-null-10" dnum="3-o" numlevel="1" lineno="42" slineno="1-21" level="1" space="false"><display>(3)</display><subsection ssid="8-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="10-2a-215(3)(b)" start="0">(3)(b)</xref>, and notwithstanding Subsection <xref depth="4" refnumber="20A-1-201.5(2)" start="0">20A-1-201.5(2)</xref>, the <ln numlevel="1" lineno="43" slineno="1-22"/>primary election described in Subsection <xref depth="4" refnumber="10-2a-215(1)(a)" start="0">(1)(a)</xref> shall be held at the earliest of the next:<subsection ssid="8-null-12" dnum="i-o" numlevel="1" lineno="44" slineno="1-23" level="3" tab="1"><display>(i)</display>regular primary election described in Subsection <xref depth="4" refnumber="20A-1-201.5(1)" start="0">20A-1-201.5(1)</xref>; or</subsection><subsection ssid="8-null-13" dnum="ii-o" numlevel="1" lineno="45" slineno="1-24" level="3" tab="1"><display>(ii)</display>municipal primary election described in Section <xref depth="3" refnumber="20A-9-404" start="0">20A-9-404</xref>.</subsection></subsection><subsection ssid="8-null-14" dnum="b-o" numlevel="1" lineno="46" slineno="1-25" level="2"><display>(b)</display>The county shall hold the primary election, if necessary, on the next election date <ln numlevel="1" lineno="47" slineno="1-26"/>described in Subsection <xref depth="4" refnumber="10-2a-215(3)(a)" start="0">(3)(a)</xref> that is after the incorporation election conducted under <ln numlevel="1" lineno="48" slineno="1-27"/>Section <xref depth="3" refnumber="10-2a-210" start="0">10-2a-210</xref>.</subsection></subsection><subsection ssid="8-null-15" dnum="4-o" numlevel="1" lineno="49" slineno="1-28" level="1" space="false"><display>(4)</display><subsection ssid="8-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="10-2a-215(4)(b)" start="0">(4)(b)</xref>, the county shall hold the final election described in <ln numlevel="1" lineno="50" slineno="1-29"/>Subsection <xref depth="4" refnumber="10-2a-215(1)(b)" start="0">(1)(b)</xref>:<subsection ssid="8-null-17" dnum="i-o" numlevel="1" lineno="51" slineno="1-30" level="3" tab="1"><display>(i)</display>on the following election date that next follows the date of the incorporation <ln numlevel="1" lineno="52" slineno="1-31"/>election held under Subsection <xref depth="4" refnumber="10-2a-210(1)(a)" start="0">10-2a-210(1)(a)</xref>;</subsection><subsection ssid="8-null-18" dnum="ii-o" numlevel="1" lineno="53" slineno="1-32" level="3" tab="1"><display>(ii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">on the</amend> regular general election described in Section <xref depth="3" refnumber="20A-1-201" start="0">20A-1-201</xref>; or</subsection><subsection ssid="8-null-19" dnum="iii-o" numlevel="1" lineno="54" slineno="1-33" level="3" tab="1"><display>(iii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">on the</amend> regular municipal general election under Section <xref depth="3" refnumber="20A-1-202" start="0">20A-1-202</xref>.</subsection></subsection><subsection ssid="8-null-20" dnum="b-o" numlevel="1" lineno="55" slineno="1-34" level="2"><display>(b)</display>The county shall hold the final election on the earliest of the next election date that is <ln numlevel="1" lineno="56" slineno="1-35"/>listed in Subsection <xref depth="4" refnumber="10-2a-215(4)(a)(i)" start="0">(4)(a)(i)</xref>, <xref depth="4" refnumber="10-2a-215(4)(a)(ii)" start="0">(ii)</xref>, or <xref depth="4" refnumber="10-2a-215(4)(a)(iii)" start="0">(iii)</xref>:<subsection ssid="8-null-21" dnum="i-o" numlevel="1" lineno="57" slineno="1-36" level="3"><display>(i)</display>that is after a primary election; or</subsection><subsection ssid="8-null-22" dnum="ii-o" numlevel="1" lineno="58" slineno="1-37" level="3"><display>(ii)</display>if there is no primary election, that is at least:<subsection ssid="8-null-23" dnum="A-o" numlevel="1" lineno="59" slineno="1-38" level="4"><display>(A)</display>75 days after the incorporation election under Section <xref depth="3" refnumber="10-2a-210" start="0">10-2a-210</xref>; and</subsection><subsection ssid="8-null-24" dnum="B-o" numlevel="1" lineno="60" slineno="1-39" level="4"><display>(B)</display>65 days after the candidate filing period.</subsection></subsection></subsection></subsection><subsection ssid="8-null-25" dnum="5-o" numlevel="1" lineno="61" slineno="1-40" level="1"><display>(5)</display>The county clerk shall provide notice of an election under this section for the future <ln numlevel="1" lineno="62" slineno="1-41"/>municipality, as a class A notice under Section <xref depth="3" refnumber="63G-30-102" start="0">63G-30-102</xref>, for at least two weeks <ln numlevel="1" lineno="63" slineno="1-42"/>before the day of the election.</subsection><subsection ssid="8-null-26" dnum="6-o" numlevel="1" lineno="64" slineno="1-43" level="1"><display>(6)</display>Until the municipality is incorporated, the county clerk:<subsection ssid="8-null-27" dnum="a-o" numlevel="1" lineno="65" slineno="1-44" level="2"><display>(a)</display>is the election officer for all purposes related to the election of municipal officers;</subsection><subsection ssid="8-null-28" dnum="b-o" numlevel="1" lineno="66" slineno="1-45" level="2"><display>(b)</display>may, as necessary, determine appropriate deadlines, procedures, and instructions <ln numlevel="1" lineno="67" slineno="1-46"/>related to the election of municipal officers for a new municipality that are not <ln numlevel="1" lineno="68" slineno="1-47"/>otherwise contrary to law;</subsection><subsection ssid="8-null-29" dnum="c-o" numlevel="1" lineno="69" slineno="1-48" level="2"><display>(c)</display>shall require and determine deadlines for municipal office candidates to file <ln numlevel="1" lineno="70" slineno="1-49"/>campaign financial disclosures in accordance with Section <xref depth="3" refnumber="10-3-208" start="0">10-3-208</xref>; and</subsection><subsection ssid="8-null-30" dnum="d-o" numlevel="1" lineno="71" slineno="1-50" level="2"><display>(d)</display>shall ensure that the ballot for the election includes each office that is required to be <ln numlevel="1" lineno="72" slineno="1-51"/>included in the election for officers of the newly incorporated municipality, including <ln numlevel="1" lineno="73" slineno="1-52"/>the term of each office.</subsection></subsection><subsection ssid="8-null-31" dnum="7-o" numlevel="1" lineno="74" slineno="1-53" level="1"><display>(7)</display>An individual who has filed as a candidate for an office described in this section shall <ln numlevel="1" lineno="75" slineno="1-54"/>comply with:<subsection ssid="8-null-32" dnum="a-o" numlevel="1" lineno="76" slineno="1-55" level="2"><display>(a)</display>the campaign finance disclosure requirements described in Section <xref depth="3" refnumber="10-3-208" start="0">10-3-208</xref>; and</subsection><subsection ssid="8-null-33" dnum="b-o" numlevel="1" lineno="77" slineno="1-56" level="2"><display>(b)</display>the requirements and deadlines established by the county clerk under this section.</subsection></subsection><subsection ssid="8-null-34" dnum="8-o" numlevel="1" lineno="78" slineno="1-57" level="1"><display>(8)</display>Notwithstanding Section <xref depth="3" refnumber="10-3-201" start="0">10-3-201</xref>, the officers elected at a final election described in <ln numlevel="1" lineno="79" slineno="1-58"/>Subsection <xref depth="4" refnumber="10-2a-215(4)(a)" start="0">(4)(a)</xref> shall take office:<subsection ssid="8-null-35" dnum="a-o" numlevel="1" lineno="80" slineno="1-59" level="2"><display>(a)</display>after taking the oath of office; and</subsection><subsection ssid="8-null-36" dnum="b-o" numlevel="1" lineno="81" slineno="1-60" level="2"><display>(b)</display>at noon on the first Monday following the day on which the election official <ln numlevel="1" lineno="82" slineno="1-61"/>transmits a certificate of nomination or election under the officer's seal to each <ln numlevel="1" lineno="83" slineno="1-62"/>elected candidate in accordance with Subsection <xref depth="4" refnumber="20A-4-304(6)(b)">20A-4-304(6)(b)</xref>.</subsection></subsection></section></bsec><bsec buid="3" num="17B-1-306" type="amend" src="code" uid="C17B-1-S306_2026050620260506" sort="17B01 03060020260506" numlevel="1" lineno="84" slineno="2-1" sn="2"><section number="17B-1-306" numlevel="1" lineno="85" slineno="2-2" type="amend"><secline lineno="84">Section 2. Section <bold>17B-1-306</bold> is amended to read:</secline><catline lineno="85"><bold>17B-1-306<parens/>. Special district board -- Election procedures -- Notice.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="86" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>Except as provided in Subsection <xref depth="4" refnumber="17B-1-306(12)">(12)</xref>, each elected board member shall be selected as <ln numlevel="1" lineno="87" slineno="2-4"/>provided in this section.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="88" slineno="2-5" level="1" space="false"><display>(2)</display><subsection ssid="3-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each election of a special district board member shall be held:<subsection ssid="3-null-4" dnum="i-o" numlevel="1" lineno="89" slineno="2-6" level="3" tab="1"><display>(i)</display>at the same time as the municipal general election or the regular general election, <ln numlevel="1" lineno="90" slineno="2-7"/>as applicable; and</subsection><subsection ssid="3-null-5" dnum="ii-o" numlevel="1" lineno="91" slineno="2-8" level="3" tab="1"><display>(ii)</display>at polling places designated by the special district board in consultation with the <ln numlevel="1" lineno="92" slineno="2-9"/>county clerk for each county in which the special district is located, which polling <ln numlevel="1" lineno="93" slineno="2-10"/>places shall coincide with municipal general election or regular general election <ln numlevel="1" lineno="94" slineno="2-11"/>polling places, as applicable, whenever feasible.</subsection></subsection><subsection ssid="3-null-6" dnum="b-o" numlevel="1" lineno="95" slineno="2-12" level="2"><display>(b)</display>The special district board, in consultation with the county clerk, may consolidate two <ln numlevel="1" lineno="96" slineno="2-13"/>or more polling places to enable voters from more than one district to vote at one <ln numlevel="1" lineno="97" slineno="2-14"/>consolidated polling place.</subsection><subsection ssid="3-null-7" dnum="c-o" numlevel="1" lineno="98" slineno="2-15" level="2" space="false"><display>(c)</display><subsection ssid="3-null-8" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Subject to Subsections <xref depth="4" refnumber="17B-1-306(5)(h)">(5)(h)</xref> and <xref depth="4" refnumber="17B-1-306(i)">(i)</xref>, the number of polling places under <ln numlevel="1" lineno="99" slineno="2-16"/>Subsection <xref depth="4" refnumber="17B-1-306(2)(a)(ii)">(2)(a)(ii)</xref> in an election of board members of an irrigation district shall <ln numlevel="1" lineno="100" slineno="2-17"/>be one polling place per division of the district, designated by the district board.</subsection><subsection ssid="3-null-9" dnum="ii-o" numlevel="1" lineno="101" slineno="2-18" level="3"><display>(ii)</display>Each polling place designated by an irrigation district board under Subsection <xref depth="4" refnumber="17B-1-306(2)(c)(i)"><ln numlevel="1" lineno="102" slineno="2-19"/>(2)(c)(i)</xref> shall coincide with a polling place designated by the county clerk under <ln numlevel="1" lineno="103" slineno="2-20"/>Subsection <xref depth="4" refnumber="17B-1-306(2)(a)(ii)">(2)(a)(ii)</xref>.</subsection></subsection></subsection><subsection ssid="3-null-10" dnum="3-o" numlevel="1" lineno="104" slineno="2-21" level="1" space="false"><display>(3)</display><subsection ssid="3-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The clerk of each special district with a board member position to be filled at the <ln numlevel="1" lineno="105" slineno="2-22"/>next municipal general election or regular general election, as applicable, shall <ln numlevel="1" lineno="106" slineno="2-23"/>provide notice of:<subsection ssid="3-null-12" dnum="i-o" numlevel="1" lineno="107" slineno="2-24" level="3" tab="1"><display>(i)</display>each elective position of the special district to be filled at the next municipal <ln numlevel="1" lineno="108" slineno="2-25"/>general election or regular general election, as applicable;</subsection><subsection ssid="3-null-13" dnum="ii-o" numlevel="1" lineno="109" slineno="2-26" level="3" tab="1"><display>(ii)</display>the constitutional and statutory qualifications for each position; and</subsection><subsection ssid="3-null-14" dnum="iii-o" numlevel="1" lineno="110" slineno="2-27" level="3" tab="1"><display>(iii)</display>the dates and times for filing a declaration of candidacy.</subsection></subsection><subsection ssid="3-null-15" dnum="b-o" numlevel="1" lineno="111" slineno="2-28" level="2"><display>(b)</display>If the election is to be held at the same time as the municipal general election, a <ln numlevel="1" lineno="112" slineno="2-29"/>declaration of candidacy shall be filed between June 1 and June 7 of any <ln numlevel="1" lineno="113" slineno="2-30"/>odd-numbered year.</subsection><subsection ssid="3-null-16" dnum="c-o" numlevel="1" lineno="114" slineno="2-31" level="2"><display>(c)</display>If the election is to be held at the same time as the regular general election, a <ln numlevel="1" lineno="115" slineno="2-32"/>declaration of candidacy shall be filed between June 1 and June 7 of any <ln numlevel="1" lineno="116" slineno="2-33"/>even-numbered year.</subsection></subsection><subsection ssid="3-null-17" dnum="4-o" numlevel="1" lineno="117" slineno="2-34" level="1"><display>(4)</display>The clerk of the special district shall publish the notice described in Subsection <xref depth="4" refnumber="17B-1-306(3)(a)">(3)(a)</xref> <ln numlevel="1" lineno="118" slineno="2-35"/>for the special district, as a class A notice under Section <xref depth="3" refnumber="63G-30-102">63G-30-102</xref>, for at least 10 days <ln numlevel="1" lineno="119" slineno="2-36"/>before the first day for filing a declaration of candidacy.</subsection><subsection ssid="3-null-18" dnum="5-o" numlevel="1" lineno="120" slineno="2-37" level="1" space="false"><display>(5)</display><subsection ssid="3-null-19" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="17B-1-306(5)(c)">(5)(c)</xref>, to become a candidate for an elective <ln numlevel="1" lineno="121" slineno="2-38"/>special district board position, an individual shall file a declaration of candidacy in <ln numlevel="1" lineno="122" slineno="2-39"/>person with an official designated by the special district within the candidate filing <ln numlevel="1" lineno="123" slineno="2-40"/>period for the applicable election year in which the election for the special district <ln numlevel="1" lineno="124" slineno="2-41"/>board is held and:<subsection ssid="3-null-20" dnum="i-o" numlevel="1" lineno="125" slineno="2-42" level="3" tab="1"><display>(i)</display>during the special district's standard office hours, if the standard office hours <ln numlevel="1" lineno="126" slineno="2-43"/>provide at least three consecutive office hours each day during the candidate filing <ln numlevel="1" lineno="127" slineno="2-44"/>period that is not a holiday or weekend; </subsection><subsection ssid="3-null-21" dnum="ii-o" numlevel="1" lineno="128" slineno="2-45" level="3" tab="1"><display>(ii)</display>if the standard office hours of a special district do not provide at least three <ln numlevel="1" lineno="129" slineno="2-46"/>consecutive office hours each day, a three-hour consecutive time period each day <ln numlevel="1" lineno="130" slineno="2-47"/>designated by the special district during the candidate filing period that is not a <ln numlevel="1" lineno="131" slineno="2-48"/>holiday or weekend; or</subsection><subsection ssid="3-null-22" dnum="iii-o" numlevel="1" lineno="132" slineno="2-49" level="3" tab="1"><display>(iii)</display>during the special district's standard office hours if the special district has <ln numlevel="1" lineno="133" slineno="2-50"/>adopted a four day standard work week with standard office hours of at least eight <ln numlevel="1" lineno="134" slineno="2-51"/>hours each of those days.</subsection></subsection><subsection ssid="3-null-23" dnum="b-o" numlevel="1" lineno="135" slineno="2-52" level="2"><display>(b)</display>When the candidate filing deadline falls on a Saturday, Sunday, holiday, or a day that <ln numlevel="1" lineno="136" slineno="2-53"/>is not a regular business day for the special district <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">under</amend> Subsection <xref depth="4" refnumber="17B-1-306(5)(a)(iii)"><ln numlevel="1" lineno="137" slineno="2-54"/>(5)(a)(iii)</xref>, the filing time shall be extended until the close of normal office hours on <ln numlevel="1" lineno="138" slineno="2-55"/>the following regular business day.</subsection><subsection ssid="3-null-24" dnum="c-o" numlevel="1" lineno="139" slineno="2-56" level="2"><display>(c)</display>Subject to Subsection <xref depth="4" refnumber="17B-1-306(5)(f)">(5)(f)</xref>, an individual may designate an agent to file a <ln numlevel="1" lineno="140" slineno="2-57"/>declaration of candidacy with the official designated by the special district if:<subsection ssid="3-null-25" dnum="i-o" numlevel="1" lineno="141" slineno="2-58" level="3"><display>(i)</display>the individual is located outside of the state during the entire filing period;</subsection><subsection ssid="3-null-26" dnum="ii-o" numlevel="1" lineno="142" slineno="2-59" level="3"><display>(ii)</display>the designated agent appears in person before the official designated by the <ln numlevel="1" lineno="143" slineno="2-60"/>special district; and</subsection><subsection ssid="3-null-27" dnum="iii-o" numlevel="1" lineno="144" slineno="2-61" level="3"><display>(iii)</display>the individual communicates with the official designated by the special district <ln numlevel="1" lineno="145" slineno="2-62"/>using an electronic device that allows the individual and official to see and hear <ln numlevel="1" lineno="146" slineno="2-63"/>each other.</subsection></subsection><subsection ssid="3-null-28" dnum="d-o" numlevel="1" lineno="147" slineno="2-64" level="2" space="false"><display>(d)</display><subsection ssid="3-null-29" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Before the filing officer may accept any declaration of candidacy from an <ln numlevel="1" lineno="148" slineno="2-65"/>individual, the filing officer shall:<subsection ssid="3-null-30" dnum="A-o" numlevel="1" lineno="149" slineno="2-66" level="4" tab="1"><display>(A)</display>read to the individual the constitutional and statutory qualification <ln numlevel="1" lineno="150" slineno="2-67"/>requirements for the office that the individual is seeking; and</subsection><subsection ssid="3-null-31" dnum="B-o" numlevel="1" lineno="151" slineno="2-68" level="4" tab="1"><display>(B)</display>require the individual to state whether the individual meets those requirements.</subsection></subsection><subsection ssid="3-null-32" dnum="ii-o" numlevel="1" lineno="152" slineno="2-69" level="3"><display>(ii)</display>If the individual does not meet the qualification requirements for the office, the <ln numlevel="1" lineno="153" slineno="2-70"/>filing officer may not accept the individual's declaration of candidacy.</subsection><subsection ssid="3-null-33" dnum="iii-o" numlevel="1" lineno="154" slineno="2-71" level="3"><display>(iii)</display>If it appears that the individual meets the requirements of candidacy, the filing <ln numlevel="1" lineno="155" slineno="2-72"/>officer shall accept the individual's declaration of candidacy.</subsection></subsection><subsection ssid="3-null-34" dnum="e-o" numlevel="1" lineno="156" slineno="2-73" level="2" format="full"><display>(e)</display>The declaration of candidacy shall be in substantially the following form:<eol numlevel="1" lineno="157" slineno="2-74"/><para/>"I, (print name) ____________, being first duly sworn, say that I reside at (Street) <ln numlevel="1" lineno="158" slineno="2-75"/>____________, City of ________________, County of ________________, state of Utah, <ln numlevel="1" lineno="159" slineno="2-76"/>(Zip Code) ______, (Telephone Number, if any)____________; that I meet the qualifications <ln numlevel="1" lineno="160" slineno="2-77"/>for the office of board of trustees member for _______________________ (state the name of <ln numlevel="1" lineno="161" slineno="2-78"/>the special district); that I am a candidate for that office to be voted upon at the next election; <ln numlevel="1" lineno="162" slineno="2-79"/>and that, if filing via a designated agent, I will be out of the state of Utah during the entire <ln numlevel="1" lineno="163" slineno="2-80"/>candidate filing period, and I hereby request that my name be printed upon the official ballot <ln numlevel="1" lineno="164" slineno="2-81"/>for that election.<eol numlevel="1" lineno="165" slineno="2-82"/><para/>(Signed) _________________________________________<eol numlevel="1" lineno="166" slineno="2-83"/><para/>Subscribed and sworn to (or affirmed) before me by ____________ on this ______ day <ln numlevel="1" lineno="167" slineno="2-84"/>of ____________, ____.<eol numlevel="1" lineno="168" slineno="2-85"/><para/>(Signed) ________________________<eol numlevel="1" lineno="169" slineno="2-86"/><para/>(Clerk or Notary Public)".</subsection><subsection ssid="3-null-35" dnum="f-o" numlevel="1" lineno="170" slineno="2-87" level="2"><display>(f)</display>An agent designated under Subsection <xref depth="4" refnumber="17B-1-306(5)(c)">(5)(c)</xref> may not sign the form described in <ln numlevel="1" lineno="171" slineno="2-88"/>Subsection <xref depth="4" refnumber="17B-1-306(5)(e)">(5)(e)</xref>.</subsection><subsection ssid="3-null-36" dnum="g-o" numlevel="1" lineno="172" slineno="2-89" level="2"><display>(g)</display>Each individual wishing to become a valid write-in candidate for an elective special <ln numlevel="1" lineno="173" slineno="2-90"/>district board position is governed by Section <xref depth="3" refnumber="20A-9-601">20A-9-601</xref>.</subsection><subsection ssid="3-null-37" dnum="h-o" numlevel="1" lineno="174" slineno="2-91" level="2"><display>(h)</display>If at least one individual does not file a declaration of candidacy as required by this <ln numlevel="1" lineno="175" slineno="2-92"/>section, an individual shall be appointed to fill that board position in accordance with <ln numlevel="1" lineno="176" slineno="2-93"/>the appointment provisions of Section <xref depth="3" refnumber="20A-1-512">20A-1-512</xref>.</subsection><subsection ssid="3-null-38" dnum="i-o" numlevel="1" lineno="177" slineno="2-94" level="2"><display>(i)</display>If only one candidate files a declaration of candidacy and there is no write-in <ln numlevel="1" lineno="178" slineno="2-95"/>candidate who complies with Section <xref depth="3" refnumber="20A-9-601">20A-9-601</xref>, the board, in accordance with <ln numlevel="1" lineno="179" slineno="2-96"/>Section <xref depth="3" refnumber="20A-1-206">20A-1-206</xref>, may:<subsection ssid="3-null-39" dnum="i-o" numlevel="1" lineno="180" slineno="2-97" level="3"><display>(i)</display>consider the candidate to be elected to the position; and</subsection><subsection ssid="3-null-40" dnum="ii-o" numlevel="1" lineno="181" slineno="2-98" level="3"><display>(ii)</display>cancel the election.</subsection></subsection></subsection><subsection ssid="3-null-41" dnum="6-o" numlevel="1" lineno="182" slineno="2-99" level="1" space="false"><display>(6)</display><subsection ssid="3-null-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A primary election <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">may be held</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">for a particular local board position or office <ln numlevel="1" lineno="183" slineno="2-100"/>may be held only</amend> if:<subsection ssid="3-null-43" dnum="i-o" numlevel="1" lineno="184" slineno="2-101" level="3" tab="1"><display>(i)</display>the <amend anum="0" ea="amend" pairid="24" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both">primary </amend>election is authorized by the special district board; and</subsection><subsection ssid="3-null-44" dnum="ii-o" numlevel="1" lineno="185" slineno="2-102" level="3" tab="1"><display>(ii)</display>the number of candidates for <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">a particular local board position or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the position or</amend> <ln numlevel="1" lineno="186" slineno="2-103"/>office exceeds twice the number of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">persons needed to fill that</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">individuals needed <ln numlevel="1" lineno="187" slineno="2-104"/>to fill that</amend> position or office.</subsection></subsection><subsection ssid="3-null-45" dnum="b-o" numlevel="1" lineno="188" slineno="2-105" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">The</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A</amend> primary election <amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both">authorized under Subsection <xref depth="4" refnumber="17B-1-306(6)(a)">(6)(a)</xref> </amend>shall be conducted:<subsection ssid="3-null-46" dnum="i-o" numlevel="1" lineno="189" slineno="2-106" level="3"><display>(i)</display>on the same date as the municipal primary election or the regular primary election, <ln numlevel="1" lineno="190" slineno="2-107"/>as applicable; and</subsection><subsection ssid="3-null-47" dnum="ii-o" numlevel="1" lineno="191" slineno="2-108" level="3"><display>(ii)</display>according to the procedures for primary elections provided under Title 20A, <ln numlevel="1" lineno="192" slineno="2-109"/>Election Code.</subsection></subsection></subsection><subsection ssid="3-null-48" dnum="7-o" numlevel="1" lineno="193" slineno="2-110" level="1" space="false"><display>(7)</display><subsection ssid="3-null-49" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="17B-1-306(7)(c)">(7)(c)</xref>, within one business day after the <ln numlevel="1" lineno="194" slineno="2-111"/>deadline for filing a declaration of candidacy, the special district clerk shall certify <ln numlevel="1" lineno="195" slineno="2-112"/>the candidate names to the clerk of each county in which the special district is located.</subsection><subsection ssid="3-null-50" dnum="b-o" numlevel="1" lineno="196" slineno="2-113" level="2" space="false"><display>(b)</display><subsection ssid="3-null-51" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="17B-1-306(7)(c)">(7)(c)</xref> and in accordance with Sections <xref depth="3" refnumber="20A-6-109"><ln numlevel="1" lineno="197" slineno="2-114"/>20A-6-109</xref> and <xref depth="3" refnumber="20A-6-110">20A-6-110</xref>, the clerk of each county in which the special district is <ln numlevel="1" lineno="198" slineno="2-115"/>located and the special district clerk shall coordinate placement of the name of <ln numlevel="1" lineno="199" slineno="2-116"/>each candidate for special district office in the nonpartisan section of the ballot <ln numlevel="1" lineno="200" slineno="2-117"/>with the appropriate election officer.</subsection><subsection ssid="3-null-52" dnum="ii-o" numlevel="1" lineno="201" slineno="2-118" level="3"><display>(ii)</display>If consolidation of the special district election ballot with the municipal general <ln numlevel="1" lineno="202" slineno="2-119"/>election ballot or the regular general election ballot, as applicable, is not feasible, <ln numlevel="1" lineno="203" slineno="2-120"/>the special district board of trustees, in consultation with the county clerk, shall <ln numlevel="1" lineno="204" slineno="2-121"/>provide for a separate special district election ballot to be administered by poll <ln numlevel="1" lineno="205" slineno="2-122"/>workers at polling places designated under Subsection <xref depth="4" refnumber="17B-1-306(2)">(2)</xref>.</subsection></subsection><subsection ssid="3-null-53" dnum="c-o" numlevel="1" lineno="206" slineno="2-123" level="2" space="false"><display>(c)</display><subsection ssid="3-null-54" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Subsections <xref depth="4" refnumber="17B-1-306(7)(a)">(7)(a)</xref> and <xref depth="4" refnumber="17B-1-306(b)">(b)</xref> do not apply to an election of a member of the board <ln numlevel="1" lineno="207" slineno="2-124"/>of an irrigation district established under Chapter 2a, Part 5, Irrigation District Act.</subsection><subsection ssid="3-null-55" dnum="ii-o" numlevel="1" lineno="208" slineno="2-125" level="3"><display>(ii)</display>The board of an irrigation district shall:<subsection ssid="3-null-56" dnum="A-o" numlevel="1" lineno="209" slineno="2-126" level="4"><display>(A)</display>subject to Subsections <xref depth="4" refnumber="17B-1-306(7)(c)(ii)(b)">(7)(c)(ii)(B)</xref> and <xref depth="4" refnumber="17B-1-306(c)">(C)</xref>, establish the form of the ballot for <ln numlevel="1" lineno="210" slineno="2-127"/>a board member election;</subsection><subsection ssid="3-null-57" dnum="B-o" numlevel="1" lineno="211" slineno="2-128" level="4"><display>(B)</display>ensure that the ballot is in a nonpartisan format; and</subsection><subsection ssid="3-null-58" dnum="C-o" numlevel="1" lineno="212" slineno="2-129" level="4"><display>(C)</display>ensure that the name of each candidate is placed on the ballot in accordance <ln numlevel="1" lineno="213" slineno="2-130"/>with Sections <xref depth="3" refnumber="20A-6-109">20A-6-109</xref> and <xref depth="3" refnumber="20A-6-110">20A-6-110</xref>.</subsection></subsection></subsection></subsection><subsection ssid="3-null-59" dnum="8-o" numlevel="1" lineno="214" slineno="2-131" level="1" space="false"><display>(8)</display><subsection ssid="3-null-60" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each voter at an election for a board of trustees member of a special district shall:<subsection ssid="3-null-61" dnum="i-o" numlevel="1" lineno="215" slineno="2-132" level="3" tab="1"><display>(i)</display>be a registered voter within the district, except for an election of:<subsection ssid="3-null-62" dnum="A-o" numlevel="1" lineno="216" slineno="2-133" level="4"><display>(A)</display>an irrigation district board of trustees member; or</subsection><subsection ssid="3-null-63" dnum="B-o" numlevel="1" lineno="217" slineno="2-134" level="4"><display>(B)</display>a basic special district board of trustees member who is elected by property <ln numlevel="1" lineno="218" slineno="2-135"/>owners; and</subsection></subsection><subsection ssid="3-null-64" dnum="ii-o" numlevel="1" lineno="219" slineno="2-136" level="3" tab="1"><display>(ii)</display>meet the requirements to vote established by the district.</subsection></subsection><subsection ssid="3-null-65" dnum="b-o" numlevel="1" lineno="220" slineno="2-137" level="2"><display>(b)</display>Each voter may vote for as many candidates as there are offices to be filled.</subsection><subsection ssid="3-null-66" dnum="c-o" numlevel="1" lineno="221" slineno="2-138" level="2"><display>(c)</display>The candidates who receive the highest number of votes are elected.</subsection></subsection><subsection ssid="3-null-67" dnum="9-o" numlevel="1" lineno="222" slineno="2-139" level="1"><display>(9)</display>Except as otherwise provided by this section, the election of special district board <ln numlevel="1" lineno="223" slineno="2-140"/>members is governed by Title 20A, Election Code.</subsection><subsection ssid="3-null-68" dnum="10-o" numlevel="1" lineno="224" slineno="2-141" level="1" space="false"><display>(10)</display><subsection ssid="3-null-69" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="17B-1-303(8)">17B-1-303(8)</xref>, a person elected to serve on a <ln numlevel="1" lineno="225" slineno="2-142"/>special district board shall serve a four-year term, beginning at noon on the January 1 <ln numlevel="1" lineno="226" slineno="2-143"/>after the person's election.</subsection><subsection ssid="3-null-70" dnum="b-o" numlevel="1" lineno="227" slineno="2-144" level="2"><display>(b)</display>A person elected shall be sworn in as soon as practical after January 1.</subsection></subsection><subsection ssid="3-null-71" dnum="11-o" numlevel="1" lineno="228" slineno="2-145" level="1" space="false"><display>(11)</display><subsection ssid="3-null-72" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="17B-1-306(11)(b)">(11)(b)</xref>, each special district shall reimburse <ln numlevel="1" lineno="229" slineno="2-146"/>the county or municipality holding an election under this section for the costs of the <ln numlevel="1" lineno="230" slineno="2-147"/>election attributable to that special district.</subsection><subsection ssid="3-null-73" dnum="b-o" numlevel="1" lineno="231" slineno="2-148" level="2"><display>(b)</display>Each irrigation district shall bear the district's own costs of each election the district <ln numlevel="1" lineno="232" slineno="2-149"/>holds under this section.</subsection></subsection><subsection ssid="3-null-74" dnum="12-o" numlevel="1" lineno="233" slineno="2-150" level="1"><display>(12)</display>This section does not apply to an improvement district that provides electric or gas <ln numlevel="1" lineno="234" slineno="2-151"/>service.</subsection><subsection ssid="3-null-75" dnum="13-o" numlevel="1" lineno="235" slineno="2-152" level="1"><display>(13)</display>Except as provided in Subsection <xref depth="4" refnumber="20A-3a-605(1)(b)">20A-3a-605(1)(b)</xref>, the provisions of Title 20A, <ln numlevel="1" lineno="236" slineno="2-153"/>Chapter 3a, Part 6, Early Voting, do not apply to an election under this section.</subsection><subsection ssid="3-null-76" dnum="14-o" numlevel="1" lineno="237" slineno="2-154" level="1" space="false"><display>(14)</display><subsection ssid="3-null-77" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="17B-1-306(14)">(14)</xref>, "board" means:<subsection ssid="3-null-78" dnum="i-o" numlevel="1" lineno="238" slineno="2-155" level="3" tab="1"><display>(i)</display>a special district board; or</subsection><subsection ssid="3-null-79" dnum="ii-o" numlevel="1" lineno="239" slineno="2-156" level="3" tab="1"><display>(ii)</display>the administrative control board of a special service district that has elected <ln numlevel="1" lineno="240" slineno="2-157"/>members on the board.</subsection></subsection><subsection ssid="3-null-80" dnum="b-o" numlevel="1" lineno="241" slineno="2-158" level="2"><display>(b)</display>If a board desires to hold elections for membership on the board at a regular general <ln numlevel="1" lineno="242" slineno="2-159"/>election instead of a municipal general election , or at a municipal general election <ln numlevel="1" lineno="243" slineno="2-160"/>instead of a regular general election, the board may submit an application to the <ln numlevel="1" lineno="244" slineno="2-161"/>lieutenant governor that:<subsection ssid="3-null-81" dnum="i-o" numlevel="1" lineno="245" slineno="2-162" level="3"><display>(i)</display>requests permission to change the election year for membership on the board in a <ln numlevel="1" lineno="246" slineno="2-163"/>manner described in this Subsection <xref depth="4" refnumber="17B-1-306(14)(b)">(14)(b)</xref>;</subsection><subsection ssid="3-null-82" dnum="ii-o" numlevel="1" lineno="247" slineno="2-164" level="3"><display>(ii)</display>indicates that a change in the election year is beneficial, based on potential cost <ln numlevel="1" lineno="248" slineno="2-165"/>savings, a potential increase in voter turnout, or another material reason; and</subsection><subsection ssid="3-null-83" dnum="iii-o" numlevel="1" lineno="249" slineno="2-166" level="3"><display>(iii)</display>if a change in the election year may result in shortening a board member's term <ln numlevel="1" lineno="250" slineno="2-167"/>of office, indicates that the members of the board unanimously support the <ln numlevel="1" lineno="251" slineno="2-168"/>lieutenant governor taking that action.</subsection></subsection><subsection ssid="3-null-84" dnum="c-o" numlevel="1" lineno="252" slineno="2-169" level="2"><display>(c)</display>Upon receipt of an application described in Subsection <xref depth="4" refnumber="17B-1-306(14)(b)">(14)(b)</xref>, the lieutenant <ln numlevel="1" lineno="253" slineno="2-170"/>governor may approve the <amend anum="0" ea="amend" pairid="31" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both">application </amend>if:<subsection ssid="3-null-85" dnum="i-o" numlevel="1" lineno="254" slineno="2-171" level="3"><display>(i)</display>the lieutenant governor concludes that changing the election year is beneficial <ln numlevel="1" lineno="255" slineno="2-172"/>based on the criteria described in Subsection <xref depth="4" refnumber="17B-1-306(14)(b)(ii)">(14)(b)(ii)</xref>; and</subsection><subsection ssid="3-null-86" dnum="ii-o" numlevel="1" lineno="256" slineno="2-173" level="3"><display>(ii)</display>for an application that may result in shortening a board member's term of office, <ln numlevel="1" lineno="257" slineno="2-174"/>the application satisfies the unanimity requirement described in Subsection <xref depth="4" refnumber="17B-1-306(14)(b)(iii)"><ln numlevel="1" lineno="258" slineno="2-175"/>(14)(b)(iii)</xref>.</subsection></subsection><subsection ssid="3-null-87" dnum="d-o" numlevel="1" lineno="259" slineno="2-176" level="2"><display>(d)</display>If the lieutenant governor approves a board's application described in this section:<subsection ssid="3-null-88" dnum="i-o" numlevel="1" lineno="260" slineno="2-177" level="3"><display>(i)</display>all future elections for membership on the board shall be held at the time of the <ln numlevel="1" lineno="261" slineno="2-178"/>general election specified in the application; and</subsection><subsection ssid="3-null-89" dnum="ii-o" numlevel="1" lineno="262" slineno="2-179" level="3"><display>(ii)</display>the board may not hold elections at the time of an election other than the general <ln numlevel="1" lineno="263" slineno="2-180"/>election specified in the application, unless the board receives permission from the <ln numlevel="1" lineno="264" slineno="2-181"/>lieutenant governor to change the election under the same procedure, and by <ln numlevel="1" lineno="265" slineno="2-182"/>applying the same criteria, described in this Subsection <xref depth="4" refnumber="17B-1-306(14)">(14)</xref>.</subsection></subsection></subsection><subsection ssid="3-null-90" dnum="15-o" numlevel="1" lineno="266" slineno="2-183" level="1" space="false"><display>(15)</display><subsection ssid="3-null-91" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This Subsection <xref depth="4" refnumber="17B-1-306(15)">(15)</xref> applies to a special district if:<subsection ssid="3-null-92" dnum="i-o" numlevel="1" lineno="267" slineno="2-184" level="3" tab="1"><display>(i)</display>the special district's board members are elected by the owners of real property, as <ln numlevel="1" lineno="268" slineno="2-185"/>provided in Subsection <xref depth="4" refnumber="17B-1-1402(1)(b)">17B-1-1402(1)(b)</xref>; and</subsection><subsection ssid="3-null-93" dnum="ii-o" numlevel="1" lineno="269" slineno="2-186" level="3" tab="1"><display>(ii)</display>the special district was created before January 1, 2020.</subsection></subsection><subsection ssid="3-null-94" dnum="b-o" numlevel="1" lineno="270" slineno="2-187" level="2"><display>(b)</display>The board of a special district described in Subsection <xref depth="4" refnumber="17B-1-306(15)(a)">(15)(a)</xref> may conduct an <ln numlevel="1" lineno="271" slineno="2-188"/>election:<subsection ssid="3-null-95" dnum="i-o" numlevel="1" lineno="272" slineno="2-189" level="3"><display>(i)</display>to fill a board member position that expires at the end of the term for that board <ln numlevel="1" lineno="273" slineno="2-190"/>member's position; and</subsection><subsection ssid="3-null-96" dnum="ii-o" numlevel="1" lineno="274" slineno="2-191" level="3"><display>(ii)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-1-512(1)(a)(i)">20A-1-512(1)(a)(i)</xref>, to fill a vacancy in an unexpired <ln numlevel="1" lineno="275" slineno="2-192"/>term of a board member.</subsection></subsection><subsection ssid="3-null-97" dnum="c-o" numlevel="1" lineno="276" slineno="2-193" level="2"><display>(c)</display>An election under Subsection <xref depth="4" refnumber="17B-1-306(15)(b)">(15)(b)</xref> may be conducted as determined by the special <ln numlevel="1" lineno="277" slineno="2-194"/>district board, subject to Subsection <xref depth="4" refnumber="17B-1-306(15)(d)">(15)(d)</xref>.</subsection><subsection ssid="3-null-98" dnum="d-o" numlevel="1" lineno="278" slineno="2-195" level="2" space="false"><display>(d)</display><subsection ssid="3-null-99" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The special district board shall provide to property owners eligible to vote at <ln numlevel="1" lineno="279" slineno="2-196"/>the special district election:<subsection ssid="3-null-100" dnum="A-o" numlevel="1" lineno="280" slineno="2-197" level="4" tab="1"><display>(A)</display>notice of the election; and</subsection><subsection ssid="3-null-101" dnum="B-o" numlevel="1" lineno="281" slineno="2-198" level="4" tab="1"><display>(B)</display>a form to nominate an eligible individual to be elected as a board member.</subsection></subsection><subsection ssid="3-null-102" dnum="ii-o" numlevel="1" lineno="282" slineno="2-199" level="3" space="false"><display>(ii)</display><subsection ssid="3-null-103" dnum="A-o" level="4" placement="sameline"><display>(A)</display>The special district board may establish a deadline for a property owner to <ln numlevel="1" lineno="283" slineno="2-200"/>submit a nomination form.</subsection><subsection ssid="3-null-104" dnum="B-o" numlevel="1" lineno="284" slineno="2-201" level="4"><display>(B)</display>A deadline under Subsection <xref depth="4" refnumber="17B-1-306(15)(d)(ii)(a)">(15)(d)(ii)(A)</xref> may not be earlier than 15 days <ln numlevel="1" lineno="285" slineno="2-202"/>after the board provides the notice and nomination form under Subsection <xref depth="4" refnumber="17B-1-306(15)(d)(i)"><ln numlevel="1" lineno="286" slineno="2-203"/>(15)(d)(i)</xref>.</subsection></subsection><subsection ssid="3-null-105" dnum="iii-o" numlevel="1" lineno="287" slineno="2-204" level="3" space="false"><display>(iii)</display><subsection ssid="3-null-106" dnum="A-o" level="4" placement="sameline"><display>(A)</display>After the deadline for submitting nomination forms, the special district <ln numlevel="1" lineno="288" slineno="2-205"/>board shall provide a ballot to all property owners eligible to vote at the special <ln numlevel="1" lineno="289" slineno="2-206"/>district election.</subsection><subsection ssid="3-null-107" dnum="B-o" numlevel="1" lineno="290" slineno="2-207" level="4"><display>(B)</display>A special district board shall allow at least five days for ballots to be returned.</subsection></subsection><subsection ssid="3-null-108" dnum="iv-o" numlevel="1" lineno="291" slineno="2-208" level="3"><display>(iv)</display>A special district board shall certify the results of an election under this <ln numlevel="1" lineno="292" slineno="2-209"/>Subsection <xref depth="4" refnumber="17B-1-306(15)">(15)</xref> during an open meeting of the board.</subsection></subsection></subsection></section></bsec><bsec buid="1" num="20A-9-404" type="amend" src="code" uid="C20A-9-S404_2026050620260506" sort="20A09 04040020260506" numlevel="1" lineno="293" slineno="3-1" sn="3"><section number="20A-9-404" numlevel="1" lineno="294" slineno="3-2" type="amend"><secline lineno="293">Section 3. Section <bold>20A-9-404</bold> is amended to read:</secline><catline lineno="294"><bold>20A-9-404<parens/>. Municipal primary elections.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="295" slineno="3-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as otherwise provided in this section<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="53" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both"> or Chapter 4, Part 6, Municipal <ln numlevel="1" lineno="296" slineno="3-4"/>Alternate Voting Methods Pilot Project</amend><amendoutend style="2"/>, candidates for municipal office in all <ln numlevel="1" lineno="297" slineno="3-5"/>municipalities shall be nominated at a municipal primary election.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="298" slineno="3-6" level="2"><display>(b)</display>Municipal primary elections shall be held:<subsection ssid="1-null-4" dnum="i-o" numlevel="1" lineno="299" slineno="3-7" level="3"><display>(i)</display>consistent with Section <xref depth="3" refnumber="20A-1-201.5">20A-1-201.5</xref>, on the second Tuesday following the first <ln numlevel="1" lineno="300" slineno="3-8"/>Monday in the August before the regular municipal election; and</subsection><subsection ssid="1-null-5" dnum="ii-o" numlevel="1" lineno="301" slineno="3-9" level="3"><display>(ii)</display>whenever possible, at the same polling places as the regular municipal election.</subsection></subsection><subsection ssid="1-null-6" dnum="c-o" numlevel="1" lineno="302" slineno="3-10" level="2"><display>(c)</display>Subsections <xref depth="4" refnumber="20A-9-404(3)">(3)</xref> through <xref depth="4" refnumber="20A-9-404(5)">(5)</xref> do not apply to an election to elect local school board <ln numlevel="1" lineno="303" slineno="3-11"/>members under Section <xref depth="3" refnumber="53G-3-302">53G-3-302</xref>.</subsection><subsection ssid="1-null-7" dnum="d-o:_-i" numlevel="1" lineno="304" slineno="3-12" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1150" style="2" owner="o" level="1" space="false"><display>(2)</display><subsection ssid="1-57" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1152" style="1" owner="i" level="1" amendtag="both">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">Except as otherwise provided in Chapter 4, Part 6, Municipal Alternate Voting <ln numlevel="1" lineno="307" slineno="3-15"/>Methods Pilot Project, if the number of candidates for a particular municipal office <ln numlevel="1" lineno="308" slineno="3-16"/>does not exceed twice the number of individuals needed to fill that office, a primary <ln numlevel="1" lineno="309" slineno="3-17"/>election for that office may not be held and the candidates are considered nominated.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="310" slineno="3-18"/>A primary election for a particular municipal office may be held only if:</amend><subsection ssid="1-56" dnum="_-o:i-i" numlevel="1" lineno="311" slineno="3-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1153" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">the primary election is authorized by the municipal legislative body; and</amend></subsection><subsection ssid="1-62" dnum="_-o:ii-i" numlevel="1" lineno="312" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1154" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">the number of candidates for the municipal office exceeds twice the number of <ln numlevel="1" lineno="313" slineno="3-21"/>individuals needed to fill that office.</amend></subsection></subsection><subsection ssid="1-58" dnum="_-o:b-i" numlevel="1" lineno="314" slineno="3-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">If a primary election is not authorized under Subsection <xref depth="4" refnumber="20A-9-404(2)(a)">(2)(a)</xref>, the candidates for the <ln numlevel="1" lineno="315" slineno="3-23"/>office are considered nominated.</amend></subsection></subsection><subsection ssid="1-null-9" dnum="3-o" numlevel="1" lineno="316" slineno="3-24" level="1" space="false"><display>(3)</display><subsection ssid="1-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For purposes of this Subsection <xref depth="4" refnumber="20A-9-404(3)">(3)</xref>, "convention" means an organized assembly of <ln numlevel="1" lineno="317" slineno="3-25"/>voters or delegates.</subsection><subsection ssid="1-null-11" dnum="b-o" numlevel="1" lineno="318" slineno="3-26" level="2" space="false"><display>(b)</display><subsection ssid="1-null-12" dnum="i-o" level="3" placement="sameline"><display>(i)</display>By ordinance adopted before the May 1 that falls before a regular municipal <ln numlevel="1" lineno="319" slineno="3-27"/>election, any third, fourth, or fifth class city or town may exempt itself from a <ln numlevel="1" lineno="320" slineno="3-28"/>primary election by providing that the nomination of candidates for municipal <ln numlevel="1" lineno="321" slineno="3-29"/>office to be voted upon at a municipal election be nominated by a municipal party <ln numlevel="1" lineno="322" slineno="3-30"/>convention or committee.</subsection><subsection ssid="1-null-13" dnum="ii-o" numlevel="1" lineno="323" slineno="3-31" level="3"><display>(ii)</display>The municipal party convention or committee described in Subsection <xref depth="4" refnumber="20A-9-404(3)(b)(i)">(3)(b)(i)</xref> <ln numlevel="1" lineno="324" slineno="3-32"/>shall be held on or before May 30 of an odd-numbered year.</subsection><subsection ssid="1-null-14" dnum="iii-o" numlevel="1" lineno="325" slineno="3-33" level="3"><display>(iii)</display>Any primary election exemption ordinance adopted under this Subsection <xref depth="4" refnumber="20A-9-404(3)">(3)</xref> <ln numlevel="1" lineno="326" slineno="3-34"/>remains in effect until repealed by ordinance.</subsection></subsection><subsection ssid="1-null-15" dnum="c-o" numlevel="1" lineno="327" slineno="3-35" level="2" space="false"><display>(c)</display><subsection ssid="1-null-16" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A convention or committee may not nominate more than one candidate for each <ln numlevel="1" lineno="328" slineno="3-36"/>of the municipal offices to be voted upon at the municipal election.</subsection><subsection ssid="1-null-17" dnum="ii-o" numlevel="1" lineno="329" slineno="3-37" level="3"><display>(ii)</display>A convention or committee may not nominate an individual who has accepted the <ln numlevel="1" lineno="330" slineno="3-38"/>nomination of a different convention or committee.</subsection><subsection ssid="1-null-18" dnum="iii-o" numlevel="1" lineno="331" slineno="3-39" level="3"><display>(iii)</display>A municipal party may not have more than one group of candidates placed upon <ln numlevel="1" lineno="332" slineno="3-40"/>the ballot and may not group the same candidates on different tickets by the same <ln numlevel="1" lineno="333" slineno="3-41"/>party under a different name or emblem.</subsection></subsection><subsection ssid="1-null-19" dnum="d-o" numlevel="1" lineno="334" slineno="3-42" level="2" space="false"><display>(d)</display><subsection ssid="1-null-20" dnum="i-o" level="3" placement="sameline"><display>(i)</display>On or before May 31 of an odd-numbered year, a convention or committee <ln numlevel="1" lineno="335" slineno="3-43"/>shall prepare and submit to the filing officer a certificate of nomination for each <ln numlevel="1" lineno="336" slineno="3-44"/>individual nominated.</subsection><subsection ssid="1-null-21" dnum="ii-o" numlevel="1" lineno="337" slineno="3-45" level="3"><display>(ii)</display>The certificate of nomination shall:<subsection ssid="1-null-22" dnum="A-o" numlevel="1" lineno="338" slineno="3-46" level="4"><display>(A)</display>contain the name of the office for which each individual is nominated, the <ln numlevel="1" lineno="339" slineno="3-47"/>name, post office address, and, if in a city, the street number of residence and <ln numlevel="1" lineno="340" slineno="3-48"/>place of business, if any, of each individual nominated;</subsection><subsection ssid="1-null-23" dnum="B-o" numlevel="1" lineno="341" slineno="3-49" level="4"><display>(B)</display>designate in not more than five words the party that the convention or <ln numlevel="1" lineno="342" slineno="3-50"/>committee represents;</subsection><subsection ssid="1-null-24" dnum="C-o" numlevel="1" lineno="343" slineno="3-51" level="4"><display>(C)</display>contain a copy of the resolution passed at the convention that authorized the <ln numlevel="1" lineno="344" slineno="3-52"/>committee to make the nomination;</subsection><subsection ssid="1-null-25" dnum="D-o" numlevel="1" lineno="345" slineno="3-53" level="4"><display>(D)</display>contain a statement certifying that the name of the candidate nominated by the <ln numlevel="1" lineno="346" slineno="3-54"/>political party will not appear on the ballot as a candidate for any other <ln numlevel="1" lineno="347" slineno="3-55"/>political party;</subsection><subsection ssid="1-null-26" dnum="E-o" numlevel="1" lineno="348" slineno="3-56" level="4"><display>(E)</display>be signed by the presiding officer and secretary of the convention or <ln numlevel="1" lineno="349" slineno="3-57"/>committee; and</subsection><subsection ssid="1-null-27" dnum="F-o" numlevel="1" lineno="350" slineno="3-58" level="4"><display>(F)</display>contain a statement identifying the residence and post office address of the <ln numlevel="1" lineno="351" slineno="3-59"/>presiding officer and secretary and certifying that the presiding officer and <ln numlevel="1" lineno="352" slineno="3-60"/>secretary were officers of the convention or committee and that the certificates <ln numlevel="1" lineno="353" slineno="3-61"/>are true to the best of their knowledge and belief.</subsection></subsection><subsection ssid="1-null-28" dnum="iii-o" numlevel="1" lineno="354" slineno="3-62" level="3"><display>(iii)</display>A candidate nominated by a municipal party convention or committee shall file a <ln numlevel="1" lineno="355" slineno="3-63"/>declaration with the filing officer in accordance with Subsection <xref depth="3" refnumber="20A-9-203">20A-9-203</xref>(3) <ln numlevel="1" lineno="356" slineno="3-64"/>that includes:<subsection ssid="1-null-29" dnum="A-o" numlevel="1" lineno="357" slineno="3-65" level="4"><display>(A)</display>the name of the municipal party or convention that nominated the candidate; <ln numlevel="1" lineno="358" slineno="3-66"/>and</subsection><subsection ssid="1-null-30" dnum="B-o" numlevel="1" lineno="359" slineno="3-67" level="4"><display>(B)</display>the office for which the convention or committee nominated the candidate.</subsection></subsection></subsection><subsection ssid="1-null-31" dnum="e-o" numlevel="1" lineno="360" slineno="3-68" level="2"><display>(e)</display>A committee appointed at a convention, if authorized by an enabling resolution, may <ln numlevel="1" lineno="361" slineno="3-69"/>also make nominations or fill vacancies in nominations made at a convention if the <ln numlevel="1" lineno="362" slineno="3-70"/>committee makes the nomination before the deadline for a write-in candidate to file a <ln numlevel="1" lineno="363" slineno="3-71"/>declaration of candidacy under Section <xref depth="3" refnumber="20A-9-601">20A-9-601</xref>.</subsection><subsection ssid="1-null-32" dnum="f-o" numlevel="1" lineno="364" slineno="3-72" level="2"><display>(f)</display>The election ballot shall substantially comply with the form prescribed in Chapter 6, <ln numlevel="1" lineno="365" slineno="3-73"/>Part 4, Ballot Form Requirements for Municipal Elections, but the party name shall <ln numlevel="1" lineno="366" slineno="3-74"/>be included with the candidate's name.</subsection></subsection><subsection ssid="1-null-33" dnum="4-o" numlevel="1" lineno="367" slineno="3-75" level="1" space="false"><display>(4)</display><subsection ssid="1-null-34" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Any third, fourth, or fifth class city or a town may adopt an ordinance before<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="54" groupid="38" style="2" owner="jchristopherson" level="1" deltag="both"> the</amend><amendoutend style="2"/> <ln numlevel="1" lineno="368" slineno="3-76"/>May 1 that falls before the regular municipal election that:<subsection ssid="1-null-35" dnum="i-o" numlevel="1" lineno="369" slineno="3-77" level="3" tab="1"><display>(i)</display>exempts the city or town from the other methods of nominating candidates to <ln numlevel="1" lineno="370" slineno="3-78"/>municipal office provided in this section; and</subsection><subsection ssid="1-null-36" dnum="ii-o" numlevel="1" lineno="371" slineno="3-79" level="3" tab="1"><display>(ii)</display>provides for a municipal partisan convention method of nominating candidates as <ln numlevel="1" lineno="372" slineno="3-80"/>provided in this Subsection <xref depth="4" refnumber="20A-9-404(4)">(4)</xref>.</subsection></subsection><subsection ssid="1-null-37" dnum="b-o" numlevel="1" lineno="373" slineno="3-81" level="2" space="false"><display>(b)</display><subsection ssid="1-null-38" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Any party that was a registered political party at the last regular general <ln numlevel="1" lineno="374" slineno="3-82"/>election or regular municipal election is a municipal political party under this <ln numlevel="1" lineno="375" slineno="3-83"/>section.</subsection><subsection ssid="1-null-39" dnum="ii-o" numlevel="1" lineno="376" slineno="3-84" level="3"><display>(ii)</display>Any political party may qualify as a municipal political party by presenting a <ln numlevel="1" lineno="377" slineno="3-85"/>petition to the city recorder that:<subsection ssid="1-null-40" dnum="A-o" numlevel="1" lineno="378" slineno="3-86" level="4"><display>(A)</display>is signed, with a holographic signature, by registered voters within the <ln numlevel="1" lineno="379" slineno="3-87"/>municipality equal to at least 20% of the number of votes cast for all <ln numlevel="1" lineno="380" slineno="3-88"/>candidates for mayor in the last municipal election at which a mayor was <ln numlevel="1" lineno="381" slineno="3-89"/>elected;</subsection><subsection ssid="1-null-41" dnum="B-o" numlevel="1" lineno="382" slineno="3-90" level="4"><display>(B)</display>is filed with the city recorder or town clerk no later than 5 p.m. on the last <ln numlevel="1" lineno="383" slineno="3-91"/>business day before the day on which the municipal party holds a convention to <ln numlevel="1" lineno="384" slineno="3-92"/>nominate a candidate under this Subsection <xref depth="4" refnumber="20A-9-404(4)">(4)</xref>;</subsection><subsection ssid="1-null-42" dnum="C-o" numlevel="1" lineno="385" slineno="3-93" level="4"><display>(C)</display>is substantially similar to the form of the signature sheets described in Section <xref depth="3" refnumber="20A-7-303"><ln numlevel="1" lineno="386" slineno="3-94"/>20A-7-303</xref>; and</subsection><subsection ssid="1-null-43" dnum="D-o" numlevel="1" lineno="387" slineno="3-95" level="4"><display>(D)</display>contains the name of the municipal political party using not more than five <ln numlevel="1" lineno="388" slineno="3-96"/>words.</subsection></subsection><subsection ssid="1-null-44" dnum="iii-o" numlevel="1" lineno="389" slineno="3-97" level="3"><display>(iii)</display>With the assistance of the county clerk, the city recorder or town clerk shall use <ln numlevel="1" lineno="390" slineno="3-98"/>the procedures described in Section <xref depth="3" refnumber="20A-1-1002">20A-1-1002</xref> to determine whether each signer <ln numlevel="1" lineno="391" slineno="3-99"/>is a registered voter who is qualified to sign the petition.</subsection></subsection><subsection ssid="1-null-45" dnum="c-o" numlevel="1" lineno="392" slineno="3-100" level="2" space="false"><display>(c)</display><subsection ssid="1-null-46" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the number of candidates for a particular office does not exceed twice the <ln numlevel="1" lineno="393" slineno="3-101"/>number of offices to be filled at the regular municipal election, no primary <ln numlevel="1" lineno="394" slineno="3-102"/>election for that office shall be held and the candidates are considered to be <ln numlevel="1" lineno="395" slineno="3-103"/>nominated.</subsection><subsection ssid="1-null-47" dnum="ii-o" numlevel="1" lineno="396" slineno="3-104" level="3"><display>(ii)</display>If the number of candidates for a particular office exceeds twice the number of <ln numlevel="1" lineno="397" slineno="3-105"/>offices to be filled at the regular municipal election, those candidates for <ln numlevel="1" lineno="398" slineno="3-106"/>municipal office shall be nominated at a municipal primary election.</subsection></subsection><subsection ssid="1-null-48" dnum="d-o" numlevel="1" lineno="399" slineno="3-107" level="2"><display>(d)</display>The clerk shall ensure that the partisan municipal primary ballot is similar to the <ln numlevel="1" lineno="400" slineno="3-108"/>ballot forms required by Section <xref depth="3" refnumber="20A-6-401">20A-6-401</xref> and, as applicable, Section <xref depth="3" refnumber="20A-6-401.1">20A-6-401.1</xref>.</subsection><subsection ssid="1-null-49" dnum="e-o" numlevel="1" lineno="401" slineno="3-109" level="2"><display>(e)</display>After marking a municipal primary ballot, the voter shall deposit the ballot in the <ln numlevel="1" lineno="402" slineno="3-110"/>blank ballot box.</subsection><subsection ssid="1-null-50" dnum="f-o" numlevel="1" lineno="403" slineno="3-111" level="2"><display>(f)</display>Immediately after the canvass, the election judges shall, without examination, destroy <ln numlevel="1" lineno="404" slineno="3-112"/>the tickets deposited in the blank ballot box.</subsection></subsection><subsection ssid="1-null-51" dnum="5-o" numlevel="1" lineno="405" slineno="3-113" level="1" space="false"><display>(5)</display><subsection ssid="1-null-52" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A voter who signs a petition under Subsection <xref depth="4" refnumber="20A-9-404(4)(b)(ii)">(4)(b)(ii)</xref> may have the voter's <ln numlevel="1" lineno="406" slineno="3-114"/>signature removed from the petition by, no later than 5 p.m. three business days after <ln numlevel="1" lineno="407" slineno="3-115"/>the day on which the petition is filed with the city recorder or town clerk, submitting <ln numlevel="1" lineno="408" slineno="3-116"/>to the city recorder or town clerk a statement requesting that the voter's signature be <ln numlevel="1" lineno="409" slineno="3-117"/>removed.</subsection><subsection ssid="1-null-53" dnum="b-o" numlevel="1" lineno="410" slineno="3-118" level="2"><display>(b)</display>A statement described in Subsection <xref depth="4" refnumber="20A-9-404(5)(a)">(5)(a)</xref> shall comply with the requirements <ln numlevel="1" lineno="411" slineno="3-119"/>described in Subsection <xref depth="4" refnumber="20A-1-1003(2)">20A-1-1003(2)</xref>.</subsection><subsection ssid="1-null-54" dnum="c-o" numlevel="1" lineno="412" slineno="3-120" level="2"><display>(c)</display>With the assistance of the county clerk and using the procedures described in <ln numlevel="1" lineno="413" slineno="3-121"/>Subsection <xref depth="4" refnumber="20A-1-1003(3)">20A-1-1003(3)</xref>, the city recorder or town clerk shall determine whether to <ln numlevel="1" lineno="414" slineno="3-122"/>remove an individual's signature from a petition after receiving a timely, valid <ln numlevel="1" lineno="415" slineno="3-123"/>statement requesting removal of the signature.</subsection></subsection></section></bsec><bsec buid="63" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="416" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="416">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="417"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate
