Section <bold>54-17-601</bold> is amended to read:</secline><catline lineno="34"><bold>54-17-601<parens/>. Definitions.</bold></catline><sectionText lineno="35"><tab/>As used in this part:</sectionText><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="36" slineno="1-4" level="1"><display>(1)</display>"Adjusted retail electric sales" means the total kilowatt-hours of retail electric sales of <ln numlevel="1" lineno="37" slineno="1-5"/>an electrical corporation to customers in this state in a calendar year, reduced by:<subsection ssid="4-null-2" dnum="a-o" numlevel="1" lineno="38" slineno="1-6" level="2"><display>(a)</display>the amount of those kilowatt-hours attributable to electricity generated or purchased <ln numlevel="1" lineno="39" slineno="1-7"/>in that calendar year from qualifying zero carbon emissions generation and qualifying <ln numlevel="1" lineno="40" slineno="1-8"/>carbon sequestration generation;</subsection><subsection ssid="4-null-3" dnum="b-o" numlevel="1" lineno="41" slineno="1-9" level="2"><display>(b)</display>the amount of those kilowatt-hours attributable to electricity generated or purchased <ln numlevel="1" lineno="42" slineno="1-10"/>in that calendar year from generation located within the geographic boundary of the <ln numlevel="1" lineno="43" slineno="1-11"/>Western Electricity Coordinating Council that derives its energy from one or more of <ln numlevel="1" lineno="44" slineno="1-12"/>the following but that does not satisfy the definition of a clean energy source or that <ln numlevel="1" lineno="45" slineno="1-13"/>otherwise has not been used to satisfy Subsection <xref depth="4" refnumber="54-17-602(1)">54-17-602(1)</xref>:<subsection ssid="4-null-4" dnum="i-o" numlevel="1" lineno="46" slineno="1-14" level="3"><display>(i)</display>wind energy;</subsection><subsection ssid="4-null-5" dnum="ii-o" numlevel="1" lineno="47" slineno="1-15" level="3"><display>(ii)</display>solar photovoltaic and solar thermal energy;</subsection><subsection ssid="4-null-6" dnum="iii-o" numlevel="1" lineno="48" slineno="1-16" level="3"><display>(iii)</display>wave, tidal, and ocean thermal energy;</subsection><subsection ssid="4-null-7" dnum="iv-o" numlevel="1" lineno="49" slineno="1-17" level="3"><display>(iv)</display>except for combustion of wood that has been treated with chemical preservatives <ln numlevel="1" lineno="50" slineno="1-18"/>such as creosote, pentachlorophenol or chromated copper arsenate, biomass and <ln numlevel="1" lineno="51" slineno="1-19"/>biomass byproducts, including:<subsection ssid="4-null-8" dnum="A-o" numlevel="1" lineno="52" slineno="1-20" level="4"><display>(A)</display>organic waste;</subsection><subsection ssid="4-null-9" dnum="B-o" numlevel="1" lineno="53" slineno="1-21" level="4"><display>(B)</display>forest or rangeland woody debris from harvesting or thinning conducted to <ln numlevel="1" lineno="54" slineno="1-22"/>improve forest or rangeland ecological health and to reduce wildfire risk;</subsection><subsection ssid="4-null-10" dnum="C-o" numlevel="1" lineno="55" slineno="1-23" level="4"><display>(C)</display>agricultural residues;</subsection><subsection ssid="4-null-11" dnum="D-o" numlevel="1" lineno="56" slineno="1-24" level="4"><display>(D)</display>dedicated energy crops; and</subsection><subsection ssid="4-null-12" dnum="E-o" numlevel="1" lineno="57" slineno="1-25" level="4"><display>(E)</display>landfill gas or biogas produced from organic matter, wastewater, anaerobic <ln numlevel="1" lineno="58" slineno="1-26"/>digesters, or municipal solid waste;</subsection></subsection><subsection ssid="4-null-13" dnum="v-o" numlevel="1" lineno="59" slineno="1-27" level="3"><display>(v)</display>geothermal energy;</subsection><subsection ssid="4-null-14" dnum="vi-o" numlevel="1" lineno="60" slineno="1-28" level="3"><display>(vi)</display>hydroelectric energy; or</subsection><subsection ssid="4-null-15" dnum="vii-o" numlevel="1" lineno="61" slineno="1-29" level="3"><display>(vii)</display>waste gas and waste heat capture or recovery; and</subsection></subsection><subsection ssid="4-null-16" dnum="c-o" numlevel="1" lineno="62" slineno="1-30" level="2"><display>(c)</display>the number of kilowatt-hours attributable to reductions in retail sales in that calendar <ln numlevel="1" lineno="63" slineno="1-31"/>year from demand side management as defined in Section <xref depth="3" refnumber="54-7-12.8">54-7-12.8</xref>, with the <ln numlevel="1" lineno="64" slineno="1-32"/>kilowatt-hours for an electrical corporation whose rates are regulated by the <ln numlevel="1" lineno="65" slineno="1-33"/>commission and adjusted by the commission to exclude kilowatt-hours for which a <ln numlevel="1" lineno="66" slineno="1-34"/>renewable energy certificate is issued under Subsection <xref depth="4" refnumber="54-17-603(4)(b)">54-17-603(4)(b)</xref>.</subsection></subsection><subsection ssid="4-null-17" dnum="2-o" numlevel="1" lineno="67" slineno="1-35" level="1"><display>(2)</display>"Amount of kilowatt-hours attributable to electricity generated or purchased in that <ln numlevel="1" lineno="68" slineno="1-36"/>calendar year from qualifying carbon sequestration generation," for qualifying carbon <ln numlevel="1" lineno="69" slineno="1-37"/>sequestration generation, means the kilowatt-hours supplied by a facility during the <ln numlevel="1" lineno="70" slineno="1-38"/>calendar year multiplied by the ratio of the amount of carbon dioxide captured from the <ln numlevel="1" lineno="71" slineno="1-39"/>facility and sequestered to the sum of the amount of carbon dioxide captured from the <ln numlevel="1" lineno="72" slineno="1-40"/>facility and sequestered plus the amount of carbon dioxide emitted from the facility <ln numlevel="1" lineno="73" slineno="1-41"/>during the same calendar year.</subsection><subsection ssid="4-null-18" dnum="3-o" numlevel="1" lineno="74" slineno="1-42" level="1"><display>(3)</display>"Banked renewable energy certificate" means a bundled or unbundled renewable energy <ln numlevel="1" lineno="75" slineno="1-43"/>certificate that is:<subsection ssid="4-null-19" dnum="a-o" numlevel="1" lineno="76" slineno="1-44" level="2"><display>(a)</display>not used in a calendar year to comply with this part or with a renewable energy <ln numlevel="1" lineno="77" slineno="1-45"/>program in another state; and</subsection><subsection ssid="4-null-20" dnum="b-o" numlevel="1" lineno="78" slineno="1-46" level="2"><display>(b)</display>carried forward into a subsequent year.</subsection></subsection><subsection ssid="4-null-21" dnum="4-o" numlevel="1" lineno="79" slineno="1-47" level="1"><display>(4)</display>"Bundled renewable energy certificate" means a renewable energy certificate for <ln numlevel="1" lineno="80" slineno="1-48"/>qualifying electricity that is acquired:<subsection ssid="4-null-22" dnum="a-o" numlevel="1" lineno="81" slineno="1-49" level="2"><display>(a)</display>by an electrical corporation by a trade, purchase, or other transfer of electricity that <ln numlevel="1" lineno="82" slineno="1-50"/>includes the renewable energy attributes of, or certificate that is issued for, the <ln numlevel="1" lineno="83" slineno="1-51"/>electricity; or</subsection><subsection ssid="4-null-23" dnum="b-o" numlevel="1" lineno="84" slineno="1-52" level="2"><display>(b)</display>by an electrical corporation by generating the electricity for which the renewable <ln numlevel="1" lineno="85" slineno="1-53"/>energy certificate is issued.</subsection></subsection><subsection ssid="4-null-24" dnum="5-o" numlevel="1" lineno="86" slineno="1-54" level="1"><display>(5)</display>"Clean energy source" means:<subsection ssid="4-null-25" dnum="a-o" numlevel="1" lineno="87" slineno="1-55" level="2"><display>(a)</display>an electric generation facility or generation capability or upgrade that becomes <ln numlevel="1" lineno="88" slineno="1-56"/>operational on or after January 1, 1995, that derives its energy from one or more of <ln numlevel="1" lineno="89" slineno="1-57"/>the following:<subsection ssid="4-null-26" dnum="i-o" numlevel="1" lineno="90" slineno="1-58" level="3"><display>(i)</display>wind energy;</subsection><subsection ssid="4-null-27" dnum="ii-o" numlevel="1" lineno="91" slineno="1-59" level="3"><display>(ii)</display>solar photovoltaic and solar thermal energy;</subsection><subsection ssid="4-null-28" dnum="iii-o" numlevel="1" lineno="92" slineno="1-60" level="3"><display>(iii)</display>wave, tidal, and ocean thermal energy;</subsection><subsection ssid="4-null-29" dnum="iv-o" numlevel="1" lineno="93" slineno="1-61" level="3"><display>(iv)</display>except for combustion of wood that has been treated with chemical preservatives <ln numlevel="1" lineno="94" slineno="1-62"/>such as creosote, pentachlorophenol or chromated copper arsenate, biomass and <ln numlevel="1" lineno="95" slineno="1-63"/>biomass byproducts, including:<subsection ssid="4-null-30" dnum="A-o" numlevel="1" lineno="96" slineno="1-64" level="4"><display>(A)</display>organic waste;</subsection><subsection ssid="4-null-31" dnum="B-o" numlevel="1" lineno="97" slineno="1-65" level="4"><display>(B)</display>forest or rangeland woody debris from harvesting or thinning conducted to <ln numlevel="1" lineno="98" slineno="1-66"/>improve forest or rangeland ecological health and to reduce wildfire risk;</subsection><subsection ssid="4-null-32" dnum="C-o" numlevel="1" lineno="99" slineno="1-67" level="4"><display>(C)</display>agricultural residues;</subsection><subsection ssid="4-null-33" dnum="D-o" numlevel="1" lineno="100" slineno="1-68" level="4"><display>(D)</display>dedicated energy crops; and</subsection><subsection ssid="4-null-34" dnum="E-o" numlevel="1" lineno="101" slineno="1-69" level="4"><display>(E)</display>landfill gas or biogas produced from organic matter, wastewater, anaerobic <ln numlevel="1" lineno="102" slineno="1-70"/>digesters, or municipal solid waste;</subsection></subsection><subsection ssid="4-null-35" dnum="v-o" numlevel="1" lineno="103" slineno="1-71" level="3"><display>(v)</display>geothermal energy located outside the state;</subsection><subsection ssid="4-null-36" dnum="vi-o" numlevel="1" lineno="104" slineno="1-72" level="3"><display>(vi)</display>waste gas and waste heat capture or recovery, including methane gas from:<subsection ssid="4-null-37" dnum="A-o" numlevel="1" lineno="105" slineno="1-73" level="4"><display>(A)</display>an abandoned coal mine; or</subsection><subsection ssid="4-null-38" dnum="B-o" numlevel="1" lineno="106" slineno="1-74" level="4"><display>(B)</display>a coal degassing operation associated with a state-approved mine permit;</subsection></subsection><subsection ssid="4-null-39" dnum="vii-o" numlevel="1" lineno="107" slineno="1-75" level="3"><display>(vii)</display>efficiency upgrades to a hydroelectric facility, without regard to the date upon <ln numlevel="1" lineno="108" slineno="1-76"/>which the facility became operational, if the upgrades become operational on or <ln numlevel="1" lineno="109" slineno="1-77"/>after January 1, 1995;</subsection><subsection ssid="4-null-40" dnum="viii-o" numlevel="1" lineno="110" slineno="1-78" level="3"><display>(viii)</display>compressed air, if:<subsection ssid="4-null-41" dnum="A-o" numlevel="1" lineno="111" slineno="1-79" level="4"><display>(A)</display>the compressed air is taken from compressed air energy storage; and</subsection><subsection ssid="4-null-42" dnum="B-o" numlevel="1" lineno="112" slineno="1-80" level="4"><display>(B)</display>the energy used to compress the air is a clean energy source;</subsection></subsection><subsection ssid="4-null-43" dnum="ix-o" numlevel="1" lineno="113" slineno="1-81" level="3"><display>(ix)</display>municipal solid waste; or</subsection><subsection ssid="4-null-44" dnum="x-o" numlevel="1" lineno="114" slineno="1-82" level="3"><display>(x)</display>energy derived from nuclear fuel;</subsection></subsection><subsection ssid="4-null-45" dnum="b-o" numlevel="1" lineno="115" slineno="1-83" level="2"><display>(b)</display>any of the following:<subsection ssid="4-null-46" dnum="i-o" numlevel="1" lineno="116" slineno="1-84" level="3"><display>(i)</display>up to 50 average megawatts of electricity per year per electrical corporation from a <ln numlevel="1" lineno="117" slineno="1-85"/>certified low-impact hydroelectric facility, without regard to the date upon which <ln numlevel="1" lineno="118" slineno="1-86"/>the facility becomes operational, if the facility is certified as a low-impact <ln numlevel="1" lineno="119" slineno="1-87"/>hydroelectric facility on or after January 1, 1995, by a national certification <ln numlevel="1" lineno="120" slineno="1-88"/>organization;</subsection><subsection ssid="4-null-47" dnum="ii-o" numlevel="1" lineno="121" slineno="1-89" level="3"><display>(ii)</display>geothermal energy if located within the state, without regard to the date upon <ln numlevel="1" lineno="122" slineno="1-90"/>which the facility becomes operational; or</subsection><subsection ssid="4-null-48" dnum="iii-o" numlevel="1" lineno="123" slineno="1-91" level="3"><display>(iii)</display>hydroelectric energy if located within the state, without regard to the date upon <ln numlevel="1" lineno="124" slineno="1-92"/>which the facility becomes operational;</subsection></subsection><subsection ssid="4-null-49" dnum="c-o" numlevel="1" lineno="125" slineno="1-93" level="2"><display>(c)</display>hydrogen gas derived from any source of energy described in Subsection <xref depth="4" refnumber="54-17-601(5)(a)">(5)(a)</xref> or <xref depth="4" refnumber="54-17-601(b)">(b)</xref>;</subsection><subsection ssid="4-null-50" dnum="d-o" numlevel="1" lineno="126" slineno="1-94" level="2"><display>(d)</display>if an electric generation facility employs multiple energy sources, that portion of the <ln numlevel="1" lineno="127" slineno="1-95"/>electricity generated that is attributable to energy sources described in Subsections <xref depth="4" refnumber="54-17-601(5)(a)"><ln numlevel="1" lineno="128" slineno="1-96"/>(5)(a)</xref> through <xref depth="4" refnumber="54-17-601(c)">(c)</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="4-null-51" dnum="e-o" numlevel="1" lineno="129" slineno="1-97" level="2"><display>(e)</display>any of the following located in the state and owned by a user of energy:<subsection ssid="4-null-52" dnum="i-o" numlevel="1" lineno="130" slineno="1-98" level="3"><display>(i)</display>a demand side management measure, as defined by Subsection <xref depth="4" refnumber="54-7-12.8(1)">54-7-12.8(1)</xref>, with <ln numlevel="1" lineno="131" slineno="1-99"/>the quantity of renewable energy certificates to which the user is entitled <ln numlevel="1" lineno="132" slineno="1-100"/>determined by the equivalent energy saved by the measure;</subsection><subsection ssid="4-null-53" dnum="ii-o" numlevel="1" lineno="133" slineno="1-101" level="3"><display>(ii)</display>a solar thermal system that reduces the consumption of fossil fuels, with the <ln numlevel="1" lineno="134" slineno="1-102"/>quantity of renewable energy certificates to which the user is entitled determined <ln numlevel="1" lineno="135" slineno="1-103"/>by the equivalent kilowatt-hours saved, except to the extent the commission <ln numlevel="1" lineno="136" slineno="1-104"/>determines otherwise with respect to net-metered energy;</subsection><subsection ssid="4-null-54" dnum="iii-o" numlevel="1" lineno="137" slineno="1-105" level="3"><display>(iii)</display>a solar photovoltaic system that reduces the consumption of fossil fuels with the <ln numlevel="1" lineno="138" slineno="1-106"/>quantity of renewable energy certificates to which the user is entitled determined <ln numlevel="1" lineno="139" slineno="1-107"/>by the total production of the system, except to the extent the commission <ln numlevel="1" lineno="140" slineno="1-108"/>determines otherwise with respect to net-metered energy;</subsection><subsection ssid="4-null-55" dnum="iv-o" numlevel="1" lineno="141" slineno="1-109" level="3"><display>(iv)</display>a hydroelectric or geothermal facility with the quantity of renewable energy <ln numlevel="1" lineno="142" slineno="1-110"/>certificates to which the user is entitled determined by the total production of the <ln numlevel="1" lineno="143" slineno="1-111"/>facility, except to the extent the commission determines otherwise with respect to <ln numlevel="1" lineno="144" slineno="1-112"/>net-metered energy;</subsection><subsection ssid="4-null-56" dnum="v-o" numlevel="1" lineno="145" slineno="1-113" level="3"><display>(v)</display>a waste gas or waste heat capture or recovery system, other than from a combined <ln numlevel="1" lineno="146" slineno="1-114"/>cycle combustion turbine that does not use waste gas or waste heat, with the <ln numlevel="1" lineno="147" slineno="1-115"/>quantity of renewable energy certificates to which the user is entitled determined <ln numlevel="1" lineno="148" slineno="1-116"/>by the total production of the system, except to the extent the commission <ln numlevel="1" lineno="149" slineno="1-117"/>determines otherwise with respect to net-metered energy; and</subsection><subsection ssid="4-null-57" dnum="vi-o" numlevel="1" lineno="150" slineno="1-118" level="3"><display>(vi)</display>the station use of solar thermal energy, solar photovoltaic energy, hydroelectric <ln numlevel="1" lineno="151" slineno="1-119"/>energy, geothermal energy, waste gas, or waste heat capture and recovery<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection></subsection><subsection ssid="4-84" dnum="_-o:f-i" numlevel="1" lineno="152" slineno="1-120" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">a high-resolution demand-side resource.</amend></subsection></subsection><subsection ssid="4-null-58" dnum="6-o" numlevel="1" lineno="153" slineno="1-121" level="1"><display>(6)</display>"Electrical corporation":<subsection ssid="4-null-59" dnum="a-o" numlevel="1" lineno="154" slineno="1-122" level="2"><display>(a)</display>is as defined in Section <xref depth="3" refnumber="54-2-1">54-2-1</xref>; and</subsection><subsection ssid="4-null-60" dnum="b-o" numlevel="1" lineno="155" slineno="1-123" level="2"><display>(b)</display>does not include a person generating electricity that is not for sale to the public.</subsection></subsection><subsection ssid="4-79" dnum="_-o:7-i" numlevel="1" lineno="156" slineno="1-124" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">"High-resolution demand-side resource" means a system that:</amend><subsection ssid="4-80" dnum="_-o:a-i" numlevel="1" lineno="157" slineno="1-125" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">provides real-time, circuit-level sub-metering to measure and verify demand <ln numlevel="1" lineno="158" slineno="1-126"/>reduction;</amend></subsection><subsection ssid="4-81" dnum="_-o:b-i" numlevel="1" lineno="159" slineno="1-127" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">utilizes automated load control capable of responding to grid conditions;</amend></subsection><subsection ssid="4-82" dnum="_-o:c-i" numlevel="1" lineno="160" slineno="1-128" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">provides granular measurement data;</amend></subsection><subsection ssid="4-83" dnum="_-o:d-i" numlevel="1" lineno="161" slineno="1-129" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">may be comprised of a single site or an aggregation of multiple distributed sites <ln numlevel="1" lineno="162" slineno="1-130"/>managed by a unified control system; and</amend></subsection><subsection ssid="4-90" dnum="_-o:e-i" numlevel="1" lineno="163" slineno="1-131" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="74" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">uses hardware, software, and firmware that comply with grid interconnection and <ln numlevel="1" lineno="164" slineno="1-132"/>communication standards adopted or recognized by the commission.</amend></subsection></subsection><subsection ssid="4-null-61" dnum="7-o:8-i" numlevel="1" lineno="165" slineno="1-133" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1067" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>"Qualifying carbon sequestration generation" means a fossil-fueled generating <ln numlevel="1" lineno="166" slineno="1-134"/>facility located within the geographic boundary of the Western Electricity Coordinating <ln numlevel="1" lineno="167" slineno="1-135"/>Council that:<subsection ssid="4-null-62" dnum="a-o" numlevel="1" lineno="168" slineno="1-136" level="2"><display>(a)</display>becomes operational or is retrofitted on or after January 1, 2008; and</subsection><subsection ssid="4-null-63" dnum="b-o" numlevel="1" lineno="169" slineno="1-137" level="2"><display>(b)</display>reduces carbon dioxide emissions into the atmosphere through permanent geological <ln numlevel="1" lineno="170" slineno="1-138"/>sequestration or through another verifiably permanent reduction in carbon dioxide <ln numlevel="1" lineno="171" slineno="1-139"/>emissions through the use of technology.</subsection></subsection><subsection ssid="4-null-64" dnum="8-o:9-i" numlevel="1" lineno="172" slineno="1-140" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1070" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>"Qualifying electricity" means<amend anum="0" ea="amend" pairid="60" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="4-88" dnum="_-o:a-i" numlevel="1" lineno="173" slineno="1-141" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>electricity generated on or after January 1, 1995, from a clean energy source if:<subsection ssid="4-null-65" dnum="a-o:i-i" numlevel="1" lineno="174" slineno="1-142" level="3" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1072" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display><subsection ssid="4-null-66" dnum="i-o:A-i" level="4" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1073" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>the renewable energy source is located within the geographic <ln numlevel="1" lineno="175" slineno="1-143"/>boundary of the Western Electricity Coordinating Council; or</subsection><subsection ssid="4-null-67" dnum="ii-o:B-i" numlevel="1" lineno="176" slineno="1-144" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1074" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>the qualifying electricity is delivered to the transmission system of an <ln numlevel="1" lineno="177" slineno="1-145"/>electrical corporation or a delivery point designated by the electrical <ln numlevel="1" lineno="178" slineno="1-146"/>corporation for the purpose of subsequent delivery to the electrical corporation; <ln numlevel="1" lineno="179" slineno="1-147"/>and</subsection></subsection><subsection ssid="4-null-68" dnum="b-o:ii-i" numlevel="1" lineno="180" slineno="1-148" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1075" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>the renewable energy attributes of the electricity are not traded, sold, <ln numlevel="1" lineno="181" slineno="1-149"/>transferred, or otherwise used to satisfy another state's renewable energy program<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="54" groupid="44" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="182" slineno="1-150"/>; and</amend></subsection></subsection><subsection ssid="4-86" dnum="_-o:b-i" numlevel="1" lineno="183" slineno="1-151" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">for purposes of commission-approved voluntary renewable or clean energy tariffs, <ln numlevel="1" lineno="184" slineno="1-152"/>verified net reductions in electricity consumption delivered through a high-resolution <ln numlevel="1" lineno="185" slineno="1-153"/>demand-side resource.</amend></subsection></subsection><subsection ssid="4-null-69" dnum="9-o:10-i" numlevel="1" lineno="186" slineno="1-154" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1077" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>"Qualifying zero carbon emissions generation":<subsection ssid="4-null-70" dnum="a-o" numlevel="1" lineno="187" slineno="1-155" level="2"><display>(a)</display>means a generation facility located within the geographic boundary of the Western <ln numlevel="1" lineno="188" slineno="1-156"/>Electricity Coordinating Council that:<subsection ssid="4-null-71" dnum="i-o" numlevel="1" lineno="189" slineno="1-157" level="3"><display>(i)</display>becomes operational on or after January 1, 2008; or</amend></subsection></subsection></subsection><subsection ssid="6-12" dnum="_-o:ii-i" numlevel="1" lineno="214" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">a high-resolution demand-side resource, whether located on the contract <ln numlevel="1" lineno="215" slineno="2-14"/>customer's premises or aggregated from third-party locations.</amend></subsection></subsection><subsection ssid="6-null-8" dnum="b-o" numlevel="1" lineno="216" slineno="2-15" level="2"><display>(b)</display>"Clean energy facility" does not include an electric generating facility for which the <ln numlevel="1" lineno="217" slineno="2-16"/>electric generating facility's costs are included in a qualified utility's rates as a facility <ln numlevel="1" lineno="218" slineno="2-17"/>that provides electric service to the qualified utility's system.</subsection></subsection><subsection ssid="6-null-9" dnum="3-o" numlevel="1" lineno="219" slineno="2-18" level="1"><display>(3)</display>"Clean energy tariff" means a tariff offered by a qualified utility that allows the <ln numlevel="1" lineno="220" slineno="2-19"/>qualified utility to procure clean generation on behalf of and to serve its customers.</subsection><subsection ssid="6-null-10" dnum="4-o" numlevel="1" lineno="221" slineno="2-20" level="1"><display>(4)</display>"Contract customer" means a person who executes or will execute a clean energy <ln numlevel="1" lineno="222" slineno="2-21"/>contract with a qualified utility.</subsection><subsection ssid="6-14" dnum="_-o:5-i" numlevel="1" lineno="223" slineno="2-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1099" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">"High-resolution demand-side resource" means the same as that term is defined in <ln numlevel="1" lineno="224" slineno="2-23"/>Section <xref depth="3" refnumber="54-17-601">54-17-601</xref>.</amend></subsection><subsection ssid="6-null-11" dnum="5-o:6-i" numlevel="1" lineno="225" slineno="2-24" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1100" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1101" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>"Qualified utility" means an electric corporation that serves more than 200,000 <ln numlevel="1" lineno="226" slineno="2-25"/>retail customers in the state.</subsection></section></bsec><bsec buid="8" num="54-17-802" type="amend" src="code" uid="C54-17-S802_2026050620260506" sort="54 17 08020020260506" numlevel="1" lineno="227" slineno="3-1" sn="3"><section number="54-17-802" numlevel="1" lineno="228" slineno="3-2" type="amend"><secline lineno="227">Section 3. Section <bold>54-17-802</bold> is amended to read:</secline><catline lineno="228"><bold>54-17-802<parens/>. Contracts for the purchase of electricity from a clean energy facility.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="229" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>Within a reasonable time after receiving a request from a contract customer and subject <ln numlevel="1" lineno="230" slineno="3-4"/>to reasonable credit requirements, a qualified utility shall enter into a clean energy <ln numlevel="1" lineno="231" slineno="3-5"/>contract with the requesting contract customer to supply some or all of the contract <ln numlevel="1" lineno="232" slineno="3-6"/>customer's electric service from one or more clean energy facilities selected by the <ln numlevel="1" lineno="233" slineno="3-7"/>contract customer.</subsection><subsection ssid="8-null-2" dnum="2-o" numlevel="1" lineno="234" slineno="3-8" level="1"><display>(2)</display>Subject to a contract customer agreeing to pay the qualified utility for all incremental <ln numlevel="1" lineno="235" slineno="3-9"/>costs associated with metering facilities, communication facilities, and administration, a <ln numlevel="1" lineno="236" slineno="3-10"/>clean energy contract may provide for electricity to be delivered to a contract customer:<subsection ssid="8-null-3" dnum="a-o" numlevel="1" lineno="237" slineno="3-11" level="2"><display>(a)</display>from one clean energy facility to a contract customer's single metered delivery <ln numlevel="1" lineno="238" slineno="3-12"/>location;</subsection><subsection ssid="8-null-4" dnum="b-o" numlevel="1" lineno="239" slineno="3-13" level="2"><display>(b)</display>from multiple clean energy facilities to a contract customer's single metered delivery <ln numlevel="1" lineno="240" slineno="3-14"/>location; or</subsection><subsection ssid="8-null-5" dnum="c-o" numlevel="1" lineno="241" slineno="3-15" level="2"><display>(c)</display>from one or more clean energy facilities to a single contract customer's multiple <ln numlevel="1" lineno="242" slineno="3-16"/>metered delivery locations.</subsection></subsection><subsection ssid="8-null-6" dnum="3-o" numlevel="1" lineno="243" slineno="3-17" level="1" space="false"><display>(3)</display><subsection ssid="8-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A single contract customer may aggregate multiple metered delivery locations to <ln numlevel="1" lineno="244" slineno="3-18"/>satisfy the minimum megawatt limit under Subsection <xref depth="4" refnumber="54-17-802(4)">(4)</xref>.</subsection><subsection ssid="8-null-8" dnum="b-o" numlevel="1" lineno="245" slineno="3-19" level="2"><display>(b)</display>Multiple contract customers may not aggregate their separate metered delivery <ln numlevel="1" lineno="246" slineno="3-20"/>locations to satisfy the minimum megawatt limit under Subsection <xref depth="4" refnumber="54-17-802(4)">(4)</xref>.</subsection></subsection><subsection ssid="8-null-9" dnum="4-o" numlevel="1" lineno="247" slineno="3-21" level="1"><display>(4)</display>The amount of electricity provided to a contract customer under a clean energy contract <ln numlevel="1" lineno="248" slineno="3-22"/>may not be less than 2.0 megawatts.</subsection><subsection ssid="8-null-10" dnum="5-o" numlevel="1" lineno="249" slineno="3-23" level="1"><display>(5)</display>The amount of electricity provided in any hour to a contract customer under a clean <ln numlevel="1" lineno="250" slineno="3-24"/>energy contract may not exceed the contract customer's metered kilowatt-hour load in <ln numlevel="1" lineno="251" slineno="3-25"/>that hour at the metered delivery locations under the contract.</subsection><subsection ssid="8-null-11" dnum="6-o" numlevel="1" lineno="252" slineno="3-26" level="1"><display>(6)</display>A clean energy contract that meets the requirements of Subsection <xref depth="4" refnumber="54-17-802(4)">(4)</xref> may provide for <ln numlevel="1" lineno="253" slineno="3-27"/>one or more increases in the amount of electricity to be provided under the contract even <ln numlevel="1" lineno="254" slineno="3-28"/>though the amount of electricity to be provided by the increase is less than the minimum <ln numlevel="1" lineno="255" slineno="3-29"/>amount required under Subsection <xref depth="4" refnumber="54-17-802(4)">(4)</xref>.</subsection><subsection ssid="8-null-12" dnum="7-o" numlevel="1" lineno="256" slineno="3-30" level="1"><display>(7)</display>The total amount of electricity to be generated by clean energy facilities and delivered <ln numlevel="1" lineno="257" slineno="3-31"/>to contract customers at any one time under all clean energy contracts may not exceed <ln numlevel="1" lineno="258" slineno="3-32"/>300 megawatts, unless the commission approves in advance a higher amount.</subsection><subsection ssid="8-null-13" dnum="8-o" numlevel="1" lineno="259" slineno="3-33" level="1"><display>(8)</display>Electricity generated by a clean energy facility and delivered to a contract customer <ln numlevel="1" lineno="260" slineno="3-34"/>under a clean energy contract may not be included in a net metering program under <ln numlevel="1" lineno="261" slineno="3-35"/>Chapter 15, Net Metering of Electricity.</subsection><subsection ssid="8-14" dnum="_-o:9-i" numlevel="1" lineno="262" slineno="3-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1114" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">For purposes of this part, the requirement for delivery of electricity to a contract <ln numlevel="1" lineno="263" slineno="3-37"/>customer is satisfied if a high-resolution demand-side resource provides a metered <ln numlevel="1" lineno="264" slineno="3-38"/>reduction in load.</amend></subsection></section></bsec><bsec buid="9" num="54-17-805" type="amend" src="code" uid="C54-17-S805_2026050620260506" sort="54 17 08050020260506" numlevel="1" lineno="265" slineno="4-1" sn="4"><section number="54-17-805" numlevel="1" lineno="266" slineno="4-2" type="amend"><secline lineno="265">Section 4. Section <bold>54-17-805</bold> is amended to read:</secline><catline lineno="266"><bold>54-17-805<parens/>. Costs associated with delivering electricity from a clean energy <ln numlevel="1" lineno="267" slineno="4-3"/>facility to a contract customer.</bold></catline><subsection ssid="9-null-1" dnum="1-o" numlevel="1" lineno="268" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>To the extent that a clean energy contract provides for the delivery of electricity from a <ln numlevel="1" lineno="269" slineno="4-5"/>clean energy facility owned by the contract customer, the clean energy contract shall <ln numlevel="1" lineno="270" slineno="4-6"/>require the contract customer to pay for the use of the qualified utility's transmission or <ln numlevel="1" lineno="271" slineno="4-7"/>distribution facilities at the qualified utility's applicable rates, which may include <ln numlevel="1" lineno="272" slineno="4-8"/>transmission costs at the qualified utility's applicable rate approved by the Federal <ln numlevel="1" lineno="273" slineno="4-9"/>Energy Regulatory Commission.</subsection><subsection ssid="9-null-2" dnum="2-o" numlevel="1" lineno="274" slineno="4-10" level="1"><display>(2)</display>To the extent that a clean energy contract provides for the delivery of electricity from a <ln numlevel="1" lineno="275" slineno="4-11"/>clean energy facility owned by a person other than the qualified utility or the contract <ln numlevel="1" lineno="276" slineno="4-12"/>customer, the clean energy contract shall require the contract customer to bear all <ln numlevel="1" lineno="277" slineno="4-13"/>reasonably identifiable costs that the qualified utility incurs in delivering the electricity <ln numlevel="1" lineno="278" slineno="4-14"/>from the clean energy facility to the contract customer, including all costs to procure and <ln numlevel="1" lineno="279" slineno="4-15"/>deliver electricity and for billing, administrative, and related activities, as determined by <ln numlevel="1" lineno="280" slineno="4-16"/>the commission.</subsection><subsection ssid="9-null-3" dnum="3-o" numlevel="1" lineno="281" slineno="4-17" level="1"><display>(3)</display>A qualified utility that enters a clean energy contract shall charge a contract customer <ln numlevel="1" lineno="282" slineno="4-18"/>for all metered electric service delivered to the contract customer, including generation, <ln numlevel="1" lineno="283" slineno="4-19"/>transmission, and distribution service, at the qualified utility's applicable tariff rates, <ln numlevel="1" lineno="284" slineno="4-20"/>excluding:<subsection ssid="9-null-4" dnum="a-o" numlevel="1" lineno="285" slineno="4-21" level="2"><display>(a)</display>any kilowatt hours of electricity delivered from the clean energy facility, based on <ln numlevel="1" lineno="286" slineno="4-22"/>the time of delivery, adjusted for transmission losses;</subsection><subsection ssid="9-null-5" dnum="b-o" numlevel="1" lineno="287" slineno="4-23" level="2"><display>(b)</display>any kilowatts of electricity delivered from the clean energy facility that coincide with <ln numlevel="1" lineno="288" slineno="4-24"/>the contract customer's monthly metered kilowatt demand measurement, adjusted for <ln numlevel="1" lineno="289" slineno="4-25"/>transmission losses;</subsection><subsection ssid="9-null-6" dnum="c-o" numlevel="1" lineno="290" slineno="4-26" level="2"><display>(c)</display>any transmission and distribution service that the contract customer pays for under <ln numlevel="1" lineno="291" slineno="4-27"/>Subsection <xref depth="4" refnumber="54-17-805(1)">(1)</xref> or <xref depth="4" refnumber="54-17-805(2)">(2)</xref>; and</subsection><subsection ssid="9-null-7" dnum="d-o" numlevel="1" lineno="292" slineno="4-28" level="2"><display>(d)</display>any transmission service that the contract customer provides under Subsection <xref depth="4" refnumber="54-17-805(2)">(2)</xref> to <ln numlevel="1" lineno="293" slineno="4-29"/>deliver generation from the clean energy facility.</subsection></subsection><subsection ssid="9-8" dnum="_-o:4-i" numlevel="1" lineno="294" slineno="4-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">For a clean energy contract involving a high-resolution demand-side resource, verified <ln numlevel="1" lineno="295" slineno="4-31"/>reductions in electricity consumption shall be treated as electricity delivered from the <ln numlevel="1" lineno="296" slineno="4-32"/>clean energy facility for purposes of Subsection <xref depth="4" refnumber="54-17-805(3)">(3)</xref>.</amend></subsection></section></bsec><bsec buid="10" num="54-17-806" type="amend" src="code" uid="C54-17-S806_2026050620260506" sort="54 17 08060020260506" numlevel="1" lineno="297" slineno="5-1" sn="5"><section number="54-17-806" numlevel="1" lineno="298" slineno="5-2" type="amend"><secline lineno="297">Section 5. Section <bold>54-17-806</bold> is amended to read:</secline><catline lineno="298"><bold>54-17-806<parens/>. Qualified utility clean energy tariff.</bold></catline><subsection ssid="10-null-1" dnum="1-o" numlevel="1" lineno="299" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>The commission may authorize a qualified utility to implement a clean energy tariff in <ln numlevel="1" lineno="300" slineno="5-4"/>accordance with this section if the commission determines the tariff that the qualified <ln numlevel="1" lineno="301" slineno="5-5"/>utility proposes is reasonable and in the public interest.</subsection><subsection ssid="10-null-2" dnum="2-o" numlevel="1" lineno="302" slineno="5-6" level="1"><display>(2)</display>The commission may authorize a tariff under Subsection <xref depth="4" refnumber="54-17-806(1)">(1)</xref> to apply to:<subsection ssid="10-null-3" dnum="a-o" numlevel="1" lineno="303" slineno="5-7" level="2"><display>(a)</display>a qualified utility customer with an aggregated electrical load of at least five <ln numlevel="1" lineno="304" slineno="5-8"/>megawatts; or</subsection><subsection ssid="10-null-4" dnum="b-o" numlevel="1" lineno="305" slineno="5-9" level="2"><display>(b)</display>a combination of qualified utility customers who are separately metered if:<subsection ssid="10-null-5" dnum="i-o" numlevel="1" lineno="306" slineno="5-10" level="3"><display>(i)</display>the aggregated electrical load of the qualified utility customers is at least five <ln numlevel="1" lineno="307" slineno="5-11"/>megawatts; and</subsection><subsection ssid="10-null-6" dnum="ii-o" numlevel="1" lineno="308" slineno="5-12" level="3"><display>(ii)</display>each of the qualified utility customers is located within a project area, as defined <ln numlevel="1" lineno="309" slineno="5-13"/>in Section <xref depth="3" refnumber="11-58-102">11-58-102</xref>.</subsection></subsection></subsection><subsection ssid="10-null-7" dnum="3-o" numlevel="1" lineno="310" slineno="5-14" level="1"><display>(3)</display>A customer who agrees to take service that is subject to the clean energy tariff under <ln numlevel="1" lineno="311" slineno="5-15"/>this section shall pay:<subsection ssid="10-null-8" dnum="a-o" numlevel="1" lineno="312" slineno="5-16" level="2"><display>(a)</display>the customer's normal tariff rate;</subsection><subsection ssid="10-null-9" dnum="b-o" numlevel="1" lineno="313" slineno="5-17" level="2"><display>(b)</display>an incremental charge in an amount equal to the difference between the cost to the <ln numlevel="1" lineno="314" slineno="5-18"/>qualified utility to supply clean generation to the clean energy tariff customer and the <ln numlevel="1" lineno="315" slineno="5-19"/>qualified utility's avoided costs as defined in Subsection <xref depth="3" refnumber="54-2-1">54-2-1</xref>(1), or a different <ln numlevel="1" lineno="316" slineno="5-20"/>methodology recommended by the qualified utility; and</subsection><subsection ssid="10-null-10" dnum="c-o" numlevel="1" lineno="317" slineno="5-21" level="2"><display>(c)</display>an administrative fee in an amount approved by the commission.</subsection></subsection><subsection ssid="10-null-11" dnum="4-o" numlevel="1" lineno="318" slineno="5-22" level="1"><display>(4)</display>The commission shall allow a qualified utility to recover the qualified utility's prudently <ln numlevel="1" lineno="319" slineno="5-23"/>incurred cost of clean generation procured pursuant to the tariff established in this <ln numlevel="1" lineno="320" slineno="5-24"/>section that is not otherwise recovered from the proceeds of the tariff paid by customers <ln numlevel="1" lineno="321" slineno="5-25"/>agreeing to service that is subject to the clean energy tariff.</subsection><subsection ssid="10-12" dnum="_-o:5-i" numlevel="1" lineno="322" slineno="5-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">For a clean energy tariff implemented under this section:</amend><subsection ssid="10-13" dnum="_-o:a-i" numlevel="1" lineno="323" slineno="5-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">notwithstanding any utility regulation or tariff to the contrary, a qualified utility shall <ln numlevel="1" lineno="324" slineno="5-28"/>accept sub-metering data from a high-resolution demand-side resource for billing and <ln numlevel="1" lineno="325" slineno="5-29"/>verification purposes;</amend></subsection><subsection ssid="10-14" dnum="_-o:b-i" numlevel="1" lineno="326" slineno="5-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">a qualified utility may not:</amend><subsection ssid="10-15" dnum="_-o:i-i" numlevel="1" lineno="327" slineno="5-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1137" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">exclude high-resolution demand-side resources from participation;</amend></subsection><subsection ssid="10-16" dnum="_-o:ii-i" numlevel="1" lineno="328" slineno="5-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">require a physical generation facility as a condition for a contract customer to <ln numlevel="1" lineno="329" slineno="5-33"/>receive credits for clean energy usage; or</amend></subsection><subsection ssid="10-17" dnum="_-o:iii-i" numlevel="1" lineno="330" slineno="5-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">fail to account for avoided capacity costs and avoided transmission losses in <ln numlevel="1" lineno="331" slineno="5-35"/>calculating charges for high-resolution demand-side resources;</amend></subsection></subsection><subsection ssid="10-18" dnum="_-o:c-i" numlevel="1" lineno="332" slineno="5-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">a contract customer may delegate the management, control, and verification of a <ln numlevel="1" lineno="333" slineno="5-37"/>high-resolution demand-side resource to a third-party service provider or aggregator, <ln numlevel="1" lineno="334" slineno="5-38"/>and the qualified utility shall recognize the third-party provider as the authorized <ln numlevel="1" lineno="335" slineno="5-39"/>agent for providing metering data, verifying load reductions, and coordinating with <ln numlevel="1" lineno="336" slineno="5-40"/>the utility; and</amend></subsection><subsection ssid="10-19" dnum="_-o:d-i" numlevel="1" lineno="337" slineno="5-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">eligibility for a demand-side management program does not disqualify a resource <ln numlevel="1" lineno="338" slineno="5-42"/>from participating in a clean energy contract under this part.</amend></subsection></subsection></section></bsec><bsec buid="1" num="79-6-410" type="enact" src="code" uid="C79-6-S410_2026050620260506" sort="79 06 04100020260506" numlevel="1" lineno="339" slineno="6-1" sn="6"><section numlevel="1" lineno="340" slineno="6-2" number="79-6-410" type="enact"><secline lineno="339">Section 6. slineno="6-6"/>54-7-12.8</xref>.</amend></subsection><subsection ssid="1-4" dnum="_-o:c-i" numlevel="1" lineno="345" slineno="6-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">"Energy rebate program" means a program operated by a public utility that provides <ln numlevel="1" lineno="346" slineno="6-8"/>financial rebates or incentives to customers for demand side management.</amend></subsection><subsection ssid="1-5" dnum="_-o:d-i" numlevel="1" lineno="347" slineno="6-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">"Large-scale public utility" means a public utility that:</amend><subsection ssid="1-53" dnum="_-o:i-i" numlevel="1" lineno="348" slineno="6-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="264" groupid="210" style="1" owner="jchristopherson" level="1" amendtag="end">provides retail electric service to more than 200,000 retail customers in the state; or</amend></subsection><subsection ssid="1-54" dnum="_-o:ii-i" numlevel="1" lineno="349" slineno="6-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="269" groupid="214" style="1" owner="jchristopherson" level="1" amendtag="end">provides retail natural gas service to more than 200,000 retail customers in the <ln numlevel="1" lineno="350" slineno="6-12"/>state.</amend></subsection></subsection></subsection><subsection ssid="1-6" dnum="_-o:2-i" numlevel="1" lineno="351" slineno="6-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1149" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">On or before November 30, 2026, the office shall conduct a comprehensive study of <ln numlevel="1" lineno="352" slineno="6-14"/>energy rebate programs and submit a report to the Public Utilities, Energy, and <ln numlevel="1" lineno="353" slineno="6-15"/>Technology Interim Committee.</amend></subsection><subsection ssid="1-7" dnum="_-o:3-i" numlevel="1" lineno="354" slineno="6-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1150" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">In conducting the study described in Subsection <xref depth="4" refnumber="79-6-410(2)">(2)</xref>, the office shall:</amend><subsection ssid="1-8" dnum="_-o:a-i" numlevel="1" lineno="355" slineno="6-17" ea="amend" anum="0" owner="jchristopherson" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">the Office of Consumer Services;</amend></subsection><subsection ssid="1-12" dnum="_-o:iv-i" numlevel="1" lineno="359" slineno="6-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" Energy rebate program reporting.</bold></catline><subsection ssid="2-1" dnum="_-o:1-i" numlevel="1" lineno="405" slineno="7-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="2-2" dnum="_-o:a-i" numlevel="1" lineno="406" slineno="7-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">"Commission" means the Public Service Commission established in Section <xref depth="3" refnumber="54-1-1">54-1-1</xref>.</amend></subsection><subsection ssid="2-3" dnum="_-o:b-i" numlevel="1" lineno="407" slineno="7-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1191" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">"Demand side management" means the same as that term is defined in Section <xref depth="3" refnumber="54-7-12.8"><ln numlevel="1" lineno="408" slineno="7-6"/>54-7-12.8</xref>.</amend></subsection><subsection ssid="2-4" dnum="_-o:c-i" numlevel="1" lineno="409" slineno="7-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1192" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">"Energy rebate program" means a program operated by a public utility that provides <ln numlevel="1" lineno="410" slineno="7-8"/>financial rebates or incentives to customers for demand side management.</amend></subsection><subsection ssid="2-5" dnum="_-o:d-i" numlevel="1" lineno="411" slineno="7-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1193" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">"Large-scale public utility" means a public utility that:</amend><subsection ssid="2-18" dnum="_-o:i-i" numlevel="1" lineno="412" slineno="7-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1194" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="84" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">provides retail electric service to more than 200,000 retail customers in the state; or</amend></subsection><subsection ssid="2-19" dnum="_-o:ii-i" numlevel="1" lineno="413" slineno="7-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1195" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">provides retail natural gas service to more than 200,000 retail customers in the <ln numlevel="1" lineno="414" slineno="7-12"/>state.</amend></subsection></subsection></subsection><subsection ssid="2-6" dnum="_-o:2-i" numlevel="1" lineno="415" slineno="7-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1196" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end"> On or before November 30, 2026, and annually thereafter on or before November 30, <ln numlevel="1" lineno="416" slineno="7-14"/>each large-scale public utility that operates an energy rebate program shall submit a <ln numlevel="1" lineno="417" slineno="7-15"/>report to the commission and to the Public Utilities, Energy, and Technology Interim <ln numlevel="1" lineno="418" slineno="7-16"/>Committee.</amend></subsection><subsection ssid="2-7" dnum="_-o:3-i" numlevel="1" lineno="419" slineno="7-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1197" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">The report required by Subsection <xref depth="4" refnumber="79-6-411(2)">(2)</xref> shall describe:</amend><subsection ssid="2-8" dnum="_-o:a-i" numlevel="1" lineno="420" slineno="7-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1198" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">each energy rebate program operated by the large-scale public utility during the <ln numlevel="1" lineno="421" slineno="7-19"/>previous calendar year;</amend></subsection><subsection ssid="2-9" dnum="_-o:b-i" numlevel="1" lineno="422" slineno="7-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1199" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">for each energy rebate program:</amend><subsection ssid="2-10" dnum="_-o:i-i" numlevel="1" lineno="423" slineno="7-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1200" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">the number of customers who participated in the program by customer class;</amend></subsection><subsection ssid="2-11" dnum="_-o:ii-i" numlevel="1" lineno="424" slineno="7-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1201" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">the total amount of rebates issued;</amend></subsection><subsection ssid="2-14" dnum="_-o:iii-i" numlevel="1" lineno="425" slineno="7-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1202" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">energy savings achieved;</amend></subsection><subsection ssid="2-13" dnum="_-o:iv-i" numlevel="1" lineno="426" slineno="7-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1203" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="67" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">cost-effectiveness metrics; and</amend></subsection><subsection ssid="2-12" dnum="_-o:v-i" numlevel="1" lineno="427" slineno="7-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1204" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">administrative costs incurred;
