Section <bold>72-21-101</bold> is enacted to read:</secline><headchap number="72-21" numlevel="1" lineno="24" slineno="1-2">21. Commuter Rail System Electrification </headchap><catline lineno="25"><bold>72-21-101<parens/>. Definitions.</bold></catline><sectionText lineno="26"><para/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">As used in this chapter:</amend></sectionText><subsection ssid="5-2" dnum="_-o:1-i" numlevel="1" lineno="27" slineno="1-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">"Commuter rail" means the same as that term is defined in Section <xref depth="3" refnumber="63N-3-602">63N-3-602</xref>.</amend></subsection><subsection ssid="5-5" dnum="_-o:2-i" numlevel="1" lineno="28" slineno="1-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">"Electrification infrastructure" means overhead catenary systems, substations, and <ln numlevel="1" lineno="29" slineno="1-7"/>related equipment necessary to supply electric power to commuter rail vehicles.</amend></subsection><subsection ssid="5-3" dnum="_-o:3-i" numlevel="1" lineno="30" slineno="1-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">"Hybrid-electric" means a commuter rail vehicle capable of operating using electric <ln numlevel="1" lineno="31" slineno="1-9"/>power supplied by overhead catenary or third-rail infrastructure and onboard battery <ln numlevel="1" lineno="32" slineno="1-10"/>storage, without reliance on diesel propulsion during normal operations.</amend></subsection></section></bsec><bsec buid="3" num="72-21-102" type="enact" src="code" uid="C72-21-S102_2026050620260506" sort="72 21 01020020260506" numlevel="1" lineno="33" slineno="2-1" sn="2"><section numlevel="1" lineno="34" slineno="2-2" number="72-21-102" type="enact"><secline lineno="33">Section 2. Section <bold>72-21-102</bold> is enacted to read:</secline><catline lineno="34"><bold>72-21-102<parens/>. Commuter rail electrification -- Hybrid-electric transition.</bold></catline><subsection ssid="3-1-2" dnum="_-o:1-i" numlevel="1" lineno="35" slineno="2-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall lead and coordinate the statewide transition of commuter rail <ln numlevel="1" lineno="36" slineno="2-4"/>service to hybrid-electric operation.</amend></subsection><subsection ssid="3-12" dnum="_-o:2-i" numlevel="1" lineno="37" slineno="2-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">Before January 1, 2031, the department, in coordination with a large public transit <ln numlevel="1" lineno="38" slineno="2-6"/>district, shall:</amend><subsection ssid="3-13" dnum="_-o:a-i" numlevel="1" lineno="39" slineno="2-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">convert each existing commuter rail vehicle to hybrid-electric operation or replace <ln numlevel="1" lineno="40" slineno="2-8"/>each existing commuter rail vehicle with a hybrid-electric commuter rail vehicle; and</amend></subsection><subsection ssid="3-14" dnum="_-o:b-i" numlevel="1" lineno="41" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">install and operate the electrification infrastructure needed for hybrid-electric <ln numlevel="1" lineno="42" slineno="2-10"/>commuter rail vehicle operation.</amend></subsection></subsection><subsection ssid="3-10" dnum="_-o:3-i" numlevel="1" lineno="43" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning July 1, 2027, a large public transit district may not place a commuter rail <ln numlevel="1" lineno="44" slineno="2-12"/>vehicle into service unless the vehicle is hybrid-electric.</amend></subsection><subsection ssid="3-11" dnum="_-o:4-i" numlevel="1" lineno="45" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">The department may implement this section in phases by corridor or service segment to <ln numlevel="1" lineno="46" slineno="2-14"/>ensure continuity of commuter rail service.</amend></subsection></section></bsec><bsec buid="6" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="47" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="47">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="48"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-11-26 10:38 AM</tm></rev></foot></leg>
