Section <bold>63G-2-103</bold> is amended to read:</secline><catline lineno="28"><bold>63G-2-103<parens/>. Definitions.</bold></catline><sectionText lineno="29"><tab/>As used in this chapter:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="30" slineno="1-4" level="1"><display>(1)</display>"Audit" means:<subsection ssid="1-null-2" dnum="a-o" numlevel="1" lineno="31" slineno="1-5" level="2"><display>(a)</display>a systematic examination of financial, management, program, and related records for <ln numlevel="1" lineno="32" slineno="1-6"/>the purpose of determining the fair presentation of financial statements, adequacy of <ln numlevel="1" lineno="33" slineno="1-7"/>internal controls, or compliance with laws and regulations; or</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="34" slineno="1-8" level="2"><display>(b)</display>a systematic examination of program procedures and operations for the purpose of <ln numlevel="1" lineno="35" slineno="1-9"/>determining their effectiveness, economy, efficiency, and compliance with statutes <ln numlevel="1" lineno="36" slineno="1-10"/>and regulations.</subsection></subsection><subsection ssid="1-null-4" dnum="2-o" numlevel="1" lineno="37" slineno="1-11" level="1"><display>(2)</display>"Chief administrative officer" means the chief administrative officer of a governmental <ln numlevel="1" lineno="38" slineno="1-12"/>entity who is responsible to fulfill the duties described in Section <xref depth="3" refnumber="63A-12-103">63A-12-103</xref>.</subsection><subsection ssid="1-null-5" dnum="3-o" numlevel="1" lineno="39" slineno="1-13" level="1"><display>(3)</display>"Chronological logs" mean the regular and customary summary records of law <ln numlevel="1" lineno="40" slineno="1-14"/>enforcement agencies and other public safety agencies that show:<subsection ssid="1-null-6" dnum="a-o" numlevel="1" lineno="41" slineno="1-15" level="2"><display>(a)</display>the time and general nature of police, fire, and paramedic calls made to the agency; <ln numlevel="1" lineno="42" slineno="1-16"/>and</subsection><subsection ssid="1-null-7" dnum="b-o" numlevel="1" lineno="43" slineno="1-17" level="2"><display>(b)</display>any arrests or jail bookings made by the agency.</subsection></subsection><subsection ssid="1-null-8" dnum="4-o" numlevel="1" lineno="44" slineno="1-18" level="1"><display>(4)</display>"Classification," "classify," and their derivative forms mean determining whether a <ln numlevel="1" lineno="45" slineno="1-19"/>record series, record, or information within a record is public, private, controlled, <ln numlevel="1" lineno="46" slineno="1-20"/>protected, or exempt from disclosure under Subsection <xref depth="4" refnumber="63G-2-201(3)(b)">63G-2-201(3)(b)</xref>.</subsection><subsection ssid="1-null-9" dnum="5-o" numlevel="1" lineno="47" slineno="1-21" level="1" space="false"><display>(5)</display><subsection ssid="1-null-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Computer program" means:<subsection ssid="1-null-11" dnum="i-o" numlevel="1" lineno="48" slineno="1-22" level="3" tab="1"><display>(i)</display>a series of instructions or statements that permit the functioning of a computer <ln numlevel="1" lineno="49" slineno="1-23"/>system in a manner designed to provide storage, retrieval, and manipulation of <ln numlevel="1" lineno="50" slineno="1-24"/>data from the computer system; and</subsection><subsection ssid="1-null-12" dnum="ii-o" numlevel="1" lineno="51" slineno="1-25" level="3" tab="1"><display>(ii)</display>any associated documentation and source material that explain how to operate the <ln numlevel="1" lineno="52" slineno="1-26"/>computer program.</subsection></subsection><subsection ssid="1-null-13" dnum="b-o" numlevel="1" lineno="53" slineno="1-27" level="2"><display>(b)</display>"Computer program" does not mean:<subsection ssid="1-null-14" dnum="i-o" numlevel="1" lineno="54" slineno="1-28" level="3"><display>(i)</display>the original data, including numbers, text, voice, graphics, and images;</subsection><subsection ssid="1-null-15" dnum="ii-o" numlevel="1" lineno="55" slineno="1-29" level="3"><display>(ii)</display>analysis, compilation, and other manipulated forms of the original data produced <ln numlevel="1" lineno="56" slineno="1-30"/>by use of the program; or</subsection><subsection ssid="1-null-16" dnum="iii-o" numlevel="1" lineno="57" slineno="1-31" level="3"><display>(iii)</display>the mathematical or statistical formulas, excluding the underlying mathematical <ln numlevel="1" lineno="58" slineno="1-32"/>algorithms contained in the program, that would be used if the manipulated forms <ln numlevel="1" lineno="59" slineno="1-33"/>of the original data were to be produced manually.</subsection></subsection></subsection><subsection ssid="1-null-17" dnum="6-o" numlevel="1" lineno="60" slineno="1-34" level="1" space="false"><display>(6)</display><subsection ssid="1-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Contractor" means:<subsection ssid="1-null-19" dnum="i-o" numlevel="1" lineno="61" slineno="1-35" level="3" tab="1"><display>(i)</display>any person who contracts with a governmental entity to provide goods or services <ln numlevel="1" lineno="62" slineno="1-36"/>directly to a governmental entity; or</subsection><subsection ssid="1-null-20" dnum="ii-o" numlevel="1" lineno="63" slineno="1-37" level="3" tab="1"><display>(ii)</display>any private, nonprofit organization that receives funds from a governmental entity.</subsection></subsection><subsection ssid="1-null-21" dnum="b-o" numlevel="1" lineno="64" slineno="1-38" level="2"><display>(b)</display>"Contractor" does not mean a private provider.</subsection></subsection><subsection ssid="1-null-22" dnum="7-o" numlevel="1" lineno="65" slineno="1-39" level="1"><display>(7)</display>"Controlled record" means a record containing data on individuals that is controlled as <ln numlevel="1" lineno="66" slineno="1-40"/>provided by Section <xref depth="3" refnumber="63G-2-304">63G-2-304</xref>.</subsection><subsection ssid="1-null-23" dnum="8-o" numlevel="1" lineno="67" slineno="1-41" level="1"><display>(8)</display>"Designation," "designate," and their derivative forms mean indicating, based on a <ln numlevel="1" lineno="68" slineno="1-42"/>governmental entity's familiarity with a record series or based on a governmental entity's <ln numlevel="1" lineno="69" slineno="1-43"/>review of a reasonable sample of a record series, the primary classification that a <ln numlevel="1" lineno="70" slineno="1-44"/>majority of records in a record series would be given if classified and the classification <ln numlevel="1" lineno="71" slineno="1-45"/>that other records typically present in the record series would be given if classified.</subsection><subsection ssid="1-null-24" dnum="9-o" numlevel="1" lineno="72" slineno="1-46" level="1"><display>(9)</display>"Elected official" means each person elected to a state office, county office, municipal <ln numlevel="1" lineno="73" slineno="1-47"/>office, school board or school district office, special district office, or special service <ln numlevel="1" lineno="74" slineno="1-48"/>district office, but does not include judges.</subsection><subsection ssid="1-null-25" dnum="10-o" numlevel="1" lineno="75" slineno="1-49" level="1"><display>(10)</display>"Explosive" means a chemical compound, device, or mixture:<subsection ssid="1-null-26" dnum="a-o" numlevel="1" lineno="76" slineno="1-50" level="2"><display>(a)</display>commonly used or intended for the purpose of producing an explosion; and</subsection><subsection ssid="1-null-27" dnum="b-o" numlevel="1" lineno="77" slineno="1-51" level="2"><display>(b)</display>that contains oxidizing or combustive units or other ingredients in proportions, <ln numlevel="1" lineno="78" slineno="1-52"/>quantities, or packing so that:<subsection ssid="1-null-28" dnum="i-o" numlevel="1" lineno="79" slineno="1-53" level="3"><display>(i)</display>an ignition by fire, friction, concussion, percussion, or detonator of any part of the <ln numlevel="1" lineno="80" slineno="1-54"/>compound or mixture may cause a sudden generation of highly heated gases; and</subsection><subsection ssid="1-null-29" dnum="ii-o" numlevel="1" lineno="81" slineno="1-55" level="3"><display>(ii)</display>the resultant gaseous pressures are capable of:<subsection ssid="1-null-30" dnum="A-o" numlevel="1" lineno="82" slineno="1-56" level="4"><display>(A)</display>producing destructive effects on contiguous objects; or</subsection><subsection ssid="1-null-31" dnum="B-o" numlevel="1" lineno="83" slineno="1-57" level="4"><display>(B)</display>causing death or serious bodily injury.</subsection></subsection></subsection></subsection><subsection ssid="1-null-32" dnum="11-o" numlevel="1" lineno="84" slineno="1-58" level="1"><display>(11)</display>"Government audit agency" means any governmental entity that conducts an audit.</subsection><subsection ssid="1-null-33" dnum="12-o" numlevel="1" lineno="85" slineno="1-59" level="1" space="false"><display>(12)</display><subsection ssid="1-null-34" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Governmental entity" means:<subsection ssid="1-null-35" dnum="i-o" numlevel="1" lineno="86" slineno="1-60" level="3" tab="1"><display>(i)</display>executive department agencies of the state, the offices of the governor, lieutenant <ln numlevel="1" lineno="87" slineno="1-61"/>governor, state auditor, attorney general, and state treasurer, the Board of Pardons <ln numlevel="1" lineno="88" slineno="1-62"/>and Parole, the Board of Examiners, the National Guard, the Career Service <ln numlevel="1" lineno="89" slineno="1-63"/>Review Office, the State Board of Education, the Utah Board of Higher <ln numlevel="1" lineno="90" slineno="1-64"/>Education, and the State Archives;</subsection><subsection ssid="1-null-36" dnum="ii-o" numlevel="1" lineno="91" slineno="1-65" level="3" tab="1"><display>(ii)</display>the Office of the Legislative Auditor General, Office of the Legislative Fiscal <ln numlevel="1" lineno="92" slineno="1-66"/>Analyst, Office of Legislative Research and General Counsel, the Legislature, and <ln numlevel="1" lineno="93" slineno="1-67"/>legislative committees, except any political party, group, caucus, or rules or sifting <ln numlevel="1" lineno="94" slineno="1-68"/>committee of the Legislature;</subsection><subsection ssid="1-null-37" dnum="iii-o" numlevel="1" lineno="95" slineno="1-69" level="3" tab="1"><display>(iii)</display>courts, the Judicial Council, the Administrative Office of the Courts, and similar <ln numlevel="1" lineno="96" slineno="1-70"/>administrative units in the judicial branch;</subsection><subsection ssid="1-null-38" dnum="iv-o" numlevel="1" lineno="97" slineno="1-71" level="3" tab="1"><display>(iv)</display>any state-funded institution of higher education or public education; or</subsection><subsection ssid="1-null-39" dnum="v-o" numlevel="1" lineno="98" slineno="1-72" level="3" tab="1"><display>(v)</display>any political subdivision of the state, but, if a political subdivision has adopted an <ln numlevel="1" lineno="99" slineno="1-73"/>ordinance or a policy relating to information practices pursuant to Section <xref depth="3" refnumber="63G-2-701"><ln numlevel="1" lineno="100" slineno="1-74"/>63G-2-701</xref>, this chapter shall apply to the political subdivision to the extent <ln numlevel="1" lineno="101" slineno="1-75"/>specified in Section <xref depth="3" refnumber="63G-2-701">63G-2-701</xref> or as specified in any other section of this chapter <ln numlevel="1" lineno="102" slineno="1-76"/>that specifically refers to political subdivisions.</subsection></subsection><subsection ssid="1-null-40" dnum="b-o" numlevel="1" lineno="103" slineno="1-77" level="2"><display>(b)</display>"Governmental entity" also means:<subsection ssid="1-null-41" dnum="i-o" numlevel="1" lineno="104" slineno="1-78" level="3"><display>(i)</display>every office, agency, board, bureau, committee, department, advisory board, or <ln numlevel="1" lineno="105" slineno="1-79"/>commission of an entity listed in Subsection <xref depth="4" refnumber="63G-2-103(12)(a)">(12)(a)</xref> that is funded or established <ln numlevel="1" lineno="106" slineno="1-80"/>by the government to carry out the public's business;</subsection><subsection ssid="1-null-42" dnum="ii-o" numlevel="1" lineno="107" slineno="1-81" level="3"><display>(ii)</display>as defined in Section <xref depth="3" refnumber="11-13-103">11-13-103</xref>, an interlocal entity or joint or cooperative <ln numlevel="1" lineno="108" slineno="1-82"/>undertaking, except for the Water District Water Development Council created <ln numlevel="1" lineno="109" slineno="1-83"/>pursuant to Section <xref depth="3" refnumber="11-13-228">11-13-228</xref>;</subsection><subsection ssid="1-null-43" dnum="iii-o" numlevel="1" lineno="110" slineno="1-84" level="3"><display>(iii)</display>as defined in Section <xref depth="3" refnumber="11-13a-102">11-13a-102</xref>, a governmental nonprofit corporation;</subsection><subsection ssid="1-null-44" dnum="iv-o" numlevel="1" lineno="111" slineno="1-85" level="3"><display>(iv)</display>an association as defined in Section <xref depth="3" refnumber="53G-7-1101">53G-7-1101</xref>;</subsection><subsection ssid="1-null-45" dnum="v-o" numlevel="1" lineno="112" slineno="1-86" level="3"><display>(v)</display>the Utah Independent Redistricting Commission; and</subsection><subsection ssid="1-null-46" dnum="vi-o" numlevel="1" lineno="113" slineno="1-87" level="3"><display>(vi)</display>a law enforcement agency, as defined in Section <xref depth="3" refnumber="53-1-102">53-1-102</xref>, that employs one or <ln numlevel="1" lineno="114" slineno="1-88"/>more law enforcement officers, as defined in Section <xref depth="3" refnumber="53-13-103">53-13-103</xref>.</subsection></subsection><subsection ssid="1-null-47" dnum="c-o" numlevel="1" lineno="115" slineno="1-89" level="2"><display>(c)</display>"Governmental entity" does not include the Utah Educational Savings Plan created in <ln numlevel="1" lineno="116" slineno="1-90"/>Section <xref depth="3" refnumber="53H-10-202">53H-10-202</xref>.</subsection></subsection><subsection ssid="1-null-48" dnum="13-o" numlevel="1" lineno="117" slineno="1-91" level="1"><display>(13)</display>"Government Records Office" means the same as that term is defined in Section <xref depth="3" refnumber="63A-12-201"><ln numlevel="1" lineno="118" slineno="1-92"/>63A-12-201</xref>.</subsection><subsection ssid="1-null-49" dnum="14-o" numlevel="1" lineno="119" slineno="1-93" level="1"><display>(14)</display>"Gross compensation" means every form of remuneration payable for a given period to <ln numlevel="1" lineno="120" slineno="1-94"/>an individual for services provided including salaries, commissions, vacation pay, <ln numlevel="1" lineno="121" slineno="1-95"/>severance pay, bonuses, and any board, rent, housing, lodging, payments in kind, and <ln numlevel="1" lineno="122" slineno="1-96"/>any similar benefit received from the individual's employer.</subsection><subsection ssid="1-null-50" dnum="15-o" numlevel="1" lineno="123" slineno="1-97" level="1"><display>(15)</display>"Individual" means a human being.</subsection><subsection ssid="1-null-51" dnum="16-o" numlevel="1" lineno="124" slineno="1-98" level="1" space="false"><display>(16)</display><subsection ssid="1-null-52" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Initial contact report" means an initial written or recorded report, however <ln numlevel="1" lineno="125" slineno="1-99"/>titled, prepared by peace officers engaged in public patrol or response duties <ln numlevel="1" lineno="126" slineno="1-100"/>describing official actions initially taken in response to either a public complaint <ln numlevel="1" lineno="127" slineno="1-101"/>about or the discovery of an apparent violation of law, which report may describe:<subsection ssid="1-null-53" dnum="i-o" numlevel="1" lineno="128" slineno="1-102" level="3" tab="1"><display>(i)</display>the date, time, location, and nature of the complaint, the incident, or offense;</subsection><subsection ssid="1-null-54" dnum="ii-o" numlevel="1" lineno="129" slineno="1-103" level="3" tab="1"><display>(ii)</display>names of victims;</subsection><subsection ssid="1-null-55" dnum="iii-o" numlevel="1" lineno="130" slineno="1-104" level="3" tab="1"><display>(iii)</display>the nature or general scope of the agency's initial actions taken in response to the <ln numlevel="1" lineno="131" slineno="1-105"/>incident;</subsection><subsection ssid="1-null-56" dnum="iv-o" numlevel="1" lineno="132" slineno="1-106" level="3" tab="1"><display>(iv)</display>the general nature of any injuries or estimate of damages sustained in the incident;</subsection><subsection ssid="1-null-57" dnum="v-o" numlevel="1" lineno="133" slineno="1-107" level="3" tab="1"><display>(v)</display>the name, address, and other identifying information about any person arrested or <ln numlevel="1" lineno="134" slineno="1-108"/>charged in connection with the incident; or</subsection><subsection ssid="1-null-58" dnum="vi-o" numlevel="1" lineno="135" slineno="1-109" level="3" tab="1"><display>(vi)</display>the identity of the public safety personnel, except undercover personnel, or <ln numlevel="1" lineno="136" slineno="1-110"/>prosecuting attorney involved in responding to the initial incident.</subsection></subsection><subsection ssid="1-null-59" dnum="b-o" numlevel="1" lineno="137" slineno="1-111" level="2"><display>(b)</display>Initial contact reports do not include follow-up or investigative reports prepared after <ln numlevel="1" lineno="138" slineno="1-112"/>the initial contact report. or</subsection><subsection ssid="1-null-69" dnum="f-o" numlevel="1" lineno="153" slineno="1-127" level="2"><display>(f)</display>any combination acting in concert with one another.</subsection></subsection><subsection ssid="1-null-70" dnum="20-o" numlevel="1" lineno="154" slineno="1-128" level="1"><display>(20)</display>"Private provider" means any person who contracts with a governmental entity to <ln numlevel="1" lineno="155" slineno="1-129"/>provide services directly to the public.</subsection><subsection ssid="1-null-71" dnum="21-o" numlevel="1" lineno="156" slineno="1-130" level="1"><display>(21)</display>"Private record" means a record containing data on individuals that is private as <ln numlevel="1" lineno="157" slineno="1-131"/>provided by Section <xref depth="3" refnumber="63G-2-302">63G-2-302</xref>.</subsection><subsection ssid="1-null-72" dnum="22-o" numlevel="1" lineno="158" slineno="1-132" level="1"><display>(22)</display>"Protected record" means a record that is classified protected as provided by Section <xref depth="3" refnumber="63G-2-305"><ln numlevel="1" lineno="159" slineno="1-133"/>63G-2-305</xref>.</subsection><subsection ssid="1-null-73" dnum="23-o" numlevel="1" lineno="160" slineno="1-134" level="1"><display>(23)</display>"Public record" means a record that is not private, controlled, or protected and that is <ln numlevel="1" lineno="161" slineno="1-135"/>not exempt from disclosure as provided in Subsection <xref depth="4" refnumber="63G-2-201(3)(b)">63G-2-201(3)(b)</xref>.</subsection><subsection ssid="1-null-74" dnum="24-o" numlevel="1" lineno="162" slineno="1-136" level="1"><display>(24)</display>"Reasonable search" means a search that is:<subsection ssid="1-null-75" dnum="a-o" numlevel="1" lineno="163" slineno="1-137" level="2"><display>(a)</display>reasonable in scope and intensity; and</subsection><subsection ssid="1-null-76" dnum="b-o" numlevel="1" lineno="164" slineno="1-138" level="2"><display>(b)</display>not unreasonably burdensome for the government entity.</subsection></subsection><subsection ssid="1-null-77" dnum="25-o" numlevel="1" lineno="165" slineno="1-139" level="1" space="false"><display>(25)</display><subsection ssid="1-null-78" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Record" means a book, letter, document, paper, map, plan, photograph, film, <ln numlevel="1" lineno="166" slineno="1-140"/>card, tape, recording, electronic data, or other documentary material regardless of <ln numlevel="1" lineno="167" slineno="1-141"/>physical form or characteristics:<subsection ssid="1-null-79" dnum="i-o" numlevel="1" lineno="168" slineno="1-142" level="3" tab="1"><display>(i)</display>that is prepared, owned, received, or retained by a governmental entity or political <ln numlevel="1" lineno="169" slineno="1-143"/>subdivision; and</subsection><subsection ssid="1-null-80" dnum="ii-o" numlevel="1" lineno="170" slineno="1-144" level="3" tab="1"><display>(ii)</display>where all of the information in the original is reproducible by photocopy or other <ln numlevel="1" lineno="171" slineno="1-145"/>mechanical or electronic means.</subsection></subsection><subsection ssid="1-null-81" dnum="b-o" numlevel="1" lineno="172" slineno="1-146" level="2"><display>(b)</display>"Record" does not include:<subsection ssid="1-null-82" dnum="i-o" numlevel="1" lineno="173" slineno="1-147" level="3"><display>(i)</display>a personal note or personal communication prepared or received by an employee <ln numlevel="1" lineno="174" slineno="1-148"/>or officer of a governmental entity:<subsection ssid="1-null-83" dnum="A-o" numlevel="1" lineno="175" slineno="1-149" level="4"><display>(A)</display>in a capacity other than the employee's or officer's governmental capacity; or</subsection><subsection ssid="1-null-84" dnum="B-o" numlevel="1" lineno="176" slineno="1-150" level="4"><display>(B)</display>that is unrelated to the conduct of the public's business;</subsection></subsection><subsection ssid="1-null-85" dnum="ii-o" numlevel="1" lineno="177" slineno="1-151" level="3"><display>(ii)</display>a temporary draft or similar material prepared for the originator's personal use or <ln numlevel="1" lineno="178" slineno="1-152"/>prepared by the originator for the personal use of an individual for whom the <ln numlevel="1" lineno="179" slineno="1-153"/>originator is working;</subsection><subsection ssid="1-null-86" dnum="iii-o" numlevel="1" lineno="180" slineno="1-154" level="3"><display>(iii)</display>material that is legally owned by an individual in the individual's private capacity;</subsection><subsection ssid="1-null-87" dnum="iv-o" numlevel="1" lineno="181" slineno="1-155" level="3"><display>(iv)</display>material to which access is limited by the laws of copyright or patent unless the <ln numlevel="1" lineno="182" slineno="1-156"/>copyright or patent is owned by a governmental entity or political subdivision;</subsection><subsection ssid="1-null-88" dnum="v-o" numlevel="1" lineno="183" slineno="1-157" level="3"><display>(v)</display>proprietary software;</subsection><subsection ssid="1-null-89" dnum="vi-o" numlevel="1" lineno="184" slineno="1-158" level="3"><display>(vi)</display>junk mail or a commercial publication received by a governmental entity or an <ln numlevel="1" lineno="185" slineno="1-159"/>official or employee of a governmental entity;</subsection><subsection ssid="1-null-90" dnum="vii-o" numlevel="1" lineno="186" slineno="1-160" level="3"><display>(vii)</display>a book that is cataloged, indexed, or inventoried and contained in the collections <ln numlevel="1" lineno="187" slineno="1-161"/>of a library open to the public;</subsection><subsection ssid="1-null-91" dnum="viii-o" numlevel="1" lineno="188" slineno="1-162" level="3"><display>(viii)</display>material that is cataloged, indexed, or inventoried and contained in the <ln numlevel="1" lineno="189" slineno="1-163"/>collections of a library open to the public, regardless of physical form or <ln numlevel="1" lineno="190" slineno="1-164"/>characteristics of the material;</subsection><subsection ssid="1-null-92" dnum="ix-o" numlevel="1" lineno="191" slineno="1-165" level="3"><display>(ix)</display>a daily calendar ;</subsection><subsection ssid="1-null-93" dnum="x-o" numlevel="1" lineno="192" slineno="1-166" level="3"><display>(x)</display>a note prepared by the originator for the originator's own use or for the sole use of <ln numlevel="1" lineno="193" slineno="1-167"/>an individual for whom the originator is working;</subsection><subsection ssid="1-null-94" dnum="xi-o" numlevel="1" lineno="194" slineno="1-168" level="3"><display>(xi)</display>a computer program that is developed or purchased by or for any governmental <ln numlevel="1" lineno="195" slineno="1-169"/>entity for its own use;</subsection><subsection ssid="1-null-95" dnum="xii-o" numlevel="1" lineno="196" slineno="1-170" level="3"><display>(xii)</display>a note or internal memorandum prepared as part of the deliberative process by:<subsection ssid="1-null-96" dnum="A-o" numlevel="1" lineno="197" slineno="1-171" level="4"><display>(A)</display>a member of the judiciary;</subsection><subsection ssid="1-null-97" dnum="B-o" numlevel="1" lineno="198" slineno="1-172" level="4"><display>(B)</display>an administrative law judge;</subsection><subsection ssid="1-null-98" dnum="C-o" numlevel="1" lineno="199" slineno="1-173" level="4"><display>(C)</display>a member of the Board of Pardons and Parole; or</subsection><subsection ssid="1-null-99" dnum="D-o" numlevel="1" lineno="200" slineno="1-174" level="4"><display>(D)</display>a member of any other body, other than an association or appeals panel as <ln numlevel="1" lineno="201" slineno="1-175"/>defined in Section <xref depth="3" refnumber="53G-7-1101">53G-7-1101</xref>, charged by law with performing a <ln numlevel="1" lineno="202" slineno="1-176"/>quasi-judicial function;</subsection></subsection><subsection ssid="1-null-100" dnum="xiii-o" numlevel="1" lineno="203" slineno="1-177" level="3"><display>(xiii)</display>a telephone number or similar code used to access a mobile communication <ln numlevel="1" lineno="204" slineno="1-178"/>device that is used by an employee or officer of a governmental entity, provided <ln numlevel="1" lineno="205" slineno="1-179"/>that the employee or officer of the governmental entity has designated at least one <ln numlevel="1" lineno="206" slineno="1-180"/>business telephone number that is a public record as provided in Section <xref depth="3" refnumber="63G-2-301"><ln numlevel="1" lineno="207" slineno="1-181"/>63G-2-301</xref>;</subsection><subsection ssid="1-null-101" dnum="xiv-o" numlevel="1" lineno="208" slineno="1-182" level="3"><display>(xiv)</display>information provided by the Public Employees' Benefit and Insurance Program, <ln numlevel="1" lineno="209" slineno="1-183"/>created in Section <xref depth="3" refnumber="49-20-103">49-20-103</xref>, to a county to enable the county to calculate the <ln numlevel="1" lineno="210" slineno="1-184"/>amount to be paid to a health care provider under Subsection <xref depth="4" refnumber="17-63-706(2)(e)(ii)">17-63-706(2)(e)(ii)</xref>;</subsection><subsection ssid="1-null-102" dnum="xv-o" numlevel="1" lineno="211" slineno="1-185" level="3"><display>(xv)</display>information that an owner of unimproved property provides to a local entity as <ln numlevel="1" lineno="212" slineno="1-186"/>provided in Section <xref depth="3" refnumber="11-42-205">11-42-205</xref>;</subsection><subsection ssid="1-null-103" dnum="xvi-o" numlevel="1" lineno="213" slineno="1-187" level="3"><display>(xvi)</display>a video or audio recording of an interview, or a transcript of the video or audio <ln numlevel="1" lineno="214" slineno="1-188"/>recording, that is conducted at a Children's Justice Center established under <ln numlevel="1" lineno="215" slineno="1-189"/>Section <xref depth="3" refnumber="67-5b-102">67-5b-102</xref>;</subsection><subsection ssid="1-null-104" dnum="xvii-o" numlevel="1" lineno="216" slineno="1-190" level="3"><display>(xvii)</display>child sexual abuse material, as defined by Section <xref depth="3" refnumber="76-5b-103">76-5b-103</xref>;</subsection><subsection ssid="1-null-105" dnum="xviii-o" numlevel="1" lineno="217" slineno="1-191" level="3"><display>(xviii)</display>before final disposition of an ethics complaint occurs, a video or audio <ln numlevel="1" lineno="218" slineno="1-192"/>recording of the closed portion of a meeting or hearing of:<subsection ssid="1-null-106" dnum="A-o" numlevel="1" lineno="219" slineno="1-193" level="4"><display>(A)</display>a Senate or House Ethics Committee;</subsection><subsection ssid="1-null-107" dnum="B-o" numlevel="1" lineno="220" slineno="1-194" level="4"><display>(B)</display>the Independent Legislative Ethics Commission;</subsection><subsection ssid="1-null-108" dnum="C-o" numlevel="1" lineno="221" slineno="1-195" level="4"><display>(C)</display>the Independent Executive Branch Ethics Commission, created in Section <xref depth="3" refnumber="63A-14-202"><ln numlevel="1" lineno="222" slineno="1-196"/>63A-14-202</xref>; or</subsection><subsection ssid="1-null-109" dnum="D-o" numlevel="1" lineno="223" slineno="1-197" level="4"><display>(D)</display>the Political Subdivisions Ethics Review Commission established in Section <xref depth="3" refnumber="63A-15-201"><ln numlevel="1" lineno="224" slineno="1-198"/>63A-15-201</xref>; </subsection></subsection><subsection ssid="1-null-110" dnum="xix-o" numlevel="1" lineno="225" slineno="1-199" level="3"><display>(xix)</display>confidential communication described in Section <xref depth="3" refnumber="58-60-102">58-60-102</xref>, <xref depth="3" refnumber="58-61-102">58-61-102</xref>, or <xref depth="3" refnumber="58-61-702"><ln numlevel="1" lineno="226" slineno="1-200"/>58-61-702</xref>;</subsection><subsection ssid="1-null-111" dnum="xx-o" numlevel="1" lineno="227" slineno="1-201" level="3"><display>(xx)</display>any item described in Subsection <xref depth="4" refnumber="63G-2-103(25)(a)">(25)(a)</xref> that is:<subsection ssid="1-null-112" dnum="A-o" numlevel="1" lineno="228" slineno="1-202" level="4"><display>(A)</display>described in Subsection <xref depth="4" refnumber="63G-2-305(17)">63G-2-305(17)</xref>, <xref refnumber="63G-2-305(18)" depth="4">(18), </xref>or <xref refnumber="63G-2-305(23)(b)" depth="4">(23)(b)</xref>; and</subsection><subsection ssid="1-null-113" dnum="B-o" numlevel="1" lineno="229" slineno="1-203" level="4"><display>(B)</display>shared between any of the following entities:<subsection ssid="1-null-114" dnum="I-o" numlevel="1" lineno="230" slineno="1-204" level="5"><display>(I)</display>the Division of Risk Management;</subsection><subsection ssid="1-null-115" dnum="II-o" numlevel="1" lineno="231" slineno="1-205" level="5"><display>(II)</display>the Office of the Attorney General;</subsection><subsection ssid="1-null-116" dnum="III-o" numlevel="1" lineno="232" slineno="1-206" level="5"><display>(III)</display>the governor's office; or</subsection><subsection ssid="1-null-117" dnum="IV-o" numlevel="1" lineno="233" slineno="1-207" level="5"><display>(IV)</display>the Legislature;</subsection></subsection></subsection><subsection ssid="1-null-118" dnum="xxi-o" numlevel="1" lineno="234" slineno="1-208" level="3"><display>(xxi)</display>the email address that a candidate for elective office provides to a filing officer <ln numlevel="1" lineno="235" slineno="1-209"/>under Subsection <xref depth="4" refnumber="20A-9-201(5)(c)(ii)">20A-9-201(5)(c)(ii)</xref> or <xref depth="4" refnumber="20A-9-203(4)(c)(iv)">20A-9-203(4)(c)(iv)</xref>; or</subsection><subsection ssid="1-null-119" dnum="xxii-o" numlevel="1" lineno="236" slineno="1-210" level="3"><display>(xxii)</display>except as provided in Sections <xref depth="3" refnumber="31A-16-105">31A-16-105</xref>, <xref depth="3" refnumber="31A-16-107.5">31A-16-107.5</xref>, and <xref depth="3" refnumber="27A-3-303">27a-3-303</xref>, an <ln numlevel="1" lineno="237" slineno="1-211"/>investment policy, or information related to an investment policy, provided to the <ln numlevel="1" lineno="238" slineno="1-212"/>insurance commissioner as described in Title <xref depth="1" refnumber="31A-18">31A, Chapter 18</xref>, Investments.</subsection></subsection></subsection><subsection ssid="1-null-120" dnum="26-o" numlevel="1" lineno="239" slineno="1-213" level="1"><display>(26)</display>"Record series" means a group of records that may be treated as a unit for purposes of <ln numlevel="1" lineno="240" slineno="1-214"/>designation, description, management, or disposition.</subsection><subsection ssid="1-null-121" dnum="27-o" numlevel="1" lineno="241" slineno="1-215" level="1"><display>(27)</display>"Records officer" means the individual appointed by the chief administrative officer of <ln numlevel="1" lineno="242" slineno="1-216"/>each governmental entity, or the political subdivision to work with state archives in the <ln numlevel="1" lineno="243" slineno="1-217"/>care, maintenance, scheduling, designation, classification, disposal, and preservation of <ln numlevel="1" lineno="244" slineno="1-218"/>records.</subsection><subsection ssid="1-null-122" dnum="28-o" numlevel="1" lineno="245" slineno="1-219" level="1"><display>(28)</display>"Schedule," "scheduling," and their derivative forms mean the process of specifying <ln numlevel="1" lineno="246" slineno="1-220"/>the length of time each record series should be retained by a governmental entity for <ln numlevel="1" lineno="247" slineno="1-221"/>administrative, legal, fiscal, or historical purposes and when each record series should be <ln numlevel="1" lineno="248" slineno="1-222"/>transferred to the state archives or destroyed.</subsection><subsection ssid="1-null-123" dnum="29-o" numlevel="1" lineno="249" slineno="1-223" level="1"><display>(29)</display>"Sponsored research" means research, training, and other sponsored activities as <ln numlevel="1" lineno="250" slineno="1-224"/>defined by the federal Executive Office of the President, Office of Management and <ln numlevel="1" lineno="251" slineno="1-225"/>Budget:<subsection ssid="1-null-124" dnum="a-o" numlevel="1" lineno="252" slineno="1-226" level="2"><display>(a)</display>conducted:<subsection ssid="1-null-125" dnum="i-o" numlevel="1" lineno="253" slineno="1-227" level="3"><display>(i)</display>by an institution within the state system of higher education described in Section <xref depth="3" refnumber="53H-1-102"><ln numlevel="1" lineno="254" slineno="1-228"/>53H-1-102</xref>; to the person's records request; and</subsection><subsection ssid="12-null-7" dnum="D-o" numlevel="1" lineno="280" slineno="2-10" level="4"><display>(D)</display>daytime telephone number; and</subsection></subsection><subsection ssid="12-null-8" dnum="ii-o" numlevel="1" lineno="281" slineno="2-11" level="3" tab="1"><display>(ii)</display>a description of the record requested that identifies the record with reasonable <ln numlevel="1" lineno="282" slineno="2-12"/>specificity.</subsection></subsection><subsection ssid="12-null-9" dnum="b-o" numlevel="1" lineno="283" slineno="2-13" level="2" space="false"><display>(b)</display><subsection ssid="12-null-10" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A single record request may not be submitted to multiple governmental entities.</subsection><subsection ssid="12-null-11" dnum="ii-o" numlevel="1" lineno="284" slineno="2-14" level="3"><display>(ii)</display>Subsection <xref depth="4" refnumber="63G-2-204(1)(b)(i)" start="0">(1)(b)(i)</xref> may not be construed to prevent a person from submitting a <ln numlevel="1" lineno="285" slineno="2-15"/>separate record request to each of multiple governmental entities, even if each of <ln numlevel="1" lineno="286" slineno="2-16"/>the separate requests seeks access to the same record.</subsection></subsection></subsection><subsection ssid="12-null-12" dnum="2-o" numlevel="1" lineno="287" slineno="2-17" level="1" space="false"><display>(2)</display><subsection ssid="12-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In response to a request for a record, a governmental entity may not provide a <ln numlevel="1" lineno="288" slineno="2-18"/>record that it has received under Section <xref depth="3" refnumber="63G-2-206" start="0">63G-2-206</xref> as a shared record.</subsection><subsection ssid="12-null-14" dnum="b-o" numlevel="1" lineno="289" slineno="2-19" level="2"><display>(b)</display>If a governmental entity is prohibited from providing a record under Subsection <xref depth="4" refnumber="63G-2-204(2)(a)" start="0">(2)(a)</xref>, <ln numlevel="1" lineno="290" slineno="2-20"/>the governmental entity shall:<subsection ssid="12-null-15" dnum="i-o" numlevel="1" lineno="291" slineno="2-21" level="3"><display>(i)</display>deny the records request; and</subsection><subsection ssid="12-null-16" dnum="ii-o" numlevel="1" lineno="292" slineno="2-22" level="3"><display>(ii)</display>inform the person making the request of the identity of the governmental entity <ln numlevel="1" lineno="293" slineno="2-23"/>from which the shared record was received.</subsection></subsection></subsection><subsection ssid="12-null-17" dnum="3-o" numlevel="1" lineno="294" slineno="2-24" level="1"><display>(3)</display>A governmental entity may make rules in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="295" slineno="2-25"/>Administrative Rulemaking Act</xref>, specifying where and to whom requests for access shall <ln numlevel="1" lineno="296" slineno="2-26"/>be directed.</subsection><subsection ssid="12-null-18" dnum="4-o" numlevel="1" lineno="297" slineno="2-27" level="1" space="false"><display>(4)</display><subsection ssid="12-59" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1153" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>After receiving a request for a record, a governmental entity shall:<subsection ssid="12-null-19" dnum="a-o:i-i" numlevel="1" lineno="298" slineno="2-28" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1154" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1155" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>review each request that seeks an expedited response and notify, within five <ln numlevel="1" lineno="299" slineno="2-29"/>business days after receiving the request, each requester that has not demonstrated <ln numlevel="1" lineno="300" slineno="2-30"/>that their record request benefits the public rather than the person that their <ln numlevel="1" lineno="301" slineno="2-31"/>response will not be expedited; and</subsection><subsection ssid="12-null-20" dnum="b-o:ii-i" numlevel="1" lineno="302" slineno="2-32" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1155" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1156" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>as soon as reasonably possible, but no later than 10 business days after <ln numlevel="1" lineno="303" slineno="2-33"/>receiving a written request, or five business days after receiving a written request <ln numlevel="1" lineno="304" slineno="2-34"/>if the requester demonstrates that expedited response to the record request benefits <ln numlevel="1" lineno="305" slineno="2-35"/>the public rather than the person:<subsection ssid="12-null-21" dnum="i-o:A-i" numlevel="1" lineno="306" slineno="2-36" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1156" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1157" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>approve the request and provide a copy of the record;</subsection><subsection ssid="12-null-22" dnum="ii-o:B-i" numlevel="1" lineno="307" slineno="2-37" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1157" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1158" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>deny the request in accordance with the procedures and requirements of <ln numlevel="1" lineno="308" slineno="2-38"/>Section <xref depth="3" refnumber="63G-2-205" start="0">63G-2-205</xref>;</subsection><subsection ssid="12-null-23" dnum="iii-o:C-i" numlevel="1" lineno="309" slineno="2-39" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1158" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1159" style="1" owner="i" level="1" amendtag="both" space="true">(C)</amend></display>notify the requester that it does not maintain the record requested and <ln numlevel="1" lineno="310" slineno="2-40"/>provide, if known, the name and address of the governmental entity that does <ln numlevel="1" lineno="311" slineno="2-41"/>maintain the record; or</subsection><subsection ssid="12-null-24" dnum="iv-o:D-i" numlevel="1" lineno="312" slineno="2-42" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1159" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="both" space="true">(D)</amend></display>notify the requester that because of one of the extraordinary <ln numlevel="1" lineno="313" slineno="2-43"/>circumstances listed in Subsection <xref depth="4" refnumber="63G-2-204(6)" start="0">(6)</xref>, it cannot immediately approve or deny <ln numlevel="1" lineno="314" slineno="2-44"/>the request, and include with the notice<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">:</amend><amendoutend style="2"/><subsection ssid="12-null-25" dnum="A-o:_-i" numlevel="1" lineno="315" slineno="2-45" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1160" style="2" owner="o" level="1" deltag="both">(A)</amend><amendoutend style="2"/></display><amend anum="0" ea="amend" pairid="34" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> </amend>a description of the circumstances that constitute the extraordinary <ln numlevel="1" lineno="316" slineno="2-46"/>circumstances<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">;</amend><amendoutend style="2"/> and</subsection><subsection ssid="12-null-26" dnum="B-o:_-i" numlevel="1" lineno="317" slineno="2-47" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1161" style="2" owner="o" level="1" deltag="both">(B)</amend><amendoutend style="2"/></display><amend anum="0" ea="amend" pairid="35" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> </amend>the date when the records will be available, consistent with the requirements <ln numlevel="1" lineno="318" slineno="2-48"/>of Subsection <xref depth="4" refnumber="63G-2-204(7)" start="0">(7)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="12-61" dnum="_-o:b-i" numlevel="1" lineno="319" slineno="2-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1162" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">An individual who is a subject of the record request may not participate in the <ln numlevel="1" lineno="320" slineno="2-50"/>governmental entity's review of or response to the record request.</amend></subsection></subsection><subsection ssid="12-null-27" dnum="5-o" numlevel="1" lineno="321" slineno="2-51" level="1"><display>(5)</display>Any person who requests a record to obtain information for a story or report for <ln numlevel="1" lineno="322" slineno="2-52"/>publication or broadcast to the general public is presumed to be acting to benefit the <ln numlevel="1" lineno="323" slineno="2-53"/>public rather than a person.</subsection><subsection ssid="12-null-28" dnum="6-o" numlevel="1" lineno="324" slineno="2-54" level="1"><display>(6)</display>The following circumstances constitute "extraordinary circumstances" that allow a <ln numlevel="1" lineno="325" slineno="2-55"/>governmental entity to delay approval or denial by an additional period of time as <ln numlevel="1" lineno="326" slineno="2-56"/>specified in Subsection <xref depth="4" refnumber="63G-2-204(7)" start="0">(7)</xref> if the governmental entity determines that due to the <ln numlevel="1" lineno="327" slineno="2-57"/>extraordinary circumstances it cannot respond within the time limits provided in <ln numlevel="1" lineno="328" slineno="2-58"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63G-2-204(4)" start="0">(4)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(4)(a)</amend>:<subsection ssid="12-null-29" dnum="a-o" numlevel="1" lineno="329" slineno="2-59" level="2"><display>(a)</display>another governmental entity is using the record, in which case the originating <ln numlevel="1" lineno="330" slineno="2-60"/>governmental entity shall promptly request that the governmental entity currently in <ln numlevel="1" lineno="331" slineno="2-61"/>possession return the record;</subsection><subsection ssid="12-null-30" dnum="b-o" numlevel="1" lineno="332" slineno="2-62" level="2"><display>(b)</display>another governmental entity is using the record as part of an audit, and returning the <ln numlevel="1" lineno="333" slineno="2-63"/>record before the completion of the audit would impair the conduct of the audit;</subsection><subsection ssid="12-null-31" dnum="c-o" numlevel="1" lineno="334" slineno="2-64" level="2" space="false"><display>(c)</display><subsection ssid="12-null-32" dnum="i-o" level="3" placement="sameline"><display>(i)</display>the request is for a voluminous quantity of records or a record series containing <ln numlevel="1" lineno="335" slineno="2-65"/>a substantial number of records; or</subsection><subsection ssid="12-null-33" dnum="ii-o" numlevel="1" lineno="336" slineno="2-66" level="3"><display>(ii)</display>the requester seeks a substantial number of records or records series in requests <ln numlevel="1" lineno="337" slineno="2-67"/>filed within five working days of each other;</subsection></subsection><subsection ssid="12-null-34" dnum="d-o" numlevel="1" lineno="338" slineno="2-68" level="2"><display>(d)</display>the governmental entity is currently processing a large number of records requests;</subsection><subsection ssid="12-null-35" dnum="e-o" numlevel="1" lineno="339" slineno="2-69" level="2"><display>(e)</display>the request requires the governmental entity to review a large number of records to <ln numlevel="1" lineno="340" slineno="2-70"/>locate the records requested;</subsection><subsection ssid="12-null-36" dnum="f-o" numlevel="1" lineno="341" slineno="2-71" level="2"><display>(f)</display>the decision to release a record involves legal issues that require the governmental <ln numlevel="1" lineno="342" slineno="2-72"/>entity to seek legal counsel for the analysis of statutes, rules, ordinances, regulations, <ln numlevel="1" lineno="343" slineno="2-73"/>or case law;</subsection><subsection ssid="12-null-37" dnum="g-o" numlevel="1" lineno="344" slineno="2-74" level="2"><display>(g)</display>segregating information that the requester is entitled to inspect from information that <ln numlevel="1" lineno="345" slineno="2-75"/>the requester is not entitled to inspect requires extensive editing; or</subsection><subsection ssid="12-null-38" dnum="h-o" numlevel="1" lineno="346" slineno="2-76" level="2"><display>(h)</display>segregating information that the requester is entitled to inspect from information that <ln numlevel="1" lineno="347" slineno="2-77"/>the requester is not entitled to inspect requires computer programming.</subsection></subsection><subsection ssid="12-null-39" dnum="7-o" numlevel="1" lineno="348" slineno="2-78" level="1"><display>(7)</display>If one of the extraordinary circumstances listed in Subsection <xref depth="4" refnumber="63G-2-204(6)" start="0">(6)</xref> precludes approval or <ln numlevel="1" lineno="349" slineno="2-79"/>denial within the time specified in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63G-2-204(4)" start="0">(4)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(4)(a)</amend>, the following time limits apply <ln numlevel="1" lineno="350" slineno="2-80"/>to the extraordinary circumstances:<subsection ssid="12-null-40" dnum="a-o" numlevel="1" lineno="351" slineno="2-81" level="2"><display>(a)</display>for claims under Subsection <xref depth="4" refnumber="63G-2-204(6)(a)" start="0">(6)(a)</xref>, the governmental entity currently in possession of <ln numlevel="1" lineno="352" slineno="2-82"/>the record shall return the record to the originating entity within five business days of <ln numlevel="1" lineno="353" slineno="2-83"/>the request for the return unless returning the record would impair the holder's work;</subsection><subsection ssid="12-null-41" dnum="b-o" numlevel="1" lineno="354" slineno="2-84" level="2"><display>(b)</display>for claims under Subsection <xref depth="4" refnumber="63G-2-204(6)(b)" start="0">(6)(b)</xref>, the originating governmental entity shall notify <ln numlevel="1" lineno="355" slineno="2-85"/>the requester when the record is available for inspection and copying;</subsection><subsection ssid="12-null-42" dnum="c-o" numlevel="1" lineno="356" slineno="2-86" level="2"><display>(c)</display>for claims under Subsections <xref depth="4" refnumber="63G-2-204(6)(c)" start="0">(6)(c)</xref>, <xref depth="4" refnumber="63G-2-204(6)(d)" start="0">(d)</xref>, and <xref depth="4" refnumber="63G-2-204(6)(e)" start="0">(e)</xref>, the governmental entity shall:<subsection ssid="12-null-43" dnum="i-o" numlevel="1" lineno="357" slineno="2-87" level="3"><display>(i)</display>disclose the records that it has located which the requester is entitled to inspect;</subsection><subsection ssid="12-null-44" dnum="ii-o" numlevel="1" lineno="358" slineno="2-88" level="3"><display>(ii)</display>provide the requester with an estimate of the amount of time it will take to finish <ln numlevel="1" lineno="359" slineno="2-89"/>the work required to respond to the request;</subsection><subsection ssid="12-null-45" dnum="iii-o" numlevel="1" lineno="360" slineno="2-90" level="3"><display>(iii)</display>complete the work and disclose those records that the requester is entitled to <ln numlevel="1" lineno="361" slineno="2-91"/>inspect as soon as reasonably possible; and</subsection><subsection ssid="12-null-46" dnum="iv-o" numlevel="1" lineno="362" slineno="2-92" level="3"><display>(iv)</display>for any person that does not establish a right to an expedited response as <ln numlevel="1" lineno="363" slineno="2-93"/>authorized by Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63G-2-204(4)" start="0">(4)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(4)(a)</amend>, a governmental entity may choose to:<subsection ssid="12-null-47" dnum="A-o" numlevel="1" lineno="364" slineno="2-94" level="4"><display>(A)</display>require the person to provide for copying of the records as provided in <ln numlevel="1" lineno="365" slineno="2-95"/>Subsection <xref depth="4" refnumber="63G-2-201(10)" start="0">63G-2-201(10)</xref>; or</subsection><subsection ssid="12-null-48" dnum="B-o" numlevel="1" lineno="366" slineno="2-96" level="4"><display>(B)</display>treat a request for multiple records as separate record requests, and respond <ln numlevel="1" lineno="367" slineno="2-97"/>sequentially to each request;</subsection></subsection></subsection><subsection ssid="12-null-49" dnum="d-o" numlevel="1" lineno="368" slineno="2-98" level="2"><display>(d)</display>for claims under Subsection <xref depth="4" refnumber="63G-2-204(6)(f)" start="0">(6)(f)</xref>, the governmental entity shall either approve or <ln numlevel="1" lineno="369" slineno="2-99"/>deny the request within five business days after the response time specified for the <ln numlevel="1" lineno="370" slineno="2-100"/>original request has expired;</subsection><subsection ssid="12-null-50" dnum="e-o" numlevel="1" lineno="371" slineno="2-101" level="2"><display>(e)</display>for claims under Subsection <xref depth="4" refnumber="63G-2-204(6)(g)" start="0">(6)(g)</xref>, the governmental entity shall fulfill the request <ln numlevel="1" lineno="372" slineno="2-102"/>within 15 business days from the date of the original request; or</subsection><subsection ssid="12-null-51" dnum="f-o" numlevel="1" lineno="373" slineno="2-103" level="2"><display>(f)</display>for claims under Subsection <xref depth="4" refnumber="63G-2-204(6)(h)" start="0">(6)(h)</xref>, the governmental entity shall complete its <ln numlevel="1" lineno="374" slineno="2-104"/>programming and disclose the requested records as soon as reasonably possible.</subsection></subsection><subsection ssid="12-null-52" dnum="8-o" numlevel="1" lineno="375" slineno="2-105" level="1" space="false"><display>(8)</display><subsection ssid="12-null-53" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a request for access is submitted to an office of a governmental entity other than <ln numlevel="1" lineno="376" slineno="2-106"/>that specified by rule in accordance with Subsection <xref depth="4" refnumber="63G-2-204(3)" start="0">(3)</xref>, the office shall promptly <ln numlevel="1" lineno="377" slineno="2-107"/>forward the request to the appropriate office.</subsection><subsection ssid="12-null-54" dnum="b-o" numlevel="1" lineno="378" slineno="2-108" level="2"><display>(b)</display>If the request is forwarded promptly, the time limit for response begins when the <ln numlevel="1" lineno="379" slineno="2-109"/>request is received by the office specified by rule.</subsection></subsection><subsection ssid="12-null-55" dnum="9-o" numlevel="1" lineno="380" slineno="2-110" level="1"><display>(9)</display>If the governmental entity fails to provide the requested records or issue a denial within <ln numlevel="1" lineno="381" slineno="2-111"/>the specified time period, that failure is considered the equivalent of a determination <ln numlevel="1" lineno="382" slineno="2-112"/>denying access to the record.</subsection></section></bsec><bsec buid="5" num="63G-2-307" type="amend" src="code" uid="C63G-2-S307_2026050620260506" sort="63G02 03070020260506" numlevel="1" lineno="383" slineno="3-1" sn="3"><section number="63G-2-307" numlevel="1" lineno="384" slineno="3-2" type="amend"><secline lineno="383">Section 3. Section <bold>63G-2-307</bold> is amended to read:</secline><catline lineno="384"><bold>63G-2-307<parens/>. Duty to evaluate records and make designations, classifications, and <ln numlevel="1" lineno="385" slineno="3-3"/>annotations.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="386" slineno="3-4" level="1" placement="noreturn"><display>(1)</display>A governmental entity shall, for each record series that the governmental entity keeps, <ln numlevel="1" lineno="387" slineno="3-5"/>uses, or creates:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="388" slineno="3-6" level="2"><display>(a)</display>evaluate all record series;</subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="389" slineno="3-7" level="2"><display>(b)</display>designate each record series as provided by this chapter and <xref depth="1" refnumber="63A-12" start="0">Title 63A, Chapter 12, <ln numlevel="1" lineno="390" slineno="3-8"/>Division of Archives and Records Service and Management of Government Records</xref>; <ln numlevel="1" lineno="391" slineno="3-9"/>and</subsection><subsection ssid="5-null-4" dnum="c-o" numlevel="1" lineno="392" slineno="3-10" level="2"><display>(c)</display>report to the state archives the designation described in Subsection <xref depth="4" refnumber="63G-2-307(1)(b)">(1)(b)</xref>.</subsection></subsection><subsection ssid="5-null-5" dnum="2-o" numlevel="1" lineno="393" slineno="3-11" level="1"><display>(2)</display>A governmental entity may classify a particular record, record series, or information <ln numlevel="1" lineno="394" slineno="3-12"/>within a record at any time, but is not required to classify a particular record, record <ln numlevel="1" lineno="395" slineno="3-13"/>series, or information until access to the record is requested.</subsection><subsection ssid="5-null-6" dnum="3-o" numlevel="1" lineno="396" slineno="3-14" level="1"><display>(3)</display>A governmental entity may redesignate a record series or reclassify a record or record <ln numlevel="1" lineno="397" slineno="3-15"/>series, or information within a record at any time.</subsection><subsection ssid="5-7" dnum="_-o:4-i" numlevel="1" lineno="398" slineno="3-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1198" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="5-9" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1199" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">An individual who authored, signed, or had other similar direct involvement in the <ln numlevel="1" lineno="399" slineno="3-17"/>creation of a record, record series, or information within a record may not make the <ln numlevel="1" lineno="400" slineno="3-18"/>final decision as to the record's, record series', or information's classification under <ln numlevel="1" lineno="401" slineno="3-19"/>this section.</amend></subsection><subsection ssid="5-10" dnum="_-o:b-i" numlevel="1" lineno="402" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1200" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">If a governmental entity classifies a record, a record series, or information within a <ln numlevel="1" lineno="403" slineno="3-21"/>record after a person requests access to the record or record series, an individual who <ln numlevel="1" lineno="404" slineno="3-22"/>is a subject of the record request may not make the final decision as to the record's, <ln numlevel="1" lineno="405" slineno="3-23"/>record series', or information's classification under this section.</amend></subsection></subsection></section></bsec><bsec buid="3" num="63G-2-401" type="amend" src="code" uid="C63G-2-S401_2026050620260506" sort="63G02 04010020260506" numlevel="1" lineno="406" slineno="4-1" sn="4"><section number="63G-2-401" numlevel="1" lineno="407" slineno="4-2" type="amend"><secline lineno="406">Section 4. Section <bold>63G-2-401</bold> is amended to read:</secline><catline lineno="407"><bold>63G-2-401<parens/>.  Appeal to chief administrative officer -- Notice of the decision of the <ln numlevel="1" lineno="408" slineno="4-3"/>appeal.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="409" slineno="4-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="3-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A requester or interested party may appeal an access denial or the denial of a fee <ln numlevel="1" lineno="410" slineno="4-5"/>waiver under Subsection <xref depth="4" refnumber="63G-2-203(4)">63G-2-203(4)</xref> to the chief administrative officer of the <ln numlevel="1" lineno="411" slineno="4-6"/>governmental entity by filing a notice of appeal with the chief administrative officer <ln numlevel="1" lineno="412" slineno="4-7"/>within 30 days after:<subsection ssid="3-null-3" dnum="i-o" numlevel="1" lineno="413" slineno="4-8" level="3" tab="1"><display>(i)</display>for an access denial:<subsection ssid="3-null-4" dnum="A-o" numlevel="1" lineno="414" slineno="4-9" level="4"><display>(A)</display>the governmental entity sends a notice of denial under Section <xref depth="3" refnumber="63G-2-205">63G-2-205</xref>, if <ln numlevel="1" lineno="415" slineno="4-10"/>the governmental entity denies a record request under Subsection <xref depth="4" refnumber="63G-2-205(1)">63G-2-205(1)</xref>; <ln numlevel="1" lineno="416" slineno="4-11"/>or</subsection><subsection ssid="3-null-5" dnum="B-o" numlevel="1" lineno="417" slineno="4-12" level="4"><display>(B)</display>the record request is considered denied under Subsection <xref depth="4" refnumber="63G-2-204(9)">63G-2-204(9)</xref>, if that <ln numlevel="1" lineno="418" slineno="4-13"/>subsection applies; or</subsection></subsection><subsection ssid="3-null-6" dnum="ii-o" numlevel="1" lineno="419" slineno="4-14" level="3" tab="1"><display>(ii)</display>for a denial of a fee waiver, the date the governmental entity notifies the requester <ln numlevel="1" lineno="420" slineno="4-15"/>that the fee waiver is denied.</subsection></subsection><subsection ssid="3-null-7" dnum="b-o" numlevel="1" lineno="421" slineno="4-16" level="2"><display>(b)</display>If a governmental entity claims extraordinary circumstances and specifies the date <ln numlevel="1" lineno="422" slineno="4-17"/>when the records will be available under Subsection <xref depth="4" refnumber="63G-2-204(4)">63G-2-204(4)</xref>, and, if the <ln numlevel="1" lineno="423" slineno="4-18"/>requester believes the extraordinary circumstances do not exist or that the date <ln numlevel="1" lineno="424" slineno="4-19"/>specified is unreasonable, the requester may appeal the governmental entity's claim <ln numlevel="1" lineno="425" slineno="4-20"/>of extraordinary circumstances or date for compliance to the chief administrative <ln numlevel="1" lineno="426" slineno="4-21"/>officer by filing a notice of appeal with the chief administrative officer within 30 <ln numlevel="1" lineno="427" slineno="4-22"/>days after notification of a claim of extraordinary circumstances by the governmental <ln numlevel="1" lineno="428" slineno="4-23"/>entity, despite the lack of a "determination" or its equivalent under Subsection <xref depth="4" refnumber="63G-2-204(9)"><ln numlevel="1" lineno="429" slineno="4-24"/>63G-2-204(9)</xref>.</subsection></subsection><subsection ssid="3-null-8" dnum="2-o" numlevel="1" lineno="430" slineno="4-25" level="1"><display>(2)</display>A notice of appeal shall contain:<subsection ssid="3-null-9" dnum="a-o" numlevel="1" lineno="431" slineno="4-26" level="2"><display>(a)</display>the name, mailing address, and daytime telephone number of the requester or <ln numlevel="1" lineno="432" slineno="4-27"/>interested party; and</subsection><subsection ssid="3-null-10" dnum="b-o" numlevel="1" lineno="433" slineno="4-28" level="2"><display>(b)</display>the relief sought.</subsection></subsection><subsection ssid="3-null-11" dnum="3-o" numlevel="1" lineno="434" slineno="4-29" level="1"><display>(3)</display>The requester or interested party may file a short statement of facts, reasons, and legal <ln numlevel="1" lineno="435" slineno="4-30"/>authority in support of the appeal.</subsection><subsection ssid="3-null-12" dnum="4-o" numlevel="1" lineno="436" slineno="4-31" level="1" space="false"><display>(4)</display><subsection ssid="3-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the appeal involves a record that is the subject of a business confidentiality <ln numlevel="1" lineno="437" slineno="4-32"/>claim under Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>, the chief administrative officer shall:<subsection ssid="3-null-14" dnum="i-o" numlevel="1" lineno="438" slineno="4-33" level="3" tab="1"><display>(i)</display>send notice of the appeal to the business confidentiality claimant within three <ln numlevel="1" lineno="439" slineno="4-34"/>business days after receiving notice, except that if notice under this section must <ln numlevel="1" lineno="440" slineno="4-35"/>be given to more than 35 persons, it shall be given as soon as reasonably possible; <ln numlevel="1" lineno="441" slineno="4-36"/>and</subsection><subsection ssid="3-null-15" dnum="ii-o" numlevel="1" lineno="442" slineno="4-37" level="3" tab="1"><display>(ii)</display>send notice of the business confidentiality claim and the schedule for the chief <ln numlevel="1" lineno="443" slineno="4-38"/>administrative officer's determination to the requester or interested party within <ln numlevel="1" lineno="444" slineno="4-39"/>three business days after receiving notice of the appeal.</subsection></subsection><subsection ssid="3-null-16" dnum="b-o" numlevel="1" lineno="445" slineno="4-40" level="2"><display>(b)</display>The business confidentiality claimant shall have seven business days after notice is <ln numlevel="1" lineno="446" slineno="4-41"/>sent by the administrative officer to submit further support for the claim of business <ln numlevel="1" lineno="447" slineno="4-42"/>confidentiality.</subsection></subsection><subsection ssid="3-null-17" dnum="5-o" numlevel="1" lineno="448" slineno="4-43" level="1" space="false"><display>(5)</display><subsection ssid="3-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The chief administrative officer shall make a decision on the appeal within:<subsection ssid="3-null-19" dnum="i-o" numlevel="1" lineno="449" slineno="4-44" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="3-null-20" dnum="A-o" level="4" placement="sameline"><display>(A)</display>10 business days after the chief administrative officer's receipt of the notice <ln numlevel="1" lineno="450" slineno="4-45"/>of appeal; or</subsection><subsection ssid="3-null-21" dnum="B-o" numlevel="1" lineno="451" slineno="4-46" level="4"><display>(B)</display>five business days after the chief administrative officer's receipt of the notice <ln numlevel="1" lineno="452" slineno="4-47"/>of appeal, if the requester or interested party demonstrates that an expedited <ln numlevel="1" lineno="453" slineno="4-48"/>decision benefits the public rather than the requester or interested party; or</subsection></subsection><subsection ssid="3-null-22" dnum="ii-o" numlevel="1" lineno="454" slineno="4-49" level="3" tab="1"><display>(ii)</display>12 business days after the governmental entity sends the notice of appeal to a <ln numlevel="1" lineno="455" slineno="4-50"/>person who submitted a claim of business confidentiality.</subsection></subsection><subsection ssid="3-null-23" dnum="b-o" numlevel="1" lineno="456" slineno="4-51" level="2" space="false"><display>(b)</display><subsection ssid="3-null-24" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the chief administrative officer fails to make a decision on an appeal of an <ln numlevel="1" lineno="457" slineno="4-52"/>access denial within the time specified in Subsection <xref depth="4" refnumber="63G-2-401(5)(a)">(5)(a)</xref>, the failure is the <ln numlevel="1" lineno="458" slineno="4-53"/>equivalent of a decision affirming the access denial.</subsection><subsection ssid="3-null-25" dnum="ii-o" numlevel="1" lineno="459" slineno="4-54" level="3"><display>(ii)</display>If the chief administrative officer fails to make a decision on an appeal under <ln numlevel="1" lineno="460" slineno="4-55"/>Subsection <xref depth="4" refnumber="63G-2-401(1)(b)">(1)(b)</xref> within the time specified in Subsection <xref depth="4" refnumber="63G-2-401(5)(a)">(5)(a)</xref>, the failure is the <ln numlevel="1" lineno="461" slineno="4-56"/>equivalent of a decision affirming the claim of extraordinary circumstances or the <ln numlevel="1" lineno="462" slineno="4-57"/>reasonableness of the date specified when the records will be available.</subsection></subsection><subsection ssid="3-null-26" dnum="c-o" numlevel="1" lineno="463" slineno="4-58" level="2"><display>(c)</display>The provisions of this section notwithstanding, the parties participating in the <ln numlevel="1" lineno="464" slineno="4-59"/>proceeding may, by agreement, extend the time periods specified in this section.</subsection></subsection><subsection ssid="3-null-27" dnum="6-o" numlevel="1" lineno="465" slineno="4-60" level="1"><display>(6)</display>Except as provided in Section <xref depth="3" refnumber="63G-2-406">63G-2-406</xref>, the chief administrative officer may, upon <ln numlevel="1" lineno="466" slineno="4-61"/>consideration and weighing of the various interests and public policies pertinent to the <ln numlevel="1" lineno="467" slineno="4-62"/>classification and disclosure or nondisclosure, order the disclosure of information <ln numlevel="1" lineno="468" slineno="4-63"/>properly classified as private under Subsection <xref depth="4" refnumber="63G-2-302(2)">63G-2-302(2)</xref> or protected under Section <xref depth="3" refnumber="63G-2-305"><ln numlevel="1" lineno="469" slineno="4-64"/>63G-2-305</xref> if the interests favoring access are greater than or equal to the interests <ln numlevel="1" lineno="470" slineno="4-65"/>favoring restriction of access.</subsection><subsection ssid="3-null-28" dnum="7-o" numlevel="1" lineno="471" slineno="4-66" level="1" space="false"><display>(7)</display><subsection ssid="3-null-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The governmental entity shall send written notice of the chief administrative <ln numlevel="1" lineno="472" slineno="4-67"/>officer's decision to all participants.</subsection><subsection ssid="3-null-30" dnum="b-o" numlevel="1" lineno="473" slineno="4-68" level="2"><display>(b)</display>If the chief administrative officer's decision is to affirm the access denial in whole or <ln numlevel="1" lineno="474" slineno="4-69"/>in part or to affirm the fee waiver denial, the notice under Subsection <xref depth="4" refnumber="63G-2-401(7)(a)">(7)(a)</xref> shall <ln numlevel="1" lineno="475" slineno="4-70"/>include:<subsection ssid="3-null-31" dnum="i-o" numlevel="1" lineno="476" slineno="4-71" level="3"><display>(i)</display>a statement that the requester has a right under Section <xref depth="3" refnumber="63A-12-204">63A-12-204</xref> to request the <ln numlevel="1" lineno="477" slineno="4-72"/>government records ombudsman to mediate the dispute between the requester and <ln numlevel="1" lineno="478" slineno="4-73"/>the governmental entity concerning the access denial or the fee waiver denial;</subsection><subsection ssid="3-null-32" dnum="ii-o" numlevel="1" lineno="479" slineno="4-74" level="3"><display>(ii)</display>a statement that the requester or interested party has the right to appeal the <ln numlevel="1" lineno="480" slineno="4-75"/>decision, as provided in Section <xref depth="3" refnumber="63G-2-402">63G-2-402</xref>, to:<subsection ssid="3-null-33" dnum="A-o" numlevel="1" lineno="481" slineno="4-76" level="4"><display>(A)</display>the director or district court; or</subsection><subsection ssid="3-null-34" dnum="B-o" numlevel="1" lineno="482" slineno="4-77" level="4"><display>(B)</display>the local appeals board, if the governmental entity is a political subdivision <ln numlevel="1" lineno="483" slineno="4-78"/>and the governmental entity has established a local appeals board;</subsection></subsection><subsection ssid="3-null-35" dnum="iii-o" numlevel="1" lineno="484" slineno="4-79" level="3"><display>(iii)</display>the time limits for filing an appeal described in Subsection <xref depth="4" refnumber="63G-2-401(7)(b)(ii)">(7)(b)(ii)</xref>, including <ln numlevel="1" lineno="485" slineno="4-80"/>an explanation of a suspension of the time limits, as provided in Subsections <xref depth="4" refnumber="63G-2-403(1)(c)"><ln numlevel="1" lineno="486" slineno="4-81"/>63G-2-403(1)(c)</xref> and <xref depth="4" refnumber="63G-2-404(1)(b)">63G-2-404(1)(b)</xref>, for a requester if the requester seeks <ln numlevel="1" lineno="487" slineno="4-82"/>mediation under Section <xref depth="3" refnumber="63A-12-204">63A-12-204</xref>; and</subsection><subsection ssid="3-null-36" dnum="iv-o" numlevel="1" lineno="488" slineno="4-83" level="3"><display>(iv)</display>the name and business address of:<subsection ssid="3-null-37" dnum="A-o" numlevel="1" lineno="489" slineno="4-84" level="4"><display>(A)</display>the director;</subsection><subsection ssid="3-null-38" dnum="B-o" numlevel="1" lineno="490" slineno="4-85" level="4"><display>(B)</display>the individual designated as the contact individual for the appeals board, if the <ln numlevel="1" lineno="491" slineno="4-86"/>governmental entity is a political subdivision that has established an appeals <ln numlevel="1" lineno="492" slineno="4-87"/>board under Subsection <xref depth="4" refnumber="63G-2-701(5)(c)">63G-2-701(5)(c)</xref>; and</subsection><subsection ssid="3-null-39" dnum="C-o" numlevel="1" lineno="493" slineno="4-88" level="4"><display>(C)</display>the government records ombudsman.</subsection></subsection></subsection></subsection><subsection ssid="3-null-40" dnum="8-o" numlevel="1" lineno="494" slineno="4-89" level="1" space="false"><display>(8)</display><subsection ssid="3-null-41" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A person aggrieved by a governmental entity's classification or designation <ln numlevel="1" lineno="495" slineno="4-90"/>determination under this chapter, but who is not requesting access to the records, may <ln numlevel="1" lineno="496" slineno="4-91"/>appeal that determination using the procedures provided in this section.  </subsection><subsection ssid="3-null-42" dnum="b-o" numlevel="1" lineno="497" slineno="4-92" level="2"><display>(b)</display>If a nonrequester is the only appellant, the procedures provided in this section shall <ln numlevel="1" lineno="498" slineno="4-93"/>apply, except that the decision on the appeal shall be made within 30 days after the <ln numlevel="1" lineno="499" slineno="4-94"/>day on which the appellant files the notice of appeal.</subsection></subsection><subsection ssid="3-null-43" dnum="9-o" numlevel="1" lineno="500" slineno="4-95" level="1" space="false"><display>(9)</display><subsection ssid="3-44" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1244" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>The duties of the chief administrative officer under this section may be delegated.</subsection><subsection ssid="3-45" dnum="_-o:b-i" numlevel="1" lineno="501" slineno="4-96" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1245" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">If the chief administrative officer is a subject of the records request that is the subject <ln numlevel="1" lineno="502" slineno="4-97"/>of an appeal under this section, the chief administrative officer:</amend><subsection ssid="3-46" dnum="_-o:i-i" numlevel="1" lineno="503" slineno="4-98" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1246" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">may not participate in the appeal; and</amend></subsection><subsection ssid="3-47" dnum="_-o:ii-i" numlevel="1" lineno="504" slineno="4-99" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1247" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">for purposes of the appeal, shall delegate to another individual the chief <ln numlevel="1" lineno="505" slineno="4-100"/>administrative officer's duties under this section.</amend></subsection></subsection></subsection></section></bsec><bsec buid="7" num="63G-2-701" type="amend" src="code" uid="C63G-2-S701_2026050620260506" sort="63G02 07010020260506" numlevel="1" lineno="506" slineno="5-1" sn="5"><section number="63G-2-701" numlevel="1" lineno="507" slineno="5-2" type="amend"><secline lineno="506">Section 5. Section <bold>63G-2-701</bold> is amended to read:</secline><catline lineno="507"><bold>63G-2-701<parens/>. Political subdivisions may adopt ordinances in compliance with <ln numlevel="1" lineno="508" slineno="5-3"/>chapter -- Appeal process.</bold></catline><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="509" slineno="5-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="7-null-2" dnum="a-o" numlevel="1" lineno="510" slineno="5-5" level="2"><display>(a)</display>"Access denial" means the same as that term is defined in Section <xref depth="3" refnumber="63G-2-400.5" start="0">63G-2-400.5</xref>.</subsection><subsection ssid="7-null-3" dnum="b-o" numlevel="1" lineno="511" slineno="5-6" level="2"><display>(b)</display>"Interested party" means the same as that term is defined in Section <xref depth="3" refnumber="63G-2-400.5" start="0">63G-2-400.5</xref>.</subsection><subsection ssid="7-null-4" dnum="c-o" numlevel="1" lineno="512" slineno="5-7" level="2"><display>(c)</display>"Requester" means the same as that term is defined in Section <xref depth="3" refnumber="63G-2-400.5" start="0">63G-2-400.5</xref>.</subsection></subsection><subsection ssid="7-null-5" dnum="2-o" numlevel="1" lineno="513" slineno="5-8" level="1" space="false"><display>(2)</display><subsection ssid="7-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each political subdivision may adopt an ordinance or a policy applicable <ln numlevel="1" lineno="514" slineno="5-9"/>throughout its jurisdiction relating to information practices including classification, <ln numlevel="1" lineno="515" slineno="5-10"/>designation, access, denials, segregation, appeals, management, retention, and <ln numlevel="1" lineno="516" slineno="5-11"/>amendment of records.</subsection><subsection ssid="7-null-7" dnum="b-o" numlevel="1" lineno="517" slineno="5-12" level="2"><display>(b)</display>The ordinance or policy shall comply with the criteria set forth in this section.</subsection><subsection ssid="7-null-8" dnum="c-o" numlevel="1" lineno="518" slineno="5-13" level="2"><display>(c)</display>If any political subdivision does not adopt and maintain an ordinance or policy, then <ln numlevel="1" lineno="519" slineno="5-14"/>that political subdivision is subject to this chapter.</subsection><subsection ssid="7-null-9" dnum="d-o" numlevel="1" lineno="520" slineno="5-15" level="2"><display>(d)</display>Notwithstanding the adoption of an ordinance or policy, each political subdivision is <ln numlevel="1" lineno="521" slineno="5-16"/>subject to <xref depth="2" refnumber="63G-2-1" start="2">Part 1, General Provisions</xref>, <xref depth="2" refnumber="63G-2-3" start="2">Part 3, Classification</xref>, and Sections <xref depth="3" refnumber="63A-12-105" start="0">63A-12-105</xref>, <xref depth="3" refnumber="63A-12-107" start="0"><ln numlevel="1" lineno="522" slineno="5-17"/>63A-12-107</xref>, <xref depth="3" refnumber="63G-2-201" start="0">63G-2-201</xref>, <xref depth="3" refnumber="63G-2-202" start="0">63G-2-202</xref>, <xref depth="3" refnumber="63G-2-205" start="0">63G-2-205</xref>, <xref depth="3" refnumber="63G-2-206" start="0">63G-2-206</xref>, <xref depth="3" refnumber="63G-2-601" start="0">63G-2-601</xref>, and <xref depth="3" refnumber="63G-2-602" start="0"><ln numlevel="1" lineno="523" slineno="5-18"/>63G-2-602</xref>.</subsection><subsection ssid="7-null-10" dnum="e-o" numlevel="1" lineno="524" slineno="5-19" level="2"><display>(e)</display>Every ordinance, policy, or amendment to the ordinance or policy shall be filed with <ln numlevel="1" lineno="525" slineno="5-20"/>the state archives no later than 30 days after its effective date.</subsection><subsection ssid="7-null-11" dnum="f-o" numlevel="1" lineno="526" slineno="5-21" level="2"><display>(f)</display>The political subdivision shall also report to the state archives all retention schedules, <ln numlevel="1" lineno="527" slineno="5-22"/>and all designations and classifications applied to record series maintained by the <ln numlevel="1" lineno="528" slineno="5-23"/>political subdivision.</subsection><subsection ssid="7-null-12" dnum="g-o" numlevel="1" lineno="529" slineno="5-24" level="2"><display>(g)</display>The report required by Subsection <xref depth="4" refnumber="63G-2-701(2)(f)" start="0">(2)(f)</xref> is notification to state archives of the <ln numlevel="1" lineno="530" slineno="5-25"/>political subdivision's retention schedules, designations, and classifications.  The <ln numlevel="1" lineno="531" slineno="5-26"/>report is not subject to approval by state archives.  If state archives determines that a <ln numlevel="1" lineno="532" slineno="5-27"/>different retention schedule is needed for state purposes, state archives shall notify <ln numlevel="1" lineno="533" slineno="5-28"/>the political subdivision of the state's retention schedule for the records and shall <ln numlevel="1" lineno="534" slineno="5-29"/>maintain the records if requested to do so under Subsection <xref depth="4" refnumber="63A-12-105(2)" start="0">63A-12-105(2)</xref>.</subsection></subsection><subsection ssid="7-null-13" dnum="3-o" numlevel="1" lineno="535" slineno="5-30" level="1"><display>(3)</display>Each ordinance or policy relating to information practices shall:<subsection ssid="7-null-14" dnum="a-o" numlevel="1" lineno="536" slineno="5-31" level="2"><display>(a)</display>provide standards for the classification and designation of the records of the political <ln numlevel="1" lineno="537" slineno="5-32"/>subdivision as public, private, controlled, or protected in accordance with <xref depth="2" refnumber="63G-2-3" start="2">Part 3, <ln numlevel="1" lineno="538" slineno="5-33"/>Classification</xref>;</subsection><subsection ssid="7-null-15" dnum="b-o" numlevel="1" lineno="539" slineno="5-34" level="2"><display>(b)</display>require the classification of the records of the political subdivision in accordance <ln numlevel="1" lineno="540" slineno="5-35"/>with those standards;</subsection><subsection ssid="7-null-16" dnum="c-o" numlevel="1" lineno="541" slineno="5-36" level="2"><display>(c)</display>provide guidelines for establishment of fees in accordance with Section <xref depth="3" refnumber="63G-2-203" start="0">63G-2-203</xref>; <ln numlevel="1" lineno="542" slineno="5-37"/>and</subsection><subsection ssid="7-null-17" dnum="d-o" numlevel="1" lineno="543" slineno="5-38" level="2"><display>(d)</display>provide standards for the management and retention of the records of the political <ln numlevel="1" lineno="544" slineno="5-39"/>subdivision comparable to Section <xref depth="3" refnumber="63A-12-103" start="0">63A-12-103</xref>.</subsection></subsection><subsection ssid="7-null-18" dnum="4-o" numlevel="1" lineno="545" slineno="5-40" level="1" space="false"><display>(4)</display><subsection ssid="7-null-19" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each ordinance or policy shall<amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="7-39" dnum="_-o:i-i" numlevel="1" lineno="546" slineno="5-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1267" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>establish access criteria, procedures, and response times for requests to inspect, <ln numlevel="1" lineno="547" slineno="5-42"/>obtain, or amend records of the political subdivision<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">, and </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="7-40" dnum="_-o:ii-i" numlevel="1" lineno="548" slineno="5-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1268" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">prohibit an individual who is a subject of a record request from participating in <ln numlevel="1" lineno="549" slineno="5-44"/>the political subdivision's review of and response to the record request; and</amend></subsection><subsection ssid="7-41" dnum="_-o:iii-i" numlevel="1" lineno="550" slineno="5-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1269" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">establish </amend>time limits for appeals consistent with this chapter.</subsection></subsection><subsection ssid="7-null-20" dnum="b-o" numlevel="1" lineno="551" slineno="5-46" level="2"><display>(b)</display>In establishing response times for access requests and time limits for appeals, the <ln numlevel="1" lineno="552" slineno="5-47"/>political subdivision may establish reasonable time frames different than those set out <ln numlevel="1" lineno="553" slineno="5-48"/>in Section <xref depth="3" refnumber="63G-2-204" start="0">63G-2-204</xref> and <xref depth="2" refnumber="63G-2-4" start="2">Part 4, Appeals</xref>, if it determines that the resources of the <ln numlevel="1" lineno="554" slineno="5-49"/>political subdivision are insufficient to meet the requirements of those sections.</subsection></subsection><subsection ssid="7-null-21" dnum="5-o" numlevel="1" lineno="555" slineno="5-50" level="1" space="false"><display>(5)</display><subsection ssid="7-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A political subdivision shall establish an appeals process for persons aggrieved by <ln numlevel="1" lineno="556" slineno="5-51"/>classification, designation, or access decisions.</subsection><subsection ssid="7-null-23" dnum="b-o" numlevel="1" lineno="557" slineno="5-52" level="2"><display>(b)</display>A political subdivision's appeals process shall include a process for a requester or <ln numlevel="1" lineno="558" slineno="5-53"/>interested party to appeal an access denial to a person designated by the political <ln numlevel="1" lineno="559" slineno="5-54"/>subdivision as the chief administrative officer for purposes of an appeal under <ln numlevel="1" lineno="560" slineno="5-55"/>Section <xref depth="3" refnumber="63G-2-401" start="0">63G-2-401</xref>.</subsection><subsection ssid="7-null-24" dnum="c-o" numlevel="1" lineno="561" slineno="5-56" level="2" space="false"><display>(c)</display><subsection ssid="7-null-25" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A political subdivision may establish an appeals board to decide an appeal of a <ln numlevel="1" lineno="562" slineno="5-57"/>decision of the chief administrative officer affirming an access denial.</subsection><subsection ssid="7-null-26" dnum="ii-o" numlevel="1" lineno="563" slineno="5-58" level="3"><display>(ii)</display>An appeals board established by a political subdivision shall be composed of <ln numlevel="1" lineno="564" slineno="5-59"/>three members:<subsection ssid="7-null-27" dnum="A-o" numlevel="1" lineno="565" slineno="5-60" level="4"><display>(A)</display>one of whom shall be an employee of the political subdivision; and</subsection><subsection ssid="7-null-28" dnum="B-o" numlevel="1" lineno="566" slineno="5-61" level="4"><display>(B)</display>two of whom shall be members of the public who are not employed by or <ln numlevel="1" lineno="567" slineno="5-62"/>officials of a governmental entity, at least one of whom shall have professional <ln numlevel="1" lineno="568" slineno="5-63"/>experience with requesting or managing records.</subsection></subsection><subsection ssid="7-null-29" dnum="iii-o" numlevel="1" lineno="569" slineno="5-64" level="3"><display>(iii)</display>If a political subdivision establishes an appeals board, any appeal of a decision of <ln numlevel="1" lineno="570" slineno="5-65"/>a chief administrative officer shall be made to the appeals board.</subsection><subsection ssid="7-null-30" dnum="iv-o" numlevel="1" lineno="571" slineno="5-66" level="3"><display>(iv)</display>If a political subdivision does not establish an appeals board, the political <ln numlevel="1" lineno="572" slineno="5-67"/>subdivision's appeals process shall provide for an appeal of a chief administrative <ln numlevel="1" lineno="573" slineno="5-68"/>officer's decision to the director of the Government Records Office, as provided in <ln numlevel="1" lineno="574" slineno="5-69"/>Section <xref depth="3" refnumber="63G-2-403" start="0">63G-2-403</xref>.</subsection></subsection><subsection ssid="7-38" dnum="_-o:d-i" numlevel="1" lineno="575" slineno="5-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1281" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">A political subdivision's appeals process shall prohibit an individual who is a subject <ln numlevel="1" lineno="576" slineno="5-71"/>of a records request from participating in an appeal of a decision related to the <ln numlevel="1" lineno="577" slineno="5-72"/>records request.</amend></subsection></subsection><subsection ssid="7-null-31" dnum="6-o" numlevel="1" lineno="578" slineno="5-73" level="1" space="false"><display>(6)</display><subsection ssid="7-null-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A political subdivision or requester may appeal an appeals board decision:<subsection ssid="7-null-33" dnum="i-o" numlevel="1" lineno="579" slineno="5-74" level="3" tab="1"><display>(i)</display>to the director of the Government Records Office, as provided in Section <xref depth="3" refnumber="63G-2-403" start="0"><ln numlevel="1" lineno="580" slineno="5-75"/>63G-2-403</xref>; or</subsection><subsection ssid="7-null-34" dnum="ii-o" numlevel="1" lineno="581" slineno="5-76" level="3" tab="1"><display>(ii)</display>by filing a petition for judicial review with the district court.</subsection></subsection><subsection ssid="7-null-35" dnum="b-o" numlevel="1" lineno="582" slineno="5-77" level="2"><display>(b)</display>The contents of a petition for judicial review under Subsection <xref depth="4" refnumber="63G-2-701(6)(a)(ii)" start="0">(6)(a)(ii)</xref> and the <ln numlevel="1" lineno="583" slineno="5-78"/>conduct of the proceeding shall be in accordance with Sections <xref depth="3" refnumber="63G-2-402" start="0">63G-2-402</xref> and <xref depth="3" refnumber="63G-2-404" start="0"><ln numlevel="1" lineno="584" slineno="5-79"/>63G-2-404</xref>.</subsection><subsection ssid="7-null-36" dnum="c-o" numlevel="1" lineno="585" slineno="5-80" level="2"><display>(c)</display>A person who appeals an appeals board decision to the director of the Government <ln numlevel="1" lineno="586" slineno="5-81"/>Records Office does not lose or waive the right to seek judicial review of the decision <ln numlevel="1" lineno="587" slineno="5-82"/>of the director of the Government Records Office.</subsection></subsection><subsection ssid="7-null-37" dnum="7-o" numlevel="1" lineno="588" slineno="5-83" level="1"><display>(7)</display>Any political subdivision that adopts an ordinance or policy under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63G-2-701(1)" start="0">(1)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)</amend> <ln numlevel="1" lineno="589" slineno="5-84"/>shall forward to state archives a copy and summary description of the ordinance or <ln numlevel="1" lineno="590" slineno="5-85"/>policy.</subsection></section></bsec><bsec buid="13" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="591" slineno="6-1" sn="6"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="591">Section 6.  <bold>Effective Date.</bold></secline><sectionText lineno="592"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-12-26 9:14 AM</tm></rev></foot></leg>
