Section <bold>18-1-1</bold> is amended to read:</secline><catline lineno="25"><bold>18-1-1<parens/>. Liability and damages for dog injury -- Exceptions.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="26" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="5-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsections <xref depth="4" refnumber="18-1-1(2)">(2)</xref> and <xref depth="4" refnumber="18-1-1(3)">(3)</xref>, an individual who owns or keeps a <ln numlevel="1" lineno="27" slineno="1-4"/>dog is liable for an injury caused by the dog, regardless of whether:<subsection ssid="5-null-3" dnum="i-o" numlevel="1" lineno="28" slineno="1-5" level="3" tab="1"><display>(i)</display>the dog is vicious or mischievous; or</subsection><subsection ssid="5-null-4" dnum="ii-o" numlevel="1" lineno="29" slineno="1-6" level="3" tab="1"><display>(ii)</display>the owner knows the dog is vicious or mischievous.</subsection></subsection><subsection ssid="5-null-5" dnum="b-o" numlevel="1" lineno="30" slineno="1-7" level="2"><display>(b)</display>Damages for an injury described in Subsection <xref depth="4" refnumber="18-1-1(1)(a)">(1)(a)</xref> shall be determined in <ln numlevel="1" lineno="31" slineno="1-8"/>accordance with Section <xref depth="3" refnumber="78B-5-818">78B-5-818</xref>.</subsection><subsection ssid="5-24" dnum="_-o:c-i" numlevel="1" lineno="32" slineno="1-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">An individual may bring a claim for damages resulting from an injury caused by a <ln numlevel="1" lineno="33" slineno="1-10"/>dog under this section no later than four years after the day on which the injury <ln numlevel="1" lineno="34" slineno="1-11"/>occurs, in accordance with Section <xref depth="3" refnumber="78B-2-307">78B-2-307</xref>.</amend></subsection></subsection><subsection ssid="5-null-6" dnum="2-o" numlevel="1" lineno="35" slineno="1-12" level="1"><display>(2)</display>Neither the state nor any county, city, or town in the state nor any peace officer <ln numlevel="1" lineno="36" slineno="1-13"/>employed by the state, a county, a city, or a town is liable in damages for an injury <ln numlevel="1" lineno="37" slineno="1-14"/>caused by a dog, if:<subsection ssid="5-null-7" dnum="a-o" numlevel="1" lineno="38" slineno="1-15" level="2"><display>(a)</display>the dog and the dog's law enforcement handler are trained to assist in law <ln numlevel="1" lineno="39" slineno="1-16"/>enforcement and are certified according to the standards adopted in Title 53, Chapter <ln numlevel="1" lineno="40" slineno="1-17"/>6, Part 4, Law Enforcement Canine Team Certification Act;</subsection><subsection ssid="5-null-8" dnum="b-o" numlevel="1" lineno="41" slineno="1-18" level="2"><display>(b)</display>the governmental agency has adopted a written policy on the necessary and <ln numlevel="1" lineno="42" slineno="1-19"/>appropriate use of dogs in official law enforcement duties;</subsection><subsection ssid="5-null-9" dnum="c-o" numlevel="1" lineno="43" slineno="1-20" level="2"><display>(c)</display>the actions of the dog's handler do not violate the agency's written policy; and</subsection><subsection ssid="5-null-10" dnum="d-o" numlevel="1" lineno="44" slineno="1-21" level="2"><display>(d)</display>the injury occurs while the dog is reasonably and carefully being used in the <ln numlevel="1" lineno="45" slineno="1-22"/>apprehension, arrest, or location of a suspected offender or in maintaining or <ln numlevel="1" lineno="46" slineno="1-23"/>controlling the public order.</subsection></subsection><subsection ssid="5-null-11" dnum="3-o" numlevel="1" lineno="47" slineno="1-24" level="1"><display>(3)</display>An individual who owns or keeps a dog is not liable for an injury or death caused by the <ln numlevel="1" lineno="48" slineno="1-25"/>dog if:<subsection ssid="5-null-12" dnum="a-o" numlevel="1" lineno="49" slineno="1-26" level="2" space="false"><display>(a)</display><subsection ssid="5-null-13" dnum="i-o" level="3" placement="sameline"><display>(i)</display>the injury or death is to another animal;</subsection><subsection ssid="5-null-14" dnum="ii-o" numlevel="1" lineno="50" slineno="1-27" level="3"><display>(ii)</display>the injury or death occurs:<subsection ssid="5-null-15" dnum="A-o" numlevel="1" lineno="51" slineno="1-28" level="4"><display>(A)</display>on the individual's private property; and</subsection><subsection ssid="5-null-16" dnum="B-o" numlevel="1" lineno="52" slineno="1-29" level="4"><display>(B)</display>while the dog is reasonably secured within a fence or other enclosure; and</subsection></subsection><subsection ssid="5-null-17" dnum="iii-o" numlevel="1" lineno="53" slineno="1-30" level="3"><display>(iii)</display>the animal described in Subsection <xref depth="4" refnumber="18-1-1(3)(a)">(3)(a)</xref> entered the individual's private <ln numlevel="1" lineno="54" slineno="1-31"/>property without consent; or</subsection></subsection><subsection ssid="5-null-18" dnum="b-o" numlevel="1" lineno="55" slineno="1-32" level="2" space="false"><display>(b)</display><subsection ssid="5-null-19" dnum="i-o" level="3" placement="sameline"><display>(i)</display>the injury or death is to a trespasser who is in violation of Subsection <xref tempid="593" depth="4" refnumber="76-6-206(2)"><ln numlevel="1" lineno="56" slineno="1-33"/>76-6-206(2)</xref>; and</subsection><subsection ssid="5-null-20" dnum="ii-o" numlevel="1" lineno="57" slineno="1-34" level="3"><display>(ii)</display>the injury or death occurs:<subsection ssid="5-null-21" dnum="A-o" numlevel="1" lineno="58" slineno="1-35" level="4"><display>(A)</display>on the individual's private property; and</subsection><subsection ssid="5-null-22" dnum="B-o" numlevel="1" lineno="59" slineno="1-36" level="4"><display>(B)</display>while the dog is reasonably secured within a fence or other enclosure.</subsection></subsection></subsection></subsection></section></bsec><bsec buid="1" num="18-1-4" type="amend" src="code" uid="C18-1-S4_2026050620260506" sort="18 01 00040020260506" numlevel="1" lineno="60" slineno="2-1" sn="2"><section number="18-1-4" numlevel="1" lineno="61" slineno="2-2" type="amend"><secline lineno="60">Section 2. Section <bold>18-1-4</bold> is amended to read:</secline><catline lineno="61"><bold>18-1-4<parens/>. Use of arbitration in personal injury from dog attack cases.</bold></catline><subsection ssid="1-null-78" dnum="1-o" numlevel="1" lineno="62" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>A person injured as a result of a dog attack may elect to submit all third party bodily <ln numlevel="1" lineno="63" slineno="2-4"/>injury claims to arbitration by filing a notice of the submission of the claim to binding <ln numlevel="1" lineno="64" slineno="2-5"/>arbitration in a court if:<subsection ssid="1-null-79" dnum="a-o" numlevel="1" lineno="65" slineno="2-6" level="2"><display>(a)</display>the claimant or the claimant's representative has:<subsection ssid="1-null-80" dnum="i-o" numlevel="1" lineno="66" slineno="2-7" level="3"><display>(i)</display>previously and timely filed a complaint in a court that includes a third party bodily <ln numlevel="1" lineno="67" slineno="2-8"/>injury claim; and</subsection><subsection ssid="1-null-81" dnum="ii-o" numlevel="1" lineno="68" slineno="2-9" level="3"><display>(ii)</display>filed a notice to submit the claim to arbitration within 14 days after the complaint <ln numlevel="1" lineno="69" slineno="2-10"/>has been answered; and</subsection></subsection><subsection ssid="1-null-82" dnum="b-o" numlevel="1" lineno="70" slineno="2-11" level="2"><display>(b)</display>the notice required under Subsection <xref depth="4" refnumber="18-1-4(1)(a)(ii)">(1)(a)(ii)</xref> is filed while the action under <ln numlevel="1" lineno="71" slineno="2-12"/>Subsection <xref depth="4" refnumber="18-1-4(1)(a)(i)">(1)(a)(i)</xref> is still pending.</subsection></subsection><subsection ssid="1-null-83" dnum="2-o" numlevel="1" lineno="72" slineno="2-13" level="1" space="false"><display>(2)</display><subsection ssid="1-null-84" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="2" style="2" owner="jchristopherson" level="1" deltag="both">If</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except for a wrongful death action described in Section <xref depth="3" refnumber="78B-3-106">78B-3-106</xref>, if</amend> a party <ln numlevel="1" lineno="73" slineno="2-14"/>submits a bodily injury claim to arbitration under Subsection <xref depth="4" refnumber="18-1-4(1)">(1)</xref>, the party submitting <ln numlevel="1" lineno="74" slineno="2-15"/>the claim or the party's representative is limited to an arbitration award that may not <ln numlevel="1" lineno="75" slineno="2-16"/>exceed <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">$50,000</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">$75,000</amend> in addition to any medical premise benefits and any claim <ln numlevel="1" lineno="76" slineno="2-17"/>for property damage.</subsection><subsection ssid="1-null-85" dnum="b-o" numlevel="1" lineno="77" slineno="2-18" level="2"><display>(b)</display>A party who elects to proceed against a defendant under this section:<subsection ssid="1-null-86" dnum="i-o" numlevel="1" lineno="78" slineno="2-19" level="3"><display>(i)</display>waives the right to obtain a judgment against the personal assets of the defendant; <ln numlevel="1" lineno="79" slineno="2-20"/>and</subsection><subsection ssid="1-null-87" dnum="ii-o" numlevel="1" lineno="80" slineno="2-21" level="3"><display>(ii)</display>is limited to recovery only against available limits of insurance coverage.</subsection></subsection></subsection><subsection ssid="1-null-88" dnum="3-o" numlevel="1" lineno="81" slineno="2-22" level="1"><display>(3)</display>A claim for punitive damages may not be made in an arbitration proceeding under <ln numlevel="1" lineno="82" slineno="2-23"/>Subsection <xref depth="4" refnumber="18-1-4(1)">(1)</xref> or any subsequent proceeding, even if the claim is later resolved through <ln numlevel="1" lineno="83" slineno="2-24"/>a trial de novo under Subsection <xref depth="4" refnumber="18-1-4(11)">(11)</xref>.</subsection><subsection ssid="1-null-89" dnum="4-o" numlevel="1" lineno="84" slineno="2-25" level="1" space="false"><display>(4)</display><subsection ssid="1-null-90" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A party who has elected arbitration under this section may rescind the party's <ln numlevel="1" lineno="85" slineno="2-26"/>election if the rescission is made within:<subsection ssid="1-null-91" dnum="i-o" numlevel="1" lineno="86" slineno="2-27" level="3" tab="1"><display>(i)</display>90 days after the election to arbitrate; and</subsection><subsection ssid="1-null-92" dnum="ii-o" numlevel="1" lineno="87" slineno="2-28" level="3" tab="1"><display>(ii)</display>no less than 30 days before any scheduled arbitration hearing.</subsection></subsection><subsection ssid="1-null-93" dnum="b-o" numlevel="1" lineno="88" slineno="2-29" level="2"><display>(b)</display>A party seeking to rescind an election to arbitrate under this Subsection <xref depth="4" refnumber="18-1-4(4)">(4)</xref> shall:<subsection ssid="1-null-94" dnum="i-o" numlevel="1" lineno="89" slineno="2-30" level="3"><display>(i)</display>file a notice of the rescission of the election to arbitrate with the court in which the <ln numlevel="1" lineno="90" slineno="2-31"/>matter was filed; and</subsection><subsection ssid="1-null-95" dnum="ii-o" numlevel="1" lineno="91" slineno="2-32" level="3"><display>(ii)</display>send copies of the notice of the rescission of the election to arbitrate to all counsel <ln numlevel="1" lineno="92" slineno="2-33"/>of record to the action.</subsection></subsection><subsection ssid="1-null-96" dnum="c-o" numlevel="1" lineno="93" slineno="2-34" level="2"><display>(c)</display>All discovery completed in anticipation of the arbitration hearing shall be available <ln numlevel="1" lineno="94" slineno="2-35"/>for use by the parties as allowed by the Utah Rules of Civil Procedure and the Utah <ln numlevel="1" lineno="95" slineno="2-36"/>Rules of Evidence.</subsection><subsection ssid="1-null-97" dnum="d-o" numlevel="1" lineno="96" slineno="2-37" level="2"><display>(d)</display>A party who has elected to arbitrate under this section and then rescinded the <ln numlevel="1" lineno="97" slineno="2-38"/>election to arbitrate under this Subsection <xref depth="4" refnumber="18-1-4(4)">(4)</xref> may not elect to arbitrate the claim <ln numlevel="1" lineno="98" slineno="2-39"/>under this section again.</subsection></subsection><subsection ssid="1-null-98" dnum="5-o" numlevel="1" lineno="99" slineno="2-40" level="1" space="false"><display>(5)</display><subsection ssid="1-null-99" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Unless otherwise agreed to by the parties or by order of the court, an arbitration <ln numlevel="1" lineno="100" slineno="2-41"/>process elected under this section is subject to Rule 26, Utah Rules of Civil <ln numlevel="1" lineno="101" slineno="2-42"/>Procedure.</subsection><subsection ssid="1-null-100" dnum="b-o" numlevel="1" lineno="102" slineno="2-43" level="2"><display>(b)</display>Unless otherwise agreed to by the parties or ordered by the court, discovery shall be <ln numlevel="1" lineno="103" slineno="2-44"/>completed within 150 days after the date arbitration is elected under this section or <ln numlevel="1" lineno="104" slineno="2-45"/>the date the answer is filed, whichever is longer.</subsection></subsection><subsection ssid="1-null-101" dnum="6-o" numlevel="1" lineno="105" slineno="2-46" level="1" space="false"><display>(6)</display><subsection ssid="1-null-102" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Unless otherwise agreed to in writing by the parties, a claim that is submitted to <ln numlevel="1" lineno="106" slineno="2-47"/>arbitration under this section shall be resolved by a single arbitrator.</subsection><subsection ssid="1-null-103" dnum="b-o" numlevel="1" lineno="107" slineno="2-48" level="2"><display>(b)</display>Unless otherwise agreed to by the parties or ordered by the court, all parties shall <ln numlevel="1" lineno="108" slineno="2-49"/>agree on the single arbitrator selected under Subsection <xref depth="4" refnumber="18-1-4(6)(a)">(6)(a)</xref> within 90 days of the <ln numlevel="1" lineno="109" slineno="2-50"/>answer of the defendant.</subsection><subsection ssid="1-null-104" dnum="c-o" numlevel="1" lineno="110" slineno="2-51" level="2"><display>(c)</display>If the parties are unable to agree on a single arbitrator as required under Subsection <xref depth="4" refnumber="18-1-4(6)(b)"><ln numlevel="1" lineno="111" slineno="2-52"/>(6)(b)</xref>, the parties shall select a panel of three arbitrators.</subsection><subsection ssid="1-null-105" dnum="d-o" numlevel="1" lineno="112" slineno="2-53" level="2"><display>(d)</display>If the parties select a panel of three arbitrators under Subsection <xref depth="4" refnumber="18-1-4(6)(c)">(6)(c)</xref>:<subsection ssid="1-null-106" dnum="i-o" numlevel="1" lineno="113" slineno="2-54" level="3"><display>(i)</display>each side shall select one arbitrator; and</subsection><subsection ssid="1-null-107" dnum="ii-o" numlevel="1" lineno="114" slineno="2-55" level="3"><display>(ii)</display>the arbitrators selected under Subsection <xref depth="4" refnumber="18-1-4(6)(d)(i)">(6)(d)(i)</xref> shall select one additional <ln numlevel="1" lineno="115" slineno="2-56"/>arbitrator to be included in the panel.</subsection></subsection></subsection><subsection ssid="1-null-108" dnum="7-o" numlevel="1" lineno="116" slineno="2-57" level="1"><display>(7)</display>Unless otherwise agreed to in writing:<subsection ssid="1-null-109" dnum="a-o" numlevel="1" lineno="117" slineno="2-58" level="2"><display>(a)</display>each party shall pay an equal share of the fees and costs of the arbitrator selected <ln numlevel="1" lineno="118" slineno="2-59"/>under Subsection <xref depth="4" refnumber="18-1-4(6)(a)">(6)(a)</xref>; and</subsection><subsection ssid="1-null-110" dnum="b-o" numlevel="1" lineno="119" slineno="2-60" level="2"><display>(b)</display>if an arbitration panel is selected under Subsection <xref depth="4" refnumber="18-1-4(6)(d)">(6)(d)</xref>:<subsection ssid="1-null-111" dnum="i-o" numlevel="1" lineno="120" slineno="2-61" level="3"><display>(i)</display>each party shall pay the fees and costs of the arbitrator selected by that party's <ln numlevel="1" lineno="121" slineno="2-62"/>side; and</subsection><subsection ssid="1-null-112" dnum="ii-o" numlevel="1" lineno="122" slineno="2-63" level="3"><display>(ii)</display>each party shall pay an equal share of the fees and costs of the arbitrator selected <ln numlevel="1" lineno="123" slineno="2-64"/>under Subsection <xref depth="4" refnumber="18-1-4(6)(d)(ii)">(6)(d)(ii)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-113" dnum="8-o" numlevel="1" lineno="124" slineno="2-65" level="1"><display>(8)</display>Except as otherwise provided in this section and unless otherwise agreed to in writing <ln numlevel="1" lineno="125" slineno="2-66"/>by the parties, an arbitration proceeding conducted under this section shall be governed <ln numlevel="1" lineno="126" slineno="2-67"/>by Title 78B, Chapter 11, Utah Uniform Arbitration Act.</subsection><subsection ssid="1-null-114" dnum="9-o" numlevel="1" lineno="127" slineno="2-68" level="1" space="false"><display>(9)</display><subsection ssid="1-null-115" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to the provisions of this section, the Utah Rules of Civil Procedure and the <ln numlevel="1" lineno="128" slineno="2-69"/>Utah Rules of Evidence apply to the arbitration proceeding.</subsection><subsection ssid="1-null-116" dnum="b-o" numlevel="1" lineno="129" slineno="2-70" level="2"><display>(b)</display>The Utah Rules of Civil Procedure and the Utah Rules of Evidence shall be applied <ln numlevel="1" lineno="130" slineno="2-71"/>liberally with the intent of concluding the claim in a timely and cost-efficient manner.</subsection><subsection ssid="1-null-117" dnum="c-o" numlevel="1" lineno="131" slineno="2-72" level="2"><display>(c)</display>Discovery shall be conducted in accordance with the Utah Rules of Civil Procedure <ln numlevel="1" lineno="132" slineno="2-73"/>and shall be subject to the jurisdiction of the court in which the matter is filed.</subsection><subsection ssid="1-null-118" dnum="d-o" numlevel="1" lineno="133" slineno="2-74" level="2"><display>(d)</display>Dispositive motions shall be filed, heard, and decided by the court prior to the <ln numlevel="1" lineno="134" slineno="2-75"/>arbitration proceeding in accordance with the court's scheduling order.</subsection></subsection><subsection ssid="1-null-119" dnum="10-o" numlevel="1" lineno="135" slineno="2-76" level="1"><display>(10)</display>A written decision by a single arbitrator or by a majority of the arbitration panel shall <ln numlevel="1" lineno="136" slineno="2-77"/>constitute a final decision.</subsection><subsection ssid="1-null-120" dnum="11-o" numlevel="1" lineno="137" slineno="2-78" level="1"><display>(11)</display>An arbitration award issued under this section shall be the final resolution of all bodily <ln numlevel="1" lineno="138" slineno="2-79"/>injury claims between the parties and may be reduced to judgment by the court upon <ln numlevel="1" lineno="139" slineno="2-80"/>motion and notice unless:<subsection ssid="1-null-121" dnum="a-o" numlevel="1" lineno="140" slineno="2-81" level="2"><display>(a)</display>either party, within 20 days after service of the arbitration award:<subsection ssid="1-null-122" dnum="i-o" numlevel="1" lineno="141" slineno="2-82" level="3"><display>(i)</display>files a notice requesting a trial de novo in the court; and</subsection><subsection ssid="1-null-123" dnum="ii-o" numlevel="1" lineno="142" slineno="2-83" level="3"><display>(ii)</display>serves the nonmoving party with a copy of the notice requesting a trial de novo <ln numlevel="1" lineno="143" slineno="2-84"/>under Subsection <xref depth="4" refnumber="18-1-4(11)(a)(i)">(11)(a)(i)</xref>; or</subsection></subsection><subsection ssid="1-null-124" dnum="b-o" numlevel="1" lineno="144" slineno="2-85" level="2"><display>(b)</display>the arbitration award has been satisfied.</subsection></subsection><subsection ssid="1-null-125" dnum="12-o" numlevel="1" lineno="145" slineno="2-86" level="1" space="false"><display>(12)</display><subsection ssid="1-null-126" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Upon filing a notice requesting a trial de novo under Subsection <xref depth="4" refnumber="18-1-4(11)">(11)</xref>:<subsection ssid="1-null-127" dnum="i-o" numlevel="1" lineno="146" slineno="2-87" level="3" tab="1"><display>(i)</display>unless otherwise stipulated to by the parties or ordered by the court, an additional <ln numlevel="1" lineno="147" slineno="2-88"/>90 days shall be allowed for further discovery;</subsection><subsection ssid="1-null-128" dnum="ii-o" numlevel="1" lineno="148" slineno="2-89" level="3" tab="1"><display>(ii)</display>the additional discovery time under Subsection <xref depth="4" refnumber="18-1-4(12)(a)(i)">(12)(a)(i)</xref> shall run from the notice <ln numlevel="1" lineno="149" slineno="2-90"/>of appeal; and</subsection><subsection ssid="1-null-129" dnum="iii-o" numlevel="1" lineno="150" slineno="2-91" level="3" tab="1"><display>(iii)</display>the claim shall proceed through litigation <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in accordance with</amend> the <ln numlevel="1" lineno="151" slineno="2-92"/>Utah Rules of Civil Procedure and the Utah Rules of Evidence in the court.</subsection></subsection><subsection ssid="1-null-130" dnum="b-o" numlevel="1" lineno="152" slineno="2-93" level="2"><display>(b)</display>In accordance with the Utah Rules of Civil Procedure, either party may request a jury <ln numlevel="1" lineno="153" slineno="2-94"/>trial with a request for trial de novo filed under Subsection <xref depth="4" refnumber="18-1-4(11)">(11)</xref>.</subsection></subsection><subsection ssid="1-null-131" dnum="13-o" numlevel="1" lineno="154" slineno="2-95" level="1" space="false"><display>(13)</display><subsection ssid="1-null-132" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the plaintiff, as the moving party in a trial de novo requested under Subsection <xref depth="4" refnumber="18-1-4(11)"><ln numlevel="1" lineno="155" slineno="2-96"/>(11)</xref>, does not obtain a verdict that is at least $5,000 and is at least 30% greater than <ln numlevel="1" lineno="156" slineno="2-97"/>the arbitration award, the plaintiff is responsible for all of the nonmoving party's <ln numlevel="1" lineno="157" slineno="2-98"/>costs.</subsection><subsection ssid="1-null-133" dnum="b-o" numlevel="1" lineno="158" slineno="2-99" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="18-1-4(13)(c)">(13)(c)</xref>, the costs under Subsection <xref depth="4" refnumber="18-1-4(13)(a)">(13)(a)</xref> shall <ln numlevel="1" lineno="159" slineno="2-100"/>include:<subsection ssid="1-null-134" dnum="i-o" numlevel="1" lineno="160" slineno="2-101" level="3"><display>(i)</display>any costs set forth in Rule 54(d), Utah Rules of Civil Procedure; and</subsection><subsection ssid="1-null-135" dnum="ii-o" numlevel="1" lineno="161" slineno="2-102" level="3"><display>(ii)</display>the costs of expert witnesses and depositions.</subsection></subsection><subsection ssid="1-null-136" dnum="c-o" numlevel="1" lineno="162" slineno="2-103" level="2"><display>(c)</display>An award of costs under this Subsection <xref depth="4" refnumber="18-1-4(13)">(13)</xref> may not exceed $6,000.</subsection></subsection><subsection ssid="1-null-137" dnum="14-o" numlevel="1" lineno="163" slineno="2-104" level="1" space="false"><display>(14)</display><subsection ssid="1-null-138" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a defendant, as the moving party in a trial de novo requested under Subsection <xref depth="4" refnumber="18-1-4(11)"><ln numlevel="1" lineno="164" slineno="2-105"/>(11)</xref>, does not obtain a verdict that is at least 30% less than the arbitration award, the <ln numlevel="1" lineno="165" slineno="2-106"/>defendant is responsible for all of the nonmoving party's costs.</subsection><subsection ssid="1-null-139" dnum="b-o" numlevel="1" lineno="166" slineno="2-107" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="18-1-4(14)(c)">(14)(c)</xref>, the costs under Subsection <xref depth="4" refnumber="18-1-4(14)(a)">(14)(a)</xref> shall <ln numlevel="1" lineno="167" slineno="2-108"/>include:<subsection ssid="1-null-140" dnum="i-o" numlevel="1" lineno="168" slineno="2-109" level="3"><display>(i)</display>any costs set forth in Rule 54(d), Utah Rules of Civil Procedure; and</subsection><subsection ssid="1-null-141" dnum="ii-o" numlevel="1" lineno="169" slineno="2-110" level="3"><display>(ii)</display>the costs of expert witnesses and depositions.</subsection></subsection><subsection ssid="1-null-142" dnum="c-o" numlevel="1" lineno="170" slineno="2-111" level="2"><display>(c)</display>An award of costs under this Subsection <xref depth="4" refnumber="18-1-4(14)">(14)</xref> may not exceed $6,000.</subsection></subsection><subsection ssid="1-null-143" dnum="15-o" numlevel="1" lineno="171" slineno="2-112" level="1"><display>(15)</display>For purposes of determining whether a party's verdict is greater or less than the <ln numlevel="1" lineno="172" slineno="2-113"/>arbitration award under Subsections <xref depth="4" refnumber="18-1-4(13)">(13)</xref> and <xref depth="4" refnumber="18-1-4(14)">(14)</xref>, a court may not consider any <ln numlevel="1" lineno="173" slineno="2-114"/>recovery or other relief granted on a claim for damages if the claim for damages was not <ln numlevel="1" lineno="174" slineno="2-115"/>disclosed in:<subsection ssid="1-null-144" dnum="a-o" numlevel="1" lineno="175" slineno="2-116" level="2"><display>(a)</display>writing prior to the arbitration proceeding; or</subsection><subsection ssid="1-null-145" dnum="b-o" numlevel="1" lineno="176" slineno="2-117" level="2"><display>(b)</display>response to discovery contrary to the Utah Rules of Civil Procedure.</subsection></subsection><subsection ssid="1-null-146" dnum="16-o" numlevel="1" lineno="177" slineno="2-118" level="1"><display>(16)</display>If a court determines, upon a motion of the nonmoving party, that the moving party's <ln numlevel="1" lineno="178" slineno="2-119"/>use of the trial de novo process was filed in bad faith, as described in Section <xref depth="3" refnumber="78B-5-825">78B-5-825</xref>, <ln numlevel="1" lineno="179" slineno="2-120"/>the court may award reasonable attorney fees to the nonmoving party.</subsection><subsection ssid="1-null-147" dnum="17-o" numlevel="1" lineno="180" slineno="2-121" level="1"><display>(17)</display>Nothing in this section is intended to affect or prevent any first party claim from later <ln numlevel="1" lineno="181" slineno="2-122"/>being brought under any first party insurance policy under which the injured person is a <ln numlevel="1" lineno="182" slineno="2-123"/>covered person.</subsection><subsection ssid="1-null-148" dnum="18-o" numlevel="1" lineno="183" slineno="2-124" level="1" space="false"><display>(18)</display><subsection ssid="1-null-149" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a defendant requests a trial de novo under Subsection <xref depth="4" refnumber="18-1-4(11)">(11)</xref>, the total verdict at <ln numlevel="1" lineno="184" slineno="2-125"/>trial may not exceed $15,000 above any available limits of insurance coverage<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both"> and <ln numlevel="1" lineno="185" slineno="2-126"/>the total verdict may not exceed $65,000</amend><amendoutend style="2"/>.</subsection><subsection ssid="1-null-150" dnum="b-o" numlevel="1" lineno="186" slineno="2-127" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">If</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except for a wrongful death action described in Section <xref depth="3" refnumber="78B-3-106">78B-3-106</xref>, if</amend> a plaintiff <ln numlevel="1" lineno="187" slineno="2-128"/>requests a trial de novo under Subsection <xref depth="4" refnumber="18-1-4(11)">(11)</xref>, the verdict at trial may not exceed <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="188" slineno="2-129"/>$50,000</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">$75,000</amend>.</subsection><subsection ssid="1-null-151" dnum="_-o:c-i" numlevel="1" lineno="189" slineno="2-130" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">The costs described in Subsections <xref depth="4" refnumber="18-1-4(13)">(13)</xref> and <xref depth="4" refnumber="18-1-4(14)">(14)</xref> are not included in a verdict amount <ln numlevel="1" lineno="190" slineno="2-131"/>described in Subsection <xref refnumber="1-null-72">(18)(a)</xref> or (b).</amend></subsection></subsection><subsection ssid="1-null-152" dnum="19-o" numlevel="1" lineno="191" slineno="2-132" level="1"><display>(19)</display>All arbitration awards issued under this section shall bear postjudgment interest <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="192" slineno="2-133"/>pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in accordance with</amend> Section <xref depth="3" refnumber="15-1-4">15-1-4</xref>.</subsection></section></bsec><bsec buid="3" num="78B-2-307" type="amend" src="code" uid="C78B-2-S307_2026050620260506" sort="78B02 03070020260506" numlevel="1" lineno="193" slineno="3-1" sn="3"><section number="78B-2-307" numlevel="1" lineno="194" slineno="3-2" type="amend"><secline lineno="193">Section 3.
