Section <bold>81-1-203</bold> is amended to read:</secline><catline lineno="33"><bold>81-1-203<parens/>. Award of costs and attorney and witness fees -- Temporary support <ln numlevel="1" lineno="34" slineno="1-3"/>and maintenance.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="35" slineno="1-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1001" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">In an action filed under Chapter 4, Dissolution of Marriage, Title 78B, Chapter 7, <ln numlevel="1" lineno="36" slineno="1-5"/>Part 6, Cohabitant Abuse Protective Orders, or in an action to establish an order of <ln numlevel="1" lineno="37" slineno="1-6"/>custody, parent-time, child support, alimony, or the division of property in a domestic <ln numlevel="1" lineno="38" slineno="1-7"/>case, the court may order a party to pay the costs, attorney fees, and witness fees, <ln numlevel="1" lineno="39" slineno="1-8"/>including expert witness fees, of the other party to enable the other party to prosecute <ln numlevel="1" lineno="40" slineno="1-9"/>or defend the action.</amend><amendoutend style="2"/></subsection><subsection ssid="1-8" dnum="_-o:a-i" numlevel="1" lineno="41" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">The court may order a party to pay the attorney fees, costs, and witness fees, <ln numlevel="1" lineno="42" slineno="1-11"/>including expert witness fees, of the other party to enable the other party to prosecute <ln numlevel="1" lineno="43" slineno="1-12"/>or defend:</amend><subsection ssid="1-9" dnum="_-o:i-i" numlevel="1" lineno="44" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" 6, Cohabitant Abuse Protective <ln numlevel="1" lineno="46" slineno="1-15"/>Orders; or</amend></subsection><subsection ssid="1-11" dnum="_-o:iii-i" numlevel="1" lineno="47" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">an action to establish or modify custody, parent-time, child support, alimony, or <ln numlevel="1" lineno="48" slineno="1-17"/>the division of property in a domestic case.</amend></subsection></subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="49" slineno="1-18" level="2"><display>(b)</display> The order under Subsection <xref depth="4" refnumber="81-1-203(1)(a)">(1)(a)</xref> may include a provision for costs of the action.</subsection></subsection><subsection ssid="1-12" dnum="_-o:2-i" numlevel="1" lineno="50" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">For a temporary order in an action to establish or modify custody, parent-time, child <ln numlevel="1" lineno="51" slineno="1-20"/>support, alimony, or the division of property in a domestic case, the court shall:</amend><subsection ssid="1-13" dnum="_-o:a-i" numlevel="1" lineno="52" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">consider the ability of the parties to pay the costs, attorney fees, and witness fees, <ln numlevel="1" lineno="53" slineno="1-22"/>including expert witness fees; and</amend></subsection><subsection ssid="1-14" dnum="_-o:b-i" numlevel="1" lineno="54" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">enter specific findings as to the ability of the parties to pay the costs described in <ln numlevel="1" lineno="55" slineno="1-24"/>Subsection <xref depth="4" refnumber="81-1-203(2)(a)">(2)(a)</xref>.</amend></subsection></subsection><subsection ssid="1-null-4" dnum="2-o:3-i" numlevel="1" lineno="56" slineno="1-25" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1010" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>In an action to enforce an order of custody, parent-time, child support, alimony, or <ln numlevel="1" lineno="57" slineno="1-26"/>division of property in a domestic case, the court <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="47" groupid="36" style="2" owner="jchristopherson" level="1" deltag="both">may award costs and attorney fees</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="55" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="58" slineno="1-27"/>shall award reasonable attorney fees and costs</amend> upon determining that the party <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="49" groupid="38" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="59" slineno="1-28"/>substantially </amend><amendoutend style="2"/>prevailed upon the claim or defense.</subsection><subsection ssid="1-null-5" dnum="3-o:4-i" numlevel="1" lineno="60" slineno="1-29" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1011" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start" space="true">(4)</amend></display><subsection ssid="1-15" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="end">(a)</amend></display>The court, in the court's discretion, may award no fees or limited fees against <ln numlevel="1" lineno="61" slineno="1-30"/>a party if the court finds the party is indigent or enters in the record the reason for not <ln numlevel="1" lineno="62" slineno="1-31"/>awarding fees.</subsection><subsection ssid="1-16" dnum="_-o:b-i" numlevel="1" lineno="63" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">If the court awards no fees or limited fees against a party as described in Subsection <xref depth="4" refnumber="81-1-203(4)(a)"><ln numlevel="1" lineno="64" slineno="1-33"/>(4)(a)</xref>, the court shall enter a specific finding as to the reason why the court did not <ln numlevel="1" lineno="65" slineno="1-34"/>award fees or awarded limited fees.</amend></subsection></subsection><subsection ssid="1-null-6" dnum="4-o:5-i" numlevel="1" lineno="66" slineno="1-35" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1014" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>In an action described in Subsection <xref depth="4" refnumber="81-1-203(1)">(1)</xref>, the court may order a party to provide <ln numlevel="1" lineno="67" slineno="1-36"/>money, during the pendency of the action, for the separate support and maintenance of <ln numlevel="1" lineno="68" slineno="1-37"/>the other party and of a minor child in the custody of the other party.</subsection><subsection ssid="1-null-7" dnum="5-o:6-i" numlevel="1" lineno="69" slineno="1-38" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>The court may amend an order entered in accordance with this section before the <ln numlevel="1" lineno="70" slineno="1-39"/>entry of the final order or judgment or in the final order or judgment.</subsection></section></bsec><bsec buid="5" num="81-4-501" type="amend" src="code" uid="C81-4-S501_2026050620260506" sort="81 04 05010020260506" numlevel="1" lineno="71" slineno="2-1" sn="2"><section number="81-4-501" numlevel="1" lineno="72" slineno="2-2" type="amend"><secline lineno="71">Section 2. Section <bold>81-4-501</bold> is amended to read:</secline><catline lineno="72"><bold>81-4-501<parens/>. Definitions for part.</bold></catline><sectionText lineno="73"><para/>As used in this part:</sectionText><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="74" slineno="2-4" level="1"><display>(1)</display>"Child support guidelines" means the same as that term is defined in Section <xref depth="3" refnumber="81-6-101">81-6-101</xref>.</subsection><subsection ssid="5-null-2" dnum="2-o" numlevel="1" lineno="75" slineno="2-5" level="1"><display>(2)</display>"Cohabit" means to live together, or to reside together on a regular basis, in the same <ln numlevel="1" lineno="76" slineno="2-6"/>residence and in a relationship of a romantic or sexual nature.</subsection><subsection ssid="5-null-3" dnum="3-o" numlevel="1" lineno="77" slineno="2-7" level="1"><display>(3)</display>"Fault" means any of the following wrongful conduct during the marriage that <ln numlevel="1" lineno="78" slineno="2-8"/>substantially contributed to the breakup of the marriage:<subsection ssid="5-null-4" dnum="a-o" numlevel="1" lineno="79" slineno="2-9" level="2"><display>(a)</display>engaging in sexual relations with an individual other than the party's spouse;</subsection><subsection ssid="5-null-5" dnum="b-o" numlevel="1" lineno="80" slineno="2-10" level="2"><display>(b)</display>knowingly and intentionally causing or attempting to cause physical harm to the <ln numlevel="1" lineno="81" slineno="2-11"/>other party or a minor child;</subsection><subsection ssid="5-null-6" dnum="c-o" numlevel="1" lineno="82" slineno="2-12" level="2"><display>(c)</display>knowingly and intentionally causing the other party or a minor child to reasonably <ln numlevel="1" lineno="83" slineno="2-13"/>fear life-threatening harm; or</subsection><subsection ssid="5-null-7" dnum="d-o" numlevel="1" lineno="84" slineno="2-14" level="2"><display>(d)</display>substantially undermining the financial stability of the other party or the minor child.</subsection></subsection><subsection ssid="5-null-8" dnum="4-o" numlevel="1" lineno="85" slineno="2-15" level="1"><display>(4)</display>"Length of the marriage" means, for purposes of alimony, the number of years from the <ln numlevel="1" lineno="86" slineno="2-16"/>day on which the parties are legally married to the day on which the petition for divorce <ln numlevel="1" lineno="87" slineno="2-17"/>is filed with the court.</subsection><subsection ssid="5-null-9" dnum="5-o" numlevel="1" lineno="88" slineno="2-18" level="1"><display>(5)</display>"Payee" means the party who is or would receive alimony from the other party.</subsection><subsection ssid="5-null-10" dnum="6-o" numlevel="1" lineno="89" slineno="2-19" level="1"><display>(6)</display>"Payor" means the party who is paying, or would pay, alimony to the other party.</subsection><subsection ssid="5-null-11" dnum="7-o" numlevel="1" lineno="90" slineno="2-20" level="1"><display>(7)</display>"Temporary alimony" means money that the court orders a party to pay during the <ln numlevel="1" lineno="91" slineno="2-21"/>pendency of an action under this chapter for the support and maintenance of a party as <ln numlevel="1" lineno="92" slineno="2-22"/>described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">81-1-203(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="81-1-203(5)">81-1-203(5)</xref></amend>.</subsection></section></bsec><bsec buid="3" num="81-9-208" type="amend" src="code" uid="C81-9-S208_2026050620260506" sort="81 09 02080020260506" numlevel="1" lineno="93" slineno="3-1" sn="3"><section number="81-9-208" numlevel="1" lineno="94" slineno="3-2" type="amend"><secline lineno="93">Section 3. Section <bold>81-9-208</bold> is amended to read:</secline><catline lineno="94"><bold>81-9-208<parens/>. Modification or termination of a custody or parent-time order -- <ln numlevel="1" lineno="95" slineno="3-3"/>Noncompliance with a parent-time order.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="96" slineno="3-4" level="1" placement="noreturn"><display>(1)</display>The court has continuing jurisdiction to make subsequent changes to modify:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="97" slineno="3-5" level="2"><display>(a)</display>custody of a minor child if there is a showing of a substantial and material change in <ln numlevel="1" lineno="98" slineno="3-6"/>circumstances since the entry of the order; and</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="99" slineno="3-7" level="2"><display>(b)</display>parent-time for a minor child if there is a showing that there is a change in <ln numlevel="1" lineno="100" slineno="3-8"/>circumstances since the entry of the order.</subsection></subsection><subsection ssid="3-null-4" dnum="2-o" numlevel="1" lineno="101" slineno="3-9" level="1"><display>(2)</display>A substantial and material change in circumstances under Subsection <xref depth="4" refnumber="81-9-208(1)(a)">(1)(a)</xref> includes a <ln numlevel="1" lineno="102" slineno="3-10"/>showing by a parent that the other parent:<subsection ssid="3-null-5" dnum="a-o" numlevel="1" lineno="103" slineno="3-11" level="2"><display>(a)</display>resides with an individual or provides an individual with access to the minor child; <ln numlevel="1" lineno="104" slineno="3-12"/>and</subsection><subsection ssid="3-null-6" dnum="b-o" numlevel="1" lineno="105" slineno="3-13" level="2"><display>(b)</display>knows that the individual:<subsection ssid="3-null-7" dnum="i-o" numlevel="1" lineno="106" slineno="3-14" level="3"><display>(i)</display>is required to register as a sex offender, a kidnap offender, or a child abuse <ln numlevel="1" lineno="107" slineno="3-15"/>offender for an offense committed against a minor child under Title 53, Chapter 29, <ln numlevel="1" lineno="108" slineno="3-16"/>Sex, Kidnap, and Child Abuse Offender Registry; or</subsection><subsection ssid="3-null-8" dnum="ii-o" numlevel="1" lineno="109" slineno="3-17" level="3"><display>(ii)</display>has been convicted of:<subsection ssid="3-null-9" dnum="A-o" numlevel="1" lineno="110" slineno="3-18" level="4"><display>(A)</display>a child abuse offense under Section <xref depth="3" refnumber="76-5-109">76-5-109</xref>, <xref depth="3" refnumber="76-5-109.2">76-5-109.2</xref>, <xref depth="3" refnumber="76-5-109.3">76-5-109.3</xref>, <xref depth="3" refnumber="76-5-109.4"><ln numlevel="1" lineno="111" slineno="3-19"/>76-5-109.4</xref>, <xref depth="3" refnumber="76-5-114">76-5-114</xref>, or <xref depth="3" refnumber="76-5-208">76-5-208</xref>;</subsection><subsection ssid="3-null-10" dnum="B-o" numlevel="1" lineno="112" slineno="3-20" level="4"><display>(B)</display>a sexual offense against a minor child under Title 76, Chapter 5, Part 4, Sexual <ln numlevel="1" lineno="113" slineno="3-21"/>Offenses, other than an offense under Section <xref depth="3" refnumber="76-5-417">76-5-417</xref>, <xref depth="3" refnumber="76-5-418">76-5-418</xref>, or <xref depth="3" refnumber="76-5-419">76-5-419</xref>;</subsection><subsection ssid="3-null-11" dnum="C-o" numlevel="1" lineno="114" slineno="3-22" level="4"><display>(C)</display>an offense for kidnapping or human trafficking of a minor child under Title <ln numlevel="1" lineno="115" slineno="3-23"/>76, Chapter 5, Part 3, Kidnapping, Trafficking, and Smuggling;</subsection><subsection ssid="3-null-12" dnum="D-o" numlevel="1" lineno="116" slineno="3-24" level="4"><display>(D)</display>a sexual exploitation offense against a minor child under Title 76, Chapter 5b, <ln numlevel="1" lineno="117" slineno="3-25"/>Sexual Exploitation Act; or</subsection><subsection ssid="3-null-13" dnum="E-o" numlevel="1" lineno="118" slineno="3-26" level="4"><display>(E)</display>an offense that is substantially similar to an offense under Subsections <xref depth="4" refnumber="81-9-208(2)(b)(ii)(a)"><ln numlevel="1" lineno="119" slineno="3-27"/>(2)(b)(ii)(A)</xref> through <xref depth="4" refnumber="81-9-208(d)">(D)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="3-null-14" dnum="3-o" numlevel="1" lineno="120" slineno="3-28" level="1"><display>(3)</display>On the petition of one or both of the parents, or the joint legal or physical custodians if <ln numlevel="1" lineno="121" slineno="3-29"/>they are not the parents, the court may, after a hearing, modify or terminate an order that <ln numlevel="1" lineno="122" slineno="3-30"/>established joint legal custody or joint physical custody if:<subsection ssid="3-null-15" dnum="a-o" numlevel="1" lineno="123" slineno="3-31" level="2"><display>(a)</display>the verified petition or accompanying affidavit initially alleges that admissible <ln numlevel="1" lineno="124" slineno="3-32"/>evidence will show that there has been a substantial and material change in the <ln numlevel="1" lineno="125" slineno="3-33"/>circumstances of the minor child or one or both parents or joint legal or physical <ln numlevel="1" lineno="126" slineno="3-34"/>custodians since the entry of the order to be modified;</subsection><subsection ssid="3-null-16" dnum="b-o" numlevel="1" lineno="127" slineno="3-35" level="2"><display>(b)</display>a modification of the terms and conditions of the order would be an improvement for <ln numlevel="1" lineno="128" slineno="3-36"/>and in the best interest of the minor child; and</subsection><subsection ssid="3-null-17" dnum="c-o" numlevel="1" lineno="129" slineno="3-37" level="2" space="false"><display>(c)</display><subsection ssid="3-null-18" dnum="i-o" level="3" placement="sameline"><display>(i)</display>both parents have complied in good faith with the dispute resolution procedure <ln numlevel="1" lineno="130" slineno="3-38"/>in accordance with Subsection <xref depth="4" refnumber="81-9-205(8)">81-9-205(8)</xref>; or</subsection><subsection ssid="3-null-19" dnum="ii-o" numlevel="1" lineno="131" slineno="3-39" level="3"><display>(ii)</display>if no dispute resolution procedure is contained in the order that established joint <ln numlevel="1" lineno="132" slineno="3-40"/>legal custody or joint physical custody, the court orders the parents to participate <ln numlevel="1" lineno="133" slineno="3-41"/>in a dispute resolution procedure in accordance with Subsection <xref depth="4" refnumber="81-9-205(13)">81-9-205(13)</xref> <ln numlevel="1" lineno="134" slineno="3-42"/>unless the parents certify that, in good faith, they have used a dispute resolution <ln numlevel="1" lineno="135" slineno="3-43"/>procedure to resolve their dispute.</subsection></subsection></subsection><subsection ssid="3-null-20" dnum="4-o" numlevel="1" lineno="136" slineno="3-44" level="1" space="false"><display>(4)</display><subsection ssid="3-null-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In determining whether the best interest of a minor child will be served by either <ln numlevel="1" lineno="137" slineno="3-45"/>modifying or terminating the joint legal custody or joint physical custody order, the <ln numlevel="1" lineno="138" slineno="3-46"/>court shall, in addition to other factors the court considers relevant, consider the <ln numlevel="1" lineno="139" slineno="3-47"/>factors described in Sections <xref depth="3" refnumber="81-9-204">81-9-204</xref> and <xref depth="3" refnumber="81-9-205">81-9-205</xref>.</subsection><subsection ssid="3-null-22" dnum="b-o" numlevel="1" lineno="140" slineno="3-48" level="2"><display>(b)</display>A court order modifying or terminating an existing joint legal custody or joint <ln numlevel="1" lineno="141" slineno="3-49"/>physical custody order shall contain written findings that:<subsection ssid="3-null-23" dnum="i-o" numlevel="1" lineno="142" slineno="3-50" level="3"><display>(i)</display>a substantial and material change of circumstance has occurred; and</subsection><subsection ssid="3-null-24" dnum="ii-o" numlevel="1" lineno="143" slineno="3-51" level="3"><display>(ii)</display>a modification of the terms and conditions of the order would be an improvement <ln numlevel="1" lineno="144" slineno="3-52"/>for and in the best interest of the minor child.</subsection></subsection><subsection ssid="3-null-25" dnum="c-o" numlevel="1" lineno="145" slineno="3-53" level="2"><display>(c)</display>The court shall give substantial weight to the existing joint legal custody or joint <ln numlevel="1" lineno="146" slineno="3-54"/>physical custody order when the minor child is thriving, happy, and well-adjusted.</subsection></subsection><subsection ssid="3-null-26" dnum="5-o" numlevel="1" lineno="147" slineno="3-55" level="1"><display>(5)</display>The court shall, in every case regarding a petition for termination of a joint legal <ln numlevel="1" lineno="148" slineno="3-56"/>custody or joint physical custody order, consider reasonable alternatives to preserve the <ln numlevel="1" lineno="149" slineno="3-57"/>existing order in accordance with Section <xref depth="3" refnumber="81-9-204">81-9-204</xref>.  </subsection><subsection ssid="3-null-27" dnum="6-o" numlevel="1" lineno="150" slineno="3-58" level="1"><display>(6)</display>The court may modify the terms and conditions of the existing order in accordance with <ln numlevel="1" lineno="151" slineno="3-59"/>this chapter and may order the parents to file a parenting plan in accordance with <ln numlevel="1" lineno="152" slineno="3-60"/>Section <xref depth="3" refnumber="81-9-203">81-9-203</xref>.</subsection><subsection ssid="3-null-28" dnum="7-o" numlevel="1" lineno="153" slineno="3-61" level="1"><display>(7)</display>A parent requesting a modification from sole custody to joint legal custody or joint <ln numlevel="1" lineno="154" slineno="3-62"/>physical custody or both, or any other type of shared parenting arrangement, shall file <ln numlevel="1" lineno="155" slineno="3-63"/>and serve a proposed parenting plan with the petition to modify in accordance with <ln numlevel="1" lineno="156" slineno="3-64"/>Section <xref depth="3" refnumber="81-9-203">81-9-203</xref>.</subsection><subsection ssid="3-null-29" dnum="8-o" numlevel="1" lineno="157" slineno="3-65" level="1"><display>(8)</display>If an issue before the court involves custodial responsibility in the event of deployment <ln numlevel="1" lineno="158" slineno="3-66"/>of one or both parents who are service members, and the service member has not yet <ln numlevel="1" lineno="159" slineno="3-67"/>been notified of deployment, the court shall resolve the issue based on the standards in <ln numlevel="1" lineno="160" slineno="3-68"/>Sections <xref depth="3" refnumber="81-10-306">81-10-306</xref> through <xref depth="3" refnumber="81-10-309">81-10-309</xref>.</subsection><subsection ssid="3-null-30" dnum="9-o" numlevel="1" lineno="161" slineno="3-69" level="1"><display>(9)</display>If the court finds that an action to modify custody or parent-time is filed or answered <ln numlevel="1" lineno="162" slineno="3-70"/>frivolously <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">or</amend>, in a manner, designed to harass the other party, the court shall assess <ln numlevel="1" lineno="163" slineno="3-71"/>attorney fees as costs against the offending party.</subsection><subsection ssid="3-null-31" dnum="10-o" numlevel="1" lineno="164" slineno="3-72" level="1"><display>(10)</display>If a petition to modify custody or parent-time provisions of a court order is made and <ln numlevel="1" lineno="165" slineno="3-73"/>denied, the court shall order the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">petitioner</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">nonprevailing party</amend> to pay the reasonable <ln numlevel="1" lineno="166" slineno="3-74"/>attorney fees expended by the prevailing party in that action if the court determines that <ln numlevel="1" lineno="167" slineno="3-75"/>the petition was <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">without merit and </amend><amendoutend style="2"/>not asserted or defended against in good faith.</subsection><subsection ssid="3-null-32" dnum="11-o" numlevel="1" lineno="168" slineno="3-76" level="1"><display>(11)</display>If a motion or petition alleges noncompliance with a parent-time order by a parent, or a <ln numlevel="1" lineno="169" slineno="3-77"/>visitation order by a grandparent or other member of the immediate family where a <ln numlevel="1" lineno="170" slineno="3-78"/>visitation or parent-time right has been previously granted by the court, the court:<subsection ssid="3-null-33" dnum="a-o" numlevel="1" lineno="171" slineno="3-79" level="2"><display>(a)</display>may award to the prevailing party:<subsection ssid="3-null-34" dnum="i-o" numlevel="1" lineno="172" slineno="3-80" level="3"><display>(i)</display>actual attorney fees incurred;</subsection><subsection ssid="3-null-35" dnum="ii-o" numlevel="1" lineno="173" slineno="3-81" level="3"><display>(ii)</display>the costs incurred by the prevailing party because of the other party's failure to <ln numlevel="1" lineno="174" slineno="3-82"/>provide or exercise court-ordered visitation or parent-time, including:<subsection ssid="3-null-36" dnum="A-o" numlevel="1" lineno="175" slineno="3-83" level="4"><display>(A)</display>court costs;</subsection><subsection ssid="3-null-37" dnum="B-o" numlevel="1" lineno="176" slineno="3-84" level="4"><display>(B)</display>child care expenses;</subsection><subsection ssid="3-null-38" dnum="C-o" numlevel="1" lineno="177" slineno="3-85" level="4"><display>(C)</display>transportation expenses actually incurred;</subsection><subsection ssid="3-null-39" dnum="D-o" numlevel="1" lineno="178" slineno="3-86" level="4"><display>(D)</display>lost wages, if ascertainable; or</subsection><subsection ssid="3-null-40" dnum="E-o" numlevel="1" lineno="179" slineno="3-87" level="4"><display>(E)</display>counseling for a parent or a minor child if ordered or approved by the court; or</subsection></subsection><subsection ssid="3-null-41" dnum="iii-o" numlevel="1" lineno="180" slineno="3-88" level="3"><display>(iii)</display>any other appropriate equitable remedy; and</subsection></subsection><subsection ssid="3-null-42" dnum="b-o" numlevel="1" lineno="181" slineno="3-89" level="2"><display>(b)</display>shall award reasonable make-up parent-time to the prevailing party, unless make-up <ln numlevel="1" lineno="182" slineno="3-90"/>parent-time is not in the best interest of the minor child.</subsection></subsection></section></bsec><bsec buid="6" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="183" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="183">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="184"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson"
