Section <bold>11-36a-305</bold> is amended to read:</secline><catline lineno="24"><bold>11-36a-305<parens/>. Calculating impact fees.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="25" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>In calculating an impact fee, a local political subdivision or private entity<amend anum="0" ea="amend" pairid="25" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="1-13" dnum="_-o:a-i" numlevel="1" lineno="26" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>may include:<subsection ssid="1-null-2" dnum="a-o:i-i" numlevel="1" lineno="27" slineno="1-5" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1002" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>the construction contract price;</subsection><subsection ssid="1-null-3" dnum="b-o:ii-i" numlevel="1" lineno="28" slineno="1-6" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1003" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>the cost of acquiring land, improvements, materials, and fixtures;</subsection><subsection ssid="1-null-4" dnum="c-o:iii-i" numlevel="1" lineno="29" slineno="1-7" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1004" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>for services provided for and directly related to the construction of the <ln numlevel="1" lineno="30" slineno="1-8"/>system improvements, the cost for planning and surveying, and engineering fees;</subsection><subsection ssid="1-null-5" dnum="d-o:iv-i" numlevel="1" lineno="31" slineno="1-9" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1005" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>for a political subdivision, debt service charges, if the political subdivision <ln numlevel="1" lineno="32" slineno="1-10"/>might use impact fees as a revenue stream to pay the principal and interest on <ln numlevel="1" lineno="33" slineno="1-11"/>bonds, notes, or other obligations issued to finance the costs of the system <ln numlevel="1" lineno="34" slineno="1-12"/>improvements; and</subsection><subsection ssid="1-null-6" dnum="e-o:v-i" numlevel="1" lineno="35" slineno="1-13" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both" space="true">(v)</amend></display>one or more expenses for overhead<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="33" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection></subsection><subsection ssid="1-14" dnum="_-o:b-i" numlevel="1" lineno="36" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">shall comply with Subsections <xref depth="4" refnumber="11-36a-305(2)">(2)</xref> and <xref depth="4" refnumber="11-36a-305(3)">(3)</xref>, as applicable.</amend></subsection></subsection><subsection ssid="1-null-7" dnum="2-o" numlevel="1" lineno="37" slineno="1-15" level="1"><display>(2)</display>In calculating an impact fee, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">each</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> local political subdivision or private entity shall <ln numlevel="1" lineno="38" slineno="1-16"/>base amounts calculated under Subsection <xref depth="4" refnumber="11-36a-305(1)" start="0">(1)</xref> on realistic estimates, and the assumptions <ln numlevel="1" lineno="39" slineno="1-17"/>underlying those estimates shall be disclosed in the impact fee analysis.</subsection><subsection ssid="1-8" dnum="_-o:3-i" numlevel="1" lineno="40" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="1-9" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this Subsection <xref depth="4" refnumber="11-36a-305(3)">(3)</xref>, "plumbing fixture" means a receptacle or device <ln numlevel="1" lineno="41" slineno="1-19"/>that is connected to a water supply system or that discharges to a drainage system or <ln numlevel="1" lineno="42" slineno="1-20"/>both.</amend></subsection><subsection ssid="1-11" dnum="_-o:b-i" numlevel="1" lineno="43" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">In calculating an impact fee for a single-family residential use development activity, <ln numlevel="1" lineno="44" slineno="1-22"/>a local political subdivision or private entity shall use the number of plumbing <ln numlevel="1" lineno="45" slineno="1-23"/>fixtures shown in the building plans for the single-family residential unit to determine <ln numlevel="1" lineno="46" slineno="1-24"/>the development activity's proportionate share.</amend></subsection></subsection></section></bsec><bsec buid="5" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="47" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="47">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="48"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-16-26 12:24 PM</tm></rev></foot></leg>
