and</hl><hl numlevel="1" lineno="14" slineno="0-14" level="2">report to the Health and Human Services Interim Committee on the outcomes of <ln numlevel="1" lineno="15" slineno="0-15"/>recommended screening tools;</hl></hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">requires the department to create a standard form for justice involved individuals to <ln numlevel="1" lineno="17" slineno="0-17"/>consent to disclosure of a mental health disorder or substance use disorder to certain <ln numlevel="1" lineno="18" slineno="0-18"/>persons, including health care providers, first responders, courts, local health authorities, <marker pairid="1"><ln numlevel="1" lineno="19" slineno="0-19"/>and the D</marker>ivision of Adult Probation and Parole (division);</hl><hl numlevel="1" lineno="20" slineno="0-20" level="1">requires the department to create a statewide list of mental health and substance use <ln numlevel="1" lineno="21" slineno="0-21"/>disorder treatment services where justice involved individuals may be referred by courts, <ln numlevel="1" lineno="22" slineno="0-22"/>first responders, jails, health care providers, or the division;</hl><hl numlevel="1" lineno="23" slineno="0-23" level="1">amends provisions related to involuntary commitment and court ordered assisted <ln numlevel="1" lineno="24" slineno="0-24"/>outpatient treatment for mental illnes<marker pairid="0">s;</marker></hl><hl numlevel="1" lineno="25" slineno="0-25" level="1">requires chief law enforcement officers or executive officers of each law enforcement <ln numlevel="1" lineno="26" slineno="0-26"/>agency to report to the State Commission on Criminal and Juvenile Justice on peace <ln numlevel="1" lineno="27" slineno="0-27"/>officers' compliance with training requirements related to crisis intervention responses;</hl><hl numlevel="1" lineno="28" slineno="0-28" level="1">defines terms; Section <bold>26B-2-135</bold> is amended to read:</secline><catline lineno="49"><bold>26B-2-135<parens/>. Licensing behavioral health receiving centers.</bold></catline><subsection ssid="9-4" dnum="_-o:1-i" numlevel="1" lineno="50" slineno="1-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="both">(1)</amend></display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, and <ln numlevel="1" lineno="51" slineno="1-4"/>Section <xref depth="3" refnumber="63J-1-504">63J-1-504</xref>, the office:<subsection ssid="9-null-1" dnum="1-o:a-i" numlevel="1" lineno="52" slineno="1-5" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1001" style="2" owner="o" level="1" deltag="both">(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="both" space="true">(a)</amend></display>shall adopt and enforce rules to establish the process for initial and renewal <ln numlevel="1" lineno="53" slineno="1-6"/>applications to operate a behavioral health receiving center;</subsection><subsection ssid="9-null-2" dnum="2-o:b-i" numlevel="1" lineno="54" slineno="1-7" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1002" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>may assess and collect application and renewal fees for behavioral health <ln numlevel="1" lineno="55" slineno="1-8"/>receiving center licenses; and</subsection><subsection ssid="9-null-3" dnum="3-o:c-i" numlevel="1" lineno="56" slineno="1-9" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1003" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>shall deposit any fees collected under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="26B-2-135(1)(b)">(2)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(1)(b)</amend> into the General <ln numlevel="1" lineno="57" slineno="1-10"/>Fund as a dedicated credit to be used solely to pay for or offset the office's costs <ln numlevel="1" lineno="58" slineno="1-11"/>incurred in performing the duties under this section.</subsection></subsection><subsection ssid="9-5" dnum="_-o:2-i" numlevel="1" lineno="59" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="9-14" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this Subsection <xref depth="4" refnumber="26B-2-135(2)">(2)</xref>:</amend><subsection ssid="9-21" dnum="_-o:i-i" numlevel="1" lineno="60" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="89" style="1" owner="jchristopherson" level="1" amendtag="end">"Diversion" <marker pairid="150">means referral</marker> to a licensed center by a law enforcement agency, a <ln numlevel="1" lineno="61" slineno="1-14"/>law enforcement officer, or by court order, including:</amend><subsection ssid="9-25" dnum="_-o:A-i" numlevel="1" lineno="62" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="end">under the terms of a diversion agreement described in Section <xref depth="3" refnumber="77-2-5">77-2-5</xref>;</amend></subsection><subsection ssid="9-26" dnum="_-o:B-i" numlevel="1" lineno="63" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="135" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="end">voluntary referral as described in Section <xref depth="3" refnumber="26B-5-121">26B-5-121</xref>; </amend></subsection><subsection ssid="9-29" dnum="_-o:C-i" numlevel="1" lineno="64" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="104" style="1" owner="jchristopherson" level="1" amendtag="end">as an alternative to penalties for a violation of probation or parole; or</amend></subsection><subsection ssid="9-27" dnum="_-o:D-i" numlevel="1" lineno="65" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="140" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="end">any other court ordered or law enforcement facilitated alternative to criminal <ln numlevel="1" lineno="66" slineno="1-19"/>penalties.</amend></subsection></subsection><subsection ssid="9-22" dnum="_-o:ii-i" numlevel="1" lineno="67" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="end">"Diversion contact" means the prosecuting attorney that is a party to a diversion <ln numlevel="1" lineno="68" slineno="1-21"/>agreement, the court that orders diversion, or the law enforcement agency or offer <ln numlevel="1" lineno="69" slineno="1-22"/>that facilitates the diversion.</amend></subsection><subsection ssid="9-15" dnum="_-o:iii-i" numlevel="1" lineno="70" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="74" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">"Licensed center" means a behavioral health receiving center licensed under this <ln numlevel="1" lineno="71" slineno="1-24"/>part.</amend></subsection><subsection ssid="9-16" dnum="_-o:iv-i" numlevel="1" lineno="72" slineno="1-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">"Responsible law enforcement agency" means the law enforcement agency that <ln numlevel="1" lineno="73" slineno="1-26"/>employs a law enforcement officer that facilitates an individual's connection with <ln numlevel="1" lineno="74" slineno="1-27"/>a licensed center as described in Section <xref depth="3" refnumber="26B-5-121">26B-5-121</xref>.</amend></subsection><subsection ssid="9-17" dnum="_-o:v-i" numlevel="1" lineno="75" slineno="1-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">"Treatment program" means a licensed center's program for providing mental <ln numlevel="1" lineno="76" slineno="1-29"/>health services to an individual experiencing a mental health crisis.</amend></subsection></subsection><subsection ssid="9-13" dnum="_-o:b-i" numlevel="1" lineno="77" slineno="1-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">Rules the office adopts in accordance with Subsection <xref depth="4" refnumber="26B-2-135(1)(a)">(1)(a)</xref> shall require a licensed <ln numlevel="1" lineno="78" slineno="1-31"/>center, for an individual that enters the treatment program through diversion to:</amend><subsection ssid="9-6" dnum="_-o:i-i" numlevel="1" lineno="79" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">establish a process for identifying and communicating with a responsible law <ln numlevel="1" lineno="80" slineno="1-33"/>enforcement agency and diversion contacts;</amend></subsection><subsection ssid="9-7" dnum="_-o:ii-i" numlevel="1" lineno="81" slineno="1-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">notify a responsible law enforcement agency or diversion contacts:</amend><subsection ssid="9-11" dnum="_-o:A-i" numlevel="1" lineno="82" slineno="1-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">if the individual is actively participating in the treatment program 60 days <ln numlevel="1" lineno="83" slineno="1-36"/>after the day on which the individual entered the treatment program; or</amend></subsection><subsection ssid="9-8" dnum="_-o:B-i" numlevel="1" lineno="84" slineno="1-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">if the individual resists participation in the treatment program before 60 days <ln numlevel="1" lineno="85" slineno="1-38"/>after the day on which the individual enters the treatment program;</amend></subsection></subsection><subsection ssid="9-23" dnum="_-o:iii-i" numlevel="1" lineno="86" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">notify diversion contacts if the individual violates a diversion agreement, court <ln numlevel="1" lineno="87" slineno="1-40"/>order, or other terms of the diversion; and</amend></subsection><subsection ssid="9-18" dnum="_-o:iv-i" numlevel="1" lineno="88" slineno="1-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">notify the responsible law enforcement agency or diversion contacts no more <ln numlevel="1" lineno="89" slineno="1-42"/>than 24 hours after the individual leaves the treatment program, if the individual <ln numlevel="1" lineno="90" slineno="1-43"/>leaves before the individual is cleared by the licensed center to leave.</amend></subsection></subsection></subsection></section></bsec><bsec buid="5" num="26B-4-1103" type="enact" src="code" uid="C26B-4-S1103_2026050620260506" sort="26B04 11030020260506" dnum="_-o:b-i" numlevel="1" lineno="97" slineno="2-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="91" style="1" owner="jchristopherson" level="1" amendtag="end">"Commission" means the State Commission on Criminal and Juvenile Justice created <ln numlevel="1" lineno="98" slineno="2-8"/>in Section <xref depth="3" refnumber="63M-7-201">63M-7-201</xref>.</amend></subsection><subsection ssid="5-17" dnum="_-o:c-i" numlevel="1" lineno="99" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="97" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">"Recommended screening tool" means a screening tool the department recommends <ln numlevel="1" lineno="100" slineno="2-10"/>as described in Subsection <xref depth="4" refnumber="26B-4-1103(2)(c)">(2)(c)</xref>.</amend></subsection><subsection ssid="5-5" dnum="_-o:d-i" numlevel="1" lineno="101" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">"Screening tool" means the evidence-based screening tool to screen an inmate for <ln numlevel="1" lineno="102" slineno="2-12"/>substance use disorders described in Subsection <xref depth="4" refnumber="17-72-501(2)(e)">17-72-501(2)(e)</xref>.</amend></subsection></subsection><subsection ssid="5-2" dnum="_-o:2-i" numlevel="1" lineno="103" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="5-7" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">In collaboration with the commission, the department shall conduct a study on, <ln numlevel="1" lineno="104" slineno="2-14"/>and make recommendations for, screening tools.</amend></subsection><subsection ssid="5-8" dnum="_-o:b-i" numlevel="1" lineno="105" slineno="2-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">In conducting the study described in Subsection <xref depth="4" refnumber="26B-4-1103(2)(a)">(2)(a)</xref>, the department shall collect <ln numlevel="1" lineno="106" slineno="2-16"/>and analyze data on:</amend><subsection ssid="5-12" dnum="_-o:i-i" numlevel="1" lineno="107" slineno="2-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">the screening tools used as described in Subsection <xref depth="4" refnumber="17-72-501(2)(e)">17-72-501(2)(e)</xref>;</amend></subsection><subsection ssid="5-10" dnum="_-o:ii-i" numlevel="1" lineno="108" slineno="2-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">outcomes of the screening of inmates screened using the screening tools; and</amend></subsection><subsection ssid="5-14" dnum="_-o:iii-i" numlevel="1" lineno="109" slineno="2-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">outcomes of treatment and programs provided to inmates based on the screening <ln numlevel="1" lineno="110" slineno="2-20"/>described in Subsection <xref depth="4" refnumber="26B-4-1103(2)(b)(ii)">(2)(b)(ii)</xref><marker pairid="135"/>.</amend></subsection></subsection><subsection ssid="5-11" dnum="_-o:c-i" numlevel="1" lineno="111" slineno="2-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><subsection ssid="5-15" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">No later than January 1, 2027, the department shall make recommendations for <ln numlevel="1" lineno="112" slineno="2-22"/>screening tools and make recommended screening tools available to persons <ln numlevel="1" lineno="113" slineno="2-23"/>conducting screenings required under Subsection <xref depth="4" refnumber="17-72-501(2)(e)">17-72-501(2)(e)</xref>.</amend></subsection><subsection ssid="5-16" dnum="_-o:ii-i" numlevel="1" lineno="114" slineno="2-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="93" groupid="72" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall ensure that a recommended screening tool is <ln numlevel="1" lineno="115" slineno="2-25"/>evidence-based, standardized, and validated, and is able to screen for:</amend><subsection ssid="5-29" dnum="_-o:A-i" numlevel="1" lineno="116" slineno="2-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="169" groupid="114" style="1" owner="jchristopherson" level="1" amendtag="end">substance use and mental health disorders;</amend></subsection><subsection ssid="5-30" dnum="_-o:B-i" numlevel="1" lineno="117" slineno="2-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="175" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="end">an inmate's service n<marker pairid="176">eeds;</marker><marker pairid="177"> </marker><marker pairid="178">a</marker><marker pairid="179">n</marker><marker pairid="180">d</marker></amend></subsection><subsection ssid="5-28" dnum="_-o:C-i" numlevel="1" lineno="118" slineno="2-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="164" groupid="110" style="1" owner="jchristopherson" level="1" amendtag="end">the appropriateness of treatment in the community, including at a behavioral <ln numlevel="1" lineno="119" slineno="2-29"/>health receiving center.</amend></subsection></subsection></subsection><subsection ssid="5-13" dnum="_-o:d-i" numlevel="1" lineno="120" slineno="2-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">By October 1, 2027, the department shall collect and analyze data on the use of the <ln numlevel="1" lineno="121" slineno="2-31"/>recommended screening tools, including data on:</amend><subsection ssid="5-20" dnum="_-o:i-i" numlevel="1" lineno="122" slineno="2-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">outcomes of the screening of inmates screened using the recommended screening <ln numlevel="1" lineno="123" slineno="2-33"/>tool; and</amend></subsection><subsection ssid="5-21" dnum="_-o:ii-i" numlevel="1" lineno="124" slineno="2-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="end">outcomes of treatment and programs, including treatment at a behavioral health <ln numlevel="1" lineno="125" slineno="2-35"/>receiving center, provided to inmates based on a screening described in <ln numlevel="1" lineno="126" slineno="2-36"/>Subsection <xref depth="4" refnumber="26B-4-1103(2)(d)(i)">(2)(d)(i)</xref>.</amend></subsection></subsection></subsection><subsection ssid="5-22" dnum="_-o:3-i" numlevel="1" lineno="127" slineno="2-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">No later than November 1, 2027, the department shall submit a report to the Health and <ln numlevel="1" lineno="128" slineno="2-38"/>Human Services Interim Committee on the data collected and analyzed in accordance <ln numlevel="1" lineno="129" slineno="2-39"/>with Subsection <xref depth="4" refnumber="26B-4-1103(2)(d)">(2)(d)</xref>.</amend></subsection></section></bsec><bsec buid="7" num="26B-4-1104" type="enact" No. 104-191, 110 Stat. 1936, as amended<marker pairid="154"/><marker pairid="153"/>.</amend></subsection><subsection ssid="7-20" dnum="_-o:g-i" numlevel="1" lineno="144" slineno="3-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="122" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">"Parolee" means an individual on parole under the supervision of the Division of <ln numlevel="1" lineno="145" slineno="3-16"/>Adult Probation and Parole.</amend></subsection><subsection ssid="7-22" dnum="_-o:h-i" numlevel="1" lineno="146" slineno="3-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="132" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="end">"Probationer" means an individual on probation under the supervision of the <ln numlevel="1" lineno="147" slineno="3-18"/>Division of Adult Probation and Parole.</amend></subsection></subsection><subsection ssid="7-7" dnum="_-o:2-i" numlevel="1" lineno="148" slineno="3-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">Before December 31, 2026, the department shall create a standard form that:</amend><subsection ssid="7-2" dnum="_-o:a-i" numlevel="1" lineno="149" slineno="3-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">is compliant with HIPAA and 42 C.F.R. Part 2; and</amend></subsection><subsection ssid="7-3" dnum="_-o:b-i" numlevel="1" lineno="150" slineno="3-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">a defendant, an inmate, a parolee, or a probationer may use to consent to the <ln numlevel="1" lineno="151" slineno="3-22"/>disclosure of the individual's mental health disorder or substance use disorder <ln numlevel="1" lineno="152" slineno="3-23"/>diagnosis to:</amend><subsection ssid="7-4" dnum="_-o:i-i" numlevel="1" lineno="153" slineno="3-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">health care providers;</amend></subsection><subsection ssid="7-5" dnum="_-o:ii-i" numlevel="1" lineno="154" slineno="3-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">first responders;</amend></subsection><subsection ssid="7-24" dnum="_-o:iii-i" numlevel="1" lineno="155" slineno="3-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="152" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="end">the c<marker pairid="155">ourts;</marker></amend></subsection><subsection ssid="7-6" dnum="_-o:iv-i" numlevel="1" lineno="156" slineno="3-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">the Division of Adult Probation and Parole;</amend></subsection><subsection ssid="7-26" dnum="_-o:v-i" numlevel="1" lineno="157" slineno="3-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="163" groupid="115" style="1" owner="jchristopherson" level="1" amendtag="end">local mental health authorities; or</amend></subsection><subsection ssid="7-27" dnum="_-o:vi-i" numlevel="1" lineno="158" slineno="3-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="168" groupid="119" style="1" owner="jchristopherson" level="1" amendtag="end">other persons the department, in consultation with the commission, identifies in <ln numlevel="1" lineno="159" slineno="3-30"/>rules made in accordance with Subsection <xref depth="4" refnumber="26B-4-1104(5)">(5)</xref>.</amend></subsection></subsection></subsection><subsection ssid="7-11" dnum="_-o:3-i" numlevel="1" lineno="160" slineno="3-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">The form described in Subsection <xref depth="4" refnumber="26B-4-1104(2)">(2)</xref> shall:</amend><subsection ssid="7-12" dnum="_-o:a-i" numlevel="1" lineno="161" slineno="3-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="98" groupid="70" style="1" owner="jchristopherson" level="1" amendtag="end">include fields for the inmate's name, date of birth, signature, and date of signature;</amend></subsection><subsection ssid="7-14" dnum="_-o:b-i" numlevel="1" lineno="162" slineno="3-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">identify each person described in Subsection <xref depth="4" refnumber="26B-4-1104(2)(b)">(2)(b)</xref> to whom the individual's <ln numlevel="1" lineno="163" slineno="3-34"/>diagnosis information will be disclosed;</amend></subsection><subsection ssid="7-15" dnum="_-o:c-i" numlevel="1" lineno="164" slineno="3-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">describe the circumstances under which the individual's diagnosis information will <ln numlevel="1" lineno="165" slineno="3-36"/>be disclosed; and</amend></subsection><subsection ssid="7-17" dnum="_-o:d-i" numlevel="1" lineno="166" slineno="3-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="end">identify the duration of time that the consent to disclosure is valid.</amend></subsection></subsection><subsection ssid="7-19" dnum="_-o:4-i" numlevel="1" lineno="167" slineno="3-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="118" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall make the form available for use by health care providers, first <ln numlevel="1" lineno="168" slineno="3-39"/>responders, courts, and the Division of Adult Probation and Parole.</amend></subsection><subsection ssid="7-25" dnum="_-o:5-i" numlevel="1" lineno="169" slineno="3-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="159" groupid="112" style="1" owner="jchristopherson" level="1" amendtag="end">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="170" slineno="3-41"/>department, in consultation with the commission, shall make rules to:</amend><subsection ssid="7-30" dnum="_-o:a-i" numlevel="1" lineno="171" slineno="3-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="186" groupid="130" style="1" owner="jchristopherson" level="1" amendtag="end">define and restrict a person's access to the information disclosed in the form, which <ln numlevel="1" lineno="172" slineno="3-43"/>shall be based on:</amend><subsection ssid="7-31" dnum="_-o:i-i" numlevel="1" lineno="173" slineno="3-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="193" groupid="134" style="1" owner="jchristopherson" level="1" amendtag="end">the person's need to access the information to provide treatment or services to an <ln numlevel="1" lineno="174" slineno="3-45"/>individual;</amend></subsection><subsection ssid="7-32" dnum="_-o:ii-i" numlevel="1" lineno="175" slineno="3-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="199" groupid="139" style="1" owner="jchristopherson" level="1" amendtag="end">the person's contact with the individual;</amend></subsection><subsection ssid="7-33" dnum="_-o:iii-i" numlevel="1" lineno="176" slineno="3-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="206" groupid="143" style="1" owner="jchristopherson" level="1" amendtag="end">the individual's consent; and</amend></subsection><subsection ssid="7-34" dnum="_-o:iv-i" numlevel="1" lineno="177" slineno="3-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="212" groupid="148" style="1" owner="jchristopherson" level="1" amendtag="end">applicable law; and</amend></subsection></subsection><subsection ssid="7-35" dnum="_-o:b-i" numlevel="1" lineno="178" slineno="3-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="219" groupid="152" style="1" owner="jchristopherson" level="1" amendtag="end"><marker pairid="220">identify</marker> additional persons for inclusion on the disclosure form as described in <ln numlevel="1" lineno="179" slineno="3-50"/>Subsection <xref depth="4" refnumber="26B-4-1104(2)(b)(vi)">(2)(b)(vi)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="16" num="26B-5-121" type="amend" src="code" uid="C26B-5-S121_2026050620260506" sort="26B05 01210020260506" numlevel="1" lineno="180" slineno="4-1" sn="4"><section number="26B-5-121" numlevel="1" lineno="181" slineno="4-2" type="amend"><secline lineno="180">Section 4. Section <bold>26B-5-121</bold> is amended to read:</secline><catline lineno="181"><bold>26B-5-121<parens/>. Voluntary referrals to substance use and mental health services by <ln numlevel="1" lineno="182" slineno="4-3"/>first responders -- Immunity from liability -- Reporting -- Rulemaking.</bold></catline><subsection ssid="16-null-1" dnum="1-o" numlevel="1" lineno="183" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="16-null-2" dnum="a-o" numlevel="1" lineno="184" slineno="4-5" level="2"><display>(a)</display>"First responder" means:<subsection ssid="16-null-3" dnum="i-o" numlevel="1" lineno="185" slineno="4-6" level="3"><display>(i)</display>a law enforcement officer, as that term is defined in Section <xref depth="3" refnumber="53-13-103">53-13-103</xref>;</subsection><subsection ssid="16-null-4" dnum="ii-o" numlevel="1" lineno="186" slineno="4-7" level="3"><display>(ii)</display>emergency medical service personnel, as that term is defined in Section <xref depth="3" refnumber="53-2d-101">53-2d-101</xref>;</subsection><subsection ssid="16-null-5" dnum="iii-o" numlevel="1" lineno="187" slineno="4-8" level="3"><display>(iii)</display>an emergency medical technician, as that term is defined in Section <xref depth="3" refnumber="53-2e-101">53-2e-101</xref>;</subsection><subsection ssid="16-null-6" dnum="iv-o" numlevel="1" lineno="188" slineno="4-9" level="3"><display>(iv)</display>an advanced emergency medical technician, as that term is defined in Section <xref depth="3" refnumber="53-2e-101"><ln numlevel="1" lineno="189" slineno="4-10"/>53-2e-101</xref>;</subsection><subsection ssid="16-null-7" dnum="v-o" numlevel="1" lineno="190" slineno="4-11" level="3"><display>(v)</display>a firefighter, as that term is defined in Section <xref depth="3" refnumber="53H-11-306">53H-11-306</xref>; or</subsection><subsection ssid="16-null-8" dnum="vi-o" numlevel="1" lineno="191" slineno="4-12" level="3"><display>(vi)</display>a dispatcher, as that term is defined in Section <xref depth="3" refnumber="53-6-102">53-6-102</xref>.</subsection></subsection><subsection ssid="16-null-9" dnum="b-o" numlevel="1" lineno="192" slineno="4-13" level="2"><display>(b)</display>"Local services list" means a comprehensive list of local substance use or mental <ln numlevel="1" lineno="193" slineno="4-14"/>health services, as described in Subsections <xref depth="4" refnumber="17-77-201(5)(b)(iii)">17-77-201(5)(b)(iii)</xref> and <xref depth="4" refnumber="17-77-301(5)(c)">17-77-301(5)(c)</xref>.</subsection><subsection ssid="16-22" dnum="_-o:c-i" numlevel="1" lineno="194" slineno="4-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">"Statewide services list" means the comprehensive list of providers of mental health <ln numlevel="1" lineno="195" slineno="4-16"/>and substance use services available to individuals in the state as described in Section <xref depth="3" refnumber="26B-5-122"><ln numlevel="1" lineno="196" slineno="4-17"/>26B-5-122</xref>.</amend></subsection></subsection><subsection ssid="16-null-10" dnum="2-o" numlevel="1" lineno="197" slineno="4-18" level="1"><display>(2)</display>As and when appropriate, a first responder is encouraged to offer a referral to substance <ln numlevel="1" lineno="198" slineno="4-19"/>use or mental health services to an individual who experiences an intentional or <ln numlevel="1" lineno="199" slineno="4-20"/>accidental overdose.</subsection><subsection ssid="16-null-11" dnum="3-o" numlevel="1" lineno="200" slineno="4-21" level="1"><display>(3)</display>If an individual expresses interest in substance use or mental health services, a first <ln numlevel="1" lineno="201" slineno="4-22"/>responder may, as appropriate:<subsection ssid="16-null-12" dnum="a-o" numlevel="1" lineno="202" slineno="4-23" level="2"><display>(a)</display>facilitate a real-time connection with an appropriate local service provider;</subsection><subsection ssid="16-null-13" dnum="b-o" numlevel="1" lineno="203" slineno="4-24" level="2"><display>(b)</display>contact the statewide 988 crisis line for assistance; or</subsection><subsection ssid="16-null-14" dnum="c-o" numlevel="1" lineno="204" slineno="4-25" level="2"><display>(c)</display>if the individual does not wish to speak with a service provider at that time, provide <ln numlevel="1" lineno="205" slineno="4-26"/>the individual with a physical copy of a local services list<amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both"> or the statewide services list</amend>.</subsection></subsection><subsection ssid="16-null-15" dnum="4-o" numlevel="1" lineno="206" slineno="4-27" level="1" space="false"><display>(4)</display><subsection ssid="16-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This section does not create a duty for a first responder to offer or provide a <ln numlevel="1" lineno="207" slineno="4-28"/>referral to substance use or mental health services.</subsection><subsection ssid="16-null-17" dnum="b-o" numlevel="1" lineno="208" slineno="4-29" level="2"><display>(b)</display>A first responder and an employer of a first responder are not liable under this <ln numlevel="1" lineno="209" slineno="4-30"/>section for a first responder's action or failure to act in regards to offering or <ln numlevel="1" lineno="210" slineno="4-31"/>providing a referral to substance use or mental health services as described in this <ln numlevel="1" lineno="211" slineno="4-32"/>section.</subsection><subsection ssid="16-null-18" dnum="c-o" numlevel="1" lineno="212" slineno="4-33" level="2"><display>(c)</display>This section does not affect any privilege or immunity from liability, exemption from <ln numlevel="1" lineno="213" slineno="4-34"/>law, ordinance, or rule, or any other benefit that applies to a first responder or an <ln numlevel="1" lineno="214" slineno="4-35"/>employer of a first responder.</subsection></subsection><subsection ssid="16-null-19" dnum="5-o" numlevel="1" lineno="215" slineno="4-36" level="1" space="false"><display>(5)</display><subsection ssid="16-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a first responder offers a referral to substance use or mental health services as <ln numlevel="1" lineno="216" slineno="4-37"/>described in this section, the first responder's employer shall report annually to the <ln numlevel="1" lineno="217" slineno="4-38"/>division the total number of individuals who accepted a referral from all first <ln numlevel="1" lineno="218" slineno="4-39"/>responders employed by the employer.</subsection><subsection ssid="16-null-21" dnum="b-o" numlevel="1" lineno="219" slineno="4-40" level="2"><display>(b)</display>The division shall make rules, in accordance with <xref depth="1" refnumber="63G-3">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="220" slineno="4-41"/>Administrative Rulemaking Act</xref>, specifying how the reports required by Subsection <xref depth="4" refnumber="26B-5-121(5)(a)"><ln numlevel="1" lineno="221" slineno="4-42"/>(5)(a)</xref> shall be submitted.</subsection></subsection></section></bsec><bsec buid="14" num="26B-5-122" type="enact" src="code" uid="C26B-5-S122_2026050620260506" sort="26B05 01220020260506" numlevel="1" lineno="222" slineno="5-1" sn="5"><section numlevel="1" lineno="223" slineno="5-2" number="26B-5-122" type="enact"><secline lineno="222">Section 5. groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">"First responder" means the same as that term is defined in Section <xref depth="3" refnumber="26B-5-121">26B-5-121</xref>.</amend></subsection><subsection ssid="14-24" dnum="_-o:c-i" numlevel="1" lineno="228" slineno="5-7" ea="amend" anum="0" owner="jchristopherson" style="1" pairid="71" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">"Provider" includes a behavioral health receiving center.</amend></subsection></subsection></subsection><subsection ssid="14-3" dnum="_-o:2-i" numlevel="1" lineno="233" slineno="5-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1104" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall annually prepare a comprehensive list of providers available to <ln numlevel="1" lineno="234" slineno="5-13"/>individuals in the state.</amend></subsection><subsection ssid="14-5" dnum="_-o:3-i" numlevel="1" lineno="235" slineno="5-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1105" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">The list described in Subsection <xref depth="4" refnumber="26B-5-122(2)">(2)</xref> shall:</amend><subsection ssid="14-6" dnum="_-o:a-i" numlevel="1" lineno="236" slineno="5-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">include services included in local services lists;</amend></subsection><subsection ssid="14-8" dnum="_-o:b-i" numlevel="1" lineno="237" slineno="5-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">be in a form and format easily usable by:</amend><subsection ssid="14-25" dnum="_-o:i-i" numlevel="1" lineno="238" slineno="5-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1108" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="143" groupid="100" style="1" owner="jchristopherson" level="1" amendtag="end">first responders for the purpose of a referral described in Section <xref depth="3" refnumber="26B-5-121">26B-5-121</xref>; and</amend></subsection><subsection ssid="14-26" dnum="_-o:ii-i" numlevel="1" lineno="239" slineno="5-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="end">courts and prosecuting attorneys for the purpose of diversion as described in <ln numlevel="1" lineno="240" slineno="5-19"/>Section <xref depth="3" refnumber="77-2-5">77-2-5</xref>;</amend></subsection></subsection><subsection ssid="14-10" dnum="_-o:c-i" numlevel="1" lineno="241" slineno="5-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">list providers by name; and</amend></subsection><subsection ssid="14-14" dnum="_-o:d-i" numlevel="1" lineno="242" slineno="5-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">be organized by county.</amend></subsection></subsection><subsection ssid="14-15" dnum="_-o:4-i" numlevel="1" lineno="243" slineno="5-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1112" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall:</amend><subsection ssid="14-16" dnum="_-o:a-i" numlevel="1" lineno="244" slineno="5-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1113" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">publish the list on the department's website;</amend></subsection><subsection ssid="14-17" dnum="_-o:b-i" numlevel="1" lineno="245" slineno="5-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1114" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">ensure the list published on the department's website is searchable by, and accessible <ln numlevel="1" lineno="246" slineno="5-25"/>to:</amend><subsection ssid="14-19" dnum="_-o:i-i" numlevel="1" lineno="247" slineno="5-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1115" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="113" groupid="76" style="1" owner="jchristopherson" level="1" amendtag="end">first responders;</amend></subsection><subsection ssid="14-20" dnum="_-o:ii-i" numlevel="1" lineno="248" slineno="5-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1116" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="118" groupid="80" style="1" owner="jchristopherson" level="1" amendtag="end">county sheriffs and other county jail employees as appropriate;</amend></subsection><subsection ssid="14-21" dnum="_-o:iii-i" numlevel="1" lineno="249" slineno="5-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1117" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="123" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">courts and prosecuting attorneys;</amend></subsection><subsection ssid="14-22" dnum="_-o:iv-i" numlevel="1" lineno="250" slineno="5-29" ea="amend" anum="0" owner="jchristopherson" style="1" owner="jchristopherson" level="1" amendtag="end">the Division of Adult Probation and Parole created in Section <xref depth="3" refnumber="64-14-202">64-14-202</xref>; and</amend></subsection><subsection ssid="14-23" dnum="_-o:v-i" numlevel="1" lineno="251" slineno="5-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1119" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="133" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">health care providers; and</amend></subsection></subsection><subsection ssid="14-18" dnum="_-o:c-i" numlevel="1" lineno="252" slineno="5-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1120" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="72" style="1" owner="jchristopherson" level="1" amendtag="end">make the list available to first responders in print format for the purpose of providing <ln numlevel="1" lineno="253" slineno="5-32"/>the list to an individual as described in Subsection <xref depth="4" refnumber="26B-5-121(3)(c)">26B-5-121(3)(c)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="24" num="26B-5-331" type="amend" src="code" uid="C26B-5-S331_2026050620260506" sort="26B05 03310020260506" numlevel="1" lineno="254" slineno="6-1" sn="6"><section number="26B-5-331" numlevel="1" lineno="255" slineno="6-2" type="amend"><secline lineno="254">Section 6. Section <bold>26B-5-331</bold> is amended to read:</secline><catline lineno="255"><bold>26B-5-331<parens/>. Temporary commitment -- Requirements and procedures -- Rights.</bold></catline><subsection ssid="24-null-1" dnum="1-o" numlevel="1" lineno="256" slineno="6-3" level="1" placement="noreturn"><display>(1)</display>An adult shall be temporarily, involuntarily committed to a local mental health authority <ln numlevel="1" lineno="257" slineno="6-4"/>upon:<subsection ssid="24-null-2" dnum="a-o" numlevel="1" lineno="258" slineno="6-5" level="2"><display>(a)</display>a written application that:<subsection ssid="24-null-3" dnum="i-o" numlevel="1" lineno="259" slineno="6-6" level="3"><display>(i)</display>is completed by a responsible individual who has reason to know, stating a belief <ln numlevel="1" lineno="260" slineno="6-7"/>that the adult, due to mental illness, is likely to pose substantial danger to self or <ln numlevel="1" lineno="261" slineno="6-8"/>others if not restrained and stating the personal knowledge of the adult's condition <ln numlevel="1" lineno="262" slineno="6-9"/>or circumstances that lead to the individual's belief; and</subsection><subsection ssid="24-null-4" dnum="ii-o" numlevel="1" lineno="263" slineno="6-10" level="3"><display>(ii)</display>includes a certification by a licensed physician, licensed physician assistant, <ln numlevel="1" lineno="264" slineno="6-11"/>licensed nurse practitioner, or designated examiner stating that the physician, <ln numlevel="1" lineno="265" slineno="6-12"/>physician assistant, nurse practitioner, or designated examiner has examined the <ln numlevel="1" lineno="266" slineno="6-13"/>adult within a three-day period immediately preceding the certification, and that <ln numlevel="1" lineno="267" slineno="6-14"/>the physician, physician assistant, nurse practitioner, or designated examiner is of <ln numlevel="1" lineno="268" slineno="6-15"/>the opinion that, due to mental illness, the adult poses a substantial danger to self <ln numlevel="1" lineno="269" slineno="6-16"/>or others; or</subsection></subsection><subsection ssid="24-null-5" dnum="b-o" numlevel="1" lineno="270" slineno="6-17" level="2"><display>(b)</display>a peace officer or a mental health officer:<subsection ssid="24-null-6" dnum="i-o" numlevel="1" lineno="271" slineno="6-18" level="3"><display>(i)</display>observing an adult's conduct that gives the peace officer or mental health officer <ln numlevel="1" lineno="272" slineno="6-19"/>probable cause to believe that:<subsection ssid="24-null-7" dnum="A-o" numlevel="1" lineno="273" slineno="6-20" level="4"><display>(A)</display>the adult has a mental illness; and</subsection><subsection ssid="24-null-8" dnum="B-o" numlevel="1" lineno="274" slineno="6-21" level="4"><display>(B)</display>because of the adult's mental illness and conduct, the adult poses a substantial <ln numlevel="1" lineno="275" slineno="6-22"/>danger to self or others; and</subsection></subsection><subsection ssid="24-null-9" dnum="ii-o" numlevel="1" lineno="276" slineno="6-23" level="3"><display>(ii)</display>completing a temporary commitment application that:<subsection ssid="24-null-10" dnum="A-o" numlevel="1" lineno="277" slineno="6-24" level="4"><display>(A)</display>is on a form prescribed by the division;</subsection><subsection ssid="24-null-11" dnum="B-o" numlevel="1" lineno="278" slineno="6-25" level="4"><display>(B)</display>states the peace officer's or mental health officer's belief that the adult poses a <ln numlevel="1" lineno="279" slineno="6-26"/>substantial danger to self or others;</subsection><subsection ssid="24-null-12" dnum="C-o" numlevel="1" lineno="280" slineno="6-27" level="4"><display>(C)</display>states the specific nature of the danger;</subsection><subsection ssid="24-null-13" dnum="D-o" numlevel="1" lineno="281" slineno="6-28" level="4"><display>(D)</display>provides a summary of the observations upon which the statement of danger is <ln numlevel="1" lineno="282" slineno="6-29"/>based; and</subsection><subsection ssid="24-null-14" dnum="E-o" numlevel="1" lineno="283" slineno="6-30" level="4"><display>(E)</display>provides a statement of the facts that called the adult to the peace officer's or <ln numlevel="1" lineno="284" slineno="6-31"/>mental health officer's attention.</subsection></subsection></subsection></subsection><subsection ssid="24-null-15" dnum="2-o" numlevel="1" lineno="285" slineno="6-32" level="1"><display>(2)</display>If at any time a patient committed under this section no longer meets the commitment <ln numlevel="1" lineno="286" slineno="6-33"/>criteria described in Subsection <xref depth="4" refnumber="26B-5-331(1)">(1)</xref>, the local mental health authority's designee shall:<subsection ssid="24-null-16" dnum="a-o" numlevel="1" lineno="287" slineno="6-34" level="2"><display>(a)</display>document the change and release the patient; and</subsection><subsection ssid="24-null-17" dnum="b-o" numlevel="1" lineno="288" slineno="6-35" level="2"><display>(b)</display>if the patient was admitted under Subsection <xref depth="4" refnumber="26B-5-331(1)(b)">(1)(b)</xref>, notify the local mental health <ln numlevel="1" lineno="289" slineno="6-36"/>authority of the patient's release if deemed appropriate by a licensed health care <ln numlevel="1" lineno="290" slineno="6-37"/>provider or if the patient consents to the information being shared.</subsection></subsection><subsection ssid="24-null-18" dnum="3-o" numlevel="1" lineno="291" slineno="6-38" level="1"><display>(3)</display>A patient committed under this section may be held for a maximum of 72 hours after <ln numlevel="1" lineno="292" slineno="6-39"/>commitment, excluding Saturdays, Sundays, and state holidays, unless:<subsection ssid="24-null-19" dnum="a-o" numlevel="1" lineno="293" slineno="6-40" level="2"><display>(a)</display>as described in Section <xref depth="3" refnumber="26B-5-332">26B-5-332</xref>, an application for involuntary commitment is <ln numlevel="1" lineno="294" slineno="6-41"/>commenced, which may be accompanied by an order of detention described in <ln numlevel="1" lineno="295" slineno="6-42"/>Subsection <xref depth="4" refnumber="26B-5-332(4)">26B-5-332(4)</xref>; or</subsection><subsection ssid="24-null-20" dnum="b-o" numlevel="1" lineno="296" slineno="6-43" level="2"><display>(b)</display>the patient makes a voluntary application for admission.</subsection></subsection><subsection ssid="24-null-21" dnum="4-o" numlevel="1" lineno="297" slineno="6-44" level="1"><display>(4)</display>Upon a written application described in Subsection <xref depth="4" refnumber="26B-5-331(1)(a)">(1)(a)</xref> or the observation and belief <ln numlevel="1" lineno="298" slineno="6-45"/>described in Subsection <xref depth="4" refnumber="26B-5-331(1)(b)(i)">(1)(b)(i)</xref>, the adult shall be:<subsection ssid="24-null-22" dnum="a-o" numlevel="1" lineno="299" slineno="6-46" level="2"><display>(a)</display>taken into a peace officer's protective custody, by reasonable means, if necessary for <ln numlevel="1" lineno="300" slineno="6-47"/>public safety; and</subsection><subsection ssid="24-null-23" dnum="b-o" numlevel="1" lineno="301" slineno="6-48" level="2"><display>(b)</display>transported for temporary commitment to a facility designated by the local mental <ln numlevel="1" lineno="302" slineno="6-49"/>health authority, by means of:<subsection ssid="24-null-24" dnum="i-o" numlevel="1" lineno="303" slineno="6-50" level="3"><display>(i)</display>an ambulance, if the adult meets any of the criteria described in Section <xref depth="3" refnumber="53-2d-405">53-2d-405</xref>;</subsection><subsection ssid="24-null-25" dnum="ii-o" numlevel="1" lineno="304" slineno="6-51" level="3"><display>(ii)</display>an ambulance, if a peace officer is not necessary for public safety, and <ln numlevel="1" lineno="305" slineno="6-52"/>transportation arrangements are made by a physician, physician assistant, nurse <ln numlevel="1" lineno="306" slineno="6-53"/>practitioner, designated examiner, or mental health officer;</subsection><subsection ssid="24-null-26" dnum="iii-o" numlevel="1" lineno="307" slineno="6-54" level="3"><display>(iii)</display>the city, town, or municipal law enforcement authority with jurisdiction over the <ln numlevel="1" lineno="308" slineno="6-55"/>location where the adult is present, if the adult is not transported by ambulance;</subsection><subsection ssid="24-null-27" dnum="iv-o" numlevel="1" lineno="309" slineno="6-56" level="3"><display>(iv)</display>the county sheriff, if the designated facility is outside of the jurisdiction of the <ln numlevel="1" lineno="310" slineno="6-57"/>law enforcement authority described in Subsection <xref depth="4" refnumber="26B-5-331(4)(b)(iii)">(4)(b)(iii)</xref> and the adult is not <ln numlevel="1" lineno="311" slineno="6-58"/>transported by ambulance; or</subsection><subsection ssid="24-null-28" dnum="v-o" numlevel="1" lineno="312" slineno="6-59" level="3"><display>(v)</display>nonemergency secured behavioral health transport as that term is defined in <ln numlevel="1" lineno="313" slineno="6-60"/>Section <xref depth="3" refnumber="53-2d-101">53-2d-101</xref>.</subsection></subsection></subsection><subsection ssid="24-null-29" dnum="5-o" numlevel="1" lineno="314" slineno="6-61" level="1"><display>(5)</display>Notwithstanding Subsection <xref depth="4" refnumber="26B-5-331(4)">(4)</xref>:<subsection ssid="24-null-30" dnum="a-o" numlevel="1" lineno="315" slineno="6-62" level="2"><display>(a)</display>an individual shall be transported by ambulance to an appropriate medical facility for <ln numlevel="1" lineno="316" slineno="6-63"/>treatment if the individual requires physical medical attention;</subsection><subsection ssid="24-null-31" dnum="b-o" numlevel="1" lineno="317" slineno="6-64" level="2"><display>(b)</display>if an officer has probable cause to believe, based on the officer's experience and <ln numlevel="1" lineno="318" slineno="6-65"/>de-escalation training that taking an individual into protective custody or transporting <ln numlevel="1" lineno="319" slineno="6-66"/>an individual for temporary commitment would increase the risk of substantial <ln numlevel="1" lineno="320" slineno="6-67"/>danger to the individual or others, a peace officer may exercise discretion to not take <ln numlevel="1" lineno="321" slineno="6-68"/>the individual into custody or transport the individual, as permitted by policies and <ln numlevel="1" lineno="322" slineno="6-69"/>procedures established by the officer's law enforcement agency and any applicable <ln numlevel="1" lineno="323" slineno="6-70"/>federal or state statute, or case law; and</subsection><subsection ssid="24-null-32" dnum="c-o" numlevel="1" lineno="324" slineno="6-71" level="2"><display>(c)</display>if an officer exercises discretion under Subsection <xref depth="4" refnumber="26B-5-331(4)(b)">(4)(b)</xref> to not take an individual <ln numlevel="1" lineno="325" slineno="6-72"/>into protective custody or transport an individual, the officer shall document in the <ln numlevel="1" lineno="326" slineno="6-73"/>officer's report the details and circumstances that led to the officer's decision.</subsection></subsection><subsection ssid="24-null-33" dnum="6-o" numlevel="1" lineno="327" slineno="6-74" level="1" space="false"><display>(6)</display><subsection ssid="24-null-34" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The local mental health authority <amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">or the local mental health authority's designee </amend><ln numlevel="1" lineno="328" slineno="6-75"/>shall inform an adult patient committed under this section of the reason for <ln numlevel="1" lineno="329" slineno="6-76"/>commitment.</subsection><subsection ssid="24-null-35" dnum="b-o" numlevel="1" lineno="330" slineno="6-77" level="2"><display>(b)</display>An adult patient committed under this section has the right to:<subsection ssid="24-null-36" dnum="i-o" numlevel="1" lineno="331" slineno="6-78" level="3"><display>(i)</display>within three hours after arrival at the local mental health authority, make a <ln numlevel="1" lineno="332" slineno="6-79"/>telephone call, at the expense of the local mental health authority, to an individual <ln numlevel="1" lineno="333" slineno="6-80"/>of the patient's choice; and</subsection><subsection ssid="24-null-37" dnum="ii-o" numlevel="1" lineno="334" slineno="6-81" level="3"><display>(ii)</display>see and communicate with an attorney.</subsection></subsection></subsection><subsection ssid="24-null-38" dnum="7-o" numlevel="1" lineno="335" slineno="6-82" level="1" space="false"><display>(7)</display><subsection ssid="24-null-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Title 63G, Chapter 7, Governmental Immunity Act of Utah, applies to this section.</subsection><subsection ssid="24-null-40" dnum="b-o" numlevel="1" lineno="336" slineno="6-83" level="2"><display>(b)</display>This section does not create a special duty of care.</subsection></subsection><subsection ssid="24-null-41" dnum="8-o" numlevel="1" lineno="337" slineno="6-84" level="1" space="false"><display>(8)</display><subsection ssid="24-null-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local mental health authority or the local mental health authority's designee <ln numlevel="1" lineno="338" slineno="6-85"/>shall provide discharge instructions to each individual committed under this section <ln numlevel="1" lineno="339" slineno="6-86"/>at or before the time the individual is discharged from the local mental health <ln numlevel="1" lineno="340" slineno="6-87"/>authority's custody, regardless of whether the individual is discharged by being <ln numlevel="1" lineno="341" slineno="6-88"/>released, taken into a peace officer's protective custody, transported to a medical <ln numlevel="1" lineno="342" slineno="6-89"/>facility or other facility, or other circumstances.</subsection><subsection ssid="24-null-43" dnum="b-o" numlevel="1" lineno="343" slineno="6-90" level="2"><display>(b)</display>Discharge instructions provided under Subsection <xref depth="4" refnumber="26B-5-331(8)(a)">(8)(a)</xref> shall include:<subsection ssid="24-null-44" dnum="i-o" numlevel="1" lineno="344" slineno="6-91" level="3"><display>(i)</display>a safety plan for the individual based on the individual's mental illness or mental <ln numlevel="1" lineno="345" slineno="6-92"/>or emotional state, if applicable;</subsection><subsection ssid="24-null-45" dnum="ii-o" numlevel="1" lineno="346" slineno="6-93" level="3"><display>(ii)</display>notification to the individual's primary care provider, if applicable;</subsection><subsection ssid="24-null-46" dnum="iii-o" numlevel="1" lineno="347" slineno="6-94" level="3"><display>(iii)</display>if the individual is discharged without food, housing, or economic security, a <ln numlevel="1" lineno="348" slineno="6-95"/>referral to appropriate services, if such services exist in the individual's <ln numlevel="1" lineno="349" slineno="6-96"/>community;</subsection><subsection ssid="24-null-47" dnum="iv-o" numlevel="1" lineno="350" slineno="6-97" level="3"><display>(iv)</display>the phone number to call or text for a crisis services hotline, and information <ln numlevel="1" lineno="351" slineno="6-98"/>about the availability of peer support services;</subsection><subsection ssid="24-null-48" dnum="v-o" numlevel="1" lineno="352" slineno="6-99" level="3"><display>(v)</display>a copy of any psychiatric advance directive, if applicable;</subsection><subsection ssid="24-null-49" dnum="vi-o" numlevel="1" lineno="353" slineno="6-100" level="3"><display>(vi)</display>information about how to establish a psychiatric advance directive if one has not <ln numlevel="1" lineno="354" slineno="6-101"/>been completed;</subsection><subsection ssid="24-null-50" dnum="vii-o" numlevel="1" lineno="355" slineno="6-102" level="3"><display>(vii)</display>as applicable, information about medications that were changed or discontinued <ln numlevel="1" lineno="356" slineno="6-103"/>during the commitment;</subsection><subsection ssid="24-null-51" dnum="viii-o" numlevel="1" lineno="357" slineno="6-104" level="3"><display>(viii)</display>information about how to contact the local mental health authority if needed; <ln numlevel="1" lineno="358" slineno="6-105"/>and</subsection><subsection ssid="24-null-52" dnum="ix-o" numlevel="1" lineno="359" slineno="6-106" level="3"><display>(ix)</display>information about how to request a copy of the individual's medical record and <ln numlevel="1" lineno="360" slineno="6-107"/>how to access the electronic patient portal for the individual's medical record.</subsection></subsection><subsection ssid="24-null-53" dnum="c-o" numlevel="1" lineno="361" slineno="6-108" level="2"><display>(c)</display>If an individual's medications were changed, or if an individual was prescribed new <ln numlevel="1" lineno="362" slineno="6-109"/>medications while committed under this section, discharge instructions provided <ln numlevel="1" lineno="363" slineno="6-110"/>under Subsection <xref depth="4" refnumber="26B-5-331(8)(a)">(8)(a)</xref> shall include a clinically appropriate supply of medications, <ln numlevel="1" lineno="364" slineno="6-111"/>as determined by a licensed health care provider, to allow the individual time to <ln numlevel="1" lineno="365" slineno="6-112"/>access another health care provider or follow-up appointment.</subsection><subsection ssid="24-null-54" dnum="d-o" numlevel="1" lineno="366" slineno="6-113" level="2"><display>(d)</display>Discharge instructions shall be provided in paper or electronic format based on the <ln numlevel="1" lineno="367" slineno="6-114"/>individual's preference.</subsection><subsection ssid="24-null-55" dnum="e-o" numlevel="1" lineno="368" slineno="6-115" level="2"><display>(e)</display>If an individual refuses to accept discharge instructions, the local mental health <ln numlevel="1" lineno="369" slineno="6-116"/>authority or the local mental health authority's designee shall document the refusal in <ln numlevel="1" lineno="370" slineno="6-117"/>the individual's medical record.</subsection><subsection ssid="24-null-56" dnum="f-o" numlevel="1" lineno="371" slineno="6-118" level="2"><display>(f)</display>If an individual's discharge instructions include referrals to services under Subsection <xref depth="4" refnumber="26B-5-331(8)(b)(iii)"><ln numlevel="1" lineno="372" slineno="6-119"/>(8)(b)(iii)</xref>, the local mental health authority or the local mental health authority's <ln numlevel="1" lineno="373" slineno="6-120"/>designee shall document those referrals in the individual's medical record.</subsection><subsection ssid="24-null-57" dnum="g-o" numlevel="1" lineno="374" slineno="6-121" level="2"><display>(g)</display>The local mental health authority shall attempt to follow up with a discharged <ln numlevel="1" lineno="375" slineno="6-122"/>individual at least 48 hours after discharge, when appropriate, and may use peer <ln numlevel="1" lineno="376" slineno="6-123"/>support professionals when performing follow-up care or developing a continuing <ln numlevel="1" lineno="377" slineno="6-124"/>care plan.</subsection></subsection></section></bsec><bsec buid="2" num="26B-5-332" type="amend" src="code" uid="C26B-5-S332_2026050620260506" sort="26B05 03320020260506" numlevel="1" lineno="378" slineno="7-1" sn="7"><section number="26B-5-332" numlevel="1" lineno="379" slineno="7-2" type="amend"><secline lineno="378">Section 7. Section <bold>26B-5-332</bold> is amended to read:</secline><catline lineno="379"><bold>26B-5-332<parens/>. Involuntary commitment under court order -- Examination -- <ln numlevel="1" lineno="380" slineno="7-3"/>Hearing -- Power of court -- Findings required -- Costs.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="381" slineno="7-4" level="1" placement="noreturn"><display>(1)</display>A responsible individual who has credible knowledge of an adult's mental illness and <ln numlevel="1" lineno="382" slineno="7-5"/>the condition or circumstances that have led to the adult's need to be involuntarily <ln numlevel="1" lineno="383" slineno="7-6"/>committed may initiate an involuntary commitment court proceeding by filing, in the <ln numlevel="1" lineno="384" slineno="7-7"/>court in the county where the proposed patient resides or is found, a written application <ln numlevel="1" lineno="385" slineno="7-8"/>that includes:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="386" slineno="7-9" level="2"><display>(a)</display>unless the court finds that the information is not reasonably available, the proposed <ln numlevel="1" lineno="387" slineno="7-10"/>patient's:<subsection ssid="2-null-3" dnum="i-o" numlevel="1" lineno="388" slineno="7-11" level="3"><display>(i)</display>name;</subsection><subsection ssid="2-null-4" dnum="ii-o" numlevel="1" lineno="389" slineno="7-12" level="3"><display>(ii)</display>date of birth; and</subsection><subsection ssid="2-null-5" dnum="iii-o" numlevel="1" lineno="390" slineno="7-13" level="3"><display>(iii)</display>social security number;</subsection></subsection><subsection ssid="2-null-6" dnum="b-o" numlevel="1" lineno="391" slineno="7-14" level="2" space="false"><display>(b)</display><subsection ssid="2-null-7" dnum="i-o" level="3" placement="sameline"><display>(i)</display>a certificate of a licensed physician or a designated examiner stating that within <ln numlevel="1" lineno="392" slineno="7-15"/>the seven-day period immediately preceding the certification, the physician or <ln numlevel="1" lineno="393" slineno="7-16"/>designated examiner examined the proposed patient and is of the opinion that the <ln numlevel="1" lineno="394" slineno="7-17"/>proposed patient has a mental illness and should be involuntarily committed; or</subsection><subsection ssid="2-null-8" dnum="ii-o" numlevel="1" lineno="395" slineno="7-18" level="3"><display>(ii)</display>a written statement by the applicant that:<subsection ssid="2-null-9" dnum="A-o" numlevel="1" lineno="396" slineno="7-19" level="4"><display>(A)</display>the proposed patient has been requested to, but has refused to, submit to an <ln numlevel="1" lineno="397" slineno="7-20"/>examination of mental condition by a licensed physician or designated <ln numlevel="1" lineno="398" slineno="7-21"/>examiner;</subsection><subsection ssid="2-null-10" dnum="B-o" numlevel="1" lineno="399" slineno="7-22" level="4"><display>(B)</display>is sworn to under oath; and</subsection><subsection ssid="2-null-11" dnum="C-o" numlevel="1" lineno="400" slineno="7-23" level="4"><display>(C)</display>states the facts upon which the application is based; and</subsection></subsection></subsection><subsection ssid="2-null-12" dnum="c-o" numlevel="1" lineno="401" slineno="7-24" level="2"><display>(c)</display>a statement whether the proposed patient has previously been under an assisted <ln numlevel="1" lineno="402" slineno="7-25"/>outpatient treatment order, if known by the applicant.</subsection></subsection><subsection ssid="2-null-13" dnum="2-o" numlevel="1" lineno="403" slineno="7-26" level="1"><display>(2)</display>Before issuing a judicial order, the court:<subsection ssid="2-null-14" dnum="a-o" numlevel="1" lineno="404" slineno="7-27" level="2"><display>(a)</display>shall require the applicant to consult with the appropriate local mental health <ln numlevel="1" lineno="405" slineno="7-28"/>authority at or before the hearing; and</subsection><subsection ssid="2-null-15" dnum="b-o" numlevel="1" lineno="406" slineno="7-29" level="2"><display>(b)</display>may direct a mental health professional from the local mental health authority to <ln numlevel="1" lineno="407" slineno="7-30"/>interview the applicant and the proposed patient to determine the existing facts and <ln numlevel="1" lineno="408" slineno="7-31"/>report the existing facts to the court.</subsection></subsection><subsection ssid="2-null-16" dnum="3-o" numlevel="1" lineno="409" slineno="7-32" level="1"><display>(3)</display>The court may issue an order, directed to a mental health officer or peace officer, to <ln numlevel="1" lineno="410" slineno="7-33"/>immediately place a proposed patient in the custody of a local mental health authority or <ln numlevel="1" lineno="411" slineno="7-34"/>in a temporary emergency facility, as described in Section <xref depth="3" refnumber="26B-5-334">26B-5-334</xref>, to be detained for <ln numlevel="1" lineno="412" slineno="7-35"/>the purpose of examination if:<subsection ssid="2-null-17" dnum="a-o" numlevel="1" lineno="413" slineno="7-36" level="2"><display>(a)</display>the court finds from the application, any other statements under oath, or any reports <ln numlevel="1" lineno="414" slineno="7-37"/>from a mental health professional that there is a reasonable basis to believe that the <ln numlevel="1" lineno="415" slineno="7-38"/>proposed patient has a mental illness that poses a danger to self or others and requires <ln numlevel="1" lineno="416" slineno="7-39"/>involuntary commitment pending examination and hearing; or</subsection><subsection ssid="2-null-18" dnum="b-o" numlevel="1" lineno="417" slineno="7-40" level="2"><display>(b)</display>the proposed patient refuses to submit to an interview with a mental health <ln numlevel="1" lineno="418" slineno="7-41"/>professional as directed by the court or to go to a treatment facility voluntarily.</subsection></subsection><subsection ssid="2-null-19" dnum="4-o" numlevel="1" lineno="419" slineno="7-42" level="1" space="false"><display>(4)</display><subsection ssid="2-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The court shall provide notice of commencement of proceedings for involuntary <ln numlevel="1" lineno="420" slineno="7-43"/>commitment, setting forth the allegations of the application and any reported facts, <ln numlevel="1" lineno="421" slineno="7-44"/>together with a copy of any official order of detention, to a proposed patient before, <ln numlevel="1" lineno="422" slineno="7-45"/>or upon, placement of the proposed patient in the custody of a local mental health <ln numlevel="1" lineno="423" slineno="7-46"/>authority or, with respect to any proposed patient presently in the custody of a local <ln numlevel="1" lineno="424" slineno="7-47"/>mental health authority whose status is being changed from voluntary to involuntary, <ln numlevel="1" lineno="425" slineno="7-48"/>upon the filing of an application for that purpose with the court.</subsection><subsection ssid="2-null-21" dnum="b-o" numlevel="1" lineno="426" slineno="7-49" level="2"><display>(b)</display>The place of detention shall maintain a copy of the order of detention.</subsection></subsection><subsection ssid="2-null-22" dnum="5-o" numlevel="1" lineno="427" slineno="7-50" level="1" space="false"><display>(5)</display><subsection ssid="2-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The court shall provide notice of commencement of proceedings for involuntary <ln numlevel="1" lineno="428" slineno="7-51"/>commitment as soon as practicable to the applicant, any legal guardian, any <ln numlevel="1" lineno="429" slineno="7-52"/>immediate adult family members, legal counsel for the parties involved, the local <ln numlevel="1" lineno="430" slineno="7-53"/>mental health authority or the local mental health authority's designee, and any other <ln numlevel="1" lineno="431" slineno="7-54"/>persons whom the proposed patient or the court designates.</subsection><subsection ssid="2-null-24" dnum="b-o" numlevel="1" lineno="432" slineno="7-55" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="26B-5-332(5)(c)">(5)(c)</xref>, the notice under Subsection <xref depth="4" refnumber="26B-5-332(5)(a)">(5)(a)</xref> shall <ln numlevel="1" lineno="433" slineno="7-56"/>advise the persons that a hearing may be held within the time provided by law.</subsection><subsection ssid="2-null-25" dnum="c-o" numlevel="1" lineno="434" slineno="7-57" level="2"><display>(c)</display>If the proposed patient refuses to permit release of information necessary for <ln numlevel="1" lineno="435" slineno="7-58"/>provisions of notice under this subsection, the court shall determine the extent of <ln numlevel="1" lineno="436" slineno="7-59"/>notice.</subsection></subsection><subsection ssid="2-null-26" dnum="6-o" numlevel="1" lineno="437" slineno="7-60" level="1"><display>(6)</display>Proceedings for commitment of an individual under 18 years old to a local mental health <ln numlevel="1" lineno="438" slineno="7-61"/>authority may be commenced in accordance with Part 4, Commitment of Persons Under <ln numlevel="1" lineno="439" slineno="7-62"/>Age 18.</subsection><subsection ssid="2-null-27" dnum="7-o" numlevel="1" lineno="440" slineno="7-63" level="1" space="false"><display>(7)</display><subsection ssid="2-null-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The court may, in the court's discretion, transfer the case to any other district court <ln numlevel="1" lineno="441" slineno="7-64"/>within this state, if the transfer will not be adverse to the interest of the proposed <ln numlevel="1" lineno="442" slineno="7-65"/>patient.</subsection><subsection ssid="2-null-29" dnum="b-o" numlevel="1" lineno="443" slineno="7-66" level="2"><display>(b)</display>If a case is transferred under Subsection <xref depth="4" refnumber="26B-5-332(7)(a)">(7)(a)</xref>, the parties to the case may be <ln numlevel="1" lineno="444" slineno="7-67"/>transferred and the local mental health authority may be substituted in accordance <ln numlevel="1" lineno="445" slineno="7-68"/>with Utah Rules of Civil Procedure, Rule 25.</subsection></subsection><subsection ssid="2-null-30" dnum="8-o" numlevel="1" lineno="446" slineno="7-69" level="1" space="false"><display>(8)</display><subsection ssid="2-151" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1208" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>Within 24 hours, excluding Saturdays, Sundays, and legal holidays, of the <ln numlevel="1" lineno="447" slineno="7-70"/>issuance of a judicial order, or after commitment of a proposed patient to a local <ln numlevel="1" lineno="448" slineno="7-71"/>mental health authority or the local mental health authority's designee under court <ln numlevel="1" lineno="449" slineno="7-72"/>order for detention or examination, the court shall appoint <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">two</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">one</amend> designated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="450" slineno="7-73"/>examiners</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">examiner</amend>:<subsection ssid="2-null-31" dnum="a-o:i-i" numlevel="1" lineno="451" slineno="7-74" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1209" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1210" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>who did not sign the civil commitment application nor the civil commitment <ln numlevel="1" lineno="452" slineno="7-75"/>certification under Subsection <xref depth="4" refnumber="26B-5-332(1)">(1)</xref>;</subsection><subsection ssid="2-null-32" dnum="b-o:ii-i" numlevel="1" lineno="453" slineno="7-76" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1210" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1211" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="35" style="2" owner="jchristopherson" level="1" deltag="both">one of whom</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">who</amend> is:<subsection ssid="2-null-33" dnum="i-o:A-i" numlevel="1" lineno="454" slineno="7-77" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1211" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1212" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>a licensed physician; or</subsection><subsection ssid="2-null-34" dnum="ii-o:B-i" numlevel="1" lineno="455" slineno="7-78" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1212" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1213" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>a psychiatric mental health nurse practitioner or a psychiatric mental <ln numlevel="1" lineno="456" slineno="7-79"/>health clinical nurse specialist who:<subsection ssid="2-null-35" dnum="A-o:I-i" numlevel="1" lineno="457" slineno="7-80" level="5"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1213" style="2" owner="o" level="1" deltag="both">(A)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1" amendtag="both" space="true">(I)</amend></display>is nationally certified;</subsection><subsection ssid="2-null-36" dnum="B-o:II-i" numlevel="1" lineno="458" slineno="7-81" level="5"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1214" style="2" owner="o" level="1" deltag="both">(B)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1215" style="1" owner="i" level="1" amendtag="both" space="true">(II)</amend></display>is doctorally trained; and</subsection><subsection ssid="2-null-37" dnum="C-o:III-i" numlevel="1" lineno="459" slineno="7-82" level="5"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1215" style="2" owner="o" level="1" deltag="both">(C)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="both" space="true">(III)</amend></display>has at least two years of inpatient mental health experience, <ln numlevel="1" lineno="460" slineno="7-83"/>regardless of the license the individual held at the time of that experience; <ln numlevel="1" lineno="461" slineno="7-84"/>and</subsection></subsection></subsection><subsection ssid="2-null-38" dnum="c-o:iii-i" numlevel="1" lineno="462" slineno="7-85" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1216" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="36" style="2" owner="jchristopherson" level="1" deltag="both">one of whom</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">who</amend> may be designated by the proposed patient or the <ln numlevel="1" lineno="463" slineno="7-86"/>proposed patient's counsel, if that designated examiner is reasonably available.</subsection></subsection><subsection ssid="2-153" dnum="_-o:b-i" numlevel="1" lineno="464" slineno="7-87" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="54" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">The court may order a second dedicated examiner to examine the proposed patient <ln numlevel="1" lineno="465" slineno="7-88"/>after the first designated examiner's examination is complete, upon request of the <ln numlevel="1" lineno="466" slineno="7-89"/>applicant or local mental health authority.</amend></subsection></subsection><subsection ssid="2-null-39" dnum="9-o" numlevel="1" lineno="467" slineno="7-90" level="1"><display>(9)</display>The court shall schedule a hearing to be held within 10 calendar days after the day on <ln numlevel="1" lineno="468" slineno="7-91"/>which the designated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="40" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both">examiners are</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">examiner is</amend> appointed.</subsection><subsection ssid="2-null-40" dnum="10-o" numlevel="1" lineno="469" slineno="7-92" level="1" space="false"><display>(10)</display><subsection ssid="2-null-41" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="42" groupid="39" style="2" owner="jchristopherson" level="1" deltag="both">The designated</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><marker pairid="85">If more </marker>than one examiner is appointed as described in <ln numlevel="1" lineno="470" slineno="7-93"/>Subsection <xref depth="4" refnumber="26B-5-332(8)(b)">(8)(b)</xref>, the</amend> examiners shall conduct the examinations separately.</subsection><subsection ssid="2-null-42" dnum="b-o" numlevel="1" lineno="471" slineno="7-94" level="2"><display>(b)</display>The designated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="65" groupid="60" style="2" owner="jchristopherson" level="1" deltag="both">examiners</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="61" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">examiner</amend> shall conduct the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="84" groupid="79" style="2" owner="jchristopherson" level="1" deltag="both">examinations</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="83" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">examination</amend>: <subsection ssid="2-null-43" dnum="i-o" numlevel="1" lineno="472" slineno="7-95" level="3"><display>(i)</display>through telehealth unless the designated examiner determines that: <subsection ssid="2-null-44" dnum="A-o" numlevel="1" lineno="473" slineno="7-96" level="4"><display>(A)</display>a telehealth examination would not be sufficient to properly assess the <ln numlevel="1" lineno="474" slineno="7-97"/>proposed patient;</subsection><subsection ssid="2-null-45" dnum="B-o" numlevel="1" lineno="475" slineno="7-98" level="4"><display>(B)</display>a telehealth examination would have a harmful effect on the proposed patient's <ln numlevel="1" lineno="476" slineno="7-99"/>health; or</subsection><subsection ssid="2-null-46" dnum="C-o" numlevel="1" lineno="477" slineno="7-100" level="4"><display>(C)</display>an in-person examination can be conducted as effectively, conveniently, and <ln numlevel="1" lineno="478" slineno="7-101"/>timely as an examination through telehealth; and</subsection></subsection><subsection ssid="2-null-47" dnum="ii-o" numlevel="1" lineno="479" slineno="7-102" level="3"><display>(ii)</display>if the designated examiner determines, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">in accordance with</amend> <ln numlevel="1" lineno="480" slineno="7-103"/>Subsection <xref tempid="762" depth="4" refnumber="26B-5-332(10)(b)(i)">(10)(b)(i)</xref>, that the examination should be conducted in person, at the <ln numlevel="1" lineno="481" slineno="7-104"/>home of the proposed patient, at a hospital or other medical facility, or at any <ln numlevel="1" lineno="482" slineno="7-105"/>other suitable place that is not likely to have a harmful effect on the proposed <ln numlevel="1" lineno="483" slineno="7-106"/>patient's health.</subsection></subsection><subsection ssid="2-null-48" dnum="c-o" numlevel="1" lineno="484" slineno="7-107" level="2"><display>(c)</display>The designated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="68" groupid="63" style="2" owner="jchristopherson" level="1" deltag="both">examiners</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="62" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">examiner</amend> shall inform the proposed patient, if not <ln numlevel="1" lineno="485" slineno="7-108"/>represented by an attorney:<subsection ssid="2-null-49" dnum="i-o" numlevel="1" lineno="486" slineno="7-109" level="3"><display>(i)</display>that the proposed patient does not have to say anything;</subsection><subsection ssid="2-null-50" dnum="ii-o" numlevel="1" lineno="487" slineno="7-110" level="3"><display>(ii)</display>of the nature and reasons for the examination;</subsection><subsection ssid="2-null-51" dnum="iii-o" numlevel="1" lineno="488" slineno="7-111" level="3"><display>(iii)</display>that the examination was ordered by the court;</subsection><subsection ssid="2-null-52" dnum="iv-o" numlevel="1" lineno="489" slineno="7-112" level="3"><display>(iv)</display>that any information volunteered could form part of the basis for the proposed <ln numlevel="1" lineno="490" slineno="7-113"/>patient's involuntary commitment;</subsection><subsection ssid="2-null-53" dnum="v-o" numlevel="1" lineno="491" slineno="7-114" level="3"><display>(v)</display>that findings resulting from the examination will be made available to the court; <ln numlevel="1" lineno="492" slineno="7-115"/>and</subsection><subsection ssid="2-null-54" dnum="vi-o" numlevel="1" lineno="493" slineno="7-116" level="3"><display>(vi)</display>that the designated examiner may, under court order, obtain the proposed <ln numlevel="1" lineno="494" slineno="7-117"/>patient's mental health records.</subsection></subsection><subsection ssid="2-null-55" dnum="d-o" numlevel="1" lineno="495" slineno="7-118" level="2"><display>(d)</display>Within 24 hours of examining the proposed patient, a designated examiner shall <ln numlevel="1" lineno="496" slineno="7-119"/>report to the court, orally or in writing, whether the proposed patient is mentally ill, <ln numlevel="1" lineno="497" slineno="7-120"/>has agreed to voluntary commitment, as described in Section <xref depth="3" refnumber="26B-5-360">26B-5-360</xref>, or has <ln numlevel="1" lineno="498" slineno="7-121"/>acceptable programs available to the proposed patient without court proceedings.</subsection><subsection ssid="2-null-56" dnum="e-o" numlevel="1" lineno="499" slineno="7-122" level="2"><display>(e)</display>If a designated examiner reports orally under Subsection <xref depth="4" refnumber="26B-5-332(10)(d)">(10)(d)</xref>, the designated <ln numlevel="1" lineno="500" slineno="7-123"/>examiner shall immediately send a written report to the clerk of the court.</subsection></subsection><subsection ssid="2-null-57" dnum="11-o" numlevel="1" lineno="501" slineno="7-124" level="1"><display>(11)</display>If a designated examiner is unable to complete an examination on the first attempt <ln numlevel="1" lineno="502" slineno="7-125"/>because the proposed patient refuses to submit to the examination, the court shall fix a <ln numlevel="1" lineno="503" slineno="7-126"/>reasonable compensation to be paid to the examiner.</subsection><subsection ssid="2-null-58" dnum="12-o" numlevel="1" lineno="504" slineno="7-127" level="1"><display>(12)</display>If the local mental health authority, the local mental health authority's designee, or a <ln numlevel="1" lineno="505" slineno="7-128"/>medical examiner determines before the court hearing that the conditions justifying the <ln numlevel="1" lineno="506" slineno="7-129"/>findings leading to a commitment hearing no longer exist, the local mental health <ln numlevel="1" lineno="507" slineno="7-130"/>authority, the local mental health authority's designee, or the medical examiner shall <ln numlevel="1" lineno="508" slineno="7-131"/>immediately report the determination to the court.</subsection><subsection ssid="2-null-59" dnum="13-o" numlevel="1" lineno="509" slineno="7-132" level="1" space="false"><display>(13)</display><subsection ssid="2-null-60" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The court shall terminate the proceedings and dismiss the application before the <ln numlevel="1" lineno="510" slineno="7-133"/>hearing if <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="66" style="2" owner="jchristopherson" level="1" deltag="both">both designated examiners inform</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="63" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a designated examiner informs</amend> the <ln numlevel="1" lineno="511" slineno="7-134"/>court that the proposed patient does not meet the criteria in Subsection <xref refnumber="26B-5-332(16)" depth="4">(16)</xref>.</subsection><subsection ssid="2-null-61" dnum="b-o" numlevel="1" lineno="512" slineno="7-135" level="2"><display>(b)</display>The court may terminate the proceedings and dismiss the application at any time, <ln numlevel="1" lineno="513" slineno="7-136"/>including before the hearing, if the designated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="74" groupid="69" style="2" owner="jchristopherson" level="1" deltag="both">examiners</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="64" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">examiner</amend> or the local <ln numlevel="1" lineno="514" slineno="7-137"/>mental health authority or the local mental health authority's designee informs the <ln numlevel="1" lineno="515" slineno="7-138"/>court that the proposed patient:<subsection ssid="2-null-62" dnum="i-o" numlevel="1" lineno="516" slineno="7-139" level="3"><display>(i)</display>has agreed to voluntary commitment, as described in Section <xref depth="3" refnumber="26B-5-360">26B-5-360</xref>;</subsection><subsection ssid="2-null-63" dnum="ii-o" numlevel="1" lineno="517" slineno="7-140" level="3"><display>(ii)</display>has acceptable options for treatment programs that are available without court <ln numlevel="1" lineno="518" slineno="7-141"/>proceedings; or</subsection><subsection ssid="2-null-64" dnum="iii-o" numlevel="1" lineno="519" slineno="7-142" level="3"><display>(iii)</display>meets the criteria for assisted outpatient treatment described in Section <xref depth="3" refnumber="26B-5-351"><ln numlevel="1" lineno="520" slineno="7-143"/>26B-5-351</xref>.</subsection></subsection></subsection><subsection ssid="2-null-65" dnum="14-o" numlevel="1" lineno="521" slineno="7-144" level="1" space="false"><display>(14)</display><subsection ssid="2-null-66" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Before the hearing, the court shall provide the proposed patient an opportunity to <ln numlevel="1" lineno="522" slineno="7-145"/>be represented by counsel, and if neither the proposed patient nor others provide <ln numlevel="1" lineno="523" slineno="7-146"/>counsel, the court shall appoint counsel and allow counsel sufficient time to consult <ln numlevel="1" lineno="524" slineno="7-147"/>with the proposed patient before the hearing.</subsection><subsection ssid="2-null-67" dnum="b-o" numlevel="1" lineno="525" slineno="7-148" level="2"><display>(b)</display>In the case of an indigent proposed patient, the county in which the proposed patient <ln numlevel="1" lineno="526" slineno="7-149"/>resides or is found shall make payment of reasonable attorney fees for counsel, as <ln numlevel="1" lineno="527" slineno="7-150"/>determined by the court.</subsection></subsection><subsection ssid="2-null-68" dnum="15-o" numlevel="1" lineno="528" slineno="7-151" level="1" space="false"><display>(15)</display><subsection ssid="2-null-69" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="2-null-70" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>The court shall afford the proposed patient, the applicant, and any other <ln numlevel="1" lineno="529" slineno="7-152"/>person to whom notice is required to be given an opportunity to appear at the <ln numlevel="1" lineno="530" slineno="7-153"/>hearing, to testify, and to present and cross-examine witnesses.</subsection><subsection ssid="2-null-71" dnum="ii-o" numlevel="1" lineno="531" slineno="7-154" level="3" tab="1"><display>(ii)</display>The court may, in the court's discretion, receive the testimony of any other person.</subsection><subsection ssid="2-null-72" dnum="iii-o" numlevel="1" lineno="532" slineno="7-155" level="3" tab="1"><display>(iii)</display>The court may allow a waiver of the proposed patient's right to appear for good <ln numlevel="1" lineno="533" slineno="7-156"/>cause, which cause shall be set forth in the record, or an informed waiver by the <ln numlevel="1" lineno="534" slineno="7-157"/>patient, which shall be included in the record.</subsection></subsection><subsection ssid="2-null-73" dnum="b-o" numlevel="1" lineno="535" slineno="7-158" level="2"><display>(b)</display>The court is authorized to exclude any person not necessary for the conduct of the <ln numlevel="1" lineno="536" slineno="7-159"/>proceedings and may, upon motion of counsel, require the testimony of each <ln numlevel="1" lineno="537" slineno="7-160"/>designated examiner to be given out of the presence of any other designated <ln numlevel="1" lineno="538" slineno="7-161"/>examiners.</subsection><subsection ssid="2-null-74" dnum="c-o" numlevel="1" lineno="539" slineno="7-162" level="2"><display>(c)</display>The court shall: <subsection ssid="2-null-75" dnum="i-o" numlevel="1" lineno="540" slineno="7-163" level="3"><display>(i)</display>conduct the hearing in as informal a manner as may be consistent with orderly <ln numlevel="1" lineno="541" slineno="7-164"/>procedure; and </subsection><subsection ssid="2-null-76" dnum="ii-o" numlevel="1" lineno="542" slineno="7-165" level="3"><display>(ii)</display>while preserving the due process rights of the proposed patient:<subsection ssid="2-null-77" dnum="A-o" numlevel="1" lineno="543" slineno="7-166" level="4"><display>(A)</display>conduct the hearing remotely, in accordance with Utah Rules of Civil <ln numlevel="1" lineno="544" slineno="7-167"/>Procedure, Rule 87, unless the court finds good cause under Rule 87 not to <ln numlevel="1" lineno="545" slineno="7-168"/>conduct the hearing remotely; or</subsection><subsection ssid="2-null-78" dnum="B-o" numlevel="1" lineno="546" slineno="7-169" level="4"><display>(B)</display>if the court finds good cause under Rule 87 not to conduct the hearing <ln numlevel="1" lineno="547" slineno="7-170"/>remotely, conduct the hearing in a physical setting that is not likely to have a <ln numlevel="1" lineno="548" slineno="7-171"/>harmful effect on the mental health of the proposed patient.</subsection></subsection></subsection><subsection ssid="2-null-79" dnum="d-o" numlevel="1" lineno="549" slineno="7-172" level="2"><display>(d)</display>The court shall consider any relevant historical and material information that is <ln numlevel="1" lineno="550" slineno="7-173"/>offered, subject to the rules of evidence, including reliable hearsay under Utah Rules <ln numlevel="1" lineno="551" slineno="7-174"/>of Evidence, Rule 1102.</subsection><subsection ssid="2-null-80" dnum="e-o" numlevel="1" lineno="552" slineno="7-175" level="2" space="false"><display>(e)</display><subsection ssid="2-null-81" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A local mental health authority or the local mental health authority's designee <ln numlevel="1" lineno="553" slineno="7-176"/>or the physician in charge of the proposed patient's care shall, at the time of the <ln numlevel="1" lineno="554" slineno="7-177"/>hearing, provide the court with the following information:<subsection ssid="2-null-82" dnum="A-o" numlevel="1" lineno="555" slineno="7-178" level="4" tab="1"><display>(A)</display>the detention order;</subsection><subsection ssid="2-null-83" dnum="B-o" numlevel="1" lineno="556" slineno="7-179" level="4" tab="1"><display>(B)</display>admission notes;</subsection><subsection ssid="2-null-84" dnum="C-o" numlevel="1" lineno="557" slineno="7-180" level="4" tab="1"><display>(C)</display>the diagnosis;</subsection><subsection ssid="2-null-85" dnum="D-o" numlevel="1" lineno="558" slineno="7-181" level="4" tab="1"><display>(D)</display>any doctors' orders;</subsection><subsection ssid="2-null-86" dnum="E-o" numlevel="1" lineno="559" slineno="7-182" level="4" tab="1"><display>(E)</display>progress notes;</subsection><subsection ssid="2-null-87" dnum="F-o" numlevel="1" lineno="560" slineno="7-183" level="4" tab="1"><display>(F)</display>nursing notes;</subsection><subsection ssid="2-null-88" dnum="G-o" numlevel="1" lineno="561" slineno="7-184" level="4" tab="1"><display>(G)</display>medication records pertaining to the current commitment; and</subsection><subsection ssid="2-null-89" dnum="H-o" numlevel="1" lineno="562" slineno="7-185" level="4" tab="1"><display>(H)</display>whether the proposed patient has previously been civilly committed or under <ln numlevel="1" lineno="563" slineno="7-186"/>an order for assisted outpatient treatment.</subsection></subsection><subsection ssid="2-null-90" dnum="ii-o" numlevel="1" lineno="564" slineno="7-187" level="3"><display>(ii)</display>The local mental health authority or the local mental health authority's designee <ln numlevel="1" lineno="565" slineno="7-188"/>or the physician in charge of the proposed patient's care shall also supply the <ln numlevel="1" lineno="566" slineno="7-189"/>information described in Subsection <xref depth="4" refnumber="26B-5-332(15)(e)(i)">(15)(e)(i)</xref> to the proposed patient's counsel at <ln numlevel="1" lineno="567" slineno="7-190"/>the time of the hearing, and at any time prior to the hearing upon request by the <ln numlevel="1" lineno="568" slineno="7-191"/>proposed patient's counsel.</subsection></subsection></subsection><subsection ssid="2-null-91" dnum="16-o" numlevel="1" lineno="569" slineno="7-192" level="1" space="false"><display>(16)</display><subsection ssid="2-null-92" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The court shall order commitment of an adult proposed patient to a local mental <ln numlevel="1" lineno="570" slineno="7-193"/>health authority if, upon completion of the hearing and consideration of the <ln numlevel="1" lineno="571" slineno="7-194"/>information presented, the court finds by clear and convincing evidence that:<subsection ssid="2-null-93" dnum="i-o" numlevel="1" lineno="572" slineno="7-195" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="2-null-94" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the proposed patient has a mental illness;</subsection><subsection ssid="2-null-95" dnum="B-o" numlevel="1" lineno="573" slineno="7-196" level="4"><display>(B)</display>because of the proposed patient's mental illness the proposed patient poses a <ln numlevel="1" lineno="574" slineno="7-197"/>substantial danger to self or others;</subsection><subsection ssid="2-null-96" dnum="C-o" numlevel="1" lineno="575" slineno="7-198" level="4"><display>(C)</display>the proposed patient lacks the ability to engage in a rational decision-making <ln numlevel="1" lineno="576" slineno="7-199"/>process regarding the acceptance of mental treatment as demonstrated by <ln numlevel="1" lineno="577" slineno="7-200"/>evidence of inability to weigh the possible risks of accepting or rejecting <ln numlevel="1" lineno="578" slineno="7-201"/>treatment;</subsection><subsection ssid="2-null-97" dnum="D-o" numlevel="1" lineno="579" slineno="7-202" level="4"><display>(D)</display>there is no appropriate less-restrictive alternative to a court order of <ln numlevel="1" lineno="580" slineno="7-203"/>commitment; and</subsection><subsection ssid="2-null-98" dnum="E-o" numlevel="1" lineno="581" slineno="7-204" level="4"><display>(E)</display>the local mental health authority can provide the proposed patient with <ln numlevel="1" lineno="582" slineno="7-205"/>treatment that is adequate and appropriate to the proposed patient's conditions <ln numlevel="1" lineno="583" slineno="7-206"/>and needs; or</subsection></subsection><subsection ssid="2-null-99" dnum="ii-o" numlevel="1" lineno="584" slineno="7-207" level="3" tab="1" space="false"><display>(ii)</display><subsection ssid="2-null-100" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the proposed patient has been charged with a criminal offense;</subsection><subsection ssid="2-null-101" dnum="B-o" numlevel="1" lineno="585" slineno="7-208" level="4"><display>(B)</display>with respect to the charged offense, the proposed patient is found incompetent <ln numlevel="1" lineno="586" slineno="7-209"/>to proceed as a result of a mental illness;</subsection><subsection ssid="2-null-102" dnum="C-o" numlevel="1" lineno="587" slineno="7-210" level="4"><display>(C)</display>the proposed patient has a mental illness;</subsection><subsection ssid="2-null-103" dnum="D-o" numlevel="1" lineno="588" slineno="7-211" level="4"><display>(D)</display>the proposed patient has a persistent unawareness of their mental illness and <ln numlevel="1" lineno="589" slineno="7-212"/>the negative consequences of that illness, or within the preceding six months <ln numlevel="1" lineno="590" slineno="7-213"/>has been requested or ordered to undergo mental health treatment but has <ln numlevel="1" lineno="591" slineno="7-214"/>unreasonably refused to undergo that treatment;</subsection><subsection ssid="2-null-104" dnum="E-o" numlevel="1" lineno="592" slineno="7-215" level="4"><display>(E)</display>there is no appropriate less-restrictive alternative to a court order of <ln numlevel="1" lineno="593" slineno="7-216"/>commitment; and</subsection><subsection ssid="2-null-105" dnum="F-o" numlevel="1" lineno="594" slineno="7-217" level="4"><display>(F)</display>the local mental health authority can provide the proposed patient with <ln numlevel="1" lineno="595" slineno="7-218"/>treatment that is adequate and appropriate to the proposed patient's conditions <ln numlevel="1" lineno="596" slineno="7-219"/>and needs.</subsection></subsection></subsection><subsection ssid="2-null-106" dnum="b-o" numlevel="1" lineno="597" slineno="7-220" level="2" space="false"><display>(b)</display><subsection ssid="2-null-107" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If, at the hearing, the court determines that the proposed patient has a mental <ln numlevel="1" lineno="598" slineno="7-221"/>illness but does not meet the other criteria described in Subsection <xref depth="4" refnumber="26B-5-332(16)(a)">(16)(a)</xref>, the <ln numlevel="1" lineno="599" slineno="7-222"/>court may consider whether the proposed patient meets the criteria for assisted <ln numlevel="1" lineno="600" slineno="7-223"/>outpatient treatment under Section <xref depth="3" refnumber="26B-5-351">26B-5-351</xref>.</subsection><subsection ssid="2-null-108" dnum="ii-o" numlevel="1" lineno="601" slineno="7-224" level="3"><display>(ii)</display>The court may order the proposed patient to receive assisted outpatient treatment <ln numlevel="1" lineno="602" slineno="7-225"/>in accordance with Section <xref depth="3" refnumber="26B-5-351">26B-5-351</xref> if, at the hearing, the court finds the <ln numlevel="1" lineno="603" slineno="7-226"/>proposed patient meets the criteria for assisted outpatient treatment under Section <xref depth="3" refnumber="26B-5-351"><ln numlevel="1" lineno="604" slineno="7-227"/>26B-5-351</xref>.</subsection><subsection ssid="2-null-109" dnum="iii-o" numlevel="1" lineno="605" slineno="7-228" level="3"><display>(iii)</display>If the court determines that neither the criteria for commitment under Subsection <xref depth="4" refnumber="26B-5-332(16)(a)"><ln numlevel="1" lineno="606" slineno="7-229"/>(16)(a)</xref> nor the criteria for assisted outpatient treatment under Section <xref depth="3" refnumber="26B-5-351">26B-5-351</xref> <ln numlevel="1" lineno="607" slineno="7-230"/>are met, the court shall dismiss the proceedings after the hearing.</subsection></subsection></subsection><subsection ssid="2-null-110" dnum="17-o" numlevel="1" lineno="608" slineno="7-231" level="1" space="false"><display>(17)</display><subsection ssid="2-null-111" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="2-150" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1291" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">The court shall immediately notify the appropriate local mental health <ln numlevel="1" lineno="609" slineno="7-232"/>authority and the division upon entry of an order of commitment, including an <ln numlevel="1" lineno="610" slineno="7-233"/>order to extend the patient's treatment period.</amend></subsection><subsection ssid="2-null-112" dnum="i-o:ii-i" numlevel="1" lineno="611" slineno="7-234" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1292" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1293" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>The order of commitment shall designate the period for which the patient <ln numlevel="1" lineno="612" slineno="7-235"/>shall be treated.</subsection><subsection ssid="2-null-113" dnum="ii-o:iii-i" numlevel="1" lineno="613" slineno="7-236" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1293" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1294" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>If the patient is not under an order of commitment at the time of the hearing, <ln numlevel="1" lineno="614" slineno="7-237"/>the patient's treatment period may not exceed six months without a review hearing.</subsection><subsection ssid="2-null-114" dnum="iii-o:iv-i" numlevel="1" lineno="615" slineno="7-238" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1294" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1295" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>Upon a review hearing, to be commenced before the expiration of the <ln numlevel="1" lineno="616" slineno="7-239"/>previous order of commitment, an order for commitment may be for an <ln numlevel="1" lineno="617" slineno="7-240"/>indeterminate period, if the court finds by clear and convincing evidence that the <ln numlevel="1" lineno="618" slineno="7-241"/>criteria described in Subsection <xref depth="4" refnumber="26B-5-332(16)">(16)</xref> will last for an indeterminate period.</subsection></subsection><subsection ssid="2-null-115" dnum="b-o" numlevel="1" lineno="619" slineno="7-242" level="2" space="false"><display>(b)</display><subsection ssid="2-null-116" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The court shall maintain a current list of all patients under the court's order of <ln numlevel="1" lineno="620" slineno="7-243"/>commitment and review the list to determine those patients who have been under <ln numlevel="1" lineno="621" slineno="7-244"/>an order of commitment for the court designated period.</subsection><subsection ssid="2-null-117" dnum="ii-o" numlevel="1" lineno="622" slineno="7-245" level="3"><display>(ii)</display>At least two weeks before the expiration of the designated period of any order of <ln numlevel="1" lineno="623" slineno="7-246"/>commitment still in effect, the court that entered the original order of commitment <ln numlevel="1" lineno="624" slineno="7-247"/>shall inform the appropriate local mental health authority or the local mental <ln numlevel="1" lineno="625" slineno="7-248"/>health authority's designee of the expiration.</subsection><subsection ssid="2-null-118" dnum="iii-o" numlevel="1" lineno="626" slineno="7-249" level="3"><display>(iii)</display>Upon receipt of the information described in Subsection <xref depth="4" refnumber="26B-5-332(17)(b)(ii)">(17)(b)(ii)</xref>, the local <ln numlevel="1" lineno="627" slineno="7-250"/>mental health authority or the local mental health authority's designee shall <ln numlevel="1" lineno="628" slineno="7-251"/>immediately reexamine the reasons upon which the order of commitment was <ln numlevel="1" lineno="629" slineno="7-252"/>based.</subsection><subsection ssid="2-null-119" dnum="iv-o" numlevel="1" lineno="630" slineno="7-253" level="3"><display>(iv)</display>If, after reexamination under Subsection <xref depth="4" refnumber="26B-5-332(17)(b)(iii)">(17)(b)(iii)</xref>, the local mental health <ln numlevel="1" lineno="631" slineno="7-254"/>authority or the local mental health authority's designee determines that the <ln numlevel="1" lineno="632" slineno="7-255"/>conditions justifying commitment no longer exist, the local mental health <ln numlevel="1" lineno="633" slineno="7-256"/>authority or the local mental health authority's designee shall discharge the patient <ln numlevel="1" lineno="634" slineno="7-257"/>from involuntary commitment and immediately report the discharge to the court<amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both"> <ln numlevel="1" lineno="635" slineno="7-258"/>and the division</amend>.</subsection><subsection ssid="2-null-120" dnum="v-o" numlevel="1" lineno="636" slineno="7-259" level="3"><display>(v)</display>If, after reexamination under Subsection <xref depth="4" refnumber="26B-5-332(17)(b)(iii)">(17)(b)(iii)</xref>, the local mental health <ln numlevel="1" lineno="637" slineno="7-260"/>authority or the local mental health authority's designee determines that the <ln numlevel="1" lineno="638" slineno="7-261"/>conditions justifying commitment continue to exist, the court shall immediately <ln numlevel="1" lineno="639" slineno="7-262"/>appoint two designated examiners and proceed under Subsections <xref depth="4" refnumber="26B-5-332(8)">(8)</xref> through <xref depth="4" refnumber="26B-5-332(14)">(14)</xref>.</subsection></subsection><subsection ssid="2-null-121" dnum="c-o" numlevel="1" lineno="640" slineno="7-263" level="2" space="false"><display>(c)</display><subsection ssid="2-null-122" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The local mental health authority or the local mental health authority's designee <ln numlevel="1" lineno="641" slineno="7-264"/>responsible for the care of a patient under an order of commitment for an <ln numlevel="1" lineno="642" slineno="7-265"/>indeterminate period shall, at six-month intervals, reexamine the reasons upon <ln numlevel="1" lineno="643" slineno="7-266"/>which the order of indeterminate commitment was based.</subsection><subsection ssid="2-null-123" dnum="ii-o" numlevel="1" lineno="644" slineno="7-267" level="3"><display>(ii)</display>If the local mental health authority or the local mental health authority's designee <ln numlevel="1" lineno="645" slineno="7-268"/>determines that the conditions justifying commitment no longer exist, the local <ln numlevel="1" lineno="646" slineno="7-269"/>mental health authority or the local mental health authority's designee shall <ln numlevel="1" lineno="647" slineno="7-270"/>discharge the patient from the local mental health authority's or the local mental <ln numlevel="1" lineno="648" slineno="7-271"/>health authority designee's custody and immediately report the discharge to the <ln numlevel="1" lineno="649" slineno="7-272"/>court<amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both"> and the division</amend>.</subsection><subsection ssid="2-null-124" dnum="iii-o" numlevel="1" lineno="650" slineno="7-273" level="3"><display>(iii)</display>If the local mental health authority or the local mental health authority's designee <ln numlevel="1" lineno="651" slineno="7-274"/>determines that the conditions justifying commitment continue to exist, the local <ln numlevel="1" lineno="652" slineno="7-275"/>mental health authority or the local mental health authority's designee shall send a <ln numlevel="1" lineno="653" slineno="7-276"/>written report of the findings to the court.</subsection><subsection ssid="2-null-125" dnum="iv-o" numlevel="1" lineno="654" slineno="7-277" level="3"><display>(iv)</display>The local mental health authority or the local mental health authority's designee <ln numlevel="1" lineno="655" slineno="7-278"/>shall notify the patient and the patient's counsel of record in writing that the <ln numlevel="1" lineno="656" slineno="7-279"/>involuntary commitment will be continued under Subsection <xref depth="4" refnumber="26B-5-332(17)(c)(iii)">(17)(c)(iii)</xref>, the <ln numlevel="1" lineno="657" slineno="7-280"/>reasons for the decision to continue, and that the patient has the right to a review <ln numlevel="1" lineno="658" slineno="7-281"/>hearing by making a request to the court.</subsection><subsection ssid="2-null-126" dnum="v-o" numlevel="1" lineno="659" slineno="7-282" level="3"><display>(v)</display>Upon receiving a request under Subsection <xref depth="4" refnumber="26B-5-332(17)(c)(iv)">(17)(c)(iv)</xref>, the court shall <ln numlevel="1" lineno="660" slineno="7-283"/>immediately appoint <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="79" groupid="74" style="2" owner="jchristopherson" level="1" deltag="both">two designated examiners</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="78" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a designated examiner</amend> and <ln numlevel="1" lineno="661" slineno="7-284"/>proceed under Subsections <xref depth="4" refnumber="26B-5-332(8)">(8)</xref> through <xref depth="4" refnumber="26B-5-332(14)">(14)</xref>.</subsection></subsection></subsection><subsection ssid="2-null-127" dnum="18-o" numlevel="1" lineno="662" slineno="7-285" level="1" space="false"><display>(18)</display><subsection ssid="2-null-128" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Any patient committed as a result of an original hearing or a patient's legally <ln numlevel="1" lineno="663" slineno="7-286"/>designated representative who is aggrieved by the findings, conclusions, and order of <ln numlevel="1" lineno="664" slineno="7-287"/>the court entered in the original hearing has the right to a new hearing upon filing a <ln numlevel="1" lineno="665" slineno="7-288"/>petition with the court within 30 days after the day on which the court entered the <ln numlevel="1" lineno="666" slineno="7-289"/>order.</subsection><subsection ssid="2-null-129" dnum="b-o" numlevel="1" lineno="667" slineno="7-290" level="2"><display>(b)</display>The petition shall allege error or mistake in the findings, in which case the court shall <ln numlevel="1" lineno="668" slineno="7-291"/>appoint three impartial designated examiners previously unrelated to the case to <ln numlevel="1" lineno="669" slineno="7-292"/>conduct an additional examination of the patient.</subsection><subsection ssid="2-null-130" dnum="c-o" numlevel="1" lineno="670" slineno="7-293" level="2"><display>(c)</display>Except as provided in Subsection <xref depth="4" refnumber="26B-5-332(18)(b)">(18)(b)</xref>, the court shall, in all other respects, <ln numlevel="1" lineno="671" slineno="7-294"/>conduct the new hearing in the manner otherwise permitted.</subsection></subsection><subsection ssid="2-null-131" dnum="19-o" numlevel="1" lineno="672" slineno="7-295" level="1"><display>(19)</display>The county in which the proposed patient resides or is found shall pay the costs of all <ln numlevel="1" lineno="673" slineno="7-296"/>proceedings under this section.</subsection><subsection ssid="2-null-132" dnum="20-o" numlevel="1" lineno="674" slineno="7-297" level="1" space="false"><display>(20)</display><subsection ssid="2-null-133" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local mental health authority or the local mental health authority's designee <ln numlevel="1" lineno="675" slineno="7-298"/>shall provide discharge instructions to each individual committed under this section <ln numlevel="1" lineno="676" slineno="7-299"/>at or before the time the individual is discharged from the local mental health <ln numlevel="1" lineno="677" slineno="7-300"/>authority's custody, regardless of the circumstances under which the individual is <ln numlevel="1" lineno="678" slineno="7-301"/>discharged.</subsection><subsection ssid="2-null-134" dnum="b-o" numlevel="1" lineno="679" slineno="7-302" level="2"><display>(b)</display>Discharge instructions provided under Subsection <xref refnumber="26B-5-332(20)(a)" depth="4">(20)(a)</xref> shall include:<subsection ssid="2-null-135" dnum="i-o" numlevel="1" lineno="680" slineno="7-303" level="3"><display>(i)</display>a safety plan for the individual based on the individual's mental illness or mental <ln numlevel="1" lineno="681" slineno="7-304"/>or emotional state, if applicable;</subsection><subsection ssid="2-null-136" dnum="ii-o" numlevel="1" lineno="682" slineno="7-305" level="3"><display>(ii)</display>notification to the individual's primary care provider, if applicable;</subsection><subsection ssid="2-null-137" dnum="iii-o" numlevel="1" lineno="683" slineno="7-306" level="3"><display>(iii)</display>if the individual is discharged without food, housing, or economic security, a <ln numlevel="1" lineno="684" slineno="7-307"/>referral to appropriate services, if such services exist in the individual's <ln numlevel="1" lineno="685" slineno="7-308"/>community;</subsection><subsection ssid="2-null-138" dnum="iv-o" numlevel="1" lineno="686" slineno="7-309" level="3"><display>(iv)</display>the phone number to call or text for a crisis services hotline, and information <ln numlevel="1" lineno="687" slineno="7-310"/>about the availability of peer support services;</subsection><subsection ssid="2-null-139" dnum="v-o" numlevel="1" lineno="688" slineno="7-311" level="3"><display>(v)</display>a copy of any psychiatric advance directive, if applicable;</subsection><subsection ssid="2-null-140" dnum="vi-o" numlevel="1" lineno="689" slineno="7-312" level="3"><display>(vi)</display>information about how to establish a psychiatric advance directive if one has not <ln numlevel="1" lineno="690" slineno="7-313"/>been completed;</subsection><subsection ssid="2-null-141" dnum="vii-o" numlevel="1" lineno="691" slineno="7-314" level="3"><display>(vii)</display>as applicable, information about medications that were changed or discontinued <ln numlevel="1" lineno="692" slineno="7-315"/>during the commitment;</subsection><subsection ssid="2-null-142" dnum="viii-o" numlevel="1" lineno="693" slineno="7-316" level="3"><display>(viii)</display>information about how to contact the local mental health authority or <ln numlevel="1" lineno="694" slineno="7-317"/>established provider as appropriate; and</subsection><subsection ssid="2-null-143" dnum="ix-o" numlevel="1" lineno="695" slineno="7-318" level="3"><display>(ix)</display>information about how to request a copy of the individual's medical record and <ln numlevel="1" lineno="696" slineno="7-319"/>how to access the electronic patient portal for the individual's medical record.</subsection></subsection><subsection ssid="2-null-144" dnum="c-o" numlevel="1" lineno="697" slineno="7-320" level="2"><display>(c)</display>If an individual's medications were changed, or if an individual was prescribed new <ln numlevel="1" lineno="698" slineno="7-321"/>medications while committed under this section, discharge instructions provided <ln numlevel="1" lineno="699" slineno="7-322"/>under Subsection <xref refnumber="26B-5-332(20)(a)" depth="4">(20)(a)</xref> shall include a clinically appropriate supply of medications, <ln numlevel="1" lineno="700" slineno="7-323"/>as determined by a licensed health care provider, to allow the individual time to <ln numlevel="1" lineno="701" slineno="7-324"/>access another health care provider or follow-up appointment.</subsection><subsection ssid="2-null-145" dnum="d-o" numlevel="1" lineno="702" slineno="7-325" level="2"><display>(d)</display>Discharge instructions shall be provided in paper or electronic format based on the <ln numlevel="1" lineno="703" slineno="7-326"/>individual's preference.</subsection><subsection ssid="2-null-146" dnum="e-o" numlevel="1" lineno="704" slineno="7-327" level="2"><display>(e)</display>If an individual refuses to accept discharge instructions, the local mental health <ln numlevel="1" lineno="705" slineno="7-328"/>authority shall document the refusal in the individual's medical record.</subsection><subsection ssid="2-null-147" dnum="f-o" numlevel="1" lineno="706" slineno="7-329" level="2"><display>(f)</display>If an individual's discharge instructions include referrals to services under Subsection <xref depth="4" refnumber="26B-5-332(20)(b)(iii)"><ln numlevel="1" lineno="707" slineno="7-330"/>(20)(b)(iii)</xref>, the local mental health authority shall document those referrals in the <ln numlevel="1" lineno="708" slineno="7-331"/>individual's medical record.</subsection><subsection ssid="2-null-148" dnum="g-o" numlevel="1" lineno="709" slineno="7-332" level="2"><display>(g)</display>The local mental health authority shall attempt to follow up with a discharged <ln numlevel="1" lineno="710" slineno="7-333"/>individual at least 48 hours after discharge, when appropriate, and may use peer <ln numlevel="1" lineno="711" slineno="7-334"/>support professionals when performing follow-up care or developing a continuing <ln numlevel="1" lineno="712" slineno="7-335"/>care plan.</subsection></subsection><subsection ssid="2-null-149" dnum="21-o" numlevel="1" lineno="713" slineno="7-336" level="1"><display>(21)</display>If any provision of Subsection <xref tempid="538" depth="4" refnumber="26B-5-332(16)(a)(ii)">(16)(a)(ii)</xref> or the application of any provision of <ln numlevel="1" lineno="714" slineno="7-337"/>Subsection <xref refnumber="26B-5-332(16)(a)" depth="4">(16)(a)</xref>(ii) to any person or circumstance is held invalid by a court with <ln numlevel="1" lineno="715" slineno="7-338"/>jurisdiction, the remainder of Subsection <xref tempid="164" depth="4" refnumber="26B-5-332(16)(a)(ii)">(16)(a)(ii)</xref> shall be given effect without the <ln numlevel="1" lineno="716" slineno="7-339"/>invalid provision or application. The provisions of Subsection <xref tempid="839" depth="4" refnumber="26B-5-332(16)(a)(ii)">(16)(a)(ii)</xref> are severable.</subsection></section></bsec><bsec buid="3" num="26B-5-351" type="amend" src="code" uid="C26B-5-S351_2026050620260506" sort="26B05 03510020260506" numlevel="1" lineno="717" slineno="8-1" sn="8"><section number="26B-5-351" numlevel="1" lineno="718" slineno="8-2" type="amend"><secline lineno="717">Section 8. Section <bold>26B-5-351</bold> is amended to read:</secline><catline lineno="718"><bold>26B-5-351<parens/>. Assisted outpatient treatment proceedings.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="719" slineno="8-3" level="1" placement="noreturn"><display>(1)</display>A responsible individual who has credible knowledge of an adult's mental illness and <ln numlevel="1" lineno="720" slineno="8-4"/>the condition or circumstances that have led to the adult's need for assisted outpatient <ln numlevel="1" lineno="721" slineno="8-5"/>treatment may file, in the court in the county where the proposed patient resides or is <ln numlevel="1" lineno="722" slineno="8-6"/>found, a written application that includes:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="723" slineno="8-7" level="2"><display>(a)</display>unless the court finds that the information is not reasonably available, the proposed <ln numlevel="1" lineno="724" slineno="8-8"/>patient's:<subsection ssid="3-null-3" dnum="i-o" numlevel="1" lineno="725" slineno="8-9" level="3"><display>(i)</display>name;</subsection><subsection ssid="3-null-4" dnum="ii-o" numlevel="1" lineno="726" slineno="8-10" level="3"><display>(ii)</display>date of birth; and</subsection><subsection ssid="3-null-5" dnum="iii-o" numlevel="1" lineno="727" slineno="8-11" level="3"><display>(iii)</display>social security number; and</subsection></subsection><subsection ssid="3-null-6" dnum="b-o" numlevel="1" lineno="728" slineno="8-12" level="2" space="false"><display>(b)</display><subsection ssid="3-null-7" dnum="i-o" level="3" placement="sameline"><display>(i)</display>a certificate of a licensed physician or a designated examiner stating that within <ln numlevel="1" lineno="729" slineno="8-13"/>the seven-day period immediately preceding the certification, the physician or <ln numlevel="1" lineno="730" slineno="8-14"/>designated examiner examined the proposed patient and is of the opinion that the <ln numlevel="1" lineno="731" slineno="8-15"/>proposed patient has a mental illness and should be involuntarily committed; or</subsection><subsection ssid="3-null-8" dnum="ii-o" numlevel="1" lineno="732" slineno="8-16" level="3"><display>(ii)</display>a written statement by the applicant that:<subsection ssid="3-null-9" dnum="A-o" numlevel="1" lineno="733" slineno="8-17" level="4"><display>(A)</display>the proposed patient has been requested to, but has refused to, submit to an <ln numlevel="1" lineno="734" slineno="8-18"/>examination of mental condition by a licensed physician or designated <ln numlevel="1" lineno="735" slineno="8-19"/>examiner;</subsection><subsection ssid="3-null-10" dnum="B-o" numlevel="1" lineno="736" slineno="8-20" level="4"><display>(B)</display>is sworn to under oath; and</subsection><subsection ssid="3-null-11" dnum="C-o" numlevel="1" lineno="737" slineno="8-21" level="4"><display>(C)</display>states the facts upon which the application is based.</subsection></subsection></subsection></subsection><subsection ssid="3-null-12" dnum="2-o" numlevel="1" lineno="738" slineno="8-22" level="1" space="false"><display>(2)</display><subsection ssid="3-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="26B-5-351(2)(b)" start="0">(2)(b)</xref>, before issuing a judicial order, the court may require <ln numlevel="1" lineno="739" slineno="8-23"/>the applicant to consult with the appropriate local mental health authority, and the <ln numlevel="1" lineno="740" slineno="8-24"/>court may direct a mental health professional from that local mental health authority <ln numlevel="1" lineno="741" slineno="8-25"/>to interview the applicant and the proposed patient to determine the existing facts and <ln numlevel="1" lineno="742" slineno="8-26"/>report them to the court.</subsection><subsection ssid="3-null-14" dnum="b-o" numlevel="1" lineno="743" slineno="8-27" level="2"><display>(b)</display>The consultation described in Subsection <xref depth="4" refnumber="26B-5-351(2)(a)" start="0">(2)(a)</xref>:<subsection ssid="3-null-15" dnum="i-o" numlevel="1" lineno="744" slineno="8-28" level="3"><display>(i)</display>may take place at or before the hearing; and</subsection><subsection ssid="3-null-16" dnum="ii-o" numlevel="1" lineno="745" slineno="8-29" level="3"><display>(ii)</display>is required if the local mental health authority appears at the hearing.</subsection></subsection></subsection><subsection ssid="3-null-17" dnum="3-o" numlevel="1" lineno="746" slineno="8-30" level="1"><display>(3)</display>If the proposed patient refuses to submit to an interview described in Subsection <xref depth="4" refnumber="26B-5-351(2)(a)" start="0">(2)(a)</xref> <ln numlevel="1" lineno="747" slineno="8-31"/>or an examination described in Subsection <xref depth="4" refnumber="26B-5-351(8)" start="0">(8)</xref>, the court may issue an order, directed to <ln numlevel="1" lineno="748" slineno="8-32"/>a mental health officer or peace officer, to immediately place the proposed patient into <ln numlevel="1" lineno="749" slineno="8-33"/>the custody of a local mental health authority or in a temporary emergency facility, as <ln numlevel="1" lineno="750" slineno="8-34"/>provided in Section <xref depth="3" refnumber="26B-5-334" start="0">26B-5-334</xref>, to be detained for the purpose of examination.</subsection><subsection ssid="3-null-18" dnum="4-o" numlevel="1" lineno="751" slineno="8-35" level="1"><display>(4)</display>Notice of commencement of proceedings for assisted outpatient treatment, setting forth <ln numlevel="1" lineno="752" slineno="8-36"/>the allegations of the application and any reported facts, together with a copy of any <ln numlevel="1" lineno="753" slineno="8-37"/>official order of detention, shall:<subsection ssid="3-null-19" dnum="a-o" numlevel="1" lineno="754" slineno="8-38" level="2"><display>(a)</display>be provided by the court to a proposed patient before, or upon, placement into the <ln numlevel="1" lineno="755" slineno="8-39"/>custody of a local mental health authority or, with respect to any proposed patient <ln numlevel="1" lineno="756" slineno="8-40"/>presently in the custody of a local mental health authority;</subsection><subsection ssid="3-null-20" dnum="b-o" numlevel="1" lineno="757" slineno="8-41" level="2"><display>(b)</display>be maintained at the proposed patient's place of detention, if any;</subsection><subsection ssid="3-null-21" dnum="c-o" numlevel="1" lineno="758" slineno="8-42" level="2"><display>(c)</display>be provided by the court as soon as practicable to the applicant, any legal guardian, <ln numlevel="1" lineno="759" slineno="8-43"/>any immediate adult family members, legal counsel for the parties involved, the local <ln numlevel="1" lineno="760" slineno="8-44"/>mental health authority or its designee, and any other person whom the proposed <ln numlevel="1" lineno="761" slineno="8-45"/>patient or the court shall designate; and</subsection><subsection ssid="3-null-22" dnum="d-o" numlevel="1" lineno="762" slineno="8-46" level="2"><display>(d)</display>advise that a hearing may be held within the time provided by law.</subsection></subsection><subsection ssid="3-null-23" dnum="5-o" numlevel="1" lineno="763" slineno="8-47" level="1"><display>(5)</display>The court may, in its discretion, transfer the case to any other court within this state, <ln numlevel="1" lineno="764" slineno="8-48"/>provided that the transfer will not be adverse to the interest of the proposed patient.</subsection><subsection ssid="3-null-24" dnum="6-o" numlevel="1" lineno="765" slineno="8-49" level="1" space="false"><display>(6)</display><subsection ssid="3-82" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1354" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>Within 24 hours, excluding Saturdays, Sundays, and legal holidays, of the <ln numlevel="1" lineno="766" slineno="8-50"/>issuance of a judicial order, or after commitment of a proposed patient to a local <ln numlevel="1" lineno="767" slineno="8-51"/>mental health authority or its designee under court order for detention in order to <ln numlevel="1" lineno="768" slineno="8-52"/>complete an examination, the court shall appoint <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">two</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">one</amend> designated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">examiners</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="769" slineno="8-53"/>examiner</amend>:<subsection ssid="3-null-25" dnum="a-o:i-i" numlevel="1" lineno="770" slineno="8-54" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1355" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1356" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>who did not sign the assisted outpatient treatment application nor the <ln numlevel="1" lineno="771" slineno="8-55"/>certification described in Subsection <xref depth="4" refnumber="26B-5-351(1)" start="0">(1)</xref>;</subsection><subsection ssid="3-null-26" dnum="b-o:ii-i" numlevel="1" lineno="772" slineno="8-56" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1356" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1357" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">one <marker pairid="60">of whom </marker></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="70" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><marker pairid="61">who </marker></amend>is a licensed physician; and</subsection><subsection ssid="3-null-27" dnum="c-o:iii-i" numlevel="1" lineno="773" slineno="8-57" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1357" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1358" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">one <marker pairid="56">of whom </marker></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="71" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><marker pairid="57"/><marker pairid="58"/><marker pairid="59">who </marker></amend><marker pairid="55">may</marker> be designated by the proposed patient or the <ln numlevel="1" lineno="774" slineno="8-58"/>proposed patient's counsel, if that designated examiner is reasonably available.</subsection></subsection><subsection ssid="3-83" dnum="_-o:b-i" numlevel="1" lineno="775" slineno="8-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1358" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">The court may order a second dedicated examiner to examine the proposed patient <ln numlevel="1" lineno="776" slineno="8-60"/>after the first designated examiner's examination is complete, upon request of the <ln numlevel="1" lineno="777" slineno="8-61"/>applicant.</amend></subsection></subsection><subsection ssid="3-null-28" dnum="7-o" numlevel="1" lineno="778" slineno="8-62" level="1"><display>(7)</display>The court shall schedule a hearing to be held within 10 calendar days of the day on <ln numlevel="1" lineno="779" slineno="8-63"/>which the designated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">examiners are</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">examiner is</amend> appointed.</subsection><subsection ssid="3-null-29" dnum="8-o" numlevel="1" lineno="780" slineno="8-64" level="1" space="false"><display>(8)</display><subsection ssid="3-84" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1361" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>The designated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">examiners</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">examiner</amend> shall:<subsection ssid="3-null-30" dnum="a-o:i-i" numlevel="1" lineno="781" slineno="8-65" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1362" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1363" style="1" owner="i" level="1" amendtag="start" space="true">(i)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">if more than one examiner is appointed as described in Subsection <xref depth="4" refnumber="26B-5-351(6)(b)">(6)(b)</xref>, </amend><ln numlevel="1" lineno="782" slineno="8-66"/>conduct <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="47" style="2" owner="jchristopherson" level="1" deltag="both">their examinations</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="50" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the examination</amend> separately<amend anum="0" ea="amend" pairid="51" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="both"> from any other examiner's <ln numlevel="1" lineno="783" slineno="8-67"/>examination</amend>;</subsection><subsection ssid="3-null-31" dnum="b-o:ii-i" numlevel="1" lineno="784" slineno="8-68" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1363" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1364" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>conduct the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">examinations</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">examination</amend> at the home of the proposed patient, <ln numlevel="1" lineno="785" slineno="8-69"/>at a hospital or other medical facility, or at any other suitable place that is not <ln numlevel="1" lineno="786" slineno="8-70"/>likely to have a harmful effect on the proposed patient's health;</subsection><subsection ssid="3-null-32" dnum="c-o:iii-i" numlevel="1" lineno="787" slineno="8-71" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1364" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1365" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>inform the proposed patient, if not represented by an attorney:<subsection ssid="3-null-33" dnum="i-o:A-i" numlevel="1" lineno="788" slineno="8-72" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1365" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1366" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>that the proposed patient does not have to say anything;</subsection><subsection ssid="3-null-34" dnum="ii-o:B-i" numlevel="1" lineno="789" slineno="8-73" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1366" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1367" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>of the nature and reasons for the examination;</subsection><subsection ssid="3-null-35" dnum="iii-o:C-i" numlevel="1" lineno="790" slineno="8-74" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1367" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1368" style="1" owner="i" level="1" amendtag="both" space="true">(C)</amend></display>that the examination was ordered by the court;</subsection><subsection ssid="3-null-36" dnum="iv-o:D-i" numlevel="1" lineno="791" slineno="8-75" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1368" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1369" style="1" owner="i" level="1" amendtag="both" space="true">(D)</amend></display>that any information volunteered could form part of the basis for the <ln numlevel="1" lineno="792" slineno="8-76"/>proposed patient to be ordered to receive assisted outpatient treatment; and</subsection><subsection ssid="3-null-37" dnum="v-o:E-i" numlevel="1" lineno="793" slineno="8-77" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1369" style="2" owner="o" level="1" deltag="both">(v)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1370" style="1" owner="i" level="1" amendtag="both" space="true">(E)</amend></display>that findings resulting from the examination will be made available to the <ln numlevel="1" lineno="794" slineno="8-78"/>court; and</subsection></subsection><subsection ssid="3-null-38" dnum="d-o:iv-i" numlevel="1" lineno="795" slineno="8-79" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1370" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1371" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>within 24 hours of examining the proposed patient, report to the court, orally <ln numlevel="1" lineno="796" slineno="8-80"/>or in writing, whether the proposed patient is mentally ill. </subsection></subsection><subsection ssid="3-85" dnum="_-o:b-i" numlevel="1" lineno="797" slineno="8-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1371" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>If the designated examiner reports orally<amend anum="0" ea="amend" pairid="47" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="both"> under Subsection<marker pairid="63"> </marker><marker pairid="64"><xref depth="4" refnumber="26B-5-351(8)(a)(iv)">(</xref></marker><marker pairid="65">8</marker><marker pairid="66">)</marker><marker pairid="67">(</marker><marker pairid="68">a</marker><marker pairid="69">)(iv)</marker></amend>, the designated <ln numlevel="1" lineno="798" slineno="8-82"/>examiner shall immediately send a written report to the clerk of the court.</subsection></subsection><subsection ssid="3-null-39" dnum="9-o" numlevel="1" lineno="799" slineno="8-83" level="1"><display>(9)</display>If a designated examiner is unable to complete an examination on the first attempt <ln numlevel="1" lineno="800" slineno="8-84"/>because the proposed patient refuses to submit to the examination, the court shall fix a <ln numlevel="1" lineno="801" slineno="8-85"/>reasonable compensation to be paid to the examiner.</subsection><subsection ssid="3-null-40" dnum="10-o" numlevel="1" lineno="802" slineno="8-86" level="1"><display>(10)</display>If the local mental health authority, its designee, or a medical examiner determines <ln numlevel="1" lineno="803" slineno="8-87"/>before the court hearing that the conditions justifying the findings leading to an assisted <ln numlevel="1" lineno="804" slineno="8-88"/>outpatient treatment hearing no longer exist, the local mental health authority, its <ln numlevel="1" lineno="805" slineno="8-89"/>designee, or the medical examiner shall immediately report that determination to the <ln numlevel="1" lineno="806" slineno="8-90"/>court.</subsection><subsection ssid="3-null-41" dnum="11-o" numlevel="1" lineno="807" slineno="8-91" level="1"><display>(11)</display>The court may terminate the proceedings and dismiss the application at any time, <ln numlevel="1" lineno="808" slineno="8-92"/>including prior to the hearing, if the designated examiners or the local mental health <ln numlevel="1" lineno="809" slineno="8-93"/>authority or its designee informs the court that the proposed patient does not meet the <ln numlevel="1" lineno="810" slineno="8-94"/>criteria in Subsection <xref depth="4" refnumber="26B-5-351(14)" start="0">(14)</xref>.</subsection><subsection ssid="3-null-42" dnum="12-o" numlevel="1" lineno="811" slineno="8-95" level="1"><display>(12)</display>Before the hearing, an opportunity to be represented by counsel shall be afforded to the <ln numlevel="1" lineno="812" slineno="8-96"/>proposed patient, and if neither the proposed patient nor others provide counsel, the <ln numlevel="1" lineno="813" slineno="8-97"/>court shall appoint counsel and allow counsel sufficient time to consult with the <ln numlevel="1" lineno="814" slineno="8-98"/>proposed patient before the hearing. In the case of an indigent proposed patient, the <ln numlevel="1" lineno="815" slineno="8-99"/>payment of reasonable attorney fees for counsel, as determined by the court, shall be <ln numlevel="1" lineno="816" slineno="8-100"/>made by the county in which the proposed patient resides or is found.</subsection><subsection ssid="3-null-43" dnum="13-o" numlevel="1" lineno="817" slineno="8-101" level="1" space="false"><display>(13)</display><subsection ssid="3-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>All persons to whom notice is required to be given shall be afforded an <ln numlevel="1" lineno="818" slineno="8-102"/>opportunity to appear at the hearing, to testify, and to present and cross-examine <ln numlevel="1" lineno="819" slineno="8-103"/>witnesses. The court may, in its discretion, receive the testimony of any other <ln numlevel="1" lineno="820" slineno="8-104"/>individual. The court may allow a waiver of the proposed patient's right to appear for <ln numlevel="1" lineno="821" slineno="8-105"/>good cause, which cause shall be set forth in the record, or an informed waiver by the <ln numlevel="1" lineno="822" slineno="8-106"/>patient, which shall be included in the record.</subsection><subsection ssid="3-null-45" dnum="b-o" numlevel="1" lineno="823" slineno="8-107" level="2"><display>(b)</display>The court is authorized to exclude all individuals not necessary for the conduct of the <ln numlevel="1" lineno="824" slineno="8-108"/>proceedings and may, upon motion of counsel, require the testimony of each <ln numlevel="1" lineno="825" slineno="8-109"/>examiner to be given out of the presence of any other examiners.</subsection><subsection ssid="3-null-46" dnum="c-o" numlevel="1" lineno="826" slineno="8-110" level="2"><display>(c)</display>The hearing shall be conducted in as informal a manner as may be consistent with <ln numlevel="1" lineno="827" slineno="8-111"/>orderly procedure, and in a physical setting that is not likely to have a harmful effect <ln numlevel="1" lineno="828" slineno="8-112"/>on the mental health of the proposed patient.</subsection><subsection ssid="3-null-47" dnum="d-o" numlevel="1" lineno="829" slineno="8-113" level="2"><display>(d)</display>The court shall consider all relevant historical and material information that is <ln numlevel="1" lineno="830" slineno="8-114"/>offered, subject to the rules of evidence, including reliable hearsay under Rule 1102, <ln numlevel="1" lineno="831" slineno="8-115"/>Utah Rules of Evidence.</subsection><subsection ssid="3-null-48" dnum="e-o" numlevel="1" lineno="832" slineno="8-116" level="2" space="false"><display>(e)</display><subsection ssid="3-null-49" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A local mental health authority or its designee, or the physician in charge of the <ln numlevel="1" lineno="833" slineno="8-117"/>proposed patient's care shall, at the time of the hearing, provide the court with the <ln numlevel="1" lineno="834" slineno="8-118"/>following information:<subsection ssid="3-null-50" dnum="A-o" numlevel="1" lineno="835" slineno="8-119" level="4" tab="1"><display>(A)</display>the detention order, if any;</subsection><subsection ssid="3-null-51" dnum="B-o" numlevel="1" lineno="836" slineno="8-120" level="4" tab="1"><display>(B)</display>admission notes, if any;</subsection><subsection ssid="3-null-52" dnum="C-o" numlevel="1" lineno="837" slineno="8-121" level="4" tab="1"><display>(C)</display>the diagnosis, if any;</subsection><subsection ssid="3-null-53" dnum="D-o" numlevel="1" lineno="838" slineno="8-122" level="4" tab="1"><display>(D)</display>doctor's orders, if any;</subsection><subsection ssid="3-null-54" dnum="E-o" numlevel="1" lineno="839" slineno="8-123" level="4" tab="1"><display>(E)</display>progress notes, if any;</subsection><subsection ssid="3-null-55" dnum="F-o" numlevel="1" lineno="840" slineno="8-124" level="4" tab="1"><display>(F)</display>nursing notes, if any; and</subsection><subsection ssid="3-null-56" dnum="G-o" numlevel="1" lineno="841" slineno="8-125" level="4" tab="1"><display>(G)</display>medication records, if any.</subsection></subsection><subsection ssid="3-null-57" dnum="ii-o" numlevel="1" lineno="842" slineno="8-126" level="3"><display>(ii)</display>The information described in Subsection <xref depth="4" refnumber="26B-5-351(13)(e)(i)" start="0">(13)(e)(i)</xref> shall also be provided to the <ln numlevel="1" lineno="843" slineno="8-127"/>proposed patient's counsel:<subsection ssid="3-null-58" dnum="A-o" numlevel="1" lineno="844" slineno="8-128" level="4"><display>(A)</display>at the time of the hearing; and</subsection><subsection ssid="3-null-59" dnum="B-o" numlevel="1" lineno="845" slineno="8-129" level="4"><display>(B)</display>at any time prior to the hearing, upon request.</subsection></subsection></subsection></subsection><subsection ssid="3-null-60" dnum="14-o" numlevel="1" lineno="846" slineno="8-130" level="1"><display>(14)</display>The court shall order a proposed patient to assisted outpatient treatment if, upon <ln numlevel="1" lineno="847" slineno="8-131"/>completion of the hearing and consideration of the information presented, the court finds <ln numlevel="1" lineno="848" slineno="8-132"/>by clear and convincing evidence that:<subsection ssid="3-null-61" dnum="a-o" numlevel="1" lineno="849" slineno="8-133" level="2"><display>(a)</display>the proposed patient has a mental illness;</subsection><subsection ssid="3-null-62" dnum="b-o" numlevel="1" lineno="850" slineno="8-134" level="2"><display>(b)</display>there is no appropriate less-restrictive alternative to a court order for assisted <ln numlevel="1" lineno="851" slineno="8-135"/>outpatient treatment; and</subsection><subsection ssid="3-null-63" dnum="c-o" numlevel="1" lineno="852" slineno="8-136" level="2" space="false"><display>(c)</display><subsection ssid="3-null-64" dnum="i-o" level="3" placement="sameline"><display>(i)</display>the proposed patient lacks the ability to engage in a rational decision-making <ln numlevel="1" lineno="853" slineno="8-137"/>process regarding the acceptance of mental health treatment, as demonstrated by <ln numlevel="1" lineno="854" slineno="8-138"/>evidence of inability to weigh the possible risks of accepting or rejecting <ln numlevel="1" lineno="855" slineno="8-139"/>treatment; or</subsection><subsection ssid="3-null-65" dnum="ii-o" numlevel="1" lineno="856" slineno="8-140" level="3"><display>(ii)</display>the proposed patient needs assisted outpatient treatment in order to prevent <ln numlevel="1" lineno="857" slineno="8-141"/>relapse or deterioration that is likely to result in the proposed patient posing a <ln numlevel="1" lineno="858" slineno="8-142"/>substantial danger to self or others.</subsection></subsection></subsection><subsection ssid="3-null-66" dnum="15-o" numlevel="1" lineno="859" slineno="8-143" level="1"><display>(15)</display>The court may order the applicant or a close relative of the patient to be the patient's <ln numlevel="1" lineno="860" slineno="8-144"/>personal representative, as described in 45 C.F.R. Sec. 164.502(g), for purposes of the <ln numlevel="1" lineno="861" slineno="8-145"/>patient's mental health treatment.</subsection><subsection ssid="3-null-67" dnum="16-o" numlevel="1" lineno="862" slineno="8-146" level="1"><display>(16)</display>In the absence of the findings described in Subsection <xref depth="4" refnumber="26B-5-351(14)" start="0">(14)</xref>, the court, after the hearing, <ln numlevel="1" lineno="863" slineno="8-147"/>shall dismiss the proceedings.</subsection><subsection ssid="3-null-68" dnum="17-o" numlevel="1" lineno="864" slineno="8-148" level="1" space="false"><display>(17)</display><subsection ssid="3-81" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1402" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">The court shall immediately notify the appropriate mental health authority and <ln numlevel="1" lineno="865" slineno="8-149"/>the division upon entry of an assisted outpatient treatment order, including an order <ln numlevel="1" lineno="866" slineno="8-150"/>extending the duration of an assisted outpatient treatment order.</amend></subsection><subsection ssid="3-null-69" dnum="a-o:b-i" numlevel="1" lineno="867" slineno="8-151" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1403" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1404" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>The assisted outpatient treatment order shall designate the period for which the <ln numlevel="1" lineno="868" slineno="8-152"/>patient shall be treated, which may not exceed 12 months without a review hearing.</subsection><subsection ssid="3-null-70" dnum="b-o:c-i" numlevel="1" lineno="869" slineno="8-153" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1404" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1405" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>At a review hearing, the court may extend the duration of an assisted outpatient <ln numlevel="1" lineno="870" slineno="8-154"/>treatment order by up to 12 months, if:<subsection ssid="3-null-71" dnum="i-o" numlevel="1" lineno="871" slineno="8-155" level="3"><display>(i)</display>the court finds by clear and convincing evidence that the patient meets the <ln numlevel="1" lineno="872" slineno="8-156"/>conditions described in Subsection <xref depth="4" refnumber="26B-5-351(14)" start="0">(14)</xref>; or</subsection><subsection ssid="3-null-72" dnum="ii-o" numlevel="1" lineno="873" slineno="8-157" level="3" space="false"><display>(ii)</display><subsection ssid="3-null-73" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the patient does not appear at the review hearing;</subsection><subsection ssid="3-null-74" dnum="B-o" numlevel="1" lineno="874" slineno="8-158" level="4"><display>(B)</display>notice of the review hearing was provided to the patient's last known address <ln numlevel="1" lineno="875" slineno="8-159"/>by the applicant described in Subsection <xref depth="4" refnumber="26B-5-351(1)" start="0">(1)</xref> or by a local mental health <ln numlevel="1" lineno="876" slineno="8-160"/>authority; and</subsection><subsection ssid="3-null-75" dnum="C-o" numlevel="1" lineno="877" slineno="8-161" level="4"><display>(C)</display>the patient has appeared in court or signed an informed waiver within the <ln numlevel="1" lineno="878" slineno="8-162"/>previous 18 months.</subsection></subsection></subsection><subsection ssid="3-null-76" dnum="c-o:d-i" numlevel="1" lineno="879" slineno="8-163" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1410" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1411" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>The court shall maintain a current list of all patients under its order of assisted <ln numlevel="1" lineno="880" slineno="8-164"/>outpatient treatment.</subsection><subsection ssid="3-null-77" dnum="d-o:e-i" numlevel="1" lineno="881" slineno="8-165" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1411" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1412" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>At least two weeks prior to the expiration of the designated period of any <ln numlevel="1" lineno="882" slineno="8-166"/>assisted outpatient treatment order still in effect, the court that entered the original <ln numlevel="1" lineno="883" slineno="8-167"/>order shall inform the appropriate local mental health authority or its designee.</subsection></subsection><subsection ssid="3-null-78" dnum="18-o" numlevel="1" lineno="884" slineno="8-168" level="1"><display>(18)</display>Costs of all proceedings under this section shall be paid by the county in which the <ln numlevel="1" lineno="885" slineno="8-169"/>proposed patient resides or is found.</subsection><subsection ssid="3-null-79" dnum="19-o" numlevel="1" lineno="886" slineno="8-170" level="1"><display>(19)</display>A court may not hold an individual in contempt for failure to comply with an assisted <ln numlevel="1" lineno="887" slineno="8-171"/>outpatient treatment order.</subsection><subsection ssid="3-null-80" dnum="20-o" numlevel="1" lineno="888" slineno="8-172" level="1"><display>(20)</display>As provided in Section <xref depth="3" refnumber="31A-22-651" start="0">31A-22-651</xref>, a health insurance provider may not deny an <ln numlevel="1" lineno="889" slineno="8-173"/>insured the benefits of the insured's policy solely because the health care that the insured <ln numlevel="1" lineno="890" slineno="8-174"/>receives is provided under a court order for assisted outpatient treatment.</subsection></section></bsec><bsec buid="18" num="53-6-202" type="amend" src="code" uid="C53-6-S202_2026050620260506" sort="53 06 02020020260506" numlevel="1" lineno="891" slineno="9-1" sn="9"><section number="53-6-202" numlevel="1" lineno="892" slineno="9-2" type="amend"><secline lineno="891">Section 9. Section <bold>53-6-202</bold> is amended to read:</secline><catline lineno="892"><bold>53-6-202<parens/>. Basic training course -- Completion required -- Annual training -- <ln numlevel="1" lineno="893" slineno="9-3"/>Prohibition from exercising powers -- Reinstatement.</bold></catline><subsection ssid="18-null-1" dnum="1-o" numlevel="1" lineno="894" slineno="9-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="18-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The director shall:<subsection ssid="18-null-3" dnum="i-o" numlevel="1" lineno="895" slineno="9-5" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="18-null-4" dnum="A-o" level="4" placement="sameline"><display>(A)</display>suggest and prepare subject material; and</subsection><subsection ssid="18-null-5" dnum="B-o" numlevel="1" lineno="896" slineno="9-6" level="4"><display>(B)</display>schedule instructors for basic training courses; or</subsection></subsection><subsection ssid="18-null-6" dnum="ii-o" numlevel="1" lineno="897" slineno="9-7" level="3" tab="1"><display>(ii)</display>review the material and instructor choices submitted by a certified academy.</subsection></subsection><subsection ssid="18-null-7" dnum="b-o" numlevel="1" lineno="898" slineno="9-8" level="2"><display>(b)</display>The subject material, instructors, and schedules shall be approved or disapproved by <ln numlevel="1" lineno="899" slineno="9-9"/>a majority vote of the council.</subsection></subsection><subsection ssid="18-null-8" dnum="2-o" numlevel="1" lineno="900" slineno="9-10" level="1"><display>(2)</display>The materials shall be reviewed and approved by the council on or before July 1st of <ln numlevel="1" lineno="901" slineno="9-11"/>each year and may from time to time be changed or amended by majority vote of the <ln numlevel="1" lineno="902" slineno="9-12"/>council.</subsection><subsection ssid="18-null-9" dnum="3-o" numlevel="1" lineno="903" slineno="9-13" level="1"><display>(3)</display>The basic training in a certified academy:<subsection ssid="18-null-10" dnum="a-o" numlevel="1" lineno="904" slineno="9-14" level="2"><display>(a)</display>shall be appropriate for the basic training of peace officers in the techniques of law <ln numlevel="1" lineno="905" slineno="9-15"/>enforcement in the discretion of the director; </subsection><subsection ssid="18-null-11" dnum="b-o" numlevel="1" lineno="906" slineno="9-16" level="2"><display>(b)</display>may not include the use of chokeholds, carotid restraints, or any act that impedes the <ln numlevel="1" lineno="907" slineno="9-17"/>breathing or circulation of blood likely to produce a loss of consciousness, as a valid <ln numlevel="1" lineno="908" slineno="9-18"/>method of restraint; and</subsection><subsection ssid="18-null-12" dnum="c-o" numlevel="1" lineno="909" slineno="9-19" level="2"><display>(c)</display>shall include instruction on identifying, responding to, and reporting a criminal <ln numlevel="1" lineno="910" slineno="9-20"/>offense that is motivated by a personal attribute as that term is defined in Section <xref depth="3" refnumber="76-3-203.14"><ln numlevel="1" lineno="911" slineno="9-21"/>76-3-203.14</xref>.</subsection></subsection><subsection ssid="18-null-13" dnum="4-o" numlevel="1" lineno="912" slineno="9-22" level="1" space="false"><display>(4)</display><subsection ssid="18-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>All peace officers shall satisfactorily complete the basic training course or the <ln numlevel="1" lineno="913" slineno="9-23"/>waiver process provided for in this chapter as well as annual certified training of not <ln numlevel="1" lineno="914" slineno="9-24"/>less than 40 hours as the director, with the advice and consent of the council, directs.</subsection><subsection ssid="18-null-15" dnum="b-o" numlevel="1" lineno="915" slineno="9-25" level="2"><display>(b)</display>A peace officer who fails to satisfactorily complete the annual training described in <ln numlevel="1" lineno="916" slineno="9-26"/>Subsection <xref depth="4" refnumber="53-6-202(4)(a)">(4)(a)</xref> shall automatically be prohibited from exercising peace officer <ln numlevel="1" lineno="917" slineno="9-27"/>powers until any deficiency is made up.</subsection><subsection ssid="18-null-16" dnum="c-o" numlevel="1" lineno="918" slineno="9-28" level="2"><display>(c)</display>The annual training described in Subsection <xref depth="4" refnumber="53-6-202(4)(a)">(4)(a)</xref> shall include training focused on <ln numlevel="1" lineno="919" slineno="9-29"/>arrest control and de-escalation training.</subsection></subsection><subsection ssid="18-null-17" dnum="5-o" numlevel="1" lineno="920" slineno="9-30" level="1" space="false"><display>(5)</display><subsection ssid="18-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Beginning July 1, 2024, all peace officers who are currently employed shall <ln numlevel="1" lineno="921" slineno="9-31"/>participate in a training at least every three years focused on the following:<subsection ssid="18-null-19" dnum="i-o" numlevel="1" lineno="922" slineno="9-32" level="3" tab="1"><display>(i)</display>mental health and other crisis intervention responses;</subsection><subsection ssid="18-null-20" dnum="ii-o" numlevel="1" lineno="923" slineno="9-33" level="3" tab="1"><display>(ii)</display>intervention responses for mental illnesses, autism spectrum disorder, and other <ln numlevel="1" lineno="924" slineno="9-34"/>neurological and developmental disorders; and</subsection><subsection ssid="18-null-21" dnum="iii-o" numlevel="1" lineno="925" slineno="9-35" level="3" tab="1"><display>(iii)</display>responses to sexual traumas and investigations of sexual assault and sexual abuse <ln numlevel="1" lineno="926" slineno="9-36"/>in accordance with Section <xref depth="3" refnumber="53-10-908">53-10-908</xref>.</subsection></subsection><subsection ssid="18-null-22" dnum="b-o" numlevel="1" lineno="927" slineno="9-37" level="2"><display>(b)</display>Any training in which a peace officer participates as described in Subsection <xref depth="4" refnumber="53-6-202(5)(a)">(5)(a)</xref> <ln numlevel="1" lineno="928" slineno="9-38"/>shall count toward the peace officer's 40-hour required annual training described in <ln numlevel="1" lineno="929" slineno="9-39"/>Subsection <xref depth="4" refnumber="53-6-202(4)(a)">(4)(a)</xref> for the year in which the peace officer participated in the training.</subsection></subsection><subsection ssid="18-null-23" dnum="6-o" numlevel="1" lineno="930" slineno="9-40" level="1" space="false"><display>(6)</display><subsection ssid="18-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The director or the director's designee, in coordination with the council, shall <ln numlevel="1" lineno="931" slineno="9-41"/>promulgate the standards for the trainings described in Subsection <xref depth="4" refnumber="53-6-202(4)">(4)</xref>.</subsection><subsection ssid="18-null-25" dnum="b-o" numlevel="1" lineno="932" slineno="9-42" level="2"><display>(b)</display>The chief law enforcement officer or executive officer of the peace officer's <ln numlevel="1" lineno="933" slineno="9-43"/>employing agency shall determine if a peace officer has complied with the standards <ln numlevel="1" lineno="934" slineno="9-44"/>established under Subsection <xref depth="4" refnumber="53-6-202(6)(a)">(6)(a)</xref>.</subsection><subsection ssid="18-26" dnum="_-o:c-i" numlevel="1" lineno="935" slineno="9-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1440" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">The chief law enforcement officer or executive officer of each law enforcement <ln numlevel="1" lineno="936" slineno="9-46"/>agency shall annually report to the State Commission on Criminal and Juvenile <ln numlevel="1" lineno="937" slineno="9-47"/>Justice created in Section <xref depth="3" refnumber="63M-7-201">63M-7-201</xref> on peace officers' compliance with the training <ln numlevel="1" lineno="938" slineno="9-48"/>requirements described<marker pairid="5"> in </marker>Subsection <xref depth="4" refnumber="53-6-202(5)(a)">(5)(a)</xref>.</amend></subsection></subsection></section></bsec><bsec buid="25" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="939" slineno="10-1" sn="10"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="939">Section 10.  <bold>Effective Date.</bold></secline><sectionText lineno="940"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-16-26 12:41 PM</tm></rev></foot></leg>
