Section <bold>36-33-103</bold> is amended to read:</secline><catline lineno="35"><bold>36-33-103<parens/>. Panel powers and duties -- Record access and confidentiality.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="36" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>The panel shall:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="37" slineno="1-4" level="2"><display>(a)</display>examine and observe the process and execution of laws governing the child welfare <ln numlevel="1" lineno="38" slineno="1-5"/>system by the executive branch and the judicial branch;</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="39" slineno="1-6" level="2"><display>(b)</display>upon request, receive testimony from the public, the juvenile court, or a state agency <ln numlevel="1" lineno="40" slineno="1-7"/>involved with the child welfare system, including the division, another office or <ln numlevel="1" lineno="41" slineno="1-8"/>agency within the department, the attorney general, the Office of Guardian Ad Litem, <ln numlevel="1" lineno="42" slineno="1-9"/>or a school district;</subsection><subsection ssid="3-37" dnum="_-o:c-i" numlevel="1" lineno="43" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">receive and review the reports described in Section <xref depth="3" refnumber="80-3-113">80-3-113</xref> regarding appeals and <ln numlevel="1" lineno="44" slineno="1-11"/>compliance with timelines in child welfare cases;</amend></subsection><subsection ssid="3-null-4" dnum="c-o:_-i" numlevel="1" lineno="45" slineno="1-12" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1004" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="13" groupid="7" style="2" owner="jchristopherson" level="1" deltag="end">before October 1 of each year, receive a report from the Administrative Office of the <ln numlevel="1" lineno="46" slineno="1-13"/>Courts identifying the cases not in compliance with the time limits established in the <ln numlevel="1" lineno="47" slineno="1-14"/>following sections, and the reasons for noncompliance:</amend><amendoutend style="2"/><subsection ssid="3-null-5" dnum="i-o:_-i" numlevel="1" lineno="48" slineno="1-15" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1005" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="14" groupid="8" style="2" owner="jchristopherson" level="1" deltag="end">Subsection <xref depth="4" refnumber="80-3-301(1)" start="0">80-3-301(1)</xref>, regarding shelter hearings;</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-6" dnum="ii-o:_-i" numlevel="1" lineno="49" slineno="1-16" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="17" groupid="11" style="2" owner="jchristopherson" level="1" deltag="end">Section <xref depth="3" refnumber="80-3-401" start="0">80-3-401</xref>, regarding pretrial and adjudication hearings;</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-7" dnum="iii-o:_-i" numlevel="1" lineno="50" slineno="1-17" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1007" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="20" groupid="14" style="2" owner="jchristopherson" level="1" deltag="end">Section <xref depth="3" refnumber="80-3-402" start="0">80-3-402</xref>, regarding dispositional hearings;</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-8" dnum="iv-o:_-i" numlevel="1" lineno="51" slineno="1-18" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1008" style="2" owner="o" level="1" deltag="start">(iv)</amend></display><amend anum="0" ea="erase" pairid="23" groupid="17" style="2" owner="jchristopherson" level="1" deltag="end">Section <xref depth="3" refnumber="80-3-406" start="0">80-3-406</xref>, regarding reunification services; and</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-9" dnum="v-o:_-i" numlevel="1" lineno="52" slineno="1-19" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1009" style="2" owner="o" level="1" deltag="start">(v)</amend></display><amend anum="0" ea="erase" pairid="26" groupid="20" style="2" owner="jchristopherson" level="1" deltag="end">Section <xref depth="3" refnumber="80-3-409" start="0">80-3-409</xref>, regarding permanency hearings and petitions for termination;</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="3-null-10" dnum="d-o" numlevel="1" lineno="53" slineno="1-20" level="2"><display>(d)</display>receive recommendations from, and make recommendations to the governor, the <ln numlevel="1" lineno="54" slineno="1-21"/>Legislature, the attorney general, the division, the Office of Guardian Ad Litem, the <ln numlevel="1" lineno="55" slineno="1-22"/>juvenile court, and the public;</subsection><subsection ssid="3-null-11" dnum="e-o" numlevel="1" lineno="56" slineno="1-23" level="2" space="false"><display>(e)</display><subsection ssid="3-null-12" dnum="i-o" level="3" placement="sameline"><display>(i)</display>receive reports from the division and the Administrative Office of the Courts on <ln numlevel="1" lineno="57" slineno="1-24"/>budgetary issues impacting the child welfare system; and</subsection><subsection ssid="3-null-13" dnum="ii-o" numlevel="1" lineno="58" slineno="1-25" level="3"><display>(ii)</display>before December 1 of each year, recommend, as the panel considers advisable, <ln numlevel="1" lineno="59" slineno="1-26"/>budgetary proposals to the Social Services Appropriations Subcommittee and the <ln numlevel="1" lineno="60" slineno="1-27"/>Criminal Justice Appropriations Subcommittee;</subsection></subsection><subsection ssid="3-null-14" dnum="f-o" numlevel="1" lineno="61" slineno="1-28" level="2"><display>(f)</display>study and recommend changes to laws governing the child welfare system;</subsection><subsection ssid="3-null-15" dnum="g-o" numlevel="1" lineno="62" slineno="1-29" level="2"><display>(g)</display>study actions the state can take to preserve, unify, and strengthen the child's family <ln numlevel="1" lineno="63" slineno="1-30"/>ties whenever possible in the child's best interest, including recognizing the <ln numlevel="1" lineno="64" slineno="1-31"/>constitutional rights and claims of parents if those family ties are severed or infringed;</subsection><subsection ssid="3-null-16" dnum="h-o" numlevel="1" lineno="65" slineno="1-32" level="2"><display>(h)</display>perform other duties related to the oversight of the child welfare system as the panel <ln numlevel="1" lineno="66" slineno="1-33"/>considers appropriate; and</subsection><subsection ssid="3-null-17" dnum="i-o" numlevel="1" lineno="67" slineno="1-34" level="2"><display>(i)</display>annually report the panel's findings and recommendations to the president of the <ln numlevel="1" lineno="68" slineno="1-35"/>Senate, the speaker of the House of Representatives, the Health and Human Services <ln numlevel="1" lineno="69" slineno="1-36"/>Interim Committee, and the Judiciary Interim Committee.</subsection></subsection><subsection ssid="3-null-18" dnum="2-o" numlevel="1" lineno="70" slineno="1-37" level="1" space="false"><display>(2)</display><subsection ssid="3-null-19" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The panel may:<subsection ssid="3-null-20" dnum="i-o" numlevel="1" lineno="71" slineno="1-38" level="3" tab="1"><display>(i)</display>review and discuss individual child welfare cases;</subsection><subsection ssid="3-null-21" dnum="ii-o" numlevel="1" lineno="72" slineno="1-39" level="3" tab="1"><display>(ii)</display>make recommendations to the Legislature, the governor, the Board of Juvenile <ln numlevel="1" lineno="73" slineno="1-40"/>Court Judges, the division, and any other statutorily created entity related to the <ln numlevel="1" lineno="74" slineno="1-41"/>policies and procedures of the child welfare system; and</subsection><subsection ssid="3-null-22" dnum="iii-o" numlevel="1" lineno="75" slineno="1-42" level="3" tab="1"><display>(iii)</display>hold public hearings, as the panel considers advisable, in various locations within <ln numlevel="1" lineno="76" slineno="1-43"/>the state to afford all interested persons an opportunity to appear and present the <ln numlevel="1" lineno="77" slineno="1-44"/>persons' views regarding the child welfare system.</subsection></subsection><subsection ssid="3-null-23" dnum="b-o" numlevel="1" lineno="78" slineno="1-45" level="2" space="false"><display>(b)</display><subsection ssid="3-null-24" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the panel discusses an individual child welfare case, the panel shall close the <ln numlevel="1" lineno="79" slineno="1-46"/>panel's meeting in accordance with <xref depth="1" refnumber="52-4" start="0">Title 52, Chapter 4, Open and Public Meetings <ln numlevel="1" lineno="80" slineno="1-47"/>Act</xref>.</subsection><subsection ssid="3-null-25" dnum="ii-o" numlevel="1" lineno="81" slineno="1-48" level="3"><display>(ii)</display>If the panel discusses an individual child welfare case, the panel shall make <ln numlevel="1" lineno="82" slineno="1-49"/>reasonable efforts to identify and consider the concerns of all parties to the case.</subsection><subsection ssid="3-null-26" dnum="iii-o" numlevel="1" lineno="83" slineno="1-50" level="3"><display>(iii)</display>The panel may not make recommendations to the court, the division, or any other <ln numlevel="1" lineno="84" slineno="1-51"/>public or private entity regarding the disposition of an individual child welfare <ln numlevel="1" lineno="85" slineno="1-52"/>case.</subsection></subsection></subsection><subsection ssid="3-null-27" dnum="3-o" numlevel="1" lineno="86" slineno="1-53" level="1" space="false"><display>(3)</display><subsection ssid="3-null-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A record of the panel regarding an individual child welfare case:<subsection ssid="3-null-29" dnum="i-o" numlevel="1" lineno="87" slineno="1-54" level="3" tab="1"><display>(i)</display>is classified as private under Section <xref depth="3" refnumber="63G-2-302" start="0">63G-2-302</xref>; and</subsection><subsection ssid="3-null-30" dnum="ii-o" numlevel="1" lineno="88" slineno="1-55" level="3" tab="1"><display>(ii)</display>may be disclosed only in accordance with federal law and <xref depth="1" refnumber="63G-2" start="0">Title 63G, Chapter 2, <ln numlevel="1" lineno="89" slineno="1-56"/>Government Records Access and Management Act</xref>.</subsection></subsection><subsection ssid="3-null-31" dnum="b-o" numlevel="1" lineno="90" slineno="1-57" level="2" space="false"><display>(b)</display><subsection ssid="3-null-32" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The panel shall have access to all of the division's records, including records <ln numlevel="1" lineno="91" slineno="1-58"/>regarding individual child welfare cases.</subsection><subsection ssid="3-null-33" dnum="ii-o" numlevel="1" lineno="92" slineno="1-59" level="3"><display>(ii)</display>In accordance with <xref depth="1" refnumber="63G-2" start="0">Title 63G, Chapter 2, Government Records Access and <ln numlevel="1" lineno="93" slineno="1-60"/>Management Act</xref>, all documents and information received by the panel from the <ln numlevel="1" lineno="94" slineno="1-61"/>division shall maintain the same classification under <xref depth="1" refnumber="63G-2" start="0">Title 63G, Chapter 2, <ln numlevel="1" lineno="95" slineno="1-62"/>Government Records Access and Management Act</xref>, that was designated by the <ln numlevel="1" lineno="96" slineno="1-63"/>division.</subsection></subsection></subsection><subsection ssid="3-null-34" dnum="4-o" numlevel="1" lineno="97" slineno="1-64" level="1"><display>(4)</display>In order to accomplish the panel's oversight functions under this section, the panel has:<subsection ssid="3-null-35" dnum="a-o" numlevel="1" lineno="98" slineno="1-65" level="2"><display>(a)</display>all powers granted to legislative interim committees in Section <xref depth="3" refnumber="36-12-11" start="0">36-12-11</xref>; and</subsection><subsection ssid="3-null-36" dnum="b-o" numlevel="1" lineno="99" slineno="1-66" level="2"><display>(b)</display>legislative subpoena powers under, <xref depth="1" refnumber="36-14" start="1">Chapter 14, Legislative Subpoena Powers</xref>.</subsection></subsection></section></bsec><bsec buid="11" num="78A-4-201" type="amend" src="code" uid="C78A-4-S201_2026050620260506" sort="78A04 02010020260506" numlevel="1" lineno="100" slineno="2-1" sn="2"><section number="78A-4-201" numlevel="1" lineno="101" slineno="2-2" type="amend"><secline lineno="100">Section 2. Section <bold>78A-4-201</bold> is amended to read:</secline><catline lineno="101"><bold>78A-4-201<parens/>. Appellate review of juvenile courts.</bold></catline><subsection ssid="11-1" dnum="_-o:1-i" numlevel="1" lineno="102" slineno="2-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="both">(1)</amend></display>To uphold the clear and compelling fundamental liberty interests and <ln numlevel="1" lineno="103" slineno="2-4"/>constitutionally protected rights of parents and the strong public policy in favor of <ln numlevel="1" lineno="104" slineno="2-5"/>maximizing family unification, appropriate appellate review shall be made available and <ln numlevel="1" lineno="105" slineno="2-6"/>applied in furtherance of those interests.</subsection><subsection ssid="11-2" dnum="_-o:2-i" numlevel="1" lineno="106" slineno="2-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">All parties in a child welfare case have a strong interest in a timely resolution of an <ln numlevel="1" lineno="107" slineno="2-8"/>appeal.</amend></subsection><subsection ssid="11-3" dnum="_-o:3-i" numlevel="1" lineno="108" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">Appellate courts shall:</amend><subsection ssid="11-4" dnum="_-o:a-i" numlevel="1" lineno="109" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">prioritize review and appeals of child welfare cases; and</amend></subsection><subsection ssid="11-5" dnum="_-o:b-i" numlevel="1" lineno="110" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">consider and implement procedures to facilitate a timely resolution of an appeal of a <ln numlevel="1" lineno="111" slineno="2-12"/>child welfare case.</amend></subsection></subsection></section></bsec><bsec buid="15" num="80-1-102" type="amend" src="code" uid="C80-1-S102_2026050620260506" sort="80 01 01020020260506" numlevel="1" lineno="112" slineno="3-1" sn="3"><section number="80-1-102" numlevel="1" lineno="113" slineno="3-2" type="amend"><secline lineno="112">Section 3. Section <bold>80-1-102</bold> is amended to read:</secline><catline lineno="113"><bold>80-1-102<parens/>. Juvenile Code definitions.</bold></catline><sectionText lineno="114"><tab/>Except as provided in Section <xref depth="3" refnumber="80-6-1103">80-6-1103</xref>, as used in this title:</sectionText><subsection ssid="15-null-1" dnum="1-o" numlevel="1" lineno="115" slineno="3-4" level="1" space="false"><display>(1)</display><subsection ssid="15-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Abuse" means:<subsection ssid="15-null-3" dnum="i-o" numlevel="1" lineno="116" slineno="3-5" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="15-null-4" dnum="A-o" level="4" placement="sameline"><display>(A)</display>nonaccidental harm of a child;</subsection><subsection ssid="15-null-5" dnum="B-o" numlevel="1" lineno="117" slineno="3-6" level="4"><display>(B)</display>threatened harm of a child;</subsection><subsection ssid="15-null-6" dnum="C-o" numlevel="1" lineno="118" slineno="3-7" level="4"><display>(C)</display>sexual exploitation;</subsection><subsection ssid="15-null-7" dnum="D-o" numlevel="1" lineno="119" slineno="3-8" level="4"><display>(D)</display>sexual abuse; or</subsection><subsection ssid="15-null-8" dnum="E-o" numlevel="1" lineno="120" slineno="3-9" level="4"><display>(E)</display>human trafficking of a child in violation of Section <xref depth="3" refnumber="76-5-308.5">76-5-308.5</xref>; or</subsection></subsection><subsection ssid="15-null-9" dnum="ii-o" numlevel="1" lineno="121" slineno="3-10" level="3" tab="1"><display>(ii)</display>that a child's parent:<subsection ssid="15-null-10" dnum="A-o" numlevel="1" lineno="122" slineno="3-11" level="4"><display>(A)</display>intentionally, knowingly, or recklessly causes the death of another parent of <ln numlevel="1" lineno="123" slineno="3-12"/>the child;</subsection><subsection ssid="15-null-11" dnum="B-o" numlevel="1" lineno="124" slineno="3-13" level="4"><display>(B)</display>is identified by a law enforcement agency as the primary suspect in an <ln numlevel="1" lineno="125" slineno="3-14"/>investigation for intentionally, knowingly, or recklessly causing the death of <ln numlevel="1" lineno="126" slineno="3-15"/>another parent of the child; or</subsection><subsection ssid="15-null-12" dnum="C-o" numlevel="1" lineno="127" slineno="3-16" level="4"><display>(C)</display>is being prosecuted for or has been convicted of intentionally, knowingly, or <ln numlevel="1" lineno="128" slineno="3-17"/>recklessly causing the death of another parent of the child.</subsection></subsection></subsection><subsection ssid="15-null-13" dnum="b-o" numlevel="1" lineno="129" slineno="3-18" level="2"><display>(b)</display>"Abuse" does not include:<subsection ssid="15-null-14" dnum="i-o" numlevel="1" lineno="130" slineno="3-19" level="3"><display>(i)</display>reasonable discipline or management of a child, including withholding privileges;</subsection><subsection ssid="15-null-15" dnum="ii-o" numlevel="1" lineno="131" slineno="3-20" level="3"><display>(ii)</display>conduct described in Section <xref depth="3" refnumber="76-2-401">76-2-401</xref>; or</subsection><subsection ssid="15-null-16" dnum="iii-o" numlevel="1" lineno="132" slineno="3-21" level="3"><display>(iii)</display>the use of reasonable and necessary physical restraint or force on a child:<subsection ssid="15-null-17" dnum="A-o" numlevel="1" lineno="133" slineno="3-22" level="4"><display>(A)</display>in self-defense;</subsection><subsection ssid="15-null-18" dnum="B-o" numlevel="1" lineno="134" slineno="3-23" level="4"><display>(B)</display>in defense of others;</subsection><subsection ssid="15-null-19" dnum="C-o" numlevel="1" lineno="135" slineno="3-24" level="4"><display>(C)</display>to protect the child; or</subsection><subsection ssid="15-null-20" dnum="D-o" numlevel="1" lineno="136" slineno="3-25" level="4"><display>(D)</display>to remove a weapon in the possession of a child for any of the reasons <ln numlevel="1" lineno="137" slineno="3-26"/>described in Subsections <xref depth="4" refnumber="80-1-102(1)(b)(iii)(a)">(1)(b)(iii)(A)</xref> through <xref depth="4" refnumber="80-1-102(c)">(C)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="15-null-21" dnum="2-o" numlevel="1" lineno="138" slineno="3-27" level="1"><display>(2)</display>"Abused child" means a child who has been subjected to abuse.</subsection><subsection ssid="15-null-22" dnum="3-o" numlevel="1" lineno="139" slineno="3-28" level="1" space="false"><display>(3)</display><subsection ssid="15-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Adjudication" means, except as provided in Subsection <xref depth="4" refnumber="80-1-102(3)(b)">(3)(b)</xref>:<subsection ssid="15-null-24" dnum="i-o" numlevel="1" lineno="140" slineno="3-29" level="3" tab="1"><display>(i)</display>for a delinquency petition or criminal information under Chapter 6, Juvenile <ln numlevel="1" lineno="141" slineno="3-30"/>Justice:<subsection ssid="15-null-25" dnum="A-o" numlevel="1" lineno="142" slineno="3-31" level="4"><display>(A)</display>a finding by the juvenile court that the facts alleged in a delinquency petition <ln numlevel="1" lineno="143" slineno="3-32"/>or criminal information alleging that a minor committed an offense have been <ln numlevel="1" lineno="144" slineno="3-33"/>proved;</subsection><subsection ssid="15-null-26" dnum="B-o" numlevel="1" lineno="145" slineno="3-34" level="4"><display>(B)</display>an admission by a minor in the juvenile court as described in Section <xref depth="3" refnumber="80-6-306">80-6-306</xref>; <ln numlevel="1" lineno="146" slineno="3-35"/>or</subsection><subsection ssid="15-null-27" dnum="C-o" numlevel="1" lineno="147" slineno="3-36" level="4"><display>(C)</display>a plea of no contest by minor in the juvenile court; or</subsection></subsection><subsection ssid="15-null-28" dnum="ii-o" numlevel="1" lineno="148" slineno="3-37" level="3" tab="1"><display>(ii)</display>for all other proceedings under this title, a finding by the juvenile court that the <ln numlevel="1" lineno="149" slineno="3-38"/>facts alleged in the petition have been proved.</subsection></subsection><subsection ssid="15-null-29" dnum="b-o" numlevel="1" lineno="150" slineno="3-39" level="2"><display>(b)</display>"Adjudication" does not include:<subsection ssid="15-null-30" dnum="i-o" numlevel="1" lineno="151" slineno="3-40" level="3"><display>(i)</display>an admission by a minor described in Section <xref depth="3" refnumber="80-6-306">80-6-306</xref> until the juvenile court <ln numlevel="1" lineno="152" slineno="3-41"/>enters the minor's admission; or</subsection><subsection ssid="15-null-31" dnum="ii-o" numlevel="1" lineno="153" slineno="3-42" level="3"><display>(ii)</display>a finding of not competent to proceed in accordance with Section <xref depth="3" refnumber="80-6-402">80-6-402</xref>.</subsection></subsection></subsection><subsection ssid="15-null-32" dnum="4-o" numlevel="1" lineno="154" slineno="3-43" level="1" space="false"><display>(4)</display><subsection ssid="15-null-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Adult" means an individual who is 18 years old or older.</subsection><subsection ssid="15-null-34" dnum="b-o" numlevel="1" lineno="155" slineno="3-44" level="2"><display>(b)</display>"Adult" does not include an individual:<subsection ssid="15-null-35" dnum="i-o" numlevel="1" lineno="156" slineno="3-45" level="3"><display>(i)</display>who is 18 years old or older; and</subsection><subsection ssid="15-null-36" dnum="ii-o" numlevel="1" lineno="157" slineno="3-46" level="3"><display>(ii)</display>who is a minor.</subsection></subsection></subsection><subsection ssid="15-null-37" dnum="5-o" numlevel="1" lineno="158" slineno="3-47" level="1"><display>(5)</display>"Attorney guardian ad litem" means the same as that term is defined in Section <xref depth="3" refnumber="78A-2-801"><ln numlevel="1" lineno="159" slineno="3-48"/>78A-2-801</xref>.</subsection><subsection ssid="15-null-38" dnum="6-o" numlevel="1" lineno="160" slineno="3-49" level="1"><display>(6)</display>"Board" means the Board of  Juvenile Court Judges.</subsection><subsection ssid="15-null-39" dnum="7-o" numlevel="1" lineno="161" slineno="3-50" level="1"><display>(7)</display>"Child" means, except as provided in Section <xref depth="3" refnumber="80-2-905">80-2-905</xref>, an individual who is under 18 <ln numlevel="1" lineno="162" slineno="3-51"/>years old.</subsection><subsection ssid="15-null-40" dnum="8-o" numlevel="1" lineno="163" slineno="3-52" level="1"><display>(8)</display>"Child and family plan" means a written agreement between a child's parents or <ln numlevel="1" lineno="164" slineno="3-53"/>guardian and the Division of Child and Family Services as described in Section <xref depth="3" refnumber="80-3-307">80-3-307</xref>.</subsection><subsection ssid="15-null-41" dnum="9-o" numlevel="1" lineno="165" slineno="3-54" level="1"><display>(9)</display>"Child placing" means the same as that term is defined in Section <xref depth="3" refnumber="26B-2-101">26B-2-101</xref>.</subsection><subsection ssid="15-null-42" dnum="10-o" numlevel="1" lineno="166" slineno="3-55" level="1"><display>(10)</display>"Child-placing agency" means the same as that term is defined in Section <xref depth="3" refnumber="26B-2-101">26B-2-101</xref>.</subsection><subsection ssid="15-null-43" dnum="11-o" numlevel="1" lineno="167" slineno="3-56" level="1"><display>(11)</display>"Child protection team" means a team consisting of:<subsection ssid="15-null-44" dnum="a-o" numlevel="1" lineno="168" slineno="3-57" level="2"><display>(a)</display>the child welfare caseworker assigned to the case;</subsection><subsection ssid="15-null-45" dnum="b-o" numlevel="1" lineno="169" slineno="3-58" level="2"><display>(b)</display>if applicable, the child welfare caseworker who made the decision to remove the <ln numlevel="1" lineno="170" slineno="3-59"/>child;</subsection><subsection ssid="15-null-46" dnum="c-o" numlevel="1" lineno="171" slineno="3-60" level="2"><display>(c)</display>a representative of the school or school district where the child attends school;</subsection><subsection ssid="15-null-47" dnum="d-o" numlevel="1" lineno="172" slineno="3-61" level="2"><display>(d)</display>if applicable, the law enforcement officer who removed the child from the home;</subsection><subsection ssid="15-null-48" dnum="e-o" numlevel="1" lineno="173" slineno="3-62" level="2"><display>(e)</display>a representative of the appropriate Children's Justice Center, if one is established <ln numlevel="1" lineno="174" slineno="3-63"/>within the county where the child resides;</subsection><subsection ssid="15-null-49" dnum="f-o" numlevel="1" lineno="175" slineno="3-64" level="2"><display>(f)</display>if appropriate, and known to the division, a therapist or counselor who is familiar <ln numlevel="1" lineno="176" slineno="3-65"/>with the child's circumstances;</subsection><subsection ssid="15-null-50" dnum="g-o" numlevel="1" lineno="177" slineno="3-66" level="2"><display>(g)</display>if appropriate, a representative of law enforcement selected by the chief of police or <ln numlevel="1" lineno="178" slineno="3-67"/>sheriff in the city or county where the child resides; and</subsection><subsection ssid="15-null-51" dnum="h-o" numlevel="1" lineno="179" slineno="3-68" level="2"><display>(h)</display>any other individuals determined appropriate and necessary by the team coordinator <ln numlevel="1" lineno="180" slineno="3-69"/>and chair.</subsection></subsection><subsection ssid="15-null-52" dnum="12-o" numlevel="1" lineno="181" slineno="3-70" level="1" space="false"><display>(12)</display><subsection ssid="15-null-53" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Chronic abuse" means repeated or patterned abuse.</subsection><subsection ssid="15-null-54" dnum="b-o" numlevel="1" lineno="182" slineno="3-71" level="2"><display>(b)</display>"Chronic abuse" does not mean an isolated incident of abuse.</subsection></subsection><subsection ssid="15-null-55" dnum="13-o" numlevel="1" lineno="183" slineno="3-72" level="1" space="false"><display>(13)</display><subsection ssid="15-null-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Chronic neglect" means repeated or patterned neglect.</subsection><subsection ssid="15-null-57" dnum="b-o" numlevel="1" lineno="184" slineno="3-73" level="2"><display>(b)</display>"Chronic neglect" does not mean an isolated incident of neglect.</subsection></subsection><subsection ssid="15-null-58" dnum="14-o" numlevel="1" lineno="185" slineno="3-74" level="1"><display>(14)</display>"Clandestine laboratory operation" means the same as that term is defined in Section <xref depth="3" refnumber="58-37d-3"><ln numlevel="1" lineno="186" slineno="3-75"/>58-37d-3</xref>.</subsection><subsection ssid="15-null-59" dnum="15-o" numlevel="1" lineno="187" slineno="3-76" level="1"><display>(15)</display>"Commit" or "committed" means, unless specified otherwise:<subsection ssid="15-null-60" dnum="a-o" numlevel="1" lineno="188" slineno="3-77" level="2"><display>(a)</display>with respect to a child, to transfer legal custody; and</subsection><subsection ssid="15-null-61" dnum="b-o" numlevel="1" lineno="189" slineno="3-78" level="2"><display>(b)</display>with respect to a minor who is at least 18 years old, to transfer custody.</subsection></subsection><subsection ssid="15-null-62" dnum="16-o" numlevel="1" lineno="190" slineno="3-79" level="1"><display>(16)</display>"Community-based program" means a nonsecure residential or nonresidential program, <ln numlevel="1" lineno="191" slineno="3-80"/>designated to supervise and rehabilitate juvenile offenders, that prioritizes the least <ln numlevel="1" lineno="192" slineno="3-81"/>restrictive setting, consistent with public safety, and operated by or under contract with <ln numlevel="1" lineno="193" slineno="3-82"/>the Division of Juvenile Justice and Youth Services.</subsection><subsection ssid="15-null-63" dnum="17-o" numlevel="1" lineno="194" slineno="3-83" level="1"><display>(17)</display>"Community placement" means placement of a minor in a community-based program <ln numlevel="1" lineno="195" slineno="3-84"/>described in Section <xref depth="3" refnumber="80-5-402">80-5-402</xref>.</subsection><subsection ssid="15-null-64" dnum="18-o" numlevel="1" lineno="196" slineno="3-85" level="1"><display>(18)</display>"Correctional facility" means:<subsection ssid="15-null-65" dnum="a-o" numlevel="1" lineno="197" slineno="3-86" level="2"><display>(a)</display>a county jail; or</subsection><subsection ssid="15-null-66" dnum="b-o" numlevel="1" lineno="198" slineno="3-87" level="2"><display>(b)</display>a secure correctional facility as defined in Section <xref depth="3" refnumber="64-13-1">64-13-1</xref>.</subsection></subsection><subsection ssid="15-null-67" dnum="19-o" numlevel="1" lineno="199" slineno="3-88" level="1"><display>(19)</display>"Criminogenic risk factors" means evidence-based factors that are associated with a <ln numlevel="1" lineno="200" slineno="3-89"/>minor's likelihood of reoffending.</subsection><subsection ssid="15-null-68" dnum="20-o" numlevel="1" lineno="201" slineno="3-90" level="1"><display>(20)</display>"Department" means the Department of Health and Human Services created in Section <xref depth="3" refnumber="26B-1-201"><ln numlevel="1" lineno="202" slineno="3-91"/>26B-1-201</xref>.</subsection><subsection ssid="15-null-69" dnum="21-o" numlevel="1" lineno="203" slineno="3-92" level="1"><display>(21)</display>"Dependent child" or "dependency" means a child who is without proper care through <ln numlevel="1" lineno="204" slineno="3-93"/>no fault of the child's parent,  guardian, or custodian.</subsection><subsection ssid="15-null-70" dnum="22-o" numlevel="1" lineno="205" slineno="3-94" level="1"><display>(22)</display>"Deprivation of custody" means transfer of legal custody by the juvenile court from a <ln numlevel="1" lineno="206" slineno="3-95"/>parent or a previous custodian to another person, agency, or institution.</subsection><subsection ssid="15-null-71" dnum="23-o" numlevel="1" lineno="207" slineno="3-96" level="1"><display>(23)</display>"Detention" means home detention or secure detention.</subsection><subsection ssid="15-null-72" dnum="24-o" numlevel="1" lineno="208" slineno="3-97" level="1"><display>(24)</display>"Detention facility" means a facility, established by the Division of Juvenile Justice <ln numlevel="1" lineno="209" slineno="3-98"/>and Youth Services in accordance with Section <xref depth="3" refnumber="80-5-501">80-5-501</xref>, for minors held in detention.</subsection><subsection ssid="15-null-73" dnum="25-o" numlevel="1" lineno="210" slineno="3-99" level="1"><display>(25)</display>"Detention risk assessment tool" means an evidence-based tool established under <ln numlevel="1" lineno="211" slineno="3-100"/>Section <xref depth="3" refnumber="80-5-203">80-5-203</xref> that:<subsection ssid="15-null-74" dnum="a-o" numlevel="1" lineno="212" slineno="3-101" level="2"><display>(a)</display>assesses a minor's risk of failing to appear in court or reoffending before <ln numlevel="1" lineno="213" slineno="3-102"/>adjudication; and</subsection><subsection ssid="15-null-75" dnum="b-o" numlevel="1" lineno="214" slineno="3-103" level="2"><display>(b)</display>is designed to assist in making a determination of whether a minor shall be held in <ln numlevel="1" lineno="215" slineno="3-104"/>detention.</subsection></subsection><subsection ssid="15-null-76" dnum="26-o" numlevel="1" lineno="216" slineno="3-105" level="1"><display>(26)</display>"Developmental immaturity" means incomplete development in one or more domains <ln numlevel="1" lineno="217" slineno="3-106"/>that manifests as a functional limitation in the minor's present ability to:<subsection ssid="15-null-77" dnum="a-o" numlevel="1" lineno="218" slineno="3-107" level="2"><display>(a)</display>consult with counsel with a reasonable degree of rational understanding; and</subsection><subsection ssid="15-null-78" dnum="b-o" numlevel="1" lineno="219" slineno="3-108" level="2"><display>(b)</display>have a rational as well as factual understanding of the proceedings.</subsection></subsection><subsection ssid="15-null-79" dnum="27-o" numlevel="1" lineno="220" slineno="3-109" level="1"><display>(27)</display>"Disposition" means an order by a juvenile court, after the adjudication of a minor, <ln numlevel="1" lineno="221" slineno="3-110"/>under Section <xref depth="3" refnumber="80-3-405">80-3-405</xref> or <xref depth="3" refnumber="80-4-305">80-4-305</xref> or Chapter 6, Part 7, Adjudication and Disposition.</subsection><subsection ssid="15-null-80" dnum="28-o" numlevel="1" lineno="222" slineno="3-111" level="1"><display>(28)</display>"Educational neglect" means that, after receiving a notice of compulsory education <ln numlevel="1" lineno="223" slineno="3-112"/>violation under Section <xref depth="3" refnumber="53G-6-202">53G-6-202</xref>, the parent or guardian fails to make a good faith <ln numlevel="1" lineno="224" slineno="3-113"/>effort to ensure that the child receives an appropriate education.</subsection><subsection ssid="15-null-81" dnum="29-o" numlevel="1" lineno="225" slineno="3-114" level="1"><display>(29)</display>"Educational series" means an evidence-based instructional series:<subsection ssid="15-null-82" dnum="a-o" numlevel="1" lineno="226" slineno="3-115" level="2"><display>(a)</display>obtained at a substance abuse program that is approved by the Division of Integrated <ln numlevel="1" lineno="227" slineno="3-116"/>Healthcare in accordance with Section <xref depth="3" refnumber="26B-5-104">26B-5-104</xref>; and</subsection><subsection ssid="15-null-83" dnum="b-o" numlevel="1" lineno="228" slineno="3-117" level="2"><display>(b)</display>designed to prevent substance use or the onset of a mental health disorder.</subsection></subsection><subsection ssid="15-null-84" dnum="30-o" numlevel="1" lineno="229" slineno="3-118" level="1"><display>(30)</display>"Emancipated" means the same as that term is defined in Section <xref depth="3" refnumber="80-7-102">80-7-102</xref>.</subsection><subsection ssid="15-null-85" dnum="31-o" numlevel="1" lineno="230" slineno="3-119" level="1"><display>(31)</display>"Evidence-based" means a program or practice that has had multiple randomized <ln numlevel="1" lineno="231" slineno="3-120"/>control studies or a meta-analysis demonstrating that the program or practice is effective <ln numlevel="1" lineno="232" slineno="3-121"/>for a specific population or has been rated as effective by a standardized program <ln numlevel="1" lineno="233" slineno="3-122"/>evaluation tool.</subsection><subsection ssid="15-null-86" dnum="32-o" numlevel="1" lineno="234" slineno="3-123" level="1"><display>(32)</display>"Forensic evaluator" means the same as that term is defined in Section <xref depth="3" refnumber="77-15-2">77-15-2</xref>.</subsection><subsection ssid="15-null-87" dnum="33-o" numlevel="1" lineno="235" slineno="3-124" level="1"><display>(33)</display>"Formal probation" means a minor is:<subsection ssid="15-null-88" dnum="a-o" numlevel="1" lineno="236" slineno="3-125" level="2"><display>(a)</display>supervised in the community by, and reports to, a juvenile probation officer or an <ln numlevel="1" lineno="237" slineno="3-126"/>agency designated by the juvenile court; and</subsection><subsection ssid="15-null-89" dnum="b-o" numlevel="1" lineno="238" slineno="3-127" level="2"><display>(b)</display>subject to return to the juvenile court in accordance with Section <xref depth="3" refnumber="80-6-607">80-6-607</xref>.</subsection></subsection><subsection ssid="15-null-90" dnum="34-o" numlevel="1" lineno="239" slineno="3-128" level="1"><display>(34)</display>"Gender identity" means the same as that term is defined in Section <xref depth="3" refnumber="34A-5-102">34A-5-102</xref>.</subsection><subsection ssid="15-null-91" dnum="35-o" numlevel="1" lineno="240" slineno="3-129" level="1"><display>(35)</display>"Group rehabilitation therapy" means psychological and social counseling of one or <ln numlevel="1" lineno="241" slineno="3-130"/>more individuals in the group, depending upon the recommendation of the therapist.</subsection><subsection ssid="15-null-92" dnum="36-o" numlevel="1" lineno="242" slineno="3-131" level="1"><display>(36)</display>"Guardian" means a person appointed by a court to make decisions regarding a minor, <ln numlevel="1" lineno="243" slineno="3-132"/>including the authority to consent to:<subsection ssid="15-null-93" dnum="a-o" numlevel="1" lineno="244" slineno="3-133" level="2"><display>(a)</display>marriage;</subsection><subsection ssid="15-null-94" dnum="b-o" numlevel="1" lineno="245" slineno="3-134" level="2"><display>(b)</display>enlistment in the armed forces;</subsection><subsection ssid="15-null-95" dnum="c-o" numlevel="1" lineno="246" slineno="3-135" level="2"><display>(c)</display>major medical, surgical, or psychiatric treatment; or</subsection><subsection ssid="15-null-96" dnum="d-o" numlevel="1" lineno="247" slineno="3-136" level="2"><display>(d)</display>legal custody, if legal custody is not vested in another individual, agency, or <ln numlevel="1" lineno="248" slineno="3-137"/>institution.</subsection></subsection><subsection ssid="15-null-97" dnum="37-o" numlevel="1" lineno="249" slineno="3-138" level="1"><display>(37)</display>"Guardian ad litem" means the same as that term is defined in Section <xref depth="3" refnumber="78A-2-801">78A-2-801</xref>.</subsection><subsection ssid="15-null-98" dnum="38-o" numlevel="1" lineno="250" slineno="3-139" level="1"><display>(38)</display>"Harm" means:<subsection ssid="15-null-99" dnum="a-o" numlevel="1" lineno="251" slineno="3-140" level="2"><display>(a)</display>physical or developmental injury or damage;</subsection><subsection ssid="15-null-100" dnum="b-o" numlevel="1" lineno="252" slineno="3-141" level="2"><display>(b)</display>emotional damage that results in a serious impairment in the child's growth, <ln numlevel="1" lineno="253" slineno="3-142"/>development, behavior, or psychological functioning;</subsection><subsection ssid="15-null-101" dnum="c-o" numlevel="1" lineno="254" slineno="3-143" level="2"><display>(c)</display>sexual abuse; or</subsection><subsection ssid="15-null-102" dnum="d-o" numlevel="1" lineno="255" slineno="3-144" level="2"><display>(d)</display>sexual exploitation.</subsection></subsection><subsection ssid="15-null-103" dnum="39-o" numlevel="1" lineno="256" slineno="3-145" level="1"><display>(39)</display>"Home detention" means placement of a minor:<subsection ssid="15-null-104" dnum="a-o" numlevel="1" lineno="257" slineno="3-146" level="2"><display>(a)</display>if prior to a disposition, in the minor's home, or in a surrogate home with the consent <ln numlevel="1" lineno="258" slineno="3-147"/>of the minor's parent, guardian, or custodian, under terms and conditions established <ln numlevel="1" lineno="259" slineno="3-148"/>by the Division of Juvenile Justice and Youth Services or the juvenile court; or</subsection><subsection ssid="15-null-105" dnum="b-o" numlevel="1" lineno="260" slineno="3-149" level="2"><display>(b)</display>if after a disposition, and in accordance with Section <xref depth="3" refnumber="78A-6-353">78A-6-353</xref> or <xref depth="3" refnumber="80-6-704">80-6-704</xref>, in the <ln numlevel="1" lineno="261" slineno="3-150"/>minor's home, or in a surrogate home with the consent of the minor's parent, <ln numlevel="1" lineno="262" slineno="3-151"/>guardian, or custodian, under terms and conditions established by the Division of <ln numlevel="1" lineno="263" slineno="3-152"/>Juvenile Justice and Youth Services or the juvenile court.</subsection></subsection><subsection ssid="15-null-106" dnum="40-o" numlevel="1" lineno="264" slineno="3-153" level="1" space="false"><display>(40)</display><subsection ssid="15-null-107" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Incest" means engaging in sexual intercourse with an individual whom the <ln numlevel="1" lineno="265" slineno="3-154"/>perpetrator knows to be the perpetrator's ancestor, descendant, brother, sister, uncle, <ln numlevel="1" lineno="266" slineno="3-155"/>aunt, nephew, niece, or first cousin.</subsection><subsection ssid="15-null-108" dnum="b-o" numlevel="1" lineno="267" slineno="3-156" level="2"><display>(b)</display>"Incest" includes:<subsection ssid="15-null-109" dnum="i-o" numlevel="1" lineno="268" slineno="3-157" level="3"><display>(i)</display>blood relationships of the whole or half blood, regardless of whether the <ln numlevel="1" lineno="269" slineno="3-158"/>relationship is legally recognized;</subsection><subsection ssid="15-null-110" dnum="ii-o" numlevel="1" lineno="270" slineno="3-159" level="3"><display>(ii)</display>relationships of parent and child by adoption; and</subsection><subsection ssid="15-null-111" dnum="iii-o" numlevel="1" lineno="271" slineno="3-160" level="3"><display>(iii)</display>relationships of stepparent and stepchild while the marriage creating the <ln numlevel="1" lineno="272" slineno="3-161"/>relationship of a stepparent and stepchild exists.</subsection></subsection></subsection><subsection ssid="15-null-112" dnum="41-o" numlevel="1" lineno="273" slineno="3-162" level="1"><display>(41)</display>"Indian child" means the same as that term is defined in 25 U.S.C. Sec. 1903.</subsection><subsection ssid="15-null-113" dnum="42-o" numlevel="1" lineno="274" slineno="3-163" level="1"><display>(42)</display>"Indian tribe" means the same as that term is defined in 25 U.S.C. Sec. 1903.</subsection><subsection ssid="15-null-114" dnum="43-o" numlevel="1" lineno="275" slineno="3-164" level="1"><display>(43)</display>"Indigent defense service provider" means the same as that term is defined in Section <xref depth="3" refnumber="78B-22-102"><ln numlevel="1" lineno="276" slineno="3-165"/>78B-22-102</xref>.</subsection><subsection ssid="15-null-115" dnum="44-o" numlevel="1" lineno="277" slineno="3-166" level="1"><display>(44)</display>"Indigent defense services" means the same as that term is defined in Section <xref depth="3" refnumber="78B-22-102"><ln numlevel="1" lineno="278" slineno="3-167"/>78B-22-102</xref>.</subsection><subsection ssid="15-null-116" dnum="45-o" numlevel="1" lineno="279" slineno="3-168" level="1"><display>(45)</display>"Indigent individual" means the same as that term is defined in Section <xref depth="3" refnumber="78B-22-102">78B-22-102</xref>.</subsection><subsection ssid="15-null-117" dnum="46-o" numlevel="1" lineno="280" slineno="3-169" level="1" space="false"><display>(46)</display><subsection ssid="15-null-118" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Intake probation" means a minor is:<subsection ssid="15-null-119" dnum="i-o" numlevel="1" lineno="281" slineno="3-170" level="3" tab="1"><display>(i)</display>monitored by a juvenile probation officer; and</subsection><subsection ssid="15-null-120" dnum="ii-o" numlevel="1" lineno="282" slineno="3-171" level="3" tab="1"><display>(ii)</display>subject to return to the juvenile court in accordance with Section <xref depth="3" refnumber="80-6-607">80-6-607</xref>.</subsection></subsection><subsection ssid="15-null-121" dnum="b-o" numlevel="1" lineno="283" slineno="3-172" level="2"><display>(b)</display>"Intake probation" does not include formal probation.</subsection></subsection><subsection ssid="15-null-122" dnum="47-o" numlevel="1" lineno="284" slineno="3-173" level="1"><display>(47)</display>"Intellectual disability" means a significant subaverage general intellectual functioning <ln numlevel="1" lineno="285" slineno="3-174"/>existing concurrently with deficits in adaptive behavior that constitutes a substantial <ln numlevel="1" lineno="286" slineno="3-175"/>limitation to the individual's ability to function in society.</subsection><subsection ssid="15-null-123" dnum="48-o" numlevel="1" lineno="287" slineno="3-176" level="1"><display>(48)</display>"Juvenile offender" means:<subsection ssid="15-null-124" dnum="a-o" numlevel="1" lineno="288" slineno="3-177" level="2"><display>(a)</display>a serious youth offender; or</subsection><subsection ssid="15-null-125" dnum="b-o" numlevel="1" lineno="289" slineno="3-178" level="2"><display>(b)</display>a youth offender.</subsection></subsection><subsection ssid="15-null-126" dnum="49-o" numlevel="1" lineno="290" slineno="3-179" level="1"><display>(49)</display>"Juvenile probation officer" means a probation officer appointed under Section <xref depth="3" refnumber="78A-6-205"><ln numlevel="1" lineno="291" slineno="3-180"/>78A-6-205</xref>.</subsection><subsection ssid="15-null-127" dnum="50-o" numlevel="1" lineno="292" slineno="3-181" level="1"><display>(50)</display>"Juvenile receiving center" means a nonsecure, nonresidential program established by <ln numlevel="1" lineno="293" slineno="3-182"/>the Division of Juvenile Justice and Youth Services, or under contract with the Division <ln numlevel="1" lineno="294" slineno="3-183"/>of Juvenile Justice and Youth Services, that is responsible for minors taken into <ln numlevel="1" lineno="295" slineno="3-184"/>temporary custody under Section <xref depth="3" refnumber="80-6-201">80-6-201</xref>.</subsection><subsection ssid="15-null-128" dnum="51-o" numlevel="1" lineno="296" slineno="3-185" level="1"><display>(51)</display>"Legal custody" means a relationship embodying:<subsection ssid="15-null-129" dnum="a-o" numlevel="1" lineno="297" slineno="3-186" level="2"><display>(a)</display>the right to physical custody  of the minor;</subsection><subsection ssid="15-null-130" dnum="b-o" numlevel="1" lineno="298" slineno="3-187" level="2"><display>(b)</display>the right and duty to protect, train, and discipline the minor;</subsection><subsection ssid="15-null-131" dnum="c-o" numlevel="1" lineno="299" slineno="3-188" level="2"><display>(c)</display>the duty to provide the minor with food, clothing, shelter, education, and ordinary <ln numlevel="1" lineno="300" slineno="3-189"/>medical care;</subsection><subsection ssid="15-null-132" dnum="d-o" numlevel="1" lineno="301" slineno="3-190" level="2"><display>(d)</display>the right to determine where and with whom the minor shall live; and</subsection><subsection ssid="15-null-133" dnum="e-o" numlevel="1" lineno="302" slineno="3-191" level="2"><display>(e)</display>the right, in an emergency, to authorize surgery or other extraordinary  care.</subsection></subsection><subsection ssid="15-null-134" dnum="52-o" numlevel="1" lineno="303" slineno="3-192" level="1"><display>(52)</display>"Licensing Information System" means the Licensing Information System maintained <ln numlevel="1" lineno="304" slineno="3-193"/>by the Division of Child and Family Services under Section <xref depth="3" refnumber="80-2-1002">80-2-1002</xref>.</subsection><subsection ssid="15-null-135" dnum="53-o" numlevel="1" lineno="305" slineno="3-194" level="1"><display>(53)</display>"Management Information System" means the Management Information System <ln numlevel="1" lineno="306" slineno="3-195"/>developed by the Division of Child and Family Services under Section <xref depth="3" refnumber="80-2-1001">80-2-1001</xref>.</subsection><subsection ssid="15-null-136" dnum="54-o" numlevel="1" lineno="307" slineno="3-196" level="1"><display>(54)</display>"Mental illness" means:<subsection ssid="15-null-137" dnum="a-o" numlevel="1" lineno="308" slineno="3-197" level="2"><display>(a)</display>a psychiatric disorder that substantially impairs an individual's mental, emotional, <ln numlevel="1" lineno="309" slineno="3-198"/>behavioral, or related functioning; or</subsection><subsection ssid="15-null-138" dnum="b-o" numlevel="1" lineno="310" slineno="3-199" level="2"><display>(b)</display>the same as that term is defined in:<subsection ssid="15-null-139" dnum="i-o" numlevel="1" lineno="311" slineno="3-200" level="3"><display>(i)</display>the current edition of the Diagnostic and Statistical Manual of Mental Disorders <ln numlevel="1" lineno="312" slineno="3-201"/>published by the American Psychiatric Association; or</subsection><subsection ssid="15-null-140" dnum="ii-o" numlevel="1" lineno="313" slineno="3-202" level="3"><display>(ii)</display>the current edition of the International Statistical Classification of Diseases and <ln numlevel="1" lineno="314" slineno="3-203"/>Related Health Problems.</subsection></subsection></subsection><subsection ssid="15-null-141" dnum="55-o" numlevel="1" lineno="315" slineno="3-204" level="1"><display>(55)</display>"Minor" means, except as provided in Sections <xref depth="3" refnumber="80-6-501">80-6-501</xref>, <xref depth="3" refnumber="80-6-901">80-6-901</xref>, and <xref depth="3" refnumber="80-7-102">80-7-102</xref>:<subsection ssid="15-null-142" dnum="a-o" numlevel="1" lineno="316" slineno="3-205" level="2"><display>(a)</display>a child; or</subsection><subsection ssid="15-null-143" dnum="b-o" numlevel="1" lineno="317" slineno="3-206" level="2"><display>(b)</display>an individual:<subsection ssid="15-null-144" dnum="i-o" numlevel="1" lineno="318" slineno="3-207" level="3" space="false"><display>(i)</display><subsection ssid="15-null-145" dnum="A-o" level="4" placement="sameline"><display>(A)</display>who is at least 18 years old and younger than 21 years old; and</subsection><subsection ssid="15-null-146" dnum="B-o" numlevel="1" lineno="319" slineno="3-208" level="4"><display>(B)</display>for whom the Division of Child and Family Services has been specifically <ln numlevel="1" lineno="320" slineno="3-209"/>ordered by the juvenile court to provide services because the individual was an <ln numlevel="1" lineno="321" slineno="3-210"/>abused, neglected, or dependent child or because the individual was <ln numlevel="1" lineno="322" slineno="3-211"/>adjudicated for an offense;</subsection></subsection><subsection ssid="15-null-147" dnum="ii-o" numlevel="1" lineno="323" slineno="3-212" level="3" space="false"><display>(ii)</display><subsection ssid="15-null-148" dnum="A-o" level="4" placement="sameline"><display>(A)</display>who is at least 18 years old and younger than 25 years old; and</subsection><subsection ssid="15-null-149" dnum="B-o" numlevel="1" lineno="324" slineno="3-213" level="4"><display>(B)</display>whose case is under the jurisdiction of the juvenile court in accordance with <ln numlevel="1" lineno="325" slineno="3-214"/>Subsection <xref depth="4" refnumber="78A-6-103(1)(b)">78A-6-103(1)(b)</xref>; or</subsection></subsection><subsection ssid="15-null-150" dnum="iii-o" numlevel="1" lineno="326" slineno="3-215" level="3" space="false"><display>(iii)</display><subsection ssid="15-null-151" dnum="A-o" level="4" placement="sameline"><display>(A)</display>who is at least 18 years old and younger than 21 years old; and</subsection><subsection ssid="15-null-152" dnum="B-o" numlevel="1" lineno="327" slineno="3-216" level="4"><display>(B)</display>whose case is under the jurisdiction of the juvenile court in accordance with <ln numlevel="1" lineno="328" slineno="3-217"/>Subsection <xref depth="4" refnumber="78A-6-103(1)(c)">78A-6-103(1)(c)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="15-null-153" dnum="56-o" numlevel="1" lineno="329" slineno="3-218" level="1"><display>(56)</display>"Mobile crisis outreach team" means the same as that term is defined in Section <xref depth="3" refnumber="26B-5-101"><ln numlevel="1" lineno="330" slineno="3-219"/>26B-5-101</xref>.</subsection><subsection ssid="15-null-154" dnum="57-o" numlevel="1" lineno="331" slineno="3-220" level="1"><display>(57)</display>"Molestation" means that an individual, with the intent to arouse or gratify the sexual <ln numlevel="1" lineno="332" slineno="3-221"/>desire of any individual, touches the anus, buttocks, pubic area, or genitalia of any child, <ln numlevel="1" lineno="333" slineno="3-222"/>or the breast of a female child, or takes indecent liberties with a child as defined in <ln numlevel="1" lineno="334" slineno="3-223"/>Section <xref depth="3" refnumber="76-5-401.1">76-5-401.1</xref>.</subsection><subsection ssid="15-null-155" dnum="58-o" numlevel="1" lineno="335" slineno="3-224" level="1" space="false"><display>(58)</display><subsection ssid="15-null-156" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Neglect" means action or inaction causing:<subsection ssid="15-null-157" dnum="i-o" numlevel="1" lineno="336" slineno="3-225" level="3" tab="1"><display>(i)</display>abandonment of a child, except as provided in Chapter 4, Part 5, Safe <ln numlevel="1" lineno="337" slineno="3-226"/>Relinquishment of a Newborn Child;</subsection><subsection ssid="15-null-158" dnum="ii-o" numlevel="1" lineno="338" slineno="3-227" level="3" tab="1"><display>(ii)</display>lack of proper parental care of a child by reason of the fault or habits of the <ln numlevel="1" lineno="339" slineno="3-228"/>parent, guardian, or custodian;</subsection><subsection ssid="15-null-159" dnum="iii-o" numlevel="1" lineno="340" slineno="3-229" level="3" tab="1"><display>(iii)</display>failure or refusal of a parent, guardian, or custodian to provide proper or <ln numlevel="1" lineno="341" slineno="3-230"/>necessary subsistence or medical care, or any other care necessary for the child's <ln numlevel="1" lineno="342" slineno="3-231"/>health, safety, morals, or well-being;</subsection><subsection ssid="15-null-160" dnum="iv-o" numlevel="1" lineno="343" slineno="3-232" level="3" tab="1"><display>(iv)</display>a child to be at risk of being neglected or abused because another child in the <ln numlevel="1" lineno="344" slineno="3-233"/>same home is neglected or abused;</subsection><subsection ssid="15-null-161" dnum="v-o" numlevel="1" lineno="345" slineno="3-234" level="3" tab="1"><display>(v)</display>abandonment of a child through an unregulated child custody transfer under <ln numlevel="1" lineno="346" slineno="3-235"/>Section <xref depth="3" refnumber="81-14-203">81-14-203</xref>; or</subsection><subsection ssid="15-null-162" dnum="vi-o" numlevel="1" lineno="347" slineno="3-236" level="3" tab="1"><display>(vi)</display>educational neglect.</subsection></subsection><subsection ssid="15-null-163" dnum="b-o" numlevel="1" lineno="348" slineno="3-237" level="2"><display>(b)</display>"Neglect" does not include:<subsection ssid="15-null-164" dnum="i-o" numlevel="1" lineno="349" slineno="3-238" level="3"><display>(i)</display>a parent or guardian legitimately practicing religious beliefs and who, for that <ln numlevel="1" lineno="350" slineno="3-239"/>reason, does not provide specified medical treatment for a child;</subsection><subsection ssid="15-null-165" dnum="ii-o" numlevel="1" lineno="351" slineno="3-240" level="3"><display>(ii)</display>a health care decision made for a child by the child's parent or guardian, unless <ln numlevel="1" lineno="352" slineno="3-241"/>the state or other party to a proceeding shows, by clear and convincing evidence, <ln numlevel="1" lineno="353" slineno="3-242"/>that the health care decision is not reasonable and informed;</subsection><subsection ssid="15-null-166" dnum="iii-o" numlevel="1" lineno="354" slineno="3-243" level="3"><display>(iii)</display>a parent or guardian exercising the right described in Section <xref depth="3" refnumber="80-3-304">80-3-304</xref>; or</subsection><subsection ssid="15-null-167" dnum="iv-o" numlevel="1" lineno="355" slineno="3-244" level="3"><display>(iv)</display>permitting a child, whose basic needs are met and who is of sufficient age and <ln numlevel="1" lineno="356" slineno="3-245"/>maturity to avoid harm or unreasonable risk of harm, to engage in independent <ln numlevel="1" lineno="357" slineno="3-246"/>activities, including:<subsection ssid="15-null-168" dnum="A-o" numlevel="1" lineno="358" slineno="3-247" level="4"><display>(A)</display>traveling to and from school, including by walking, running, or bicycling;</subsection><subsection ssid="15-null-169" dnum="B-o" numlevel="1" lineno="359" slineno="3-248" level="4"><display>(B)</display>traveling to and from nearby commercial or recreational facilities;</subsection><subsection ssid="15-null-170" dnum="C-o" numlevel="1" lineno="360" slineno="3-249" level="4"><display>(C)</display>engaging in outdoor play;</subsection><subsection ssid="15-null-171" dnum="D-o" numlevel="1" lineno="361" slineno="3-250" level="4"><display>(D)</display>remaining in a vehicle unattended, except under the conditions described in <ln numlevel="1" lineno="362" slineno="3-251"/>Subsection <xref tempid="894" depth="4" refnumber="76-5-115(2)">76-5-115(2)</xref>;</subsection><subsection ssid="15-null-172" dnum="E-o" numlevel="1" lineno="363" slineno="3-252" level="4"><display>(E)</display>remaining at home unattended; or</subsection><subsection ssid="15-null-173" dnum="F-o" numlevel="1" lineno="364" slineno="3-253" level="4"><display>(F)</display>engaging in a similar independent activity.</subsection></subsection></subsection></subsection><subsection ssid="15-null-174" dnum="59-o" numlevel="1" lineno="365" slineno="3-254" level="1"><display>(59)</display>"Neglected child" means a child who has been subjected to neglect.</subsection><subsection ssid="15-null-175" dnum="60-o" numlevel="1" lineno="366" slineno="3-255" level="1"><display>(60)</display>"Nonjudicial adjustment" means closure of the case by the assigned juvenile probation <ln numlevel="1" lineno="367" slineno="3-256"/>officer, without an adjudication of the minor's case under Section <xref depth="3" refnumber="80-6-701">80-6-701</xref>, upon the <ln numlevel="1" lineno="368" slineno="3-257"/>consent in writing of:<subsection ssid="15-null-176" dnum="a-o" numlevel="1" lineno="369" slineno="3-258" level="2"><display>(a)</display>the assigned juvenile probation officer; and</subsection><subsection ssid="15-null-177" dnum="b-o" numlevel="1" lineno="370" slineno="3-259" level="2" space="false"><display>(b)</display><subsection ssid="15-null-178" dnum="i-o" level="3" placement="sameline"><display>(i)</display>the minor; or</subsection><subsection ssid="15-null-179" dnum="ii-o" numlevel="1" lineno="371" slineno="3-260" level="3"><display>(ii)</display>the minor and the minor's parent, guardian, or custodian.</subsection></subsection></subsection><subsection ssid="15-null-180" dnum="61-o" numlevel="1" lineno="372" slineno="3-261" level="1"><display>(61)</display>"Not competent to proceed" means that a minor, due to a mental illness, intellectual <ln numlevel="1" lineno="373" slineno="3-262"/>disability or related condition, or developmental immaturity, lacks the ability to:<subsection ssid="15-null-181" dnum="a-o" numlevel="1" lineno="374" slineno="3-263" level="2"><display>(a)</display>understand the nature of the proceedings against the minor or of the potential <ln numlevel="1" lineno="375" slineno="3-264"/>disposition for the offense charged; or</subsection><subsection ssid="15-null-182" dnum="b-o" numlevel="1" lineno="376" slineno="3-265" level="2"><display>(b)</display>consult with counsel and participate in the proceedings against the minor with a <ln numlevel="1" lineno="377" slineno="3-266"/>reasonable degree of rational understanding.</subsection></subsection><subsection ssid="15-null-183" dnum="62-o" numlevel="1" lineno="378" slineno="3-267" level="1" space="false"><display>(62)</display><subsection ssid="15-null-184" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Parent" means, except as provided in Section <xref depth="3" refnumber="80-3-302">80-3-302</xref>, an individual with a <ln numlevel="1" lineno="379" slineno="3-268"/>parent-child relationship to a minor under Section <xref depth="3" refnumber="81-5-201">81-5-201</xref>.</subsection><subsection ssid="15-null-185" dnum="b-o" numlevel="1" lineno="380" slineno="3-269" level="2"><display>(b)</display>"Parent" includes the minor's noncustodial parent as defined in Section <xref depth="3" refnumber="81-1-101">81-1-101</xref>.</subsection></subsection><subsection ssid="15-null-186" dnum="63-o" numlevel="1" lineno="381" slineno="3-270" level="1"><display>(63)</display>"Parole" means a conditional release of a juvenile offender from residency in secure <ln numlevel="1" lineno="382" slineno="3-271"/>care to live outside of secure care under the supervision of the Division of Juvenile <ln numlevel="1" lineno="383" slineno="3-272"/>Justice and Youth Services, or another person designated by the Division of Juvenile <ln numlevel="1" lineno="384" slineno="3-273"/>Justice and Youth Services.</subsection><subsection ssid="15-null-187" dnum="64-o" numlevel="1" lineno="385" slineno="3-274" level="1"><display>(64)</display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both">"Permanency" means a permanent, safe, and stable living environment for a minor.</amend></subsection><subsection ssid="15-325" dnum="_-o:65-i" numlevel="1" lineno="386" slineno="3-275" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1229" style="1" owner="i" level="1" amendtag="both">(65)</amend></display>"Physical abuse" means abuse that results in physical injury or damage to a child.</subsection><subsection ssid="15-null-188" dnum="65-o:66-i" numlevel="1" lineno="387" slineno="3-276" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1230" style="2" owner="o" level="1" deltag="both">(65)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1231" style="1" owner="i" level="1" amendtag="both" space="true">(66)</amend></display><subsection ssid="15-null-189" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Probation" means a legal status created by court order, following an <ln numlevel="1" lineno="388" slineno="3-277"/>adjudication under Section <xref depth="3" refnumber="80-6-701">80-6-701</xref>, whereby the minor is permitted to remain in the <ln numlevel="1" lineno="389" slineno="3-278"/>minor's home under prescribed conditions.</subsection><subsection ssid="15-null-190" dnum="b-o" numlevel="1" lineno="390" slineno="3-279" level="2"><display>(b)</display>"Probation" includes intake probation or formal probation.</subsection></subsection><subsection ssid="15-null-191" dnum="66-o:67-i" numlevel="1" lineno="391" slineno="3-280" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1233" style="2" owner="o" level="1" deltag="both">(66)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1234" style="1" owner="i" level="1" amendtag="both" space="true">(67)</amend></display>"Prosecuting attorney" means:<subsection ssid="15-null-192" dnum="a-o" numlevel="1" lineno="392" slineno="3-281" level="2"><display>(a)</display>the attorney general and any assistant attorney general;</subsection><subsection ssid="15-null-193" dnum="b-o" numlevel="1" lineno="393" slineno="3-282" level="2"><display>(b)</display>any district attorney or deputy district attorney;</subsection><subsection ssid="15-null-194" dnum="c-o" numlevel="1" lineno="394" slineno="3-283" level="2"><display>(c)</display>any county attorney or assistant county attorney; and</subsection><subsection ssid="15-null-195" dnum="d-o" numlevel="1" lineno="395" slineno="3-284" level="2"><display>(d)</display>any other attorney authorized to commence an action on behalf of the state.</subsection></subsection><subsection ssid="15-null-196" dnum="67-o:68-i" numlevel="1" lineno="396" slineno="3-285" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1238" style="2" owner="o" level="1" deltag="both">(67)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1239" style="1" owner="i" level="1" amendtag="both" space="true">(68)</amend></display>"Protective custody" means the shelter of a child by the Division of Child and <ln numlevel="1" lineno="397" slineno="3-286"/>Family Services from the time the child is removed from the home until the earlier of:<subsection ssid="15-null-197" dnum="a-o" numlevel="1" lineno="398" slineno="3-287" level="2"><display>(a)</display>the day on which the shelter hearing is held under Section <xref depth="3" refnumber="80-3-301">80-3-301</xref>; or</subsection><subsection ssid="15-null-198" dnum="b-o" numlevel="1" lineno="399" slineno="3-288" level="2"><display>(b)</display>the day on which the child is returned home.</subsection></subsection><subsection ssid="15-null-199" dnum="68-o:69-i" numlevel="1" lineno="400" slineno="3-289" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1241" style="2" owner="o" level="1" deltag="both">(68)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1242" style="1" owner="i" level="1" amendtag="both" space="true">(69)</amend></display>"Protective services" means expedited services that are provided:<subsection ssid="15-null-200" dnum="a-o" numlevel="1" lineno="401" slineno="3-290" level="2"><display>(a)</display>in response to evidence of neglect, abuse, or dependency of a child;</subsection><subsection ssid="15-null-201" dnum="b-o" numlevel="1" lineno="402" slineno="3-291" level="2"><display>(b)</display>to a cohabitant who is neglecting or abusing a child, in order to:<subsection ssid="15-null-202" dnum="i-o" numlevel="1" lineno="403" slineno="3-292" level="3"><display>(i)</display>help the cohabitant develop recognition of the cohabitant's duty of care and of the <ln numlevel="1" lineno="404" slineno="3-293"/>causes of neglect or abuse; and</subsection><subsection ssid="15-null-203" dnum="ii-o" numlevel="1" lineno="405" slineno="3-294" level="3"><display>(ii)</display>strengthen the cohabitant's ability to provide safe and acceptable care; and</subsection></subsection><subsection ssid="15-null-204" dnum="c-o" numlevel="1" lineno="406" slineno="3-295" level="2"><display>(c)</display>in cases where the child's welfare is endangered:<subsection ssid="15-null-205" dnum="i-o" numlevel="1" lineno="407" slineno="3-296" level="3"><display>(i)</display>to bring the situation to the attention of the appropriate juvenile court and law <ln numlevel="1" lineno="408" slineno="3-297"/>enforcement agency;</subsection><subsection ssid="15-null-206" dnum="ii-o" numlevel="1" lineno="409" slineno="3-298" level="3"><display>(ii)</display>to cause a protective order to be issued for the protection of the child, when <ln numlevel="1" lineno="410" slineno="3-299"/>appropriate; and</subsection><subsection ssid="15-null-207" dnum="iii-o" numlevel="1" lineno="411" slineno="3-300" level="3"><display>(iii)</display>to protect the child from the circumstances that endanger the child's welfare <ln numlevel="1" lineno="412" slineno="3-301"/>including, when appropriate:<subsection ssid="15-null-208" dnum="A-o" numlevel="1" lineno="413" slineno="3-302" level="4"><display>(A)</display>removal from the child's home;</subsection><subsection ssid="15-null-209" dnum="B-o" numlevel="1" lineno="414" slineno="3-303" level="4"><display>(B)</display>placement in substitute care; and</subsection><subsection ssid="15-null-210" dnum="C-o" numlevel="1" lineno="415" slineno="3-304" level="4"><display>(C)</display>petitioning the court for termination of parental rights.</subsection></subsection></subsection></subsection><subsection ssid="15-null-211" dnum="69-o:70-i" numlevel="1" lineno="416" slineno="3-305" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1253" style="2" owner="o" level="1" deltag="both">(69)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1254" style="1" owner="i" level="1" amendtag="both" space="true">(70)</amend></display>"Protective supervision" means a legal status created by court order, following an <ln numlevel="1" lineno="417" slineno="3-306"/>adjudication on the ground of abuse, neglect, or dependency, whereby:<subsection ssid="15-null-212" dnum="a-o" numlevel="1" lineno="418" slineno="3-307" level="2"><display>(a)</display>the minor is permitted to remain in the minor's home; and</subsection><subsection ssid="15-null-213" dnum="b-o" numlevel="1" lineno="419" slineno="3-308" level="2"><display>(b)</display>supervision and assistance to correct the abuse, neglect, or dependency is provided <ln numlevel="1" lineno="420" slineno="3-309"/>by an agency designated by the juvenile court.</subsection></subsection><subsection ssid="15-null-214" dnum="70-o:71-i" numlevel="1" lineno="421" slineno="3-310" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1256" style="2" owner="o" level="1" deltag="both">(70)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1257" style="1" owner="i" level="1" amendtag="both" space="true">(71)</amend></display><subsection ssid="15-null-215" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Related condition" means a condition that:<subsection ssid="15-null-216" dnum="i-o" numlevel="1" lineno="422" slineno="3-311" level="3" tab="1"><display>(i)</display>is found to be closely related to intellectual disability;</subsection><subsection ssid="15-null-217" dnum="ii-o" numlevel="1" lineno="423" slineno="3-312" level="3" tab="1"><display>(ii)</display>results in impairment of general intellectual functioning or adaptive behavior <ln numlevel="1" lineno="424" slineno="3-313"/>similar to that of an intellectually disabled individual;</subsection><subsection ssid="15-null-218" dnum="iii-o" numlevel="1" lineno="425" slineno="3-314" level="3" tab="1"><display>(iii)</display>is likely to continue indefinitely; and</subsection><subsection ssid="15-null-219" dnum="iv-o" numlevel="1" lineno="426" slineno="3-315" level="3" tab="1"><display>(iv)</display>constitutes a substantial limitation to the individual's ability to function in society.</subsection></subsection><subsection ssid="15-null-220" dnum="b-o" numlevel="1" lineno="427" slineno="3-316" level="2"><display>(b)</display>"Related condition" does not include mental illness, psychiatric impairment, or <ln numlevel="1" lineno="428" slineno="3-317"/>serious emotional or behavioral disturbance.</subsection></subsection><subsection ssid="15-null-221" dnum="71-o:72-i" numlevel="1" lineno="429" slineno="3-318" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1263" style="2" owner="o" level="1" deltag="both">(71)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1264" style="1" owner="i" level="1" amendtag="both" space="true">(72)</amend></display><subsection ssid="15-null-222" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Residual parental rights and duties" means the rights and duties remaining <ln numlevel="1" lineno="430" slineno="3-319"/>with a parent after legal custody or guardianship, or both, have been vested in another <ln numlevel="1" lineno="431" slineno="3-320"/>person or agency, including:<subsection ssid="15-null-223" dnum="i-o" numlevel="1" lineno="432" slineno="3-321" level="3" tab="1"><display>(i)</display>the responsibility for support;</subsection><subsection ssid="15-null-224" dnum="ii-o" numlevel="1" lineno="433" slineno="3-322" level="3" tab="1"><display>(ii)</display>the right to consent to adoption;</subsection><subsection ssid="15-null-225" dnum="iii-o" numlevel="1" lineno="434" slineno="3-323" level="3" tab="1"><display>(iii)</display>the right to determine the child's religious affiliation; and</subsection><subsection ssid="15-null-226" dnum="iv-o" numlevel="1" lineno="435" slineno="3-324" level="3" tab="1"><display>(iv)</display>the right to reasonable parent-time unless restricted by the court.</subsection></subsection><subsection ssid="15-null-227" dnum="b-o" numlevel="1" lineno="436" slineno="3-325" level="2"><display>(b)</display>If no guardian has been appointed, "residual parental rights and duties" includes the <ln numlevel="1" lineno="437" slineno="3-326"/>right to consent to:<subsection ssid="15-null-228" dnum="i-o" numlevel="1" lineno="438" slineno="3-327" level="3"><display>(i)</display>marriage;</subsection><subsection ssid="15-null-229" dnum="ii-o" numlevel="1" lineno="439" slineno="3-328" level="3"><display>(ii)</display>enlistment; and</subsection><subsection ssid="15-null-230" dnum="iii-o" numlevel="1" lineno="440" slineno="3-329" level="3"><display>(iii)</display>major medical, surgical, or psychiatric treatment.</subsection></subsection></subsection><subsection ssid="15-null-231" dnum="72-o:73-i" numlevel="1" lineno="441" slineno="3-330" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1273" style="2" owner="o" level="1" deltag="both">(72)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1274" style="1" owner="i" level="1" amendtag="both" space="true">(73)</amend></display>"Runaway" means a child, other than an emancipated child, who willfully leaves <ln numlevel="1" lineno="442" slineno="3-331"/>the home of the child's parent or guardian, or the lawfully prescribed residence of the <ln numlevel="1" lineno="443" slineno="3-332"/>child, without permission.</subsection><subsection ssid="15-null-232" dnum="73-o:74-i" numlevel="1" lineno="444" slineno="3-333" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1274" style="2" owner="o" level="1" deltag="both">(73)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1275" style="1" owner="i" level="1" amendtag="both" space="true">(74)</amend></display>"Secure care" means placement of a minor, who is committed to the Division of <ln numlevel="1" lineno="445" slineno="3-334"/>Juvenile Justice and Youth Services for rehabilitation, in a facility operated by, or under <ln numlevel="1" lineno="446" slineno="3-335"/>contract with, the Division of Juvenile Justice and Youth Services, that provides 24-hour <ln numlevel="1" lineno="447" slineno="3-336"/>supervision and confinement of the minor.</subsection><subsection ssid="15-null-233" dnum="74-o:75-i" numlevel="1" lineno="448" slineno="3-337" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1275" style="2" owner="o" level="1" deltag="both">(74)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1276" style="1" owner="i" level="1" amendtag="both" space="true">(75)</amend></display>"Secure care facility" means a facility, established in accordance with Section <xref depth="3" refnumber="80-5-503"><ln numlevel="1" lineno="449" slineno="3-338"/>80-5-503</xref>, for juvenile offenders in secure care.</subsection><subsection ssid="15-null-234" dnum="75-o:76-i" numlevel="1" lineno="450" slineno="3-339" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1276" style="2" owner="o" level="1" deltag="both">(75)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1277" style="1" owner="i" level="1" amendtag="both" space="true">(76)</amend></display>"Secure detention" means temporary care of a minor who requires secure custody <ln numlevel="1" lineno="451" slineno="3-340"/>in a physically restricting facility operated by, or under contract with, the Division of <ln numlevel="1" lineno="452" slineno="3-341"/>Juvenile Justice and Youth Services:<subsection ssid="15-null-235" dnum="a-o" numlevel="1" lineno="453" slineno="3-342" level="2"><display>(a)</display>before disposition of an offense that is alleged to have been committed by the minor; <ln numlevel="1" lineno="454" slineno="3-343"/>or</subsection><subsection ssid="15-null-236" dnum="b-o" numlevel="1" lineno="455" slineno="3-344" level="2"><display>(b)</display>under Section <xref depth="3" refnumber="80-6-704">80-6-704</xref>.</subsection></subsection><subsection ssid="15-null-237" dnum="76-o:77-i" numlevel="1" lineno="456" slineno="3-345" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1279" style="2" owner="o" level="1" deltag="both">(76)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1280" style="1" owner="i" level="1" amendtag="both" space="true">(77)</amend></display>"Serious youth offender" means an individual who:<subsection ssid="15-null-238" dnum="a-o" numlevel="1" lineno="457" slineno="3-346" level="2"><display>(a)</display>is at least 14 years old, but under 25 years old;</subsection><subsection ssid="15-null-239" dnum="b-o" numlevel="1" lineno="458" slineno="3-347" level="2"><display>(b)</display>committed a felony listed in Subsection <xref depth="4" refnumber="80-6-503(1)">80-6-503(1)</xref> and the continuing jurisdiction <ln numlevel="1" lineno="459" slineno="3-348"/>of the juvenile court was extended over the individual's case until the individual was <ln numlevel="1" lineno="460" slineno="3-349"/>25 years old in accordance with Section <xref depth="3" refnumber="80-6-605">80-6-605</xref>; and</subsection><subsection ssid="15-null-240" dnum="c-o" numlevel="1" lineno="461" slineno="3-350" level="2"><display>(c)</display>is committed by the juvenile court to the Division of Juvenile Justice and Youth <ln numlevel="1" lineno="462" slineno="3-351"/>Services for secure care under Sections <xref depth="3" refnumber="80-6-703">80-6-703</xref> and <xref depth="3" refnumber="80-6-705">80-6-705</xref>.</subsection></subsection><subsection ssid="15-null-241" dnum="77-o:78-i" numlevel="1" lineno="463" slineno="3-352" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1283" style="2" owner="o" level="1" deltag="both">(77)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1284" style="1" owner="i" level="1" amendtag="both" space="true">(78)</amend></display>"Severe abuse" means abuse that causes or threatens to cause serious harm to a <ln numlevel="1" lineno="464" slineno="3-353"/>child.</subsection><subsection ssid="15-null-242" dnum="78-o:79-i" numlevel="1" lineno="465" slineno="3-354" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1284" style="2" owner="o" level="1" deltag="both">(78)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1285" style="1" owner="i" level="1" amendtag="both" space="true">(79)</amend></display>"Severe neglect" means neglect that causes or threatens to cause serious harm to <ln numlevel="1" lineno="466" slineno="3-355"/>a child.</subsection><subsection ssid="15-null-243" dnum="79-o:80-i" numlevel="1" lineno="467" slineno="3-356" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1285" style="2" owner="o" level="1" deltag="both">(79)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1286" style="1" owner="i" level="1" amendtag="both" space="true">(80)</amend></display><subsection ssid="15-null-244" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Severe type of child abuse or neglect" means, except as provided in <ln numlevel="1" lineno="468" slineno="3-357"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="80-1-102(79)(b)">(79)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(80)(b)</amend>:<subsection ssid="15-null-245" dnum="i-o" numlevel="1" lineno="469" slineno="3-358" level="3" tab="1"><display>(i)</display>if committed by an individual who is 18 years old or older:<subsection ssid="15-null-246" dnum="A-o" numlevel="1" lineno="470" slineno="3-359" level="4"><display>(A)</display>chronic abuse;</subsection><subsection ssid="15-null-247" dnum="B-o" numlevel="1" lineno="471" slineno="3-360" level="4"><display>(B)</display>severe abuse;</subsection><subsection ssid="15-null-248" dnum="C-o" numlevel="1" lineno="472" slineno="3-361" level="4"><display>(C)</display>sexual abuse;</subsection><subsection ssid="15-null-249" dnum="D-o" numlevel="1" lineno="473" slineno="3-362" level="4"><display>(D)</display>sexual exploitation;</subsection><subsection ssid="15-null-250" dnum="E-o" numlevel="1" lineno="474" slineno="3-363" level="4"><display>(E)</display>abandonment;</subsection><subsection ssid="15-null-251" dnum="F-o" numlevel="1" lineno="475" slineno="3-364" level="4"><display>(F)</display>chronic neglect; or</subsection><subsection ssid="15-null-252" dnum="G-o" numlevel="1" lineno="476" slineno="3-365" level="4"><display>(G)</display>severe neglect; or</subsection></subsection><subsection ssid="15-null-253" dnum="ii-o" numlevel="1" lineno="477" slineno="3-366" level="3" tab="1"><display>(ii)</display>if committed by an individual who is under 18 years old:<subsection ssid="15-null-254" dnum="A-o" numlevel="1" lineno="478" slineno="3-367" level="4"><display>(A)</display>causing serious injury, as defined in Subsection <xref depth="4" refnumber="76-5-109(1)">76-5-109(1)</xref>, to another child <ln numlevel="1" lineno="479" slineno="3-368"/>that indicates a significant risk to other children; or</subsection><subsection ssid="15-null-255" dnum="B-o" numlevel="1" lineno="480" slineno="3-369" level="4"><display>(B)</display>sexual behavior with or upon another child that indicates a significant risk to <ln numlevel="1" lineno="481" slineno="3-370"/>other children.</subsection></subsection></subsection><subsection ssid="15-null-256" dnum="b-o" numlevel="1" lineno="482" slineno="3-371" level="2"><display>(b)</display>"Severe type of child abuse or neglect" does not include:<subsection ssid="15-null-257" dnum="i-o" numlevel="1" lineno="483" slineno="3-372" level="3"><display>(i)</display>the use of reasonable and necessary physical restraint by an educator in <ln numlevel="1" lineno="484" slineno="3-373"/>accordance with Section <xref depth="3" refnumber="53G-8-301">53G-8-301</xref> or Section <xref depth="3" refnumber="76-2-401">76-2-401</xref>;</subsection><subsection ssid="15-null-258" dnum="ii-o" numlevel="1" lineno="485" slineno="3-374" level="3"><display>(ii)</display>an individual's conduct that is justified under Section <xref depth="3" refnumber="76-2-401">76-2-401</xref> or constitutes the <ln numlevel="1" lineno="486" slineno="3-375"/>use of reasonable and necessary physical restraint or force in self-defense or <ln numlevel="1" lineno="487" slineno="3-376"/>otherwise appropriate to the circumstances to obtain possession of a weapon or <ln numlevel="1" lineno="488" slineno="3-377"/>other dangerous object in the possession or under the control of a child or to <ln numlevel="1" lineno="489" slineno="3-378"/>protect the child or another individual from physical injury; or</subsection><subsection ssid="15-null-259" dnum="iii-o" numlevel="1" lineno="490" slineno="3-379" level="3"><display>(iii)</display>a health care decision made for a child by a child's parent or guardian, unless, <ln numlevel="1" lineno="491" slineno="3-380"/>subject to Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="80-1-102(79)(c)">(79)(c)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(80)(c)</amend>, the state or other party to the proceeding <ln numlevel="1" lineno="492" slineno="3-381"/>shows, by clear and convincing evidence, that the health care decision is not <ln numlevel="1" lineno="493" slineno="3-382"/>reasonable and informed.</subsection></subsection><subsection ssid="15-null-260" dnum="c-o" numlevel="1" lineno="494" slineno="3-383" level="2"><display>(c)</display>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="80-1-102(79)(b)(iii)">(79)(b)(iii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(80)(b)(iii)</amend> does not prohibit a parent or guardian from <ln numlevel="1" lineno="495" slineno="3-384"/>exercising the right to obtain a second health care opinion.</subsection></subsection><subsection ssid="15-null-261" dnum="80-o:81-i" numlevel="1" lineno="496" slineno="3-385" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1303" style="2" owner="o" level="1" deltag="both">(80)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1304" style="1" owner="i" level="1" amendtag="both" space="true">(81)</amend></display><subsection ssid="15-null-262" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Sexual abuse" means:<subsection ssid="15-null-263" dnum="i-o" numlevel="1" lineno="497" slineno="3-386" level="3" tab="1"><display>(i)</display>an act or attempted act of sexual intercourse, sodomy, incest, or molestation by an <ln numlevel="1" lineno="498" slineno="3-387"/>adult directed towards a child;</subsection><subsection ssid="15-null-264" dnum="ii-o" numlevel="1" lineno="499" slineno="3-388" level="3" tab="1"><display>(ii)</display>an act or attempted act of sexual intercourse, sodomy, incest, or molestation <ln numlevel="1" lineno="500" slineno="3-389"/>committed by a child towards another child if:<subsection ssid="15-null-265" dnum="A-o" numlevel="1" lineno="501" slineno="3-390" level="4"><display>(A)</display>there is an indication of force or coercion;</subsection><subsection ssid="15-null-266" dnum="B-o" numlevel="1" lineno="502" slineno="3-391" level="4"><display>(B)</display>the children are related, as described in Subsection <xref depth="4" refnumber="80-1-102(40)">(40)</xref>, including siblings by <ln numlevel="1" lineno="503" slineno="3-392"/>marriage while the marriage exists or by adoption; or</subsection><subsection ssid="15-null-267" dnum="C-o" numlevel="1" lineno="504" slineno="3-393" level="4"><display>(C)</display>the act or attempted act constitutes unlawful sexual activity as described in <ln numlevel="1" lineno="505" slineno="3-394"/>Section <xref depth="3" refnumber="76-5-401.3">76-5-401.3</xref>.</subsection></subsection><subsection ssid="15-null-268" dnum="iii-o" numlevel="1" lineno="506" slineno="3-395" level="3" tab="1"><display>(iii)</display>engaging in any conduct with a child that would constitute an offense under any <ln numlevel="1" lineno="507" slineno="3-396"/>of the following, regardless of whether the individual who engages in the conduct <ln numlevel="1" lineno="508" slineno="3-397"/>is actually charged with, or convicted of, the offense:<subsection ssid="15-null-269" dnum="A-o" numlevel="1" lineno="509" slineno="3-398" level="4"><display>(A)</display>Title 76, Chapter 5, Part 4, Sexual Offenses;</subsection><subsection ssid="15-null-270" dnum="B-o" numlevel="1" lineno="510" slineno="3-399" level="4"><display>(B)</display>child bigamy, Section <xref depth="3" refnumber="76-7-101.5">76-7-101.5</xref>;</subsection><subsection ssid="15-null-271" dnum="C-o" numlevel="1" lineno="511" slineno="3-400" level="4"><display>(C)</display>incest, Section <xref depth="3" refnumber="76-7-102">76-7-102</xref>;</subsection><subsection ssid="15-null-272" dnum="D-o" numlevel="1" lineno="512" slineno="3-401" level="4"><display>(D)</display>voyeurism, Section <xref refnumber="76-12-306" depth="4">76-12-306</xref>;</subsection><subsection ssid="15-null-273" dnum="E-o" numlevel="1" lineno="513" slineno="3-402" level="4"><display>(E)</display>recorded or photographed voyeurism, Section <xref refnumber="76-12-307" depth="4">76-12-307</xref>; or</subsection><subsection ssid="15-null-274" dnum="F-o" numlevel="1" lineno="514" slineno="3-403" level="4"><display>(F)</display>distribution of images obtained through voyeurism, Section <xref refnumber="76-12-308" depth="4">76-12-308</xref>; or</subsection></subsection><subsection ssid="15-null-275" dnum="iv-o" numlevel="1" lineno="515" slineno="3-404" level="3" tab="1"><display>(iv)</display>subjecting a child to participate in or threatening to subject a child to participate <ln numlevel="1" lineno="516" slineno="3-405"/>in a sexual relationship, regardless of whether that sexual relationship is part of a <ln numlevel="1" lineno="517" slineno="3-406"/>legal or cultural marriage.</subsection></subsection><subsection ssid="15-null-276" dnum="b-o" numlevel="1" lineno="518" slineno="3-407" level="2"><display>(b)</display>"Sexual abuse" does not include engaging in any conduct with a child that would <ln numlevel="1" lineno="519" slineno="3-408"/>constitute an offense described in:<subsection ssid="15-null-277" dnum="i-o" numlevel="1" lineno="520" slineno="3-409" level="3"><display>(i)</display>Section <xref depth="3" refnumber="76-5-401">76-5-401</xref>, unlawful sexual activity with a minor, if the alleged perpetrator <ln numlevel="1" lineno="521" slineno="3-410"/>of the offense is a minor; or</subsection><subsection ssid="15-null-278" dnum="ii-o" numlevel="1" lineno="522" slineno="3-411" level="3"><display>(ii)</display>Section <xref depth="3" refnumber="76-5-417">76-5-417</xref>, enticing a minor.</subsection></subsection></subsection><subsection ssid="15-null-279" dnum="81-o:82-i" numlevel="1" lineno="523" slineno="3-412" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1321" style="2" owner="o" level="1" deltag="both">(81)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1322" style="1" owner="i" level="1" amendtag="both" space="true">(82)</amend></display>"Sexual exploitation" means knowingly:<subsection ssid="15-null-280" dnum="a-o" numlevel="1" lineno="524" slineno="3-413" level="2"><display>(a)</display>employing, using, persuading, inducing, enticing, or coercing any child to:<subsection ssid="15-null-281" dnum="i-o" numlevel="1" lineno="525" slineno="3-414" level="3"><display>(i)</display>pose in the nude for the purpose of sexual arousal of any individual; or</subsection><subsection ssid="15-null-282" dnum="ii-o" numlevel="1" lineno="526" slineno="3-415" level="3"><display>(ii)</display>engage in any sexual or simulated sexual conduct for the purpose of <ln numlevel="1" lineno="527" slineno="3-416"/>photographing, filming, recording, or displaying in any way the sexual or <ln numlevel="1" lineno="528" slineno="3-417"/>simulated sexual conduct;</subsection></subsection><subsection ssid="15-null-283" dnum="b-o" numlevel="1" lineno="529" slineno="3-418" level="2"><display>(b)</display>displaying, distributing, possessing for the purpose of distribution, or selling material <ln numlevel="1" lineno="530" slineno="3-419"/>depicting a child:<subsection ssid="15-null-284" dnum="i-o" numlevel="1" lineno="531" slineno="3-420" level="3"><display>(i)</display>in the nude, for the purpose of sexual arousal of any individual; or</subsection><subsection ssid="15-null-285" dnum="ii-o" numlevel="1" lineno="532" slineno="3-421" level="3"><display>(ii)</display>engaging in sexual or simulated sexual conduct; or</subsection></subsection><subsection ssid="15-null-286" dnum="c-o" numlevel="1" lineno="533" slineno="3-422" level="2"><display>(c)</display>engaging in any conduct that would constitute an offense under Section <xref depth="3" refnumber="76-5b-201">76-5b-201</xref>, <ln numlevel="1" lineno="534" slineno="3-423"/>sexual exploitation of a minor, or Section <xref depth="3" refnumber="76-5b-201.1">76-5b-201.1</xref>, aggravated sexual <ln numlevel="1" lineno="535" slineno="3-424"/>exploitation of a minor, regardless of whether the individual who engages in the <ln numlevel="1" lineno="536" slineno="3-425"/>conduct is actually charged with, or convicted of, the offense.</subsection></subsection><subsection ssid="15-null-287" dnum="82-o:83-i" numlevel="1" lineno="537" slineno="3-426" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1329" style="2" owner="o" level="1" deltag="both">(82)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1330" style="1" owner="i" level="1" amendtag="both" space="true">(83)</amend></display>"Shelter" means the temporary care of a child in a physically unrestricted facility <ln numlevel="1" lineno="538" slineno="3-427"/>pending a disposition or transfer to another jurisdiction.</subsection><subsection ssid="15-null-288" dnum="83-o:84-i" numlevel="1" lineno="539" slineno="3-428" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1330" style="2" owner="o" level="1" deltag="both">(83)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1331" style="1" owner="i" level="1" amendtag="both" space="true">(84)</amend></display>"Shelter facility" means a nonsecure facility that provides shelter for a minor.</subsection><subsection ssid="15-null-289" dnum="84-o:85-i" numlevel="1" lineno="540" slineno="3-429" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1331" style="2" owner="o" level="1" deltag="both">(84)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1332" style="1" owner="i" level="1" amendtag="both" space="true">(85)</amend></display>"Significant risk" means a risk of harm that is determined to be significant in <ln numlevel="1" lineno="541" slineno="3-430"/>accordance with risk assessment tools and rules established by the Division of Child and <ln numlevel="1" lineno="542" slineno="3-431"/>Family Services in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="543" slineno="3-432"/>Rulemaking Act, that focus on:<subsection ssid="15-null-290" dnum="a-o" numlevel="1" lineno="544" slineno="3-433" level="2"><display>(a)</display>age;</subsection><subsection ssid="15-null-291" dnum="b-o" numlevel="1" lineno="545" slineno="3-434" level="2"><display>(b)</display>social factors;</subsection><subsection ssid="15-null-292" dnum="c-o" numlevel="1" lineno="546" slineno="3-435" level="2"><display>(c)</display>emotional factors;</subsection><subsection ssid="15-null-293" dnum="d-o" numlevel="1" lineno="547" slineno="3-436" level="2"><display>(d)</display>sexual factors;</subsection><subsection ssid="15-null-294" dnum="e-o" numlevel="1" lineno="548" slineno="3-437" level="2"><display>(e)</display>intellectual factors;</subsection><subsection ssid="15-null-295" dnum="f-o" numlevel="1" lineno="549" slineno="3-438" level="2"><display>(f)</display>family risk factors; and</subsection><subsection ssid="15-null-296" dnum="g-o" numlevel="1" lineno="550" slineno="3-439" level="2"><display>(g)</display>other related considerations.</subsection></subsection><subsection ssid="15-null-297" dnum="85-o:86-i" numlevel="1" lineno="551" slineno="3-440" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1339" style="2" owner="o" level="1" deltag="both">(85)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1340" style="1" owner="i" level="1" amendtag="both" space="true">(86)</amend></display>"Single criminal episode" means the same as that term is defined in Section <xref depth="3" refnumber="76-1-401"><ln numlevel="1" lineno="552" slineno="3-441"/>76-1-401</xref>.</subsection><subsection ssid="15-null-298" dnum="86-o:87-i" numlevel="1" lineno="553" slineno="3-442" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1340" style="2" owner="o" level="1" deltag="both">(86)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1341" style="1" owner="i" level="1" amendtag="both" space="true">(87)</amend></display>"Status offense" means an offense that would not be an offense but for the age of <ln numlevel="1" lineno="554" slineno="3-443"/>the offender.</subsection><subsection ssid="15-null-299" dnum="87-o:88-i" numlevel="1" lineno="555" slineno="3-444" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1341" style="2" owner="o" level="1" deltag="both">(87)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1342" style="1" owner="i" level="1" amendtag="both" space="true">(88)</amend></display>"Substance abuse" means, except as provided in Section <xref depth="3" refnumber="80-2-603">80-2-603</xref>, the misuse or <ln numlevel="1" lineno="556" slineno="3-445"/>excessive use of alcohol or other drugs or substances.</subsection><subsection ssid="15-null-300" dnum="88-o:89-i" numlevel="1" lineno="557" slineno="3-446" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1342" style="2" owner="o" level="1" deltag="both">(88)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1343" style="1" owner="i" level="1" amendtag="both" space="true">(89)</amend></display>"Substantiated" or "substantiation" means a judicial finding based on a <ln numlevel="1" lineno="558" slineno="3-447"/>preponderance of the evidence, and separate consideration of each allegation made or <ln numlevel="1" lineno="559" slineno="3-448"/>identified in the case, that abuse, neglect, or dependency occurred.</subsection><subsection ssid="15-null-301" dnum="89-o:90-i" numlevel="1" lineno="560" slineno="3-449" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1343" style="2" owner="o" level="1" deltag="both">(89)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1344" style="1" owner="i" level="1" amendtag="both" space="true">(90)</amend></display>"Substitute care" means:<subsection ssid="15-null-302" dnum="a-o" numlevel="1" lineno="561" slineno="3-450" level="2"><display>(a)</display>the placement of a minor in a family home, group care facility, or other placement <ln numlevel="1" lineno="562" slineno="3-451"/>outside the minor's own home, either at the request of a parent or other responsible <ln numlevel="1" lineno="563" slineno="3-452"/>relative, or upon court order, when it is determined that continuation of care in the <ln numlevel="1" lineno="564" slineno="3-453"/>minor's own home would be contrary to the minor's welfare;</subsection><subsection ssid="15-null-303" dnum="b-o" numlevel="1" lineno="565" slineno="3-454" level="2"><display>(b)</display>services provided for a minor in the protective custody of the Division of Child and <ln numlevel="1" lineno="566" slineno="3-455"/>Family Services, or a minor in the temporary custody or custody of the Division of <ln numlevel="1" lineno="567" slineno="3-456"/>Child and Family Services, as those terms are defined in Section <xref depth="3" refnumber="80-2-102">80-2-102</xref>; or</subsection><subsection ssid="15-null-304" dnum="c-o" numlevel="1" lineno="568" slineno="3-457" level="2"><display>(c)</display>the licensing and supervision of a substitute care facility.</subsection></subsection><subsection ssid="15-null-305" dnum="90-o:91-i" numlevel="1" lineno="569" slineno="3-458" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1347" style="2" owner="o" level="1" deltag="both">(90)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1348" style="1" owner="i" level="1" amendtag="both" space="true">(91)</amend></display>"Supported" means a finding by the Division of Child and Family Services based <ln numlevel="1" lineno="570" slineno="3-459"/>on the evidence available at the completion of an investigation, and separate <ln numlevel="1" lineno="571" slineno="3-460"/>consideration of each allegation made or identified during the investigation, that there is <ln numlevel="1" lineno="572" slineno="3-461"/>a reasonable basis to conclude that abuse, neglect, or dependency occurred.</subsection><subsection ssid="15-null-306" dnum="91-o:92-i" numlevel="1" lineno="573" slineno="3-462" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1348" style="2" owner="o" level="1" deltag="both">(91)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1349" style="1" owner="i" level="1" amendtag="both" space="true">(92)</amend></display>"Termination of parental rights" means the permanent elimination of all parental <ln numlevel="1" lineno="574" slineno="3-463"/>rights and duties, including residual parental rights and duties, by court order.</subsection><subsection ssid="15-null-307" dnum="92-o:93-i" numlevel="1" lineno="575" slineno="3-464" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1349" style="2" owner="o" level="1" deltag="both">(92)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1350" style="1" owner="i" level="1" amendtag="both" space="true">(93)</amend></display>"Therapist" means:<subsection ssid="15-null-308" dnum="a-o" numlevel="1" lineno="576" slineno="3-465" level="2"><display>(a)</display>an individual employed by a state division or agency for the purpose of conducting <ln numlevel="1" lineno="577" slineno="3-466"/>psychological treatment and counseling of a minor in the division's or agency's <ln numlevel="1" lineno="578" slineno="3-467"/>custody; or</subsection><subsection ssid="15-null-309" dnum="b-o" numlevel="1" lineno="579" slineno="3-468" level="2"><display>(b)</display>any other individual licensed or approved by the state for the purpose of conducting <ln numlevel="1" lineno="580" slineno="3-469"/>psychological treatment and counseling.</subsection></subsection><subsection ssid="15-null-310" dnum="93-o:94-i" numlevel="1" lineno="581" slineno="3-470" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1352" style="2" owner="o" level="1" deltag="both">(93)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1353" style="1" owner="i" level="1" amendtag="both" space="true">(94)</amend></display>"Threatened harm" means actions, inactions, or credible verbal threats, indicating <ln numlevel="1" lineno="582" slineno="3-471"/>that the child is at an unreasonable risk of harm or neglect.</subsection><subsection ssid="15-null-311" dnum="94-o:95-i" numlevel="1" lineno="583" slineno="3-472" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1353" style="2" owner="o" level="1" deltag="both">(94)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1354" style="1" owner="i" level="1" amendtag="both" space="true">(95)</amend></display>"Torture" means:<subsection ssid="15-null-312" dnum="a-o" numlevel="1" lineno="584" slineno="3-473" level="2"><display>(a)</display>the infliction of a serious injury upon a child in an exceptionally cruel or <ln numlevel="1" lineno="585" slineno="3-474"/>exceptionally depraved manner that causes the child to experience extreme physical <ln numlevel="1" lineno="586" slineno="3-475"/>or psychological pain or anguish; or</subsection><subsection ssid="15-null-313" dnum="b-o" numlevel="1" lineno="587" slineno="3-476" level="2"><display>(b)</display>the infliction of a serious injury, or more than one serious injury, upon a child as part <ln numlevel="1" lineno="588" slineno="3-477"/>of a course of conduct or over a prolonged period of time.</subsection></subsection><subsection ssid="15-null-314" dnum="95-o:96-i" numlevel="1" lineno="589" slineno="3-478" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1356" style="2" owner="o" level="1" deltag="both">(95)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1357" style="1" owner="i" level="1" amendtag="both" space="true">(96)</amend></display>"Ungovernable" means a child in conflict with a parent or guardian, and the <ln numlevel="1" lineno="590" slineno="3-479"/>conflict:<subsection ssid="15-null-315" dnum="a-o" numlevel="1" lineno="591" slineno="3-480" level="2"><display>(a)</display>results in behavior that is beyond the control or ability of the child, or the parent or <ln numlevel="1" lineno="592" slineno="3-481"/>guardian, to manage effectively;</subsection><subsection ssid="15-null-316" dnum="b-o" numlevel="1" lineno="593" slineno="3-482" level="2"><display>(b)</display>poses a threat to the safety or well-being of the child, the child's family, or others; child welfare appeals and expedite <ln numlevel="1" lineno="699" slineno="5-52"/>decisions for child welfare appeals.</amend></subsection></subsection></subsection></section></bsec><bsec buid="8" num="80-3-409" type="amend" src="code" uid="C80-3-S409_2026050620260506" sort="80 03 04090020260506" numlevel="1" lineno="700" slineno="6-1" sn="6"><section number="80-3-409" numlevel="1" lineno="701" slineno="6-2" type="amend"><secline lineno="700">Section 6. Section <bold>80-3-409</bold> is amended to read:</secline><catline lineno="701"><bold>80-3-409<parens/>. Permanency hearing -- Final plan -- Petition for termination of <ln numlevel="1" lineno="702" slineno="6-3"/>parental rights filed -- Hearing on termination of parental rights.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="703" slineno="6-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="8-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If reunification services are ordered under Section <xref depth="3" refnumber="80-3-406">80-3-406</xref>, with regard to a <ln numlevel="1" lineno="704" slineno="6-5"/>minor who is in the custody of the division, the juvenile court shall hold a <ln numlevel="1" lineno="705" slineno="6-6"/>permanency hearing no later than 12 months after the day on which the minor is <ln numlevel="1" lineno="706" slineno="6-7"/>initially removed from the minor's home.</subsection><subsection ssid="8-null-3" dnum="b-o" numlevel="1" lineno="707" slineno="6-8" level="2"><display>(b)</display>If reunification services are not ordered at the dispositional hearing, the juvenile <ln numlevel="1" lineno="708" slineno="6-9"/>court shall hold a permanency hearing within 30 days after the day on which the <ln numlevel="1" lineno="709" slineno="6-10"/>dispositional hearing ends.</subsection></subsection><subsection ssid="8-null-4" dnum="2-o" numlevel="1" lineno="710" slineno="6-11" level="1" space="false"><display>(2)</display><subsection ssid="8-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If reunification services are ordered in accordance with Section <xref depth="3" refnumber="80-3-406">80-3-406</xref>, the <ln numlevel="1" lineno="711" slineno="6-12"/>juvenile court shall, at the permanency hearing, determine, consistent with <ln numlevel="1" lineno="712" slineno="6-13"/>Subsection <xref depth="4" refnumber="80-3-409(3)">(3)</xref>, whether the minor may safely be returned to the custody of the <ln numlevel="1" lineno="713" slineno="6-14"/>minor's parent.</subsection><subsection ssid="8-null-6" dnum="b-o" numlevel="1" lineno="714" slineno="6-15" level="2"><display>(b)</display>If the juvenile court finds, by a preponderance of the evidence, that return of the <ln numlevel="1" lineno="715" slineno="6-16"/>minor to the minor's parent would create a substantial risk of detriment to the minor's <ln numlevel="1" lineno="716" slineno="6-17"/>physical or emotional well-being, the minor may not be returned to the custody of the <ln numlevel="1" lineno="717" slineno="6-18"/>minor's parent.</subsection><subsection ssid="8-null-7" dnum="c-o" numlevel="1" lineno="718" slineno="6-19" level="2"><display>(c)</display>Prima facie evidence that return of the minor to a parent or guardian would create a <ln numlevel="1" lineno="719" slineno="6-20"/>substantial risk of detriment to the minor is established if:<subsection ssid="8-null-8" dnum="i-o" numlevel="1" lineno="720" slineno="6-21" level="3"><display>(i)</display>the parent or guardian fails to:<subsection ssid="8-null-9" dnum="A-o" numlevel="1" lineno="721" slineno="6-22" level="4"><display>(A)</display>participate in a court approved child and family plan;</subsection><subsection ssid="8-null-10" dnum="B-o" numlevel="1" lineno="722" slineno="6-23" level="4"><display>(B)</display>comply with a court approved child and family plan in whole or in part; or</subsection><subsection ssid="8-null-11" dnum="C-o" numlevel="1" lineno="723" slineno="6-24" level="4"><display>(C)</display>meet the goals of a court approved child and family plan; or</subsection></subsection><subsection ssid="8-null-12" dnum="ii-o" numlevel="1" lineno="724" slineno="6-25" level="3"><display>(ii)</display>the minor's parent:<subsection ssid="8-null-13" dnum="A-o" numlevel="1" lineno="725" slineno="6-26" level="4"><display>(A)</display>intentionally, knowingly, or recklessly causes the death of another parent of <ln numlevel="1" lineno="726" slineno="6-27"/>the minor;</subsection><subsection ssid="8-null-14" dnum="B-o" numlevel="1" lineno="727" slineno="6-28" level="4"><display>(B)</display>is identified by a law enforcement agency as the primary suspect in an <ln numlevel="1" lineno="728" slineno="6-29"/>investigation for intentionally, knowingly, or recklessly causing the death of <ln numlevel="1" lineno="729" slineno="6-30"/>another parent of the minor; or</subsection><subsection ssid="8-null-15" dnum="C-o" numlevel="1" lineno="730" slineno="6-31" level="4"><display>(C)</display>is being prosecuted for or has been convicted of intentionally, knowingly, or <ln numlevel="1" lineno="731" slineno="6-32"/>recklessly causing the death of another parent of the minor.</subsection></subsection></subsection></subsection><subsection ssid="8-null-16" dnum="3-o" numlevel="1" lineno="732" slineno="6-33" level="1"><display>(3)</display>In making a determination under Subsection <xref depth="4" refnumber="80-3-409(2)(a)">(2)(a)</xref>, the juvenile court shall:<subsection ssid="8-null-17" dnum="a-o" numlevel="1" lineno="733" slineno="6-34" level="2"><display>(a)</display>review and consider:<subsection ssid="8-null-18" dnum="i-o" numlevel="1" lineno="734" slineno="6-35" level="3"><display>(i)</display>the report prepared by the division;</subsection><subsection ssid="8-null-19" dnum="ii-o" numlevel="1" lineno="735" slineno="6-36" level="3"><display>(ii)</display>in accordance with the Utah Rules of Evidence, any admissible evidence offered <ln numlevel="1" lineno="736" slineno="6-37"/>by the minor's attorney guardian ad litem;</subsection><subsection ssid="8-null-20" dnum="iii-o" numlevel="1" lineno="737" slineno="6-38" level="3"><display>(iii)</display>any report submitted by the division under Subsection <xref depth="4" refnumber="80-3-408(3)(a)(i)">80-3-408(3)(a)(i)</xref>;</subsection><subsection ssid="8-null-21" dnum="iv-o" numlevel="1" lineno="738" slineno="6-39" level="3"><display>(iv)</display>any evidence regarding the efforts or progress demonstrated by the parent; and</subsection><subsection ssid="8-null-22" dnum="v-o" numlevel="1" lineno="739" slineno="6-40" level="3"><display>(v)</display>the extent to which the parent cooperated and used the services provided; and</subsection></subsection><subsection ssid="8-null-23" dnum="b-o" numlevel="1" lineno="740" slineno="6-41" level="2"><display>(b)</display>attempt to keep the minor's sibling group together if keeping the sibling group <ln numlevel="1" lineno="741" slineno="6-42"/>together is:<subsection ssid="8-null-24" dnum="i-o" numlevel="1" lineno="742" slineno="6-43" level="3"><display>(i)</display>practicable; and</subsection><subsection ssid="8-null-25" dnum="ii-o" numlevel="1" lineno="743" slineno="6-44" level="3"><display>(ii)</display>in accordance with the best interest of the minor.</subsection></subsection></subsection><subsection ssid="8-null-26" dnum="4-o" numlevel="1" lineno="744" slineno="6-45" level="1"><display>(4)</display>With regard to a case where reunification services are ordered by the juvenile court, if a <ln numlevel="1" lineno="745" slineno="6-46"/>minor is not returned to the minor's parent or guardian at the permanency hearing, the <ln numlevel="1" lineno="746" slineno="6-47"/>juvenile court shall, unless the time for the provision of reunification services is <ln numlevel="1" lineno="747" slineno="6-48"/>extended under Subsection <xref depth="4" refnumber="80-3-409(7)">(7)</xref>:<subsection ssid="8-null-27" dnum="a-o" numlevel="1" lineno="748" slineno="6-49" level="2"><display>(a)</display>order termination of reunification services to the parent;</subsection><subsection ssid="8-null-28" dnum="b-o" numlevel="1" lineno="749" slineno="6-50" level="2"><display>(b)</display>make a final determination regarding whether termination of parental rights, <ln numlevel="1" lineno="750" slineno="6-51"/>adoption, or permanent custody and guardianship is the most appropriate final plan <ln numlevel="1" lineno="751" slineno="6-52"/>for the minor, taking into account the minor's primary permanency plan established <ln numlevel="1" lineno="752" slineno="6-53"/>by the juvenile court under Section <xref depth="3" refnumber="80-3-406">80-3-406</xref>; and</subsection><subsection ssid="8-null-29" dnum="c-o" numlevel="1" lineno="753" slineno="6-54" level="2"><display>(c)</display>in accordance with Subsection <xref depth="4" refnumber="80-3-406(2)">80-3-406(2)</xref>, establish a concurrent permanency plan <ln numlevel="1" lineno="754" slineno="6-55"/>that identifies the second most appropriate final plan for the minor, if appropriate.</subsection></subsection><subsection ssid="8-null-30" dnum="5-o" numlevel="1" lineno="755" slineno="6-56" level="1"><display>(5)</display>The juvenile court may order another planned permanent living arrangement other than <ln numlevel="1" lineno="756" slineno="6-57"/>reunification for a minor who is 16 years old or older upon entering the following <ln numlevel="1" lineno="757" slineno="6-58"/>findings:<subsection ssid="8-null-31" dnum="a-o" numlevel="1" lineno="758" slineno="6-59" level="2"><display>(a)</display>the division has documented intensive, ongoing, and unsuccessful efforts to reunify <ln numlevel="1" lineno="759" slineno="6-60"/>the minor with the minor's parent or parents, or to secure a placement for the minor <ln numlevel="1" lineno="760" slineno="6-61"/>with a guardian, an adoptive parent, or an individual described in Subsection <xref depth="4" refnumber="80-3-301(6)(e)"><ln numlevel="1" lineno="761" slineno="6-62"/>80-3-301(6)(e)</xref>;</subsection><subsection ssid="8-null-32" dnum="b-o" numlevel="1" lineno="762" slineno="6-63" level="2"><display>(b)</display>the division has demonstrated that the division has made efforts to normalize the life <ln numlevel="1" lineno="763" slineno="6-64"/>of the minor while in the division's custody, in accordance with Section <xref depth="3" refnumber="80-2-308">80-2-308</xref>;</subsection><subsection ssid="8-null-33" dnum="c-o" numlevel="1" lineno="764" slineno="6-65" level="2"><display>(c)</display>the minor prefers another planned permanent living arrangement; and</subsection><subsection ssid="8-null-34" dnum="d-o" numlevel="1" lineno="765" slineno="6-66" level="2"><display>(d)</display>there is a compelling reason why reunification or a placement described in <ln numlevel="1" lineno="766" slineno="6-67"/>Subsection <xref depth="4" refnumber="80-3-409(5)(a)">(5)(a)</xref> is not in the minor's best interest.</subsection></subsection><subsection ssid="8-null-35" dnum="6-o" numlevel="1" lineno="767" slineno="6-68" level="1"><display>(6)</display>Except as provided in Subsection <xref depth="4" refnumber="80-3-409(7)">(7)</xref>, the juvenile court may not extend reunification <ln numlevel="1" lineno="768" slineno="6-69"/>services beyond 12 months after the day on which the minor is initially removed from <ln numlevel="1" lineno="769" slineno="6-70"/>the minor's home, in accordance with the provisions of Section <xref depth="3" refnumber="80-3-406">80-3-406</xref>.</subsection><subsection ssid="8-null-36" dnum="7-o" numlevel="1" lineno="770" slineno="6-71" level="1" space="false"><display>(7)</display><subsection ssid="8-null-37" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="8-103" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1470" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>Subject to Subsection <xref depth="4" refnumber="80-3-409(7)(b)">(7)(b)</xref>, the juvenile court may extend reunification <ln numlevel="1" lineno="771" slineno="6-72"/>services for no more than 90 days if the juvenile court finds, by a preponderance <ln numlevel="1" lineno="772" slineno="6-73"/>of the evidence, that:<subsection ssid="8-null-38" dnum="i-o:A-i" numlevel="1" lineno="773" slineno="6-74" level="4" tab="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1471" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1472" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>there has been substantial compliance with the child and family plan;</subsection><subsection ssid="8-null-39" dnum="ii-o:B-i" numlevel="1" lineno="774" slineno="6-75" level="4" tab="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1472" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1473" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>reunification is probable within that 90-day period; and</subsection><subsection ssid="8-null-40" dnum="iii-o:C-i" numlevel="1" lineno="775" slineno="6-76" level="4" tab="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1473" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1474" style="1" owner="i" level="1" amendtag="both" space="true">(C)</amend></display>the extension is in the best interest of the minor.</subsection></subsection><subsection ssid="8-104" dnum="_-o:ii-i" numlevel="1" lineno="776" slineno="6-77" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1474" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">The juvenile court shall specify the facts upon which the findings described in <ln numlevel="1" lineno="777" slineno="6-78"/>Subsection <xref depth="4" refnumber="80-3-409(7)(a)(i)">(7)(a)(i)</xref> are based.</amend></subsection></subsection><subsection ssid="8-null-41" dnum="b-o" numlevel="1" lineno="778" slineno="6-79" level="2" space="false"><display>(b)</display><subsection ssid="8-null-42" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="80-3-409(7)(c)">(7)(c)</xref>, the juvenile court may not extend any <ln numlevel="1" lineno="779" slineno="6-80"/>reunification services beyond 15 months after the day on which the minor is <ln numlevel="1" lineno="780" slineno="6-81"/>initially removed from the minor's home.</subsection><subsection ssid="8-null-43" dnum="ii-o" numlevel="1" lineno="781" slineno="6-82" level="3"><display>(ii)</display>Delay or failure of a parent to establish paternity<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both"> or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="42" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">,</amend> seek custody<amend anum="0" ea="amend" pairid="29" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both">, or participate <ln numlevel="1" lineno="782" slineno="6-83"/>in reunification services</amend> does not provide a basis for the juvenile court to extend <ln numlevel="1" lineno="783" slineno="6-84"/>services for the parent beyond the 12-month period described in Subsection <xref depth="4" refnumber="80-3-409(6)">(6)</xref>.</subsection></subsection><subsection ssid="8-null-44" dnum="c-o" numlevel="1" lineno="784" slineno="6-85" level="2"><display>(c)</display>In accordance with Subsection <xref depth="4" refnumber="80-3-409(7)(d)">(7)(d)</xref>, the juvenile court may extend reunification <ln numlevel="1" lineno="785" slineno="6-86"/>services for one additional <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">90</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">60</amend>-day period, beyond the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">90</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">60</amend>-day period <ln numlevel="1" lineno="786" slineno="6-87"/>described in Subsection <xref depth="4" refnumber="80-3-409(7)(a)">(7)(a)</xref>, if:<subsection ssid="8-null-45" dnum="i-o" numlevel="1" lineno="787" slineno="6-88" level="3"><display>(i)</display>the juvenile court finds, by clear and convincing evidence, that:<subsection ssid="8-null-46" dnum="A-o" numlevel="1" lineno="788" slineno="6-89" level="4"><display>(A)</display>the parent has substantially complied with the child and family plan;</subsection><subsection ssid="8-null-47" dnum="B-o" numlevel="1" lineno="789" slineno="6-90" level="4"><display>(B)</display>it is likely that reunification will occur within the additional <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">90</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">60</amend>-day <ln numlevel="1" lineno="790" slineno="6-91"/>period; and</subsection><subsection ssid="8-null-48" dnum="C-o" numlevel="1" lineno="791" slineno="6-92" level="4"><display>(C)</display>the extension is in the best interest of the minor;</subsection></subsection><subsection ssid="8-null-49" dnum="ii-o" numlevel="1" lineno="792" slineno="6-93" level="3"><display>(ii)</display>the juvenile court specifies the facts upon which the findings described in <ln numlevel="1" lineno="793" slineno="6-94"/>Subsection <xref depth="4" refnumber="80-3-409(7)(c)(i)">(7)(c)(i)</xref> are based;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="8-null-50" dnum="iii-o" numlevel="1" lineno="794" slineno="6-95" level="3"><display>(iii)</display>the juvenile court specifies the time period in which it is likely that reunification <ln numlevel="1" lineno="795" slineno="6-96"/>will occur<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="8-101" dnum="_-o:iv-i" numlevel="1" lineno="796" slineno="6-97" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1485" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">the juvenile court finds that a 60-day extension of reunification services will not <ln numlevel="1" lineno="797" slineno="6-98"/>impede the juvenile court's or the parties' ability to comply with the deadlines <ln numlevel="1" lineno="798" slineno="6-99"/>described in Subsection <xref depth="4" refnumber="80-3-409(10)">(10)</xref> or (13)(c), including a trial if necessary.</amend></subsection></subsection><subsection ssid="8-null-51" dnum="d-o" numlevel="1" lineno="799" slineno="6-100" level="2"><display>(d)</display>A juvenile court may not extend the time period for reunification services without <ln numlevel="1" lineno="800" slineno="6-101"/>complying with the requirements of this Subsection <xref depth="4" refnumber="80-3-409(7)">(7)</xref> before the extension.</subsection><subsection ssid="8-null-52" dnum="e-o" numlevel="1" lineno="801" slineno="6-102" level="2"><display>(e)</display>In determining whether to extend reunification services for a minor, a juvenile court <ln numlevel="1" lineno="802" slineno="6-103"/>shall take into consideration the status of the minor siblings of the minor.</subsection></subsection><subsection ssid="8-null-53" dnum="8-o" numlevel="1" lineno="803" slineno="6-104" level="1" space="false"><display>(8)</display><subsection ssid="8-null-54" dnum="a-o" level="2" placement="sameline"><display>(a)</display>At the permanency hearing, if a child remains in an out-of-home placement, the <ln numlevel="1" lineno="804" slineno="6-105"/>juvenile court shall:<subsection ssid="8-null-55" dnum="i-o" numlevel="1" lineno="805" slineno="6-106" level="3" tab="1"><display>(i)</display>make specific findings regarding the conditions of parent-time that are in the <ln numlevel="1" lineno="806" slineno="6-107"/>child's best interest; and</subsection><subsection ssid="8-null-56" dnum="ii-o" numlevel="1" lineno="807" slineno="6-108" level="3" tab="1"><display>(ii)</display>if parent-time is denied, state the facts that justify the denial.</subsection></subsection><subsection ssid="8-null-57" dnum="b-o" numlevel="1" lineno="808" slineno="6-109" level="2"><display>(b)</display>Parent-time shall be under the least restrictive conditions necessary to:<subsection ssid="8-null-58" dnum="i-o" numlevel="1" lineno="809" slineno="6-110" level="3"><display>(i)</display>protect the physical safety of the child; or</subsection><subsection ssid="8-null-59" dnum="ii-o" numlevel="1" lineno="810" slineno="6-111" level="3"><display>(ii)</display>prevent the child from being traumatized by contact with the parent due to the <ln numlevel="1" lineno="811" slineno="6-112"/>child's fear of the parent in light of the nature of the alleged abuse or neglect.</subsection></subsection><subsection ssid="8-null-60" dnum="c-o" numlevel="1" lineno="812" slineno="6-113" level="2" space="false"><display>(c)</display><subsection ssid="8-null-61" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The division or the person designated by the division or a court to supervise a <ln numlevel="1" lineno="813" slineno="6-114"/>parent-time session may deny parent-time for the session if the division or the <ln numlevel="1" lineno="814" slineno="6-115"/>supervising person determines that, based on the parent's condition, it is necessary <ln numlevel="1" lineno="815" slineno="6-116"/>to deny parent-time to:<subsection ssid="8-null-62" dnum="A-o" numlevel="1" lineno="816" slineno="6-117" level="4" tab="1"><display>(A)</display>protect the physical safety of the child;</subsection><subsection ssid="8-null-63" dnum="B-o" numlevel="1" lineno="817" slineno="6-118" level="4" tab="1"><display>(B)</display>protect the life of the child; or</subsection><subsection ssid="8-null-64" dnum="C-o" numlevel="1" lineno="818" slineno="6-119" level="4" tab="1"><display>(C)</display>consistent with Subsection <xref depth="4" refnumber="80-3-409(8)(c)(ii)">(8)(c)(ii)</xref>, prevent the child from being traumatized <ln numlevel="1" lineno="819" slineno="6-120"/>by contact with the parent.</subsection></subsection><subsection ssid="8-null-65" dnum="ii-o" numlevel="1" lineno="820" slineno="6-121" level="3"><display>(ii)</display>In determining whether the condition of the parent described in Subsection <xref depth="4" refnumber="80-3-409(8)(c)(i)"><ln numlevel="1" lineno="821" slineno="6-122"/>(8)(c)(i)</xref> will traumatize a child, the division or the person supervising the <ln numlevel="1" lineno="822" slineno="6-123"/>parent-time session shall consider the impact that the parent's condition will have <ln numlevel="1" lineno="823" slineno="6-124"/>on the child in light of:<subsection ssid="8-null-66" dnum="A-o" numlevel="1" lineno="824" slineno="6-125" level="4"><display>(A)</display>the child's fear of the parent; and</subsection><subsection ssid="8-null-67" dnum="B-o" numlevel="1" lineno="825" slineno="6-126" level="4"><display>(B)</display>the nature of the alleged abuse or neglect.</subsection></subsection></subsection></subsection><subsection ssid="8-null-68" dnum="9-o" numlevel="1" lineno="826" slineno="6-127" level="1"><display>(9)</display>The juvenile court may, in the juvenile court's discretion:<subsection ssid="8-null-69" dnum="a-o" numlevel="1" lineno="827" slineno="6-128" level="2"><display>(a)</display>enter any additional order that the juvenile court determines to be in the best interest <ln numlevel="1" lineno="828" slineno="6-129"/>of the minor, so long as that order does not conflict with the requirements and <ln numlevel="1" lineno="829" slineno="6-130"/>provisions of Subsections <xref depth="4" refnumber="80-3-409(4)">(4)</xref> through <xref depth="4" refnumber="80-3-409(8)">(8)</xref>; or</subsection><subsection ssid="8-null-70" dnum="b-o" numlevel="1" lineno="830" slineno="6-131" level="2"><display>(b)</display>order the division to provide protective supervision or other services to a minor and <ln numlevel="1" lineno="831" slineno="6-132"/>the minor's family after the division's custody of a minor is terminated.</subsection></subsection><subsection ssid="8-null-71" dnum="10-o" numlevel="1" lineno="832" slineno="6-133" level="1" space="false"><display>(10)</display><subsection ssid="8-null-72" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the final plan for the minor is to proceed toward termination of parental rights, <ln numlevel="1" lineno="833" slineno="6-134"/>the petition for termination of parental rights shall be filed, and a pretrial held, within <ln numlevel="1" lineno="834" slineno="6-135"/>45 calendar days after the day on which the permanency hearing is held.</subsection><subsection ssid="8-null-73" dnum="b-o" numlevel="1" lineno="835" slineno="6-136" level="2"><display>(b)</display>If the division opposes the plan to terminate parental rights, the juvenile court may <ln numlevel="1" lineno="836" slineno="6-137"/>not require the division to file a petition for the termination of parental rights, except <ln numlevel="1" lineno="837" slineno="6-138"/>as required under Subsection <xref depth="4" refnumber="80-4-203(2)">80-4-203(2)</xref>.</subsection></subsection><subsection ssid="8-null-74" dnum="11-o" numlevel="1" lineno="838" slineno="6-139" level="1" space="false"><display>(11)</display><subsection ssid="8-null-75" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Any party to an action may, at any time, petition the juvenile court for an <ln numlevel="1" lineno="839" slineno="6-140"/>expedited permanency hearing on the basis that continuation of reunification efforts <ln numlevel="1" lineno="840" slineno="6-141"/>are inconsistent with the permanency needs of the minor.</subsection><subsection ssid="8-null-76" dnum="b-o" numlevel="1" lineno="841" slineno="6-142" level="2"><display>(b)</display>If the juvenile court so determines, the juvenile court shall order, in accordance with <ln numlevel="1" lineno="842" slineno="6-143"/>federal law, that:<subsection ssid="8-null-77" dnum="i-o" numlevel="1" lineno="843" slineno="6-144" level="3"><display>(i)</display>the minor be placed in accordance with the permanency plan; and</subsection><subsection ssid="8-null-78" dnum="ii-o" numlevel="1" lineno="844" slineno="6-145" level="3"><display>(ii)</display>whatever steps are necessary to finalize the permanent placement of the minor be <ln numlevel="1" lineno="845" slineno="6-146"/>completed as quickly as possible.</subsection></subsection></subsection><subsection ssid="8-null-79" dnum="12-o" numlevel="1" lineno="846" slineno="6-147" level="1"><display>(12)</display>Nothing in this section may be construed to:<subsection ssid="8-null-80" dnum="a-o" numlevel="1" lineno="847" slineno="6-148" level="2"><display>(a)</display>entitle any parent to reunification services for any specified period of time;</subsection><subsection ssid="8-null-81" dnum="b-o" numlevel="1" lineno="848" slineno="6-149" level="2"><display>(b)</display>limit a juvenile court's ability to terminate reunification services at any time before a <ln numlevel="1" lineno="849" slineno="6-150"/>permanency hearing; or</subsection><subsection ssid="8-null-82" dnum="c-o" numlevel="1" lineno="850" slineno="6-151" level="2"><display>(c)</display>limit or prohibit the filing of a petition for termination of parental rights by any party, <ln numlevel="1" lineno="851" slineno="6-152"/>or a hearing on termination of parental rights, at any time before a permanency <ln numlevel="1" lineno="852" slineno="6-153"/>hearing provided that relative placement and custody options have been fairly <ln numlevel="1" lineno="853" slineno="6-154"/>considered in accordance with Sections <xref depth="3" refnumber="80-2a-201">80-2a-201</xref> and <xref depth="3" refnumber="80-4-104">80-4-104</xref>.</subsection></subsection><subsection ssid="8-null-83" dnum="13-o" numlevel="1" lineno="854" slineno="6-155" level="1" space="false"><display>(13)</display><subsection ssid="8-null-84" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="80-3-409(13)(b)">(13)(b)</xref>, if a petition for termination of parental rights is <ln numlevel="1" lineno="855" slineno="6-156"/>filed before the date scheduled for a permanency hearing, the juvenile court may <ln numlevel="1" lineno="856" slineno="6-157"/>consolidate the hearing on termination of parental rights with the permanency hearing.</subsection><subsection ssid="8-null-85" dnum="b-o" numlevel="1" lineno="857" slineno="6-158" level="2"><display>(b)</display>For purposes of Subsection <xref depth="4" refnumber="80-3-409(13)(a)">(13)(a)</xref>, if the juvenile court consolidates the hearing on <ln numlevel="1" lineno="858" slineno="6-159"/>termination of parental rights with the permanency hearing:<subsection ssid="8-null-86" dnum="i-o" numlevel="1" lineno="859" slineno="6-160" level="3"><display>(i)</display>the juvenile court shall first make a finding regarding whether reasonable efforts <ln numlevel="1" lineno="860" slineno="6-161"/>have been made by the division to finalize the permanency plan for the minor; and</subsection><subsection ssid="8-null-87" dnum="ii-o" numlevel="1" lineno="861" slineno="6-162" level="3"><display>(ii)</display>any reunification services shall be terminated in accordance with the time lines <ln numlevel="1" lineno="862" slineno="6-163"/>described in Section <xref depth="3" refnumber="80-3-406">80-3-406</xref>.</subsection></subsection><subsection ssid="8-null-88" dnum="c-o" numlevel="1" lineno="863" slineno="6-164" level="2"><display>(c)</display>The juvenile court shall make a decision on a petition for termination of parental <ln numlevel="1" lineno="864" slineno="6-165"/>rights within 18 months after the day on which the minor is initially removed from <ln numlevel="1" lineno="865" slineno="6-166"/>the minor's home.</subsection></subsection><subsection ssid="8-null-89" dnum="14-o" numlevel="1" lineno="866" slineno="6-167" level="1" space="false"><display>(14)</display><subsection ssid="8-null-90" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a juvenile court determines that a minor will not be returned to a parent of the <ln numlevel="1" lineno="867" slineno="6-168"/>minor, the juvenile court shall consider appropriate placement options inside and <ln numlevel="1" lineno="868" slineno="6-169"/>outside of the state.</subsection><subsection ssid="8-null-91" dnum="b-o" numlevel="1" lineno="869" slineno="6-170" level="2"><display>(b)</display>In considering appropriate placement options under Subsection <xref depth="4" refnumber="80-3-409(14)(a)">(14)(a)</xref>, the juvenile <ln numlevel="1" lineno="870" slineno="6-171"/>court shall provide preferential consideration to a relative's request for placement of <ln numlevel="1" lineno="871" slineno="6-172"/>the minor.</subsection></subsection><subsection ssid="8-null-92" dnum="15-o" numlevel="1" lineno="872" slineno="6-173" level="1" space="false"><display>(15)</display><subsection ssid="8-null-93" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with Section <xref depth="3" refnumber="80-3-108">80-3-108</xref>, if a minor 14 years old or older desires an <ln numlevel="1" lineno="873" slineno="6-174"/>opportunity to address the juvenile court or testify regarding permanency or <ln numlevel="1" lineno="874" slineno="6-175"/>placement, the juvenile court shall give the minor's wishes added weight, but may not <ln numlevel="1" lineno="875" slineno="6-176"/>treat the minor's wishes as the single controlling factor under this section.</subsection><subsection ssid="8-null-94" dnum="b-o" numlevel="1" lineno="876" slineno="6-177" level="2"><display>(b)</display>If the juvenile court's decision under this section differs from a minor's express <ln numlevel="1" lineno="877" slineno="6-178"/>wishes if the minor is of sufficient maturity to articulate the wishes in relation to <ln numlevel="1" lineno="878" slineno="6-179"/>permanency or the minor's placement, the juvenile court shall make findings <ln numlevel="1" lineno="879" slineno="6-180"/>explaining why the juvenile court's decision differs from the minor's wishes.</subsection></subsection><subsection ssid="8-null-95" dnum="16-o" numlevel="1" lineno="880" slineno="6-181" level="1" space="false"><display>(16)</display><subsection ssid="8-null-96" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If, for a relative placement, an interstate placement requested under the Interstate <ln numlevel="1" lineno="881" slineno="6-182"/>Compact on the Placement of Children has been initiated by the division or is ordered <ln numlevel="1" lineno="882" slineno="6-183"/>by or pending before the juvenile court, the court may not finalize a non-relative <ln numlevel="1" lineno="883" slineno="6-184"/>placement unless the court gives due weight to:<subsection ssid="8-null-97" dnum="i-o" numlevel="1" lineno="884" slineno="6-185" level="3" tab="1"><display>(i)</display>the preferential consideration granted to a relative in Section <xref depth="3" refnumber="80-3-302">80-3-302</xref>;</subsection><subsection ssid="8-null-98" dnum="ii-o" numlevel="1" lineno="885" slineno="6-186" level="3" tab="1"><display>(ii)</display>the rebuttable presumption in Section <xref depth="3" refnumber="80-3-302">80-3-302</xref>; and</subsection><subsection ssid="8-null-99" dnum="iii-o" numlevel="1" lineno="886" slineno="6-187" level="3" tab="1"><display>(iii)</display>the division's placement authority under Subsections <xref depth="4" refnumber="80-1-102(51)">80-1-102(51)</xref> and <xref depth="4" refnumber="80-3-303(1)"><ln numlevel="1" lineno="887" slineno="6-188"/>80-3-303(1)</xref>.</subsection></subsection><subsection ssid="8-null-100" dnum="b-o" numlevel="1" lineno="888" slineno="6-189" level="2"><display>(b)</display>Nothing in this section affects the ability of a foster parent to petition the juvenile <ln numlevel="1" lineno="889" slineno="6-190"/>court under Subsection <xref depth="4" refnumber="80-3-502(3)">80-3-502(3)</xref>.</subsection></subsection></section></bsec><bsec buid="17" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="890" slineno="7-1" sn="7"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="890">Section 7.  <bold>Effective Date.</bold></secline><sectionText lineno="891"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-16-26 3:59 PM</tm></rev></foot></leg>
