Section <bold>17-77-301</bold> is amended to read:</secline><catline lineno="33"><bold>17-77-301<parens/>. Local mental health authorities -- Responsibilities.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="34" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="8-null-2" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="8-null-3" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>In each county other than a county described in Subsection <xref depth="4" refnumber="17-43-301(1)(a)(ii)">(1)(a)(ii)</xref> or (iii), <ln numlevel="1" lineno="35" slineno="1-4"/>the county legislative body is the local mental health authority.</subsection><subsection ssid="8-null-4" dnum="ii-o" numlevel="1" lineno="36" slineno="1-5" level="3" tab="1"><display>(ii)</display>In each county operating under a county executive-council form of government <ln numlevel="1" lineno="37" slineno="1-6"/>under Section <xref depth="3" refnumber="17-62-203">17-62-203</xref>, the county legislative body is the local mental health <ln numlevel="1" lineno="38" slineno="1-7"/>authority, except that the county executive administers any contract for plan <ln numlevel="1" lineno="39" slineno="1-8"/>services.</subsection><subsection ssid="8-null-5" dnum="iii-o" numlevel="1" lineno="40" slineno="1-9" level="3" tab="1"><display>(iii)</display>In each county operating under a council-manager form of government under <ln numlevel="1" lineno="41" slineno="1-10"/>Section <xref depth="3" refnumber="17-62-204">17-62-204</xref>, the county manager is the local mental health authority.</subsection></subsection><subsection ssid="8-null-6" dnum="b-o" numlevel="1" lineno="42" slineno="1-11" level="2"><display>(b)</display>Within legislative appropriations and county matching funds required by this section, <ln numlevel="1" lineno="43" slineno="1-12"/>under the direction of the division, each local mental health authority shall:<subsection ssid="8-null-7" dnum="i-o" numlevel="1" lineno="44" slineno="1-13" level="3"><display>(i)</display>provide mental health services to individuals within the county; and</subsection><subsection ssid="8-null-8" dnum="ii-o" numlevel="1" lineno="45" slineno="1-14" level="3"><display>(ii)</display>cooperate with the division's efforts to promote integrated programs that address <ln numlevel="1" lineno="46" slineno="1-15"/>an individual's substance use, mental health, and physical healthcare needs, as <ln numlevel="1" lineno="47" slineno="1-16"/>described in Section <xref depth="3" refnumber="26B-5-102">26B-5-102</xref>.</subsection></subsection><subsection ssid="8-null-9" dnum="c-o" numlevel="1" lineno="48" slineno="1-17" level="2"><display>(c)</display>Within legislative appropriations and county matching funds required by this section, <ln numlevel="1" lineno="49" slineno="1-18"/>each local mental health authority shall cooperate with the department's efforts to <ln numlevel="1" lineno="50" slineno="1-19"/>promote a system of care, as defined in Section <xref depth="3" refnumber="26B-5-101">26B-5-101</xref>, for minors with or at risk <ln numlevel="1" lineno="51" slineno="1-20"/>for complex emotional and behavioral needs, as described in Section <xref depth="3" refnumber="26B-5-101">26B-5-101</xref>.</subsection></subsection><subsection ssid="8-null-10" dnum="2-o" numlevel="1" lineno="52" slineno="1-21" level="1" space="false"><display>(2)</display><subsection ssid="8-null-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>By executing an interlocal agreement under <xref depth="1" refnumber="11-13">Title 11, Chapter 13</xref>, Interlocal <ln numlevel="1" lineno="53" slineno="1-22"/>Cooperation Act, two or more counties may join to:<subsection ssid="8-null-12" dnum="i-o" numlevel="1" lineno="54" slineno="1-23" level="3" tab="1"><display>(i)</display>provide mental health prevention and treatment services; or</subsection><subsection ssid="8-null-13" dnum="ii-o" numlevel="1" lineno="55" slineno="1-24" level="3" tab="1"><display>(ii)</display>create a united local health department that combines substance use treatment <ln numlevel="1" lineno="56" slineno="1-25"/>services, mental health services, and local health department services in <ln numlevel="1" lineno="57" slineno="1-26"/>accordance with Subsection <xref depth="4" refnumber="17-43-301(3)">(3)</xref>.</subsection></subsection><subsection ssid="8-null-14" dnum="b-o" numlevel="1" lineno="58" slineno="1-27" level="2"><display>(b)</display>The legislative bodies of counties joining to provide services may establish <ln numlevel="1" lineno="59" slineno="1-28"/>acceptable ways of apportioning the cost of mental health services.</subsection><subsection ssid="8-null-15" dnum="c-o" numlevel="1" lineno="60" slineno="1-29" level="2"><display>(c)</display>Each agreement for joint mental health services shall:<subsection ssid="8-null-16" dnum="i-o" numlevel="1" lineno="61" slineno="1-30" level="3" space="false"><display>(i)</display><subsection ssid="8-null-17" dnum="A-o" level="4" placement="sameline"><display>(A)</display>designate the county treasurer of one of the participating counties or another <ln numlevel="1" lineno="62" slineno="1-31"/>individual as the treasurer for the combined mental health authorities and as the <ln numlevel="1" lineno="63" slineno="1-32"/>custodian of money available for the joint services; and</subsection><subsection ssid="8-null-18" dnum="B-o" numlevel="1" lineno="64" slineno="1-33" level="4"><display>(B)</display>provide that the designated county treasurer, or other disbursing officer <ln numlevel="1" lineno="65" slineno="1-34"/>authorized by the designated county treasurer, may make payments from the <ln numlevel="1" lineno="66" slineno="1-35"/>money available for the joint services upon audit of the appropriate county <ln numlevel="1" lineno="67" slineno="1-36"/>auditor representing the participating counties;</subsection></subsection><subsection ssid="8-null-19" dnum="ii-o" numlevel="1" lineno="68" slineno="1-37" level="3"><display>(ii)</display>provide for the appointment of an independent auditor or a county auditor of one <ln numlevel="1" lineno="69" slineno="1-38"/>of the participating counties as the designated auditing officer for the combined <ln numlevel="1" lineno="70" slineno="1-39"/>mental health authorities;</subsection><subsection ssid="8-null-20" dnum="iii-o" numlevel="1" lineno="71" slineno="1-40" level="3" space="false"><display>(iii)</display><subsection ssid="8-null-21" dnum="A-o" level="4" placement="sameline"><display>(A)</display>provide for the appointment of the county attorney or district attorney of <ln numlevel="1" lineno="72" slineno="1-41"/>one of the participating counties as the designated legal officer for the <ln numlevel="1" lineno="73" slineno="1-42"/>combined mental health authorities; and</subsection><subsection ssid="8-null-22" dnum="B-o" numlevel="1" lineno="74" slineno="1-43" level="4"><display>(B)</display>authorize the designated legal officer to request and receive the assistance of <ln numlevel="1" lineno="75" slineno="1-44"/>the county or district attorneys of the other participating counties in defending <ln numlevel="1" lineno="76" slineno="1-45"/>or prosecuting actions within their counties relating to the combined mental <ln numlevel="1" lineno="77" slineno="1-46"/>health authorities; and</subsection></subsection><subsection ssid="8-null-23" dnum="iv-o" numlevel="1" lineno="78" slineno="1-47" level="3"><display>(iv)</display>provide for the adoption of management, clinical, financial, procurement, <ln numlevel="1" lineno="79" slineno="1-48"/>personnel, and administrative policies as already established by one of the <ln numlevel="1" lineno="80" slineno="1-49"/>participating counties or as approved by the legislative body of each participating <ln numlevel="1" lineno="81" slineno="1-50"/>county or interlocal board.</subsection></subsection><subsection ssid="8-null-24" dnum="d-o" numlevel="1" lineno="82" slineno="1-51" level="2"><display>(d)</display>An agreement for joint mental health services may provide for:<subsection ssid="8-null-25" dnum="i-o" numlevel="1" lineno="83" slineno="1-52" level="3"><display>(i)</display>joint operation of services and facilities or for operation of services and facilities <ln numlevel="1" lineno="84" slineno="1-53"/>under contract by one participating local mental health authority for other <ln numlevel="1" lineno="85" slineno="1-54"/>participating local mental health authorities; and</subsection><subsection ssid="8-null-26" dnum="ii-o" numlevel="1" lineno="86" slineno="1-55" level="3"><display>(ii)</display>allocation of appointments of members of the mental health advisory council <ln numlevel="1" lineno="87" slineno="1-56"/>between or among participating counties.</subsection></subsection></subsection><subsection ssid="8-null-27" dnum="3-o" numlevel="1" lineno="88" slineno="1-57" level="1" space="false"><display>(3)</display><subsection ssid="8-null-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A county governing body may elect to combine the local mental health authority <ln numlevel="1" lineno="89" slineno="1-58"/>with: <subsection ssid="8-null-29" dnum="i-o" numlevel="1" lineno="90" slineno="1-59" level="3" tab="1"><display>(i)</display>the local substance abuse authority created in <xref depth="2" refnumber="17-43-2">Part 2, Local Substance Abuse <ln numlevel="1" lineno="91" slineno="1-60"/>Authorities</xref>; or </subsection><subsection ssid="8-null-30" dnum="ii-o" numlevel="1" lineno="92" slineno="1-61" level="3" tab="1"><display>(ii)</display>the local health department created in <xref depth="2" refnumber="26A-1-1">Title 26A, Chapter 1, Part 1</xref>, Local Health <ln numlevel="1" lineno="93" slineno="1-62"/>Department Act. </subsection></subsection><subsection ssid="8-null-31" dnum="b-o" numlevel="1" lineno="94" slineno="1-63" level="2"><display>(b)</display>A local mental health authority that joins with a united local health department shall <ln numlevel="1" lineno="95" slineno="1-64"/>comply with this part.</subsection></subsection><subsection ssid="8-null-32" dnum="4-o" numlevel="1" lineno="96" slineno="1-65" level="1" space="false"><display>(4)</display><subsection ssid="8-null-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each local mental health authority is accountable to the department and the state <ln numlevel="1" lineno="97" slineno="1-66"/>with regard to the use of state and federal funds received from the department for <ln numlevel="1" lineno="98" slineno="1-67"/>mental health services, regardless of whether the services are provided by a private <ln numlevel="1" lineno="99" slineno="1-68"/>contract provider.</subsection><subsection ssid="8-null-34" dnum="b-o" numlevel="1" lineno="100" slineno="1-69" level="2" space="false"><display>(b)</display><subsection ssid="8-null-35" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Each local mental health authority shall comply, and require compliance by the <ln numlevel="1" lineno="101" slineno="1-70"/>local mental health authority's contract provider, with all directives issued by the <ln numlevel="1" lineno="102" slineno="1-71"/>department regarding the use and expenditure of state and federal funds received <ln numlevel="1" lineno="103" slineno="1-72"/>from the department for the purpose of providing mental health programs and <ln numlevel="1" lineno="104" slineno="1-73"/>services.  </subsection><subsection ssid="8-null-36" dnum="ii-o" numlevel="1" lineno="105" slineno="1-74" level="3"><display>(ii)</display>The department shall: <subsection ssid="8-null-37" dnum="A-o" numlevel="1" lineno="106" slineno="1-75" level="4"><display>(A)</display>ensure that directives issued by the department described in Subsection <xref depth="4" refnumber="17-43-301(4)(b)(i)"><ln numlevel="1" lineno="107" slineno="1-76"/>(4)(b)(i)</xref> are not duplicative or conflicting; and </subsection><subsection ssid="8-null-38" dnum="B-o" numlevel="1" lineno="108" slineno="1-77" level="4"><display>(B)</display>consult and coordinate with local mental health authorities with regard to <ln numlevel="1" lineno="109" slineno="1-78"/>programs and services.</subsection></subsection></subsection></subsection><subsection ssid="8-null-39" dnum="5-o" numlevel="1" lineno="110" slineno="1-79" level="1" space="false"><display>(5)</display><subsection ssid="8-null-40" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each local mental health authority shall:<subsection ssid="8-null-41" dnum="i-o" numlevel="1" lineno="111" slineno="1-80" level="3" tab="1"><display>(i)</display>review and evaluate mental health needs and services, including mental health <ln numlevel="1" lineno="112" slineno="1-81"/>needs and services for:<subsection ssid="8-null-42" dnum="A-o" numlevel="1" lineno="113" slineno="1-82" level="4"><display>(A)</display>an individual incarcerated in a county jail or other county correctional facility; <ln numlevel="1" lineno="114" slineno="1-83"/>and</subsection><subsection ssid="8-null-43" dnum="B-o" numlevel="1" lineno="115" slineno="1-84" level="4"><display>(B)</display>an individual who is a resident of the county and who is court ordered to <ln numlevel="1" lineno="116" slineno="1-85"/>receive assisted outpatient treatment under Section <xref depth="3" refnumber="26B-5-351">26B-5-351</xref>;</subsection></subsection><subsection ssid="8-null-44" dnum="ii-o" numlevel="1" lineno="117" slineno="1-86" level="3" tab="1"><display>(ii)</display>in accordance with Subsections <xref refnumber="17-43-301(5)(b)" depth="4">(5)(b)</xref> and <xref refnumber="17-43-301(6)(c)" depth="4">(c)</xref>, annually prepare and submit to the <ln numlevel="1" lineno="118" slineno="1-87"/>division a plan approved by the county legislative body for mental health funding <ln numlevel="1" lineno="119" slineno="1-88"/>and service delivery, either directly by the local mental health authority or by <ln numlevel="1" lineno="120" slineno="1-89"/>contract;</subsection><subsection ssid="8-null-45" dnum="iii-o" numlevel="1" lineno="121" slineno="1-90" level="3" tab="1"><display>(iii)</display>establish and maintain, either directly or by contract, programs licensed under <ln numlevel="1" lineno="122" slineno="1-91"/>Title <xref depth="2" refnumber="26B-2-1">26B, Chapter 2, Part 1</xref>, Human Services Programs and Facilities;</subsection><subsection ssid="8-null-46" dnum="iv-o" numlevel="1" lineno="123" slineno="1-92" level="3" tab="1"><display>(iv)</display>appoint, directly or by contract, a full-time or part-time director for mental health <ln numlevel="1" lineno="124" slineno="1-93"/>programs and prescribe the director's duties;</subsection><subsection ssid="8-null-47" dnum="v-o" numlevel="1" lineno="125" slineno="1-94" level="3" tab="1"><display>(v)</display>provide input and comment on new and revised rules established by the division;</subsection><subsection ssid="8-null-48" dnum="vi-o" numlevel="1" lineno="126" slineno="1-95" level="3" tab="1"><display>(vi)</display>establish and require contract providers to establish administrative, clinical, <ln numlevel="1" lineno="127" slineno="1-96"/>personnel, financial, procurement, and management policies regarding mental <ln numlevel="1" lineno="128" slineno="1-97"/>health services and facilities, in accordance with the rules of the division, and state <ln numlevel="1" lineno="129" slineno="1-98"/>and federal law;</subsection><subsection ssid="8-null-49" dnum="vii-o" numlevel="1" lineno="130" slineno="1-99" level="3" tab="1"><display>(vii)</display>establish mechanisms allowing for direct citizen input;</subsection><subsection ssid="8-null-50" dnum="viii-o" numlevel="1" lineno="131" slineno="1-100" level="3" tab="1"><display>(viii)</display>annually contract with the division to provide mental health programs and <ln numlevel="1" lineno="132" slineno="1-101"/>services in accordance with the provisions of <xref depth="1" refnumber="26B-5">Title 26B, Chapter 5</xref>, Health Care - <ln numlevel="1" lineno="133" slineno="1-102"/>Substance Use and Mental Health;</subsection><subsection ssid="8-null-51" dnum="ix-o" numlevel="1" lineno="134" slineno="1-103" level="3" tab="1"><display>(ix)</display>comply with all applicable state and federal: <subsection ssid="8-null-52" dnum="A-o" numlevel="1" lineno="135" slineno="1-104" level="4"><display>(A)</display>statutes; </subsection><subsection ssid="8-null-53" dnum="B-o" numlevel="1" lineno="136" slineno="1-105" level="4"><display>(B)</display>policies; </subsection><subsection ssid="8-null-54" dnum="C-o" numlevel="1" lineno="137" slineno="1-106" level="4"><display>(C)</display>audit requirements; </subsection><subsection ssid="8-null-55" dnum="D-o" numlevel="1" lineno="138" slineno="1-107" level="4"><display>(D)</display>contract requirements; and </subsection><subsection ssid="8-null-56" dnum="E-o" numlevel="1" lineno="139" slineno="1-108" level="4"><display>(E)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="93" groupid="64" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/> directives resulting from those audits and contract requirements;</subsection></subsection><subsection ssid="8-null-57" dnum="x-o" numlevel="1" lineno="140" slineno="1-109" level="3" tab="1"><display>(x)</display>provide funding equal to at least 20% of the state funds that it receives to fund <ln numlevel="1" lineno="141" slineno="1-110"/>services described in the plan;</subsection><subsection ssid="8-null-58" dnum="xi-o" numlevel="1" lineno="142" slineno="1-111" level="3" tab="1"><display>(xi)</display>comply with the requirements and procedures of: <subsection ssid="8-null-59" dnum="A-o" numlevel="1" lineno="143" slineno="1-112" level="4"><display>(A)</display><xref depth="1" refnumber="11-13">Title 11, Chapter 13, Interlocal Cooperation Act</xref>; </subsection><subsection ssid="8-null-60" dnum="B-o" numlevel="1" lineno="144" slineno="1-113" level="4"><display>(B)</display><xref depth="2" refnumber="17B-1-6">Title 17B, Chapter 1, Part 6, Fiscal Procedures for Special Districts</xref>; and </subsection><subsection ssid="8-null-61" dnum="C-o" numlevel="1" lineno="145" slineno="1-114" level="4"><display>(C)</display><xref depth="1" refnumber="51-2a">Title 51, Chapter 2a, Accounting Reports from Political Subdivisions</xref>, <ln numlevel="1" lineno="146" slineno="1-115"/>Interlocal Organizations, and Other Local Entities Act;</subsection></subsection><subsection ssid="8-null-62" dnum="xii-o" numlevel="1" lineno="147" slineno="1-116" level="3" tab="1"><display>(xii)</display>take and retain physical custody of minors committed to the physical custody of <ln numlevel="1" lineno="148" slineno="1-117"/>local mental health authorities by a judicial proceeding under <xref depth="2" refnumber="26B-5-4">Title 26B, Chapter <ln numlevel="1" lineno="149" slineno="1-118"/>5, Part 4, Commitment of Persons Under Age 18</xref>; and</subsection><subsection ssid="8-null-63" dnum="xiii-o" numlevel="1" lineno="150" slineno="1-119" level="3" tab="1"><display>(xiii)</display>cooperate with the Department of Corrections to complete the requirements <ln numlevel="1" lineno="151" slineno="1-120"/>described in Section <xref depth="3" refnumber="64-14-204">64-14-204</xref>.</subsection></subsection><subsection ssid="8-null-64" dnum="b-o" numlevel="1" lineno="152" slineno="1-121" level="2"><display>(b)</display>Each plan under Subsection <xref depth="4" refnumber="17-43-301(5)(a)(ii)">(5)(a)(ii)</xref> shall include services for adults, youth, and <ln numlevel="1" lineno="153" slineno="1-122"/>children, which shall include:<subsection ssid="8-null-65" dnum="i-o" numlevel="1" lineno="154" slineno="1-123" level="3"><display>(i)</display>inpatient care and services;</subsection><subsection ssid="8-null-66" dnum="ii-o" numlevel="1" lineno="155" slineno="1-124" level="3"><display>(ii)</display>residential care and services;</subsection><subsection ssid="8-null-67" dnum="iii-o" numlevel="1" lineno="156" slineno="1-125" level="3"><display>(iii)</display>outpatient care and services;</subsection><subsection ssid="8-null-68" dnum="iv-o" numlevel="1" lineno="157" slineno="1-126" level="3"><display>(iv)</display>24-hour crisis care and services;</subsection><subsection ssid="8-null-69" dnum="v-o" numlevel="1" lineno="158" slineno="1-127" level="3"><display>(v)</display>psychotropic medication management;</subsection><subsection ssid="8-null-70" dnum="vi-o" numlevel="1" lineno="159" slineno="1-128" level="3"><display>(vi)</display>psychosocial rehabilitation, including vocational training and skills development;</subsection><subsection ssid="8-null-71" dnum="vii-o" numlevel="1" lineno="160" slineno="1-129" level="3"><display>(vii)</display>case management;</subsection><subsection ssid="8-null-72" dnum="viii-o" numlevel="1" lineno="161" slineno="1-130" level="3"><display>(viii)</display>community supports, including: <subsection ssid="8-null-73" dnum="A-o" numlevel="1" lineno="162" slineno="1-131" level="4"><display>(A)</display>in-home services; </subsection><subsection ssid="8-null-74" dnum="B-o" numlevel="1" lineno="163" slineno="1-132" level="4"><display>(B)</display>housing; </subsection><subsection ssid="8-null-75" dnum="C-o" numlevel="1" lineno="164" slineno="1-133" level="4"><display>(C)</display>family support services; and </subsection><subsection ssid="8-null-76" dnum="D-o" numlevel="1" lineno="165" slineno="1-134" level="4"><display>(D)</display>respite services;</subsection></subsection><subsection ssid="8-null-77" dnum="ix-o" numlevel="1" lineno="166" slineno="1-135" level="3"><display>(ix)</display>consultation and education services, including: <subsection ssid="8-null-78" dnum="A-o" numlevel="1" lineno="167" slineno="1-136" level="4"><display>(A)</display>case consultation; and</subsection><subsection ssid="8-null-79" dnum="B-o" numlevel="1" lineno="168" slineno="1-137" level="4"><display>(B)</display>collaboration with other county service agencies, public education, and public <ln numlevel="1" lineno="169" slineno="1-138"/>information;</subsection></subsection><subsection ssid="8-null-80" dnum="x-o" numlevel="1" lineno="170" slineno="1-139" level="3"><display>(x)</display>services to an individual incarcerated in a county jail or other county correctional <ln numlevel="1" lineno="171" slineno="1-140"/>facility; and</subsection><subsection ssid="8-null-81" dnum="xi-o" numlevel="1" lineno="172" slineno="1-141" level="3"><display>(xi)</display>services to an individual described in Subsection <xref depth="4" refnumber="64-14-204(8)(a)">64-14-204(8)(a)</xref>.</subsection></subsection><subsection ssid="8-null-82" dnum="c-o" numlevel="1" lineno="173" slineno="1-142" level="2"><display>(c)</display>Each plan under Subsection <xref depth="4" refnumber="17-43-301(5)(a)(ii)">(5)(a)(ii)</xref> shall include, in a form and format usable by a <ln numlevel="1" lineno="174" slineno="1-143"/>first responder, an inclusive list of providers of mental health services for individuals <ln numlevel="1" lineno="175" slineno="1-144"/>within the local mental health authority's jurisdiction.</subsection></subsection><subsection ssid="8-null-83" dnum="6-o" numlevel="1" lineno="176" slineno="1-145" level="1" space="false"><display>(6)</display><subsection ssid="8-null-84" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a local mental health authority provides for a local mental health crisis line <ln numlevel="1" lineno="177" slineno="1-146"/>under the plan for 24-hour crisis care and services described in Subsection <xref depth="4" refnumber="17-43-301(5)(b)(iv)">(5)(b)(iv)</xref>, <ln numlevel="1" lineno="178" slineno="1-147"/>the local mental health authority shall:<subsection ssid="8-null-85" dnum="i-o" numlevel="1" lineno="179" slineno="1-148" level="3" tab="1"><display>(i)</display>collaborate with the statewide mental health crisis line described in Section <xref depth="3" refnumber="26B-5-610"><ln numlevel="1" lineno="180" slineno="1-149"/>26B-5-610</xref>;</subsection><subsection ssid="8-null-86" dnum="ii-o" numlevel="1" lineno="181" slineno="1-150" level="3" tab="1"><display>(ii)</display>ensure that each individual who answers calls to the local mental health crisis line:<subsection ssid="8-null-87" dnum="A-o" numlevel="1" lineno="182" slineno="1-151" level="4"><display>(A)</display>is a mental health therapist or a crisis worker; and</subsection><subsection ssid="8-null-88" dnum="B-o" numlevel="1" lineno="183" slineno="1-152" level="4"><display>(B)</display>meets the standards of care and practice established by the Division of <ln numlevel="1" lineno="184" slineno="1-153"/>Integrated Healthcare, in accordance with Section <xref depth="3" refnumber="26B-5-610">26B-5-610</xref>; and</subsection></subsection><subsection ssid="8-null-89" dnum="iii-o" numlevel="1" lineno="185" slineno="1-154" level="3" tab="1"><display>(iii)</display>ensure that when necessary, based on the local mental health crisis line's <ln numlevel="1" lineno="186" slineno="1-155"/>capacity, calls are immediately routed to the statewide mental health crisis line to <ln numlevel="1" lineno="187" slineno="1-156"/>ensure that when an individual calls the local mental health crisis line, regardless <ln numlevel="1" lineno="188" slineno="1-157"/>of the time, date, or number of individuals trying to simultaneously access the <ln numlevel="1" lineno="189" slineno="1-158"/>local mental health crisis line, a mental health therapist or a crisis worker answers <ln numlevel="1" lineno="190" slineno="1-159"/>the call without the caller first:<subsection ssid="8-null-90" dnum="A-o" numlevel="1" lineno="191" slineno="1-160" level="4"><display>(A)</display>waiting on hold; or</subsection><subsection ssid="8-null-91" dnum="B-o" numlevel="1" lineno="192" slineno="1-161" level="4"><display>(B)</display>being screened by an individual other than a mental health therapist or crisis <ln numlevel="1" lineno="193" slineno="1-162"/>worker.</subsection></subsection></subsection><subsection ssid="8-null-92" dnum="b-o" numlevel="1" lineno="194" slineno="1-163" level="2"><display>(b)</display>If a local mental health authority does not provide for a local mental health crisis line <ln numlevel="1" lineno="195" slineno="1-164"/>under the plan for 24-hour crisis care and services described in Subsection <xref depth="4" refnumber="17-43-301(5)(b)(iv)">(5)(b)(iv)</xref>, <ln numlevel="1" lineno="196" slineno="1-165"/>the local mental health authority shall use the statewide mental health crisis line as a <ln numlevel="1" lineno="197" slineno="1-166"/>local crisis line resource.</subsection></subsection><subsection ssid="8-null-93" dnum="7-o" numlevel="1" lineno="198" slineno="1-167" level="1"><display>(7)</display>Before disbursing any public funds, each local mental health authority shall require that <ln numlevel="1" lineno="199" slineno="1-168"/>each entity that receives any public funds from a local mental health authority agrees in <ln numlevel="1" lineno="200" slineno="1-169"/>writing that:<subsection ssid="8-null-94" dnum="a-o" numlevel="1" lineno="201" slineno="1-170" level="2"><display>(a)</display>the entity's financial records and other records relevant to the entity's performance of <ln numlevel="1" lineno="202" slineno="1-171"/>the services provided to the mental health authority shall be subject to examination <ln numlevel="1" lineno="203" slineno="1-172"/>by:<subsection ssid="8-null-95" dnum="i-o" numlevel="1" lineno="204" slineno="1-173" level="3"><display>(i)</display>the division;</subsection><subsection ssid="8-null-96" dnum="ii-o" numlevel="1" lineno="205" slineno="1-174" level="3"><display>(ii)</display>the local mental health authority director;</subsection><subsection ssid="8-null-97" dnum="iii-o" numlevel="1" lineno="206" slineno="1-175" level="3" space="false"><display>(iii)</display><subsection ssid="8-null-98" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the county treasurer and county or district attorney; or</subsection><subsection ssid="8-null-99" dnum="B-o" numlevel="1" lineno="207" slineno="1-176" level="4"><display>(B)</display>if two or more counties jointly provide mental health services under an <ln numlevel="1" lineno="208" slineno="1-177"/>agreement under Subsection <xref depth="4" refnumber="17-43-301(2)">(2)</xref>, the designated treasurer and the designated <ln numlevel="1" lineno="209" slineno="1-178"/>legal officer;</subsection></subsection><subsection ssid="8-null-100" dnum="iv-o" numlevel="1" lineno="210" slineno="1-179" level="3"><display>(iv)</display>the county legislative body; and</subsection><subsection ssid="8-null-101" dnum="v-o" numlevel="1" lineno="211" slineno="1-180" level="3"><display>(v)</display>in a county with a county executive that is separate from the county legislative <ln numlevel="1" lineno="212" slineno="1-181"/>body, the county executive;</subsection></subsection><subsection ssid="8-null-102" dnum="b-o" numlevel="1" lineno="213" slineno="1-182" level="2"><display>(b)</display>the county auditor may examine and audit the entity's financial and other records <ln numlevel="1" lineno="214" slineno="1-183"/>relevant to the entity's performance of the services provided to the local mental health <ln numlevel="1" lineno="215" slineno="1-184"/>authority; and</subsection><subsection ssid="8-null-103" dnum="c-o" numlevel="1" lineno="216" slineno="1-185" level="2"><display>(c)</display>the entity will comply with the provisions of Subsection <xref depth="4" refnumber="17-43-301(4)(b)">(4)(b)</xref>.</subsection></subsection><subsection ssid="8-null-104" dnum="8-o" numlevel="1" lineno="217" slineno="1-186" level="1" space="false"><display>(8)</display><subsection ssid="8-null-105" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local mental health authority may receive for mental health services:<subsection ssid="8-null-106" dnum="i-o" numlevel="1" lineno="218" slineno="1-187" level="3" tab="1"><display>(i)</display>property; </subsection><subsection ssid="8-null-107" dnum="ii-o" numlevel="1" lineno="219" slineno="1-188" level="3" tab="1"><display>(ii)</display>grants; </subsection><subsection ssid="8-null-108" dnum="iii-o" numlevel="1" lineno="220" slineno="1-189" level="3" tab="1"><display>(iii)</display>gifts; </subsection><subsection ssid="8-null-109" dnum="iv-o" numlevel="1" lineno="221" slineno="1-190" level="3" tab="1"><display>(iv)</display>supplies; </subsection><subsection ssid="8-null-110" dnum="v-o" numlevel="1" lineno="222" slineno="1-191" level="3" tab="1"><display>(v)</display>materials; </subsection><subsection ssid="8-null-111" dnum="vi-o" numlevel="1" lineno="223" slineno="1-192" level="3" tab="1"><display>(vi)</display>contributions; and </subsection><subsection ssid="8-null-112" dnum="vii-o" numlevel="1" lineno="224" slineno="1-193" level="3" tab="1"><display>(vii)</display>any benefit derived from the items described in Subsections <xref depth="4" refnumber="17-43-301(8)(a)(i)">(8)(a)(i)</xref> through <xref depth="4" refnumber="17-43-301(vi)">(vi)</xref>.  </subsection></subsection><subsection ssid="8-null-113" dnum="b-o" numlevel="1" lineno="225" slineno="1-194" level="2"><display>(b)</display>If the items described in Subsections <xref depth="4" refnumber="17-43-301(8)(a)(i)">(8)(a)(i)</xref> through (vi) are conditioned upon their <ln numlevel="1" lineno="226" slineno="1-195"/>use for a specified service or program, they shall be so used.</subsection></subsection><subsection ssid="8-null-114" dnum="9-o" numlevel="1" lineno="227" slineno="1-196" level="1"><display>(9)</display>Public funds received for the provision of services in accordance with the local mental <ln numlevel="1" lineno="228" slineno="1-197"/>health plan may not be used for any other purpose except those authorized in the <ln numlevel="1" lineno="229" slineno="1-198"/>contract between the local mental health authority and the provider for the provision of <ln numlevel="1" lineno="230" slineno="1-199"/>plan services.</subsection><subsection ssid="8-null-115" dnum="10-o" numlevel="1" lineno="231" slineno="1-200" level="1"><display>(10)</display>A local mental health authority shall: <subsection ssid="8-null-116" dnum="a-o" numlevel="1" lineno="232" slineno="1-201" level="2"><display>(a)</display>provide assisted outpatient treatment services to a resident of the county who has <ln numlevel="1" lineno="233" slineno="1-202"/>been ordered under Section <xref depth="3" refnumber="26B-5-351">26B-5-351</xref> to receive assisted outpatient treatment; and</subsection><subsection ssid="8-null-117" dnum="b-o" numlevel="1" lineno="234" slineno="1-203" level="2"><display>(b)</display>to the extent feasible, coordinate with the Department of Corrections to ensure the <ln numlevel="1" lineno="235" slineno="1-204"/>continuity of mental health services for county residents who are on probation or <ln numlevel="1" lineno="236" slineno="1-205"/>parole.</subsection></subsection><subsection ssid="8-118" dnum="_-o:11-i" numlevel="1" lineno="237" slineno="1-206" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1117" style="1" owner="i" level="1" amendtag="start">(11)</amend></display><subsection ssid="8-139" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1118" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="74" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">A local mental health authority shall provide to an individual that contacts the <ln numlevel="1" lineno="238" slineno="1-207"/>local mental health authority information and referrals to resources regarding <ln numlevel="1" lineno="239" slineno="1-208"/>guardianship and conservatorship, including about:</amend><subsection ssid="8-120" dnum="_-o:i-i" numlevel="1" lineno="240" slineno="1-209" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1119" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">alternatives to guardianship or conservatorship;</amend></subsection><subsection ssid="8-121" dnum="_-o:ii-i" numlevel="1" lineno="241" slineno="1-210" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1120" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">the Office of Public Guardian and other guardianship or conservatorship agencies;</amend></subsection><subsection ssid="8-122" dnum="_-o:iii-i" numlevel="1" lineno="242" slineno="1-211" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">family support organizations and agencies;</amend></subsection><subsection ssid="8-123" dnum="_-o:iv-i" numlevel="1" lineno="243" slineno="1-212" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">how to apply for guardianship or conservatorship;</amend></subsection><subsection ssid="8-124" dnum="_-o:v-i" numlevel="1" lineno="244" slineno="1-213" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1123" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">training on:</amend><subsection ssid="8-125" dnum="_-o:A-i" numlevel="1" lineno="245" slineno="1-214" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">alternatives to guardianship;</amend></subsection><subsection ssid="8-126" dnum="_-o:B-i" numlevel="1" lineno="246" slineno="1-215" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">court processes and procedures; in Subsection <xref depth="4" refnumber="26B-5-382(2)">(2)</xref>.</subsection><subsection ssid="13-null-2" dnum="2-o" numlevel="1" lineno="323" slineno="3-6" level="1"><display>(2)</display>Subject to appropriations from the Legislature and the assignment of a judge to preside <ln numlevel="1" lineno="324" slineno="3-7"/>over the proceedings, the Third Judicial District Court of Salt Lake County shall <ln numlevel="1" lineno="325" slineno="3-8"/>establish and administer a HOME Court Pilot Program beginning October 1, 2024, and <ln numlevel="1" lineno="326" slineno="3-9"/>ending June 30, 2029, that provides for comprehensive and individualized, <ln numlevel="1" lineno="327" slineno="3-10"/>court-supervised treatment and services to individuals with mental illness.</subsection><subsection ssid="13-null-3" dnum="3-o" numlevel="1" lineno="328" slineno="3-11" level="1"><display>(3)</display>The pilot program shall:<subsection ssid="13-null-4" dnum="a-o" numlevel="1" lineno="329" slineno="3-12" level="2"><display>(a)</display>allow a person to petition the court for an order requiring an individual's participation <ln numlevel="1" lineno="330" slineno="3-13"/>in the pilot program;</subsection><subsection ssid="13-null-5" dnum="b-o" numlevel="1" lineno="331" slineno="3-14" level="2"><display>(b)</display>require the court to substitute the local mental health authority as the petitioner if the <ln numlevel="1" lineno="332" slineno="3-15"/>initial petitioner is not the local mental health authority;</subsection><subsection ssid="13-null-6" dnum="c-o" numlevel="1" lineno="333" slineno="3-16" level="2"><display>(c)</display>provide an opportunity for the parties to enter into an agreement regarding an <ln numlevel="1" lineno="334" slineno="3-17"/>individual's participation in the pilot program, including a treatment plan, prior to a <ln numlevel="1" lineno="335" slineno="3-18"/>court order under Subsection <xref depth="4" refnumber="26B-5-382(3)(e)">(3)(e)</xref>;</subsection><subsection ssid="13-null-7" dnum="d-o" numlevel="1" lineno="336" slineno="3-19" level="2"><display>(d)</display>provide for a hearing at which information is presented to determine whether an <ln numlevel="1" lineno="337" slineno="3-20"/>individual qualifies for court-ordered participation in the pilot program as provided in <ln numlevel="1" lineno="338" slineno="3-21"/>Subsection <xref depth="4" refnumber="26B-5-382(3)(e)">(3)(e)</xref>;</subsection><subsection ssid="13-null-8" dnum="e-o" numlevel="1" lineno="339" slineno="3-22" level="2"><display>(e)</display>require the court to order an individual to participate in the pilot program if, upon <ln numlevel="1" lineno="340" slineno="3-23"/>completion of the hearing described in Subsection <xref depth="4" refnumber="26B-5-382(3)(d)">(3)(d)</xref>, the court finds by clear and <ln numlevel="1" lineno="341" slineno="3-24"/>convincing evidence that:<subsection ssid="13-null-9" dnum="i-o" numlevel="1" lineno="342" slineno="3-25" level="3"><display>(i)</display>the individual resides or may be presently found within Salt Lake County;</subsection><subsection ssid="13-null-10" dnum="ii-o" numlevel="1" lineno="343" slineno="3-26" level="3"><display>(ii)</display>the individual has a mental illness;</subsection><subsection ssid="13-null-11" dnum="iii-o" numlevel="1" lineno="344" slineno="3-27" level="3"><display>(iii)</display>because of the individual's mental illness, the individual:<subsection ssid="13-null-12" dnum="A-o" numlevel="1" lineno="345" slineno="3-28" level="4"><display>(A)</display>is unlikely to survive or remain safe without supervision, assistance, or <ln numlevel="1" lineno="346" slineno="3-29"/>services; or</subsection><subsection ssid="13-null-13" dnum="B-o" numlevel="1" lineno="347" slineno="3-30" level="4"><display>(B)</display>meets the criteria described in Subsection <xref depth="4" refnumber="26B-5-351(14)(c)(i)">26B-5-351(14)(c)(i)</xref> or (ii);</subsection></subsection><subsection ssid="13-null-14" dnum="iv-o" numlevel="1" lineno="348" slineno="3-31" level="3"><display>(iv)</display>there is no appropriate less-restrictive alternative to a court order for participation <ln numlevel="1" lineno="349" slineno="3-32"/>in the pilot program;</subsection><subsection ssid="13-null-15" dnum="v-o" numlevel="1" lineno="350" slineno="3-33" level="3"><display>(v)</display>the individual is likely to benefit from participation in the pilot program; and</subsection><subsection ssid="13-null-16" dnum="vi-o" numlevel="1" lineno="351" slineno="3-34" level="3"><display>(vi)</display>there is adequate capacity within the pilot program to meet the individual's need <ln numlevel="1" lineno="352" slineno="3-35"/>for services described in Subsection <xref depth="4" refnumber="26B-5-382(3)(f)">(3)(f)</xref>;</subsection></subsection><subsection ssid="13-null-17" dnum="f-o" numlevel="1" lineno="353" slineno="3-36" level="2"><display>(f)</display>upon the court's order for an individual to participate in the pilot program, require the <ln numlevel="1" lineno="354" slineno="3-37"/>local mental health authority to prepare a comprehensive and individualized <ln numlevel="1" lineno="355" slineno="3-38"/>treatment plan, for approval by the court, that includes the following components for <ln numlevel="1" lineno="356" slineno="3-39"/>the individual to successfully achieve the purposes of the pilot program:<subsection ssid="13-null-18" dnum="i-o" numlevel="1" lineno="357" slineno="3-40" level="3"><display>(i)</display>mental health services;</subsection><subsection ssid="13-null-19" dnum="ii-o" numlevel="1" lineno="358" slineno="3-41" level="3"><display>(ii)</display>housing resources;</subsection><subsection ssid="13-null-20" dnum="iii-o" numlevel="1" lineno="359" slineno="3-42" level="3"><display>(iii)</display>social services;</subsection><subsection ssid="13-null-21" dnum="iv-o" numlevel="1" lineno="360" slineno="3-43" level="3"><display>(iv)</display>case management;</subsection><subsection ssid="13-null-22" dnum="v-o" numlevel="1" lineno="361" slineno="3-44" level="3"><display>(v)</display>peer support;</subsection><subsection ssid="13-null-23" dnum="vi-o" numlevel="1" lineno="362" slineno="3-45" level="3"><display>(vi)</display>exit or transition services; and</subsection><subsection ssid="13-null-24" dnum="vii-o" numlevel="1" lineno="363" slineno="3-46" level="3"><display>(vii)</display>individualized goals for the successful completion of the pilot program;</subsection></subsection><subsection ssid="13-null-25" dnum="g-o" numlevel="1" lineno="364" slineno="3-47" level="2"><display>(g)</display>upon the court's approval of a treatment plan prepared by the local mental health <ln numlevel="1" lineno="365" slineno="3-48"/>authority:<subsection ssid="13-null-26" dnum="i-o" numlevel="1" lineno="366" slineno="3-49" level="3"><display>(i)</display>require the local mental health authority to coordinate services required for <ln numlevel="1" lineno="367" slineno="3-50"/>participation in the pilot program; and</subsection><subsection ssid="13-null-27" dnum="ii-o" numlevel="1" lineno="368" slineno="3-51" level="3"><display>(ii)</display>require the court to conduct regular review hearings as deemed necessary to <ln numlevel="1" lineno="369" slineno="3-52"/>evaluate the individual's progress in completing the treatment plan; and</subsection></subsection><subsection ssid="13-null-28" dnum="h-o" numlevel="1" lineno="370" slineno="3-53" level="2"><display>(h)</display>operate in a manner that is consistent with the procedures for ordering assisted <ln numlevel="1" lineno="371" slineno="3-54"/>outpatient treatment under Section <xref depth="3" refnumber="26B-5-351">26B-5-351</xref>.</subsection></subsection><subsection ssid="13-null-29" dnum="4-o" numlevel="1" lineno="372" slineno="3-55" level="1" space="false"><display>(4)</display><subsection ssid="13-null-30" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="13-null-31" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>If a individual participating in the pilot program has an outstanding warrant <ln numlevel="1" lineno="373" slineno="3-56"/>or pending criminal matter in another Utah court, the Third Judicial District Court <ln numlevel="1" lineno="374" slineno="3-57"/>of Salt Lake County may notify the other court in which the individual has an <ln numlevel="1" lineno="375" slineno="3-58"/>outstanding warrant or pending criminal matter regarding the individual's <ln numlevel="1" lineno="376" slineno="3-59"/>participation in the pilot program.</subsection><subsection ssid="13-null-32" dnum="ii-o" numlevel="1" lineno="377" slineno="3-60" level="3" tab="1"><display>(ii)</display>Upon receiving notice of an individual's participation in the pilot program under <ln numlevel="1" lineno="378" slineno="3-61"/>Subsection <xref depth="4" refnumber="26B-5-382(4)(a)(i)">(4)(a)(i)</xref>, the other court may, if deemed appropriate, recall the warrant <ln numlevel="1" lineno="379" slineno="3-62"/>or stay the case in which the individual is involved unless the warrant or case <ln numlevel="1" lineno="380" slineno="3-63"/>involves a felony charge.</subsection><subsection ssid="13-null-33" dnum="iii-o" numlevel="1" lineno="381" slineno="3-64" level="3" tab="1"><display>(iii)</display>In determining whether to recall a warrant or stay a case under Subsection <xref depth="4" refnumber="26B-5-382(4)(a)(ii)"><ln numlevel="1" lineno="382" slineno="3-65"/>(4)(a)(ii)</xref>, the other court shall consider the likelihood of the individual's <ln numlevel="1" lineno="383" slineno="3-66"/>successful completion of the pilot program, the severity of the pending charges, <ln numlevel="1" lineno="384" slineno="3-67"/>the impact on victims' rights, and the impact on the government's ability and right <ln numlevel="1" lineno="385" slineno="3-68"/>to prosecute the case.</subsection></subsection><subsection ssid="13-null-34" dnum="b-o" numlevel="1" lineno="386" slineno="3-69" level="2" space="false"><display>(b)</display><subsection ssid="13-null-35" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If an individual described in Subsection <xref depth="4" refnumber="26B-5-382(4)(a)(i)">(4)(a)(i)</xref> successfully completes the <ln numlevel="1" lineno="387" slineno="3-70"/>pilot program, the Third Judicial District Court of Salt Lake County may notify <ln numlevel="1" lineno="388" slineno="3-71"/>the other court in which the individual has an outstanding warrant or pending <ln numlevel="1" lineno="389" slineno="3-72"/>criminal matter regarding the individual's successful completion of the pilot <ln numlevel="1" lineno="390" slineno="3-73"/>program.</subsection><subsection ssid="13-null-36" dnum="ii-o" numlevel="1" lineno="391" slineno="3-74" level="3"><display>(ii)</display>Upon receiving notice of an individual's successful completion of the pilot <ln numlevel="1" lineno="392" slineno="3-75"/>program under Subsection <xref depth="4" refnumber="26B-5-382(4)(b)(i)">(4)(b)(i)</xref>, the other court shall consider the effect of the <ln numlevel="1" lineno="393" slineno="3-76"/>individual's completion of the pilot program on the case pending before that court, <ln numlevel="1" lineno="394" slineno="3-77"/>including the dismissal of criminal charges if deemed appropriate.</subsection></subsection></subsection><subsection ssid="13-null-37" dnum="5-o" numlevel="1" lineno="395" slineno="3-78" level="1" space="false"><display>(5)</display><subsection ssid="13-null-38" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Costs of all services provided under the pilot program, including the costs <ln numlevel="1" lineno="396" slineno="3-79"/>incurred by the multidisciplinary team described in Subsection <xref depth="4" refnumber="26B-5-382(5)(b)(ii)(b)">(5)(b)(ii)(B)</xref>, shall be <ln numlevel="1" lineno="397" slineno="3-80"/>paid by Salt Lake County.</subsection><subsection ssid="13-null-39" dnum="b-o" numlevel="1" lineno="398" slineno="3-81" level="2"><display>(b)</display>If the Legislature appropriates money to the division for implementation of the pilot <ln numlevel="1" lineno="399" slineno="3-82"/>program, the division shall:<subsection ssid="13-null-40" dnum="i-o" numlevel="1" lineno="400" slineno="3-83" level="3"><display>(i)</display>require the local mental health authority, as part of the plan required under <ln numlevel="1" lineno="401" slineno="3-84"/>Subsection <xref depth="4" refnumber="17-77-301(5)">17-77-301(5)</xref>, to submit to the division a proposal for implementation <ln numlevel="1" lineno="402" slineno="3-85"/>of the pilot program on or before May 15 of each year;</subsection><subsection ssid="13-null-41" dnum="ii-o" numlevel="1" lineno="403" slineno="3-86" level="3"><display>(ii)</display>review the proposal described in Subsection <xref depth="4" refnumber="26B-5-382(5)(b)(i)">(5)(b)(i)</xref> to ensure that the proposal:<subsection ssid="13-null-42" dnum="A-o" numlevel="1" lineno="404" slineno="3-87" level="4"><display>(A)</display>meets the requirements of this section; and</subsection><subsection ssid="13-null-43" dnum="B-o" numlevel="1" lineno="405" slineno="3-88" level="4"><display>(B)</display>establishes a multidisciplinary team, with a sufficient number of stakeholders, <ln numlevel="1" lineno="406" slineno="3-89"/>to adequately address the provision of treatment and services under the pilot <ln numlevel="1" lineno="407" slineno="3-90"/>program;</subsection></subsection><subsection ssid="13-null-44" dnum="iii-o" numlevel="1" lineno="408" slineno="3-91" level="3"><display>(iii)</display>upon approval of the proposal described in Subsection <xref depth="4" refnumber="26B-5-382(5)(b)(i)">(5)(b)(i)</xref>, contract funds <ln numlevel="1" lineno="409" slineno="3-92"/>appropriated for the pilot program with the local mental health authority; and</subsection><subsection ssid="13-null-45" dnum="iv-o" numlevel="1" lineno="410" slineno="3-93" level="3"><display>(iv)</display>conduct an annual audit and review of the local mental health authority, and any <ln numlevel="1" lineno="411" slineno="3-94"/>contracted provider, regarding the use of funds appropriated for the pilot program.</subsection></subsection><subsection ssid="13-null-46" dnum="c-o" numlevel="1" lineno="412" slineno="3-95" level="2"><display>(c)</display>The matching requirement in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><xref refnumber="17-77-301(6)(a)(x)" depth="4">17-77-301(6)(a)(x)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="4" refnumber="17-77-301(5)(a)(x)">17-77-301(5)(a)(x)</xref></amend> <ln numlevel="1" lineno="413" slineno="3-96"/>does not apply to funds appropriated by the Legislature for the pilot program.</subsection><subsection ssid="13-null-47" dnum="d-o" numlevel="1" lineno="414" slineno="3-97" level="2"><display>(d)</display>Subject to appropriation by the Legislature, Salt Lake County may:<subsection ssid="13-null-48" dnum="i-o" numlevel="1" lineno="415" slineno="3-98" level="3"><display>(i)</display>apply to the division to receive funds to cover the county's costs under the pilot <ln numlevel="1" lineno="416" slineno="3-99"/>program; and</subsection><subsection ssid="13-null-49" dnum="ii-o" numlevel="1" lineno="417" slineno="3-100" level="3"><display>(ii)</display>pay county contributions to the nonfederal share of Medicaid expenditures with <ln numlevel="1" lineno="418" slineno="3-101"/>funds appropriated for the pilot program.</subsection></subsection></subsection><subsection ssid="13-null-50" dnum="6-o" numlevel="1" lineno="419" slineno="3-102" level="1"><display>(6)</display>The department shall:<subsection ssid="13-null-51" dnum="a-o" numlevel="1" lineno="420" slineno="3-103" level="2"><display>(a)</display>establish and evaluate metrics for the success of the pilot program with input from <ln numlevel="1" lineno="421" slineno="3-104"/>the local mental health authority, the Utah Homeless Services Board created in <ln numlevel="1" lineno="422" slineno="3-105"/>Section <xref depth="3" refnumber="35A-16-204">35A-16-204</xref>, and the Judicial Council; and</subsection><subsection ssid="13-null-52" dnum="b-o" numlevel="1" lineno="423" slineno="3-106" level="2"><display>(b)</display>in collaboration with the local mental health authority, submit to the Health and <ln numlevel="1" lineno="424" slineno="3-107"/>Human Services Interim Committee a report on or before June 30 of each year, <ln numlevel="1" lineno="425" slineno="3-108"/>beginning in calendar year 2025, regarding the outcomes of the pilot program.</subsection></subsection></section></bsec><bsec buid="1" num="75A-9-108" type="amend" src="code" uid="C75A-9-S108_2026050620260506" sort="75A09 01080020260506" numlevel="1" lineno="426" slineno="4-1" sn="4"><section number="75A-9-108" numlevel="1" lineno="427" slineno="4-2" type="amend"><secline lineno="426">Section 4. Section <bold>75A-9-108</bold> is amended to read:</secline><catline lineno="427"><bold>75A-9-108<parens/>. Advance mental health care directive.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="428" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual may create an advance health care directive that addresses only <ln numlevel="1" lineno="429" slineno="4-4"/>mental health care for the individual.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="430" slineno="4-5" level="2"><display>(b)</display>The directive may include a health care instruction, a power of attorney for health <ln numlevel="1" lineno="431" slineno="4-6"/>care, or both.</subsection></subsection><subsection ssid="1-null-4" dnum="2-o" numlevel="1" lineno="432" slineno="4-7" level="1"><display>(2)</display>A health care instruction under this section may include the individual's:<subsection ssid="1-null-5" dnum="a-o" numlevel="1" lineno="433" slineno="4-8" level="2"><display>(a)</display>general philosophy and objectives regarding mental health care; or</subsection><subsection ssid="1-null-6" dnum="b-o" numlevel="1" lineno="434" slineno="4-9" level="2"><display>(b)</display>specific goals, preferences, and wishes regarding the provision, withholding, or <ln numlevel="1" lineno="435" slineno="4-10"/>withdrawal of a form of mental health care, including:<subsection ssid="1-null-7" dnum="i-o" numlevel="1" lineno="436" slineno="4-11" level="3"><display>(i)</display>preferences regarding professionals, programs, and facilities;</subsection><subsection ssid="1-null-8" dnum="ii-o" numlevel="1" lineno="437" slineno="4-12" level="3"><display>(ii)</display>admission to a mental-health facility, including duration of admission;</subsection><subsection ssid="1-null-9" dnum="iii-o" numlevel="1" lineno="438" slineno="4-13" level="3"><display>(iii)</display>preferences regarding medications;</subsection><subsection ssid="1-null-10" dnum="iv-o" numlevel="1" lineno="439" slineno="4-14" level="3"><display>(iv)</display>refusal to accept a specific type of mental health care, including a medication; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="440" slineno="4-15"/>and</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-11" dnum="v-o" numlevel="1" lineno="441" slineno="4-16" level="3"><display>(v)</display>preferences regarding crisis intervention<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="1-14" dnum="_-o:vi-i" numlevel="1" lineno="442" slineno="4-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1243" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">preferences regarding a person to serve as guardian for the individual if one is <ln numlevel="1" lineno="443" slineno="4-18"/>appointed, including an emergency guardian appointed in accordance with Section <xref depth="3" refnumber="75-5-310"><ln numlevel="1" lineno="444" slineno="4-19"/>75-5-310</xref>.</amend></subsection></subsection></subsection><subsection ssid="1-null-12" dnum="3-o" numlevel="1" lineno="445" slineno="4-20" level="1"><display>(3)</display>A power of attorney for health care under this section may appoint an agent to make <ln numlevel="1" lineno="446" slineno="4-21"/>decisions only for mental health care.</subsection></section></bsec><bsec buid="14" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="447" slineno="5-1" sn="5"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="447">Section 5.  <bold>Effective Date.</bold></secline><sectionText lineno="448"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-17-26 10:23 AM</tm></rev></foot></leg>
