Section <bold>17B-2a-829</bold> is enacted to read:</secline><catline lineno="34"><bold>17B-2a-829<parens/>. Information on autonomous vehicle transit.</bold></catline><subsection ssid="107-1" dnum="_-o:1-i" numlevel="1" lineno="35" slineno="1-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">A large public transit district shall complete a request for information in accordance <ln numlevel="1" lineno="36" slineno="1-4"/>with Section <xref depth="3" refnumber="63G-6a-409">63G-6a-409</xref> to gather information regarding a large scale implementation <ln numlevel="1" lineno="37" slineno="1-5"/>of an autonomous vehicle network for public transit.</amend></subsection><subsection ssid="107-3" dnum="_-o:2-i" numlevel="1" lineno="38" slineno="1-6" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="ahaskell" level="1" amendtag="end">A large public transit district shall coordinate the request for information described in <ln numlevel="1" lineno="39" slineno="1-7"/>Subsection <xref depth="4" refnumber="17B-2a-829(1)">(1)</xref> with relevant stakeholders.</amend></subsection><subsection ssid="107-9" dnum="_-o:3-i" numlevel="1" lineno="40" slineno="1-8" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="33" style="1" owner="ahaskell" level="1" amendtag="end">The request for information described in Subsection <xref depth="4" refnumber="17B-2a-829(1)">(1)</xref> shall include inquiries <ln numlevel="1" lineno="41" slineno="1-9"/>addressing:</amend><subsection ssid="107-12" dnum="_-o:a-i" numlevel="1" lineno="42" slineno="1-10" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="43" style="1" owner="ahaskell" level="1" amendtag="end">autonomous vehicle technology;</amend></subsection><subsection ssid="107-13" dnum="_-o:b-i" numlevel="1" lineno="43" slineno="1-11" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="42" style="1" owner="ahaskell" level="1" amendtag="end">timelines and feasibility for implementation of an autonomous vehicle public transit <ln numlevel="1" lineno="44" slineno="1-12"/>network;</amend></subsection><subsection ssid="107-14" dnum="_-o:c-i" numlevel="1" lineno="45" slineno="1-13" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="48" style="1" owner="ahaskell" level="1" amendtag="end">financial implications;</amend></subsection><subsection ssid="107-16" dnum="_-o:d-i" numlevel="1" lineno="46" slineno="1-14" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="62" style="1" owner="ahaskell" level="1" amendtag="end">benefits and drawbacks of different strategies; and</amend></subsection><subsection ssid="107-17" dnum="_-o:e-i" numlevel="1" lineno="47" slineno="1-15" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="67" style="1" owner="ahaskell" level="1" amendtag="end">other considerations relevant to autonomous vehicle public transit.</amend></subsection></subsection><subsection ssid="107-2" dnum="_-o:4-i" numlevel="1" lineno="48" slineno="1-16" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="89" groupid="68" style="1" owner="ahaskell" level="1" amendtag="end">On or before November 30, 2026, a large public transit district shall report to the <ln numlevel="1" lineno="49" slineno="1-17"/>Transportation Interim Committee regarding the information gathered under this section.</amend></subsection></section></bsec><bsec buid="115" num="41-26-102.1" type="amend" src="code" uid="C41-26-S102.1_2026050620260506" sort="41 26 01020120260506" numlevel="1" lineno="50" slineno="2-1" sn="2"><section number="41-26-102.1" numlevel="1" lineno="51" slineno="2-2" type="amend"><secline lineno="50">Section 2. Section <bold>41-26-102.1</bold> is amended to read:</secline><catline lineno="51"><bold>41-26-102.1<parens/>. Definitions. <eol numlevel="1" lineno="52" slineno="2-3"/>As used in this chapter:</bold></catline><subsection ssid="115-null-175" dnum="1-o" numlevel="1" lineno="53" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>"ADS-dedicated vehicle" means a vehicle<amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="ahaskell" level="1" amendtag="both">:</amend> <subsection ssid="115-null-176" dnum="_-o:a-i" numlevel="1" lineno="54" slineno="2-5" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>designed to be operated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="108" groupid="80" style="2" owner="ahaskell" level="1" deltag="both">exclusively </amend><amendoutend style="2"/>by a level four <amend anum="0" ea="amend" pairid="106" groupid="78" style="1" owner="ahaskell" level="1" amendtag="both">ADS </amend>or <amend anum="0" ea="amend" pairid="107" groupid="79" style="1" owner="ahaskell" level="1" amendtag="both">level </amend>five ADS for all <ln numlevel="1" lineno="55" slineno="2-6"/>trips within the given operational design domain limitations of the ADS, if any<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="16" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="14" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="115-null-177" dnum="_-o:b-i" numlevel="1" lineno="56" slineno="2-7" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="87" style="1" owner="ahaskell" level="1" amendtag="end">that conforms to all applicable U.S. federal motor vehicle safety, bumper, and theft <ln numlevel="1" lineno="57" slineno="2-8"/>prevention standards in effect on the date of the vehicle's manufacture.</amend></subsection></subsection><subsection ssid="115-null-178" dnum="_-o:2-i" numlevel="1" lineno="58" slineno="2-9" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="132" groupid="98" style="1" owner="ahaskell" level="1" amendtag="end">"ADS-equipped vehicle" means a vehicle with a level three, level four, or level five <ln numlevel="1" lineno="59" slineno="2-10"/>ADS that is designed for:</amend><subsection ssid="115-null-179" dnum="_-o:a-i" numlevel="1" lineno="60" slineno="2-11" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="116" style="1" owner="ahaskell" level="1" amendtag="end">complete trips in driverless operation under routine or normal operating conditions <ln numlevel="1" lineno="61" slineno="2-12"/>within the vehicle's operation design domain; or </amend></subsection><subsection ssid="115-null-180" dnum="_-o:b-i" numlevel="1" lineno="62" slineno="2-13" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="110" style="1" owner="ahaskell" level="1" amendtag="end">operation by an in-vehicle driver.</amend></subsection></subsection><subsection ssid="115-null-181" dnum="2-o:3-i" numlevel="1" lineno="63" slineno="2-14" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display><subsection ssid="115-null-182" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Automated driving system" or "ADS" means the hardware and software that <ln numlevel="1" lineno="64" slineno="2-15"/>are<amend anum="0" ea="amend" pairid="24" groupid="21" style="1" owner="ahaskell" level="1" amendtag="both">:</amend> <subsection ssid="115-null-183" dnum="_-o:i-i" numlevel="1" lineno="65" slineno="2-16" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>collectively capable of performing the entire dynamic driving task on a sustained <ln numlevel="1" lineno="66" slineno="2-17"/>basis, regardless of whether the ADS is limited to a specific operational design <ln numlevel="1" lineno="67" slineno="2-18"/>domain, if any<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="30" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="32" groupid="28" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="115-null-184" dnum="_-o:ii-i" numlevel="1" lineno="68" slineno="2-19" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="89" style="1" owner="ahaskell" level="1" amendtag="end">conforming to all applicable U.S. federal motor vehicle safety, bumper, and theft <ln numlevel="1" lineno="69" slineno="2-20"/>prevention standards in effect on the date of the vehicle's manufacture.</amend></subsection></subsection><subsection ssid="115-null-185" dnum="b-o" numlevel="1" lineno="70" slineno="2-21" level="2"><display>(b)</display>"Automated driving system" or "ADS" is used specifically to describe a level three, <ln numlevel="1" lineno="71" slineno="2-22"/>four, or five driving automation system.</subsection></subsection><subsection ssid="115-null-186" dnum="3-o:4-i" numlevel="1" lineno="72" slineno="2-23" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>"Commission" means the State Tax Commission as defined in Section <xref depth="3" refnumber="59-1-101" start="0">59-1-101</xref>.</subsection><subsection ssid="115-null-187" dnum="4-o:5-i" numlevel="1" lineno="73" slineno="2-24" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>"Conventional driver" means a human driver who is onboard the motor vehicle and <ln numlevel="1" lineno="74" slineno="2-25"/>manually performs some or all of the following actions in order to operate a vehicle:<subsection ssid="115-null-188" dnum="a-o" numlevel="1" lineno="75" slineno="2-26" level="2"><display>(a)</display>braking;</subsection><subsection ssid="115-null-189" dnum="b-o" numlevel="1" lineno="76" slineno="2-27" level="2"><display>(b)</display>accelerating;</subsection><subsection ssid="115-null-190" dnum="c-o" numlevel="1" lineno="77" slineno="2-28" level="2"><display>(c)</display>steering; and</subsection><subsection ssid="115-null-191" dnum="d-o" numlevel="1" lineno="78" slineno="2-29" level="2"><display>(d)</display>transmission gear selection input devices.</subsection></subsection><subsection ssid="115-null-192" dnum="5-o:6-i" numlevel="1" lineno="79" slineno="2-30" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1026" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display><subsection ssid="115-null-193" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Dispatch" means to place an ADS-equipped vehicle into service in driverless <ln numlevel="1" lineno="80" slineno="2-31"/>operation by engaging the ADS.</subsection><subsection ssid="115-null-194" dnum="b-o" numlevel="1" lineno="81" slineno="2-32" level="2"><display>(b)</display>"Dispatch" includes software-enabled dispatch of multiple ADS-equipped motor <ln numlevel="1" lineno="82" slineno="2-33"/>vehicles in driverless operation that may complete multiple trips involving pick-up <ln numlevel="1" lineno="83" slineno="2-34"/>and drop-off of passengers or goods throughout a day or other pre-defined periods of <ln numlevel="1" lineno="84" slineno="2-35"/>service, and which may involve multiple agents performing various tasks related to <ln numlevel="1" lineno="85" slineno="2-36"/>the dispatch function.</subsection></subsection><subsection ssid="115-null-195" dnum="6-o:7-i" numlevel="1" lineno="86" slineno="2-37" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>"Division" means the Motor Vehicle Division of the commission, created in <ln numlevel="1" lineno="87" slineno="2-38"/>Section <xref depth="3" refnumber="41-1a-106" start="0">41-1a-106</xref>.</subsection><subsection ssid="115-null-196" dnum="7-o:8-i" numlevel="1" lineno="88" slineno="2-39" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1030" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>"Driverless operation" means the operation of an ADS-equipped vehicle in which:<subsection ssid="115-null-197" dnum="a-o" numlevel="1" lineno="89" slineno="2-40" level="2"><display>(a)</display>no on-board user is present; or</subsection><subsection ssid="115-null-198" dnum="b-o" numlevel="1" lineno="90" slineno="2-41" level="2"><display>(b)</display>no on-board user is a human driver with a valid driver license or fallback-ready user.</subsection></subsection><subsection ssid="115-null-199" dnum="8-o:9-i" numlevel="1" lineno="91" slineno="2-42" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>"Driverless operation dispatcher" means a user who dispatches an ADS-equipped <ln numlevel="1" lineno="92" slineno="2-43"/>vehicle in driverless operation.</subsection><subsection ssid="115-null-200" dnum="9-o:10-i" numlevel="1" lineno="93" slineno="2-44" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1034" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="both" and</amend></subsection><subsection ssid="88-71-59" dnum="_-o:d-i" numlevel="1" lineno="231" slineno="5-16" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1105" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="173" groupid="124" style="1" owner="ahaskell" level="1" amendtag="end">consider research and testing projects that support advanced air mobility, connected <ln numlevel="1" lineno="232" slineno="5-17"/>vehicle technology, and vehicle-to-vehicle communication to coordinate multiple <ln numlevel="1" lineno="233" slineno="5-18"/>vehicles at once.</amend></subsection></subsection><subsection ssid="88-71-60" dnum="_-o:4-i" numlevel="1" lineno="234" slineno="5-19" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="88-71-61" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="46" style="1" owner="ahaskell" level="1" amendtag="end">An entity that submits a proposal for a grant to the office shall include details in <ln numlevel="1" lineno="235" slineno="5-20"/>the proposal regarding:</amend><subsection ssid="88-71-62" dnum="_-o:i-i" numlevel="1" lineno="236" slineno="5-21" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1108" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="50" style="1" owner="ahaskell" level="1" amendtag="end">the entity's plan to use the grant to fulfill the purposes described in Subsection <xref depth="4" refnumber="63N-3-1801(2)">(2)</xref>; <ln numlevel="1" lineno="237" slineno="5-22"/>and</amend></subsection><subsection ssid="88-71-63" dnum="_-o:ii-i" numlevel="1" lineno="238" slineno="5-23" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="58" style="1" owner="ahaskell" level="1" amendtag="end">any existing or planned partnerships between the entity and another person to <ln numlevel="1" lineno="239" slineno="5-24"/>implement the proposal.</amend></subsection></subsection><subsection ssid="88-71-64" dnum="_-o:b-i" numlevel="1" lineno="240" slineno="5-25" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="62" style="1" owner="ahaskell" level="1" amendtag="end">In evaluating a proposal for a grant, the office shall consider:</amend><subsection ssid="88-71-65" dnum="_-o:i-i" numlevel="1" lineno="241" slineno="5-26" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="66" style="1" owner="ahaskell" level="1" amendtag="end">the likelihood the proposal will accomplish the purposes described in Subsection <xref depth="4" refnumber="63N-3-1801(2)"><ln numlevel="1" lineno="242" slineno="5-27"/>(2)</xref>;</amend></subsection><subsection ssid="88-71-66" dnum="_-o:ii-i" numlevel="1" lineno="243" slineno="5-28" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1112" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="70" style="1" owner="ahaskell" level="1" amendtag="end">the extent to which any additional funding sources or existing or planned <ln numlevel="1" lineno="244" slineno="5-29"/>partnerships will benefit the proposal; and</amend></subsection><subsection ssid="88-71-67" dnum="_-o:iii-i" numlevel="1" lineno="245" slineno="5-30" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1113" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="74" style="1" owner="ahaskell" level="1" amendtag="end">the viability and sustainability of the proposal.</amend></subsection></subsection><subsection ssid="88-71-68" dnum="_-o:c-i" numlevel="1" lineno="246" slineno="5-31" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1114" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="78" style="1" owner="ahaskell" level="1" amendtag="end">In determining a grant award, the office may consult with the GOEO board.</amend></subsection></subsection><subsection ssid="88-71-69" dnum="_-o:5-i" numlevel="1" lineno="247" slineno="5-32" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1115" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="89" style="1" owner="ahaskell" level="1" amendtag="end">Before receiving the grant, a grant recipient shall enter into a written agreement with the <ln numlevel="1" lineno="248" slineno="5-33"/>office that specifies:</amend><subsection ssid="88-71-70" dnum="_-o:a-i" numlevel="1" lineno="249" slineno="5-34" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1116" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="93" style="1" owner="ahaskell" level="1" amendtag="end">the grant amount;</amend></subsection><subsection ssid="88-71-71" dnum="_-o:b-i" numlevel="1" lineno="250" slineno="5-35" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1117" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="97" style="1" owner="ahaskell" level="1" amendtag="end">the time period and structure for distribution of the grant, including any terms and <ln numlevel="1" lineno="251" slineno="5-36"/>conditions the recipient is required to meet to receive a distribution; and</amend></subsection><subsection ssid="88-71-72" dnum="_-o:c-i" numlevel="1" lineno="252" slineno="5-37" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1118" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="144" groupid="101" style="1" owner="ahaskell" level="1" amendtag="end">the expenses for which the recipient may use the grant, including:</amend><subsection ssid="88-71-73" dnum="_-o:i-i" numlevel="1" lineno="253" slineno="5-38" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1119" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="165" groupid="118" style="1" owner="ahaskell" level="1" amendtag="end">acquisition of equipment;</amend></subsection><subsection ssid="88-71-74" dnum="_-o:ii-i" numlevel="1" lineno="254" slineno="5-39" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1120" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="105" style="1" owner="ahaskell" level="1" amendtag="end">production, design, construction, or engineering costs;</amend></subsection><subsection ssid="88-71-75" dnum="_-o:iii-i" numlevel="1" lineno="255" slineno="5-40" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="155" groupid="110" style="1" owner="ahaskell" level="1" amendtag="end">specialized employee training;</amend></subsection><subsection ssid="88-71-76" dnum="_-o:iv-i" numlevel="1" lineno="256" slineno="5-41" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="159" groupid="113" style="1" owner="ahaskell" level="1" amendtag="end">technology upgrades;</amend></subsection><subsection ssid="88-71-77" dnum="_-o:v-i" numlevel="1" lineno="257" slineno="5-42" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1123" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="185" groupid="133" style="1" owner="ahaskell" level="1" amendtag="end">utilities; or</amend></subsection><subsection ssid="88-71-78" dnum="_-o:vi-i" numlevel="1" lineno="258" slineno="5-43" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="164" groupid="117" style="1" owner="ahaskell" level="1" amendtag="end">provisions of a grant to another individual or entity for the expenses described in <ln numlevel="1" lineno="259" slineno="5-44"/>Subsections <xref depth="4" refnumber="63N-3-1801(5)(c)(i)">(5)(c)(i)</xref> through <xref depth="4" refnumber="63N-3-1801(v)">(v)</xref> or to otherwise fulfill the recipient's proposal.</amend></subsection></subsection></subsection><subsection ssid="88-71-79" dnum="_-o:6-i" numlevel="1" lineno="260" slineno="5-45" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><subsection ssid="88-71-80" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="27" style="1" owner="ahaskell" level="1" amendtag="end">If the office awards a grant to an entity for the purposes described in Subsection <xref depth="4" refnumber="63N-3-1801(2)"><ln numlevel="1" lineno="261" slineno="5-46"/>(2)</xref>, the office shall consider projects that:</amend><subsection ssid="88-71-81" dnum="_-o:i-i" numlevel="1" lineno="262" slineno="5-47" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="28" style="1" owner="ahaskell" level="1" amendtag="end">include fast-charging stations, capable of delivering at least 350 kilowatts of <ln numlevel="1" lineno="263" slineno="5-48"/>direct-current charging per charging port;</amend></subsection><subsection ssid="88-71-82" dnum="_-o:ii-i" numlevel="1" lineno="264" slineno="5-49" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="30" style="1" owner="ahaskell" level="1" amendtag="end">are in a geographic area with fewer than 3 electric vehicle chargers within 100 <ln numlevel="1" lineno="265" slineno="5-50"/>miles;</amend></subsection><subsection ssid="88-71-83" dnum="_-o:iii-i" numlevel="1" lineno="266" slineno="5-51" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="190" groupid="137" style="1" owner="ahaskell" level="1" amendtag="end">are in a geographic area where 250 kilowatt chargers are in limited quantities; Information for autonomous vehicles.</bold></catline><subsection ssid="22-47" dnum="_-o:1-i" numlevel="1" lineno="285" slineno="6-3" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="212" groupid="158" style="1" owner="ahaskell" level="1" amendtag="end">The department shall complete a request for information in accordance with Section <xref depth="3" refnumber="63G-6a-409"><ln numlevel="1" lineno="286" slineno="6-4"/>63G-6a-409</xref> to gather information regarding:</amend><subsection ssid="22-62" dnum="_-o:a-i" numlevel="1" lineno="287" slineno="6-5" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="280" groupid="211" style="1" owner="ahaskell" level="1" amendtag="end">large scale autonomous vehicle operation in the state; and</amend></subsection><subsection ssid="22-63" dnum="_-o:b-i" numlevel="1" lineno="288" slineno="6-6" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="285" groupid="215" style="1" owner="ahaskell" level="1" amendtag="end">safety considerations with the operation of autonomous vehicles.</amend></subsection></subsection><subsection ssid="22-48" dnum="_-o:2-i" numlevel="1" lineno="289" slineno="6-7" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="217" groupid="162" style="1" owner="ahaskell" level="1" amendtag="end">The department shall coordinate the request for information with stakeholders the <ln numlevel="1" lineno="290" slineno="6-8"/>department determines are relevant.</amend></subsection><subsection ssid="22-52" dnum="_-o:3-i" numlevel="1" lineno="291" slineno="6-9" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="233" groupid="175" style="1" owner="ahaskell" level="1" amendtag="end">The request for information shall address:</amend><subsection ssid="22-66" dnum="_-o:a-i" numlevel="1" lineno="292" slineno="6-10" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="303" groupid="228" style="1" owner="ahaskell" level="1" amendtag="end">ways the state can encourage and facilitate the private sector to establish more <ln numlevel="1" lineno="293" slineno="6-11"/>autonomous vehicle services in the state in advance of the 2034 Olympic and <ln numlevel="1" lineno="294" slineno="6-12"/>Paralympic Winter Games;</amend></subsection><subsection ssid="22-67" dnum="_-o:b-i" numlevel="1" lineno="295" slineno="6-13" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="309" groupid="233" style="1" owner="ahaskell" level="1" amendtag="end">the potential of autonomous vehicle technology to positively impact the overall <ln numlevel="1" lineno="296" slineno="6-14"/>safety of traveling on state highways; and</amend></subsection><subsection ssid="22-68" dnum="_-o:c-i" numlevel="1" lineno="297" slineno="6-15" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="314" groupid="237" style="1" owner="ahaskell" level="1" amendtag="end">identification of barriers that are impeding or may potentially impede the <ln numlevel="1" lineno="298" slineno="6-16"/>establishment of autonomous vehicle services and business activities such as issues <ln numlevel="1" lineno="299" slineno="6-17"/>related to insurance and liability, vehicle registration and identification, and public <ln numlevel="1" lineno="300" slineno="6-18"/>safety.</amend></subsection></subsection><subsection ssid="22-60" dnum="_-o:4-i" numlevel="1" lineno="301" slineno="6-19" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="273" groupid="206" style="1" owner="ahaskell" level="1" amendtag="end">On or before November 30, 2027, the department shall report to the Transportation <ln numlevel="1" lineno="302" slineno="6-20"/>Interim Committee regarding the information gathered under this section.</amend></subsection></section></bsec><bsec buid="116" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="303" slineno="7-1" sn="7"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="303">Section 7.  <bold>Effective Date.</bold></secline><sectionText lineno="304"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-25-26 4:12 PM</tm></rev></foot></leg>
